وَقَوْلِ اللهِ عَزَّ وَجَلَّ: ﴿وَكَتَبْنَا١ عَلَيْهِمْ فِيهَآ أَنَّ النَّفْسَ بِالنَّفْسِوَالْعَيْنَ بِالْعَيْنِ وَالْأَنَفَ بِالْأَنْفِوَالْأُذُنَ بِالْأُذنِ وَالسِّنَّ بِاالسِّنِّ وَالْجُرُوحَ قِصَاصٌ فَمَن تَصَدَّقَ بِهِ فَهُوَ كَفَّارَةٌ لَّه وَمَن لَّمْ يَحْكُم بِمَآأَنْزَلَ اللهُ فَأُوْلٰۤئِكَ هُمُ الظّٰلِمُونَ﴾ ٤٥وَقَوْلِهِ تَعَالٰى: ﴿ يَأَيُّهَااَلَّذِينَ ءَامَنُواْ كُتِبَ عَلَيْكُمُ الْقِصَاصُ فِى الْقَتْلٰي﴾(البقرة: ١٧٨) وَقَوْلِهِ تَعَالَي) ﴿فَمَنِ اعْتَدَىٰ عَلَيْكُمْ فَأعْتَدُواْ عَلَيْهِ بِمِثْلِ مَا أعْتَدَىٰ عَلَيْكُمْ﴾ (البقرة:١٩٤ )

١قوله: وكتبنا عليهم إلخ: هذه الآية جامعة لبيان قصاص النفس وما دونها، وما مضى من الآية في البقرة في بيان قصاص النفس فقط، وهي إخبار عما شرع الله على موسىعليه السلام وقومه؛ إذ ضمير (عليهم) راجع إلى اليهود، وضمير(فيها) إلى التوراة، وطريق الاستدلال بهذه الآية: أن شرائع من قبلنا تلزمنا إذا قص الله أو رسوله من غير إنكار، يعني إذا بيّن أن شرائع سابقكم كانت موصوفة بهذه الصفات، وسكت على ذلك القدر، ولم يأمرنا بتركها يلزم علينا تلك الشرائع، وهذه هي: الضابطة الكلية في علم الأصول، وههنا كذلك؛ لأنه أخبرنا بأنا كتبنا على اليهود في التوراة: أن النفس مقتولة بالنفس إلى آخره ولم ينكر عليها، فيكون لازما علينا، هكذا ذكره الإمام الزاهد. وبالجملة والآيةمشتملة على قصاص النفس وما دونها، وأما قصاص النفس هي قوله تعالى: ﴿أَنَّ النَّفْسَ بِالنَّفْسِ﴾ (المائدة: ٤٥)،وهي ناسخة لقوله تعالى: ﴿الْحُرُّ بِالْحُرِّ وَاَلْعَبْدُ بِالْعَبْدِ وَالْأُنثَى بِآلْأُانثٰی﴾(البقرة: ١٧٨)عند أبي حنيفة ، فيجوزعندهم قتل الحر بالعبد، وقتل الذَكَر بالأنثى، خلافًا للشافعي . كذا في (التفسيرات الأحمدية).

And the saying of Allah, the Mighty and Majestic: "And We ordained 1 for them therein: a life for a life, an eye for an eye, a nose for a nose, an ear for an ear, a tooth for a tooth, and for wounds is retaliation. But whoever gives it up as charity, it is an expiation for him. And whoever does not judge by what Allah has sent down, those are the wrongdoers" (Al-Ma'idah: 45); and His saying, the Exalted: "O you who believe, retaliation has been prescribed for you in the matter of the slain" (Al-Baqarah: 178); and His saying, the Exalted: "So whoever transgresses against you, transgress against him in the like of his transgression against you" (Al-Baqarah: 194).

1 His saying "and We ordained for them", to the end: this verse comprehensively sets out retaliation for life and for what is less than life, while the verse that has passed in Al-Baqarah sets out retaliation for life only. It is a report of what Allah legislated for Musa (peace be upon him) and his people, since the pronoun in "for them" refers to the Jews and the pronoun in "therein" to the Torah. The manner of drawing proof from this verse: the laws of those before us bind us when Allah or His Messenger relates them without repudiation; that is, when it is made plain that the laws of your predecessors bore these descriptions, and silence is kept at that point and we are not commanded to leave them, those laws become binding upon us. This is the universal rule in the science of usul, and it is so here, for He informed us that "We ordained for the Jews in the Torah that a life is taken for a life", to the end, and did not repudiate it, so it is binding upon us. Thus did al-Imam al-Zahid state it. In sum, the verse embraces retaliation for life and for what is below it. As for retaliation for life, it is His saying, the Exalted: "a life for a life" (Al-Ma'idah: 45), and with Abu Hanifa it abrogates His saying, the Exalted: "the free for the free, the slave for the slave, and the female for the female" (Al-Baqarah: 178); so with them the free man may be put to death for the slave and the male for the female, contrary to al-Shafi'i. So it is in al-Tafsirat al-Ahmadiyya.

عَنْ عَبْدِ اللهِ بْنِ مَسْعُوْدٍ رَضِیَ اللهُ عَنهُ، قَالَ: قَالَ رَسُوْلُ اللّهِﷺ :(لَا يَحِلُّ٢ دَمُ امْرِئٍ مُسْلِمٍ يَشْهَدُ أَنْ لَا إِلَهَ إِلَّا اللهُ وَأَنِّی رَسُولُ اللهِ إِلَّا بِإِحْدَى ثَلَاثٍ:النَّفْسُ١ بِالنَّفْسِ، وَالثَيِّبُ٢ الزَّانِيِ، وَالْمَارِقُ٣ مِنْ الدِّينِ التَّارِكُ لِلْجَمَاعَةِ). مُتَّفَقٌ عَلَيْهِ.

وَرَوَى الطَّبَرَانِيُّ فِي مُعْجَمِهِ عَنْ مُعَاذٍ بْنِ جَبَلٍ رَضِیَ اللهُ عَنهُ أَنَّ رَسُوْلَ اللهِ ﷺ قَالَ لَهُ حِيْنَبَعَثَهُ إِلَى الْيَمَنِ: (أَيُّمَا رَجُلٍ ارْتَدَّ عَنِ الْإِسْلامِ فَادْعُهُ، فَإِنْ تَابَ فَاقْبَلْ مِنْهُ، وَإِنْ لَمْ يَتُبْ فَاضْرِبْ عُنُقَهُ، وَأَيُّمَا امْرَأَةٍ ارْتَدَّتْ عَنِ الْإِسْلامِ فَادْعُهَا، فَإِنْ تَابَتْ فَاقْبَلْ مِنْهَا، وَإِن أَبَتْ فَاسْتَتِبْهَا)۔

وَفِيْ رِوَايَةٍ لِلَّترْمِذِيِّ وَالنَّسَائِيِّ وَابْنِ مَاجَه عَنْ أَبِيْ أُمَامَةَ ابْنِ سَهْلِ بْنِ حَنِيْفٍ أَنَّ عُثْمَانَ بْنَ عَفّان أَشْرَفَ يَوْمَ الدَّارِ، فَقَالَ: أَنْشُدُكُمْ اللّهَ، أَتَعْلَمُونَ أَنَّ رَسُولَ اللهِ ﷺ قَالَ:(لَا يَحِلُّ دَمُ امْرِئٍ مُسْلِمٍ إِلَّا بِإِحْدَى ثَلَاثِ: زِنًا بَعْدَ إِحْصَانٍ أَوْ ارْتِدَادٍ بَعْدَ إِسْلَامِ أَوْ قَتْلِ نَفْسٍ بِغَيْرِ حَقٍّفَقُتِلَ بِهِ)، فَوَاللهِ! مَا زَنَيْتُ فِي جَاهِلِيَّةٍ وَلَا فِي إِسْلَامٍ، وَلَا ارْتَدَدْتُ مُنْذُ بَايَعْتُ رَسُولَ اللهِ ﷺ، وَلَا قَتَلْتُ النَّفْسَ الَّتِي حَرَّمَ اللهُ فَبِمَ تَقْتُلُونَنِيْ؟

English

Abdullah ibn Mas’ud (may Allah be pleased with him) narrated: The Messenger of Allah (ﷺ) said: The blood of a Muslim who testifies that there is no god but Allah and that I am the Messenger of Allah is not lawful except for one of three reasons: a life for a life, a married person who commits adultery, and the one who abandons his religion, forsaking the community. [Agreed upon] And Al-Tabarani narrated in his Mu’jam from Mu’adh ibn Jabal (may Allah be pleased with him) that the Messenger of Allah (ﷺ) said to him when he sent him to Yemen: Any man who apostatizes from Islam, call him back. If he repents, accept it from him. If he does not repent, strike his neck. And any woman who apostatizes from Islam, call her back. If she repents, accept it from her. If she refuses, seek her repentance. And in a narration by Al-Tirmidhi, Al-Nasa’i, and Ibn Majah from Abu Umamah ibn Sahl ibn Hunayf, that Uthman ibn Affan overlooked the house and said: I adjure you by Allah, do you know that the Messenger of Allah (ﷺ) said: The blood of a Muslim is not lawful except for one of three: adultery after marriage, apostasy after Islam, or killing a soul without right, so he is killed for it. By Allah, I have not committed adultery in Jahiliyyah or Islam, nor have I apostatized since I pledged allegiance to the Messenger of Allah (ﷺ), nor have I killed a soul that Allah has forbidden. So why do you kill me?

2 His statement: “The blood of a Muslim is not lawful” etc.: Al-Hafidh Abu Al-Hasan Ali Al-Mufaddal Al-Misri Al-Maliki deduced from this Hadith that one who abandons prayer out of laziness, without denial, is not killed. The Hanafis hold this view, stating that one who deliberately abandons prayer out of laziness is a sinner and is imprisoned until he prays, because he is imprisoned for a human right, so the right of Allah is more worthy. It is said: He is beaten until blood flows from him. According to Al-Shafi’i, he is killed for missing a single prayer as a legal punishment, or it is said: for disbelief. (Umdat al-Qari and Al-Durr al-Mukhtar, excerpted from them). 1 His statement: “a life for a life”: This refers to retribution. Abu Hanifah and his companions deduce from its generality that a free person is killed for a slave and a Muslim for a non-Muslim protected person, while Al-Shafi’i holds the opposite. Our position is supported by His statement, the Exalted: And We ordained for them therein that a life is for a life (Al-Ma’idah: 45). The implication derived from His statement, the Exalted: the free for the free, the slave for the slave (Al-Baqarah: 178) is not considered by us, especially since the explicit text exists, and it is agreed that there is no implication in the rest of the verse regarding His statement: and the female for the female (Al-Baqarah: 178), because a man is killed for a woman by consensus. (Nayl al-Awtar, Al-Durr al-Mukhtar, and Al-Mirqat, excerpted from them). It is said in (Al-Durr al-Mukhtar): We have the generality of His statement, the Exalted: that a life is for a life (Al-Ma’idah: 45), which abrogates His statement, the Exalted: the free for the free (Al-Baqarah: 178), as narrated by Al-Suyuti in (Al-Durr al-Manthur) from Al-Nahhas from Ibn Abbas, that it is a specification by mention, so it does not negate what is beyond it. Otherwise, it would necessitate that a male be killed for a female, and no one holds this view. 2 His statement: “a married person who commits adultery”: The married person here refers to the muhsan, meaning a responsible free person who has consummated a valid marriage and then committed adultery. The Imam stones him, and this is not for individuals to do. This is [Agreed upon] As for a responsible unmarried person, if free, he is lashed one hundred times, and if a slave, fifty times. (Nayl al-Awtar and Al-Mirqat, excerpted from them).

3 His statement: “the one who abandons his religion, forsaking the community”: The one who abandons his religion refers to the one who exits it, and forsaking the community is an emphasizing attribute, meaning the one who has left the Muslim community and separated from them through apostasy, which is cutting off Islam by word, deed, or belief. He must be killed if he does not repent. Calling him a Muslim warrior is in consideration of his prior state. The scholars have agreed on killing a male apostate if he does not return to Islam and persists in disbelief. They differed regarding killing a female apostate. Al-Shafi’i equates her to a male apostate. Abu Hanifah says: A female apostate is not killed, meaning she is an exception from this generality, because of the general prohibition against killing women and children, supported by the Hadith of Al-Tabarani mentioned later in this chapter. ٢قوله: لا يحل دم امرئ منهم إلخ: واستدل الحافظ أبو الحسن علي المفضل المصري المالكي بهذا الحديث على أن تارك الصلاة لا يُقتَل إذا كان تكاسلًا من غير جحد، وبه قالت الحنفية، فإن تارك الصلاة عمدًا مجانة أي تكاسلًافاسق يُحْبَس حتى يصليَ؛ لأنه يحبس لحق العبد فحق الحق أحق. وقيل: يضرب حتى يسيل منه الدم، وعند الشافعي يُقتَل بصلاةٍ واحدة حدًّا. وقيل: كفرًا. (عمدة القاري) و(الدر المختار) ملتقط منهما.

١قوله: النفس بالنفس: المراد به القصاص. وقد يستدل به أبو حنيفة وأصحابه على أنه يقتل الحر بالعبد والمسلم بالذمي لما فيه من العموم، والشافعي على خلافه، ويؤيد مذهبنا أيضًا قوله تعالى: ﴿وَكَتَبْنَا عَلَيْهِمْ فِيهَآَ أَنَّ اَلنَّفْسَ بِالنَّفْسِ﴾ (المائدة: ٤٥) والمفهوم المستفاد من قوله تعالى: ﴿اَلْحُرُّ بِالْحُرِّ وَالْعَبْدُ بِالْعَبْدِ﴾ (البقرة: ١٧٨) غير معتبرعندنا، لا سيما عند وجود المنطوق مع الاتفاق على أن لا مفهوم في بقية الآية من قوله: ﴿وَاَلْأُنثٰى بِالْأُنْثٰىْ﴾ (البقرة: ١٧٨)؛ لأن الرجل يُقتَل بالمرأة بالإجماع. (نيل الأوطار) و (الدر المختار) و(المرقاة) ملتقط منها. وقال في (الدرالمختار): ولنا إطلاق قوله تعالى: ﴿أَنَّ النَّفْسَ بِالنَّفْسِ﴾ (المائدة: ٤٥) فإنه ناسخ لقوله تعالى: ﴿اَلْحُرُّ بِالْحُرِ﴾ (البقرة: ١٧٨)الاۤية كما رواه السيوطي في (الدر المنثور) عن النحاس عن ابن عباس على أنه تخصيص بالذكر فلا ينفي ماعداه، كيف ولو دل لوجب أن يقتل الذكر بالأنثى، ولا قائل به.

٢ قوله: والثيب الزاني: والمراد بالثيب: المحصن، وهو المكلَّف الحر الذي أصاب في نكاح صحيح ثم زنى، فإن الإمام رجمه، وليس لآحاد الناس ذلك، هذا مجمع عليه، وأما البكروالمكلَّف غير المحصن، فإن كان حُرًّا فيجلدمائة، وإن كان رقيقًا يجلد خمسين، (نيل الأوطار) و(المرقاة) ملتقط منهما.

٣ قوله: والمارق لدينه التارك للجماعة: ويراد بالمارق لدينه: الخارج عنه، والتارك للجماعة صفة مؤكدة للمارق أي الذي ترك جماعة المسلمين وخرج من جملتهم، وانفرد عن أمرهم بالردّة التي هي قطع الإسلام قولًا أو فعلًا أواعتقادًا، فيجب قتله إن لم يتب، وتسميته مسلما محاربا باعتبار ما كان عليه. وقد أجمع العلماء على قتل الرجل المرتدإذا لم يرجع إلى الإسلام وأصر على الكفر. واختلفوا في قتل المرتدة، فجعلها الشافعي كالرجل المرتد. وقال أبوحنيفة : لا تقتل المرتدة يعني يستثنى من هذا العموم المرأة، فإنها لا تقتل عنده لعموم قوله: نهى عن قتل النساءوالصبيان، ويؤيده حديث الطبراني الذي سيذكر في هذا الباب بعد هذا. التقطته من (المرقاة) و(عمدة القاري)و(رحمة الأمة).

Ibn Umar (may Allah be pleased with them) narrated: The Messenger of Allah (ﷺ) said: A believer remains in the expanse of his religion as long as he does not shed unlawful blood. [Narrated by Bukhari]

وَعَنْ أَبِيْ الدَّرْدَاءِ رَضِيَ اللهُ عَنهُ عَنْ رَسُوْلِ اللهِ ﷺ قَالَ: (لَا يَزَالُ الْمُؤْمِنُ مُعْنِقًاصَالِحًا مَا لَمْ يُصِبْ دَمًا حَرَامًا، فَإِذَا أَصَابَ دَمًا حَرَامًا بَلَّحَ). رَوَاهُ أَبُوْدَاوُدَ.

English

Abu Darda (may Allah be pleased with him) narrated from the Messenger of Allah (ﷺ): A believer remains steadfast in righteousness as long as he does not shed unlawful blood. When he sheds unlawful blood, he falters. [Narrated by Abu Dawud]

عن عَبدِاللهِ بنِ عَمروٍ رَضِيَ اللهُ عَنهُما اَن النَۤبِيَۤﷺ قَالَ:(لَزَوَالُ الدُۤنيَا اَهوَنُ عَلَي اللهِ مِنْ قَتْلِ رَجُلٍ مُسْلِمٍ). رَوَاهُ التِّرْمِذِيُّ وَالنَّسَائِيُّ، وَرَوَاهُ ابْنُ مَاجَه عَنْ الْبَرَاءِ بْنِ عازِبٍ۔

English

Abdullah ibn Amr (may Allah be pleased with them) narrated that the Prophet (ﷺ) said: The destruction of the world is lighter to Allah than the killing of a Muslim man. [Narrated by Al-Tirmidhi and Al-Nasa’i, and narrated by Ibn Majah from Al-Bara’ ibn Azib]

عَن ابِي سَعِيدٍ وَ اَبِي هُرَيرَةَ رَضِيَ اللهُ عَنهُمَا عَن رَسُولِ اللهِ ﷺ قَالَ:(لَواَنَۤ أَهْلَ السَّمَاءِ وَاَهلَالْأَرْضِ اشْتَرَكُوا فِي دَمِ مُؤْمِنٍ لَأَكَبَّهُمُ اللّهُ فِي النَّارِ). رَوَاهُ التِّرْمِذِيُّ، وَقَالَ:هَذَا حَدِيْثٌغَرِيْبٌ.

English

Abu Sa’id and Abu Hurayrah (may Allah be pleased with them) narrated from the Messenger of Allah (ﷺ): If the inhabitants of the heavens and the earth conspired in the blood of a believer, Allah would cast them into the Fire. [Narrated by Al-Tirmidhi, who said: This is a rare Hadith]

English

Abu Darda (may Allah be pleased with him) narrated from the Messenger of Allah (ﷺ): Every sin Allah may forgive except for one who dies a polytheist or one who intentionally kills a believer. [Narrated by Abu Dawud, and narrated by Al-Nasa’i from Mu’awiyah]

1 His statement: “or one who intentionally kills a believer”: Meaning he intended to kill him because he is a believer, or to aggravate, or to satisfy his opponent, or unless he is forgiven, due to His statement, the Exalted: Indeed, Allah does not forgive association with Him, but He forgives what is less than that for whom He wills (Al-Nisa: 48). Al-Muzhir said: Meaning if he considered his blood lawful. So it is in (Al-Mirqat), and its elaboration was omitted for brevity.

And the saying of Allah Almighty: And call to witness two witnesses from among your men. And if there are not two men, then a man and two women from those whom you accept as witnesses, so that if one of them errs, the other can remind her. And let not the witnesses refuse when they are called upon. [Al-Baqarah: 282] And His saying, Exalted is He: O you who have believed, be persistently standing firm in justice, witnesses for Allah, even if it be against yourselves or parents and relatives. Whether one is rich or poor, Allah is more worthy of both. So do not follow desire, lest you not be just. And if you distort or refuse, then indeed Allah is ever Acquainted with what you do. [An-Nisa: 135] And His saying, Exalted is He: Indeed, those who exchange the covenant of Allah and their oaths for a small price will have no share in the Hereafter, and Allah will not speak to them or look at them on the Day of Resurrection, nor will He purify them; and they will have a painful punishment. [Aal-E-Imran: 77]

1 Regarding the saying: And call to witness two witnesses, etc.: The conclusion is that for zina, four male witnesses are required by consensus, based on His saying, Exalted is He: Then call to witness four of you against them [An-Nisa: 15] and His saying: But if they do not bring four witnesses [An-Nur: 4]. For other hudud and qisas, the testimony of two men alone is accepted by consensus, based on al-Zuhri’s statement: The Sunnah from the Messenger of Allah (ﷺ) and the two caliphs after him was that women’s testimony is not accepted in hudud and qisas, so the default is considered, which is the testimony of two men only. For matters other than hudud and qisas, if it is something men can witness, the testimony of two men or one man and two women is accepted, whether it concerns wealth or otherwise, according to us. According to al-Shafi‘i, if it concerns wealth or its derivatives like sales, purchases, option conditions, terms, rentals, loans, and the like, the testimony of two men or one man and two women is accepted. If it is not wealth-related, like marriage and the like, only the testimony of two men is accepted. If it is something men cannot witness, like childbirth and similar matters, the testimony of one woman is accepted according to us, and four women according to al-Shafi‘i, with their evidence detailed in extended texts.

The conditions for testimony include Islam and justice, as mentioned in the verse. The first is based on His saying: From among your men [Al-Baqarah: 282], meaning from your community, which refers to Muslims, as stated in tafsirs. This does not support al-Shafi‘i and Malik’s view that the witnesses’ Islam is required in all cases, even prohibiting non-Muslims from testifying against each other, as it was mentioned in the context of Muslims dealing with Muslims, as indicated by His saying: When you contract a debt [Al-Baqarah: 282] and And let a scribe write between you [Al-Baqarah: 282]. Thus, Abu Hanifa ruled that the witnesses’ Islam is required when testifying against Muslims, so non-Muslims’ testimony is only accepted against non-Muslims specifically.

The second condition is based on His saying: From those whom you accept as witnesses [Al-Baqarah: 282], as the accepted one is the just one, as if it said: those whose justice you know and rely on their righteousness, so he must be just. The author of al-Hidayah relied on this in the chapter on testimony, but he clarified in the chapter on judging that a judge should not accept a sinner’s testimony, though if accepted, it is valid according to us. Al-Shafi‘i said a sinner’s testimony is not accepted at all, perhaps for this reason. The author of al-Madarik said: This indicates that a non-accepted person is a witness, as the verse’s implication is to call witnesses from those you accept, so it is known that some witnesses are not accepted due to their known lack of justice, making the witness broader than being just or not. The remaining conditions, freedom, maturity, precision, and the wording of testimony, will be addressed in their places. The condition of precision can be established from His saying: So that if one of them errs, the other can remind her [Al-Baqarah: 282]. Similarly, the requirement of the testimony’s wording can be established from this verse and all that clarifies testimony in it, as the author of al-Hidayah stated, saying: The wording of testimony is required because the texts explicitly mandate it, as the command uses this wording. If one does not use the word testimony but says “I know” or “I am certain,” his testimony is not accepted, as per his wording. Likewise, as stated in al-Husayni, the meaning of His saying: From among your men [Al-Baqarah: 282] is from Muslim, free, mature men, so freedom and maturity can also be established from the verse, as is evident.

His saying, Exalted is He: And let not the witnesses refuse when they are called upon [Al-Baqarah: 282] can have two meanings. First, that witnesses should not refuse to give testimony after bearing it when called to the court, making it an obligatory command. Second, that witnesses should not refuse to bear testimony, being called witnesses by what they will become, making it a recommended command or abrogated by His saying: And no scribe or witness should be harmed [Al-Baqarah: 282]. In al-Kashshaf, Qatada said: A man would wander in the assembly, a great gathering of people, and none would follow him, so this was revealed. The author of al-Hidayah affirmed the first meaning, stating at the beginning of the Book of Testimony: Testimony is an obligation binding on witnesses, and they cannot conceal it if the claimant demands it, based on His saying: And let not the witnesses refuse when they are called upon [Al-Baqarah: 282]. However, it should be known that this applies to non-hudud cases. In hudud, the witness has the choice between concealing or revealing, with concealing being preferable, based on the saying: Whoever conceals a Muslim’s fault, Allah will conceal his fault in this world and the Hereafter. But in theft, he must testify about the property, saying: He took the property, to uphold the rights of the victim, and not say: He stole, to maintain concealment, summarized from Tafsir al-Ahmadiyya.

2 Regarding the saying: Be persistently standing firm in justice, witnesses for Allah, even if it be against yourselves, etc.: The author of al-Madarik said: Testifying against oneself is confession, as it has the same effect as testifying against oneself by establishing the right. This is because a claim, testimony, and confession all share in reporting a right of one against another, except that a claim is reporting one’s own right against another, confession is for another against oneself, and testimony is for another against another, as per his words. In summary, the verse is evidence for the legality of confession and the permissibility of testifying to the detriment of parents and relatives, which is well-known. The verse may also indicate that testimony is for Allah, not for show or reputation or self-benefit, so it can be used to argue that the testimony of a partner in a partnership’s wealth, a worker for his employer, a student for his teacher, a parent for his child, and the like is not permissible, as it comes to mind, gathered from Tafsir al-Ahmadiyya.

English

Ibn Abbas (may Allah be pleased with them) narrated from the Prophet (ﷺ): The one killed comes with his killer on the Day of Resurrection, holding his forelock and head, his veins gushing blood, saying: O Lord! English

Al-Miqdad ibn al-Aswad (may Allah be pleased with him) narrated: He said: O Messenger of Allah! What if I meet a man from the disbelievers, and we fight, and he strikes one of my hands with a sword and cuts it off, then he takes refuge behind a tree and says: I have submitted to Allah. In another narration: When I raised my sword to kill him, he said: There is no god but Allah. Should I kill him after he has said it? He (ﷺ) said: Do not kill him. He said: O Messenger of Allah! He cut off one of my hands. The Messenger of Allah (ﷺ) said: Do not kill him, for if you kill him, he will have your status before you killed him, and you will have his status before he said the word he uttered. [Agreed upon]

2 His statement: “Do not kill him”: It is deduced from this that the Islam of one under coercion is valid, and if a disbeliever says: I have submitted, or I am a Muslim, he is judged to be a Muslim, even if coerced into Islam. If he is judged to be a Muslim and then reverts, he is not killed due to the possibility of doubt regarding apostasy, which prevents killing. (Al-Mirqat and Al-Hidayah, excerpted from them).

3 His statement: “The Messenger of Allah said: Do not kill him” and what follows: From his prohibition of killing and confronting him again after he repeated that he cut off one of his hands, it is deduced that if a belligerent commits a crime against a Muslim and then embraces Islam, he is not held accountable for retribution. If retribution were obligatory, he would have been permitted to cut off one of his hands in retaliation. So it is in (Al-Mirqat). It is said in (Al-Ashbah wa al-Nazair): As for a protected non-Muslim, Islam cancels what came before it regarding the rights of Allah, the Exalted, but not the rights of individuals, such as retribution and compensation for property, except in certain cases. If a disbeliever commits a crime and then embraces Islam, it does not cancel it. Among them: If he committed adultery and then embraced Islam, and his adultery was proven by the testimony of Muslims, the punishment is not canceled by his Islam; otherwise, it is canceled.

وَفِي رِوَايَةِ الجُندُبِ بنِ عَبدِاللهِ البَجَلِي اَن رَسُولَ اللهِﷺ قَالَ :(كَيفَ تَصنَعُ بِلاَاِلٰهَإِلَّا اللهُ إِذَا جَاءَتْ يَوْمَ الْقِيَامَةِ) قَالَهُ مِرَارًا. رَوَاهُ مُسْلِمٌ.

English

Usamah ibn Zayd (may Allah be pleased with him) narrated: The Messenger of Allah (ﷺ) sent us to some people from Juhaynah. I came upon a man from them, and I went to stab him, but he said: There is no god but Allah. I stabbed him and killed him. I came to the Prophet (ﷺ) and informed him. He said: Did you kill him when he testified that there is no god but Allah? I said: O Messenger of Allah, he only did that to seek protection. He said: Why did you not split open his heart? [Agreed upon] And in a narration by Jundub ibn Abdullah al-Bajali, the Messenger of Allah (ﷺ) said: What will you do with “There is no god but Allah” when it comes on the Day of Resurrection? He said it repeatedly. [Narrated by Muslim]

Abu Hurayrah (may Allah be pleased with him) narrated: The Messenger of Allah (ﷺ) said: Whoever throws himself from a mountain and kills himself will be in the Fire of Hell, throwing himself therein, abiding eternally forever. Whoever drinks poison and kills himself, his poison will be in his hand, drinking it in the Fire of Hell, abiding eternally forever. Whoever kills himself with a piece of iron, his iron will be in his hand, stabbing himself in his stomach in the Fire of Hell, abiding eternally forever. [Agreed upon]

1 His statement: “And kills himself, he will be in the Fire of Hell” etc.: It appears that those who did this while considering it lawful are meant. If the general meaning is intended, “eternity” and “forever” refer to a long duration, which can mean either uninterrupted permanence or a prolonged period that eventually ends, as both meanings are used. Therefore, jurists and the people of the Sunnah agree that one who kills himself does not exit Islam. Abu Hanifah and Muhammad said: He is washed and prayed over, and this is the fatwa. Though his sin is greater than one who kills another, Kamal preferred Abu Yusuf’s view that he is washed but not prayed over, based on a narration in (Muslim) that a man who killed himself was brought, and he (ﷺ) did not pray over him. It is said in (Al-Bahr): The verification differed, but Abu Yusuf’s view is supported by the Hadith. I say: It may be said that the Hadith does not indicate this, as it only states that he (ﷺ) did not pray over him. It appears he refrained to deter others from such an act, as he refrained from praying over a debtor, but it does not follow that no one from the companions prayed over him, as there is no equivalence between his prayer and others’. Allah, the Exalted, said: Indeed, your prayer is a source of tranquility for them (Al-Tawbah: 103). Know that this applies to one who kills himself intentionally. ٤ قوله: فقتل نفسه فهو في نار جهنم إلخ: الظاهر أن المراد من هؤلاء الذين فعلوا ذلك مستحلِّين له، وإن أريد منهالعموم بالمراد من الخلود والتأبيد المكث الطويل المشترك بين دوام الانقطاع له واستمرار مديد ينقطع بعد حين بعيد لاستعمالهما في المعنيين، لذلك أجمع الفقهاء وأهل السنة على أنه من قتل نفسه أنه لا يخرج بذلك من الإسلام.وقال أبو حنيفة ومحمد: يغسل ويصلى عليه، به يفتى، وإن كان أعظم وزرا من قاتل غيره، ورجح الكمال قول أبييوسف إنه يغسل ولا يصلى عليه، بما في (مسلم) أنه أُتي برجل قَتل نفسَه فلم يُصلِّ عليه. قال في (البحر): فقداختلف التصحيح لكن تأيّد أبو يوسف بالحديث، انتهى. أقول: قد يقال: لا دلالة في الحديث على ذلك؛ لأنه ليس فيهسوى أنهﷺ لم يصل عليه، فالظاهر أنه امتنع زجرا لغيره عن مثل هذا الفعل، كما امتنع عن الصلاة على المديون،ولا يلزم من ذلك عدم صلاة أحد عليه من الصحابة إذ لا مساواة بين صلاته وصلاة غيره، قال تعالى: ﴿إِنَّ صَلَوْتَكَسَكَنُ لَّهُمْ﴾ (التوبة: ١٠٣). ثم اعلم أن هذا كله فيمن قتل نفسه عمدا أما لو كان خطأ فإنه يصلَّى عليه بلا خلاف، كماصرَّح به في (الكفاية) وغيرها (المرقاة) و(عمدة القاري) و(الدر المختار) و(رد المحتار) ملتقط منها.

Jundub ibn Abdullah (may Allah be pleased with him) narrated: The Messenger of Allah (ﷺ) said: Among those before you was a man with a wound who became impatient, took a knife, and cut his hand with it. The blood did not stop until he died. Allah, the Exalted, said: My servant hastened himself to Me, so I have forbidden Paradise to him. [Agreed upon]

وَعَنْ جَابِرٍرَضِیَ اللهُ عَنهُ أَنَّ الطُفَيْلَ بْنَ عَمْرِو الدَّوْسِيَّ رَضِیَ اللهُ عَنهُ لَمَّا هَاجَرَ النَّبِيُّ ﷺ إِلَىالْمَدِينَةِ هَاجَرَ إِلَيْهِ، وَهَاجَرَ مَعَهُ رَجُلٌ مِنْ قَوْمِهِ، فَمَرِضَ فَجَزِعَ، فَأَخَذَ مَشَاقِصَ لَهُ، فَقَطَعَبِهَا بَرَاجِمَهُ، فَشَخَبَتْ يَدَاهُ حَتي مَاتَ، فَرَآهُ الطُّفَيْلُ بْنُ عَمْرٍو فِي مَنَامِهِ، وَهَيْئَتُهُ حَسَنَةٌ وراۤهُ مُغَیِۤطًا یَدَيهِ فَقَالَ لَهُ مَا صَنَعَ بَكَ رَبُكَ فَقَالَ غَفَرَلِي بِهِجرَتِي الي نبيه ﷺ،فَقَالَ: مَا لِي أَرَاكَ مُغَطِّيًا يَدَيْكَ، قَالَ: قِيلَ لِيْ: لَنْ نُصْلِحَ مِنْكَ مَا أَفْسَدْتَ، فَقَصَّهَا الطُّفَيْلُ عَلٰي رَسُولِ اللهِﷺ(اللهم١ وَلِيَدَيهِ فَاغفِر)رَوَاهُ مُسلِمٌ.

English

Jabir (may Allah be pleased with him) narrated: When al-Tufayl ibn Amr al-Dawsi (may Allah be pleased with him) migrated to the Prophet (ﷺ) in Madinah, he migrated with him, and a man from his people migrated with him. The man fell ill and became impatient, took his arrows, and cut his knuckles with them. His hands bled until he died. Al-Tufayl ibn Amr saw him in a dream, his appearance good but his hands covered. He said to him: What did your Lord do with you? He said: He forgave me due to my migration to His Prophet (ﷺ). He said: Why do I see you covering your hands? He said: It was said to me: We will not mend what you ruined. Al-Tufayl related this to the Messenger of Allah (ﷺ), who said: O Allah, forgive his hands as well. [Narrated by Muslim]

1 His statement: “O Allah, forgive his hands as well”: Al-Turbashti said: Although this Hadith mentions a dream seen by a companion for reflection on its interpretation, the Prophet’s (ﷺ) statement, “O Allah, forgive his hands as well,” is among the narrations we mentioned indicating that eternity does not apply to one who utters the testimony of faith, even if he kills himself. For the Prophet (ﷺ) prayed for forgiveness for the one who harmed himself, and it is not permissible for him to seek forgiveness for one destined for eternal punishment, as he was prohibited from doing so. So it is in (Al-Mirqat).

وَعَنِ ابْنِ عَبَّاسِ رَضِیَ اللهُ عَنهُمَا قَالَ: قَالَ رَسُوْلُ اللهِ ﷺ: (الْعَمدُ ٢ قَوَدٌ إِلَّا ٣ أَنْيَعْفُوَ وَلِيُّالْمَقْتُولِ). رَوَاهُ ابْنُ أَبِيِّ شَيْبَةَ وَالدَّارَقُطْنِيُّ فِي سُنَنِهِ وَالطَّبَرَانِيُّ فِي مُعْجَمِهِ.

وَفِي (الْمُتَّفَقِ عَلَيْهِ) عَنْ أَنَسٍ رَضِیَ اللهُ عَنهُقَالَ: كَسَرَتْ الرُّبَيَّعُ وَهِيَ عَمَّةُ أَنَسِ بْنِ مَالِكٍ ثَنِيَّةَ جَارِيَةٍ مِنَ الْأَنْصَارِ، فَأَتَوُا الَّنَبِي ﷺ فَأُمَرَ بِالْقِصَاصِ، فَقَالَ أَنَسُ بْنُ النَّصْرِ عَمُّ أَنَسِ بن مالک لاَ وَاللهِ لاَتُکسَرُ ثَنِيَتُهَا يارسول الله فقال رسول الله ﷺ(يَا اَنَسُ١ كِتَابُ اللهِ القِصَاصُ)فَرَضِيَ القَومُ وَقَبِلُوا الاَرشَ فَقَالَ رَسُولُ الله ﷺ (اِنَ مِن عِبَادِاللّهِ مَنْ لَوْ أَقْسَمَ عَلَى اللهِ لَأَبَرَّ).

وَرَوَى أُبُوْ دَاوُدَ وَالنَّسَائِيُّ عَنِ ابْنِ عَبَّاسٍ رضي الله عنهما عَنْ رَسُوْلِ اللهِﷺ قَالَ: (مَنْ قُتِلَ٢فِي عِمِّيَّا فِي رَمْيٍ يَكُونُ بَيْنَهُمْ بِحِجَارَةٍ أَوْ بِالسِّيَاطِ أَوْ ضَرْبٍ بِعَصًا فَهُوَ خَطَاٌ، وَعَقْلُهُعَقْلُ الْخَطَإِ، وَمَنْ قُتِلَ عَمْدًا فَهُوَ قَوَدٌ، وَمَنْ حَالَ دُوْنَهُ فَعَلَيْهِ لَعْنَةُ اللهِ وَالْمَلَائِكَةِوَالنَّاسِ أَجْمَعِينَ، وَغَضَبُهُ، لَا يُقْبَلُ مِنْهُ صَرْفٌ وَلَا عَدْلٌ).

وَفِيْ رِوَايَةِ ابْنِ مَاجَهِ وَالْبَزَّارِ عَنْ أَبِيْ بَكْرَةَ رَضِیَ اللهُ عَنهُ عَنِ النَّبِيِّ ﷺ قَالَ:(لَا قَوَدَ١الا بِالسَّيْفِ)

وَرَوَي البُخَارِيُّعَنْ أَنَسٍ بنِ مَالِكٍ رَضِیَ اللهُ عَنهُأَنَّالنَّبِيِّ ﷺ قَتَلَ٢ يَهُودِياً بِجَارِيَةٍ قَتَلَهَا عَلَى أَوْضَاحٍ لَهَا.

Ibn Abbas (may Allah be pleased with them) narrated: The Messenger of Allah (ﷺ) said: Intentional killing requires retribution unless the victim’s guardian forgives. [Narrated by Ibn Abi Shaybah, al-Daraqutni in his Sunan, and al-Tabarani in his Mu’jam] In a narration by al-Tirmidhi from Amr ibn Shu’ayb, from his father, from his grandfather (may Allah be pleased with him), attributed to the Prophet: And whatever they agree upon is theirs. In an agreed-upon narration from Anas (may Allah be pleased with him), he said: Al-Rubayyi’, Anas ibn Malik’s aunt, broke the tooth of a girl from the Ansar. They came to the Prophet (ﷺ), and he ordered retribution. Anas ibn al-Nadr, Anas’s uncle, said: By Allah, her tooth will not be broken, O Messenger of Allah. The Messenger of Allah (ﷺ) said: O Anas, the Book of Allah prescribes retribution. The people were satisfied and accepted compensation. The Messenger of Allah (ﷺ) said: Among Allah’s servants are those who, if they swear by Allah, He fulfills their oath. Abu Dawud and al-Nasa’i narrated from Ibn Abbas (may Allah be pleased with them) that the Messenger of Allah (ﷺ) said: Whoever is killed in a melee, in a fight with stones, whips, or sticks, it is a mistake, and his compensation is that of a mistake. Whoever is killed intentionally, it is retribution. Whoever stands in its way is cursed by Allah, the angels, and all people, and his anger is upon him; no expiation or ransom is accepted from him. In a narration by Ibn Majah and al-Bazzar from Abu Bakrah (may Allah be pleased with him), the Prophet (ﷺ) said: There is no retribution except with a sword. Bukhari narrated from Anas ibn Malik (may Allah be pleased with him) that the Prophet (ﷺ) killed a Jew for a girl he killed over her silver ornaments.

1 His statement: “O Anas, the Book of Allah prescribes retribution”: Al-Tahawi said: Since the ruling the Messenger of Allah (ﷺ) issued against al-Rubayyi’ for the girl whose tooth was broken was retribution, and he did not give her a choice between retribution and taking compensation, when Anas ibn al-Nadr objected, he said: O Anas, the Book of Allah prescribes retribution. The people forgave, and he did not rule for compensation. This establishes that what is obligatory by the Book of Allah, the Exalted, and the Sunnah of His Messenger (ﷺ) for intentional acts is retribution. If the victim had a choice between retribution, forgiveness, or taking compensation from the offender, the Messenger of Allah (ﷺ) would have given her that choice and informed her of her options. Do you not see that if a judge is approached by someone entitled to one of two things, and his right is established, he does not rule for one without the other but rules that he may choose what he prefers? If he exceeds that, he fails to understand the ruling. The Messenger of Allah (ﷺ) is the wisest of judges. Since he ruled for retribution and stated it is the Book of Allah, the Exalted, it is established that in such cases, it is retribution and nothing else. Since this Hadith is as we described, the narrations of Abu Shurayh and Abu Hurayrah (may Allah be pleased with them) must be interpreted to mean that he has the choice to forgive, seek retribution, or accept compensation with the offender’s agreement to pay, so that the meanings of these two narrations align with the narration of Anas (may Allah be pleased with him). 2 His statement: “Whoever is killed in a melee with stones, whips, or sticks” etc.: Jurists call such killing quasi-intentional. Know that killing initiated without right, which entails retribution, compensation, or expiation, is of five types: intentional, quasi-intentional, mistaken, akin to mistaken, and caused indirectly. The classification is: Killing is either direct or not. If not direct, it is caused indirectly. If direct, it is either intentional or mistaken. If intentional, it is either with a weapon or something that severs parts or not. The former is intentional, the latter quasi-intentional. If mistaken, it is either while awake or asleep. The former is a mistake, the latter akin to a mistake. In detail: Killing that entails the following rulings, retribution, compensation, expiation, sin, or loss of inheritance, is of five types; otherwise, its types are many, like stoning, crucifixion, or killing a belligerent. The first: Intentional, which is striking deliberately with something that severs parts, like a sword, stone, fire, or sharp wood or stone. The instrument of killing is of two types: weapons and non-weapons. Weapons are cutting instruments like swords or knives, and killing with them is purely intentional. Non-weapons, like stones, blunt spears, or similar, if they wound, are purely intentional, as they act like a sword by severing parts. The narrations differ regarding the Imam’s requirement of wounding with iron. In the apparent narration, wounding is not required with iron, as it is made for killing, as Allah, the Exalted, said: And We sent down iron, wherein is great might (Al-Hadid: 25). Likewise, anything like iron, copper, lead, gold, silver, whether it cuts or crushes. Even if killed with a heavy iron object or similar, retribution is required, as if struck with a copper or lead pole. Al-Tahawi narrated from the Imam that wounding is considered with iron and similar, which Al-Sadr al-Shahid said is more correct, preferred in (Al-Hidayah) and others. In (Al-Durr al-Mukhtar): If he killed with a “marr” (a tool used in clay), retribution applies if it struck with the sharpness of iron or its back and wounded, by consensus, as cited from (Al-Mujtaba). If it did not strike with its sharpness but with its back and did not wound, there is no retribution per al-Tahawi’s narration. The apparent narration is that retribution applies without wounding with iron, copper, gold, or similar, attributed to Qadi Khan in (Al-Durar). However, (Al-Khulasah) cites that the Imam considers wounding necessary for retribution, followed by Ibn al-Kamal. In any case, killing with a lead bullet is intentional, as it is like iron and wounds, so retribution applies. But if it does not wound, there is no retribution per al-Tahawi’s narration. The ruling of intentional killing is sin and retribution, with consensus, and no expiation per our view, though Shafi’i says expiation is required. The second: Quasi-intentional, per Abu Hanifah, is striking deliberately with something that is not a weapon nor acts like one in severing parts. Abu Yusuf, Muhammad, and Shafi’i say: Striking with a large stone or wood is intentional. Quasi-intentional is striking deliberately with what usually does not kill, like a stick, whip, or small stone. For them, intentional is striking with intent using what usually kills, and quasi-intentional is with what usually does not. If drowned in little water and died, it is neither intentional nor quasi-intentional. If thrown into a well, from a roof, or mountain with no hope of survival, it is quasi-intentional per Abu Hanifah, intentional per them. The fatwa follows his view, as in (Al-Tatimmah). Abu Hanifah relies on this Hadith, as he (ﷺ) did not distinguish between small and large, ordering generality. The ruling of quasi-intentional per both views is sin, expiation, and heavy compensation on the clan. Quasi-intentional for limbs is intentional, requiring retribution, so there is no quasi-intentional for limbs. The third: Mistake, of two types: Mistake in intent, like shooting someone thinking he is game or a belligerent apostate, but he is a Muslim, or mistake in action, like aiming at a target or game but hitting a person. The fourth: Akin to a mistake, like a sleeper rolling over someone and killing him. The ruling for both mistake and akin to mistake is expiation and compensation on the clan, with no sin in these types. They say: The sin meant is the intent to kill. Killing itself is not free of sin, as one neglected due diligence. This sin is of killing, as neglecting diligence is not sinful unless connected to killing, so expiation is for the sin of killing, even without intent. The fifth: Caused indirectly, like digging a well or placing a stone in public land without permission. If someone dies due to it, the compensation is on the clan, with no expiation or sin of killing, but sin for digging or placing in public land. All aforementioned types of unauthorized killing prevent inheritance if the offender is accountable, except indirect killing, which does not prevent inheritance per our view. Shafi’i says indirect killing follows the rulings of a mistake. (Al-Mirqat, Uqud al-Jawahir, Al-Durr al-Mukhtar, Radd al-Muhtar, Al-Hidayah, Al-Binayah, Al-Kifayah, and commentaries on Al-Kanz, excerpted from them).

2 His statement: “There is no retribution except with a sword”: Shafi’i says: He is killed with the same lawful act used. If he dies by that lawful act, fine; otherwise, his neck is severed, as retribution is based on equality. Per our view, retribution is only with a sword, even if killed otherwise. We rely on: There is no retribution except with a sword. “Sword” means weapon. Shafi’i’s view risks excess if the intended result is not achieved by the same act, requiring severance, so excess must be avoided, as with breaking a bone. (Al-Hidayah and Al-Durr al-Mukhtar, excerpted from them).

3 His statement: “Killed a Jew for a girl” etc.: This indicates that a man is killed for a woman, as a woman is killed for him, which is the view of most scholars. So it is in (Al-Mirqat).

١قوله: يا أنس كتاب الله القصاص: وقال الطحاوي ولما كان الحكم الذي حكم به رسول الله ﷺ علی الربیع للمنزوعة ثنيتها هو القصاص ،ولم يخيرها بين القصاص واخذ الدية ،وحاج انس بن النضر حين ابي ذلك فقال:ياانس كتاب الله القصاصفعفا القوم فلم يقض لهم بالدية. ثبت بذلك أن الذي يجب بكتاب الله عز وجل، وسنةرسوله ﷺ في العمد هو القصاص؛ لأنه لو كان يجب للمجني عليه الخيار بين القصاص وبين العفو مما يأخذ به الجانيإذًا لخيَّرها رسول اللّه ﷺ، ولأعلمها بما لها أن تختاره من ذلك. ألا ترى أن حاكمًا لو تقدم إليه رجل في شيء يجب لهفيه أحد شيئين، فثبت عنده حقه أنه لا يحكم له بأحد الشيئين دون الآخر، وإنما يحكم له بأن يختار ما أحبَّ من كذاومن كذا، فإن تعدى ذلك فقد قصر عن فهم الحكم، ورسول الله ﷺ أحكَم الحكماءِ، فلما حكم بالقصاص وأخبر أنهكتاب الله عز وجل ثبت بذلك أن الذي في مثل ذلك هو القصاص لا غيره، فلما ثبت هذا الحديث على ما ذكرنا، وجبأن يعطف عليه حديث أبي شريح وأبي هريرة رضی اللہ عنھما ليجعل قول رسول الله ﷺ فيهما فهو بالخيار بين أن يعفو أو بين أنيقتص أو يأخذ الدية على الرضاء من الجاني بغُرم الديةِ حتى تتفق معاني هذين الحديثين، ومعنى حديث أنس رضي الله عنه.

٢ قوله: من قتل في عمية في رمي يكون بينهم بالحجارة أو جلد بالسياط أو ضرب بعصا إلخ: والقتل بمثل ذلكتسميه الفقهاء شبه العمد. اعلم أن القتل الواقع ابتداء بغير حق الذي يتعلق به القصاص، والدية والكفارة على خمسةأقسام: عمد وشبهه وخطأ وما أجري مجراه وقتل بسبب. وبيان الحصر: أن القتل لا يخلو إما أن يكون بمباشرة أو لا،فإن لم يكن بمباشرة فهو القتل بسبب، إن كان مباشرة فإما إن كان عمدا أو خطأ، وإن كان عمدا،فإما إن كان بسلاح وما شابهه في تفريق الأجزاء أو بغير ذلك، والأَولى عمد، والثاني شبه العمد، وإن كان خطأ، فإماإن كان حالة اليقظة أو حالة النوم، فالأُول الخطأ، والثاني جار مجرى الخطأ. وتفصيله: أن القتل الذي يتعلق بهالأحكام الآتية من قَوَد ودية وكفارة وإثم وحرمان إرث خمسة، وإلا فأنواعه كثيرة، كرجم وصلب وقتل حربي.

الأول: عمد، وهو أن يتعمد الضرب بما يفرق الأجزاء كالسيف والليطة والنار وكالمحدد من الخشب والحجر،يعني أن آلة القتل على ضربين: آلة السلاح وغير السلاح، أما السلاح: فكل آلة جارحة كالسيف والسكين ونحوهمافيقتل به، وهو عمد محض، وأما غير السلاح: كالليطة والمروة والرمح الذي لا سنان فيه ونحوه إذا جرحه فهو عمدمحض؛ لأنه إذا فرق الأجزاء عَمِل عَمَلَ السيف.

واختلفت الرواية عن الإمام في اشتراط الجرح في الحديد، ففي ظاهر الرواية لا يشترط الجرح في الحديد؛ لأنهوضع للقتل، قال تعالى: ﴿وَأَنزَلْنَا الْحَدِيدَ فِيهِ بَأْسُ شَدِيدٌ﴾ (الحديد: ٢٥) وكذا كل ما يشبه الحديد كالصُّفْروالرصاص والذهب والفضة، سواء كان يبضع أو يرضّ حتى لو قتله بالمثقل من الحديد وأشباهه، يجب عليهالقصاص، كما إذا ضربه بعمود من صفر أو رصاص. وروى الطحاوي عن الإمام اعتبار الجرح في الحديد ونحوه، قالالصدر الشهيد: وهو الأصح، ورجَّحه في (الهداية) وغيرها.

وفي (الدر المختار): (وإن قتله بِمَرّ) بفتح الميم ما يعمل به في الطين (يقتص إن أصابه حدّ الحديد) أو ظهرهوجرحه إجماعًا كما نقله المصنف عن (المجتبى) وإلا يصبه حده، بل قتله بظهره ولم يجرحه، لا يقتص في روايةالطحاوي، وظاهر الرواية أنه يقتص بلا جرح في حديد ونحاس وذهب ونحوها، وعزاه في (الدرر) لقاضي خان،لكن نقل المصنف عن (الخلاصة) أن الأصح اعتبار الجرح عند الإمام لوجوب القود، وعليه جرى ابن الكمال انتهى.وعلى كل حال فالقتل بالبندقة الرصاص عمد؛ لأنها من جنس الحديد وتجرح فيقتص به، لكن إذا لم تجرح لا يقتصبه على رواية الطحاوي. وحكمه أي العمد الإثم والقود، وعليه إجماع الأمة، ولا كفارة في العمد عندنا، وعندالشافعي تجب.

والثاني: شبه العمد عند أبي حنيفة رحمہ اللہ أن يتعمد الضرب بما ليس بسلاح، ولا ما أجري مجرى السلاح في تفريقالأجزاء. وقال أبو يوسف ومحمد وهو قول الشافعي رحمہ اللہ : إذا ضربه بحجر عظيم أو بخشبة عظيمة فهو عمد، وشبهالعمد: أن يتعمد ضربه بما لا يقتل به غالبا كالعصا والسوط والحجر الصغير؛ لأن العمد عندهما ضربه قصدًا بما يقتلغالبا، وشبه العمد بما لا يقتل غالبا، فلو غرق في الماء القليل ومات ليس بعمد، ولا شبه عمد عندهم، ولو ألقي في بئرأو من سطح أو جبل، ولا يرجى منه النجاة كان شبه عمد عنده، وعمدًا عندهما، ويفتى بقوله، كما في (التتمة)، ولأبي حنيفة رحمہ اللہ هذا الحديث، والتمسك به أنه علیہ السلام لم يفصل بين الصغير والكبيـر، وأمر بالإطلاق، وموجب شبه العمد على القولين الإثم والكفارة، والدية مغلظة على العاقلة، وشبه العمد فيما دون النفس من الأطراف عمد موجب للقصاص، فليس فيما دون النفس شبه عمد.

والثالث: خطأ، وهو نوعان: لانه إما خطأ في القصد أي خطأ في ظن الفاعل كأن يرمي شخصا ظنَّه صيد، أو حربيًامرتدا فإذا هو مسلم، أو خطأ في نفس الفعل كأن يرمي غرضًا أو صيدًا فأصاب آدميًّا.

والرابع: ما يجري مجرى الخطأ: كنائم انقلب على رجل فقتله، موجبهما أي موجب الخطأ، وما جرى مجراه الكفارة والدية على العاقلة، ولا إثم في هذا النوعين. قالوا: المراد إثم قصد القتل، فأما القتل في نفسه، فلا يعرى عن الإثم .حيث ترك العزيمة والمبالغة في التثبت. وهذا الإثم إثم القتل؛ لأن نفس ترك المبالغة في التثبت ليس بإثم، وإنما يصـيربه آثما إذا اتصل به القتل،فيصير الكفارة لذنب القتل، وإن لم يكن فيه إثم قصد القتل.

والخامس: قتل بسبب، كحافر البئر وواضع حجر في غير ملكه بغير إذن من السلطان. وموجبه إذا تلف به آدمي الدية على العاقلة، ولا كفارة فيه ولا إثم القتل، بل إثم الحفر والوضع في غير ملكه. وكل ما تقدم من أقسام القتل الغـيرالمأذون فيه يوجب حرمان الإرث، لو الجاني مكلَّفا، إلا هذا القتل بسبب لا يتعلق به حرمان الميراث عندنا. وقـال الشافعي : يلحق القتل بسبب بالخطأ في أحكامه، (المرقاة) و(عقود الجواهر) و(الدر المختار) و(رد المحتار)و(الهداية) و(البناية) و(الكفاية) وشروح (الكنز) ملتقط منها.

١قوله: لا قود إلا بالسيف: وقال الشافعي : يقتل به مثل ما فعل إن كان فعلًا مشروعًا، فإن مات بذلك الفعـل المشروع، وإلا تُحَزُّ رقبته؛ لأن مبنى القصاص على المساواة. وعندنا لا يقاد إلا بالسيف، وإن قتله بغيره. ولنا قوله: (لا قود إلا بالسيف). والمراد به السلاح، ولأن فيما ذهب الشافعي إليه استيفاء الزيادة لو لم يحصل المقصود بمـثل ما فعل فيحزّ، فيجب التحرز عن الزيادة كما في كسر العظم. (الهداية) و(الدرالمختار) ملتقط منها.

٢ قوله: قتل يهوديا بجارية إلخ: فيه دليل على أن الرجل يُقتَل بالمرأة، كما تُقتَل المرأة به، وهو قول عامة أهل العلـم كذا في (المرقاة).

وَعَنْ عَليٍّرَضِیَ اللهُ عَنهُعَنِ النَّبِيَّﷺ قَالَ: (الْمُسْلِمُونَ تَتَكَافَأَ دِمَاؤُهُمْ، وَيَسْعَى١ِ بِذِمَّتِهِمْ أَدْنَاهُمْ، وَيُجِيرُ عَلَيْهِمْ أَقْصَاهُمْ، وَهُمْ يَدٌ عَلَى مَنْ سِوَاهُمْ، أَلَا لَا يُقْتَلُ ٢ مُسْلِمٌبِكَافِرٍ وَلَا ذُو عَهْدٍ فِي عَهْدِه). رَوَاهُ أَبُوْ دَاوُدَ وَالنَّسَائِيُّ، وَرَوَاهُ ابْنُ مَاجَه عَنِ ابْنِ عَبَّاسٍ.

وَفِي رِوَايَةٍ لِلطَّحَاوِيِّ عَنْ قَيْسِ بْنِ عُبَادٍ قَالَ: انْطَلَقْتُ أَنَا وَالْأَشْتَرُ إِلَى عَلِيٍّ، فَقُلْنَا: هَل عَهِدَ اِلَيكَ رَسُولُ اللهِﷺ عَهداً لَم يَعهَدهُ اِلَي الناسِ عَامَةً قَالَ لَا اِلاَ مَا فِي كِتَابِي هَذَا، فَأَخْرَجَ كِتَابًا مِنْ قِرَابِ سَيْفِهِ، فَإِذَا فِيهِ: (الْمُؤْمِنُونَ تَكَافَأُ دِمَاؤُهُمْ، وَيَسْعَىبِذِمَّتِهِمْ أَدْنَاهُمْ، وَهُمْ يَدٌ عَلَى مَنْ سِوَاهُمْ، أَلَا لَا يُقْتَلُ مُؤْمِنٌ بِكَافِرٍ وَلَا ذُو عَهْدٍ فِيعَهْدِهِ، وَمَنْ أَحْدَثَ حَدَثًا فَعَلَى نَفْسِهِ، وَمَنْ أَحْدَثَ حَدَثًا أَوْ آوَى مُحْدِثًا فَعَلَيْهِ لَعْنَةُ اللهِ وَالْمَلَائِكَةِ وَالنَّاسِ أَجْمَعِينَ).

وَرَوَى الدَّارُقُطْنِيُّ فِي سُنَنِهِ عَنِ ابْنِ عُمَرَ رضي الله عنهما أَنَّ رَسُوْلَ اللّهِ ﷺ قَتَلَ مُسْلِمًابِمُعَاهَدٍ، وَقَالَ: (أَنَا أَكْرَمُ مَنْ وَفّى بِذِمَّتِهِ)، هَذَا رُوِيَ مُسْنَدًا وَمُرْسَلًا، وَفِيْهِ ابْنُ الْبَلمانيوَثَّقَهُ١ ابْنُ حِبَّانَ، وَذَكَرَهُفِي الثَّقَاتِ، وَهُوَ رَجُلٌ مَعْرُوْفٌ مِنْ الَّتابِعِيْنَ۔

English

Ali (may Allah be pleased with him) narrated from the Prophet (ﷺ): The Muslims’ blood is equal, their protection is upheld by the least of them, the farthest of them grants safety, and they are a hand against others. Indeed, a Muslim is not killed for a disbeliever, nor one under a covenant during his covenant. [Narrated by Abu Dawud and al-Nasa’i, and by Ibn Majah from Ibn Abbas] In a narration by al-Tahawi from Qays ibn Ubad, he said: I and al-Ashtar went to Ali and said: Did the Messenger of Allah (ﷺ) entrust you with a covenant he did not entrust to people generally? He said: No, except what is in this document. He took out a document from his sword’s sheath, and it read: The believers’ blood is equal, their protection is upheld by the least of them, they are a hand against others. Indeed, a believer is not killed for a disbeliever, nor one under a covenant during his covenant. Whoever commits a crime is responsible for himself, and whoever commits a crime or shelters a criminal is cursed by Allah, the angels, and all people. Al-Daraqutni narrated in his Sunan from Ibn Umar (may Allah be pleased with them) that the Messenger of Allah (ﷺ) killed a Muslim for a person under a covenant and said: I am the most honorable in fulfilling his protection. This was narrated with a chain and as a mursal report. It includes Ibn al-Baylamani, whom Ibn Hibban deemed trustworthy and listed among the trustworthy, and he is a well-known Follower.

1 His statement: “Their protection is upheld by the least of them” etc.: It is said in (Badhl al-Majhud): “Their protection” means their covenant and safety. “The least of them” means the lowest, even one person. Abu Hanifah interprets “least” as the lowest to distinguish from Muhammad’s interpretation, who took it as a slave, as a slave is the lowest of Muslims. “Grants safety to them” means to the Muslims. “The farthest” means in rank, like a slave permitted to fight. The least is like the greatest, granting safety to whomever they wish. It is said in (Al-Bada’i): Conditions for safety include sanity and puberty, so a madman or child’s safety is invalid per most scholars. Per Muhammad, puberty is not required; a discerning adolescent who understands Islam can grant valid safety. Another condition is Islam, so a disbeliever’s safety is invalid, even if fighting with Muslims. I say: Al-Hafidh said: Al-Awza’I said: If a protected non-Muslim fights with Muslims and grants safety, the Imam may uphold it or return him to safety. Freedom is not a condition for valid safety, so a slave permitted to fight can grant safety by consensus. Does a slave prohibited from fighting grant valid safety? There is disagreement. Abu Hanifah and Abu Yusuf say: It is invalid. Muhammad and Shafi’I say: It is valid, as the Hadith includes the slave, the lowest of Muslims. Abu Hanifah and Abu Yusuf say: The Hadith does not include the prohibited slave, as “least” refers either to baseness or proximity. Baseness is not meant, as the Hadith includes Muslims with: “The Muslims’ blood is equal,” and there is no baseness with Islam. Proximity does not include the prohibited slave, as he is not in the battle line, so not closest to disbelievers. I say: Al-Hafidh said in (Al-Fath): Most allow a slave’s safety, whether fighting or not. Abu Hanifah says: If fighting, it is valid; otherwise, not. I say: I see no difference between the two phrases: “Their protection is upheld by the least of them” and “The farthest grants safety to them.” They seem to mean the same.

2 His statement: “A Muslim is not killed for a disbeliever, nor one under a covenant during his covenant”: They agree that if a disbeliever kills a Muslim, he is killed for it. They differ if a Muslim kills a protected non-Muslim. Shafi’i and Ahmad say: He is not killed for it. Abu Hanifah says: A Muslim is killed for a protected non-Muslim, not a belligerent. Among Abu Hanifah’s proofs is the generality of: that a life is for a life (Al-Ma’idah: 45). His evidence includes what al-Daraqutni and al-Bayhaqi narrated from Abdul Rahman ibn al-Baylamani that the Messenger of Allah (ﷺ) killed a Muslim for a person under a covenant and said: I am the most honorable in fulfilling his protection. Al-Tahawi said: This is Ali’s Hadith in full. The part negating a believer’s killing for a disbeliever is: “A believer is not killed for a disbeliever, nor one under a covenant during his covenant.” It cannot mean what Shafi’i claims, as that would be a grammatical error, and the Messenger of Allah (ﷺ) is far from that. It would mean: A believer is not killed for a disbeliever nor a covenanted person during his covenant. Since the wording is “nor one under a covenant,” we know the covenanted person is meant for retribution. It is as if he said: A believer nor one under a covenant during his covenant is killed for a disbeliever. We know the covenanted person is a disbeliever, so the disbeliever the Prophet (ﷺ) prohibited killing a believer for is one without a covenant. There is no disagreement among believers that a believer is not killed for a belligerent disbeliever, and a covenanted disbeliever with protection is not killed for either. We find this often in the Qur’an. Allah, the Exalted, said: Those who no longer expect menstruation among your women, if you doubt, their waiting period is three months, and those who have not menstruated (Al-Talaq: 4). It means: Those who no longer expect menstruation among your women, if you doubt, their waiting period is three months. So, it is with: “A believer is not killed for a disbeliever, nor one under a covenant during his covenant.” They interpreted it, and Allah knows best, as: A believer nor one under a covenant during his covenant is killed for a disbeliever, rearranging the order. The disbeliever prohibited from killing a believer for is the non-covenanted disbeliever. Al-Turbashti said: If the meaning were not as our colleagues claim, the statement would lack benefit, as there is consensus that a covenanted person is not killed during his covenant. Our scholars said: When narrations differ, as Shafi’i, Malik, Ahmad, and others relied on Ali’s Hadith in Bukhari (the document Hadith), and al-Tahawi addressed its text, analogy must be used, which supports us. The sanctity of protected non-Muslims’ blood and property is established by consensus, with many clear narrations, such that a thief among them is punished, an adulterer with their women is punished, and a slanderer against them is punished. Thus, killing for their sanctity is more appropriate. This is our view and that of al-Nakha’i and al-Sha’bi. 3 His statement: “Ibn Hibban deemed him trustworthy and listed him among the trustworthy, and he is a well-known Follower”: If so, his Hadith is authentic. A mursal report is evidence per our view, Malik, Ahmad, and most scholars. Al-Tabari cited the consensus of the Followers on this. He said: This continued until the year 200, when rejecting mursal reports emerged, and it was said: Rejecting mursal is an innovation. Ibn Abdul Barr said: Whoever rejects mursal rejects most of the Sunnah. Ibn al-Baylamani’s mursal was narrated through chains from Abu Hanifah, Malik, and al-Thawri, from Rabi’ah. These Imams suffice as examples. It was also supported by the mursal of Ibn al-Munkadir and Abdullah ibn Abdul Aziz, making it evidence. The mursal is not flawed if established through chains that strengthen each other. (Tansiq al-Nizam and Uqud al-Jawahir, excerpted from them).

١ قوله: ويسعى بذمتهم أدناهم إلخ: قال في (بذل المجهود): (يسعى بذمتهم) أي عهدهم وأمانهم، (أدناهم) أيأقلهم وهو الواحد، وإنما فسر الآدمي ههنا بالأقل عند أبي حنيفة احترازا عن تفسيرِ محمدٍ حيث فسَّره بالعبد؛لأنه جعله من الدناءة، والعبد أدنى المسلمين، (ويجير عليهم) على المسلمين (أقصاهم) أي في المرتبة كالعبدالمأذون في القتال، فالأدنى كالأعلى يعطي الأمان لمن يشاء. قال في (البدائع): ومن شرائطه الأمان العقل والبلوغ،فلا يجوز أمان المجنون والصبي عند عامة العلماء، وعند محمد البلوغ ليس بشرط حتى إن الصبي المراهق الذي يعقلالإسلام إذا آمن يصحُّ أمانه، ومنها الإسلام، فلا يصحُّ أمان الكافر، وإن كان يقاتل مع المسلمين، قلت: قال الحافظ:لكن قال الأوزاعي: إن غزا الذمي مع المسلمين فآمن أحدًا، فإن شاء الإمام أمضاه وإلا فليرده إلى مأمنه.

وأما الحرية فليست بشرط لصحة الأمان، فيصحُّ أمان العبد المأذون في القتال بالإجماع، وهل يصحُّ أمان العبدالمحجور عن القتال؟ اختلف فيه، قال أبو حنيفة وأبو يوسف : لا يصحُّ. وقال محمد: يصحُّ، وهو قول الشافعيوالعبد المسلم أدنى المسلمين، فيتناوله الحديث. وقال أبو حنيفة وأبو يوسف : الحديث لا يتناول المحجور؛لأن الأدنى إما أن يكون من الدناءة، وهي الخساسة، وإما أن يكون من الدنو وهو القرب، والأول ليس بمراد؛ لأنالحديث يتناول المسلمين بقوله: (المسلمون تتكافأً دمائهم) ولا خساسة مع الإسلام، والثاني لا يتناول المحجور؛لأنه لا يكون في صف القتال، فلا يكون أقرب إلى الكفار. قلت: قال الحافظ في (الفتح): وأما العبد فأجاز الجمهورأمانه، قاتل أو لم يقاتل. وقال أبو حنيفة : إن قاتل جاز أمانه، وإلا فلا. قلت: ولم يظهر لي فرق بين مدلولَيّالجملتينٍ، وهو قوله: (يسعى بذمتهم أدناهم) وقوله: (يجبر عليهم أقصاهم) والظاهر أنهما لمعنى واحد.

٢ قوله: لا يقتل مسلم بكافر ولا ذو عهد في عهده: واتفقوا على أن الكافر إذا قتل مسلما قتل به. واختلفوا فيما إذا قتلمسلم ذميا، فقال الشافعي وأحمد: لا يقتل به. وقال أبو حنيفة: يقتل المسلم بالذمي لا بالحربي، ومن جملة ما احتج بهأبو حنيفة عموم قوله تعالى: ﴿أَنَّ النَّفْسَ بِالنَّفْسِ﴾ (المائدة: ٤٥) ومن أدلته ما أخرجه الدار قطني والبيهقي منحديث عبد الرحمن بن البيلماني (أن رسول الله ﷺ قتل مسلما بمعاهد)، وقال: (أنا أكرم من وفى بذمته). وقالالطحاوي: فهذا هو حديث علي بتمامه، والذي فيه من نفي قتل المؤمن بالكافر هو قوله: (لا يقتل مؤمن بكافرولا ذو عهد في عهده) فاستحال أن يكون معناه على ما حمله عليه الشافعي؛ لأنه لو كان معناه على ما ذكر لكان ذلكلحنًا، ورسول الله ﷺ أبعد الناس من ذلك، ولكان لا يقتل مؤمن بكافر ولا ذي عهد في عهده، فلما لم يكن لفظهكذلك، وإنما هو ولا ذو عهد في عهده، علمنا بذلك أن ذا العهد هو المعنى بالقصاص، فصار ذلك كقوله: (لا يقتلالمؤمنولا ذو عهد في عهده بكافر)وقد علمنا ان ذا العهد كافر،فدل ذلك ان الكافر الذي منع النبي ﷺ ان يقتل به المؤمن في هذا الحديث هو الكافر الذي لا عهد له، فهذا مما لا اختلاف فيه بين المؤمنين أن المؤمن لا يقتل بالكافرالحربي، وأن ذا العهد الكافر الذي قد صار له ذمة لا يقتل به أيضًا.

وقد نجد مثل هذا كثيرا في القرآن قال الله تعالى: ﴿وَاّلْتِى يَئِسْنَ مِنَ الْمَحِيضِ مِنَ نِّسَآَئِكُمْ إِنِ آَرْتَبْتُمْفَعِدَّتُهُنَّ ثَلَثَةُ أَشْهُرِ وَالَّتِيلْميَحِضْنَ﴾ (الطلاق: ٤) فكان معنى ذلك ﴿وَالَّتِى يَئِسْنَ مِنَ اَلْمَحِيضِ مِنْ نِّسَآَئِكُمْإِنِ أَرْتَبْتُمْ فَعِدَّتُهُنَّ ثَلَٰثَةُ أَشْهُرٍ﴾ (الطلاق: ٤) فقدم وأخر، فكذلك قوله: (لا يقتل مؤمن بكافر ولا ذو عهد في عهده)أنما ضربوه فيه والله أعلم لا يقتل مؤمن ولا ذو عهد في عهده بكافر، فقدم وأخّر، والكافر الذي منع أن يقتل بهالمؤمن هو الكافر غير المعاهد. قال التوربشتي: لولا أن المراد ما ذهب إليه الأصحاب لكان الكلام خاليا عنالفائدة لحصول الإجماع على أن المعاهد لا يقتل في عهده انتهى. وقال علماؤنا: وإذا جاء الاختلاف في الأحاديث علىما احتج الشافعي ومالك وأحمد وغيرهم بحديث عليٍّ عند البخاري، وهو حديث الصحيفة. وقد تكلم فيه الطحاويمن جهة المتن وجب المصير إلى القياس، وهو معنا؛ لأن عصمة دماء أهل الذمة وأموالهم ثابتة إجماعًا، ويكثر منالأحاديث الصريحة حتى يقطع السارق منهم، ويحد الزاني بنسائهم والقاذف لهم، فلأن يقتل بعصمة دمهم أولى.وهذا مذهبنا وقول النخعي والشعبي. (رحمة الأمة) و(المرقاة) و(تنسيق النظام) و(نيل الأوطار) و(معاني الآثار)ملتقط منها.

١قوله: وثقه ابن حبان وذكره في الثقات وهو رجل معروف من التابعين: وإذا كان كذلك يكون حديثه صحيحًا،والمرسل حجة عندنا، وعند مالك وأحمد وأكثر العلماء، حتى نقل الطبري إجماع التابعين عليه. قال: ولم يزل الأمركذلك إلى رأس المائتين، فحدث رد المرسل حتى قيل: رد المرسل بدعة. وقال ابن عبد البر: من رد المرسل. فقد ردأكثر من السُّنَن، ومرسل البيلماني المذكور قد روي من طُرُّق عن أبي حنيفة ومالك والثوري ثلاثهم عن ربيعة، وكفىبهؤلاء الأئمة قدوةً. وقد تابعه أيضًا بمرسل ابن المنكدر ومرسل عبد الله بن عبد العزيز، فصار حجة، فلا يعيبالحديث الإرسال مع ثبوته من طُرُق يقوي بعضها بعضًا، أخذته من (تنسيق النظام) و(عقود الجواهر).

وَعَنْ جَابِرٍرَضِیَ اللهُ عَنهُ قَالَ: قَالَ رَسُوْلُ اللّهِ ﷺ: (لَا ٢ أُعْفِيَ مَنْ قَتَلَ بَعْدَ أَخْذِالدِّيَةِ). رَوَاهُ أَبُوْ دَاوُدَ.

وَفِي رِوَايَةِ الدَّارِميِّ: (فَإِنْ أَخَذَ مِنْ ذَلِكَ شَيْئاً ثُمَّ عَدَا بَعْدَ ذَلِكَ فَلَهُ النَّارُ خَالِدًا فِيهَا مخلدا).

English

Jabir (may Allah be pleased with him) narrated: The Messenger of Allah (ﷺ) said: I will not exempt one who kills after taking compensation. [Narrated by Abu Dawud] In a narration by al-Darimi: If he takes anything from that and then transgresses afterward, he will be in the Fire, abiding therein eternally.

Ibn Abbas (may Allah be pleased with them) narrated: The Messenger of Allah (ﷺ) said: The prescribed punishments are not to be carried out in the mosques, and a parent is not to be subjected to retribution by their child. [Narrated by Al-Tirmidhi and Al-Darimi]

2 His statement: “The prescribed punishments are not to be carried out in the mosques”: Because the mosques are primarily for the obligatory prayers and their adjuncts, such as supererogatory prayers, remembrance, and teaching knowledge, as mentioned by Ibn Al-Humam. So it is in (Al-Mirqat).

3 His statement: “And a parent is not to be subjected to retribution by their child”: It is said in (Ikhtilaf al-A’immah): They agreed that if a son kills one of his parents, he is to be killed. They differed regarding if a father kills his child. Abu Hanifah, Al-Shafi’i, and Ahmad said: He is not to be killed for it. Malik said: He is to be killed for it if the killing was purely intentional, like laying him down and slaughtering him. The mother is like the father, and the paternal and maternal grandparents are like the parents, as narrated by Al-Burjandi. So it is stated in (Al-Mirqat). It is said in (Al-Durr al-Mukhtar): Because they are the cause of his life, so he cannot be the cause of their death. Therefore, the compensation is obligatory on the father’s property over three years per our view, as this is intentional, and the clan does not bear the responsibility for intentional acts. Al-Shafi’i said: It is obligatory immediately, like the compensation for reconciliation. (Zayla’i and Jawharah).

٣ قوله: لا يقام الحدود في المساجد: لانه إنما هي المساجد للصلاة المكتوبة وتوابعها من النوافل والذكر وتدريسالعلم، ذكره ابن الهمام. كذا في (المرقاة).

٤ قوله: ولا يقاد بالولد الوالد: قال في (اختلاف الأئمة): اتفقوا على أن الابن إذا قتل أحد أبويه قُتِل. واختلفوا فيماإذا قتل الأبُ ولدَه، قال أبو حنيفة والشافعي وأحمد: لا يقتل به. وقال مالك: يقتل به؛ إذا كان قتله بمجردالقصد كإضجاعه وذبحه. والوالدة كالوالد، والجد والجدة من الأب ولأم كالوالدين، نقله البرجندي. قاله في(المرقاة). وقال في (الدر المختار): لأنهم أسباب في إحيائه فلا يكون سببًا لإفنائهم، وحينئذٍ تجب الدية في مال الأب في ثلاث سنين عندنا؛ لأن هذا عمد، والعاقلة لا تعقل العمد. وقال الشافعي: تجب حالة كبدل الصلح،(زيلعي) و(جوهرة).

Amr ibn Shu’ayb narrated from his father, from his grandfather (may Allah be pleased with him), from Suraqah ibn Malik (may Allah be pleased with him): He said: I was present with the Messenger of Allah (ﷺ) when he exacted retribution from a father for his son but did not exact retribution from a son for his father. [Narrated by Al-Tirmidhi]

وَعَن اَبِي رِمثَةَ رَضِیَ اللهُ عَنهُ قال اَتَيتُ رَسُولَ اللهِ ﷺمَع اَبِی،فَقَالَ:(مَن هٰذاَالَّذِيْ مَعَكَ؟) قَالَ: ابْنِيْ أَشْهَدُ بِهِ، قَالَ: (أَمَا إِنَّهُ لَا يَجْنِي عَلَيْكَ وَلَا تَجْنِي عَلَيْهِ). رَوَاهُ أَبُوْدَاوُدَ وَالنَّسَائِيُّ.

زَادَ فِي (شَرْجِ السُّنَّةِ) فِي أَوَّلِهِ قَالَ: دَخَلْتُ مَعَ أَبِيْ عَلَى رَسُوْلِ اللهِ ﷺ فَرَأَى أَبِيْالَّذِيْ بِظَهْرِ رَسُوْلِ اللهِ ﷺ فَقَالَ: دَعْنِيْ أُعَالِجُ الَّذِيْ بِظَهْرِكَ فَإِنِّيْ طَبِيْبُ، فَقَالَ: (أَنْتَرَفِيْقٌ، وَاللهُ الطَّبِيْبُ).

English

Abu Rimthah (may Allah be pleased with him) narrated: I came to the Messenger of Allah (ﷺ) with my father. He said: Who is this with you? He said: My son, I testify to it. He (ﷺ) said: Indeed, he does not commit a crime against you, nor do you commit a crime against him. [Narrated by Abu Dawud and Al-Nasa’i]

It is added in (Sharh al-Sunnah): At the beginning, he said: I entered with my father to the Messenger of Allah (ﷺ), and my father saw what was on the back of the Messenger of Allah (ﷺ). He said: Let me treat what is on your back, for I am a physician. He (ﷺ) said: You are a companion, and Allah is the Physician.

وَفِي رِوَايَةٍ لِلْبَيْهَقِيِّ عَنِ ابْنِ عَبَّاسِ رَضِیَ اللهُ عَنهُمَا قَالَ: جَاءَتْ جَارِيَةٌ إِلَى عُمَرَ بْنِ الْحَظّابِ رَضِیَ اللهُ عَنهُفَقَالَتْ: إِنَّ سَيِّدِيْ اتَّهَمَنِيْ فَأَقْعَدَنِيْ عَلَى النَّارِ حَتّى احْتَرَقَ فَرْجِيْ، فَقَالَ لَهَا عُمَر

رَضِیَ اللهُ عَنهُ ھَل رَأی ذَلِکَ عَلَیکَ؟ قَالت:لا،قَالَ:هَل اِعتَرَفتِ لَهُ بِشَئٍ ؟قَالَت:لاَ فَقَالَ عُمَرُ عَلَيَّ بِهِ، فَلَمَّا رَأَى عُمَرُ الرَّجُلَ قَالَ: أَتُعَذِّبُ بِعَذَابِ اللهِ؟ قَالَ: يَا أَمِيْرَ الْمُؤْمِنِيْنَ! اتَّهَمْتُهَا فِينَفْسِهَا، قَالَ: رَأَيْتَ ذَلِكَ عَلَيْهَا؟ قَالَ الرَّجُلُ: لَا، قَالَ: فَاعْتَرَفَتْ لَكَ بِهِ؟ فَقَالَ: لَا، قَالَ:وَالَّذِيْ نَفْسِي بِيَدِهِ لَوْ لَمْ أَسْمَعْ رَسُوْلَ اللهِ ﷺ يَقُوْلُ: (لَا يُقَادُ مَمْلُوْكٌ مِنْ مَالِكِهِ وَلَاوَلَدٌ مِنْ وَالِدهِ) لَأَقَدْتُهَا مِنْكَ، فَبَرَزَهُ وَضَرَبَهُ مِائَةَ سَوْطٍ، وَقَالَ لِلْجَارِيَةِ: اذْهَبِيْ فَأَنْتِ حُرَّةٌلِوَجْهِ اللهِ وَأَنْتِ مَوْلَاةُ اللهِ وَرَسُوْلِهِ.

وَرَوَى أَبُوْ دَاوُدَ عَنْ عَمْرِو بْنِ شُعَيْبٍ عَنْ أَبِيْهِ عَنْ جَدِّهِ رَضِیَ اللهُ عَنهُ ، قَالَ: جَاءَ رَجُلٌمُسْتَصْرِخٌ إِلَى النَّبِيِّ ﷺ فَقَالَ جَارِيَةٌ لَهُ: يَا رَسُولَ اللهِ! فَقَالَ: وَيْحَكَ مَا لَكَ فَقَالَ: شَرًّاأَبْصَرَ لِسَيِّدِهِ جَارِيَةً لَهُ فَغَارَ عَلَيْهَا، فَجَبَّ١ مَذَا كِيْرَهُ، فَقَالَ رَسُولُ اللهِ ﷺ: (عَلَيَّ بَاالرَجُلِ)فَطُلِبَ فَلَم یَقدِر عَلیهِ،فَقَالَ رَسُولَ اللهِﷺ (اِذهَب فَانتَ حُر)فَقَالَ يارَسُولَ اللهِ! عَلَى مَنْ نُصْرَتِي قَالَ: (عَلَى كُلِّ مُؤْمِنٍ)، أَوْ قَالَ:(كُلِّ مُسْلِمٍ).

English

Amr ibn Shu’ayb narrated from his father, from his grandfather (may Allah be pleased with him): A man intentionally killed his slave. The Prophet (ﷺ) lashed him one hundred times, exiled him for a year, erased his share from the Muslims’ register, did not exact retribution from him for it, and ordered him to free a slave. [Narrated by Al-Bayhaqi in his Sunan and Al-Daraqutni with his chain]

In a narration by Al-Bayhaqi from Ibn Abbas (may Allah be pleased with them), he said: A slave girl came to Umar ibn Al-Khattab (may Allah be pleased with him) and said: My master accused me and made me sit on fire until my private part was burned. Umar said to her: Did he see that upon you? She said: No. He said: Did you confess anything to him? She said: No. Umar said: Bring him to me. When Umar saw the man, he said: Do you torture with Allah’s torture? He said: O Commander of the Faithful! I suspected her regarding herself. He said: Did you see that upon her? The man said: No. He said: Did she confess it to you? He said: No. He said: By the One in Whose hand is my soul, if I had not heard the Messenger of Allah (ﷺ) say: A slave is not subjected to retribution by his owner, nor a child by his parent, I would have exacted retribution from you for her. He flogged him one hundred lashes and said to the slave girl: Go, you are free for the sake of Allah, and you are the freed slave of Allah and His Messenger.

Abu Dawud narrated from Amr ibn Shu’ayb, from his father, from his grandfather (may Allah be pleased with him): A man came crying for help to the Prophet (ﷺ), and his slave girl said: O Messenger of Allah! He said: Woe to you, what is the matter with you? He said: A misfortune. His master saw something with his slave girl and became jealous over her, so he castrated him. The Messenger of Allah (ﷺ) said: Bring the man to me. He was sought but could not be found. The Messenger of Allah (ﷺ) said: Go, you are free. He said: O Messenger of Allah! Upon whom is my support? He said: Upon every believer, or he said: Upon every Muslim.

1 His statement: “A man killed his slave” etc.: Our position is that a free person is killed for another’s slave but not for his own slave, as his slave is his property, so he cannot claim against himself, but expiation is upon him, as in (Al-Jawharah). Our evidence is these narrations. Al-Shafi’i and Malik said: A free person is not killed for a slave, even if it is another’s slave, due to His statement, the Exalted: the free for the free, the slave for the slave (Al-Baqarah: 178). This is a reciprocal statement, implying that a free person is not killed for a slave. Also, a free person is an owner, and a slave is owned, so there is no equality between them, and retribution relies on equality. We rely on general statements like His statement, the Exalted: And We ordained for them therein that a life is for a life (Al-Ma’idah: 45), His statement, the Exalted: Prescribed for you is retribution (Al-Baqarah: 178), and his (ﷺ) statement: Intentional killing requires retribution. There is no conflict with what was recited, as it has a qualified reciprocity, while what we recited has absolute reciprocity, so it is not restricted by the qualified one. Moreover, the reciprocity of free for free does not negate free for slave, as it only mentions part of what the general includes, agreeing with its ruling, and that does not necessitate specifying what remains. Do you not see that He reciprocated female for female and male for male, yet that does not prevent reciprocating male for female, and similarly, it does not prevent reciprocating slave for free, such that a slave is killed for a free person by consensus, and vice versa. If it prevented that, it would prevent the reverse as well. (Al-Mirqat, Radd al-Muhtar, and commentaries on Al-Kanz, excerpted from them).

2 His statement: “So he castrated him” etc.: It is deduced that a free person’s limb is not cut for a slave’s limb by agreement, meaning there is no retribution for it per our view and Al-Shafi’i’s. Therefore, it is said in (Al-Hidayah): There is no retribution between a man and a woman for what is less than life, nor between a free person and a slave, nor between two slaves, contrary to Al-Shafi’i in all of that except for a free person cutting a slave’s limb.

١قوله: فحبَّ مذاكيره إلخ: يستفاد منه أن طرف الحر لا يقطع بطرف العبد عليه الاتفاق يعني لا قصاص فيه عندنا،وعند الشافعي أيضًا لذلك قال في (الهداية): ولا قصاص بين الرجل والمرأة فيما دون النفس، ولا بين الحر والعبد، ولا بين العبدين، خلافًا للشافعي في جميع ذلك إلا في الحر يقطع طرف العبد.

English

Abu Al-Darda (may Allah be pleased with him) narrated: I heard the Messenger of Allah (ﷺ) say: No man is afflicted with something in his body and then gives it in charity except that Allah raises him a degree and removes a sin from him for it. [Narrated by Al-Tirmidhi and Ibn Majah]

وَعَنْ سَعِيْدِ بْنِ الْمُسَيِّبِ أَنَّ عُمَرَ بْنَ الْحَظّابِ رَضِیَ اللهُ عَنهُ ، قَتَلَ نَفَرًا خَمْسَةً أَوْ سَبْعَةًبِرَجُلٍ وَاحِدٍ قَتَلُوهُ قَتْلَ غِيلَةٍ، وَقَالَ عُمَرُ: لَوْ١ تَمَالَا عَلَيْهِ أَهْلُ صَنْعَاءَ لَقَتَلْتُهُمْ جَمِيعًا.رَوَاهُ مَالِكٌ، وَرَوَى الْبُخَارِيُّ عَنِ ابْنِ عُمَرَ رَضِیَ اللهُ عَنهُمَانَحْوَهُ.

English

Sa’id ibn Al-Musayyib narrated that Umar ibn Al-Khattab (may Allah be pleased with him) killed a group of five or seven for one man they killed treacherously. Umar said: If the people of Sana’a conspired against him, I would kill them all. [Narrated by Malik, and Bukhari narrated something similar from Ibn Umar (may Allah be pleased with them)]

وَعَنِ ابْنِعُمَرَرَضِیَ اللهُ عَنهُمَا عَنِالنَّبِيِّﷺ قَالَ:(اِذَا اَمسَک الرجُلُ الرَجُلَ وَقَتَلَهُالآخَرُ يُقْتَلُ٢ الَّذِيْ قَتَلَ وَيُحْبَسُ الَّذِيْ أَمْسَكَ). رَوَاهُ الدَّارقُطْنِيُ.

وَرَوَى الشَّافِعِيُّ عَنْ عَلِيٍّ رَضِیَ الله عَنهُ أَنَّهُ قَضَى فِي رَجُلٍ قَتَلَ رَجُلًا مُتَعَمِّدًا وَأَمْسَكَهُ آخَرُ قَالَ:يُقْتَلُ الْقَاتِلُ وَيُحْبَسُ الْآخَرُ فِي السِّجْنِ حَتَّى يَمُوْتَ.

English

Ibn Umar (may Allah be pleased with them) narrated from the Prophet (ﷺ): If a man holds another man and another kills him, the one who killed is to be killed, and the one who held is to be imprisoned. [Narrated by Al-Daraqutni]

Al-Shafi’i narrated from Ali (may Allah be pleased with him) that he judged regarding a man who intentionally killed another while another held him: The killer is to be killed, and the other is to be imprisoned until he dies.

1 His statement: “The one who killed is to be killed, and the one who held is to be imprisoned”: The Hadith indicates that the one who holds the victim while the killer kills him is not subject to retribution, and his act is not considered participation such that it would be a case of a group killing one person. Rather, what is obligatory is only his imprisonment. The author of (Al-Bahr) narrated this view from both parties, meaning the Shafi’is and the Hanafis. They deduced it from the mentioned Hadith and report, and His statement, the Exalted: So whoever transgresses against you, transgress against him in the same manner as he transgressed against you (Al-Baqarah: 194). The mentioned imprisonment is left to the Imam’s discretion regarding its duration, as the purpose is discipline, not intended to last until death. So it is in (Nayl al-Awtar). It is also understood from (Radd al-Muhtar).

٢ قوله: يقتل الذي قتل ويحبس الذي أمسك: والحديث فيه دليل على أن الممسك للمقتول حال قتل القاتل له لايلزمه القود، ولا يعد فعله مشاركة حتى يكون ذلك من باب قتل الجماعة بالواحد، بل الواجب حبسه فقط. وقدحكى صاحب (البحر) هذا القول عن الفريقين يعني الشافعية والحنفية. وقد استدل لهم بالحديث والأثر المذكورينوقوله تعالى: ﴿فَمَنِ أَعْتَدَى عَلَيْكُمْ فَأَعْتَدُواْ عَلَيْهِ بِمِثْلِ مَا أَعْتَدَى عَلَيْكُمْ﴾ (البقرة: ١٩٤) والحبس المذكورجعله الجمهور موكولا إلى رأي الإمام في طول المدة وقصرها؛ لأن الغرض تأديبه، وليس بمقصود استمراره إلىالموت. كذا في (نيل الأوطار). وأيضًا يفهم من (رد المحتار).
