الله برز وبرتر كا ارشاد و ل يوفوا نذورهم ١ اوروا ي منتو كو وري كري

اورالل تعالي كا ارشاد و لا تنزر وا زر و زر اخري اوركويي بو ا طحان والاسي
دوسرے (کے گناہول) کا بوڑھیس اٹھائے گا)(35فاطر18)
سیدنا ابوہریرہ رضی اللہ تعالی عنہاورسیدنا عبد اللہبن عمررضی اللہ تعالی عنہما نے روایت کے ان دونوں نفر ماپرسول اللہ ﷺ ارشادفرمايانذرمت مانو 2 کیونکہ نذر تقدیر کے مقابلہ میں پچھا میں دی صرف اتنا کہ نذر کی وجہ سے بخیل ہے (مال) نکلا جاتا ہے۔ (متفق علیہ)
قولہ وَ لِّ يُوْفُوا نُذُوْرَهُمْ - (اورواپی منتوں کو پورا کریں) پرامروجواب کے لئے - اگرچہ یا ں کریما کی مخصوص نذر کے بارے میں آئی مگرموما سے مطلق نذر کو پورا کرنا وااجب ہو نے پراستدلال کیا گیا ں کیونکہ اس میں نذر پورا کرنے کا حکم ہے۔اورہمارے پاس نص اپنے مورد او رسب کے ساتھ خاص نہیں ہوتی پبل اس سے هرنذر کو پورا کرنے کا وجوب ثابت ہوتا ں اوریہال لفظ وجوب کوفرض کے مقابلہ میں ذکر کیا گیا ں کیونکہ یہ عام خصوصا بعض ں لیجنی اس عام کے بعض افراد کواس حکم سے خاص کروا گیا ں جیسے گناہ کی نذر مانا یاطاعت غیرمقصودہ کی نذر مانتا (پاس سے خارج ہو گے) پس یعام ظاہراوراسی لے اس پر لفظ وجوب کا جس میں اختیال ہوتا ں اطلاق کیا گیا ں
قولہ لا تنذر وا .. الخ (نذر مت مانو کیونکہ نذر تقدیر کے مقابلہ میں پچھا میں دی اس میں جونذر سے منع کیا جارہہوہ نذر کے پورا کرنے کی تاکید کے لئے ں کہ نذر کرنے کے بعد اس کو پورا کرنے میں ستی نہ کی جائے۔ اگراس تمراد نذر ں رونا ہوتا تو نذر مانتا معصیت ہوجاتا اوراس کا حکم باطل ہوجاتا اوراس کو پورا کرنا ساقط ہوجاتا اس حدیث شریف کے ذریعہ پ نے بتایا ں کہ نذرلان کونکونی نفع دے سکتی ہےاورنہ کونی ضرر کوالن سے دور کر سکتی ہے۔اور نہ اللہ تعالی کے فیصلے ہوتی چیز کور درسکتی ہے حضرت پاک کا بقیہ اگلے صفحہ پر۔
Abu Hurayrah and Ibn Umar (may Allah be pleased with them) narrated: The Messenger of Allah (ﷺ) said: “Do not make vows, for a vow does not avail anything against fate, and it only extracts something from the miser.” [Agreed upon]
(2) The statement: “Do not make vows, for a vow does not avail anything against fate, etc.”: The meaning of his prohibition of vows is to emphasize its command and warn against neglecting it after making it obligatory. If it meant prohibiting it entirely, that would nullify its ruling and remove the obligation to fulfill it, as it would become a sin. The perspective of the hadith is that he informed them that it is something that does not bring them immediate benefit, nor repel harm, nor avert anything decreed by Allah, the Exalted. He says: Do not make vows thinking that by vowing you will attain something not decreed by Allah for you, or repel something decreed against you. If you do so, fulfill it, for what you vowed is binding upon you. Thus, prohibiting vows for this purpose encourages vowing, but with sincerity. Its clarification is that he justified the prohibition by saying: “For a vow does not avail anything against fate,” indicating that what is prohibited is the condition, meaning the corrupt belief that a vow can avail against fate. The conclusion is that the prohibition of vows is not related to their essence but to the corrupt belief arising from them. Thus, the prohibition is against vowing with the belief that it can avert fate, not against vowing absolutely. Its status as worship is due to its association with acts of worship like prayer, fasting, pilgrimage, emancipation, and the like. Its legislation is due to the commands to fulfill it. It is stated in “Umdat al-Qari”: Consensus has been established on the obligation to fulfill a vow if it is an act of obedience. Allah, the Exalted, said: Fulfill your contracts (Al-Ma’idah: 1), and said: They fulfill their vows (Al-Insan: 7), praising them for it. There is disagreement regarding initiating a vow. Some said it is recommended, while others said it is disliked, and Nawawi affirmed this. Shafi’i stated that it is contrary to what is preferable. Some later scholars interpreted the prohibition as applying to a vow of obstinacy, while they recommended a vow of piety. We will mention their explanation in this chapter, God willing, the Exalted.
سیرتنا عاشرصد قدرضی اللہ تعالیٰ عنہما روايتہ انہوں نے کہا کر رسول اللہ صلی اللہ علیہ وسلم ارشاد فرمایے گناہ کے کام میں نذر نہیں ہوتی۔ اوراس کا کفارہ بھی نہیں کا کفارہ ہے۔
مانتی حاشیہ فرمان "نز رمت ما تو" اس بناء پر ہے کر اللہ تعالیٰ نے تمہارے لے جب کسی چیز کو مقدر نہیں کیا ہے تو تم اس کو نذر کے ذرائعہ نہ حاصل کر سکتا ہوا ورنے اللہ تعالیٰ کا جوتم پر فیصلہ ہو چکا ہے جہاں سکتے ہو پھر کہی جب تم نذر مان لوتو اس کو پورا کرو کیونکہ تم جس چیز کی نذر مانے ہووہ تمہارے لے ضروری ہے۔ حدیث شریف میں نذر سے جو منع کیا گیا ہے دراصل اس میں اخلاص کے ساتھ نذر مانے اوراس کو پورا کر کی ترغیب ہے حضرت پاک صلی اللہ علیہ وسلم نے اپنے اس ارشاد سے کہ تقدیر کے مقابلے میں نذر پڑھ کا مثبت وی۔ نذر سے منع کرنے کی جوعلت بیان فرمائی ہے اس سے اس خیال فاسد پر کمزور تقدیر کے مقابلے میں کام دیتے ہے تمہیں فرمائی ہے خلاصہ یہ کہ منع کرنے کاتعلق مطلق نذر سے نہیں ہے بلکہ اس کا تعلق ان کے اس خیال فاسد سے ہے کہ "نزرتقدیر کوک سکتی ہے"۔(مرقات، لمعات) اس لے رد اختار میں ہے۔ تم اس باٹ کو جانا کہ نذر رثریعت میں تقرب کی چیز ہے اس لے کراسے لازم آئے والی عبادات نماز، روزہ، زکاوۃ حق وغیرہ سب تقرب کی چیزیں ہیں اوراس کا مشروع ہونا اس لے ہے کراس کو پورا کرنے کے احکام دین کے ہیں عمدۃ القاری میں ہے کراطاعت کی نذر کو پورا کرنے پرامجاع ہوگیا ہے اللہتابک وتعالی کا ارشاد ہے "اوفوا بالعقود" معاملات کوتم پورا کرو "یوفون بالنذر" وہ نذر کو پورا کرنے ہیں
قوله لانذر في معصية الخ : (گناہ کے کام میں نذر نہیں ہوتی) جانواس باٹ کو کہ نذر اگر کسی طاعت کے کام میں ہوتا وہ بالاتفاق لازم ہے اور اگر معصیت میں ہوتا اس کو پورا کرنا جائز نہیں البتنذر معصیت کے منعقر ہونے کے بارے میں علماء کے میں اختلاف ہے حضرت امام شافعی رحمۃ اللہ علیہ فرماتے ہیں کہ نذر معصیت باکمل منعقد نہیں ہوتی۔ اور نذر معصیت لغو ہے جس میں کفارہ بیں ہے۔اورحضرت امام اعظم ابوحنیفرحمۃ اللہ علیہ کے پاس نذر معصیت بطورقسم منعقد ہوجاتی ہے مگر اس کو پورا کرنا نہیں ہے بلکہ اس میں کفارہ وی نہیں ہے۔ اور امام طحاوی نے ایک واختیار کیا ہے۔اور فرماتے ہیں کہ اگر جب معاصی کی نذر مانے مثلًا پی کہ "للہ علی ان اقتل فلانا اللہ تعالی کے لے میں فلان کو قتل کر دوں گا" تو اب پیسم ہے اوراس کو توڑ کر کفارہ و پناضروری ہے۔اس کی تا نیدیا ناحا ویث سے ہوتی ہے جواس باب میں نذور ہیں۔۔۔۔بقیہ کے صفحہ پر۔۔۔۔

عرف الشد ي مين و كيليس -
صاحب ممسوط نقل کیا ہے کے امام شعي رحمۃ اللّٰعلیہ نفرمايا : نذر معصیت پركولي چیز واجب نمين کیونکہ
معاصي کی نذر مانتنے ندان کو کرنا ضروری ہوتا ہے اور نہ کفارہ دینا ہے کیونکہ کفارہ قسم کی وجہ سے واجب ہونے والی
چیز کا خلیفہ یاوه پھراس چیز کا خلیفہ ہے جس کون زرکی مجہتے پورا کرنا ضروری ہوتا ہے اور یہ چیز تو نذر معصیت
میں پانی ہی نمين جاتی -
حكابت : بیان کیا جاتا ہے کے امام عظیم ابوحنیفرحمۃ اللّٰعلیہ امام شعی کے پاس گے اور پی مستہ ( لیجن
گناہ کی نذر مانتنے متعلق ) ان سے دریافت کیا امام شعی نے فرمایا کے اس پر کولی چیز واجب نمين کیونکہ جس چیز کی
نذر کی گئی وہ معصیت ہے تو حضرت امام عظيم ابوحنیفرحمۃ اللّٰعلیہ نفرمايا کیا ظہار معصیت نمين ہے اور اللّٰتعا لی نے
اس میں کفارہ کا حکم فرماياهے؟ امام شعی حیران ہوگے اور فرمايا انت من الآ رائيين " آپ تو اصحاب را ہے لیجن
مجہتین میں سے ہیں -
اور فتاوی عالمگیری میں ہے اگر کوئی معصیت کی نذر مانتے تو وہ درست نمين ہے البتہ ایک نذر مانتے کفارہ
لازم آتا ہے اور نیل الاوطار میں کہا ہے کہ نذر معصیت میں کفارہ کے واجب ہونے نہ ہونے کے بارے میں
اخلاف ہے جمہور کے پاس کفارہ واجب نمين ہے اور امام احمد، امام ثوری، امام اشق اور بعض شافعی اور حنفی کے
پاس کفارہ ہے اور امام ترمذی نے اس بارے میں صحابہ کا اختلاف نقل فرماياهے اور نذر معصیت کے حرام ہونے پر
سب کا اتفاق ہے اور ان کا اختلاف توصرف و جوب کفارہ کے بارے میں ہے۔
اور جو و جوب کفارہ کے تقابل میں وہ اس باب میں حضرت عائشہ رضی اللّٰتعا لی عنہا بقیہ اگل صفحہ پر ---

The marginal note for the phrase 'nazr mat ma tu' is based on the premise that when Allah, the Exalted, has not predestined something for you, you cannot obtain it through a vow. However, if Allah, the Exalted, has already decided something for you, then you can achieve it where possible. Therefore, when you make a vow, you should fulfill it because the thing you have vowed for is necessary for you. The noble Hadith forbids making vows, but in reality, it encourages making and fulfilling vows with sincerity. The Holy Prophet (SAW) has indicated through his guidance that making a vow can be beneficial in the face of predestination. The reason for prohibiting vows is to weaken the false notion that a vow can alter predestination. In summary, the prohibition does not relate to all vows but specifically to the false belief that 'a vow can change predestination.' (Mirqat, Lum'at) This is part of the refutation of this false notion. You should know that a vow is a means of drawing closer to Allah in Islam, and thus, obligatory acts such as prayer, fasting, zakat, and other forms of charity are all means of drawing closer to Allah. Their legitimacy is based on the commands of religion to fulfill them. It is stated in 'Emdat al-Qari' that there is a consensus on fulfilling a vow made for obedience. The command of Allah, the Exalted, is: 'Fulfill your covenants,' meaning fulfill your obligations, and 'fulfill your vows,' meaning fulfill your vows.
The statement 'lanazara fi ma'asaya' (Do not make a vow for sin) indicates that a vow should not be made for sinful acts. You should know that if a vow is made for an act of obedience, it is obligatory by consensus, and if it is made for a sin, it is not permissible to fulfill it. However, there is a difference of opinion among scholars regarding the annulment of a vow for sin. Imam Shafi (RA) states that a vow for sin is not valid and is nullified, and there is a penalty involved. Imam Abu Hanifa (RA) holds that a vow for sin is valid as an oath, but it should not be fulfilled, and there is no penalty. Imam Tahaawi has presented another view, stating that if a sinful vow is made, such as saying, 'I will kill so-and-so for Allah's sake,' it must be broken, and a penalty is required. This is established through various narrations related to vows.
This defines those who make vows and the differences of opinion regarding vows for sins. It has been deemed desirable and some consider it reprehensible, according to Imam Nawawi's view. Imam Shafi (RA) has opposed this view and some later scholars have discussed the legal status of a vow for sin and the desirability of a vow for an act of obedience, which we will explain in detail.

The author of 'Mumtah' has quoted Imam Sha'bi (RA) as saying: A vow for sin is not obligatory because it is necessary to fulfill what is vowed, and there is no penalty, as a penalty is a substitute for an obligatory act, and in a vow for sin, there is no such act to be fulfilled.
It is narrated that Imam Abu Hanifa (RA) asked Imam Sha'bi about a vow for sin, and Imam Sha'bi replied that it is not obligatory because the thing vowed for is a sin. Imam Abu Hanifa (RA) then asked if it is not a sin and if Allah, the Exalted, has prescribed a penalty for it. Imam Sha'bi was surprised and said, 'You are one of the people of opinion, one of the wise men.'
In 'Fatawa Alamgiri,' it is stated that if someone makes a vow for a sin, it is not correct, but if they make a vow, a penalty is required. In 'Nail al-Awtaar,' it is mentioned that there is a difference of opinion among the majority regarding whether a penalty is required for a vow for sin. According to Imam Ahmad, Imam Thawri, Imam Ash'ari, and some Shafi and Hanafi scholars, a penalty is required, while others do not require a penalty. There is unanimous agreement that a vow for sin is forbidden, and the difference of opinion is only regarding the penalty. The issue of the penalty is discussed in the context of the narration of the Companions, and the rest is on the next page.
سید ناعمران بن حسین رضی اللہ تعالی عنہ سے مروی ہے کر انہوں نے کہا کہ
رسول اللہ صلی اللہ علیہ وسلم نے ارشاد فرمایا کہ معصیت کی نذر 1 کو پورا کرنا ضمیں ہے۔ اور نامی
مانتی حاشیہ میں ذکورہ حدیث سے اوراس میں دوسرا آیہ بھولی حدیث کے استدلال کرتے ہیں۔(انجی)
اور لا نذر فی معصیۃ” کے معنی ضمیں ہے کہ زر با کل منعق ضمیں ہوتی کیونکہ آپ کا ارشاد ہی ہے
اس کا کفارہ ضمیں کا کفارہ ہے“ پھر دونوں میں اس کی کوئی مناسب ضمیں رہتی بلکہ اس کا مطلب یہ ہے کہ اگر کو
پورا کرنا ضمیں ہے۔ بعض تحقیق روايتی میں وضاحت کے ساتھ یہ بات موجود ہے کہ معصیت کی نذر کو پورا کرنا ضمیں
ہے۔(فتاودود)
۔ قولاً لا وفاء لنذر فی معصیۃ“(معصیت کی کسی نذر کو پورا کرنا ضمیں ہے) کیونکہ نذر کے طرح ہو نے
اوراس کے پورا کرنے کے وجہ کے لیے چند شرطیں ہیں جملہ ان کے بیچ
(1)- نذر اللہ تعالی کے تقریب کے لیے ہو
(2)- نذر معصیت کی نہ ہو کیونکہ جب وہ نفی نفس حرام ہے تو اس میں تقرب اللہ کوئی صورت ضمیں
ہے اور غراس میں تقرب اللہ کوئی صورت ہے لیکن وہ دوسرا وجب ہے حرام ہوتا یعنز منعقد ہوجائے گی۔ جیسے یوم
خرمیں روزہ رکن کی نذر ما نا۔ اور اگروہ ان ایام میں روزہ رکن کا توز مرداری سے بری ہوگا لیکن کہنگا رہوگا۔ اور زیادہ
بہتر صورت پیہ کوئی دوسرا دان روزہ رکن کر نذر پوری کر لے۔(فتاقدیر)
(3)- جس چیز کی نذر ما نی گئی ہے وہ اس کے ذمہ نذر ما نے سے پہلے واجب نہ ہو۔ اگر شرعی نجیما ظہری اس
جس کسی چیز کی نذر ما نے تو ان چیزوں کے سوا دوسرا کوئی چیز بطور نذر واجب ضمیں ہوگی۔-
(4)- جس چیز کی نذر ما نی گئی ہے اپنی ملکیت سے زاکدنہ ہو اپنی ملکیت میں۔ ایسے ہوتا نذر منعق ضمیں ہوگی۔ مشاہ
اگر کسی دوسرا کی بڑی کے لیے کہ کر اللہ تعالی کے لیے میں اس کو یوم آخر میں ذنگ کرو نگا تو وہ نذر درست ضمیں ہے۔-
(5) وہ ایسی چیز نہ ہو جس کا وجود حال ہے۔ جیسے اگر نذر ما نے کر گذرنے ہو گے دن میں روزہ رکونگا یا
گزر ہو گے دن میں اعتکاف رکونگا تو پیش نذر درست ضمیں۔-
(6) اور جس چیز کی نذر ما نی گئی ہے وہ شرعاً واجبات کی جنس سے ہو لیجنی اس سے صرف فرض مراد ضمیں ہے بلکہ
فرض یا شرعی واجب مراد ہے۔ نذر ما نے والا اگر ایسی چیز کی نذر ما نے جو واجبات کی جنس سے نہ ہوتا نذر واجب ضمیں
ہے جیسے جنازہ کے ساتھ جانا، مسجد میں داخل ہونا
(7) جس چیز کی نذر ما نی گئی ہو وہ عبادت مقصود ہو۔ وضو بنانا ایا میت کوفن ویتا، غسل دینا وغیرہ کی نذر واجب ضمیں

چیز کی نذر کو جس کا بندہ ما لک نہیں ہے -1 (مسلم)
۔ قولاً و لا فیما لا یملک العبد "(جس چیز کا بندہ ما لک نہواس نذر کو پورا کرنا نہیں ہے) اس کی
صورت میں کر مثالاً ایون کہ کا گرا للہ تعالیٰ میرے پیار کو شفاف تو فلال غلام آزاد ہے جب کروہ (غلام) اس کی ملك
میں نہیں ہے۔ اور اگراس نذر کے بعد وہ اس کی ملك میں آ جائے تو بھی اس کو یہ نذر پوری کرنا ضروری نہیں ہے۔ اس
کے برخلاف جب وہ کسی غلام کی آزادی کو پچی ملكیت کے ساتھ متعلق کر تو یقیناً وہ ہمارے پاس اس کا ما لک ہو نے کے
بعد آزاد ہو جائے گا۔ کیونکہ نذر کے تنج ہو نے کی ہمارے باس شرط پیہ کہ جس چیز کی نذر مانی گئی ہے وہ نذر مانے
والے کی ملك ہو یا سب ملك کی طرف اس کی نسبت کی گئی ہو مشاہدہ ہے کہ کہ میں تمہ کو خریدو نگا تو للہ تعالیٰ کے لے میرے
ذمہ کے تمہ کو میں آزاد کر دو ل۔
اور منت کے بارے میں پر اختلاف ایسائی ہے جسیا قبل نکاح طلاق کے بارے میں ہے۔ ملك یا سب ملك
پر طلاق کو متعلق کر نے کی احادیث پرتیاس کر تے ہو ے حنفی کہتے ہیں کہ جس چیز کی نذر مانی گئی ہے اس کی نسبت سبب
ملك کی طرف کی جائے تو نذر چھ ہے۔ اور اس کو پورا کرنا ضروری ہے۔ مثل اگر بیکہ کر میں تنج خریدو نگا تو للہ تعالیٰ
کے لے میرے ذمہ کے تمہ کے آزاد کر دو۔ جب مجھی خریدی ہو جائے تو نذر کر دہ چیز لا زم ہو جائے گی۔ امام شافعی
رحمۃ للہ علیہ فرماتے ہیں اس طرح متعلق کرنا درست نہیں ہے۔ اور ایسی نذر کو پورا کرنا ضروری نہیں کیونکہ کسی چیز کو متعلق
کر کے کرنا اور اس کو متعلق نہ کر کے کرنا دونوں ایک ہی طرح ہیں۔ عدم ملك کی صورت میں جس طرح تخصیز لیجن
بغیر متعلق کے کرنا ممکن نہیں ہے اس طرح تعیق بھی درست نہیں ہے۔
اس کا جواب یہ کہ تعیق مثالاً ان اشتر یتک فللہ علی ان اعتقک "(اگر میں تنج خریدو لگا تو
اللہ تعالیٰ کے لے میرے ذمہ کے آزاد کرنے ہے) اگر تعیق جملہ میں فی الحال مو جود ہے لیکن جس چیز کی نذر کی جارہی
ہے وہ شرط کے پائے جانے پر ہی پانی جائے گی اور اس وقت وہ ملکیت بھی پانی جائے گی جونذر کو پورا کرنے کے لے
ضروری ہے۔ اس کے برخلاف پیکہ نا" ان شفی اللہ مریضی فالعبد الفلانی حر "(اگر اللہ تعالیٰ میرے
مریض کو شفاف پیرے تو فلال کا غلام آزاد ہے) جواس کی ملکیت میں نہیں ہے کیونکہ یہاں ایسی صورت میں ملکیت کا
کوئی نام و نشان نہیں ہے، نہ فی الحال نہ بعد میں۔ اس لے ایسی تعیق کے ساتھ نذر درست نہیں ہوتی۔ جسیا کہ غیر
کی ملکیت میں بغیر تعیق کے نذر درست نہیں ہوتی۔ حضور پاک صلی اللہ علیہ وسلم کے ارشاد و لا فیما لا یملک
العبد "کو ای پرمول کیا جائے گا۔ امام شافعی رحمۃ للہ علیہ کا اس سے استدلال کرنا درست نہیں ہے۔ (اشعتہ

Aishah (may Allah be pleased with her) narrated: The Messenger of Allah (ﷺ) said: “There is no vow in disobedience, and its expiation is the expiation of an oath.” [Narrated by Abu Dawud, Tirmidhi, Nasa’i, and Ibn Majah, and authenticated by Tahawi and Abu Ali ibn as-Sakan]
Muslim narrated from Imran ibn Husayn (may Allah be pleased with him) that he said: The Messenger of Allah (ﷺ) said: “There is no fulfillment for a vow in disobedience, nor in what a servant does not possess.” In a narration by him from Uqbah ibn Amir (may Allah be pleased with him), the Messenger of Allah (ﷺ) said: “The expiation of a vow is the expiation of an oath.”
Nasa’i narrated from Imran ibn Husayn (may Allah be pleased with him) that he said: I heard the Messenger of Allah (ﷺ) say: “A vow is of two types: Whoever vows in obedience to Allah, that is for Allah, and it must be fulfilled. Whoever vows in disobedience to Allah, that is for Satan, and there is no fulfillment for it, and he expiates it with what expiates an oath.”
(1) The statement: “There is no vow in disobedience, and its expiation is the expiation of an oath”: Know that if a vow is for an act of obedience, it is binding by consensus. If it is for a sin, fulfilling it is not permissible. There is disagreement regarding its formation. Its apparent meaning is that it does not form at all, and a vow of disobedience is invalid, with no expiation. This is the view of Shafi’i. It is also said that a vow of disobedience forms as an oath, with no fulfillment, but it requires expiation. This is the view of Abu Hanifah, and perhaps this narration is what Tahawi adopted. He said: If a vow is associated with sins, such as “It is upon me to kill so-and-so,” it is an oath, and expiation is required for breaking it. This is supported by the hadiths mentioned in this chapter. This is the essence of what is in “As-Sindhi,” “Al-Kawkab ad-Durri,” “Radd al-Muhtar,” and “Al-Mirqat.” Whoever seeks a detailed explanation of the school should refer to “Al-Urf ash-Shadhi.” The author of “Al-Mabsut” narrated that Sha’bi (may Allah be pleased with him) said: There is nothing upon a vow of disobedience, because sins are not obligated by a vow, and expiation is a substitute for the obligatory fulfillment of an oath or the obligatory fulfillment of a vow, which does not exist in disobedience. It is narrated that Abu Hanifah (may Allah be pleased with him) visited Sha’bi and asked him about this issue. He said: There is nothing upon him, because what is vowed is a sin. Abu Hanifah said: Is not the declaration of prohibition a sin, yet Allah commanded expiation for it? Sha’bi was perplexed and said: You are one of the opinionated. It is stated in “Al-Alamgiriyyah”: If one vows something that is a sin, it is not valid, but if he does it, expiation is required. It is stated in “Nayl al-Awtar”: There is disagreement regarding a vow of disobedience and whether expiation is required. The majority said: No. Ahmad, Thawri, Ishaq, some Shafi’is, and Hanafis said: Yes. Tirmidhi narrated the disagreement of the companions on this. They agreed on prohibiting a vow in disobedience, and their disagreement is only regarding the obligation of expiation. Those who obligated it cited the hadith of Aishah mentioned in this chapter and what is similar to it. The statement: “There is no vow in disobedience” does not mean it does not form at all, as that would not suit the statement “and its expiation is the expiation of an oath.” Rather, it means there is no fulfillment for it. This is explicit in some authentic narrations, which state: “There is no fulfillment for a vow in disobedience.” [Stated in “Fath al-Wadud”]
(2) The statement: “There is no fulfillment for a vow in disobedience”: This is because the validity of a vow and the obligation to fulfill it require conditions, including that the vow be an act of drawing closer to Allah, the Exalted, and that it not be a sin if it is inherently forbidden, with no aspect of worship. If it has an aspect of worship but is forbidden for another reason, the vow is valid, such as vowing to fast on the day of sacrifice. If he fasts, he fulfills the obligation but sins, and it is better to fulfill it by fasting another day. [Stated in “Al-Fath”] Another condition is that the vowed act not be obligatory upon him before the vow. If he vows the obligatory pilgrimage, the noon prayer, or the like, nothing else is required. Another condition is that the vowed act not exceed what he possesses or be something he does not own. If he says about another’s sheep: “It is upon me to slaughter it on the day of sacrifice,” the vow is not valid. Another condition is that it not be impossible, such as vowing to fast yesterday or perform retreat therein, which is not valid. Another condition is that the vowed act be of a type that is legally obligatory, meaning what includes the mandated and the obligatory in technical terms, specifically the mandated. Thus, the vower is not obligated by what is not of a type obligatory by the vow, such as vowing to escort a funeral or enter a mosque. Another condition is that it be an intended act of worship, so vowing ablution, shrouding the dead, ritual bathing, or the like is not binding. [Taken from “Umdat ar-Ri’ayah” and “Radd al-Muhtar”]
(3) The statement: “Nor in what a servant does not possess”: Its example is saying: “If Allah heals my sick person, such-and-such slave, who is not in my possession, is free.” If he later acquires it, he is not required to fulfill the vow, unlike if he suspends the emancipation of a slave he owns, as it is emancipated upon acquisition according to us. This is because a condition for the validity of a vow, according to us, is that the vowed act be owned by the vower or associated with the cause of ownership, such as saying: “If I buy you, it is upon me to emancipate you for Allah.” The disagreement regarding a vow is like the disagreement regarding divorce before marriage. The Hanafis, by analogy to the effects of suspending divorce on ownership or its cause, say: If the vowed act is associated with the cause of ownership, it is valid, and he must fulfill the vow. For example, if he says: “If I buy you, it is upon me to emancipate you for Allah,” when the purchase occurs, the vowed act occurs. Shafi’i said: This suspension is not valid, and he is not required to fulfill the vow, because suspension is like immediate execution. Just as immediate execution is not possible without ownership, suspension is not valid. The response is that suspension, such as saying: “If I buy you, it is upon me to emancipate you for Allah,” exists at the time, but the vowed act occurs when the condition is met, at which point ownership is realized, allowing fulfillment of the vow. This is unlike saying: “If Allah heals my sick person, such-and-such slave, who is not in my possession, is free,” as ownership has no effect there, neither immediately nor later, so the vow is not valid with this suspension, just as an immediate vow without ownership is not valid. Thus, the statement “nor in what a servant does not possess” is understood accordingly. Shafi’i’s inference from it is not valid. کہ آپ علیہ صلی اللہ نے ارشاد فرمایا نذر کا کفارہ قسم کا کفارہ ہے۔ (مسلم)
عقبر بن عامر رضی اللہ تعالی عنہ رسول اللہ صلی علیہ وسلم سے روایت کر ے ہیں
عمران بن حسین رضی اللہ تعالی عنہما سے مروی ہے انہوں نے کہا کہ میں نے
رسول اللہ صلی اللہ علیہ وسلم کو فرماتے ہوئے سناتا کہ نذر کی دو قسمیں ہیں:
(1) جو آدمی اللہ تعالی کی اطاعت میں نذر مانے تو وہ اللہ تعالی کے لئے ہے۔ اس کو پورا کرنا ہے۔
(2) اور جو آدمی معصیت کی نذر مانے تو وہ شیطان کے لئے ہے۔ اس کو پورا کرنا نہیں ہے۔
اور اس کا کفارہ وہی ہے جو تم کا کفارہ ہے۔ (نسائی)
I heard the Messenger of Allah ﷺ say: 'There are two types of vows: (1) If a person makes a vow to obey Allah, then it is for Allah, and it must be fulfilled. (2) And if a person makes a vow to disobey, then it is for Satan, and it should not be fulfilled. And its expiation is the same as your expiation.' (Nasai)
ام المؤمنین بی بی عائشہ رضی اللہ تعالی عنہا سے روایت سے کہ رسول اللہ صلی اللہ
علیہ وسلم نے ارشاد فرمایا کہ جو آدمی نذر مانے تو وہ اللہ تعالی کی اطاعت کرے گا تو اس کو چاہے
کر اطاعت کرے۔
۔ قو له من نذر ان يطيع اللہ فليطعه الخ (جو آدمی نذر مانے کروہ اللہ تعالی کی اطاعت کرے گا تو اس
کو چاہے کروہ اطاعت کرے۔) ثخ ابن همام نے فرمایاہے اگر نذر کو کسی شرط کے ساتھ معلق کرے پھروہ شرط پانی
جاۓ تو اس کے ذمہ اس نذر کو پورا کرنا ضروری ہے۔ کیونکہ نذر کے بارے میں احادیث شریفہ مطلق ہیں یعنی
تخجیز اور تعیق کی قید کے بغیر نذر کو پورا کر نے کا حکم دیا گیاہے۔ اور یاس لئے کہ جو نذر شرط کے ساتھ ہے وہ شرط
کے پائے جانے کے وقت بغیر شرط کی نذر کی طرح سے ہے۔ گویا یہ للہ علی کذا، بغیر شرط کے کہنے کی طرح سے
ہے۔ حضرت امام اعظم ابو حنیفہ رحمۃ اللہ علیہ سے روایت سے کرآپ نے نذر جب کسی شرط کے ساتھ معلق ہوتا س نذر
کی چیز کو پورا کرنا ضروری قرار دینے کے قول سے رجوع فرمایاہے۔ یعنی اب اس کو اختیار ہے وہی نذر کی ہوتی چیز پورا
کرے یا کفارہ دے۔ اور یہی قول امام محمد رحمۃ اللہ علیہ کہہ۔ بلکہ یہ کہ کرگیا ایسا کام کرولگا تو میرے ذمہ
ایک نہ ہے۔ ایک سال کے روز میں تو اس کو اختیار ہے۔ ایک نہ کرے۔ ایک سال کے روز میں رکے یا چاہے تو
کفارہ دے۔ اگر تقدست ہے تو اس کو اختیار ہے کر وہ سال بھر کے روز میں رکے یا دو روز میں کے ذریعہ ہے۔
کفارہ دے لیکن ظاہر روایت میں خاص نذر کو پورا کرنا لازم ہو نے کا ذکر ہے۔ اور نوادر میں امام اعظم ابو حنیفہ رحمۃ اللہ
کے قول میں نذر کی چیز پورا کر نے یا کفارہ دینے کا اختیار ذکور ہے۔۔۔۔بقیہ اگلے صفحے پر۔۔۔
۔۔۔ ماہی حاشیہ۔۔۔ عبد العزیز بن خالد رضی اللہ تعالیٰ عنہ روایت سے کہ انہوں نے کہا کہ میں نے کے ارادے سے نکلا اور جب کوفہ داخل ہوا تو کتاب النذور والکفارات سیدنا امام ابوحنیفہ رحمۃ اللہ علیہ کے پاس پڑھا اور جب اس مسئلہ پر پیچھا تو آپ نے فرمایا کہ ظہر جائے کیونکہ میری راہ اب پیہ کے میں اس سے رجوع کرول اور جب میں سے واپس ہوا تو اس وقت تک سیدنا امام ابوحنیفہ رحمۃ اللہ علیہ کا وصال ہو چکا تھا و لیہ بن ابان نے پیتا کرآ پہ نے اپنے انتقال سے سات دن پہلے اس قول سے رجوع کیا اور فرمایا کہ اس کو ( نذر پورا کرنے یا کفارہ دین ) کا اختیار سے امتحان زاہد کی اس قول پر فتوی دیتے تھے امام ولوا بی نے فرمایا کہ شہر تھا اور بخارا کے علماء اس پر فتوی دیتے تھے شمس الامام نے اس کو اختیار کیا سے اور فرمایا کہ حکم اس زمانے میں کثرت ابتلاء کی وجہ سے ہے اور طاہر روایت کی وجہ قرآن پاک کی آیت اور احادیث ثریف کے نصوص میں اور نوادر کی روایت وہ حدیث پاک کے جوسلم ثریف میں ہے کے عقیدہ بن عامر ضی اللہ تعالیٰ عنہ سے روایت سے کر سول اللہ صلی اللہ علیہ وسلم نے ارشاد فرمایا نذر کا کفارہ میں کا کفارہ ہے اور اس کا تقاضہ پیہ کے کفارہ سے مطلقاً نذر ساقط ہو جائے اس میں تعارض کو دور کرنے کے لئے شیعی معیین کے پورا کرنے کو بغیر شرط کے نذر پر محمل کیا جائے گا اور کفارہ کے ذریعہ سقوط کونزہ محل پر محمل کیا جائے گا اباس میں کوئی اشكال نہیں ہے کیونکہ نذر محلق فی الحال مشتق ہے اور اس میں نذر ثابت نہیں ہے اس لے پیند رشم کی طرح سے اس معنی میں کے کفارہ کو اجب کرنے کا سبب قسم کو توڑ ناہے اور پی ( خش ) جس وقت کلام کیا جارہا ہے غیر موجود ہے پس اس کو تم کے ساتھ ملت کیا جائے گا برخلاف نذر غیر محلق کے کوہ نذر فی الوقت ثابت ہے پس اس میں شیعی معیین کو پاکرنے کی حدیث پر عمل کیا جائے گا مصنف رحمۃ اللہ علیہ اور محققین کے پاس ایک شرط جس میں کفارہ کافی ہو جاتا ہے اس سے مرادہ شرط ہے کر جس کے کے جانے کا ارادہ ہو مثلًا گهر میں داخل ہونا ایفلان سے کلام کرنا وغیرہ کیونکہ جب محلم کا مقصد اس کا عدم وقوع سے تو اس سے بات معلوم ہوتی ہے کر جس چیز کی نذر لی گئی وہ محی مقصود نہیں ہے کیونکہ اس میں ایک شرط لگا کر رکاوٹ قائم کی گئی ہے نذر کو ایک شرط پر محلق کرنا جس کا وقوع مقصود نہیں ہے تو خود کوہی اس نذر سے رونا مقصود سے کیونکہ انسان میش عبادت کرتے رہنے کو اجب نہیں کر لیتا اگر پچیلے اس سے ثواب حاصل ہوتا ہے کیونکہ اس میں اندیشہ ہے کر اس کو پورا کرنا مشکل ہو جائے گا بلکہ ہوسکتا ہے کہ وہ عذاب کا سبب بن جائے اس کے تیج حدیث ثریف میں ہے کے حضور صلی اللہ علیہ وسلم نے نذر سے منع فرمایا کہ انہ لايات بخیر ( بخیر کوئی لاتی ) اب رہا لیکن شرط جس کا وقوع مطلوب ہے مثلًا پول کہ کے اللہ تعالیٰ میرے پیار کو شفا دے پیمر اغا تب ہوں والا آجا یا میرا دشمن مر جائے اللہ تعالیٰ کے لئے میرے ذم ایک مہیں کے بقیہ اگلے صفحہ پر۔۔۔
اور جو آدمی معصیت کی نذر مانے تو وہ معصیت کا کام نہ کرے۔ (بخاری نے روایت کی ہے)
مسلم کی ایک روایت میں ہے "لانذر فی معصیۃ الله" اللہ تعالیٰ کی نافرمانی
میں کوئی نذر نہیں ہوتی۔
Whoever makes a vow to obey Allah, then let him obey Him willingly.
1. If someone makes a vow to obey Allah, then let him obey Him. (If a person vows to perform an act of obedience to Allah, then he must fulfill that vow.) Ibn Humam has stated that if a vow is made conditional upon a certain condition, and that condition is met, it becomes obligatory for the person to fulfill the vow. This is because the ahadith regarding vows are absolute, meaning that the command to fulfill a vow is given without any restrictions or delays. And this is because a vow that is made conditional becomes unconditional when the condition is met. It is as if one says, 'For Allah, I will do such and such,' without mentioning the condition. According to the narration from Imam Abu Hanifah (RA), he initially held the view that if a vow was made conditional, it was necessary to fulfill the vow once the condition was met. However, he later retracted this view and held that the person has the option to either fulfill the vow or pay the expiation. This is also the view of Imam Muhammad (RA). He said, 'If I do such a thing, then I have one obligation; if I do not do it within a year, then I have the option to either do it or pay the expiation.' If it is possible, he has the option to delay it for a year or pay the expiation through two days' worth of fasting. The apparent narration states that it is obligatory to fulfill a specific vow. In the Nawadir, it is mentioned that according to Imam Abu Hanifah (RA), the person has the option to either fulfill the vow or pay the expiation. ... The rest is on the next page. ... This is a marginal note. ... Abd al-Aziz ibn Khaled (RA) narrated that he said, 'I left with the intention and when I entered Kufa, I read the book of vows and expiations with Imam Abu Hanifah (RA). When we reached this issue, he said, 'It appears that my way is now to retract from this view, and when I returned, Imam Abu Hanifah (RA) had already passed away. Therefore, Ibn Abban narrated that he retracted from this view seven days before his death and said, 'I would give fatwa based on the view that the person has the option to either fulfill the vow or pay the expiation.' Imam al-Walibi said, 'This was the practice in the city, and the scholars of Bukhara gave fatwa based on this view.' Shams al-A'immah said, 'The command in this era is due to the prevalence of trials, and the authentic narration is based on the verses of the Holy Quran and the texts of the noble ahadith. The narration in the Nawadir is based on the hadith from Ibn Umar (RA) that the Prophet (SAW) said, 'There is expiation for a vow, and if the expiation is paid, the vow is nullified.' To resolve the contradiction, the specific fulfillment of the vow will be considered as an unconditional vow, and the nullification of the vow through expiation will be considered in its proper place. There is no difficulty in this, as the vow in question is currently derived and not established. Therefore, the expiation is not a means of breaking the vow, but rather a means of fulfilling it, as the object of the vow is not present at the time of the vow. Conversely, for a non-conditional vow, the vow is established at the time, so the specific fulfillment of the vow will be based on the hadith. The author (RA) and the scholars consider a condition where expiation is sufficient, which refers to a condition whose occurrence is intended, such as entering a house or speaking in a certain language, because when the purpose of the condition is the absence of its occurrence, it is clear that the object of the vow is not the intended purpose, as a condition has been placed to prevent it. Making a vow conditional on something whose occurrence is not intended is itself a means of avoiding the vow, as a person does not usually continue to worship if they have already received reward for it, because there is a concern that fulfilling the vow may become difficult, and it could even lead to punishment. This is indicated in the noble hadith where the Prophet (SAW) prohibited making vows, saying, 'Do not make vows, for they do not change anything, but they may cause you to sin.' However, if the condition is something whose occurrence is desired, such as if Allah cures my beloved, then I will do such and such, or if my enemy dies, then I will do such and such for Allah, the rest is on the next page. And if someone makes a vow to commit a sin, then he should not commit that sin. (Bukhari has narrated this.) In a narration from Muslim, it is stated, 'There is no vow in disobedience to Allah,' meaning that no vow can be made to disobey Allah.
ماقی حاشیہ روزے میں اس میں اگر شرط پانی جائے کی تو اس نذر کردہ عین شیء (اس نذر کی ہونی چیز ہے)
کا پورا کرنا ضروری ہے۔ کیونکہ جب اس کے پاس شرط کا تو ع مطلوب ہوا تو نذر کی اس کی مقصود ہی تو یہ زر، غیر متعلق
نذر کی طرح ہے۔ لہذا اگر متعلق کا حکم جاری ہو گا۔ لیجن اس کو پورا کرنا ضروری ہے۔ لیجن عین شیء منزور کو پورا کرنا ہو گا
اور اس کو تخجیر یعنے پرمحل کیا جائے گا۔
اور کفارہ کی کافی ہو نے کو ایسی نذر متعلق پرمحل کیا جائے گا جس کا ہونا مقصود ہو بعض فقہاء نے اس کا نام
نذر اللہ کہا ہے (انصہ)
اور تانج کعبی حدیث شریف کو ایسی نذر متعلق پرمحل کیا جائے گا جس کا تو ع مقصود ہیں ہے۔ اگر اس کو توڑ
دے گا تو کفارہ واجب ہو گا۔
حضرت امام شافعی رحمۃ اللہ علیہ فرما تے ہیں کہ نذر مانے والاجب اس پر عمل کرے کا تو اس پر قسم توڑنے کی
طرحا کافارہ کافی ہو جائے گا۔
اور حضرت امام محمد رحمۃ اللہ علیہ اپنی موطا میں ظاہر روایت کو اختیار کرتے ہوئے فرما تے ہیں کہ ہمارے پاس
پیندیدہ پیہ کا س نے اپنے نفس پر جس چیز کو عام کر لیا ہے اس کو پورا کرے اور اس کو ضرورت کی حد تک رکے لے
کر صدقہ دے اور جب مزید مال فراہم ہو جائے تو جس قدرو کا حق اس کے مثل صدقہ میں دے دے۔
۔ قولہ ومن نذر ان يعصیه فلا يعصه (اور جو معصیت کی نذر مانے وہ معصیت کا کام نہ کرے) اس میں
بات کی دلیل ہے کہ جو آدمی طاعت لیجن نیک کام کی نذر مانے تو اس کو پورا کرنا ضروری ہے اگر چیز کی چیز کے ساتھ اس کو
متعلق لیجن مشروط نہ کیا ہوا اور جو آدمی کسی معصیت لیجن نا فرمانی کے کام کی نذر مانے تو اس کو پورا کرنا جائز نہیں ہے۔ اور کفارہ
ہی لازم نہیں آتا تو کیونکہ اگر کفارہ لا زم آتا تو حضور پاک صلی اللہ علیہ و آلہ وسلم اس کو ضروری نہ کرتے۔ (شرح السنہ)
صاحب مرقات نے فرما اس بات کو جانو کہ کیمیں اور نذر دونوں کے درمیان فرق ہے اور علماء کا اس بات پر
اتفاق ہے کہ قسم، خواہ وہ قسم طاعت کی ہو، یا معصیت کی، یا کسی امر مباح کی اس کو پورا نہ کرنے سے کفارہ لا زم آتا ہے
لیکن نذر کا جہا ل تک تعلق ہے اگر وہ طاعت میں ہے لیجن نیک کام کے لیے ہے تو اس کو پورا کرنا ضروری ہے اور اگر
معصیت کی ہے تو پورا کرنا درست نہیں ہے البتراس میں کفارہ کے واجب ہو نے۔ بقیہ اے گل صفحہ پر۔
Aishah (may Allah be pleased with her) narrated: The Messenger of Allah (ﷺ) said: “Whoever vows to obey Allah, let him obey Him, and whoever vows to disobey Him, let him not disobey Him.” [Narrated by Bukhari] In a narration by Muslim: “There is no vow in disobedience to Allah.”
(1) The statement: “Whoever vows to obey Allah, let him obey Him, etc.”: Shaykh Ibn al-Humam said: If a vow is suspended on a condition, and the condition is met, he must fulfill the specific vow, due to the generality of this hadith and others, as it commands it without restriction to immediate or suspended vows. A suspended vow is like an immediate one for him, as if he said upon the condition: “It is upon me to do such-and-such.” It is narrated from Abu Hanifah (may Allah be pleased with him) that he retracted from it, meaning from the obligation to fulfill the specific vowed act if it is suspended on a condition, so he has the choice between performing it specifically or offering the expiation of an oath. This is the view of Muhammad. If he says: “If I do such-and-such, it is upon me to perform a pilgrimage or fast a year,” he may perform the pilgrimage or fast a year if he wishes, or offer expiation if he wishes. If he is poor, he has the choice between fasting a year or fasting three days. The first view, which is the obligation to fulfill it specifically, is mentioned in the apparent narration. The choice is narrated from Abu Hanifah in the rare narrations. It is narrated from Abdul Aziz ibn Khalid at-Tirmidhi, who said: I set out for pilgrimage, and when I entered Kufa, I read the book of vows and expiations to Abu Hanifah. Thus, the absolute fulfillment specifically is interpreted as applying to immediate vows, and the absolution by expiation applies to suspended vows. There is no issue, as a suspended vow is non-existent at the time, so the vow is absent, making it like an oath in that the cause of obligation, which is breaking, is absent at the time of speaking, so it is associated with it, unlike an immediate vow, which is an established vow at its time, so the hadith of fulfillment applies to it. The author and the verifiers chose that the condition where expiation suffices is one not intended to occur, such as entering a house or speaking to so-and-so. If he does not intend its occurrence, he knows he does not intend the vowed act, as he made it a deterrent from fulfilling that condition, because suspending a vow on something he does not intend to occur is necessarily to prevent himself from it. A person does not always intend to obligate acts of worship, as they may be burdensome, exposing him to punishment, even though they bring reward. Hence, it is authentically reported that he prohibited vows and said: “It does not bring good” in the hadith. As for a condition he intends to occur, such as saying: “If Allah heals my sick person, my absent one returns, or my enemy dies, it is upon me to fast a month,” if the condition is met, only performing the specific vowed act suffices, because if he intends its occurrence, he intends the vow, making the vow equivalent to an immediate one, falling under its ruling, which is the obligation to fulfill it. Thus, what implies fulfillment applies to immediate vows and suspended vows intended to occur, and what implies the sufficiency of expiation applies to suspended vows not intended to occur, which is called by some jurists the vow of obstinacy. The hadith of the Ka’bah’s door latch is interpreted according to us as a suspended vow not intended to occur, so expiation suffices if he breaks it. Shafi’i said: If he does that act, he must offer the expiation of an oath, as if he broke his oath. Muhammad in “Al-Muwatta” adhered to the apparent narration and said: It is preferable to us that he fulfills what he obligated upon himself, gives charity with it, and retains what he misses. (2) The statement: “And whoever vows to disobey Him, let him not disobey Him”: This is evidence that whoever vows an act of obedience must fulfill it, even if it is not suspended on anything, and whoever vows a sin, fulfilling it is not permissible, nor is expiation required, as he would have clarified it if it were. [Stated in “Sharh as-Sunnah” and “Al-Mirqat”] Know that there is a difference between an oath and a vow. They agreed that expiation is required for breaking an oath, whether it is for obedience, disobedience, or a permissible act. As for a vow, if it is for obedience, it is binding by consensus, and if it is for disobedience, fulfilling it is not permissible. They disagreed regarding the obligation of expiation for it. Abu Hanifah, Malik, and Shafi’i said: No expiation is required. There are two narrations from Ahmad: one is that it forms, but fulfilling it is not permissible, and expiation is required; this is another narration from the Hanafis. The conclusion is that according to us, there are two views regarding a vow of disobedience: the first is Tahawi’s view of the obligation of expiation, and the second is that the basis of our school is that if one vows a sin, there is no fulfillment or expiation. حضرت ابن عباس رضی اللہ تعالیٰ عنہما سے روایت ہے انہوں نے کہا نبی اکرم صلی اللہ علیہ وآلہ وسلم خطبہ ارشاد فرمادے تھے اس دوران آپ علیہ صلاۃ و السلام کے ساحب کٹرے ہوئے ہیں تو آپ علیہ صلاۃ و السلام کے بارے میں دریافت فرمائی صحابہ نے عرض کیا کہ یہ ابوسرائیل ہیں جوی منت مانے تھے کہ وہ کٹرے رہیں گے، مطیعین گے نہیں، ساپی میں نہیں رہیں گے، بات نہیں کریں گے اور روزہ رکھیں گے۔ نبی کریم صلی اللہ علیہ وسلم نے (یعنی) فرمائی تم ان کو یہ حکم سنادو کہ وہ بات کریں اور سائیت فاندہ اٹھا لیں اور پیٹھجا کیلی البتر روزہ کو پورا کریں (بخاری)
ماقی حاشیہ کے بارے میں علماء کا اختلاف ہے۔ امام اعظم ابوحنیفہ، امام ماک اور امام شافعی رحمہم اللہ تعالیٰ فرماتے ہیں اس میں کفارہ نہیں ہے۔ اور حضرت امام احمد رحمہ اللہ علیہ دور روايتیں ہیں۔ ایک روایت میں ہے کہ پیڑز منعقد ہوجاتی ہے کیا اس کو پورا کرنا جائز نہیں ہے البتر کفارہ واجب ہے اور خفیہ سے ایک دوسری روایت میں ایسا ہے۔ خفیہ کے اس حکم کا خلاصہ یہ ہے، نذر معصیت کے متعلق دو قول ہیں۔ پہلا قول یہ ہے کہ کفارہ واجب ہے۔ اس کو امام طحاوی نے اختیار کیا ہے اور دوسرا قول ہمارا اصل نذہب ہے وہ یہ ہے کہ نذر معصیت کی نذر میں تواس کون پورا کرنا ہے کفارہ ویتا ہے۔ (رحمۃ اللہ، رواختار، عرف الشذی)
۔ قولہ: مروہ فليتكلم الخ (الن کو یہ حکم سنادو کہ وہ بات کریں) اس میں اس بات کی ویل ہے کہ مروہ چیز جس سے انسان کو تکلیف ہوتی ہے اور کتاب وسنہ میں اس کی مشروعيت کا کوئی ذکر نہیں ہے جسے برہمنہ پیچر چلتا، وصوب میں بیچنا، پر اللہ تعالیٰ کی اطاعت لیتن نہیں میں سے نہیں ہے۔ اور اگر نذر اطاعت میں نہ ہوتا وہ معصیت ہو جاتے گی اور معصیت، اطاعت خداوندی کے خلاف ہے۔ پیل ایک نذر منعقد نہیں ہوتی اس لے رسول اکرم صلی اللہ علیہ وسلم نے اس حدیث ثریف میں ابوسرائیل رضی اللہ تعالیٰ عنہ کصرف روزہ پورا کر نے کا حکم فرمایا اور اس کے علاوہ دوسری چیز ون کے لے حکم نہیں فرمایا۔ اور اس کواس بات پر محول کیا جاتے گا کہ حضرت صلی اللہ علیہ وسلم اس بات کو جاتے ہیں کہ پیچیر (روزہ رکھنا) ان کے لے مشقت کا باعث نہیں ہے۔

They said: It is Abu Isra’il, who vowed to stand and not sit, not seek shade, not speak, and fast. In a narration by Ahmad and Tabarani, the Messenger of Allah (ﷺ) looked at a Bedouin standing in the sun while delivering a sermon and said: “What is your matter?” He said: “I vowed, O Messenger of Allah, not to move from the sun until you finish.” The Messenger of Allah (ﷺ) said: “This is not a vow. A vow is only what seeks the countenance of Allah.”
(1) The statement: “Order him to speak, etc.”: This is evidence that anything that harms a person, which is not prescribed by the Book or Sunnah, such as walking barefoot or sitting in the sun, is not an act of obedience to Allah, the Exalted. If his vow is for something other than obedience, it is a sin, as disobedience is the opposite of obedience, so the vow does not form. He ordered Abu Isra’il in this hadith to complete the fast, which is understood as him knowing it was not burdensome for him. Qurtubi said regarding the story of Abu Isra’il: This is the greatest evidence for the majority that no expiation is required for one who vows a sin or something that is not obedience. If one vows a permissible act, such as saying: “It is upon me to walk to my house, ride my horse, or wear my garment,” there is nothing upon him according to Abu Hanifah and Malik. Shafi’i said: If he violates it, he is obligated by it and has the choice between fulfilling it or offering expiation. Among the evidence for the obligation to fulfill a vow of a permissible act is the story of the woman who vowed to play the tambourine. We say: Playing the tambourine is not among the acts of obedience associated with vows, and at best, it is permissible. However, as it was connected to expressing joy for the safe return of the Messenger of Allah (ﷺ) from one of his expeditions, and it involved humiliating the disbelievers and vexing the hypocrites, it became akin to some acts of worship. Similar to this is the statement of the Prophet (ﷺ) regarding satirizing the disbelievers: “Satirize Quraysh, for it is harder on them than a shower of arrows.” They disagreed about a man who vows as a polytheist and then becomes Muslim. Shafi’i and Ahmad said: If a man obligates something upon himself during his polytheism, such as retreat, charity, or something Muslims obligate for Allah, then becomes Muslim, it is obligatory upon him. Ibrahim an-Nakha’i, Thawri, Abu Hanifah, Abu Yusuf, Muhammad, Malik, Shafi’i in one opinion, and Ahmad in a narration said: Nothing is obligatory upon him. They argued with the hadith of Aishah: “And whoever vows to disobey Him, let him not disobey Him,” and the hadith of Shu’ayb: “A vow is only what seeks the countenance of Allah.” This indicates that vows are only obligatory if they are acts of drawing closer to Allah, the Exalted, and not obligatory if they are sins against Allah. If a disbeliever says: “It is upon me to fast” or “It is upon me to perform retreat,” if he does it, he is not drawing closer to Allah, as he intended what he worshipped besides Allah, which is a sin. 1- قولاً نذر الا فيما ابتغى به وجه الله تعالى (آدی جس چیز ولے اللہ تعالیٰ کی خوشنوی حاصل کرسکتا ہے ان کے سوا کسی چیز کی نذر درست نہیں)۔ - پیغمبر کریم صلی اللہ علیہ وسلم نے اس بات پر دلالت کرتے ہیں کہ مباحات میں نذر منعقد نہیں ہوتی مثلًا اگر کوئی امر مباح کی نذر مانے اور پیغمبر کر اللہ تعالیٰ کے لئے میرے ذمہ کے حرمت کے پیشلے چلو نگا اپنے گھوڑے پرسوار ہونگا اپنے کپڑے پہنونگا تو حضرت امام اعظم ابوحنیفہ اور امام ماکر رحمۃ اللہ علیهما کے پاس اس کے ذمہ کوئی چیز نہیں ہے امام شافعی رحمۃ اللہ علیہ فرماتے ہیں اگر چہ اس کی نذر وری نہیں ہے مگر اس کے خلاف کرنے سے کفارہ لازم آتا ہے۔ امام احمد رحمۃ اللہ علیہ فرماتے ہیں اس سے نذر منعقد ہوجاتے گی لیکن اس کو اختیار ہے چاہے تو پورا کرے یا کفارہ دے اور مجمل ان دوال کے جس سے نذر مباح کو پورا کرنے پر استدلال کیا گیا ہے اس خاتون کا قصہ جس کے جس کے دفع جانے کی نذر مانی گئی۔ تم کہتے ہیں کہ دفع جانا الطاعت کے امور میں سے نہیں ہے کہ جس سے نذر متعلق ہوتی ہے البہر تو جہیہ ہوسکتی ہے کروہ مباحات کے قبل سے مگر جب رسول اللہ صلی علیہ وسلم کی ایک غزوہ سے پسلا کی تشریف آوری کے اظهار کی خوشی اس کے ساتھ شال ہوگئی جو کافر ون کو بری لگتی ہے اور اس میں منافقوں کی ذلت و خواری ہے۔
عمر و بن شعیب رضو اللہ تعالیٰ علیہما اوروہان کے دادا کے روایت کرتے ہیں کہ نبی صلی اللہ علیہ وسلم نے ارشاد فرمایا آدی جس چیز ولے اللہ تعالیٰ کی خوشنوی حاصل کرسکتا ہے اس کے سوا کسی چیز کی نذر درست نہیں۔ -1 (احمد، البوداوودیہ)
ہے تو اس طرح فعل امور تقرب میں سے ہوگیا۔ اور اسی معنی میں حضرت صلی اللہ علیہ وسلم کا کافروں کی بجوکے لئے ارشاد فرمایا کہ کفار قریش کی بجوکرو کیون کہ بیان پر تیر بر سانے سے زیادہ شدید ہے۔ پھر علماء کا اختلاف ہے اس آدی کے بارے میں جس کے حالت شرک میں کسی چیز کی نذر مانی پھر مسلمان ہوگیا حضرت امام شافعی اور امام احمد رحمہ اللہ کے نہیں پیہ کر آدی اپنے نفس پر حالت شرک میں کوئی چیز واجب کر لے جسے اعتکاف یا صدقہ کرنا آدی کوئی چیز واجب کر لے جواللہ تعالیٰ کے لئے مسلمان اپنے ذمہ واجب کر لیتے ہیں پھر وہ شخص مسلمان ہو جائے تو پیند راس پر واجب ہے۔ حضرت ابرہیم علیہ، امام ثوری، حضرت امام اعظم، امام ابویوسف، امام محمد، بقیہ اغل صحف پر۔۔۔
تلخیص میں حافظ صاحب نے اس حدیث کو بیان کیا ہے کہ اس کا مرتبہ ذکر نہیں کیا ہے۔

ماہق حاشیہ ___ امام ماکر رحمۃ اللہ علیہ اپنے ایک قول میں اور امام احمد رحمۃ اللہ علیہ کی
ایک روایت میں سے کہ اس پر کوئی چیز واجب نہیں ہوتی اور اس بارے میں حضرت سیدنا عاتک رضی اللہ تعالیٰ
عنہا کی حدیث سے استدلال کرتے ہیں۔ کہ جوآدمی معصیت کی نذر مانے تو معصیت نہ کرے۔ اور عمرو بن شعیب کی
حدیث سے جس ان کا استدلال ہے کہ نذر وہ ہے۔ جس سے اللہ تعالیٰ کی خوشنو دی مقصود ہوپس ان احادیث شریف سے
یہ بات ثابت ہوتی ہے کہ متنی اس وقت واجب ہوتی ہیں جب کہ وہ مجملہ ان چیزوں کے ہول جن سے اللہ تعالیٰ کا
تقرب حاصل کیا جاتا ہے اور اگر اللہ تعالیٰ کے احکام کیخلاف ورزی کی نذر مانی جائے تو وہ واجب نہیں ہوگی۔
اور ملاعلی قاری نے فرما یا: کہ ازکم بدی ایک بڑی، زیادہ سے زیادہ اونٹ سے بڑی کافی ہے۔ اونٹ کا جو حکم
ہے مستحب ہیاور کا فریضہ رما نے کہ اللہ کے لیے مجھ پر روزہ ہے۔ یا یکہ کہ اللہ کے لیے مجھ پر اعتکاف ہے۔ اور پھر
وہ اس کو پورا کرے۔ تو اللہ تعالیٰ کا تقرب اس کو حاصل نہیں ہوگا۔ اس لیے کہ جب یہذراپنے زم واجب کر با تھا اس کی
مراد اس کے وہ باطل معبد تھا جن کی خدا کے سوا وہ عبادت کرتا تھا۔ اور یہ معصیت ہے۔ رسول اللہ صلی اللہ علیہ وسلم
کے ارشاد کرائی لا نذر فی معصیة اللہ، میں یہ شاہ لے ہے (لہذا اس کو پورا نہیں کیا جاتے گا)۔

Similar to this is the statement of the Prophet (ﷺ) regarding satirizing the disbelievers: “Satirize Quraysh, for it is harder on them than a shower of arrows.” They disagreed about a man who vows as a polytheist and then becomes Muslim. Shafi’i and Ahmad said: If a man obligates something upon himself during his polytheism, such as retreat, charity, or something Muslims obligate for Allah, then becomes Muslim, it is obligatory upon him. Ibrahim an-Nakha’i, Thawri, Abu Hanifah, Abu Yusuf, Muhammad, Malik, Shafi’i in one opinion, and Ahmad in a narration said: Nothing is obligatory upon him. They argued with the hadith of Aishah: “And whoever vows to disobey Him, let him not disobey Him,” and the hadith of Shu’ayb: “A vow is only what seeks the countenance of Allah.” This indicates that vows are only obligatory if they are acts of drawing closer to Allah, the Exalted, and not obligatory if they are sins against Allah. If a disbeliever says: “It is upon me to fast” or “It is upon me to perform retreat,” if he does it, he is not drawing closer to Allah, as he intended what he worshipped besides Allah, which is a sin. حضرت عبد اللہ بن عباس رضی اللہ تعالیٰ عنہما سے روایت ہے کہ عقرب بن عامر کی بیٹی نے خانہ کعبہ تک پیل جانے کی نذر مانی 1 تو نبی اکرم صلی اللہ علیہ وسلم نے ان کو حکم فرمایا کہ وہ سوار ہو جائیں اور ایک حدیث کریں (قرآنی دیں)۔ ابوداود)
۔ قو ل نذر ت ان تمشی الی البيت اع (خانہ کعبہ تک پیل جانے کی نذر مانی) اس حدیث ثبوت کا مطلب یہ ہے کہ جب کوئی آدمی قسم کھائے کہ اگر وہ ایسا کام کرے گا تو خانہ کعبہ کو پیل جانے گا اور وہ اس کو پورا کرے تو قیاس جاہتا ہے کہ کوئی چیز اس پر لازم نہ آئے کیونکہ نذر اس وقت واجب ہوتی ہے جب کہ منظور (جس کی نذر مانی گئی) واجبات شرعیہ میں سے ہواور بیت اللہ کو پیل جانا ثر عاً واجب نہیں ہے کیونکہ اس میں جو چیز لازم کیا ہے وہ پیل چڑنا ہے پر اب اس کے ذمہ لازم نہیں آئے گا تو بد رجاولی وسری چیز لینی چاہیے لازم نہیں آ سکی گیراستحساناً (خلاف قیاس) اس کے ذمہ نہ یا عمرہ لازم ہو گا اور سیدنا علی رضی اللہ تعالیٰ عنہ نے مجھی اس طرح کی روایت آئی ہے اور اس لے مجھی کر عرف میں اس لفظ کا ذکر نہ یا عمرہ کے لے ہوتا ہے اور نذر راور قسموں میں عرف کا اعتبار ہے پس تم نے اس کواس سے مجازاً نہ یا عمرہ کا لازم آنا قرار دیا ہے کیونکہ کلام کا مقصود لوگوں کے لے اپنے مافی اضمیر کا ظہار کرنا ہوتا ہے جب کوئی لفظ کسی معنی میں مجازاً مستعمل ہو نے گلتا ہے تو وہ اس معنی میں حقیقت کی طرح سے ہو جاتا ہے پھر اس کو نہ یا عمرہ دونوں میں کسی ایک کو ادا کرنے کا اختیار رہے گا کیونکہ وہ دونوں کعبۃ اللہ سے متعلق ایسی عبادتیں ہیں کہ ان کی ادائیگی احرام کے بغیر اور اس مقام پر کے بغیر نہیں ہوسکتی۔ علما کا اس آدمی کے بارے میں اختلاف ہے جو بیت اللہ کے پیل جانے کی نذر مانے۔ امام شافعی رحمۃ اللہ علیہ فرما تے ہیں کہ اگر اس کو پیل چلنے کی طاقت ہے تو چلے، اگر چل نہیں سکتا تو سوار ہو جائے۔ اور ایک دم دے۔ (کبرا ذنہ کرے) اور حضرت امام اعظم ابوحنیفہ رحمۃ اللہ علیہ کے اصحاب فرما تے ہیں کہ چلنے کی طاقت ہو یا نہ ہو دم دے اور سوار ہو جائے۔ البتہ ہمارے پاس مستند یہ ہے کہ اس کا اختیار رہے گا چاہے تو پیل چل کیونکہ یا عمرہ صورت ہے اور اس میں اس کی نذر پوری ہو جائے گی۔ اور چاہے تو سوار ہو کر جائے۔ اس دومری صورت میں ایک بڑی ذنہ کرے۔ اس نے مجھ یا عمرہ میں ایک قسم کا تقسیم پیش کیا کیونکہ پیل چل کرنا افضل ہے اور اس لے مجھی کہ پیل طریقے سے مناسک کی ادائیگی کامل طور پر ہوتی ہے۔ پر اس روایت کی بناء پر ہے کہ حضرت عبد اللہ بن عباس رضی اللہ تعالیٰ عنہما جب ناپیا ہو گے تفر ما کرتے ہے مجھ کسی چیز پر اتنا افسوس نہیں جتنا کر نے کے لے پیل نہ چل سکنے پر ہے کیونکہ اللہ تعالیٰ نے پیل جانے والوں کا ذکر مقدم فرما یہ۔ ارشاد ہے "یاتوک رجال۔۔۔بقیہ اے غل صفحہ پر۔۔۔
روایت میں فتہم کا بھی ذکر ہے لیکن میں سمجھتا ہوں کہ یہ عبد اللہ بن عباس رضی اللہ تعالیٰ عنہما سے
ہے۔ اور امام طحاوی کی تفسیر میں ابوداؤد شریف کی روایت سے حضرت عبد اللہ بن عباس رضی اللہ تعالیٰ عنہما سے
ہے۔ (یعنی بڑی ذن کرنا ہے) تین دون کے روز سے حدیث کابل پین فتہم کافارہ نہیں۔ کیونکہ ظاہر پیہ کر کفارہ دین
ہے مراد جنايت کا کفارہ ہے اور پیحدیسے پچراس کے قائم مقام روزے پین اس طرح روایت میں تیپ ہو جائی
ہے کہ اس خاتون (عقہبن عامر رضی اللہ عنہا) نے نذر مانی ہوا رسم کہانی ہو میں کہوں گا کہ واجب تو ہی
ذکرہ اور بعض میں تین دون کے روز کے کافرہ اور بعض میں دونوں کا ذکر ہے۔ امام طحاوی فرماتے ہیں: ہوسکتا
ہے کہ بعض احادیث ثریفہ میں حدیس کا
( میسوط، مرقات، شرویح کنز، مسوعی، اشعة اللمعات ) اور الحرف الشاذ میں ہے کہ
جس سے عبده برآہوسلتا تھا۔ اور اگر وہ پچھ راستے سوار ہوکر لٹ کیا تو اس کے بعد رباری کی قیمت صرف ہی ہے۔
ہے یا بلا عذر پورا راستے یاراست کا اکثر حصہ سوار ہوکر جائے تو اس پر دم لا زم ہوگا کیونکہ اس نے واجب کو ترک کیا ہے
قول قابل ترجمے ہے۔ اور اگر اپنے گھر تے احرام باندھے تو بالاتفاق گھر سے یہ چلتا ہوا جائے گے۔ اور پچھر کی عذر کی وجہ
قاضی خان، امام زیلمی اور ابن حا م رحمہ اللہ تعالیٰ نے اس کو تحق قرار دیا کیونکہ عرف میں اس کومراد لیا جاتا ہے۔ اور
کہ جہان سے احرام باندھا گیا ہے وہاں سے آغاز کرے۔ امام فخر الاسلام، عتابی اور ان کے سوابیگر علماء کا مہی قول
باب میں اختلاف ہے کہ پیلے چلنے کا آغاز کہاں سے کیا جائے۔ تو کہا گیا کہ میقات سے آغاز کرے۔ اور بھی کہا گیا
بدی کا مطلق ذکر ہے اونٹ کا تیین نہیں ہے۔ اس روایت کی قوت کی بناء پر اس ای پر عمل کرتے ہیں پچراس
اونٹ کا حکم احتیالی ہے۔ امام شافعی کے اس بارے میں دوقول ہیں اوراس میں سے میں قول رانج ہے۔
چھرہمارے پاس دم اور بدی کم سے کم ایک بڑی ہے اور زیادہ سے زیادہ اونٹ سے بڑی کافی ہو جائی ہے اور
پچنے سے عا جزہ ہو جائے تو اس پر دم نہیں ہے اوراس کے ذمہ کوئی چیز واجب نہیں ہے۔

Ibn Abbas (may Allah be pleased with him) narrated: The sister of Uqbah ibn Amir vowed to walk to the House, so the Prophet (ﷺ) ordered her to ride and offer a sacrificial animal. [Narrated by Abu Dawud]
Ali al-Qari said: The minimum is a sheep, and the maximum is a camel, so a sheep suffices, and the command for a camel is for recommendation. In another wording: The sister of Uqbah ibn Amir vowed to walk to the House, but she could not endure it, so the Prophet (ﷺ) ordered her to ride and offer a sacrificial animal. [Narrated by Abu Dawud] He said: The hadith of Ibn Abbas: “Whoever vows a vow he cannot endure, its expiation is the expiation of an oath,” was narrated by Waki’ and others from Abdullah ibn Sa’id ibn Abi al-Hind, who stopped it at Ibn Abbas. Talhah ibn Yahya al-Ansari narrated it as a connected narration, but stopping it at Ibn Abbas is more likely due to its chain.
Shawkani said: Talhah ibn Yahya is a matter of disagreement.
In a narration by Ahmad from Uqbah ibn Amir (may Allah be pleased with him), he said: My sister vowed to walk to the Ka’bah, so the Messenger of Allah (ﷺ) said: “Allah is independent of her walking. Let her ride and offer a camel.”
Our scholars said: We acted upon the generality of the sacrificial animal without specifying a camel, due to the strength of its narration. Muhammad in “Al-Muwatta” said: It is preferable to us, as narrated from Ali ibn Abi Talib (may Allah be pleased with him), who said: Whoever vows to perform pilgrimage on foot and then is unable, let him ride, perform pilgrimage, and slaughter a camel. In another hadith from him: And offer a sacrificial animal. We adopt this, so the sacrificial animal is in place of walking. This is the view of Abu Hanifah and the majority of our jurists. Bayhaqi narrated something similar from Ali (may Allah be pleased with him).
In a narration by him from Abu Hurayrah (may Allah be pleased with him), he said: While the Messenger of Allah (ﷺ) was traveling with a caravan in the depth of the night, he noticed a shadow that startled their camels. He sent a man to look, and it was a naked woman with disheveled hair. He said: “What is wrong with you?” She said: “I vowed to perform pilgrimage to the House on foot, naked, with disheveled hair, so I hide during the day and avoid the road at night.” He went to the Prophet (ﷺ) and informed him. He said: “Return to her and order her to wear her clothes and shed blood.”
(1) The statement: “She vowed to walk, etc.”: If one swears to walk to the House of Allah if he does such-and-such and then does it, nothing is required of him by analogy, because only what is of a type legally obligatory is obligated by a vow, and walking to the House is not legally obligatory. Since he is not obligated to fulfill specifically what he committed to, which is walking, it is even less likely that something else, such as pilgrimage or minor pilgrimage, is required. By istihsan, he is obligated to perform a pilgrimage or minor pilgrimage, as narrated from Ali (may Allah be pleased with him). This is because, in people’s custom, this expression implies committing to pilgrimage or minor pilgrimage. In vows and oaths, custom is considered, so we treat this as an expression for committing to pilgrimage or minor pilgrimage metaphorically, as the purpose of speech is people’s usage to express their inner intentions. When an expression becomes used metaphorically for something, it is treated as literal in that context. Then he has the choice between pilgrimage and minor pilgrimage, as they are the two rites related to the House, which are only performed through consecration and going to that place. They disagreed about one who vows to walk to the House of Allah. Shafi’i said: He walks if he can endure it, but if he is unable, he sheds blood and rides. The companions of Abu Hanifah (may Allah be pleased with them) said: He rides and sheds blood, whether he can endure walking or not. According to us, he has the choice: if he wishes, he walks, which is more complete and fulfills the vow; if he rides, he slaughters a sheep, because he introduced a deficiency in the pilgrimage or minor pilgrimage, as pilgrimage on foot is superior, since a rite with the attribute of walking is more complete. It is narrated that Abdullah ibn Abbas (may Allah be pleased with them) after losing his sight said: “I do not regret anything as much as not performing pilgrimage on foot, for Allah, the Exalted, mentioned the walkers first, saying: They come to you on foot and on every lean camel (Al-Hajj: 27).” If he rides, he has introduced a deficiency, and deficiencies in rites are compensated with blood. This is due to his statement: “Let her ride and shed blood.” Shafi’i has two opinions: the first, which we hold, is that blood is required, and it is his more correct opinion; the second is that if he is unable to walk, no sacrificial animal is required, and nothing is established against him. The blood or sacrificial animal, according to us, is at least a sheep and at most a camel, so a sheep suffices, and the command for a camel is for recommendation. This is Shafi’i’s more apparent opinion. We also acted upon the generality of the sacrificial animal without specifying a camel due to the strength of its narration. They disagreed about the starting point of walking. Some said: From the ritual boundary. Others said: From where he consecrates, and this is the view of Imam Fakhr al-Islam (may Allah be pleased with him), Utabi, and others. Others said: From his house, and this is the view of Shams al-A’immah as-Sarakhsi, the author of “Al-Hidayah,” and authenticated by Qadi Khan, Zayla’i, and Ibn al-Humam, as it is the customary intent, and it is the preferred view. If he consecrates from his house, it is agreed that he walks from his house. If he rides the entire way or most of it, with or without an excuse, blood is required, as he neglected an obligation to fulfill the vow. If he rides for the lesser part, he gives charity equivalent to the value of a sheep. Tahawi said: Perhaps she vowed and swore. I say: The obligatory is the sacrificial animal, and fasting three days is a substitute for the sacrificial animal, not the expiation of an oath, as the apparent meaning is that expiation refers to the expiation of a violation, which is the sacrificial animal or its equivalent in fasting, to align the narrations. Tahawi is supported by what is in Abu Dawud from Ibn Abbas mentioning the oath, and I believe it is from Ibn Abbas’s ijtihad, as he knew the question was about the oath fundamentally, as it is not mentioned in the narrations.
(2) The statement: “The sacrificial animal is in place of walking”: Meaning without returning to walking when able. By analogy, he does not fulfill the vow’s obligation if he rides, but he must walk if he can, just as if he vows consecutive fasting and breaks the continuity. However, this is established by text for pilgrimage, so it must be followed. This is what Abu Dawud narrated from the hadith of Ibn Abbas that the sister of Uqbah ibn Amir vowed to walk to the House, and the Messenger of Allah (ﷺ) ordered her to ride and offer a sacrificial animal. [Stated in “At-Ta’liq al-Mumajjad”]
The meaning of this hadith is that when someone swears an oath that if they do a certain deed, they will circumambulate the Ka'bah on foot, and if they fulfill it, it is inferred by analogy that no obligation should be placed upon them because a vow becomes obligatory only when it pertains to one of the legal obligations of Islam. Circumambulating the Ka'bah on foot is not necessarily obligatory; what is required is to perform the circumambulation, but if it is not performed on foot, there is no obligation to do so. Therefore, it would be considered a minor sin to take something that is not necessary, and it cannot be made obligatory by analogy. Thus, either Hajj or Umrah will become obligatory for them. Sayyiduna Ali (RA) has narrated this tradition, and according to custom, the term 'Hajj or Umrah' is used in such cases, as custom is considered in vows and oaths. Hence, you have established that either Hajj or Umrah must be performed, because the purpose of speech is to express one's intention, and when a word is used figuratively, it becomes equivalent to its literal meaning. In this case, the person will have the option to perform either Hajj or Umrah, as both are acts of worship related to the Ka'bah, which cannot be performed without entering the state of ihram and at the designated place. There is a difference of opinion among scholars regarding the person who makes a vow to circumambulate the Ka'bah on foot. Imam Shafi'i (RA) states that if they have the ability to walk, they should walk; if not, they should ride and take a rest. (They should make a large sacrifice.) The companions of Imam Abu Hanifah (RA) say that whether they have the ability to walk or not, they should take a rest and ride. However, it is firmly established that they have the option to either walk, as it is a form of Umrah, and their vow will be fulfilled, or to ride, in which case they must make a large sacrifice. This is because walking is more virtuous, and it completes the rituals in the proper manner. This is based on the narration that when Abdullah ibn Abbas (RA) was asked about this, he said that he did not feel as much regret over anything as he did over not being able to walk around the Ka'bah. Allah (SWT) mentions those who walk around the Ka'bah first. The guidance is: 'And men.'... The rest is on the next page. The narration also mentions Fathimah, but I believe it is from Abdullah ibn Abbas (RA). According to Imam Tahawi's exegesis, it is from Abdullah ibn Abbas (RA) as reported by Abu Dawud. (It means making a large sacrifice.) It is not permissible to pay a ransom for the two days of Tashriq. This is because it is apparent that a ransom must be paid for a sin, and the ransom for the first day of Tashriq is equivalent to fasting for the remaining days. This is evident from the narration of Umm Kuhayl bint Amr (RA), who made a vow to perform a ritual. I will say that it is obligatory, and some mention the ransom for the two days of Tashriq, while others mention both. Imam Tahawi says: It is possible that in some authentic traditions, the hadith is mentioned in (Musnad, Maraqat, Sharh Kanz, Musa'yi, Ash'at al-Lama'at) and in al-Harf al-Shad, where it is stated that the person was accustomed to walking. If they rode and rested on the way, then the price of a large camel is sufficient. If they ride without a valid excuse for most of the journey, they must make a large sacrifice because they have abandoned an obligation. The statement is translatable. If they put on ihram from their home, they must start walking from there. Due to the custom, Qadi Khan, Imam Zayla'i, and Ibn Hamam (RA) have validated this, as it is customary to consider it so. They must begin from where they put on ihram. There is a difference of opinion among scholars, including Imam Fakhr al-Islam, Attabi, and their followers, regarding where the walking should begin. Some say it should start from the miqat, and others say it is a reference to a camel, not a donkey. Based on the strength of this narration, they act accordingly. The command for riding a donkey is a precautionary measure. Imam Shafi'i (RA) has two opinions on this matter, and I prefer the second. We have at least one large sacrifice and at most a large camel. If the camel is lost, there is no obligation on them. One opinion is that they must make a large sacrifice, and the other is that if they walk, they must make a large sacrifice. If they ride and make a large sacrifice, they must ride and make a large sacrifice. Imam Shafi'i (RA) has two opinions, and both require rectification. By making a large sacrifice, the rectification is achieved. This is because the guidance of Ali (RA) is that when they complete the rituals with perfection, they make a large sacrifice, but if they complete them with imperfection, they must make a large sacrifice. When a person rides, they have caused a deficiency in the rituals, and this deficiency is rectified by making a large sacrifice. (Your people will ask how they will walk and ride in the end.)

چوکہ ان کوبرہمن پاپچنے کی طاقت نہیں رکھتی اس لے رسول اللہ علیہ وسلم نے انہیں سوار ہوکر جانے کا حکم
فرمایااور(سوارہو نے کا) حکم ان کے برہمن پاپیل نجر کرنے کی نذر مانے سے متعلق ہے، اور پھران کوتین دون
کے روزے کا جو حکم فرمایے یہ حکم ان کے سرپر نا اورہکر جانے کی نذر سے متعلق ہے جومعصیت ہے اورمعصیت کی نذر
نہیں ہوتی، اس لے اب پی نذر، قسم بن گی لہذا الان کوتم کے کفارہ کے طور پرتین دون کے روزے کا حکم فرمایاگیا کیونکہ
معصیت کی قسم منعقد ہوجاتی ہے لیکن اس کو پورا کرنا جائز نہیں ہے اس لے کر رسول اللہ علیہ وسلم نے ارشاد
فرمایا جوآدمی معصیت کی منت ما نے تو اس کوتوڑ دیناواجب ہے اور اس پر تم کا کفارہ لا زم آ گے گا-
اب رہی دوسری روايتیں ان میں سرکونہ ذها کنہ کا اورمعصیت کی نذر کا ذکر نہیں ہے بلکہ صرف طاعت ہی
یعنی بیت اللہ کے پیل جانے کا ذکر ہے پس پینذر منعقد ہوگی اور اس کو پورا کرنا ضروری ہوگیا(انتہی)-اورہداہی
میں ہے۔ اس کے ذم پیل چل کر جا عمرہ کرنے کے اور اگر چاہے تو سوار ہوکر جائے اور اپنے زمرہ جس چیز کو لازم کرلیا
تحاس میں کی کرنے کی وجہے ایک دم دے(یعنی برازنے کرے)-

Muhammad in “Al-Muwatta” said: It is preferable to us, as narrated from Ali ibn Abi Talib (may Allah be pleased with him), who said: Whoever vows to perform pilgrimage on foot and then is unable, let him ride, perform pilgrimage, and slaughter a camel. In another hadith from him: And offer a sacrificial animal. We adopt this, so the sacrificial animal is in place of walking. This is the view of Abu Hanifah and the majority of our jurists. موطا میں حضرت امام محمد رحمۃ اللہ علیہ فرماتے ہیں کہ حضرت سیدنا علی بن ابی طالب
رضی اللہ تعالیٰ عنہ سے جور و ایت آئی ہے وہ تمارے پاس زیادہ مناسب ہے کہ پڑنے فرمایا جوآ دی پیلے
کرنے کی منت مانے پھروہ پیلے چلنے سے عاجز ہو جائے تو وہ سوار ہو کر نج کرے اور ایک اوٹھ ذخیرے کرے
it is more appropriate for you to read the verses before performing the action they command. If you become unable to perform the action after reading, then you should ride and proceed, and keep one [camel] as a reserve.
اور ایسے دورسری حدیث میں ہے کہ وہ ایک بدی بڑراذنے کرے اس کو تم
اختیار کرتے ہیں کہ پیلے چلنے کے جبائے ایک بدی ذخیرے کرنا چاہئے۔ 1 حضرت امام اعظم رحمۃ
اللہ علیہ اور تمارة اکثر فقہاء کرام کا بھی قول ہے اور امام مہماق نے سیدنا علی مرضی اللہ تعالیٰ عنہ
سے ایک محتی ایک اور حدیث روایت کی ہے۔
In a similar hadith, it is stated that they choose to impose a bad tax on you so that you store a bad provision before traveling. مطلب یہ ہے اگر چلنے پر قدرت ہو جائے تو دوبارہ چلنے کر جائے نہیں قیاس پر چاہتا ہے کہ سوار ہو کر جائے
کی صورت میں اس کی نذر پوری نہیں ہو نا چاہئے بلکہ پنجے پرجب قدرت حاصل ہو جائے تو چلنے کر جانا ضروری ہو نا
چاہئے جسیا کہ کوئی آدمی مسلسل روزہ رکھنے کی منت مانے اور تسلسل توڈ جائے (تو منت پوری نہیں ہو گی) لیکن جب
کے بارے میں بیبات نص سے ثابت ہے لہذا اس پر عمل ضروری ہے چنانچہ امام ابوداوود نے عبد اللہ بن مبارک سے
ایک حدیث کا ذکر کیا ہے کہ عقبہ بن عامر رضی اللہ تعالیٰ عنہ کی بہن بیت اللہ کو پیلے جانے کی نذر مانی تھی تو ان کو رسول اللہ
صلی اللہ علیہ وسلم نے حکم فرمایا کہ وہ سوار ہو کر جائے۔ اور بدی دے (بڑراذنے کر دے)۔ (لتعلیق احمد)
(پر جھائی، ساپ ) پرآ پعلیصہ کی نظر پڑی جس سے قافلہ کے اوٹ بڈک لگے _ آ پعلیصہ نے ایک صاحب کو انزر کرو کیہنا کا حکم دیا_ انہول نے و کہا کروہ ایک برہند عورت تھی جواپچ بال کھولے ہوئے تھی _ انہول نے اس سے دریافت کیا تیرا کیا معاملہ؟ اس نے کہا میں نے برہنداور کہل بالون سنج کرنے کی منت مانی ہے _ اس لگ دون میں چھپ چلنی ہول اور رات کوراست ط کرتی ہول _ انہول نے نبی اکرم صلی اللہ علیہ وسلم کی خدمت میں آ کراس کی اطلاع دی توآ پعلیصہ نے فرماياجا کراۓ حکم دوکروہ کپڑے پہین لے اور ایک دم ( کبرا ) زنے کرے _ (بیہق)
During the darkness of the night, we were traveling with a caravan when one night He said: 'He who says, “I will walk on foot,” may find himself riding.' For example, if someone vows to fast continuously and then breaks the continuity, the vow is not fulfilled. However, regarding this, there is a clear command, so it must be followed. Imam Abu Dawud has mentioned a hadith from Abdullah bin Mubarak that Uqbah bin Amr (RA)’s sister had vowed to go to the House of Allah on foot. The Messenger of Allah ﷺ commanded her to ride and to give charity (sadaqah) instead. (Ahmad)
When they reached a place where the caravan stopped, the Messenger of Allah ﷺ noticed a woman who was walking barefoot with her hair open. He ordered one of his companions to inquire about her situation. The companion asked her, 'What is your issue?' She replied, 'I have vowed to walk barefoot and with my hair open.' She said, 'I hide myself and rest at night.' When the companion informed the Messenger of Allah ﷺ about this, he commanded, 'Order her to wear clothes and to plait her hair.' (Bayhaqi)
سیرنا ابن عباس رضی اللہ تعالیٰ عنہما سے روایت ہے کہ سعد بن عبادہ رضی اللہ تعالیٰ عنہ نے حضرت نبی کریم صلی اللہ علیہ وسلم نے اپنے نذر کے بارے میں دریافت کیا۔ جوان کی والدہ کے ذمہ گیاوروہ اس کو پورا کرنے سے پیلے انتقال کرگئی۔ رسول اللہ صلی اللہ علیہ وسلم نے فتوی دیا کہ وہ اپنی والدہ کی طرف سے اس نذر کو پورا کریں (تفق علیہ)
(1) جس چیز کی نذر مانی گئی جہاس کا تعین ہوگا تو اس کا تعین نہ کر لے مثلًا یون کہ کہ : اگر میں ایسا کروں گا تو میرے ذمہ زرعوائی کفارہ لازم آئے گا اور محلق کی صورت میں کافارہ لازم آئے گا خواہ پیش نظر مطلق ہو یا محلق البتن زرع مطلق میں فوری کفارہ لازم آئے گا اور اگر نذر میں کسی چیز کا تعین کیا ہے تو پھراس کی دو صورتیں ہیں - شرط پایے جانے کے وقت کفارہ لازم آئے گا اور اگر نذر میں کسی چیز کا تعین نہ ہوگا تو پھراس کی دو صورتیں ہیں - (الف)
(2) متعلق بالشرط
نذر مطلق ہوتا اس کو پورا کرنا ضروری ہے اور اگر وہ نذر متعلق بالشرط ہے تو پھراس کی دو صورتیں ہیں - (ب) اور اگر وہ شرط غیر مقصود ہے تو اس سے متعلق کچھ دو قبول ہیں - پہلا نذر کو پورا کرنا ضروری ہے اور دوسرا اس کو اختیار ہے چاہے قسم کافارہ دے یا نذر پوری کرے اور یہ بات درست ہے اس کی طرف حضرت امام عظیم رحمۃ اللہ علیہ نے اپنے انتقال سے تین دن اساتذن پیلے رجوع فرمایا ہے اور اس طرح اگر پیکہ میرے ذمہ ہے تو اس پر کفارہ لازم آئے گا کیونکہ اس کا مطلب 'علی موجب اليمين، نہ یعنی میرے ذمہ تم لازم آئے والی چیز ہے (ماؤخوذ از نیل الاوطار، بدل انجوم و ثرواح کنز)
حق ابن حمام رحمۃ اللہ علیہ نے فرمایا کہ اگر کوئی شخص پیکہ کے میرے ذمہ نذر ہے یا اللہ تعالیٰ کے لئے نذر ہے، اگر وہ جس چیز پرتم کہار پایہ اس کا ذکر کرے گا تو پیکہ موجاب گی مثلًا پیکہ کے میرے ذمہ اللہ کے لئے نذر ہے میں ضرور ایسا کروں گا ایا ضرور ایسا نہیں کروں گا - پیہال تک کر اگراس کو پورا نہ کرے تو اس کے ذمہ تم کافارہ لازم آئے گا - پیاس وقت ہے جب کر اس نذر مطلق سے ایسی چیز کی نیت نہ کرے جس میں تقرب اللہ ہے، جسے چیا روزہ وغیرہ پیس اگروہ'علی نذر ان فعلت کذا '(میرے ذمہ نذر ہے اگر میں ایسا کروں ) سے عبادت مقصودہ کی نیت کرے تو اس کی نذر درست ہو جائے گی اگر وہ پیکام کرے گا تو عبادت اس پر لازم ہو جائے گی حاکم نے فرمایا ہے جب وہ نذر مطلق کے الفاظ سے معین عبادت کی نیت کرے تو وہ معین کرے نہ کی طرح سے ہے اور پیکلام کی سے متعين
ہے اس حدیث ثمریف کواس چیز پر مولوی جاجا نے گا جس کے ساتھ نذر کے لفظ سے نیت ہیں (مرقات ملخصا12)

Tahawi narrated from Amrah bint Abdur-Rahman, who said: I said to Aishah (may Allah be pleased with her): My mother died with a vow of fasting Ramadan upon her. Is it appropriate for me to fulfill it on her behalf? She said: No, but give charity on her behalf for each day to a poor person, which is better than your fasting. This has an authentic chain.
Nasa’i narrated from Ibn Abbas (may Allah be pleased with him) that the Messenger of Allah (ﷺ) said: “No one prays on behalf of another, but he feeds on his behalf.” In another narration by him from him: “No one fasts on behalf of another, nor prays on behalf of another.” Abdul Razzaq narrated something similar from Ibn Umar (may Allah be pleased with him).
(1) The statement: “He sought the verdict of the Prophet (ﷺ) regarding a vow upon his mother, etc.”: Qadi Iyad said: They differed about the vow of Sa’d’s mother. Some said it was an absolute vow, others said it was fasting, others said emancipation, and others said charity. Each claimant cited hadiths related to the story of Sa’d’s mother. The most apparent is that it was a vow concerning wealth or an unspecified vow. This is supported by what Darqutni narrated from the hadith of Malik, where he said to him, meaning the Prophet (ﷺ): “Distribute water on her behalf.” Our Hanafi scholars specified it to financial acts of worship, not purely physical ones. Ibn Abbas (may Allah be pleased with him) said: “No one fasts on behalf of another, nor prays on behalf of another.” The detail is that a vow is either a physical act of worship or a financial one. If it is a physical act, the heirs may not fulfill it on her behalf due to the prohibition. Nasa’i narrated in his “Sunan al-Kubra” from Ibn Abbas: “No one fasts on behalf of another, nor prays on behalf of another,” and something similar from Ibn Umar. If it is financial and the deceased did not make a bequest, the heirs are not obligated to fulfill it. If the deceased made a bequest to fulfill her vow, the heirs must fulfill it from one-third of his wealth, feeding for each day one sa’ of non-wheat grain or half a sa’ of wheat. This is the view of Abu Hanifah. Shafi’i in his later opinion said: The guardian feeds on behalf of the deceased each day one mudd of wheat for a poor person, and no one fasts on behalf of another. In his earlier opinion: If someone misses something from Ramadan, is able to make it up, then dies without doing so, or similarly for a vow or expiation, it is made up by his guardian, either by fasting on his behalf or feeding from his estate. If a specific thing is vowed, its specification will be determined; for example, if one says: 'If I do this, then a specified expiation will be incumbent upon me,' and in the case of a conditional vow, expiation will be incumbent whether it is absolute or conditional. However, in the case of an absolute vow, immediate expiation will be incumbent. If something is specified in the vow, there are two scenarios: expiation will be incumbent when the condition is met. If nothing is specified in the vow, there are also two scenarios: (a) related to the condition. An absolute vow must be fulfilled, and if it is a conditional vow, there are two scenarios: (b) if the condition is not intended, there are two acceptable views: the first is that fulfilling the vow is necessary, and the second is that it is optional, whether one pays the expiation or fulfills the vow. The correct view is that it is obligatory, as Imam-e-Azam (RA) retracted his opinion three days before his death. Thus, if something is incumbent upon me, expiation will be required because it means 'due to the oath,' not 'incumbent upon me.' (Extracted from Nael al-Awtar, Badl al-Anjum wa Thuruat al-Kanz)
Imam Ibn Humam (RA) said that if someone vows something due to a debt or for Allah's sake, and mentions the thing for which they are compelled, it will be due to the vow, for example, 'I have vowed to Allah that I will definitely do this or I will not do this at all.' If they do not fulfill it, expiation will be incumbent upon them. This is the time when, in an absolute vow, one does not intend to do something that involves devotion to Allah, such as fasting, etc. If one intends to perform worship with the words 'I have vowed to do this if I do that,' the vow will be valid, and if they perform it, the worship will be incumbent upon them. The jurist has stated that when one intends a specific act of worship with the words of an absolute vow, it is like specifying it, and it is determined.
This hadith states: 'A man asked the Prophet (peace be upon him) about a vow (Qul lahu astafti al-Nabi ﷺ fi nadr al-kh...)' Qadi Iyad (RA) says: The rest is on the next page.
عمرۃ بنت عبد الرحمٰن رضی اللہ تعالیٰ عنہا سے روایت سے کہ میں نے حضرت
عائشہ رضی اللہ تعالیٰ عنہا سے عرض کی کہ میری والدہ کا انتقال ہوگیا تو ان کے ذمہ رمضان ثریف
کے روزے تھے، کیا میرے لئے یہ بات درست ہے کہ میں ان کی طرف سے روزے قضا کروں -
ما تقی حاشیہ ___ کہ حضرت سعد کی والدہ ماجده کی اس نذر کے متعلق علماء کے میں اختلاف ہے۔ چنانچہ یہ ماؤجا
ہے کہ وہ نذر مطلق تقی اور یہی کہا گیا ہے کہ وہ نذر روزے کی تقی اور یہی کہا گیا ہے کہ وہ غلام کو آزاد کرنا تقوا اور یہی
کہ وہ صدقہ کرنا تقوا ہرا ئے نے ان احادیث سے استدلال کیا ہے جو حضرت ام سعد رضی اللہ عنہا کے قصے کے بارے
میں ہے اور نظاہر بات یہ ہے کہ وہ منت بال سے متعلق تقی یا کوئی مہم اور غیر واقع نظر چی اوراس کی تا تیرا امام ما کچکی
اس حدیث سے هویق ہے حسن وا مامدار تقی نے روایت کیا ہے، کہ نے (حضرت سعد نے) نیا کرم صلی اللہ علیہ وسلم
نے ارشاد فرما یا کہ اپنی مال کی طرف سے پائل پلا دو _
اور ہمارے اصحاب خفیہ رحم اللہ تعالیٰ نے اس کو صرف مالی عبادت سے مخصوص کیا ہے، خاص بد نی عبادت سے
نہیں _ حضرت ابن عباس رضی اللہ تعالیٰ عنہما فراماتے ہیں کہ نکولی کسی کی طرف سے روزہ رکنا اور نکولی کسی کی طرف سے
نماز پڑھنے کا اس کی تفصیل اس طرح ہے کہ نذر کی وصو تمیں ہیں _
(1) وهبد نی عبادت ہوگی یا (2) مالی عبادت ہوگی
اگرنہ ربد نی عبادت سے تو ورش کے لئے اس کی قضاء کرنا جائز نہیں کیونکہ اس سے منع کیا گیا ہے امام نسا ئی نے اپنی
سفن کبری میں حضرت عبد اللہ بن عباس رضی اللہ تعالیٰ عنہما کی روایت ذکر فرماتے ہے کہ کوئی آدمی نہسی کی طرف سے روزہ
رکھے، اور نہ کسی کی طرف سے نماز پڑھے _ حضرت عبد اللہ بن عمر رضی اللہ تعالیٰ عنہما کے مجھی اس کی روایت آئی ہے _
اگر نذر عبادت مالی کی ہو اور نذر مانتوا لے نے کوئی وصیت نہیں ہوتا وارثوں پراس کو پورا کرنا ضروری نہیں
ہے _ اور اگر میت اس کی نذر پوری کرنے کی وصیت کرے تو میت کے ثلث مال میں سے اس کی وصیت کو پورا کرنا
وارثوں پر ضروری ہے کہ وہ روزا نہ ایک صاع غیر گیہون کا ایآ دھا صاع گیہون کا کھلا یا کریں _ یہ حضرت امام ابوحنیفہ
رحمۃ اللہ علیہ کا قول ہے _ حضرت امام شافعی رحمۃ اللہ علیہ نے اپنے قول جدید میں فرمایا ہے کہ میت کی طرف سے اس کا
ولی روزا نہ ایک مسلکین کو ایک مد گیہون کھلا یے، اور کوئی کسی کی طرف سے روزہ نہیں رکتا کا امام شافعی رحمۃ اللہ علیہ کا
قول قدیم یہ ہے کہ جس آدمی سے رمضان ثریف کی کوئی چیز (یعنی روزہ) چھوٹ جائے اوراس کو قضاء کرنے کی
قررت تقی لیکن قضاء کے بغیر انتقال کر جائے اوراسی طرح سے اس کے ذمہ نذر اور کفارہ تھا تو اس کا ولی اس کی طرف
سے تلافی کرے گا اتواس کی طرف سے روزہ رکنے کا ایاس کے نزک میں سے کہنا کہلا یے گا _
امام نووی نے فرمایا ہے کہ یہ اقوال قدیم کا اعتبار، یہ زیادہ ظاہر ہے _

آپ نے فرمايام ايسائيين کو سکتنے لگین ان کی طرف سے تمہرون کے بد لے کسی مسکین کو صدقہ دو

Regarding the vow of the noble mother of Sad (RA), there is a difference of opinion among scholars. Some say that it was an unconditional vow, and others say that it was a vow to fast, or to free a slave, or to give charity. These scholars have argued based on the hadith related to the story of Umm Sad (RA). The apparent meaning is that it was a vow concerning something heard or some significant and real matter. Imam Harae has cited this hadith as evidence for the permissibility of making vows. It is narrated that the Prophet (SAW) said to Sad, 'Make a vow on behalf of your slave.' Our pious predecessors (may Allah have mercy on them) have specified that this refers to financial acts of worship, not non-financial ones. Ibn Abbas (RA) states that fulfilling a vow can be either through fasting or praying on behalf of someone, with the details being: (1) it could be a non-financial act of worship, or (2) a financial act of worship. If it is a non-financial act of worship, then it cannot be made up by the heir because it is prohibited, as Imam Nasa'i mentions in his Sahih Kabeer, citing the narration of Abdullah ibn Abbas (RA) that one should not fast or pray on behalf of someone else. If the vow is a financial act of worship and the deceased did not make any will regarding it, the heirs are not obligated to fulfill it. However, if the deceased made a will to fulfill the vow, the heirs must do so from one-third of the deceased's wealth, such as giving a sa' of wheat or other grains. This is the view of Imam Abu Hanifah (RA). Imam Shafi'i (RA) in his new opinion stated that the guardian of the deceased should fast or give a mudd of wheat to a needy person, and no one should fast on behalf of another. In his old opinion, Imam Shafi'i (RA) said that if someone misses a fast during Ramadan and dies without making it up, and if they had a vow or expiation, their guardian should make up for it, which would include fasting on their behalf. Imam Nawawi (RA) said that the old opinions are more apparent. (Merqat, At-Taliq Al-Muhammad, Bazl Al-Majhud, Umdat Al-Qari, Amawi) The Prophet (SAW) said, 'It is better for you to give charity to a poor person than to fast on their behalf.' حضرت عبد اللہ بن عباس رضی اللہ تعالیٰ عنہما سے روایت ہے کر رسول اللہ
صلی اللہ علیہ وسلم نے ارشاد فرمایا کونی کسی کی طرف نمازیین پڑھ کا البند وہ اس کی طرف سے کہنا
کہ لا سلتا ہے۔ (نسائی)
Do not pray towards someone's direction; if you do, then say to him: 'Come forward.'
حضرت عبد اللہ بن عباس رضی اللہ عنہما سے روایت ہے کر کونی کسی کی طرف
سے نہ روزہ رک سلتا ہے اور نہ نماز پڑھ سلتا ہے۔ (نسائی)
Ibn Abbas (may Allah be pleased with him) said: “No one should pray (2) or fast on behalf of another, but a meal should be provided for a needy person for each day, equivalent to a mudd of wheat.” (3) [Narrated by Al-Nasa’i in his Sunan]
In Al-Jawhar al-Naqi, it is said: “This chain is sound according to the conditions of Al-Bukhari and Muslim, except for Ibn Abd al-A’la, who meets Muslim’s conditions.” In Al-Binayah, it is mentioned similarly, but with two mudds of wheat. Abu Bakr Al-Razi narrated in his commentary on Mukhtasar al-Tahawi from Ibn Umar (may Allah be pleased with him) that the Messenger of Allah (ﷺ) said: “Whoever dies owing fasts from Ramadan should have half a sa’ of food provided for a needy person for each day.”
(2) The statement: “No one should pray…” This hadith indicates that providing food is required for missed fasts, just as it is for missed prayers.
(3) The statement: “A mudd of wheat.” This is mentioned in Al-Jawhar al-Naqi.
محمدث عبد الرزاق نے عبد اللہ بن عمر رضی اللہ تعالیٰ عنہما سے اس طرح
روایت کی ہے۔
حضرت کعب بن ماکر رضی اللہ تعالیٰ عنہ سے روایت ہے انہوں نے کہا
کہ میں نے عرض کیا یرسول اللہ صلی اللہ علیہ کیا میں (میری توپہ، قبول ہوئے کے شکر ان میں) اللہ اور اس
کے رسول کے لے اپنے مال کو صدقہ 1 کروں۔ (یعنی کر) رسول اللہ صلی اللہ علیہ وسلم نے ارشاد
فرمایا پنا پچھ مال رؤک لو، یتمہارے لے نہ بہتر ہے۔ میں نے عرض کیا میرا وہ حصہ جو مجھے خیربر میں ملا
ہے 2 میں اس کورو کے لیتا ہوں۔ (متقعق علیہ، یطويل حدیث کا ایک حصہ ہے)
شفاعۃ عطا ئفرما لی تو میلاس کے شکر پینے روزہ رکونگا اس حجیس او رکو بات کہے۔
کہا گیا ہے کران دونوں صورتوں میں نذر کے درست ہونے پر اتفاق ہے بعض علماء شافعی کے پاس وسری
صورت میں نذر منعقد نہیں ہوتی۔
نذر تبریکی دوسری قسم وہ ہے جس میں عمل تقرب کے لئے کہا گیا ہو مثلًا اگر فلان صحاب سفرت آجا کیں
تو میں روزہ رکونگا اور بالاتفاق اس نذر کو پورا کرنالازم ہے۔
اور اس طرح نذر لجاج کی بھی دو قسمیں ہیں۔
وہ نذر جو حرام کام کرنے یا اجب کو چھوڑنے سے متعلق ہو پینزر منعقد نہیں ہوتی
وہ نذر جو مباح کام کرنے یا ستہ کو چھوڑنے باخلاف اولی کرنے سے متعلق ہو
اس میں علماء کے تین اقوال ہیں -(1) قسم پورا کرنا(2) قسم کافارہ دینا(3) ان دونوں میں سے کسی کو بھی
کرنے کا اختیار ہونا۔
پیشافعی کے پاس ہے ما لی کے پاس پینزرم نعقد نہیں ہوتی اور حفی کے پاس تمام صورتوں میں کفارہ
میں لازمآتاہے-(انتص)
کتاب مسوی میں ہے کہ کوئی آدمی اپنے مال کصدقہ کرنے کی قسم کہا یا یوں کہ میرا مال اللہ تعالیٰ کے
راستے میں صدقہ تو بعض علماء کہاہے کراس پر قسم کافارہ ہے اور پینزر لجاج ہے اور امام شافعی رحمۃ اللہ علیہ کا
بہی نذہب ہے امام ما لک رحمۃ اللہ علیہ فرما تے ہیں کہ وہ اپنے ثلث مال کصدقہ کرے اور حضرت امام اعظم ابو
حنیفرحمۃ اللہ علیہ فرما تے ہیں کہ اس (نذر) کا تعقل اپنے مال سے ہوگا جن میں زکوۃ واجب ہوتی ہے، اور ایسا مال جس
میں زکوۃ واجب نہیں ہوتی ہے حیزنیں، جانور اور اراس حجیسی چیزوں سے اس کا تعقل نہیں ہے۔
درختاراوردراجتارمیں ہے کر اگر کوئی پی کہ میرا مال مسا کین میں صدقہ کے اور اس کا کوئی مال نہیں ہے تو بالا
تقاق پینزر درست نہیں ہے اور اگر اس کا مال ہے تو درست ہوجائے گی اور اس سے مراد استحساناً وہ مال ہوگا جس سے
زکوۃ متعلق ہے خواہ نصاب کے برابر ہو یا نہو اس پر قرض ہو یا نہ ہو۔
اور اگر اس کے پاس اس کے سوا کوئی اور مال نہیں ہے تو اپنی غذا کی ضرورت کی حد تک اس میں سے رکے
لے اور جب اس کے پاس دوسرا مال آ جائے تو اس مقدار میں صدقہ کرے جواس نے رک لیا ہے۔
اور اس کی تحقیق یہ کہ مال کی تقسیم میں علماء کا بڑا اختلاف ہے ابن عبد البر اور بقیہ اگل صحف پر۔
حضرت امام ابو حنیفرحمۃ اللہ علیہ فرما تے ہیں بنذرائے مال میں بھ جس میں زکوۃ واجب ہوئی
بھا ور جس میں زکوۃ واجب نہیں ہوتی اس میں نہیں ہے۔ جیہ ز میں، جانوراوراس جیسی چیزیں۔
I said, 'O Messenger of Allah ﷺ, shall I give my wealth as charity for Allah and His Messenger?' He replied, 'Keep some for yourself; it is better for you.' I said, 'The portion that I have received from my father, I will give that as charity.' He said, 'If you fast in gratitude for what you have received, that would be better.'
It is said that there is consensus on the validity of a vow in both forms. However, some Shafi scholars hold that a vow is not valid in the second form.
2 - A votive offering is another type of vow where an act is performed for the sake of drawing near to Allah, for example, if a certain Companion returns from travel, then I will fast. It is obligatory to fulfill such a vow.
Similarly, there are two types of vows made under compulsion:
1 - A vow related to committing a forbidden act or abandoning something obligatory is not valid.
2 - A vow related to performing a permissible act or abandoning something recommended has three opinions among scholars: (1) fulfilling the vow, (2) paying expiation, (3) having the choice between either.
According to the Maliki school, a vow is not valid in the first case, and according to the Hanbali school, expiation is obligatory in all cases.
In Al-Musawi, it is stated that if someone makes a vow to give their wealth as charity, or says, 'My wealth is for the path of Allah,' some scholars say that the expiation for this vow is obligatory, and it is a vow made under compulsion. Imam Shafi (RA) holds the same view. Imam Malik (RA) states that one should give one-third of their wealth as charity, and Imam Abu Hanifa (RA) states that the fulfillment of this vow (nazar) will be from the wealth in which Zakat is obligatory. This does not apply to wealth in which Zakat is not obligatory, such as land, animals, and other similar items.
In Al-Rajtari, it is mentioned that if someone says, 'My wealth is for charity,' and they have no wealth, then the vow is not valid. If they do have wealth, the vow is valid, and the intended wealth will be that in which Zakat is applicable, whether it meets the Nisab or not, and whether it is pledged or not.
If they have no other wealth besides this, they should keep enough for their basic needs and when they acquire additional wealth, they should give in charity the amount they kept.
The division of wealth is a matter of significant disagreement among scholars, as noted by Ibn Abd al-Barr and others in subsequent texts.
Imam Abu Hanifa (RA) states that in a vow concerning wealth, if Zakat is obligatory on it, the vow is valid; if Zakat is not obligatory, such as in the case of land, animals, and similar items, the vow is not valid.

پچھر نذر تبرر کی دوستی میں ہیں-
جس میں ثروع ہے، ای بخیری شرط کے تقرب مقصورہ وجی للہ علی ان اصوم کذا”---بقیہ کے صفحہ پر---
سیدنا ثابت بن ضحاک رضی اللہ تعالیٰ عنہ سے روایت ہے کہ انہوں نے کہا
ایک صاحب رسول اللہ صلی اللہ علیہ وسلم کے زمانے میں مقام بوانہ میں ایک اونٹ ذبح کرنے کی نذر
میں اور حضرت رسول اللہ صلی اللہ علیہ وسلم کی خدمت میں حاضر ہو کر آپعلیہ صلی اللہ علیہ وسلم کے اس کا ذکر کیا۔
رسول اللہ صلی اللہ علیہ وسلم نے دریافت فرما کیا وال جا پلیت کے جؤ ل میں سے کسی بت کی پرش
کی جاتی تھی؟ صحابہ نے عرض کیا "نہیں"، آپعلیہ صلی اللہ علیہ وسلم فرما کیا اس (مقام) میں ان کی عیادوں
میں سے (میلیوں میں سے) کوئی عیاد منالی جاتی تھی؟ انہوں نے کہا "نہیں"، رسول اللہ صلی اللہ علیہ وسلم
مانتی حاشیہ دومسر علماء نے فرما یہ کہ سیدنا ابو حریرہ رضی اللہ تعالیٰ عنہ کے قبیلہ دوس کی زبان میں عیبین
کے سواد و مر امال مراد ہے جیسا مان اور کپڑے میں اور ایک جماعت کے پاس مال سے مراد خاص کر عین سونا چاندی۔
مطرزی رحمۃ اللہ علیہ نے بیان کیا ہے کہ مال سے مراد صامت (غیر جاندار جیسے سونا، چاندی) اور ناطق
(حيوانات) ہے اور قائل رحمۃ اللہ علیہ نے ثعلب رحمۃ اللہ علیہ سے روایت کی ہے کہ عرب کے پاس مال سے مراد کم از کم
اثنی عشرہ جس میں زکوۃ واجب ہوتی ہے اور اس سے کم ہوتا اس کو مال نہیں کہا جاتا۔
ابن سیدہ نے العریض میں کہا ہے کہ عرب کے پاس لفظ مال جب مطلق ہوتا اونٹوں کے لے بولا جاتا ہے کیونکہ وہ
ان کے پاس نہایت ثروت کی چیز ہے اور اس میں کثرت ثروت ہے اور انہوں نے پیش کہا ہے کہ بعض و فعسار نے
جانورول پر جی اس کا اطلاق کیا جاتا ہے اور ان میں سے بعض حضرات مال کا اطلاق ہراس چیز پر کرتے ہیں جو
انسان کی ملکیت میں ہے کیونکہ اللہ تعالیٰ کا ارشاد ہے "و لا تؤتو ا السفهآء اموالکم" (اور کم عقل ون کو پنا مال
حوا لے نہ کرو) اس میں کسی چیز کو خاص نہیں کیا گیا اور یہ اکثر متاخرین کا اختیار کردہ قول ہے پیاس سے پیات
واضح ہے کہ امام نخاری رحمۃ اللہ علیہ نے جی اہی اقوال میں سے ایک قول کو اختیار کیا ہے۔
جس کا خلاصہ یہ ہے کہ مال ہروہ چیز ہے جو انسان کی ملکیت میں ہے امام عظیم رحمۃ اللہ علیہ نے جی اہی ان میں سے
ایک قول کو اختیار کیا ہے اور فرما یہ جوآ دی اپنے سارے مال کو صدقہ کرنے کی قسم کہا یا نذر مانے تو اس کی قسم
اور اس کی منت اس مال سے متعلق رہ گی جس میں زکوۃ عا نہ ہوتی ہے (عمدۃ القاری)
ہے۔ اور نان چیز ول میں (نذر) پورا کرنا ہے جس کا انسان ما کے نہیں ہے۔ (ابوداؤد)
۔ قو له: اوف بن ذر ک: الخ (تم اپنی نذر کو پوری کرو۔ 1 بلا شہر اللہ تعالیٰ کی معصیت میں کسی نذر کو پورا کرنا نہیں
کی ویل بے کر کسی معین جگہ کے لئے نذر کی جائے تو اس کو پورا کرنا ضروری ہے۔ و جوب کا حکم امام شافعی رحمۃ اللہ علیہ
کا نہیب ہوسکتا ہے۔ اور تم پیکہ پیں کہ شریعت میں یہ بات معروف ہے کہ کسی ایسی چیز کو لا زم کر لینا جس میں
تقرب ہووہ و جوب کا سبب ہے۔ اور بندر کا عبادت کو کسی مقام میں خصوص کر لینا، شریعت میں اس کا کوئی اعتبار
نہیں ہے۔ یہ بات تو صرف اللہ تعالیٰ کے لئے خاص ہے۔ بندر کا کسی تقرب کی چیزوں اور لا زم کر لینے
تے اس کی کسی خاص جگہ میں تخصیص لا زم نہیں آتی لیکن جس میں تقرب ہے بس وہی چیز لا زم آتی اور جگہ کی تخصیص
لغوہوجاے گی۔ حدیث شریف میں جو حکم ہے وہ ابا حت کا ہے۔ (ماخوذ از مرقات)
صاحب رواختار نے کتاب الاذحیہ میں لکھا ہے: اس بات کو جانو کہ اضیحیہ اس جانور کا نام ہے جس کو مقررہ
خاص وقت میں ذبح کیا جاتا ہے۔ اس میں وقت کی قید لغویہ ہوتی۔ جب قربانی کی نذر مانے گا تو اس کو ان مقررہ
اوقات میں ہی کرنا ہوگا۔ ورنہ وہ نذر پوری کرنے والا نہیں ہوگا۔ کیونکہ ان اوقات کے بعد اس کا نام اضحیہ نہیں ہے۔
ایسے لئے جب وقت نکل جائے تو زندہ حالت میں اس جانور کو صدقہ کرنا ہوگا۔ برخلاف اس کے جب وہ کسی خاص
وقت میں کبری کو ذبح کرنے کی نذر مانے تو وقت کا ذکر لغوہوجاے گا۔ اس لئے کہ پیس کبری سے ایک زائد وصف
ہے۔ اس لئے ہمارے علماء نے کسی زمانے یا جگہ کے تعین کو لغو قرار دیا ہے۔ برخلاف قربانی کے کر اس میں وقت قربانی
کے مفہوم کا ایک جزء ہے لہذا اس کا اعتبار ضروری ہے۔
اس کی ایک نظیر یہ کہ اگر کبی کی بدی پیش کرنے کی نذر مانے تو علماء نے کہا ہے کہ اس کو حرم شریف میں
ذبح کرنے اور پیش اس کو صدقہ کرنے سے اپنی زند داری سے بدی ہوگا (کیونکہ حدوحرم بدی کے مفہوم کا جزء
ہے)۔ اس کے ساتھ علماء نے پیچھی کہا ہے کہ اگر فقراء کہ پرسی درتم کو صدقہ کرنے کی نذر مانے تو ان کے سوا کسی
دورسرے پر کی اس کو صدقہ کرنا جائز ہے۔ اس کی وجہ یہ ہے کہ بدی نام ہے اس جانور کا جو کہ مکرم کو لجایا جاتا ہے اور
و بالصدقہ کیا جاتا ہے۔ قربانی کے لئے وقت کی طرح سے حدوحرم بدی کے مفہوم کا ایک جزء ہیں۔ پس اگر اس بدی
کو کہ کر میں علاوہ کسی اور صدقہ کرے گا تو اس کی نذر پوری نہیں ہوگی۔
اس کے برخلاف درتم کو کہ کر میں صدقہ کرنے کی نذر کرنے کے کیونکہ حجم درتم کے مفہوم کا جزء نہیں ہے۔ درتم
کو کہ کر میں اغیر کہ کمر میں کچھ صدقہ کیا جائے تو وہ درتم ہی ہے۔ لیکن بدی حدوحرم کے سوا کسی نہیں ہوتی۔ پس
اس سے نذر کے تجہ ہوئے اور ایام نہر میں قربانی کے جانور کو ذبح کرنا ضروری ہوئے کی وجہ ظاہر ہے۔
صاحب رواختار نے فرما یہ اس یعنی فائدہ کو تم غنیمت جانو کیونکہ بیمیری گہری فطر کے نتاج میں سے ہے۔
اور اس کو کی کتاب میں دیکھا نہیں ہوئے اور ساری حمد اللہ تعالیٰ کے لئے جو ما کو اور خوب عطا کر نے والہ ہے۔
اور انہیں یہ کہتے ہیں کہ شریعت میں یہ بات معروف ہے کہ کسی ایسی چیز کو لازم کر لینا جس میں
تقرّب ہووہ و جواب کا سبب ہے۔ اور بندے کا عبادت کوئی مقام میں مخصوص کر لینا، شریعت میں
اس کا کوئی اعتبار نہیں ہے۔ یہ بات توصرف اللہ تعالیٰ کے لئے ہی خاص ہے۔ بندہ کے کسی تقرب
کی چیز کو اپنے اوپر لازم کر لینے کے اس کی کسی خاص جگہ میں تخصیص لازم نہیں آتی لیکن جس میں
تقرّب ہے۔ اور یہ چیز لازم آئے گی اور جگہ کی تخصیص لغو ہو جائے گی۔ حدیث شریف میں جو کم
ہے وہ اباہت کا ہے۔
Thabit ibn Ad-Dahhak (may Allah be pleased with him) narrated: A man during the time of the Messenger of Allah (ﷺ) vowed to slaughter camels at Bawana. He came to the Messenger of Allah (ﷺ) and informed him. The Messenger of Allah (ﷺ) said: “Was there an idol of the pre-Islamic idols worshipped there?” They said: No. He said: “Was there a festival of their festivals there?” They said: No. The Messenger of Allah (ﷺ) said: “Fulfill your vow, for there is no fulfillment for a vow in disobedience to Allah, nor in what the son of Adam does not possess.” [Narrated by Abu Dawud]
We say: It is known from the Shariah that committing to an act of worship is obligatory. It is not established in the Shariah that a servant’s specification of a place for worship is considered. Rather, that is known for Allah, the Exalted. Thus, the obligation of the essence of the act of worship by committing to it does not extend to the obligation of specifying a place, so it is nullified, and what remains obligatory is the act of worship itself. Thus, the command in the hadith is for permissibility.
Abu Dawud and Darimi narrated from Jabir ibn Abdullah (may Allah be pleased with him) that a man stood on the day of the conquest and said: O Messenger of Allah, I vowed to Allah, the Mighty, the Exalted, that if Allah grants you victory over Mecca, I will pray two rak’ahs in Jerusalem. He said: “Pray here.” He repeated it to him, and he said: “Pray here.” He repeated it again, and he said: “As you wish, then.”
(1) The statement: “Fulfill your vow, etc.”: Tayyibi (may Allah be pleased with him) said: This is evidence that fulfilling a vow in a specific place is obligatory. The command is for obligation, perhaps this is Shafi’i’s view. We say: It is known from the Shariah that committing to an act of worship is obligatory, and it is not established in the Shariah that a servant’s specification of a place for worship is considered. Rather, that is known for Allah, the Exalted. Thus, the obligation of the essence of the act of worship by committing to it does not extend to the obligation of specifying a place, so it is nullified, and what remains obligatory is the act of worship itself. Thus, the command in the hadith is for permissibility. [Taken from “Al-Mirqat”] It is stated in “Radd al-Muhtar” in the book of sacrifice: Know that a sacrificial animal is a term for what is slaughtered at a specific time, and the time is not nullified. If one vows it, he must perform it at that time, otherwise he has not fulfilled the vowed act, as it is not called a sacrificial animal afterward. Hence, it is given as charity alive if its time passes, unlike if one vows to slaughter a sheep at a specific time, where mentioning the time is nullified, as it is an additional attribute to the sheep’s essence. Hence, our scholars nullified specifying time and place, unlike a sacrificial animal, as the time is part of its concept, so it must be considered. Similarly, if one vows a sacrificial sheep, they said: He fulfills the obligation only by slaughtering it in the sanctuary and giving it as charity there, although they said: If one vows to give a dirham as charity to the poor of Mecca, he may give it to others. This is because a sacrificial animal is a term for what is offered to Mecca and given as charity there, so the place is part of its concept, like time in a sacrificial animal. If he gives it as charity outside Mecca, he has not fulfilled what he vowed, unlike vowing to give a dirham as charity there, as the place is not part of the dirham’s concept. A dirham is a dirham whether given as charity in Mecca or elsewhere, unlike a sacrificial animal. Thus, the validity of the tenth day and the obligation to slaughter it on the days of sacrifice are clear. The author of “Radd al-Muhtar” said: Seize this noble benefit, which is a result of my humble thought, as I have not seen it in any book, and praise be to Allah, the Sovereign, the Bestower.
(2) The statement: “He said: Pray here, etc.”: Ibn al-Humam said: If one vows two rak’ahs in the Sacred Mosque and performs them in a less noble place or one with no nobility, it suffices. [Stated in “Al-Mirqat”] It is stated in “Al-Alamgiriyyah”: Our scholars differed about one who vows fasting or prayer in a specific place. Abu Hanifah and Muhammad said: He may fast and pray in any place he wishes. [Stated in “As-Siraj al-Wahhaj”] Tahawi preferred it, and its evidence is mentioned in “Sharh Ma’ani al-Athar.” It is stated in “Ad-Durr al-Mukhtar” in the book of oaths: Because an unsuspended vow is not restricted to anything. Its detail is in “Radd al-Muhtar”: A vow for retreat, pilgrimage, prayer, fasting, or others, unsuspended, even if specified, is not restricted to time, place, dirham, or poor person. If one vows to give charity on Friday in Mecca with this dirham to so-and-so and violates it, it is valid. Likewise, if he advances it before, or specifies the month of retreat or fasting and advances it, it is valid. Similarly, if he vows to perform pilgrimage in a specific year and performs it in a prior year, or prayer on a specific day and prays it before, as it is advancing after the cause, which is the vow, so the specification is nullified. This is unlike a suspended vow, which cannot be advanced before the condition’s occurrence. The difference is that a suspended vow does not form a cause immediately, as established in principles, but upon the condition’s occurrence. If advancing it were permissible, it would occur before its cause, which is not valid. It is clear from this that in a suspended vow, the time is specified regarding advancing, but delaying it is apparently permissible, as there is no issue in it. It is also clear that the place, dirham, and poor person are not specified, as the suspension only affects the formation of causality, preventing advancing and specifying the time. The place, dirham, and poor person remain on the default of non-specification. Just as the poor person is not specified, their number is not specified. It is stated in “Al-Khaniyah”: If he says: “If I marry my daughter, a thousand dirhams of my wealth are charity, one dirham for each poor person,” and he marries her and gives the thousand to one poor person entirely, it is valid.
In the second margin, the scholars have stated that the term 'ayyubin' in the language of Sayyiduna Abu Hurairah (RA)'s tribe, Daws, refers to black and white stripes, as in clothing, and when referring to a group's wealth, it specifically means gold and silver. Maturazi (RA) has explained that 'wealth' (maal) includes both silent (non-living things like gold and silver) and speaking (animals). Qa'il (RA) has narrated from Tha'lab (RA) that among the Arabs, 'wealth' (maal) refers to at least twelve items, upon which zakat is obligatory, and anything less than this is not considered wealth. Ibn Sida has mentioned in Al-'Arid that among the Arabs, the word 'wealth' (maal) when used generally refers to camels, as they were their primary source of wealth and prosperity. Some lexicographers have applied this term to animals, and some scholars have applied it to any property owned by a person, as Allah (SWT) says, 'And do not give your property to the foolish' (Quran 4:5), where no specific item is mentioned. This is the view adopted by most later scholars. It is clear that Imam Nakhari (RA) has adopted one of these views, which states that wealth (maal) is anything owned by a person. Imam Azam (RA) has also adopted one of these views and said that if someone takes an oath to give all their wealth as charity or makes a vow, the oath and the fulfillment of the vow will be related to the wealth upon which zakat is due, and it must be fulfilled with something that is not a necessity. 1. The ruling: Fulfill your vows, except for those made in disobedience to Allah (SWT), which should not be fulfilled. If a vow is made for a specific place, it must be fulfilled there. The command of Imam Shafi (RA) cannot be applied here. It is well-known in the Shariah that something is made obligatory if it involves devotion and is a cause of the vow. Specifying a particular place for worship has no basis in the Shariah; worship is exclusively for Allah (SWT). Making something obligatory for devotion does not require specifying a particular place, but only what involves devotion is obligatory, and the specification of a place is nullified. The command in the noble hadith is absolute. (Extracted from Mirqat)
The author of Al-Azhiya has written: Know that Azhiya is the name of an animal that is sacrificed at a specified time. The time constraint is essential. If a vow is made for a sacrifice, it must be performed during the specified times; otherwise, the vow is not fulfilled, as it is no longer called Azhiya after these times. Therefore, if the time passes, the living animal must be given as charity. Conversely, if a vow is made to sacrifice a large animal at a specific time, the time specification is nullified because a large animal has an additional attribute. Therefore, our scholars have nullified the specification of time or place. In contrast, for a sacrifice, time is an essential part of its definition, so it must be considered.
An example of this is if a vow is made to offer a badia (a type of sacrifice), the scholars have said it must be performed in the sacred precincts and given as charity while alive (since being in the sacred precincts is part of the definition of badia). Similarly, if a vow is made to give charity to the poor, it can be fulfilled by giving to anyone other than the poor. The reason is that badia is the name of an animal brought to the sacred precincts and given as charity. Time is part of the definition of a sacrifice, just as the sacred precincts are part of the definition of badia. Therefore, if badia is given outside the sacred precincts, the vow is not fulfilled. In contrast, if a vow is made to give charity to the poor, it can be fulfilled anywhere, as being poor is not part of the definition of the poor. Thus, the necessity of performing the sacrifice during the days of Eid is clear.
The author of Al-Azhiya has said: Know that this benefit is a profound insight, as it is not found in books, and all praise is due to Allah (SWT), who bestows good and blessings. They say that it is well-known in the Shariah that something is made obligatory if it involves devotion and is a cause of the vow. Specifying a particular place for worship has no basis in the Shariah; worship is exclusively for Allah (SWT). Making something obligatory for devotion does not require specifying a particular place, but only what involves devotion is obligatory, and the specification of a place is nullified. قوله قال صلى الله عليه وسلم (فرماپیہال نماز پڑھلو) فقیر ابن همام رحم اللہ تعالیٰ فرماتے ہیں کہ مسجد
حرام میں دور کے تکی جب نذر مانے اور اس سے کم شرف و اعلیٰ مکان میں ادا کرے یا کسی ایسے مکان میں ادا
کرے جس کو کوئی شرف حاصل نہیں ہے تو جس اس کے لئے کافی ہے۔ (مرقات)
فقاوی عالمگیری میں ہے کہ ہمارے اصحاب رحم اللہ کے ماہین اختلاف اس مسئلہ میں ہے کہ آدمی کسی معمیں جگہ
میں روزہ رکھنے نماز پڑھنے کی نذر مانے حضرت امام عظیم ابوحنیفہ اور امام محمد رحمهما اللہ تعالیٰ فرماتے ہیں کہ اس کو
اختیار ہے جس مقام میں چاہے روزہ رکھے اور نماز پڑھے۔ (السرج الوهاج)
امام طحاوی رحمۃ اللہ علیہ نے ایکو ترجمہ دی ہے۔ ان کے والد کتاب "شرح معانی الآثار" میں ذکور
ہیں۔ درمتار کتاب الایمان میں ہے کہ نذر غیر محلق کسی چیز کے ساتھ مختص نہیں ہوتی اور اس کی تفصیل رواجتار میں اس
طرح ہے کہ اعتکاف یا نماز، روزہ و غیرہ کی نذر جو غیر محلق ہے آگر چہ وہ معمیں ہوتی وہ کسی زمانے کسی مکان کا کسی
دور کہم یا کسی فقیر سے مخصوص نہیں ہوتی۔ پس اگر کوئی نذر مانے کہ جمعہ کے دن مکہ کر میں اس دور کہم کوفلا آدمی پرخراج
کر ونگا اور اگراس کے خلاف کیا تو مجھی جانتے ہے۔ اس طرح آگراس سے پہلے دے دیتا تو بقیدا گل صفحہ پر۔۔۔
صلى الله عليه وسلم اس پر آپ ﷺ نے ارشاد فرمائتم کہ میں نماز پڑھ لو انہولو نے پھر بھی عرض کیا تو آپ ﷺ
سیدنا جابر بن عبد اللہ رضی اللہ تعالیٰ عنہما سے مروی ہے کہ ایک صاحب فتح
کلم کے دونوں کطرے ہوئے اور عرض کے یارسول اللہ صلی اللہ علیہ وسلم نے اللہ برکت و برتری کے لئے پیمنت
کی ہے کہ اگر اللہ تعالیٰ آپ کے لئے کمر فتح کر دے تو میں بیت المقدس میں دور کے نماز پڑھونگا۔
تو آپ صلی اللہ علیہ وسلم ارشاد فرمایا تم میں نماز پڑھ لو۔ پھر انہوں نے حضرت صلی اللہ علیہ وسلم دوبارہ پیش عرض
نے فرمایا تب تو تمہاری مرضی - (ابودا ور، وارث)
a companion mentioned that the two ends of the key to Fath were broken, and he said to the Messenger of Allah ﷺ: 'O Messenger of Allah, may Allah grant you blessing and excellence; if Allah, the Exalted, opens the way for you, I will perform the prayer at the farthest end of the Bayt al-Maqdis.' So, the Messenger of Allah ﷺ said: 'Perform the prayer with me.' Then he presented it again to the Messenger of Allah ﷺ, who said: 'Then it will be your satisfaction.'
- حضرت محمد بن منظّر رحمۃ اللہ علیہ سے روایت ہے انہولو نے کہا کر ایک صاحب حضرت ابن عباس رضی اللہ تعالیٰ عنہما کے پاس آئے اور کچھ لگ میں اپنے بیٹو قربان کے جانے والابنا دیا ہول (جس قربان کرنے کی نبوت کر ليا هول)۔ او مسروق بن اجدع مسبد مين بيتى هو تھے۔ ان صاحب سے حضرت ابن عباس رضی اللہ تعالیٰ عنہما نفر ما يتم الن بزرگ (مسروق) کے پاس جاو اوران سے در يافت کرو پہر مير لے پاس آنا او رو هجو پچھو فرا مین لگ مجھو بتلانا تو وه
حضرت مسروق کے پاس آئے اور ان سے دریافت کیا۔ انہوں نے فرمایا۔ اگر وہ (ان کابلیا) مسلمان
ہو تو تم اس کو جنت میں بھیجے کے لئے جلدی کر رہے ہو اور اگر وہ کافر ہے تو تم اس کو دوزخ میں
بھیجے کے لئے جلدی کر رہے ہو۔ تم ایک دنہڑ زنگ کردو۔ وہ تمہارے لئے کافی ہو جائے گا۔ 1۔ پھر وہ
Muhammad ibn al-Muntashir narrated: A man came to Ibn Abbas (may Allah be pleased with him) and said: I made my son a sacrificial offering. Masruq ibn al-Ajda’ was sitting in the mosque, so Ibn Abbas said to him: Go to that elder and ask him, then come back and tell me what he says. He went and asked him. Masruq said: If it is a believing soul, you hastened it to Paradise, and if it is a disbelieving soul, you hastened it to the Fire. Slaughter a ram, for it will suffice you. He came to Ibn Abbas and told him what Masruq said. He said: I order you as Masruq ordered you. [Narrated by Muhammad in “Al-Athar”]
(1) The statement: “Slaughter a ram, for it will suffice you, etc.”: Meaning whoever vows to slaughter his son must slaughter a sheep, due to the story of Khalil (may Allah be pleased with him), and the second vow is nullified. Shafi’i said: It is as if he vowed to kill him, and it is nullified, whether it was to slaughter himself or his slave. Muhammad obligated a sheep. If it was to slaughter his father, grandfather, or mother, it is nullified by consensus, as they are not his earnings. [Stated in “Ad-Durr al-Mukhtar”] It is stated in “Radd al-Muhtar” and “Al-Ikhtiyar”: If one vows to slaughter his son or the like, he must slaughter a sheep according to Abu Hanifah and Muhammad. Similarly, vowing to slaughter himself or his slave according to Muhammad. Regarding parents, there are two narrations from Abu Hanifah, and the correct one is that it is not valid. Abu Yusuf and Zufar said: None of this is valid, as it is a sin, so it is not valid. For them, regarding the son, it is the view of a group of companions, such as Ali, Ibn Abbas, and others (may Allah be pleased with them), and it is not known by analogy, so it is by transmission. This is because obligating the slaughter of a son is an expression for obligating the slaughter of a sheep. If he vows to slaughter him in Mecca, he must slaughter the sheep in the sanctuary. Its evidence is the story of the sacrificial son, as Allah, the Exalted, obligated Khalil to slaughter his son and ordered him to slaughter a sheep, where He said: You have fulfilled the vision (As-Saffat: 105). Thus, it is so in our Shariah, either by Allah’s statement, the Exalted: Then We revealed to you, “Follow the religion of Ibrahim, inclining toward truth” (An-Nahl: 123), or because the Shariah of those before us is binding upon us until abrogation is established. It has parallels, such as obligating walking to the House of Allah being an expression for pilgrimage or minor pilgrimage, and obligating a sacrificial animal being an expression for obligating a sheep, and many similar cases. If vowing to slaughter a son is an expression for slaughtering a sheep, it is not a sin but an act of worship. Isbijabi and other scholars said: If he intends the actual slaughter and knows it is a sin, it is not valid. Its parallel is fasting for an elderly person, which is a sin as it leads to his destruction, yet vowing to fast is valid, and he must offer a redemption. This is considered an obligation for redemption, as here. For Muhammad, regarding himself and his slave, his authority over them is greater than over his son. For Abu Hanifah, the obligation of a sheep is contrary to analogy, known by inference from the story of Khalil. It was mentioned regarding the son, so it is limited to it. If he vows with the term “killing,” nothing is required by consensus, as the text uses the term “slaughter,” and “sacrifice” is similar, unlike “killing.” This is because slaughter and sacrifice are mentioned in the Quran as acts of worship and devotion, while killing is mentioned only as punishment, retribution, and prohibition. If one vows to slaughter a sheep with the term “killing,” it is not valid, so this is even more so.
