وَقَوْلِ اللَّهِ عَزَّ وَجَلَّ: {وَأُحِلَّ۱ لَكُم مَّا وَرَاءَ ذَلِكُمْ أَن تَبْتَغُوا بِأَمْوَالِكُمْ} (النساء: ٢٤ ، وَقَوْلِهِ تَعَالَى: قَدْ۲ عَلِمْنَا مَا فَرَضْنَا عَلَيْهِمْ فِيأَزْوَاجِهِمْ} (الأحزاب: ٥٠) ، وَقَوْلِهِ تَعَالَى: ﴿وَآتَيْتُمْ۳ إِحْدَاهُنَّ قِنْطَارًا} (النساء: ۲۰
۱ قوله : وأحل لكم ما وراء ذلك أن تبتغوا بأموالكم وفي هذه الآية دليل على أن النكاح لا يكون إلا بمهر، وأنه يجب وإن لم يسم، وإن غير المال لا يصلح مهرا، وإن القليل لا يصلح مهرا؛ إذ الحبة لا تعد مالا ، هكذا في «المدارك».
۲ قوله: قد علمنا ما فرضنا عليهم في أزواجهم فيه رد على الشافعي الله فيما ذهب إليه أن المهر غير مقدر من عند الله تعالى، وإن تقديره إلى رأي الزوج؛ وذلك لأن الله تعالى لما ذكر لفظ الفرض ومعناه التقدير، وأسنده إلى ضمير المتكلم كان معناه ما قدرنا عليهم في حق أزواجهم، والآية في باب المهر، فعلم أن المهر مقدر شرعًا من عند الله تعالى، وهو عشرة دراهم، والزيادة عليه بالغا ما بلغ تبرع، والنقصان عنه ممنوع، لا كما قال الشافعي من أن كل ما يصلح ثمنا في البيع يصلح مهرا في النكاح، قل أو كثر. وتحقيقه أن الفرض لغة القطع، ويستعمل تارة بمعنى الإيجاب، وتارة بمعنى التقدير، وقد غلب الاستعمال في عرف الشرح على التقدير، فصار كأنه حقيقة عرفية بعد كونه منقولا.
فلهذا جزم فخر الإسلام بأن الفرض لفظ خاص وضع لمعنى خاص، وهو التقدير، وإن لفظ الكناية أيضًا لفظ خاص وضع لمعنى معلوم، وهو المتكلم، فعلم أن صاحب الشرع هو المتولي للإيجاب والتقدير، وإن تقدير العبد امتثال به، وقد يقال: إن قدر المفروض لم يعلم من الآية، فيكون مجملا لا خاصا، وأجيب بأن الفرض خاص والمفروض مجمل، فقد بينه بقوله : لا مهر أقل من عشرة دراهم. كذا في التفسيرات الأحمدية». حاصله: أن ذلك المعين مجمل فيلتحق بيانا بخبر الواحد. قال العيني وأيضًا قال الشافعي: إن المهر حقها، فيكون التقدير إليها، ولنا أنه حق الشرع وجوبا فيقدر بماله حظ في الشرع، وهو نصاب السرقة، وإنما قلنا: إنه مقدر شرعًا لقوله تعالى: ﴿قد عَلِمْنَا مَا فَرَضْنَا عَلَيْهِمْ فِي أَزْوَاجِهِمْ ﴾ (الأحزاب: ٥٠).
۳ قوله: وآتيتم إحداهن قنطارا فيه دليل على أن المهر يصلح بالغا ما بلغ ؛ لأن معناه مالا عظيما، كما روي أنه قال عمر على المنبر: لا تغالوا بصدقات النساء فقالت له امرأة: أنتبع قولك أم قول الله: ﴿وَعَاتَيْتُمْ إِحْدَتْهُنَّ قِنطَارًا (النساء: ۲۰). فقال عمر : كل واحد أعلم من عمر، تزوجوا على ما شئتم . قاله في التفسيرات الأحمدية».
And the saying of Allah, the Mighty and Majestic: "And lawful for you 1 is whatever lies beyond these, that you seek them with your wealth" (An-Nisa: 24); and His saying, the Exalted: "We certainly know 2 what We have made obligatory upon them concerning their wives" (Al-Ahzab: 50); and His saying, the Exalted: "And you have given 3 one of them a heap of gold" (An-Nisa: 20).
1 His saying "and lawful for you is whatever lies beyond these, that you seek them with your wealth": in this verse is a proof that marriage takes place only with a dower; that it is obligatory even if none is named; that what is not property is not fit to be a dower; and that a trifling amount is not fit to be a dower, since a single grain does not count as property. Thus in al-Madarik.
2 His saying "We certainly know what We have made obligatory upon them concerning their wives": in it is a refutation of al-Shafi'i in his view that the dower is not fixed in amount from Allah Most High and that its estimation is left to the husband's judgement. For when Allah Most High used the word "fard", whose meaning is fixing an amount, and attached it to the first-person pronoun, its meaning became "what We have fixed for them in respect of their wives"; and the verse concerns the dower. So it is known that the dower has an amount fixed in the Law from Allah Most High, namely ten dirhams; whatever exceeds it, however much, is a voluntary addition, and falling short of it is barred. It is not as al-Shafi'i said, that whatever may serve as a price in a sale may serve as a dower in marriage, little or much. Its verification: "fard" in the language means cutting off, and it is used sometimes in the sense of making obligatory and sometimes in the sense of fixing an amount; in the usage of the Law the latter has prevailed, as if it had become a customary literal sense. For this reason Fakhr al-Islam held decisively that "fard" is a specific word set down for a specific meaning, namely fixing an amount, and that the first-person pronoun too is a specific word set down for a known meaning, the Speaker; so it is known that the Lawgiver Himself undertakes the obligating and the fixing, and the servant's estimation is compliance with it. It may be said: the amount of what was fixed is not known from the verse, so it is general, not specific; and it is answered that the fixing is specific while the thing fixed is left general, and he made it plain by his saying: "no dower is less than ten dirhams". So it is in al-Tafsirat al-Ahmadiyya. Its upshot: that unspecified amount is clarified by a solitary report. Al-Ayni said: al-Shafi'i also said that the dower is her right, so its estimation belongs to her; but for us it is a right of the Law in its obligation, so it is estimated by property that carries weight in the Law, namely the minimum amount for the hadd of theft. We say it is fixed in the Law because of His saying, the Exalted: "We certainly know what We have made obligatory upon them concerning their wives" (Al-Ahzab: 50).
3 His saying "and you have given one of them a heap of gold": in it is a proof that the dower may validly reach any amount, for its meaning is immense wealth; as it is related that Umar said on the pulpit: "Do not be excessive in the dowers of women", whereupon a woman said to him: "Shall we follow your word or the word of Allah: 'and you have given one of them a heap of gold' (An-Nisa: 20)?" Umar said: "Everyone is more knowing than Umar; marry on whatever terms you wish." He said it in al-Tafsirat al-Ahmadiyya.
عن جَابِرِ بْن عَبْدِ اللهِ (رضي الله عنه) قَالَ: قَالَ رَسُوْلُ اللهِ ﷺ: «وَلَا مَهْرَ۱ أَقَلُّ مِنْ عَشْرَةِ مِنَ الْحَدِيثِ الطَّوِيلِ. رَوَاهُ ابْنُ أَبِي حَاتِمٍ.
وَقَالَ الْحَافِظُ ابْنُ حَجَرٍ: إِنَّهُ بِهَذَا الْإِسْنَادِ حَسَنٌ كَمَا فِي «فَتْحِ الْقَدِيرِ» فِي بَابِ الْكَفَاءَةِ». وَرَوَى الدَّارَقُطْنِيُّ وَالْبَيْهَقِيُّ فِي سُنَنِهِمَا عَنْهُ قَالَ: قَالَ رَسُوْلُ اللَّهِ ﷺ: «وَلَا مَهْرَ دُوْنَ عَشْرَةِ دَرَاهِمَ».
وَفِي رِوَايَةٍ لَهُمَا عَنْ عَلِيٍّ(رضي الله عنه) مَوْقُوْفًا ۲ وَلَا يَكُوْنُ الْمَهْرُ أَقَلَّ مِنْ عَشْرَةِ دَرَاهِمَ. وَرَوَى سَعِيدُ بْنُ مَنْصُورٍ فِي سُنَنِهِ عَنْ أَبِي النُّعْمَانِ الْأَزْدِيِّ قَالَ: زَوَّجَ۳ رَسُولُ اللَّهِ ﷺ امْرَأَةً عَلَى سُورَةٍ مِنَ الْقُرْآنِ، ثُمَّ قَالَ: «لَا يَكُونُ لِأَحَدٍ بَعْدَكَ مَهْرًا».
وَفِي رِوَايَةٍ لِأَبِي دَاوُدَ عَنْ مَكْحُوْلٍ: أَنَّهُ كَانَ يَقُوْلُ: لَيْسَ ذَلِكَ لِأَحَدٍ بَعْدَ رَسُولِ اللَّهِ ﷺ.
Jabir ibn Abdullah (may Allah be pleased with him) narrated: The Messenger of Allah (ﷺ) said, “There is no dowry 1 less than ten [dirhams],” in a long Hadith. Narrated by Ibn Abi Hatim.
Al-Hafiz Ibn Hajar said: With this chain, it is good, as in Fath al-Qadir in the chapter on compatibility. Ad-Daraqutni and Al-Bayhaqi narrated in their Sunan from him that the Messenger of Allah (ﷺ) said, “There is no dowry less than ten dirhams.”
In another narration by them from Ali (may Allah be pleased with him), stopped 2: “The dowry shall not be less than ten dirhams.” Sa‘id ibn Mansur narrated in his Sunan from Abu an-Nu‘man al-Azdi, who said: The Messenger of Allah (ﷺ) married a woman for a chapter of the Qur’an 3, then said, “It shall not be a dowry for anyone after you.”
In a narration by Abu Dawud from Makhul, he said, “That is not for anyone after the Messenger of Allah (ﷺ).”

1 The statement: “There is no dowry less than ten”: Thus, in Sharh al-Wiqayah, it is said: The minimum is ten dirhams, according to us. For Ash-Shafi‘i, anything valid as a price is valid as a dowry, whether ten dirhams, less, or more. In Umdat ar-Ri‘ayah, it means anything that can be a price in transactions, even a dirham or less, is valid as a dowry, so there is no minimum limit except its validity as compensation, and there is no maximum limit by consensus. In Ad-Durr al-Mukhtar: The minimum is ten dirhams, due to Al-Bayhaqi’s Hadith and others: No dowry less than ten dirhams. Narrations allowing less are interpreted as the prompt portion. In Radd al-Muhtar: Meaning, what the Hadiths apparently indicate as permissible for less than ten is all weak except the Hadith: “Seek, even if a ring of iron,” which must be interpreted as the prompt portion, as it was their custom to give part of the dowry before consummation as recommended. The rest is deferred. We say: It does not indicate that the Qur’an was made the dowry, as he did not stipulate teaching her. ۳ قوله: زوج رسول الله الله امرأة على سورة من القرآن إلخ يعني لو تزوج امرأة على أنه علمها القرآن، فالعقد صحيح، وعندنا لها مهر مثلها. قال الشافعي: لها تعليم القرآن، كما في حديث سهل بن سعد الساعدي له هل معك شيء من القرآن ؟ قال: نعم، فقال : قد ملكتكها بما معك من القرآن. رواه أبو داود. قلنا: ليس فيه دلالة على أن القرآن جعله مهرا، ولهذا لم يشترط أن يعلمنها، وإنما معناه ببركة ما معك أو لأجل أنك من أهل القرآن، فكان كتزوج أبي طلحة علي إسلامه، وهو لا يصلح صداقا للبضع أي وقع النكاح بصداقها، ووهتبته إياه بسبب إسلامه على مقتضى وعدها، فصار الإسلام سببا لاستقاقه لها كالمهر، لا أنه المهر حقيقة؛ لأن الإسلام منفعة دينية، والمنفعة الدينية ما لا يكون فيه النفعة الدنيوية مع أنه مخالف لقوله تعالى: ﴿وَأُحِلَّ لَكُم مَّا وَرَاءَ ذَلِكُمْ أَن تَبْتَغُوا بِأَمْوَلِكُمْ﴾ (النساء: ٢٤) وبالإجماع لا يطلق على المنفعة الدينية اسم المال، هذا حاصل ما قال العيني وعلي القاري (رحممها الله).

وَعَنْ أَبِي سَلَمَةَ (رضي الله عنه)، قَالَ : سَأَلْتُ عَائِشَةَ كَمْ كَانَ صَدَاقُ النَّبِيِّ ﷺ قَالَتْ: كَانَ صَدَاقُهُ لِأَزْوَاجِهِ ثِنْتَيْ۱ عَشْرَةَ أُوقِيَّةً وَنَشًّا، قَالَتْ: أَتَدْرِي مَا النَّشُّ؟ قَالَ: قُلْتُ: لَا ، قَالَتْ: نِصْفُ أُوقِيَّةٍ، فَتِلْكَ خَمْسُ مِائَةِ دِرْهَم. رَوَاهُ مُسْلِمٌ.
وَنَشٌّ بِالرَّفْعِ فِي شَرْحِ السُّنَّةِ» وَفِي جَمِيعِ الْأُصُولِ.
وَرَوَى النَّسَائِيُّ وَأَبُو دَاوُدَ عَنْ أُمَّ حَبِيبَةَ (رضي الله عنها)، أَنَّهَا كَانَتْ تَحْتَ عَبْدِ اللَّهِ بْنِ جَحْشٍ، فَمَاتَ بِأَرْضِ الْبَشَةِ، فَزَوَّجَهَا النَّجَاشِيُّ النَّبِيَّ ﷺ وَأَمْهَرَهَا عَنْهُ أَرْبَعَةَ آلَافٍ، فِي رِوَايَةٍ : أَرْبَعَةَ آلَافٍ دِرْهَمٍ، وَبَعَثَ بِهَا إِلَى رَسُولِ اللهِ ﷺ مَعَ شُرَحْبِيلَ ابْنِ حَسَنَةً.
Abu Salamah (may Allah be pleased with him) narrated: I asked Aishah, “What was the dowry of the Prophet (ﷺ)?” She said, “His dowry for his wives was twelve 1 uqiyyahs and a nash.” She said, “Do you know what a nash is?” I said, “No.” She said, “Half an uqiyyah, so that is five hundred dirhams.” Narrated by Muslim.
“Nash” is in the nominative case in Sharh as-Sunnah and all primary sources.
An-Nasa’i and Abu Dawud narrated from Umm Habibah (may Allah be pleased with her) that she was married to Abdullah ibn Jahsh, who died in the land of Abyssinia. An-Najashi married her to the Prophet (ﷺ) and gave her a dowry on his behalf of four thousand, in one narration: four thousand dirhams, and sent her to the Messenger of Allah (ﷺ) with Shurahbil ibn Hasanah.

Ash-Sha‘bi narrated: Umar ibn al-Khattab (may Allah be pleased with him) gave a sermon, praised Allah and extolled Him, and said, “Do not exaggerate in women’s dowries. If it reaches me that anyone has given more than what the Messenger of Allah (ﷺ) gave or was given to him, I will place the excess in the public treasury.” Then he descended, and a Qurayshi woman confronted him, saying, “O Commander of the Faithful, is the Book of Allah more worthy of being followed, or your words?” He said, “The Book of Allah, so what is it?” She said, “You just forbade people from exaggerating in women’s dowries, but Allah, the Exalted, says in His Book: ‘And if you have given one of them a qintar, do not take anything from it’ [An-Nisa: 20].” Umar said, “Everyone is more knowledgeable than Umar,” twice or thrice, then returned to the pulpit and said to the people, “I forbade you from exaggerating in women’s dowries, but let a man do with his wealth as he pleases.” Narrated by Al-Bayhaqi in his Sunan and Sa‘id ibn Mansur.
وَعَنْ عَلْقَمَةَ عَنِ ابْنِ مَسْعُودٍ (رضي الله عنه) أَنَّهُ سُئِلَ عَنْ رَجُلٍ تَزَوَّجَ امْرَأَةً وَلَمْ يَفْرِضُ لَهَا شَيْئًا وَلَمْ يَدْخُلْ بِهَا حَتَّى مَاتَ. فَقَالَ۱ ابْنُ مَسْعُودٍ: لَهَا مِثْلُ صَدَاقٍ نِسَائِهَا، لَا وَكُسَ وَلَا شَطَطَ، وَعَلَيْهَا الْعِدَّةُ وَلَهَا الْمِيرَاثُ، فَقَامَ مَعْقِلُ بْنُ سِنَانِ الْأَشْجَعِيُّ فَقَالَ: قَضَى رَسُولُ اللهِ ﷺ فِي بِرْوَعَ بِنْتِ وَاشِقٍ امْرَأَةٍ مِنَّا مِثْلَ الَّذِي قَضَيْتَ، فَفَرِحَ بِهَا ابْنُ مَسْعُودٍ. رَوَاهُ التَّرْمِذِيُّ وَأَبُو دَاوُدَ وَالنَّسَائِيُّ وَالدَّارِيُّ، وَصَحْحَهُ التَّرْمِذِيُّ وَحَسَّنَهُ.
Alqamah narrated from Ibn Mas‘ud (may Allah be pleased with him) that he was asked about a man who married a woman without specifying a dowry and died before consummating the marriage. Ibn Mas‘ud said 1, “She is entitled to the dowry of her peers, neither deficient nor excessive, and she must observe the waiting period, and she has inheritance.” Ma‘qil ibn Sinan al-Ashja‘i stood and said, “The Messenger of Allah (ﷺ) ruled in the case of Birwa‘ bint Washiq, a woman from us, as you have ruled.” Ibn Mas‘ud was pleased with it. Narrated by Tirmidhi, Abu Dawud, An-Nasa’i, and Ad-Darimi. Tirmidhi authenticated it and deemed it good.

1 The statement: “Ibn Mas‘ud said, ‘She is entitled to the dowry of her peers, etc.’”: The detail is that if a man marries an adult woman with her consent without a dowry, the marriage is valid, and she can demand a dowry. If he consummates before specifying, she is entitled to the dowry of her peers. If he divorces her before specifying and consummation, she is entitled to a compensatory gift. If one of them dies before consummation and specification, scholars differed on whether she is entitled to a dowry. Some, including Ali, said she has no dowry, as if divorced before consummation and specification. Others said she is entitled to a dowry, as death is like consummation in confirming a specified dowry, so it confirms the dowry of peers if none was specified in the contract. This is Ibn Mas‘ud’s view. Ash-Shafi‘i has two opinions aligning with both, and Abu Hanifah and Ahmad’s school aligns with Ibn Mas‘ud. It is narrated that Ash-Shafi‘i retracted his first opinion in Egypt and adopted the Hadith of Birwa‘ bint Washiq. This is the essence of At-Ta‘liq al-Mumajjad, Al-Marqah, and Tansiq an-Nizam. 2 The statement: “And she must observe the waiting period, and she has inheritance”: Meaning the waiting period for death. In Tansiq an-Nizam, it is said: As for her having inheritance, it is agreed upon, as stated in At-Ta‘liq al-Mumajjad.
۱قوله: فقال ابن مسعود لها مثل صداق نسائها إلخ تفصيله أن من تزوج امرأة بالغة برضاها على غير مهر يصحالنكاح، وللمرأة مطالبته بأن يفرض لها صداقا فإن دخل بها قبل الفرض فلها مهر مثلها، وإن طلقها قبل الفرض والدخول فلها المتعة، وإن مات أحدهما قبل الدخول والفرض، فاختلف أهل العلم في أنها هل تستحق المهر أم لا؟ فذهب جماعة إلى أن لا مهر لها وهو قول علي، كما لو طلقها قبل الدخول والفرض وذهب قوم إلى أن لها المهر؛ لأن الموت كالدخول في تقرير المسمى، فكذلك في تقرير مهر المثل إذا لم يكن في العقد مسمى، وهو قول ابن مسعود. وللشافعي قولان يوافقان قولهما، ومذهب أبي حنيفة وأحمد كقول ابن مسعود، وروي عن الشافعي أنه رجع بمصر عن القول الأول وقال بحديث بروع بنت واشق. هذا حاصل ما في التعليق الممجد» و «المرقاة» و«تنسيق النظام».
