عَنْ أَنَسٍ(رضي الله عنه) قَالَ: مَا أَوْلَمَ رَسُولِ اللهِ ﷺ عَلَى أَحَدٍ مِنْ نِسَائِهِ مَا أَوْلَمَ عَلَى زَيْنَبَ أَوْلَمَ بِشَاةٍ مُتَّفَقٌ عَلَيْهِ.

English

Anas (may Allah be pleased with him) narrated: The Messenger of Allah (ﷺ) did not hold a wedding feast for any of his wives as he did for Zaynab, with a sheep. Agreed upon.

1 The statement: “He held a feast with a sheep”: In Rahmat al-Ummah, it is said: The wedding feast is a Sunnah according to the predominant view of Ash-Shafi‘i, and recommended according to the other three. In Al-‘Alamgiriyyah: The wedding feast is a Sunnah with great reward. When a man consummates his marriage, he should invite neighbors, relatives, and friends, slaughter for them, and prepare food for them. The command in the Hadith of Abdul Rahman ibn Awf is understood as recommended, as he was ordered with a sheep, which is unanimously not obligatory, as stated in Bazl al-Majhud. In Rahmat al-Ummah: As for feasts other than weddings, such as circumcision and the like, Abu Hanifah, Malik, and Ash-Shafi‘i say they are recommended. Ahmad says they are not recommended.

۱ قوله: أولم بشاة: قال في رحمة الأمة» وليمة العرس سنة على الراجع من مذهب الشافعي ومستحبة عند الثلاثة، انتهى. وقال في العالمگيرية»: ووليمة العرس سنة، وفيها مثوبة عظيمة، وهي إذا بنى الرجل بامرأته ينبغي أن يدعو الجيران والأقرباء والأصدقاء، ويذبح لهم، ويصنع لهم طعاما اهـ. والأمر في حديث عبد الرحمن بن عوف محمول على الاستحباب؛ لأنه أمر بشاة، وهي غير واجبة اتفاقا. قاله في بذل المجهود». قال في رحمة الأمة»: وأما وليمة غير العرس كالختان ونحوه، قال أبو حنيفة ومالك والشافعي تستحب. وقال أحمد: لا تستحب.

وَعَنْهُ (رضي الله عنه) قَالَ: أَوْلَمَ رَسُولُ اللهِ ﷺ حِينَ بَنَى بِزَيْنَبَ بِنْتِ جَحْشٍ، فَأَشْبَعَ النَّاسَ خُبْرًا وَلَحْمًا. رَوَاهُ الْبُخَارِيُّ.

English

Anas (may Allah be pleased with him) narrated: The Messenger of Allah (ﷺ) held a feast when he consummated his marriage with Zaynab bint Jahsh, satisfying people with bread and meat. Narrated by Bukhari.

وَعَنْهُ (رضي الله عنه)، قَالَ : أَقَامَ النَّبِيُّ ﷺ بَيْنَ خَيْبَرَ وَالْمَدِينَةِ ثَلَاثَ لَيَالٍ يُبْنَى عَلَيْهِ بِصَفِيَّةَ، فَدَعَوْتُ الْمُسْلِمِينَ إِلَى وَلِيمَتِهِ، وَمَا كَانَ فِيهَا مِنْ خُبْرٍ وَلَا لَحْمٍ، وَمَا كَانَ فِيهَا إِلَّا أَنْ أَمَرَ بِلَالًا بِالْأَنْطَاعِ فَبُسِطَتْ، فَأَلْقَى عَلَيْهَا التَّمْرَ وَالْأَقِطَ وَالسَّمْنَ. رَوَاهُ الْبُخَارِيُّ.

وَرَوَى الْبَيْهَقِيُّ عَنْ رَزِينَةٍ قَالَتْ: لَمَّا كَانَ يَوْمُ قُرَيْظَةَ وَالنَّضِيْرِ جَاءَ رَسُولُ اللَّهِ ﷺ بِصَفِيَّةَ يَقُوْدُهَا سَبِيَّةً حَتَّى فَتَحَ اللهُ عَلَيْهِ وَذِرَاعُهَا فِي يَدِهِ، فَأَعْتَقَهَا وَخَطَبَهَا وَتَزَوَّجَهَا، وَأَمْهَرَهَا رَزِينَةً.

وَرَوَى الطَّحَاوِيُّ عَنِ ابْنِ عُمَرَ عَنِ النَّبِيِّ ﷺ أَنَّهُ فَعَلَ فِي جُوَيْرِيَةَ بِنْتِ الْحَارِثِ مَثْلَ مَا فَعَلَهُ فِي صَفِيَّةَ، ثُمَّ قَالَ ابْنُ عُمَرَ بَعْدَ النَّبِيِّ ﷺ فِي مِثْلِ هَذَا الْحُكْمِ إِنَّهُ يُجَدِّدُ لَهَا صَدَاقًا.

وَعَنْ أَنَسٍ أَنَّ النَّبِيَّ ﷺ أَوْلَمَ عَلَى صَفِيَّةَ بِسَوِيْقٍ وَتَمْرٍ. رَوَاهُ أَحْمَدُ وَالتَّرْمِذِيُّ وَأَبُوْ دَاوُدَ وَابْنُ مَاجَه.

English

Anas (may Allah be pleased with him) narrated: The Prophet (ﷺ) stayed between Khaybar and Medina for three nights to consummate his marriage with Safiyyah. I invited the Muslims to his feast, which had neither bread nor meat. He ordered Bilal to spread leather mats, and dates, dried cheese, and clarified butter were placed on them. Narrated by Bukhari.

Al-Bayhaqi narrated from Razinah, who said: On the day of Qurayzah and Nadir, the Messenger of Allah (ﷺ) brought Safiyyah as a captive, leading her until Allah granted him victory, with her arm in his hand. He freed her, proposed to her, married her, and gave her Razinah as a dowry.

Al-Tahawi narrated from Ibn Umar, from the Prophet (ﷺ), that he did with Juwayriyah bint al-Harith as he did with Safiyyah. Then Ibn Umar said after the Prophet (ﷺ) regarding such a ruling: He should renew a dowry for her.

Anas narrated that the Prophet (ﷺ) held a feast for Safiyyah with barley meal and dates. Narrated by Ahmad, Tirmidhi, Abu Dawud, and Ibn Majah.

1 The statement: “And gave her as a dowry, etc.”: Meaning, if he frees a slave woman and makes her emancipation her dowry, saying, “I freed you on condition that you marry me for the compensation of emancipation,” and she accepts, the emancipation is valid, and she has the choice to marry him. If she marries him, she is entitled to the dowry of her peers. This is the view of Abu Hanifah, Zufar, and Muhammad. Ash-Shafi‘i and Abu Yusuf, a companion of Abu Hanifah, differed, citing the Hadith: He married Safiyyah and made her emancipation her dowry. We say: The text of Allah’s Book specifies wealth, as after listing the prohibited women, He permitted those beyond them, conditioned on seeking with wealth, as Allah says: “And lawful to you is what is beyond that, that you seek with your wealth” [An-Nisa: 24]. This is supported by Razinah’s Hadith and the narrator’s statement, which is a euphemism for no dowry, meaning he freed her and married her without anything but emancipation. Marriage without a dowry was permissible for the Prophet (ﷺ), not others. At most, the narrator’s wording is ambiguous, so it should be interpreted to avoid conflict with the Book. If she refuses to marry him, we compel her with her value. In essence, this is specific to the Prophet (ﷺ), and others cannot do so, supported by Ibn Umar’s statement in the text. This is the essence of Al-Marqah and Umdat al-Qari.

۱ قوله: وأمهرها إلخ : يعني إذا أعتق أمة وجعل عتقها صداقها كأن يقول: أعتقتك على أن تزوجني نفسك بعوض العتق فقبلت، صح العتق، وهي بالخيار في تزوجه، فإن تزوجته فلها مهر مثلها، وممن قال بهذا القول أبو حنيفة وزفر ومحمد . وخالفهم في ذلك الشافعي وأبو يوسف صاحب أبي حنيفة لهما الحديث: تزوج صفية، وجعل عتقها صداقها، قلنا: نص كتاب الله تعالى يعين المال؛ فإنه بعد عد المحرمات أحل ما وراءهن مقيدًا بالابتغاء بالمال، قال الله تعالى: ﴿وَأُحِلَّ لَكُم مَّا وَرَاءَ ذَلِكُمْ أَن تَبْتَغُوا بِأَمْوَلِكُمْ ﴾ (النساء: ٢٤) الآية، ويؤيده حديث رزينة وقول الراوي ذلك كناية عن عدم المهر، يعني أعتقها وتزوجها، ولم يكن شيء غير العتق، والتزوج بلا مهر جائز للنبي ﷺ دون غيره، وغاية ما فيه أن ما ذكرناه محتمل لفظ الراوي، فيجب حمله عليه، دفعا للمعارضة بينه وبين الكتاب، وإن أبت أن تتزوجه الزمناها بقيمتها. وحاصله : أنه مخصوص بالنبي ، وليس لغيره أن يفعل ذلك، ومما يؤيده كلام ابن عمر المذكور في الكتاب. هذا حاصل ما في المرقاة» و«عمدة القاري.

وَعَنْ صَفِيَّةَ بِنْتِ شَيْبَةَ (رضي الله عنهما)قَالَتْ: أَوْلَمَ النَّبِيُّ ﷺ عَلَى بَعْضِ نِسَائِهِ بِمُدَّيْنِ مِنْ شَعِيرٍ. رَوَاهُ الْبُخَارِيُّ.

English

Safiyyah bint Shaybah (may Allah be pleased with them) narrated: The Prophet (ﷺ) held a feast for some of his wives with two mudds of barley. Narrated by Bukhari.

وَعَنْ عَبْدِ اللهِ بْنِ عُمَرَ(رضي الله عنهما) أَنَّ رَسُوْلَ اللهِ ﷺ قَالَ: «إِذَا دُعِيَ أَحَدُكُمْ إِلَى الْوَلِيمَةِ فَلْيَأْتِهَا». مُتَّفَقٌ عَلَيْهِ.

وَفِي رِوَايَةٍ لِمُسْلِمٍ: «فَلْيُجِبْ عُرْسًا كَانَ أَوْ نَحْوَهُ».

English

Abdullah ibn Umar (may Allah be pleased with them) narrated that the Messenger of Allah (ﷺ) said: “If one of you is invited to a wedding feast, let him attend.” Agreed upon.

In a narration by Muslim: “Let him respond, whether it is a wedding or similar.”

1 The statement: “Let him attend”: In Al-Hindiyyah, from At-Tamartashi: Scholars differed on responding to an invitation. Some said it is obligatory, not permissible to neglect. The majority said it is a Sunnah, and it is best to respond if it is a wedding feast; otherwise, he has a choice. Responding is better, as it brings joy to a believer’s heart. If he responds, he fulfills his duty whether he eats or not, but eating is better if he is not fasting. In Al-Binayah: Responding to an invitation is a Sunnah, whether a wedding or otherwise. In Al-Ikhtiyar: The wedding feast is an established Sunnah; if he does not respond, he sins, as it is said: Whoever does not respond to the invitation has disobeyed Allah and His Messenger. If he is fasting, he responds and supplicates; if not fasting, he eats and supplicates. If he neither eats nor responds, he sins and is rude, as it mocks the host. He said: If invited to a hoof, I would respond. This implies it is a strongly emphasized Sunnah, unlike others. The commentators of Al-Hidayah stated it is close to obligatory. In Rahmat al-Ummah: Responding is recommended according to the soundest view of Abu Hanifah, obligatory according to the prevalent view of Malik, the more apparent of Ash-Shafi‘i’s two opinions, and one of Ahmad’s two narrations.

وَعَنْ جَابِرٍ(رضي الله عنه) قَالَ: قَالَ رَسُولُ اللهِ ﷺ: «إِذَا دُعِيَ أَحَدُكُمْ إِلَى طَعَامٍ فَلْيُجِبْ، فَإِنْ شَاءَ طَعِمَ وَإِنْ شَاءَ تَرَكَ. رَوَاهُ مُسْلِمٌ.

English

Wa’ilah ibn Al-Asqa’ narrated: I heard the Messenger of Allah (ﷺ) say: "Whoever sells a defective item without disclosing it will remain under Allah’s wrath, and the angels will curse him." [Narrated by Ibn Majah]

وَعَنْ أَبِي هُرَيْرَةَ (رضي الله عنه) قَالَ: قَالَ رَسُوْلُ اللهِ : شَرُّ الطَّعَامِ طَعَامُ الْوَلِيمَةِ يُدْعَى لَهَا الْأَغْنِيَاءُ وَيُتْرَكُ الْفُقَرَاءُ، وَمَنْ تَرَكَ الدَّعْوَةَ فَقَدْ عَصَى اللَّهَ وَرَسُولَهُ مُتَّفَقٌ عَلَيْهِ.

English

Abu Hurayrah (may Allah be pleased with him) narrated: The Messenger of Allah (ﷺ) said: “The worst food is that of a wedding feast to which the rich are invited and the poor are excluded. Whoever neglects the invitation has disobeyed Allah and His Messenger.” Agreed upon.

وَعَنْ عَبْدِ اللهِ بْنِ عُمَرَ (رضي الله عنهما)، قَالَ: قَالَ رَسُوْلُ اللَّهِ ﷺ: «مَنْ دُعِيَ فَلَمْ يُجِبْ فَقَدْ عَصَى اللَّهَ وَرَسُولَهُ، وَمَنْ دَخَلَ عَلَى غَيْرِ دَعْوَةٍ دَخَلَ سَارِقًا وَخَرَجَ مُغِيرًا». رَوَاهُ أَبُو دَاوُدَ.

English

Abdullah ibn Umar (may Allah be pleased with them) narrated: The Messenger of Allah (ﷺ) said: “Whoever is invited and does not respond has disobeyed Allah and His Messenger. Whoever enters without an invitation enters as a thief and leaves as a raider.” Narrated by Abu Dawud.

3 The statement: “Whoever is invited, etc.”: In essence, he taught his nation noble morals and forbade base traits. Not responding to an invitation without an excuse indicates arrogance, recklessness, and lack of affection. Entering without an invitation suggests greed, low ambition, and humiliation. Noble character is moderation between these blameworthy traits, as in Al-Marqah.

۳ قوله: من دعي إلخ والحاصل أنه علم أمته مكارم الأخلاق البهية، ونهاهم عن الشمائل الدنية؛ فإن عدم إجابة الدعوة من غير حصول المعذرة يدلُّ على تكبر النفس والرعونة وعدم الألفة والمودة، والدخول من غير دعوة يشير إلى حرص النفس ودناءة الهمة وحصول المذلة والمهانة، فالخلق الحسن هو

وَعَنْ أَبِي مَسْعُودٍ (رضي الله عنه) الْأَنْصَارِي (رضي الله عنه) قَالَ: كَانَ رَجُلٌ مِنَ الْأَنْصَارِ يُكْنَى أَبَا شُعَيْبٍ وَكَانَ لَهُ غُلَامٌ لَحَامُ فَأَتَى النَّبِيَّ اللهِ وَهُوَ فِي أَصْحَابِهِ، فَعَرَفَ الْجُوعَ فِي وَجْهِ النَّبِيِّ ، فَذَهَبَ إِلَى غُلَامِهِ اللَّحَامِ فَقَالَ: اصْنَعْ لِي طَعَامًا يَكْفِي خَمْسَةً لَعَلِّي أَدْعُو النَّبِيَّ خَامِسَ خَمْسَةٍ، فَصَنَعَ لَهُ طُعَيَّمًا، ثُمَّ أَتَاهُ فَدَعَاهُ ، فَتَبِعَهُمْ رَجُلٌ، فَقَالَ النَّبِيُّ : يَا أَبَا شُعَيْبٍ، إِنَّ رَجُلًا تَبِعَنَا ، فَإِنْ شِئْتَ أَذِنْتَ لَهُ وَإِنْ شِئْتَ تَرَكْتَهُ، قَالَ: لَا ، بَلْ أَذِنْتُ لَهُ ) مُتَّفَقٌ عَلَيْهِ.

English

Abu Mas‘ud al-Ansari (may Allah be pleased with him) narrated: A man from the Ansar, nicknamed Abu Shu‘ayb, had a butcher slave. He came to the Prophet (ﷺ) among his companions and recognized hunger on the Prophet’s face. He went to his butcher slave and said, “Prepare food for five, so I may invite the Prophet as the fifth of five.” He prepared a small meal, then invited him. A man followed them, and the Prophet (ﷺ) said, “O Abu Shu‘ayb, a man has followed us. If you wish, permit him; if you wish, leave him.” He said, “No, I permit him.” Agreed upon.

وَعَنْ سَفِينَةَ (رضي الله عنه) أَنَّ رَجُلًا أَضَافَ عَلِيَّ بْنَ أَبِي طَالِبٍ، فَصَنَعَ لَهُ طَعَامًا، فَقَالَتْ فَاطِمَةُ: لَوْ دَعَوْنَا رَسُوْلَ اللهِ ﷺ فَأَكَلَ مَعَنَا، فَدَعَوْهُ فَجَاءَ فَوَضَعَ يَدَهُ عَلَى عِضَادَتَيْ الْبَابِ فَرَأَى قِرَامًا فِي نَاحِيَةِ الْبَيْتِ فَرَجَعَ قَالَتْ فَاطِمَةُ: فَتَبِعْتُهُ، فَقُلْتُ: يَا رَسُولَ اللَّهِ، مَا رَدَّكَ؟ قَالَ: «إِنَّهُ لَيْسَ لِي أَوْ لِنَبِيَّ أَنْ يَدْخُلَ بَيْتًا مُزَوَّقًا». رَوَاهُ أَحْمَدُ وَابْنُ مَاجَه.

English

Safinah (may Allah be pleased with him) narrated: A man hosted Ali ibn Abi Talib and prepared food for him. Fatimah said, “If only we invited the Messenger of Allah (ﷺ) to eat with us.” They invited him, and he came, placing his hand on the doorposts. He saw a decorated curtain in a corner of the house and returned. Fatimah followed him and said, “O Messenger of Allah, what turned you back?” He said, “It is not for me or a prophet to enter a decorated house.” Narrated by Ahmad and Ibn Majah.

1 The statement: “He saw a decorated curtain in a corner of the house”: Al-Khattabi, followed by Ibn al-Malik, said it was ornamented and patterned. Others said it was not patterned but set up like a bride’s canopy, covering the wall, which is reckless and resembles the actions of tyrants. It indicates not responding to an invitation with a prohibition, as in Al-Marqah. In Al-‘Alamgiriyyah, Faqih Abu Ja‘far (may Allah have mercy on him) said in Sharh as-Siyar al-Kabir: There is no harm in covering house walls with patterned felts if the intent is to ward off cold. If the intent is decoration, it is disliked. Shams al-A’immah as-Sarakhsi said in Sharh as-Siyar: There is no harm in covering walls with felts to ward off cold, or with straw to ward off heat. What is disliked is that done for decoration, as in Az-Zakhirah. In essence, what is done for arrogance is disliked; if for need or necessity, it is not, which is the chosen view, as in Al-Ghayathiyyah. 2 The statement: “He returned, etc.”: In Ad-Durr al-Mukhtar: If invited to a feast where there is playing or singing, he may sit and eat. If the prohibition is in the house but not at the table, he should not sit but leave discreetly, per His saying: “Do not sit after the reminder with the wrongdoing people” [Al-An‘am: 68]. If he can prevent it, he should; if not, he endures if not a role model. If a role model and unable to prevent, he leaves and does not sit, as it tarnishes religion. What is narrated about the Imam was before he became a role model. ۲ قوله: فرجع إلخ وقال في الدر المختار دعى إلى وليمة وثم لعب أو غناء قعد وأكل أو المنكر في المنزل فلو على المائدة لا ينبغي أن يقعد بل يخرج معرضا لقوله تعال: فلا تقعد بعد الذكرى مع القوم الظالمين فإن قدر على المنع فعل وإلا يقدر صبر إن لم يكن ممن يقتدى به، فإن كان مقتديا ولم يقدر على المنع خرج ولم يقعد؛ لأن فيه شين الدين. والمحكي عن الإمام كان قبل أن يصير مقتديا به، وإن علم أولا باللعب لا يحضر أصلا، سواء كان ممن يقتدى به أو لا؛ لأن حق الدعوة إنما يلزمه بعد الحضور لا قبله، ابن كمال، انتهى.

وَعَنْ رَجُلٍ مِنْ أَصْحَابِ رَسُوْلِ اللهِ : أَنَّ رَسُولَ اللَّهِ ﷺ قَالَ: «إِذَا اجْتَمَعَ الدَّاعِيَانِ فَأَجِبْ أَقْرَبَهُمَا بَابًا، فَإِنَّ أَقْرَبَهُمَا بَابًا أَقْرَبُهُمَا جِوَارًا، وَإِنْ سَبَقَ أَحَدُهُمَا فَأَجِبْ الَّذِي سَبَقَ رَوَاهُ أَحْمَدُ وَأَبُوْ دَاوُدَ.

English

A man from the companions of the Messenger of Allah (ﷺ) narrated: The Messenger of Allah (ﷺ) said: “If two inviters coincide, respond to the one closest in door, as the closest in door is the closest in neighborliness. If one precedes, respond to the one who preceded.” Narrated by Ahmad and Abu Dawud.

وَعَنِ ابْنِ مَسْعُودٍ (رضي الله عنه) قَالَ: قَالَ رَسُولُ اللهِ : طَعَامُ أَوَّلِ يَوْمٍ حَقٌّ، وَطَعَامُ يَوْمِ الثَّانِي سُنَّةٌ، وَطَعَامُ يَوْمِ الثَّالِثِ سُمْعَةُ، وَمَنْ سَمَّعَ سَمَّعَ اللَّهُ بِهِ». رَوَاهُ التَّرْمِذِيُّ.

وَقَالَ فِي بَذْلِ الْمَجْهُودِ: هَذَا لِأَنَّ الْعَادَةَ كَانَتْ فِيْهِمْ كَذَلِكَ.

English

Ibn Mas‘ud (may Allah be pleased with him) narrated: The Messenger of Allah (ﷺ) said: “The food of the first day is a duty, the food of the second day is a Sunnah, and the food of the third day is for show. Whoever seeks fame, Allah will expose him.” Narrated by Tirmidhi.

In Bazl al-Majhud, it is said: This is because that was their custom.

1 The statement: “The food of the third day is for show, etc.”: The Shafi‘is and Hanbalis acted on its apparent meaning. Al-Tayyibi said: When Allah grants a servant a blessing, it is his right to express gratitude, and it is recommended on the second day to compensate for any shortfall on the first, as the Sunnah completes the duty. The third day is only for show and fame. The invited must respond on the first day, it is recommended on the second, and disliked or prohibited on the third. Malik said the feast is recommended for seven days. Summarized from Fath al-Bari and Al-Marqah. In Qadikhan: It is permissible without dislike to invite for three days, then the wedding and feast cease, as in Al-‘Alamgiriyyah and Majma‘ al-Barakat. The statement: “The food of the third day is for show” is understood by us as their custom. Eating at an invitation intended for show and fame is disliked, taken from Bazl al-Majhud and Radd al-Muhtar.

وَعَنْ عِكْرَمَةَ عَنِ ابْنِ عَبَّاسٍ (رضي الله عنهما) أَنَّ النَّبِيَّ ﷺ نَهَى عَنْ طَعَامِ الْمُتَبَارِيَيْنِ أَنْ يُؤْكَلَ». رَوَاهُ أَبُو دَاوُدَ.

وَقَالَ مُحْيِي السُّنَّةِ: وَالصَّحِيحُ أَنَّهُ عَنْ عِكْرَمَةَ عَنِ النَّبِيِّ ﷺ مُرْسَلًا.

English

‘Ikrimah narrated from Ibn Abbas (may Allah be pleased with them) that the Prophet (ﷺ) forbade eating the food of those who compete in boasting. Narrated by Abu Dawud.

Muhyi as-Sunnah said: The correct view is that it is from ‘Ikrimah, from the Prophet (ﷺ), as a mursal narration.

English

Abu Hurayrah (may Allah be pleased with him) narrated: The Messenger of Allah (ﷺ) said: “Those who compete in boasting are not to be responded to, nor is their food to be eaten.” Imam Ahmad said: It means those who vie in hospitality for pride or show.

3309: ‘Imran ibn Husayn (may Allah be pleased with him) narrated: The Messenger of Allah (ﷺ) forbade responding to the food of the openly disobedient.

وَعَنْ أَبِي هُرَيْرَةَ (رضي الله عنه)قَالَ: قَالَ النَّبِيُّ ﷺ: «إِذَا دَخَلَ أَحَدُكُمْ عَلَى أَخِيهِ الْمُسْلِمِ فَلْيَأْكُلْ مِنْ طَعَامِهِ وَلَا يَسْأَلُ، وَيَشْرَبُ مِنْ شَرَابِهِ وَلَا يَسْأَلْ». رَوَى الْأَحَادِيثَ الثَّلَاثَةَ الْبَيْهَقِيُّ فِي شُعَبِ الْإِيْمَانِ».

وَقَالَ: هَذَا إِنْ صَحٌ، فَلِأَنَّ الظَّاهِرَ أَنَّ الْمُسْلِمَ لَا يُطْعِمُهُ وَلَا يَسْقِيْهِ إِلَّا مَا هُوَ حَلَالٌ عِنْدَهُ.

English

Abu Hurayrah (may Allah be pleased with him) narrated: The Prophet (ﷺ) said: “If one of you enters upon his Muslim brother, let him eat his food without asking and drink his drink without asking.” Narrated by Al-Bayhaqi in Shu‘ab al-Iman.

He said: If this is authentic, it is because it is apparent that a Muslim would only offer food or drink that is lawful for him.

1 The statement: “Let him eat his food without asking, etc.”: Meaning, one should not respond to an invitation from someone whose wealth is predominantly unlawful unless informed it is lawful. Conversely, he responds unless it is evident to him that it is unlawful, as in At-Tamartashi. If a usurer or earner of unlawful wealth gifts or hosts him, and most of his wealth is unlawful, he does not accept or eat unless informed that the wealth’s source is lawful, inherited, or borrowed. If most of his wealth is lawful, there is no harm in accepting his gift or eating from it, as in Al-Mutlaqat. This is because people’s wealth rarely lacks some unlawful portion, so the predominant is considered, as is eating their food, as in Al-Ikhtiyar Sharh al-Mukhtar, cited from Al-‘Alamgiriyyah.

1 The statement: “If you fear that you will not be just, then one, etc.”: It is understood that justice among wives is obligatory, whether new or old, virgin or previously married, Muslim or from the People of the Book, and it is equal between two free women. Between a free woman and a slave woman married to another, justice is divided in thirds: two-thirds for the free woman, one-third for the slave woman. This justice applies to clothing, maintenance, housing, and staying with them, not to love of the heart, as that is beyond human control, nor to intercourse, as that depends on love of the heart, nor to travel rights, as he may travel with whichever he wishes, though drawing lots is preferred, as stated by the jurists, in Tafsir al-Ahmadiyyah.

2 The statement: “You will never be able to be just, etc.”: An earlier verse in this surah clarified the condition of justice: “If you fear that you will not be just, then one” [An-Nisa: 3]. This verse clarifies that justice is not required in love of the heart but is required in other matters. The verse’s meaning is: You, owners of many wives, will never be able to be just among them, as complete justice without any inclination is impossible. Thus, the Messenger of Allah (ﷺ) was just among his wives in maintenance, clothing, and housing, saying, “O Allah, this is my division in what I control. Do not blame me for what You control and I do not,” meaning love of the heart. He loved Aishah (may Allah be pleased with her) more than all his wives with complete love. Even if you strive to be just among women, “do not incline completely” [An-Nisa: 129], meaning do not combine inclination of action with inclination of the heart. Be just in actions like maintenance, clothing, housing, and staying, even if you cannot control the heart’s love or intercourse, so that action and heart inclination do not combine. If you also abandon just actions, “leaving her” [An-Nisa: 129], the one undesired in action and heart, “as if suspended” [An-Nisa: 129], neither married nor divorced. The Prophet (ﷺ) said: “Whoever has two wives and inclines toward one, he will come on the Day of Judgment with one side tilted.” Thus, justice to the extent possible is obligatory, as in Tafsir al-Ahmadiyyah.

۱قوله: كنت أرعى على قراريط لأهل مكة وفي الحديث دليل على جوا الإجارة على رعي الغنم، ويلحق بها في الجواز غيرها من الحيوانات. قاله في نيل الأوطار». وقال في المرقاة»: وفيه استئجار الأحرار.

1 قوله: فإن خفتم أن لا تعدلوا فواحدة إلخ فعلم من ههنا أن العدل بين الأزواج فرض، سواء كانت جديدة أو قديمة، بكرًا أو ثيبا، مسلمةً أو كتابية، وهو بين الحرتين على سواء. وأما بين الحرة والأمة المنكوحة للغير، فالعدل بينهما أثلاثا، ثلثان للحرة وثلث للأمة، وذلك العدل في الكسوة والنفقة والسكنى والبيتوتة معها، لا في محبة القلب؛ لأن ذلك غير مقدور للبشر، ولا في الجماع؛ لأن ذلك موقوف على محبة القلب، ولا في حق السفر بل ليسافر بأية شاء، ولكن القرعة أحب كذا ذكره الفقهاء. كذا في التفسيرات الأحمدية».

۲ قوله : ولن تستطيعوا إلخ : قد مضت آية في أول هذه السورة في بيان اشتراط العدل، وهي قوله تعالى: ﴿فَإِنْ خِفْتُمْ أَلَّا تَعْدِلُوا فَوَاحِدَةً) (النساء: ۳)، وهذه الآية في بيان أن العدل لا يشترط في محبة القلب ويشترط في غيره؛ إذ مضمون الآية ولن تستطيعوا يا صاحبي الأزواج الكثيرة أن تعدلوا بينهن؛ لأن العدل لا يقع ميل البتة، وهو متعذر، ولذلك كان رسول الله والله يعدل بين أزواجه بالنفقة والكسوة والسكنى. ويقول: اللهم! هذه قسمتي فيما أملك،

ولا تؤاخذ فيما لا أملك، وهو محبة القلب؛ لأن رسو الله احب عائشة له على جميع نسائه محبة كاملة ولو حرصت أن تعدلو بين النساء وبالختم فيه فَلَا تَمِيلُواْ كُلَّ الْمَيْلِ﴾ (النساء: ۱۲۹ : أي لا تجمعوا ميل النعل مع ميل القلب. أي اعدلوا في ميل الفعل كالنفقة والكسوة والسكنى والبيتوتة، وإن لم تقدروا على ميل القلب الذي هو المحبة أو الجماع؛ لئلا يجتمع ميل الفعل مع ميل القلب. إن تركتم ميل الفعل أيضا فَتَذَرُوهَا) (النساء: ١٢٩) أي المرغوب عنها بالفعل والقلب جميعا كَالْمُعَلَّقَةٌ) (النساء : ۱۲۹) التي ليست ذات بعل ولا مطلقة. وقال النبي ﷺ : من كان له امرأتان يميل مع إحداهما جاء يوم القيامة وأحد شقيه مائل. فعلم أن العدل بقدر الإمكان واجب. كذا في التفسيرات الأحمدية».
