بَابُ قِسْمَةِ الْغَنَائِمِ وَالْغُلُوْلِ فِيْهَاThe Distribution of Spoils and Misappropriation (Ghulul)

العربية

وَقَوْلِ اللهِ عَزَّ وَجَلَّ: ﴿وَأَعْلَمُواْ أَنَّمَا غَنِمْتُم مِّن شَىْءٍ فَأَنَّ لِلْهِ خُمُسَهُ.وَلِلرَّسُولِ وَلِذِى الْقُرْبَى وَالْيَتَمَى وَالْمَسَكِينِ وَأَبْنِ السَّبِيلِ إِن كُنتُمْءَامَنْتُمْ بِاللهِ وَمَا أَنزَلْنَا عَلَى عَبْدِنًا يَوْمَ الْفُرْقَانِ يَوْمَ الْتَقَى الْجَمْعَانِّوَلُهُ عَلَى كُلِّ شَىْءٍ قَدِيرُ ٤١﴾ وَقَوْلِهِ تَعَالَى: ﴿يَأَيُّهَا ٣ النَّبيُّ حَرِّضٍاٌلْمُؤْمِنِينَ عَلَى الْقِتَالِ﴾ وَقَوْلِهِ ثَعَالَى: ﴿وَمَن يَغْلُلُ يَأْتِ بِمَا غَلَّ يَوْم القيمة ثم توفي كل نفس ماكسبت وهم لايظلمون﴾.

English

And the saying of Allah, the Mighty and Exalted: “And know that whatever you take as spoils, a fifth of it is for Allah, His Messenger, the near relatives, the orphans, the needy, and the wayfarer, if you believe in Allah and what We revealed to Our servant on the day of distinction, the day the two armies met. And Allah is capable of all things” [Qur’an 8:41].And His saying: “O Prophet, urge the believers to fight” [Qur’an 8:65].And His saying: “Whoever misappropriates will come with what he misappropriated on the Day of Resurrection. Then every soul will be fully repaid for what it earned, and they will not be wronged” [Qur’an 3:161].

وَعَنْ أَبِي أُمَامَةَ الله عَنِ النَّبِيِّ ﷺ قَالَ: (إِنَّ اللَّهَ فَضَّلَنِي عَلَى الْأَنْبِيَاءِ) - أَوْقَالَ: (فَضَّلَ أُمَّتِي عَلَى الْأُمَمِ - وَأَحَلَّ لِيَ الْغَنَائِمَ). رَوَاهُ التَّرْمِذِيُّ.

English

Abu Umamah (may Allah be pleased with him) narrated that the Prophet (ﷺ) said: “Allah has favored me over the prophets” – or he said: “favored my nation over other nations – and made spoils lawful for me.” [Narrated by Tirmidhi]

وَعَنْ أَبِيْ هُرَيْرَةَ رضي الله عنه عَنْ رَسُوْلِ اللهِ صلي الله عليه واله وسلم قَالَ:(فَلَمْ تَحِلَّ الْغَنَائِمُ لِأَحَدٍ مِنْقَبْلِنَا، ذَلِكَ بِأَنَّ اللّهَ رَأَى ضَعْفَنَا وَعَجْزَنًا، فَطَيَّبَهَا لَنَا). مُتَّفَقُّ عَلَيْهِ.

English

Abu Hurayrah (may Allah be pleased with him) narrated that the Messenger of Allah (ﷺ) said: “Spoils were not lawful for anyone before us. That is because Allah saw our weakness and inability, so He made them lawful for us.” [Narrated by Bukhari and Muslim]

وَعَنْهُ رضي الله عنه قَالَ: قَالَ رَسُوْلُ اللهِ صلي الله عليه واله وسلم : (غَزَا نَبِيُّ مِنَ الْأَنْبِيَاءِ، فَقَالَ لِقَوْمِهِ: لَايَتْبَعْنِي رَجُلٌ مَلَكَ بُضْعَ امْرَأَةِ، وَهُوَ يُرِيدُ أَنْ يَبْنِيَ بِهَا، وَلَمَّا يَبْنِ بِهَا، وَلَا أَحَدُّ بَنَى بُيُوتًا،وَلَمْ يَرْفَعْ سُقُوفَهَا، وَلَا أَحَدُّ اشْتَرَى غَنَمَا أَوْ خَلِفَاتٍ، وَهُوَ يَنْتَظِرُ وِلَادَهَا، فَغَزَا، فَدَنَا مِنَالْقَرْيَةِ صَلَاةَ الْعَصْرِ أَوْ قَرِيبًا مِنْ ذَلِكَ، فَقَالَ لِلشَّمْسِ: إِنَّكِ مَأْمُورَةً وَأَنَا مَأْمُورُ، اللّهُمَّاحْبِسْهَا عَلَيْنَا، فَحُبِسَتْ حَتَّى فَتَحَ اللهُ عَلَيْهِ، فَجَمَعَ الْغَنَائِمَ، فَجَاءَتْ - يَعْنِي النَّارَ -لِتَأْكُلَهَا فَلَمْ تَظْعَمْهَا، فَقَالَ: إِنَّ فِيكُمْ غُلُولًا فَلْيُبَايِعْنِي مِنْ كُلِّ قَبِيلَةٍ رَجُلٌّ. فَلَزِقَتْ يَدُرَجُلٍ بِيَدِهِ، فَقَالَ: فِيكُمْ الْغُلُولُ، فَجَاءُوا بِرَأْسٍ مِثْلِ رَأْسِ بَقَّرَةٍ مِنَ الذَّهَبِ، فَوَضَعُوهَا،فَجَاءَتُ١ النَّارُ فَأَكَلَتْهَا). زَادَ فِي رِوَايَةٍ: (فَلَمْ تَحِلَّ الْغَنَائِمُ لِأَحَدٍ مِنْ قَبْلِنَا، ثُمَّ أَحَلَّ اللهُلنَا الْغَنَائِمَ رَأَى ضَعْفَنَا وَعَجْزَنَا فَأَحَلَّهَا لَنَا). مُتَّفَقُّ عَلَيْهِ.

English

Abu Hurayrah (may Allah be pleased with him) narrated: The Messenger of Allah (ﷺ) said: “A prophet among the prophets went to battle and said to his people: ‘Let no man follow me who has married a woman and intends to consummate but has not yet done so, or who has built houses but not raised their roofs, or who has bought sheep or pregnant animals and awaits their offspring.’ He went to battle and approached the town at the time of Asr prayer or close to it. He said to the sun: ‘You are under command, and I am under command. O Allah, hold it back for us.’ It was held back until Allah granted him victory. He gathered the spoils, and the fire came to consume them but did not. He said: ‘There is misappropriation among you. Let one man from each tribe pledge to me.’ A man’s hand stuck to his, and he said: ‘The misappropriation is among you.’ They brought a head-sized piece of gold, placed it down, and 1 the fire came and consumed it.” In another narration: “Spoils were not lawful for anyone before us. Then Allah made them lawful for us, seeing our weakness and inability.” [Narrated by Bukhari and Muslim]

English notes

1 The statement: “The fire came and consumed it, etc.”: If you ask: What is the wisdom in the fire consuming their spoils but making them lawful for us? I say: For them, it was to ensure their fighting was not for spoils due to their lack of sincerity. For this nation, spoils were made lawful because sincerity predominates among them, needing no additional incentive. As stated in (‘Umdat al-Qari).

١قوله: فجاءت النار فأكلتها إلخ: فإن قلت: ما الحكمة في أكل النار غنائمهم والتحليل لنا؟ قلت: جعل هذا فيحقهم حتى لا يكون قتالهم لأجل الغنيمة؛ لقصورهم في الإخلاص، وأما تحليلها في حق هذه الأمة فلكون الإخلاصغالبًا عليهم، فلم يحتج إلى باعث آخر. كذا في (عمدة القاري).

English

Khawlah al-Ansariyyah (may Allah be pleased with her) narrated: I heard the Messenger of Allah (ﷺ) say: “Some men misuse Allah’s wealth unlawfully, and for them is the Fire on the Day of Resurrection.” [Narrated by Bukhari]

وَعَنْ خَوْلَةَ بِنْتِ قَيْسٍ رضي الله عنها قَالَتْ: سَمِعْتُ رَسُوْلَ اللهِ صلي الله عليه واله وسلم يَقُوْلُ: (إِنَّ هَذَاالْمَالَ خَضِرَةٌ حُلْوَةٌّ، فَمَنْ أَصَابَهُ بِحَقَّهِ بُورِكَ لَهُ فِيهِ، وَرُبَّ مُتَخَوِّضٍ فِيمَا شَاءَتْ بِهِ نَفْسُهُمِنْ مَالِ اللهِ وَرَسُولِهِ لَيْسَ لَهُ يَوْمَ الْقِيَامَةِ إِلَّا النَّارُ). رَوَاهُ التّرْمِذِيُّ.

English

Khawlah bint Qays (may Allah be pleased with her) narrated: I heard the Messenger of Allah (ﷺ) say: “This wealth is green and sweet. Whoever takes it rightfully is blessed in it. But many who indulge in it as their soul desires from the wealth of Allah and His Messenger will have nothing but the Fire on the Day of Resurrection.” [Narrated by Tirmidhi]

English

Abu Hurayrah (may Allah be pleased with him) narrated: The Messenger of Allah (ﷺ) stood among us one day and mentioned 2 misappropriation, emphasizing its gravity and severity. He said: “Let me not find one of you coming on the Day of Resurrection with a camel bleating on his neck, saying: ‘O Messenger of Allah, help me,’ and I say: ‘I have no power for you; I conveyed the message.’ Let me not find one of you coming with a horse neighing on his neck, saying: ‘O Messenger of Allah, help me,’ and I say: ‘I have no power for you; I conveyed the message.’ Let me not find one of you coming with a sheep bleating on his neck, saying: ‘O Messenger of Allah, help me,’ and I say: ‘I have no power for you; I conveyed the message.’ Let me not find one of you coming with a soul crying on his neck, saying: ‘O Messenger of Allah, help me,’ and I say: ‘I have no power for you; I conveyed the message.’ Let me not find one of you coming with fluttering rags on his neck, saying: ‘O Messenger of Allah, help me,’ and I say: ‘I have no power for you; I conveyed the message.’ Let me not find one of you coming with silent gold or silver on his neck, saying: ‘O Messenger of Allah, help me,’ and I say: ‘I have no power for you; I conveyed the message.’” [Narrated by Bukhari and Muslim, with Muslim’s wording being more complete]

وَعَنْ عُبَادَةَ بْنِ الصَّامِتِ رضي الله عنه أَنَّ النَّبِيَّ صلي الله عليه واله وسلم كَانَ يَقُوْلُ: (أَدُّوا الْخِيَاطَوَالْمَخِيطَ، وَإِيَّاكُمْ وَالْغلُولَ؛ فَإِنَّهُ عَارٌ عَلَى أَهْلِهِ يَوْمَ الْقِيَامَةِ). رَوَاهُ الدَّارِميُّ، وَرَوَاهُالنَّسَائِيُّ عَنْ عَمْرِو بْنِ شُعَيْبٍ عَنْ أَبِيْهِ عَنْ جَدِّهِ.

English

Ubadah ibn as-Samit (may Allah be pleased with him) narrated that the Prophet (ﷺ) said: “Return the needle and thread, and beware of misappropriation, for it is a disgrace to its people on the Day of Resurrection.” [Narrated by Ad-Darimi, and by An-Nasa’i from Amr ibn Shu‘ayb, from his father, from his grandfather]

وَعَنْ عَبْدِ اللهِ بْنِ عَمْرِو رضي الله عنهما قَالَ: كَانَ عَلَى ثَقَلِ النَّبِيِّ ﷺ رَجُلٌ يُقَالُ لَهُكِرْكِرَةُ فَمَاتَ، فَقَالَ رَسُولُ اللهِ صلي الله عليه واله وسلم :(هُوَ فِي النَّارِ) فَذَهَبُوا يَنْظُرُونَ إِلَيْهِ فَوَجَدُوا عَبَاءَةًقَدْ غَلَّهَا. رَوَاهُ الْبُخَارِيُّ.

English

Abdullah ibn Amr (may Allah be pleased with them both) narrated: A man named Kirkirah was in charge of the Prophet’s (ﷺ) baggage and died. The Messenger of Allah (ﷺ) said: “He is in the Fire.” They went to check and found a cloak he had misappropriated. [Narrated by Bukhari]

وَعَنِ ابْنِ عَبَّاسِ رضي الله عنهما قَالَ: حَدَّثَنِي عُمَرُ لَمَّا كَانَ يَوْمُ خَيْبَرَ أَقْبَلَ نَفَرٌ مِنْصَحَابَةِ النبِيِّ صلي الله عليه واله وسلم ، فَقَالُوا: فُلَانٌ شَهِيدٌ، فُلَانٌ شَهِيدٌ، وَقُلَانٌ شَهِيدُ، حَتَّى مَرُّوا عَلَى رَجُلٍفَقَالُوا: فُلَانٌ شَهِيدٌ، فَقَالَ رَسُولُ اللهِ ﷺ: (كَلَّا إِنِّي رَأَيْتُهُ فِي النَّارِ فِي بُرْدَةٍ غَلَّهَا أَوْعَبَاءَةٍ). ثُمَّ قَالَ رَسُولُ اللهِ صلي الله عليه واله وسلم : (يَا ابْنَ الْخَطّابِ، اذْهَبْ، فَنَادِ فِي النَّاسِ:أَنَّهُ لَا يَدْخُلُ١ الْجَنَّةَ إِلَّا الْمُؤْمِنُونَ) ثَلَاثًا، قَالَ: فَخَرَجْتُ فَنَادَيْتُ: أَلَا إِنَّهُ لَا يَدْخُلُالْجَنَّةَ إِلَّا الْمُؤْمِنُونَ ثَلَاثًا. رَوَاهُ مُسْلِمٌ.

English

Ibn Abbas (may Allah be pleased with them both) narrated: Umar said: On the day of Khaybar, a group of the Prophet’s Companions came, saying: “So-and-so is a martyr, so-and-so is a martyr,” until they passed a man and said: “So-and-so is a martyr.” The Messenger of Allah (ﷺ) said: “No, I saw him in the Fire for a cloak or mantle he misappropriated.” Then the Messenger of Allah (ﷺ) said: “O Ibn al-Khattab, go and announce among the people three times: ‘Only the believers enter Paradise.’” 1 I went out and announced three times: “Indeed, only the believers enter Paradise.” [Narrated by Muslim]

1 The statement: “Only the believers enter Paradise”: Ibn al-Malik said: In customary usage, a believer is one who believes in Muhammad (ﷺ) and what he brought. One who misappropriates is as if he did not believe him, failing to act on his belief, so the Prophet (ﷺ) did not count him among the believers to deter others. As stated in (Al-Mirqat).

١ قوله: لا يدخل الجنة إلا المؤمنون: قال ابن الملك: المؤمن في العرف من آمن بمحمد صلي الله عليه واله وسلم وبما جاء به، ومن غلكأنه لم يصدقه لعدم جريه على موجب تصديقه، ولم يجعله النبي صلي الله عليه واله وسلم من المؤمنين زجرًا لهم عن ذلك. كذا في(المرقاة).

وَعَنْ يَزِيْدَ بْنِ خَالِدٍ رضي الله عنه ، أَنَّ رَجُلًا مِنْ أَصْحَابِ النَّبِيِّ صلي الله عليه واله وسلم تُوُفيَ يَوْمَ خَيْبَرَ،فَذَكَرُوا ذَلِكَ لِرَسُولِ اللهِ صلي الله عليه واله وسلم فَقَالَ: (صَلُّوا عَلَى صَاحِبِكُمْ). فَتَغَيَّرَتْ وُجُوهُ النَّاسِلِذَلِكَ، فَقَالَ: (إِنَّ صَاحِبَكُمْ غَلَّ فِي سَبِيلِ اللّهِ)، فَفَتَّشْنَا مَتَاعَهُ فَوَجَدْنَا خَرَزًا مِنْ خَرَزِيَهُودَ لَا يُسَاوِي دِرْهَمَيْنٍ. رَوَاهُ مَالِكُ وَأَبُوْ دَاوُدَ وَالنَّسَائِيُّ.

وَقَالَ ١ الْإِمَامُ الطَّحَاوِيُّ: وَلَوْ صَحَّ حَدِيْثُ التَّحْرِيْقِ حُمِلَ عَلَى أَنَّهُ كَانَ إِذَا كَانَتِ الْعُقُوْبَاتُفِي الْأَمْوَالِ كَأَخْذِ شَطْرِ الْمَالِ مِنْ مَانِعِ الرَّكَاةِ وَضَالَّةِ الْإِبلِ وَسَارِقِ التَّمَرِ، وَكُلُّهُ مَنْسُوْخٌ.

English

Yazid ibn Khalid (may Allah be pleased with him) narrated: A man from the Prophet’s Companions died on the day of Khaybar. They mentioned it to the Messenger of Allah (ﷺ), who said: “Pray over your companion.” The people’s faces changed at this, so he said: “Your companion misappropriated in the path of Allah.” They searched his belongings and found beads from Jewish beads not worth two dirhams. [Narrated by Malik, Abu Dawud, and An-Nasa’i]

Imam At-Tahawi said: 1 If the Hadith about burning were authentic, it would be interpreted as applying to financial punishments, like taking half the wealth of one who withholds zakat, straying camels, or a date thief, all of which are abrogated.

1 Scholars differed on the punishment for misappropriation. The majority said: He is disciplined according to his situation as the leader sees fit, but his belongings are not burned. This is the view of Abu Hanifah, Shafi‘i, Malik, and many Companions, Successors, and later scholars. They interpreted the Hadith as a warning, not an obligation. Bukhari said: Several Hadiths about misappropriation do not mention burning belongings. Al-Hasan, Ahmad, Ishaq, Mukhawwal, and Al-Awza‘i said: His saddle and belongings are burned, except, per Al-Awza‘i, his weapons and clothes, and per Al-Hasan, animals and the Qur’an. The Hadith from Ibn Umar via Amr about burning the misappropriator’s saddle is narrated solely by Salih ibn Muhammad, weak from Salim. The Prophet (ﷺ) did not burn the belongings of the one with the beads or cloak. As stated in (‘Umdat al-Qari) and (Al-Mirqat).

١ قوله: وقال الإمام الطحاوي إلخ: اختلفوا في عقوبة الغال، فقال الجمهور: يعذر بقدر حاله على ما يراه الإمام، ولا يحرقمتاعه. وهذا قول أبي حنيفة والشافعي ومالك وجماعة كثيرة من الصحابة والتابعين فمن بعدهم، وحملواالحديث على الزجر والوعيد دون الإيجاب، قالالبخاري: قد روي في غير حديث عن النبي في الغال ولم يأمربحرق متاعه. وقال الحسن وأحمد وإسحاق ومكحول والأوزاعي فد: يحرق رحله ومتاعه كله، قال الأوزاعي: إلا سلاحهوثيابه التي عليه، قال الحسن: إلا الحيوان والمصحف، وقال: ما حديث ابن عمر عن عمرو مرفوعًا في تحريقرحل الغال فهو حديث تفرد به صالح بن محمد، وهو ضعيف عن سالم، ولأن النبي صلي الله عليه واله وسلم لم يحرق رحل الذي وجدعنده الخرز والعباءة من (عمدة القاري) و(المرقاة) بالتقاط.

وَعَنْ أَبِي هُرَيْرَةَ اللهِ قَالَ : أَهْدَى رَجُلٌ لِرَسُولِ اللهِ ﷺ غُلَامًا يُقَالُ لَهُمِدْعَمُ، وَبَيْنَمَا مِدْعَمُ يَخْطُ رَحْلًا لِرَسُولِ اللهِ صلي الله عليه واله وسلم إِذَا أَصَابَهِ سَهْمُ عَائِرُ فَقَتَلَهُ، فَقَالَالنَّاسُ : هَنِيئًا لَهُ الْجَنَّةُ. فَقَالَ رَسُولُ اللهِ ﷺ: (كَلَّا وَالَّذِي نَفْسِي بِيَدِهِ إِنَّ الشَّمْلَةَ الَّتِيأَخَذَهَا يَوْمَ خَيْبَرَ مِنَ الْمَغَانِمِ لَمْ تُصِبْهَا الْمَقَاسِمُ لَتَشْتَعِلُ عَلَيْهِ نَارًا)، فَلَمَّا سَمِعَ ذَلِكَالنَّاسُ جَاءَ١ رَجُلٌ بِشِرَاكِ أَوْ شِرَاكَيْنِ إِلَى النَّبِيِّ صلي الله عليه واله وسلم فَقَالَ:(شِرَاكٌ مِنْ نَارٍ أَوْ شِرَاكَانِمِنْ نَارٍ). مُتَّفَقٌّ عَلَيْهِ.

وَرَوَى أَبُو دَاوُدَ عَنْ عَبْدِ اللهِ بْنِ عَمْرِو له قَالَ: كَانَ رَسُولُ اللَّهِ ﷺ إِذَا أَصَابَ غَنِيمَةً أَمَرَ بِلَالًا، فَنَادَى فِي النَّاسِ، فَيَجِيْئُوْنَ بِغَنَائِمِهِمْ، فَيَخْمُسُهُ وَيُقَسِّمُهُ، فَجَاءَ رَجُلٌ بَعْدَ ذَلِكَ بِزِمَامٍ مِنْ شَعَرٍ، فَقَالَ: يَا رَسُولَ اللهِ، هَذَا فِيمَا كُنَّا أَصَبْنَاهُ مِنَ الْغَنِيمَةِ، فَقَالَ:(أَسَمِعْتَ بِلَالًا فَنَادَى ثَلَاثًا؟) قَالَ: نَعَمْ، قَالَ: (فَمَا مَنَعَكَ أَنْ تَجِيءَ بِهِ؟) فَاعْتَذَرَ إِلَيْهِقَالَ: فَقَالَ:(كُنْ أَنْتَ تَجِيءُ بِهِ يَوْمَ الْقِيَامَةِ فَلَنْ أَقْبَلَهُ عَنْكَ)٢.

English

Abu Hurayrah (may Allah be pleased with him) narrated: A man gifted a slave named Mid‘am to the Messenger of Allah (ﷺ). While Mid‘am was saddling for the Messenger of Allah (ﷺ), a stray arrow struck and killed him. The people said: “Congratulations, he gets Paradise.” The Messenger of Allah (ﷺ) said: “No, by the One in Whose Hand is my soul, the shawl he took from the spoils of Khaybar before distribution is burning on him.” When the people heard this, a man brought one or two sandal straps 1 to the Prophet (ﷺ), who said: “A strap of fire or two straps of fire.” [Narrated by Bukhari and Muslim]

Abu Dawud narrated from Abdullah ibn Amr: When the Messenger of Allah (ﷺ) acquired spoils, he ordered Bilal to call the people, who brought their spoils. He took the fifth and distributed them. A man later brought a hair rein, saying: “O Messenger of Allah, this was among the spoils we took.” He said: “Did you hear Bilal call three times?” He said: “Yes.” He said: “What stopped you from bringing it?” The man apologized, and he said: “You will bring it on the Day of Resurrection; I will not accept it from you.” 2

Hanafis, per (As-Siyar al-Kabir), say: If someone misappropriates, then repents and brings it to the leader after dispersal, the leader may reject his claim, saying: “I don’t know your truthfulness; you bear the consequence until you deliver it to its rightful owners.” Or he may accept it, as the person holds the property and is legally trusted about its status. The fifth goes to those Allah specified, and the rest is like lost property. If he hopes to find the owners, the ruling is as stated; if not, he may give it to the poor or keep it in the treasury, noting its status. If the misappropriator repents but does not bring it to the leader, it is recommended to give it in charity if he cannot find the owners. Delivering it to the leader is preferred, as with lost property. The leader may give it in charity but must allocate the fifth to those Allah specified, as the person’s admission is valid.

1 The statement: “A man brought one or two sandal straps, etc.”: Scholars agree the misappropriator must return what he took to the distributor before the army disperses. They differed on what to do after dispersal. Some said: He gives the fifth to the leader and gives the rest in charity. This is the view of Al-Hasan, Malik, Al-Awza‘i, Al-Layth, Az-Zuhri, Ath-Thawri, Ahmad, Ibn Mas‘ud, Ibn Abbas, and Mu‘awiyah. Shafi‘i said: If he owns it, he need not give it in charity; if not, he cannot give away another’s property. It must be given to the leader like lost property.

2 The statement: “I will not accept it from you”: Because misappropriation was not confirmed, per Imam Muhammad in (As-Siyar al-Kabir).

وَعَنْ جُنَادَةَ بْنِ أَبِيُّ أُمَيَّةَ رضي الله عنه قَالَ: نَزَلْنا دَابِقَ وَعَلَيْنَا أَبُو عُبَيْدَةَ بنِ الْجَرَّاجِ،فَبَلَغَ حَبِيبَ بْنَ مَسْلَمَةَ أَنَّ صَاحِبَ قُبْرُسَ خَرَجَ يُرِيدُ طَرِيقَ أَذْرِبِيجانَ، وَمَعَهُ زُمُرُّدُّوَيَاقُوتُ وَلُؤْلُؤٌّ وَغَيْرُهَا فَخَرَجَ إِلَيْهِ فَقَتَلَهُ، وَجَاءَ بِمَا مَعَهُ، فَأَرَادَ أَبُو عُبَيْدَةً أَنْ يُخَمِّسَهُ،فَقَالَ حَبِيبُ بْنُ مَسْلَمَةَ : لا تَّحْرِمْنِي رِزْقًا رَزَقَنِيهِ اللَّهُ؛ فَإِنَّ رَسُولَ اللهِ صلي الله عليه واله وسلم جَعَلَالسَّلَبَ لِلْقَاتِلِ، فَقَالَ مُعَادٌ: يَا حَبِيبُ، إِنِّي سَمِعْتُ رَسُولَ اللَّهِ ، يَقُولُ: (إِنَّمَا١ لِلْمَرْءِمَا طَابَتْ بِهِ نَفْسُ إِمَامِهِ). رَوَاهُ الطَّبَرَانيُّ فِي مُعْجَمِهِ الْكَبِيْرِ وَالْوَسِطِ.هَذَا ٢ حَدِيْثُ حَسَنُّ لِتَعَدُّدِ طُرُقِهِ، وَقَدْ يَتَأَيَّدُ بِمَا أَخْرَجَهُ الْبُخَارِيُّ وَمُسْلِمُ عَنْعَبْدِ الرَّحْمَنِ بْنِ عَوْفٍ. قَالَ: إِنِّي لَوَاقِفٌ فِي الصَّفِّ يَوْمَ بَدْرٍ، فَنَظَرْتُ عَنْ يَمِينِي وَعَنْشِمَالِي، فَإِذَا أَنَا بِغُلَامَيْنِ مِنَ الْأَنْصَارِ، حَدِيثَةٍ، فَأَسْتَانُهُمَا تَمَنَّيْتُ أَنْ أَكُونَ بَيْنَ أَضْلَعَمِنْهُمَا، فَغَمَزَنِي أَحَدُهُمَا، فَقَالَ: يَا عَمَّ، هَلْ تَعْرِفُ أَبَا جَهْلٍ؟ قُلْتُ: نَعَمْ، مَا حَاجَتُكَ إِلَيْهِيَا ابْنَ أَخِيْ؟ قَالَ: أُخْبِرْتُ أَنَّهُ يَسُبُّ رَسُولَ اللهِ صلي الله عليه واله وسلم ، وَالَّذِي نَفْسِي بِيَدِهِ! لَئِنْ رَأَيْتُهُ لَايُفَارِقُ سَوَادِي سَوَادَهُ، حَتَّى يَمُوتَ الْأَعْجَلُ مِنَّا. فَقَالَ: فَتَعَجَّبْتُ لِذَلِكَ، قَالَ: فَغَمَزَنِيالْآخَرُ، فَقَالَ لِي مِثْلَهَا، قَلَمْ أَنْشَبْ أَنْ نَظَرْتُ إِلَى أَبِي جَهْلٍ يَجُولُ فِي النَّاسِ، فَقُلْتُ: أَلَاتَرَيَانِ هَذَا صَاحِبُكُمَا الَّذِي تَسْأَلَانِ عَنْهُ، قَالَ: فَابْتَدَرَاهُ بِسَيْفَيْهِمَا، فَضَرَبَاهُ حَقَّى قَتَلَاهُ،ثُمَّ انْصَرَفَا إِلَى رَسُولِ اللهِ صلي الله عليه واله وسلم ، فَأَخْبَرَاهُ. فَقَالَ:(أَيُّكُمَا قَتَلَهُ؟) فَقَالَ كُلُّ وَاحِدٍ مِنْهُمَاأَنَا قَتَلْتُهُ، فَقَالَ: مَسَحْتُمَا سَيْفَيْكُمَا؟ فَقَالَا : لَا ، فَنَظَرَ رَسُولُ اللهِ ﷺ إِلَى السَّيْفَيْنِ:فَقَالَ: (كِلَا كُمَا قَتَلَهُ).٣ وَقَضَى رَسُوْلِ اللّهِ صلي الله عليه واله وسلم بِسَلَبِهِ لِمُعَاذِ بْنِ عَمْرِو بْنِ الْجُمُوجِ.وَالرَّجُلَانِ: مُعَاذُ بْنُ عَمْرِو بْنِ الْجُمُوجِ وَمُعَاذُ بْنُ عَفْرَاءَ.

وَفِيْ رِوَايَةٍ لَهُمَا: (عَنْ أَنَسِ رضي الله عنه ، قَالَ: قَالَ رَسُوْلُ اللهِ صلي الله عليه واله وسلم يَوْمَ بَدْرٍ: (مَنْ يَنْظُرُ لَنَا مَاصَنَعَ أَبُو جَهْلٍ؟) فَانْطَلَقَ ابْنُ مَسْعُودٍ، فَوَجَدَهُ قَدْ ضَرَبَهُ ابْنَا عَفْرَاءَ حَتّى بَرَدَ، قَالَ: فَأَخَذَبِلِحْيَتِهِ، فَقَالَ: أَنْتَ أَبُو جَهْلٍ؟ فَقَالَ: وَهَلْ فَوْقَ رَجُلٍ قَتَلْتُمُوهُ؟.

وَفِي رِوَايَةٍ: قَالَ: فَلَوْ غَيْرُ أَكَّارٍ قَتَلَنِيْ. وَرَوَى الدَّارِميُّ عَنْهُ قَالَ: قَالَ رَسُوْلُ اللهِ صلي الله عليه واله وسلم يَوْمَئِذٍ يَعْنِيْ يَوْمَ حُنَيْنٍ: (مَنْ قَتَلَ كَافِرًا فَلَهُ سَلَبُهُ)فَقَتَلَ ٤ أَبُو طَلْحَةً يَوْمَئِذٍ عِشْرِينَ رَجُلًا وَأَخَذَ أَسْلَابَهُمْ.

Junadah ibn Abi Umayyah (may Allah be pleased with him) narrated: We camped at Dabiq under Abu Ubaidah ibn al-Jarrah. It reached Habib ibn Maslamah that the ruler of Cyprus was heading toward Azerbaijan’s route with emeralds, rubies, pearls, and more. Habib went out, killed him, and brought what he had. Abu Ubaidah wanted to take a fifth, but Habib ibn Maslamah said: “Do not deprive me of sustenance Allah granted me, for the Messenger of Allah (ﷺ) gave the spoils to the killer.” Mu‘adh said: “O Habib, I heard the Messenger of Allah (ﷺ) say: ‘A man gets only what his leader willingly gives.’” 1 [Narrated by At-Tabarani in Al-Mu‘jam al-Kabir and Al-Awsat]

This Hadith is hasan due to multiple narrations 2 and is supported by Bukhari and Muslim’s narration from Abdur-Rahman ibn Awf, who said: “I was standing in the ranks on the day of Badr and looked to my right and left, finding two young Ansari boys. I wished I were between stronger men. One nudged me and said: ‘Uncle, do you know Abu Jahl?’ I said: ‘Yes, what do you want with him, nephew?’ He said: ‘I heard he insults the Messenger of Allah (ﷺ). By the One in Whose Hand is my soul, if I see him, my shadow won’t leave his until one of us dies.’ I was amazed. The other nudged me, saying the same. Soon, I saw Abu Jahl moving among the people. I said: ‘Don’t you see? That’s the man you asked about.’ They rushed him with their swords, struck, and killed him, then went to the Messenger of Allah (ﷺ) and informed him. He said: ‘Which of you killed him?’ Each said: ‘I killed him.’ He said: ‘Have you wiped your swords?’ They said: ‘No.’ He looked at their swords and said: ‘Both of you killed him.’ 3 He awarded the spoils to Mu‘adh ibn Amr ibn al-Jumuh.” The two were Mu‘adh ibn Amr ibn al-Jumuh and Mu‘adh ibn Afra’.

In another narration by them: Anas (may Allah be pleased with him) said: On the day of Badr, the Messenger of Allah (ﷺ) said: “Who will check what Abu Jahl did?” Ibn Mas‘ud went and found that Afra’s two sons had struck him until he was lifeless. He took his beard and said: “Are you Abu Jahl?” He replied: “Is there anyone greater than the man you killed?” In another narration: “If only it wasn’t a farmer who killed me.” Ad-Darimi narrated from him: On that day, meaning Hunayn, the Messenger of Allah (ﷺ) said: “Whoever kills a disbeliever gets his spoils.” Abu Talhah killed twenty men 4 that day and took their spoils.

Then he said: If tanfil were permissible after acquiring the spoils, the Messenger of Allah (ﷺ) would not have prohibited it despite a genuine need. He further said: What is narrated that the Prophet (ﷺ) performed tanfil after securing the spoils is interpreted as him giving it from the fifth, considering the recipient as one of the needy, or giving it from his own share of the fifth, or from the selected spoils that were his, or giving what Allah Almighty bestowed upon him without exertion of horses or camels. The matter was delegated to the Messenger of Allah (ﷺ), as Allah Almighty said: Say, the spoils are for Allah and the Messenger [Al-Anfal: 1]. It is mentioned about Khalid ibn Walid (may Allah be pleased with him) and Awf ibn Malik (may Allah be pleased with him) that they did not take the fifth from the spoils. Habib ibn Maslamah and Mahkul said: The spoils are part of the booty, and the fifth applies to it. This was also narrated from Ibn Abbas (may Allah be pleased with him). We adopt their view based on the words of Allah Almighty: And know that anything you obtain of war booty [Al-Anfal: 41]. The spoils are part of the booty. The interpretation of what is narrated from Khalid and Awf is that it applies if the imam declares tanfil in advance by saying: "Whoever kills an enemy has his spoils." In our view, in this case, the spoils are not subject to the fifth. However, without tanfil, the fifth applies.

Abu Talhah killed twenty men that day and took their spoils. This clearly shows that the killing occurred after the statement, thus restricting the absolute.

1 The statement: "The woman only gets what her imam willingly gives her." The summary of what is in the explanation of As-Sir al-Kabir is that the term "anfal" in the terminology of jurists refers to what the imam allocates to some of the warriors, and this act is called tanfil, and that wealth is called nafl. There is no disagreement that tanfil is permissible before the spoils are acquired to encourage fighting, as it is an instructed act known as incitement, based on the words of Allah Almighty: O Prophet, urge the believers to fight [Al-Anfal: 65]. This address is to the Messenger of Allah (ﷺ) and to everyone who takes his place. Brave warriors rarely risk their lives if they are not singled out with something from the spoils. When the imam allocates something to them, it motivates them to risk their lives and confront the enemy’s onslaught. According to our view, the killer does not deserve the spoils without the imam’s tanfil. According to Shafi’i, whoever kills a polytheist in single combat, while advancing and not retreating, deserves his spoils, even without prior tanfil from the imam, because the statement of the Messenger of Allah (ﷺ): "Whoever kills an enemy has his spoils" establishes a legal ruling. Such a statement from the lawgiver clarifies the cause, like his saying (ﷺ): "Whoever changes his religion, kill him." However, we say: Even if the Messenger of Allah (ﷺ) said this in Madinah in the presence of his companions, it was not reported except after the need for incitement arose. Malik ibn Anas (may Allah be pleased with him) said: "It has not reached us that the Prophet (ﷺ) said in any of his battles: 'Whoever kills an enemy has his spoils,' except on the Day of Hunayn, and that was after the Muslims were defeated and there was a need to incite them to charge, as Allah Almighty said: Then you turned back, fleeing [At-Tawbah: 25]." Muhammad ibn Ibrahim at-Taymi mentioned that he said it on the Day of Badr and Hunayn as well. The need for incitement on the Day of Badr was evident, so we understand that he said it as a form of tanfil for incitement, not as a general legal ruling. This is supported by what Abdullah ibn Shaddad reported: The Prophet (ﷺ) was besieging and distributing villages. A man came to him and asked about the spoils. He said: "For Allah Almighty is a share, and for these four." The man said: "What about the spoil a man takes?" He said: "If you are struck in your side with an arrow, you are no more entitled to it than your Muslim brother." This is clear evidence that the killer is not entitled to the spoils without tanfil. This is agreed upon by the scholars of Iraq and Hijaz. Abu Hanifah (may Allah be pleased with him) said: "There is no tanfil after securing the spoils." This is the view of the scholars of Iraq and Hijaz, while the scholars of Sham permit tanfil after securing the spoils, and among those who held this view is Al-Awza’i. Our view invalidates their opinion because tanfil is for inciting fighting, which occurs before acquiring the spoils, not after. Tanfil is to establish exclusive allocation initially, not to nullify an established right of the warriors or the right to the fifth for its recipients. Tanfil after acquiring the spoils nullifies an established right. Then, he cited the hadith of Al-Hasan regarding the rein, that a man asked the Messenger of Allah (ﷺ) for a rein of hair from the spoils, and he said: "Woe to you, you have asked me for a rein of fire," [the rest of the hadith]. And by the hadith of Mujahid, that a man came to the Messenger of Allah (ﷺ) with a tuft of hair from the spoils and said: "Grant me this." He said: "As for my share of it, it is yours." And by the hadith of Abu al-Ash’ath as-San’ani, who said: A man came to the Prophet (ﷺ) with a rein of hair [the rest of the hadith].

2 The statement: "This is a good hadith due to its multiple narrations." It is mentioned in Al-Fath that the hadith is weak, but its weakness does not harm it, as we take it as supporting evidence for one of the possible interpretations of the hadith about spoils, namely the saying of the Prophet (ﷺ): "Whoever kills an enemy has his spoils," by interpreting it as tanfil. Not every weak hadith is false, and when weak hadiths have multiple chains, they can rise to the level of hasan, making it likely that it refers to tanfil. The full verification of this matter is in Radd al-Muhtar.

3 The statement: "He said: Both of you killed him, then he awarded the spoils to Mu’adh ibn Amr ibn al-Jamuh." The evidence is that if the spoils belonged to the killer, they would have been divided between them. The fact that he (ﷺ) gave it to one of them indicates that the matter is delegated to the imam. 4 The statement: "Abu Talhah killed..." In Al-Marqah, it is said: Ibn al-Malik said: Shafi’i used the hadith of Abu Qatadah to argue that the spoils belong to the killer. Abu Hanifah (may Allah be pleased with him) said: The spoils do not belong to the killer unless the imam grants tanfil. The hadith is interpreted as tanfil to reconcile it with another hadith: "You have no right to the spoils of your killed enemy except what your imam willingly gives." Al-Taybi said in Sharh al-Mishkat: Shafi’i is supported by the hadith of Awf ibn Malik in the second section, as it is absolute, and the default is the absence of restriction. I say: There is no doubt that he (ﷺ) said it in the hadith of Abu Qatadah after the battle, but it is possible that it was a reiteration of what he said before. As for the hadith of Awf, it awards the spoils to the killer with restriction. As for the hadith of Anas in the second section, narrated by Ad-Darimi, he said: The Messenger of Allah (ﷺ) said on that day, meaning the Day of Hunayn: "Whoever kills a disbeliever has his spoils."

ثم قال: ولو جاز التنفيل بعد الإصابة لما حرمه رسول الله صلي الله عليه واله وسلم ذلك مع صدق حاجة، ثم قال: والذي روي أنالنبي صلي الله عليه واله وسلم نفل بعد الإحراز، فإنما يحمل على أنه أعطى ذلك من الخمس باعتبار أنه من المساكين، أو أعطى ذلك منسهم نفسه من الخمس أو من الصفى الذي كان له أو أعطى ذلك ما أفاء الله تعالى عليه لا بإيجاف الخيل والركاب. فقدكان الأمر فيها مفوَّضًا إلى رسول الله صلي الله عليه واله وسلم كما قال الله تعالى: ﴿قُلِ الْأَنْقَالُ لِلْهِ وَالرَّسُولِ﴾ (الأنفال: ١)، وذكر عنالخالد بن وليد وعوف بن مالكأنهما كان لا يخمسان الأسلاب، وعن حبيب بن مسلمة ومحكول: أن السلبمغنم، وفيه الخمس، وهكذا روي عن ابن عباس، وإنما نأخذ بقول هؤلاء؛ لقوله تعالى: ﴿وَأَعْلَمُوَاْ أَنَّمَا غَنِمْتُم مِّنشَىْءٍ﴾ (الأنفال: ٤١) والسلب من الغنيمة. وتأويل ما نقل عن خالد وعوف إذا تقدم التنفيل من الإمام بقوله: (منقتل قتيلا فله سلبه). وعندنا في هذا الموضع لا يخمس السلب، وأما بدون التنفيل يخمس، انتهى ملخصا.

٢ قوله: هذا حديث حسن لتعدد طرقه: وذكر في (الفتح): أن الحديث ضعيف، ولا يضر ضعفه؛ لأنا نستأنس بهلأحد محتملي حديث السلب أي قوله صلي الله عليه واله وسلم : (من قتل قتيلا فله سلبه) بحمله على التنفيل، وليس كل ضعيف باطلاوقد تظافرت أحاديث ضعيفة تفيدأن حديث السلب ليس نصبا عاما مستمرا، والضعيف إذا تعددت طرقهيرتقي إلى الحسن، فيغلب الظن بأنه تنفيل، وتمام تحقيق المقام فيه. كذا في (رد المحتار).

٣ قوله: فقال: كلاكما قتله ثم قضى بسلبه لمعاذ بن عمرو بن الجموح: وجه الدليل: أن السلب لو كان للقاتل لقضيبه بينهما، وكونه عليه السلام دفعه إلى أحدهما دليل على أن الأمر فيه مُفوَّض إلى الإمام. كذا في (نصب الراية).

٤ قوله: فقتل أبو طلحة إلخ: قال في (المرقاة): قال ابن الملك: استدل الشافعي بحديث أبي قتادة على أن السلبللقاتل. وقال أبو حنيفة: السلب لا يكون للقاتل إذا لم ينفل الإمام به، والحديث محمول على التنفيل جمعًا بينه، وبينحديث آخر(ليس لك من سلب قتيلك إلا ما طابت به نفس إمامك). وقال الطيبي في (شرح المشكاة): ويؤيدالشافعي حديث عوف بن مالك في الفصل الثاني؛ لأنه مطلق، والأصل عدم التقييد. قلت: لا شك أنه صلي الله عليه واله وسلم قاله فيحديث أبي قتادة بعد الفراغ، لكنه يحتمل أن يكون إعادة لما قاله قبله، وأما حديث عوف قضى في السلب للقاتي فقاتلللتقييد، وأما حديث أنس في الفصل الثاني، رواه الدارمي قال: قال رسول الله صلي الله عليه واله وسلم يومئذ يعني يوم حنين: (من قتلكافرًا فله سلبه)، فقتل أبو طلحة يومئذٍ عشرين رجلًا، وأخذ أسلابهم، فصريح في أن القتل وقع بعد القول، فيقيدالمطلق به.

وَعَنْ مُجَمِّعِ بْنِ جَارِيَةً رضي الله عنه قَالَ: قُسِمَتْ خَيْبَرُ عَلَى أَهْلِ الْحَدَيْبِيَةِ فَقَسَمَهَارَسُولُ اللهِ صلي الله عليه واله وسلم عَلَى ثَمَانِيَةَ عَشَرَ سَهْمًا، وَكَانَ الْجَيْشُ أَلْفًا وَخَمْسَ مِائَةٍ، فِيهِمْ ثَلَاثُ مِائَةِفَارِسِ، فَأَعْطَى١ الْفَارِسَ سَهْمَيْنِ وَالرَّاجِلَ سَهْمًا. رَوَاهُ أَبُوْ دَاوُدَ.

وَقَالَ ٢ الْحَافِظُ شَمْسُ الدِّيْنِ الذَّهَبِيُّ فِي تَلْخِيْصِهِ بَعْدَ التَّخْرِيْجِ: الْحَدِيْثُ صَحِيْحُ.

وَقَالَ فِي (الْجُوْهَرِ النّقِيَّ): هَذَا الْحَدِيْثُ أَخْرَجَهُ الْحَاكِمُ فِي (الْمُسْتَدْرَكِ)، وَقَالَ:حَدِيْثٌ كَبِيْرٌ صَحِيْحُ الْإِسْنَادِ، وَفِيْهِ مُجَمَّعُ بْنُ يَعْقُوْبَ، وَهُوَ مَعْرُوْفٌّ، قَالَ صَاحِبُ (الْكَمَالِ): رَوَى عَنْهُ الْقَعْنَبِيُّ وَيَحْيى الْوَعَاظِيُّ وَإِسْمَاعِيْلُ بْنُ أَبِي أُوَيسٍ وَيُؤْنسُ الْمُؤَدِّبُوَأَبُوْ عَامِرٍ الْمُعقدِيُّ وَغَيْرُهُمْ. وَقَالَ ابْنُ سَعْدٍ: تُوُفِّيَ بِالْمَدِيْنَةِ، وَكَانَ ثِقَةً، وَقَالَ أُبُوْ حَاتِمٍوَابْنُ مَعِيْنٍ: لَيْسَ بِهِ بَأْسُّ. وَرَوَى لَهُ النَّسَائِيُّ وَمَعْلُوْمٌ أَنَّ ابْنَ مَعِيْنٍ إِذَا قَالَ:(لَيْسَ بِهِبَأْسٌ) فَهُوَ تَوْثِيْقُ.

وَرَوَى ابْنُ أَبِيِّ شَيْبَةَ عَنْ نُعَيْمِ بْنِ حَمَّادٍ حَدَّثَنَا ابْنُ الْمُبَارَكِ عَنْ عُبَيْدِ اللهِ بْنِ عُمَرَ رضي الله عنهما عَنِ النَّبِيِّ ﷺ أَنَّهُ أَسْهَمَ لِلْفَارِسِ سَهْمَيْنِ وَلِلرَّاجِلِ سَهْمًاوَقَالَ الشَّيْخُ ابْنُالْهُمَاءِ: وَلَا شَكَّ أَنَّ نُعَيْمًا ثِقَةٌّ وَابْنُ الْمُبَارَكِ مِنْ أَثْبَتِالنَّاسِ.

English

Mujammi‘ ibn Jariyah (may Allah be pleased with him) narrated: Khaybar was divided among the people of Hudaybiyyah. The Messenger of Allah (ﷺ) divided it into eighteen shares, with the army consisting of one thousand five hundred men, including three hundred horsemen. 1 He gave the horseman two shares and the foot soldier one share. [Narrated by Abu Dawud]

Al-Hafiz Shams ad-Din adh-Dhahabi said 2 in his summary after verification: “The Hadith is authentic.” In (Al-Jawhar an-Naqi): This Hadith was reported by Al-Hakim in (Al-Mustadrak), and he said: “A significant Hadith with an authentic chain.” It includes Mujammi‘ ibn Ya‘qub, who is well-known. The author of (Al-Kamal) said: He was narrated from by Al-Qa‘nabi, Yahya al-Wa‘azi, Isma‘il ibn Abi Uways, Yunus al-Mu’addib, Abu ‘Amir al-Mu‘qadi, and others. Ibn Sa‘d said: He died in Madinah and was trustworthy. Abu Hatim and Ibn Ma‘in said: “There is no harm in him.” An-Nasa’i narrated from him. It is known that when Ibn Ma‘in says, “There is no harm in him,” it is a confirmation of trustworthiness. Ibn Abi Shaybah narrated from Nu‘aym ibn Hammad, who narrated from Ibn al-Mubarak, from Ubaydullah ibn Umar (may Allah be pleased with them both), that the Prophet (ﷺ) gave the horseman two shares and the foot soldier one share. Shaykh Ibn al-Humam said: There is no doubt that Nu‘aym is trustworthy, and Ibn al-Mubarak is among the most reliable people.

1 The statement: “He gave the horseman two shares and the foot soldier one share”: Scholars differed on the entitlement of fighters, whether foot soldiers or horsemen. A foot soldier receives one share by consensus. For a horseman, Abu Hanifah and Zufar say he and his horse get two shares. Abu Yusuf and Muhammad say he gets three shares, one for himself and two for his horse, this being the view of Shafi‘i, Malik, and Ahmad. The majority cite the Hadith of Ibn Umar and similar narrations. Abu Hanifah relies on this Hadith of Mujammi‘ ibn Jariyah. As for Ibn Umar’s Hadith, it does not specify when that division occurred, before or after Khaybar. If before, it could be abrogated; if it was discretionary, the Prophet (ﷺ) could divide as he wished, or it could be tanfil (extra allocation), so it is not conclusive. For further details, refer to (Badhl al-Majhud), which is valuable in this context.

English

Yazid ibn Hurmuz narrated: Najdah al-Haruri wrote to Ibn Abbas asking about slaves and women who attend the spoils, do they receive a share? Ibn Abbas told Yazid: Write to him: “They do not receive a share unless they are given a discretionary portion (radkh).” 1 In another narration: Ibn Abbas wrote: “You asked whether the Messenger of Allah (ﷺ) took women to battle and gave them a share. He did take them to battle; they treated the wounded and were given a discretionary portion from the spoils, but not a fixed share.” [Narrated by Muslim]

1 The statement: “They do not receive a share unless they are given a discretionary portion”: Ibn al-Humam said: No share is given to a slave, woman, child, or dhimmi, but they may receive a discretionary portion (radkh), which is less than a share, as determined by the leader. This applies whether the slave fights with or without his master’s permission. Per Hanafis, radkh is taken from the spoils before the fifth, as per Shafi‘i and Ahmad. In another view, narrated from Ahmad, it is from four-fifths. Shafi‘i, in one view, says from one-fifth of the fifth. Malik says from the fifth. A slave receives radkh only if he fights, as do a child or dhimmi, as they are capable of fighting if the child is able. For women, they receive it for fighting or serving the army, even without fighting, as they are incapable of it, so service substitutes. As stated in (Al-Mirqat).

English

Umayr, the freed slave of Abi al-Lahm (may Allah be pleased with him), narrated: I attended Khaybar with my masters. They spoke to the Messenger of Allah (ﷺ) about me, mentioning that I was a slave. He ordered a sword be given to me, but I was dragging it. He then ordered some miscellaneous items from the spoils be given to me. I presented a ruqyah I used for the insane, and he ordered me to discard some of it and keep some. [Narrated by Tirmidhi and Abu Dawud, though Abu Dawud’s narration ends at “miscellaneous items”]

1 The statement: “We ate without taking them for division”: In (Ad-Durr al-Mukhtar) and (Radd al-Muhtar): Fighters may use fodder, food, firewood, weapons, and oil in the land of war without division, as per (Al-Kanz). (Al-Wiqayah) restricts weapons to need, which is correct. In (Ad-Durr al-Muntaqa): (Fath al-Qadir) states using weapons, mounts, or horses is permissible only if needed, e.g., if one’s horse dies or sword breaks. Using them to preserve one’s own is impermissible and sinful, but no compensation is owed if damaged. For food and similar items, (As-Siyar as-Saghir) requires need, which is analogy-based, but (As-Siyar al-Kabir) does not, which is istihsan (preferred), as do the three Imams. Both rich and poor may partake. As in (Ash-Sharnablaliyyah). Istihsan is preferred here, as chosen by the author of (Al-Multaqa), and is correct.

١قوله: فنأكله ولا نرفعه: قال في (الدر المختار) و(رد المحتار): وللغانمين الانتفاع في دار الحرب وبعلف وطعاموحطب وسلاح ودهن بلا قسمة، أطلق الكل تبعا لـ(الكنز). وقيد في (الوقاية) السلاح بالحاجة، وهو الحق. قال في (الدر المنتقى): اعلم أنه ذكر في (فتح القدير) أن استعمال السلاح والكراع والفرس إنما يجوز بشرط الحاجة بأن ماتفرسه أو انكسر سيفه، أما إذا أراد أن يوفر سيفه باستعمال ذلك، فلا يجوز، ولو فعل أثم ولا ضمان عليه إن تلف، وأماغير السلاح ونحوه مما مرَّ كالطعام، فشرط في (السير الصغير) الحاجة إلى التناول من ذلك، وهو القياس، ولميشترطها في (السير الكبير) وهو الاستحسان، وبه قالت الأئمة الثلاثة، فيجوز لكل من الغني والفقير تناوله. ملخصا، وهكذا ذكره في (الشرنبلالية). ولا يخفى ترجيحالاستحسان ههنا. قلت: هو ما اختاره الماتن، يعني صاحب (الملتقى) وهو الحق كما علمت اهـ.

وَعَنْهُ أَنَّ جَيْشًا غَنِمُوا فِي زَمَنِ رَسُولِ اللَّهِ ﷺ طَعَامًا وَعَسَلًا، فَلَمْيُؤْخَذْ مِنْهُمْ الْخُمُسُ.١ رَوَاهُ أَبُوْ دَاوُدَ.

English

Ibn Umar (may Allah be pleased with them both) narrated: An army in the time of the Messenger of Allah (ﷺ) acquired food and honey, 1 and the fifth was not taken from what they ate. [Narrated by Abu Dawud]

In (Al-Hidayah): There is no harm in the army using fodder, eating found food, using firewood, oil for anointing, or weapons for fighting in the land of war without division if needed. They may not sell or accumulate wealth from it. Using clothes or items without need before division is disliked.

Al-Qasim, freed slave of Abdur-Rahman, narrated from a Companion of the Prophet (ﷺ): We ate fresh dates during campaigns without dividing them, 1 until we returned to our abodes with full loads from them. [Narrated by Abu Dawud]

Ibn al-Humam said: When Muslims leave the land of war, they may not use or eat from the spoils, as the necessity has ended. The permissibility in the land of war was due to need. After securing, rights are confirmed, unlike before removal. Excess food or fodder must be returned to the spoils if undivided in the land of war per conditions. If used after securing but before division, its value is repaid. This is the view of Malik, Ahmad, and Shafi‘i in one opinion. Another view from Shafi‘i likens it to a scout who takes something and keeps it. We say: Spoils are tied to the fighters’ rights, and exclusivity was for need, which has ended, unlike a scout, whose right persists. After division, the rich give it or its value in charity if sold; the poor may use it, as it becomes like lost property due to the impossibility of returning it to dispersed fighters. If consumed, nothing is owed. The value of what was used after securing is given in charity by the rich, not the poor. As in (Al-Mirqat).

Ruwayfi‘ ibn Thabit (may Allah be pleased with him) narrated: The Prophet (ﷺ) said: “Whoever believes in Allah and the Last Day should not ride an animal from the Muslims’ spoils 3 and return it after wearing it out, nor wear a garment from the Muslims’ spoils and return it after wearing it out.” [Narrated by Abu Dawud]

وَعَنْ أَبِي مُوْسَى الْأَشْعَرِيِّ رضي الله عنه قَالَ: قَدِمْنَا فَوَافَقْنَا رَسُولَ اللّهِ صلي الله عليه واله وسلم حِينَافْتَتَحَ خَيْبَرَ، فَأَسْهَمَ لنَا، أَوْ قَالَ: فَأَعْطَانا مِنْهَا، وَمَا قَسَمَ لِأَحَدٍ غَابَ عَنْ فَتْجِ خَيْبَرَ مِنْهَاشَيْئًا إِلَّا لِمَنْ شَهِدَ مَعَهُ إِلَّا أَصْحَابَ سَفِينَتِنَا جَعْفَرُ وَأَصْحَابُهُ، فَأَسْهَمَ لَهُمْ مَعَهُمْ. رَوَاهُأَبُوْ دَاوُدَ، وَقَالَ الْقَاضِيْ: وَإِنَّمَا ٢ أَسْهَمَ لَهُمْ؛ لِأَنَّهُمْ وَرَدُوْا عَلَيْهِ قَبْلَ حِيَازَةِ الْغَنِيْمَةِ.

Abu Musa al-Ash‘ari (may Allah be pleased with him) narrated: We arrived and met the Messenger of Allah (ﷺ) when he conquered Khaybar. He gave us shares, or said: gave us from it. He did not give anything to anyone absent from Khaybar’s conquest except those with him and the people of our ship, Ja‘far and his companions, for whom he gave shares. [Narrated by Abu Dawud]

The Qadi said: 2 He gave them shares because they arrived before the spoils were secured.

As for the allocation of shares to Abu Musa al-Ash‘ari, as narrated in [Narrated by Bukhari and Muslim], he said: We heard of the departure of the Messenger of Allah (ﷺ) while we were in Yemen. So, I set out with two brothers of mine, migrating to him, with me being the youngest. One was Abu Burda, and the other was Abu Ruhm, along with fifty-some men from my people. We boarded a ship, which took us to the Negus, where we met Ja‘far ibn Abi Talib (may Allah be pleased with him) and his companions. Ja‘far said: The Messenger of Allah (ﷺ) sent us here and ordered us to stay, so stay with us. We stayed until we came to the Messenger of Allah (ﷺ) when he conquered Khaybar. He allocated shares for us, but he did not allocate shares for anyone who was absent from the conquest of Khaybar except for the people of our ship. Ibn Hibban said in his Sahih: He gave them from the fifth of the fifth to win their hearts, not from the spoils, and this is sound. Do you not see that he did not give to others who did not witness it? Some Shafi‘is interpreted this as them having witnessed it before the spoils were taken, contrary to their school, as they make no distinction in the lack of entitlement whether the arrival was before or after taking the spoils, as long as it was after the conquest. In summary: According to us, the cause is crossing the boundary between the abode of Islam and the abode of war with the intention of fighting. According to Shafi‘i, it is witnessing the battle. Thus, according to us, those who acquire the spoils and the reinforcements share in the spoils because they are equal in this cause. This is taken from the commentaries of (The Kanz).

2 The statement: "He only allocated shares for them, etc.": It is stated in (Mercy of the Ummah): They agreed that if the spoils were divided and taken possession of, and then reinforcements arrived, the reinforcements would have no share in it. However, if the reinforcements arrived after the battle ended but before the spoils were taken to the abode of Islam or before they were divided, Abu Hanifa said: They are entitled to a share as long as the spoils have not been taken to the abode of Islam or divided. Malik and Ahmad said: They are not entitled to a share in any case. As for Shafi‘i, there are two opinions: one that they are entitled to a share, and the other that they are not. Ibn al-Humam said: If reinforcements join in the abode of war before the spoils are taken to the abode of Islam, according to Shafi‘i, there are two opinions about whether the reinforcements share in the spoils. What we mentioned is based on the premise that ownership is not complete for those who acquired the spoils until they are taken to the abode of Islam. Thus, it is permissible for the reinforcements to share in them if there is evidence for it. The right of the reinforcements is not cut off except by three things: taking the spoils to the abode of Islam, dividing them in the abode of war, or the leader selling the spoils before the reinforcements arrive. This is based on our established principle that confirms or negates the right. As for what Shafi‘i cited as evidence from [Narrated by Bukhari] from Abu Huraira (may Allah be pleased with him), who said: The Messenger of Allah (ﷺ) sent Aban on an expedition toward Najd. Aban and his companions arrived at Khaybar after the Messenger of Allah (ﷺ) had conquered it, and he did not allocate shares for them. There is no evidence in this, because the arrival of reinforcements in the abode of Islam does not necessitate their participation, and Khaybar became an abode of Islam immediately upon its conquest. Thus, their arrival occurred when the spoils were already in the abode of Islam.

وأما إسهامه لأبي موسى الأشعري على ما في (الصحيحين) عنه، قال: بلغنا مخرج رسول الله صلي الله عليه واله وسلم ونحنباليمن، فخرجنا مهاجرين إليه أنا وأخوان لي أنا أصغرهم، أحدهما: أبو بردة، والآخر: أبو رهم في بضع وخمسينرجلًاً من قومي، فركبنا سفينة، فألقتنا إلى النجاشي، فوافينا جعفر بن أبي طالب وأصحابه عنده، فقال جعفر: إنرسول الله صلي الله عليه واله وسلم بعثنا ههنا وأمرنا بالإقامة فأقيموا معنا، فأقمنا حتى قدمنا، فعافينا رسول الله صلي الله عليه واله وسلم حين افتتح خيبر،فأسهم لنا ولم يسهم لاحد غاب عن فتح خيبر إلا أصحاب سفينتنا، فقال ابن حبان في صحيحه: إنما أعطاهم منخمس الخمس؛ ليستميل قلوبهم لا من الغنيمة، وهو حسن.

ألا ترى أنه لم يعط غيرهم ممن لم يشهدها وحمل بعض الشافعية على أنهم شهدوا قبل حوز الغنائم خلافمذهبهم؛ فإنه لا فرق عندهم في عدم الاستحقاق بين كون الوصول قبل الحوز أو بعده بعد كونه بعد الفتح. حاصله:أن السبب عندنا هو مجاوزة الدرب الفاصل بين دار الإسلام ودار الحرب على قصد القتال. وعند الشافعي شهودالوقعة، فالغانمون والمدد هما يشتركان عندنا في الغنيمة؛ لاستوائهما في هذا السبب. أخذته من شروح (الكنز).

وَعَنِ ابْنِ عُمَرَ رضى الله عنهما أَنَّ رَسُوْلَ اللهِ صلي الله عليه واله وسلم قَامَ يَعْنِي يَوْمَ بَدْرٍ فَقَالَ: (إِنَّعُثْمَانَ انْظَلَقَ فِي حَاجَةِ اللهِ وَحَاجَةٍ رَسُولِهِ، وَإِّني لَأُبَايِعُ لَهُ) فَضَرَبَ١ لَهُ رَسُولُ اللهِ صلي الله عليه واله وسلم بِسَهْمٍ وَلَمْ يَضْرِبْ لِأَحَدٍ غَابَ غَيْرُهُ. رَوَاهُ أَبُوْ دَاوُدَ.

Ibn Umar (may Allah be pleased with them both) narrated: On the day of Badr, the Messenger of Allah (ﷺ) stood and said: “Uthman left for Allah’s and His Messenger’s need, and I pledge for him.” 1 The Messenger of Allah (ﷺ) gave him a share, and no one else absent received one. At-Tahawi said: Likewise, anyone absent from a battle due to a task assigned by the leader, like fighting elsewhere or fetching weapons or men from the land of Islam, shares in the spoils as if present, even if they do not return until after the spoils are taken. Similarly, one intending to join but assigned another task by the leader shares as if present. Abu Hurayrah’s Hadith suggests Aban was sent to Najd before Khaybar’s preparations, so his absence was not a task assigned to miss Khaybar, unlike one intending to join but reassigned.

١ قوله: فضرب له رسول الله صلي الله عليه واله وسلم بسهم: قد استدل أبو حنيفة بإسهامه صلي الله عليه واله وسلم لعثمان يوم بدر على أنه يسهم الإماملمن كان غائبًا في حاجة له بعثه لقضائها. أخذته من (نيل الأوطار). وقال الطحاوي: وكذلك كل من غاب عن وقعةالمسلمين بأهل الحرب بشغل يشغله به الإمام من أمور المسلمين مثل أن يبعثه إلى جانب آخر من دار الحرب لقتالقوم آخرين، فيصيب الإمام غنيمة بعد مفارقة ذلك الرجل إياه، أو يبعث برجل ممن معه من دار الحرب إلى دارالإسلام؛ ليمده بالسلاح والرجال، فلا يعود ذلك الرجل إلى الإمام حتى يغنم غنيمة، فهو شريك فيها،وهو كمن حضرها، وكذلك من أرادها فرده الإمام عنها، وشغله بشيء من أمور المسلمين فهو شريك فيها، وهو كمن حضرها واما حديث ابي هريرة فانما ذلك عندنا -والله اعلم – ان النبي صلي الله عليه واله وسلم وجه ابانا الي نجد قبل ان يتهيأ خرجه إلى خيبر، فتوجه أبان في ذلك، ثم حدث من خروج النبي صلي الله عليه واله وسلم إلى خيبر ما حدث، فكان ما غاب فيه أبانمن ذلك عن حضور خيبر ليس هو شغلا شغله النبي صلي الله عليه واله وسلم به عن حضورها بعد إرادته إياه، فيكون كمن حضرها.

وَعَنْ سَلَمَةَ بْنِ الْأَكْوَعِ رضى الله عنه ، قَالَ: بَعَثَ رَسُولُ اللهِ صلي الله عليه واله وسلم بِظَهْرِهِ مَعَ رَبَاحِغُلَامِ رَسُولِ اللهِ صلي الله عليه واله وسلم وَأَنَا مَعَهُ، فَلَمَّا أَصْبَحْنَا إِذَا عَبْدُ الرَّحْمَنِ الْفَزَارِيُّ قَدْ أَغَارَ عَلَىظَهْرِ رَسُولِ اللهِ ﷺ، قُمْتُ عَلَى أَكَمَةٍ فَاسْتَقْبَلْتُ الْمَدِينَةَ، فَنَادَيْتُ ثَلَاثًا: يَا صَبَاحَاهُ، ثُمَّخَرَجْتُ فِي آثَارِ الْقَوْمِ أَرْمِيهِمْ بِالتَبْلِ، وَأَرْتَجِزُ أَقُولُ:

أَنَا ابْنُ الْأَكْوَعِ وَالْيَوْمُ يَوْمُ الرُّضَّعِ.

فَمَا زِلْتُ أَرْمِيهِمْ وَأَعْقِرُ بِهِمْ، حَتَّى مَا خَلَقَ اللهُ مِنْ بَعِيرٍ مِنْ ظَهْرٍ رَسُولِ اللّهِ صلي الله عليه واله وسلم إِلَّاخَلَّفْتُهُ وَرَاءَ َظَهْرِيٍ، ثُمَّ اتَّبَعْتُهُمْ أَرْمِيهِمْ، حَقَّى أَلْقَوْا أَكْثَرَ مِنْ ثَلَاثِينَ بُرْدَةً وَثَلَاثِينَ رُمحَايَسْتَخِفُونَ، وَلَا يَطْرَحُونَ شَيْئًا إِلَّا جَعَلْتُ عَلَيْهِ آَرَامًا مِنَ الْحِجَارَةِ يَعْرِفُهَا رَسُولُ اللهِ صلي الله عليه واله وسلم وَأَصْحَابُهُ، حَتَّى رَأَيْتُ فَوَارِسَ رَسُولِ اللهِ صلي الله عليه واله وسلم ، وَلَحِقَ أَبُو قَتَادَةً فَارِسُ رَسُولِ اللهِ صلي الله عليه واله وسلم بِعَبْدِالرَّحْمَنِ فَقَتَلَهُ، قَالَ رَسُوْلُ اللّهِ صلي الله عليه واله وسلم : (خَيْرُ فُرْسَانِنَا الْيَوْمَ أَبُو قَتَادَةَ، وَخَيْرُ رَجَّالَتِنَا سَلَمَةُ).قَالَ: ثُمَّ أَعْطَانِي ١ رَسُوْلُ اللهِ صلي الله عليه واله وسلم سَهْمَيْنٍ سَهْمَ الْفَارِسِ وَسَهْمَ الرَّاجِلِ، فَجَمَعَهُمَا لِي جَمِيعًا،ثُمَّ أَرْدَفَنِي رَسُولُ اللهِ صلي الله عليه واله وسلم وَرَاءَهُ عَلَى الْعضْبَاءِ رَاجِعِينَ إِلَى الْمَدِينَةِ. رَوَاهُ مُسْلِمٌ.

وَرَوَاهُ ابْنُ حِبَّانَ، وَقَالَ: كَانَ سَلَمَةُ بْنُ الْأَكْوَعِ فِي تِلْكَ الْغُزَاةِ رَاجِلًا، فَأَعْطَاهُ مِنْخُمْسِهِ عليه السلام لَا مِنْ سِهَامِ الْمُسْلِمِيْنَ.

English

Salamah ibn al-Akwa‘ (may Allah be pleased with him) narrated: The Messenger of Allah (ﷺ) sent his camels with Rabah, his slave, and I was with him. At dawn, Abdur-Rahman al-Fazari raided the camels. I stood on a hill, faced Madinah, and shouted three times: “Ya Sabahah!” I pursued the raiders, shooting arrows and reciting: “I am Ibn al-Akwa‘, today is the day of infants.” I kept shooting and hamstrung their camels, recovering all the Prophet’s camels. They dropped over thirty cloaks and thirty spears to lighten their load. I marked each with stones for the Messenger of Allah (ﷺ) and his Companions to recognize. The Prophet’s horsemen arrived, and Abu Qatadah, his horseman, caught and killed Abdur-Rahman. The Messenger of Allah (ﷺ) said: “Our best horseman today is Abu Qatadah, and our best foot soldier is Salamah.” 1 He gave me two shares, a horseman’s and a foot soldier’s, combined for me. Then he let me ride behind him on Al-Adhba’ returning to Madinah. [Narrated by Muslim]

Ibn Hibban narrated: Salamah was a foot soldier in that campaign, and he was given from the Prophet’s fifth, not the Muslims’ shares.

1 The statement: “He gave me two shares, a horseman’s and a foot soldier’s”: He gave me a horseman’s share alongside a foot soldier’s because most of the spoils’ recovery was due to Salamah. The leader may give extra from the fifth, not the Muslims’ shares, to one who exerts great effort. He did not give all due to no prior tanfil before the battle. Post-battle tanfil is from the fifth, as detailed by As-Sarakhsi. As in (Al-Mirqat), (Fath al-Qadir), and (Radd al-Mukhtar).

English

Abu al-Juwayriyah al-Jarmi narrated: In the land of the Romans, during Mu‘awiyah’s leadership, I found a red jar containing dinars. Our commander was a Companion of the Messenger of Allah (ﷺ) from Banu Sulaym, named Ma‘n ibn Yazid. I brought it to him, and he divided it among the Muslims, giving me the same as each man. Then he said: “Had I not heard the Messenger of Allah (ﷺ) say, ‘No tanfil except after the fifth,’ I would have given you more.” [Narrated by Abu Dawud]

They differ on its source: some say from the fifth for the Muslim treasury (Malik’s view); others say from one-fifth of the fifth, the leader’s share (Shafi‘i’s choice); others say from the total spoils (Ahmad’s view). In (Fath al-Qadir): Per Hanafis, tanfil is from the four-fifths before securing in the land of Islam; after securing, it is only from the fifth. If fighting occurs in the land of Islam due to an enemy attack, tanfil is only from the fifth, as spoils are secured upon capture.

English

Ibn Umar (may Allah be pleased with them both) narrated: The Messenger of Allah (ﷺ) 2 would give tanfil to some he sent on expeditions, exclusively for them, beyond the army’s general division. [Narrated by Bukhari and Muslim]

وَقَالَ الْعَلَّامَةُ الْعَيْنِيُّ: سَقَطَ الصَّفْيُّ فَلَا يَصْطَفِيُّ الْإِمَامُ لِنَفْسِهِ شَيْئًا مِنَ الْغَنِيْمَةِ،وَهَذَا مُجْمَعُ عَلَيْهِ.

English

Ibn Abbas (may Allah be pleased with them both) narrated: The Prophet (ﷺ) took his sword, Dhu al-Faqar, as tanfil on the day of Badr. [Narrated by Ibn Majah] Tirmidhi added: It was the sword he saw in his dream on the day of Uhud.

Al-‘Ayni said: The safiyy (leader’s chosen portion) was abrogated, so the leader does not take anything from the spoils for himself, and this is agreed upon.

وَعَنْ جُبَيْرِ بْنِ مُطْعِمٍ رضي الله عنه قَالَ: مَشَيْتُ أُنَا وَعُثْمَانُ بْنُ عَفَّانَ إِلَى النَّبِيِّ صلي الله عليه واله وسلم فَقُلْنَا: أَعْطَيْتَ بَنِيُ الْمُطّلِبِ مِنْ خُمْسِ خَيْبَرَ وَتَرَكْتَنَا، وَنحْنُ بِمَنْزِلَةٍ وَاحِدَةٍ مِنْكَ، فَقَالَ: (إِنَّمَا بَنُو هَاشِمٍ وَبَنُو الْمُطَّلِبِ شَيْءٌ وَاحِدٌ). قَالَ جُبَيْرٌ: وَلَمْ يُقَسمِ النَّبِيُّ١ﷺ لِبَنِيعَبْدٍ شَمْسٍ وَبَنِيْ نَوْفَلٍ شَيْئًا. رَوَاهُ الطَّحَاوِيُّ.

وَرَوَى الشَّافِعِيُّ عَنْهُ رضي الله عنه ، قَالَ: لَمَّا قَسَّمَ رَسُوْلُ اللّهِ صلي الله عليه واله وسلم سَهْمَ ذَوِيْ الْقُرْبَى بَيْنَ بَنِيْهَاشِمٍ وَبَنِيْ الْمُطّلِبِ أَتَيْتُهُ أَنَا وَعُثْمَانُ بْنُ عَفَّانَ، فَقُلْنَا: يَا رَسُوْلَ اللّهِ، هَؤُلَاءِ إِخْوَانُنَا مِنْبَنِيْ هَاشِمٍ لَا نُنْكِرُ فَضْلَهُمْ لِمَكَّانِكَ الَّذِيْ وَضَعَكَ اللهُ مِنْهُمْ، أَرَأَيْتَ إِخْوَانَنَا مِنْ بَنِيْالْمُطّلِبِ أَعْطَيْتَهُمْ وَتَرَكْتَنَا، وَإِنَّمَا قَرَابَتُنَا وَقَرَابَتُهُمْ وَاحِدَةُ، فَقَالَ رَسُوْلُ اللّهِ صلي الله عليه واله وسلم :(أَمَّابَنُوْ هَاشِمٍ وَبَنُوْ الْمُطّلِبِ فَشَيْءٌ وَاحِدُ هَكَذَا) وَشَبَّكَ بَيْنَ أَصَابَعِهِ.

وَفِي رِوَايَةٍ أَبِيْ دَاوُدَ وَالنَّسَائِّيِّ نَحْوُ، وَفِيْهِ: (إِنَّا وَبَنُو الْمُطَّلِبِ لَا نَفْتَرِقُ فِي جَاهِلِيَّةٍ وَلَاإِسْلَامِ، وَإِنَّمَا نَحْنُ وَهُمْ شَيْءٌ وَاحِدٌ،) وَشَبَّكَ بَيْنَ أَصَابِعِهِ.

وَقَالَ عُلَمَاؤُّنًا: وَفِي ذَلِكَ دَلِيْلٌ عَلَى أَنَّ الْمُرَادَ بِقَوْلِهِ تَعَالَى: ﴿وَلِذِى الْقُرْبَى﴾ قُرْبُالنُّصْرَةِ لَا قُرْبُ الْقَرَابَةِ، فَإِذَا ثَبَتَ أَنَّ التَّبِيَّ صلي الله عليه واله وسلم أَعْطَاهُمْ لِلنُّصْرَةِ لَا لِلْقَرَابِةِ، وَقَدِ انْتَهَتِالنُّصْرَةُ انْتَقَى الْإِعْطَاءُ؛ لِأَنَّ الْحُكْمَ يَنْتَهِيْ بِانْتِهَاءِ عِلَّتِهِ.

وَرَوَى أَبُوْ يُؤْسُفَ عَنِ ابْنِ عَبَّاسِ رضي الله عنهما أَنَّ الْخَمْسَ كَانَ يُقَسَّمُ عَلَى عَهْدِهِ عليه السلام عَلَىخَمْسَةِ أَسْهُمٍ: لِلْهِ وَلِرَسُوْلِهِ سَهْمُ، وَلِذِيْ الْقُرْبَى سَهْمٌ، وَلِلْيَتَامَى سَهْمٌ، وَلِلْمَسَاكِيْنِ سَهْمٌ،وَلاَبْنِ السَّبِيْلِ سَهْمٌ، ثُمَّ قَسَّمَ أَبُوْ بَكْرٍ وَعُمَرُ وَعُثْمَانُ وَعَليّ رضي الله عنهم عَلَى ثَلَاثَةِ أَسْهُمٍ: سَهْمُلِلْيَتَامَى، وَسَهْمُ لِلْمَسَاكِيْنِ، وَسَهْمُ لِابْنِ السَّبِيْلِ.

وَفِي رِوَايَةٍ لِلطّحَاوِيِّ عَنْ مُحَمَّدِ بْنِ إِسْحَاقَ قَالَ: سَأَلْتُ أَبَا جَعْفَرٍ يَعْنِيْ مُحَمَّدَ بْنَ عَلِيٍّ،فَقُلْتُ: أَرَأَيْتَ عَلِيَّ بْنَ أَبِيْ طَالِبٍ رضي الله عنه حَيْثُ وُلِّي الْعِرَاقُ، وَمَا وَلي مِنْ أَمْرِ النَّاسِ كَيْفَصَنَعَ فِي سَهْمِ ذَوِي الْقُرْبِ؟ قَالَ: سَلَكَ بِهِ - وَاللّهِ - سَبِيْلَ أَبِيِّ بَكْرٍ وَعُمَرَ.

English

Jubayr ibn Mut‘im (may Allah be pleased with him) narrated: I and Uthman ibn Affan went to the Prophet (ﷺ) and said, “You gave Banu al-Muttalib from the fifth of Khaybar but left us, though we are of the same status as you.” He said: “Banu Hashim and Banu al-Muttalib are one.” Jubayr said: 1 The Prophet (ﷺ) did not give anything to Banu Abd Shams or Banu Nawfal. [Narrated by At-Tahawi]

Shafi‘i narrated from him: When the Messenger of Allah (ﷺ) divided the share of the near relatives among Banu Hashim and Banu al-Muttalib, Uthman ibn Affan and I went to him and said, “O Messenger of Allah, we do not deny the merit of Banu Hashim due to your position among them, but what about our brothers from Banu al-Muttalib? You gave to them and left us, though our kinship is the same.” The Messenger of Allah (ﷺ) said: “Banu Hashim and Banu al-Muttalib are one,” interlacing his fingers. In a narration by Abu Dawud and An-Nasa’i, he said: “We and Banu al-Muttalib never parted in pre-Islam or Islam; we and they are one,” interlacing his fingers.

Our scholars said: This indicates that “near relatives” in Allah’s saying, “and for the near relatives” [Qur’an 8:41], refers to closeness in support, not kinship. Since the Prophet (ﷺ) gave to them for their support, not kinship, and that support has ended, the allocation ceases, as a ruling ends with its cause.

Abu Yusuf narrated from Ibn Abbas (may Allah be pleased with them both): In the Prophet’s time (ﷺ), the fifth was divided into five shares: one for Allah, one for His Messenger, one for the near relatives, one for orphans, and one for the needy and wayfarers. Then Abu Bakr, Umar, Uthman, and Ali (may Allah be pleased with them) divided it into three shares: one for orphans, one for the needy, and one for wayfarers.

At-Tahawi narrated from Muhammad ibn Ishaq: I asked Abu Ja‘far (Muhammad ibn Ali), “What did Ali ibn Abi Talib do with the share of the near relatives when he governed Iraq and managed people’s affairs?” He said: “By Allah, he followed the way of Abu Bakr and Umar.”

They differ on the fifth: some say it is divided into six shares, one for Allah, one for the Messenger, and so on, per the verse’s apparent meaning, with Allah’s share for the Ka‘bah (per Abu al-‘Aliyah), the treasury, or combined with the Messenger’s share. The majority hold that Allah’s mention is for blessing, as it precedes the others, so the fifth is divided into five shares, as the Prophet (ﷺ) did. After his death, Shafi‘i says the Messenger’s share goes to Muslim interests, the leader, or the four categories. Per Abu Hanifah, the Messenger’s and near relatives’ shares ceased at his death, with the remainder for orphans, the needy, and wayfarers, including poor relatives, prioritizing them but excluding their rich. ولنا أن الخلفاء الأربعة الراشدين قسّموه على ثلاثة أسهم على نحو ما قلناه، وكفى بهم قدوةً، ثم إنه لم ينكرعليهم ذلك أحد مع علم جميع الصحابة بذلك وتوافرهم، فكان إجماعًا منهم على ذلك، وقال عليه السلام : (يا معشر بنيهاشم! إن الله تعالى كره لكم غسالة الناس وأوساخهم،وعوضكم منها بخمس الخمس). والعوض إنما يثبت في حقمن يثبت في حقه المعوض، وهم الفقراء، والنبي خلا أعطاهم للنصرة.

ألا ترى أنه عليه السلام علَّل، فقال: إنهم لن يزالوا معي هكذا في الجاهلية والإسلام، وشبك بين أصابعه، دل على أنالمراد من النص قرب النصرة لا قرب القرابة؛ لأن لفظ (لذي القربى) مشترك بين القرابة الصلبية والقرابة المودة،وههنا الأخير مراد خاصة بدليل أن رسول الله صلي الله عليه واله وسلم ابن عبد الله بن عبد المطلب بن هاشم بن عبد منافوكان لعبد مناف أربعة أبناء: هاشم والمطلب وعبد شمس ونوفل، وكان عثمان بن عفان من أولاد عبدالشمس وجبير بن مطعم من أولاد نوفل، فلما قسم رسول الله صلي الله عليه واله وسلم غنائم خيبر، أعطى خمس الخمس بني هاشم وبنيالمطلب، ولم يعط عثمان وجبير أصلًا، فقالا: إنا لا ننكر فضل بني هاشم؛ لمكانك الذي وضعك الله فيهم، يعنيأنك منهم، وهم إخوتك، ولكن نحن وبنو المطلب سواء، فما بالك أعطيتهم وحرمتنا، فقال حيث: (إنهم لم يفارقونيفي الجاهلية ولا في الإسلام). وشبك بين أصابعه.

فعلم أن المراد قرابة المودة؛ لأنه لو كان المراد القرابة الصلبية لاعطى عثمان وجبيرا أيضًا كما أعطى بني هاشموبني هاشم وبني المطلب، فإذا كان المراد قرابة المودة. فقد فات ذلك بوفات رسول الله عنهم؛ لأنه علّلهبصحبته، وهي لم تبقّ، فلا يستحقون السهم بعد وفاته إذا كانوا أغنياء، وما روي أنه قسم الخمس على خمسةأسهم، فأعطى ذا القربى سهما فنعم لكن الكلام في أنه أعطاهم خاصة لفقرهم وحاجتهم أو لقرابتهم. وقد علمنبقسمة الخلفاء الراشدين أنه أعطاهم لحاجتهم وفقرهم لا لقرابتهم، والدليل عليه أنه صلي الله عليه واله وسلم كان يشدد في أمرالغنائم، فتناول من وبر بعير. وقال: لا يحل من غنائمكم شيء إلا الخمس، وهو مردود فيكم ردوا الخيط والمخيط،فإن الغلول عار وشناء على صاحبه يوم القيامة لم يخص عليه السلام القرابة بشيء من الخمس، وعمّ المسلمين جميعا بقوله:والخمس مردود فيكم، فَدَلَّ أن سبيلهم سبيل سائر فقراء المسلمين يعطى من يحتاج منهم كفاية. التقطته من (التفسيرات الأحمدية) و(الهداية) و(بذل المجهود).

وَعَنْ عَمْرِو بْنِ شَعَيْبٍ عَنْ أَبِيْهِ عَنْ جَدِّهِ رضي الله عنه قَالَ: دَنَا النَّبِيُّ صلي الله عليه واله وسلم مِنْبَعِيرٍ، فَأَخَدَ وَبَرَةً مِنْ سَنَامِهِ، ثُمَّ قَالَ: (يَا أَيُّهَا النَّاسُ، إِنَّهُ لَيْسَ لِي مِنْ هَذَا الْفَيْءِ شَيْءًوَلَا هَذَا - وَرَفَعَ إِصْبَعَهُ - إِلَّا الْخُمُسَ، وَالْخُمُسُ مَرْدُودُ عَلَيْكُمْ، فَأَدُّوا الْخِيَاطَوَالْمِخْيَطَ). فَقَامَ رَجُلٌ فِي يَدِهِ كُبَّةٌّ مِنْ شَعْرٍ، فَقَالَ: أَخَدْتُ هَذِهِ؛ لِأُصْلِحَ بِهَا بَرْذَعَةً لِيْ،فَقَالَ النَّبِيُّ : أَمَّا مَا كَانَ لِي وَلِبَنِي عَبْدِ الْمُطَّلِبِ فَهُوَ لَكَ، فَقَالَ: أَمَّا إِذْ بَلَغَتْ هَذِهِمَا أَرَى، فَلَا أَرَبَ لِي فِيهَا وَنَبَذَهَا. رَوَاهُ أَبُوْ دَاوُدَ.

وَفِي رِوَايَةٍ لَهُ عَنْ عَمْرِو بْنِ عَبَسَةَ الله قَالَ: صَلَّى بِنَا رَسُولُ اللَّهِ ﷺ إِلَى بَعِيرٍ مِنَالْمَغْنَمِ، فَلَمَّا سَلَّمَ أَخَدَ وَبَرَةً مِنْ جَنْبِ الْبَعِيرِ، ثُمَّ قَالَ: (وَلَا يَحِلُّ لِي مِنْ غَنَائِمِكُمْ مِثْلُهَذَا إِلَّا الْخُمُسَ، وَالْخُمُسُ مَرْدُودٌّ فِيكُمْ).

وَقَالَ الشَّيْخُ ابْنُ الْهُمَامِ: لَمْ يَخْصَّ عَلَيْهِ الصَّلَاةِ وَالسَّلَامِ الْقَرَابَةَ بِشَيْءٍ مِنَ الْخُمْسِ،وَعَمَّ الْمُسْلِيْنَ جَمِيْعًا بِقَوْلِهِ: (وَالْخُمُسُ مَرْدُودُ فِيكُمْ)، فَدَلَّ أَنَّ سَبِيْلَهُمْ سَبِيْلُ سَائِرٍفُقَرَاءِ الْمُسْلِمِيْنَ يُعْطَى مَنْ يَحْتَاجُ مِنْهُمْ كِفَايَةً.

English

Amr ibn Shu‘ayb, from his father, from his grandfather (may Allah be pleased with him), narrated: The Prophet (ﷺ) approached a camel, took a hair from its hump, and said: “O people, I have no right to this fay’ except the fifth, and the fifth is returned to you. So return the needle and thread.” A man stood with a tuft of hair, saying: “I took this to mend my saddle.” The Prophet (ﷺ) said: “What is mine and Banu Abd al-Muttalib’s is yours.” The man said: “If it has reached this point, I have no need for it,” and discarded it. [Narrated by Abu Dawud]

In another narration by Abu Dawud from Amr ibn Abasah: The Messenger of Allah (ﷺ) prayed toward a camel from the spoils. After finishing, he took a hair from its side and said: “Even this much of your spoils is not lawful for me except the fifth, and the fifth is returned to you.”

Shaykh Ibn al-Humam said: The Prophet (ﷺ) did not favor relatives with any of the fifth, including all Muslims in: “The fifth is returned to you,” showing their way is like other poor Muslims, given enough for their needs.

وَعَنْ سَعْدِ بْنِ أَبِيْ وَقَّاصٍ رضي الله عنه قَالَ: أَعْطَى رَسُولُ اللهِ صلي الله عليه واله وسلم رَهْطًا وَأَنَاجَالِسٌ، فَتَرَكَ١ رَسُولُ اللهِ صلي الله عليه واله وسلم مِنْهُمْ رَجُلًا هُوَ أَعْجَبُهُمْ إِلَيَّ فَقُمْتُ فَقُلْتُ: مَا لَكَفُلَانٍ وَاللَّهِ إِنِّي لَأَرَاهُ٢ مُؤْمِنًا، فَقَالَ رَسُولُ اللهِ صلي الله عليه واله وسلم (أَوْ مُسْلِمًا؟) ذَكَرَ ذَلِكَ سَعْدُ ثَلَاثًاعَنْوَأَجَابَهُ بِمِثْلِ ذَلِكَ، ثُمَّ قَالَ:(إِنِّي لَأُعْطِي الرَّجُلَ وَغَيْرُهُ أَحَبُّ إِلَيَّ مِنْهُ خَشْيَةَ أَنْ يُكَبَّ فِيالنَّارِ عَلَى وَجْهِهِ). مُتَّفَقُّ عَلَيْهِ.

وَقَالَ عَلِيُّ الْقَارِيْ: الْإِسْلَامُ وَالْإِيْمَانُ مُخْتَلِفَانٍ بِاعْتِبَارِ اللُّغَةِ وَتَتَّحِدَانِ فِي الشَّرِيْعَةِ.

English

Sa‘d ibn Abi Waqqas (may Allah be pleased with him) narrated: The Messenger of Allah (ﷺ) gave to a group while I was present, 1 but left out a man who impressed me most. I stood and said: “What about so-and-so? By Allah, I see him as a believer.” 2 The Messenger of Allah (ﷺ) said: “Or a Muslim?” Sa‘d repeated this three times, and each time he replied similarly, then said: “I give to a man while another is dearer to me, fearing he be thrown into the Fire on his face.” [Narrated by Bukhari and Muslim]

Ali al-Qari said: Islam and faith differ linguistically but are united in Shariah.

3 The statement: “Your share is in it, etc.”: Per Hanafis, fay’ is not subject to the fifth. Shafi‘i says it is, like spoils, so this Hadith is evidence against him. As in (Al-Mirqat), (Radd al-Muhtar), and (Rahmat al-Ummah). In Nawawi’s (Sharh Muslim), the Qadi said: The first refers to fay’ not fought for with horses or mounts, abandoned or taken by treaty, so “your share” means their right to allocations as fay’ is distributed. The second refers to spoils taken by force, from which the fifth is taken, the rest for the fighters, as meant by “then it is for you,” i.e., the remainder. Some who do not mandate the fifth for fay’ cite this Hadith. Shafi‘i mandates the fifth for fay’, like all scholars do for spoils. Ibn al-Mundhir said: No one before Shafi‘i mandated the fifth for fay’.

وَعَنِ ابْنِ عَبَّاسِ رضي الله عنهما عَنِ النَّبِيَّ صلي الله عليه واله وسلم قَالَ:(فِيمَا أَحْرَزَ١ الْعَدُوُّ فَاسْتَنْقَذَهُالْمُسْلِمُونَ مِنْهُمْ، إِنْ وَجَدَهُ صَاحِبُهُ قَبْلَ أَنْ يُقْسَمَ فَهُوَ أَحَقُّ بِهِ، وَإِنْ وَجَدَهُ قَدْ قُسِمَ فَإِنْشَاءَ أَخَذَهُ بِالثَّمَنِ). رَوَاهُ الدَّارِقُطْنِيُّ وَالْبَيْهَقِيُّ فِي سُنَنِهِمَا. وَرَوَى الطَّبَرَانِيُّ فِي الْمُعْجَمِالْوَسِطِ نَحْوَهُ.

وَرَوَى الطَّحَاوِيُّ عَنْ قُبَيْصَةَ بْنِ ذُويْبٍ أَنَّ عُمَرَ بْنَ الْخَطَّابِ قَالَ فِيْمَا أَحْرَزَالْمُشْرِكُوْنَ، فَأَصَابَهُ الْمُسْلِمُوْنَ، فَعَرَفَهُ صَاحِبُهُ، قَالَ: إِنْ أَذْرَكَهُ قَبْلَ أَنْ يُقْسَمَ فَهُوَ لَهُ،وَإِنْ جَرَتْ فِيْهِ السِّهَامُ فَلَا شَيْءَ لَهُ.

Ibn Abbas (may Allah be pleased with them both) narrated that the Prophet (ﷺ) said: 1 “Regarding what the enemy secured and Muslims recovered, if the owner finds it before division, he has the right to it. If it has been divided, he may take it by paying its price.” [Narrated by Ad-Daraqutni and Al-Bayhaqi in their Sunan] At-Tabarani narrated similarly in Al-Mu‘jam al-Awsat.

At-Tahawi narrated from Qubaysah ibn Dhuwayb that Umar ibn al-Khattab said about what polytheists secured and Muslims took: If the owner recognizes it before division, it is his; if shares are assigned, he gets nothing.

1 The statement: “Regarding what the enemy secured and Muslims recovered, etc.”: If disbelievers overpower Muslims’ wealth, God forbid, and secure it in their land, Shafi‘i says they do not own it, and if Muslims recover it, it returns to its owner before or after division. Abu Hanifah says: If disbelievers gain and secure Muslims’ wealth, the Muslims’ ownership ceases, per Allah’s saying in Surah al-Hashr about fay’ recipients: “For the poor emigrants who were expelled from their homes and their wealth” [Qur’an 59:8], calling the Companions who migrated from Makkah to Madinah poor despite owning homes and wealth in Makkah. This indicates disbelievers gained ownership upon capture, making them poor, eligible for charity. Supporting Hadiths include those of Ad-Daraqutni and Al-Bayhaqi from Ibn Abbas, stating if the owner finds it before division, it is his; after division, he takes it by price. At-Tabarani narrated from Jabir ibn Samurah: The enemy took a man’s camel from Banu Sulaym; a Muslim bought it, and its owner recognized it, informing the Prophet (ﷺ), who ordered it returned for the price paid or left as is. Abu Dawud narrated similarly in (Kitab al-Marasil). Ad-Daraqutni, Ibn Adi, and others narrated: Whoever finds his property in fay’ before division gets it; after division, he gets nothing. These narrations support this, as disbelievers’ ownership enables valid sales, and division matters after recovery. One cannot say these narrations are weak, as Shafi‘i noted per Az-Zayla‘i and others, as multiple weak chains strengthen the ruling, especially since the ruling is supported by the Qur’an’s indication. The narrations reinforce this, and their weakness does not harm. The Hadiths in (Chapters of Hajj) by Bukhari, Muslim, and others support this, showing Aqil ibn Abi Talib’s question: “Did the Prophet leave us a home?” Thus, if Muslims recover disbelievers’ taken wealth, the owner gets it before division without cost; after division, by value. “Securing” means ownership requires securing in the land of war, not mere capture. As in (Sharh al-Wiqayah), (‘Umdat al-Qari), (Sharh Ma‘ani al-Athar), and (Al-Mirqat).

١ قوله: فيما أحرزه العدو فاستنقذه المسلمون منهم إلخ: اعلم أن الكفار إذا غلبوا على أموال المسلمين - والعياذ بالله - وأحرزوها بدارهم. قال الشافعي: لا يتملكونها، وإذا استنقذها المسلمون من أيديهم ترد إلى صاحبها، وله أخذهاقبل القسمة وبعدها. وقال أبو حنيفة: إن الكفار إذا ملكوا أموال المسلمين بالاستيلاء والإحراز زال عنها ملكالمسلمين يشهد له قوله تعالى في (سورة الحشر) عند ذكر مصارف الفيء: ﴿لِلْفُقَّرَآءِ الْمُهَجِرِينَ آَلَّذِينَ أَخْرِجُواْ مِندِيَرِهِمْ وَأَمْوَلِهِمْ﴾ (الحشر: ٨) الآية حيث سمي الصحابة الذين هاجروا من مكة إلى المدينة وأخرجهم الكفار،وتسلطوا على دُورهم وأموالهم فقراء مع كونهم ذوي أموالهم وبيوت بمكة.

فعلم منه بإشارة النص أن الكفار حين استولوا على أموالهم ملكوه، فصاروا فقراء مستحقين لأموال الصدقاتوغيرها، ويشهد له من الأحاديث ما أخرجه الدارقطني والبيهقي عن ابن عباس عن النبي صلي الله عليه واله وسلم : فيما أحرزه العدو،فاستنقذه المسلمون منهم، إن وجده صاحبه قبل أن يقسم فهو أحق به وإن وجده قسم، فإن شاء أخذه بالثمنوأخرج الطبراني عن جابر سمرة: أصاب العدو ناقة رجل من بني سليم، ثم اشتراها رجل من المسلمين،فعرفها صاحبها، فأتى النبي صلي الله عليه واله وسلم فأخبره،(فأمر أن يأخذها بالثمن الذي اشتراها به صاحبها من العدو وإلا يخليبينها وبينه). ومثله أخرجه أبو داود في (كتاب المراسيل). وأخرج الدار قطني وابن عدي وغيرهما مرفوعًا: من وجدماله في الفيء قبل أن يقسّم فهو له ومن وجده بعد ما قسم، فليس له شيء. فهذه الأخبار تثبت ما ذكرنا؛ فإنه لولا أنالكفار يملكون أموالنا بالاستيلاء والإحراز لما صحَّ بيعهم من آخر، ولما اعتبرت قسمتها بعد غلبتنا.لا يقال: أسانيد هذه الأخبار كلها ضعيفة كما ذكره الشافعي على ما نقله عنه الزيلعي وغيره، فلا تقوم حجة؛ لأنانقول: كثرة الطرق يجبر الضعف على أنه ليس الغرض منها إثبات حكم حتى يضر الضعف؛ فإن الحكم ثابت بإشارةنص القرآن، بل الغرض منها استئناس تلك الإشارة وتقويتها، فلا يضر حينئذٍ ضعفها، ويكفي في الباب حديثالشيخين وغيرهما المخرج في (أبواب الحج) المفيد؛ لما ذكرنا؛ فإنه يثبت منه أن عقيل بن أبي طالب حين خرج النبيهل ترك لنا عقيلا منزلا؟ فثبت بهذا أن المسلمين إذا أوجفوا على الكفار، وأخذوا أموال المسلمين منهم، فإن جاءصاحبه قبل أن يقسم أخذه بغير شيء، وإن جاء بعد ما قسم أخذه بالقيمة، وأشار بالإحراز إلى أن مجرد الاستيلاء لايفيد الملك ما لم يوجد الإحراز بدار الحرب. التقطته من (شرح الوقاية) و(عمدة القاري) و(شرح معاني الآثار)و (المرقاة).

وَعَنِ ابْنِ عَبَّاسِ رضي الله عنهما قَالَ: سَأَلَ رَجُلَّ رَسُوْلَ اللهِ صلي الله عليه واله وسلم ، فَقَالَ: أَشْتَرِيْ سَبْعًامِنَ الْغَنَمِ إِنَّ عَلَيَّ ناقَة، وَقَدْ غَرَبَتْ عَنَّيْ، فَقَالَ: (اشْتَرِ سَبْعًا مِنَ الْغَنَمِ). رَوَاهُ الطَّحَارِيُّ،وَقَالَ: أَفَلَا تَرَى أَنَّ رَسُوْلَ اللّهِ صلي الله عليه واله وسلم فِي هَذَا الْحَدِيْثِ إِنَّمَا عَدَّلَهَا بِسْبْعَ مِنَ الْغَنَمِ مِمَّايُجْزِئُ كُلُّ وَاحِدَةٍ مِنْهُنَّ عَنْ رَجُلٍ، وَلَمْ يُعَدَّلْهَا لِعِشْرِ مِنَ الْغَنَمَ اهـ وَقَالَ أَهْلُ الْعِلْمِ:فَحَدِيْثُ تَعْدِيْلٍ عشْرَ شِيَاهِ مَنْسُوْخٌ.

Ibn Abbas (may Allah be pleased with them both) narrated: A man asked the Messenger of Allah (ﷺ), “I bought seven sheep, but I owe a camel that has gone missing.” He said: “Buy seven sheep.” [Narrated by At-Tahawi] He said: “Do you not see that the Messenger of Allah (ﷺ) equated it to seven sheep, each sufficient for one person, not ten sheep?” Scholars said: The Hadith equating it to ten sheep is abrogated.

1 The statement: “From among those given the Scripture”: This clarifies “those who do not believe in Allah”, meaning the jizyah is imposed on those who believe in a revealed scripture, like Jews who believe in the Torah, Samaritans who believe in the Psalms, and Christians who believe in the Gospel. As in (At-Tafsir al-Ahmadiyyah) and (Sharh al-Kanz).

2 The statement: “Say to those who remained behind, etc.”: In (At-Tafsir al-Ahmadiyyah), this verse indicates that apostates and Arab idol-worshippers are not offered jizyah, as stated by exegetes and the author of (Al-Hidayah) in the chapter on fighting: This applies to those from whom jizyah is accepted. For those from whom it is not, like apostates and Arab idol-worshippers, there is no benefit in offering jizyah, as only Islam is accepted from them, per Allah’s saying: “You will fight them, or they will submit” [Qur’an 48:16].

٢ قوله: قل للمخالفين إلخ: قال في (التفسيرات الأحمدية): فيكون الآية دليلا على أن المرتدين ومشركي العرب لا يقبلمنهما الجزية صرَّح به المفسرون، وصاحب (الهداية) أيضًا؛ حيث قال في (باب كيفية القتال): وهذا في حق من يقبلمنه الجزية، ومن لا يقبل منه، كالمرتدين وعَبَدَة الأوثان من العرب لا فائدة في دعائهم إلى قبول الجزية؛ لأنه لا يقبلمنهم إلا الإسلام، قال الله تعالى: ﴿تُقَتِلُونَهُمْ أَوْ يُسْلِمُونٌّ﴾ (الفتح: ١٦). هذا لفظه.
