وَقَوْلِ اللهِ عَزَّ وَجَلَّ: ﴿يَأَيُّهَا الَّذِينَ ءَامَنُواْ إِذَا لَقِيتُمُ الَّذِينَكَفَرُوْ رَحْقَا فَلَا تُوَلُوهُمُ الْأَذْبَارَوَمَنْ يُوَلّهِمْ

يَوْمَيِذِ دُرَةٌ إِلَامُتَحَرِّفَا لِّقِتَالٍ أَوْ مُتَحَيِّزًا إِلَى فِئَةِ فَقَدْ بَآءَ بِغَضَبٍ مِّنَ اُللهِ وَمَأْوَلَهُجهنم وبئس المصير.

English

And the saying of Allah, the Mighty and Exalted: “O you who have believed, when you meet those who disbelieve advancing [for battle], do not turn your backs to them. And whoever turns his back to them on such a day, unless swerving [as a strategy] for battle or joining [another] company, has certainly returned with anger [upon him] from Allah, and his refuge is Hell, and wretched is the destination.” [Qur’an 8:15-16]

وَعَنْ جَابِرٍ قَالَ رَجُلٌ لِلنَّبِيِّ ﷺ يَوْمَ أُحُدٍ: أَرَأَيْتَ إِنْ قُتِلْتُ فَأَيْنَ أَنَا قَالَ: (فِي الْجَنَّةِ)، فَأَلْقَى تَمَرَاتٍ فِي يَدِهِ، ثُمَّ قَاتَلَ حَتَّى قُتِلَ. مُتَّفَقَّ عَلَيْهِ.

English

Jabir (may Allah be pleased with him) narrated: A man said to the Prophet (ﷺ) on the day of Uhud, “If I am killed, where will I be?” He said: “In Paradise.” So the man threw away the dates in his hand and fought until he was killed. [Narrated by Bukhari and Muslim]

وَعَنْ كَعْبِ بْنِ مَالِكٍ رضى الله عنه قَالَ : لَمْ يَكُنْ رَسُولُ اللَّهِ ﷺ يُرِيدُ غَزْوَةً إِلَّا وَرَّى١ بِغَيْرِهَا حَتَّى كَانَتْ تِلْكَ الْغَزْوَةُ يَعْنِي عَزْوَةَ تَبُوْكِ غَزَاهَا رَسُولُ اللهِ ﷺ فِي حَرَّشَدِيدٍ، وَاسْتَقْبَلَ سَفَرًا بَعِيدًا، وَمَفَارًا وَعَدُوًّا كَثِيرًا، فَجَلَّى لِلْمُسْلِمِينَ أَمْرَهُمْ؛ لِيَتَأْهَّبُواأُهْبَةَ غَزْوِهِمْ، فَأَخْبَرَهُمْ بِوَجْهِهِ الَّذِي يُرِيدُ. مُتَّفَقُّ عَلَيْهِ. لَكِنَّ اللَّفْظَ لِلْبُخَارِيِّ.

English

Ka‘b ibn Malik (may Allah be pleased with him) narrated: The Messenger of Allah (ﷺ) would not intend an expedition without 1 concealing it by mentioning something else, until the expedition of Tabuk. The Messenger of Allah (ﷺ) undertook it in extreme heat, facing a long journey, a desert, and a numerous enemy. He clarified their objective to the Muslims so they could prepare adequately and informed them of the destination he intended. [Narrated by Bukhari and Muslim, with the wording from Bukhari]

1 The statement: “concealing it by mentioning something else”: Ibn al-Malik said: This means he hid it by referring to something else, appearing to intend another destination for strategic reasons, to keep the enemy unaware and safe from spies who might inform them. His concealment (ﷺ) was through insinuation, such as intending Makkah but asking people about Khaybar’s condition and routes, not explicitly saying he intended one place while meaning another, as that would be lying, which is impermissible. As stated in (Al-Mirqat).

وَعَنْ جَابِرٍرضي الله عنه قَالَ: قَالَ رَسُولُ اللهِ ﷺ: (الْحَرْبُ٢ خَدْعَةٌ) مُتَّفَقٌ عَلَيْهِ.

English

Jabir (may Allah be pleased with him) narrated: The Messenger of Allah (ﷺ) said: “2 War is deception.” [Narrated by Bukhari and Muslim]

2 The statement: “War is deception”: Al-Nawawi said: The most eloquent pronunciation is with an open “kha” and a silent “dal,” which was the Prophet’s (ﷺ) dialect. Scholars agree on the permissibility of deception against disbelievers in war by any means, except if it involves breaking a covenant or safe-conduct. It is authentically reported that lying is permissible in three cases. At-Tabari said: Only insinuation is allowed in war, not outright lying, though outright lying is permissible, but insinuation is preferable. As stated in (Al-Mirqat).

وَعَنْ أَنَسِ رضي الله عنه قَالَ: كَانَ رَسُولُ اللهِ ﷺ يَغْزُو بِأَمَّ سُلَيْمٍ وَنِسْوَةٍ مِنَالْأَنْصَارِ مَعَهُ، إِذَا ٣ غَزَا فَيَسْقِينَ الْمَاءَ وَيُدَاوِينَ الْجَرْحَى. رَوَاهُ مُسْلِمٌّ.

English

Anas (may Allah be pleased with him) narrated: The Messenger of Allah (ﷺ) would go on expeditions with Umm Sulaym and some Ansari women who, when he went out, 3 would provide water and treat the wounded. [Narrated by Muslim]

3 The statement: “when he went out, would provide water and treat the wounded”: In (Al-Hidayah): There is no issue with taking women and Qur’ans with Muslims if it is a large army where safety is assured, as safety is the dominant expectation and treated as certain. It is disliked to take them in a small detachment where safety is not assured. Elderly women may join a large army for tasks suited to them, like cooking, providing water, and treating wounds. Young women should stay home to avoid fitnah. They should not engage in combat, as this suggests Muslim weakness unless absolutely necessary. It is not recommended to take them for intimacy or service, but if necessary, it should be with slave women, not free women. In (‘Umdat al-Qari): If asked how this was permissible, I say: It was allowed for older women, as the context of treating wounds is not desirable, causing discomfort to both parties. For others, they treated without direct contact, applying medicine that others placed on the wound, or possibly without touching the body at all. This is supported by the consensus that if a woman dies and no woman is available to wash her, a man does not touch her but washes her from behind a barrier, per Hasan al-Basri, Nakha‘i, Zuhri, Qatadah, and Ishaq. According to Sa‘id ibn al-Musayyab, Malik, the Kufis, and Ahmad, she is purified with tayammum, which is the soundest Shafi‘i view. Al-Awza‘i said she is buried as is without tayammum. The difference between treating wounds and washing the dead is that washing is worship, while treatment is a necessity, and necessities permit the prohibited.

٣ قوله: إذا غزا يسقين الماء ويداوين الجرحى: قال في (الهدية): ولا بأس بإخراج النساء والمصاحف مع المسلمينإن كان عسكرًا عظيمًا يؤمن عليه؛ لأن الغالب هو السلامة، والغالب كالمتحقق، ويكره إخراج ذلك في سرية لا يؤمنعليها، يعني العجائز يخرجن في العسكر العظيم لاقامة عمل يليق بهن، كالطبخ والسقي والمداواة، فأما الشوابفقرارهن في البيوت أدفع للفتنة، ولا يباشرن القتال؛ لأنه يستدل به على ضعف المسلمين إلا عند الضرورة، ولايستحب إخراجهن للمباضعة والخدمة، فإن كانوا لا بد مخرجين فبالإماء دون الحرائر.

وقال في (عمدة القاري): فإن قلت: كيف ساغ ذلك؟ قلت: جاز ذلك للمتجالات منهن؛ لأن موضع الحرجلا يلتذ بمسه بل تقشعر منه الجلود، وتهابه الأنفس، ولمسه عذاب للامس والملموس، وأما غيرهن، فيعالجن بغيرمباشرة منهن لهم، فيضعن الدواء، ويضعه غيرهن على الجرح، وقد يمكن أن يضعنه من غير مس شيء من جسده،ويدل على ذلك اتفاقهم أن المرأة إذا ماتت ولم توجد امرأة تغسلها أن الرجل لا يباشر غسلها بالمس، بل يغسلها منوراء حائل في قول الحسن البصري والنخعي والزهري وقتادة وإسحاق. وعند سعيد بن المسيب ومالك والكوفيينوأحمد يتيمم بالصعيد، وهو أصح الأوجه عند الشافعية. وقال الأوزاعي: تدفن كما هي، ولا يتيمم. وقيل: الفرق بينحال المداواة وتغسيل الميت إن الغسل عبادة والدواء ضرورة، والضرورات تبيح المحظورات.

وَعَنْ أُمَّ عَطِيَّةَ رضى الله عنها قَالَتْ: غَزَوْتُ مَعَ رَسُولِ اللهِ ﷺ سَبْعَ غَزَوَاتٍ، أَخْلُفُهُمْفِي رِحَالِهِمْ، فَأَصْنَعُ لَهُمْ الطَّعَامَ، وَأَدَاوِي الْجَرْحَى، وَأَقُومُ عَلَى الْمَرْضَى. رَوَاهُ مُسْلِمٌ.

English

Umm Atiyyah (may Allah be pleased with her) narrated: I went on seven expeditions with the Messenger of Allah (ﷺ), staying behind with their baggage, preparing food, treating the wounded, and caring for the sick. [Narrated by Muslim]

وَعَنْ سَمُرَةَ بْنِ جُنْدُبٍ رضي االله عنه عَنِ النَّبِيِّ ﷺ قَالَ: (اقْتُلُوا شُيُوخَ١ الْمُشْرِكِينَالْمُشْرِكِينَ وَاسْتَبْقُوا شَرْخَهُمْ)، أَيْ صِبْيَانَهُمْ رَوَاهُ التَّرْمِذِيُّ وَأَبُوْ دَاوُدَ.

English

Samurah ibn Jundub (may Allah be pleased with him) narrated: The Prophet (ﷺ) said: “1 Kill the elderly polytheists but spare their youth,” meaning their children. [Narrated by Tirmidhi and Abu Dawud]

وَعَنْ أَنَسِ رضى الله عنه أَنَّ رَسُوْلَ اللهِ ﷺ قَالَ: (انْطَلِقُوا بِاسْمِ اللهِ وَبِاللهِ وَعَلَىمِلَّةِ رَسُولِ اللهِ، وَلَا تَقْتُلُوا ٢ شَيْخًا فَانِيًا، وَلَا طِفْلًا وَلَا صَغِيرًا وَلَا امْرَأَةً، وَلَا تَغُلُّوا،وَضُمُّوا عَنَائِمَكُمْ، وَأَصْلِحُوا وَأَحْسِنُوا، إِنَّ اللهَ يُحِبُّ الْمُحْسِنِينَ). رَوَاهُ أَبُوْ دَاوُدَ.

English

Anas (may Allah be pleased with him) narrated: The Messenger of Allah (ﷺ) said: “Go in the name of Allah, with Allah, and upon the religion of the Messenger of Allah. Do not 2 kill a frail elder, a child, a young boy, or a woman. Do not embezzle, gather your spoils, reform, and do good, for Allah loves those who do good.” [Narrated by Abu Dawud]

2 The statement: “Do not kill a frail elder, etc.”: In (Al-Hidayah): Do not kill a woman, child, frail elder, cripple, or blind person, as, in our view, the justification for killing is waging war, which they cannot do. Thus, those with a paralyzed side, a severed right hand, or severed hand and foot on opposite sides are not killed. Shafi‘i disagrees regarding the frail elder, cripple, and blind, as he considers disbelief the justification for killing. Our evidence refutes this. It is authentically reported that the Prophet (ﷺ) prohibited killing children and offspring, and when he saw a slain woman, he said: “She was not fighting; why was she killed?”

٢ قوله: لا تقتلوا شيخا فانيا إلخ: وقال في (الهداية): ولا تقتلوا امرأة ولا صبيًا ولا شيخًا فانيًا ولا مقعدًا ولا أعمى؛لأن المبيح للقتل عندنا هو الحرب، ولا يتحقق منهم، ولهذا لا يقتل يابس الشق والمقطوع اليمنى والمقطوع يدهورجله من خلاف، والشافعي يخالفنا في الشيخ والمقعد والأعمى؛ لأن المبيح عنده الكفر والحجة عليه ما بيّناً. وقدصحَّ أن النبي صلي الله عليه وأله وسلم نهى عن قتل الصبيان والذراري وحين رأى رسول الله صلي الله عليه واله وسلم امرأة مقتولة، قال: هاه ما كانت هذهتقاتل فلم قتلت؟

وَعَنْ عَبْدِ اللهِ بْنِ عُمَرَرضي اللهِ عنه قَالَ: نَهَى١ رَسُولُ اللَّهِ ﷺ عَنْ قَتْلِ النِّسَاءِوَالصِّبْيَانِ. مُتَّفَقِّ عَلَيْهِ.

وَفِي الْمُتَّفَقِ عَلَيْهِ عَنْ الصَّعْبِ بْنِ جَثَّامَةَ قَالَ: سُئِلَ رَسُوْلُ اللهِ صلي الله عليه واله وسلم عَنْ أَهْلِ الدَّارِيُبَيَّتُونَ مِنَ الْمُشْرِكِينَ، فَيُصَابُ مِنْ نِسَائِهِمْ وَذَرَارِيِّهِمْ قَالَ: (هُمْ مِنْهُمْ).٢ وَفِي رِوَايَةٍ: (هُمْمِنْ آبَائِهِمْ).

English

Abdullah ibn Umar (may Allah be pleased with them both) narrated: The Messenger of Allah (ﷺ) prohibited 1 the killing of women and children. [Narrated by Bukhari and Muslim]

In another agreed-upon narration, As-Sa‘b ibn Jaththamah said: The Messenger of Allah (ﷺ) was asked about the people of a household attacked at night from the polytheists, where their women and children are harmed. He said: “2 They are from them.” In another narration: “They are from their fathers.”

1 The statement: “prohibited the killing of women and children”: Shaykh Ibn al-Humam said: The six, except Nasa’i, narrated from Ibn Umar that a woman was found killed, and he prohibited killing women and children. I believe there is a consensus on the prohibition of killing women and children. Abu Bakr advised Yazid ibn Abi Sufyan when sending him to Sham: “Do not kill children, women, or the elderly,” as per the Hadith. However, those who fight from among those we say should not be killed, like the insane, children, women, elderly, or monks, are killed. Children and the insane are killed during their fighting, while others, like women and monks, are killed if they fight after being captured. A queen is killed even if she does not fight, as are a child or insane person who is a king, to break their power. As stated in (Al-Mirqat).

2 The statement: “They are from them”: In (‘Umdat al-Qari): If you say this contradicts Bukhari’s narration from Ibn Umar prohibiting killing women and children, I say: Al-Khattabi said: “They are from them” means they share the ruling of their religion, as a disbeliever’s child is ruled as a disbeliever. This does not permit intentionally targeting their blood. It applies when reaching the fathers is only possible through them, so if they are harmed due to their intermingling, there is no blame for their killing. The Prophet (ﷺ) prohibited killing women and children intentionally, not in combat. If they fight, the prohibition is lifted, and the blood of disbelievers is permissible unless protected by a right. Tirmidhi narrated a Hadith prohibiting killing women and children, saying some Companions and others disliked it, which is the view of Thawri and Shafi‘i. Some scholars permitted killing women and children during night raids, which is the view of Ahmad and Ishaq. Our Shaykh said: Tirmidhi’s narration about Thawri and Shafi‘i’s dislike applies to killing them absolutely, in night raids or otherwise, but this is not so. Killing them outside night raids is unanimously prohibited if they do not fight, as Al-Nawawi stated in Sharh Muslim. If they fight, the majority say they are killed. Al-Tahawi titled a chapter: “What is prohibited from killing women and children in the land of war,” citing nine Companions prohibiting it. Some said it is impermissible to kill women and children in the land of war under any circumstance, and it is not permissible to target others if it risks harming them. For example, if the enemy uses their children as shields and Muslims cannot attack without hitting them, it is prohibited, or if they fortify with children, attacking the fortress is prohibited if it risks harming them, based on these Hadiths. I say: These are Al-Awza‘i, Malik, Shafi‘i in one opinion, and Ahmad in one narration. Abu Umar said: Scholars differed on attacking fortresses with catapults if polytheist children or Muslim captives are inside. Malik said: Do not attack the fortress or burn the disbelievers’ ships if Muslim captives are present. Al-Awza‘i said: If disbelievers use Muslim children as shields, do not attack or burn ships with Muslim captives. Thawri, Abu Hanifah, Abu Yusuf, Muhammad, Shafi‘i in the sound opinion, Ahmad, and Ishaq said: If reaching them requires harming children or women, it is permissible. Abu Umar said: Abu Hanifah, his companions, and Thawri said there is no issue with attacking polytheist fortresses even if Muslim captives or their children are inside, or burning ships targeting polytheists. If a Muslim is harmed, there is no blood money or expiation. Thawri said: If they are harmed, there is expiation but no blood money.

١ قوله: نهى رسول الله صلي الله عليه واله وسلم عن قتل النساء والصبيان: قال الشيخ ابن الهمام: أخرج الستة إلا النسائي عن ابن عمرأن امرأة وجدت مقتولة فنهى عن قتل النساء والصبيان، قال: وما أظن إلا أن حرمة قتل النساء والصبيان إجماع، وعن أبي بكر أنه أوصى يزيد بن أبي سفيان حيث بعثه إلى الشام، فقال: لا تقتلوا الولدان ولا النساء ولا الشيوخ، الحديث.

قال: لكن يقتل من قاتل من كل من قلنا: إنه لا يقتل كالمجنون والصبي والمرأة والشيوخ والرهبان إلا أن الصبيوالمجنون يقتلان في حال قتالهما، أما غيرهما من النساء والرهبان ونحوهم، فإنهم يقتلون إذا قاتلوا بعد الأسر،والمرأة الملكة تقتل وإن لم تقاتل، وكذا الصبي الملِك والمعتوه الملك؛ لأن في قتل الملك كسر شوكتهن. كذا في (المرقاة).

٢ قوله: هم منهم: قال في (عمدة القاري): فإن قلت: هذا يخالف ما ذكره البخاري عن ابن عمر نهى عن قتلالنساء والصبيان. قلت: قال الخطابي: قوله: (هم منهم) يريد في حكم الدين، فإن ولد الكافر محكوم له بالكفر، ولميرد بهذا القول إباحة دمائهم تعمدا لها وقصدا إليها، وإنما هو إذا لم يمكن الوصول إلى الآباء إلا بهم، فإذا أصيبوالاختلاطهم بالآباء لم يكن عليهم في قتلهم شيء. وقد نهى النبيﷺ عن قتل النساء والصبيان، فكان ذلك علىالقصد لا قتال فيهن، فإذا قاتلن فقد ارتفع الحظر، وأحل دماء الكفار إلا بشرط الحق، ولما روى الترمذي حديث ابن الذي فيه نهي عن قتل النساء والصبيان، قال: والعمل على هذا عند بعض أهل العلم من أصحاب النبي وغيرهم كرهوا قتل النساء والولدان، وهو قول الثوري والشافعي، ورخص بعض أهل العلم في البيات قتلالنساء فيهم والولدان، وهو قول أحمد وإسحاقوقال شيخنا: وما حكاهالترمذي عن الثوري والشافعي من كراهة قتل النساء والصبيان ظاهر في ترك القتلمطلقًا في البيات وغيره، وليس كذلك أما قتلهم في غير البيات، فأجمعوا على تحريمه إذا لم يقاتلوا كما حكاه النووي في شرح(مسلم). فإن قاتلوا فقال في (شرح مسلم) حكاية عن جماهير العلماء: يقتلون. وقال الطحاوي : باب ما نهى عنقتله من النساء والولدان في دار الحرب، ثم أخرج عن تسعة أنفس من الصحابة في النهي عن قتل الولدان والنسوان،ثم قال: فذهب قوم إلى أنه لا يجوز قتل النساء والولدان في دار الحرب على حال، وأنه لا يحل أن يقصد إلى قتل غيرهمإذا كان لا يؤمن في ذلك تَلَفُهم من ذلك أن أهل الحرب إذا تترسوا بصبيانهم، وكان المسلمون لا يستطيعون رميهمإلا بإصابة صبيانهم، فحرام عليهم رميهم في قول هؤلاء، وكذلك إن تحصنوا بحصن، وجعلوا فيه الولدان فحرامعليهم رمي ذلك الحصن إذا كنا نخاف في ذلك تلف نسائه وولدانهم، واحتجوا في ذلك بهذه الأحاديث التي رويناها.قلت: أراد بالقوم هؤلاء الأوزاعي ومالكا والشافعي في قول وأحمد في رواية. وقال أبو عمر: اختلفوا في رمي الحصونبالمنجنيق إذا كان فيها أطفال المشركين أو أسارى المسلمين، فقال مالك: لا يرمى الحصن، ولا تحرق سفينة الكفارإذا كان فيها أسارى المسلمين. وقال الأوزاعي: إذا تترس الكفار بأطفال المسلمين لم يرموا ولا تحرق المركب فيهأسارى المسلمين. وقال الثوري وأبو حنيفة وأبو يوسف ومحمد والشافعي في الصحيح وأحمد وإسحاق : إذا كانلا يوصل إلى قتلهم إلا بتلف الصبيان أو النساء فلا بأس به. وقال أبو عمر: قال أبو حنيفة وأصحابه والثوري: لابأس برمي حصونالمشركين، وإن كان فيه أسارى من المسلمين وأطفالهم أو أطفال المشركين، ولا بأس أن يحرقالسفن ويقصد به المشركون، فإن أصابوا واحدا من المسلمين بذلك فلا دية ولا كفارة. وقال الثوري: إن أصابواففيه الكفارة ولا دية.

وَعَنْ رَبَاجِ ابْنِ الرَّبِيعِ قَالَ: كُنَّا مَعَ رَسُولِ اللهِ ﷺ فِي غَزْوَةٍ، فَرَأَى النَّاسَمُجْتَمِعِينَ عَلَى شَيْءٍ، فَبَعَثَ رَجُلًا، فَقَالَ: (انْظُرْ عَلَامَ اجْتَمَعَ هَؤُلَاءٍ؟) فَجَاءَ فَقَالَ: عَلَىامْرَأَةٍ قَتِيلٍ، فَقَالَ: (مَا كَانَتْ هَذِهِ لِتُقَاتِلَ)، قَالَ: وَعَلَى الْمُقَدِّمَةِ خَالِدُ بْنُ الْوَلِيدِ، فَبَعَثَرَجُلًا، فَقَالَ: (قُلْ لِخَالِدٍ لَا يَقْتُلَنَّ امْرَأَةً وَلَا عَسِيفًا).١ رَوَاهُ أَبُوْ دَاوُدَ.

English

Rabah ibn ar-Rabi‘ narrated: We were with the Messenger of Allah (ﷺ) on an expedition. He saw people gathered around something and sent a man, saying: “See what they are gathered around.” He returned and said: “Around a slain woman.” He said: “She was not one to fight.” Khalid ibn al-Walid was leading the vanguard, so he sent a man, saying: “Tell Khalid not to kill a woman or a hired servant 1.” [Narrated by Abu Dawud]

وَهَانَ عَلَى سَرَاةٍ بَنِي لُؤَيٍّ حَرِيقُ بِالْبُوَيْرَةِ مُسْتَطِيرُ

وَفِيْ ذَلِكَ نَزَلَتْ: ﴿مَا قَطَعْتُم مِّن لِّيْنَةٍ أَوْ تَرَّكْتُمُوهَا قَآَبِمَةٌ عَلَّ أُصُولِهَا فَبِإِذْنِ اللهِ )الحشر: ٥مُتَّفَقُّ عَلَيْهِ.

English

Ibn Umar (may Allah be pleased with them both) narrated: The Messenger of Allah (ﷺ) cut down 2 the palm trees of Banu an-Nadir and burned them. For this, Hassan said: The nobles of Banu Lu’ayy found it easy, the blazing fire at Buwayrah spreading.

For this, the verse was revealed: “Whatever you have cut down of [their] palm trees or left standing on their trunks, it was by permission of Allah” [Qur’an 59:5]. [Narrated by Bukhari and Muslim]

2 The statement: “cut down the palm trees of Banu an-Nadir and burned them, etc.”: Ibn al-Humam said: This is permissible to weaken Allah’s enemies and break their strength. They may burn, cut trees, or destroy crops, but if it is evident they are defeated and victory is clear, this is disliked as it is destruction without necessity, which is only permitted for need. As stated in (Al-Mirqat).

Abdullah ibn Awn narrated that Nafi‘ wrote to him, informing him that Ibn Umar told him the Prophet (ﷺ) raided 3 Banu al-Mustaliq unexpectedly at Muraysi‘ while they were tending their livestock, killed their fighters, and took their women and children captive. [Narrated by Bukhari and Muslim]

Abu Usayd narrated: On the day of Badr, when the Prophet (ﷺ) arrayed us against Quraysh and they arrayed against us, he said: “When they approach you in large numbers, use your arrows.” In another narration: “When they approach you in large numbers, shoot them and spare your arrows.” [Narrated by Bukhari]

1 The statement: “disliked raising their voices during combat”: Al-Mudhhar said: Warriors typically raise their voices to glorify themselves, exaggerate their numbers, intimidate their enemies, or display bravery by saying, “I am the courageous one seeking battle.” The Companions disliked raising voices for any of these reasons, as they do not draw one closer to Allah. Instead, they raised their voices with the remembrance of Allah, as it brings success in this world and the Hereafter. As stated in (Al-Mirqat).

وَعَنْ عَلِيَّ رضي الله عنه ، قَالَ: لَمَّا كَانَ يَوْمُ بَدْرٍ تَقَدَّمَ عُتْبَةُ بْنُ رَبِيعَةَ، وَتَبِعَهُ ابْنُهُوَأَخُوهُ، فَنَادَى: ٢ مَنْ يُبَارِزُ؟ فَانْتَدَبَ لَهُ شَبَابٌ مِنَ الْأَنْصَارِ، فَقَالَ: مَنْ أَنْتُمْ؟ فَأَخْبَرُوهُ،فَقَالَ: لَا حَاجَةَ لَنا فِيكُمْ، إِنَّمَا أَرَدْنَا بَنِي عَمِّنَا، فَقَالَ رَسُولُ اللهِ صلي الله عليه واله وسلم : (قُمْ يَا حَمْزَةُ، قُمْيَا عَلِيُّ، قُمْ يَا عُبَيْدَةَ بْنَ الْحَارِثِ) فَأَقْبَلَ حَمْزَةُ إِلَى عُتْبَةَ، وَأَقْبَلْتُ إِلَى شَيْبَةَ، وَاخْتُلِفَ بَيْنَعُبَيْدَةَ وَالْوَلِيدِ ضَرْبَتَانٍ، فَأَثْخَنَ كُلُّ وَاحِدٍ مِنْهُمَا صَاحِبَهُ، ثُمَّ٣ مِلْنَا عَلَى الْوَلِيدِ فَقَتَلْنَاهُ،وَاحْتَمَلْنَا عُبَيْدَةً. رَوَاهُ أَحْمَدُ وَأَبُوْ دَاوُدَ.

English

Ali (may Allah be pleased with him) narrated: On the day of Badr, Utbah ibn Rabi‘ah stepped forward, followed by his son and brother, and called out: “2 Who will duel?” Some young Ansar volunteered, but he asked, “Who are you?” They informed him, and he said, “We have no need of you; we only want our cousins.” The Messenger of Allah (ﷺ) said: “Rise, O Hamzah! Rise, O Ali! Rise, O Ubaydah ibn al-Harith!” Hamzah faced Utbah, I faced Shaybah, and Ubaydah and al-Walid exchanged blows, each severely wounding the other. Then 3 we turned to al-Walid and killed him, and we carried Ubaydah away. [Narrated by Ahmad and Abu Dawud]

2 The statement: “called out: Who will duel?, etc.”: In (Sharh as-Sunnah): This indicates the permissibility of dueling in jihad against disbelievers, and there is no disagreement on its permissibility if the leader authorizes it. They differed if it occurs without the leader’s permission: some, including Malik and Shafi‘i, permitted it. In (Rahmat al-Ummah): If a Muslim initiates and seeks a duel, it is not allowed. Ibn Abi Habirah, a Shafi‘i, said it is disliked, and it is preferable not to duel without the leader’s permission, but if done without permission, it is permissible. Abu Hanifah said it is prohibited unless the duel is conducted with strength. 3 The statement: “Then we turned to al-Walid”: This indicates it is permissible for each side in a duel to assist their comrade if able. In (Sharh as-Sir al-Kabir): If a Muslim and a polytheist duel, it is permissible for Muslims to aid their companion if they can, as the polytheist intends to kill them as he does his opponent. They may repel his harm, and even if he does not target them, they may kill him as a warring polytheist. In the story of the Badr duel, Ali killed Shaybah, Hamzah killed Utbah, and Ali and Hamzah helped Ubaydah against al-Walid until they killed him, showing it is permissible. As stated in (Nayl al-Awtar).

وَعَنِ ابْنِ عُمَرَ رضي الله عنهما قَالَ: بَعَثَنَا رَسُولُ اللهِ صلي الله عليه واله وسلم فِي سَرِيَّةٍ، فَحَاصَ النَّاسُحَيْصَةً، فَقَدِمْنَا الْمَدِينَةَ فَاخْتَبَيْنَا بِهَا، وَقُلْنَا: هَلَكْنَا، ثُمَّ أَتَيْنَا رَسُولَ اللهِ صلي الله عليه واله وسلم فَقُلْنَا: يَارَسُولَ اللهِ، نَحْنُ الْفَرَّارُونَ، قَالَ: (بَلْ أَنْتُمْ الْعَكَّارُونَ وَأَنَا فِئَتُكُمْ). رَوَاهُ التَّرْمِذِيُّ.

وَفِي رِوَايَةٍ أَبِيْ دَاوُدَ نَحْوُّهُ، وَقَالَ: (لَا، بَلْ أَنْتُمْ الْعَكَّارُونَ، قَالَ: فَدَنَوْنَا فَقَبَّلْنَا يَدَهُ،فَقَالَ: (أَنَا فِئَةُ الْمُسْلِمِينَ).

English

Ibn Umar (may Allah be pleased with them both) narrated: The Messenger of Allah (ﷺ) sent us on a detachment, but the people fled in panic. We arrived in Madinah and hid, saying, “We are ruined.” Then we came to the Messenger of Allah (ﷺ) and said, “O Messenger of Allah, we are the deserters.” He said: “No, you are the ones who return to fight, and I am your company.” [Narrated by Tirmidhi]

In a narration by Abu Dawud, similar wording is used, and he said: “No, you are the ones who return to fight.” We approached and kissed his hand, and he said: “I am the company of the Muslims.”

وَعَنْ ثَوْبَانَ بْنِ يَزِيدَ ، أَنَّ النَّبِيَّ ﷺ نَصَبَ١ الْمَنْجَنِيقَ عَلَى أَهْلِالطّائِفِ. رَوَاهُ التِّرْمِذِيُّ مُرْسَلًا.

English

Thawban ibn Yazid narrated: The Prophet (ﷺ) set up 1 a catapult against the people of Ta’if. [Narrated by Tirmidhi, mursal]

1 The statement: “set up a catapult, etc.”: In (Al-Hidayah): They set up catapults against them, as the Messenger of Allah (ﷺ) did against Ta’if.

2 The statement: “Kill the polytheists, etc.”: In (‘Umdat al-Qari): There is no disagreement among the people of tafsir and narrators of traditions that Surah Bara’ah (At-Tawbah) was revealed after Surah Muhammad, so its rulings abrogate the ransom mentioned elsewhere.

١ قوله: نصب المنجنيق إلخ: قال في (الهداية): نصبوا عليهم المجانيق كما نصبه رسول الله صلي الله عليه واله وسلم على الطائف.
