بَابُ الْقَسَامَةِCompurgation (Qasamah)

١قوله: القسامة: بفتح أوله، وهي أيمان تقسم على أهل المحلة التي وُجِد القتيل فيها، هذاعندنا،وعند الشافعيتقسم على أولياء المقتول المدعين لدمه ضد جهالة القاتل، وسببها وجود القتل في المحلة أو ما يقوم مقامها، وركنهاقولهم: بالله ما قتلناه ولا علمنا له قاتلا. وشرطها: أن يكون المقسم رجلًاً حرا عاقلًا. وقال مالك: يدخل النساء فيقسامة الخطأ دون العمد، وحكمها القضاء، فوجب الدية بعد الحلف، سواء كانت الدعوى في القتل العمد أو الخطأ.

حديث القسامة أصل من أصول الشرع، وقاعدة من أحكام الدين، وركن من أركان مصالح العباد وبه أخذالعلماء كافة من الصحابة والتابعين ومن بعدهم، وإن اختلفوا في كيفية الأخذ به. واختلف القائلون بها فيما إذا كانالقتل عمدا هل يجب القصاص بها أم لا؟ فقال جماعة من العلماء: يجب، وهو قول مالك وأحمد وإسحاق وقولالشافعي في القديم. وقال الكوفيون والشافعي في أصح قولَيه: لا يجب، بل تجب الدية. واختلفوا فيمن يحلف فيالقسامة، فقال مالك والشافعي والجمهور: يحلف الورثة ويجب الحق بحلفهم، قال أصحاب أبي حنيفة: يستحلفخمسون من أهل المدينة، ويتحراهم الولي، يحلفون: (بالله ما قتلناه وما علمنا قاتله)، فإذا حلفوا قضى عليهم وعلىأهل المحلة وعلى عاقلتهم بالدية. كذا في (المرقاة).

1 His statement: Al-Qasama: With a fatha on the first letter, it refers to oaths sworn by the residents of a locality where a slain person is found, according to our view. According to Al-Shafi’i, it is sworn by the heirs of the victim claiming blood money due to the unknown identity of the killer. Its cause is the occurrence of a killing in the locality or its equivalent. Its condition is their statement: “By Allah, we did not kill him, nor do we know his killer.” Its requirement is that the oath-taker be a free, sane man. Malik said: Women are included in qasama for unintentional killing, not intentional. Its ruling is that the judgment is enforced, and blood money is imposed after the oath, whether the claim is for intentional or unintentional killing.

The Hadith of qasama is a fundamental principle of Sharia, a rule among the rulings of the religion, and a pillar of the public’s welfare. All scholars from the Companions, their successors, and those after them adopted it, though they differed in its application. Those who uphold it disagreed on whether retribution is obligatory for intentional killing through qasama. A group of scholars, including Malik, Ahmad, and Ishaq, and Al-Shafi’i in his old view, said it is obligatory. The Kufans and Al-Shafi’i in his more authentic view said it is not obligatory, but blood money is required. They also differed on who swears in qasama. Malik, Al-Shafi’i, and the majority said the heirs swear, and the right is established by their oath. Abu Hanifah’s companions said: Fifty men from the city, selected by the guardian, swear: “By Allah, we did not kill him, nor do we know his killer.” If they swear, judgment is made against them, the residents, and their clan for the blood money. So it is in (Al-Mirqat).

عَنِ الْحَارِثِ بْنِ الْأَزْمَعِ قَالَ: قُتِلَ قَتِيْلٌ بَيْنَ وَادِعَةَ وَحَيٍّ آخَرَ، وَالْقَتِيْلُ إِلَى وَادِعَةَأَقْرَبُ، فَقَالَ عُمَرُ٢ لِوَادِعَةَ: يَخْلِفُ خَمْسُوْنَ رَجُلًا مِنْكُمْ بِاللّهِ مَا قَتَلْنَا وَلَا نَعْلَمُ قَاتِلًا، ثُمَّ أُغْرِمُوْا الدِّيَةَ، فَقَالَ لَهُ الْخَارِثُ: نَحْلِفُ وَتُغَرِّمُنَا، فَقَالَ: نَعَمْ. رَوَاهُ الطَّحَارِيُّ. وَرَوَىابْنُ أَبِيْ شَيْبَةَ وَعَبْدُ الرَّزَّاقِ وَالْبَيْهَقِيُّ تَحْوَهُ.

وَفِي رِوَايَةٍ لِلْبَيْهَقِيِّ عَنْ سُلَيْمَانَ بْنِ يَسَارٍ أَنَّ عُمَرَ بَدَأَ بِأَيْمَانِ الْمُدَّعَى عَلَيْهِمْ فِيالْقَسَامَةِ. وَقَالَ الطَّحَاوِيُّ: إِنَّ عُمَرَ بْنَ الْخَطَّابِ رَضِیَ اللهُ عَنهُ حَكَمَ بِهِ بَعْدَ رَسُوْلِ اللّهِ ﷺ بِمَحْضَرٍ مِنْ الصَّحَابَةِ مِنْ غَيْرٍ إِنْكَارٍ أَحَدٍ مِنْهُمْ فَصَارَ إِجْمَاعًا.

وَرَوي ابْنُ أَبِي شَيْبَةَ عَنْ الزُّهْرِيِّ أَنَّ النَّبِيَّ قَضَى فِي القَسَامَةِ أَنَّ اليَمِينَالْمُدَّعَى عَلَيْهِمْ.

وَفِي رِوَايَةِ الْبَزَّارِ عَنْ أَبِيْ سَلَمَةَ بْنِ عَبْدِ الرَّحْمَنِ عَنْ أَبِيْهِ قَالَ: جَاءَتِ الْأَنْصَارُفَقَالُوْا: إِنَّ صَاحِبَنَا يَتَشَحَّطُ فِي دَمِهِ، فَقَالَ: يَعْرِفُوْنَ قَاتِلَهُ؟ قَالُوْا: لَا إِلَّا أَنْ يَهُوْدَ قَتَلَتْهُ،فَقَالَ رَسُوْلُ اللهِ ﷺ: (اخْتَارُوْا مِنْهُمْ خَمْسِيْنَ رَجُلًا يَخْلِفُوْنَ بِاللّهِ جَهْدَ أَيْمَانِهِمْ، ثُمَّخُذُوا الدِّيَةَ مِنْهُمْ)، فَفَعَلُوْا.

ویؤيِّدُهُ مَا رَوَاهُ مُسْلِمُ عَنِ ابْنِ عَبَّاسِ رَضِیَ اللهُ عَنهُما أَنَّ النَّبِيَّ ﷺ قَالَ:(لَوْ يُعْطَى النَّاسُبِدَعْوَاهُمْ لَادَّعَى نَاسُ دِمَاءَ رِجَالٍ وَأَمْوَالَهُمْ، وَلَكِنَّ الْيَمِينَ عَلَى الْمُدَّعَى عَلَيْهِ).

English

Al-Harith ibn Al-Azma’ narrated: A man was killed between Wadi’ah and another tribe, and the slain was closer to Wadi’ah. Umar said to Wadi’ah: “Let fifty men from among you swear by Allah: ‘We did not kill him, nor do we know his killer,’” then they were imposed the blood money. Al-Harith said to him: “We swear, yet you impose on us?” He said: “Yes.” [Narrated by Al-Tahawi] Ibn Abi Shaybah, Abdul Razzaq, and Al-Bayhaqi narrated similarly.

In Al-Bayhaqi’s narration from Sulayman ibn Yasar, Umar began with the oaths of the accused in qasama. Al-Tahawi said: Umar ibn Al-Khattab (may Allah be pleased with him) ruled by it after the Messenger of Allah (ﷺ) in the presence of the Companions without any objection, so it became a consensus.

Ibn Abi Shaybah narrated from Al-Zuhri that the Prophet (ﷺ) ruled in qasama that the oath is on the accused.

In Al-Bazzar’s narration from Abu Salamah ibn Abdul Rahman, from his father: The Ansar came and said: “Our companion is writhing in his blood.” He said: “Do you know his killer?” They said: “No, except that the Jews killed him.” The Messenger of Allah (ﷺ) said: “Choose fifty men from among them to swear by Allah with their utmost effort, then take the blood money from them.” They did so.

This is supported by what Muslim narrated from Ibn Abbas (may Allah be pleased with them) that the Prophet (ﷺ) said: “If people were given based on their claims, some would claim the blood and wealth of others, but the oath is on the accused.”

The disagreement with Al-Shafi’i is in two matters: first, that the claimant does not swear according to us, contrary to him; second, in the absolution of the residents by their oath. Lawth is circumstantial evidence that instills belief in the claimant’s truth, such as a sign of killing on a specific person, evident enmity, or testimony of a just person or a group of non-just persons that the residents killed him. The condition of death is required because, without it, his view aligns with ours. Our evidence is these Hadiths mentioned in the text. Also, his (ﷺ) statement: “If people were given based on their claims, some would claim the blood and wealth of others, but the oath is on the accused,” equates blood and wealth, ruling them under one judgment. It cannot be said that Al-Bukhari agrees with us, as he recorded the qasama of Abu Talib in the pre-Islamic era, which matches our qasama. Perhaps Al-Bukhari indicates that this qasama remained as it was in the pre-Islamic era. The incident in his (ﷺ) time is singular, and the disagreement lies in its interpretation. 1 His statement: Ahl al-Ridda: Meaning the male or female apostate. Linguistically, it means one who returns. Legally, it is one who turns back from Islam. The condition of apostasy is uttering a word of disbelief with the tongue after faith. Its validity requires sanity, sobriety, and free will; thus, the apostasy of an insane person, an imbecile, a compulsive person, a child lacking understanding, an intoxicated person, or one coerced is invalid. Puberty and maleness are not conditions. Excerpted from the commentaries on (Al-Kanz).

2 His statement: “Umar said to Wadi’ah: Let fifty men swear” etc.: Meaning, according to us, the victim’s guardian does not swear, even if there is lawth (circumstantial evidence). Al-Shafi’i said: If there is lawth, the heirs swear fifty oaths, and judgment is made for them for the blood money against the accused, whether the claim is for intentional or unintentional killing, and this is his authentic view. In his old view, if they swear it was intentional, retribution is granted, and this is the view of Malik and Ahmad. If the heirs refuse to swear, the residents are made to swear; if they swear, they are absolved; if they refuse, judgment is made against them for the blood money.

2 His statement: “And Allah would not let a people stray” etc.: This verse indicates that their killing is not obligatory until evidence is established against them and their arguments are refuted. The verse proves that Allah does not hold His servants accountable until He clarifies what they should do and avoid. Excerpted from (Umdat al-Qari).

٢ قوله: فقال عمر لوادعة: يحلف خمسون رجلً إلخ: أي لا يحلف ولي القتيل عندنا، وإن وجد اللوث. وقالالشافعي: إذا كان لوث استحلف الأولياء خمسين يمينا، ويقضى لهم بالدية على المدعى عليه، عمدا كانت الدعوى أوخطأ، وهو قوله الصحيح، وفي القديم: إذا حلف أنهم قتلوه عمدا فله القصاص، وبه قال مالك وأحمد، وإن نكلالأولياء عن اليمين استحلف أهل المحلة، فإن حلفوا برئوا، وإن نكلوا حكم عليهم بالدية.

فالخلاف مع الشافعي في موضعَين، أحدهما: أن المدعي لا يحلف عندنا، خلافًا له، والثاني: في براءة أهلالمحلة باليمين، واللوث قرينة حالية توقع في القلب صدق المدعي، بإن يكون هناك علامة القتل على واحد بعينه، أوظاهر يشهد للمدعي من عداوة ظاهرة أو شهادة عدل أو جماعة غير عدول إن أهل المحلة قتلوه،وإنما شرط الموت؛ لأن مذهبه عند عدمه كمذهبنا، لنا هذه الأحاديث التي ذكرت في المتن. وأيضًا لنا قولهﷺ:(لو يعطى الناس بدعواهم لادعى ناس دماء رجال وأموالهم، ولكن اليمين على المدعى عليه)، فسوى في ذلك بينالدماء والأموال، وحكم فيهما بحكم واحد، ويمكن لأحد أن يقول: إن البخاري موافق لنا، فإنه أخرج قسامة أبيطالب في الجاهلية، وقسامته موافق قسامتنا، ولعله يشير البخاري إلى أن تلك القسامة باقية على ما كانت في الجاهلية،والواقعة في عهده ﷺ واحدة، والخلاف في تخريجها. التقطته من شروح (الكنز) و(العرف الشذي)، وفي المقامتفصيل آخر من شاء الاطلاع عليه، فليرجع إلى (بذل المجهود) و(شرح معاني الآثار).
