حَدَّثَنَا أَبُو بَرِيدٍ رَضِيَ اللَّهُ تَعَالَى عَنْهُ مَرْوِيٌّ عَنْ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ

أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ: مَنْ قَتَلَ حَيَّةً فِي أَوَّلِ لَيْلَةٍ فَقَدْ أَجْرَى عَلَى أَهْلِ الدَّارِ الْبَرَكَةَ فِي أَمْوَالِهِمْ وَأَطْعَامِهِمْ وَأَشْرَابِهِمْ

1قولہ العجماء جرحها جبار (چوپائے کے کسی کوئی کروینے کاضمان (تاوان) نہیں) اس سے حضرت امام البوحنیفرحمۃ اللہ علیہ نے استدلال کیا ہے اس بات پر کہ جانور دوسرے کے مال کو خراب کر دے اور اس کے ساتھ اس کاما لک نہ ہوتا اس پر ضمان نہیں خواہ رات میں ہو یا دن میں۔ اور اگراس کے ساتھ اس کاما لک ہوا اور اس کو چھپے سے باکر رباہوتو بر حالت میں تلف شدہ کا اس پر ضمان نہ اور اگراس کاما لک ساتھ ہو یا اس پر سوار ہو تو اس پر ان چیز ول کا ضمان نہ جن کو چوپائے نے منہ یا اٹھے تلف کیا ہے۔ اور جس کو (چوپائے) نے پیرے تلف کیا ہے اس کا ضمان نہیں۔ لہذا اگر ساتھ رہنے والا اس کو تلف کر نے پر ابھارے یا اس کا قصد کرے تو ایسی صورت میں چونکہ اس کی طرف سے زیادتی پانی جارہی ہے اس لے وہ ضمان دے گا۔ حضرت امام شافعی رحمۃ اللہ علیہ فرماتے ہیں کہ جانور دن میں اگر دوسرے کا مال تلف کر دے اور ما لک ساتھ نہ ہو تو اس پر ضمان نہیں۔ لہذا اور اگر ما لک اس کے ساتھ نہ ہو خواہ سوار ہو یا چھپے سے باکر رباہو یا ساتھ ہو یا وہ جانور اس کے پاس ہمراہ ہوا ہو بر حالت میں اس پر ضمان نہ خواہ ہاتھ تلف کرے یا پیرے یا منہ سے۔ حضرت امام البوحنیفرحمۃ اللہ علیہ کے اصحاب اس کے جواب میں فرماتے ہیں کہ العجماء جرحها جبار مطلق سے اور عام سے، اس کے عموم پر عمل کرنا ضروری ہے البتر زیادتی ہو تو واسے خارج ہے۔ (ماخوذ از عمدۃ القاری وامسوی) اور اتعلیق امحمد میں سے کر ضمان کانہونازم کے ساتھ خاص نہیں سے بلکہ تمام نقصانات کی اس کے ساتھ شامل ہیں۔ حضرت عیاض رحمۃ اللہ علیہ فرماتے ہیں کہ زخم جوخاص طور پر زکر کیا گیا وہ اکثریت کے اعتبار سے ہے یا یکر وہ دوسرے اور نقصانات کے لے ایک مثل کے طور پر ہے۔

Abu Hurayrah (may Allah be pleased with him) narrated: The Messenger of Allah (ﷺ) said: "The injury caused by a dumb animal is waived, the mine is waived, and the well is waived." [Agreed upon]

حضرت لعلی بن امیر ضی اللہ تعالیٰ عمنے مروی سے کہ میں جیش عسرت (غزوہ تھوک) میں رسول اکرم صلی اللہ علیہ وسلم کے ہمراہ جہاں میں شریک رہا۔ اور میرا ایک نوکر تھا جس کی ایک شخص سے لڑائی ہوئی۔ ان میں سے ایک نے دوسروے کا باٹھ کر دیا۔ جس کا باٹھ کرتا اگیا تھا اس نے اپنے باٹھ کو کتر نے والے کے منہ میں اس طرح کھینچا کر اس کا سانخ کا دانت آ کھڑ کر گر گیا وہ شخص نبی اکرم صلی اللہ علیہ وسلم کی خدمت میں حاضر ہوا۔ آپ صلی اللہ علیہ وسلم کے دانت کا تاوان نہیں دلا یا۔ اور آپ علیہ صلی اللہ نے فرمایا: کیا وہ شخص اپنا باٹہ تیرے منہ میں چھوڑے رکھتا، تاکہ تو سانخ کی طرح اس کو چھاڈا لے۔ (بخاری و مسلم)

Ya’la ibn Umayyah (may Allah be pleased with him) narrated: "I went on the expedition of difficulty with the Messenger of Allah (ﷺ), and I had a hired worker. He fought with a man, and one of them bit the other’s hand. The one who was bitten pulled his hand from the biter’s mouth, dislodging his incisor, which fell out. He went to the Prophet (ﷺ), who waived his incisor and said: 'Would he leave his hand in your mouth for you to gnaw on it like a stallion?'" [Agreed upon]

(1) His statement: “He waived his incisor” etc.: The scholars differed on this. A group said: "If someone bites another’s hand, and the bitten one pulls his hand from the biter’s mouth, dislodging some of the biter’s teeth, there is nothing upon him for the tooth." This is narrated from Abu Bakr Al-Siddiq and Shurayh, and it is the view of the Kufans and Al-Shafi’i. They said: "If the bitten one injured him elsewhere, he is liable for it." Ibn Abi Layla and Malik said: "He is liable for the blood money of the tooth." The Hadith of this chapter is evidence for the first group. So it is in (Umdat al-Qari). It is said in (Nayl al-Awtar): "This Hadith indicates that if an offense occurs due to the victim, like the mentioned incident and similar, there is no retribution or compensation. The majority hold this view, but with the condition that the bitten one, for example, could not free his hand or similar by a lesser means, and that the bite was painful. The apparent evidence does not require this condition. It is said: 'It is from qualifying with general rules.'"

صلى الله عليه وسلم کو مارو الول؟ آپ علیسے نے فرمايا: وہ دوزخ میں جائے گا۔ 4 (مسلم)

سیدنا ابو بریرہ رضی اللہ عنہ روایت کرتے ہیں کہ ایک شخص آیا اور اس نے کہا یا رسول اللہ علیہ صلی اللہ آپ، میں فرمایے اگر کوئی شخص میرے پاس میرا مال چھین لینے آے (تو کیا میں اپنا مال اس کے حوالے کر دوں)۔ آپ علیہ صلی اللہ نے فرما یہیں! تم اس کو اپنا مال لینے دو۔ اس نے عرض کیا اگروہ مجھے سے لڑے تو حضرت علیہ صلی اللہ نے فرما یا تم مجھی اس سے لڑو۔ اس نے عرض کیا، بتلا یہ اگروہ مجھے مار ذا لے؟ آپ نے فرما یا (ایسی صورت میں) تم شہادت کا درجہ پاؤ گے۔ اس نے عرض کیا اگر میں اس

Abu Hurayrah (may Allah be pleased with him) narrated: A man came and said: "O Messenger of Allah! What if a man comes wanting to take my property?" He said: "Do not give him your property." He said: "What if he fights me?" He said: "Fight him." He said: "What if he kills me?" He said: "Then you are a martyr." He said: "What if I kill him?" He said: "He is in the Fire." [Narrated by Muslim]

In an agreed-upon narration from Abdullah ibn Amr, he said: "I heard the Messenger of Allah (ﷺ) say: 'Whoever is killed defending his property is a martyr.'"

Al-Tirmidhi, Abu Dawud, and Al-Nasa’i narrated from Sa’id ibn Zayd that the Messenger of Allah (ﷺ) said: "Whoever is killed defending his religion is a martyr, whoever is killed defending his life is a martyr, whoever is killed defending his property is a martyr, and whoever is killed defending his family is a martyr."

(1) His statement: “He said: 'What if I kill him?' He said: 'He is in the Fire'”: This permits killing one who intends to take property unjustly, whether little or much, due to the generality of the Hadith. This is the view of the majority of scholars. Some of Malik’s companions said: "It is not permissible to kill him if he demands something minor like a garment or food." This is nothing, and the correct view is that of the majority. It also indicates that if the aggressor is killed, there is no blood money or retribution for him, and if the defender is killed, he is a martyr. So it is stated in (Umdat al-Qari). It is said in (Al-Mirqat): "The general view of the scholars is that if a man’s property, life, or family is targeted, he may repel the aggressor by the best means. If he cannot prevent it except by fighting and kills him, there is nothing upon him." It is said in (Al-Durr al-Mukhtar): "Whoever transgresses against a man’s sanctities, it is permissible for him to kill him, even if he does not find evidence, so retribution applies in worldly rulings, and there is no sin in the hereafter." In another place: "If someone enters another’s house at night and steals, and the owner follows and kills him, there is nothing upon him, due to his (ﷺ) statement: 'Fight for your property.' Likewise, if he kills him before taking, if he intended to take his property and could not repel him except by killing." (Sadr al-Shari’ah).

(2) His statement: “Whoever is killed defending his property is a martyr”: It is said in (Al-Durr al-Mukhtar): "It is permissible to fight for one’s property, even if it does not reach the minimum amount, and to kill whoever fights him for it, due to the generality of the Hadith: 'Whoever is killed defending his property is a martyr.'" (Fath).

3 قولہ: فاہد ثبوتہ (دانت کا کوئی تاوان نہیں دلا یا) اس میں علم کا اختلاف ہے ایک جماعت یہ کہتے ہیں:

کوئی آدمی کسی کا باٹہ کتر دالے اور وہ باٹہ کو کتر نے والے کے منہ سے چھین لے اور اس کا کچھ نا کچھ نے واں کو احاطہ دے تو اس دانت کی اس پر کوئی دیت نہیں۔ سیدنا ابو بکر اور سیدنا اثرت رضی اللہ عنہما سے اس طرح کی روایت سے اور یقول کوئی کا اور اما شافعی رحمۃ اللہ علیہ کہ اور ان حضرات کا کہنا یہ کہ جس کو کتر اگیا ہے اگروہ کتر نے واں کو کسی دوسری جگہ زخمی کر دے تو اس پراس کا ضمان آے گا ابن ابی لیلا اور امام ماک رحمہ اللہ فرما تے ہیں کہ وہ دانت کی دیت کا ضامن ہے اور اس باب کی پحدیث پہل حضرات کی کی حفیز و شافعی کی دلیل ہے۔ (عمدۃ القاری)

اور نبل الاوطار میں ہے کہ پحدیث اس بات پر دلالت کرتی ہے کہ جنايت اگر کچی علیہ (جس پر زیادتی کی گئی

ہو) پر خود اس کے سب سے ہو جیے نذکورہ قصہ یا س جسیا کوئی واقعہ ہوتا اس میں قصاص اور تاوان نہیں ہے اور جہہور کا

نہیب ہی ہے کی اس میں یہ شرط لحو ظرہ ہے کی کہ جس کو کتر اگیا ہے اسے اپنے باٹہ کو ایکسی اور عضو کو اس سے آسان

طریقت سے چھڑا لینے کی قدرت نہ ہو اور پکتر نا اس کے لے تکلیف دہ ہو گر ظاہر حدیث سے اس کا شرط نہ ہو نا معلوم

ہوتا ہے اور یہ کچھ کہا گیا ہے کہ پیشر طقواع کلیکی بناء پر قید کا نے کے باب سے ہے۔

سیدنا عبد اللہ بن عمر رضی اللہ تعالیٰ عنہما سے روایت ہے: انہوں نے کہا کہ میں نے رسول اللہ صلی اللہ علیہ وسلم کو بیفرماتے ہوئے سنا ہے کہ جواب پن مال کی حفاظت میں قتل کیا جائے تو وہ شہید ہے (بخاری، مسلم)

سیدنا سعید بن زید رضی اللہ عنہ سے روایت ہے کہ رسول اللہ صلی اللہ علیہ وسلم نے فرمایا جو کوئی اپنے دین کی حفاظت کرتے ہوئے قتل کیا جائے تو وہ شہید ہے۔ اور جواب پن مال کی حفاظت کرتے (جان) کی حفاظت کرتے ہوئے قتل کیا جائے تو وہ بھی شہید ہے۔ اور جو کوئی اپنے غیر والول کی حفاظت کرتے ہوئے قتل کیا جائے تو وہ بھی شہید ہے۔ 5 اور جو کوئی اپنے غیر والول کی حفاظت کرتے ہوئے قتل کیا

قوله: قال ارأيت ان قتلته قال هو في النار (آپ بتلا کیا آریس اس کومارو الول؟ آپ علیسے نے فرمایا: وہ دوزخ میں جائے گا) اس حدیث کی روے ناحق کس کامل لین کا ارادہ رکھنے والے کو قتل کر دینا جائزہ خواہ مال تحوّر اہویازیادہ کیونکہ حدیث کا حکم عام ہے اور پیجمہور علماء کا قول ہے بعض اصحاب امام ماک کا قول پیہ کراگروہ معنوی یہ چیز کوطلب کیا ہے تو قتل کرنا جائز نہیں ہے۔ لیکن ان کا قول درست نہیں اس معاملہ میں جمہور کا قول ہے درست ہے۔ اور اس حدیث شریف سے یہ مستدل کچھ معلوم ہوتا ہے کہ مال چر اس والے کو جب قتل کر دیا جائے تو اس میں اس کے لیے ندویت ہے اور نقصاص اور پیکچی مستدل کردا فعت کرنے والا آگراس میں قتل ہوجائے تو وہ شہید ہے۔ (عمدۃ القاری) اور مرقات میں ہے اکثر علماء بیفرما تے ہیں کہ آگرسی آدمی کے مال یاجان کوفوت کرنے یاس کے پیوی پچون کو ضرر پیچا نے کا ارادہ کیا گیا ہوتا اس آدمی کو اجازت ہے کہ اس ارادہ کرنے والے کو اتنے طریقے سے اس کی مدافعت کرے آگروہ بغیر لا اتي کے بازندا ے اور اس وقت اس کو قتل کر دے تو اس پر کوئی چیز واجب نہیں۔ درختار میں ہے جو آدمی کی کے مارم پرزیادہ کرے تو ایس آدمی کو قتل کرنے کی اس کو اجازت ہے۔ اور آگروہ ایسی صورت میں اپنے لے گو اہ نہ پایے تو دونیا کے احکام میں تو اس سے قصاص لیا جائے گا اور آخرت کے احکام اس پر کوئی گناہ نہیں ہے۔ اور اس کتاب میں ایک دوسرے مقام پر ہے کہ کوئی غیر آدمی کسی کے پاس رات میں داخل ہو اور اس کے گھر سے مال چرا کر لے جارباہے اور ماک مکان اس کا پچھا کر کے مارذا لے تو ایسی صورت میں اس پر کوئی چیز واجب نہیں۔ کیونکہ رسول پاک صلی اللہ علیہ وآل وسلم کا ارشاد پاک ہے "قاتل دون مالک" اپنے مال کی حفاظت کے لیے تم اڑ سکتے ہو۔ اور آگروہ مال لینے کے ارادہ ہے آیا اور اس کو قتل کرنے کے سوا دفع کرنے کی کوئی صورت نہ ہو اور وہ اس کو مال لینے پیلے قتل کر دے تو بھی اس کا بھی حکم ہے "صدر الشریعة"۔

قوله: ومن قتل دون ماله فهو شهيد (اور جواب پن مال کی حفاظت کرتے ہوئے مارا جائے تو وہ شہید ہے) درمتار میں ہے کہ اپنے مال کی حفاظت میں قتل کرنا جائزہ اگر چہ کہ مال نصاب سے کم ہو اور اسی طرح

جاے وہ بھی شہید ہے۔ (ترمذی، ابوداود، نسائی)

It is narrated from Saeed bin Zaid (RA) that the Messenger of Allah ﷺ said:

Whoever is killed while protecting his religion, he is a martyr. And whoever is killed while protecting his property (or life), he is also a martyr. And whoever is killed while protecting his non-mahram, he is also a martyr. And if someone is killed while protecting his non-mahram, I asked: 'What if I kill him?' He said: 'He will be in the Fire.'

This hadith permits the killing of someone who unlawfully intends to take something completely, especially when it involves a significant amount of wealth, because the command of the hadith is general, and the majority of scholars hold this view. Some companions of Imam Malik have opined that if the intention is to take a small amount, then killing is not permissible. However, their opinion is incorrect; in this matter, the majority's view is correct. From this noble hadith, it is deduced that if a thief is killed, there is no retaliation or blood money for him, and the one who kills in self-defense is not held accountable. If he is subsequently killed, he is considered a martyr. (Imda al-Qari) In Al-Mirqat, it is mentioned that most scholars agree that if someone intends to harm another person's property or life, it is permissible for that person to defend themselves by any means necessary. If the aggressor is killed without any unlawful intent, no penalty is imposed. In Durr al-Tar, it is stated that if someone excessively harms another, it is permissible to kill them. If the defender does not find any other way to protect themselves and kills the aggressor, they will be held accountable in worldly law but will not bear any sin in the hereafter. Another place in this book mentions that if someone enters another’s house at night with the intention of stealing and is caught and killed, no penalty is imposed. This is because the Blessed Prophet (peace be upon him and his family) has said, 'The killer and the killed are both owners of the property.' You may resist to protect your property. If the intention is to steal and there is no other way to prevent it except by killing, and the defender kills before the theft occurs, this is also permissible according to 'Sadr al-Sharia.' The statement: 'Whoever is killed while defending his property is a martyr' (and if he is killed while protecting his property, he is a martyr) is found in Durr al-Tar, which states that it is permissible to kill in defense of one's property, even if the property is less than the nisab, and such a person is also considered a martyr. (Tirmidhi, Abu Dawud, Nasa'i)

سیدنا ابوہریرہ رضی اللہ عنہ سے روایت ہے کہ انہوں نے رسول اللہ صلی اللہ علیہ وسلم کو فرماتے ہوئے سنایا کہ آگر کوئی تمہارے گھر میں تجارت کے اورتم نے اس اجازت نہیں دی ہے اور پھر اگر تم کتنے مراسکی آ کہ پھوٹ دو تو تم پر کوئی گناہ نہیں۔ (بخاری و مسلم)

..... لڑنے والے کو تل کر دینا بھی جائزہے کیونکہ حدیث شریف "من قتل دون ماله فهو شهيد "(جوپچمال کی حفاظت کرتے ہوئے قتل کیا جاتے وہ شہید ہے) مطلق ہے۔ (فتح القدیر)

قولہ : ففقأت عینہ ما کان علیک من جناح (پہ تم اس کی آ کہ کو پھوٹ دو تو تم پر کوئی حرج نہیں)

کتاب "القنیہ" میں ہے کہ جو کوئی کسی آدمی کے گھر کے دروازہ میں نظر دا لے اور وہ آدمی اس کی آ کہ کو پھوٹ دے تو اس پر کوئی ضمان نہیں ہے جب کہ بغیر آ کہ پھوٹنے کے اس کو رخ کرنا ممکن نہیں تھا اور اگر بغیر آ کہ پھوٹنے اس کو رخ کرنا ممکن ہوتا ضمان ہو گا۔

امام شافعی رحمۃ اللہ علیہ فرماتے ہیں دونوں صورتوں میں بھی ضامن نہیں ہو گا اور اگر اپنا سراندر داخل کیا (گھر وا لے نے) اس کو پھڑنے مار کر سر پھوٹ دیا تو بالاتفاق اس پر ضمان نہیں ہے۔ اختلاف صرف گھر کے باہر تے دیکھنے وا لے کے بارے میں ہے۔ (درویشار)

اور رواختا ریبل اور محراج الدرائیہ میں ہے۔ جوآدمی کسی انسان کے گھر میں دیکھ گھر کے سوراخ یا دروازے کے شکاف یا س جیسی چیز سے دیکھ تو گھر کا ماکس کو کری سے چچھو کر یا کنگر چیک کراس کی آ کہ پھوٹ دے تو ہمارے پاس وہ اس کا تاوان دے گا۔ امام شافعی رحمۃ اللہ علیہ کے پاس ضمان نہیں دے گا، ان کی ویل سیدنا ابوہریرہ رضی اللہ عنہ کی روایت ہے کہ حضرت صلی اللہ علیہ وآلہ وسلم ارشاد فرماتے آگر کوئی آدمی بغیر اجازت کے تم پر جحا کے تو تم اس کو کرے مار کر آ کہ پھوٹ دو تو تم پر کوئی حرج نہیں۔ اور ہماری ویل حضرت پاک صلی اللہ علیہ وسلم ارشاد گرا می فی العین نصف الدیة (آ کہ میں نصف دیت ہے) اور پی عام ہے اور اس لے کر محض کسی کی طرف دیکھنے کو نقصان پہنچانے کو جائز نہیں کرتا جیسا کر کوئی آدمی کہل ہوئے دروازے میں سے دیکھ لے اور جیسا کر گھر میں پچل جانے اور دیکھ لے یا س کی پیوی کی شرمگاہ کے علاوہ کسی حصہ کوس کرے تو (اس کے جرم پر) اس کی آ کہ نکال دیا جائز نہیں ہے اور اس لے کر حضرت علیہ الصلاۃ والسلام کا ارشاد لا یحل دم امرئی مسلم الا باحدی ثلاث النفس بالنفس و الثیب الزانی والمآرق لدينه التارک للجماعۃ "(تین چیزوں میں کسی ایک چیز کے بغیر کسی مسلمان کا خون کرنا جائز نہیں)

حضرت صلی اللہ علیہ وسلم کا پی ارشاد اس کی عصمت (جان کی سلامتی) کے ساقط نہ ہو نے کا مقتضی ہے۔ اور حضرت سیدنا ابوہریرہ رضی اللہ عنہ کی جوروايت ہے اس سے مقصد اس طرح کے عمل کو نہیں سے روکنے ہے۔ انتہی .......

امام اعظم ابوحنیفہ رحمۃ اللہ علیہ کے نزدیک یہ حدیث شریف اس بات پر محول ہے کہ کوئی آدمی کسی کے گھر کے دروازے میں سے دیکھے اور وہ اس کی آنکھ پھوٹ دے تو اس پر کوئی تاوان نہیں دے گا بلکہ طیبہ بغاوت کہ پھوٹنے والے اس کو ہشانا مکن نہ ہو اور اگر اس کی آنکھ پھوٹ لے بغاوت کو ہشانا مکن ہو تو تاوان دینا پڑے گا۔

Abu Hurayrah (may Allah be pleased with him) narrated that he heard the Messenger of Allah (ﷺ) say: "If someone peeks into your house without permission and you throw a pebble at him, blinding his eye, there is no sin upon you." [Agreed upon]

Per Abu Hanifah, this Hadith is understood to mean that if a man looks through the door of another’s house and the man blinds his eye, he is not liable if he could not remove him without blinding him. If he could, he is liable.

In a narration by the two from Sahl ibn Sa’d, a man peeked through a hole in the door of the Messenger of Allah (ﷺ), and the Messenger of Allah (ﷺ) had a comb with which he was scratching his head. He said: "If I knew you were watching me, I would have stabbed your eyes with it. Permission was made for the sake of sight."

Al-Tirmidhi narrated from Abu Dharr that the Messenger of Allah (ﷺ) said: "Whoever lifts a curtain and looks into a house before being permitted and sees the private parts of its people has committed a forbidden act. If a man confronts him and blinds his eyes, I would not blame him. If a man passes by an open door without a curtain and looks, there is no sin upon him; the sin is upon the people of the house."

(1) His statement: “And you blind his eye, there is no sin upon you”: In (Al-Qunyah): "If someone looks through the door of another’s house and the man blinds his eye, he is not liable if he could not remove him without blinding him. If he could, he is liable." Al-Shafi’i said: "He is not liable in both cases. If he inserted his head and was hit with a stone, blinding him, there is no liability by consensus. The disagreement is only if he looked from outside." So it is in (Al-Durr al-Mukhtar). It is said in (Radd al-Muhtar): "In (Mi’raj al-Dirayah): If someone looks into another’s house through a hole or door crack or similar, and the owner stabs him with a stick or throws a pebble, blinding his eye, he is liable per our view. Per Al-Shafi’i, he is not liable, due to what Abu Hurayrah narrated that he (ﷺ) said: 'If a man peeks at you without permission and you throw a pebble at him, blinding his eye, there is no sin upon you,' and his (ﷺ) statement: 'For the eye, half the blood money,' which is general. Merely looking does not permit offending him, like looking through an open door or entering his house and looking or touching his wife short of intercourse; it does not permit blinding his eye. His (ﷺ) statement: 'The blood of a Muslim is not lawful except for one of three,' implies that his sanctity is not waived. The intent of what Abu Hurayrah narrated is to emphasize deterrence. Similar in Ta’ from Al-Shamni. His statement: 'Like if he entered his house,' etc., contradicts what the commentator, the author of (Al-Durr al-Mukhtar), mentioned, unless what he mentioned is when removal is not possible without it, and here when it is possible, so reflect, and Allah knows best."

It is permissible to blind the one who fights, as the noble hadith states: 'Whoever is killed while defending his property, he is a martyr' (who is killed while protecting his wealth, he is a martyr). This is absolute. (Fath al-Qadir)

The statement: 'Then let his eye burst, there is no sin upon you' (if you burst his eye, there is no harm upon you) is found in the book 'Al-Qaniya.' It states that if someone looks through the door of another person's house and that person bursts his eye, there is no liability, provided that it was impossible to prevent him without bursting his eye. If it were possible to prevent him without bursting his eye, there would be liability.

Imam Shafi'i (RA) says that in both cases, there will be no liability, and if the homeowner strikes and bursts his head after he has inserted his head, there will unanimously be no liability. The difference is only regarding the one who looks from outside the house. (Daruwishar)

And in Rawaqat and Al-Dara'iyah, it is stated that if a person looks into someone's house through a hole, crack in the door, or similar opening, and the homeowner bursts his eye with a needle or a thorn, we will give him compensation. Imam Shafi'i (RA) does not consider this liable, based on the narration of our master Abu Hurairah (RA), who reported that the Prophet (SAW) said: 'If any man looks at you without permission, then you may strike and burst his eye, and there is no sin upon you.' Our position is that the Prophet (SAW) said: 'In the eye, half the diya (compensation)' and this is common. Therefore, causing harm merely by looking at someone is not permissible, such as when a person looks through an open door or enters the house and looks, or touches any part of the body other than the private parts; it is not permissible to burst his eye for such actions. Hence, the guidance of the Prophet (SAW) is: 'It is not lawful to shed the blood of a Muslim except in one of three cases: for a life, for a life; for a married person who commits adultery; and for one who forsakes his religion and leaves the community.'

The guidance of the Prophet (SAW) implies the preservation of his sanctity (life's safety). And the narration of our master Abu Hurairah (RA) aims to prevent such actions.

According to Imam Abu Hanifa (RA), this noble hadith pertains to the situation where if someone looks through the door of another person's house and the homeowner bursts his eye, there will be no compensation. However, if the act of bursting the eye is done in a state of rebellion and the person is not in a state of rebellion, then there will be no compensation. If the eye is burst in a state of rebellion, then compensation must be paid.

سیدنا سہیل بن سعد رضی اللہ تعالیٰ عنہ سے مروی ہے کہ ایک شخص رسول اللہ صلی اللہ علیہ وسلم کے پاس ایک دریا کے میان میں دروازے کے سوراخ سے جھانا کا، اور رسول اللہ صلی اللہ علیہ وسلم کے پاس صلاۃ اللہ صلی جس سے آپ پر علیہ اپناسر مبارک کے طجارت کے تو آپ پر علیہ نے فرمایا اگر میں جانتا کہ تو مجھے دیکھ رہا ہے تو میں پیدری تیری آنکھ میں گھونپ دیتا اور فرمایا: اجازت حاصل کرنا نگاہ کی خفا ظت کے لئے ہے۔ (بخاری، مسلم)

سیدنا ابوذر رضی اللہ عنہ نے روایت کی ہے کہ حضرت اکرم صلی اللہ علیہ وسلم نے فرمایا جس نے اجازت لینے سے پہلے کسی کے گھر میں پردہ ہٹا کر اپنی نگاہ دوالی اور اس گھر والوں کی ستر کو دیکھ تو وہ ایسے جرم کا مرتبہ ہوا جس کا کرنا اس کے لئے جائز نہیں تھا اور جس وقت اس نے نگاہ دوالی اگراس وقت کوئی آدمی اس کے سامنے آکراس کی آنکھ پھوٹ دے تو آنکھ پھوٹنے والے کو میں سرزش نہیں کروں گا۔ بالاگر کوئی مرد کسی ایسے دروازے پر سے گذرے جس پر نہ کوئی پردہ پڑا ہوا ہو اور نہ بندہ اور اس کی نظر گھر کے اندر کے آدمیوں پر پڑ جائے تو اس پر کوئی نگاہ نہیں ہے۔ بلکہ گناہ تو گھر والوں پر ہو گا۔ (ترمذی)

It is narrated on the authority of Abu Dharr (RA) that the Messenger of Allah ﷺ said:

Whoever removes the curtain and looks into someone's house before seeking permission, he commits such a sin that it is not permissible for him to do so. And if at the time he looks, someone were to come and gouge out his eye, I would not blame the one who gouges out his eye. If a man passes by a door that has no curtain or is not closed, and his gaze falls upon the people inside the house, there is no sin upon him. Rather, the sin will be upon the inhabitants of the house. (Tirmidhi)

سیدنا عبد اللہ مغفل رضی اللہ عنہ سے روایت ہے، انہوں نے ایک آدمی کو دیکھا کہ وہ پتھر پھینک کر مار رہا ہے تو انہوں نے کہا کہ مت پھینکو، کیونکہ رسول اللہ صلی اللہ علیہ وسلم نے پتھر پھینک کر مارنے سے منع کیا اور فرمایا ہے کہ اس سے نہ کوئی شکر کیا جاسکتا ہے اور نہ کسی وشم کو مارا جاسکتا ہے البتہ وہ جسی دانتوں کو توڑ دیتا ہے اور آنکھوں کو پھوٹ دیتا ہے۔ (بخاری و مسلم)

Abdullah ibn Mughaffal (may Allah be pleased with him) narrated that he saw a man throwing pebbles and said: "Do not throw pebbles, for the Messenger of Allah (ﷺ) forbade throwing pebbles and said: 'It does not catch game nor defeat an enemy, but it may break a tooth or blind an eye.'" [Agreed upon]

اور حضرت شمعی رحمۃ اللہ علیہ سے ایسی طرح مروی ہے۔

وقولہ : کما لود خل بیتہ الخ (جسیا کے سے گھر میں چل جاتے) پراس قول کے خلاف ہے جس کو صاحب درختار نے ذکر کیا ہے مگر یکران کی ذکر کردہ صورت کو محول کیا جاتے۔ ایسی صورت پر جس کے بغاوت کو فرع کرنا ممکن ہو۔ اور یہاں جومسلہ ہے وہ اس صورت میں ہے جب کہ اس کو فرع کرنا اس کے بغاوت ممکن ہے "فليتأمل" اس کو غور سے بھیو و اللہ تعالیٰ علم۔

حضرت ابوموسی رضی اللہ عنہ سے روایت ہے وہ فرماتے ہیں کہ رسول اللہ صلی اللہ علیہ وسلم نے فرمایا کہ جب تم میں سے کوئی ہماری مسجد یا ہمارے بازار میں گذرے اوراس کے پاس تیرہول تواس کی نوک کو پکڑ رکھے اپیانہ ہو کہ مسلمان کواس سے پکڑ نقصان ہوئے۔ (متفق علیہ)

Abu Musa (may Allah be pleased with him) narrated: The Messenger of Allah (ﷺ) said: "If one of you passes through our mosque or market with arrows, let him hold their tips with his hand lest any Muslim be harmed by them." [Agreed upon]

حضرت ابوہریرہ رضی اللہ عنہ سے روایت ہے کہ رسول اللہ صلی اللہ علیہ وسلم نے فرمایا کہ تم میں سے کوئی اپنے بھائی پر تھیارے اشارہ نہ کرے، کیا خبر کہ شاپیرشيطان اس کے باٹھ کے چھین لے، توپیدوزخ کے گزرنے میں گرجائے۔ (متفق علیہ)

Abu Hurayrah (may Allah be pleased with him) narrated: The Messenger of Allah (ﷺ) said: "Let none of you point a weapon at his brother, for he does not know; perhaps Satan may cause it to slip from his hand, and he falls into a pit of Fire." [Agreed upon]

اور ابی سے روایت ہے کہ رسول اللہ صلی اللہ علیہ وسلم نے فرمایا جو اپنے بھائی کو کسی لوہے کی چیز سے اشارہ کرے تو فرشتہ اس پر لعن کرتے ہیں۔ یہاں تک کہ وہ اسے (بات کو میں سے) رکھ دے اگر چیکہ وہ اس کا حقیقی بھائی ہو۔ (بخاری)

Abu Hurayrah (may Allah be pleased with him) narrated that the Messenger of Allah (ﷺ) said: “Whoever points a piece of iron at his brother, the angels curse him until he desists, even if it is his brother from his father and mother.” [Narrated by Al-Bukhari]

حضرت ابن عمر اور حضرت ابوہریرہ رضی اللہ علیہما حضور اکرم صلی اللہ علیہ وسلم سے روایت کرتے ہیں جس نے تم پر تھیارا لحاياوہ نہم میں سے نہیں ہے۔ (متفق علیہ)۔ اور امام مسلم نے بیزیادہ کیا کہ جو تم کو دھوکہ دے وہ تم میں سے نہیں ہے۔

It is narrated from Ibn Umar and Abu Hurairah (RA) that they reported from the Messenger of Allah ﷺ,

he said: 'He who shaves his beard is not from among you.' (Agreed upon). And Imam Muslim added: 'He who deceives you is not from among you.'

حضرت سلم بن اکوع رضی اللہ تعالیٰ عنہ سے روایت ہے کہ رسول اللہ صلی اللہ علیہ وسلم نے فرمایا جو تم پتلوار سونت لے وہ تم میں سے نہیں ہے۔ (مسلم)

It is narrated from Salm bin Akwa' (RA) that

the Messenger of Allah ﷺ said: 'Whoever listens to the flute is not from among us.' (Muslim)

حضرت ابن عمر رضی اللہ عنہما حضرت بی کریم صلی اللہ علیہ وسلم سے روایت کرتے ہیں کہ پعلویہ نے فرمایا جتنہ تم کے سات دروازے ہیں، ان میں سے ایک دروازہ ان کیلئے ہے جو میری امت پتلوار اٹھائے یا آپعلویہ نے فرمایا "محمد (صلى الله عليه وسلم) کی امت پر"(امام ترمذی نے کہا کہ یہ حدیث غریبہ)

Ibn Umar (may Allah be pleased with them) narrated that the Prophet (ﷺ) said: “Hellfire has seven gates, one of which is for those who draw a sword against my nation, or he said: the nation of Muhammad.” [Narrated by Al-Tirmidhi, who said: This Hadith is gharib (unusual).]

حضرت جابر رضی اللہ عنہ سے روایت ہے کہ رسول اللہ صلی اللہ علیہ وسلم نے بے نیام پلوار لین دینے سے منع فرمایا۔ (ترمذی وابوداود)

It is narrated from Jabir (RA) that

the Messenger of Allah ﷺ prohibited giving medicine at night.

حضرت حسن نے حضرت سمرة رضی اللہ تعالیٰ عنہ سے روایت کی ہے، رسول اللہ صلی اللہ علیہ وسلم نے دوانگیبون کے درمیان تسمہ کے طور پر 7 (ابوداود)

It is narrated from Hasan that he narrated from Samurah (RA) that

the Messenger of Allah ﷺ said: 'Between the two bowings, there are seven (Abu Dawud)'

7قولہ: نہیں ان یقد السیربین اصبعین (آپعلویہ نے تسم کو وانگیبون کے درمیان رکھ کر کے منع فرمایا) تسم کیے کے بعد چاقو پچسل کر لیجنی ونون انگیون کا ورمیانی حصن نکٹ جائے۔ ابن ملک نے فرمایا کہ ان دونوں حدیثوں میں جمنے وارد ہے وہ تخریجی اورشفقت کے طور پر ہے۔ (مرقات)

حضرت حمید، مکہ شام میں چند کسانوں لے پاس سے گذرے جنہیں دھوب میں کڑا کیا گیا تھا، اور ان کے سروں پرتیلے الاغیا تھا۔ انہوں نے پوچھا کیا ہے؟ کہا گیا کہ ان لوگوں کو خراج کے بارے میں سزا دی جاری ہے۔ تو حشام نے کہا میں گواہی دیتا ہوں کہ میں نے رسول اکرم صلی اللہ علیہ وسلم کو یہ فرما تے ہوئے سناتا ہے کہ اللہ تعالیٰ ان لوگوں کو سزا دے گا جو دیا میں لوگوں کو عذاب دیتے ہیں۔

Hisham ibn Urwah narrated from his father that Hisham ibn Hakim ibn Hizam passed by some Nabateans in Al-Sham who were made to stand in the sun with oil poured over their heads. He asked: “What is this?” It was said: “They are being punished for the land tax.” Hisham said: “I bear witness that I heard the Messenger of Allah (ﷺ) say: ‘Allah will punish those who punish people in this world.’” [Narrated by Muslim]

حضرت ابوہریرہ رضی اللہ عنہ سے روایت ہے رسول اللہ صلی اللہ علیہ وسلم نے فرما یا اگر تمہیاری عمر دراز ہو تو قریب سے کہتم ایسی قوم دیکھو گے جن کے ہاتھوں میں گاہے کی دم جسی کو تیزی سے ہوگی۔ وہ مجھ کریںگے اللہ کے غضب میں اور شام کریں گے اللہ کی نارا ضگی میں۔

Abu Hurayrah (may Allah be pleased with him) narrated that the Messenger of Allah (ﷺ) said: “Soon, if you live long, you will see people holding in their hands what resemble the tails of cows; they go out in the morning under Allah’s wrath and return in the evening under Allah’s displeasure.” In another narration: “And return under Allah’s curse.” [Narrated by Muslim]

ایک اور روایت میں ہے کہ وہ شام کریںگے اللہ کی لعنہ میں۔

Abu Hurayrah (may Allah be pleased with him) narrated that the Messenger of Allah (ﷺ) said: “Soon, if you live long, you will see people holding in their hands what resemble the tails of cows; they go out in the morning under Allah’s wrath and return in the evening under Allah’s displeasure.” In another narration: “And return under Allah’s curse.” [Narrated by Muslim]

حضرت ابوہریرہ رضی اللہ تعالیٰ عنہ سے روایت ہے کہ رسول اللہ نے فرما یا کہ دوزخیوں کی دوشمیس ہیں (ان جسی) میں نہیں دیکھا، ایک وہ قوم جن کے ساتھ گاہے کی دم طرح کوڑے ہوئے جن سے وہ لوگوں کو ماریں گے، اور دوسرا وہ عورتیں جولباس پہن کر مجھی تیزی سے ہوگی، مال کرنے والی، مال ہوئے والی، جن کے سر موتی اونٹیوں کے کوپان کی طرح بلے ہوئے گے، وہ نے جنت میں جائیں گی اور ناس کی خوشبو پائیں گی حالا کہ اس کی خوشبو نہ آئی اتنی مسافت سے محوس کی جائے گی۔

Abu Hurayrah (may Allah be pleased with him) narrated that the Messenger of Allah (ﷺ) said: “Two types of people of Hellfire I have not seen: a people with whips like the tails of cows, with which they strike people, and women who are clothed yet naked, inclining and inclined, their heads like the humps of leaning Bactrian camels. They will not enter Paradise nor smell its fragrance, though its fragrance can be sensed from such and such a distance.” [Narrated by Muslim]

حضرت ابوہریرہ رضی اللہ تعالیٰ عنہ سے مریہ کہ رسول اللہ صلی اللہ علیہ وسلم نے فرما یا کہ جب تم میں کوئی کسی کو مارے تو چہرے پر مارنے سے پچ کیونکہ اللہ تعالیٰ نے آدم علیہ السلام کو اس کی صورت پر پیار فرما یہ۔

Abu Hurayrah (may Allah be pleased with him) narrated that the Messenger of Allah (ﷺ) said: “If one of you fights his brother, let him avoid the face, for Allah created Adam in His image.” [Agreed upon]
