بَابُ حُكْمِ الْأُسَرَاءُThe Ruling on Captives

وَقَوْلِ اللهِ عَزَّ وَجَلَّ: ﴿فَآَقْتُلُواْ٢ الْمُشْرِكِينَ حَيْثُ وَجَدتُّمُوهُمْ﴾

٢ قوله: اقتلوا المشركين إلخ: وقال في (عمدة القاري): ولم يختلف أهل التفسير ونقله الآثارأن سورة براءة بعدسورة محمد ، فوجب أن يكون المذكور فيها ناسخا للفداء المذكور في غيرها.

English

And the saying of Allah, the Mighty and Majestic: "Then kill 2 the polytheists wherever you find them" (At-Tawbah: 5).

2 His saying "kill the polytheists", to the end: the author of Umdat al-Qari said: the people of tafsir and the transmitters of reports have not differed that Surat Bara'ah is later than Surat Muhammad, so what is mentioned in it must be an abrogation of the ransom mentioned elsewhere.

عَنْ أَبِيُّ هُرَيْرَةَ رضي الله عنه عَنِ النَّبِيِّ صلي الله عليه واله وسلم قَالَ:(عَجِبَ اللهُ مِنْ قَوْمٍ يَدْخُلُونَ الْجَنَّةَفِي السَّلَاسِلِ). وَفِي رِوَايَةٍ:(يُقَادُونَ إِلَى الْجَنَّةِ فِي السَّلَاسِلِ). رَوَاهُ الْبُخَارِيُّ.

English

Abu Hurayrah (may Allah be pleased with him) narrated: The Prophet (ﷺ) said: “Allah is amazed at a people who enter Paradise in chains.” In another narration: “They are led to Paradise in chains.” [Narrated by Bukhari]

وَعَنْ سَلَمَةَ بْنِ الْأَكْوَعِ رضي الله عنه قَالَ: أَتَى النَّبِيَّ ﷺ عَيْنٌ مِنَ الْمُشْرِكِينَ وَهُوَ فِيسَفَرٍ، فَجَلَسَ عِنْدَ أَصْحَابِهِ يَتَحَدَّثُ، ثُمَّ انْفَتَلَ فَقَالَ النَّبِيُّ صلي الله عليه واله وسلم : (اطْلُبُوهُ وَاقْتُلُوه)٣فَقَتَلْتُهُ فَنَقَّلَنِيْ ٤ سَلَبَهُ، مُتَّفَقُّ عَلَيْهِ. قُلْنَا: هَذَا التَّنْفِيْلُ وَاقِعَةُ حَالٍ لَيْسَ شَرْعًا عَامًالَازِمًا عِنْدَنَا.

English

Salamah ibn al-Akwa‘ (may Allah be pleased with him) narrated: A spy from the polytheists came to the Prophet (ﷺ) while he was on a journey. He sat with his Companions, conversing, then slipped away. The Prophet (ﷺ) said: “3 Seek him and kill him.” I killed him, and he granted me his spoils. [Narrated by Bukhari and Muslim]

We say: This granting of spoils was a specific incident, not a general, binding ruling in our view.

3 The statement: “Seek him and kill him, etc.”: This indicates the permissibility of killing a hostile spy, and there is consensus on this. As for a spy under a covenant or dhimmi, Malik and Al-Awza‘i said: He breaks the covenant, and the leader may enslave or kill him. The majority say his covenant is not broken unless stipulated otherwise. For a Muslim spy, Abu Hanifah, Shafi‘i, and some Malikis say he is punished as the leader sees fit, short of death. Malik said: The leader exercises discretion. Iyadh said: Prominent Malikis say he is killed. They differed on sparing him if he repents; Al-Majishun said: If known for it, he is killed; otherwise, he is punished. As for a hostile spy from the land of war entering the land of Islam without safe-conduct, scholars differed. Malik said: The leader has discretion, and his ruling is like that of the people of war. Al-Awza‘i and Shafi‘i said: If he claims to be a messenger, it is accepted. Abu Hanifah, Abu Yusuf, and Ahmad said: His claim is not accepted, and he is spoils for the Muslims. Muhammad said: He belongs to whoever finds him. As stated in (‘Umdat al-Qari). 4 The statement: “granted me his spoils”: Al-Nawawi said: This Hadith clearly supports Shafi‘i and his followers’ view that the killer is entitled to the spoils, and it is not subject to one-fifth tax. In (Al-‘Alamgiriyyah): The killer does not automatically deserve the spoils unless the leader grants it before the killing, saying, “Whoever kills an enemy gets his spoils.” This is our scholars’ view. The Hadiths cited by Shaykh Ibn al-Humam clearly support our position; refer to (Fath al-Qadir) and (Al-Binayah) for details.

٣ قوله: اطلبوه واقتلوه إلخ: فيه قتل الجاسوس الحربي، وعليه الإجماع، وأما الجاسوس المعاهد أو الذمي، فقالمالك والأوزاعي: يصير ناقضا للعهد، فإن رأى الإمام استرقاقه أرقه ويجوز قتله. وعند الجمهور لا ينقض عهدهبذلك إلا أن يشترط عليه انتقاضه به، وأما الجاسوس المسلم عند أبي حنيفة والشافعي وبعض المالكية يعزر بما يراهالإمام إلا القتل. وقال مالك:يجتهد فيه الإمام. وقال عياض: قال كبار أصحابه: يقتل. واختلفوا في تركه بالتوبة،فقال الماجشون: إن عرف بذلك قُتل وإلا عُزر، وأما الحربي من أهل دار الحرب إذا دخل دار الإسلام بغير أمان مايكون أمره هل يجوز قتله أم لا؟ فاختلفوا فيه، فقال مالك: يتخير فيه الإمام، وحكمه حكم أهل الحرب. وقالالأوزاعي والشافعي: إذا ادعى أنه رسول قُبل منه. وقال أبو حنيفة وأبو يوسف وأحمد: لا يقبل ذاك منه، وهو فيءللمسلمين. وقال محمد: هو لمن وجده. قاله في (عمدة القاري).

٤ قوله: فتفلني سلبه: وقال النووي: وفي هذا الحديث دلالة ظاهرة لمذهب الشافعي وموافقيه أن القاتل يستحقالسلب وأنه لا يخمس، انتهى. وقال في (العالمكيرية): ولا يستحق القاتل سلب المقتول بنفس القتل ما لم ينفلالإمام قبل القتل، فيقول: (من قتل قتيلا فله سلبه). وهذا مذهب علمائنا رحمهم الله تعالى، وفي الأحاديث التي ذكرهاالشيخ ابن الهمام دلالة ظاهرة لمذهبنا، إن شئت الاطلاع إليها فارجع إلى (فتح القدير) و(البناية).

وَعَنْهُ رضي الله عنه قَالَ: غَزَوْنَا مَعَ رَسُولِ اللهِ صلي الله عليه واله وسلم هَوَازِنَ، فَبَيْنَا نَحْنُ نَتَضَحَّى مَعَرَسُولِ اللهِ ﷺ إِذْ جَاءَ رَجُلٌ عَلَى جَمَلٍ أَحْمَرَ ، فَأَنَاخَهُ وَجَعَلَ يَنْظُرُ وَفِينَا ضَعْفَةٌ وَرِقَةٌ فِي الظَّهْرِالظَّهْرِ وَبَعْضُنَا مُشَاءً إِذْ خَرَجَ يَشْتَدُّ فَأَتى جَمَلَهُ فَأَثَارَهُ فَاشْتَدَّ بِهِ الْجَمَلُ فَخَرَجْتُ أَشْتَدُّحَتَّى أَخَذْتُ بِخِطَامِ الْجَمَلِ، فَأَنخْتُهُ ثُمَّ اخْتَرَطْتُ سَيْفِي فَضَرَبْتُ رَأْسَ الرَّجُلِ، ثُمَّ جِئْتُبِالْجَمَلِ أَقُودُهُ، عَلَيْهِ رَحْلُهُ وَسِلَاحُهُ فَاسْتَقْبَلَنِي رَسُولُ اللهِ ﷺ وَالنَّاسُ مَعَهُ، فَقَالَ:(مَنْقَتَلَ الرَّجُلَ؟) قَالُوا: ابْنُ الْأَكْوَعِ، قَالَ: (لَهُ سَلَبُهُ أَجْمَعُ). مُتَّفَقُّ عَلَيْهِ.

English

Salamah ibn al-Akwa‘ (may Allah be pleased with him) narrated: We went with the Messenger of Allah (ﷺ) against Hawazin. While we were eating with the Messenger of Allah (ﷺ), a man came on a red camel, dismounted, and looked around. Among us were weak and soft people at the rear, some on foot. He hurriedly went to his camel, spurred it, and it ran off. I chased him, caught the camel’s reins, made it kneel, drew my sword, and struck the man’s head. I brought the camel, with its saddle and weapons, leading it. The Messenger of Allah (ﷺ) and the people met me, and he said: “Who killed the man?” They said: “Ibn al-Akwa‘.” He said: “All his spoils are for him.” [Narrated by Bukhari and Muslim]

وَعَنْ أَبِيْ سَعِيْدٍ الْخُدْرِيِّ رضي الله عنه قَالَ: لَمَّا نَزَلَتْ بَنُو قُرَيْظَةَ عَلَى حُكْمٍ سَعْدِ بْنِمُعَادٍ، بَعَثَ رَسُولُ اللهِ ﷺ فَجَاءَ عَلَى حِمَارِ، فَلَمَّا دَنَا قَالَ رَسُولُ اللَّهِ ﷺ: (قُومُوا١ إِلَى سَيِّدِكُمْ) فَجَاءَ فَجَلَسَ، فَقَالَ رَسُولُ اللهِ ﷺ: (إِنَّ هَؤُلَاءِ٢ نَزَلُوا عَلَى حُكْمِكَ قَالَ:فَإِنيْ ٣ أَحْكُمُ أَنْ تُقْتَلَ الْمُقَاتِلَةُ وَأَنْ تُسْبَى الدُّرِّيَّةُ، قَالَ: (لَقَدْ حَكَمْتَ فِيهِمْ بِحُكْمِالْمَلِكِ). وَفِي رِوَايَةٍ: (بِحُكْمِ اللهِ). مُتَّفَقُّ عَلَيْهِ.

English

Abu Sa‘id al-Khudri (may Allah be pleased with him) narrated: When Banu Qurayzah surrendered to the judgment of Sa‘d ibn Mu‘adh, the Messenger of Allah (ﷺ) sent for him. He came on a donkey, and when he approached, the Messenger of Allah (ﷺ) said: “1 Rise to your leader.” He sat, and the Messenger of Allah (ﷺ) said: “2 These people have surrendered to your judgment.” He said: “3 I rule that their fighters be killed and their women and children be taken captive.” He said: “You have judged them with the judgment of the King.” In another narration: “With the judgment of Allah.” [Narrated by Bukhari and Muslim]

1 The statement: “Rise to your leader, etc.”: In (Radd al-Muhtar): It is permissible, even recommended, to stand in respect for an arriving person worthy of honor. In (Al-Qunya): Standing in the mosque for someone entering out of respect, or a Qur’an reciter standing for someone worthy, is not disliked. In (Mushkil al-Athar): Standing for another is not inherently disliked; what is disliked is loving to have others stand for oneself. If one stands for someone not typically stood for, it is not disliked. Ibn Wahban said: In our time, standing is recommended to avoid resentment, hatred, or enmity, especially in places where standing is customary. Threats regarding standing apply to those who love having others stand before them, as Turks and non-Arabs do. This is supported by (Al-‘Inayah) and others, citing Shaykh Abu al-Qasim, who stood for the wealthy to honor them but not for the poor or students, saying the wealthy expect honor, and neglecting it harms them, while the poor and students seek only greetings and knowledge. See Risalat ash-Sharnilali for details. 2 The statement: “These people have surrendered to your judgment, etc.”: This indicates the permissibility of arbitration in Muslim affairs, even major ones. Scholars unanimously agree on this, except the Khawarij, who objected to Ali’s arbitration, and he refuted them. As stated by Al-Nawawi in (‘Umdat al-Qari) and (Al-Hidayah).

3 The statement: “I rule that their fighters be killed, etc.”: In (Al-Hidayah): The leader has discretion with captives: he may kill them if they do not accept Islam, as the Prophet (ﷺ) killed some captives like Uqbah ibn Abi Mu‘ayt to eliminate their corruption entirely. He may enslave them to repel their harm while benefiting Muslims, so none of the fighters may kill a captive independently, as the decision belongs to the leader. He may also free them as dhimmis for Muslims, as Umar did with the people of the Sawad, except for Arab polytheists and apostates, who are offered only Islam or the sword. If captives convert after capture, they are not killed, but enslavement is permissible, as Islam does not negate slavery as a consequence of prior disbelief after the cause of ownership is established. If they convert before capture, they are not enslaved and remain free, as conversion precedes the cause of ownership. As stated in (Al-Mirqat).

١ قوله: قوموا إلى سيدكم إلخ: قال في (رد المحتار): يجوز، بل يندب القيام تعظيما للقادم أي إن كان ممن يستحقالتعظيم. قال في (القنية): قيام الجالس في المسجد لمن دخل عليه تعظيما وقيام قارئ القرآن لمن يجيء تعظيما لا يكرهإذا كان ممن يستحق التعظيم. وفي(مشكل الآثار): القيام لغيره ليس بمكروه لعينه، إنما المكروه محبة القيام لمن يقامله، وإن قام لمن لا يقام له لا يكره. قال ابن وهبان: أقول: وفي عصرنا ينبغي أن يستحب ذلك، أي القيام لما يورثتركه من الحقد والبغضاء والعداوة، لا سيما إذا كان في مكان اعتيد فيه القيام، وما ورد من التوعد عليه في حق منيحب القيام بين يَدَيْه كما يفعله الترك والأعاجم اهـ. قلت: يؤيده ما في (العناية) وغيرها عن الشيخ الحكيم أبي القاسمكان إذا دخل عليه غنيٍّ يقوم له ويعظمه، ولا يقوم للفقراء وطلبة العلم، فقيل له في ذلك، فقال: الغني يتوقع منيالتعظيم، فلو تركته لتضرر، والفقراء والطلبة إنما يطمعون جواب السلام والكلام معهم في العلم، وتمام ذلك فيرسالة الشرنيلالي.

٢ قوله: هؤلاء نزلوا على حكمك إلخ: فيه جواز التحكيم في أمور المسلمين، وفي مهماتهم العظام. وقد أجمع العلماءعليه، ولم يخالف فيه إلا الخوارج، فإنهم أنكروا على عليٍّ التحكيم وأقام الحجة عليهم، قاله النووي. كذا في(عمدة القاري) و(الهداية).

٣ قوله: فإني أحكم أن تقتل المقاتلة إلخ: في (الهداية). وهو في الأسارى بالخيار إن شاء قتلهم قال ابن الهمام: يعنيإذا لم يسلموا؛ لأنه صلي الله عليه واله وسلم قد قتل عن الأسرى إذ لا شك في قتله عقبة بن أبي معيط وغيره؛ لأن في قتلهم حسم مادةالفساد الكائن منهم بالكلية، وإن شاء استرقهم؛ لأن فيه دفع شرهم مع وفور المصلحة لأهل الإسلام، ولهذا، قلنا:ليس لاحد من الغزاة أن يقتل أسير بنفسه؛ لأن الرأي فيه إلى الإمام، وإن شاء تركهم أحرارًا ذمة للمسلمين لما بينا أنعمر فعل ذلك في أهل السواد لا مشركي العرب، والمرتدين لا يقبل منهم جزية، ولا يجوزاسترقاقهم،بل إما الإسلام وإما السيف، وإن أسلم الأسارى بعد الأسر لا نقتلهم، ولكن يجوزاسترقاقهم؛ لأن الإسلام لاينافي الرق جزاء على الكفر الأصلي، وقد وجد بعد انعقاد سبب الملك، وهو استيلاء على الحربي غير المشرك منالعرب، بخلاف ما لو أسلموا قبل الأخذ بأنهم لا يسترقون، ويكونون أحرارا؛ لأنه إسلام قبل انعقاد سبب الملكفيهم. كذا في (المرقاة).

وَعَنْ عَطِيَّةَ الْقُرَظِيِّ رضي الله عنه قَالَ: كُنْتُ فِي سَبِيٍ بَنِي قُرَيْظَةَ، عُرِضْنَا عَلَىالنَّبِيِّ صلي الله عليه واله وسلم فَكَانُوا يَنْظُرُونَ فَمَنْ أَنْبَتَ٤ الشَّعْرَ قُتِلَ، وَمَنْ لَمْ يُنْبِتْ لَمْ يُقْتَلْ، فَكَشَفُواعَانَتِي فَوَجَدُوهَا لَمْ تَنْبُتْ، فَجَعَلُونِي فِي السَّبْيِ. رَوَاهُ أَبُوْ دَاوُدَ وَابْنُ مَاجَه وَالدَّارِميُّ.

English

Atiyyah al-Qurazi (may Allah be pleased with him) narrated: I was among the captives of Banu Qurayzah. We were presented to the Prophet (ﷺ), and they checked: whoever had grown pubic hair was killed, and whoever had not was spared. They examined me, found no hair, and placed me among the captives. [Narrated by Abu Dawud, Ibn Majah, and Ad-Darimi]

4 The statement: “Whoever had grown pubic hair was killed”: At-Turbashti said: Pubic hair was considered due to necessity, as asking about wet dreams or age would not yield truthful answers, given the risk of death. Otherwise, pubic hair is not a criterion, contrary to Shafi‘i and a narration from Abu Yusuf. As cited in (Al-Mirqat) and (Radd al-Muhtar).

English

Ibn Mas‘ud (may Allah be pleased with him) narrated: When the Messenger of Allah (ﷺ) intended to kill Uqbah ibn Abi Mu‘ayt, he said: “Who will look after my children?” He replied: “The Fire.” [Narrated by Abu Dawud]

وَعَنِ ابْنِ عُمَرَرضي الله عنهما قَالَ: بَعَثَ النَّبِيُّ ﷺ خَالِدَ بْنَ الْوَلِيدِ إِلَى بَنِي جَدِيمَةَقَدَعَاهُمْ إِلَى الْإِسْلَامِ قَلَمْ يُحْسِنُوا أَنْ يَقُولُوا: أَسْلَمْنَا، فَجَعَلُوا يَقُولُونَ: صَبَأْنَا صَبَأْنَا،فَجَعَلَ خَالِدٌ يَأْسِرُ وَيَقْتُلُ، وَدَفَعَ إِلَى كُلِّ رَجُلٍ مِنَّا أَسِيرَهُ، حَقَّى إِذَا كَانَ يَوْمُ أَمَرَ خَالِدٌ أَنْيَقْتُلَ كُلُّ رَجُلٍ مِنَّا أَسِيرَهُ، فَقُلْتُ: وَاللهِ لَا أَقْتُلُ أَسِيرِي، وَلَا يَقْتُلُ رَجُلُّ مِنْ أَصْحَابِيأَسِيرَهُ، حَتَّى قَدِمْنَا عَلَى النَّبِيِّ ﷺ فَذَكَرْنَاهُ فَرَفَعَ يَدَيْهِ، فَقَالَ: (اللَّهُمَّ١ إِنِّي أَبْرَأُ إِلَيْكَ مِمَّاصَنَعَ خَالِدٌ) مَرَّتَيْنٍ. رَوَاهُ الْبُخَارِيُّ.

English

Ibn Umar (may Allah be pleased with them both) narrated: The Prophet (ﷺ) sent Khalid ibn al-Walid to Banu Jadhimah, inviting them to Islam. They did not know how to say, “We have submitted,” and instead said, “We have left, we have left.” Khalid began capturing and killing them, assigning each of us a captive. When the day came, Khalid ordered each man to kill his captive. I said: “By Allah, I will not kill my captive, nor will any of my companions kill theirs.” We came to the Prophet (ﷺ) and mentioned it. He raised his hands and said: “1 O Allah, I disassociate myself from what Khalid has done,” twice. [Narrated by Bukhari]

1 The statement: “O Allah, I disassociate myself from what Khalid has done”: Ibn Battal said: There is no disagreement that a judge’s unjust or erroneous ruling is rejected. If it results from ijtihad or interpretation, as Khalid did, the sin is lifted, but liability remains according to most scholars. If it involves killing or injury, compensation is from the treasury, per Thawri, Abu Hanifah, Ahmad, and Ishaq. Some said it is on the judge’s clan. Al-Awza‘i, Abu Yusuf, Muhammad, and Shafi‘i said it is on the judge or his clan. Al-Majishun said: Neither the judge, his clan, nor the treasury are liable. As stated in (‘Umdat al-Qari).

١ قوله: اللهم إني أبرأ إليك مما صنع خالد: قال ابن بطال: لا خلاف أن القاضي إذا قضى بجور، أو بخلاف قول أهلالعلم فهو مردود، فإن كان على وجه الاجتهاد والتأويل كما صنع خالد ، فإن الإثم ساقط والضمان لازم عند عامةأهل العلم، إلا أنهم اختلفوا في ضمان ذلك، فإن كان في قتل أو جراح، ففي بيت المال. وهذا قول الثوري وأبي حنيفةوأحمد وإسحاق على، وقالت طائفة: على عاقلة الإمام أو الحاكم. وهذا قول الأوزاعي وأبي يوسف ومحمد والشافعي وقال الماجشون: ليس على الحاكم شيء من الدية في ماله ولا على وعاقلته ولا في بيت المال، كذا في (عمدة القاري).

وَعَنْ أَبِيْ هُرَيْرَةَ رضي الله عنه قَالَ: بَعَثَ رَسُولُ اللهِ صلي الله عليه واله وسلم خَيْلًا قِبَلَ نَجْدٍ، فَجَاءَتْبِرَجُلٍ مِنْ بَنِي حَنِيفَةَ يُقَالُ لَهُ: ثُمَامَةُ بْنُ أُثَالٍ سَيِّدُ أَهْلِ الْيَمَامَةِ، فَرَبَطُوهُ٢ بِسَارِيَةٍ مِنْسَوَارِي الْمَسْجِدِ، فَخَرَجَ إِلَيْهِ رَسُولُ اللهِ فَقَالَ: (مَاذَا عِنْدَكَ يَا ثُمَامَةُ؟) فَقَالَ: عِنْدِي يَامُحَمَّدُ خَيْرُ، إِنْ تَقْتُلْ تَقْتُلْ ذَا دَمِ، وَإِنْ تُنْعِمْ تُنْعِمْ عَلَى شَاكِرٍ، وَإِنْ كُنْتَ تُرِيدُ الْمَالَ فَسَلْتُعْطَ مِنْهُ مَا شِئْتَ. فَتَرَّكَهُ رَسُولُ اللهِ صلي الله عليه واله وسلم حَتّى كَانَ بَعْدَ الْغَدِ، فَقَالَ: (مَا عِنْدَكَ يَاثُمَامَةُ؟) قَالَ: مَا قُلْتُ لَكَ، إِنْ تُنْعِمْ تُنْعِمْ عَلَى شَاكِرٍ، وَإِنْ تَقْتُلْ تَقْتُلْ ذَا دَمٍ، وَإِنْ كُنْتَتُرِيدُ الْمَالَ فَسَلْ تُعْظَ مِنْهُ مَا شِئْتَ. فَتَرَّكَهُ رَسُولُ اللهِ صلي الله عليه واله وسلم حَتَّى كَانَ مِنَ الْغَدِ فَقَالَ:(مَاذَا عِنْدَكَ يَا ثُمَامَةُ؟) فَقَالَ: عِنْدِي مَا قُلْتُ لَكَ، إِنْ تُنْعِمْ تُنْعِمْ عَلَى شَاكِرٍ، وَإِنْ تَقْتُلْتَقْتُلْ ذَا دَمٍ، وَإِنْ كُنْتَ تُرِيدُ الْمَالَ فَسَلْ تُعْطَ مِنْهُ مَا شِئْتَ، فَقَالَ رَسُوْلُ اللهِ صلي الله عليه واله وسلم (أَطْلِقُوا٣ ثُمَامَة)، فَانْطَلَقَ٤ إِلَى نَخْلٍ قَرِيبٍ مِنَ الْمَسْجِدِ، فَاغْتَسَلَ ثُمَّ دَخَلَ الْمَسْجِدَ،فَقَالَ: أَشْهَدُ أَنْ لَا إِلَه إِلَّا اللَّهُ، وَأَشْهَدُ أَنَّ مُحَمَّدًا عَبْدُهُ وَرَسُولُهُ، يَا مُحَمَّدُ، وَاللهِ! مَا كَانَعَلَى الْأَرْضِ وَجْهُ أَبغَضَ إِلَيَّ مِنْ وَجْهِكَ، فَقَدْ أَصْبَحَ وَجْهُكَ أَحَبِّ الْوُجُوهِ كُلَّهَا إِلَّي، وَاللهِمَا كَانَ مِنْ دِينٍ أَبغَضَ إِلَيَّ مِنْ دِينِكَ، فَأَصْبَحَ دِينُكَ أَحَبَّ الدِّينِ كُلَّهِ إِلَّي، وَاللهِ مَا كَانَمِنْ بَلَدٍ أَبْغَضَ إِلَيَّ مِنْ بَلَدِكَ، فَأَصْبَحَ بَلَدُكَ أَحَبَّ الْبِلَادِ كُلَّهَا إِلَّي، وَإِنَّ٥ خَيْلَكَ أَخَذَتْنِيوَأَنَا أُرِيدُ الْعُمْرَةَ، فَمَاذَا تَرَى؟ فَبَشَرَهُ رَسُولُ اللهِ ، وَأَمَرَهُ أَنْ يَعْتَمِرَ، فَلَمَّا قَدِمَ مَكَّةَقَالَ لَهُ قَائِلُ: أَصَبَوْتَ؟ فَقَالَ: لَا، وَلَكِنِّي أَسْلَمْتُ مَعَ رَسُولِ اللهِ صّلي الله عليه واله وسلم، وَلَا وَاللّهِ لَايَأْتِيكُمْ٦ مِنَ الْيَمَامَةِ حَبَّةُ حِنْطَةٍ حَتَّى يَأْذَنَ فِيهَا رَسُولُ اللهِ صلي الله عليه واله وسلم . رَوَاهُ مُسْلِمٌ.

وَاخْتَصَرَهُ الْبُخَارِيُّ، وَقَالَ الْعَلَّامَةُ الْعَيْنِيُّ: إِنَّ الْمَنَّ عِنْدَنَا مَنْسُوْخٌ، وَقِيْلَ: كَانَخَاصًّا بِسَيِّدِنًا رَسُوْلِ اللهِ صلي الله عليه واله وسلم ، وَمَا وَرَدَ فِي أُسَارَى بَدْرٍ كُلُّهُ مَنْسُوْخٌ، وَقَالَ الطّحَاوِيُّ:نَذْرُ الْكَافِرِ إِذَا أَسْلَمَ لَا يَجِبُ عَلَيْهِ عِنْدَنَا، وَأَوَّلْنَا الرِّوَايَةَ عَلَى النُّدُبِ.

English

Abu Hurayrah (may Allah be pleased with him) narrated: The Messenger of Allah (ﷺ) sent cavalry toward Najd, and they brought a man from Banu Hanifah named Thumamah ibn Uthal, the leader of the people of Yamamah. They tied him 2 to a pillar of the mosque. The Messenger of Allah (ﷺ) approached and said: “What do you have, O Thumamah?” He said: “I have good, O Muhammad. If you kill, you kill one with blood ties. If you show favor, you favor one who is grateful. If you want wealth, ask, and you will be given what you wish.” The Messenger of Allah (ﷺ) left him until the next day and asked: “What do you have, O Thumamah?” He replied: “As I told you: if you show favor, you favor one who is grateful; if you kill, you kill one with blood ties; if you want wealth, ask, and you will be given what you wish.” The Messenger of Allah (ﷺ) left him until the following day and asked again: “What do you have, O Thumamah?” He said: “As I told you: if you show favor, you favor one who is grateful; if you kill, you kill one with blood ties; if you want wealth, ask, and you will be given what you wish.” The Messenger of Allah (ﷺ) said: “3 Release Thumamah.” He went 4 to a palm grove near the mosque, bathed, entered the mosque, and said: “I bear witness that there is no god but Allah and that Muhammad is His servant and Messenger. O Muhammad, by Allah, no face on earth was more hated to me than yours, but now it is the most beloved. By Allah, no religion was more hated to me than yours, but now it is the most beloved. By Allah, no land was more hated to me than yours, but now it is the most beloved. 5 Your cavalry captured me while I intended Umrah. What do you think?” The Messenger of Allah (ﷺ) gave him glad tidings and ordered him to perform Umrah. When he arrived in Makkah, someone said: “Have you apostatized?” He replied: “No, but I have embraced Islam with the Messenger of Allah (ﷺ). By Allah, not a grain of wheat will come to you from Yamamah until the Messenger of Allah (ﷺ) permits it.” [Narrated by Muslim, summarized by Bukhari]

Al-Allamah al-Ayni said: Releasing captives freely is abrogated in our view. Some said it was specific to our master, the Messenger of Allah (ﷺ). All narrations about Badr captives are abrogated. At-Tahawi said: A disbeliever’s vow, if he embraces Islam, is not obligatory in our view, and we interpret the narration as recommended.

In (Nafa‘ al-Mufti was-Sa’il): Malik said a disbeliever cannot enter a mosque due to likely impurity, as the impure may not enter. Shafi‘i said they are barred only from the Sacred Mosque, per Allah’s saying: “Indeed, the polytheists are impure, so let them not approach the Sacred Mosque after this year” [Qur’an 9:28], referring to the year Abu Bakr led the pilgrimage and Ali announced Surah Bara’ah, year nine of Hijrah, as in (Ma‘alim at-Tanzil). Shafi‘i permitted it, citing: “Either confer favor afterwards or ransom” [Qur’an 47:4]. We say: This is abrogated by “Kill the polytheists wherever you find them” [Qur’an 9:5], as Surah Bara’ah was the last revealed, per (Fath). The freeing of Abu ‘Azzah al-Jumahi on Badr’s day was before abrogation, so he was killed when captured at Uhud. No one may permit delay; he must hasten, then bathe. Shafi‘i’s view: Bathing is obligatory if he was impure during disbelief, whether he bathed for it or not. Some Shafi‘is said: If he bathed, it suffices; otherwise, it is obligatory. Some Shafi‘is and Malikis said: No action is required, as impurity is nullified by Islam, like sins, but this is weakened by the consensus that wudu is required, so the effect of minor impurity is not nullified by Islam. If he was not impure and then converts, bathing is recommended, not obligatory, per Shafi‘i, Malik, and others. Ahmad and others said bathing is obligatory. 6 The statement: “Not a grain of wheat will come to you from Yamamah, etc.”: In (Al-Hidayah): Weapons should not be sold to people of war if they come under safe-conduct, nor sent to their land with traders, as the Prophet (ﷺ) prohibited selling or transporting weapons to them, per (Sir al-Bayhaqi), (Musnad al-Bazzar), and (Mu‘jam at-Tabarani) from Imran ibn Husayn. Bayhaqi said the sound view is that it is mawquf. The author of (Al-Hidayah) said: Analogy suggests prohibiting food transport to their land, as it strengthens them, and the goal is to weaken them, but we know food was transported per this Hadith of Thumamah and Usamah’s.

وقد نقل في (الفتح) أن قول مالك وأحمد كقولنا، ثم أيد مذهب الشافعي بما مَرَّ من قصة الجمحي ونحوها. وقدعلمت جوابه، انتهى. وقال في (عمدة الرعاية): فإن قلت: ينبغي عدم جوازالاسترقاق وتركهم ذمة لنا أيضًا؛ لأنالآية ليس فيها إلا ذكر القتل قلت: إنما تركنا العمل بظاهر الآية في هذا الباب بالإجماع وبالأخبار المشهور في جوازالاسترقاق وضرب الجزية.

٤ قوله: فانطلق إلى قريب من المسجد فاغتسل ثم دخل المسجد، فقال: أشهد أن لا إله إلا الله وأشهد أن محمدعبده ورسوله: قال النووي: إذا أراد الكافر الإسلام يبادر به، ولا يؤخره للاغتسال، ولا يحل لأحد أن يأذن له فيتأخيره، بل يبادر به، ثم يغتسل. ومذهب الشافعي أن اغتساله واجب إن كان عليه جنابة في الشرك، سواء كان اغتسلمنها أم لا. وقال بعض أصحاب الشافعي: وإن كان اغتسل أجزأه وإلا وجب. وقال بعض أصحاب الشافعي وبعضالمالكية: لا عمل عليه، ويسقط حكم الجنابة بالإسلام كما يسقط الذنوب، وضعفوا هذا بالوضوء؛ فإنه يلزمهبالإجماع، ولا يقال: يسقط أثر الحدث بالإسلام، هذا كله إذا كان أجنب في الكفر، أما إذا لم يجنب أصلًاً ثم أسلمفالغسل مستحب له، وليس بواجب هذا مذهب الشافعي، ومذهب مالك وآخرين. وقال أحمد وآخرون: يلزمهالغسل. كذا في (المرقاة).

وقال في (بذل المجهود): وعند الحنفية ما قال في (المنية) وشرحه للحلبي: وواحد منها أي من الاغتسالمستحب، وهو غسل الكافر حكمه، هكذا ذكره مطلقًا شمس الأئمة السرخسي في شرحه للمبسوط، وذكر في (المحيط): أن الكافر إذا أجنب ثم أسلم، الصحيح أنه يجب عليه الغسل؛ لأن الجنابة صفة باقية بعد إسلامه كبقاءصفة الحدث. وقال في (الدر المختار): كما يجب على من أسلم جنبًا أو حائضًا أو نفساء ولو بعد الانقطاع على الأصحلبقاء الحدث الحكمي.

٥ قوله: وإن خيلك أخذتني وأنا أريد العمرة إلخ: وقال في (العرف الشذي): قال الحنفية: من حلف في حالة الكفرثم أسلم، لا يجب وفاء ذلك النذر. وقال الشافعية بوجوب الوفاء، وتمسكوا بحديث، ونقول: الكلام في الوجوب ولاننفي الاستحباب، ولا نص على وجوبه.

٦ قوله: لا تأتيكم من اليمامة حبة حنطة إلخ: وفي (الهداية): ولا ينبغي أن يباع السلاح من أهل الحرب إذا حضروامستأمنين، ولا يجهز إليهم مع التجار إلى دار الحرب؛ لأنه صلي الله عليه واله وسلم نهى عن بيع السلاح من أهل الحرب وحمله إليهم، قالابن الهمام: المعروف ما في (سير البيهقي) و(مسند البزار) و(معجم الطبراني) عن عمران بن حصين رضي الله عنه : أن رسولالله صلي الله عليه واله وسلم نهى عن بيع السلاح في الفتنة، قال البيهقي: الصواب أنه موقوف، قال صاحب (الهداية): وهو القياس فيالطعام أي القياس فيه أن يمنع من حمله إلى دار الحرب؛ لأنه به التقوي على كل شيء، والمقصود إضعافهم إلا أناعرفنا نقل الطعام إليهم بالنص، يعني حديث ثمامة هذا وحديث أسامة.

وَعَنْ عِمْرَانَ بْنِ حُصَيْنٍ رضي الله عنه ، قَالَ: كَانَتْ ثَقِيْفُ حُلَفَاءَ لِبَنِيْ عُقَيْلٍ، فَأَسَرَتْثَقِيفُ رَجُلَيْنِ مِنْ أَصْحَابِ رَسُولِ اللهِ ، وَأَسَرَ أَصْحَابُ رَسُولِ اللَّهِ ﷺ رَجُلًا مِنْبَنِي عُقَيْلٍ، فَأَوْقَفُوْهُ فَطَرَحُوْهُ فِي الْخَرَّةِ، فَمَرَّ بِهِ رَسُوْلُ اللهِ صلي الله عليه واله وسلم فَنَادَاهُ: يَا مُحَمَّدُ، يَا مُحَمَّدُ،بِمَ أَخَذْتَ؟ قَالَ: بَجَرِيْرَةٍ حُلَفَائِكُمْ ثَقِيْفٍ، فَتَرَكَهُ وَمَضَى، فَنَادَاهُ: يَا مُحَمَّدُ، يَا مُحَمَّدُ،فَرَجِمَهُ رَسُوْلُ اللهِ صلي الله عليه واله وسلم فَرَجَعَ، قَالَ: (مَا شَأْتُكَ؟) قَالَ: إِنِّيْ مُسْلِمُ، فَقَالَ: (لَوْ قُلْتَهَا وَأَنْتَتَمْلِكُ أَمْرَكَ أَفْلَحْتَ كُلَّ الْفَلَاحِ) قَالَ: فَدَاه١ رَسُوْلُ اللهِ صلي الله عليه واله وسلم بِالرَّجُلَيْنِ اللَّدَيْنِ أَسَرَتْهُمَاتَقِيْفُ. رَوَاهُ مُسْلِمٌ.

English

Imran ibn Husayn (may Allah be pleased with him) narrated: Thaqif were allies of Banu Uqayl. Thaqif captured two of the Prophet’s Companions, and the Prophet’s Companions captured a man from Banu Uqayl, bound him, and threw him in the heat. The Messenger of Allah (ﷺ) passed by, and he called: “O Muhammad, O Muhammad, why was I taken?” He said: “For the crime of your allies, Thaqif.” He left, and the man called again: “O Muhammad, O Muhammad.” The Messenger of Allah (ﷺ) returned and said: “What is the matter?” He said: “I am a Muslim.” He said: “If you had said that when you were in control of your affair, you would have succeeded completely.” The Messenger of Allah (ﷺ) ransomed 1 him for the two men Thaqif had captured. 1 The statement: “ransomed him for the two men Thaqif had captured”: In (Radd al-Muhtar): Ransoming captives by exchanging them for money or Muslim captives is prohibited in the prevalent view. The first is impermissible, but permissible if needed, per (As-Sir al-Kabir). Muhammad said: It is permissible if the captive cannot reproduce, like a frail elder, per (Al-Ikhtiyar). The second is impermissible per Abu Hanifah, but permissible per his two companions, with the first being the sound view, per (Az-Zad). In (Al-Muhit): It is permissible in the apparent narration. See (Al-Qahistani) for details. Zayla‘i in (Al-Fath) said it is the view of Abu Hanifah’s two companions and the three Imams, supported by Sahih Muslim and others, where the Prophet (ﷺ) ransomed two Muslims for one polytheist and ransomed Muslims captured in Makkah for a woman. Thus, prohibiting ransom applies to money without necessity, but ransom with money when needed or with Muslim captives is permissible. They agreed that ransoming with women, children, horses, or weapons is prohibited except in necessity, and a Muslim captive who converts is not exchanged for a Muslim unless his Islam is secure.

وَعَنْ عَلِيَّ رضي الله عنه ، قَالَ: خَرَجَ عَبْدَانٌ إِلَى رَسُولِ اللهِ صلي الله عليه واله وسلم يَعْنِي يَوْمَ الْحَدَيْبِيَّةِقَبْلَ الصُّلْحِ، فَكَتَبَ إِلَيْهِ مَوَالِيهُمْ، فَقَالُوا: يَا مُحَمَّدُ، وَاللهِ! مَا خَرَجُوا إِلَيْكَ رَغْبَةً فِيدِينِكَ، وَإِنَّمَا خَرَجُوا هَرَبًا مِنَ الرِّقِّ، فَقَالَ نَاسٌ: صَدَقُوا يَا رَسُولَ اللهِ، رُدَّهُمْ إِلَيْهِمْ.فَغَضِبَ رَسُولُ اللهِ صلي الله عليه واله وسلم وَقَالَ: (مَا أُرَاكُمْ تَنْتَهُونَ يَا مَعْشَرَ قُرَيْشٍ، حَتَّى يَبْعَثَ اللهُعَلَيْكُمْ مَنْ يَضْرِبُ رِقَابَكُمْ عَلَى هَذَا)، وَأَبَى٢ أَنْ يَرُدَّهُمْ، وَقَالَ: (هُمْ عُتَقَاءُ اللّهِ). رَوَاهُأَبُوْ دَاوُدَ. وَقَالَ فِي (الْمَدَارِكِ): ﴿وهُوَ الَّذِى كَفَّ أَيْدِيَهُمْ عَنكُمْ﴾ أَيْدِيْ أَهْلِ مَكَّةً﴿وَأَيْدِيَكُمْ عَنْهُمْ﴾ عَنْ أَهْلِ مَكَّةَ يَعْنِيْ قَضَى بَيْنَهُمْ وَبَيْنَكُمْ الْمُكَافَةَ وَالْمُحَاجِزَةَ بَعْدَمَا خَوَّلَكُمْ الْظُفْرَ عَلَيْهِمْ وَالْغَلَبَةَ، وَذَلِكَ يَوْمَ٣ الْفَتْجِ، وَبِهِ اسْتَشْهَدَ أَبُوْ حَنِيْفَةَ عَلَىأَنَّ مَكَّةَ فُتِحَتْ عَنْوَةً لَا صُلْحًا ﴿بِبَطْنِ مَكَّةَ﴾ أَيْ بِمَكَّةَ ﴿ مِنْ بَعْدِ أَنْ أَظْفَرَكُمْعَلَيْهِمَّ﴾ أَي أَقْدَرَّكُمْ وَسَلَّطَكُمْ، ﴿وَكَانَ اللهُ بِمَا تَعْمَلُونَ بَصِيرًا ٌ﴾(الفتح: ٢٤).

English

Ali (may Allah be pleased with him) narrated: Slaves came to the Messenger of Allah (ﷺ) on the day of Hudaybiyyah before the truce. Their masters wrote to him, saying: “O Muhammad, by Allah, they did not come to you desiring your religion but fleeing slavery.” Some said: “They speak the truth, O Messenger of Allah, return them.” The Messenger of Allah (ﷺ) became angry and said: “I see you, O Quraysh, persisting until Allah sends someone to strike your necks for this.” He refused 2 to return them and said: “They are Allah’s freed.” [Narrated by Abu Dawud]

In (Al-Madarik): “It is He who restrained their hands from you and your hands from them”, meaning the people of Makkah, “in the valley of Makkah after He granted you victory over them, and Allah is Seeing of what you do” [Qur’an 48:24]. This refers to the day of 3 the conquest, supporting Abu Hanifah’s view that Makkah was conquered by force, not treaty.

2 The statement: “refused to return them, etc.”: In (Badhl al-Majhud): Abu Hanifah and his companions’ view, per (Al-Hidayah): If a slave of a hostile person converts and comes to us or we gain control over their land, he is free. Similarly, if their slaves join the Muslim army, they are free, as narrated that slaves from Ta’if converted, came to the Prophet (ﷺ), and he declared them free, saying: “They are Allah’s freed.”

3 The statement: “the day of the conquest, etc.”: Scholars differed on Makkah’s conquest. Shafi‘i said it was by treaty. In our view, it was by force, supported by this verse, as “granted victory” indicates overpowering, per Abu Hanifah. This is prioritized by Hanafi tafsir scholars like (Al-Kashaf) and (Al-Madarik). In (Al-Hidayah), in the chapter on tithes and land tax: Any land conquered by force and its people left on it is subject to land tax, except Makkah, which the Prophet (ﷺ) conquered by force and left to its people without tax. Some said this refers to Hudaybiyyah, as the surah was revealed before Makkah’s conquest. I say: This is weak, as the rulings in past tense are prophetic news of the unseen, per their books, summarized from (At-Tafsir al-Ahmadiyyah). In (Fath al-Qadir): Dividing lands is not mandatory, as Makkah was conquered by force, and the Prophet (ﷺ) did not divide its land. Malik said conquest makes land a waqf for Muslims, as he is most knowledgeable of narrations. Their claim of a treaty lacks evidence, contradicted by Sahih narrations: “Whoever enters Abu Sufyan’s house is safe; whoever locks his door is safe.” If it were a treaty, all would be safe without this. Also, Umm Hani’s protection of someone, and the Prophet’s order to kill Ibn Khatal despite his clinging to the Ka‘bah’s curtains, are clearer. His saying in Sahihayn: “Allah made Makkah sacred the day He created the heavens and earth; no blood is spilled there,” until he said: “If anyone justifies fighting citing the Messenger’s fighting, say: Allah permitted His Messenger, not you,” explicitly supports this.

٢ قوله: وأبى أن يردهم إلخ: وقال في (بذل المجهود): مذهب أبي حنيفة وأصحابه في ذلك ما قال في (الهداية): وإذا أسلم عبد لحربي ثم خرج إلينا أو ظهر على الدار فهو حر، وكذلك إذا خرج عبيدهم إلى عسكرالمسلمين فهم أحرار؛ لما روي أن عبيدًا من عبيد الطائف أسلموا، وخرجوا

إلى رسول الله كثيفً فقضى بعتقهم،وقال: (هم عتقاء الله).

٣ قوله: وذلك يوم الفتح إلخ: اختلف العلماء في فتح مكة، فعند الشافعي فتحت صلحا. وعندنا فتحت عنوة،والحجة لنا هذه الآية، ولفظ الإظفار يدل على القهر والغلبة، فيدل على أن مكة فتحت عنوة وقهرا، لا صلحا، كما هومذهب أبي حنيفة ، ولهذا قدم هذا التوجيه صاحب (الكشاف) و(المدارك) من مفسري الحنفية، وصرَّحًا بأنه دليللأبي حنيفة في هذا الباب. وقد قال صاحب (الهداية) في باب العشر والخراج: وكل أرض فتحت عنوة فأقر أهلهاعليها فهي أرض خراج، ثم قال: ومكة مخصوصة من هذا؛ فإن رسول الله صلي الله عليه واله وسلم فتحها عنوة وتركها لاهلها، ولميوظف الخراج. هذا لفظه. وقيل: كان ذلك في غزوة الحديبية، فإن السورة نزلت قبل فتح مكة، وأقول: لا خيرَ فيه إذاالأحكام المذكورة فيها بصيغة الماضي كلها خبر من الأمة معجزة للرسول صلي الله عليه واله وسلم في إظهار الغيب، كما تقرر في كتبهم،ملخص من (التفسيرات الأحمدية).

وقال في (فتح القدير): إن قسمة الأراضي ليس حتمًا؛ لأن مكة فتحت عنوة ولم يقسم النبي صلي الله عليه واله وسلم أرضها، ولهذاذهب مالك إلى أن بمجرّد الفتح تصير الأرض وقفا للمسلمين، وهو أدرى بالأخبار والآثار، ودعواهم أن مكةفتحت صلحا، لا دليل عليها، بل على نقيضها. ألا ترى أنه ثبت في الصحيح من قوله صلي الله عليه واله وسلم : (من دخل دار أبي سفيانفهو آمن، ومن أغلق بابه عليه فهو آمن). ولو كان صلحا لآمنوا كلهم به بلا حاجة إلى ذلك، وإلى ما ثبت من إجارة أمهانئ من أجارته ومدافعتها علياعن قتله، وأمره صلي الله عليه واله وسلم بقتل ابن خطل بعد دخوله، وهو متعلق بأستار الكعبة،أظهر من الكل. قوله صلي الله عليه واله وسلم في الصحيحين: (إن الله تعالى حرم مكة يوم خلق السموات والأرض لا يسفك بها دم) إلىأن قال: (فإن أحد ترخص بقتال رسول الله وتيّة فقولوا له: إن الله أذن لرسوله ولم يأذن لكم) فقوله: (بقتال رسولالله صلي الله عليه واله وسلم ) صريح في ذلك.

وَعَنْ قَتَادَةً قَالَ: ذَكَرَ لَنَا أَنَسُ بْنُ مَالِكٍ عَنْ أَبِيْ طَلْحَةَ أَنَّ نَبِيَّ اللّهِ صلي الله عليه واله وسلم أَمَرَ يَوْمَ بَدْرٍ بِأَرْبَعَةٍ وَعِشْرِينَ رَجُلًا مِنْ صَنَادِيدٍ قُرَيْشٍ فَقُذِفُوا فِي طَوِيٍّ مِنْ أَطْوَاءِ بَدْرٍخَبِيثٍ مخْبِثٍ وَكَانَ إِذَا ظَهَرَ عَلَى قَوْمٍ أَقَامَ بِالْعَرْصَةِ ثَلَاثَ لَيَالٍ، فَلَمَّا كَانَ بِبَدْرِ الْيَوْمَالثَّالِكَ أَمَرَ بِرَاحِلَتِهِ، فَشُدَّ عَلَيْهَا رَحْلُهَا، ثُمَّ مَشَى وَاتَّبَعَهُ أَصْحَابُهُ حَقَّى قَامَ عَلَى شَفَّةٍالرَّكِيَّ، فَجَعَلَ يُنَادِيهِمْ بِأَسْمَائِهِمْ وَأَسْمَاءِ آبَائِهِمْ: (يَا فُلَانُ بْنَ فُلَانٍ، وَيَا فُلَانُ بْنَ فُلَانٍ،مأَيَسُرُّكُمْ أَنَّكُمْ أَطَعْتُمْ اللهَ وَرَسُولَهُ فَإِنَّا قَدْ وَجَدْنَا مَا وَعَدَنَا رَبُّنَا حَقًّا، فَهَلْ وَجَدْتُمْ مَاوَعَدَ رَبُّكُمْ حَقًّا؟) قَالَ: فَقَالَ عُمَرُ: يَا رَسُولَ اللهِ، مَا تُكَلِّمُ مِنْ أَجْسَادٍ لَا أَرْوَاحَ لَهَا،فقال رَسُولُ اللهِ صلي الله عليه واله وسلم(والذي نفس محمد بيده١ ما انتم باسمع لما اقول منهم)وفي رِوَايَةٍ: (مَا أَنْتُمْ بِأَسْمَعَ مِنْهُمْ وَلَكِن لَا يُجِيْبُوْنَ). مُتَّفَقُّ عَلَيْهِ.

Qatadah narrated: Anas ibn Malik reported from Abu Talhah that on the day of Badr, the Prophet of Allah (ﷺ) ordered that twenty-four prominent men of Quraysh be thrown into a foul, defiled well among the wells of Badr. When he was victorious over a people, he would stay at the battlefield for three nights. On the third day at Badr, he ordered his riding camel to be saddled, and he walked with his Companions following him until he stood at the edge of the well. He began calling them by their names and their fathers’ names: “O so-and-so, son of so-and-so, and O so-and-so, son of so-and-so, would it not have pleased you to have obeyed Allah and His Messenger? We have found what our Lord promised us to be true; have you found what your Lord promised you to be true?” Umar said: “O Messenger of Allah, why do you speak to bodies without souls?” The Messenger of Allah (ﷺ) said: “By the One in Whose Hand is Muhammad’s soul, 1 you are not more able to hear what I say than they are.” In another narration: “You are not more able to hear than they are, but they cannot respond.” [Narrated by Bukhari and Muslim]

1 The statement: “You are not more able to hear what I say than they are”: It is inferred that the dead can hear, but some of our esteemed scholars reportedly denied the dead’s ability to hear, understand, or perceive. Some Hanafi jurists explicitly stated this, citing Allah’s saying: “Indeed, you cannot make the dead hear” [Qur’an 27:80]. They addressed this Hadith by noting that Aishah rejected it. This issue has several points: First, their claim that the dead cannot feel pain contradicts Hadiths indicating the dead feel pain as the living do, as mentioned by As-Suyuti in (Sharh as-Sudur). Second, their stance against visiting graves contradicts the Prophet’s saying: “Whoever visits me solely for my sake, it is my right to intercede for him on the Day of Resurrection,” and Hadiths stating the dead are comforted by visitors, respond to greetings, and recognize those they knew, which are numerous in Hadith collections. Third, their view on speaking to the dead contradicts authentic Hadiths in Sahihayn and elsewhere stating the dead hear and respond to greetings and understand the living’s speech. Aishah’s rejection of some of these Hadiths was not accepted by most Companions and later scholars. As for “Indeed, you cannot make the dead hear” [Qur’an 27:80], it negates making them hear, not hearing itself. The sound view is that “the dead” here refers to those dead in heart (disbelievers), not the physically dead. For a detailed discussion, refer to my treatise (Tadhkirat ar-Rashid) refuting (Tabsirat an-Naqid). To avoid length, I omit further details here; see my (Sharh al-Kabir) for clarification. No strong evidence from the Qur’an or Sunnah negates the dead’s hearing, understanding, or pain. Authentic Sunnah clearly affirms these. The truth is our scholars are innocent of denying these matters. Their rulings on oaths about striking, speaking, or visiting the dead, that they do not count as breaking the oath, are based on custom, not denial of these phenomena. Custom dictates that such oaths refer to the living, not the dead. Thus, speaking to the dead, though real and heard, is not considered “speaking” in the customary sense of an oath like “I won’t speak to you,” which applies to the living. Similarly, pain in the dead is real, but an oath like “I won’t strike you” applies to the living per custom. The restriction of such oaths is based on custom, not the reasons they stated. As stated in (‘Umdat ar-Ri‘ayah).

١ قوله: ما أنتم بأسمع لما أقول منهم: ويستفاد منه الميت يسمع لكن نسب إلى أئمتنا الأعلام أنهم ينكرون سماعالأموات وفهمهم وإدراكهم. وقد صرّح به جمع من أصحاب الفتاوى من أصحابنا، وأيدوه لقوله تعالى: ﴿إِنَّكَ لَاتُسْمعُ الْمَوْتى﴾ (النمل: ٨٠) وأجابوا من حديث ما أنتم بأسمع منه بأنه ردّته عائشة ، وفي المقام أبحاث، الأول:أن ما ذكروه من الإيلام لا يتحقق في الميت مخالف للأحاديث الدالَّة على أن الميت يتأذى مما يتأذى منه الحي، كماذكره السيوطي في كتابه (شرح الصدور). والثاني: أن قولهم في باب الدخول إلى زيارة الميت لقبره لا زيارة للقبوريخالف قوله صلي الله عليه واله وسلم: من جاءني زائرا لا تحمله حاجة إلا زيارتي كان حقا عَليَّ أن أكون له شفيعا يوم القيامة، وأقواله صلي الله عليه واله وسلم الدالَّة على أن الميت ليتأنس بزائره، ويجيب سلامه، ويعرف من كانت بينه وبينه معرفة، وهي كثيرة في كتب الحديثمروية. الثالث: أن قولهم في بحث الكلام يخالف الأحاديث الصحيحة الدالّة على أن الميت يسمع سلام من يسلمعليه، ويجيب السلام ويفهم كلام الأحياء، وهي مروية في الصحيحين وغيرهما.

وأما رد عائشة بها بعض تلك الأحاديث، فلم يعتد به جمهور الصحابة ومن بعدهم، وأما قوله تعالى: ﴿إِنَّكَ لَاتُسْمِعُ اَلْمَوْتَى﴾ (النمل: ٨٠) ففيه نفي الإسماع لا السماع. علا أن الصحيح أن المراد بالموتى هناك موتى القلوبوهم الكفار لا الأموات العرفية، وإن شئت تفصيل هذا البحث فارجع إلى رسالتي (تذكرة الراشد) برد(تبصرةالناقد)، ولولا خوف التطويل لأوردت ههنا قدرا من التفصيل، وليرجع من شاء التوضيح والتنقيح إلى شرحي(الكبير).وبالجملة لم يدل دليل قوي على نفي سماع الميت وإدراكه وفهمه وتألمه، لا من الكتاب ولا من السنة، بلالسُّنَن الصحيحة الصريحة دالَّة على ثبوتها له، والحق أن أئمتنا فهم بريئون عن إنكار هذه الأمور، وإنما حكموا في الحلفبالضرب والكلام والدخول عليه ونحوها بعدم الحنث عند وجود هذه الأشياء بالميت؛ لكون الأيمان مبنية على العرف،والعرف قاض على أن هذه الأمور يراد بها ارتباطها مادام الحياة لا بعد الموت فالكلام بالميت، وإن كان كلاما حقيقة،ويوجد فيه الإسماع والإفهام، لكن العرف يحكم بأن المراد في قوله: لا أكلمك هو الكلام حالة حياته، وكذا الإيلام،وإن كان كان يتحقق في الميت لكن العرف قاض على أن المراد في قوله: لا أضربك هو ضربه حيا لا ضربه ميتا.وبالجملة فالوجه في تقييد هذه الأيمان هو حكم العرف لا ما ذكروه. قاله في (عمدة الرعاية)

عَنْ أُمِّ هَانِئٍ بِنْتِ أَبِيْ طَالِبٍ رضى الله عنها قَالَتْ: ذَهَبْتُ إِلَى رَسُولِ اللهِ صلي الله عليه واله وسلم عَامَالْفَتْحِ، فَوَجَدْتُهُ يَغْتَسِلُ، وَفَاطِمَةُ ابْنَتُهُ تَسْتُرُهُ بِثَوْبٍ، فَسَلَّمْتُ، فَقَالَ: (مَنْ هَذِهِ؟) فَقُلْتُ:أَنَا أُمُّ هَانِئٍ بِنْتِ أَبِيْ طَالِبٍ، فَقَالَ: (مَرْحَبًا بِأُمَّ هَانِئٍ)، فَلَمَّا فَرَغَ مِنْ غُسْلِهِ قَامَ١ فَصَلَّى

ثَمَانِيَ رَكَعَاتٍ مُلْتَحِفًا ٢ فِي ثَوْبٍ وَاحِدٍ، ثُمَّ انْصَرَفَ. فَقُلْتُ: يَا رَسُولَ اللهِ، زَعَمَ ابْنُ أُميعَلىَّ أَنَّهُ قَاتِلَّ رَجُلًا أَجَرْتُهُ فُلَانُ بْنُ هُبَيْرَةَ. فَقَالَ رَسُولُ اللهِ صلي الله عليه واله وسلم : (قَدْ٣ أَجَرْنَا مَنْأَجَرْتِ يَا أُمَّ هَانِئٍ) قَالَتْ أُمُّ هَانِئٍ: وَذَلِكَ ضُحيً. مُتَّفَقُّ عَلَيْهِ.

وَفِي رِوَايَةٍ لِلَتّرْمِذِيِّ قَالَتْ: أَجَرْتُ رَجُلَيْنِ مِنْ أَحْمَائِيْ، فَقَالَ رَسُولُ اللهِ صلي الله عليه واله وسلم : (قَدْأَمَّنَّا مَنْ أَمَّنْتِ).

English

Umm Hani’ bint Abi Talib (may Allah be pleased with her) narrated: I went to the Messenger of Allah (ﷺ) during the year of the Conquest (of Makkah) and found him bathing, with his daughter Fatimah shielding him with a cloth. I greeted him, and he said: “Who is this?” I said: “I am Umm Hani’ bint Abi Talib.” He said: “Welcome, O Umm Hani’.” After finishing his bath, he stood 1 and prayed eight rak‘ahs 2 wrapped in a single cloth, then concluded. I said: “O Messenger of Allah, my cousin Ali claims he will kill a man I have granted safety to, so-and-so ibn Hubayrah.” The Messenger of Allah (ﷺ) said: “3 We have granted safety to whomever you have granted safety, O Umm Hani’.” She said: That was in the forenoon. [Narrated by Bukhari and Muslim]

In a narration by Tirmidhi, she said: “I granted safety to two of my in-laws.” The Messenger of Allah (ﷺ) said: “We have secured whomever you have secured.”

1 The statement: “stood and prayed eight rak‘ahs”: This refers to the Duha prayer. In (Ad-Durr al-Mukhtar): It is recommended to pray four or more rak‘ahs for Duha, per the sound view, from sunrise to noon, with the preferred time after a quarter of the day. In (Al-Munya): The minimum is two rak‘ahs, the maximum is twelve, and eight is the middle and best, as in (Adh-Dhakha’ir al-Ashrafiyyah), proven by his action and saying (ﷺ). The maximum is based on his saying alone. If prayed with one salam, eight is best; if separated, more is better, as Ibn Hajar noted in his commentary on Bukhari.

2 The statement: “wrapped in a single cloth”: This indicates praying in one cloth is permissible. Al-Tahawi said: This is the view of Abu Hanifah, Abu Yusuf, and Muhammad (may Allah have mercy on them). In (Al-‘Urf ash-Shadhi): The purpose, as Al-Tahawi said, is that the cloth not be left idle. If it is wide, one drapes it over the shoulders, called opposing the ends, wrapping, or enveloping. If moderately wide, it is knotted at the neck; otherwise, it is worn as a lower garment. Hanafis state that enveloping like the Jews in one cloth is disliked, but it is permissible with two cloths.

3 The statement: “We have granted safety to whomever you have granted safety”: In (Ad-Durr al-Mukhtar): We do not kill one granted safety by a free man or woman, even if sinful, blind, elderly, a child, or a slave permitted to fight, in any language, even if the enemy does not understand it, provided Muslims know it and the enemy hears it. Safety is invalid if granted from a distance. It is valid explicitly, e.g., “I grant you safety” or “No harm to you,” implicitly, e.g., “Come,” if perceived as safety, or by gesture, e.g., pointing to the sky.

١ قوله: قام يصلي ثماني ركعات: أي صلاة الضحى. وقال في (الدر المختار): وندب أربع فصاعدا في الضحى علىالصحيح من بعد الطلوع إلى الزوال ووقتها المختار بعد ربع النهار. وفي (المنية): أقلها ركعتان وأكثرها اثنا عشروأوسطها ثمان، وهو أفضلها، كما في (الذخائر الأشرفية) لثبوته بفعله وقوله صلي الله عليه واله وسلم ، وأما أكثرها فبقوله فقط. وهذا لوصلى الأكثر بسلام واحد، أما لو فصل فكل ما زاد أفضل كما أفاده ابن حجر في شرح (البخاري).

٢ قوله: ملتحفا في ثوب: فيستفاد منه أن الصلاة في الثوب الواحد جائزة. وقال الطحاوي: هذا قول أبي حنيفة وأبييوسف ومحمد رحمهم الله تعالى. وقال في (العرف الشذي): حاصل الباب كما قال الطحاوي: إن غرض الشارع أن لايبقى الثوب مهملا، فإذا كان أوسع يتوشح، ويسمى بالمخالفة بين الطرفين والالتحاف والاشتمال، وإن كان وسيعافيعقد على القفا وإلا فيتزر، ثم صرَّح الأحناف أن اشتمال الصماء أي اشتمال اليهود في الثوب الواحد مكروه، ولا بأسبه في الثوبين.

٣ قوله: قد أجرنا من أجرت: وقال في (الدر المختار): ولا نقتل من آمنه حُرٍّ أو حرةٌ ولو فاسقًا أو أعمى أوفانيًا أو صبيًاً أو عبداً أذن لهما في القتال بأيّ لغة كان الأمان، وإن كانوا لا يعرفونها بعد معرفة المسلمين ذلك بشرطسماعهم ذلك من المسلمين، فلا أمان لو كان بالبعد منهم، ويصح بالصريح كآمنت أو لا بأس عليكم وبالكنايةكتعال إذا ظنه أمانًا، وبالإشارة بالإصبع إلى السماء.

وَعَنْ أَبِيْ هُرَيْرَةَ أَنَّ النَّبِيَّ صلي الله عليه واله وسلم قَالَ:(إِنَّ الْمَرْأَةَ لَتَأْخُدُ لِلْقَوْم) يَعْنِي تُجِيرُعَلَى الْمُسْلِمِينَ. رَوَاهُ التَرْمِذِيُّ. وَقَالَ الشَّيْخُ ابْنُ الْهُمَامِ: لَا ٤ يَصِحُ أَمَانُ الْعَبْدِ الْمَحْجُوْرِعَلَيْهِ عِنْدَ أَبِيَّ حَنِيْفَةَ، إِلَّا أَنْ يَأْذَنَ لَهُ مَوْلَاهُ فِي الْقِتَالِ، وَقَالَ مُحَمَّدٌّ: يَصِحُّ.

English

Abu Hurayrah (may Allah be pleased with him) narrated: The Prophet (ﷺ) said: “A woman may grant safety on behalf of the Muslims.” [Narrated by Tirmidhi]

Shaykh Ibn al-Humam said: 4 The safety granted by a restricted slave is invalid per Abu Hanifah unless his master permits him to fight. Muhammad said it is valid.

4 The statement: “The safety granted by a restricted slave, etc.”: In (Al-Mirqat): The safety of a restricted slave is invalid per Abu Hanifah unless his master permits fighting. Muhammad said it is valid, as did Shafi‘i, Malik, Ahmad, and Abu Yusuf in a narration. Abu Hanifah and Malik (per Sahnun’s narration) provide detailed reasoning in Ibn al-Humam’s commentary. If a child who does not understand Islam or describe it grants safety, it is invalid by consensus of the four Imams, like a madman’s. If the child understands but is restricted from fighting, the dispute applies: invalid per Abu Hanifah, valid per Muhammad. Shafi‘i and Ahmad (in one view) align with Abu Hanifah, as the child’s word is not binding, like his divorce or manumission. Malik and Ahmad align with Muhammad. If permitted to fight, the sound view is that it is valid by consensus among our scholars, Malik, and Ahmad. Details on safety are in the chapter on retribution under Ali’s Hadith: “The lowliest of them upholds their covenant.” Refer to it, as it is valuable.

Amr ibn Shu‘ayb, from his father, from his grandfather (may Allah be pleased with him), narrated: The Messenger of Allah (ﷺ) said in his sermon: “1 Fulfill the alliances of the pre-Islamic era, for Islam only strengthens them, and do not initiate new alliances in Islam.” [Narrated by Tirmidhi]

In (An-Nihayah): Alliances in the pre-Islamic era for tribal conflicts and wars were prohibited in Islam by his saying (ﷺ): “No alliances in Islam.” Those for supporting the oppressed, maintaining kinship, and similar were strengthened by Islam, per his saying: “Any alliance in the pre-Islamic era, Islam only strengthens it.” As stated in (Al-Mirqat).

English

Amr ibn al-Himaq (may Allah be pleased with him) narrated: I heard the Messenger of Allah (ﷺ) say: “Whoever grants safety to a man over his life and then kills him will be given the banner of treachery on the Day of Resurrection.” [Narrated in (Sharh as-Sunnah)]

وَعَنْ سُلَيْمِ بْنِ عَامِرٍ قَالَ: كَانَ بَيْنَ مُعَاوِيَةَ وَبَيْنَ الرُّومِ عَهْدُ، وَكَانَ يَسِيرُ نَحْوَبِلَادِهِمْ، حَقَّى إِذَا انْقَضَى الْعَهْدُ غَزَاهُمْ، فَجَاءَ رَجُلُّ عَلَى فَرَسٍ أَوْ بِرْذَوْنٍ، وَهُوَ يَقُوْلُ: اللّهُأَكْبَرُ اللهُ أَكْبَرُ، وَفَاءً لَا غَدَرَ.٢ فَنَظَرُوا فَإِذَا عَمْرُو بْنُ عَبَسَةَ، فَسَأَلَهُ مُعَاوِيَةُ عَنْ ذَلِكَ،فَقَالَ : سَمِعْتُ رَسُولَ اللهِ ﷺ يَقُولُ: (مَنْ كَانَ بَيْنَهُ وَبَيْنَ قَوْمٍ عَهْدٌ فَلَا يَحُلَّنَّ عَهْدًا، وَلَايَشُدَّنَّهُ حَتّى يَمْضِيَ أَمَدُهُ أَوْ يَنْبِذَ إِلَيْهِمْ عَلَى سَوَاءٍ). قَالَ: فَرَجَعَ مُعَارِيَةُ بِالنَّاسِ. رَوَاهُالتِّرْمِذِيُّ وَأَبُوْ دَاوُدَ.

English

Sulaym ibn Amir narrated: There was a treaty between Mu‘awiyah and the Romans. He marched toward their land, intending to attack them when the treaty expired. A man on a horse or mule came, saying: “Allah is Greater, Allah is Greater, fulfillment, not treachery.” 2 They looked and saw it was Amr ibn Abasah. Mu‘awiyah asked him about it, and he said: “I heard the Messenger of Allah (ﷺ) say: ‘Whoever has a treaty with a people must not dissolve or tighten it until its term expires or he renounces it openly.’ Mu‘awiyah returned with the people.” [Narrated by Tirmidhi and Abu Dawud]

وَعَنْ أَبِيْ رَافِعِ رضي الله عنه ، قَالَ: بَعَثَتْنِي قُرَيْشِّ إِلَى رَسُولِ اللهِ صلي الله عليه واله وسلم ، فَلَمَّا رَأَيْتُ رَسُولَاللهِ صلي الله عليه واله وسلم أُلْتِيَ فِي قَلْبِي الْإِسْلَامُ. فَقُلْتُ: يَا رَسُولَ اللهِ، إِنَّي - وَاللهِ - لَا أَرْجِعُ إِلَيْهِمْ أَبَدًا،قَالَ:(إِنَّ لَا أَخِيسُ١ بِالْعَهْدِ، وَلَا أَحْبِسُ الْبُرْدَ، وَلَكِنِ ارْجِعْ، فَإِنْ كَانَ فِي نَفْسِكَ الَّذِيفِي نَفْسِكَ الْآنَ فَارْجِعْ)، قَالَ: فَذَهَبْتُ ثُمَّ أَتَيْتُ النَّبِيَّ صلي الله عليه واله وسلم ، فَأَسْلَمْتُ. رَوَاهُ أَبُوْ دَاوُدَ.

English

Abu Rafi‘ (may Allah be pleased with him) narrated: Quraysh sent me to the Messenger of Allah (ﷺ). When I saw him, Islam was inspired in my heart. I said: “O Messenger of Allah, by Allah, I will never return to them.” He said: “1 I do not break a covenant or detain messengers. Return, and if what is in your heart now remains, come back.” I went, then returned to the Prophet (ﷺ) and embraced Islam. [Narrated by Abu Dawud]

وَعَنِ ابْنِ مَسْعُوْدٍ قَالَ: جَاءَ ابْنُ النَّوَّاحَةِ وَابْنُ أَثَالٍ رَسُولَا مُسَيْلِمَةَ إِلَىالنَّبِيِّ صلي الله عليه واله وسلم فَقَالَ لَهُمَا: (أَتَشْهَدَانِ أَنِي رَسُولُ اللهِ؟) قَالَا: نَشْهَدُ أَنَّ مُسَيْلِمَةَ رَسُولُ اللهِ،فَقَالَ النَّبِيُّ صلي الله عليه واله وسلم : آمَنْتُ بِاللهِ وَرُسُلِهِ، لَوْ كُنْتُ قَائِلًا رَسُولًا لَقَتَلْتُكُمَا). قَالَ عَبْدُ اللَّهِ:فَمَضَتِ السُّنَّةُ أَنَّ الرُّسُلَ لَا تُقْتَلُ. رَوَاهُ أَحْمَدُ.

English

Ibn Mas‘ud (may Allah be pleased with him) narrated: Ibn an-Nawwahah and Ibn Athal, messengers of Musaylimah, came to the Prophet (ﷺ). He said to them: “Do you bear witness that I am the Messenger of Allah?” They said: “We bear witness that Musaylimah is the Messenger of Allah.” The Prophet (ﷺ) said: “I believe in Allah and His Messengers. If I were to kill messengers, I would have killed you both.” Abdullah said: Thus, it became established that messengers are not killed. [Narrated by Ahmad]
