بَابُ إِعْتَاقِ الْعَبْدِ الْمُشْتَرَكِ وَشِرَاءِ الْقَرِيبِ وَالْعِتْقِ فِي الْمَرَضِEmancipation of a Shared Slave, Purchasing a Relative, and Emancipation During Illness
وَقَوْلِ الله عَزَّ وَجَلَّ: ﴿فَكَاتِبُوهُمْ إِنْ عَلِمْتُمْ فِيهِمْ خَيْرًا﴾(النور: ۳۳
1 قوله: وكاتبوهم إلخ : قال في الهداية»: هذا الأمر ليس أمرا يجاب بإجماع بين الفقهاء، وإنما هو أمر ندب هو الصحيح، ففي الحمل على الإباحة إلغاء الشرط، أي قوله : ﴿إِنْ عَلِمْتُمْ فِيهِمْ خَيْرًا﴾ (النور:۳۳)؛ إذ عقد الكتابة مباحبدونه، أما الندبية فمعلقة به، والمراد بالخير المذكور في قوله تعالى: ﴿إِنْ عَلِمْتُمْ فِيهِمْ خَيْرًا﴾ (النور: ۳۳)؛ على ما قيل: إن لا يضر بالمسلمين بعد العتق، فإن كان يضر بهم، فالأفضل أن لا يكاتبه، وإن كان يصح لو فعل المولى عقد الكتابة.
And the words of Allah, the Mighty and Majestic: And give them a contract of emancipation if you know there is good in them [An-Nur: 33].
1 The statement: “And give them a contract, etc.”: It is stated in Al-Hidayah: This command is not obligatory by consensus among jurists; rather, it is a recommendation, which is the correct view. Interpreting it as permission nullifies the condition, i.e., His saying: if you know there is good in them [An-Nur: 33], because the contract of emancipation is permissible without it. However, the recommendation is tied to it. The meaning of “good” mentioned in His saying: if you know there is good in them [An-Nur: 33], as has been said, is that they will not harm Muslims after emancipation. If they would harm them, it is better not to grant the contract, though it would be valid if the master did so.
وَعَنْ عَبْدِ الرَّحْمَنِ ابْنِ يَزِيدَ الله قَالَ: كَانَ لَنَا غُلَامٌ قَدْ شَهِدَ الْقَادِسِيَّةَ فَأَبْلَى فِيْهَا، وَكَانَ بَيْنِي وَبَيْنَ أَتَيْ وَبَيْنَ أَخِي الْأَسْوَد فَأَرَادُوْا عِتْقَهُ، وَكُنْتُ يَوْمَئِذٍ صَغِيرًا فَذَكَرَ ذَلِكَ الْأَسْوَدُ لِعُمَرَ بْنِ الْخَطَابِ ، فَقَالَ: أَعْتِقُوْا أَنْتُمْ، فَإِذَا بَلَغَ عَبْدُ الرَّحْمَنِ، فَإِنْ رَغِبَ فِيْمَا رَغِبْتُمْ أَعْتَقَ وَإِلَّا فَتَمَنَكُمْ. رَوَاهُ الطَّحَاوِي بِإِسْنَادٍ قَوِيٌّ.
وَفِي الْمُتَّفَقِ عَلَيْهِ عَنْ أَبِي هُرَيْرَةَ لله عَنِ النَّبِيِّ ﷺ قَالَ: «مَنْ أَعْتَقَ شَقِيصًا مِنْ مَمْلُوكِهِ فَعَلَيْهِ خَلَاصُهُ فِي مَالِهِ، فَإِنْ لَمْ يَكُنْ لَهُ مَالُ قُوَّمَ الْمَمْلُوكُ قِيمَةَ عَدْلٍ، ثُمَّ اسْتُسْعِي غَيْرَ مَشْقُوقٍ عَلَيْهِ».
وَرَوَى عَبْدُ الرَّزَّاقِ بِإِسْنَادٍ رِجَالُهُ ثِقَاتُ: أَنَّ رَجُلًا مِنْ بَنِي عُذْرَةَ أَعْتَقَ مَمْلُوْكًا لَهُ عِنْدَ مَوْتِهِ، وَلَيْسَ لَهُ مَالُ غَيْرُهُ، فَأَعْتَقَ رَسُولُ اللهِ وَ ثُلُثَهُ وَأَمَرَهُ أَنْ يَسْعَى فِي الثُّلُثَيْنِ.
Abdul Rahman ibn Yazid (may Allah be pleased with him) narrated: We had a slave who had witnessed the Battle of Qadisiyyah and performed well in it. He was shared between me, my brother Al-Aswad, and Ata. They wanted to emancipate him, but I was young at the time. Al-Aswad mentioned this to Umar ibn Al-Khattab (may Allah be pleased with him), who said: “You emancipate, and when Abdul Rahman reaches maturity, if he desires what you desired, he may emancipate; otherwise, he guarantees you.” [Narrated by At-Tahawi with a strong chain]
In the agreed-upon narration from Abu Hurayrah (may Allah be pleased with him), the Prophet (ﷺ) said: “Whoever emancipates his share of a slave, the rest must be freed with his wealth. If he has no wealth, the slave is valued justly, then made to work without hardship.”
Abdul Razzaq narrated with a chain of trustworthy narrators: A man from Banu Udhrah emancipated a slave at his death, having no other wealth. The Messenger of Allah (ﷺ) emancipated one-third of him and ordered him to work for the remaining two-thirds.
Abu Hanifah said: If a master emancipates part of his slave, that portion is freed, and he works for the remaining value for his master. If the slave is shared between two partners and one emancipates his share, it is freed. If solvent, the partner has the choice: he may emancipate, guarantee the emancipator the value of his share, or make the slave work. If he guarantees, the emancipator reverts to the slave, and patronage is for the emancipator. If he emancipates or makes him work, patronage is shared. If the emancipator is insolvent,.Concurrent Assistant: the partner has the choice: he may emancipate or make the slave work, and patronage is shared in both cases, i.e., emancipation or work. This is based on two principles: one, whether emancipation can be partial or not; two, whether the emancipator’s solvency prevents work. For Abu Hanifah, it does not prevent work; for the two, it does. In summary: emancipation is partial in all cases for Abu Hanifah, not partial in any case for his two companions, and for Shafi‘i, it is partial in some cases but not others. The correct view is the Imam’s, as stated in Qahastani from Al-Mudmarat, and Qasim confirmed its correctness from the authorities of verification, supported in Fath Al-Qadir by meaning and narration, including the hadith in the two Sahihs: “Whoever emancipates his share in a slave, if he has wealth to cover the slave’s value, he is valued justly, gives his partners their shares, and the slave is freed; otherwise, only what was emancipated is freed,” indicating partial emancipation, which supports Abu Hanifah. Nawawi said the hadiths align with Shafi‘i. I say: How, when Shafi‘i took the hadith of guarantee and ignored the hadith of work despite its authenticity? Fairness, in terms of hadith, is what Tahawi said, choosing the view of the two companions. I say: Abu Hanifah’s position is strong in jurisprudence, as emancipation entails the guarantee and work mentioned in the hadiths. Bukhari agreed with Abu Hanifah from start to finish. Among Abu Hanifah’s proofs is this narration of Umar narrated by Tahawi, who said: In this narration, Abdul Rahman, after reaching maturity, could emancipate his share of the slave already partially emancipated by his mother and brother. Abu Hanifah (may Allah be pleased with him) said: Since he could emancipate by paying it without compensation, he could take the slave by paying the value of what remained, so it is freed by paying it. Since the non-emancipator could emancipate his share, the emancipating partner who guaranteed reverts to the guaranteed amount from the slave, so he must make the slave work for the value of what his partner had, and for what his partner could make him work. The hadith of work will be verified later in this chapter. In Arf Ash-Shadhi, it is said: Our Imam Abu Hanifah has two authentic hadiths, one in Abdul Razzaq’s Musannaf and the other in Ahmad’s Musnad, with trustworthy narrators, and one was authenticated by a preserver among preservers. This is gathered from Arf Ash-Shadhi, Al-Hidayah, commentaries of Al-Kanz, Ad-Durr Al-Mukhtar, Radd Al-Muhtar, and Sharh Ma‘ani Al-Athar.

2 The statement: “Then made to work, etc.”: Work, for us, means hiring him out and taking half his value from the wage. Some Shafi‘is said work means he serves his master one day and is free the next, forever. I say: This contradicts “valued justly, etc.,” and we have this hadith, so work is established. Ibn Hazm said thirty Companions confirmed work, and nothing in their narrations contradicts our position; rather, it supports what we say, as it says in a hadith: “If solvent, he is valued, then freed,” and “then” indicates delay, meaning he is freed afterward, either by emancipation or work. Another hadith says: “He gave his partners their shares and freed,” with “and” not negating sequence or delay, so we interpret it for reconciliation. However, the apparent hadith of work supports the two companions that the slave is not made to work for the remaining share if the emancipator is solvent, meaning capable of paying the other’s share value, as the hadith’s wording indicates: “If he has wealth to cover his value.” But its support for them depends on considering the opposite implication, i.e., “If he has no wealth, valued justly, then made to work,” implying no work if he has wealth. You know our three scholars did not accept the opposite implication, so how can they establish their aim with it? This is gathered from Al-Mirqat, Arf Ash-Shadhi, commentaries of Al-Kanz, and Al-Kawkab Ad-Durri.
3 The statement: “Ordered him to work for the two-thirds, so work is established”: The hadith of lots, for us, applies to the early days of Islam before lots were abrogated by the prohibition of gambling, so that ruling was lifted. This is taken from Badhl Al-Majhud. Abu Hanifah said: Each one’s share is freed, and he works for the rest, with his evidence being Abdul Razzaq’s hadith. This is gathered from Al-Mirqat.
۱ قوله: فإذا بلغ عبد الرحمن فإن رغب فيما ارغبتم أعتق وإلا ضمنكم يعني إذا كان العبد مشتركا بين رجلين، فأعتق أحدهما نصيبه، فقال أبو يوسف ومحمد: إن العبد حر يعتق كله، ثم إن كان المعتق موسرًا فيضمن قيمة شريكه، وإن كان معسرا فيستسعى العبد، يعني قالا : ليس له إلا الضمان مع اليسار، والسعاية مع الإعسار، ولا يرجع المعتق على العبد والولاء للمعتق. قال الشافعي: إن المعتق إن كان موسرا فيضمن شريكه، ولا يتجزأ العتق، وإن كان معسرا فيتجزأ العتق، ولا يقول بالاستسعاء، بل يقول: يستخدم منه الشريك الثاني يوما ويدعه يوما إلى الأبد، يعني قول الشافعي الله في الموسر كقولهما. وقال في المعسر : يبقى نصيب الساكت على ملكه، يباع ويوهب.
وقال أبو حنيفة: إذا أعتق المولى بعض عبده عتق ذلك القدر، ويسعى في بقية قيمته لمولاه، يعني إذا كان العبد بين شريكين فأعتق أحدهما نصيبه عتق، فإن كان موسرا فشريكه بالخيار، إن شاء أعتق، وإن شاء ضمن شريكه قيمة نصيبه، وإن شاء استسعى العبد، فإن ضمن رجع المعتق على العبد، والولاء للمعتق، وإن أعتق أو استسعى، فالولاءبينهما، وإن كان المعتق معسرا فالشريك بالخيار، إن شاء أعتق، وإن شاء استسعى العبد، والولاء بينهما في الوجهين أي صورة الإعتاق وصورة الاستسعاء.
هذا مبني على أصلين، أحدهما: تجزؤ الإعتاق وعدمه. والثاني: أن يسار المعتق لا يمنع السعاية عنده، وعندهما يمنع. حاصله: أن العتق يتجزئ عند أبي حنيفة في كل حال، ولا يتجزأ عند صاحبيه في حال. وقال الشافعي: يتجزأ في بعض الأحوال لا في البعض الآخرة، والصحيح قول الإمام، قهستاني» عن «المضمرات وكذا نقل العلامة قاسم تصحيحه عن أئمة التصحيح وأيده في فتح القدير» بالمعنى وبالسمع، ومنه حديث الصحيحين: «من أعتق شركا له في عبد، فكان له مال يبلغ ثمن العبد قوم عليه قيمة عدل، فأعطى شركاءه حصصهم وعتق العبد عليه، وإلا فقد عتق منه ما عتق أفاد تصور عتق البعض فقط، يعني وهو دليل لأبي حنيفة له. وقال النووي: إن وفاق الأحاديث للشافعي أقول: كيف وقد أخذ الشافعي بحديث الضمان وأمهل حديث الاستسعاء مع صحته والإنصاف من حيث الحديث ما قال الطحاوي من أنه اختار مذهب الصاحبين.
وأقول: إن مذهب أبي حنيفة قوي تفقها، فإن الإعتاق لازم الضمان والاستسعاء المذكورين في الأحاديث ووافق البخاري أبا حنيفة من الأول إلى الآخر، ومن مستدلات أبي حنيفة هذا أثر عمر الذي رواه الطحاوي، وقال: ففي هذا الأثر لعبد الرحمن بعد بلوغه أن يعتق نصيبه من العبد الذي قد كان دخله عتاق أمه وأخيه قبل ذلك، فأبو حنيفة الله قال : فلما كان له أن يعتق بأداء ذلك إليه بلا بدل، كان له أن يأخذ العبد بأداء قيمة ما بقي له فيه حتى يعتق بأداء ذلك إليه، ولما كان الذي لم يعتق أن يعتق نصيبه من العبد، فضمن الشريك المعتق رجع إلى هذا المضمن من هذا العبد مثل ما كان للذي ضمنه، فوجب له أن يستسعى العبد في قيمة ما كان لصاحبه فيه، وفيما كان لصاحبه أن يستسعيه فيه، ومنها حديث الاستسعاء سيأتي تحقيقه في هذا الباب بعد. وقال في العرف الشذي»: ولإمامنا أبي حنيفة ه أيضًا حديثان صحيحان، أحدهما في مصنف عبد الرزاق، والثاني في مسند أحمد، ورجاله ثقات، وصحححافظ من الحفاظ أحدهما، التقطته من العرف الشذي» و «الهداية» وشروح «الكنز» و «الدر المختار» و«رد المحتار» و شرح معاني الآثار».
۲ قوله : ثم استسعى إلخ والاستسعاء عندنا أن يؤجره فيأخذ نصف قيمته من الأجرة. وقال بعض الشافعية في الاستسعاء بأن المراد به أن يخدم مولاه يوما ويترك يوما، ويبقى على هذا إلى الأبد، أقول: إن هذا يخالفه «قوم قيمة عدل إلخ، ولنا هذا الحديث فثبت السعاية بذلك. وقال ابن حزم على ثبوت الاستسعاء ثلاثون صحابيا، وليس فيما رووه ما ينافي مذهبنا، بل فيه دليل على ما نقول؛ لأنه له قال في حديث فإن كان موسرا قوم عليه، ثم يعتق، وكلمة ثم للتراخي، فدل على أنه يعتق بعد ذلك إما بعتقه أو بالسعاية. وقال في حديث آخر: أعطى شركاءه حصصهم وعتق عليه بالواو وهي لا تنافي الترتيب ولا التراخي فحملناه عليه توفيقا بين الأحاديث، لكن ظاهر حديث الاستسعاء مؤيد للصاحبين أنه لا يستسعى العبد في نصيبه الباقي إذا كان المعتق موسرا، والمعنى بالموسر ههنا القادر على إيفاء ثمن نصيب الآخر، كما يدلُّ عليه لفظ الحديث، فكان له من المال ما يبلغ ثمنه، لكن تأييده لهما موقوف على اعتبار مفهوم المخالفة، فإن قوله : وإن لم يكن له مال قوم قيمة عدل، ثم يستسعى يثبت باعتبار مفهوم المخالفة أن لا سعاية عليه إذا كان له مال، وأنت تعلم أن أصحابنا الثلاثة لم يُسلموا المفهوم، فكيف لهم إثبات مرامهم به أخذته من المرقاة» و«العرف الشذي» وشروح «الكنز» و «الكوكب الدري».
۳ قوله: وأمره أن يسعى في الثلاثين فثبت السعاية بذلك أيضًا، وحديث الأقراع عندنا محمول على زمان ابتداء الإسلام قبل أن تنسخ القرعة. فلما نسخت القرعة بالنهي عن القمار، ارتفع ذلك الحكم، أخذته من بذل المجهود». وقال أبو حنيفة يعتق من كل واحد قسطه ويسعى في الباقي، وحجته حديث عبد الرزاق، هذا ملتقط من «المرقاة».
وَعَنِ الْحَسَنِ عَنْ ثمرة عَنْ رَسُولِ اللهِ ﷺ قَالَ: «مَنْ مَلَكَ ذَا رَحِمٍ مَحْرَمٍ فَهُوَ حُرَّ». رَوَاهُ التَّرْمِذِيُّ وَأَبُوْ دَاوُدَ وَابْنُ مَاجَه.
وَفِي رِوَايَةٍ لِمُسْلِمٍ عَنْ أَبِي هُرَيْرَةَ * أَنَّ رَسُوْلَ اللهِ ﷺ قَالَ: «لَا يَجْزِي وَلَدٌ وَالِدًا إِلَّا أَنْ يَجِدَهُ مَمْلُوكًا فَيَشْتَرِيَهُ فَيُعْتِقَهُ.
Al-Hasan, from Samurah, narrated that the Messenger of Allah (ﷺ) said: “Whoever owns a close relative who is a mahram, he is free.” [Narrated by Tirmidhi, Abu Dawud, and Ibn Majah]
In Muslim’s narration from Abu Hurayrah (may Allah be pleased with him), the Messenger of Allah (ﷺ) said: “A child does not repay a parent except by finding him enslaved, buying him, and freeing him.”

1 The statement: “Whoever owns a close relative who is a mahram, he is free”: For us, if a man owns a close mahram relative, they are freed upon ownership without initiating emancipation. For Shafi‘i, they are not freed except in parental relations, like parents and children. For Malik, they are freed in sibling relations only. We have this hadith, and similar narrations from Umar and Ibn Mas‘ud, and many Successors. Non-mahram relatives, like cousins, or mahram non-relatives, like those by marriage or nursing, are not freed by consensus. This is taken from commentaries of Al-Kanz.
2 The statement: “And frees him”: Some literalists inferred that a father is not freed upon his child’s ownership, as otherwise, emancipation would not follow purchase. They interpret the “fa” in “frees him” as sequential. The majority hold that he is freed upon ownership without initiating emancipation, and “frees him” means freeing by purchase, not by initiating emancipation. The sequence is in terms of ruling, not initiation. Thus, the “fa” in “frees him” indicates causality, meaning he is freed due to purchase, not requiring “I freed you” after purchase, but freed by the purchase itself. This is gathered from Al-Mirqat.
۱ قوله: من ملك ذا رحم محرم فهو حر : أي عندنا إذا ملك الرجل ذا رحم محرم منه عتق عليه بمجرد التملك من غير أن ينشئ فيه عتقا، وعند الشافعي لا يعتق إلا في قرابة الولاد، مثل الوالدين والمولودين، وعند مالك يعتق فيه، وفي قرابة الأخوة والأخوات فقط، ولنا هذا الحديث، وروى عن عمر وابن مسعود مثله، وعن كثير من التابعين كذلك، ولا يعتق ذو رحم غير محرم كبني الأعمام والأخوان، ولا محرم غير رحم كالمحرمات الصهرية والرضاع إجماعا، أخذته من شروح «الكنز».
۲ قوله فيعتقه قال بعض أهل الظاهر : يستفاد منه أن الأب لا يعتق على ولده إذا تملكه، وإلا لم يصح ترتيب الإعتاق على الشراء، ويجعل الفاء في فيعتقه للتعقيب والجمهور على أنه يعتق بمجرد التملك من غير أن يُنشئ فيه عتقا، وإن قوله: فيعتقه معناه فيعتقه بالشراء لا بإنشاء عتق، والترتيب باعتبار الحكم دون الإنشاء، فعلى هذا الفاء في فيعتقه للسببية، يعني فيعتقه بسبب شرائه، ولا يحتاج إلى قوله: أعتقتك بعد الشراء، بل عتق بنفس الشراء، هذا ملتقط من «المرقاة».
وَعَنِ ابْنِ عُمَرَ (رضي الله عنهما) قَالَ: قَالَ رَسُولُ اللهِ ﷺ: «الْمُدَبَّرُ لَا يُبَاعُ وَلَا يُوهَبُ، وَهُوَ حُلٌّ مِنَ الثُّلُثِ. رَوَاهُ الدَّارَقُطْنِي.
وَاحْتَجَّ بِهَذَا الْحَدِيثِ الْكَرْخِيُّ وَالطَّحَاوِي وَالرَّازِيُّ وَغَيْرُهُمْ وَهُمْ أَسَاطِينُ فِي الْحَدِيثِ.
Ibn Umar (may Allah be pleased with him) narrated: The Messenger of Allah (ﷺ) said: “A slave promised freedom at his master’s death is not sold or gifted, and he is freed from one-third.” [Narrated by Ad-Daraqutni]
Karkhi, Tahawi, Razi, and others, who are pillars in hadith, used this hadith as evidence.
A conditional promised slave differs from these two absolute forms, i.e., emancipation is tied to death with an unlikely condition, e.g., “If I die in this illness, he is free.” If the master dies with that condition, he is freed, like an absolute promised slave, from one-third, as the ruling of promised freedom applies at the last moment of life when that condition is met, making him absolute, so he cannot be sold. If he recovers from that illness and dies, he is not freed, as the condition lapsed.
Scholars differed on whether a promised slave can be sold. Abu Hanifah, Malik, and a group from Kufa said the master cannot sell his promised slave. Shafi‘i said it is permissible to transfer ownership by sale, gift, or otherwise, based on Jabir’s narration that a man promised his slave freedom, then needed money, so the Prophet (ﷺ) took him and said: “Who will buy him from me?” Nu‘aym ibn Abdullah bought him for such-and-such and handed him over. Ahmad said the same, and Ahmad said sale is only permissible if the master has a debt. We have the hadith mentioned in the book. If you say: It is a rare hadith. I say: It is a well-known hadith used by Karkhi, Tahawi, Razi, and other imams as evidence. Tirmidhi narrated Jabir’s hadith, saying: “Some scholars among the Prophet’s Companions and others acted on this hadith, seeing no issue with selling a promised slave,” which is the view of Shafi‘i, Ahmad, and Ishaq. Some scholars among the Companions disliked selling a promised slave, which is the view of Sufyan Ath-Thawri, Malik, and Al-Awza‘i. Abu Al-Walid Al-Baji narrated that Umar (may Allah be pleased with him) prohibited the sale of a promised female slave in the presence of the best generations, a consensus among them that selling a promised slave is not permissible. What Shafi‘i narrated is a specific incident, and a verbal text is not contradicted by an action. Also, a specific incident cannot be used as evidence, as it may involve a conditionally promised slave. Further responses to Jabir’s hadith include: First, Ibn Battal said it is not evidence, as the hadith states the master had a debt, so the sale was for that. Second, it is a specific case open to interpretation, and some Malikis interpreted it as the master having no other wealth, so his action was voided. Third, it may involve selling his service, as hiring is called sale in Yemen’s dialect, as it involves selling service, supported by Ibn Hazm’s narration from Abu Ja‘far Muhammad ibn Ali, mursal from the Prophet (ﷺ), that he sold a promised slave’s service. Fourth, the master who sold the promised slave was foolish, so the Prophet (ﷺ) sold him himself, and selling a promised slave, for those who permit it, does not require the imam’s sale. Fifth, it may have been sold when a free indebted person could be sold, as narrated that he sold a free man for his debt, then abrogated by His saying: And if he is in hardship, then [grant] a respite until ease [Al-Baqarah: 280]. The absolute is divided into two: one, where emancipation is tied to death without specifying time or condition, e.g., “If I die, you are free”; two, tied to death with a condition likely to occur, e.g., “If I die within a hundred years,” when he is eighty, which, though conditional, is effectively absolute, as he likely dies before that, equivalent to “If I die” without a condition. The ruling for an absolute promised slave is that he is not sold, gifted, employed, or hired out; a female promised slave may be married. Upon the master’s death, he is freed from one-third of his wealth, and works for two-thirds of his value if the master is poor with no other wealth, or for his entire value if indebted with a debt consuming all his wealth.
۱ قوله: المدير لا يباع إلخ وعند أئمتنا الحنفية المدبر على نوعين مدير مطلق والنوع الثاني: مدير مقيد، فالمدبر المطلق أيضًا على قسمين، أحدهما : أن يكون العتق مضافا إلى الموت مطلقا من دون أن يقيد بزمان أو بحال، نحو: ما إذا قال لعبده إذا مت فأنت حر، وثانيهما: أن يكون مضافا إلى الموت للقيد بقيد يكون غالب الوقوع نحو قوله: إن مت إلى مائة سنة، وهو ابن ثمانين سنة مثلا، وإن كان في الصورة مقيدا فهو في المعنى مطلق؛ لأن الغالب أن يموت قبل هذه المدة، فقوله: إن مت إلى مائة سنة يكون بمنزلة قوله : إن مت أي بدون ذكر القيد، فيكون في حكم المطلق فحكم المدير المطلق أنه لا يباع، ولا يوهب ويستخدم ويوجر وتوطؤ المديرة وتنكح، وبموت المولى يعتق المدبر من ثلث ماله، ويسعى في ثلثيه أي ثلثي قيمته إن كان المولى فقير، ولم يكن مال غيره، ويسعى في كل قيمته لو كان مديونا بدين مستغرق جميع ماله.
والمدير المقيد ما يكون مخالفا لهاتين الصورتين المذكورتين في المدير المطلق، يعني يعلق العتق بموت مقيد بقيد لا يكون غالب الوقوع، أي يعلق التدبير بموته على صفة، نحو: إن مت في مرضي هذا فهو حر، ثم إن مات المولى على الصفة التي ذكرها عتق، كما يعتق المدير المطلق، يعني من الثلث؛ لأنه يثبت حكم التدبير له في آخر جزء من أجزاء حياته، يتحقق تلك الصفة فيه، فإذ ذاك يصير مدبرا مطلقا لا يجوز بيعه، بل لا يمكن، وإن برئ من ذلك المرض، ثم مات لم يعتق؛ لأن الشرط الذي علق به قد انعدم.
اختلف العلماء هل المدبر يباع أم لا؟ فذهب أبو حنيفة ومالك وجماعة من أهل الكوفة إلى أنه ليس للسيد أن يبيع مديره. وقال الشافعي: يجوز إخراجه عن الملك بالبيع والهبة وغيرها لما روى عن جابر عنه أن رجلا أعتق غلاما له عن دبر منه فاحتاج، فأخذه النبي ، وقال: من يشتريه مني؟ فاشتراه نعيم بن عبد الله بكذا وكذا، فدفعه إليه، وبه قال أحمد، وعن أحمد إنما يجوز بيعه إذا كان على السيد دين، ولنا هذا الحديث الذي ذكر في الكتاب. فإن قلت: هو حديث غريب. قلت: هو حديث مشهور احتج به الكرخي والطحاوي والرازي وغيرهم من الأئمة لذلك؛ لما روى الترمذي حديث جابر قال: والعمل على هذا الحديث عند بعض أهل العلم من أصحاب النبي ، وغيرهم لم يروا بيع المدبر بأسا، وهو قول الشافعي وأحمد وإسحاق، وكره قوم من أهل العلم من أصحاب النبي بيع المدبر، وهو قول سفيان الثوري ومالك والأوزاعي، وروى أبو الوليد الباجي أن عمر الله رد بيع المدبرة في ملأ خير القرون، وهم حضور متوافرون، وهو إجماع منهم أن بيع المدبر لا يجوز، وما رواه الشافعي حكاية حال، فالنص القولي لا يعارضه الفعلي، وأيضًا لا يمكن الاحتجاج بحكاية الحال؛ لأنه يحتمل أن يكون الغلام مدبرا مقيدا.
وأيضًا الجواب عن حديث جابر من وجوه، الأول: قاله ابن بطال لا حجة فيه؛ لأن في الحديث أن سيده كان عليه دين، فثبت أن بيعه كان لذلك. الثاني: أنها قضية عين يحتمل التأويل، وتأوله بعض المالكية على أنه لم يكن له مال غيره، فرد تصرفه. الثالث: أنه يحتمل أنه باع منفعته بأن أجره، والإجارة تسمى بيعا بلغة أهل اليمن؛ لأن فيها بيع المنفعة، ويؤيده ما ذكره ابن حزم، فقال: وروي عن أبي جعفر محمد بن علي عن النبي مرسلا : أنه باع خدمة المدير. الرابع: أن سيد المدير الذي باعه النبي ﷺ كان سفيها، فلهذا تولى النبي ﷺ بيعه بنفسه، وبيع المدير عند من يجوزه لا يفتقر فيه إلى بيع الإمام الخامس : يحتمل أنه باعه في وقت كان يباع الحر المديون، كما روي أنه باع حرا بدينه، ثم نسخ بقوله تعالى: ﴿وَإِن كَانَ ذُو عُسْرَةٍ فَنَظِرَةٌ إِلَى مَيْسَرَةً﴾ (البقرة: ۲۸۰)، التقطته من عمدة القاري» و «عمدة الرعاية» وشرح الوقاية» و«المرقاة» وشروح «الكنز».
وَعَنِ ابْنِ عَبَّاسٍ (رضي الله عنهما)عَنِ النَّبِيِّ ﷺ قَالَ: «إِذَا وَلَدَتْ أَمَةُ الرَّجُلِ مِنْهُ فَهِيَ مُعْتَقَةً عَنْ دُبُرٍ مِنْهُ أَوْ بَعْدَهُ». رَوَاهُ الدَّارِمِيُّ.
وَرَوَى ابْنُ مَاجَهِ وَالدَّارِ قُطْنِيُّ عَنْهُ الله أَنَّهُ قَالَ: ذُكِرَتْ أُمُّ إِبْرَاهِيمَ عِنْدَ رَسُولِ الله ﷺ فَقَالَ: «أَعْتَقَهَا وَلَدُهَا».
Ibn Abbas (may Allah be pleased with him) narrated that the Prophet (ﷺ) said: “If a man’s slave woman bears his child, she is freed at his death or after.” [Narrated by Ad-Darimi]

Ibn Qudamah narrated a consensus of the Companions on this. The narrations from Ali, Ibn Abbas, and Ibn Az-Zubayr permitting it do not undermine this, as their retraction from opposition is narrated, as Ibn Ruslan stated in Sharh As-Sunan. Safinah narrated: I was a slave of Umm Salamah. 2 The statement: “A contracted slave, etc.”: It is stated in At-Takmilah: Discussion of the contract has several aspects: first, its linguistic meaning; second, its legal meaning; third, its pillar; fourth, its condition of validity; fifth, its evidence; sixth, its ruling; seventh, its description; eighth, its reality; ninth, its cause; tenth, its rulings. Linguistically, it derives from “kataba,” meaning to gather or join, and writing is called “kitabah” for joining letters. The contracted slave is the object of “kataba,” and the master is “mukaatib” with a kasra on the ta’. Legally, it is a specific joining, combining the slave’s freedom in wealth with freedom of action immediately. Its pillar is offer and acceptance, linked together. Its condition of validity is the existence of slavery and a known specified amount. Its evidence from the Quran is: “A contracted slave, etc.,” and “Whoever contracts his slave for a hundred ounces, pays it except ten ounces, he is a slave.” Its description is that it is a recommended contract for both the righteous and unrighteous. ۳ قوله : عبد ما بقي عليه من مكاتبته درهم وفي الهداية»: ولا يعتق إلا بأداء كل البدل؛ لقوله : أيهما عبد كوتب على مائة دينار فأداها إلا عشرة دنانير فهو عبد. وقال عليه المكاتب عبد ما بقي عليه درهم، وفيه اختلاف الصحابة ن، وما اخترناه قول زيد الله، يعني لأنه مؤيد بالأحاديث. وقال في نيل الأوطار»: قال أبو حنيفة والشافعي: أنه لا يثبت له شيء من أحكام الأحرار، بل حكمه حكم العبد حتى يستكمل الحرية، وحكاه الحافظ في «الفتح» عن الجمهور، وحكى في البحر» عن عمر وابن عباس وزيد ابن ثابت وعائشة وأم سلمة والحسن البصري وسعيد بن المسيب والزهري والثوري والعترة وأبي حنيفة والشافعي ومالك أن المكاتب لا يعتق حتى يوفي، ولو سلم الأكثر، احتجوا بهذه الأحاديث ورجحوها، وفي ظاهر حديث أم سلمة إذا كان لإحداكن مكاتب، فكان عنده ما يؤدي فلتحتجب منه دليل على أن عبد المرأة محرمها، وبه قال الشافعي، خلافًا لأبي حنيفة. قال قاضي خان: والعبد في النظر إلى مولاته الحرة التي لا قرابة بينه وبينها بمنزلة الرجل الأجنبي، فتأويل حديث أم سلمة بأن المراد منه الاحتجاب عنه حق احتجاب كالكلام معه والنظر إلى الكفين والوجه كما تحتجب من غيره من الأجانب ذكر في «المدارك» في تفسير قوله تعالى: ﴿أَوْ مَا مَلَكَتْ أَيْمَانُهُنَّ﴾ (النور: ۳۱ قال سعيد بن المسيب: لا يغرنكم سورة النور فإنها في الإماء دون الذكور من تحقيقه. كذا في بذل المجهود».
وَعَنْ عَبْدِ الرَّحْمَنِ بْنِ أَبِي عَمْرَةَ الْأَنْصَارِي أَنَّ أُمَّهُ أَرَادَتْ أَنْ تُعْتِقُ، فَأَخَّرَتْ ذَلِكَ إِلَى أَنْ تُصْبِحَ فَمَاتَتْ قَالَ عَبْدُ الرَّحْمَنِ: فَقُلْتُ لِلْقَاسِمِ بْنِ مُحَمَّدٍ: أَيَنْفَعُهَا أَنْ أُعْتِقَ عَنْهَا؟ فَقَالَ الْقَاسِمُ: أَتَى سَعْدُ بْنُ عُبَادَةَ رَسُولَ اللهِ ﷺ فَقَالَ: إِنَّ أُتِي هَلَكَتْ، فَهَلْ يَنْفَعُهَا أَنْ أُعْتِقَ عَنْهَا؟ فَقَالَ رَسُولُ اللهِ ﷺ: «نَعَمْ». رَوَاهُ مَالِكُ.
وَفِي رِوَايَةٍ لَهُ عَنْ يَحْيَى بْنِ سَعِيدٍ قَالَ: تُوُفِّيَ عَبْدُ الرَّحْمَنِ بْنُ أَبِي بَكْرٍ فِي نَوْمٍ نَامَهُ، فَأَعْتَقَتْ عَنْهُ عَائِشَةُ أُخْتُهُ رِقَابًا كَثِيرَةً.
Abdul Rahman ibn Abi Amrah Al-Ansari narrated: His mother intended to emancipate but delayed until morning and died. Abdul Rahman said: I asked Al-Qasim ibn Muhammad: “Will it benefit her if I emancipate on her behalf?” Al-Qasim said: Sa‘d ibn Ubadah came to the Messenger of Allah (ﷺ) and said: “My mother died; will it benefit her if I emancipate on her behalf?” The Messenger of Allah (ﷺ) said: “Yes.” [Narrated by Malik]
In his narration from Yahya ibn Sa‘id, it is said: Abdul Rahman ibn Abi Bakr died in his sleep, and his sister Aisha freed many slaves on his behalf.

1 The statement: “Will it benefit her if I emancipate on her behalf? He said: Yes”: Because emancipation is among the best forms of charity, and all types of charity, as well as financial and physical worship, their reward reaches the deceased, prompting forgiveness and raising their ranks. Narrations and reports confirm this, as detailed by As-Suyuti in Sharh As-Sudur on the states of the dead and graves, and others elsewhere. Among the best reports on emancipation for the deceased is what An-Nasa’i narrated from Wathilah, who said: We were with the Prophet (ﷺ) in the Tabuk expedition and said: “Our companion died.” The Messenger of Allah (ﷺ) said: “Free a slave on his behalf, and Allah will free for every limb of his a limb from him from the Fire.” Thus, in At-Ta‘liq Al-Mumajjad.
2 The statement: “Aisha freed many slaves on his behalf”: Muhammad said in Al-Muwatta: “We adopt this; there is no issue with emancipating for the deceased. If he bequeathed it, patronage is his; if he did not, patronage is for the emancipator, and the reward reaches the deceased.” In At-Ta‘liq Al-Mumajjad, it is said: There is no doubt the reward reaches the deceased if a living person emancipates for him and directs the reward to him, even without a bequest. If the emancipation or charity is obligatory on the deceased and he bequeathed it, the executor must fulfill it from one-third of his estate, and his obligation is cleared. If he did not bequeath and the executor voluntarily fulfills what was obligatory, his obligation is cleared, by Allah’s grace and favor, if He wills.
۱ قوله: فهل ينفعها أن أعتق عنها ؟ فقال رسول الله : نعم : لأن العتق من أفضل أنواع الصدقة، والصدقة بجميع أقسامها، وكذا العبادات المالية والبدنية ثوابها يصل إلى الميت، ويكون باعثاً لمغفرته، ورفع درجاته به، وردت الأخبار وشهدت به الآثار، كما بسطه السيوطي في شرح الصدور في أحوال الموتى والقبور وغيره في غيره وورد في العتق عن الميت آثار من أحسنها ما أخرجه النسائي عن واثلة قال: كنا عند ا النبي في في غزوة تبوك، فقلنا : إن صاحبا لنا قد مات، فقال رسول الله : أعتقوا عنه يعتق الله بكل عضو منها عضوا منه من النار. كذا في التعليق الممجد».
۲ قوله: فأعتقت عنه عائشة رقابا أخته كثيرة وقال محمد في الموطأ»: وبهذا نأخذ لا بأس أن يعتق عن الميت، فإن كان أوصى بذلك كان الولاء له، وإن كان لم يوص كان الولاء لمن أعتق ويلحق الميت الأجر، انتهى. وقال في التعليق الممجد ولا شبهة في وصول الأجر إلى الميت إذا أعتق الحي عنه، وأوصل ثوابه إليه، وإن لم يوص. نعم، إن كان الإعتاق أو شيء من الصدقات واجبًا على الميت، فإن أوصى به يجب على الوصي تنفيذه في ثلث ما تركه، ويحكم ببراءة ذمته عن ذلك الواجب، وإن لم يوص وتبرع الوصي بأداء ما وجب عليه يحكم ببراءة الذمة إن شاء الله تفضلا منه ومنة.
