وَقَوْلِ اللهِ عَزَّ وَجَلَّ: ﴿لَا يُؤَاخِذُكُمُ الله بِاللَّغْوِ فِي أَيْمَانِكُمْ وَلَكِن يُؤَاخِذُكُم بِمَا كَسَبَتْ قُلُوبُكُمْ وَالله غَفُورٌ حَلِيمٌ﴾(البقرة : ٢٢٥)
وَقَوْلِهِ تَعَالَى: ﴿لَا يُؤَاخِذُكُمُ اللهُ بِاللَّغْوِ فِي أَيْمَانِكُمْ وَلَكِن يُؤَاخِذُكُم بِمَا عَقَدتُمُ الْأَيْمَانَ فَكَفَّرَتُهُ إِطْعَامُ عَشَرَةِ مَسَكِينَ مِنْ أَوْسَطِ مَا تُطْعِمُونَ أَهْلِيكُمْ أَوْ كِسْوَتُهُمْ أَوْ تَحْرِيرُ رَقَبَةٍ فَمَن لَّمْ يَجِدْ فَصِيَامُ ثَلَثَةِ أَيَّامٍ ذَلِكَ كَفَرَةُ أَيْمَنِكُمْ إِذَا حَلَفْتُمْ وَاحْفَظُوا أَيْمَانَكُمْ كَذَلِكَ يُبَيِّنُ الله لَكُمْ وَآيَاتِهِ، لَعَلَّكُمْ تَشْكُرُونَ﴾ (المائدة : ۸۹
And the statement of Allah, the Mighty, the Exalted: Allah does not hold you accountable for the unintentional in your oaths, but He holds you accountable for what your hearts have earned. And Allah is Forgiving, Forbearing (Al-Baqarah: 225).
And His statement, the Exalted: Allah does not hold you accountable for the unintentional in your oaths, but He holds you accountable for the oaths you have bound yourselves with. Its expiation is the feeding of ten poor people with the average of what you feed your families, or clothing them, or freeing a slave. But whoever cannot find [the means], then fasting for three days. That is the expiation for your oaths when you have sworn. And guard your oaths. Thus does Allah make clear to you His signs, that you may be grateful (Al-Ma’idah: 89).
عَنِ ابْنِ عُمَرَ (رضي الله عنهما) قَالَ: أَكْثَرُ مَا كَانَ النَّبِيُّ ﷺ يَحْلِفُ لَا وَمُقَلِّبٍ الْقُلُوبِ. رَوَاهُ الْبُخَارِيُّ.

وَعَنْ أَبِي سَعِيدٍ الْخُدْرِيِّ (رضي الله عنه) قَالَ: كَانَ رَسُولُ الله ﷺ إِذَا اجْتَهَدَ فِي الْيَمِينِ قَالَ: «وَالَّذِي نَفْسُ أَبِي الْقَاسِمِ بِيَدِهِ». رَوَاهُ أَبُو دَاوُدَ.
Abu Sa’id al-Khudri (may Allah be pleased with him) narrated: When the Messenger of Allah (ﷺ) exerted effort in an oath, he said: “By the One in whose hand is the soul of Abu al-Qasim.” [Narrated by Abu Dawud]

1 قوله : لا وأستغفر الله : هذا بظاهره ليس بيمين، بل صورته صورة اليمين من حيث إنه أكد الكلام، ويمكن أن يقال: إن الواو للقسم، والمقسم به محذوف، أي لا والله، ثم ابتدأ بالكلام أستغفر الله، أي إن كان الأمر خلاف ذلك أو التقدير وأستغفر الله من الحلف، فإن الأفضل تركها إلا لمكان ضرورة بها؛ فإنها في الأصل عرضة، وهي منهية ولذا امتنع بعضهم عن الحلف ولو كان صادقاً، فما ثبت عنه الله إنما كان للاحتياج إليه من تأكيد حكم أو بيان جواز، ولذا قيل: إذا أراد الحلف ذكر هذا بدلا عن الحلف ولم يحلف، «المرقاة» ملخصا.
وَعَنِ ابْنِ عُمَرَ (رضي الله عنهما) أَنَّ رَسُوْلَ اللهِ ﷺ قَالَ: «إِنَّ الله يَنْهَاكُمْ أَنْ تَحْلِفُوْا بِآبَائِكُمْ، فَمَنْ كَانَ حَالِفًا فَلْيَحْلِفْ بِالله وَإِلَّا لِيَصْمُتْ». مُتَّفَقٌ عَلَيْهِ.

۱ قوله: من حلف بالأمانة: أي مطلقا من غير إضافة إلى الله فليس منا، أي يكون فيها الكراهة من أجل أنه إنما أمر أن يحلف بالله وصفاته، وليست الأمانة من صفاته، وإنما هي أمر من أموره وفرض من فروضه، فنهوا عنه؛ لما في ذلك من التسوية بينهما وبين أسماء الله تعالى وصفاته، ولعله أراد به الوعيد عليه فإنه حلف بغير الله، ولا يتعلق به الكفارة وفاقا، واختلف فيما إذا قال وأمانة الله، فقال الشافعي: لا يكون ذلك يمينا، ولا تلزمه فيها الكفارة. وقال أبو حنيفة: إنه يمين تجب الكفارة بالحنث فيه. وقال في البدائع: اختلفت الروايات عندنا في اليمين؛ بقوله: وأمانة الله، فذكر في الأصل» أنه يكون يمينا، وذكر ابن سماعة عن أبي يوسف أنه لا يكون يمينا، وذكر الطحاوي عن أصحابنا أنه ليس بيمين.

وَعَنْ ثَابِتِ بْنِ الضَّحَاكِ (رضي الله عنه) عَنِ النَّبِيِّ ﷺ قَالَ: «مَنْ حَلَفَ بِمِلَّةٍ غَيْرِ الْإِسْلَامِ كَاذِبًا مُتَعَمِّدًا فَهُوَ كَمَا قَالَ، وَمَنْ قَتَلَ نَفْسَهُ بِحَدِيدَةٍ عُذِّبَ بِهِ فِي نَارِ نَارِ جَهَنَّمَ مُتَّفَقٌ عَلَيْهِ.
وَرَوَى أَبُو دَاوُدَ وَالنَّسَائِيُّ وَابْنُ مَاجَهِ عَنْ بُرَيْدَةَ الله أَنَّ رَسُوْلَ اللهِ ﷺ قَالَ: «مَنْ قَالَ: إِنِّي بَرِيءٌ مِنَ الْإِسْلَامِ، فَإِنْ كَانَ كَاذِبًا فَهُوَ كَمَا قَالَ، وَإِنْ كَانَ صَادِقًا فَلَنْ يَرْجِعَ إِلَى الْإِسْلَامِ سَالِمًا».

Thabit ibn Ad-Dahhak (may Allah be pleased with him) narrated from the Prophet (ﷺ): “Whoever swears by a religion other than Islam, lying deliberately, is as he said. And whoever kills himself with a piece of iron will be tormented with it in the fire of Hell.” [Agreed upon]
Abu Dawud, Nasa’i, and Ibn Majah narrated from Buraydah (may Allah be pleased with him) that the Messenger of Allah (ﷺ) said: “Whoever says, ‘I am free from Islam,’ if he is lying, he is as he said, and if he is truthful, he will not return to Islam safely.”
Shaykh al-Islam al-Ayni said: The one who swears by the mentioned oath, his oath is binding, and he is required to offer expiation, by analogy to prohibiting the permissible, as it is an oath by the text. Allah, the Exalted, obligated expiation for one who makes a declaration of prohibition, which is an evil and false statement. Swearing by these things is evil and false. It is narrated from Ibn Abbas (may Allah be pleased with him) that he said: Whoever swears by Judaism, it is an oath.

Nakha’i, Awza’i, Thawri, the companions of Abu Hanifah, Ahmad, and Ishaq held that it is an oath, and expiation is required for breaking it. Malik, Shafi’i, and Abu Ubayd said: It is not an oath, and there is no expiation, but the one who says it is sinful whether he is truthful or lying. They argued with the statement: “Whoever swears and says, ‘By al-Lat and al-Uzza,’ let him say, ‘There is no god but Allah,’” and no expiation is mentioned in the hadith. We say: The absence of mention does not necessitate the negation of expiation. Our evidence is this hadith mentioned in the book, as Allah, the Exalted, obligated expiation for one who makes a declaration of prohibition, which is an evil and false statement, and swearing by these things is evil and false. The author of “Al-Hidayah” said: We hold this by analogy to prohibiting the permissible, as it is an oath by the text, for he (ﷺ) prohibited Mariyah to himself, so Allah, the Exalted, revealed: O Prophet, why do you prohibit what Allah has made lawful for you? (At-Tahrim: 1), then said: Allah has ordained for you the dissolution of your oaths (At-Tahrim: 2). This is supported by what Allamah Muhammad Ahsan as-Siddiqi an-Nanotawi said in the margin of “Al-Kanz,” taken from its commentaries: Ibn Abbas said: Whoever swears by Judaism, it is an oath. It is also supported by what Bayhaqi narrated from Zayd ibn Thabit. Thus, it is stated in “Ad-Durr al-Mukhtar” and “Radd al-Muhtar”: Swearing by saying, “If I do such and such, I am a Jew, a Christian, bear witness that I am a Christian, a partner with the disbelievers, or a disbeliever,” requires expiation if he breaks it, by analogy to prohibiting the permissible. Since he made the condition a sign of disbelief, and he believed it obligatory to abstain, and it is possible to say it is obligatory for another reason, we consider it an oath. This applies to the future. As for the past, such as saying, “If I did such and such, I am a disbeliever or a Jew,” or the like, knowing it is contrary, it is a deliberate false oath with no expiation except repentance. There is disagreement regarding his disbelief. The correct view is that the one who swears does not become a disbeliever, whether it is about the past or the future, if he believes it is an oath. If he is ignorant and believes he becomes a disbeliever in a deliberate false oath or by fulfilling the condition in the future, he becomes a disbeliever in both cases, immediately in the deliberate false oath, and upon fulfilling the condition in the binding oath, due to his acceptance of disbelief, as clarified in “Al-Bahr.” It is established in the two Sahihs from him (ﷺ) that he said: “Whoever swears by a religion other than Islam, lying deliberately, is as he said.” It appears that this was stated in the context of the prevalent case, as the majority of those who swear such oaths are ignorant and believe that disbelief is necessary upon breaking it. If this is established, otherwise, the hadith is evidence for those who absolutely hold his disbelief.
2 The statement: “Whoever kills himself with a piece of iron will be tormented with it in the fire of Hell”: The jurists and the people of the Sunnah unanimously agree that whoever kills himself does not exit Islam by that. Abu Hanifah and Muhammad said: He is washed and prayed over, and this is the fatwa, though his sin is greater than one who kills another. Kamal preferred the view of Abu Yusuf: “He is washed but not prayed over,” based on what is in “Muslim”: A man who killed himself was brought, and he (ﷺ) did not pray over him. In “Al-Bahr,” it is stated: The verification differs, but Abu Yusuf is supported by the hadith. I say: It may be said that the hadith does not indicate this, as it only states that he (ﷺ) did not pray over him. It appears he refrained as a deterrent to others from such an act, as he refrained from praying over a debtor, and it does not necessitate that no one among the companions prayed over him, as there is no equivalence between his prayer and that of others. Allah, the Exalted, said: Indeed, your prayer is a source of tranquility for them (At-Tawbah: 103). Know that this applies to one who kills himself intentionally. If it was by mistake, he is prayed over without disagreement, as clarified in “Al-Kifayah” and others, “Umdat al-Qari,” “Ad-Durr al-Mukhtar,” and “Radd al-Muhtar,” taken from them.
3 The statement: “Whoever says, ‘I am free from Islam,’ etc.”: Ibn al-Humam said: Saying, “He is free from Islam if he does such and such,” is an oath according to us, and likewise if he says he is free from prayer and fasting. [From “Al-Mirqat”] The statement: “There is no vow for the son of Adam in what he does not possess” will be addressed, God willing, in the chapter on vows.
۱ قوله: من حلف بملة غير الإسلام كاذبا متعمدا فهو كما قال: «غير الإسلام) صفة لـ «ملة» كان فعل كذا، فهو يهودي، أو نصراني، أو برئ من الإسلام. هذا النوع من الكلام هل يُسمى في عرف الشرع يمينا؟ وهل تتعلق الكفارة بالحنث فيه؟ فذهب النخعي والأوزاعي والثوري وأصحاب أبي حنيفة الله وأحمد وإسحاق إلى أنه يمين، تجب الكفارة بالحنث فيها. وقال مالك والشافعي وأبو عبيد : إنه ليس بيمين، ولا كفارة فيه، لكن القائل به آثم صَدَقَ فيه أو كَذَبَ، واحتجوا بقوله : من حلف، فقال: باللات والعزى، فليقل: لا إله إلا الله، ولم يذكر في الحديث كفارة.
قلنا : لا يلزم من عدم ذكرها فيه نفي وجوب الكفارة، وحجتنا هذا الحديث الذي ذكر في الكتاب؛ لأن الله تعالى أوجب على المظاهر الكفارة، وهو منكر من القول وزور، والحلف بهذا الأشياء منكر وزور، قال صاحب «الهداية»: قلنا به قياسا على تحريم الحلال، فإنه يمين بالنص، وذلك أنه الله حرم مارية على نفسه، فأنزل الله تعالى: ﴿يَأَيُّهَا النَّبِيُّ لِمَ تُحَرِّمُ مَا أَحَلَّ اللهُ لَكَ﴾ (التحريم: ۱) ، ثم قال : ﴿قَدْ فَرَضَ اللهُ لَكُمْ تَحِلَّةَ أَيْمَانِكُمْ﴾ (التحريم: ۲، ويؤيده ما قال العلامة محمد أحسن الصديقي النانوتوي في هامش «الكنز» آخذا من شروحه: إن ابن عباس قال: من حلف بالتَّهَودِ فهو يمين.
وأيضا يؤيده ما روى البيهقي عن زيد ابن ثابت لذلك قال في الدر المختار» ورد المحتار»: والقسم أيضًا بقوله: إن فعل كذا فهو يهودي أو نصراني، أو فأشهدوا علي بالنصرانية، أو شريك للكفار أو كافر، فتلزمه الكفارة إذا حنث إلحاقا له بتحريم الحلال؛ لأنه لما جعل الشرط علما على الكفر، وقد اعتقده واجب الامتناع، وأمكن القول بوجوبه لغيره جعلناه يمينا. هذا لو في المستقبل، أما الماضي كإن كنت فعلت كذا فهو كافر أو يهودي، ومثله الحال عالما بخلافه فغموس لا كفارة فيها، إلا التوبة، واختلف في كفره، والأصح أن الحالف لم يكفر، سواء علقه بماض أو آت، إن كان عنده في اعتقاده أنه يمين، وإن كان جاهلا وعنده أنه يكفر في الحلف بالغموس وبمباشرة الشرط في المستقبل يكفر فيهما، أي في الغموس والمنعقدة لرضاه بالكفر، أما في الغموس ففي الحال، وأما في المنعقدة فعند مباشرة الشرط، كما صرح به في البحر». واعلم أنه ثبت في الصحيحين عنه الله أنه قال: من حلف على يمين بملة غير الإسلام كاذبا متعمدا فهو كما قال، والظاهر أنه أخرج مخرج الغالب، فإن الغالب فمن يحلف بمثل هذه الأيمان أن يكون جاهلا لا يعرف إلا لزوم الكفر على تقدير الحنث، فإن تم هذا وإلا فالحديث شاهد لمن أطلق القول بكفره.
۲ قوله: من قتل نفسه بحديدة عذب به في نار جهنم أجمع الفقهاء وأهل السنة على أنه من قتل نفسه أنه لا يخرج بذلك من الإسلام. وقال أبو حنيفة ومحمد يغسل ويصلى عليه، به يفتى، وإن كان أعظم وزرا من قاتل غيره، ورجحالكمال قول أبي يوسف: «إنه يغسل ولا يصلى عليه بما في «مسلم»: أنه أتي برجل قتل نفسه فلم يصل عليه، قال في «البحر»: فقد اختلف التصحيح، لكن تأيد أبو يوسف بالحديث. أقول: قد يقال: لا دلالة في الحديث على ذلك لأنه ليس فيه سوى أنه لم يصل عليه، فالظاهر أنه امتنع زجرًا لغيره عن مثل هذا الفعل، كما امتنع عن الصلاة على المديون، ولا يلزم من ذلك عدم صلاة أحد عليه من الصحابة؛ إذ لا مساواة بين صلاته وصلاة غيره، قال تعالى: ﴿إِنَّ صَلَوتَكَ سَكَنٌ لَّهُمْ﴾ (التوبة: ۱۰۳) . ثم اعلم أن هذا كله فيمن قتل نفسه عمدًا. أما لو كان خطأ فإنه يصلى عليه بلا خلاف، كما صرح به في الكفاية» وغيرها عمدة القاري» و «الدر المختار» و«رد المحتار»، ملتقط منها.
۳ قوله: من قال: إني بريء من الإسلام إلخ : قال ابن الهمام قوله : وهو بريء من الإسلام إن فعل كذا يمين عندنا، وكذا إذا قال هو بريء من الصلاة والصوم. كذا في المرقاة. قوله وليس لعى ابن آدم نذر فيما لا يملك، سيأتي إن شاء الله تعالى تحقيقه في باب في النذور.
وَعَنْ زَيْدِ بْنِ ثَابِتٍ له قَالَ: سُئِلَ رَسُوْلُ اللهِ ﷺ عَنِ الرَّجُلِ يَقُوْلُ: هُوَ يَهُودِيُّ أَوْ نَصْرَانِيُّ أَوْ بَرِيءٌ مِنَ الْإِسْلَامِ فِي الْيَمِينِ يَحْلِفُ عَلَيْهِ فَيَحْنُتُ قَالَ: «كَفَّارَةُ يَمِينِ». رَوَاهُ الْبَيْهَقِيُّ.
وَفِي الْمُتَّفَقِ عَلَيْهِ عَنْ ثَابِتِ بْنِ الضَّحَاكِ ، أَنَّ رَسُولَ الله ﷺ قَالَ: «مَنْ حَلَفَ عَلَى مِلَّةٍ غَيْرِ الْإِسْلَامِ فَهُوَ كَمَا قَالَ، وَلَيْسَ عَلَى ابْنِ آدَمَ نَذْرُ فِيمَا لَا يَمْلِكُ، وَمَنْ قَتَلَ نَفْسَهُ بِشَيْءٍ فِي الدُّنْيَا عُذِّبَ بِهِ يَوْمَ الْقِيَامَةِ، وَمَنْ لَعَنَ مُؤْمِنًا فَهُوَ كَقَتْلِهِ، وَمَنْ قَذَفَ مُؤْمِنًا بِكُفْرٍ فَهُوَ كَقَتْلِهِ. وَمَنِ ادَّعَى دَعْوَى كَاذِبَةً لِيَتَكَثَّرَ بِهَا لَمْ يَزِدْهُ الله إِلَّا قِلَّةً». وَفِي رِوَايَةٍ لَهُمَا عَنْ أَبِي هُرَيْرَةَ اللهِ مَرْفُوْعًا: «مَنْ قَالَ لِصَاحِبِهِ: تَعَالَ أُقَامِرْكَ فَلْيَتَصَدَّقْ».
Zayd ibn Thabit (may Allah be pleased with him) narrated: The Messenger of Allah (ﷺ) was asked about a man who says, “He is a Jew, a Christian, or free from Islam” in an oath he swears and then breaks it. He said: “The expiation of an oath.” [Narrated by Bayhaqi]
In the agreed-upon narration from Thabit ibn Ad-Dahhak (may Allah be pleased with him), the Messenger of Allah (ﷺ) said: “Whoever swears by a religion other than Islam is as he said. There is no vow for the son of Adam in what he does not possess. Whoever kills himself with something in this world will be tormented with it on the Day of Resurrection. Whoever curses a believer, it is as if he killed him. Whoever accuses a believer of disbelief, it is as if he killed him. Whoever makes a false claim to gain wealth, Allah will only increase his poverty.”
In a narration of theirs from Abu Hurayrah (may Allah be pleased with him), attributed to the Prophet (ﷺ): “Whoever says to his companion, ‘Come, let us gamble,’ let him give charity.”

Bukhari narrated from Abdur-Rahman ibn Samurah (may Allah be pleased with him) that the Messenger of Allah (ﷺ) said: “Do not seek leadership, for if you are given it without asking, you will be helped in it, but if you are given it by asking, you will be left to it. If you swear an oath and see something better than it, do what is better and expiate your oath.” It is also narrated: “And expiate” with the letter “fa.”
In a narration by Nasa’i from Abi al-Ahwas Awf ibn Malik, from his father (may Allah be pleased with him), he said: I said, “O Messenger of Allah, what about my cousin? I go to him asking, but he neither gives me nor maintains ties with me. Then he needs me, comes to me, and asks, but I have sworn not to give him or maintain ties with him.” He ordered me to do what is better and expiate my oath.

1 The statement: “And sees something better than it, let him do what is better”: The author of “Al-Hidayah” said: Whoever swears to commit a sin, such as not praying, not speaking to his father, or killing someone, should break it. Ibn al-Humam (may Allah be pleased with him) said: Meaning, it is obligatory for him to break his oath and expiate it. In “Radd al-Muhtar,” it is stated: It is not far-fetched that obligation is intended by their saying “it is preferable,” and it is expressed in “Al-Majma’” as “fulfilling righteousness is preferred.” This is supported by the statements in “Al-Hidayah,” “Al-Kanz,” and others: Whoever swears to commit a sin should break it, as breaking it is obligatory, as you have learned. 2 The statement: “Let him do what is better and expiate his oath”: Know that expiation has three states: First, before swearing, it does not suffice by consensus. Second, after swearing and breaking, it suffices by consensus. Third, after swearing but before breaking, there is disagreement regarding advancing expiation before breaking. Shafi’i, Malik, and Ahmad permitted it, except that Shafi’i said: If one expiates by fasting before breaking, it is not permissible, but freeing a slave, feeding, or clothing is permissible, just as advancing zakat before its time is permissible, but advancing the fast of Ramadan before its time is not. Abu Hanifah and his companions said: Expiation, with all its types, does not suffice before breaking, even if one expiates before breaking and then breaks, he must expiate again. Meaning, the time of obligation for expiation in a binding oath about the future is the time of breaking, so it is not obligatory except after breaking according to us. According to Shafi’i and others, its time is the time of the oath’s existence, so expiation is obligatory upon making the oath without breaking. The conclusion is that according to them, the oath is the cause of expiation, and breaking is a condition, so expiation is permissible after the cause is realized, as expiation is attributed to the oath. Allah, the Exalted, said: That is the expiation for your oaths when you have sworn (Al-Ma’idah: 89), which is an indication of causality, as obligations are attributed to their causes in reality, such as expiation for killing, expiation for declaration of prohibition, expiation for breaking the fast, and others. According to us, breaking is the cause of the obligation of expiation, and the oath is a condition, as the oath’s binding nature is based on intending fulfillment, doing what was sworn, and being truthful in swearing, which is commanded by Shariah, as Allah, the Exalted, said: And guard your oaths (Al-Ma’idah: 89). Thus, it is not a cause for expiation, as the least degree of a cause is that it leads to the ruling and is a path to it, but the oath prevents it, so how can it be a cause? The oath does not lead to expiation. What leads to it is breaking, if it occurs after the oath, so it is the cause, and the oath is a condition for obligation. Thus, advancing expiation before breaking is not permissible, as it is advancing before the cause. The attribution mentioned in the verse is to the condition, as attribution to the condition is permissible and established in Shariah, such as expiation for pilgrimage and charity of breaking the fast. Even if we grant that the oath is the cause, there is no doubt that breaking is a condition of obligation, as it is certain that expiation is not obligatory before it, otherwise it would be obligatory by the mere oath. The conditioned does not exist before its condition, so expiation does not occur as obligatory before it, nor does it remove the obligation before or at the time of its establishment by an act that was not obligatory before. As for the hadith, it is narrated with variations: “Let him do what is better and expiate his oath,” and “Then let him expiate his oath.” In all its narrations, it is evidence for us, not for them, because if expiation were obligatory by the oath itself, he would have said: “Whoever swears an oath, let him expiate,” without addressing what the oath was about. Breaking was required when it was better, followed by expiation. Since he specified the oath where breaking is better than fulfilling with breaking and expiation, it is specific to breaking, not the oath itself, even if it is by the oath’s establishment without breaking. These narrations with the letter “waw,” which is for absolute conjunction without precedence or delay, whether expiation is mentioned before or after, do not indicate advancing expiation before breaking as evidence for us. The evidence for the permissibility of “then” meaning “and” is Allah’s statement: Or a poor person in dust, then he is among those who believe (Al-Balad: 16-17), meaning “and he was before that,” as righteous deeds before faith are not considered. Thus, expiation is not obligatory before breaking. If it were as they say, expiation would be obligatory first, then breaking afterward, separated by the command for it. Saying that one is free to do it before or after negates the requirement of the command and the function of “then.” In Shafi’i’s view, expiation includes all its types. ۱ قوله: فرأى غيرها خيرا منها فليأت الذي هو خير : قال صاحب الهداية»: ومن حلف على معصية مثل: لا يصلي، أو لا يكلم أباه، أو ليقتلن فلانا، ينبغي أن يحنث. قال ابن الهمام الله : أي يجب عليه أن يحنث نفسه ويكفر عن يمينه.
وفي رد المحتار: ولا يبعد أن يكون الوجوب هو المراد من قولهم: أولى، وعبر في المجمع» بقوله: «ترجح البر»، ويقربه قول «الهداية» و«الكنز» وغيرهما، ومن حلف على معصية ينبغي أن يحنث، فإن الحنث واجب كما علمت فأرادا بلفظ «ينبغي» الوجوب، مع أن الغالب استعماله في غيره، فكذا هذا كما تقول الأولى بالمسلم أن يصلي.
۲ قوله : فليأت الذي هو خير وليكفر عن يمينه: اعلم أن الكفارة لها ثلاث حالات، أحدها: قبل الحلف، فلا تجزئ اتفاقا، ثانيها: بعد الحلف والحنث، فتجزئ اتفاقا، ثالثها: بعد الحلف وقبل الحنث، ففيها الخلاف، يعني اختلفوا في تقديم الكفارة على الحنث، فذهب الشافعي ومالك وأحمد إلى جوازه، إلا أن الشافعي يقول: إن كفر بالصوم قبل الحنث فلا يجوز، وإنما يجوز العتق أو الإطعام أو الكسوة، كما يجوز تقديم الزكاة على الحول، ولا يجوز تعجيل صوم رمضان قبل وقته. وقال أبو حنيفة وأصحابه: لا يجزء الكفارة مع أنواعها قبل الحنث حتى لو كفر قبل الحنث، ثم حنث بعد الكفارة، كفر ثانيًا، يعني وقت وجوب الكفارة في اليمين المعقودة على المستقبل هو وقت وجود الحنث، فلا يجب إلا بعد الحنث عندنا، وعند الشافعي وغيره وقته وقت وجود اليمين، فتجب الكفارة بعقد اليمين من غير حنث، الحاصل أن اليمين عنده سبب الكفارة والحنث شرط، فيجوز الكفارة بعد تحقق السبب، فإن الكفارة تضاف إلى اليمين.
قال الله تعالى: ﴿ذَلِكَ كَفَرَةُ أَيْمَانِكُمْ إِذَا حَلَفْتُمْ﴾ (المائدة: ۸۹، وهذا آية السببية، فإن الواجبات تضاف إلى أسبابها حقيقة، كما يقال: كفارة القتل، وكفارة الظهار، وكفارة الإفطار، وغير ذلك، وعندنا الحنث سبب لوجوب الكفاره واليمين شرط؛ لأن انعقاد اليمين إنما يكون بقصد البر، وإتيان ما حلف عليه وصدقه في حلفه، وهو المأمور به شرعًا، بقوله تعالى: ﴿وَاحْفَظُوا أَيْمَنَكُمْ﴾ (المائدة: ۸۹ ، فلا يكون سببا لكفارة؛ لأن أدنى درجات السبب أن يكون مفضيا إلى الحكم وطريقا إليه، واليمين مانعة، فكيف يكون سببًا ؟ فلا تكون اليمين مفضية إلى الكفارة.
وإنما المفضي إليها الحنث إذا وجد بعد اليمين فيكون هو السبب، واليمين تكون شرطا للوجوب، فلا يجوز تقديم الكفارة على الحنث لكونه تقديما على السبب. فالإضافة المذكورة في الآية إضافة إلى الشرط، فإن الإضافة إلى الشرط جائزة وثابتة في الشرع، كما في كفارة الإحرام وصدقة الفطر على أنه لو سلم أن اليمين سبب، فلا شك في أن الحنث شرط الوجوب للقطع بأن الكفارة لا تجب قبله، وإلا وجبت بمجرد اليمين، والمشروط لا يوجد قبل شرطه فلا يقع التكفير واجبا قبله، فلا يسقط الوجوب قبل ثبوته، ولا عند ثبوته بفعل قبله لم يكن واجبا، وأما الحديث فقد روی براویات روي فليأت الذي هو خير وليكفر عن يمينه، وروي ثم ليكفر عن يمنيه، وهو على الروايات كلها حجة عليهم لا لهم؛ لأن الكفارة لو كانت واجبة بنفس اليمين، لقال : من حلف على يمين فليكفر» من غير التعرض لما وقع عليه اليمين أنه ماذا، ولما لزم الحنث إذا كان خير، ثم بالتكفير.
فلما خص اليمين على ما كان الحنث خيرا من البر بالنقض والكفارة على أنها تختص بالحنث دون اليمين نفسها وإنها بعقد اليمين دون الحنث، وأيضًا هذه الروايات الواردة بحرف الواو الموضوع للجمع المطلق من غير تقديم وتأخير سواء كان ذكر التكفير مقدما أو مؤخرا، لا دلالة لها على تقديم الكفارة على الحنث حجة لنا، وكذا ما ورد في بعض الروايات فليأت بالذي هو خير ثم ليكفر عن يمينه ثم إن المروي في «أبي داود والنسائي» هو لفظ إذا حلفت على يمين فكفر عن يمينك، ثم انت الذي هو خير ، فتأويل هذا الحديث إن صح أن كلمة «ثم» فيه بمعنى الواو جمعا بين الروايات المختلفة، والدليل على جواز مجيء ثم» بمعنى الواو قوله تعالى: ﴿أَوْ مِسْكِينًا ذَا مَتْرَبَةٍ ثُمَّ كَانَ مِنَ الَّذِينَ ءَامَنُوا﴾ (البلد : ١٦-١٧)
تقديره وكان قبل ذلك؛ لأن الأعمال الصالحة قبل الإيمان لا يعتد بها، لهذا لا يجب التكفير قبل الحنث، ولو كان كما قاله لوجب التكفير أولا، ثم الحنث بعده مفصولا للأمر به، والقول بأنه مخير في الإتيان بها قبله أو بعده، يبطل موجب الأمر والعمل بـ ثم»، وأيضًا فيما ذهب إليه الشافعي أن الكفارة اسم الجميع أنواعها، فبعد الحنث حمل اللفظ على جميعها وقبل الحنث خصص اللفظ ببعضها، فترك الظاهر من ثلاثة أوجه أحدها: تسميتها كفارة، وليس هناك ما يكفر؛ لأن الكفارة لستر الجناية من الكفر، وهو الستر، فلا جناية قبل الحنث، والثاني: صرف الأمر عن الوجوب يجب ذلك عليه، فيجاب بأن ذلك باعتبار أن في الحنث هتك حرمة الله في الظاهر، أو باعتبار توهم الحالف أن في الحنث إثما، اللمعات» ملخصا. وقال البرماوي: «آثم» أفعل تفضيل يقتضي المشاركة، فيشعر بأن إعطاء الكفارة فيه إثم؛ لما في الحنث من عدم تعظيم اسم الله تعالى، وبينه وبين الكفارة ملازمة عادة. قاله في «المرقاة».
وَعَنْ أَبِي هُرَيْرَةَ (رضي الله عنه) قَالَ: قَالَ رَسُولُ اللهِ ﷺ: «وَالله لَأَنْ يَلِ أَحَدُكُمْ بِيَمِينِهِ فِي أَهْلِهِ آثَمُ لَهُ عِنْدَ اللهِ مِنْ أَنْ يُعْطِيَ كَفَّارَتَهُ الَّتِي افْتَرَضَ الله عَلَيْهِ». مُتَّفَقٌ عَلَيْهِ.
Abu Hurayrah (may Allah be pleased with him) narrated: The Messenger of Allah (ﷺ) said: “By Allah, for one of you to persist in his oath regarding his family is more sinful in the sight of Allah than giving the expiation that Allah has obligated upon him.” [Agreed upon]

وَرَوَى أَحْمَدُ وَابْنُ مَاجَه عَنْ سُوَيْدِ بْنِ حَنْظَلَةَ قَالَ: خَرَجْنَا نُرِيدُ رَسُولَ الله ﷺ وَمَعَنَا وَائِلُ بْنُ حُجْرٍ، فَأَخَذَهُ عَدُوٌّ لَهُ، فَتَحَرَّجَ الْقَوْمُ أَنْ يَحْلِفُوْا وَحَلَفْتُ أَنَّهُ أَخِي فَخَلَّى عَنْهُ، فَأَتَيْنَا رَسُولَ اللهِ ﷺ فَذَكَرْتُ ذَلِكَ لَهُ، فَقَالَ: «أَنْتَ كُنْتَ أَبَرَّهُمْ وَأَصْدَقَهُمْ صَدَقْتَ الْمُسْلِمُ أَخُو الْمُسْلِمِ». وَذَكَرَ إِبْرَاهِيمُ النَّخَعِيُّ الْيَمِينُ عَلَى نِيَّةِ الْخَالِفِ لَوْ مَظْلُومًا، وَعَلَى نِيَّةِ الْمُسْتَحْلِفِ لَوْ ظَالِمًا.
Abu Hurayrah (may Allah be pleased with him) narrated: The Messenger of Allah (ﷺ) said: “Your oath is based on what your companion believes you on.” [Narrated by Muslim]
In another narration by him, he narrated: The Messenger of Allah (ﷺ) said: “The oath is based on the intention of the one who demands it.” It is said: This is interpreted as applying to the one who demands it if he is wronged.
Ahmad and Ibn Majah narrated from Suwayd ibn Hanzalah: We set out intending to meet the Messenger of Allah (ﷺ), and with us was Wa’il ibn Hujr. An enemy of his seized him, and the people refrained from swearing, but I swore that he was my brother, so he released him. We came to the Messenger of Allah (ﷺ), and I mentioned that to him. He said: “You were the most righteous and truthful of them. You were truthful; the Muslim is the brother of the Muslim.”
Ibrahim an-Nakha’i mentioned: The oath is based on the intention of the swearer if he is wronged, and on the intention of the one who demands it if he is the wrongdoer.

1 The statement: “This is interpreted as applying to the one who demands it if he is wronged”: Its detail is in “Radd al-Muhtar.” In “Al-Khaniyah,” it is stated: If a man demands an oath from another, and he swears intending something other than what the one demanding intends, such as divorce, emancipation, or the like, the intention of the swearer is considered if the swearer does not intend contrary to the apparent, whether he is the wrongdoer or wronged. If the oath is by Allah, the Exalted, and the swearer is wronged, the intention is his, but if he is the wrongdoer intending to nullify another’s right, the intention of the one demanding is considered. This is the view of Abu Hanifah and Muhammad. 2 The statement: “You were the most righteous and truthful of them”: Qadi Iyad narrated consensus that one who swears without being demanded and without a right attached to his oath has his intention considered, and his statement is accepted. If there is a right of another upon him, there is no disagreement that judgment is based on the apparent meaning of his oath, whether he swears voluntarily or by demand. [Summarized] If the consensus is established contrary to what the apparent hadith of Muslim suggests, it is relied upon. This can be supported by this hadith of Suwayd ibn Hanzalah mentioned in the chapter, as the Prophet (ﷺ) judged him as righteous in his oath, and he is not righteous except by considering his own intention, as he intended metaphorical brotherhood, while the one demanding intended literal brotherhood. ۱ قوله: هو محمول على المستحلف المظلوم تفصيله ما في رد المحتار». قال في «الخانية»: رجل حلف رجلا فحَلَفَ ونوى غير ما يريد المستحلف أن بالطلاق والعتاق ونحوه يعتبر نية الحالف إذا لم ينو الحالف خلاف الظاهر، ظالما كان الحالف أو مظلوما، وإن كانت اليمين بالله تعالى، فلو الحالف مظلومًا فالنية فيه إليه، وإن ظالما يريد إبطال حق الغير اعتبر نية المستحلف، وهو قول أبي حنيفة ومحمد. قلت: وتقييده بما إذا لم ينو خلاف الظاهر يدلُّ على أن المراد باعتبار نية الحالف اعتبارها في القضاء؛ إذ لا خلاف في اعتبار نيته ديانة، وبه علم الفرق بينه وبين مذهب الخصاف فإن عنده تعتبر نيته في القضاء أيضًا، ويفتى بقوله، إذا كان الحالف مظلوما كما علمت. وفي الهندية» عن «المحيط»: ذكر قول إبراهيم النخعي، وبه أخذ أصحابنا وحاصله ما في الدر المختار»: وقالوا: النية للحالف لو بـ طلاق أو عتاق، وكذا بالله لو مظلومًا، وإن ظالما فللمستحلف، ولا تعلق للقضاء في اليمين بالله.
۲ قوله : أنت كنت أبرهم وأصدقهم : وقد حكى القاضي عياض الإجماع على أن الحالف من غير استحلاف، ومن غير تعلق حق بيمينه له نيته، ويقبل قوله: وأما إذا كان لغيره حق عليه، فلا خلاف أنه يحكم على بظاهر يمينه، سواء حلف متبرعا أو باستحلاف، انتهى ملخصا. وإذا صح الإجماع على خلاف ما يقضي به ظاهر حديث «مسلم» كان الاعتماد عليه، ويمكن التمسك لذلك بهذا حديث سويد بن حنظلة المذكور في الباب، فإن النبي ﷺ حكم له بالبر في يمينه، مع أنه لا يكون بارا إلا بالاعتبار نية نفسه؛ لأنه قصد الأخوة المجازية، والمستحلف له قصد الأخوة الحقيقية، ولعل هذا هو مستند الإجماع، «نيل الأوطار» ملخصا.

Aishah (may Allah be pleased with her) narrated: This verse was revealed: Allah does not hold you accountable for the unintentional in your oaths regarding a man’s statement: “No, by Allah,” and “Yes, by Allah.” [Narrated by Bukhari]
In “Sharh as-Sunnah,” the wording of (Al-Ma’idah: 89) is in “Al-Masabih,” and it is said that some attributed it to Aishah.
In a narration by Bayhaqi from Ata ibn Abi Rabah: I and Ubayd ibn Umayr al-Laythi were with Aishah (may Allah be pleased with her), the wife of the Prophet (ﷺ). Ubayd asked her about Allah’s statement, the Mighty, the Exalted: Allah does not hold you accountable for the unintentional in your oaths (Al-Ma’idah: 89). She said: It is a man’s oath based on his knowledge, then he finds it not to be so, and there is no expiation for it.
Ibn Jarir and Ibn al-Mundhir narrated from Ibn Abbas (may Allah be pleased with him) that he said regarding the interpretation of the verse: The unintentional is breaking an oath falsely, believing it to be true, while the reality is contrary to what he thought.

1 The statement: “This verse was revealed, etc.”: Know that oaths are of three types: unintentional, deliberate false, and binding. The unintentional is when one swears about a past act, believing it to be true, but it is actually contrary. This is the Hanafi view, narrated from Ibn Abbas and Ata ibn Abi Rabah regarding the interpretation of unintentional, and it is mentioned in the texts, “Al-Hidayah,” and its commentaries. It was held by Rabiah, Malik, Layth, Hasan, Mujahid, Nakha’i, Zuhri, Sulayman ibn Yasar, Qatadah, Sudi, and Mukhawwal. Two narrations are from Ahmad. In “Al-Fath,” it is stated that Ibn al-Mundhir and others narrated it from Ibn Umar, Ibn Abbas, and others among the companions. His statement: “It is interpreted according to us, etc.” is a report of what Muhammad mentioned, based on that narration from Abu Hanifah, intending to clarify the difference between it and Shafi’i’s view, as the future is unintentional according to him, not us. Our evidence is Allah’s statement: Allah does not hold you accountable for the unintentional in your oaths, but He holds you accountable for the oaths you have bound yourselves with (Al-Ma’idah: 89), contrasting the unintentional oath with the binding oath, distinguishing between them by accountability and its negation. Thus, it is narrated from Ibn Abbas regarding the interpretation of the unintentional oath: It is when a man swears a false oath, believing it to be true. ألا ترى أن المؤاخذة فيها ثابتة، وفيها الكفارة بالنص، فدل على أن المراد باللغو ما قلنا، وهكذا روي عن ابن عباس في تفسير يمين اللغو هي أن يحلف الرجل على اليمين الكاذبة، وهو يرى أنه صادق، وتيين أن المراد من قول عائشة وقول رسول الله : إن يمين اللغو ما يجري في كلام الناس لا والله» و«بلى والله» في الماضي لا في المستقبل، والدليل عليه أنها فسرتها بالماضي، روى عن مطر عن رجل قال: دخلت أنا وابن عمر على عائشة، فسألتها عن يمين اللغو فقالت: قول الرجل: فعلنا والله كذا ، وصنعنا والله كذا، فتحمل تلك الرواية على هذا توفيقا بين الروايتين؛ إذ المجمل محمول على المفسر، فالحاصل أن يقال: إن اللغو عندنا قسمان: الأول ما ذكر في المتون والثاني ما في هذه الرواية، فتكون هذه الرواية بيانا للقسم الذي سكت عنه أصحاب المتون. وفي «الفتح» التصريحبعدم المؤاخذة في اللغو على التفسيرين، رد المحتار» و «البدائع ملتقط منها، وسيجيء تفسير الغموس والمنعقدة في الحديث الآتي بعد.

۱قوله: الشغار أن يزوج الرجل إلخ : قال في النهر : وهو أن يشاغر الرجل، أي يزوجه حريمته على أن يزوجه الآخر حريمته، ولا مهر إلا هذا. كذا في المغرب، أي على أن يكون بضع كل صداقًا عن الآخر، وهذا القيد لا بد فيه في مسمى الشغار حتى لو لم يقل ذلك ولا معناه، بل قال: زوجتك بنتي على أن تزوجني بنتك، فقبل، أو على أن يكون بضع بنتي صداقا لبنتك، فلم يقبل الآخر ، بل زوجه بنته، ولم يجعلها صداقا لم يكن شغارًا، بل نكاحا صحيحًا اتفاقا، وإن وجب مهر المثل في الكل؛ لما أنه سمى ما لا يصلح صداقا حاصله: أن مجرد ترك الصداق ليس المقتضى للبطلان عندهم؛ لأن النكاح يصح بدون تسمية، بل المقتضي لذلك جعل البضع صداقا، والشغار منهي عنه الخلوه عن المهر، فأوجبنا فيه مهر المثل، فلم يبق شغارا.
هذا جواب عما أورده الشافعي من حديث الكتب الستة مرفوعا من النهي عن نكاح الشغار، والنهي يقتضي فساد المنهي عنه، والجواب: أن متعلّق النهي مسمى الشغار المأخوذ في مفهومه خلوه عن المهر، وكون البضع صداقا، ونحن قائلون بنفي هذه الماهية، وما يصدق عليها شرعًا، فلا تثبت النكاح كذلك، بل نبطله فيبقى نكاحا سمي فيه ما لا يصلح مهرًا، فينعقد موجبا لمهر المثل، كالمسمى فيه خمر أو خنزير فيما هو متعلق النهي لم نثبته، وما أثبتناه لم يتعلق به، بل اقتضت العمومات صحته، تمامه في الفتح، زاد الزيلعي أو هو، أي النهي محمول على الكراهة. أي والكراهة لا توجب الفساد، وحاصله : أنه مع إيجاب مهر المثل لم يبق شغارا حقيقة، وإن سلم فالنهي على معنى الكراهة، فيكون الشرع أوجب فيه أمرين: الكراهة، ومهر المثل، فالأول مأخوذ من النهي، والثاني من الأدلة الدالة على أن ما سمي فيه ما لا يصلح مهرا ينعقد موجبا لمهر المثل، وهذا الثاني دليل على حمل النهي على الكراهة دون الفساد.
وبهذا التقرير اندفع ما أورد من أن حمله على الكراهة يقتضي أن الشغار الآن غير منهي عنه لا يجابنا فيه مهر المثل، ووجه الدفع أنه إذا حمل النهي على معنى الفساد فكونه غير منهي الآن، أي بعد إيجاب مهر المثل مسلم، وإن حمل على معنى الكراهة فالنهي باق، فافهم الدر المختار ورد المختار منها قال عياض: لا خلاف في النهي عن الشغار ابتداء، فإن وقع الكوفيون والليث والزهري وعطا بصداق المثل، وأبطله مالك والشافعي. كذا في شرح الزرقاني.
وَعَنْ أَبِي هُرَيْرَةَ (رضي الله عنه)قَالَ: قَالَ رَسُولُ اللهِ : خَمْسُ لَيْسَ لَهُنَّ كَفَّارَةُ: الشِّرْكُ بِاللهِ، وَقَتْلُ النَّفْسِ بِغَيْرِ حَقٌّ، وَبَهْتُ مُؤْمِنٍ ، وَالْفِرَارُ يَوْمَ الزَّحَفِ، وَيَمِينُ صَابِرَة يَقْتَطِعُ بِهَا مَالًا بِغَيْرِ حَقٌّ». رَوَاهُ أَحْمَدُ.
Abu Hurayrah (may Allah be pleased with him) narrated: The Messenger of Allah (ﷺ) said: “Five have no expiation: Associating partners with Allah, killing a soul without right, slandering a believer, fleeing on the day of battle, and a deliberate false oath by which one wrongfully takes wealth.” [Narrated by Ahmad]

1 The statement: “And a deliberate false oath, etc.”: Meaning the deliberate false oath, which is when one swears about a past act, deliberately lying, knowing it is contrary. The binding oath is when one swears about a future act, intending or not intending that statement. According to us, if he breaks a binding oath, expiation is obligatory, and he sins, otherwise not. There is nothing obligatory in the unintentional or deliberate false oath, but he sins in the deliberate false oath, and there is no expiation except repentance and seeking forgiveness, and forgiveness is hoped for in the unintentional. According to Shafi’i, as expiation is obligatory in the binding oath, it is obligatory in the deliberate false oath. Our view is supported by this hadith. 1 The statement: "A man should not propose over his brother’s proposal, etc.": The prohibition according to the Hanafis is only after acceptance; otherwise, it is not, based on Fatimah bint Qays’ Hadith, where she mentioned that three proposed to her, and he did not object to some proposing over others. According to others, the prohibition is absolute. This is the summary of what Al-Tahawi said in "Sharh Ma‘ani al-Athar."
۱ قوله: ويمين صابرة إلخ : أي الغموس، وهو أن يحلف على فعل ماض يتعمد الكذب فيه، أي حال كونه عالما أنه خلافه، والمنعقدة، أن يحلف على فعل آت في المستقبل قاصدًا أو غير قاصد لذلك القول، فعندنا إن حنث في المنعقدة يجب عليه الكفارة ويأثم، وإلا فلا، وليس في اللغو والغموس شيء يجب عليه، ولكن يأثم في الغموس، ولا كفارة فيها إلا التوبة والاستغفار، ويرجى العفو في اللغو، وعند الشافعي كما يجب الكفارة في المنعقدة يجب في الغموس، ويؤيدنا هذا الحديث، والتحقيق مع الدلائل يطلب من التفسيرات الأحمدية» وكتب الفقه، أخذته من الهداية» و«رد المحتار» و «التفسيرات الأحمدية».
وَعَنْ أُبَيَّ بْنِ كَعْبٍ وَابْنِ مَسْعُودٍ (رضي الله عنهما) أَنَّهُمَا قَرَأهَا: ﴿فَصِيَامُ ثَلَاثَةِ أَيَّامٍ مُتَتَابِعَاتٍ﴾ حَكَاهُ أَحْمَدُ، وَرَوَاهُ الْأَثْرَمُ بِإِسْنَادِهِ.
Ubayy ibn Ka’b and Ibn Mas’ud (may Allah be pleased with them) recited: Fasting for three consecutive days. Ahmad narrated it, and Athram narrated it with his chain.

2 The statement: “They recited, etc.”: Meaning if he cannot afford any of the three things, he fasts for three consecutive days. Shafi’i said: He may choose to separate them or make them consecutive, due to the generality of the text. According to us, there is the recitation of Ibn Mas’ud (may Allah be pleased with him): Fasting for three consecutive days, which is like a well-known report, and it is permissible to add to the general text of the Book with it. ۲ قوله : أنهما قرأ إلخ : يعني فإن لم يقدر على أحد الأشياء الثلاثة صام ثلاثة أيام متتابعات. وقال الشافعي الله بخير، إن شاء فرق وإن شاء تابع؛ لإطلاق النص، ولنا قراءة ابن مسعود الله: فصيام ثلاثة أيام متتابعات، وهي كالخبر المشهور يجوز الزيادة به على مطلق الكتاب، ويؤيده هذا الحديث أيضًا، أخذته من «الهداية» و«البناية».
وَعَنِ ابْنِ عُمَرَ(رضي الله عنهما) أَنَّ رَسُولَ اللهِ ﷺ قَالَ: «مَنْ حَلَفَ عَلَى يَمِينٍ فَقَالَ إِنْ شَاءَ الله فَلَا حِنْتَ عَلَيْهِ. رَوَاهُ التَّرْمِذِيُّ وَأَبُو دَاوُدَ وَالنَّسَائِيُّ وَابْنُ مَاجَهِ وَالدَّارِمِيُّ.
وَرَوَى الْبَيْهَقِيُّ فِي سُنَنِهِ عَنْهُ الله أَنَّهُ قَالَ: كُلُّ اسْتِثْنَاءِ مَوْصُولٍ فَلَا حِنْتَ عَلَى صَاحِبِهِ، وَإِنْ كَانَ غَيْرَ مَوْصُوْلٍ فَهُوَ حَانِثُ, وَرَوَى الدَّارَ قُطْنِيُّ عَنْهُ مَوْقُوْفًا نَحْوَهُ.

Bayhaqi narrated in his Sunan from him (may Allah be pleased with him) that he said: Every connected exception has no breaking upon its maker, but if it is disconnected, he is a breaker.

1 The statement: "Shighar is when a man, etc.": In "An-Nahr": It is when a man engages in shighar, meaning he marries his woman on the condition that the other marries his woman to him, with no dowry except this. As in "Al-Mughrib," meaning that each woman’s intimacy is the dowry for the other. This condition is necessary for it to be called shighar. If he does not say this or its meaning, but says: "I marry you my daughter on the condition you marry me your daughter," and it is accepted, or "on the condition that my daughter’s intimacy is the dowry for your daughter," and the other does not accept but marries his daughter without making it a dowry, it is not shighar but a valid marriage by consensus. The dowry of peers is required in all cases because something unsuitable was named as dowry. In summary: Merely omitting the dowry does not necessitate invalidity according to them, as marriage is valid without naming a dowry. The reason for invalidity is making intimacy a dowry. Shighar is prohibited due to the absence of a dowry, so we require the dowry of peers, and it is no longer shighar.
1 The statement: And let them fulfill their vows: This command indicates obligation. Although this was revealed concerning a specific vow, it may be used as evidence that fulfilling a vow absolutely is obligatory, because it is a command to fulfill the vow, and the text, according to us, is not restricted to its context or cause. Thus, it indicates that fulfilling every vow is obligatory. They used the term “obligation” here in contrast to a mandated duty, because it is a general rule from which some specific cases are excluded, such as a vow to commit a sin or a non-intended act of worship, making it presumptive. Therefore, they applied the term “obligation” to it, indicating the ambiguity.
3 The statement: “Whoever swears an oath, etc.”: Meaning whoever connects “If Allah wills” with his oath, it is nullified. This excludes when he says “If Allah wills” after his oath, disconnected, as it does not nullify his oath, because the exception only applies when connected, not disconnected. [Taken from the commentary on “Al-Wiqayah” and “Umdat ar-Ri’ayah”] If you say: The hadith in its generality does not distinguish between connected and disconnected. I say: The evidence from texts and others regarding the obligation of contracts necessitates connection, as permitting a disconnected exception would lead to nullifying all contracts, such as sales, marriages, and others, and the corruption in that is evident, as stated by Ayni. Sadr ash-Shari’ah mentioned in the evidence for prohibiting delay: The hadith “Let him expiate his oath” obligated expiation, so if a delayed exception were permissible, expiation would not be obligatory in any oath, as he could say delayed: “If Allah wills,” nullifying his oath. ۳ قوله: من حلف على يمين إلخ : أي من وصل إن شاء الله تعالى بحلفه بطل، احترز بمن وصل عما إذا قال بعد حلفه منفصلا : إن شاء الله فإنه لا يبطل به يمينه؛ لأن الاستثناء إنما يعمل متصلا لا منفصلا، أخذته من شرحالوقاية» و«عمدة الرعاية. فإن قلت: الحديث بإطلاقه لا يفصل بين المتصل والمنفصل. قلت: الدلائل الدالة من النصوص وغيرها على لزوم العقود هي التي توجب الاتصال، فإن جواز الاستثناء منفصلا يفضي إلى إخراج العقودكلها من المقصود من البيوع والأنكحة وغيرها، وفي ذلك من الفساد ما لا يخفى، كذا ذكر العيني، وذكر صدر الشريعة في الاستدلال على امتناع التراخي حديث فليكفر عن يمينه فإنه أوجب الكفارة، فلو جاز بيان التغيير، أي الاستثناء متراخيا، لما وجبت الكفارة في يمين أصلا؛ لجواز أن يقول متراخيا: إن شاء الله فتبطل يمينه. قاله في التعليق الممجد». وأيضًا يؤيده أثر البيهقي والدارقطني الذي ذكر في الكتاب. وقال في «عمدة القاري»: والمراد بالاستثناء هنا لفظ إن شاء الله، وليس المراد به الاستثناء الاصطلاحي ، نحو : والله لأفعلن كذا إن شاء الله تعالى، أو قال: والله لأفعلن كذا إن شاء الله، وفيه اختلاف للعلماء، فقال إبراهيم والحسن والثوري وأبو حنيفة وأصحابه والأوزاعي والليث وجمهور العلماء: شرطه أن يتصل بالحلف.
وقال الشافعي: يشترط وصل الاستثناء بالكلام الأول، ووصله أن يكون أي بلا فصل متلائم على نظام واحد، فإن كان بينها سكوت انقطع، إلا إذا كان لتذكر أو تنفس أو عي العجز عن المنطق وببيان مراده أو انقطاع صوت واختلفوا أيضًا في الاستثناء في الطلاق والعتق فقال ابن أبي ليلى والأوزاعي والليث ومالك: لا يجوز الاستثناء، وروى مثله عن ابن عباس وابن المسيب. وقال طاوس والنخعي والحسن وعطاء في رواية وأبو حنيفة وأصحابه والشافعي وأصحابه وإسحاق: يجوز الاستثناء، انتهى.
وقال في البحر»: ظاهر كلام صاحب «الكنز»، ولو وصل بحلفه إن شاء الله، بر أن اليمين منعقدة إلا أنه لا حنث عليه أصلا؛ لعدم الاطلاع على مشيئة الله تعالى، وهذا قول أبي يوسف الله تعالى، وعند أبي حنيفة ومحمد الله أن التعليق بالمشيئة إبطال، ولذا قال في التبيين»: وأراد بقوله: «بر» عدم الانعقاد؛ لأن فيه عدم الحنث كالبر، فأطلق علهي، وحاصل كلام الفقهاء أن كل شيء تعلّق بالقول، فالمشيئة المتصلة به مبطلة له عبادة أو معاملة، بخلاف المتعلق بالقلب كالنية.
۱ قوله : وليوفوا نذورهم هذا الأمر للوجوب، ثم هذا وإن كان واردا في نذر مخصوص إلا أنه ربما تمسك به في أن إيفاء النذر مطلقا واجب؛ لأنه أمر بإيفاء النذر، والنص لا يختص بمورده وسببه عندنا، فدل على أن كل نذر إيفاءه واجب. وإنما أطلقوا لفظ الوجوب ههنا مقابلا للفريضة؛ لأنه عام خص عنه بعض أفراده، وهو النذر بالمعصية والقرب الغير المقصود، فكان ظنيا، فأطلقوا عليه لفظ الوجوب المنبئ عن الشبهة.
