قسمول اور منتوال کا بیان

The Prostration and Recitation of the Quran

الله بزر و برتر كا رشاد لا يواخذكم الله باللغو في ايمانكم ولكن يواخذكم بما عسبتم قلوبكم والله غفور حليم

(ترجمہ) اللہ تعالیٰ تہماری گرفت نہیں کرتا تہماری لغو (اور بے معنی) قسمون پر لیکن جو تمیں

تمہارے دلون کے ارادے سے ہول ان پر ضرور تہماری گرفت کرے گا اور اللہ تعالیٰ بہت مغفرت

کرنے والانہايت برداشت ہے - (2، سورۃ البقرہ، آیت نمبر:225)

اور اللہ تعالیٰ کا رشاد ہے:

Allah, the Exalted, does not hold you accountable for your oaths that are meaningless, but He will certainly hold you accountable for what is in your hearts. And Allah is Most Forgiving, Most Forbearing - (2, Surah Al-Baqarah, Verse Number: 225). And the guidance of Allah is as follows:

لا يواخذكم الله باللغو في ايمانكم ولكن يواخذكم بما عقدتم الايمان فكفارتها طعام عشره مساكين من اوسط ما تطعمون اهليكم او كسوتهم او تحرير رقبه فمن لم يجد فصيام ثلاثه ايام ذلك كفاره ايمانكم اذا حلفتم واحفظوا ايمانكم كذلك يبين الله لكم اياته لعلكم تشكرون

اللہ تعالیٰ تہماری لغو (اور بے معنی) قسمون پر تم سے موافخذہ نہیں کرتا البتن (قسمون)

پر موافخذہ کرتا گا جتنے کے لئے تم نے پکارادہ کیا ہوتا اس کا کفارہ دس مسکینوں کو اوسط درجہ کا کھانا

کھلانا ہے جو تم اپنے ال و عیال کو خلاصے ہو یا ایک کپڑے پہنانا ایک غلام کو زاد کرنا اور جس کو پی

میسر نہ ہوتا اس کو تین دن کے روزے رکھنا ہے۔ یہ تہماری قسمون کا کفارہ ہے۔ جب تم کھاواور

تم اپنی قسمون کی حفاظت کرو اسی طرح اللہ تعالیٰ تہمارے لئے اپنی آیتیں صاف صاف بيان فرماتا

ہے تاکہ تم (اس کی) شکرگزاری کرو - (5 سورۃ المائدة، آیت نمبر:89)

نہیں! ولون کے پچھر نے وا لے کی قسم!

Allah, the Exalted, does not hold you accountable for your oaths that are meaningless, but He will hold you accountable for those oaths which you have taken seriously. The expiation for such an oath is to feed ten poor persons with food of an average quality that you would provide to your own family, or to clothe one person, or to free a slave. If none of these are possible, then you must fast for three days. This is the expiation for your oaths. When you eat and drink, guard your oaths, just as Allah makes His verses clear to you so that you may be grateful - (Surah Al-Ma'idah, Verse 89)

سید نا بن عمر رضی اللہ عنہما سے روایت ہے انہول نے کہا نی اکرم صلی اللہ علیہ وسلم قسم

کہا تے تو اکثر فراماتے لا و مقلب القلوب "1 (بخاری)

ولون کو پچھر نے وا لے کی قسم) اس سے یہ بات معلوم ہوتی ہے کہ ذہب مختار کی بناء پر اللہ کی اوراس کے ناموں میں

کے کسی نام کی، اگر چہ کہ وہ مشترک ہو، اور عرف میں اس کی قسم کہا تی جاتی ہو یا نہ ہو، جسے رحمٰن و رحیم، حیم و علیم، ما کہ

یوم الدین، الطالب الغالب اور احتی، جوالف لام کے ساتھ ہو بغیر الف لام کے نہیں ہے قسم ہو جاتی ہے۔ اور کتاب مختی

میں ہے اگر اس اے مشترک کے قسم سے ہبت کر کی چیز کی نیت کرے تو دیانے قبول کیا جاتے گا اور اللہ تعالی کے صفات میں

کے کسی ایسی صفت سے قسم کہا ہے جس کی عام طور پر قسم کہا تی جاتی ہے اور اس کی صفت ذاتی ہو لیجن اس کی ضراس میں

نہیں پانی جاتی جیسے اللہ کی عزت، جلال، کبریائی، ملكوت، جبروت، عظمت اور قدرت کی قسم کہا ہے تو بھی قسم ہو جاتی

ہے۔ یا اس کی فعلی صفت کی (لیجن جس کی ضراس میں پانی جاتی ہے) قسم کہا ہے جسے غضب اور رضا کی، تو ایسی صورت

میں قسموں کا دارودار عرف پر ہے اور ان صفات میں جو قسموں کے لے معروف پیل تو ان کی قسم ہوتی ہے۔ اور جواس

کے لے معروف نہیں پیل ان کی قسم نہیں ہوتی۔

اور اللہ تعالی کے صفات میں سے ایسی صفت کی قسم نہیں ہوتی جو قسم کے لے معروف نہیں ہے لیجن عرف میں

ان کی قسم نہیں کہا تی جاتی جیسے اللہ کی رحمت اس کا علم، اس کی رضا، اس کا غضب، اس کی ناراضگی، اس کا عذاب، اس کی

لعنت، اس کی شریعت، اس کا دین، اس کے حدود، اس کی صفت، سجان اللہ اور اس جیسے دیگر صفات کی قسم نہیں ہوگی۔

یہ کہلم صفات کے ساتھ خاص ہے اس میں ذات کے ساتھ نہیں کیونکہ اس میں ذات میں عرف کا اعتبار نہیں ہوتا جسیا کہ اس کا

پیان گزر چکا ہے۔ (دروختار، رواختار)

کتاب رحمۃ اللامت میں ہے کر علم کا اتفاق ہے اس بات پر کہ اسم جلال کے اور اس کے تمام اسماء حسنی سے قسم

منعقد ہو جاتی ہے جیسے الرحمٰن، الرحیم، اگر اور اس کے تمام صفات ذاتی ہے جس قسم منعقد ہو جاتی ہے۔ جیسے اللہ تعالی

کی عزت اور اس کے جلال کی قسم، لیکن امام اعظم ابو حنیفہ رحمۃ اللہ علیہ نے اللہ تعالی کے علم کو مستثنی قرار دیا ہے۔ آپ

اس کو قسم نہیں سمجھتا (اہلی) اور کتاب عناوی میں ہے۔ بہال اللہ کے اسم سے مراد وہ لفظ ہے جو ایسی ذات پر دلالت کرتا

ہو جو کسی صفت سے متصرف ہو۔ جیسے الرحمٰن، الرحیم۔ اور صفت سے مراد وہ مصادر ہیں جو اسماء صفاتی کو اللہ تعالی کی

زات سے متصل کرنے پر حاصل ہوتے ہیں جیسے رحمت، علم، عزت وغیرہ۔ بقیہ کے صفت پر۔

It is narrated from Sayyiduna Ibn Umar (RA) that he said:

The Messenger of Allah ﷺ took an oath, saying, 'By Him in Whose hand is the control of the hearts, I often recite: ‘By Him in Whose hand is the control of the hearts.’'

This indicates that an oath taken by Allah's name or any of His names, even if it is a common term and whether or not it is considered an oath in common usage, such as Ar-Rahman, Ar-Raheem, Al-Hayy, Al-Aleem, Yawm ad-Deen, At-Talib, Al-Ghalib, and Al-Ihtiyat, which are with the definite article 'Al' and not without it, is indeed an oath. In the book Mukhtasar, it is stated that if someone takes an oath using a common term and intends something specific, it will be accepted in legal terms. If an oath is taken using one of Allah's attributes that is generally considered an oath and is an essential attribute, even if it is not found in the essence, such as Allah's glory, majesty, greatness, sovereignty, power, might, and authority, it is still considered an oath. Or if an oath is taken using an active attribute (which is found in the essence), such as anger and satisfaction, then in this case, the validity of oaths is based on common usage, and those attributes for which oaths are commonly known are considered oaths. And those for which oaths are not commonly known are not considered oaths.

And an oath is not valid for any of Allah's attributes that are not commonly known as oaths, because they are not considered oaths in common usage, such as Allah's mercy, His knowledge, His satisfaction, His anger, His displeasure, His punishment, His curse, His law, His religion, His limits, His attributes, and other similar attributes. This rule applies specifically to attributes and not to the essence, because the essence does not have common usage considerations, as has been previously explained. (Daruhtar, Rawuhtar)

In the book Rahmatullah, it is stated that there is consensus on the fact that an oath is valid when taken by the name of Majesty and all the Beautiful Names, such as Ar-Rahman, Ar-Raheem, and all essential attributes, such as Allah's glory and majesty. However, Imam Abu Hanifah (RA) has excluded Allah's knowledge, considering it not an oath (Ahli). This is mentioned in the book Anawiy. The word 'Allah' refers to the term that indicates an essence characterized by an attribute, such as Ar-Rahman, Ar-Raheem. Attributes refer to the qualities derived from the attributive names when connected to Allah's essence, such as mercy, knowledge, glory, etc. The rest pertains to the attributes.

سیدنا ابوسعید خدری رضی اللہ تعالیٰ عنہ سے روایت ہے رسول اللہ صلی اللہ علیہ وسلم

جب قسم میں تاکید کرنا چاہتے تو فرماتے "نہیں، قسم مجھے اس ذات کی جس کے دست قدرت میں ابو

القاسم کی جان ہے" (صلی اللہ علیہ وآلہ وسلم) (ابوداود)

Abu Sa’id al-Khudri (may Allah be pleased with him) narrated: When the Messenger of Allah (ﷺ) exerted effort in an oath, he said: “By the One in whose hand is the soul of Abu al-Qasim.” [Narrated by Abu Dawud]

اور سیدنا ابوہریرہ رضی اللہ تعالیٰ عنہ سے روایت ہے کر رسول پاک صلی اللہ علیہ

وسلم جب قسم کا موقع آتا تو لا واستغفر اللہ (نہیں، میں اللہ سے مزید عظمت کی سرفرازی ماگتا

ہول1) فرماتے (ابوداود، ابن ماجہ)

Abu Hurayrah (may Allah be pleased with him) narrated: The oath of the Messenger of Allah (ﷺ) when he swore was: “No, and I seek Allah’s forgiveness.” [Narrated by Abu Dawud and Ibn Majah]

(1) The statement: “No, and I seek Allah’s forgiveness” in its apparent form is not an oath, but it resembles an oath in that it emphasizes speech. It can be said that the “and” is for swearing, and the object of the oath is omitted, meaning “No, by Allah,” then he began with the statement “I seek Allah’s forgiveness,” meaning if the matter is contrary to that. Or it could mean: “And I seek Allah’s forgiveness from swearing,” as it is preferable to avoid swearing except when necessary, for it is inherently risky and prohibited. Thus, some refrained from swearing even if truthful. What is established from him (ﷺ) was due to the need to emphasize a ruling or clarify permissibility. Hence, it is said: When he intended to swear, he mentioned this instead of swearing and did not swear. [Summarized from “Al-Mirqat”]

سیدنا ابن عمر رضی اللہ تعالیٰ عنہما سے روایت ہے کر رسول اللہ صلی اللہ علیہ وسلم

مفتی حاشیہ امام زیلعی کی شرح کنز میں اور موابہب الرحمن کی شرح "برہان" میں ہے کے علماء عراق

نے بیان کیا ہے کہ صفات ذاتی کی قسم ہوتی ہے اور صفات فعلی کی نہیں۔

علماء موراء انہوں نے بیان کیا ہے کہ قسم میں عرف کا اعتبار ہے۔ جس صفت سے عام طور پر قسم کہائی جاتی ہو خواہ

صفت ذاتی ہو جسے قدرت،خواہ صفت فعلی ہو جسے پیدا کرنا اور رزق دینا، قسم ہول گے اور عرف میں جن سے قسم کہائی نہیں

جاتی خواہ وہ صفت ذاتی ہو یا عملی اس سے قسم متصور نہیں ہوتی۔ اور میں مجھ سے حاصل کلام یہ کہ اللہ تعالیٰ کے نامول کے

ساتھ قسم بلا شبہ تمہے اوراس کے صفات کی قسم کہا نے میں عرف کا اعتبار سے اور غیر اللہ کی قسم مطلق قسم نہیں ہے۔12

1(قول:واستغفر اللہ (اور میں اللہ سے مزید عظمت کی سرفرازی ماگتا ہول )یہ بظاہر قسم نہیں ہے لیکن چونکہ

آپ نے کلام کو تاکید کے ساتھ فرمایا ہے اس لے قسم کی صورت ہے اور یہی ممکن ہے کہ "واستغفر اللہ" میں واو قسم کا

ہوااور مقسم ہر (جس کی قسم کہائی جاتی ہو) مزدوف ہویعنی لا واللہ (نہیں اللہ کی قسم) پھر استغفر اللہ سے کلام کی

ابتدا ہے۔استغفر اللہ سے مراد اگر معاملہ اس کے خلاف ہے تو میں مغفرت چاہتا ہول یا استغفر اللہ کے بعد "میں

الحلف "مزدوف ہویعنی قسم سے میں اللہ کی جانب میں استغفار کرتا ہوں" کیوںکہ قسم نہ کانا ہی افضل ہے سوا ہے

اس کی ضرورت ہو کیوںکہ قسم اصل میں عرضہ (نشانہ) ہے اور عرضہ سے منع کیا گیا اس لے بعض حضرات قسم کا نے

سے رکے ہیں اگر چیکہ وہ پچھول اور حضرت رسول اکرم صلی اللہ علیہ وسلم سے قسم ثابت ہے، وہصرف ضرورت کے

لے ہے جسے حکم کو مؤكد کرنے کے لے یا بیان جواز کی غرض سے ہے اس لے کہ اگیا ہے رسول اکرم صلی اللہ علیہ وسلم

نے جب قسم کا رادہ فرمایا تو قسم کے بجائے "لا واستغفر اللہ" فرمایا، قسم نہیں کہائی۔ (مرقات ملخصا)

چاہتا ہے، وہ اللہ قسم کہا یے یا خاموش رہے۔ (متفق علیہ)

It is narrated from Sayyiduna Ibn Umar (RA) that the Messenger of Allah ﷺ

said: 'The scholars of Iraq have stated that it is a type of intrinsic attribute, not an acquired one. The scholars of Andalus have stated that custom is considered in oaths. Any attribute that is commonly used in oaths, whether it is an intrinsic attribute such as nature, or an acquired one such as creation and sustenance, can be used in an oath. However, if an attribute is not commonly used in oaths, whether it is intrinsic or acquired, it does not form a valid oath. And my statement is that swearing by Allah's names without doubt is an oath, and swearing by His attributes is based on custom, but swearing by anything other than Allah is not an absolute oath. (Saying: “And I seek forgiveness from Allah” is apparently not an oath, but since it is said with emphasis, it takes the form of an oath. It is possible that the “wa” (and) in “wa astaghfir Allah” is the conjunction of the oath, and the object of the oath is “la wal Allah” (by Allah, no). Then, “astaghfir Allah” begins the speech, meaning if the matter is against this, I seek forgiveness, or “astaghfir Allah” is followed by “min al-halif,” meaning I seek forgiveness from Allah in the context of the oath, because not taking an oath is better unless there is a need, as an oath is essentially a challenge, and challenging is prohibited. Therefore, some scholars refrained from taking oaths, even though oaths are established from the noble Messenger of Allah ﷺ, but only out of necessity to confirm a command or to clarify a point. Thus, when the noble Messenger of Allah ﷺ intended to take an oath, he would say “la wa astaghfir Allah” instead of taking an oath. (Al-Mirqat, summarized) He desired that one should either swear by Allah or remain silent. (Agreed upon)'

(قول: ان اللہ یعنہا کم ان تحلفو با بائکم ان (اللہ تعالیٰ تم کو اپنے باب دادا کی

قسم کرتا ہے) حضرت امام محمد رحمۃ اللہ علیہ موطائیں فرما تے ہیں تم اس کو اختیار کرتے ہیں کی آدی کے لے اپنے باب پکی

قسم کہنا مناسب نہیں جوآ دی قسم کہنا چاہتا ہے وہ اللہ تعالیٰ کی قسم کہا ے اور قسم کو پوری کرے یا پھر قسم کہا نے تے

خاموش رہے اور مرقات میں سے کہ جس قسم سے منع کیا گیا ہے وہ غیر اللہ کی قسم سے اور باب دادا کا خصوصیت سے ذکر اس

لے سے کہ باب دادا کی قسم کہنا اولا دکی عادت ہوتی ہیہد ایسی سے جوکونی آدی غیر اللہ جیسی اور کعبہ غیرہ کی قسم

کہا ے گا تو وہ قسم کہا نے والاشمار نہیں ہوگا کیونکہ رسول پاک صلی اللہ علیہ وسلم کا ارشاد ہے "من کان منکم حالفا

فليحلف بالله او ليذر "(تم میں سے جو قسم کہا ے وہ اللہ کی قسم کہا ے یا چھوڑ دے) اس طرح سے جب قرآن

مجید کی قسم کہا ے (تو قسم کہا نے والاشمار نہیں ہوگا) کیونکہ یہ قسم متعارف نہیں ہے۔ (تحفی)-

صاحب بدایی کے قول سے معلوم ہوتا ہے کہ قرآن کی قسم غیر اللہ کی قسم کی طرح نہیں ہے بلکہ اس کی نواعت

صفات کی قسم کی ہے کیونکہ اس کی علم قسم کے لے غیر معروف ہونا بیان کیا گیا ہے اور اگر پیشہ لی قسم سے ہوتی تو اس کی علت

ذکورہ ممانعت یا س کے سوا کونی اور وجہ ہوتی۔ کیونکہ عرف کا اعتبار صرف صفات مشترک میں ہوتا ہے اور دونوں ول میں نہیں۔

علامہ کمال نے فرما یا ن دول (لیکن موجودہ دور میں) بیبات پوشیدہ نہیں ہے کہ قرآن کی قسم متعارف ہے اس لے قرآن کی

قسم کہنا قسم ہے۔ (ور مختار، رواجتار)۔ اور نہیل الاوطار میں سے کر اس باب کی احادیث ثریفہ سے بیبات معلوم ہوتی سے کر

غیر اللہ کی قسم منعقد نہیں ہوتی۔ کیونکہ اس سے منع کیا جانا منہی عنز (جس سے رو کا گیا ہے) کے فساد پر دلالت کرتا ہے اور جمہور

کا مہی نہ ہب سے بعض حوالے نے فرما یا ہے کہ نبی اکرم صلی اللہ علیہ وسلم کی قسم کہا نے سے بھی قسم منعقد ہو جاتی ہے اور کفارہ

جسی واجب ہوتا ہے (روا جتاریں اس طرح ہے)

2 (قول: لا تحلفو بالطواغی ان (تم نہ بتول کی قسم کہا اور نہ اپنے باب دادا کی) عرب اپنی جاہلیت

کے زمانے میں بتول کی اور اپنے باب دادا کی قسم کہا تے چھوٹی ان کواس سے منع کیا گیا تا کہ وہ اپنی گفتگو اور محاورات میں

متاثر نہیں کہیں ان کی عادت کے مطابق ان کی زبان اس میں سبقت نہ کر جائے۔ (مرقات)

Ibn Umar (may Allah be pleased with him) narrated that the Messenger of Allah (ﷺ) said: “Allah forbids you from swearing by your forefathers. Whoever swears, let him swear by Allah, or let him remain silent.” [Agreed upon]

In a narration by Muslim from Abdur-Rahman ibn Samurah (may Allah be pleased with him), the Messenger of Allah (ﷺ) said: “Do not swear by idols or by your forefathers.”

Abu Dawud and Nasa’i narrated from Abu Hurayrah (may Allah be pleased with him) that the Messenger of Allah (ﷺ) said: “Do not swear by your fathers, nor by your mothers, nor by rivals, and do not swear except by Allah, and do not swear by Allah unless you are truthful.”

(1) The statement: “Allah forbids you from swearing by your forefathers, etc.”: Muhammad said in “Al-Muwatta”: This is what we follow; no one should swear by his father, and whoever swears should swear by Allah, then fulfill it or remain silent. In “Al-Mirqat,” it is stated: The prohibition refers to anything other than Allah, and forefathers were specified because it was the custom of the descendants. In “Al-Hidayah,” it is stated: Whoever swears by other than Allah is not considered to have sworn, such as by the Prophet or the Ka’bah, due to the statement: “Whoever among you swears, let him swear by Allah or leave it.” Similarly, if one swears by the Qur’an, as it is not customary. This indicates that it is not from the category of swearing by other than Allah, but from the category of attributes, hence it is justified by the lack of custom. If it were from the first category, the reason would be the mentioned prohibition or another, as custom is considered only in shared attributes, not in others. Al-Kamal said: It is evident that swearing by the Qur’an is now customary, so it is an oath. This is taken from “Ad-Durr al-Mukhtar” and “Radd al-Muhtar.” In “Nayl al-Awtar,” it is stated: The hadiths of this chapter indicate that swearing by other than Allah is not binding, as prohibition implies the invalidity of the prohibited act, and this is the view of the majority. Some Hanbalis said: Swearing by our Prophet (ﷺ) is binding, and expiation is required. This is also in “Radd al-Muhtar.”

(2) The statement: “Do not swear by idols, etc.”: The Arabs in their pre-Islamic ignorance used to swear by them and by their forefathers, so they were forbidden from this to remain vigilant in their speech, lest their tongues slip into what they were accustomed to. [From “Al-Mirqat”]

حضرت ابوہریرہ رضی اللہ تعالیٰ عنہ سے روایت کی ہے کہ رسول اللہ صلی اللہ علیہ وسلم نے ارشاد فرمايندے اپنے باب دادا کی، نماز کی اور نہ بتول کی فتنہ کھاواور اللہ کی فتنہ اس وقت کھاونے جب کہ تم پچھوڑ (ابوداود، نسائی)

It is narrated from Abu Hurairah (RA) that the Messenger of Allah ﷺ said:

Pray and do not follow the path of the one who leaves prayer, and do not fall into the trial of Allah at a time when you forsake.

سیدنا ابن عمر رضی اللہ تعالیٰ عنہما سے روایت ہے: میں نے رسول اللہ صلی اللہ علیہ وسلم کو فرماتے ہوئے سنایا کہ آگ کس آدمی کے غیر اللہ کی فتنہ کھانے تواس نے شرک کیا (ترمزی)

It is narrated from Ibn Umar (RA) that he said:

I heard the Messenger of Allah ﷺ say: 'Whoever eats the table spread by fire, other than from Allah, has committed shirk.'

سیدنا ابوبکر رضی اللہ تعالیٰ عنہ سے روایت ہے انہوں نے کہا کہ رسول اللہ صلی اللہ علیہ وسلم نے ارشاد فرمایا کہ جو کوئی امانت کی فتنہ کھا لے تو وہ تم میں سے نہیں (ابوداود)

It is narrated from Sayyiduna Abu Bakr (RA) that he said:

The Messenger of Allah ﷺ said: 'Whoever takes the bait of trust is not from among you.' (Abu Dawud)

1(قول: من حلف بالا مانة ان (جوكوئی امانت کی فتنہ کھا نے) یہاں امانت کی نسبت اللہ کی طرف نہیں ہے بلکہ مطلق ہے۔ فليس هنا (وہ تم میں سے نہیں) اس میں کرامت معلوم ہوتی ہے کیونکہ اللہ تعالیٰ کی ذات اور اس کے فرض کردہ امور میں سے ہے اور اس سے (یعنی اللہ کے فراض واحکام کی فتنہ سے) منع کیا گیا ہے کیونکہ میں اللہ تعالیٰ کے اسما اور صفات کے ساتھ برائی معلوم ہوتی ہے اور یہی ہوسکتا ہے کہ اس سے وعید کی مراد ہے کیونکہ اس کے غیر اللہ کی فتنہ کھانے ہے اور بالاتفاق اس کے کفارہ متعلق نہیں ہوسکتا۔ اور امانۃ اللہ "(امانت کی اللہ تعالیٰ کی طرف نسبت کر کے) کی فتنہ کھانے میں اختلاف ہے امام شافعی رحمۃ اللہ علیہ فرماتے ہیں کہ فتنہ نہیں ہے اور اس میں کفارہ لازم نہیں آنے گا۔ اور امام اعظم ابوحنیفہ رحمۃ اللہ علیہ نے فرمایا کہ فتنہ ہے اس کو توڑنے کے کفارہ لازم آنے گا۔ اور کتاب البدائع میں ہے کہ امانۃ اللہ " کہہ کر فتنہ کھانے میں ہمارے پاس روايات مختلف ہیں۔" کتاب الاصل " میں ہے کہ فتنہ ہے۔ اور ابن ساعد امام ابویوسف رحمۃ اللہ علیہ سے روایت کرتے ہیں کہ فتنہ نہیں ہوگی۔ امام طحاوی نے ہمارے اصحاب سے روایت کی ہے کہ فتنہ نہیں ہے اور امام طحاوی کے ذکرہ میان کی وجہ یہ ہے کہ امانۃ اللہ " اللہ تعالیٰ کے فرض کردہ امور میں جمن کے ذریعہ بنے اللہ تعالیٰ کی عبادت کرتے ہیں۔ اللہ تعالیٰ کا ارشاد ہے: " انا عَرَضْنَا الْآمَانَةَ عَلَى السَّمَوَاتِ وَ الْأَرْضِ وَ الْجَبَالِ فَأَبْیْنَ أَن يَحْمِلْنَهَا "۔ (33-سورۃ الاحزاب، آیت نمبر:72) " پیشکہم نے امانت کو آسمانوں اور زمین اور پہاڑوں پر پیش کیا تو انہوں نے اس کے اٹھانے سے انکار کیا " اس لے کر (امانت اللہ کی فتنہ کھانا) بقیہ کے صفحہ پر

1 (قوله : من حلف بملة غير الاسلام الخ ( جو کوئی اسلام کے سوا کسی نذرب کی قسم کہائے ) اس عبارت میں کلمہ غیر الاسلام " ملت کی صفت ہے مثلًا وہ کہ کا آگروہ اسیا کرے گا تو وہ یہودی یا نصرانی یا اسلام ہے بری ہے کیا اس کا کلام شریعت کی اصطلاح میں قسم ہے اور کیا ایسی قسم پوری نہ کر نے کفارہ لازم آتا ہے ؟ امام تحقی ، امام اوزاعی ، امام ثوری اور امام ابوحنیفہ کے اصحاب ، امام احمد اور اسحاق رحمہ اللہ کے پاس یہ قسم ہے اور اس کو توڑ نے کفارہ واجب ہوتا ہے امام ماکو ، امام شافعی اور ابو عبید نے فرمایا ہے کہ قسم نہیں ہے اور اس میں کفارہ کچھ ہی نہیں والگنہ کارہ چاہے اس سے جو کہا ہو یا جحوط اور یہ حضرات رسول پاک صلی اللہ علیہ وسلم کے ارشاد سے استدلال کر تے ہیں کہ جو کوئی لات و عزی کی قسم کہائے اس کولا اللہ الا الله ( کلمہ شہادت پڑ ہنا چائے ) اس حدیث شریف میں کفارہ کا ذکر نہیں ہے تم بیبین گے کہ اس میں کفارہ کا ذکر نہ کر نے کفارہ واجب ہو نے کی نہی لازم نہیں آئی ہماری دلیل نذورہ حدیث ہے کیونکہ اللہ تبارک و تعالی نے ظہار کر نے والوں پر کفارہ واجب فرما یہ اور پی ( ظہار ) ناپسندیدہ بات اور غلط ہے اور ان اشیاء کی قسم جو ناپسندیدہ اور غلط ہے صاحب بدایی نے فرما یا کہ تم نے بیبات حلال کو حرام کر نے پر قیاس کر تے ہو گے کیا ہے کیونکہ اس کا قسم ہو نا نص سے ثابت ہے اور وہ اس لے کہ حضور علی الصلاۃ و السلام حضرت ماری رضي اللہ تعالی عنہ کو اپنے اوپر حرام کر لے خطا اللہ تعالی نے پرآ یت نازل فرما لی : " یَا یُّہَا النَّبِیُّ لِمَ تُحَرِّمُ مَا أَحَلَّ اللَّهُ لَکَ "۔ (۶۶ سورۃ اخریم ، آیت نمبر :۱ ) اے نبی جو چیز اللہ تعالی نے آپ کے لے حلال کی ہے اے اپنے اوپر کیون حرام کر تے ہو اور پچھر اللہ تعالی کا یہی ارشاد ہے : " قَدْ فَرَضَ اللَّهُ لَکُمْ تَحِلَّةَ أَیْمَانُکُمْ "۔ بقیہ کے صفحہ پر

سیدنا ثابت بن ضحاک رضی اللہ تعالی عنہ سے روایت ہے وہ نبی اکرم صلی اللہ علیہ وسلم سے روایت کر تے ہیں کر آپ نے ارشاد فرمایا کہ جو کوئی آدمی اسلام کے سوا کسی ذہب 1 کی جان بوجھ سے ماہی حاشیرے اللہ برزگ و برتر کے نام سے ہے کرے لہذا قسم نہیں کہ لائے گی اور کتاب الاصل میں جو پچھیاں کیا گیا ہے اس کی وجہ یہ کہ امانت جس کی نسبت اللہ کی طرف کی جاتی ہے قسم کہاتے وقت تو اس سے اللہ تعالی کی صفت مراد ہوتی ہے کیا تم نہیں دیکھتے کہ لا مین اللہ تعالی کے ناموں میں سے ہے اور امانت سے مشتق ہے خصوصاً قسم کے موقع پر جب مطلق ذکر کیا جاتا ہے تو اس سے اللہ تعالی کی صفت مراد ہوتی ہے رواجتا روا رخانی میں جہاں کر امانة اللہ قسم ہے اور امام طاوی نے ذکر کیا ہے قسم نہیں ہوگی اور امام ابویوسف رحمۃ اللہ علیہ کی ایک روایت ایسی ہے اور فتح القدیر میں ہے کہ ہمارے باس اور امام ماکو اور امام احمد رحمہ اللہ کے پاس یہ قسم ہے اور شافعی رحمۃ اللہ علیہ کے پاس نیت کا اعتبار ہے کیونکہ امانت کی تفسیر عبادات سے کی گئی ہے تم اس کے جواب میں کہتے ہیں کہ حرف قسم کے بعد جب امانت کا ذکر ہوتا قسم کا مراد لیا جانا ہے غالب ہے اس لے ضروری ہے کہ عام عادت کی بناء پراس کونیت پر موقف نہ رکھا جائے اس سے معلوم ہوتا ہے کہ خانی میں جو پچھیاں کیا گیا ہے وہ قابل اعتبار ورت ہے

کر ججویلی وشتم کہا ے گا وہ ویسا یہ ہے جسیا کر اس نے کہا ہے اور جو کوئی آدمی کسی وحاری دار پڑز

(تتحیار) سے خودشی کر لے تو 1 دوزخ کی آگ میں اس کو اسے مزادی جائی گی - (بخاری، مسلم)

ماقی حاشیہ - (66- اخریم، آیت نمبر:2) بلاشبہ اللہ تعالیٰ نے تمہارے لے تمہاری قسموں کا کفارہ مقرر فرمایا

بے اوراس کی تا تیر علا مہ مداحسن صدیقی صاحب نانوتوی کے قول سے بھی ہوتی ہے۔ جس کو آپ نے کرنے کے حاشیہ

میں مختلف شروط کے حوالوں سے فرمایا ہے کہ سیدنا عبد اللہ بن عباس رضی اللہ تعالیٰ عنہما نے ارشاد فرمایا جو کوئی آدمی

پیو دیت کی وشتم کہا ے تو وشتم میں شمار ہیا ممہنی رحمۃ اللہ علیکی روایت سے اس کی تا تیر ہوتی ہے۔ جس کو انہوں نے

زیر بن ثابت رضی اللہ تعالیٰ عنہ سے روایت کیا ہے۔ اس کے لے درختار اور رواختا ریں سے کرآ دی کا اس طرح کہنا بھی

قتسم میں شمار ہوتا ہے۔ اگر وہ ایسا کرے گا تو وہ یہودی ہے۔ یا نصرانی ہے۔ یا یہ کہ کہ میرے نصرانی ہوجائے یا

کافر ہو لے ساتھوثر کیے ہو نے پرت مگواہ رہو، یا پی کہ کہ (اگر وہ ایسا کرے گا تو) وہ کافر ہے ایسی صورت میں اگر وہ

قتسم توثرے گا تو اس مستند میں حال کو حرام کر نے کے مستند پر قیاس کر تے ہو نے کفارہ لازم آئے گا کیونکہ جب اس

نے شرط کو فری علامت قرار دیا اور اس کے قطعی طور ممتئح ہو نے کا عقیدہ رکھا ہے۔ اور اس کے ممتئح ہو نے کا حکم گنا کسی

دوسری وجہ سے بھی ممکن ہے اس لے تم اس کو قسم قرار دیتے ہیں۔ یہ حکم اس صورت میں ہے جبہی مستقبل کی بات ہو

اب ربا ماضی کا صیغہ جیے اگر میں ایسا کیا تھا تو کافر ہوں، یہودی ہوں اور اسی طرح سے حال کا صیغہ کہ جائے ہو نے

بھی کر ایا نہیں ہو اے (قتسم کہار پاہے) تو وہ یمین غموس ""ہے اس میں کفارہ نہیں ہے صرف توبہ البتر اس

کے کفر کے بارے میں اختلاف ہے لیکن قول اصح یہ ہے کہ قسم کہانے والا کافر نہیں ہوتا خواہ فعل ماضی کے ساتھ اس کو

متعلق کیا ہو یا مستقبل کے ساتھوثر طیئرا س کے اعتقاد میں یہ قسم ہواوراگروہ (قتسم کہانے والا) ناواقف ہو یا وہ بے حکمتا

ہے بھی میں غموس میں یا مستقبل میں شرط کے پائے جانے کی صورت میں کافر ہو جاتا ہے۔ تو ایسی دونوں صورتوں میں بھی

میں غموس اور میں منعقدہ میں کافر ہو جاتے گا۔ کیونکہ وہ کفر سے راضی ہے۔ میں غموس میں اس وقت کافر ہو جاتے گا

اور میں منعقدہ میں شرط پر عمل کر نے کی صورت میں کافر ہو جاتے گا۔ جسیا کر ابحر الرائق میں اس کی صراح ت ہے۔

اور جانو اس بات کو کہ صحیحین میں حضور پاک صلی اللہ علیہ وسلم سے ثابت ہے کرآ پر علیسہ نے ارشاد فرمایا جو

کوئی آدمی اسلام کے سوا کسی ذہب کی جان بو جہ کر ججویلی وشتم کہا ے گا تو وہ ایسا یہ ہے جسیا سے کہا، ظاہر ہے کہ

ارشاد غالب احوال کی بناء پر ہے کیونکہ عموماً جو کوئی اس طرح کی وشتم میں کہا تا ہے تو وہ صرف پر جان تا ہے کر اس طرح کی

قتسم توثرے پر کفر لا زم آ جاتا ہے۔ اگری بات ہے تو طیب ہے ورنہ جولوگ اس طرح کہنے پر مطلق کفر کے قابل ہیں، یہ

حدیث شریف ان کی دلیل ہے۔

۔ (قولہ: و من قتل نفسہ بحدیدة الخ (جوا دی اپنے آپ کو کسی وحاری دار پچیز سے بلاک لعنی خود کی

کر لے) فقہاء کرام اورامیل سنہ وجماعت کا اس بات پر اتفاق ہے کہ جو کوئی آدمی ---بقیہ اگلے صفحہ پر---

کوئی بیکہ کہ میں اسلام سے بری ہوں

Zayd ibn Thabit (may Allah be pleased with him) narrated: The Messenger of Allah (ﷺ) was asked about a man who says, “He is a Jew, a Christian, or free from Islam” in an oath he swears and then breaks it. He said: “The expiation of an oath.” [Narrated by Bayhaqi]

In the agreed-upon narration from Thabit ibn Ad-Dahhak (may Allah be pleased with him), the Messenger of Allah (ﷺ) said: “Whoever swears by a religion other than Islam is as he said. There is no vow for the son of Adam in what he does not possess. Whoever kills himself with something in this world will be tormented with it on the Day of Resurrection. Whoever curses a believer, it is as if he killed him. Whoever accuses a believer of disbelief, it is as if he killed him. Whoever makes a false claim to gain wealth, Allah will only increase his poverty.”

In a narration of theirs from Abu Hurayrah (may Allah be pleased with him), attributed to the Prophet (ﷺ): “Whoever says to his companion, ‘Come, let us gamble,’ let him give charity.”

(2) The statement: “Let him give charity”: The command to give charity is interpreted by the jurists as recommended, as evidenced by the fact that if one intends to give charity and does not, there is no obligation of charity or anything else, but a good deed is recorded for him. [From “Umdat al-Qari”]

یہودی ہوجائے نکی قسم

سید نا بریدہ رضی اللہ تعالیٰ عمنہ سے روایت سے کہ رسول اللہ صلی اللہ علیہ وسلم نے ارشاد فرمایا کہ جو کوئی کہ کہ میں اسلام سے بری ہوں 1 اگروہ ججو طاہے تو وہ ویا کی سے جسیا کراس نے کہا اگروہ سپاہے تو وہ اسلام کی طرف سلامتی کے ساتھ برگزوالپس نہیں آ سے گا لیجن وہ گنجہ کار ہوگا )۔(ابوداود، نساوی، ابن ماجہ)

ماقی حاشیہ اپنے آپ کو قتل کر لے کہا لیجن خودشی کر لے گا تو اس کی وجہ سے وہ اسلام سے خارج نہیں ہوگا حضرت امام اعظم اور امام محمد رحمہما اللہ نے فرمایا کر اس کو غسل دیا جائے اور اس پر نماز پڑھی جائے گی اور اس پر فتویٰ ہے اگر چیئے اس کا گناہ (خودشی کا) کسی دوسرے کو قتل کرنے سے بڑا ہو کرے۔ حضرت کمال نے حضرت امام ابو یوسف رحمۃ اللہ علیہ کے قول کو ترجیح دی ہے کر اس کو غسل دیا جائے گا لیکن اس پر نماز (جنازہ) نہیں پڑھی جائے کی کیونکہ مسلم شریعہ میں ہے حضور علیہ الصلاۃ والسلام کی خدمت میں ایک ایس شخص (جنازہ) کولایاگیا جس نے خودشی کر لی ہے آپ علیہ الصلاۃ نے اس پر نماز نہیں پڑھی۔ جس راہ میں ہے کہ (الا اقوال کی) توجہ میں اختلاف ہے لیکن امام ابو یوسف رحمۃ اللہ علیہ کے قول کو حدیث شریعہ کی تائید حاصل ہے۔ لیکن میں کہتا ہوں کہ حدیث شریعہ میں اس پر کوئی ولايت نہیں ہے کیونکہ اس حدیث شریعہ میں صرف یہ ہے کہ حضور علیہ الصلاۃ والسلام نے اس پر نماز نہیں پڑھی۔ خاطر ہر یہ کہ آپ علیہ الصلاۃ نے دومروں کواس جیئے (برے) عمل سے روکنے کے لیے نماز نہیں پڑھی جسیا کہ آپ علیہ الصلاۃ قرض دار پر نماز پڑھنے سے مجی رک کے گئے تھے۔ اس سے یہ لازم نہیں آتا کہ صحابہ میں سے کسی نے ان پر نماز نہیں پڑھی کیونکہ آپ علیہ الصلاۃ کی اور دومروں کی نماز کے درمیان میں کوئی برابری نہیں ہے۔ (بہت بڑا فرق ہے) اللہ تبارک و تعالیٰ کا ارشاد ہے:

"انَّ صَلوتَکَ سَگن " لہُمْ " (9_ التوبة، آیت نمبر:103) "آپ علیہ الصلاۃ کی دعاں کے لئے باعث سکون ہے " پھر (یعنی) یاد کرو کہ یسب اس آدمی کے بارے میں ہے جو اپنے آپ کو عمدہ قتل کرے۔ اب ربابی کا اگراس کاپی عمل غلطی سے ہوتا اس پر نماز پڑھی جائے گی۔ اس میں (کسی کو) اختلاف نہیں ہے جسیا کہ اس کی صراحت کفا یا اور اس کے سوا عمدۃ القاری، ویختارا ورداختار میں ہے۔

1 (قولہ: من قال انی برئی من الاسلام انہ ابینہمام نے فرمایا کر اس کا کہناوہو برئی من الاسلام ان فعل کذا ہے (اگروہ ایا کرے گا تو اسلام سے بری ہے)اوریہمارے پاس تمہے اور اس طرح ہو بری من الصلاۃ والصوم (وہ نماز سے بری ہے، روزہ سے بری ہے) کہنا جسی تمہے ہے (مرقات)

شخ الاسلام علامہ بنی نے فرمایا کہ نذورہ قسم کہا نے والے کی قسم منعقدہو جائے گی حلال کو حرام کرنے پرتیاس کرتے ہوئے اس پر کفارہ لازم ہوگا۔ کیونکہ اس کا قسم ہونا ضرور ثابت ہے اور اس لے بھی کہ الشدتاب کر وتعالیٰ نے ظہار کرنے والے پر کفارہ واجب فرمایا ہے جبکہ وہ (ظہار) ناپیندیدہ اور ججوی بات ہے اور ان اشياء کی قسم کہانا، ناپیندیدہ اور ججوی طہے۔

It is narrated on the authority of Abu Barida (RA) that the Messenger of Allah ﷺ said:

Whoever says, 'I am free from Islam,' even if he is then purified, will be like the one who says, 'I am free from Allah,' and if he is then saved, he will not return to Islam with safety, even if he performs good deeds.

Regarding the person who commits suicide, it is said that if he kills himself, he will not be considered to have left Islam. Imam Abu Hanifah and Imam Muhammad (may Allah have mercy on them) stated that he should be given a ritual bath (ghusl) and funeral prayers (janazah) should be performed for him. It is also ruled that his sin (of suicide) may be greater than that of killing another person. Imam Kamal preferred the opinion of Imam Abu Yusuf (may Allah have mercy on him) that he should be given a ritual bath but no funeral prayers should be performed for him, because according to Islamic law, there was an instance where a person who committed suicide was brought to the Prophet (peace be upon him), and he did not perform the funeral prayers for him. There is a difference of opinion regarding this, but Imam Abu Yusuf’s (may Allah have mercy on him) opinion is supported by the hadith of the Shariah. However, I say that there is no explicit directive in the hadith of the Shariah, as it only states that the Prophet (peace be upon him) did not perform the funeral prayers for him. The reason being that the Prophet (peace be upon him) refrained from performing the funeral prayers to deter others from committing evil deeds, such as when he refused to pray for a debtor. This does not necessarily mean that none of the Companions prayed for him, as there is a significant difference between the prayers of the Prophet (peace be upon him) and those of others. Allah, the Most High, says: 'Verily, your Salah (prayer) brings them peace' (9:103). This refers to a person who intentionally kills himself. If someone commits suicide unintentionally, funeral prayers should be performed for him, and there is no disagreement about this, as it is clearly stated in various sources, including the Siraat and other authentic narrations.

(Regarding the statement): 'Whoever says, “I am free from Islam” or “If I do such and such, I am free from Islam,”' Imam Abu Hanifah (may Allah have mercy on him) stated that if someone says, “I am free from Islam” or “If I do such and such, I am free from Islam,” and then performs that act, he is considered to have left Islam. Similarly, if someone says, “I am free from prayer and fasting,” it means he has abandoned prayer and fasting (as per the Maraqi).

The scholar of Islam, Imam Ibn Nujaym (may Allah have mercy on him), stated that the oath or vow made by someone who swears to make something lawful unlawful must be fulfilled, and expiation (kaffarah) will be required. This is because the oath must be binding, and just as Allah, the Exalted, has made expiation obligatory for those who make a declaration (zihar), which is an unseen and baseless matter, the same applies to oaths and vows that are unseen and baseless.

It is narrated from Ibn 'Abbas (RA) that he said:

The Messenger of Allah ﷺ said: 'Whoever becomes Jewish and swears by a good oath, his oath will be binding.' This was said concerning a man.

سیدنا زید بن ثابت رضی اللہ تعالیٰ عنہ سے روایت ہے کہ رسول اللہ صلی اللہ علیہ وسلم نے ایک آدمی کے بارے میں دریافت کیا گیا کہ جب وہ کسی چیز کی قسم کہا تا تو کہتا ہے کہ (اگروہ ایسا کرے گا) تو وہ یہودی ہے یا نفرانی ہے یا اسلام سے بری ہے۔ پھر وہ قسم توڑتا ہے تو آپ علیہ صلی اللہ نے ارشاد فرمایا (اس پر) قسم کافارت ہے۔ (تہقیق)

سیدنا ثابت بن ضحاک رضی اللہ تعالیٰ عنہ سے روایت ہے کہ رسول اللہ صلی اللہ علیہ وسلم نے ارشاد فرمایا کہ جو کوئی اسلام کے سوا کسی نہہب کی ججوی قسم کہا تو وہ ایسائی ہے جسیا کہ اس نے کہا (گویا وہ ان نہہب والوں کی طرح سے ہوگیا)۔ انسان 1 پرجس چیز کا وہ ما کہ نہیں ہے اس میں نذر حقیقی ہوتی اور جو کوئی دنیا میں کسی چیز سے خود کشی کر لے گا تو اس کو اس چیز سے قیامت کے دن سزا دی جائے گی۔ اور جو کوئی کسی مسلمان پر لعن کرے گا تو یہ اس کو قتل

کر دینے کی طرح سے ہے۔ اور جو کوئی کسی مسلمان پر فریبہیتمت لگائے گا تو اس کو قتل کر دینے کی

طرح سے ہے۔ اور جو کوئی جھوٹا عومی کرے گا اس سے (اپنی چیز میں) اضافہ کرنے کی غرض سے تو

اللہ تعالیٰ اس کے نقصان میں اضافہ کرے گا (جس وہ کم ہوتی جائے گی)۔(بخاری و مسلم)

آ، میں تیرے ساتھ جو آکھیتا ہول

Zayd ibn Thabit (may Allah be pleased with him) narrated: The Messenger of Allah (ﷺ) was asked about a man who says, “He is a Jew, a Christian, or free from Islam” in an oath he swears and then breaks it. He said: “The expiation of an oath.” [Narrated by Bayhaqi]

In the agreed-upon narration from Thabit ibn Ad-Dahhak (may Allah be pleased with him), the Messenger of Allah (ﷺ) said: “Whoever swears by a religion other than Islam is as he said. There is no vow for the son of Adam in what he does not possess. Whoever kills himself with something in this world will be tormented with it on the Day of Resurrection. Whoever curses a believer, it is as if he killed him. Whoever accuses a believer of disbelief, it is as if he killed him. Whoever makes a false claim to gain wealth, Allah will only increase his poverty.”

In a narration of theirs from Abu Hurayrah (may Allah be pleased with him), attributed to the Prophet (ﷺ): “Whoever says to his companion, ‘Come, let us gamble,’ let him give charity.”

(2) The statement: “Let him give charity”: The command to give charity is interpreted by the jurists as recommended, as evidenced by the fact that if one intends to give charity and does not, there is no obligation of charity or anything else, but a good deed is recorded for him. [From “Umdat al-Qari”]

It is narrated on the authority of Abu Hurairah (RA) that he said, raised to the Prophet ﷺ:

If any man says to his companion, 'Come, if I swear by you, I will give charity,' and then swears by him, it is obligatory to give charity.

اور ان، یہ سے (ابو ہریرہ رضی اللہ تعالیٰ عنہ ) سے روایت سے کر رسول اللہ

صلی اللہ علیہ وسلم ارشاد فرمائے اگر کوئی آدمی کسی چیز پر سم کہائے اوراس سے بہتر کوئی دوسرا چیز

وکیے تو بہتر چیز کو کرے .......

1.(قولہ : فليتصدق ( اس کو صدق کرنا چاہیے ) ایسی صورت میں صدقہ کا حکم فقہاء کے پاس استحباب پر

محمول ہے اس کی دلیل میں کر صدقہ کرنے کا ارادہ کرنے والا جب صدقہ ذکرے تو اس پر صدقہ وغیرہ کی کوئی چیز

واجب نہیں بلکہ اس کے لئے ( اس کی نیت کی وجہ سے ) نہیں کہودی جائے گی -(عمدة القاري)

2.(قوله : فر آئے غیرہا خیرا منها : الخ ( کوئی دوسرا بہتر چیز دیکھے ) صاحب بدایین فرمایا ہے اگر

کوئی آدمی کسی گناہ پر سم کہائے مثلًا نماز نیں پڑنے گا ایا پن والدت باتنیں کرے گا افاللہ کو قتل کرے گا تو ایسے

آدمی کو چاہیے کہ وہ اپنی قسم توڑ دے۔

ابن حمام رحمۃ اللہ علیہ نے ارشاد فرمایا ہے کہ ایسے آدمی پر سم توڑنا اور کفارہ دینا واجب ہے اور دا اختار میں ہے کہ پی

بات بعید نہیں کہ فقہاء کے قول "اوّل" سے مراد و جواب، یہ ہو اور کتاب "مجمع" میں اپنے قول "ترجیح البر کو"

( جیسے نیک واختیار کرنا قابل ترجیح ہے ) بیان کیا ہے اور صاحب بداییہ صاحب کنز الاوران کے علاوہ دیگر علماء کا قول ہے

اس کے قریب ہے اور جو کوئی آدمی کسی گناہ پر سم کہائے تو اس کو سم توڑنا چاہیے اور بلاشبہ سم توڑنا واجب ہے جسیا کہ تم

کو معلوم ہوا کیونکہ لفظ "ینبغی" سے ان علماء نے و جوب مراد لیا ہے باوجود یہ اس کا آخر استعمال غیر و جوب میں

ہے۔ راپیاہ جسیا کہ تم کہتے ہو مسلمان کے لئے نماز پڑھنا زیادہ بقیہ اے گل صغیر پر

اوراپنی قسم کا کفارہ دے۔۔۔3(مسلم)

قتسم کے بعداورقتسم توثرنے سے پہلے کفارہ دینا-اس میں علماء کے اختلاف کیاہے-امام شافعی، امام

ماکے، امام احمد رحمہ اللہ نے اس کو جائز قرار دیاہے-البتہ امام شافعی رحمۃ اللہ کے پاس اس میں تفصیل ہے-وہ یہ

فرماتے ہیں کہ قتسم توثرنے سے پہلے روزہ کے ذریعہ کفارہ ادا کرنے جائز نہیں ہے-البتہ کفارہ میں غلام کوآزاد کرنا، کھانا

کھلانا، یا کپڑے دینا، قتسم توثرنے سے پہلے جائز ہے-جبسیاکہ سالگزرنے سے پہلے پیشگی زکوۃ ادا کرنے جائز ہے لیکن

رمضان شریف کے آنے سے پہلے اس کے روزے رکھنا جائز نہیں ہے-امام عظیم ابوحنیفہ رحمۃ اللہ علیہ اورآپ کے

اصحاب نے فرمایاکہ قتسم توثرنے سے پہلے کسی بھی قسم کا کفارہ نہیں ہوسکتا-یہ حال تک کہ اگر قتسم توثرنے سے پہلے کفارہ

دیدےاور کفارہ دینے کے بعد قتسم توثرنے تودوبارہ کفارہ دیناپڑے گا-یعنی اس قتسم میں جو مستقبل سے متعلق ہے کفارہ کے

واجبنے کا وقت قتسم توثرنے جانے کا وقت ہے-پس کفارہمارے پاس قتسم توثرنے کے بعد، یا واجب ہوتا ہے-

اورحضرت امام شافعی اوردوسرے ائمرحمہ اللہ کے پاس کفارہ کے وجوب کا وقت قتسم کے پانے جانے کا وقت

ہے-اس لے ان کے پاس قتسم کے منعقد ہونے کی اس کو توثرنے بغیر (بھی) کفارہ واجب ہوجاتا ہے-خلاصہ یہ کہ ان

کے پاس قتسم کفارہ کا سبب ہے اور قتسم توثرنے اس کے لے شرط ہے، اس لے سب پانے جانے کے بعد کفارہ ادا کرنادرست

ہے کیونکہ کفارہ کی نسبت قتسم کی طرف کی جانب ہے-

اللہ تعالیٰ کا ارشاد ہے: "ذِلْکَ گَفَارَةُ أَيْمَانِكُمْ إِذا حَلَفْتُمْ"۔ (5- المائدة، آیت نمبر:89)(یہ

تمہارے قسمول کا کفارہ ہے جب تم قسم کھاؤ)اوریا آیت سے یہ کیونکہ درحقیقت واجبات کی نسبت ان کے اسباب

کی طرف کی جانب ہے جسیا کہ کھانا جاتا ہے پر کفارۃ القتل، کفارۃ الظهار، کفارۃ الافطار-(یعنی کفارہ واجب

ہے اوراس کے اسباب قتل، ظہار افطار یعنی روزہ توطرنا وغیرہ ہیں)-

اورتمہارے پاس قتسم توثرنے کفارہ کے وجوب کا سبب ہے-اور قتسم شرط ہے کیونکہ قتسم اس کو پورا کرنے کے ارادہ

سے ہوتی ہے-اوراس چیزوپورا کرنے کی غرض سے جس پرتعم کیار باہے-اور۔۔۔بقیہ اغلصفحہ پر۔۔۔

مانت حاشیہ اپن قسم میں سپاکی کو طاہر کرنے کے لئے ہوئی ہے۔ اوراس کا ثر عا حکم ویاگیاہے۔اوری اللہ تعالیٰ

کے اس ارشاد کے بناء پر ہے کفر ما یا: "وَا ح ف ظ وا آیما نکم" (5 المائدة،آیت نمبر :89 ) اپے قسمول کی

حفاظت کرو)۔ اس لئے قسم کفارہ کے لئے سب بھیں بنی کیونکہ سبب کا کم سے کم مرتبہ پیہ کروہ مفضی اللی

الحكم (کسی چیز کے حکم کا باعث یا س تک لے جانے والی ہوئی ہے) اوراس کے لئے ذریعہ تو اورتم بہال اس

کے لئے مانح ہے تو وہ سبب کی بنگی لہذا اقتسم مفضی الی الكفارۃ (کفارہ کا باعث) نہیں ہوگی بلکہ کفارہ کا

باعث قسم توڑناہے جبکہ وہ تم کے بعد پاپا جاے تویہ قسم کو توڑنا سبب ہوگا اورتم اس کے واجب ہو نے کے لئے شرط ہوگی

پس قسم توڑنے سے پہلے پشتشکی کفارہ ادا کرنا جائز نہیں ہوگا کیونکہ اس سے سبب کا مقدم ہونالازم آ گا۔

آیت کریم میں جواضافت ذکور ہے وہ شرط کی طرف سے اورثرط کی طرف اضافت شرعی احکام میں جاتزاور

ثابت ہے جسے احرام اورصدقہ فطر کے کفارہ میں ہے۔ یہاں بالفرض قسم کا سبب ہونا تسلیم کرلیا جاے تواس میں کوئی

شک نہیں کر قسم کا توڑنا وجوب کی شرط ہے کیونکہ یہ بات قطعی ہے کہ کفارہ اس سے پہلے واجب نہیں ہوتا۔ ورنہ محض قسم

سے کفارہ واجب ہوجاے گا۔ اورکوئی مشروط اپنی شرط سے پہلے پاپہیں جاتا تو کفارہ کچھ اس سے پہلے واجب نہیں ہوگا

اور وجوب اپنے ثبوت سے پہلے یاثبوت کے بعد کی ایسے فعل سے جواب واجب ہو نے سے پہلے کیاگیاہے ساقط نہیں ہوتا۔

اب رباحدیث شریف تواس میں متعدد روايتین میں ایک روایت میں "فلیات الذی هو خیر

ولکیفر عن يمينه " پس چاہے کروہا پنی قسم کافارہ دے اورجوچیز بہتر ہے اس اختیار کرے ) ہے اور ایک

روایت "فلیات الذی هو خیر ثم ليکفر بیمینه " (جوچیز بہتر ہے اس اختیار کرے پھرا پنی قسم کافارہ دے ) ہے۔

پیساری روايتین ان کے خلاف پیں جو قسم توڑنے سے پہلے کفارہ دینے سے کفارہ ساقط ہو نے کے قائل ہیں۔ اوراس

میں ان کے لئے کوئی ویل نہیں ہے۔ کیونکہ اگر کفارہ محض قسم ہی سے واجب ہوتا تو حضرت علی والصلوۃ السلام حس

چیز پرتم کحالی جاری اس کا زکر کہ بخیری یول ارشاد فراما "من حلف على يمين فليكفر "(جولوئی کس چیز پر

قسم کہا ہے تو وہ کفارہ دے ) مگراس کے برخلاف پیارشا ادفر ما اگیاہے کروہ چیز جس پرتم کحالی ہی سے اچھی نہ ہوتی قسم

توڑ کر کفارہ دینے کا حکم فرمایا۔

کسی ایسی چیز پرتم جس کا توڑنا اس کو پورا کر نے سے بہتر ہے اس کو آپعلیسوۃ نے توڑ کر کفارہ دینے کا

خصوصیت سے حکم فرمایا س لئے کہ کفارہ قسم توڑنے سے ہے نہ کہ محض قسم کہانے سے۔۔۔بقیہ اگل صفحہ پر۔۔۔

It is narrated from Abu Hurairah (RA) that the Messenger of Allah ﷺ said:

If someone curses a thing and there is something better than it, then let him do the better thing.

1. (His saying: 'Let him give in charity' - it is such that in this situation, the ruling of charity according to the jurists is one of desirability. If someone intends to give charity in his heart and then mentions charity, there is no obligation or anything else incumbent upon him, nor will he be blamed for it - (Imad al-Qari).

2. (His saying: 'But let him come with something better than that' - the author of Badai' says that if someone swears an oath to commit a sin, such as not praying, speaking ill of one's parents, or killing someone, then that person should break his oath. Ibn Humam (RA) has stated that breaking the oath and paying expiation (kaffarah) is obligatory for such a person. In this regard, it is not far-fetched to say that the word 'awwal' (first) implies the answer, and in the book Majma', it is stated that 'preferring the good option is preferable.' The opinion of the author of Badai' is close to that of the scholars other than the author of Kunuz al-Urwan, who state that if someone swears an oath to commit a sin, they should break their oath, and without doubt, breaking the oath is obligatory, as you know, because the scholars have derived the meaning of obligation from the word 'yandabi' (it is necessary), although its final usage is in a non-obligatory context. As you say, for a Muslim, praying is more important than giving a small amount of charity and paying the expiation for one's oath - (Muslim).

3. (His saying: 'Let him come with what is better and expiate for his oath' - it should be known that there are three conditions for expiation:

1. Before taking the oath (expiation) - this is unanimously considered expiation.

2. After taking the oath and before its fulfillment (expiation) - this is also unanimously considered expiation.

3. After taking the oath and before its fulfillment (expiation) - there is a difference of opinion among the scholars. Imam Shafi'i, Imam Malik, and Imam Ahmad (RA) have deemed it permissible. However, Imam Shafi'i (RA) has detailed this, stating that expiation through fasting is not permissible before the oath is broken. However, expiation by freeing a slave, feeding, or clothing someone is permissible before the oath is broken. This is similar to how paying zakat in advance is permissible before the year ends, but fasting in Ramadan is not permissible before it arrives. Imam Abu Hanifah (RA) and his companions have stated that expiation is not possible before the oath is broken. If expiation is paid before the oath is broken, and after paying expiation, the oath is broken, then expiation must be paid again. This means that for oaths related to future actions, the time for the obligation of expiation is when the oath is broken. Therefore, expiation is due after the oath is broken, or it becomes obligatory.

For Imam Shafi'i and other Imams (RA), the time for the obligation of expiation is when the oath is broken. Therefore, in their view, expiation is obligatory even if the oath is not broken. In summary, for them, the oath is the cause of expiation, and breaking the oath is the condition for it. Thus, expiation is valid after all conditions are met, as expiation is related to the side of the oath.

Allah Almighty says: 'That is the expiation for your oaths when you swear' (5:89). This verse indicates that obligations are related to their causes, such as food being consumed, expiation for murder, expiation for zihar, and expiation for breaking fasts (i.e., expiation is obligatory, and its causes include murder, zihar, and breaking fasts, etc.).

For you, breaking the oath is the cause of expiation, and the oath is the condition, as the oath is taken with the intention of fulfilling it, and the purpose is to fulfill what is sworn. ...

The marginal note states that the purpose of the oath is to purify speech, and its effect is a legal ruling. This is based on Allah's command: 'And be mindful of your oaths' (5:89). Therefore, the oath is the cause of expiation because the cause must precede the effect, which is a principle in legal rulings, and the means must be established for the cause. Hence, taking an oath does not lead to expiation; rather, breaking the oath is the cause of expiation. When a sin occurs after the oath, breaking the oath becomes the cause, and it is a condition for expiation. Therefore, expiation cannot be performed before the oath is broken, as this would reverse the order of cause and effect.

In the noble hadith, there are multiple narrations. One narration states: 'Let him come with what is better and expiate for his oath,' meaning he should pay expiation for his oath and choose the better option. Another narration states: 'Let him come with what is better, then expiate for his oath,' meaning he should choose the better option and then pay expiation for his oath. Those who hold that expiation can be performed before breaking the oath and thereby nullify the need for expiation have no strong basis. If expiation were obligatory merely by taking the oath, then Ali (RA) would have mentioned this in the context of a specific matter, advising, 'If someone swears an oath, let him expiate.' However, the opposite occurred, where he advised that if a better option is available, the oath should be broken and expiation paid. For matters where breaking the oath is better than fulfilling it, the Prophet (SAW) specifically ruled that expiation is due after breaking the oath, not just by taking the oath. ... حضرت عبد الرحمٰن بن سمرہ رضی اللہ عنہ سے روایت ہے کر رسول اللہ صلی اللہ

علیہ وسلم کو توڑنے بغیر محض قسم کھانے سے کفارہ واجب نہیں ہوگا۔ وہ زیوروايتین جسی تمارے

لئے حجت ہیں کیونکہ حرف واو کے ساتھ آنے والے جو تقدیم وتأخیر کا لاحظ کے بغیر مطلق جمع کے لئے خواہ کفارہ کا ذکر

مقدم ہو یا مؤخر ہواس میں قسم توڑنے سے پہلے کفارہ کے لئے جواز نہیں ہے۔ اس طرح بعض روایتیں جس میں ذکر ہے

فلیات بالذی ہو خیر ثم لیکفر عن يمينه وہ کافر لے جو بہتر ہے پھر اپنی قسم کا پہلے کفارہ دے۔ البتن

ابوداودشريفاور سننسالی میں جوالقاظآ لے جیوہی جیں اذا حلفت على يمين فکفر عن يمينک ثم

اثت الذی ہو خیر جب تم کسی چیز پرتم کھاو تو اپنی قسم کا کفارہ دو پھروہ کافر وجواس سے بہتر ہے۔

اگریحدیث درجہ صحیح میں لے تو اس کی تاویل یہ کہ لفظ ثم اس حدیث میں واو کے معنی میں لے اس

طرح سے مختلف روایتیں مجعہوجاتی ہیں لفظ ثم کا واو کے معنی میں استعمال ہوتے کی ویل اللہ تعالیٰ کا یارشاہ

سے کرفرمایا: أو مسکينا ذا متربة۔ ثم كان من الذين امنوا۔ (یاخاک نشیبن محتاج کو کھانا کھلتا اور ان

لوگول میں ہوتا جوابیان لے آے(90 البدر، آیت نمبر:16/17) اس میں لفظ ثم واو کے معنی میں لے کیونکہ

اعمال صالح ایمان سے پہلے معترفیں اور اس لے قسم توڑنے سے پہلے کفارہ واجب نہیں ہوتا اور اگر اسی کی ہوتا جسیا

انہوں نے کہاہے تو پہلے کفارہ واجب ہوجاتا پھر عمل حکم میں اس کے بعد قسم توڑنا ہوتا کیونکہ اس کا حکم اس کے بعد آیا

سے اور اگر پہلے یا بعد سے طرح کفارہ دونیں کا اختیار دیا جاتے تو ثم کے معنی پرمل نہیں ہوگا نیز (ہماری ویل)

یہی سے کراماشفی رحمۃ اللہ علیہ کے پاس اس کی تمام قسموں کا نام کفارہ ہے۔ اس طرح ان کے پاس قسم توڑنے کے

بعد کفارہ کواس کی تمام قسموں پر حمول کیا گیاہے اور قسم توڑنے سے پہلے لفظصرف بعض قسموں کے لے مختص کیا گیا

ہے جس کی وجہ سے لفظ کفارہ کے ظاہری معنی تین وجب سے چھوٹ رہے ہیں۔

(1) لفظ کفارہ کفر سے ہے اور جس کے معنی چھپانے کے پیں کفارہ کواس لے کفارہ کیتے ہیں کروہ گناہوں کو

چھپاتاہے اور قسم توڑنے سے پہلے کوئی جنايت (جرم) نہ نہیں ہے کہ جس کو چھپایا جاتے لہذا ایگناہ سرزدہوں کے

بعد میں متصور ہوگا۔

(2) دوسرا وجہ یہ کہ اس میں امر کو جوب سے جواز کی طرف پیچرنالازم آتاہے۔

(3) تیسری وجہ یہ کہ ایک صورت میں کفارہ اپنی بعض قسموں کے ساتھ مخصوص ہو جاتے گا۔ (ماخوذ از نبل

الاوطار، برائع، عمدة القاری، عمدۃ الرعاية، فتح القدیر، ثروح کنز)

علیہ وسلم نے ارشاد فرمایا کہ اقتدارطلب مت کرو کیونکہ تم کو اقتدار بھی رما لگے کے عطاہو جاے تو اس پر تمہاری مد کی جائے گی۔ اور اگر ما لگے کے بعد عطاہو تو تم اس کے حوالے کردے جائو گے۔ اور جب تم کسی چیز پر قسم کھائے۔ اور دوسری چیز اس سے بہتر و یہو تو اس کام کو جو بہتر ہے اسے کرواورا پی قسم کا کفارہ دیرو اوراس میں "فکفر" (لیعن) فاء کے ساتھ جو روایت آئی ہے۔ (بخاری)۔

It is narrated from Abdur-Rahman bin Samurah (RA) that he said:

The Messenger of Allah ﷺ said: 'No expiation is required for merely taking an oath without breaking it. These are the evidences for you, as the conjunction 'and' (و) indicates an absolute plural without regard to sequence, whether the mention of expiation comes first or last. There is no validity for expiation before breaking the oath. Thus, some narrations state: 'Let him do what is better, then make expiation for his oath.' And in the narration of Abu Dawud al-Sharif and Sunan al-Salih, it is stated: 'If you take an oath, then make expiation for your oath, and do what is better.' When you swear an oath on something, make expiation for your oath, and then do what is better. If the hadith is of sound authenticity, its interpretation is that the word 'then' (ثم) indicates the sequence.'

In this hadith, different narrations are reported regarding the meaning of 'wa' (and) in place of 'then'. The word 'then' (ثم) is used in the sense of 'and' as Allah's Messenger (SAW) asked his friend and benefactor: أو مسکينا ذا متربة (O poor one, covered with dust). ثم كان من الذين امنوا (Then he was among those who believed) (Al-Buruj, verse number: 16/17). Here, the word 'then' (ثم) is used in the sense of 'and' because righteous deeds are acknowledged before faith, and similarly, expiation (kaffarah) is not obligatory before breaking an oath. If it were otherwise, as they said, then expiation would be obligatory first, followed by the command, and then breaking the oath, because the command came afterward. If both options for expiation were given either before or after, the meaning of 'then' (ثم) would not be preserved. Moreover, according to Imam Shafi (RA), all forms of expiation are called 'kaffarah.' Thus, expiation is imposed on all forms of breaking an oath, while before breaking the oath, the word is limited to some forms, which is why the apparent meaning of 'kaffarah' is less than three obligations.

(1) The word 'kaffarah' comes from 'kufr' (disbelief), and its meaning is to conceal. Therefore, expiation is performed to cover sins, and there is no sin before breaking the oath that needs to be concealed, so it is only considered after committing a sin.

(2) Another reason is that it implies a shift from obligation to permission.

(3) A third reason is that in one instance, expiation will be specific to some of its forms. (Extracted from Nabil Al-Awtar, Bulugh Al-Maram, Umdah Al-Qari, Umdah Ar-Raayah, Fath Al-Qadir, Thuruq Al-Kanz)

The Prophet (SAW) said: 'Do not seek power, for if you are granted power, you will be held accountable for it. And if you are not granted it, you will be held accountable for not being granted it. And when you swear an oath about something, and another thing better than it comes to you, do the better thing and expiate for the oath.' In this, the narration that came with 'فکفر' (for expiation) using 'fa' (and) is reported (Bukhari).

ابوالاحص عوف بن ما کے نے اپنے والد سے روایت کی ہے کہ میں نے عرض کیا یارسول اللہ میرے پچازاد بھائی کے بارے میں آپ کیا فرماتے ہیں میں ان کے پاس جاتا ہوں اور ما لگتا ہوں تو وہ مجھے نہیں دیتا اور میرے ساتھ صلحتی نہیں کرتے ہیں۔ پھر جب ان کو میری ضرورت ہوتی ہے تو میرے پاس آتے ہیں اور مجھے ما لگتے ہیں اور میں قسم کھاتا ہوں کہ میں ان کو نہیں دونگا اور ان کے ساتھ صلحتی نہیں کروں گا۔ تو حضور پاک صلی اللہ علیہ وسلم نے مجھے حکم دیا کہ میں ان کے ساتھ ہوہ برتا کر وں جو بہتر ہے اورا پی قسم کا کفارہ دول (نسائی)۔

Abu Al-Ahwas 'Awf bin Ma'k narrated from his father that

I said, 'O Messenger of Allah ﷺ, what do you say about my half-brother? When I go to him and give him money, he does not accept it, and he does not reconcile with me. Then when he needs me, he comes to me, and I give him money, and I swear that I will not give him anything and will not reconcile with him.' So, the Blessed Messenger ﷺ commanded me to treat him with what is better and to give the expiation for the oath (Diu al-Nisa').

سیدنا ابوہریرہ رضی اللہ تعالیٰ عنہ سے روایت ہے کر رسول اللہ صلی اللہ علیہ وسلم نے ارشاد فرمایے کہ اگر کوئی آدمی اپنے گھر والوں کے بارے میں قسم کا کر قسم پرمصر رہے تو یہ اللہ تعالیٰ کے پاس قسم کو توڑ کر اللہ کے فرض کردہ کفارہ دینے سے بڑھ کر گناہ کی چیز ہے۔ کیونکہ ایسی قسم پر قائم رہنا حقوق کو تلف کرنا ہے۔ (مشتق علیہ)۔

Abu Hurayrah (may Allah be pleased with him) narrated: The Messenger of Allah (ﷺ) said: “By Allah, for one of you to persist in his oath regarding his family is more sinful in the sight of Allah than giving the expiation that Allah has obligated upon him.” [Agreed upon]

لا نیلج احد کم بیمینہ الخ : اگر کوئی آدمی اپنے گھر والوں کے بارے میں قسم کا کر قسم پرمصر رہے۔ اس حدیث شریف کا مضمون یہ ہے کہ اگر کوئی آدمی کسی بات پر قسم کھائے پھر اس سے بہتر دوسری چیز دکھ تو اس کو چاہیے کہ اس قسم کو توڑے۔ اور دوسری بہتر چیز عمل کرے۔ اور کفارہ دے۔ اور ابل و عیال کے متعلق کسی مستند میں قسم جس کو پورا کر نے سے ان کو ضروری نہیں پتا ہے۔ اور ان کا حق ضائع ہوتا ہے۔ تو یہی مجمل النصورتول کے بہ جس میں قسم توڑ کر اس سے بہتر اورا تھہ کا مکوا اختیار کرنا چاہیے۔ اب یہ بات باقی رہتی ہے کہ اس تم تفضیل کے صیغے سے بھی میں آتا۔ بقیہ کے صفحہ پر۔۔۔۔

اور ایسے (یعنی سیدنا ابوہریرہ رضی اللہ تعالیٰ عنہ) روایت سے کر رسول اللہ صلی اللہ علیہ وسلم نے ارشاد فرمایا کہ تمہاری قسم اس چیز پر ہوگی جس پر تمہارا فریق تمہاری قصد یقین کرے۔ (مسلم)

It is narrated on the authority of Abu Hurairah (RA) that the Messenger of Allah ﷺ said:

Your oath will be binding concerning that thing which your community confirms as your intention.

ا نہیں سے (سیدنا ابوہریرہ رضی اللہ تعالیٰ عنہ) مرویہ آپ نے فرمایا کر رسول اللہ صلی اللہ علیہ وسلم نے ارشاد فرمایا قسم کہ لا نے والے کی نیت کے مطابق ہوتی ہے۔ (مسلم) اس حديث شريف کے بارے میں کہا گیا ہے کہ یہاں قسم کہ لا نے والے سے مراد مظلوم ہے جو تم کہا رہا ہے۔

Abu Hurayrah (may Allah be pleased with him) narrated: The Messenger of Allah (ﷺ) said: “Your oath is based on what your companion believes you on.” [Narrated by Muslim]

In another narration by him, he narrated: The Messenger of Allah (ﷺ) said: “The oath is based on the intention of the one who demands it.” It is said: This is interpreted as applying to the one who demands it if he is wronged.

Ahmad and Ibn Majah narrated from Suwayd ibn Hanzalah: We set out intending to meet the Messenger of Allah (ﷺ), and with us was Wa’il ibn Hujr. An enemy of his seized him, and the people refrained from swearing, but I swore that he was my brother, so he released him. We came to the Messenger of Allah (ﷺ), and I mentioned that to him. He said: “You were the most righteous and truthful of them. You were truthful; the Muslim is the brother of the Muslim.”

Ibrahim an-Nakha’i mentioned: The oath is based on the intention of the swearer if he is wronged, and on the intention of the one who demands it if he is the wrongdoer.

(1) The statement: “This is interpreted as applying to the one who demands it if he is wronged”: Its detail is in “Radd al-Muhtar.” In “Al-Khaniyah,” it is stated: If a man demands an oath from another, and he swears intending something other than what the one demanding intends, such as divorce, emancipation, or the like, the intention of the swearer is considered if the swearer does not intend contrary to the apparent, whether he is the wrongdoer or wronged. If the oath is by Allah, the Exalted, and the swearer is wronged, the intention is his, but if he is the wrongdoer intending to nullify another’s right, the intention of the one demanding is considered. This is the view of Abu Hanifah and Muhammad. I say: Restricting it to when he does not intend contrary to the apparent indicates that the consideration of the swearer’s intention is in judgment, as there is no disagreement about considering his intention in faith. This clarifies the difference between this and the view of Khassaf, who holds that his intention is considered in judgment as well, and the fatwa is according to his view if the swearer is wronged, as you have learned. In “Al-Hindiyyah” from “Al-Muhit,” the statement of Ibrahim an-Nakha’i is mentioned, and our companions adopted it, and its essence is in “Ad-Durr al-Mukhtar”: They said: The intention is for the swearer if by divorce or emancipation, and likewise by Allah if he is wronged. If he is the wrongdoer, it is for the one demanding. There is no relevance to judgment in the oath by Allah.

(2) The statement: “You were the most righteous and truthful of them”: Qadi Iyad narrated consensus that one who swears without being demanded and without a right attached to his oath has his intention considered, and his statement is accepted. If there is a right of another upon him, there is no disagreement that judgment is based on the apparent meaning of his oath, whether he swears voluntarily or by demand. [Summarized] If the consensus is established contrary to what the apparent hadith of Muslim suggests, it is relied upon. This can be supported by this hadith of Suwayd ibn Hanzalah mentioned in the chapter, as the Prophet (ﷺ) judged him as righteous in his oath, and he is not righteous except by considering his own intention, as he intended metaphorical brotherhood, while the one demanding intended literal brotherhood. Perhaps this is the basis of the consensus. [Summarized from “Nayl al-Awtar”]

ماقی حاشیہ سے کہ قسم توڑنے میں کچھ اور کفارہ دینے میں کچھ گناہ ہے حالانکہ قسم توڑنے میں بھلا کیا اوراس قسم کو توڑنا کچھ واجب ہے۔ اس کا جواب یہ ہے کہ ظاہر قسم توڑنے میں اللہ تعالیٰ کی حرمت و تقدس کو پامال کرنا معلوم ہوتا ہے۔ یا یہ قسم کہا نے والے کو یوں تمہیں ہوسکتا ہے کہ قسم توڑنے میں شاندگناہ ہے (ماخوذ ازمعات)۔ اور بر ماوي رحمۃ اللہ تعالیٰ علیہ نے فرمایا کہ آثم، اسم تقضیل ہے جومشار کہ کوچاہتا ہے۔ اوراس سے معلوم ہوتا ہے کہ کفارہ دینے میں کچھ گناہ ہے۔ کیونکہ قسم توڑنے میں اللہ تعالیٰ کے نام پر کچھ غظیم نہ کرنا لازم آتا ہے۔ اور قسم توڑنا اور کفارہ دینا عام پر لازم وملزوم ہے۔ (مرقات)۔

1قولہ : وهو محمول على المستحلف المظلوم (قسم کہا نے سے مراد مظلوم ہے جو تم کہا رہا ہے) رواجتار میں اس کی تفصیل اس طرح ہے کہ صاحب "خانی" نے فرمایا ہے کہ ایک آدمی کسی آدمی کو قسم دلا یا اور وہ قسم کہا لیا اوراس نے قسم کہا نے والے کے خلاف نیت کی تو، طلاق اور عتاق اوراس جسی چیز وں میں قسم کہا نے والے کی نیت میں کا اعتبار ہوگا جب کہ قسم کہا نے والا طاہر کے خلاف نیت نہ کرے خواہ قسم کہا نے والا طالم ہو یا مظلوم اور اللہ تعالیٰ کی قسم ہو اور قسم کہا نے والا مظلوم ہو تو نیت قسم کہا نے والے کی ہوگی اور قسم کہا نے والا طالم ہو اور دوسرا کا حق باطل کرنا چاہتا ہے قسم کہا نے والے کی نیت کا اعتبار ہوگا۔ اور یا امام عظیم اور امام محمد رحمۃ اللہ علیہما کا قول ہے۔ میں کہتا ہوں کہ اذا لم ینو خلاف الظاہر۔ (جب کروہ طاہر کے خلاف نیت نہ کرے) اس کی قید کا دلالت کرتا ہے کہ قسم کہا نے والے کی نیت کا اعتبار قضاء ہے کیونکہ دیانگا س کی نیت کا بقیہ اگلے صفحہ پر۔

حضرت سوید بن خزلم رضي اللہ تعالی عمنہ نے بیان کیاہے کر انہوں نے کہا، ثم

رسول اللہ صلی اللہ علیہ وسلم (کی زیارت) کے ارادہ سے نکل اور ہمارے ساتھ واصل بن حجر رضي اللہ

تعالی عمنہ ان کے ایک دشمن نے انہیں کیڑ لیا اور لوگ قسم کہا نے میں حرج محسوس کے لیکن میں

نے اس بات پر قسم کہا لی کہ پیغمبر کے بجا کی جین تو اس (دشمن) نے ان کو چھوڑ دیا۔ ثم رسول اللہ

صلی اللہ علیہ وسلم کی خدمت میں حاضر ہوئے اور آپ علیہ صلاۃ و السلام سے میں نے اس کا ذکر کیا۔ تو آپ

صلی اللہ علیہ وسلم نے ارشاد فرمایا تم ان لوگول سے بطہ کر نیک اور سے ہو۔ 1 تم نے چج کہاہے مسلمان،

مسلمان کا بجا کی ہے۔ (احمد ابن ماجہ)

ماقی حاشیہ اعتماد کرنے میں کوئی اختلاف نہیں ہے اور اس سے اس میں اور امام خصاف کے نہ بہب میں فرق

معلوم ہوجاتاہے کیونکہ ان کے پاس قضاء میں کچھ نیت کا اعتبار ہے اور جب قسم کہا نے والامظوم ہوتا ان کے نہ بہب

پرفتوی دیا جاتاہے جسیا کہ آپ کو معلوم ہے اور فتاوی ہندیہ میں محیط منقول ہے کہ ابراہیم خی نے فرمایا۔ وبہ اخذ ا

صحابنا (اور ایکوہمارے اصحاب نے اختیار کیاہے۔) اور اس کا خلاصہ جسیا کہ درختار میں ہے کہ فقہاء نے کہاہے کہ

طلاق یا عتق میں قسم کہا نے والے کی نیت کا اعتبار ہے اور مظوم اللہ تعالی کی قسم کہا تاہے تو اس کی نیت کا اعتبار ہوگا اور

اگروہ قسم کہا نے والاخالم ہے تو قسم کہا نے والے کی نیت کا اعتبار ہوگا اور اللہ تعالی کی قسم میں قضاء کوئی تعلق نہیں۔ 12

قولہ : انت کنت ابرهم و اصدقهم (تم ان لوگول سے بطہ کر نیک اور سے ہو) حضرت قاضی

عیاض رحمہ اللہ علیہ نے اس امر پر اجماع نقل فرمایاہے کہ کسی کے قسم کہا نے بغیر کوئی قسم کہا نے جب کس کی قسم

کہا نے کسی کا حق متعلق نہ ہور باہوتو اس کی نیت کا اعتبار کیا جاتے گا اور اس کے قول کو قبول کیا جاتے گا اور اگر اس

پر کسی کا حق ہے تو بلا اختلاف اس قسم کے ظاہر پر حکم کیا جاتے گا نواہ اپنے طور پر ہویا کسی کے قسم کہا نے وہ قسم کہاہے

ہو۔ (انہی ملخصاً)

اور مسلم شریف کی حدیث کے ظاہری مفہوم کے خلاف جب اجماع نہ ثابت ہوگیا تو اب اس پر اعتماد کیا

جاے گا اور سوید بن خزلم رضی اللہ تعالی عمنہ کی حدیث سے کچھ استدلال کیا جاسکتاہے جواس باب میں ذکور ہے۔

کیونکہ نبی اکرم صلی اللہ علیہ وسلم نے ان کے لے ان کی قسم میں نیک ہو نے کا حکم فرمایہے باوجود اس کے کروہصرف

اپنی نیت کے اعتبار سے نیک ٹھک کیونکہ انہوں نے مجازی أخوت مراد لی اور ان سے قسم کا مطالبہ کرنے والے نے حقیقی

بجا کی سمجاہے جو سکتاہے اجماع کے لے کچھ چیز سندهو۔ (نیل الاوطار ملخصاً 12)

ابراہیم نے ذکر کیا ہے کہ تم کہا نے والامظوم بھ تو فتم اس کی نیت کے مطابق ہوگی اور اگر تم کہا نے والافالم بھ تو فتم کہا نے والے کی نیت کے مطابق ہوگی۔

There is no difference in relying on this commentary, and from it, the differences between this and Imam Khassa's narration become apparent, because they consider some intention in oaths to be valid. When an oath is made and it is accepted, a fatwa is given accordingly, as you know, and it is mentioned in Fatawa Hindiyyah that Ibrahim Khayyam said: 'And my companions have adopted this.' And its summary, as found in Dikhtar, is that the jurists have said: 'In divorce or manumission, the intention of the one who makes the oath is considered valid. If the oath is made by Allah, then the intention of the one who makes the oath is considered valid. If the oath is made without any oath being taken, then the intention of the one who makes the oath is considered valid, and there is no relation to the oath in the name of Allah.' The Prophet ﷺ said: 'You are Abraham and the most truthful among them (you are better than those people).' Imam Qadi Iyad (RA) has reported a consensus on this matter: 'When someone makes an oath without taking an oath, and when the oath does not pertain to anyone's right, their intention will be considered valid, and their statement will be accepted. If there is a right involved, then without any difference, the apparent meaning of the oath will be enforced, regardless of whose oath it is.' This is based on the explicit meaning of the hadith in Muslim, which is not contradicted by any established consensus. Some inference can be drawn from the hadith of Suwayd bin Khuzaim (RA), as mentioned in the relevant chapter, because the noble Prophet ﷺ commanded him to be good in his oath, despite the fact that he intended a metaphorical brotherhood, while the one demanding the oath considered it to be a real brotherhood, which can serve as evidence for consensus. (Summarized from Niq al-Awatar) Ibrahim mentioned that if the oath is made and it is accepted, then it will be according to the intention of the one who made the oath. If the oath is made and it is not accepted, then it will be according to the intention of the one who made the oath.'

سیرتنا عا نثر صدیقد رضی اللہ تعالیٰ علیہا سے روایت سے کہ انہوں نے فرمایا: لا یُوَاخِذُکُمُ اللہُ بِاللّغُوِ فِی آیَمَائِکُمْ (اللہ تعالیٰ تمہاری لغو قسموں پر تم سے موعذہ نہیں کرے گا)۔ یہ آیت (5 المائدة، آیت نمبر:89) ایک شخص کے بارے میں نازل ہوئی ہے۔ جو لا واللہ یا بلی واللہ (نہیں خدا کی قسم اور کیون نہیں اللہ تعالیٰ کی قسم) کہتے ہوتے (تمہیں کلام کے طور پر) قسم کہا کرتا تھا۔ (بخاری)

۔ قول: انزلت هذه الاية الخ (یا آیت ای شخص کے بارے میں نازل ہوئی) اس بات کو جانو کہ قسم کی تین قسمیں ہیں: 1 لغو 2 غموس 3 منعقدہ

لغو قسم پیہ کر آدی کی گزرے ہوئے کام پر یہ مجھ کر کہ وہ چہے قسم کہا حا لگروہ اس کے برخلاف ہے، یہ خفیہ کے پاس (لغو) ہے۔

اور عبد اللہ بن عباس، عطا، ابن ابی رباح رضی اللہ تعالیٰ علیہم سے لغو کی تفسیر میں یہی روایت سے اور یہی بات دیگر متون، بدایا اور اس کے شروح میں ذکور سے اور ربعیہ، ماک، لیث، حسن، مجاهد، نخعی، زبری، سلمیان بن سیار، ثقة دہ، سدی اور کحول رحمہ اللہ تعالیٰ کا یہی قول ہے۔

اور امام احمد رحمۃ اللہ علیہ سے دور واپیتن میں اور خقدری میں سے کر ابن منذر اور دومرو ل نے حضرت ابن عمر اور ابن عباس اور دیگر صحابہ رحمہ الرضوان سے اس کو نقل کیا ہے۔ لیکن امام شافعی رحمۃ اللہ علیہ کے پاس میں لغو قسم ہے جس کے ساتھ عزیزم نے واصل طرح سے کر سبقت لسانی ہوجاتے یا س کے معنی سے ناواقف ہو کر قسم کہا جیسے عرب میں لا والداور بلی واللہ کہ کاروانج سے بعض اپنی بات کی تاکید کے لئے ہوتی ہے۔

اور لغو کی تفسیر حضرت عا نثر رضی اللہ تعالیٰ علیہا سے مردوی سے یہی قول شمعی، طاوس اور کرمہ کا ہے۔ امام زیعی نے نقل کیا سے کر امام عظمہ البوحنیفر رحمۃ اللہ علیہ امام شافعی رحمۃ اللہ علیہ کے قول کے مطابق روایت آئی سے اور کتاب "الاختیار" میں سے کر اس قول کو امام عظمہ البوحنیفر رحمۃ اللہ علیہ امام محمد نے نقل کیا سے اس طرح بدالے میں منقول سے کر پہلا قول ہمارے اصحاب کا ہے۔ چہر انہوں نے کہا کر امام محمد رحمۃ اللہ علیہ نے امام عظمہ رحمۃ اللہ علیہ سے اس کو نقل کرنے کے بعد فرمایا کہ قسم لغو دہ سے جولوگول کے درمیان "لا والله، بلی والله" بقیہ کے صفحہ پر۔

مانتی حاشیہ (تمام کلام کے طور پر) جاری ہے تویہمارے پاس ماضی یاحال پہمول ہے اور یہ ملغوب ہے۔

شرہ اختلاف ہمارے اور امام شافعی رحمۃ اللہ علیہ کے درمیان اس فتنم کے بارے میں ہے جس میں فتنم کہانے والا

مستقبل کا ارادہ نہیں کیا تو ایسی فتنم ہمارے پاس لغویہ ہے البتراس میں کفارہ و نیابہ اور شافعی کے پاس لغوہ جس میں

کفارہ کچھ نہیں ہے تو صاحب برائے کا قول فذلک محمول عندنا اے و ما ذکر محمد اغ کی خبر ہے۔

اور یاس روایت پر نہیں ہے جو امام عظیم رحمۃ اللہ سے منتقل ہے اور اس سے ان کی مراد اس قول میں اور امام

شافعی رحمۃ اللہ علیہ کے قول میں فرق کو ظاہر کرنے ہے اور وہ فرق یہ ہے کہ اگر فتنم مستقبل کے لے ہوتا جس امام شافعی

کے پاس لغوہ اور ہمارے پاس مستقبل کی لغوتو لغویہ۔

اور ہماری دلیل اللہ تبارک و تعالی کا ارشاد ہے لا یؤاخذکم اللہ باللغو فی ایمانکم ولكن يؤاخذ

کم بما عقدتم الايمان (5 المائدة89) اللہ تعالی تمہاری قسمون میں سے جولغو (بمعنی) ہون ان پرتے

ماؤ اخذہ میں کرے کا البتران قسمون پرماؤ خذه کرے کا جس کے لے تم نے پکاراده کیا ہو۔)

اس میں لغو کو کیمین منعقدہ کے مقابل میں ذکر کیا گیا ہے اور دونوں کے درمیان ماؤ اخذہ اور عدم ماؤ اخذہ

فرق کیا گیا ہے اور اس مقابل کے اثبات کے لے میمن لغو کا میمن کے مغاہرہ و نا ضروری ہے۔

اور مستقبل میں فتنم میمن منعقدہ ہوگی خواہ بالا رادہ ہو یا بلا رادہ ہو کیونکہ لغت میں لغو کی چیز کو کہتا ہیں جو باطل

اور بحقیقت ہو جیے اللہ تعالی کا ارشاد ہے لا یسمعون فيها لغو ا (56 الواقعہ25) اس (جنہ) میں وہ لغو

کلام میمن سننے گے) اس میں لغو، باطل کے معنی میں ہے اور یہی ہمارا قول ہے کہ میمن لغو وہ فتنم ہے جس کی حقیقت میمن

ہوتی بلکہ فتنم کہانے والے کا کیا گمان ہوتا ہے کہ معاملہ ایسا ہے جس حال کہ حقیقت اس کے خلاف ہوتی ہے اس طرح

سے جو چیز مانہ ماضی یاحال سے متعلق تمام کلام کے طور پر بلا ارادہ زبان پر جاری ہوجائے ہے تو مجملد ان چیزوں کے

ہے جس کی کوئی حقیقت میمن ہوتی تویہ لغوہ اس کے لے کوئی حکم نہیں ہے اور میمن منعقدہ میمن ہوتی کیونکہ میمن

منعقدہ کے لے حکم ہوتا ہے۔

کیا تم میمن دیکھتے کر میمن منعقدہ میں ماؤ اخذہ اور کفارہ نص سے ثابت ہے تو اس سے کچھ پر ثابت ہوتا ہے کہ

میمن لغو وی ہے جو تم نے بیان کیا ہے حضرت ابن عباس رضی اللہ تعالی عنہما سے میمن لغو کی تفسیر مروی ہے کہ میمن لغو

پیہ کر آدی کسی تحولی بات پر پیش گیا ہو فتنم کہانے کو ہے پیاہ اور اس سے حضرت عاشرصد رضی اللہ تعالی

عنہما کے قول اور حضور پاک صلی اللہ علیہ وسلم کے ارشاد کے مفہوم کی وضاحت معلوم ہوتی ہے کہ میمن لغو وہ فتنم ہے جو

لوگوں کی نفتگو لا والله، بلی واللہ

Aishah (may Allah be pleased with her) narrated: This verse was revealed: Allah does not hold you accountable for the unintentional in your oaths regarding a man’s statement: “No, by Allah,” and “Yes, by Allah.” [Narrated by Bukhari]

In “Sharh as-Sunnah,” the wording of (Al-Ma’idah: 89) is in “Al-Masabih,” and it is said that some attributed it to Aishah.

In a narration by Bayhaqi from Ata ibn Abi Rabah: I and Ubayd ibn Umayr al-Laythi were with Aishah (may Allah be pleased with her), the wife of the Prophet (ﷺ). Ubayd asked her about Allah’s statement, the Mighty, the Exalted: Allah does not hold you accountable for the unintentional in your oaths (Al-Ma’idah: 89). She said: It is a man’s oath based on his knowledge, then he finds it not to be so, and there is no expiation for it.

Ibn Jarir and Ibn al-Mundhir narrated from Ibn Abbas (may Allah be pleased with him) that he said regarding the interpretation of the verse: The unintentional is breaking an oath falsely, believing it to be true, while the reality is contrary to what he thought.

(1) The statement: “This verse was revealed, etc.”: Know that oaths are of three types: unintentional, deliberate false, and binding. The unintentional is when one swears about a past act, believing it to be true, but it is actually contrary. This is the Hanafi view, narrated from Ibn Abbas and Ata ibn Abi Rabah regarding the interpretation of unintentional, and it is mentioned in the texts, “Al-Hidayah,” and its commentaries. It was held by Rabiah, Malik, Layth, Hasan, Mujahid, Nakha’i, Zuhri, Sulayman ibn Yasar, Qatadah, Sudi, and Mukhawwal. Two narrations are from Ahmad. In “Al-Fath,” it is stated that Ibn al-Mundhir and others narrated it from Ibn Umar, Ibn Abbas, and others among the companions. According to Shafi’i, it is what has no binding intent, slipping from the tongue or spoken ignorantly, such as the Arabs’ saying: “No, by Allah,” and “Yes, by Allah,” for mere emphasis, narrated from Aishah regarding the interpretation of unintentional, and held by Sha’bi, Tawus, and Ikrimah. Zayla’i narrated that it was narrated from Abu Hanifah like Shafi’i’s view. In “Al-Ikhtiyar,” it is stated that Muhammad narrated it from Abu Hanifah. In “Al-Bada’i,” it is narrated first from our companions, then it is stated: What Muhammad mentioned following his narration from Abu Hanifah that the unintentional is what people say: “No, by Allah,” and “Yes, by Allah,” is interpreted according to us as referring to the past or present, and according to us, that is unintentional. The essence of the disagreement between us and Shafi’i is regarding an oath not intended by the swearer for the future. According to us, it is not unintentional, and expiation is required. According to him, it is unintentional, and there is no expiation. His statement: “It is interpreted according to us, etc.” is a report of what Muhammad mentioned, based on that narration from Abu Hanifah, intending to clarify the difference between it and Shafi’i’s view, as the future is unintentional according to him, not us. Our evidence is Allah’s statement: Allah does not hold you accountable for the unintentional in your oaths, but He holds you accountable for the oaths you have bound yourselves with (Al-Ma’idah: 89), contrasting the unintentional oath with the binding oath, distinguishing between them by accountability and its negation. Thus, the unintentional oath must be other than the binding oath to realize the contrast. An oath about the future is a binding oath, whether intended or not, because unintentional in language is a name for something without reality, as Allah, the Exalted, said: They hear therein no idle talk (Maryam: 62), meaning falsehood. This applies to what we said, which is swearing by what has no reality, but on the swearer’s belief that it is as he swore, while the reality is contrary. Likewise, what slips from the tongue without intention, but about the past or present, has no reality, so it is unintentional and has no ruling, thus it is not a binding oath, as it has a ruling. Do you not see that accountability is established for it, and expiation is required by the text? This indicates that the unintentional is what we said. Thus, it is narrated from Ibn Abbas regarding the interpretation of the unintentional oath: It is when a man swears a false oath, believing it to be true. It is clarified that Aishah’s statement and the statement of the Messenger of Allah (ﷺ): The unintentional oath is what people say: “No, by Allah,” and “Yes, by Allah,” refers to the past, not the future. The evidence is that she interpreted it as the past, narrated from Matar from a man who said: I and Ibn Umar entered upon Aishah, and I asked her about the unintentional oath. She said: A man’s statement: “We did such and such, by Allah,” and “We made such and such, by Allah.” Thus, that narration is interpreted according to this to reconcile the two narrations, as the ambiguous is interpreted by the clear. The conclusion is that the unintentional according to us is of two types: The first is what is mentioned in the texts, and the second is what is in this narration, so this narration clarifies the type omitted by the authors of the texts. In “Al-Fath,” it is explicitly stated that there is no accountability for the unintentional in both interpretations. [Taken from “Radd al-Muhtar” and “Al-Bada’i”]

Know that there are three types of oaths: 1. Ligho (لغو) 2. Ghumus (غموض) 3. Man'qadah (منعقدہ).

1. Ligho (لغو) is an oath taken on a past or present action, and it is said that if one wishes to take an oath, it is considered ligho. This is in contrast to the other type, which is considered secret (خفیہ). According to Abdullah ibn Abbas, Ata, Ibn Abi Rubah (رضي الله تعالى عنهم), this interpretation of ligho is narrated, and this is also mentioned in other texts, Badaya, and its commentaries, as well as by Rabia, Maq, Layth, Hassan, Mujahid, Nakhai, Zabri, Salami bin Siyar, Thaqah, Sadi, and Khol (رحمه الله تعالى).

Furthermore, Imam Ahmad (رحمه الله عليه) has narrated this in his discussions on avoidance and in his Khudari, and Ibn Muzah and Dumaru have narrated it from Ibn Umar, Ibn Abbas, and other Companions (رضي الله عنهم). However, according to Imam Shafi (رحمه الله عليه), ligho is an oath where the speaker uses it without fully understanding its meaning or significance, such as saying 'La walda' or 'Bali wallah' in Arabic to emphasize something.

The interpretation of ligho from Anas (رضي الله تعالى عنه) through Murdawi is the same as that of Shami, Taous, and Karmah. Imam Zayi narrates from Imam Abu Hanifah (رحمه الله عليه) and Imam Shafi (رحمه الله عليه) according to the narration in the book 'Al-Ikhtiyar,' and Imam Muhammad (رحمه الله عليه) narrates from Imam Abu Hanifah (رحمه الله عليه) that this is the first opinion of our scholars. After narrating this from Imam Abu Hanifah (رحمه الله عليه), Imam Muhammad (رحمه الله عليه) said that ligho is used between people in phrases like 'La wallah, Bali wallah' on the rest of the page.

If the statement (the entire speech) is ongoing, then it is either past or present, and it is considered ligho.

The difference between us and Imam Shafi (رحمه الله عليه) regarding this statement is that if the person making the statement does not intend the future, then such a statement is considered ligho by us, but for Imam Shafi, it is ligho with no kaffarah (atonement) or substitute. The opinion of the majority is that this is the correct view, and this is the report of Muhammad (رحمه الله عليه).

There is no narration from Imam Abu Hanifah (رحمه الله عليه) that indicates a difference in their opinions, and the difference is that if the statement is about the future, it is ligho for Imam Shafi, and for us, it is ligho if it is about the future.

And our Lord, the Most Blessed and Exalted, says: 'Allah will not punish you for what is unintentional in your oaths, but He will punish you for what your hearts have earned (5:89).' Allah will not hold you accountable for ligho in your faith, but He will hold you accountable for what you have made binding in your faith.

Here, ligho is mentioned in contrast to man'qadah, and the difference between them is whether there is accountability or not. To prove this distinction, it is not necessary for ligho to be contradictory or unnecessary.

In the future, a statement is man'qadah whether it is revocable or irrevocable, because in terms of language, ligho refers to something false, and in reality, it is false. As Allah says: 'They will not hear therein any ligho (56:25),' meaning they will not hear any false speech. Here, ligho means false, and this is our opinion that ligho is a statement that is false in reality, but the speaker thinks it is true, while the reality is otherwise. Thus, if a statement is made about the past or present without intention, it is a general statement, and if it has no reality, it is ligho, and there is no ruling for it, whereas man'qadah has a ruling.

Do you see that in man'qadah, accountability and kaffarah are established by clear evidence, so it proves that ligho, which you have described, is also a type of ligho. From Ibn Abbas (رضي الله تعالى عنه), the interpretation of ligho is narrated that it is a statement made on a past or present event, and this clarifies the statement of Anas (رضي الله تعالى عنه) and the implication of the guidance of the Holy Prophet (صلى الله عليه وسلم) that ligho is a statement like 'La wallah, Bali wallah' used in conversation.

Anas (may Allah be pleased with him) narrated that the Messenger of Allah (ﷺ) said: “By the One in Whose Hand is my soul, a servant does not believe until he loves for his brother what he loves for himself.” [Agreed Upon]

ابن جریراور ابن منذر حضرت ابن عباس رضی اللہ تعالیٰ عنہما سے روایت ہے۔

ما تی حاشیہ نے کہ مستقبل کے بارے میں اس کی دلیل حضرت عائشہ رضی اللہ تعالیٰ عنہا کا قول ہے کہ آپ نے کچھ زمانہ مضی سے اس کی تفسیر کی ہے۔ چنانچہ حضرت مطر رضی اللہ تعالیٰ عنہ ایک صحابی سے روایت کرتے ہیں کہ انہوں نے کہا میں اور حضرت عبد اللہ بن عمر رضی اللہ تعالیٰ عنہما سیدہ عائشہ رضی اللہ تعالیٰ عنہا کے پاس گئے اور میں نے ان سے کچھ لغو کے بارے میں دریافت کیا تو آپ نے فرمایا کہ آدمی کافعلنا و اللہ کذا (خدا کی قسم، میں ایسا عمل کیا) کہنا کچھ لغو ہے۔ اور پرروایت اس (ماضی) پر محول کی جاتے گی تاکہ دونوں روایتون میں مطابقت ہو جائے چونکہ محمل مفسر محمل هوتا ہے۔

بطور خلاصہ کہا جاسکتا ہے کہ لغو کی ہمارے پاس دو قسمیں ہیں۔

ایک وہ قسم ہے جس کا ذکر مذکور نیں ہے۔

دوسرا قسم وہ جو اس روایت میں ذکور ہے۔ (یعنی ما ضی یا حال میں لا واللہ، بلی واللہ کہنا) تو پیر روایت اس قسم کا بیان ہو جائے گی جس کے بارے میں اصحاب مذکور نے سکوت اختیار کیا۔ اور فتح القدیر میں کچھ لغو کی دونوں واضاحتوں پر موافقت موجود ہے۔ (ماخوذ از رد اختاراور بدائع) کچھ غموں اور منعقدہ کی واضح اس کے بعد آنے والی حدیث میں موجود ہے۔

کہ آپ نے اس آیت کی تفسیر میں فرمایا لگوا کے غلط جھوٹی بات پرتم کہانا ہے۔ جب کروہ اس کو تجھہر باہے حالا کہ دراصل وہ اس کے گمان کے برخلاف ہے۔

It is narrated from Ibn Jarir and Ibn Muzah that they reported from Ibn Abbas (RA).

Ma'ti al-Haashiyah said that the proof regarding the future is the statement of Aishah (RA), who said that she interpreted it some time after. Thus, Matr (RA) narrates from a Companion that he said: 'I went to Aishah (RA) along with Abdullah ibn Umar (RA) and asked her about some oaths, and she said: 'Saying, “I did such and such by Allah” (i.e., swearing by Allah that one did something) is considered an oath. And the narration will be referred to the past so that both narrations may agree, as the context of interpretation applies to the past. In summary, it can be said that there are two types of oaths: 1) One type is mentioned here. 2) The other type is what is mentioned in this narration (i.e., saying 'maa zayya allah' or 'bali allah' in the present tense). Therefore, the narration will refer to this type, about which the scholars have remained silent. And in Fath al-Qadir, there is agreement on both explanations of oaths. (Extracted from Rad al-Khitar and Badai') Some oaths and their implications are clearly mentioned in the following hadith, where it is said: 'Oaths are false and deceptive statements when one swears to something that is contrary to the truth.'

صلى الله عليه وسلم نے ارشاد فرمایا کہ پانچ چیزیں ایسی ہیں (اپنا برآگناہ ہیں) کہ ان کے لے کوئی کفارہ نہیں ہے۔

1_اللہ تعالیٰ کے ساتھ شرک کرنا۔

ناحق کسی نفس کو قتل کرنا۔

کسی موسیٰ پر تہمت لگانا۔

جنگ کے دونوں جہاگ جانا۔

جھوٹی قسم کہالینا تاکہ نا حق مال کھاجا لیں۔(احمد)

Abu Hurayrah (may Allah be pleased with him) narrated: The Messenger of Allah (ﷺ) said: “Five have no expiation: Associating partners with Allah, killing a soul without right, slandering a believer, fleeing on the day of battle, and a deliberate false oath by which one wrongfully takes wealth.” [Narrated by Ahmad]

(1) The statement: “And a deliberate false oath, etc.”: Meaning the deliberate false oath, which is when one swears about a past act, deliberately lying, knowing it is contrary. The binding oath is when one swears about a future act, intending or not intending that statement. According to us, if he breaks a binding oath, expiation is obligatory, and he sins, otherwise not. There is nothing obligatory in the unintentional or deliberate false oath, but he sins in the deliberate false oath, and there is no expiation except repentance and seeking forgiveness, and forgiveness is hoped for in the unintentional. According to Shafi’i, as expiation is obligatory in the binding oath, it is obligatory in the deliberate false oath. Our view is supported by this hadith. The verification with evidence is sought from “At-Tafsir al-Ahmadiyyah” and books of jurisprudence. [Taken from “Al-Hidayah,” “Radd al-Muhtar,” and “At-Tafsir al-Ahmadiyyah”]

سیدنا ابی بن کعب رضی اللہ تعالیٰ عنہ اور حضرت ابن مسعود رضی اللہ تعالیٰ عنہ سے روایت ہے کہ ان دونوں نے "فصیام ثلاثة ایام متتابعات" لعنی متابعات کے اضافے کے ساتھ

1قولہ یمین صابرۃ ان (زبردستی جھوٹی قسم کہالینا) کیمین صابرہ، کیمین غموس ہے اور وہ یہ کہآ دی گزرے ہوئے کام پر بجا نے ہوئے کہ بی خلاف واقعہ عمداً جھوٹی قسم کہانے کیمین منعقدہ= آتندرہ زمانے میں کسی کام پرخواہ اس کا ارادہ رکھا ہو یا ارادہ نہ رکھا ہو تم کہانا منعقدہ ہے۔ اور ہمارے پاس کیمین منعقدہ میں اگر قسم توڑ دے تو اس پر کفارہ واجب ہے اور گنہگار ہو گا ورنہ (قسم نہ توڑے تو کفارہ واجب نہیں ہے اور کیمین لگواو رغموس میں اس پر کوئی چیز واجب نہیں ہے۔ کیمین غموس میں کفارہ نہیں ہے مگر بہت بڑا گنہگار ہو گا۔ البنت تو براور استغفار کرے اور کیمین لغو میں کچھ کفارہ نہیں ہے۔ اور اس میں معاف کے جانے کی امید ہے اور حضرت امام شافعی کے پاس منعقدہ میں جس طرح کفارہ واجب ہوتا ہے، کیمین غموس میں بھی واجب ہوتا ہے اور یہ حدیث ثریف ہماری تائید کرتی ہے دالل کے ساتھ مزید تحقیق تفسیرات احمدیا و رفقہ کتابول سے معلوم کی جاسکتی ہے (ماخوذ از بدایی، ردالختار و تفسیرات احمدیہ)

قرأت کی ہے 1 (پس کفارہ کیے نہیں میں مسلسل تین دن کے روزے رکھنا ہے) اس کو امام احمد نے نقل کیا –

Yamin (an oath) is of three types: a steadfast oath, a forgetful oath, and an intentional false oath. A steadfast oath is one taken on a past action, whether it was done intentionally or unintentionally. If someone takes such an oath, it is binding. If they break this oath, expiation is obligatory, and they will be sinful. If they do not break it, no expiation is required. In a forgetful oath, there is no obligation, and no expiation is required, but it is a great sin. In a false oath, there is no expiation, but it is a grave sin. One should seek forgiveness and nullify the oath. In a nullified oath, no expiation is required, and there is hope for forgiveness. According to Imam Shafi'i, just as expiation is obligatory in a binding oath, it is also obligatory in a forgetful oath. This hadith supports our position with evidence. Further investigation and interpretation can be found in the works of Ahmadia and other commentaries (extracted from Bada'i, Rad al-Mukhtar, and Tafsirat Ahmadia). It is read: 'If expiation is not made, one must fast continuously for three days.' This is reported by Imam Ahmad.

نے ارشاد فرمایا اگر کسی چیز پر کونی آدمی قسم کھائے تو اوران شاء اللہ کہ تو اس پر قسم توڑنے سے کونی

گناہ نہیں ہے – (ترمذی، البوداود، نسائی، ابن ماجہ، داری)

It is narrated from Ibn Umar (RA) that the Messenger of Allah ﷺ said:

If a person swears an oath regarding something, and then Allah wills otherwise, then there is no sin in breaking that oath.

ابنی (عبد اللہ بن عمر رضی اللہ تعالیٰ عنہما) سے روایت کی ہے کہ اگر استثناء بلا فصل ہوتا

اس قسم کے توڑنے سے گناہ نہیں اور اگر وہ استثناء بلا فصل ہوتا قسم توڑنے والا گناہ کار ہو گا – (سنن بیہقی)

قولہ انہما قرآ اخ (ان دونوں کی قرأت) اس کا مطلب یہ ہے کہ اگر تین چیزوں میں سے کسی چیز پر

قدرت نہ ہوتی مسلسل تین دن کے روزے رکے تو اور امام شافعی رحمۃ اللہ علیہ نے فرمایا کہ چونکہ نقص مطلق ہے اس لیے

اس کو اختیار ہے خواہ اگر اگر کہیا مسلسل رکے اور ہماری ویل حضرت عبد اللہ بن مسعود رضی اللہ تعالیٰ علیہ کی

قرأت ہے فصیام ثلاثة ایام متتابعات ” اور یہ بھر مشہور ہے اور کتاب اللہ کے مطلق پر خبر مشہور ہے زیادتی جائز

ہے اور یہ دیث کہی اس کی تائید کرتی ہے – (ماخوذ از بدايہ، بنایی)

قول : من حلف علی يمين اخ (اگر کسی بات پر کونی آدمی قسم کھائے) اس کا مطلب یہ ہے کہ جو آدمی

اپنی قسم کے ساتھ بلا فصل ان شاء اللہ کہ کا تو اس کی قسم باطل ہو جائے گی اس سے وہ قسم خارج ہے جس میں آدمی اپنی

قسم کے بعد ان شاء اللہ فوری نہ کہا تو اور پیغم باطل نہیں ہوتی کیونکہ استثناء کا عمل بلا فصل ہو نے کی صورت میں ہوتا

ہے بالفصل ہوتا اس کا عمل نہیں ہوتا – (ماخوذ از شرح و قابی، عمدۃ الرعایی) اگر تم بیکہو کہ حدیث مطلق ہے اس میں وصل

فصل کا فرق نہیں کیا جائے کا تو اس کے جواب میں، میں کہوں گا کہ منصوص علیہ اور غیر منصوص علیہ دوالل سے معاملات کا

جوڑ و متناہت ہوتا ہے وہ سب اتصال کو واجب قرار دیتے ہیں – کیونکہ ان شاء اللہ دیتے کہنے کو جائز قرار دیا جائے تو

سارے معاملات (جیسے نجاح و غیرہ و غیرہ) کوئی چیز ملازم نہیں رہے کی اوراس میں جوفساد ہے کسی پر پوشیدہ نہیں –

علامہ عینی نے ایسے کہا ہے اور صدر الشریعت استثناء بالاقصال کے عدم جواز پر ایک حدیث کا بھی ذکر کیا ہے –

فليكفر عن يمينه (اپنی قسم کا کفارہ دے) اس حدیث ثریف میں کفارہ کو لازم قرار دیا گیا ہے اور اگر بیان تغییر

لیئے استثناء منفصل جائز ہوتا تو کسی قسم میں کفارہ باکل لازم ہی نہ ہوتا بقیہ اے لگ صفحہ پر ––

Ibn Umar (may Allah be pleased with him) narrated that the Messenger of Allah (ﷺ) said: “Whoever swears an oath and says, ‘If Allah wills,’ there is no breaking upon him.” [Narrated by Tirmidhi, Abu Dawud, Nasa’i, Ibn Majah, and Darimi]

Bayhaqi narrated in his Sunan from him (may Allah be pleased with him) that he said: Every connected exception has no breaking upon its maker, but if it is disconnected, he is a breaker.

Darqutni narrated from him, as a stopped narration, something similar.

(3) The statement: “Whoever swears an oath, etc.”: Meaning whoever connects “If Allah wills” with his oath, it is nullified. This excludes when he says “If Allah wills” after his oath, disconnected, as it does not nullify his oath, because the exception only applies when connected, not disconnected. [Taken from the commentary on “Al-Wiqayah” and “Umdat ar-Ri’ayah”] If you say: The hadith in its generality does not distinguish between connected and disconnected. I say: The evidence from texts and others regarding the obligation of contracts necessitates connection, as permitting a disconnected exception would lead to nullifying all contracts, such as sales, marriages, and others, and the corruption in that is evident, as stated by Ayni. Sadr ash-Shari’ah mentioned in the evidence for prohibiting delay: The hadith “Let him expiate his oath” obligated expiation, so if a delayed exception were permissible, expiation would not be obligatory in any oath, as he could say delayed: “If Allah wills,” nullifying his oath. [From “At-Ta’liq al-Mumajjad”] This is also supported by the report of Bayhaqi and Darqutni mentioned in the book. In “Umdat al-Qari,” it is stated: The exception here refers to the phrase “If Allah wills,” not the technical exception, such as: “By Allah, I will do such and such, if Allah wills,” or he said: “By Allah, I will do such and such,” then “If Allah wills.” There is disagreement among the scholars. Ibrahim, Hasan, Thawri, Abu Hanifah, his companions, Awza’i, Layth, and the majority of scholars said: Its condition is that it is connected to the oath. Shafi’i said: The exception must be connected to the initial speech, meaning without separation, in a coherent manner. If there is a pause, it is disconnected, unless it is for recollection, breathing, or inability to speak, explaining his intent, or a break in voice. They also disagreed about the exception in divorce and emancipation. Ibn Abi Layla, Awza’i, Layth, and Malik said: The exception is not permissible, and it is narrated from Ibn Abbas and Ibn al-Musayyib. Tawus, Nakha’i, Hasan, Ata in a narration, Abu Hanifah, his companions, Shafi’i, his companions, and Ishaq said: The exception is permissible. In “Al-Bahr,” it is stated: The apparent statement of the author of “Al-Kanz”: If he connects “If Allah wills” with his oath, he is free, meaning the oath is binding but there is no breaking upon him due to the inability to know Allah’s will, the Exalted. This is the view of Abu Yusuf (may Allah be pleased with him). According to Abu Hanifah and Muhammad (may Allah be pleased with them), attaching to the will nullifies it. Thus, it is stated in “At-Tabyin”: He meant by “free” the lack of binding, as it entails no breaking, like being free, so he used it absolutely. The essence of the jurists’ statements is that everything attached to speech, the connected will nullifies it, whether worship or transaction, unlike what is attached to the heart, like intention.

جہی اس کی تائیر ہوتی ہے اور عمدہ القاری میں ہے کراستثناء یہاں مراد لفظ ان شاء اللہ سے نہوی اصطلاحی استثناء

مراد نہیں ہے جیے اللہ لا فعلن کذا ان شاء اللہ تعالیٰ (اللہ کی قسم میں ضروراً یا کرولگا ان شاء اللہ) یا اللہ

لا افعلن کذا ان شاء اللہ۔ (اللہ کی قسم میں ایسا مرکز نہیں کرولگا ان شاء اللہ) اوراس میں علم کا اختلاف ہے۔

حضرت ابراہیم، حضرت حسن بصری، حضرت ثوری امام ابوحنیفہ اورآپ کے اصحاب، امام اوزاعی، حضرت

لیث اور جمہور علماء نے فرمایا کہ قسم کے ساتھ استثناء ہوتا اس کا متصل (بالاوقفہ) ہونا شرط ہے۔ اور امام شافعی رحمۃ اللہ

علیہ فرماتے کہ کلام اول کے ساتھ استثناء ہوتا اس کا متصل ہونا شرط ہے۔ اوراس کا اتصال بالترتیب ہو اور آگر دونوں

کے درمیان سکوت ہوتا استثناء ختم ہوجاتے گا سواے اس کے کسی چیزویاد کرنے کے لئے یا سنس لینے یا زبان کے

رک جانے یا آواز کے منقطع ہوجانے کی وجہ سے ہو (ایسی صورت میں استثناء متصل رہتا) طلاق اور عتق میں استثناء

کے بارے میں اختلاف ہے ابن ابی لیلی، امام اوزاعی امام لیث اور امام ماکر رحمہ اللہ تعالیٰ نے فرمایا کہ اس میں

استثناء جائز نہیں ہے۔ اس طرح کی ایک روایت حضرت عبد اللہ بن عباس اور ابن مسیب رضی اللہ تعالیٰ عنہم سے آئی ہے۔

طاوس، نخعی، حسن اور ایک روایت میں عطاء اور امام ابوحنیفہ اور ان کے اصحاب، امام شافعی اور ان کے اصحاب، اور امام

اسحاق رحمہ اللہ تعالیٰ نے فرمایا (اس میں) استثناء جائز ہے۔ (خرم شد)

اور ابحر الرائق میں ہے کہ صاحب کنز کے کلام سے پیٹاہر ہوتا ہے کہ آیہ قسم کے ساتھ اگر ان شاء اللہ

متصل کہ کا تو وہ قسم پوری کرے کیونکہ یہ قسم منعقدہ ہے۔ البتر اس پراس طرح کی قسم توثر نہ کا کوئی گناہ نہیں ہے۔

کیونکہ اللہ تعالیٰ کی مشیت سے کوئی آ کا نہیں ہے۔ اور امام ابویوسف رحمۃ اللہ علیہ کا قول ہے اور امام ابوحنیفہ اور امام

محمد رحمہ اللہ تعالیٰ کے پاس تعلیق بالمشیت (قسم کے ساتھ ان شاء اللہ کہنا) قسم کو باطل کردیتا ہے۔ اس لئے کتاب "تمیین" میں ہے کہ ان کے قول "بر" سے قسم کا منعقدہ ہونا مراد ہے کیونکہ عد مہشت اور بر ایک ہی ہے اس لئے عد مہشت پر "بر" کا طلاق کیا گیا ہے۔ فقہاء کے کلام کا خلاصہ یہ کہ عبادات و معاملات کی ہروہ چیز جس کا تعلق قول سے ہے جب وہ ان شاء اللہ کے ساتھ متصل ہو جائے تو باطل ہو جائے ہے برخلاف قلب سے تعلق رکھنے والی چیز ون کے جیے نیت و غیرہ ہے (ان شاء اللہ سے وہ باطل نہیں ہوتے)۔

It is narrated from Abdullah bin Umar (RA) by Imam Dar Qutni as marfu‘.

Al-Matqi in his commentary states that if the exception is separated (i.e., if 'Insha Allah' is said after a pause), the oath becomes invalid. (Ahmad's commentary) Furthermore, the Imam does not [make such a distinction], and the authentic hadith of the Imam Dar Qutni, which is mentioned in the book, supports this view, as it is also found in the excellent reading. The term 'Insha Allah' is not meant to be an exception in the technical sense, like 'If Allah wills, I will do so.' Rather, it means 'By Allah, I will surely do so, Insha Allah,' or 'By Allah, I will not do so, Insha Allah.' There is a difference of opinion among scholars regarding this. Imam Ibrahim, Imam Hasan Basri, Imam Thawri, Imam Abu Hanifa, and his companions, Imam Auza'i, Imam Layth, and the majority of scholars have stated that when an exception is made with an oath, it must be connected (without a pause). Imam Shafi'i (RA) has said that when an exception is made with the first statement, it must be connected, and this connection must be sequential. If there is a pause between the two, the exception ends unless it is for adding something, taking a breath, a speech impediment, or a break in the voice (in which case the exception remains connected). There is a difference of opinion regarding exceptions in divorce and manumission. Ibn Abi Laila, Imam Auza'i, Imam Layth, and Imam Makur (RA) have said that exceptions are not permissible in these cases. This view is also reported from Abdullah ibn Abbas and Ibn Mas'ud (RA). Ta'us, Nakhai, Hasan, and according to one narration, Ata, Imam Abu Hanifa, and his companions, Imam Shafi'i and his companions, and Imam Is-haq (RA) have said that exceptions are permissible in these cases. (Kharam shad) It is mentioned in Al-Bahr al-Ra'iq that from the words of the owner of Kanz, it is understood that if someone says 'By Allah, I will do so, Insha Allah' without a pause, then the oath is valid because it is a binding oath. If the 'Insha Allah' is said after a pause, it does not affect the oath, and there is no sin because nothing can come against the will of Allah. According to Imam Abu Yusuf (RA), Imam Abu Hanifa, and Imam Muhammad (RA), saying 'Insha Allah' with an oath invalidates it. Therefore, in the book 'Tamyin,' it is stated that their view is that the oath is binding with 'Bar' because 'Bar' and 'Ad Majshat' are the same, so 'Bar' is used for 'Ad Majshat.' The summary of the jurists' statements is that any matter related to worship or transactions, when connected with 'Insha Allah,' becomes invalid, unlike matters of the heart, such as intention, which remain valid even with 'Insha Allah.'
