باب ما لا يضمن من الجناياتOffenses That Do Not Require Compensation
عَنْ أَبِيْ هُرَيْرَةَ قَالَ: قَالَ رَسُوْلُ اللهِ ﷺ: (الْعَجْمَاءُ٢ جَرْحُهَا جُبَارٌ وَالْمَعْدِنُ٣ جُبَارٌ، وَالْبِئْرُ جُبَارٌ). مُتَّفَقُّ عَلَيْهِ.
Abu Hurayrah (may Allah be pleased with him) narrated: The Messenger of Allah (ﷺ) said: "The injury caused by a dumb animal is waived, the mine is waived, and the well is waived." [Agreed upon]

1 His statement: “The injury caused by a dumb animal is waived”: Abu Hanifah deduced from this that if livestock destroys another’s property without its owner present, there is no liability on the owner, whether at night or day. If the owner is present, if he is driving it, he is liable for what it destroys in any case. If he is leading or riding it, he is liable for what it destroys with its mouth or hand, but not for what it destroys with its foot unless he drives it to destroy or intends it, then he is liable due to his transgression. Al-Shafi’i said: "If livestock destroys another’s property by day without its owner present, there is no liability on the owner. If the owner is present, he is liable for what it destroys, whether riding, driving, leading, or it is standing with him, whether it destroys with its hand, foot, or mouth." Abu Hanifah’s companions answered that “the dumb animal is waived” is general, so its generality must be applied, and transgression is outside of it. (Umdat al-Qari and Al-Musawwa, excerpted from them). It is said in (Al-Ta’liq al-Mumajjad): "The waiver is not specific to injury but includes all destructions. Iyad said: 'He mentioned injury as it is the most common, or as an example indicating others.'"
2 His statement: “The mine is waived, and the well is waived”: Meaning, if a man hires another to dig a well or mine, and the well or mine collapses on the digger, killing him, it is waived, with no liability, due to the absence of causation or direct action from him. ٢ قوله: العجماء جرحها جبار: احتج به أبو حنيفة ، على أن ما أفسدت الماشية من مال الغير لم يكن معها مالكها فلا ضمان عليه، ليلًا كان أو نهارًا، وإن كان معها مالكها، فإن كان يسوقها فعليه ضمان ما أتلفت بكل حال، وإن كان قائدها أو راكبها فعليه ضمان ما أتلفت بفمها أو يدها، ولا يجب ضمان ما أتلفت برِجلها إلا أن يحملها الذي معها على الإتلاف أو يقصده فحينئذٍ يضمن لوجود التعدي منه. وقال الشافعي: إن ما أفسدت الماشية بالنهار من مال الغير فلاضمان على ربها إذا لم يكن معها مالكها، وإن كان معها فعليه ضمان ما أتلفته، سواء كان راكبها او سائقها او قاءدها او كانت واقفة عنده، سواء أتلفت بيدها أو رِجلها أو فمها۔
وأجاب أصحاب أبي حنيفة بأن العجماء جبار مطلق عام، فوجب العمل بعمومه، وأما التعدي فخارج عنه،(عمدة القاري) و(المسوى) ملتقط منهما. وقال في (التعليق الممجّد): فلا يختص الهدر بالجرح، بل كل الإتلافات ملحقة بها. وقال عياض: إنما نبَّه بالجرح؛ لأنه الأغلب أو هو مثال نَبَّه به على ما عداه.
٣ قوله: والمعدن جبار والبئر جبار: معناه أن الرجل يستأجر الرجل لحفر البئر أو المعدن فيسقط البئر أو المعدن على الحافرفيقتله، فذلك هدر لا ضمان فيه؛ لعدم التسبب والمباشرة منه. التقطته من (موطأ محمد) و(التعليق الممجّد).
وعن يعلي بن امية رضي الله عنه غزوت مع رسول الله ﷺ جيش العسرة ،وكان لي أَجِيرُ، فَقَاتَلَ إِنْسَانًا، فَعَضَّ أَحَدُهُمَا يَدَ الْآخَرِ، فَانْتَزَعَ الْمَعْضُوْضُ يَدَهُ مِنْ فِي الْعَاضِ،فَأَنْدَرَ ثَنِيَّتَهُ فَسَقَطَتْ، فَانْطَلَقَ إِلَى النَّبِيِّ ﷺ فَأَهْدَرَ ثَنِيَّتَهُ،١ وَقَالَ:(أَفَيَدَعُ يَدَهُ فِي فِيكَتَقْضَمُهَا كَالْفَحْلِ). مُتَّفَقُّ عَلَيْهِ.
Ya’la ibn Umayyah (may Allah be pleased with him) narrated: "I went on the expedition of difficulty with the Messenger of Allah (ﷺ), and I had a hired worker. He fought with a man, and one of them bit the other’s hand. The one who was bitten pulled his hand from the biter’s mouth, dislodging his incisor, which fell out. He went to the Prophet (ﷺ), who waived his incisor and said: 'Would he leave his hand in your mouth for you to gnaw on it like a stallion?'" [Agreed upon]

1 His statement: “He waived his incisor” etc.: The scholars differed on this. A group said: "If someone bites another’s hand, and the bitten one pulls his hand from the biter’s mouth, dislodging some of the biter’s teeth, there is nothing upon him for the tooth." This is narrated from Abu Bakr Al-Siddiq and Shurayh, and it is the view of the Kufans and Al-Shafi’i. They said: "If the bitten one injured him elsewhere, he is liable for it." Ibn Abi Layla and Malik said: "He is liable for the blood money of the tooth." The Hadith of this chapter is evidence for the first group. So it is in (Umdat al-Qari). It is said in (Nayl al-Awtar): "This Hadith indicates that if an offense occurs due to the victim, like the mentioned incident and similar, there is no retribution or compensation. The majority hold this view, but with the condition that the bitten one, for example, could not free his hand or similar by a lesser means, and that the bite was painful. The apparent evidence does not require this condition. It is said: 'It is from qualifying with general rules.'"
١ قوله: فأهدر ثنيته إلخ: واختلف العلماء فيه، فقالت طائفة: من عَضَّ يد رجل فانتزع المعضوض يده من فم العاضَ فقلع شيئًا من أسنان العاض فلا شيء عليه في السن، روي هذا عن أبي بكر الصديق وشريح، وهو قول الكوفيين والشافعي، قالوا: ولو جرحه المعضوض في موضع آخر فعليه ضمانه. وقال ابن أبي ليلى ومالك: هو ضامن لدية السن، وحديث الباب حجة الأولين. كذا في (عمدة القاري). وقال في (نيل الأوطار): هذا الحديث يدل على أن الجناية إذا وقعت على المجني بسبب منه كالقصة المذكورة وما شابهها، فلا قصاص ولا أرش، وإليه ذهب الجمهور، ولكن بشرط أن لا يتمكن المعضوض مثلًا من إطلاق يده أو نحوها بما هو أيسر من ذلك، وأن يكون ذلك العض مما يتألم به المعضوض، وظاهر الدليل عدم الاشتراط. وقد قيل: إنه من باب التقييد بالقواعد الكلية.
وَعَنْ أَبِيْ هُرَيْرَةَ قَالَ: جَاءَ رَجُلٌّ، فَقَالَ: يَا رَسُوْلَ اللهِ! أَرَيْتَ إِنْ جَاءَ رَجُلٌ يُرِيدُ أَخْذَ مَالِي؟ قَالَ: (فَلَا تُعْطِهِ مَالَكَ) قَالَ: أَرَأَيْتَ إِنْ قَاتَلَنِيْ؟ قَالَ:(قَاتِلْهُ) قَالَ: أَرَأَيْتَ إِنْ قَتَلَنِي؟ قَالَ: (فَأَنْتَ شَهِيدٌ)، قَالَ: أَرَأَيْتَ٢ إِنْ قَتَلْتُهُ؟ قَالَ: (هُوَ فِي النَّارِ). رَوَاهُ مُسْلِمٌ.
وَفِي (الْمُتَّفَقِ عَلَيْه) عَنْ عَبْدِ اللهِ بْنِ عَمْرِو قَالَ: سَمِعْتُ رَسُوْلَ اللهِ ﷺ يَقُوْلُ:(منْ قُتِلَ دُونَ مَالِهِ فَهُوَ شَهِيدٌ).
وَرَوَى التَّرْمِذِيُّ وَأَبُوْ دَاوُدَ وَالنَّسَائِيُّ عَنْ سَعِيْدِ بْنِ زَيْدٍ أَنَّ رَسُوْلَ اللهِ ﷺ قَالَ: (مَنْ قُتِلَ دُونَ دِينِهِ فَهُوَ شَهِيدٌ، وَمَنْ قُتِلَ دُونَ دَمِهِ فَهُوَ شَهِيدٌ، وَمَنْ قُتِلَ١ دُونَ مَالِهِ فَهُوَ شَهِيدٌ، وَمَنْ قُتِلَ دُونَ أَهْلِهِ فَهُوَ شَهِيدً).
Abu Hurayrah (may Allah be pleased with him) narrated: A man came and said: "O Messenger of Allah! What if a man comes wanting to take my property?" He said: "Do not give him your property." He said: "What if he fights me?" He said: "Fight him." He said: "What if he kills me?" He said: "Then you are a martyr." He said: "What if I kill him?" He said: "He is in the Fire." [Narrated by Muslim]
In an agreed-upon narration from Abdullah ibn Amr, he said: "I heard the Messenger of Allah (ﷺ) say: 'Whoever is killed defending his property is a martyr.'"
Al-Tirmidhi, Abu Dawud, and Al-Nasa’i narrated from Sa’id ibn Zayd that the Messenger of Allah (ﷺ) said: "Whoever is killed defending his religion is a martyr, whoever is killed defending his life is a martyr, whoever is killed defending his property is a martyr, and whoever is killed defending his family is a martyr."

1 His statement: “He said: 'What if I kill him?' He said: 'He is in the Fire'”: This permits killing one who intends to take property unjustly, whether little or much, due to the generality of the Hadith. This is the view of the majority of scholars. Some of Malik’s companions said: "It is not permissible to kill him if he demands something minor like a garment or food." This is nothing, and the correct view is that of the majority. It also indicates that if the aggressor is killed, there is no blood money or retribution for him, and if the defender is killed, he is a martyr. So it is stated in (Umdat al-Qari). It is said in (Al-Mirqat): "The general view of the scholars is that if a man’s property, life, or family is targeted, he may repel the aggressor by the best means. If he cannot prevent it except by fighting and kills him, there is nothing upon him." It is said in (Al-Durr al-Mukhtar): "Whoever transgresses against a man’s sanctities, it is permissible for him to kill him, even if he does not find evidence, so retribution applies in worldly rulings, and there is no sin in the hereafter." In another place: "If someone enters another’s house at night and steals, and the owner follows and kills him, there is nothing upon him, due to his (ﷺ) statement: 'Fight for your property.' Likewise, if he kills him before taking, if he intended to take his property and could not repel him except by killing." (Sadr al-Shari’ah).
2 His statement: “Whoever is killed defending his property is a martyr”: It is said in (Al-Durr al-Mukhtar): "It is permissible to fight for one’s property, even if it does not reach the minimum amount, and to kill whoever fights him for it, due to the generality of the Hadith: 'Whoever is killed defending his property is a martyr.'" (Fath).
٢ قوله: قال: أرأيت إن قتلته؟ قال: هو في النار: فيه جواز قتل القاصد لأخذ المال بغير حق سواء كان قليلا أو كثيرا؛ لعموم الحديث. وهذا قول جماهير العلماء. وقال بعض أصحاب مالك: لا يجوز قتله إذا طلب شيئًا يسير كالثوب والطعام. وهذا ليس بشيء، والصواب ما قالهالجماهير، وفيه أن القاصد إذا قتل لا دية له ولا قصاص، وفيه أن الدافع إذا قتل يكون شهيدًا. قاله في (عمدة القاري). وقال في (المرقاة): وعامة العلماء على أن الرجل إذا قصد ماله أو دمه أو أهله فله دفع القاصد بالأحسن، فإن لم يمتنع إلا بالمقاتلة، فقتله فلا شيء عليه انتهى. وفي (الدر المختار): من تعدى على محارم رجل يجوز له قتله وإن لم يجد البيئة فيقتصفي أحكام الدنيا ولا حرج عليه في أحكام الآخرة. وقال في موضع آخر منه: ومن دخل عليه غيره ليلًا فأخرج السرقة من بيته فأتبعه ربُّ البيت فقتله فلا شيء عليه؛ لقوله ﷺ: (قاتل دون مالك)، وكذا لو قتله قبل الأخذ إذا قصد أخذ ماله ولم يتمكن من دفعه إلا بالقتل. صدر الشريعة.
١ قوله: ومن قتل دون ماله فهو شهيد: وقال في (الدر المختار) ويجوز أن يقاتل دون ماله وإن لم يبلغ نصابًا، ويقتل من يقاتله عليه؛ لإطلاق الحديث: (من قتل دون ماله فهو شهيد)، (فتح).
عن ابي هريرة رضي الله عنه انه سمع رسول الله ﷺ يقول : لو اطلع في بيتك احد وَلَمْ
تَأْذَنْ لَهُ خَدَفْتَهُ بِحَصَاةٍ، فَفَقَأْتَ٢ عَيْنَهُ مَا كَانَ عَلَيْكَ مِنْ جُنَاجِ. مُتَّفَقٌّ عَلَيْهِ.
فَالْحَدِيْثُ مَحْمُوْلُ عِنْدَ أَبِيْ حَنِيْفَةَ عَلَى مَنْ نَظَرَ فِي بَابِ دَارٍ رَجُلٌ، فَفَقَأَ الرَّجُلُ عَيْنَهُ لَا يَضْمَنُ إِنْ لَمْ يُمْكِنْهُ تَنْحِيَتَهُ مِنْ غَيْرٍ فَقْئِهَا، وَإِنْ أَمْكَنَهُ ضَمِنَ.
وَفِي رِوَايَةٍ لَهُمَا عَنْ سَهْلِ بْنِ سَعْدٍ أَنَّ رَجُلًا اطَّلَعَ فِي جُحْرٍ فِي بَابٍ رَسُوْلِ اللهِ وَمَعَ رَسُوْلِ اللهِ مِدْرَى يَحْكُّ بِهِ رَأْسَهُ، فَقَالَ: (لَوْ أَعْلَمُ أَنَّكَ تَنْتَظِرُنِي لَطَعَنْتُ بِهِ فِي عَيْنَيْكَ، إِنَّمَا جُعِلَ الإِسْتِئْذَانُ مِنْ أَجْلِ الْبَصَرِ).
وَرَوَى التَّرْمِذِيُّ عَنْ أَبِيْ ذَرِّ ُ قَالَ: قَالَ رَسُوْلُ اللهِ: (مَنْ كَشَفَ سِتْرًا فَأَدْخَلَ بَصَرَهُ فِي الْبَيْتِ قَبْلَ أَنْ يُؤْذَنَ لَهُ، فَرَأَى عَوْرَةً أَهْلِهِ فَقَدْ أَنَى حَدَّا لَا يَحِلُّ لَهُ أَنْ يَأْتِيَهُ لَوْأَنَّهُ حِينَ أَدْخَلَ بَصَرَّهُ اسْتَقْبَلَهُ رَجُلٌّ فَفَقَأَّ عَيْنَيْهِ مَا عَيَرْتُ عَلَيْهِ، وَإِنْ مَرَّ الرَّجُلُ عَلَى بَابٍ لَا سِتُرَلَهُ غَيْرٍ مُغْلَقٍ فَنَظَرَ فَلَا خَطِيئَةَ عَلَيْهِ، إِنَّمَا الْخَطِيئَةُ عَلَى أَهْلِ الْبَيْتِ).
Abu Hurayrah (may Allah be pleased with him) narrated that he heard the Messenger of Allah (ﷺ) say: "If someone peeks into your house without permission and you throw a pebble at him, blinding his eye, there is no sin upon you." [Agreed upon]
Per Abu Hanifah, this Hadith is understood to mean that if a man looks through the door of another’s house and the man blinds his eye, he is not liable if he could not remove him without blinding him. If he could, he is liable.
In a narration by the two from Sahl ibn Sa’d, a man peeked through a hole in the door of the Messenger of Allah (ﷺ), and the Messenger of Allah (ﷺ) had a comb with which he was scratching his head. He said: "If I knew you were watching me, I would have stabbed your eyes with it. Permission was made for the sake of sight."
Al-Tirmidhi narrated from Abu Dharr that the Messenger of Allah (ﷺ) said: "Whoever lifts a curtain and looks into a house before being permitted and sees the private parts of its people has committed a forbidden act. If a man confronts him and blinds his eyes, I would not blame him. If a man passes by an open door without a curtain and looks, there is no sin upon him; the sin is upon the people of the house."

1 His statement: “And you blind his eye, there is no sin upon you”: In (Al-Qunyah): "If someone looks through the door of another’s house and the man blinds his eye, he is not liable if he could not remove him without blinding him. If he could, he is liable." Al-Shafi’i said: "He is not liable in both cases. If he inserted his head and was hit with a stone, blinding him, there is no liability by consensus. The disagreement is only if he looked from outside." So it is in (Al-Durr al-Mukhtar). It is said in (Radd al-Muhtar): "In (Mi’raj al-Dirayah): If someone looks into another’s house through a hole or door crack or similar, and the owner stabs him with a stick or throws a pebble, blinding his eye, he is liable per our view. Per Al-Shafi’i, he is not liable, due to what Abu Hurayrah narrated that he (ﷺ) said: 'If a man peeks at you without permission and you throw a pebble at him, blinding his eye, there is no sin upon you,' and his (ﷺ) statement: 'For the eye, half the blood money,' which is general. Merely looking does not permit offending him, like looking through an open door or entering his house and looking or touching his wife short of intercourse; it does not permit blinding his eye. His (ﷺ) statement: 'The blood of a Muslim is not lawful except for one of three,' implies that his sanctity is not waived. The intent of what Abu Hurayrah narrated is to emphasize deterrence. Similar in Ta’ from Al-Shamni. His statement: 'Like if he entered his house,' etc., contradicts what the commentator, the author of (Al-Durr al-Mukhtar), mentioned, unless what he mentioned is when removal is not possible without it, and here when it is possible, so reflect, and Allah knows best."
٢ قوله: ففقأت عينه ما كان عليك من جناح: وفي (القنية): من نظر في باب دار رجل ففقاً الرجل عينه لا يضمن إن لم يمكنه تَنحيتُه من غيره ففقاً، وإن أمكنه ضمن. وقال الشافعي: لا يضمن فيهما، ولو أدخل رأسه فرماه بحجر ففقأها لا يضمن إجماعًا، إنما الخلاف فيمن نظر من خارجها. كذا في (الدر المختار). وقال في (رد المحتار): وفي (معراج الدراية): ومن نظر في بيت إنسان من نقب أو شق باب أو نحوه فطعنه صاحب الدار بخشبة أو رماه بحصاه ففقاً عينه يضمن عندنا، وعند الشافعي لا يضمن؛ لما روى أبو هريرة أنه ﷺ قال: (لو أن امرأ اطلع عليك بغير إذن فخذفته بحصاة وفقأت عينه لم يكن عليك جناح)، ولقوله ﷺ:(في العين نصف الدية)، وهو عام، ولأن مجرد النظر إليه لا يبيح الجناية عليه، كما لو نظر من الباب المفتوح وكما لو دخل بيته ونظر فيه أو نال من امرأته ما دون الفرج لم يجز قلع عينه، ولأن قوله ﷺ: (لا يحل دم امرئ مسلم) الحديث يقتضي عدم سقوط عصمته. والمراد ما روى أبو هريرة المبالغة في الزجر عن ذلك. ومثله في ط عن الشمني، وقوله: وكما لو دخل بيته إلخ مخالف لما ذكره الشارح صاحب (الدر المختار) إلا أن يحمل ما ذكره على ما إذا لم يكن تنحيته بغير ذلك وما هنا على ما إذا أمكن، فليتأمل والله أعلم.
وَعَنْ عَبْدِ اللهِ مُغَقَّلٍ ُ أَنَّهُ رَأَى رَجُلًا يَخْذِفُ وَقَالَ: لَا تَخْذِفْ؛ فَإِنَّ رَسُولَ اللهِﷺ نَهَى عَنِ الْخَذْفِ، وَقَالَ: (إِنَّهُ لَا يُصَادُ بِهِ صَيْدُ، وَلَا يُنْكَى بِهِ عَدُوٌّ،وَلَكِنَّهَا قَدْ تَكْسِرُ السَّنَّ وَتَفْقَأُ الْعَيْنَ). مُتَّفَقُ عَلَيْهِ.
Abdullah ibn Mughaffal (may Allah be pleased with him) narrated that he saw a man throwing pebbles and said: "Do not throw pebbles, for the Messenger of Allah (ﷺ) forbade throwing pebbles and said: 'It does not catch game nor defeat an enemy, but it may break a tooth or blind an eye.'" [Agreed upon]
وَعَنْ أَبِيَّ مُؤْسَى قَالَ: قَالَ رَسُوْلُ اللهِ ﷺ: (إِذَا مَرَّ أَحَدُكُمْ فِي مَسْجِدِنًا أَوْ فِي سُوقِنَا وَمَعَهُ نَبْلَّ، فَلْيُمْسِكْ عَلَى نِصَالِهَا بِكَفِّهِ أَنْ يُصِيبَ أَحَدًا مِنَ الْمُسْلِمِينَ مِنْهَا شَيْءٍ). مُتَّفَقُّ عَلَيْهِ.
Abu Musa (may Allah be pleased with him) narrated: The Messenger of Allah (ﷺ) said: "If one of you passes through our mosque or market with arrows, let him hold their tips with his hand lest any Muslim be harmed by them." [Agreed upon]
وعن ابي هريرة رضي الله عنه قال : قال رسول الله ﷺ(لا يشير احدكم علي أَخِيهِ بِالسَّلَاحِ؛ فَإِنَّهُ لَا يَدْرِيْ لَعَلَّ الشَّيْطَانَ يَنْزِعُ فِي يَدِهِ، فَيَقَعُ فِي حُفْرَةٍ مِنْ النَّار).مُتَّفَقُّ عَلَيْهِ
Abu Hurayrah (may Allah be pleased with him) narrated: The Messenger of Allah (ﷺ) said: "Let none of you point a weapon at his brother, for he does not know; perhaps Satan may cause it to slip from his hand, and he falls into a pit of Fire." [Agreed upon]
وَعَنْهُ، قَالَ: قَالَ رَسُوْلُ اللهِ ﷺ: (مَنْ أَشَارَ إِلَى أَخِيهِ بِحَدِيدَةٍ فَإِنَّ الْمَلَائِكَةَ تَلْعَنْهُ حَتَّى يَدَعَهُ وَإِنْ كَانَ أَخَاهُ لِأَبِيهِ وَأُمَّهِ). رَوَاهُ الْبُخَارِيُّ.
Abu Hurayrah (may Allah be pleased with him) narrated that the Messenger of Allah (ﷺ) said: “Whoever points a piece of iron at his brother, the angels curse him until he desists, even if it is his brother from his father and mother.” [Narrated by Al-Bukhari]
وَعَنِ ابْنِ عُمَرَ وَأَبِيْ هُرَيْرَةَ رَضِیَ اللهُ عَنهُما عَنِ النَّبِيِّ ﷺ قَالَ: (مَنْ حَمَلَ عَلَيْنَا السِّلَاحَ فَلَيْسَ مِنَّا). رَوَاهُ الْبُخَارِيُّ، وَزَادَ مُسْلِمُ: (وَمَنْ غَشَّنَا فَلَيْسَ مِنَّا).
Ibn Umar and Abu Hurayrah (may Allah be pleased with them) narrated that the Prophet (ﷺ) said: “Whoever bears arms against us is not one of us.” [Narrated by Al-Bukhari] Muslim added: “And whoever deceives us is not one of us.”
وَعَنْ سَلَمَةَ بْنِ الْأَكْوَعِ رَضِیَ اللهُ عَنهُ قَالَ: قَالَ رَسُوْلُ اللهِ ﷺ: (مَنْ سَلَّ عَلَيْنَا السَّيْفَ فَلَيْسَ مِنَّا). رَوَاهُ مُسْلِمٌ.
Salamah ibn Al-Akwa’ (may Allah be pleased with him) narrated that the Messenger of Allah (ﷺ) said: “Whoever draws a sword against us is not one of us.” [Narrated by Muslim]
وَغَنِ ابْنِ عُمَرَ رَضِیَ اللهُ عَنهُماعَنِ النَّبِيِّ ﷺ قَالَ: (لِجَهَنَّمَ سَبْعَةُ أَبْوَابٍ، بَابٌ مِنْهَا لِمَنْ سَلَّ السَّيْفَ عَلَى أُمَّتِي - أَوْ قَالَ -: عَلَى أُمَّةِ مُحَمَّدٍ). رَوَاهُ التِّرْمِذِيُّ، وَقَالَ: هَذَا حَدِيْثٌ غَرِيْبُ.
Ibn Umar (may Allah be pleased with them) narrated that the Prophet (ﷺ) said: “Hellfire has seven gates, one of which is for those who draw a sword against my nation, or he said: the nation of Muhammad.” [Narrated by Al-Tirmidhi, who said: This Hadith is gharib (unusual).]
وعن جابررَضِیَ اللهُ عَنهُ قال نهي رسول الله ﷺ ان يتعاطي السيف مسلولا رواه الترمذي وابوداؤد.
Jabir (may Allah be pleased with him) narrated that the Messenger of Allah (ﷺ) forbade handing a drawn sword to another. [Narrated by Al-Tirmidhi and Abu Dawud]
وعن الحسن عن سمرةرَضِیَ اللهُ عَنهُ ان رسول الله ﷺ نهي ان یقد السیر بین اصبعین رواہ ابو داؤد۔
Al-Hasan narrated from Samurah (may Allah be pleased with him) that the Messenger of Allah (ﷺ) forbade guiding a sword between two fingers. [Narrated by Abu Dawud]

1 His statement: “Forbade guiding a sword” etc.: Ibn Al-Malik said: The prohibition in these two Hadiths is one of disapproval and compassion. So it is in (Al-Mirqat).

عَنْ هِشَامِ بْنِ عُرْوَةَ عَنْ أَبِيهِ أَنَّ هِشَامَ بْنَ حَكِيمِ بْنِ حِزَامٍ مَرَّ بِالشَّامِعَلَى أُنَاسِ مِنَ الْأَنْبَاطِ وَقَدْ أُقِيمُوا فِي الشَّمْسِ، وَصُبَّ عَلَى رُؤُؤْسِهِمْ الزَّيْتُ. فَقَالَ: مَاهَذَا؟ قِيْلَ: يُعَذَّبُونَ فِي الْخَرَاجِ، فَقَالَ هِشَامٌ: أَشْهَدُ لَسَمِعْتُ رَسُولَ اللهِ ﷺ يَقُولُ: (إِنَّاللهَ يُعَذِّبُ الَّذِينَ يُعَذِّبُونَ النَّاسَ فِي الدُّنْيَا). رَوَاهُ مُسْلِمٌ.
Hisham ibn Urwah narrated from his father that Hisham ibn Hakim ibn Hizam passed by some Nabateans in Al-Sham who were made to stand in the sun with oil poured over their heads. He asked: “What is this?” It was said: “They are being punished for the land tax.” Hisham said: “I bear witness that I heard the Messenger of Allah (ﷺ) say: ‘Allah will punish those who punish people in this world.’” [Narrated by Muslim]
وَعَنْ أَبِيْ هُرَيْرَةَ رَضِیَ اللهُ عَنهُ قَالَ: قَالَ رَسُوْلُ اللهِ ﷺ: (يُوشِكُ إِنْ طَالَتْ بِكَ مُدَّةًأَنْ تَرَى قَوْمًا فِي أَيْدِيهِمْ مِثْلُ أَذْتَابِ الْبَقَرِ، يَغْدُونَ فِي غَضَبِ اللهِ وَيَرُوحُونَ فِي سَخَطِاللّهِ). وَفِي رِوَايَةٍ: (وَيَرُوحُونَ فِي لَعْنَةِ اللّهِ). رَوَاهُ مُسْلِمٌ.
Abu Hurayrah (may Allah be pleased with him) narrated that the Messenger of Allah (ﷺ) said: “Soon, if you live long, you will see people holding in their hands what resemble the tails of cows; they go out in the morning under Allah’s wrath and return in the evening under Allah’s displeasure.” In another narration: “And return under Allah’s curse.” [Narrated by Muslim]
وَعَنْهُ رَضِیَ اللهُ عَنهُ قَالَ: قَالَ رَسُوْلُ اللهِ ﷺ: (صِنْفَانٍ مِنْ أَهْلِ النَّارِ لَمْ أَرَهُمَا قَوْمٌمَعَهُمْ سِيَاطٌ كَأَذْئَابِ الْبَقَرِ يَضْرِبُونَ بِهَا النَّاسَ وَنِسَاءُ كَاسِيَاتٌ عَارِيَاتٌ مُمِيلَاتُمَائِلَاتُ رُءُوسُهُنَّ كَأَسْنِمَةِ الْبُخْتِ الْمَائِلَةِ لَا يَدْخُلْنَ الْجَنَّةَ وَلَا يَجِدْنَ رِيحَهَا وَإِنَّ رِيحَهَالَيُوجَدُ مِنْ مَسِيرَةٍ كَذَا وَكَذَا). رَوَاهُ مُسْلِمٌ.
Abu Hurayrah (may Allah be pleased with him) narrated that the Messenger of Allah (ﷺ) said: “Two types of people of Hellfire I have not seen: a people with whips like the tails of cows, with which they strike people, and women who are clothed yet naked, inclining and inclined, their heads like the humps of leaning Bactrian camels. They will not enter Paradise nor smell its fragrance, though its fragrance can be sensed from such and such a distance.” [Narrated by Muslim]

١قوله: أهل الردة: يعني المرتد والمرتدة. هو لغة: الراجع، وشرعا: الراجع عن دين الإسلام. وركن الردة إجراءكلمة الكفر على اللسان بعد الإيمان. ويشترط لصحة الردة العقل والصحو والطوع، فلا تصح ردة مجنون ومعتوه وموسوس وصبي لا يعقل وسكران ومكرَه عليها، والبلوغ والذكورة ليسا بشرط. مأخوذ من شروح (الكنز)

وَعَنْهُ رَضِیَ اللهُ عَنهُ قَالَ: قَالَ رَسُوْلُ اللهِ ﷺ: (إِذَا قَاتَلَ أَحَدُكُمْ أَخَاهُ فَلْيَجْتَنِبْالْوَجْهَ؛ فَإِنَّ اللهَ خَلَقَ آدَمَ عَلَى صُورَتِهِ). مُتَّفَقُّ عَلَيْهِ.
Abu Hurayrah (may Allah be pleased with him) narrated that the Messenger of Allah (ﷺ) said: “If one of you fights his brother, let him avoid the face, for Allah created Adam in His image.” [Agreed upon]

1 His statement: Al-Qasama: With a fatha on the first letter, it refers to oaths sworn by the residents of a locality where a slain person is found, according to our view. According to Al-Shafi’i, it is sworn by the heirs of the victim claiming blood money due to the unknown identity of the killer. Its cause is the occurrence of a killing in the locality or its equivalent. Its condition is their statement: “By Allah, we did not kill him, nor do we know his killer.” Its requirement is that the oath-taker be a free, sane man. Malik said: Women are included in qasama for unintentional killing, not intentional. Its ruling is that the judgment is enforced, and blood money is imposed after the oath, whether the claim is for intentional or unintentional killing.
