وَقَوْلِ اللهِ عَزَّ وَجَلَّ: فَإِنْ خِفْتُمْ أَلَّا تَعْدِلُوا فَوَاحِدَةً أَوْ مَا مَلَكَتْ أَيْمَانُكُمْ ذَلِكَ أَدْنَى أَلَّا تَعُولُوا ﴾ (النساء: ٣ وَقَوْلِهِ تَعَالَى: ﴿وَلَن تَسْتَطِيعُوا أَن تَعْدِلُوا بَيْنَ النِّسَاءِ وَلَوْ حَرَصْتُمْ فَلَا تَمِيلُوا كُلَّ الْمَيْلِ فَتَذَرُوهَا كَالْمُعَلَّقَةِ (النساء: ۱۲۹
1 قوله: فإن خفتم أن لا تعدلوا فواحدة إلخ فعلم من ههنا أن العدل بين الأزواج فرض، سواء كانت جديدة أو قديمة، بكرًا أو ثيبا، مسلمةً أو كتابية، وهو بين الحرتين على سواء. وأما بين الحرة والأمة المنكوحة للغير، فالعدل بينهما أثلاثا، ثلثان للحرة وثلث للأمة، وذلك العدل في الكسوة والنفقة والسكنى والبيتوتة معها، لا في محبة القلب؛ لأن ذلك غير مقدور للبشر، ولا في الجماع؛ لأن ذلك موقوف على محبة القلب، ولا في حق السفر بل ليسافر بأية شاء، ولكن القرعة أحب كذا ذكره الفقهاء. كذا في التفسيرات الأحمدية».
۲ قوله : ولن تستطيعوا إلخ : قد مضت آية في أول هذه السورة في بيان اشتراط العدل، وهي قوله تعالى: ﴿فَإِنْ خِفْتُمْ أَلَّا تَعْدِلُوا فَوَاحِدَةً) (النساء: ۳)، وهذه الآية في بيان أن العدل لا يشترط في محبة القلب ويشترط في غيره؛ إذ مضمون الآية ولن تستطيعوا يا صاحبي الأزواج الكثيرة أن تعدلوا بينهن؛ لأن العدل لا يقع ميل البتة، وهو متعذر، ولذلك كان رسول الله والله يعدل بين أزواجه بالنفقة والكسوة والسكنى. ويقول: اللهم! هذه قسمتي فيما أملك،
ولا تؤاخذ فيما لا أملك، وهو محبة القلب؛ لأن رسو الله احب عائشة له على جميع نسائه محبة كاملة ولو حرصت أن تعدلو بين النساء وبالختم فيه فَلَا تَمِيلُواْ كُلَّ الْمَيْلِ﴾ (النساء: ۱۲۹ : أي لا تجمعوا ميل النعل مع ميل القلب. أي اعدلوا في ميل الفعل كالنفقة والكسوة والسكنى والبيتوتة، وإن لم تقدروا على ميل القلب الذي هو المحبة أو الجماع؛ لئلا يجتمع ميل الفعل مع ميل القلب. إن تركتم ميل الفعل أيضا فَتَذَرُوهَا) (النساء: ١٢٩) أي المرغوب عنها بالفعل والقلب جميعا كَالْمُعَلَّقَةٌ) (النساء : ۱۲۹) التي ليست ذات بعل ولا مطلقة. وقال النبي ﷺ : من كان له امرأتان يميل مع إحداهما جاء يوم القيامة وأحد شقيه مائل. فعلم أن العدل بقدر الإمكان واجب. كذا في التفسيرات الأحمدية».
And the saying of Allah, the Mighty and Majestic: "But if you fear that you will not be just, then one, or those your right hands possess; that is nearer to your not deviating" (An-Nisa: 3); and His saying, the Exalted: "And you will never be able to be equal between wives, however much you strive; so do not incline wholly to one and leave the other as if suspended" (An-Nisa: 129).
1 His saying "but if you fear that you will not be just, then one", to the end: from here it is known that justice between wives is obligatory, whether a wife is new or old, virgin or previously married, Muslim or of the People of the Book; and between two free wives it is on an equal footing. As between a free wife and a slave-woman married to him with her master's leave, the division between them is in thirds: two thirds for the free wife and one third for the slave. That justice concerns clothing, maintenance, lodging, and spending the night with her; not the love of the heart, for that is not within human power, nor marital relations, for that depends upon the heart's love, nor the right of travel, rather he may travel with whichever he wishes, though drawing lots is preferable, as the jurists have stated. So it is in al-Tafsirat al-Ahmadiyya.
2 His saying "and you will never be able", to the end: a verse has already passed at the opening of this sura stipulating justice, namely His saying, the Exalted: "but if you fear that you will not be just, then one" (An-Nisa: 3). This verse makes plain that justice is not stipulated in the heart's love but is stipulated in what lies outside it, since the purport of "you will never be able" is: O you who have many wives, you will never manage perfect equality between them, for inclination inevitably occurs and it is beyond capacity. For this reason the Messenger of Allah ﷺ used to deal justly between his wives in maintenance, clothing and lodging, and would say: "O Allah, this is my division in what I possess; do not take me to task for what I do not possess", that is, the love of the heart, for the Messenger of Allah ﷺ loved Aisha with a complete love above all his wives. "So do not incline wholly to one" (An-Nisa: 129): that is, do not join the inclination of deed to the inclination of the heart; deal justly in the inclination of deed, such as maintenance, clothing, lodging and spending the night, even if you cannot command the heart's inclination, which is love, or marital relations, lest the inclination of deed combine with the inclination of the heart. If you abandon the inclination of deed as well, "you leave her" (An-Nisa: 129), the one turned away from in deed and heart together, "as if suspended" (An-Nisa: 129), neither having a husband nor divorced. And the Prophet ﷺ said: "Whoever has two wives and inclines toward one of them will come on the Day of Resurrection with one of his sides leaning." So it is known that justice to the extent possible is obligatory. So it is in al-Tafsirat al-Ahmadiyya.
عَنِ ابْنِ عَبَّاسٍ (رضي الله عنهما) أَنَّ رَسُوْلَ اللهِ ﷺ قُبِضَ عَنْ تِسْعِ نِسْوَةٍ، وَكَانَ يَقْسِمُ مِنْهُنَّ لِثَمَانٍ مُتَّفَقٌ عَلَيْهِ.
Ibn Abbas (may Allah be pleased with them) narrated: The Messenger of Allah (ﷺ) passed away leaving nine wives and divided among eight. Agreed upon.

First: If someone says, “I grant you this house for your lifetime, and after your death, it goes to your heirs or descendants,” it is valid without dispute, and the recipient owns the house’s title, as it is a gift. In Radd al-Muhtar: In Al-Khaniyyah, among the duties of husbands toward wives is justice and equality in what he controls, and staying with them for companionship and affection, not in what he does not control, which is love and intercourse.
1 The statement: “If he is intimate with you, you have no choice”: Al-Shawkani said: This is evidence that the choice of an emancipated woman is delayed, and it is nullified if she allows her husband intimacy. This is the view of Malik, Abu Hanifah, and Ahmad, and one opinion of Ash-Shafi‘i. He has another opinion that it is immediate, and in another narration, it lasts three days, or upon rising from the judge’s assembly, or her own assembly. فلهذا جزم فخر الإسلام بأن الفرض لفظ خاص وضع لمعنى خاص، وهو التقدير، وإن لفظ الكناية أيضًا لفظ خاص وضع لمعنى معلوم، وهو المتكلم، فعلم أن صاحب الشرع هو المتولي للإيجاب والتقدير، وإن تقدير العبد امتثال به، وقد يقال: إن قدر المفروض لم يعلم من الآية، فيكون مجملا لا خاصا، وأجيب بأن الفرض خاص والمفروض مجمل، فقد بينه بقوله : لا مهر أقل من عشرة دراهم. كذا في التفسيرات الأحمدية». حاصله: أن ذلك المعين مجمل فيلتحق بيانا بخبر الواحد. قال العيني وأيضًا قال الشافعي: إن المهر حقها، فيكون التقدير إليها، ولنا أنه حق الشرع وجوبا فيقدر بماله حظ في الشرع، وهو نصاب السرقة، وإنما قلنا: إنه مقدر شرعًا لقوله تعالى: ﴿قد عَلِمْنَا مَا فَرَضْنَا عَلَيْهِمْ فِي أَزْوَاجِهِمْ ﴾ (الأحزاب: ٥٠).

وَعَنْهَا (رضي الله عنها) أَنَّ سَوْدَةَ لا لَمَّا كَبِرَتْ قَالَتْ: يَا رَسُولَ اللَّهِ، قَدْ جَعَلْتُ يَوْمِي مِنْكَ لِعَائِشَةَ، فَكَانَ رَسُولُ اللهِ ﷺ يَقْسِمُ لِعَائِشَةَ يَوْمَيْنِ يَوْمَهَا وَيَوْمَ سَوْدَةَ. مُتَّفَقٌ عَلَيْهِ.
Aishah (may Allah be pleased with her) narrated: When Sawdah grew old, she said, “O Messenger of Allah, I have given my day with you to Aishah.” So the Messenger of Allah (ﷺ) divided for Aishah two days: her day and Sawdah’s day. Agreed upon.

1 The statement: “I have given my day with you to Aishah, etc.”: In Al-Hidayah: If one wife agrees to forgo her share for another, it is permissible, per this Hadith. She may retract, as she waived a right not yet due, so it is not forfeited. Ibn al-Humam said: This applies if it is not a bribe from the husband, such as increasing her dowry to do so or marrying her on condition that he marries another and stays with her two days and the addressed one day. Such a condition is void, and the money is unlawful for her in the first case, so he may retract it. If she paid or reduced money for him, it is apparently not binding, unlawful for her, and she may retract her money.
۱ قوله : قد جعلت يومي منك لعائشة إلخ في الهداية»: وإن رضيت إحدى الزوجات بترك قسمها لصاحبتها جاز لهذا الحديث. ولها أن ترجع في ذلك؛ لأنها أسقطت حقا لم يجب بعد فلا يسقط. وقال ابن الهمام: هذا إذا لم يكن برشوة من الزوج بأن زادها في مهرها لتفعل أو تزوجها بشرط أن يتزوج أخرى فيقيم عندها يومين، وعند المخاطبة يوما، فإن الشرط باطل، ولا يحل لها المال في الصورة الأولى فله أن يرجع فيه. وأما إذا دفعت إليه أو حطت عنه مالا فظاهر أنه لا يلزم، ولا يحل لها، ولها أن توجع في مالها.
وَعَنْ عَطَاءٍ قَالَ: حَضَرْنَا مَعَ ابْنِ عَبَّاسٍ جِنَازَةَ مَيْمُوْنَةَ بِسَرِفَ، فَقَالَ: هَذِهِ زَوْجَةُ رَسُوْلِ اللَّهِ ، فَإِذَا رَفَعْتُمْ نَعْشَهَا فَلَا تُزَعْزِعُوهَا وَلَا تُزَلْزِلُوهَا، وَارْفُقُوْا فَإِنَّهُ كَانَ عِنْدَ رَسُوْلِ اللهِﷺ تِسْعُ نِسْوَةٍ كَانَ يَقْسِمُ لِثَمَانِ، وَلَا يَقْسِمُ لِوَاحِدَةٍ. قَالَ عَطَاءُ: الَّتِي كَانَ رَسُولُ اللَّهِ ﷺ لَا يَقْسِمُ لَهَا بَلَغَنَا أَنَّهَا صَفِيَّهُ، وَكَانَتْ آخِرَهُنَّ مَوْتًا مَاتَتْ بِالْمَدِينَةِ. مُتَّفَقٌ عَلَيْهِ.
وَقَالَ رَزِينٌ: قَالَ غَيْرُ عَطَاءٍ: هِيَ سَوْدَةُ ، وَهُوَ أَصَحُ، وَهَبَتْ يَوْمَهَا لِعَائِشَةَ حِيْنَ أَرَادَ رَسُولُ اللهِ ﷺ طَلَاقَهَا ، فَقَالَتْ لَهُ : أَمْسِكْنِي قَدْ وَهَبْتُ يَوْمِي لِعَائِشَةَ، لَعَلِّي أَنْ أَكُوْنَ مِنْ نِسَائِكَ فِي الْجَنَّةِ.
‘Ata’ narrated: We attended Maymunah’s funeral with Ibn Abbas at Sarif. He said, “This is the wife of the Messenger of Allah (ﷺ). When you lift her bier, do not shake or jolt it, but be gentle. The Messenger of Allah (ﷺ) had nine wives, dividing among eight and not dividing for one.” ‘Ata’ said: It reached us that the one he did not divide for was Safiyyah, and she was the last to die, dying in Medina. Agreed upon.
Razin said: Others than ‘Ata’ said it was Sawdah, which is more correct. She gave her day to Aishah when the Messenger of Allah (ﷺ) intended to divorce her. She said, “Keep me; I have given my day to Aishah, hoping to be among your wives in Paradise.”
وَعَنْ عَائِشَةَ (رضي الله عنها) أَنَّ رَسُولَ اللهِ اللهِ كَانَ يَسْأَلُ فِي مَرَضِهِ الَّذِي مَاتَ فِيهِ، يَقُولُ: أَيْنَ أَنَا غَدًا ۚ أَيْنَ أَنَا غَدًا؟ يُرِيدُ يَوْمَ عَائِشَةَ، فَأَذِنَ لَهُ أَزْوَاجُهُ يَكُونُ حَيْثُ شَاءَ، فَكَانَ فِي بَيْتِ عَائِشَةَ حَتَّى مَاتَ عِنْدَهَا. رَوَاهُ الْبُخَارِيُّ.
Aishah (may Allah be pleased with her) narrated: In the illness in which he died, the Messenger of Allah (ﷺ) kept asking, “Where am I tomorrow? Where am I tomorrow?” intending Aishah’s day. His wives permitted him to be where he wished, so he stayed in Aishah’s house until he died there. Narrated by Bukhari.

۲ قوله: ولهن مثل الذي عليهن بالمعروف: إيماء إلى حقوق كل من الزوج والزوجة على الآخر، فحقوق الزوج على الزوجة الخدمة والأدب وترك الاعتراض عليه وامتثال أوامره بالكلية وانقيادها له في كل شيء وترك المنع من الوطء في حالة الحيض والنفاس. وحقوق الزوجة على الزوج النفقة والكسوة وأداء المهر بحسب ما ذكر في الفقه وتعليم الشرائع والأحكام. فالزوج والزوجة وإن كانا مستويين في حق الحقوق، ولكن للرجال عليهن درجة أي زيادة في الحق وفضيلة

وَعَنْهَا (رضي الله عنها) قَالَتْ: كَانَ رَسُولُ اللهِ ﷺ إِذَا أَرَادَ سَفَرًا أَقْرَعَ بَيْنَ نِسَائِهِ، فَأَيَّتُهُنَّ خَرَجَ سَهْمُهَا خَرَجَ بِهَا مَعَهُ. مُتَّفَقٌ عَلَيْهِ.
وَقَالَ الشَّيْخُ ابْنُ الْهُمَامِ : قُلْنَا: ذَلِكَ كَانَ اسْتِحْبَابًا لِتَطْبِيبِ قُلُوْبِهِنَّ، وَهَذَا لِأَنَّ مُطْلَقَ الْفِعْلِ لَا يَقْتَضِي الْوُجُوْبَ.
Aishah (may Allah be pleased with her) narrated: When the Messenger of Allah (ﷺ) intended to travel, he drew lots among his wives, and whichever’s lot came up, he took her with him. Agreed upon.
Shaykh Ibn al-Humam said: We say this was recommended to comfort their hearts, as an absolute action does not necessitate obligation.

1 The statement: “When he intended to travel, he drew lots among his wives, etc.”: Meaning, they have no right to division during travel, so the husband travels with whichever he wishes. It is better to draw lots and travel with the one whose lot is drawn. Ash-Shafi‘i said: Drawing lots is required, meaning obligatory, as it is narrated that the Prophet (ﷺ) drew lots among his wives when intending travel. We say: The drawing of lots in this Hadith is to comfort their hearts, so it is recommended. This is because a wife has no right during her husband’s travel. Does he not have the right to travel without any of them? Likewise, he may travel with one, and that duration is not counted against him, as in Al-Hidayah. In Radd al-Muhtar: There is no division during travel, as it is not feasible unless he takes them all, and requiring that causes evident harm, per An-Nahr. He may trust one for travel and another for residence, or for safeguarding property, or fear fitnah, or one’s excessive weight may prevent travel. Requiring travel with one whose companionship he fears, because her lot came up, imposes severe harm, which is negated by the principle of removing hardship, per Fath. In Al-‘Inayah: They have no right to division during travel. This addresses two issues: First, drawing lots is recommended for us, but required for Ash-Shafi‘i, meaning obligatory. Second, if he travels with one without drawing lots and returns, do the others count that duration? For us, they do not, unlike him. This is based on the first, as if drawing lots is required and he does not do it, the travel duration is the turn of the one with him, so the others should have equivalent turns for justice. We say: Equality is obligatory when division is due, and during travel, it is not, so equality is not required, and that duration is not counted as her turn.
۱ قوله: إذا أراد سفرا أقرع بين نسائه إلخ : أي ولا حق لهن في القسمة حالة السفر فيسافر الزوج بمبن شاء منهن، والأولى أن يقرع بينهن فيسافر بمن خرجت قرعتها. وقال الشافعي: القرعة مستحقة، يعني واجبة؛ لما روي أن النبي كان إذا أراد سفرا أقرع بين نسائه، إلا إنا نقول: إن القرعة في هذا الحديث لتطييب قلوبهن، فيكون من الاستحباب، وهذا؛ لأنه لا حق للمرأة عند مسافرة الزوج، ألا يرى أن له أن لا يستصحب واحدة منهن، فكذا له أن يسافر بواحدة منهن، ولا يحتسب عليه بتلك المدة. قاله في «الهداية».
وقال في رد المحتار: ولا قسم في السفر؛ لأنه لا يتيسر إلا بحملهن معه، وفي إلزامه ذلك من الضرر ما لا يخفى نهر»، ولأنه قد يثق بإحداهما في السفر، وبالأخرى في الحضر، والقرار في المنزل لحفظ الأمتعة أو لخوف الفتنة أو يمنع من سفر إحداهما كثرة سمنها، فتعيين من يخاف صحبتها في السفر؛ للسفر الخروج قرعتها إلزام للضرر الشديد، وهو مندفع بالنافي للحرج، «فتح»، انتهى. وقال في العناية» ولا حق لهن في القسم حالة السفر، هذا الكلام يشتمل على المسألتين، إحداهما: أن القرعة مستحبة عندنا، وعند الشافعي مستحقة، يعني واجبة. والثانية: أنه إذا سافر بواحدة من غير قرعة، ثم رجع هل للباقيات أن يحتسبن تلك المدة أو لا؟ عندنا ليس لهن ذلك خلافا له، وهذه بناء على الأولى؛ لأن الإقراع إذا كان مستحقا ولم يفعله كانت مدة سفره نوبة التي كانت معه، فينبغي أن يكون عند الأخرى مثل ذلك؛ ليتحقق العدل، ولكنا نقول: وجوب التسوية في وقت استحقاق القسم عليه، وفي حالة السفر ليس بمستحق، فلا تجب التسوية، فلا تكون تلك المدة محسوبة من نوبتها.
وَعَنْ أُمَّ سَلَمَةَ (رضي الله عنها)، أَنَّ رَسُوْلَ اللهِ ﷺ قَالَ لَهَا: «إِنْ سَبِّعْتُ عِنْدَكِ وَسَبَّعْتُعِنْدَهُنَّ». رَوَاهُ الصَّحَاوِيُّ.

Umm Salamah (may Allah be pleased with her) narrated: The Messenger of Allah (ﷺ) said to her, “If I stay seven [nights] with you, I will stay seven with them.” Narrated by As-Sahawi.
Ahmad, Al-Bayhaqi, At-Tabarani, and Abu Ya‘la narrated similarly. Ali al-Qari said: We deduce equality between the new and old wife from his saying to Umm Salamah: “If I stay seven with you, I will stay seven with them.” We say: If the three days, which are the right of the previously married, were exclusively hers without sharing, he would have rotated among them four by four, as the three are her right. Since it is seven as mentioned, it is understood that it is the same for three.
In a narration by Muslim, from Abu Bakr ibn Abdul Rahman, when the Messenger of Allah (ﷺ) married Umm Salamah and she stayed with him, he said to her, “There is no dishonor to your family. If you wish, I will stay seven with you and seven with them. If you wish, I will stay three with you and rotate,” meaning with three among the rest.

1 The statement: “I will stay seven with you, etc.”: Based on these Hadiths, our scholars said the new and old wife are equal in division, whether the new is a virgin or previously married. Ash-Shafi‘i said: If she is a virgin, he favors her with seven nights; if previously married, three nights, then equality, citing Abu Hurayrah’s Hadith that the Prophet (ﷺ) said: “Favor the virgin with seven and the previously married with three.” The old wife is accustomed to his companionship and comfortable with him, while the new wife is not, having some shyness and unease, so he should remove that with companionship to equal the old wife in familiarity, then equality follows. A virgin has greater shyness toward men, so she is favored with seven nights. A previously married woman has experienced men but not him specifically, so three nights suffice for her to become familiar with his companionship. Our evidence is that the cause of obligatory equality is their inclusion in his marriage, which is realized by the contract itself. If favoring one were required, the old wife would be more entitled, as her unease is greater, having another brought upon her, which typically angers her. The old wife has greater sanctity due to her service, as it is said: Every new has pleasure, and every old has sanctity. As for the Hadith, it means favoring by starting, not increasing, as in Umm Salamah’s Hadith: “If you wish, I will stay seven with you and seven with them,” and “If you wish, I will stay three with you and rotate,” meaning I will rotate with the same among each of them. We say: The husband may start with the new wife for the pleasure in that, but after equalizing between them, as in Al-Mabsut.
1 The statement: “And live with them in kindness, etc.”: This means to treat women with kindness, such as providing maintenance, speaking gently, and other good conduct. If you dislike them due to their bad character or appearance, be patient with them and do not separate from them, for in what you dislike, there may be much good, such as abundant reward, righteous offspring, or other benefits. The phrase “perhaps you dislike” is placed as the reason for the implied command to be patient, as explained in Tafsir al-Ahmadiyyah. 2 The statement: “And they have rights similar to those against them in a just manner”: This indicates the mutual rights of the husband and wife. The husband’s rights over the wife include her service, respect, refraining from objecting to him, complete obedience to his commands, submission to him in all matters, and not preventing intimacy during menstruation or postpartum. The wife’s rights over the husband include maintenance, clothing, payment of the dowry as specified in fiqh, and teaching her the laws and rulings of the religion. Although the husband and wife are equal in rights, men have a degree over them, meaning an additional right and virtue due to their responsibility for expenditure, authority in marriage, divorce, revocation, inheritance, and similar matters, as in Tafsir al-Ahmadiyyah. 3 The statement: “As for those from whom you fear rebellion”: This refers to their turning away or disobedience. Admonish them by advising them to obey. If advice does not work, forsake them in bed, meaning do not share their blanket, engage in intimacy, or turn your back to them in bed. If forsaking does not work, strike them lightly, without causing harm or injury. If they then obey by ceasing rebellion after admonishment, forsaking, or striking, as clarified in “Then if they obey you” [An-Nisa: 34], do not seek means against them by rebuking or harming them. Instead, remove any blame from them and treat their past actions as if they did not occur, for one who repents from a sin is as one who has no sin. “Indeed, Allah is Exalted, Great” [An-Nisa: 34], meaning He has greater power over you than you have over your wives, as in Tafsir al-Ahmadiyyah.
In Umdat al-Qari, Imam At-Tahawi said: Some said if a man marries a previously married woman, he has the choice to stay seven with her and seven with the others, or three with her and rotate among the rest day by day, night by night. I say: He meant by “some” Ibrahim an-Nakha‘i, ‘Amir ash-Sha‘bi, Malik, Ash-Shafi‘i, Ahmad, Ishaq, Abu Thawr, and Abu ‘Ubayd. He said: Others differed, saying if he stays three with her, three with the others, as if he stays seven with her, seven with the others. I say: He meant by “others” Hammad ibn Abi Sulayman, Al-Hakam ibn ‘Utbah, Abu Hanifah, Abu Yusuf, and Muhammad. They cited Umm Salamah’s Hadith, narrated by At-Tahawi, that the Messenger of Allah (ﷺ) said to her, “If you wish, I will stay seven with you and seven with them,” narrated at length by Ahmad, and longer by At-Tabarani, Abu Ya‘la, and Al-Bayhaqi. At-Tahawi said: When he said to her, “If you wish, I will stay seven with you and seven with them,” meaning I will be just between them and you, giving each seven as I stayed seven with you. Likewise, if he stays three with her, he stays three with each of them. The Shafi‘is said Anas’s Hadith is evidence against the Hanafis. I say: Likewise, Umm Salamah’s Hadith is evidence against the Shafi‘is. The Hanafis also cited Aishah’s Hadith that the Prophet (ﷺ) divided among his wives justly, narrated by the four, recently mentioned, whose apparent meaning requires absolute equality. In Bahr ar-Ra’iq: What is narrated in the Hadith, “For the virgin seven, for the previously married three,” and his saying to Umm Salamah, “If you wish, I will stay seven with you and seven with my wives, or three with you and rotate,” means favoring by starting with the new wife, not increasing. There is no doubt the Hadiths are ambiguous, not definitive, so the definitive evidence and absolute Hadiths take precedence. In Sharh Durar al-Bihar: The Hadith does not negate equality but allows choosing rotation with seven or three, reconciling with what we narrated.
2 The statement: “Meaning with three among the rest”: This is the essence of what Imam At-Tahawi said, meaning “rotate” refers to rotating among the rest with three to achieve equality.

وإذا كانت ثيبا فهي قد صحبت الرجال، وإنما لم تصحبه خاصة فيكفيها ليال لتأنس بصحبته. وحجتنا في ذلك أن سبب وجوب التسوية اجتماعها في نكاحه، وقد تحقق ذلك بنفس العقد، ولو وجب تفضيل إحداهما كانت القديمة أولى بذلك؛ لأن الوحشة في جانبها أكثر حيث أدخل غيرها عليها؛ فإن ذلك يغيظها عادة، ولأن للقديمة زيادة حرمة بسبب الخدمة كما يقال: لكل جديدة لذة ولكل قديم حرمة. وأما الحديث فالمراد التفضيل بالبداية دون الزيادة كما ذكر في حديث أم سلمة ما إن شئت سبعت لك وسبعت لهن، وقوله : إن شئت ثلثت لك ثم درت. أي أدور بمثل ذلك على كل واحدة منهن، ونحن نقول به: إن للزوج أن يبدأ بالجديد لما له في ذلك من اللذة، ولكن بعد أن يسوي بينهما. قاله في المبسوط».
وقال في عمدة القاري: قال الإمام الطحاوي: فذهب قوم إلى أن الرجل إذا تزوج الثيب أنه بالخيار إن شاء سبع لها، وبع لسائر نسائه، وإن شاء أقام عندها ثلاثا، ودار على بقية نسائه يوما يوما وليلة ليلة. قلت: أراد بالقوم إبراهيم النخعي وعامر الشعبي ومالكا والشافعي وأحمد وإسحاق وأبا ثور وأبا عبيد، ثم قال: وخالفهم في ذلك آخرون، فقالوا: إن ثلث لها ثلث لسائر نسائه، كما إذا سبع لها سبع لسائر نسائه. قلت: أراد بالقوم هؤلاء حماد بن أبي سليمان والحكم بن عتبة وأبا حنيفة وأبا يوسف ومحمدًا ، واحتجوا في ذلك بحديث أم سلمة أخرجه الطحاوي أن رسول الله ﷺ قال لها: إن شئت سبعت عندك سبعت عندهن، وأخرجه أحمد في مسنده مطولًا، وأخرجه الطبراني بأطول منه، أخرجه أبو يعلى أيضًا والبيهقي، قال الطحاوي: فلما قال لها رسول : إن شئت سبعت لك سبعت عندهن أي أعدل بينهن وبينك، فأجعل لكل واحدة منهن سبعًا، كما أقمت عندك سبعا، كذلك إذا جعل لها ثلاثا جعل لكل واحدة منهن ثلاثا. وقالت الشافعية حديث أنس المذكور حجة على الحنفية. قلت: كذلك حديث أم سلمة حجة على الشافعية، واحتجت الحنفية أيضًا بحديث عائشة لا أن النبي و كان يقسم بين نسائه فيعدل، الحديث. رواه الأربعة، وقد مر عن قريب فظاهره يقتضي المساواة بينهن مطلقا، انتهى. وقال في البحر الرائق»: وما روي في الحديث للبكر سبع وللثيب ثلاث وقوله للأم سلمة : إن شئت سبعت لك وسبعت لنسائي، وإن شئت ثلثت لك ودرت. فالمراد التفضيل في البداءة بالحديدة دون الزيادة، ولا شك أن الأحاديث محتملة فلم تكن قطعية الدلالة فوجب تقديم الدليل القطعي، والأحاديث المطلقة. وفي شرح درر البحار» أن الحديث لا يدلُّ على نفي التسوية، بل على اختيار الدور بالسبع والثلاث جمعا بينه وبين ما روينا.
۲ قوله: أي بالثلاث بين البقية: هذا حاصل ما قال الإمام الطحاوي، يعني معنى درت» الدوران عند البقية بالثلاث؛ ليحصل المساوات.
۱ قوله : وعاشروهن بالمعروف إلخ : أي عاشروا النساء بالمعروف مثل : النفقة والحسن في القول وغير ذلك، فإن كرهتموهن؛ لسوء خلقهن وقبحهن فعسى أن تكرهوا أي فاصبروا عليهن، ولا تفارقوهن؛ لكراهة فلعمل لكم فيما تكرهون خيرا كثير ليس فيما تحبونه من الثواب الجزيل والولد الصالح وغير ذلك، فأقيم علة جزاء الشرط، أعني فعسى أن تكرهوا مقام الجزاء، أعني قوله: فاصبروا كذا في «التفسيرات الأحمدية».
۳ قوله: واللاتي تخافون نشوزهن: أي إعراضهن فعظوهن أي انصحوهن للإطاعة، فإن لم ينفع النصحفاهجروهن في المضاجع أي في المراقد، فلا تدخلوهن تحت اللحاف أو تجامعوهن أو وولوهن ظهركم في المضجع، فإن لم ينفع الهجران فاضربوهن ضربا غير مبرح ولا شأن، ثم بعد هؤلاء أن تأتي تلك الناشزة على الإطاعة. فبيانه في قوله تعالى: ﴿فَإِنْ أَطَعْنَكُمْ ﴾ (النساء : ٣٤) أي بترك النشوز بعد الوعظ والهجران والضرب، ﴿فَلا تَبْغُوا عَلَيْهِنَّ سَبِيلًا (النساء: ٣٤) بالتوبيخ والإيذاء، بل أزيلوا عنهن التعرض واجعلوا ما كان منهن كأن لم يكن. وإن التائب من الذنب كمن لا ذنب له، إِنَّ اللهَ كَانَ عَلِيًّا كَبِيرًا ﴾ (النساء : ٣٤ أي أنه أقدر عليكم من قدرتكم على أزواجكم. كذا في «التفسيرات الأحمدية» ملتقطا.
