عن عَليَّ قَالَ: نَهَى۱ النَّبِيُّ ﷺ عَنْ ضَرْبِ الدُّفِّ وَلَعْبِ الضَّنْجِ وَضَرْبِ الزِّمَارَةِ. رَوَاهُ الْخَطِيبُ.

وَفِي رِوَايَةٍ لِمُسْلِمٍ عَنْ عَائِشَةَ قَالَتْ: دَخَلَ عَلَيَّ أَبُو بَكْرٍ وَعِنْدِي جَارِيَتَانِ تَلْعَبَانِ بِدُفٌ، فَقَالَ أَبُو بَكْرٍ: أَبِمَزْمُورِ الشَّيْطَانِ فِي بَيْتِ رَسُولِ اللَّهِ ﷺ. وَنَقَلَ الشَّيْخُ الْأَجَلْ السَّهروَرْدِي عَنِ الْحَسَنِ أَنَّهُ قَالَ: لَيْسَ الدُّفُّ مِنْ سُنَّةِ الْمُسْلِمِينَ. وَقَالَ التَّوْرَبُشْتِيْ: إِنَّ الدُّفَّ حَرَامٌ عَلَى قَوْلِ أَكْثَرِ الْمَشَايِخِ، وَمَا وَرَدَ مِنْ ضَرْبِ الدُّفُّ فِي الْعُرْسِ كِنَايَةُ عَنِ الْإِعْلَانِ لَا حَقِيقَتُهُ، أَوْ يُسْتَدَلُّ بِحَدِيْثِ عَلِيَّ أَنَّ النَّبِيَّ ﷺ أَجَازَهُمْ ثُمَّ بَعْدَ ذَلِكَ مَنَعَهُمْ ؛ لِأَنَّ ضَرْبَ الدُّفْ مَا ثَبَتَ فِي نِكَاحِ النَّبِيِّ ﷺ وَلَا فِي نِكَاحِ أَصْحَابِهِ عُمُوْمًا، وَلَوْ ثَبَتَ سُنَّةً جَارِيَةً مَا تَرَكُوهُ قَطُّ ؛ لِشَغَفِهِمْ عَلَى اتَّبَاعِ سُنَّةِ النَّبِيِّ ﷺ

وَرَوَى التَّرْمِذِيُّ عَنْ عَائِشَةَ قَالَتْ: قَالَ رَسُوْلُ اللَّهِ ﷺ: «أَعْلِنُوْا هَذَا النِّكَاحَ، وَاجْعَلُوهُ۲ فِي الْمَسَاجِدِ، وَاضْرِبُوا عَلَيْهِ بِالدُّفُوفِ».

English

Ali (may Allah be pleased with him) narrated: The Prophet (ﷺ) prohibited 1 beating the tambourine, playing the flute, and striking the pipe. Narrated by Al-Khatib. In a narration by Muslim from Aishah, she said: Abu Bakr entered upon me while two girls were playing with a tambourine, and Abu Bakr said: "The devil’s pipe in the house of the Messenger of Allah (ﷺ)?" Shaykh Al-Ajal As-Sahrawardi quoted Al-Hasan saying: "The tambourine is not from the Sunnah of the Muslims." Al-Tawrabushti said: "The tambourine is forbidden according to most scholars, and what is mentioned about beating the tambourine at weddings is a metaphor for announcement, not its reality, or it is inferred from Ali’s Hadith that the Prophet (ﷺ) permitted it then later prohibited it, because beating the tambourine was not established in the Prophet’s (ﷺ) marriage or generally in the marriages of his Companions. If it were an established Sunnah, they would not have abandoned it due to their zeal in following the Prophet’s Sunnah (ﷺ)." Tirmidhi related from Aishah that the Messenger of Allah (ﷺ) said: "Announce this marriage, hold it in mosques, and beat tambourines for it."

1 The statement: "The Prophet (ﷺ) prohibited beating the tambourine": Therefore, the Hanafis explicitly stated that the tambourine is also forbidden, which is the apparent narration. In "Radd al-Muhtar," it is said: Listening to the beating of the tambourine, pipe, and similar is forbidden. In "Sharh al-Wiqayah": Listening to the beating of the tambourine, pipe, singing, and the like is forbidden. Abu al-Makarim said: Amusement like beating the tambourine and pipe is disliked (prohibited). In "Fatawa al-Bayhaqi": Singing, listening to it, beating the tambourine, and all types of entertainment are forbidden, as in "Fatawa al-Aziziyyah." In "Al-Nihayah": Singing, the lute, the harp, the tambourine, and similar are forbidden, as stated in "Ma la Budd Minhu." Ibn Hajar al-Makki, the Shafi‘i, said in his book "Kaff ar-Ru‘a ‘an Muharramat al-Lahw wa as-Sama‘," Section Four on the tambourine: The relied-upon opinion in our school is that it is permissible without dislike at weddings and circumcisions, and abandoning it is better. Likewise, its ruling outside these occasions is permissible according to the sounder opinion. In "Al-Minhaj" and others: A group of our companions said it is forbidden outside these occasions. Shaykh As-Sahrawardi, the Shafi‘i, said in "‘Awarif al-Ma‘arif": As for the tambourine and flute, although there is leniency in the Shafi‘i school, it is preferable to abandon them and take the safer path to avoid disagreement. The details are mentioned in "Imdad al-Fatawa," Part Five, for those who wish to refer to it, as it is valuable in its field. In "Al-Bahr," quoting "Adh-Dhakhirah": Beating the tambourine at weddings is disputed, as stated in "Radd al-Muhtar." In "Tafsir al-Ahmadiyyah" under the verse: And of the people is he who buys the amusement of speech [Luqman: 6], it is mentioned in "Fatawa al-Hammadiyyah" and "‘Awarif": Mujahid said that the verse: And incite whoever you can among them with your voice [Al-Isra: 64] indicates the prohibition of singing, as it is addressed to Iblis, cursed be he, meaning: Stir whomever you can of the children of Adam with your voice, which is the voice of singing, pipes, tambourines, and the like. The complete discussion will come, God willing, in the Chapter on Explanation and Poetry, so refer to it, as it is also valuable in its field, and I have not seen anything better than it. 2 The statement: "Hold it in mosques": Ibn al-Humam said: It is recommended to conduct the marriage contract in the mosque, as it is an act of worship, and on Friday, as in "Al-Marqah."

وَعَنْهَا قَالَتْ: تَزَوَّجَنِي۱ رَسُولُ اللهِ ﷺ فِي شَوَّالٍ، وَبَنَى بِي فِي شَوَّالٍ، فَأَيُّ نِسَاءِ رَسُولِ اللهِ ﷺ كَانَ أَحْظَى عِنْدَهُ مِنِّي. رَوَاهُ مُسْلِمٌ.

English

Aishah (may Allah be pleased with her) narrated: The Messenger of Allah (ﷺ) married me 1 in Shawwal and consummated the marriage in Shawwal, so which of the Prophet’s wives was more fortunate with him than me? Narrated by Muslim.

1 The statement: "The Messenger of Allah (ﷺ) married me, etc.": In "Al-Bazaziyyah": Marriage and consummation between the two Eids are permissible, but the procession is disliked. The preferred opinion is that it is not disliked, as he married the truthful one (Aishah) in Shawwal and consummated in it. The interpretation of the statement: "No marriage between the two Eids," if authentic, is that he refrained from the Eid prayer in the shortest winter days on Friday, so it was said to him to not miss the preferable time for attending Friday prayer, as in "Radd al-Muhtar."

وَعَنْ عُقْبَةَ بْنِ عَامِرٍ (رضي الله عنه) قَالَ: قَالَ رَسُولُ اللَّهِ ﷺ: «أَحَقُّ۱ الشَّرُوطِ أَنْ تُوفُوْا بِهِ مَا اسْتَحْلَلْتُمْ بِهِ الْفُرُوجَ». مُتَّفَقٌ عَلَيْهِ.

English

Uqbah ibn Amir (may Allah be pleased with him) narrated: The Messenger of Allah (ﷺ) said: "The most rightful conditions 1 to fulfill are those by which you make private parts lawful." Agreed upon.

1 The statement: "The most rightful conditions, etc.": The conditions here refer to the dowry, as it is stipulated in exchange for intimacy. It is also said: All that a woman is entitled to by virtue of marriage, such as dowry, maintenance, and good companionship, as the husband commits to them by the contract, as if they were stipulated in it. It is also said: All that the husband stipulates to encourage the woman for marriage, as long as it is not prohibited, as in "Al-Marqah." In "Umdat al-Qari": Scholars differed regarding a man marrying a woman and stipulating for her that he will not take her out of her house, or not marry another, or not take a concubine, or similar permissible conditions, on two opinions. The first: He is obligated to fulfill it, which is the opinion of Al-Awza‘i and Ahmad. The second: The husband is ordered to fear Allah and fulfill the condition, but it is not enforced judicially. If he insists on going against it, he has the most right to his family. This was the opinion of Ata, Ash-Sha‘bi, Sa‘id ibn al-Musayyib, An-Nakha‘i, Al-Hasan, Ibn Sirin, Rabi‘ah, Abu az-Zinad, Qatadah, and it is the opinion of Malik, Abu Hanifah, and Ash-Shafi‘i. In summary: Conditions that do not contradict marriage are permissible and must be fulfilled morally, but not judicially according to Abu Hanifah.

۱ قوله: أحق الشروط إلخ والمراد بالشروط ههنا المهر؛ لأنه المشروط في مقابلة البضع، وقيل: جميع ما تستحقه المرأة بمقتضى الزوجية من المهر والنفقة وحسن المعاشرة، فإن الزوج التزمها بالعقد، فكأنها شرطت فيه، وقيل: كل ما شرط الزوج ترغيبا للمرأة في النكاح ما لم يكن محظورا قاله في المرقاة»، وقال في عمدة القاري»: واختلف العلماء في الرجل يتزوج المرأة، ويشترط لها أن لا يخرجها من دارها، أو لا يتزوج عليها، أو لا يتسرى أو نحو ذلك من الشروط المباحة على قولين أحدهما: أنه يلزمه الوفاء بذلك، وهو قول الأوزاعي وأحمد والثاني: أن يؤمر الزوج بتقوى الله، والوفاء بالشرط، ولا يحكم عليه بذلك حكما، فإن أبى إلا الخروج لها كان أحق الناس بأهله إليه، ذهب عطاء والشعبي وسعيد بن المسيب والنخعي والحسن وابن سيرين وربيعة وأبو الزناد وقتادة، وهو قول مالك وأبي حنيفة والشافعي انتهى. حاصله : أن الشروط التي لا تنافي النكاح جائزة ويوفى ديانة، ولا تلزمه قضاء عند أبي حنيفة .

وَعَنْ أَبِي هُرَيْرَةَ (رضي الله عنه) قَالَ: قَالَ رَسُوْلُ اللهِ ﷺ: «لَا يَخْطُبُ۱ الرَّجُلُ عَلَى خِطْبَةِ أَخِيهِ حَتَّى يَنْكِحَ أَوْ يَتْرُكَ». مُتَّفَقٌ عَلَيْهِ.

وَرَوَى الطَّحَاوِيُّ عَنْ فَاطِمَةَ بِنْتِ قَيْسٍ قَالَتْ: لَمَّا حَلَلْتُ أَتَيْتُ رَسُوْلَ اللهِ ﷺ فَذَكَرْتُ لَهُ أَنَّ مُعَاوِيَةَ بْنَ أَبِي سُفْيَانَ وَأَبَا جَهْمٍ خَطَبَانِي، فَقَالَ رَسُولُ اللَّهِ ﷺ: «أَمَّا أَبُو جَهْمٍ فَلَا يَضَعُ عَصَاهُ عَنْ عَاتِقِهِ، وَأَمَّا مُعَاوِيَةُ فَصُعْلُوكٌ لَا مَالَ لَهُ، انْكِحِي أُسَامَةَ بْنَ زَيْدٍ»، قَالَتْ: فَكَرِهْتُهُ ثُمَّ قَالَ: «انْكِحِي أُسَامَةَ بْنَ زَيْدٍ»، فَنَكَحْتُهُ، فَجَعَلَ اللَّهُ فِي ذَلِكَ خَيْرًا، وَاغْتَبَطْتُ بِهِ.

English

Abu Hurayrah (may Allah be pleased with him) narrated: The Messenger of Allah (ﷺ) said: "A man should not propose 1 over his brother’s proposal until he marries or withdraws." Agreed upon. Al-Tahawi narrated from Fatimah bint Qays: When I became permissible, I came to the Messenger of Allah (ﷺ) and mentioned that Mu‘awiyah ibn Abi Sufyan and Abu Jahm proposed to me. The Messenger of Allah (ﷺ) said: "As for Abu Jahm, he does not put down his staff from his shoulder, and as for Mu‘awiyah, he is a pauper with no wealth. Marry Usamah ibn Zayd." She said: I disliked it, then he said: "Marry Usamah ibn Zayd." So I married him, and Allah placed goodness in it, and I was pleased with him.

1 The statement: "A man should not propose over his brother’s proposal, etc.": The prohibition according to the Hanafis is only after acceptance; otherwise, it is not, based on Fatimah bint Qays’ Hadith, where she mentioned that three proposed to her, and he did not object to some proposing over others. According to others, the prohibition is absolute. This is the summary of what Al-Tahawi said in "Sharh Ma‘ani al-Athar."

وَعَنْ أَبِي هُرَيْرَةَ (رضي الله عنه)قَالَ: قَالَ رَسُولُ اللهِ ﷺ: «لَا تَسْأَلِ الْمَرْأَةُ طَلَاقَ أُخْتِهَا لِتَسْتَفْرِغَ صَحْفَتَهَا، وَلْتَنْكِحْ؛ فَإِنَّ لَهَا مَا قُدَّرَ لَهَا». مُتَّفَقٌ عَلَيْهِ.

English

Abu Hurayrah (may Allah be pleased with him) narrated: The Messenger of Allah (ﷺ) said: "A woman should not ask for her sister’s divorce to empty her plate and marry, for she will have what is decreed for her." Agreed upon.

وَعَنِ ابْنِ عُمَرَ (رضي الله عنهما) أَنَّ رَسُوْلَ اللهِ لا نَهَى عَنِ الشَّغَارِ. وَالشَّغَارُ۱ أَنْ يُزَوِّجَ الرَّجُلُ ابْنَتَهُ عَلَى أَنْ يُزَوِّجَهُ الْآخَرُ ابْنَتَهُ لَيْسَ بَيْنَهُمَا صَدَاقٌ. مُتَّفَقٌ عَلَيْهِ.

وَفِي رِوَايَةٍ لِمُسْلِمٍ: «قَالَ: لَا شِغَارَ فِي الْإِسْلَامِ».

وَقَالَ عَطَاءُ وَعَمْرُو بْنُ دِينَارٍ وَالزُّهْرِيُّ وَمَكْحُولُ وَالنَّوْرِيُّ: عَقْدُ النِّكَاحِ عَلَى الشَّغَارِ جَائِزُ، وَلِكُلِّ وَاحِدَةٍ مِنْهُمَا صَدَاقُ مِثْلِهَا.

English

Ibn Umar (may Allah be pleased with them) narrated: The Messenger of Allah (ﷺ) prohibited shighar. Shighar 1 is when a man marries his daughter on the condition that the other marries his daughter to him without a dowry. Agreed upon. In a narration by Muslim: He said: "There is no shighar in Islam." Ata, Amr ibn Dinar, Az-Zuhri, Makhul, and An-Nawri said: A marriage contract based on shighar is permissible, and each woman is entitled to the dowry of her peers.

This is the response to what Ash-Shafi‘i cited from the six books, elevated, prohibiting shighar marriage, as prohibition implies the invalidity of the prohibited. The response: The prohibition pertains to the named shighar, understood as lacking a dowry and making intimacy a dowry. We deny this essence and what legally applies to it, so we do not establish marriage as such but invalidate it, making it a marriage where something unsuitable was named as dowry, so it is contracted requiring the dowry of peers, like naming wine or pork as dowry. What the prohibition pertains to, we do not establish, and what we establish is not subject to it, but its validity is required by general evidence. Az-Zayla‘i added: Or the prohibition is understood as dislike. Meaning, dislike does not necessitate invalidity. In summary: With the requirement of the dowry of peers, it is no longer shighar in reality. Even if conceded, the prohibition means dislike, so the Sharia mandates two things: dislike and the dowry of peers. The first is taken from the prohibition, and the second from evidence indicating that what is named as an unsuitable dowry is contracted requiring the dowry of peers. This second point supports interpreting the prohibition as dislike, not invalidity. This explanation refutes the claim that interpreting it as dislike implies shighar is no longer prohibited now, requiring the dowry of peers. The refutation is: If the prohibition means invalidity, it is conceded that it is no longer prohibited now after requiring the dowry of peers. If it means dislike, the prohibition remains, so understand. In "Ad-Durr al-Mukhtar" and "Radd al-Muhtar," ‘Iyad said: There is no disagreement on prohibiting shighar initially. If it occurs, the Kufis, Al-Layth, Az-Zuhri, and Ata require the dowry of peers, while Malik and Ash-Shafi‘i invalidate it, as in "Sharh az-Zarqani."

1 The statement: "Shighar is when a man, etc.": In "An-Nahr": It is when a man engages in shighar, meaning he marries his woman on the condition that the other marries his woman to him, with no dowry except this. As in "Al-Mughrib," meaning that each woman’s intimacy is the dowry for the other. This condition is necessary for it to be called shighar. If he does not say this or its meaning, but says: "I marry you my daughter on the condition you marry me your daughter," and it is accepted, or "on the condition that my daughter’s intimacy is the dowry for your daughter," and the other does not accept but marries his daughter without making it a dowry, it is not shighar but a valid marriage by consensus. The dowry of peers is required in all cases because something unsuitable was named as dowry. In summary: Merely omitting the dowry does not necessitate invalidity according to them, as marriage is valid without naming a dowry. The reason for invalidity is making intimacy a dowry. Shighar is prohibited due to the absence of a dowry, so we require the dowry of peers, and it is no longer shighar.

۱قوله: الشغار أن يزوج الرجل إلخ : قال في النهر : وهو أن يشاغر الرجل، أي يزوجه حريمته على أن يزوجه الآخر حريمته، ولا مهر إلا هذا. كذا في المغرب، أي على أن يكون بضع كل صداقًا عن الآخر، وهذا القيد لا بد فيه في مسمى الشغار حتى لو لم يقل ذلك ولا معناه، بل قال: زوجتك بنتي على أن تزوجني بنتك، فقبل، أو على أن يكون بضع بنتي صداقا لبنتك، فلم يقبل الآخر ، بل زوجه بنته، ولم يجعلها صداقا لم يكن شغارًا، بل نكاحا صحيحًا اتفاقا، وإن وجب مهر المثل في الكل؛ لما أنه سمى ما لا يصلح صداقا حاصله: أن مجرد ترك الصداق ليس المقتضى للبطلان عندهم؛ لأن النكاح يصح بدون تسمية، بل المقتضي لذلك جعل البضع صداقا، والشغار منهي عنه الخلوه عن المهر، فأوجبنا فيه مهر المثل، فلم يبق شغارا.

هذا جواب عما أورده الشافعي من حديث الكتب الستة مرفوعا من النهي عن نكاح الشغار، والنهي يقتضي فساد المنهي عنه، والجواب: أن متعلّق النهي مسمى الشغار المأخوذ في مفهومه خلوه عن المهر، وكون البضع صداقا، ونحن قائلون بنفي هذه الماهية، وما يصدق عليها شرعًا، فلا تثبت النكاح كذلك، بل نبطله فيبقى نكاحا سمي فيه ما لا يصلح مهرًا، فينعقد موجبا لمهر المثل، كالمسمى فيه خمر أو خنزير فيما هو متعلق النهي لم نثبته، وما أثبتناه لم يتعلق به، بل اقتضت العمومات صحته، تمامه في الفتح، زاد الزيلعي أو هو، أي النهي محمول على الكراهة. أي والكراهة لا توجب الفساد، وحاصله : أنه مع إيجاب مهر المثل لم يبق شغارا حقيقة، وإن سلم فالنهي على معنى الكراهة، فيكون الشرع أوجب فيه أمرين: الكراهة، ومهر المثل، فالأول مأخوذ من النهي، والثاني من الأدلة الدالة على أن ما سمي فيه ما لا يصلح مهرا ينعقد موجبا لمهر المثل، وهذا الثاني دليل على حمل النهي على الكراهة دون الفساد.

وبهذا التقرير اندفع ما أورد من أن حمله على الكراهة يقتضي أن الشغار الآن غير منهي عنه لا يجابنا فيه مهر المثل، ووجه الدفع أنه إذا حمل النهي على معنى الفساد فكونه غير منهي الآن، أي بعد إيجاب مهر المثل مسلم، وإن حمل على معنى الكراهة فالنهي باق، فافهم الدر المختار ورد المختار منها قال عياض: لا خلاف في النهي عن الشغار ابتداء، فإن وقع الكوفيون والليث والزهري وعطا بصداق المثل، وأبطله مالك والشافعي. كذا في شرح الزرقاني.

وَعَنْ عَلَيَّ (رضي الله عنه) أَنَّ رَسُولَ اللهِ ﷺ نَهَى۱ عَنْ مُتْعَةِ النِّسَاءِ يَوْمَ خَيْبَرَ، وَعَنْ أَكل لحومِ الْحُمُرِ الْإِنْسِيَّةِ. مُتَّفَقٌ عَلَيْهِ.

English

Ali (may Allah be pleased with him) narrated: The Messenger of Allah (ﷺ) prohibited 1 temporary marriage of women on the day of Khaybar and eating the meat of domesticated donkeys. Agreed upon.

1 The statement: "Prohibited temporary marriage, etc.": Know that temporary marriage is forbidden by consensus of scholars and the four Imams. Attributing its permissibility to Malik, as occurred in "Al-Hidayah," is a mistake, as clarified by its commentators. How could it be when the Malikis agree on it, and none of their books permit it, but are filled with its prohibition? Malik cited in his "Muwatta" Hadiths that decisively prove its prohibition forever, and he only cites what is acted upon, as in "Tansiq an-Nizam" and "Fath al-Qadir."

وَعَنْ سَلَمَةَ بْنِ الْأَكْوَعِ (رضي الله عنه) قَالَ : رَخَّصَ رَسُولُ اللَّهِ ﷺ عَامَ أَوْطَاسٍ فِي الْمُتْعَةِ ثَلَاثًا، ثُمَّ نَهَى عَنْهَا . رَوَاهُ مُسْلِمٌ. وَفِي رِوَايَةٍ لَهُ عَنْ سَبْرَةَ الْجُهَنِيِّ أَنَّهُ كَانَ مَعَ رَسُوْلِ اللهِ ، فَقَالَ: «يَا أَيُّهَا النَّاسُ، إِنِّي قَدْ كُنْتُ أَذِنْتُ لَكُمْ فِي الاسْتِمْتَاعِ مِنَ النِّسَاءِ، وَإِنَّ اللَّهَ قَدْ حَرَّمَ ذَلِكَ إِلَى يَوْمِ الْقِيَامَةِ، فَمَنْ كَانَ عِنْدَهُ مِنْهُنَّ شَيْءٍ فَلْيُخَلَّ سَبِيلَهُ، وَلَا تَأْخُذُوْا مِمَّا آتَيْتُمُوهُنَّ شَيْئًا».

وَرَوَى التَّرْمِذِيُّ عَنِ ابْنِ عَبَّاسٍ (رضي الله عنهما) قَالَ: إِنَّمَا كَانَتِ الْمُتْعَةُ فِي أَوَّلِ الْإِسْلَامِ، كَانَ الرَّجُلُ يَقْدَمُ الْبَلْدَةَ لَيْسَ لَهُ بِهَا مَعْرِفَةً، فَيَتَزَوَّجُ الْمَرْأَةَ بِقَدْرِ مَا يَرَى أَنَّهُ يُقِيمُ، فَتَحْفَظُ لَهُ مَتَاعَهُ وَتُصْلِحُ لَهُ شَيَّهُ حَتَّى إِذَا نَزَلَتِ الْآيَةُ: {أَوْ مَا مَلَكَتْ أَيْمَانُهُمْ} (المؤمنون: 1) قَالَ ابْنُ عَبَّاسٍ: فَكُلُّ فَرْجِ سِوَى هَذَيْنِ فَهُوَ حَرَامٌ.

English

Salamah ibn al-Akwa‘ (may Allah be pleased with him) narrated: The Messenger of Allah (ﷺ) permitted temporary marriage in the year of Awtaas for three days, then prohibited it. Narrated by Muslim. In another narration by him from Sabrah al-Juhani, who was with the Messenger of Allah (ﷺ), he said: "O people, I had permitted you to enjoy women, but Allah has forbidden it until the Day of Resurrection. Whoever has any of them, let her go, and do not take back anything you gave them." Tirmidhi narrated from Ibn Abbas (may Allah be pleased with them): Temporary marriage was only at the beginning of Islam. A man would arrive in a town where he had no acquaintance, so he would marry a woman for as long as he estimated he would stay, and she would guard his belongings and prepare his food until the verse was revealed: Or those your right hands possess [Al-Mu’minun: 1]. Ibn Abbas said: Every private part other than these is forbidden.

Allah, the Mighty and Exalted, said: “As for the thief, male or female, cut off their hands as a recompense for what they earned, a deterrent from Allah. And Allah is Mighty, Wise. But whoever repents after their wrongdoing and reforms, indeed, Allah will turn to him in forgiveness. Indeed, Allah is Forgiving, Merciful” [Al-Ma’ida: 38–39]

1 The statement: But whoever repents, etc.: This means no torment in the Hereafter after repentance, but the prescribed punishment is not dropped. In Al-Kashshaf: Repentance does not drop amputation per Abu Hanifa and his companions. Al-Shafi‘i, in one view, says it does. Some said: It is dropped for a belligerent (harbi) who steals if he repents, to encourage Islam, unlike a Muslim, as enforcing it benefits believers. (As mentioned in Al-Tafsir al-Ahmadiyyah)

وَفِي جَامِعِ التَّرْمِذِيَّ» فَسَّرَ الْآيَاتِ الثَّلَاثَ سُفْيَانُ الثَّوْرِيُّ، وَزَادَ ابْنُ مَاجَهِ بَعْدَ قَوْلِهِ: أَنِ الْحَمْدُ لِلهِ : نَحْمَدُهُ، وَبَعْدَ قَوْلِهِ:مِنْ شُرُوْرِ أَنْفُسِنَا وَمِنْ سَيِّئَاتِ أَعْمَالِنَا، وَالدَّارِيُّ بَعْدَ قَوْلِهِ: عَظِيمًا ثُمَّ يَتَكَمَّلُ بِحَاجَتِهِ، وَرَوَى فِي شَرْحِ السُّنَّةِ عَنِ ابْنِ مَسْعُوْدٍ فِي خُطْبَةِ الْحَاجَةِ مِنَ النِّكَاحِ وَغَيْرِهِ.

Abdullah ibn Mas‘ud (may Allah be pleased with him) narrated: The Messenger of Allah (ﷺ) taught us 1 the tashahhud in prayer and the tashahhud for a need. He said: The tashahhud in prayer is: "All compliments, prayers, and pure words are for Allah. Peace be upon you, O Prophet, and Allah’s mercy and blessings. Peace be upon us and upon Allah’s righteous servants. I bear witness that there is no god but Allah, and I bear witness that Muhammad is His servant and Messenger." The tashahhud for a need is: "All praise is for Allah; we seek His help and forgiveness, and we seek refuge in Allah from the evils of our souls and the wrongs of our deeds. Whoever Allah guides, none can misguide, and whoever He misguides, none can guide. I bear witness that there is no god but Allah, and I bear witness that Muhammad is His servant and Messenger." And he recites three verses: O you who have believed, fear Allah as He should be feared and do not die except as Muslims [Al-Imran: 102], And fear Allah, through whom you ask one another, and the wombs. Indeed, Allah is ever, over you, an Observer [An-Nisa: 1], O you who have believed, fear Allah and speak words of appropriate justice. He will amend for you your deeds and forgive you your sins. And whoever obeys Allah and His Messenger has certainly attained a great attainment [Al-Ahzab: 70-71]. Narrated by Ahmad, Tirmidhi, Abu Dawud, An-Nasa’i, Ibn Majah, and Ad-Darimi. In "Jami‘ Tirmidhi," Sufyan ath-Thawri explained the three verses. Ibn Majah added after "All praise is for Allah": "We praise Him," and after "from the evils of our souls and the wrongs of our deeds," and Ad-Darimi after "great attainment": "Then he completes with his need." In "Sharh as-Sunnah," from Ibn Mas‘ud regarding the sermon for a need in marriage and other matters.

1 The statement: "He taught us, etc.": This Hadith of Ibn Mas‘ud is used as evidence for the legitimacy of the sermon at the marriage contract and for every need. Tirmidhi said in his "Sunan": Scholars said marriage is permissible without a sermon, which is the opinion of Sufyan ath-Thawri and others among the scholars. This is supported by the Hadith of Ismail ibn Ibrahim, coming later. Thus, the sermon in marriage is recommended, as in "Nayl al-Awtar" and "Ad-Durr al-Mukhtar."

وَفِي رِوَايَةِ أَبِي دَاوُدَ: عَنْ إِسْمَعِيلَ بْنِ إِبْرَاهِيمَ عَنْ رَجُلٍ مِنْ بَنِي سُلَيْمٍ قَالَ: خَطَبْتُ إلَى النَّبِيِّ اللهِ أُمَامَةَ بِنْتَ عَبْدِ الْمُطَّلِبِ فَأَنْكَحَنِي مِنْ غَيْرِ أَنْ يَتَشَهَّدَ.

English

Abu Hurayrah (may Allah be pleased with him) narrated: The Messenger of Allah (ﷺ) said: "Every significant matter not begun with praise is defective." Narrated by Ibn Majah. In a narration by Abu Dawud from Ismail ibn Ibrahim, from a man of Banu Sulaym, he said: I proposed to the Prophet (ﷺ) for Ummamah bint Abdul Muttalib, and he married me to her without reciting tashahhud.

English

Samurah narrated that the Messenger of Allah (ﷺ) said: "If a woman is married by two guardians, she belongs to the first of them, 1 and if a man sells a sale to two men, it belongs to the first of them." Narrated by Tirmidhi, Abu Dawud, An-Nasa’i, and Ad-Darimi.

And the saying of Allah, the Mighty, the Exalted: And do not marry those whom your fathers married, except what has already passed. Indeed, it was an immorality and hateful and an evil way. Prohibited to you are your mothers, your daughters, your sisters, your paternal aunts, your maternal aunts, your brother’s daughters, your sister’s daughters, your mothers who nursed you, your sisters through nursing, your wives’ mothers, and your stepdaughters under your guardianship from your wives with whom you have consummated. But if you have not consummated with them, there is no blame on you. And the wives of your sons who are from your loins, and that you combine two sisters, except what has already passed. Indeed, Allah is Forgiving and Merciful. And married women, except those your right hands possess. This is the decree of Allah upon you [An-Nisa: 22-24]. And His saying, the Exalted: Mothers shall breastfeed their children two complete years for whoever wishes to complete the nursing [Al-Baqarah: 233]. And His saying, the Exalted: And his gestation and weaning are thirty months [Al-Ahqaf: 15]. And His saying, the Exalted: If you know them to be believers, do not return them to the disbelievers. They are not lawful for them, nor are they lawful for them [Al-Mumtahanah: 10].

1 The statement: "She belongs to the first of them": Tirmidhi said after citing this Hadith: This is a good Hadith, and this is acted upon among the scholars. We know of no disagreement among them that if one of the guardians marries her before the other, the marriage of the first is permissible, and the marriage of the other is invalid. If they marry her simultaneously, both marriages are annulled, which is the opinion of Ath-Thawri, Ahmad, and Ishaq. I say: This is also the Hanafi position on this issue. In "Al-Bada’i‘": If they are of equal rank, like two brothers or two paternal uncles, each has the right to marry her independently, whether the other agrees or not, provided the marriage is to a suitable match with a sufficient dowry. Malik said: None of the guardians has the authority to marry her unless they agree, based on the guardianship being a shared one according to him. According to us and the majority, it is an independent guardianship. His reasoning: The cause of this guardianship is kinship, which is shared among them, so the guardianship is shared, like the guardianship of property. If a slave girl is shared between two, one marrying her without the other’s consent is not permissible. I say: For us, guardianship is indivisible, as it is established by an indivisible cause, which is kinship. What is established by a collective, indivisible cause is established for each perfectly, as if there were no other, like the guardianship of trust. This differs from property guardianship, as its cause, ownership, is divisible and proportionate to the ownership. If each guardian marries her to a different man, both contracts are invalid, as there is no way to combine them, and neither is preferred over the other. If it is unknown which was first, the same applies, as we said, and because if one were valid, it would require speculation, which is not permissible in matters of private parts. If the earlier is known, the first is valid, and the later is not, as in "Badhl al-Majhud."

1 The statement: "Those whom your fathers married, etc.": Marriage here means intercourse, meaning do not have intercourse with those your fathers had intercourse with. This indicates the prohibition of all women a father had intercourse with, whether by marriage, ownership, or adultery, as is our position and that of many exegetes, as in "Al-Madarak." According to Ash-Shafi‘i: A woman a father committed adultery with is not prohibited, as adultery is inherently reprehensible, so it cannot be a cause for lawful prohibition, which is a blessing, and a blessing is not attained by the prohibited. For us: Intercourse is a cause of partial kinship through the child, so it is attributed to each as complete, making her ascendants and descendants like his ascendants and descendants, and vice versa. Prohibited intercourse is a cause of the child, not as adultery. Similarly, the disagreement regarding a touched woman, one who touched, or one whose private part was looked at with desire is prohibited according to us, not according to him. The author of "At-Tawdih" said at the beginning of the book: An example of analogy derived from consensus is the analogy of prohibited intercourse to permissible intercourse in the prohibition of affinity, like the analogy of prohibiting the mother of an adulteress to prohibiting the mother of a slave woman he had intercourse with. The prohibition in the original case is established by consensus, with no text, but the text came regarding wives’ mothers without requiring intercourse. This is his statement, very beneficial, as in "Tafsir al-Ahmadiyyah." 2 The statement: "Your mothers who nursed you, etc.": In "Tafsir al-Ahmadiyyah": According to Ash-Shafi‘i, nursing prohibition is not established except with five sucklings, based on the saying of the Prophet (ﷺ): "One or two sucklings do not prohibit, nor one or two sips." According to us, it is established with one suckling if it occurs within the nursing period, due to the generality of the verse: Your mothers who nursed you without distinguishing between little or much, as mentioned in "Al-Hidayah" in the Chapter on Nursing. Malik agrees with Abu Hanifah, and Ahmad ibn Hanbal with Ash-Shafi‘i, as stated in "Al-Husayni." The complete discussion will come, God willing, in this chapter under An-Nasa’i’s Hadith, so refer to it, as it is valuable in its field. 3 The statement: "That you combine two sisters, etc.": In "Tafsir al-Ahmadiyyah": The text indicates prohibition of combining only two sisters, but scholars added to the Book with the well-known Hadith: "Do not marry a woman with her paternal or maternal aunt, nor with her brother’s or sister’s daughter," so they made combining these prohibited and established a rule: It is prohibited to combine two women like two sisters, such that if one were assumed male, the other would be unlawful to him, like a paternal aunt with her sister’s daughter. If the aunt were male, they would be a father and a brother’s daughter, prohibited in marriage. If the brother’s daughter were male, they would be an aunt and a nephew, prohibited in marriage, so combining them is prohibited for a man, as with two sisters, and so by analogy. This differs if it is from one side, like a woman and her husband’s daughter, as combining them is permissible, contrary to Zufar, as is known. 4 The statement: "Except those your right hands possess, etc.": Its explanation will come in the Hadith of Awtaas. 5 The statement: "Two complete years, etc.": There is a disagreement regarding the nursing period between the Hanafis, Abu Hanifah’s two companions, and Ash-Shafi‘i. Abu Hanifah held it is two and a half years, while his companions and Ash-Shafi‘i held it is two years only. Zufar said three years. Abu Hanifah relied on what will come in Surah Al-Ahqaf: And his gestation and weaning are thirty months [Al-Ahqaf: 15], and they relied on this verse. The sounder opinion is theirs, which is Al-Tahawi’s choice. The verse: For whoever wishes to complete the nursing [Al-Baqarah: 233] by consensus explains to whom the ruling applies or relates to shall breastfeed, meaning this ruling is for those who wish to complete the nursing, or they breastfeed for the sake of those who wish to complete it. Thus, it is known that the complete nursing period is two years, as Al-Baydawi said under this verse, which indicates that the maximum nursing period is two years, and it has no effect after that, and it may be less. Summarized from "Tafsir al-Ahmadiyyah" and "At-Ta‘liq al-Mumajjad." 6 The statement: "And his gestation and weaning are thirty months": Abu Hanifah held that the maximum nursing period is two and a half years. Its explanation, as in "Al-Hidayah": The verse thirty months informs about each of gestation and weaning, as if it said: The gestation period is thirty months, and the weaning period is thirty months, so the verse indicates the maximum of both periods. But since a reduction was found for the gestation period, based on Aishah’s saying: "By Allah, a child does not remain in the womb more than two years," and no reduction was found for the nursing period, Abu Hanifah ruled that the maximum gestation period is two years, and the weaning period is thirty months. Or gestation refers to carrying in arms, not in the womb. Abu Yusuf, Muhammad, and Ash-Shafi‘i held that the maximum nursing period is two years, as thirty months informs about the total of gestation and weaning, meaning their total is thirty months, so it is unclear which applies to each. The verse elsewhere: And his weaning is in two years [Luqman: 14] and Two complete years clarify that the weaning period is two years, and the remaining six months are the gestation period, as the minimum gestation period is that by consensus. Thus, this verse clarifies the minimum gestation period and the maximum nursing period. Al-Qadi said: Perhaps specifying the minimum gestation and maximum nursing is due to their regulation and the establishment of lineage and nursing rulings. This is his statement, taken from "Tafsir al-Ahmadiyyah" and "Al-Madarak." I say: Their opinion is supported by Ad-Daraqutni’s Hadith: "There is no nursing except what is in the two years." 7 The statement: "They are not lawful for them, nor are they lawful for them": Due to the separation between them by her becoming Muslim, as in "Al-Madarak," meaning due to the separation by the difference in abodes.

۱قوله: فهي للأول منهما قال الترمذي بعد إخراج هذا الحديث هذا حديث حسن، والعمل على هذا عند أهل العلم، لا نعلم بينهم في ذلك اختلافا، إذا زوج أحد الوليين قبل الآخر، فنكاح الأول جائز، ونكاح الآخر مفسد، وإذا زَوَّجَا جميعًا فنكاحهما جميعا مفسوخ، وهو قول الثوري وأحمد وإسحاق. قلت: وهكذا مذهب الحنفية في هذه المسألة. قال في البدائع: فأما إذا كان في الدرجة سواء كالأخوين وعمين، ونحو ذلك ، فلكل واحد منهما على حياله أن يزوج رضي الآخر أو سخط بعد إن كان التزويج من كفؤ بمهر وافر ، وقال مالك: ليس لأحد الأولياء ولاية الإنكاح ما لم يجتمعوا بناءً على أن هذه الولاية ولاية شركة عنده، وعندنا وعند العامة ولاية استبداد، وجه قوله: إن سبب هذه الولاية هو القرابة، وإنها مشتركة بينهم، فكانت الولاية مشتركة؛ لأن الحكم يثبت على وفق العلة وصار كولاية الملك، فإن الجارية بين اثنين إذا زوجها أحدهما لا يجوز من غير رضى الآخر.

قلت: كذا هذا. ولنا أن الولاية لا تتجزأ، لأنها ثبتت بسبب لا يتجزأ وهو القرابة وما لا يتجزأ؛ إذ ثبتت بجماعة سبب لا يتجزأ يثبت لكل واحد منهم على الكمال، كأنه ليس معه غيره كولاية الأمان، بخلاف ولاية الملك؛ لأن سببها الملك، أو أنه يتجزأ فيتقدر بقدر الملك، فإن زوجها كل واحد من الوليين رجلا على حدة، فإن وقع العقدان بطلا جميعًا؛ لأنه لا سبيل إلى جمع بينهما، وليس أحدهما أولى من الآخر، وإن وقعا مرتبا فإن كان لا يدرى السابق فكذلك؛ لما قلنا، ولأنه لو جاز الجاز بالتجزي، ولا يجوز العمل بالتجزي في الفروج، وإن علم السابق منهما من اللاحق جاز الأول ولم يجز الآخر. كذا في بذل المجهود».

۱قوله: ما نكح آبائكم إلخ المراد بالنكاح الوطء، يعني لا توطؤا ما وطئ آبائكم، ففيه دليل على تحريم موطوءة الأب كلها، سواء كان بنكاح أو بملك يمين أو بزني، كما هو مذهبنا، وعليه كثير من المفسرين، هكذا في «المدارك» ،

وعند الشافعي: لا يحرم مزنية الأب؛ لأن الزنا قبيح بنفسه، فلا يصلح سببا المشروع، وهو حرمة المصاهرة؛ لأنها نعمة فلا تنال بالمحظور، ولنا أن الوطئ سبب الجزئية بواسطة الولد، حتى يضاف إلى كل واحد منهما كملا، فيصير أصولها وفروعها كأصوله وفروعه، وبالعكس. والوطئ محرم من حيث إنه سبب الولد لا من حيث إنه زنا وهكذا الختلاف في ممسوسة وماسة ومنظورة إلى فرجها بشهوة يحرم عندنا ولا يحرم عنده وإن شئت زيادة تحقيق فانظر إلى الهداية وكتب الأصول وقد قال صاحب التوضيح في أول الكتاب: إن نظير القياس المستنبط من الإجماع قياس الوطء الحرام على الوطء الحلال في حرمة المصاهرة كقياس حرمة أم المزنية على حرمة وطء أم أمته التي وطيها والحرمة في المقيس عليه ثابت إجماعا ولا نص فيه بل النص ورد في أمهات النساء من غير اشتراط الوطء هذا كلامه وهو نافع هذا جدا هكذا في التفسيرات الأحمدية.

۲ قوله: أمهاتكم اللاتي أرضعنكم إلخ : قال في التفسيرات الأحمدية: إن عند الشافعي لم يثبت حرمة الرضاع إلا بخمسة رضعات لقوله عليه السلام: لا يحرم المصة والمصتان ولا الإملاجة ولا الإملاجتان وعندنا يثبت بمصة إذا حصل في مدة الرضاع لإطلاق قوله تعالى : أمهاتكم اللاتي أرضعنكم من غير فصل بين القليل والكثير هكذا ذكر في الهداية في باب الرضاع ومالك مع أبي حنيفة رحمه الله وأحمد بن حنبل مع الشافعي نص بذلك في الحسيني وسيأتي إن شاء الله تعالى تمام الكلام عليه في هذا الباب تحت حديث النسائي فلينظر ثمه فإنه نفيس في بابه.

۳قوله: أن تجمعوا بين الأختين إلخ: قال في التفسيرات الأحمدية ثم النص يقتضي الحرمة في جمع الأختين فقط والعلماء زادوا على الكتاب بالخبر المشهور وهو قوله عليه السلام: لا تنكحوا المرأة على عمتها ولا على خالتها ولا على ابنة أخيها ولا على ابنة أختها فجعلوا الجمع بين هؤلاء حراما وقرروا ضابطة وقالو بحرمة الجمع بين كل امرأتين مثل الأختين في أن أيتهما فرضت ذكرًا لم تحل له الأخرى، كالعمة مع بنت أختها، فإن العمة إذا فرضت ذكرا كانتا عما وبنت أخ، يحرم النكاح بينهما، وبت الأخ إذا فرضت ذكرًا كانتا عمة وابن أخ يحرم النكاح بينهما، فمحرم الجمع بينهما للرجل، كما أن الأختين كذلك، وهكذا القياس، بخلاف ما إذا كان ذلك من جانب واحد كالمرأة وبنت زوجها، فإنه يحل الجمع بينهما، خلافا لزفر، على ما عرف.

٤قوله : إلا ما ملك أيمانكم إلخ : سنذكر تفسيره في حديث الأوطاس.

٥قوله: حولين كاملين إلخ وفي تقدير مدة الرضاع خلاف بين إلي حنفية وبين صاحبيه والشافعي، فذهب أبو حنيفة إلى أنها حولان ونصف، وذهب صاحباه والشافعي إلى أنها حولان فقط، وعند زفر ثلاثة أحوال، وقد تمسك أبو حنيفة بما سيأتي في سورة الأحقاف من قوله تعالى: ﴿وَحَمْلُهُ وَفِصَالُهُ ثَلَاثُونَ شَهْرًا﴾ (الأحقاف: ١٥) وتمسكوا أيضًا بهذه الآية، والأصح قولهما، وهو مختار الطحاوي. وقوله تعالى: ﴿لِمَنْ أَرَادَ أَن يُتِمَّ الرَّضَاعَةَ﴾ (البقرة: ۲۳۳) فإنه بالاتفاق بيان لما توجه إليه الحكم أو متعلق بـ يُرْضِعْنَ ، أي هذا الحكم لمن أراد إتمام الرضاع أو يرضعن لأجل من أراد إتمام الرضاع أو يرضعن لأجل من أراد إتما الرضاع فعلم أن تمام مدة الرضاع حولان فقط كما قال صاحب البيضاوي تحت هذا القول وهو دليل على أن أقصى مدة الرضاع حولان ولا عبرة به بعدهما وإنه يجوز أن ينقص عنه. ملخص من التفسيرات الأحمدية والتعليق الممجد.

٦ قوله : وحمله وفصاله ثلاثون شهرا: ذهب أبو حنيفة رحمه الله إلى أن أكثر مدة الرضاع حولان ونصف حول، وبيانه على ما في الداية أن قوله تعالى ثلاثون شهرا خبر عن كل واحد من الحمل والفصال فكأنه قيل: مدة الحمل ثلاثون شهرا ومدة الفصال ثلاثون شهرا، فكانت الآية لبيان أكثر كلتا المدتين لكن لما وجد المنقص لمدة الحمل، وهو قول عائشة : والله لا يبقي الولد في البطن أكثر من سنتين، ولم يوجد في حق مدة الرضاع حكم أبي حنيفة بأن أكثر مدة الحمل سنتان، ومدة الفصال ثلاثون شهرا، أو الحمل الحمل على الأيدي لا الحمل في البطن وأما أبو يوسف ومحمد والشافعي فذهبوا إلى أن أكثر مدة الرضاع سنتان؛ لأن قوله تعالى: {ثَلٰثُونَ شَهْرًا} خبر عن مجموع الحمل والفصال، يعني أن مجموع الحمل والفصال ثلاثون شهرًا ، فاشتبه تعيين المقدار في حق كل منهما، وكان قوله تعالى في موضع آخر : {وَفِصَالُهُ فِي عَامَيْنِ}(لقمان: ١٤ وقوله تعالى: ﴿حَوْلَيْنِ كَامِلَيْنِ} بيانا؛ لأن مدة الفصال سنتان، والباقي وهو ستة أشهر يكون مدة الحمل؛ لأن أقل مدة الحمل ذلك بالاتفاق، فكان هذه الآية بيانا لأقل مدة الحمل وأكثر مدة الرضاع، وقال القاضي: ولعل تخصيص أقل الحمل وأكثر الرضاع الانضباطهما، وتحقق ارتباط حكم النسب والرضاع بهما، هذا لفظه، ملتقط من التفسيرات الأحمدية» و«المدارك». قلت: ويؤيد قولهما حديث الدارقطني لا رضاع إلا ما كان في الحولين.

٧قوله : لا من حل لهم ولا هم يحلون لهن: لوقوع الفرقة بينهما بخروجها مسلمة. قاله في «المدارك»، يعني لوقوع الفرقة باختلاف الدارين.
