وَقَوْلِ اللهِ عَزَّ وَجَلَّ: ﴿وَلْيُوفُوا نُذُورَهُمْ﴾(الحج: ۲۹ وَقَوْلِهِ تَعَالَى: ﴿وَلَا تَزِرُ وَازِرَةٌ وِزْرَ أُخْرَى﴾

۱ قوله : وليوفوا نذورهم هذا الأمر للوجوب، ثم هذا وإن كان واردا في نذر مخصوص إلا أنه ربما تمسك به في أن إيفاء النذر مطلقا واجب؛ لأنه أمر بإيفاء النذر، والنص لا يختص بمورده وسببه عندنا، فدل على أن كل نذر إيفاءه واجب. وإنما أطلقوا لفظ الوجوب ههنا مقابلا للفريضة؛ لأنه عام خص عنه بعض أفراده، وهو النذر بالمعصية والقرب الغير المقصود، فكان ظنيا، فأطلقوا عليه لفظ الوجوب المنبئ عن الشبهة.
And the statement of Allah, the Mighty, the Exalted: And let them fulfill their vows (Al-Hajj: 29). And His statement, the Exalted: And no bearer of burdens will bear the burden of another (Al-An’am: 164).
1 The statement: And let them fulfill their vows: This command indicates obligation. Although this was revealed concerning a specific vow, it may be used as evidence that fulfilling a vow absolutely is obligatory, because it is a command to fulfill the vow, and the text, according to us, is not restricted to its context or cause. Thus, it indicates that fulfilling every vow is obligatory. They used the term “obligation” here in contrast to a mandated duty, because it is a general rule from which some specific cases are excluded, such as a vow to commit a sin or a non-intended act of worship, making it presumptive. Therefore, they applied the term “obligation” to it, indicating the ambiguity.
عَنْ أَبِي هُرَيْرَةَ وَابْنِ عُمَرَ (رضي الله عنهما) قَالَا : قَالَ رَسُولُ الله ﷺ : «لَا تَنْذِرُوا فَإِنَّ النَّذْرَ لَا يُغْنِي مِنَ الْقَدَرِ شَيْئًا، وَإِنَّمَا يُسْتَخْرَجُ بِهِ مِنَ الْبَخِيلِ». مُتَّفَقٌ عَلَيْهِ.
Abu Hurayrah and Ibn Umar (may Allah be pleased with them) narrated: The Messenger of Allah (ﷺ) said: “Do not make vows, for a vow does not avail anything against fate, and it only extracts something from the miser.” [Agreed upon]

2 The statement: “Do not make vows, for a vow does not avail anything against fate, etc.”: The meaning of his prohibition of vows is to emphasize its command and warn against neglecting it after making it obligatory. If it meant prohibiting it entirely, that would nullify its ruling and remove the obligation to fulfill it, as it would become a sin. The perspective of the hadith is that he informed them that it is something that does not bring them immediate benefit, nor repel harm, nor avert anything decreed by Allah, the Exalted. He says: Do not make vows thinking that by vowing you will attain something not decreed by Allah for you, or repel something decreed against you. If you do so, fulfill it, for what you vowed is binding upon you. Thus, prohibiting vows for this purpose encourages vowing, but with sincerity. Its status as worship is due to its association with acts of worship like prayer, fasting, pilgrimage, emancipation, and the like. Its legislation is due to the commands to fulfill it. It is stated in “Umdat al-Qari”: Consensus has been established on the obligation to fulfill a vow if it is an act of obedience. Allah, the Exalted, said: Fulfill your contracts (Al-Ma’idah: 1), and said: They fulfill their vows (Al-Insan: 7), praising them for it. There is disagreement regarding initiating a vow. Some said it is recommended, while others said it is disliked, and Nawawi affirmed this. Shafi’i stated that it is contrary to what is preferable. Some later scholars interpreted the prohibition as applying to a vow of obstinacy, while they recommended a vow of piety. We will mention their explanation in this chapter, God willing, the Exalted.
۲ قوله : لا تنذروا، فإن النذر لا يغني من القدر شيئًا إلخ : معنى نهيه عن النذر إنما هو التأكيد لأمره وتحذير التهاون به بعد إيجابه، ولو كان معناه الزجر عنه حتى يفعل، لكان في ذلك إبطال حكمه وإسقاط لزوم الوفاء به؛ إذ صار معصية، وإنما وجه الحديث أنه أعلمهم أن ذلك أمر لا يجلب لهم في العاجل نفعًا، ولا يصرف عنهم ضرا، ولا يرد شيئًا قضاه الله تعالى يقول: فلا تنذروا على أنكم تدركون بالنذر شيئًا لم يقدره الله لكم أو تصرفون عن أنفسكم شيئًا جرى القضاء به علكيم، وإذا فعلتم ذلك فأخرجوا عنه بالوفاء، فإن الذي نذر تموه لازم لكم. ففي النهي عن النذر لهذا الغرض ترغيب على النذر، لكن على جهة الإخلاص تحريره أنه علل النهي بقوله: فإن النذر لا يغني من القدر ونبه به على أن المنهي عنه هو القيد، أعني الاعتقاد الفاسد من أن النذر يغني عن القدر.
حاصله: أن النهي عن النذر لم يتعلق بذاته، وإنما تعلّق بما ينشأ عنه من الاعتقاد الفاسد، فالنهي عن النذر على اعتقاد أنه يرد عن القدر شيئًا لا عن النذر مطلقا، «المرقاة و اللمعات ملتقط منها، ولذلك قال في رد المحتار»: واعلم أن النذر قربة مشروعة، أما كونه قربة فلما يلازمه من القرب كالصلاة والصوم والحج والعتق ونحوها، وأما شرعيته فللأوامر الواردة بإيفائه. وقال في عمدة القاري. وقام الإجماع على وجوب الوفاء إذا كان النذر بالطاعة، وقد قال الله تعالى: ﴿أَوْفُوا بِالْعُقُودِ﴾ (المائدة: ۱، وقال: ﴿يُوفُونَ بِالنَّذْرِ﴾ (الإنسان: ۷ فمدحهم بذلك، واختلف في ابتداء النذر، فقيل : إنه مستحب، وقيل: مكروه و به جزم النووي، ونص الشافعي على أنه خلاف الأولى، وحمل بعض المتأخرين النهي على نذر اللجاج، واستحب نذر التبرر، سنذكر تفسيرهما في هذا الباب إن شاء الله تعالى.
وَعَنْ عَائِشَةَ (رضي الله عنها) قَالَتْ: قَالَ رَسُوْلُ اللهِ ﷺ: «لَا نَذْرَ فِي مَعْصِيَةٍ، وَكَفَّارَتُهُ كَفَّارَةُ الْيَمِينِ». رَوَاهُ أَبُو دَاوُدَ وَالتَّرْمِذِيُّ وَالنَّسَائِيُّ وَابْنُ مَاجَهِ، وَقَدْ صَحَّحَهُ الطَّحَاوِي وَأَبُوْ عَلِيَّ بْنُ السَّكَنِ.

Muslim narrated from Imran ibn Husayn (may Allah be pleased with him) that he said: The Messenger of Allah (ﷺ) said: “There is no fulfillment for a vow in disobedience, nor in what a servant does not possess.” In a narration by him from Uqbah ibn Amir (may Allah be pleased with him), the Messenger of Allah (ﷺ) said: “The expiation of a vow is the expiation of an oath.”
Nasa’i narrated from Imran ibn Husayn (may Allah be pleased with him) that he said: I heard the Messenger of Allah (ﷺ) say: “A vow is of two types: Whoever vows in obedience to Allah, that is for Allah, and it must be fulfilled. Whoever vows in disobedience to Allah, that is for Satan, and there is no fulfillment for it, and he expiates it with what expiates an oath.”

Its apparent meaning is that it does not form at all, and a vow of disobedience is invalid, with no expiation. This is the view of Shafi’i. Abu Hanifah said: Is not the declaration of prohibition a sin, yet Allah commanded expiation for it? Sha’bi was perplexed and said: You are one of the opinionated. It is stated in “Al-Alamgiriyyah”: If one vows something that is a sin, it is not valid, but if he does it, expiation is required. It is stated in “Nayl al-Awtar”: There is disagreement regarding a vow of disobedience and whether expiation is required. The majority said: No. Ahmad, Thawri, Ishaq, some Shafi’is, and Hanafis said: Yes. Tirmidhi narrated the disagreement of the companions on this. They agreed on prohibiting a vow in disobedience, and their disagreement is only regarding the obligation of expiation. Those who obligated it cited the hadith of Aishah mentioned in this chapter and what is similar to it. 2 The statement: “There is no fulfillment for a vow in disobedience”: This is because the validity of a vow and the obligation to fulfill it require conditions, including that the vow be an act of drawing closer to Allah, the Exalted, and that it not be a sin if it is inherently forbidden, with no aspect of worship. If it has an aspect of worship but is forbidden for another reason, the vow is valid, such as vowing to fast on the day of sacrifice. If he fasts, he fulfills the obligation but sins, and it is better to fulfill it by fasting another day. [Stated in “Al-Fath”] Another condition is that the vowed act not be obligatory upon him before the vow. If he vows the obligatory pilgrimage, the noon prayer, or the like, nothing else is required. Another condition is that the vowed act not exceed what he possesses or be something he does not own. If he says about another’s sheep: “It is upon me to slaughter it on the day of sacrifice,” the vow is not valid. Another condition is that it not be impossible, such as vowing to fast yesterday or perform retreat therein, which is not valid. Another condition is that the vowed act be of a type that is legally obligatory, meaning what includes the mandated and the obligatory in technical terms, specifically the mandated. 3 The statement: “Nor in what a servant does not possess”: Its example is saying: “If Allah heals my sick person, such-and-such slave, who is not in my possession, is free.” If he later acquires it, he is not required to fulfill the vow, unlike if he suspends the emancipation of a slave he owns, as it is emancipated upon acquisition according to us. This is because a condition for the validity of a vow, according to us, is that the vowed act be owned by the vower or associated with the cause of ownership, such as saying: “If I buy you, it is upon me to emancipate you for Allah.” The disagreement regarding a vow is like the disagreement regarding divorce before marriage. The Hanafis, by analogy to the effects of suspending divorce on ownership or its cause, say: If the vowed act is associated with the cause of ownership, it is valid, and he must fulfill the vow. For example, if he says: “If I buy you, it is upon me to emancipate you for Allah,” when the purchase occurs, the vowed act occurs. Shafi’i said: This suspension is not valid, and he is not required to fulfill the vow, because suspension is like immediate execution. Just as immediate execution is not possible without ownership, suspension is not valid. The response is that suspension, such as saying: “If I buy you, it is upon me to emancipate you for Allah,” exists at the time, but the vowed act occurs when the condition is met, at which point ownership is realized, allowing fulfillment of the vow. وحكي أن أبا حنفية الله دخل على الشعبي ، وسأله عن هذه المسألة، فقال: لا شيء عليه؛ لأن المنذور معصية، فقال أبو حنيفة: أليس أن الظهار معصية، وقد أمر الله بالكفارة فيه ؟ فتحير الشعبي، وقال: أنت من الآرائيين. وقال في العالمكيرية»: وإن نذر بما هو معصية لا يصح، فإن فعله يلزمه الكفارة. وقال في نيل الأوطار»: واختلف في النذر بمعصية، وهل تجب فيه الكفارة أم لا ؟ فقال الجمهور : لا، وعن أحمد والثوري وإسحاق وبعض الشافعية والحنفية: نعم، ونقل الترمذي اختلاف الصحابة في ذلك، واتفقوا على تحريم النذر في المعصية واختلافهم إنما هو في وجوب الكفارة، واحتج من أوجبها بحديث عائشة المذكور في الباب، وما ورد في معناه، انتهى. وقوله: لا نذر في المعصية، وليس معناه أنه لا ينعقد أصلا؛ إذ لا يناسب ذلك قوله وكفارته كفارة اليمين، بل معناه ليس فيه وفاء، وهذا هو صريح في بعض الروايات الصحيحة، فإن فيها لا وفاء لنذر في معصية. قاله في فتح الودود».
۲ قوله: لا وفاء لنذر في معصية لأنه تشترط لصحة النذر ووجوب وفائه شروط، منها: أن يكون النذر تقربا إلى الله تعالى، ومنها: أن لا يكون النذر بمعصية إذا كان حراما لعينه، وليس فيه وجه قربة، فإن كانت فيها جهة قربة وكانت محرمة للغير انعقد النذر به كنذر صوم يوم النحر، فلو صامه خرج عن العهدة وأثم، والأحسن أن يفي بصوم يوم غيره. كذا في «الفتح»، ومنها: أن لا يكون المنذور واجبًا عليه قبل النذر ، فلو نذر حجة الإسلام أو صلاة الظهر ونحو ذلك لم يلزمه شيء غيرها، ومنها: أن لا يكون المنذور أكثر مما يملكه أو غير مملوك له، فلو قال لشاة غيره: «الله علي أن أذبحها يوم النحر لم يصح النذر، ومنها: أن لا يكون مستحيل الوجود، فلو نذر صوم أمس أو اعتكافه لم يصح، ومنها : أن يكون المنذور من جنسه واجب شرعا، والمراد بالواجب ما يشمل الفرض، والواجب الاصطلاحي خصوص الفرض فقط، فلا يلزم الناذر ما ليس من جنسه واجب بالنذر، كما إذا نذر تشييع الجنازة ودخول المسجد، ومنها: أن يكون عبادة مقصودة، فلا يلزم الوضوء وتكفين الميت والغسل ونحو ذلك بالنذر عمدة الرعاية» و«رد المحتار ملتقط منهما.
۳ قوله: ولا فيما لا يملك العبد صورته أن يقول: إن شفى الله مريضي فالعبد الفلاني حر، وليس في ملكه، وإن دخل بعد ذلك ملكه لم يلزمه الوفاء بنذر، بخلاف ما إذا علق عتق عبد بملكه فإنه يعتق عندنا بعد التملك؛ لأن شرط صحة النذر عندنا أن يكون المنذور ملكا للناذر، أو مضافا إلى سبب الملك، كقوله: إن اشتريتك فلله على أن أعتقك، والخلاف في النذر مثل الخلاف في الطلاق قبل النكاح، يعني قالت الحنفية قياسا على آثار تعليق الطلاق بنفس الملك أو بسببه: إنه إذا أضاف المنذور إلى سببية الملك صح، ويلزمه الوفاء بنذر، كما إذا قال: إن اشتريتك فلله علي أن أعتقك، فإذا وقع الاشتراء وقع المنذور. وقال الشافعي: لا يصح هذا التعليق، ولم يلزمه الوفاء بنذر؛ لأن التعليق كالتنجيز، فكما لا يمكن التنجيز في حال عدم الملك، كذلك لا يصح التعليق، وجوابه: أن التعليق بقوله: «إن اشتريتك فلله علي أن أعتقك وإن وجد في الحال، لكن المنذور يوجد عند وجود الشرط، وعند ذلك يتحقق الملك المجوز لوفاء النذر، بخلاف قوله : إن شفى الله مريضي، فالعبد الفلاني حر، وليس في ملكه؛ فإنه لا أثر للملك هناك لا حالا ولا مالا، فلا يصح النذر بهذا التعليق، كما لا يصح النذر المنجز في غير ملكه، وعلى هذا يحمل قوله : ولا فيما لا يملك العبد، فاستدلال الشافعي به لا يصح، التقطته من اللمعات) ورد المحتار» و«العرف الشذي» وغيرها.
وَعَنْ عَائِشَةَ (رضي الله عنها) أَنَّ رَسُولَ اللهِ ﷺ قَالَ: «مَنْ نَذَرَ أَنْ يُطِيعَ الله فَلْيُطِعْهُ، وَمَنْ نَذَرَ أَنْ يَعْصِيَهُ فَلَا يَعْصِهِ». رَوَاهُ الْبُخَارِيُّ. وَفِي رِوَايَةٍ لِمُسْلِمٍ: «لَا نَذْرَ فِي مَعْصِيَةِ اللهِ».

1 The statement: “Whoever vows to obey Allah, let him obey Him, etc.”: Shaykh Ibn al-Humam said: If a vow is suspended on a condition, and the condition is met, he must fulfill the specific vow, due to the generality of this hadith and others, as it commands it without restriction to immediate or suspended vows. A suspended vow is like an immediate one for him, as if he said upon the condition: “It is upon me to do such-and-such.” It is narrated from Abu Hanifah (may Allah be pleased with him) that he retracted from it, meaning from the obligation to fulfill the specific vowed act if it is suspended on a condition, so he has the choice between performing it specifically or offering the expiation of an oath. This is the view of Muhammad. If he says: “If I do such-and-such, it is upon me to perform a pilgrimage or fast a year,” he may perform the pilgrimage or fast a year if he wishes, or offer expiation if he wishes. If he is poor, he has the choice between fasting a year or fasting three days. The first view, which is the obligation to fulfill it specifically, is mentioned in the apparent narration. Thus, the absolute fulfillment specifically is interpreted as applying to immediate vows, and the absolution by expiation applies to suspended vows. There is no issue, as a suspended vow is non-existent at the time, so the vow is absent, making it like an oath in that the cause of obligation, which is breaking, is absent at the time of speaking, so it is associated with it, unlike an immediate vow, which is an established vow at its time, so the hadith of fulfillment applies to it. The author and the verifiers chose that the condition where expiation suffices is one not intended to occur, such as entering a house or speaking to so-and-so. If he does not intend its occurrence, he knows he does not intend the vowed act, as he made it a deterrent from fulfilling that condition, because suspending a vow on something he does not intend to occur is necessarily to prevent himself from it. A person does not always intend to obligate acts of worship, as they may be burdensome, exposing him to punishment, even though they bring reward. Hence, it is authentically reported that he prohibited vows and said: “It does not bring good” in the hadith. As for a condition he intends to occur, such as saying: “If Allah heals my sick person, my absent one returns, or my enemy dies, it is upon me to fast a month,” if the condition is met, only performing the specific vowed act suffices, because if he intends its occurrence, he intends the vow, making the vow equivalent to an immediate one, falling under its ruling, which is the obligation to fulfill it. Thus, what implies fulfillment applies to immediate vows and suspended vows intended to occur, and what implies the sufficiency of expiation applies to suspended vows not intended to occur, which is called by some jurists the vow of obstinacy. The hadith of the Ka’bah’s door latch is interpreted according to us as a suspended vow not intended to occur, so expiation suffices if he breaks it. Shafi’i said: If he does that act, he must offer the expiation of an oath, as if he broke his oath. Muhammad in “Al-Muwatta” adhered to the apparent narration and said: It is preferable to us that he fulfills what he obligated upon himself, gives charity with it, and retains what he misses. 2 The statement: “And whoever vows to disobey Him, let him not disobey Him”: This is evidence that whoever vows an act of obedience must fulfill it, even if it is not suspended on anything, and whoever vows a sin, fulfilling it is not permissible, nor is expiation required, as he would have clarified it if it were. [Stated in “Sharh as-Sunnah” and “Al-Mirqat”] Know that there is a difference between an oath and a vow. They agreed that expiation is required for breaking an oath, whether it is for obedience, disobedience, or a permissible act. As for a vow, if it is for obedience, it is binding by consensus, and if it is for disobedience, fulfilling it is not permissible. They disagreed regarding the obligation of expiation for it. Abu Hanifah, Malik, and Shafi’i said: No expiation is required. There are two narrations from Ahmad: one is that it forms, but fulfilling it is not permissible, and expiation is required; this is another narration from the Hanafis. The conclusion is that according to us, there are two views regarding a vow of disobedience: the first is Tahawi’s view of the obligation of expiation, and the second is that the basis of our school is that if one vows a sin, there is no fulfillment or expiation. 1 قوله : من نذر أن يطيع الله فليطعه إلخ قال الشيخ ابن الهمام وإن علق النذر بشرط، فوجد الشرط فعليه الوفاء بنفس النذر؛ لإطلاق هذا الحديث وغيره؛ فإنه أمر بذلك من غير تقييد بمنجز، ولا معلق، ولأن المعلق بالشرط كالمنجز عنده، فصار كأنه قال عند الشرط الله علي كذا ، وعن أبي حنيفة له: أنه رجع عنه أي عن لزوم عين المنذور، إذا كان معلقا بالشرط، أي أنه مخير بين فعله بعينه وكفارة يمين، وهو قول محمد، فإذا قال: إن فعلت كذا فعليّ حَجَّة أو صوم سنة، إن شاء حج أو صام سنة، وإن شاء كفر، فإن كان فقيرًا صار مخيرا بين صوم سنة وصوم ثلاثة أيام، والأول وهو لزوم الوفاء به عينا، هو المذكور في ظاهر الرواية، والتخيير عن أبي حنيفة في النوادر.
وروي عن عبد العزيز بن خالد الترمذي قال: خرجت حاجا. فلما دخلت الكوفة قرأت كتاب النذور والكفارات على أبي حنيفة. فلما انتهيت إلى هذه المسألة قال : قف، فإن من رأيي أن أرجع. فلما رجعت من الحج إذا أبو حنيفة قد توفي، فأخبرني الوليد بن أبان أنه رجع قبل موته بسبعة أيام، وقال: يتخير، وبهذا كان يفتي إسماعيل الزاهد. وقال الولوالجي مشايخ بلخ وبخارى يفتون بهذا ، وهو اختيار شمس الأئمة قال لكثرة البلوى في هذا الزمان، وجه الظاهر النصوص من الآية الكريمة والأحاديث، ووجه رواية النوادر ما في صحيح مسلم من حديث عقبة بن عامر عنه له قال: كفارة النذر كفارة المين، فهذا يقتضي أن يسقط بالكفارة مطلقا، فيتعارض، فيحمل مطلق الإيفاء بعينه على المنجز.
و مقتضى سقوطه بالكفارة على المعلق، ولا يشكل؛ لأن المعلق منتف في الحال، فالنذر فيه معدوم، فيصير كاليمين في أن سبب الإيجاب، وهو الحنث منتف حال التكلم فيلحق به بخلاف النذر المنجز؛ لأنه نذر ثابت في وقته فيعمل فيه حديث الإيفاء، واختار المصنف والمحققون أن المراد بالشرط - الذي تجزئ فيه الكفارة - الشرط الذي لا يريد كونه مثل دخول الدار وكلام فلان ، فإنه إذا لم يرد كونه يعلم أنه لم يرد كون المنذور حيث جعله مانعا من فعل ذلك الشرط؛ لأن تعليق النذر على ما لا يريد كونه بالضرورة يكون لمنع نفسه عنه؛ فإن الإنسان لا يريد إيجاب العبادات دائما، وإن كانت مجلبة للثواب مخافة أن يثقل فيتعرض العقاب، ولهذا صح عنه أنه نهى عن النذر، وقال: إنه لا يأت بخير الحديث.
وأما الشرط الذي يريد كونه مثل قوله: إن شفى الله مريضي أو قدم غائبي أو مات عدوي فلله علي صوم شهر، فوجد الشرط لا يجزئه إلا فعل عين المنذور؛ لأنه إذا أراد كونه كان مريدا كون النذر، فكان النذر في معنى المنجز فيندرج في حكمه، وهو وجوب الإيفاء به، فصار محمل ما يقتضي الإيفاء المنجز والمعلق المراد كونه ومحمل ما يقتضي أجزاء الكفارة المعلق الذي لا يراد كونه، وهو المسمى عند طائفة من الفقهاء نذر الحاج، انتهى.
ويحمل حديث رتاج الكعبة عندنا على المعلق الذي لا يراد كونه، فتجزئ فيه الكفارة إن حنث، وأما الشافعي فقال: إذا فعل ذلك الفعل يجب عليه كفارة اليمين، كما لو حنث في يمينه، وذهب محمد في الموطأ إلى ظاهر الرواية، وقال:
وأحب إلينا أن يفي بما جعل على نفسه، فيتصدق بذلك ويمسك ما يفوته، فإذا أفاد ما لا تصدق بمثل ما كان أمسك.
۲ قوله: ومن نذر أن يعصيه فلا يعصه : فيه دليل على أن من نذر طاعة يلزمه الوفاء به وإن لم يكن معلقا بشيء، وأن من نذر معصية لا يجوز الوفاء به ولا يلزمه الكفارة؛ إذ لو كانت فيه الكفارة لبينه . كذا في «شرح السنة». قاله في «المرقاة». اعلم أنه فرق بين اليمين والنذر، واتفقوا على أن الكفارة تجب بالحنث في اليمين سواء كانت في طاعة أو معصية أو مباح. وأما النذر فإن كان في طاعة فهو لازم بالاتفاق وإذا كان في معصية لم يجز الوفاء به. واختلفوا في طاعة فهو لازم بالاتفاق، وإذا كان في معصية لم يجز الوفاء به. واختلفوا في وجوب الكفارة به، فقال أبو حنيفة ومالك والشافعي: لا يلزمه كفارة. وعن أحمد روايتان أحداهما ينعقد ولا يحل فعله وتجب به كفارة، هذه رواية أخرى عن الحنفية محصله أن عندنا في نذر المعصية قولين: الأول: ما ذهب إليه الطحاوي من وجوب الكفارة، والثاني: أن أصل مذهبنا أنه لو نذر بمعصية فلا وفاء ولا كفارة. أخذته من رد المحتار والعرف الشذي.
وَعَنِ ابْنِ عَبَّاسٍ (رضي الله عنهما) قَالَ: بَيْنَا النَّبِيُّ ﷺ يَخْطُبُ إِذَا هُوَ بِرَجُلٍ قَائِمٍ فَسَأَلَ عَنْهُ فَقَالُوْا أَبُو إِسْرَائِيلَ نَذَرَ أَنْ يَقُومَ وَلَا يَقْعُدَ وَلَا يَسْتَظِلَّ وَلَا يَتَكَلَّمَ وَيَصُومَ، فَقَالَ النَّبِيُّ : مُرْهُ " فَلْيَتَكَلَّمْ وَلْيَسْتَظِلَّ وَلْيَقْعُدْ وَلْيُتِمَّ صَوْمَهُ». رَوَاهُ الْبُخَارِيُّ. وَرَوَى أَحْمَدُ وَأَبُوْ دَاوُدَ وَالْبَيْهَقِيُّ عَنْ عَمْرِو بْنِ شُعَيْبٍ عَنْ أَبِيْهِ عَنْ جَدِّهِ ، أَنَّ النَّبِيَّ ﷺ قَالَ: «لَا نَذْرَ إِلَّا فِيْمَا ابْتُغِيَ بِهِ وَجْهُ الله تَعَالَى، وَأَوْرَدَهُ الْحَافِظُ فِي التَّلْخِيْصِ وَسَكَتَ عَنْهُ.
وَفِي رِوَايَةٍ لَأَحْمَدَ وَالطَّبَرَانِي أَنَّ رَسُوْلَ اللهِ ﷺ نَظَرَ إِلَى أَعْرَابِي قَائِمًا فِي الشَّمْسِ وَهُوَ يَخْطُبُ، فَقَالَ: «مَا شَأْنُكَ؟ قَالَ: نَذَرْتُ يَا رَسُولَ اللهِ، أَنْ لَا أَزَالَ فِي الشَّمْسِ حَتَّى تَفْرُغَ، فَقَالَ رَسُولُ اللهِﷺ : «لَيْسَ هَذَا نَدْرًا، إِنَّمَا النَّذْرُ مَا ابْتُغِيَ بِهِ وَجْهُ الله».
Ibn Abbas (may Allah be pleased with him) narrated: While the Prophet (ﷺ) was delivering a sermon, he saw a man standing and asked about him. They said: It is Abu Isra’il, who vowed to stand and not sit, not seek shade, not speak, and fast. The Prophet (ﷺ) said: “Order him to speak, seek shade, sit, and complete his fast.” [Narrated by Bukhari]
Ahmad, Abu Dawud, and Bayhaqi narrated from Amr ibn Shu’ayb, from his father, from his grandfather, that the Prophet (ﷺ) said: “There is no vow except in what seeks the countenance of Allah, the Exalted.” The Hafiz cited it in “At-Talkhis” and remained silent about it.
In a narration by Ahmad and Tabarani, the Messenger of Allah (ﷺ) looked at a Bedouin standing in the sun while delivering a sermon and said: “What is your matter?” He said: “I vowed, O Messenger of Allah, not to move from the sun until you finish.” The Messenger of Allah (ﷺ) said: “This is not a vow. A vow is only what seeks the countenance of Allah.”

1 The statement: “Order him to speak, etc.”: This is evidence that anything that harms a person, which is not prescribed by the Book or Sunnah, such as walking barefoot or sitting in the sun, is not an act of obedience to Allah, the Exalted. If his vow is for something other than obedience, it is a sin, as disobedience is the opposite of obedience, so the vow does not form. 2 The statement: “There is no vow except in what seeks, etc.”: This hadith and the previously mentioned hadith indicate that a vow does not form in permissible acts. If one vows a permissible act, such as saying: “It is upon me to walk to my house, ride my horse, or wear my garment,” there is nothing upon him according to Abu Hanifah and Malik. Shafi’i said: If he violates it, he is obligated by it and has the choice between fulfilling it or offering expiation. Among the evidence for the obligation to fulfill a vow of a permissible act is the story of the woman who vowed to play the tambourine. We say: Playing the tambourine is not among the acts of obedience associated with vows, and at best, it is permissible. However, as it was connected to expressing joy for the safe return of the Messenger of Allah (ﷺ) from one of his expeditions, and it involved humiliating the disbelievers and vexing the hypocrites, it became akin to some acts of worship. Similar to this is the statement of the Prophet (ﷺ) regarding satirizing the disbelievers: “Satirize Quraysh, for it is harder on them than a shower of arrows.” They disagreed about a man who vows as a polytheist and then becomes Muslim. Shafi’i and Ahmad said: If a man obligates something upon himself during his polytheism, such as retreat, charity, or something Muslims obligate for Allah, then becomes Muslim, it is obligatory upon him. Ibrahim an-Nakha’i, Thawri, Abu Hanifah, Abu Yusuf, Muhammad, Malik, Shafi’i in one opinion, and Ahmad in a narration said: Nothing is obligatory upon him. ۱ قوله: مره فليتكلم إلخ فيه دليل على أن كل شيء يتأذى به الإنسان مما لم يرد بمشروعيته كتاب ولا سنة كالمشي حافيا والجلوس في الشمس ليس من طاعة الله تعالى. فإذا كان نذره في غير طاعة يكون معصية؛ لأن المعصية خلاف الطاعة فلا ينعقد النذر به؛ فإنه الأمر أبا إسرائيل في هذا الحديث بإتمام الصوم وهو محمول على أنه علم أنه لا يشق عليه. قال القرطبي في قصة أبي إسرائيل : هذا أعظم حجة للجمهور في عدم وجوب الكفارة على من نذر معصية أو ما لا طاعة فيه. هذا ملتقط من نيل الأوطار وعمدة القاري.
۲ قوله : لا نذر إلا فيها ابتغي إلخ هذا الحديث والحديث المذكور آنفًا على أن النذر لا ينعقد في المباح فإذا نذر فعل مباح كما إذا قال: الله علي أن أمشي إلى بيتي أو أركب فرسي أو ألبس ثوبي فلا شيء عليه عند أبي حنيفة ومالك. وقال الشافعي: متى خالف لزمه بذلك وهو بالخيار بين الوفاء به وبين الكفارة. ومن جملة ما استدل به على أنه يلزم الوفاء بالنذر المباح قصة التي نذرت الضرب بالدف. قلنا ضرب الدف ليس مما يعد في باب الطاعات التي يتعلق بها النذور وأحسن حاله أن يكون من باب المباح غير أنه لما اتصل بإظهار الفرح لسلامة مقدم رسول الله ﷺ حين قدم من بعض غزواته وكانت فيه مساءة الكفار وإرغام المنافقين صار فعله كبعض القريب.
ومما يشبه هذا المعنى قول النبي الله في هجاء الكفار اهجوا قريشا فإنه أشد عليهم من رشق النبل. ثم اختلفوا في الرجل ينذر وهو مشرك نذرا ثم يسلم فذهب الشافعي وأحمد إلى أن الرجل إذا أوجب على نفسه شيئا في حال شركه من اعتكاف أو صدقة أو شيء مما يوجبه المسلمون الله ثم أسلم أن ذلك واجب عليه. وقال إبرهيم النخعي والثوري وأبو حنيفة وأبو يوسف ومحمد ومالك والشافعي في قول وأحمد في رواية: لا يجب عليه في ذلك شيء.
واحتجوا في ذلك بحديث عائشة : ومن نذر أن يعصيه فلا يعصه، وبحديث شعيب إنما النذر ما ابتغي به وجه الله. فدل على أن النذور إنما تجب إذا كانت مما يتقرب به إلى الله تعالى ولا تجب إذا كانت معاصي الله وكان الكافر إذا قال: الله علي صيام أو قال: الله علي اعتكاف فهو لو فعل ذلك لم يكن به متقربا إلى الله؛ لأنه حين كان يوجبه يقصد به الذي كان يعبده من دون الله وذلك معصية، فدل في قوله : لا نذر في معصية الله رحمة الأمة ونيل الأوطار والمرقاة وعمدة القاري والطحاوي ملتقط منها.
وَعَنِ ابْنِ عَبَّاسٍ لا أَنَّ أُخْتَ عُقْبَةَ بْنِ عَامِرٍ نَذَرَتْ أَنْ تَمْشِيَ إِلَى الْبَيْتِ، فَأَمَرَهَا النَّبِيُّ ﷺ أَنْ تَرْكَبَ وَتُهْدِيَ هَدْيًا. وَرَوَاهُ أَبُوْ دَاوُدَ.

Ibn Abbas (may Allah be pleased with him) narrated: The sister of Uqbah ibn Amir vowed to walk to the House, so the Prophet (ﷺ) ordered her to ride and offer a sacrificial animal. [Narrated by Abu Dawud]
Ali al-Qari said: The minimum is a sheep, and the maximum is a camel, so a sheep suffices, and the command for a camel is for recommendation. In another wording: The sister of Uqbah ibn Amir vowed to walk to the House, but she could not endure it, so the Prophet (ﷺ) ordered her to ride and offer a sacrificial animal. [Narrated by Abu Dawud] He said: The hadith of Ibn Abbas: “Whoever vows a vow he cannot endure, its expiation is the expiation of an oath,” was narrated by Waki’ and others from Abdullah ibn Sa’id ibn Abi al-Hind, who stopped it at Ibn Abbas. In a narration by Ahmad from Uqbah ibn Amir (may Allah be pleased with him), he said: My sister vowed to walk to the Ka’bah, so the Messenger of Allah (ﷺ) said: “Allah is independent of her walking. Let her ride and offer a camel.”
Our scholars said: We acted upon the generality of the sacrificial animal without specifying a camel, due to the strength of its narration. Muhammad in “Al-Muwatta” said: It is preferable to us, as narrated from Ali ibn Abi Talib (may Allah be pleased with him), who said: Whoever vows to perform pilgrimage on foot and then is unable, let him ride, perform pilgrimage, and slaughter a camel. In another hadith from him: And offer a sacrificial animal. We adopt this, so the sacrificial animal is in place of walking. This is the view of Abu Hanifah and the majority of our jurists. Bayhaqi narrated something similar from Ali (may Allah be pleased with him).
In a narration by him from Abu Hurayrah (may Allah be pleased with him), he said: While the Messenger of Allah (ﷺ) was traveling with a caravan in the depth of the night, he noticed a shadow that startled their camels. He sent a man to look, and it was a naked woman with disheveled hair. He said: “What is wrong with you?” She said: “I vowed to perform pilgrimage to the House on foot, naked, with disheveled hair, so I hide during the day and avoid the road at night.” He went to the Prophet (ﷺ) and informed him. He said: “Return to her and order her to wear her clothes and shed blood.”

1 The statement: “She vowed to walk, etc.”: If one swears to walk to the House of Allah if he does such-and-such and then does it, nothing is required of him by analogy, because only what is of a type legally obligatory is obligated by a vow, and walking to the House is not legally obligatory. In vows and oaths, custom is considered, so we treat this as an expression for committing to pilgrimage or minor pilgrimage metaphorically, as the purpose of speech is people’s usage to express their inner intentions. When an expression becomes used metaphorically for something, it is treated as literal in that context. Then he has the choice between pilgrimage and minor pilgrimage, as they are the two rites related to the House, which are only performed through consecration and going to that place. They disagreed about one who vows to walk to the House of Allah. Shafi’i said: He walks if he can endure it, but if he is unable, he sheds blood and rides. The companions of Abu Hanifah (may Allah be pleased with them) said: He rides and sheds blood, whether he can endure walking or not. According to us, he has the choice: if he wishes, he walks, which is more complete and fulfills the vow; if he rides, he slaughters a sheep, because he introduced a deficiency in the pilgrimage or minor pilgrimage, as pilgrimage on foot is superior, since a rite with the attribute of walking is more complete. It is narrated that Abdullah ibn Abbas (may Allah be pleased with them) after losing his sight said: “I do not regret anything as much as not performing pilgrimage on foot, for Allah, the Exalted, mentioned the walkers first, saying: They come to you on foot and on every lean camel (Al-Hajj: 27).” If he rides, he has introduced a deficiency, and deficiencies in rites are compensated with blood. This is due to his statement: “Let her ride and shed blood.” Shafi’i has two opinions: the first, which we hold, is that blood is required, and it is his more correct opinion; the second is that if he is unable to walk, no sacrificial animal is required, and nothing is established against him. The blood or sacrificial animal, according to us, is at least a sheep and at most a camel, so a sheep suffices, and the command for a camel is for recommendation. This is Shafi’i’s more apparent opinion. We also acted upon the generality of the sacrificial animal without specifying a camel due to the strength of its narration. They disagreed about the starting point of walking. Some said: From the ritual boundary. Others said: From where he consecrates, and this is the view of Imam Fakhr al-Islam (may Allah be pleased with him), Utabi, and others. Others said: From his house, and this is the view of Shams al-A’immah as-Sarakhsi, the author of “Al-Hidayah,” and authenticated by Qadi Khan, Zayla’i, and Ibn al-Humam, as it is the customary intent, and it is the preferred view. If he consecrates from his house, it is agreed that he walks from his house. If he rides the entire way or most of it, with or without an excuse, blood is required, as he neglected an obligation to fulfill the vow. If he rides for the lesser part, he gives charity equivalent to the value of a sheep. Tahawi said: Perhaps she vowed and swore. I say: The obligatory is the sacrificial animal, and fasting three days is a substitute for the sacrificial animal, not the expiation of an oath, as the apparent meaning is that expiation refers to the expiation of a violation, which is the sacrificial animal or its equivalent in fasting, to align the narrations. Tahawi is supported by what is in Abu Dawud from Ibn Abbas mentioning the oath, and I believe it is from Ibn Abbas’s ijtihad, as he knew the question was about the oath fundamentally, as it is not mentioned in the narrations.
2 The statement: “The sacrificial animal is in place of walking”: Meaning without returning to walking when able. By analogy, he does not fulfill the vow’s obligation if he rides, but he must walk if he can, just as if he vows consecutive fasting and breaks the continuity. However, this is established by text for pilgrimage, so it must be followed. This is what Abu Dawud narrated from the hadith of Ibn Abbas that the sister of Uqbah ibn Amir vowed to walk to the House, and the Messenger of Allah (ﷺ) ordered her to ride and offer a sacrificial animal. ۱ قوله: نذرت أن تمشي إلخ : يعني إذا حلف بالمشي إلى بيت الله إن فعل كذا ففعل ذلك الفعل لم يلزمه شيء في القياس؛ لأنه إنما يجب بالنذر ما يكون من جنسه واجب شرعا، والمشي إلى بيت الله ليس بواجب شرعا؛ولأنه لا يلزمه عين ما التزمه وهو المشي، فلأن لا يلزمه شيء آخر أولى وهو الحج أو العمرة، وفي الاستحسان يلزمه حجة أو عمرة، وهكذا روي عن علي ، ولأن في عرف الناس يذكر هذا اللفظ بمعنى التزام الحج والعمرة، وفي النذور والأيمان يعتبر العرف فجعلنا هذا عبارة عن التزام حج أو عمرة مجازا؛ لأن المقصود بالكلام استعمال الناس لإظهار ما في باطنهم، فإذا صار اللفظ في شيء مستعملا مجازا يجعل كالحقيقة في ذلك الشيء ثم يتخير بين الحج والعمرة؛ لأنهما النسكان المتعلقان بالبيت لا يتوسل إلى أدائها إلا بالإحرام وإلا بالذهاب إلى ذلك الموضع.
ثم اختلفوا فيمن نذر بأن يمشي إلى بيت الله، فقال الشافعي: يمشي إن أطاق المشي فإن عجز أراق دما وركب وقال أصحاب أبي حنيفة رحمهم الله تعالى: يركب ويريق دما سواء أطاق المشي أو لم يطقه، ثم عندنا له الخيار إن شاء مشى وهو أكمل وفيه وفاء النذر، وإن شاء ركب، فإن ركب ذبح شاة؛ لأنه أدخل النقص في الحج أو العمرة؛ لأن الحج ماشيا أفضل؛ لأن النسك بصفة المشي يكون أتم على ما روي أن عبد الله بن عباس رضي الله عنهما بعد ما كف بصره كان يقول: لا أتأسف على شيء كتأسفي على أن لا أحج ماشيا فإن الله تعالى قدم المشاة فقال يأتوك رجالا وعلى كل ضامري، فإذا ركب فقد أدخل فيه نقصا ونقائص النسك تجبر بالدم يعني إذا التزم بصفة الكمال وأداه بصفة النقصان لزم جبر النقصان وهو الدم، ولقوله عمرها أن تركب ولترق دما. وعند الشافعي فيه قولان الأول : ما قلنا به عليه دم وهو أصح قوليه. والثاني: أنه من عجز عن المشي فلا هدي عليه ولا يثبت في ذمته شيء. ثم الدم والهدي عندنا أقله شاة وأعلاه بدنة فالشاة كافية والأمر بالبدنة للندب وهو أظهر قولي الشافعي وأيضا أنه عملنا بإطلاق الهدي من غير تعيين بدنة لقوة روايته.
ثم اختلفوا في محل ابتداء المشي فقيل: يبتدئ من الميقات، وقيل: حيث أحرم وعليه الإمام فخر الإسلام رحمه الله والعتابي وغيرهما، وقيل: من بيته، وعليه شمس الأئمة السرخسي وصاحب الهداية» وصححه قاضي خان والزيلعي وابن الهمام؛ لأنه المراد عرفا، وهو الراجح، ولو أحرم من بيته فبالاتفاق على أنه يمشي من بيته، ثم لو ركب في كل الطريق أو أكثر بعذر أو بلا عذر لزمه دم؛ لأنه ترك واجبًا يخرج عن العهد وإن ركب في الأقل تصدق بقدره من قيمة الشاة، التقطته من المبسوط» و «المرقاة وشروح «الكنز» و «المسوى» و«أشعة اللمعات».
وقال في العرف الشذي: أما الأحاديث ففي بعضها ذكر الهدي، وفي بعضها ذكر صيام ثلاثة أيام، وفي بعضها ذكرهما. وقال الطحاوي لعلها نذرت وحلفت أقول: إن الواجب الهدي وأما صيام ثلاثة أيام، فبدل الهدي لا كفارة اليمين؛ لأن الظاهر أن المراد بالتكفير كفارة الجناية، وهي الهدي أو ما يقوم مقامه من الصوم ليطابق الروايات ويؤيد الطحاوي ما في «أبي داود عن ابن عباس ذكر اليمين أيضًا، وعندي أنه من اجتهاد ابن عباس؛ لأنه علم يسأل عن اليمين أصلا، فإنه ليس ذكره في الروايات، انتهى.
= وقال في بذل المجهود واختلف الروايات في قصة أخت عقبة بن عامر ، ففي إحدى أحاديث عقبة أنها نذرت أن تحج حافية غير مختمرة، فاشتملت نذرها أمرين أحدهما : عبادة لا تطيقها، والثاني: معصية، وهو عدم تغطية الرأس، فأمرها بالركوب؛ لعدم إطاقتها المشي حافية، وهذا باعتبار نذرها الحج حافية، ثم أمرها ثلاثة أيام، وهذا الحكم راجع إلى نذرها من غير خمار، وهو كانت معصية، فلم تنعقد النذر بها، وصار يمينا، فأمرها بالصوم ثلاثة أيام لكفارة اليمين، فإن اليمين بالمعصية انعقدت ولم يجز وفائها؛ لأنه الله قال : ومن ندر أن يعصي الله فلا يعصه، فوجب الحنث، ولزم كفارة اليمين عليها، وأما في الباقية من الروايات، فليس فيها ذكر عدم الاختمار، فلم يشمل الحديث لنذر المعصية، ولكن فيها ذكر لنذر الطاعة، وهو المشي إلى بيت الله فانعقدت النذر فوجب الوفاء. وقال في «الهداية»: يعني وعليه حجة أو عمرة ماشيًا، وإن شاء ركب وأهرق دما؛ لنقصانه عما التزم عليه.
۲ قوله : يكون الهدي مكان المشي : أي من دون عود المشي عند القدرة، والقياس أن لا يخرج عن عهدة النذر إذا ركب، بل يجب عليه إذا قدر المشي كما لو نذر الصوم تتابعا وقطع التتابع، لكن ثبت ذلك نصا في الحج،فوجب العمل به، وهو ما أخرجه أبو داود من حديث ابن عباس أن أخت عقبة بن عامر نذرت أن تمشي إلى البيت، فأمرها رسول الله الله أن تركب وتهدي هديا . كذا في التعليق الممجد».
۱ قوله: تقاضى ابن أبي حدرد إلخ فيه إشارة إلى أنه لا يجتمع الوضيعة والمطل؛ لأن صاحب الدين يتفرر كما والمطالبة بالديون. قاله ابن بطال، وفيه دليل على إباحة رفع الصوت في المسجد ما لم يتفاحش لعدم الإنكار منه وفيه جواز الاعتماد على الإشارة وإنها بمنزلة الكلام إذا فهمت لدلالتها عليه فيصح على هذا يمين الأخرس وشهادته ولعانه وعقوده إذا فهم عنه ذلك، وفيه إشارة الحاكم إلى الصلح على جهة الإرشاد، وههنا وقع الصلح على الإقرار المتفق عليه؛ لأن نزاعهما لم يكن في الدين، وإنما كان في التقاضي، وأما الصلح على الإنكار فأجازه أبو حنيفةومالك، وهو قول الحسن، وقال الشافعي: هو باطل، وبه قال ابن أبي ليلى، وفيه الملازمة للاقتضاء، وفيه الشفاعة إلى صاحب الحق والإصلاح بين الخصوم وحسن التوسط بينهم، وفيه قبول الشفاعة في غير معصية، وفيه إرسال الستور عند الحجرة. كذا في عمدة القاري».
وَعَنْ عُقْبَةَ بْنِ عَامِرٍ (رضي الله عنه) قَالَ: قَالَ رَسُوْلُ اللهِ ﷺ: «كَفَّارَةُ النَّذْرِ إِذَا لَمْ يُسَمَّ كَفَّارَةُ يَمِينٍ». رَوَاهُ ابْنُ مَاجَهِ وَالتَّرْمِذِيُّ وَصَحَّحَهُ.

1 The statement: “The expiation of a vow, if not specified, is the expiation of an oath”: Meaning if he says: “It is upon me a vow” and does not specify it, its expiation is the expiation of an oath. Scholars differed on the meaning of this hadith. The majority of Shafi’i’s companions interpreted it as a vow of obstinacy, which is in the form of a condition and consequence, such as a person saying to abstain from speaking to Zayd: “If I speak to Zayd, it is upon me a pilgrimage or something else.” He has the choice between fulfilling the vow or offering expiation. Ahmad and some of Shafi’i’s companions interpreted it as a vow of disobedience. 1 The statement: "The most rightful conditions, etc.": The conditions here refer to the dowry, as it is stipulated in exchange for intimacy. It is also said: All that a woman is entitled to by virtue of marriage, such as dowry, maintenance, and good companionship, as the husband commits to them by the contract, as if they were stipulated in it. It is also said: All that the husband stipulates to encourage the woman for marriage, as long as it is not prohibited, as in "Al-Marqah." In "Umdat al-Qari": Scholars differed regarding a man marrying a woman and stipulating for her that he will not take her out of her house, or not marry another, or not take a concubine, or similar permissible conditions, on two opinions. The first: He is obligated to fulfill it, which is the opinion of Al-Awza‘i and Ahmad. The second: The husband is ordered to fear Allah and fulfill the condition, but it is not enforced judicially. If he insists on going against it, he has the most right to his family. وَعَنِ ابْنِ عَبَّاسٍ(رضي الله عنهما) ، أَنَّ سَعْدَ بْنَ عُبَادَةَ اسْتَفْتَى النَّبِيَّ ﷺ فِي نَذْرٍ كَانَ عَلَى أُمِّهِ فَتُوُفِّيَتْ قَبْلَ أَنْ تَقْضِيَهُ، فَأَفْتَاهُ أَنْ يَقْضِيَهُ عَنْهَا. مُتَّفَقٌ عَلَيْهِ.
وَرَوَى الطَّحَاوِيُّ عَنْ عَمْرَةَ بِنْتِ عَبْدِ الرَّحْمَنِ قُلْتُ لِعَائِشَةَ: إِنَّ أُمِّي تُوُفِّيَتْ وَعَلَيْهَا نَذْرُ صِيَامٍ رَمَضَانَ، أَيَصْلَحُ أَنْ أَقْضِيْ عَنْهَا؟ فَقَالَتْ: لَا، وَلَكِنْ تَصَدَّقِي عَنْهَا مَكَانَ كُلِّ يَوْمٍ عَلَى مِسْكِينٍ خَيْرٍ مِنْ صِيَامِكِ، وَهَذَا سَنَدٌ صَحِيحٌ.

Ibn Abbas (may Allah be pleased with him) narrated: Sa’d ibn Ubadah sought the verdict of the Prophet (ﷺ) regarding a vow upon his mother, who died before fulfilling it. He ruled that he should fulfill it on her behalf. [Agreed upon]
Tahawi narrated from Amrah bint Abdur-Rahman, who said: I said to Aishah (may Allah be pleased with her): My mother died with a vow of fasting Ramadan upon her. Is it appropriate for me to fulfill it on her behalf? She said: No, but give charity on her behalf for each day to a poor person, which is better than your fasting. This has an authentic chain.
Nasa’i narrated from Ibn Abbas (may Allah be pleased with him) that the Messenger of Allah (ﷺ) said: “No one prays on behalf of another, but he feeds on his behalf.” In another narration by him from him: “No one fasts on behalf of another, nor prays on behalf of another.” Abdul Razzaq narrated something similar from Ibn Umar (may Allah be pleased with him).

1 The statement: “He sought the verdict of the Prophet (ﷺ) regarding a vow upon his mother, etc.”: Qadi Iyad said: They differed about the vow of Sa’d’s mother. Some said it was an absolute vow, others said it was fasting, others said emancipation, and others said charity. Each claimant cited hadiths related to the story of Sa’d’s mother. The most apparent is that it was a vow concerning wealth or an unspecified vow. This is supported by what Darqutni narrated from the hadith of Malik, where he said to him, meaning the Prophet (ﷺ): “Distribute water on her behalf.” Our Hanafi scholars specified it to financial acts of worship, not purely physical ones. Ibn Abbas (may Allah be pleased with him) said: “No one fasts on behalf of another, nor prays on behalf of another.” The detail is that a vow is either a physical act of worship or a financial one. ۱ قوله: استفتى النبي ﷺ في نذر كان على أمه إلخ : قال القاضي عياض: اختلفوا في نذر أم سعد هذا، فقيل: كان نذرا مطلقا، وقيل: كان صومًا، وقيل: عتقا، وقيل: صدقة، واستدل كل قائل بأحاديث جاءت في قصة أم سعد، والأظهر أنه كان نذرا في المال أو نذرا مبهما، ويعضده ما رواه الدارقطني من حديث مالك، فقال له يعني النبي ﷺ: اسق عنها الماء. وأصحابنا الحنفية خصوه بالعبادات المالية دون البدنية المحضة، يقول ابن عباس: لا يصوم أحد عن أحد، ولا يصلي أحد عن أحد، وتفصيله: أن النذر إما أن يكون عبادة بدنية، أو يكون عبادة مالية، فإن كان النذر بالعبادة البدنية لا يجوز قضاء الورثة عنها؛ للنهي عنه، فإن النسائي أخرج في سننه الكبرى عن ابن عباس : لا يصوم أحد عن أحد، ولا يصلي أحد عن أحد، وعن ابن عمر نحوه، وإذا كانت مالية ولم يوص، فكذلك لا يجب على الورثة وفاءه. وأما إذا أوصى الميت بوفاء نذرها، فيجب على الورثة وفائه من ثلث ماله يطعم عنه عن كل يوم صاعا من غير البر ونصف صاع من البر، وهو قول أبي حنيفة. وقال الشافعي في الجديد: أن يطعم الولي عن الميت كل يوم مسكينا مدا من قمح، ولا يصوم أحد عن أحد، وقوله في القديم: إن من فاته شيء من رمضان وتمكن من قضائه، ثم مات ولم يقض وكذا النذر والكفارة تدارك عنه وليه، أما بالصوم عنه أو الإطعام من تركته، قال النووي: القديم ههنا أظهر، التقطته من المرقاة» و«التعليق الممجد» و بذل المجهود و عمدة القاري» و«المسوى».
وَعَنْ كَعْبِ بْنِ مَالِكِ (رضي الله عنه) قَالَ: قُلْتُ: يَا رَسُولَ الله، إِنَّ مِنْ تَوْبَتِي أَنْ أَغْخَلِعَ مِنْ مَالِي صَدَقَةً إِلَى الله وَإِلَى رَسُولِهِ، فَقَالَ رَسُولُ اللهِ ﷺ: «أَمْسِكْ عَلَيْكَ بَعْضَ مَالِكَ فَهُوَ خَيْرٌ لَكَ، قُلْتُ: فَإِنِّي أُمْسِكُ سَهْمِي الَّذِي بِخَيْبَرَ. مُتَّفَقٌ عَلَيْهِ.
وَهَذَا طَرَفُ مِنْ حَدِيثٍ مُطَوَّلٍ، قَالَ الْإِمَامُ أَبُو حَنِيفَةَ: يَنْصَرِفُ ذَلِكَ إِلَى كُلِّ مَا يَجِبُ فِيْهِ الزَّكَاةُ مِنْ عَيْنِهِ مِنَ الْمَالِ دُوْنَ مَا لَا زَكَاةَ فِيْهِ مِنَ الْعَقَارِ وَالدَّوَابِّ وَنَحْوِهَا.
Ka’b ibn Malik (may Allah be pleased with him) narrated: I said: O Messenger of Allah, part of my repentance is to give all my wealth as charity to Allah and His Messenger. The Messenger of Allah (ﷺ) said: “Retain some of your wealth, for it is better for you.” I said: Then I will retain my share in Khaybar. [Agreed upon]
This is part of a lengthy hadith. Imam Abu Hanifah said: This applies to everything subject to zakat from its essence, excluding what is not subject to zakat, such as real estate, animals, and the like.

Ibn Battal said: It shows the permissibility of raising voices in the mosque if it is not excessive, due to the absence of disapproval. It also permits relying on gestures, which are equivalent to speech if understood, so the oath, testimony, and contracts of a mute person are valid if understood. It indicates the judge gesturing toward reconciliation as guidance. Here, reconciliation occurred with mutual acknowledgment, as their dispute was not about the debt but about demanding it. Reconciliation with denial is permitted by Abu Hanifah and Malik, and it is the view of Al-Hasan, but Ash-Shafi‘i and Ibn Abi Layla said it is invalid. It also indicates persistence in demanding payment, intercession with the creditor, reconciling between disputants, and mediating well between them, accepting intercession in non-sinful matters, and lifting curtains at the room. 2 The statement: “Then I will retain my share in Khaybar”: Meaning from real estate and other things. It is stated in “Umdat al-Qari”: Vows are of two types: a vow of piety and a vow of obstinacy. The first is divided into two: the first is what is initiated to draw closer, such as saying: “It is upon me to fast such-and-such” absolutely, or “to fast in gratitude if Allah heals my sick person,” or the like. It is said: There is consensus on its validity in both cases. Some Shafi’is said in the second case it does not form. The second is what is suspended to draw closer, such as saying: “If so-and-so returns from his journey, it is upon me to fast such-and-such.” This is binding by consensus. A vow of obstinacy is also divided into two: the first is its suspension on a forbidden act or neglecting an obligation, which does not form. The second is what is suspended on a permissible act, neglecting a recommended act, or something contrary to what is preferable. There are three opinions among scholars: fulfillment, expiation of an oath, or the choice between them according to Shafi’is. According to Malikis, it does not form at all. According to Hanafis, expiation of an oath is required in all cases. It is stated in “Al-Muswi”: If a man swears by giving his wealth as charity or says: “My wealth is for the cause of Allah,” some said: He must offer the expiation of an oath, and it is a vow of obstinacy, and this is Shafi’i’s view. Malik said: He gives one-third of his wealth. Ibn Abdul Barr and others said: In the language of the Daws tribe, Abu Hurayrah’s tribe, wealth excludes currency, such as goods and clothes. According to a group, wealth is currency, such as gold and silver specifically. Mutarrizi narrated that wealth is the silent, like gold and silver, and the speaking. Qali narrated from Thalab that he said: Wealth among the Arabs is at least what is subject to zakat, and what is less than that is not called wealth. Ibn Sayyidah said in “Al-Areez”: The Arabs do not apply the term wealth absolutely except to camels, due to their nobility and great utility. He said: Sometimes they apply it to all types of livestock, and some apply it to everything a person owns, due to Allah’s statement, the Exalted: And do not give the foolish your wealth (An-Nisa: 5), which does not specify anything over another. This is the choice of many later scholars. Thus, it is clear that Bukhari chose one opinion, saying: The conclusion is that wealth applies to everything owned. ۲ قوله: فإني أمسك سهمي الذي بخيبر : أي من العقار وغيره قال في عمدة القاري والنذر نوعان: نذر تبرر، ونذر الجاج، فالأول على قسمين، أحدهما ما يتقرب به ابتداء، كقوله: الله علي أن أصوم كذا مطلقا، أو أصوم شكرا على إن شفى الله مريضي، ونحوه، وقيل: الاتفاق على صحته في الوجهين، وعن بعض الشافعية في الوجه الثاني أنه لا ينعقد، والثاني من القسمين ما يتقرب به معلقا ، كقوله : إن قدم فلان من سفره فعلي أن أصوم كذا، وهذا لازم اتفاقا، ونذر اللجاج كذلك على قسمين، أحدهما : تعلقه على فعل حرام أو ترك واجب، فلا ينعقد، والقسم الآخر: ما يتعلق بفعل مباح أو ترك مستحب أو خلاف الأولى، ففيه ثلاثة أقوال للعلماء: الوفاء أو كفارة يمين، أو التخيير بينهما عند الشافعية، وعند المالكية لا ينعقد أصلا، وعند الحنفية يلزمه كفارة اليمين في الجميع، انتهى.
وقال في المسوى»: لو حلف الرجل بصدقة ماله، أو قال: مالي في سبيل الله، فقال قوم: عليه كفارة يمين، وهو من نذر اللجاج، وعليه الشافعي. وقال مالك: يخرج ثلث ماله. وقال أبو حنيفة: ينصرف ذلك إلى كل ما يجب فيه الزكاة من عينه من المال، دون ما لا زكاة فيه من العقار والدواب ونحوها، انتهى. وفي الدر المختار» ورد المحتار»، لو قال: مالي في المساكين صدقة، ولا مال له لم يصح اتفاقا ، أما لو كان له مال يصح، ويكون المراد به جنس مال الزكاة استحسانًا أي جنس كان بلغ نصابا أو لا، عليه دين مستغرق أو لا، وإن لم يجد غيره أمسك منه قدر قوته، فإذا ملك غيره تصدق بقدره، أي بقدر ما أمسك.
وتحقيقه: أن اختلافهم قد كثر في تفسير المال حيث قال ابن عبد البر وآخرون: إن المال في لغة دوس قبيلة أبي هريرة غير العين كالعروض والثياب، وعند جماعة المال هو العين كالذهب والفضة خاصة، وحكى المطرزي أن المال هو الصامت كالذهب والفضة والناطق، وحكى القالي عن ثعلب أنه قال: المال عند العرب أقله ما تجب فيه الزكاة، وما نقص عن ذلك فلا يقال له مال. وقال ابن سيدة في العريض»: العرب لا توقع اسم المال مطلقا إلا على الإبل؛ لشرفها عندهم وكثرة غنائها، قال: وربما أوقعوه على أنواع المواشي كلها، ومنهم من أوقعه على جميع ما يملكه الإنسان لقوله تعالى: ﴿وَلَا تُؤْتُوا السُّفَهَاءَ أَمْوَالَكُمُ﴾ (النساء: ٥) فلم يخص شيئًا دون شيء، وهو اختيار كثير من المتأخرين، فتبين من ذلك أن البخاري اختار قولًا من الأقوال، وقال: حاصله: أن المال يقع على كل متملك، فكذلك اختار أبو حنيفة قولًا من الأقوال، وقال: إن من حلف أو نذر أن يتصدق بماله كله، فإنه لا يقع يمينه ونذره من الأموال إلا على ما فيه الزكاة خاصة، أخذته من عمدة القاري».
وَعَنْ ثَابِتِ بْنِ الضَّحَاكِ (رضي الله عنه) قَالَ: نَذَرَ رَجُلٌ عَلَى عَهْدِ رَسُوْلِ الله ﷺ أَنْ يَنْحَرَ إِبِلًا بِبَوَانَةَ، فَأَتَى رَسُولَ اللهِ ﷺ فَأَخْبَرَهُ ، فَقَالَ رَسُولُ الله ﷺ: «هَلْ كَانَ فِيهَا وَثَنُ مِنْ أَوْثَانِ الْجَاهِلِيَّةِ يُعْبَدُ؟»، قَالُوا: لَا ، قَالَ: «فَهَلْ كَانَ فِيهَا عِيدٌ مِنْ أَعْيَادِهِمْ؟»، قَالُوا: لَا ، فَقَالَ رَسُوْلُ اللهِ : أَوْفِ بِنَدْرِكَ فَإِنَّهُ لَا وَفَاءَ لِنَذْرٍ فِي مَعْصِيَةِ الله وَلَا فِيمَا لَا يَمْلِكُ ابْنُ آدَمَ». رَوَاهُ أَبُو دَاوُدَ.
قُلْنَا: عُرِفَ مِنَ الشَّرْعِ أَنَّ الْتِزَامَ مَا هُوَ قُرْبَةٌ مُوْجِبُ، وَلَمْ يَثْبُتْ عَنِ الشَّرْعِ اعْتِبَارُ تَخْصِيْصِ الْعَبْدِ الْعِبَادَةَ بِمَكَانٍ، بَلْ إِنَّمَا عُرِفَ ذَلِكَ لِلهِ تَعَالَى فَلَا يَتَعَدَّى لُزُوْمٍ أَصْلِ الْقُرْبَةِ بِالْتِزَامِهِ إِلَى الْتِزَامِ التَّخْصِيْصِ بِمَكَانٍ فَكَانَ مُلْغَى، وَبَقِيَ لَا زِمًا بِمَا هُوَ قُرْبَةٌ، فَفِي الْحَدِيثِ أَمَرَ إِبَاحَةً.
وَرَوَى أَبُو دَاوُدَ وَالدَّارِمِيُّ عَنْ جَابِرِ بْنِ عَبْدِ اللهِ(رضي الله عنهما) : أَنَّ رَجُلًا قَامَ يَوْمَ الْفَتْحِ، فَقَالَ: يَا رَسُولِ الله، إِنِّي نَذَرْتُ لِلهِ عَزَّ وَجَلَّ إِنْ فَتَحَ اللهُ عَلَيْكَ مَكَّةَ أَنْ أُصَلِّي فِي بَيْتِ الْمَقْدِسِ رَكْعَتَيْنِ، قَالَ: «صَلَّ هَهُنَا» ثُمَّ أَعَادَ عَلَيْهِ، فَقَالَ: «صَلَّ هَهُنَا» ثُمَّ أَعَادَ عَلَيْهِ، فَقَالَ: شَأْنُكَ إِذَا».
Thabit ibn Ad-Dahhak (may Allah be pleased with him) narrated: A man during the time of the Messenger of Allah (ﷺ) vowed to slaughter camels at Bawana. He came to the Messenger of Allah (ﷺ) and informed him. The Messenger of Allah (ﷺ) said: “Was there an idol of the pre-Islamic idols worshipped there?” They said: No. He said: “Was there a festival of their festivals there?” They said: No. The Messenger of Allah (ﷺ) said: “Fulfill your vow, for there is no fulfillment for a vow in disobedience to Allah, nor in what the son of Adam does not possess.” [Narrated by Abu Dawud]
We say: It is known from the Shariah that committing to an act of worship is obligatory. It is not established in the Shariah that a servant’s specification of a place for worship is considered. Rather, that is known for Allah, the Exalted. Thus, the obligation of the essence of the act of worship by committing to it does not extend to the obligation of specifying a place, so it is nullified, and what remains obligatory is the act of worship itself. Thus, the command in the hadith is for permissibility.
Abu Dawud and Darimi narrated from Jabir ibn Abdullah (may Allah be pleased with him) that a man stood on the day of the conquest and said: O Messenger of Allah, I vowed to Allah, the Mighty, the Exalted, that if Allah grants you victory over Mecca, I will pray two rak’ahs in Jerusalem. He said: “Pray here.” He repeated it to him, and he said: “Pray here.” He repeated it again, and he said: “As you wish, then.”

Similarly, if one vows a sacrificial sheep, they said: He fulfills the obligation only by slaughtering it in the sanctuary and giving it as charity there, although they said: If one vows to give a dirham as charity to the poor of Mecca, he may give it to others. This is because a sacrificial animal is a term for what is offered to Mecca and given as charity there, so the place is part of its concept, like time in a sacrificial animal. If he gives it as charity outside Mecca, he has not fulfilled what he vowed, unlike vowing to give a dirham as charity there, as the place is not part of the dirham’s concept. A dirham is a dirham whether given as charity in Mecca or elsewhere, unlike a sacrificial animal. Thus, the validity of the tenth day and the obligation to slaughter it on the days of sacrifice are clear. The author of “Radd al-Muhtar” said: Seize this noble benefit, which is a result of my humble thought, as I have not seen it in any book, and praise be to Allah, the Sovereign, the Bestower.
2 The statement: “He said: Pray here, etc.”: Ibn al-Humam said: If one vows two rak’ahs in the Sacred Mosque and performs them in a less noble place or one with no nobility, it suffices. [Stated in “Al-Mirqat”] It is stated in “Al-Alamgiriyyah”: Our scholars differed about one who vows fasting or prayer in a specific place. Abu Hanifah and Muhammad said: He may fast and pray in any place he wishes. [Stated in “As-Siraj al-Wahhaj”] Tahawi preferred it, and its evidence is mentioned in “Sharh Ma’ani al-Athar.” It is stated in “Ad-Durr al-Mukhtar” in the book of oaths: Because an unsuspended vow is not restricted to anything. Its detail is in “Radd al-Muhtar”: A vow for retreat, pilgrimage, prayer, fasting, or others, unsuspended, even if specified, is not restricted to time, place, dirham, or poor person. If one vows to give charity on Friday in Mecca with this dirham to so-and-so and violates it, it is valid. If advancing it were permissible, it would occur before its cause, which is not valid. It is clear from this that in a suspended vow, the time is specified regarding advancing, but delaying it is apparently permissible, as there is no issue in it. It is also clear that the place, dirham, and poor person are not specified, as the suspension only affects the formation of causality, preventing advancing and specifying the time. The place, dirham, and poor person remain on the default of non-specification. Just as the poor person is not specified, their number is not specified. It is stated in “Al-Khaniyah”: If he says: “If I marry my daughter, a thousand dirhams of my wealth are charity, one dirham for each poor person,” and he marries her and gives the thousand to one poor person entirely, it is valid.
۱ قوله : أوف بنذرك إلخ : قال الطيبي الله فيه دليل على أنه يجب الوفاء بالنذر في المكان المعين. فالأمر للوجوب لعل هذا مذهب الشافعي، وقلنا عرف من الشرع أن التزامه ما هو قربة موجب، ولم يثبت عن الشرع اعتبار تخصيص العبد العبادة بمكان، بل إنما عرف ذلك الله تعالى، فلا يتعدى لزوم أصل القربة بالتزامه إلى التزام التخصيص بمكان، فكان ملغى، وبقي لازما بما هو قربة، ففي الحديث أمر إباحة، أخذته من المرقاة». قال في رد المحتار» في كتاب الأضحية: اعلم أن الأضحية اسم لما يذبح في وقت مخصوص لم يكن فيها إلغاء الوقت، فإذا نذرها يلزم فعلهما فيه وإلا لم يكن آتيا بالمنذور؛ لأنها بعدها لا تسمى أضحية، ولذا يتصدق بها حية إذا خرج وقتها، بخلاف ما إذا نذر ذبح شاة في وقت كذا يلغو ذكر الوقت؛ لأنه وصف زائد على مسمى الشاة، ولذا ألغى علمائنا تعيين الزمان والمكان بخلاف الأضحية، فإن الوقت قد جعل جزأ من مفهومها، فلزم اعتباره.
ونظير ذلك ما لو نذر هدى شاة فإنهم قالوا : إنما يخرجه عن العهدة ذبحها في الحرم والتصدق بها هناك، مع أنهم قالوا: لو نذر التصدق بدرهم على فقراء مكة، له التصدق على غيرهم، وما ذك إلا لكون الهدي اسما لما يهدى إلى مكة، ويتصدق به فيها فقد جعل المكان جزأ من مفهومه كالزمان في الأضحية، فإذا تصدق به في غير مكةلم يأت بما نذره، بخلاف ما لو نذر التصدق بالدرهم فيها، فإن المكان لم يجعل جزأ من مفهوم الدرهم، فإن الدرهم درهم سواء تصدق به في مكة أو غيرها، بخلاف الهدي فقد ظهر وجه تصحيح العشر، ووجه لزوم ذبحها في أيام النحر. وقال صاحب رد المحتار: فاغتنم هذه الفائدة الجليلة التي هي من نتائج فكرتي العليلة، فإني لم أرها في كتاب والحمد لله الملك الوهاب.
۲ قوله: قال صل ههنا إلخ : قال ابن الهمام: إذا نذر ركعتين في المسجد الحرام فأداها في أقل شرفا منه أو فيما لا شرف له أجزأه قاله في المرقاة». وقال في العالمكيرية»: اختلف أصحابنا فيمن نذر صوما أو صلاة في موضع بعينه، فقال أبو حنيفة ومحمد له أن يصوم ويصلي في أي موضع شاء. كذا في السراج الوهاج» رجحه الطحاوي دلائله مذكورة في شرح معاني الآثار». وقال في الدر المختار» في كتاب الأيمان؛ لأن النذر غير المعلق لا يختص بشيء، وتفصيله ما في رد المحتار: أن النذر من اعتكاف أو حج أو صلاة أو صيام أو غيرها غير المعلق، ولو معينا لا يختص بزمان ومكان ودرهم وفقير، فلو نذر التصدق يوم الجمعة بمكة بهذا الدرهم على فلان، فخالف جاز، وكذا لو عجل قبله، فلو عين شهر الاعتكاف أو للصوم، فعجل قبله عنه صح، وكذا لو نذر أن يحج سنة كذا، فحج سنة قبلها صح، أو صلاة في يوم كذا، فصلاها قبله؛ لأنه تعجيل بعد وجود السبب، وهو النذر فيلغو التعيين، بخلاف النذر المعلق، فإنه لا يجوز تعجيله قبل وجود الشرط.
فالفرق أن المعلق على شرط لا ينعقد سبباً للحال، كما تقرر في الأصول، بل عند وجود شرطه، فلو جاز تعجيله لزم وقوعه قبل سببه، فلا يصح، ويظهر من هذا أن المعلق يتعين فيه الزمان بالنظر إلى التعجيل أما تأخيره، فالظاهر أنه جائز؛ إذ لا محذور فيه، وكذا يظهر منه أنه لا يتعين فيه المكان والدرهم والفقير؛ لأن التعليق إنما أثر في انعقاد السببية فقط، فلذا امتنع فيه التعجيل وتعين فيه الوقت، أما المكان والدرهم والفقير، فهي باقية على الأصل من عدم التعيين، وكما لا يتعين الفقير لا يتعين عدده، ففي الخانية»: إن زوجت بنتي فألف درهم من مالي صدقة لكل مسكين درهم، فزوج ودفع الألف إلى مسكين جملة جاز.
وَعَنْ مُحَمَّدِ بْنِ الْمُنْتَشِرِ قَالَ: أَتَى رَجُلٌ إِلَى ابْنِ عَبَّاسٍ قَالَ: إِنِّي جَعَلْتُ ابْنِي نَحِيرًا وَمَسْرُوْقُ بْنُ الْأَجْدَعِ جَالِسٌ فِي الْمَسْجِدِ، فَقَالَ لَهُ ابْنِ عَبَّاسٍ: اذْهَبْ إِلَى ذَلِكَ الشَّيْخِ فَاسْأَلْهُ ثُمَّ تَعَالِ فَأَخْبِرْنِي بِمَا يَقُولُ، فَأَتَاهُ فَسَأَلَهُ، فَقَالَ مَسْرُوْقُ: إِنْ كَانَتْ نَفْسُ مُؤْمِنَةً تَعَجَّلَتْ إِلَى الْجَنَّةِ، وَإِنَّ كَانَتْ كَافِرَةً عَجَّلْتَهَا إِلَى النَّارِ، اذْبَحْ كَبَشًا فَإِنَّهُ يُجْزِئُكَ، فَأَتَى ابْنَ عَبَّاسٍ فَحَدَّثَهُ بِمَا قَالَ مَسْرُوْقٌ، قَالَ: وَأَنَا آمُرُكَ بِمَا أَمَرَكَ بِهِ مَسْرُوقٌ. رَوَاهُ مُحَمَّدُ فِي الْآثَارِ».
Muhammad ibn al-Muntashir narrated: A man came to Ibn Abbas (may Allah be pleased with him) and said: I made my son a sacrificial offering. Masruq ibn al-Ajda’ was sitting in the mosque, so Ibn Abbas said to him: Go to that elder and ask him, then come back and tell me what he says. He went and asked him. Masruq said: If it is a believing soul, you hastened it to Paradise, and if it is a disbelieving soul, you hastened it to the Fire. Slaughter a ram, for it will suffice you. He came to Ibn Abbas and told him what Masruq said. He said: I order you as Masruq ordered you. [Narrated by Muhammad in “Al-Athar”]

1 The statement: “Slaughter a ram, for it will suffice you, etc.”: Meaning whoever vows to slaughter his son must slaughter a sheep, due to the story of Khalil (may Allah be pleased with him), and the second vow is nullified. Shafi’i said: It is as if he vowed to kill him, and it is nullified, whether it was to slaughter himself or his slave. Muhammad obligated a sheep. If it was to slaughter his father, grandfather, or mother, it is nullified by consensus, as they are not his earnings. [Stated in “Ad-Durr al-Mukhtar”] It is stated in “Radd al-Muhtar” and “Al-Ikhtiyar”: If one vows to slaughter his son or the like, he must slaughter a sheep according to Abu Hanifah and Muhammad. Similarly, vowing to slaughter himself or his slave according to Muhammad. Regarding parents, there are two narrations from Abu Hanifah, and the correct one is that it is not valid. Abu Yusuf and Zufar said: None of this is valid, as it is a sin, so it is not valid. For them, regarding the son, it is the view of a group of companions, such as Ali, Ibn Abbas, and others (may Allah be pleased with them), and it is not known by analogy, so it is by transmission. This is because obligating the slaughter of a son is an expression for obligating the slaughter of a sheep. If he vows to slaughter him in Mecca, he must slaughter the sheep in the sanctuary. Its evidence is the story of the sacrificial son, as Allah, the Exalted, obligated Khalil to slaughter his son and ordered him to slaughter a sheep, where He said: You have fulfilled the vision (As-Saffat: 105). Thus, it is so in our Shariah, either by Allah’s statement, the Exalted: Then We revealed to you, “Follow the religion of Ibrahim, inclining toward truth” (An-Nahl: 123), or because the Shariah of those before us is binding upon us until abrogation is established. It has parallels, such as obligating walking to the House of Allah being an expression for pilgrimage or minor pilgrimage, and obligating a sacrificial animal being an expression for obligating a sheep, and many similar cases. If vowing to slaughter a son is an expression for slaughtering a sheep, it is not a sin but an act of worship. Isbijabi and other scholars said: If he intends the actual slaughter and knows it is a sin, it is not valid. Its parallel is fasting for an elderly person, which is a sin as it leads to his destruction, yet vowing to fast is valid, and he must offer a redemption. This is considered an obligation for redemption, as here. For Muhammad, regarding himself and his slave, his authority over them is greater than over his son. For Abu Hanifah, the obligation of a sheep is contrary to analogy, known by inference from the story of Khalil. It was mentioned regarding the son, so it is limited to it. If he vows with the term “killing,” nothing is required by consensus, as the text uses the term “slaughter,” and “sacrifice” is similar, unlike “killing.” This is because slaughter and sacrifice are mentioned in the Quran as acts of worship and devotion, while killing is mentioned only as punishment, retribution, and prohibition. If one vows to slaughter a sheep with the term “killing,” it is not valid, so this is even more so.
1 قوله: أذبح كبشا فإنه يجزئك إلخ يعني من نذر أن يذبح ولده فعليه شاة لقصة الخليل له وألغاه الثاني، والشافعي كنذره بقتله ولغا لو كان بذبح نفسه أو عبده، وأوجب محمد الشاة، ولو بذبح أبيه أو جدة أو أمه لغا إجماعا؛ لأنهم ليسوا كسبه. قاله في الدر المختار». وقال في رد المحتار»: وفي الاختيار»: ولو نذر ذبح ولده أو نحوه لزمه ذبح شاة عند أبي حنيفة ومحمد، وكذا النذر بذبح نفسه أو عبده عند محمد وفي الوالد والوالدة عن أبي حنيفة روايتان والأصح عدم الصحة. وقال أبو يوسف وزفر : لا يصح شيء من ذلك؛ لأنه معصية، فلا يصح ولهما في الولد مذهب جماعة من الصحابة كعلي وابن عباس وغيرهما ومثله لا يعرف قياسًا، فيكون سماعا، ولأن إيجاب ذبح الولد عبارة عن إيجاب ذبح الشاة حتى لو نذر ذبحه بمكة يجب عليه ذبح الشاة بالحرم بيانه قصة الذبيح، فإن الله تعالى أوجب على الخليل ذبح ولده، وأمره بذبح الشاة حيث قال: قد صدقت الرؤيا، فيكون كذلك في شريعتنا إما بقوله تعالى: ﴿ثُمَّ أَوْحَيْنَا إِلَيْكَ أَنِ اتَّبِعْ مِلَّةَ إِبْرَاهِيمَ حَنِيفًا﴾ (النحل: ۱۲۳ أو لأن شريعة من قبلنا تلزمنا حتى يثبت النسخ.
وله نظائر منها أن إيجاب المشي إلى بيت الله تعالى عبارة عن حج أو عمرة وإيجاب الهدي عبارة عن إيجاب شاة ومثله كثير، وإذا كان نذر ذبح الولد عبارة عن ذبح الشاة لا يكون معصية، بل قربة حتى قال الإسبيجابي وغيره من المشايخ: إن أراد عين الذبح وعرف أنه معصية لا يصح، ونظيره الصوم في حق الشيخ الفاني معصية؛ لإفضائه إلى إهلاكه، ويصح نذره بالصوم، وعليه الفدية، وجعل ذلك التزاما للفدية كذا هذا، لمحمد في النفس والعبد أن ولايته عليهما فوق ولايته على ولده، ولأبي حنيفة أن وجوب الشاة على خلاف القياس عرفناه استدلالا بقصة الخليل. وإنما وردت في الولد فيقتصر عليه، ولو نذر بلفظ القتل لا يلزمه شيء بالإجماع؛ لأن النص ورد بلفظ الذبح والنحر مثله، ولا كذلك القتل، ولأن الذبح والنحر وردا في القرآن على وجه القربة والتعبد، والقتل لم يرد إلا على وجه العقوبة والانتقام والنهي، ولأنه لو نذر ذبح الشاة بلفظ القتل لم يصح، فهذا أولى.
