And the saying of Allah, the Mighty and Majestic: "And blood money delivered to his family, unless they remit it as charity" (An-Nisa: 92).

عَنِ ابْنِ عَبَّاسِ رَضِیَ اللهُ عَنهُمَاعَنِ النَّبِيِّﷺ قَالَ:(هَذِه١ وَهَذِه سَواءٌ) يَعنِي اَلخِنصَرَ وَالْإِبْهَامَ. رَوَاهُ الْبُخَارِيُّ.

Ibn Abbas (may Allah be pleased with them) narrated from the Prophet (ﷺ): He said: This and this are equal, meaning the little finger and the thumb. [Narrated by Bukhari]

1 His statement: “This and this are equal”: Meaning the little finger and the thumb, i.e., they are equal in blood money, even though the thumb has fewer joints than the little finger. For in each finger, there is one-tenth of the blood money, which is ten camels. In (Sharh al-Sunnah): For each finger that is cut off, ten camels are due. If one phalanx of a finger is cut off, one-third of the blood money for a finger is due, except for the phalanx of the thumb, in which half of the blood money for a finger is due, as it has only two phalanges. There is no difference between the phalanges of the hand and the foot, and the Imams have agreed upon this. So it is in (Al-Mirqat) and (Al-Hidayah).

٣ قوله: هذه وهذه سواء: يعني الخنصر والإبهام أي هما مستويان في الدية، وإن كان الإبهام أقلّ مَفصلًا من الخنصر؛إذ في كلِّ إصبع عُشر الدية، وهي عَشرٌ من الإبل، في (شرح السنة): يجب في كل إصبع يقطعها عشر من الإبل، وإذاقطع أنملة من أنامله ففيها ثُلُث دية إصبع إلا أنملة الإبهام، فإن فيها نصف دية إصبع؛ لأنه ليس فيها إلا أنملتان، ولا فرق فيه بين أنامل اليد والرجل، وأجمع عليه الأئمة. كذا في (المرقاة) و(الهداية).

وَفِي رِوَايَةِ أَبِي دَاوُدَ وَالنَّسَائِّيِّ عَنْ عَمْرِو بْنِ شُعَيْبٍ عَنْ أَبِيْهِ عَنْ جَدِّهِ رَضِیَ الله عَنه ، قَالَ: قَالَقَالَ: قَالَ رَسُوْلُ اللهِ ﷺ(إِنَّالعَقلَ مِيرَاثٌ بَينَ وَرَثَةِ القَتِيلِ)وَقَضَى رَسُوْلُ اللهِ ﷺ إِنَّعَقلَ الْمَرْأَةِ بَيْنَ عَصَبَتِهَا وَلَا يَرِثُ الْقَاتِلُ شَيْئًا.

وَرَوَى أَبُوْ دَاوُدَ فِي سُنَنِهِ عَنِ الْمُغِيْرَةِ بْنِ شُعْبَةَ رَضِیَ الله عَنه أَنَّ امْرَأَتَيْنٍ كَانَتَا تَحْتَ رَجُلٍ مِنْهذيلفَضَرَبَتْ إِحْدَاهُمَا الْأُخْرَى بِعَمُودٍ فَقَتَلَتْهَا وَقَتَلَتْ جَنِينَهَا فَاخْتَصَمُوا إِلَى النَّبِيِّ ﷺ فَقَالَ أَحَدُ الرَّجُلَيْنِ: كَيْفَ نَدِيْ مَنْ لَا صَاحَ وَلَا أَكَلَ، وَلَا شَرِبَ وَلَا اسْتَهَلَّ، فَقَالَ: (أَسَجْعُ كَسَجْعِ الْأَعْرَابِ) فَقَضَى فِيْهِ بِغُرَّةٍ وَجَعَلَهُ عَلَى عَاقِلَةِ الْمَرْأَةِ، وَرَوَاهُ التِّرْمِذِيُّ،وَقَالَ: حَدِيْثُ حَسَنُّ صَحِيْعٌ.

وَفِي رِوَايَةِ ابْنِ أَبِي شَيْبَةَ عَنْ جَابِرٍ رَضِيَ اللَّهُ عَنْهُ، أَنَّ النَّبِيَّ ﷺ جَعَلَ فِي الْجَنِينِ غُرَّةً عَلَى عَاقِلَتِهِ.

وَفِي (الْمُتَّفَقِ عَلَيْهِ) عَنْ أَبِي هُرَيْرَةَ رَضِيَ اللَّهُ عَنْهُ قَالَ اقْتَتَلَتِ امْرَأَتَانِ مِنْ هِذِيلٍ فَرَمَتْ إِحْدَاهُمَا الْأُخْرَى بِحَجَرٍ فَقَتَلَتْهَا وَمَا فِي بَطْنِهَا فَاخْتَصَمُوا إِلَى النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَقَضَى صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ أَنَّ الدِّيَّةَ.جَنِينِهَا غُرَّةٌ عَبْدُ أَوْ وَلِيدَةُ، وَقَضَى أَنَّ دِيَةَ الْمَرْأَّةِ عَلَى عَاقِلَتِهَا وَوَرَثَهَا وَلَدَهَا وَمَنْ مَعَهُمْ.

وَفِي رِوَايَةِ مُسْلِمٍ عَنِ الْمُغِيْرَةِ بْنِ شُعْبَةَ قَالَ: ضَرَبَتْ امْرَأَةُ ضَرَّتَهَا بِعَمُودِ فُسْطَاطٍوَهِيَ حُبْلَى فَقَتَلَتْهَا، قَالَ: وَإِحْدَاهُمَا لِحيَانِيَّةُ، قَالَ: فَجَعَلَ رَسُولُ اللهِ ﷺ دِيَةَ الْمَقْتُولَةِعَلَى عَصَبَةِ الْقَاتِلَةِ وَغُرَّةً لِمَا فِي بَطْنِهَا.

وَرَوَى الْبَزَّارُ فِي مُسْتَدِهِ عَنْ عَبْدِ اللهِ بْنِ بُرَيْدَةَ عَنْ أَبِيْهِ أَنَّ امْرَأَةً خَذَفَتْ امْرَأَةًوَقَضَى رَسُولُ اللَّهِ فِي وَلَدِهَا بِخَمْسِ مِائَةٍ وَنَهَى عَنِ الحَذْفِ.

وَفِي رِوَايَةِ ابْنِ أَبِيْ شَيْبَةَ عَنْ زَيْدِ بْنِ أَسْلَمَ أَنَّ عُمَرَ بْنَ الْخَطَّابِ قَوَّمَ الْغُرَّةَ بِخَمْسِيْنَدِيْنَارًا وَكُلَّ دِيْنَارٍ بِعَشَرَةٍ دَرَاهِمَ.

وَرَوَى أُبُوْ دَاوُدَ فِي سُنَنِهِ عَنْ إِبْرَاهِيْمَ النَّخَعِيِّ قَالَ: الْغُرَّةُ خَمْسُ مِائَةٍ، يَعْنِيْ دِرْهَمًا.وَرُوِيَ عَنْ مُحَمَّدٍ قَالَ: بَلَغَنَا أَنَّ رَسُوْلَ اللهِ ﷺ جَعَلَ عَلَى الْعَاقِلَةِ سَنَةً وَقَالُوا: إِنَّبَلَاغَاتُ مُحَمَّدٍ فِي حُكْمِ الْمُسْنَدَةِ.

Abu Hurayrah (may Allah be pleased with him) narrated: The Messenger of Allah (ﷺ) ruled regarding a fetus of a woman from Bani Lahyan that was miscarried dead, that a ghurrah (a male or female slave) is due. Then the woman for whom the ghurrah was ruled died, so the Messenger of Allah (ﷺ) ruled that her inheritance goes to her sons and husband, and the blood money is upon her clan. [Agreed upon]

In a narration by Abu Dawud and Al-Nasa’i from Amr ibn Shu’ayb, from his father, from his grandfather (may Allah be pleased with him), he said: The Messenger of Allah (ﷺ) said: The blood money is an inheritance among the heirs of the deceased. And the Messenger of Allah (ﷺ) ruled that the blood money of a woman is upon her clan, and the killer does not inherit anything.

Abu Dawud narrated in his Sunan from Al-Mughirah ibn Shu’bah (may Allah be pleased with him) that two women were under a man from Hudhayl. One of them struck the other with a tent pole, killing her and her fetus. They disputed before the Prophet (ﷺ), and one of the men said: How do we pay blood money for one who neither cried, ate, drank, nor made a sound? He (ﷺ) said: Is this the rhyming of the Bedouins? Then he ruled for a ghurrah and placed it upon the clan of the woman. Al-Tirmidhi narrated it and said: This is a hasan and sahih Hadith.

In a narration by Ibn Abi Shaybah from Jabir (may Allah be pleased with him), the Prophet (ﷺ) placed a ghurrah for the fetus upon his clan.

In an agreed-upon narration from Abu Hurayrah (may Allah be pleased with him), he said: Two women from Hudhayl fought, and one threw a stone at the other, killing her and what was in her womb. They disputed before the Prophet (ﷺ), and he ruled that the blood money for her fetus is a ghurrah, a male or female slave, and that the blood money for the woman is upon her clan, and her inheritance goes to her children and those with them.

In a narration by Muslim from Al-Mughirah ibn Shu’bah, he said: A woman struck her co-wife with a tent pole while she was pregnant, killing her. One of them was from Lihyan. The Messenger of Allah (ﷺ) placed the blood money for the killed woman upon the clan of the killer and a ghurrah for what was in her womb.

Al-Bazzar narrated in his Musnad from Abdullah ibn Buraydah, from his father, that a woman threw a stone at another woman, and the Messenger of Allah (ﷺ) ruled for her child five hundred and forbade throwing stones.

In a narration by Ibn Abi Shaybah from Zayd ibn Aslam, Umar ibn Al-Khattab valued the ghurrah at fifty dinars, each dinar being ten dirhams.

Abu Dawud narrated in his Sunan from Ibrahim Al-Nakha’i, who said: The ghurrah is five hundred, meaning dirhams. It is narrated from Muhammad, who said: It reached us that the Messenger of Allah (ﷺ) placed upon the clan a year, and they said: Muhammad’s reports are in the ruling of the attributed narrations.

Then, the ghurrah is obligatory upon the clan in one year per our view. Al-Shafi’i said: In three years, like other blood moneys for killing a person. We rely on what is narrated from Muhammad, who said: It reached us that the Messenger of Allah (ﷺ) placed upon the clan a year, as mentioned in (Al-Hidayah). Though he did not find its narrations, many scholars said that Muhammad’s reports are in the ruling of attributed narrations, as the blood money for the fetus has two similarities: it resembles life as it is alive with its own life, and resembles a limb as it is connected to the mother. We act upon the first similarity for inheritance and upon the second for deferment. Compensation for a limb, if one-tenth, is due in a year, so likewise this. The five hundred is the same for a male or female fetus per most scholars, due to the generality of the Hadith. 1 His statement: “Was miscarried dead”: This is a conditional state, for if he strikes a woman’s abdomen and she miscarries a dead fetus, a ghurrah is due. If she miscarries a live fetus that then dies, a full blood money is due. Ibn Al-Mundhir said: There is no disagreement among the scholars on this. The disagreement is that life is established by any sign of life, such as crying, suckling, breathing, sneezing, etc., which is our position and that of Al-Shafi’i and Ahmad. They say it is only established by crying. We say that any sign of life, like drinking milk, sneezing, or breathing, indicates life like crying. If a limb moves, it does not indicate life, as it could be a spasm or emerging from a tight space. If she miscarries a dead fetus and then the mother dies, he owes blood money for killing the mother and a ghurrah for the miscarriage. It is authentically reported that he (ﷺ) ruled for both the blood money and the ghurrah. If the mother dies from the strike and then the fetus emerges alive and dies, he owes blood money for the mother and blood money for the fetus, as he killed two persons. If she dies and then miscarries a dead fetus, he owes blood money for the mother and nothing for the fetus. Al-Shafi’i said: A ghurrah is due for the fetus, as it likely died from the strike, like if she miscarried a dead fetus while alive. We say: The mother’s death is one of the causes of its death, as it suffocates with her death, since its breath is like hers, so no liability is due with doubt. It is objected that doubt exists in both cases if she miscarries a dead fetus, as it could have died from the strike or not had the soul been breathed into it, yet liability is established. It is answered that the ghurrah in that case is established by text against analogy, as we mentioned, and this case is not analogous, as the doubt is from multiple angles: the soul not being breathed, death due to lack of nourishment, or death due to the mother’s death. Thus, it does not follow by analogy or indication, so it remains on the principle of no liability. The ghurrah is one-tenth of the blood money of a man if the fetus is male, and one-tenth of the blood money of a woman if female, each being five hundred dirhams, as in the narration of Ibn Abi Uyaynah, Al-Bazzar, and Abu Dawud, which is evidence against those who set it at six hundred, like Malik and Al-Shafi’i. It is upon the clan per our view, while Malik says it is upon the striker’s property, as it is compensation for a part, like cutting a finger, and the clan does not bear except compensation for life. We rely on that he (ﷺ) ruled for the ghurrah upon the clan, narrated by Abu Dawud and Al-Tirmidhi from Al-Mughirah ibn Shu’bah, and by Ibn Abi Shaybah from Jabir, and because it is for the life of the fetus, hence he (ﷺ) called it blood money when he said: Pay it. They said: Do we pay for one who did not cry or make a sound? The Hadith.

ثم وجوب الغرة عندنا على العاقلة في سَنَة واحدة. وقال الشافعي: في ثلاث سنين كسائر ديات قتل النفس. ولناما روي عن محمد قال: بلغنا أن رسول الله ﷺ جعل على العاقلة سَنَة، ذكره في (الهداية)، وهو وإن لم يجده فخرجواأحاديثه، لكن قد ذكر جمع من المشايخ أن بلاغات محمد في حكم المسندة، وله وجه، وهو أن دية الجنين لهاشبهان: شبه بالنفس من حيث إنه حي لحياة نفسه، وشبه بالعضو من حيث إنه متصل بالأم، فعملنا بالشبه الأول فيحق التوريث، وبالثاني في حق التأجيل، وبدل العضو إذا كان نصف العشر يجب في سنة، فكذا هذا، ويستوي فيوجوب الخمس مائة في الجنين الذكر والأنثى عند عامة أهل العلم؛ لإطلاق الحديث. التقطته من (المرقاة)و (الهداية) و(العناية) و(التعليق الممجّد) وشروح (الكنز)

وَعَنْ عَلْقَمَةَ وَالْأَسْوَدِ قَالَا: قَالَ عَبْدُ اللهِ: فِي شِبْهِ١ الْعَمْدِ خَمْسٌ وَعِشْرُونَحِقَّةً وَخَمْسٌ وَعِشْرُونَ جَذَعَةً وَخَمْسٌ وَعِشْرُونَ بَنَاتِ لَبُونٍ وَخَمْسٌ وَعِشْرُونَ بَنَاتِمَخَاضٍ. رَوَاهُ أَبُوْ دَاوُدَ، وَهُوَ كَالْمَرْفُوْعِ؛ لِأَنَّ الْمَقَادِيْرَ لَا تُعْرَفُ بِالرَّأْيِ.

Alqamah and Al-Aswad narrated: Abdullah said: For quasi-intentional killing, twenty-five hiqqah, twenty-five jadha’ah, twenty-five banat labun, and twenty-five banat makhad. [Narrated by Abu Dawud, and it is like a raised narration, as amounts are not known by opinion]

1 His statement: “For quasi-intentional killing, twenty-five hiqqah” etc.: Therefore, it is said in (Al-Hidayah): The blood money for quasi-intentional killing per Abu Hanifah and Abu Yusuf is one hundred camels in quarters: twenty-five banat makhad, twenty-five banat labun, twenty-five hiqqah, and twenty-five jadha’ah. Muhammad and Al-Shafi’i said: In thirds: thirty jadha’ah, thirty hiqqah, and forty thaniyyah, all pregnant. Due to his (ﷺ) statement: The killing by mistake in intention, like killing with a whip or stick, for it is one hundred camels, forty of which are pregnant. From Umar and Zayd: thirty hiqqah and thirty jadha’ah. Because the blood money for quasi-intentional killing is heavier, which is in what we said. They rely on his (ﷺ) statement: For a believer’s life, one hundred camels. What they narrated is not established due to the companions’ disagreement on the manner of heaviness. Ibn Mas’ud said: With heaviness in quarters, as we mentioned, and it is like a raised narration, so it is opposed by it.

Amr ibn Shu’ayb narrated from his father, from his grandfather (may Allah be pleased with him): The Prophet (ﷺ) said: The blood money for quasi-intentional killing is heavy, like the blood money for intentional killing, but its perpetrator is not killed. [Narrated by Abu Dawud]

وَرَوَى أُبُوْ دَاوُدَ وَالنَّسَائِيُّ وَالدَّارِميُّ عَنْ عَمْرِو بْنِ شُعَيْبٍ عَنْ أَبِيْهِ عَنْ جَدِّهِ قَالَ: قَضَى رَسُوْلُ اللهِ ﷺ فِي الْمَوَاضِحِ خَمْسًا خَمْسًا مِنَ الْإبِلِ، وَفِي الْأَسْتَانِ خَمْسًا خَمْسًامِنَ الْإِبِلِ. وَرَوَى اللتَّرْمِذِيُّ وَابْنِ مَاجَه الْفَصْلَ الْأَوَّلَ.

English

Abu Bakr ibn Muhammad ibn Amr ibn Hazm narrated from his father, from his grandfather (may Allah be pleased with him): The Messenger of Allah (ﷺ) wrote to the people of Yemen, and in his letter: Whoever kills a believer with clear evidence, it is retribution unless the victim’s guardians are satisfied. In it: A man is killed for a woman. In it: For life, the blood money is one hundred camels. For the people of gold, one thousand dinars. For the nose, if its tip is completely cut off, the blood money is one hundred camels. For the tongue, the blood money. For the two lips, the blood money. For the two testicles, the blood money. For the penis, the blood money. For the spine, the blood money. For the two eyes, the blood money. For one leg, half the blood money. For a head wound reaching the brain, one-third of the blood money. For a penetrating wound, one-third of the blood money. For a fracture, fifteen camels. For each finger of the hand and foot, ten camels. For a tooth, five camels. [Narrated by Al-Nasa’i and Al-Darimi]

In a narration by Malik: For the eye, fifty. For the hand, fifty. For the leg, fifty. For a wound exposing bone, five.

Abu Dawud, Al-Nasa’i, and Al-Darimi narrated from Amr ibn Shu’ayb, from his father, from his grandfather: The Messenger of Allah (ﷺ) ruled for wounds exposing bone, five camels each, and for teeth, five camels each. Al-Tirmidhi and Ibn Majah narrated the first section.

As for what Abu Dawud and Al-Nasa’i narrated that a boy from poor people cut the ear of a boy from rich people, and his family came to the Prophet (ﷺ), who said: We are poor people, so he did not impose anything upon them. This is evidence for us that the intentional act of a minor is a mistake, as it does not stem from valid choice, so no retribution is taken from him for killing, and the blood money is upon the clan. Al-Shafi’i said: A minor’s intentional act is intentional, so the blood money is from his property. Al-Shafi’i deduced from this Hadith that the clan is not liable for a mistake if they are poor. Abu Hanifah said: The clan is liable even if poor, if they have a trade or work, due to the generality of the Hadith on the clan. (Al-Hidayah, Al-Mirqat, and Nayl al-Awtar, excerpted from them).

Our scholar, Shaykh Muhammad Al-Muhaddith Al-Tahanawi, said in interpreting this Hadith: Perhaps he (ﷺ) did not impose the blood money upon them immediately and did not demand it at once, but set a time for ease or wealth, or it is specific to them by the Lawgiver’s (ﷺ) permission in their case, or it was at the beginning, then this part of the Hadith was abrogated by imposing blood money in similar cases. This is if the offender is free. If the offender is a slave, the interpretations are similar, but the liability is upon the slave’s neck, not the clan.

1 His statement: “For life, the blood money” etc.: Meaning, when opting for blood money instead of retribution in intentional killing, and it is obligatory in mistake or quasi-intentional killing. In (Kitab al-Rahmah): The Imams agreed that the blood money for a free Muslim male is one hundred camels from the killer’s property if intentional and he opts for blood money. They differed on whether it is immediate or deferred. Malik, Al-Shafi’i, and Ahmad said: Immediate. Abu Hanifah said: Deferred over three years. They differed on the blood money for intentional killing. Abu Hanifah and Ahmad in one narration: It is in quarters for each age group of camels: twenty-five banat makhad, twenty-five banat labun, twenty-five hiqqah, and twenty-five jadha’ah. Al-Shafi’i said: Taken in thirds: thirty hiqqah, thirty jadha’ah, and forty thaniyyah, all pregnant. Ahmad has another narration like this. As for the blood money for quasi-intentional killing, it is like that for purely intentional killing per Abu Hanifah and Al-Shafi’i. Malik’s narrations differ. For mistake, Abu Hanifah and Ahmad said: Twenty-five jadha’ah, twenty hiqqah, twenty banat labun, twenty ibn makhad, and twenty banat makhad. So it is in (Al-Mirqat).

2 His statement: “For the people of gold, one thousand dinars”: They differed on whether dinars and dirhams can be taken for blood money. Abu Hanifah and Ahmad said: It is permissible to take them even if camels are available. There are two narrations: whether they are principal or substitutes for camels. Malik said: They are principal, specified by Sharia, not considered in terms of camels. Al-Shafi’i said: Do not opt for other than camels if available, except by agreement. If unavailable, his new preferred view is to take their value at the time of payment, whether more or less. His old view, used out of necessity, is to take one thousand dinars or twelve thousand dirhams. They differed on settling blood money in dirhams. Abu Hanifah said: Ten thousand dirhams. Al-Shafi’i and Ahmad said: Twelve thousand dirhams. So it is in (Ikhtilaf al-A’immah). The apparent Hadith supports Abu Hanifah. He said: For the people of gold, so the amount is one hundred camels for camel owners and one thousand dinars or their equivalent, ten thousand dirhams, for gold owners. So it is in (Al-Mirqat). 3 His statement: “For the nose, if its tip is completely cut off, the blood money is one hundred camels”: The principle for limbs is that if a type of benefit is completely lost or intended beauty in a human is completely removed, the full blood money is due, as it is akin to destroying life from one aspect, and it is treated as destroying it from all aspects, to honor the human. The evidence is the Prophet’s (ﷺ) ruling of full blood money for the tongue and nose. Thus, many rulings follow. We say: For the nose, the blood money, as it removes beauty completely, which is intended. Likewise, if the bridge or tip is cut, for the same reason. If the bridge and cartilage are cut, it does not exceed one blood money, as it is one organ. So it is in (Al-Hidayah).

4 His statement: “For the teeth, the blood money”: Al-Tayyibi said: If you ask how this aligns with his statement in the coming Hadith: “For teeth, five each,” I say: Here, he considered their plurality, and there, their essence. Like in definition, the essence of the genus and its inclusion. Hence, he repeated “five” to encompass the full blood money by its fifths. Ibn Al-Hajib said: The Arabs repeat a thing twice to encompass the details of the entire body by the meaning the repeated word indicates. It is objected that the fifths there exceed the blood money. (Al-Mirqat).

5 His statement: “For the two lips, the blood money” etc.: Know that for what has no second in the human body among organs or intended meanings, the full blood money is due. The organs are four types: singular, which are three: the nose, tongue, and penis. The singular meanings in the body are intellect, life, smell, and taste. The paired organs are the two eyes, two ears, two eyebrows, two lips, two hands, a woman’s two breasts, two testicles, and two legs; for them, the blood money, and for one, half. The quartered are the eyelids, with each lid being a quarter of the blood money. The tenthed are the fingers of the hands and feet, with the ten being the blood money, and one being a tenth. Those exceeding that are the teeth, with each being half a tenth of the blood money. So it is in (Radd al-Muhtar).

6 His statement: “For one leg, half the blood money”: Al-Shamni said: The full blood money is due for two of what is in the body that has two, like the two eyes, two hands, two legs, two lips, two ears, and two testicles. For one of two in the body that has two, half the blood money is due. So it is in (Al-Mirqat).

7 His statement: “For a head wound reaching the brain, one-third of the blood money” etc.: So it is in (Al-Hidayah). Al-Tayyibi said in (Al-Mirqat): Such estimations are purely devotional, not knowable except by divine instruction.

8 His statement: “For each finger” etc.: So it is said in (Al-Hidayah) due to this Hadith, and because cutting all fingers loses a type of benefit, for which the full blood money is due, and there are ten fingers, so the blood money is divided among them.

9 His statement: “For a tooth, five camels”: Or fifty dinars or five hundred dirhams, due to his (ﷺ) statement: For each tooth, five camels, meaning half a tenth of his blood money if free, or half a tenth of his value if a slave. If you say: Then the blood money for all teeth exceeds the blood money for life by three-fifths, based on the usual thirty-two teeth, requiring sixteen thousand dirhams, which is the blood money for life plus three-fifths. I say: Yes, and there is no issue, as it is established by text against analogy, as in (Al-Ghayah) and others. In (Al-Inayah): There is nothing in the body whose loss requires more than the blood money except the teeth. (Al-Durr al-Mukhtar and Radd al-Muhtar, excerpted from them).

10 His statement: “For the eye, fifty”: Meaning fifty camels, which is half the blood money for life. So it is in (Al-Hidayah).

١ قوله: وفي النفس الدية إلخ: أي عند العدول عن القصاص إليها في العمد، وهي متعينة في الخطأ شبه العمد. وفي(كتاب الرحمة): اتفق الأئمة على أن الدية للمسلم الحُرّ الذَكر مائة من الإبل في مال القاتل العامد إذا عدل إلى الدية،ثم اختلفوا هل هي حالَّة أو مؤجلة؟ فقال مالكوالشافعي وأحمد: حالة. وقال أبو حنيفة: هي مؤجلة فيثلاث سنين. واختلفوا في دية العمد، فقال أبو حنيفة وأحمد في إحدى روايتيه: هي أرباع لكل سن من أسنان الإبل،منها خمس وعشرون بنت مخاض، ومثلها بنت لبون، ومثلها حقاق، ومثلها جذاع. وقال الشافعي: يؤخذ مثلثة،ثلاثون حقة، وثلاثون جذعة، وأربعون خَلِفة، وهي حوامل، وبه قال أحمد في روايته الأخرى. وأما دية شبه العمدفهي مثل دية العمد المحض عند أبي حنيفة والشافعي. واختلف الرواية عن مالك في ذلك. وأما دية الخطأ، فقال أبوحنيفة وأحمد: هي خمسة وعشرون جذعة، وعشرون حقة، وعشرون بنت لبون، وعشرون ابن مخاض، وعشرون بنتمخاض. كذا في (المرقاة).

٢ قوله: وعلى أهل الذهب ألف دينار: اختلفوا في الدنانير والدراهم هل تؤخذ في الديات أم لا؟ فقال أبو حنيفةوأحمد: يجوز أخذهما في الديات مع وجود الإبل، ثم عنهما روايتان، هل هيأصل بنفسها أم الأصل الإبل،والذهب والدرهم بدل عنها. وقال مالك: هي الأصل بنفسها مقدرة بالشرع ولم يعتبرها بالإبل. وقال الشافعي: لايعدل عن الإبل إذا وجدت إلا بالتراضي، وإنأعوزت فعنه قولان الجديد الراجح أنه يعدل إلى قيمته حين القبض،زائدةً أو ناقصةً، والقديم المعمول به ضرورة أنه يعدل إلى ألف دينار أو اثني عشر ألف درهم. واختلفوا في صلحالدية من الدراهم، فقال أبو حنيفة: عشرة آلاف درهم. وقال الشافعي وأحمد: اثنا عشر ألف درهم.كذا في (اختلاف الأئمة)، وظاهر الحديث يؤيد أبا حنيفة. قال: وعلى أهل الذهب، فالتقدير مائة من الإبل، علىأهل الإبل وألف دينار أو ما يقوم مقامها وهو عشرة آلاف درهم على أهل الذهب.

١ قوله: وفي الأنف إذا أوعب جدعه الدية مائة من الإبل: والأصل في الأطراف أنه إذا فوّت جنس منفعته على الكمالأو أزال جمالا مقصودا في الآدمي على الكمال يجب كل الدية لاتلافه النفس من وجهٍ، وهو ملحق بالإتلاف من كلوجه؛ تعظيمًا للآدمي، دليله قضاء رسول الله ﷺ بالدية كلها في اللسان والأنف، وعلى هذا ينسخب فروع كثيرة،فنقول: في الأنف الدية؛ لأنه أزال الجمال على الكمال، وهو مقصود، وكذا إذا قطع المارن أو الأَرْنَبَة؛ لما ذكرنا من إزالةالجمال، ولو قطع المارن مع القصبة لا يزاد على دية واحدة؛ لأنه عضو واحد. كذا في(الهداية).

٢ قوله: وفي الأسنان الدية: قال الطيبي: فإن قلت: كيف يوافق هذا قوله في الحديث الآتي: (وفي الأسنان خمسًا خمسًا)؟؟قلت: اعتبر في الجمع هناك أفراده وهنا حقيقته، مثاله فيالتعريف حقيقة الجنس واستغراقه، ولذلك كرَّر خمسًا؛ليستوعب الدية الكاملة باعتبار أخماسها. قال ابن الحاجب: العرب تكرر الشيء مرتين لتستوعب تفصيل جميع جسمهباعتبار المعنى الذي دل عليه اللفظ المكرر. وفيه أن الأخماس هناك زيادة على الدية. أخذته من (المرقاة).

٣ قوله: وفي الشفتين الدية إلخ: اعلم أن ما لا ثاني له في بدن الإنسان من الأعضاء أو المعاني المقصودة فيه كمالالدية، والأعضاء أربعة أنواع: أفراد، وهي ثلاثة: الأنف واللسان والذَكر، والمعاني التي هي أفراد في البدن: العقلوالنفس والشم والذوق. وأما الأعضاء التي هي أزواج فالعينان والأذنان الشاخصتان والحاجبان والشفتان واليدانوثديا المرأة والأنثيان والرجلان، ففيهما الدية، وفي أحدهما نصفها. والتي هي أرباع: أشفار العين، وفي كل شفر رُبعالدية. والتي هي أعشار: أصابع اليدين والرجلين، ففي العشرة الدية، وفي الواحدة عُشرها. والتي تزيد على ذلك:الأسنان، وفي كل منها نصف عُشر الدية. كذا في (رد المحتار).

وأما ما رواه أبو داود والنسائي أن غلاما لاناس فقراء قطع أذن غلام لأناس أغنياء، فأتى أهله النبي ﷺ، فقالوا: إناأناس فقراء، فلم يجعل عليهم شيئا. ففيه دليل لنا على أن عمد الصبي خطأ؛ إذ لم تصدر عن اختيار صحيح، ولهذا لا يقتصمنه في القتل، وفيه الدية على العاقلة. وقال الشافعي : عمد الصبي عمد، حتى تجب الدية في ماله، واستدل الشافعي بهذاالحديث على أن جناية الخطأ لا تلزم العاقلة إن كانوا فقراء. وقال أبو حنيفة: تلزم العاقلة الفقراء إذا كان لهم حرفة وعمل؛لإطلاق حديث العاقلة، التقطته من (الهداية) و(المرقاة) و(نيل الأوطار).

وقال مولانا الشيخ محمد المحدث التهانوي في تأويل هذا الحديث: لعله ﷺ لم يجعل الدية عليهمبالفعل، ولم يطلب منهم على الفور، بل جعل أمده على اليسر والغنا أو يحمل على الخصوصية بإذن الشارع ﷺ فيحقهم خاصةً، أو يكون في أول الأمر، ثم نُسخ هذا الجرء من الحديثبإجراء الدية في أمثال ذلك الأمر، هذا كله علىتقدير كون الجاني حُرًّا، وأما في صورة كون الجاني عبدًا فالتوجيهات هكذا، لكن الجناية تكون على رقبة العبد لا علىالعاقلة.

١ قوله: وفي الرجل الواحدة نصف الدية: قال الشمني: تجب الدية كاملة في اثنين مما في البدن منه اثنان كالعينين واليدينوالرجلين، والشفتين والأذنين والأنثيين، وفي أحد اثنين مما في البدن منه اثنان نصف الدية. كذا في (المرقاة).

٢ قوله: وفي المامومة ثلث الدية إلخ: كذا في (الهداية). وقال في (المرقاة): قال الطيبي : وأمثال هذهالتقديرات تعبُّدٌ محض، لا طريق إلى معرفته إلا بالتوقيف.

٣ قوله: وفي كل إصبع إلخ: كذا قال في (الهداية) لهذا الحديث، ولأن في قطع الكل تفويت جنس المنفعة، وفيه ديةكاملة، والأصابع عَشَرٌ فتقسم الدية عليها.

٤ قوله: وفي السن خمس من الإبل: أو خمسون دينارا أو خمسائة درهم؛ لقوله ﷺ: في كل سن خمس من الإبل يعنينصف عُشر ديته لو حُرًّا، ونصف عُشر قيمته لو عبدًا، فإن قلت: تزيد حينئذٍ دية الأسنان كلها على دية النفس ثلاثةأخماسها، أي بناء على الغالب من أن الأسنان اثنان وثلاثون، فيجب فيها ستة عشر ألفَ درهم، وذلك دية النفسوثلاثة أخماسها. قلت: نعم، ولا بأس فيه؛ لأنه ثابت بالنص على خلاف القياس، كما في (الغاية) وغيرها. وفي(العناية): وليس في البدن ما يجب بتفويته أكثر من قدر الدية سوى الأسنان. (الدر المختار) و(رد المحتار) ملتقطمنهما.

٥ قوله: وفي العين خمسون: أي من الإبل، وهي نصف دية النفس. كذا في (الهداية).

وَعَنْ عُمَرَ بْنِ الْخَظّابِ رَضِیَ اللهُ عَنهُ أَنَّهُ قَضَى١ فِي رَجُلٍ ضَرَبَ رَجُلًا، فَذَهَبَ سَمْعُهُ وَبَصَرُهُ وَنِكَاحُهُ وَعَقْلُهُ بِأَرْبَعَةِ دِيَاتٍ. ذَكَرَهُ أَحْمَدُ بْنُ حَنْبَلٍ فِي رِوَايَةٍ عَنِ الْحَارِثِ وَابْنِهِ عَبْدِ اللهِ، وَرَوَى ابْن أَبِيْ شَيْبَةَ نَحْوَهُ.

English

Umar ibn Al-Khattab (may Allah be pleased with him) narrated that he ruled regarding a man who struck another, causing him to lose his hearing, sight, marriage, and sanity, with four blood moneys. Mentioned by Ahmad ibn Hanbal in a narration from Al-Harith and his son Abdullah, and Ibn Abi Shaybah narrated something similar.

1 His statement: “He ruled regarding a man” etc.: This indicates that for each of the four mentioned losses, a full blood money is due per our view and the jurists. The author of (Al-Bahr) deduced this, saying: No companion disapproved of it, so it is consensus. (Nayl al-Awtar, excerpted from it). Therefore, it is said in (Al-Hidayah): Whoever strikes a limb and removes its benefit owes the full blood money, like a paralyzed hand or an eye whose light is gone. In another place: For intellect lost by striking, the blood money, and likewise if his hearing, sight, smell, or taste is lost, as each is an intended benefit.

١ قوله: قضى في رجل إلخ: فيه دليل على أنه يجب في كل واحد من الأربعة المذكورة دية عندنا وعند الفقهاء. وقداستدل بها صاحب (البحر)، وقال: إنه لم ينكره أحد من الصحابة، فكان إجماعًا. التقطته من (نيل الأوطار). لذلك قال في (الهداية): ومن ضرب عضوا فأذهب منففعته، ففيه دية كاملة، كاليد إذا شلت، والعين إذا ذهب ضوؤها.وقال في موضع آخر منه: وفي العقل إذا ذهب بالضرب الدية، وكذا إذا ذهب سمعه أو بصره أو شمه أو ذوقه؛ لأن كل واحد منها منفعة مقصودة.

وَرَوَى أَبُوْ دَاوُدَ فِي مَرَاسِيْلِهِ عَنْ سَعِيْدِ بْنِ الْمُسَيِّبِ قَالَ: قَالَ رَسُوْلُ اللهِﷺ: (دِيَةُ كُلّ ذِيْ عَهْدٍ فِي عَهْدِهِ أَلْفُ دِيْنَارٍ).

وَرَوَى مُحَمَّدٌ فِي (كِتَابِ الْآثَارِ) عَنِ الْهَيْثَمِ مِنْ أَبِيْ الْهَيْثَمِ أَنَّ النبیَﷺ وَأَبَا بَكْرٍوَعُمَرَ وَعُثْمَانَ قَالُوْا: دِيَةُ الْمُعَاهِدِ دِيَةُ الْحُرِّ الْمُسْلِم.

English

Ibn Abbas (may Allah be pleased with them) narrated that the Prophet (ﷺ) paid the blood money for the two men from Banu Amir with the blood money of the Muslims, and they had a covenant from the Messenger of Allah (ﷺ). [Narrated by Al-Tirmidhi]

Abu Dawud narrated in his Marasil from Sa’id ibn Al-Musayyib that the Messenger of Allah (ﷺ) said: "The blood money for every person under a covenant during his covenant is one thousand dinars."

Muhammad narrated in (Kitab al-Athar) from Al-Haytham, from Abu Al-Haytham, that the Prophet (ﷺ), Abu Bakr, Umar, and Uthman said: "The blood money for a person under a covenant is the blood money of a free Muslim."

1 His statement: “Paid the blood money for the two men from Banu Amir with the blood money of the Muslims” etc.: Meaning, the blood money for a Muslim and a protected non-Muslim, even if he is a Magian, is equal. Malik said: "The blood money for a Jew or Christian is six thousand dirhams," due to his (ﷺ) statement: "The blood money for a disbeliever is half the blood money for a Muslim," and the full amount is twelve thousand dirhams. Al-Shafi’i said: "The blood money for a Christian or Jew is four thousand dirhams, and for a Magian, eight hundred dirhams," as it is narrated thus. This is his old view, and Ahmad and Malik in a narration agree. His new view is one-third of one hundred camels or their value if unavailable, and likewise for a Magian. We rely on what is narrated from Ibn Abbas that the Prophet (ﷺ) paid for the two covenanted men who had a covenant from the Messenger of Allah (ﷺ), and Amr ibn Umayyah Al-Damri killed them, eight hundred camels. He (ﷺ) said: "The blood money for every person under a covenant during his covenant is one thousand dinars." From Al-Zuhri, Abu Bakr and Umar used to make the blood money for a protected non-Muslim equal to that of a Muslim. It cannot be said that the deficiency of disbelief is greater than that of femininity or slavery, so his blood money should be reduced accordingly, and since slavery is a consequence of disbelief, if it reduces for its consequence, then for it is more so. We say: The reduction in the blood money for a woman or slave is not due to the deficiency of femininity or slavery but due to the deficiency in ownership attributes. A woman does not own marriage, and a slave does not own property, while a free male owns both, so his value is greater, and theirs is less. A disbeliever is equal to a Muslim in this regard, so his compensation should be like his. (Commentaries on Al-Kanz, excerpted from them).

وعن خشف بن مالك عن ابن مسعود رضي الله عنه قال : قضي رسول الله ﷺ١ فِي دِيَّةِ الْخَطَإِ عِشْرِينَ بِنْتَ مَخَاضٍ، وَعِشْرِينَ ابْنَ مَخَاضٍ ذُكُوْرًا، وَعِشْرِينَ بِنْتَ لَبُونٍ،وَعِشْرِينَ جَذَعَةً، وَعِشْرِينَ حِقَّةً. رَوَاهُ التَّرْمِذِيُّ وَأَبُوْ دَاوُدَ وَالنَّسَائِيُّ، وَالصَّحِيْحُ أَنَّهُ مَوْقُوْفٌ عَلَى ابْنِ مَسْعُوْدٍ رضي الله عنه.

وَقَالَ عَلِيُّ الْقَارِي: وَعَلَى تَقْدِيْرِ تَسْلِيْمِهِ لَا يَضُرُّهُ، فَإِنَّ مِثْلَ هَذَا الْمَوْقُوْفِ فِي حُكْمِالْمَرْفُوْعِ؛ لِأَنَّ التَّقَادِيْرَ لَا تُعْرَفُ مِنْ قِبَلَ الرَّأْيِ مَعَ أَنَّ الْمُقَرَّرَ فِي الْأُصُوْلِ أَنَّهُ إِذَا كَانَالْحَدِيْثُ مَرْفُوْعًا وَمَوْقُوْفًا يُعْتَبَرُ الْمَرْفُوْعُ، وَخِشْفٌ وَثَقَهُ النَّسَائِيُّ، وَذَكَّرَهُ ابْنُ حِبَّانَ فِيالثَّقَاتِ، وَهُوَ رَوَى عَنِ ابْنِ مَسْعُوْدٍ، وَعَنْ عُمَرَ، وَعَنْ أَبِيْهِ، فَيَكُوْنُ مَعْرُؤْفًا؛ لِأَنَّ أَقَلَّالْمَعْرُوْفِ أَنْ يُرْوَى عَنْ اثْنَيْنِ.

وقال الشمني : واجاب الاصحاب عن الذي وداه النَّبِيَّﷺ من ابل الصدقةبان النبي ﷺ تَبَرَّعَ بِذَلِكَ وَلَمْ يَجْعَلْهُ حُكْمًا.

وَرَوَى الْبَيْهَقِيُّ مِنْ طَرِيْقِ الشَّافِعِيِّ قَالَ: قَالَ مُحَمَّدُ بْنُ الْحَسَنِ: بَلَغَنَا عَنْ عُمَرَ أَنَّهُ فَرَضَ١ عَلَى أَهْلِ الذَّهَبِ فِي الدِّيَةِ أَلْفَ دِيْنَارٍ، وَمِنَ الْوَرِقِ ٢ عَشْرَةُ آلَافِ دِرْهَمٍ.

Khushaf ibn Malik narrated from Ibn Mas’ud (may Allah be pleased with him): The Messenger of Allah (ﷺ) ruled regarding the blood money for a mistake: twenty banat makhad, twenty ibn makhad males, twenty banat labun, twenty jadha’ah, and twenty hiqqah. [Narrated by Al-Tirmidhi, Abu Dawud, and Al-Nasa’i, and the correct view is that it is stopped at Ibn Mas’ud (may Allah be pleased with him)]

Ali Al-Qari said: "Even if it is accepted, it does not harm, as such a stopped narration is in the ruling of a raised one, since amounts are not known by opinion. Moreover, it is established in legal theory that if a Hadith is both raised and stopped, the raised one is considered. Khushaf is deemed trustworthy by Al-Nasa’i, and Ibn Hibban mentioned him among the trustworthy. He narrated from Ibn Mas’ud, Umar, and his father, so he is known, as the least for being known is narrating from two."

Al-Shamni said: "The companions answered regarding what the Prophet (ﷺ) paid from the charity camels that the Prophet (ﷺ) voluntarily did that and did not make it a ruling."

Al-Bayhaqi narrated through Al-Shafi’i, who said: Muhammad ibn Al-Hasan said: "It reached us from Umar that he imposed on the people of gold for blood money one thousand dinars, and from silver ten thousand dirhams."

Al-Shafi’i agreed with us but said: "Twenty ibn labun instead of ibn makhad." The evidence against him is what we narrated. (Al-Takmilah and Al-Ayni, excerpted from them).

2 His statement: “Imposed on the people of gold for blood money one thousand dinars” etc.: Know that the scholars differed on the principal in blood money. Al-Shafi’i and Ahmad in a narration said: "Camels only, and other types are settlements, not legal specifications, so their value is due, whatever it may be." This Hadith and the previous one, “For the people of gold, one thousand dinars,” indicate that all three types, camels, gold, and silver, are principals, which is Abu Hanifah’s view. The specification is by agreement or judgment, and this is what judges practice. It is said: "It is for the killer," as mentioned by Al-Qahistani. The deduction is that Umar ruled thus in the presence of the companions without disapproval, so it is consensus. Abu Yusuf, Muhammad, and Ahmad in a narration said: "Camels, gold, silver, cows, two hundred cows, sheep, one thousand sheep, and garments, two hundred garments, are principals." The benefit of the disagreement appears in the killer’s choice. Per Abu Hanifah, the choice is from the three types only; per them, from the six. The benefit appears if the killer settles with the victim’s guardian for more than two hundred cows; per him, it is permissible, as it is settling for what is not of the type of blood money; per them, it is not, like settling for more than one hundred camels or more than one thousand dinars. The correct view is the Imam’s, as in (Al-Mudmarat), because Abu Yusuf and Muhammad took the apparent meaning of Umar’s Hadith, saying: "Blood money is from the six types," as Umar made it from these types and specified each. It is known that ruling for all at once does not occur, so we know the intent was to show the amount for each type. Abu Hanifah said: "Blood money is from camels, dirhams, and dinars," as the reports from the Messenger of Allah (ﷺ) are well-known. Umar took cows, sheep, and garments initially because they were their wealth, and paying from them was easier, so he took them to facilitate. The narrator thought it was to specify the blood money for these types. When the treasuries and grants became their main wealth, dirhams, dinars, and camels, he ruled for blood money from them. Cows and sheep have no role in the value of destroyed property at all, like houses, slaves, and maidservants. Similarly, camels should not be included, but the reports from the Messenger of Allah (ﷺ) are well-known, so we left analogy for that specifically for camels. (Al-Mirqat, Nayl al-Awtar, Radd al-Muhtar, Al-Binayah, Al-Hidayah, and Al-Mabsut, excerpted from them). 2 His statement: “And from silver, ten thousand dirhams”: Al-Shamni said: "Blood money per us is one thousand dinars from gold, ten thousand dirhams from silver, and one hundred from camels." Al-Shafi’i said: "From silver, twelve thousand," and Malik, Ahmad, and Ishaq agreed, due to what the four Sunan compilers narrated from Ibn Abbas that a man from Banu Adi was killed, and the Prophet (ﷺ) set his blood money at twelve thousand. We rely on what Al-Bayhaqi narrated through Al-Shafi’i, who said: Muhammad ibn Al-Hasan said: "It reached us from Umar that he imposed on the people of gold for blood money one thousand dinars and from silver ten thousand dirhams." The interpretation of what Al-Shafi’i narrated is that the Prophet (ﷺ) ruled with dirhams whose weight was six, meaning six of them weighed six mithqals. At the beginning of the Messenger of Allah’s (ﷺ) time, dirhams were of weight six, until Umar’s time, then became weight seven. Taj Al-Shari’ah said: "The interpretation of what is narrated is that he imposed twelve, meaning from dirhams that were weighed as six, and twelve weighed as six amount to ten thousand weighed as seven." ١ قوله: قضى رسول الله في دية الخطأ إلخ: أي دية الخطأ مائة من الأبل أخماسا أي عشرون ابن مخاض،وعشرون بنت مخاض، وعشرون بنت لبون، وعشرون حقة، وعشرون جذعة؛ لهذا الحديث، والشافعي أخذ بمذهبنا غير أنه قال: يجب عشرون ابن لبون مكان (ابن مخاض)، والحجة عليه ما روينا. مأخوذ من (التكملة) و(العيني).

١ قوله: فرض على أهل الذهب في الدية ألف دينار إلخ: واعلم أن العلماء اختلفوا في الأصل في الدية، فقال الشافعي وأحمد في رواية: الإبل فقط، وبقية الأصناف مصالحة لا تقدير شرعي، فتجب قيمتها، بالغةً ما بلغت. وأفاد هذا الحديث والحديث السابق أعني (وعلى أهل الذهب ألف دينار): أن كل الأنواع الثلاثة من الإبل والذهب والفضة أصول، وعليه أبو حنيفة ، وأن التعيين بالرضاء أو القضاء، وعليه عمل القُضاة. وقيل: للقاتل، ذكره القهستاني.

ووجه الاستدلال به أن عمر قضى بذلك بمحضر من الصحابة ، من غير نكير، فحل بمحل الإجماع. وقال أبويوسف ومحمد وأحمد في رواية: الإبل والذهب والفضة والبقر، مائتا بقرة والغنم ألف شاة، والحلة مائتا حلة، أصول. وفائدة الخلاف تظهر في اختيار القاتل، فعند أبي حنيفة الخيار من الأنواع الثلاثة فقط، وعندهما من الستة، ثم فائدة هذا الاختلاف إنما يظهر فيما إذا صالح القاتل مع ولي القتيل على أكثر من مائتي بقرٍ، فعنده يجوز؛ لأنه صالح على ما ليس من جنس الدية وعلى قولهما لا يجوز، كما هو صالح على أكثر من مائة من الإبل أو أكثر من ألف دينار.

والصحيح ما ذهب إليه الإمام، كما في (المضمرات)؛ لأن أبا يوسف ومحمد أخذا بظاهر حديث عمر،وقالا: الدية من الأصناف الستة، فإن عمر جعلها من هذه الأصناف، وقدر كل صنف منه بمقدار. ومعلوم أنه ما كان يتفق القضاء بذلك كله في وقت واحد، فعرفنا أن المراد بيان المقدار من كل صنف، وأبو حنيفة قال: الدية من الإبل والدراهم والدنانير. وقد اشتهرت الآثار بذلك عن رسول الله ﷺ، وإنما أخذ عمر من البقر والغنم والحلل في الابتداء؛ لأنها كانت أموالهم، وكان الأداء منها أيسر عليهم، وأخذها بطريق التيسير عليهم، فظنَّ الراوي أن ذلك كان منه على وجه بيان التقدير للدية في هذه الأصناف. فلما صارت الدواوين والإعطاءات جل أموالهم. الدراهم والدنانير والإبل، فقضى بالدية منها. ثم لا مدخل للبقر والغنم في قيمة المتلفات أصلًا، فهي بمنزلة الدوروالعبيد والجواري، وهكذا كان ينبغي أن لا تدخل الإبل إلا أن الآثار اشتهرت فيه عن رسول الله ﷺ تركنا القياس لذلك في الإبل خاصة. أخذته من (المرقاة) (نيل الأوطار) و(رد المحتار) و(البناية) و(الهداية) و(المبسوط).

٢ قوله: ومن الورق عشرة آلاف درهم: قال الشمني: الدية عندنا من الذهب ألف دينار، ومن الفضة عشرة آلاف درهم، ومن الإبل مائة. وقال الشافعي: من الورق اثنا عشر ألفًا، وبه قال مالك وأحمد وإسحاق؛ لما أخرج أصحاب السُّنَن الأربعة عن ابن عباس أن رجلًا من بني عدي قتل، فجعل النبي ﷺ ديته اثني عشر ألفًا. ولنا وهو قول الثوري وأبي ثور من أصحاب الشافعي ما روى البيهقي من طريق الشافعي قال: قال محمد بن الحسن: بلغنا عن عمر أنه فرض على أهل الذهب في الدية ألف دينار، ومن الورق عشرة آلاف درهم. وتأويل ما روى الشافعي أن النبي ﷺ قضى من دراهم كان وزنها وزن ستة أي وزن ستة منها ستة مثاقيل،فان في ابتداء عهد رسول الله ﷺ كان وزن الدراهم وزن ستة.وقد كانت الدراهم كذلك اي وزن ستة الي عهد عمر،ثم صار وزن سبعة. وقال تاج الشريعة: وتأويل ما روى أنه أوجب اثني عشر محمول على أنه أوجب من دراهم كانت توزن ستة واثني عشر بوزن ستة تبلغ عشرة آلاف بوزن سبعة. التقطته من (المرقاة) و(العناية).

وَعَنْ عَمْرِو بْنِ شُعَيْبٍ عَنْ أَبِيْهِ عَنْ جَدِّهِ ُ أَنَّ رَسُوْلَ اللهِ ﷺ قَالَ: (مَنْ تَطَبَّبَ وَلَمْ يُعْلَمْ مِنْهُ طِبُّ قَبْلَ ذَلِكَ فَهُوَ ضَامِنُ).١ (رَوَاهُ أَبُوْ دَاوُدَ وَالنَّسَائِيُّ)

English

Amr ibn Shu’ayb narrated from his father, from his grandfather (may Allah be pleased with him): The Messenger of Allah (ﷺ) said: "Whoever practices medicine without prior knowledge of medicine is liable." [Narrated by Abu Dawud and Al-Nasa’i]

1 His statement: “He is liable”: Meaning, for blood money, and retribution is waived due to the patient’s permission. The physician’s offense is upon the clan per most jurists. (Al-Luma’at and Al-Mirqat, excerpted from them). It is said in (Badhl al-Majhud): "In summary, if the physician performs a treatment with his hand, like cutting a vein, incising the skin, cauterizing, or administering medicine with his hand, and it leads to death, it is an offense requiring blood money. If he prescribes medicine and explains it to the patient, and the patient takes it with his own hand, there is no liability."

١ قوله: فهو ضامن: أي دية وسقط عنه القصاص لإذن المريض، وجناية الطبيب عند عامة الفقهاء على العاقلة،(اللمعات) و(المرقاة) ملتقط منهما. وقال في (بذل المجهود): حاصله: أن الطبيب إذا عالج شيء من المعالجة بيده مثلا: قطع العرق أو شق الجلد أو كواه بمكواة أو سقاه بيده فأوجر في فيه فتلف، فهو جناية تلزمه الدية، وأما إذا وصف له الدواء وبينه للمريض فأكل المريض بيده فلا ضمان فيه.
