بَابُ الْوَلِيِّ فِي النِّكَاحِ وَاسْتِثْنَانِ الْمَرْأَةِThe Guardian in Marriage and the Woman’s Consent
وَقَوْلِ الله عز وجل: {حَتَّى۱ تَنكِحَ زَوْجًا غَيْرَهُ} (البقرة: ۲۳۰) ، وَقَوْلِهِ تَعَالَى: {أَن يَنكِحْنَ أَزْوَاجَهُنَّ} (البقرة: ۲۳۲ ، وَقَوْلِهِ تَعَالَى: ﴿فَلَا جُنَاحَ عَلَيْكُمْ فِيمَا فَعَلْنَ فِي أَنفُسِهِنَّ} (البقرة: ٢٣٤)
۱ قوله: حتى تنكح إلخ : أضاف العقد في هذه الآيات إليهن، فدل على أنها تملك المباشرة بالنكاح مع أن النكاحتصرف في خالص حقها، وهي من أهله؛ لكونها عاقلة بالغة، ولهذا أجاز له التصرف في الأموال، واختيار الأزواج اتفاقا فلا معنى؛ لعدم انعقاده بعبارتها، ولاشتراط الولي لصحته غاية ما في الباب أن يكون للولي حق الاعتراض إذا قصرت في أمر بأن تزوجت بغير كفؤ أو بأقل من مهر المثل، وأحاديث الخصوم عندنا محمولة على النكاح الغير المكلفة، ومن لا يملك التصرف جمعا بين الأدلة أو على نفي الكمال ونفي اللزوم، ويؤيده أن عائشة له ، وهي أحد رواة حديث اشتراط الولي، زوجت حفصة بنت أخيها عبد الرحمن، وهو غائب بالشام، كما أخرجه مالك في الموطأ. كذا في عمدة الرعاية».
And the saying of Allah, the Mighty, the Exalted: “And live with them in kindness. For if you dislike them, perhaps you dislike a thing and Allah makes therein much good” [An-Nisa: 19], and His saying, the Exalted: “And they have rights similar to those against them in a just manner, and men have a degree over them. And Allah is Mighty, Wise” [Al-Baqarah: 228], and His saying, the Exalted: “As for those from whom you fear rebellion, admonish them and forsake them in bed and strike them. Then if they obey you, seek no means against them. Indeed, Allah is Exalted, Great” [An-Nisa: 34].
1 The statement: “And live with them in kindness, etc.”: This means to treat women with kindness, such as providing maintenance, speaking gently, and other good conduct. If you dislike them due to their bad character or appearance, be patient with them and do not separate from them, for in what you dislike, there may be much good, such as abundant reward, righteous offspring, or other benefits. The phrase “perhaps you dislike” is placed as the reason for the implied command to be patient, as explained in Tafsir al-Ahmadiyyah.2 The statement: “And they have rights similar to those against them in a just manner”: This indicates the mutual rights of the husband and wife. The husband’s rights over the wife include her service, respect, refraining from objecting to him, complete obedience to his commands, submission to him in all matters, and not preventing intimacy during menstruation or postpartum. The wife’s rights over the husband include maintenance, clothing, payment of the dowry as specified in fiqh, and teaching her the laws and rulings of the religion. Although the husband and wife are equal in rights, men have a degree over them, meaning an additional right and virtue due to their responsibility for expenditure, authority in marriage, divorce, revocation, inheritance, and similar matters, as in Tafsir al-Ahmadiyyah.3 The statement: “As for those from whom you fear rebellion”: This refers to their turning away or disobedience. Admonish them by advising them to obey. If advice does not work, forsake them in bed, meaning do not share their blanket, engage in intimacy, or turn your back to them in bed. If forsaking does not work, strike them lightly, without causing harm or injury. If they then obey by ceasing rebellion after admonishment, forsaking, or striking, as clarified in “Then if they obey you” [An-Nisa: 34], do not seek means against them by rebuking or harming them. Instead, remove any blame from them and treat their past actions as if they did not occur, for one who repents from a sin is as one who has no sin. “Indeed, Allah is Exalted, Great” [An-Nisa: 34], meaning He has greater power over you than you have over your wives, as in Tafsir al-Ahmadiyyah.
عن أَبِي هُرَيْرَةَ(رضي الله عنه)، قَالَ : قَالَ رَسُولُ اللهِ ﷺ : «لَا تُنْكَحُ۱ الْأَيِّمُ حَتَّى تُسْتَأْمَرَ وَلَا تُنْكَحُ۲ الْبِكْرُ حَتَّى تُسْتَأْذَنَ قَالُوا : يَا رَسُولَ اللهِ، وَكَيْفَ إِذْنُهَا؟ قَالَ: «أَنْ تَسْكُتَ». مُتَّفَقٌ عَلَيْهِ.
وَفِي رِوَايَةِ مُسْلِمٍ عَنْ عَائِشَةَ هِ أَنَّ۳ النَّبِيَّ ﷺ تَزَوَّجَهَا وَهِيَ بِنْتُ سَبْعِ سِنِينَ، وَزُفَتْ إِلَيْهِ وَهِيَ بِنْتُ تِسْعِ سِنِينَ، وَلُعَبُهَا مَعَهَا، وَمَاتَ عَنْهَا وَهِيَ بِنْتُ ثَمَانَ عَشْرَةَ.
Abu Hurayrah (may Allah be pleased with him) narrated: The Messenger of Allah (ﷺ) said: "A widow is not to be married until she is consulted, nor a virgin until her permission is sought." They said: "O Messenger of Allah, how is her permission?" He said: "That she remains silent" [Agreed upon]. In a narration by Muslim from Aishah (may Allah be pleased with her), the Prophet (ﷺ) married her when she was seven years old, she was brought to him when she was nine, her toys were with her, and he passed away when she was eighteen

1 The statement: "A widow is not to be married until she is consulted" Know that the dispute between us and the Shafi‘is and others here concerns two issues. The first is whether a marriage contract is valid with a woman’s expression, whether she can undertake it herself without a guardian if she is mature, or whether it is invalid and impermissible. Ash-Shafi‘i and Ahmad hold that it is invalid and impermissible, citing: Do not prevent them from marrying their husbands [Al-Baqarah: 232], arguing that the address is to the guardians, as narrated from Ma‘qil ibn Yasar, who prevented his sister from marrying her husband, so the verse was revealed. Thus, it is understood that marriage is in the hands of the guardian who undertakes it, supported by the Hadiths in this chapter, such as Aishah’s narration: "Any woman who marries without her guardian’s permission, her marriage is void," repeated thrice, narrated by Abu Dawud, An-Nasa’i, Ibn Majah, and At-Tirmidhi, who deemed it good. Also, by reason, marriage aims at its objectives, and delegating it to women is inappropriate, as they are deficient in intellect and religion, quick to be deceived, and poor in choice. Abu Hanifah and his companions, however, ultimately hold that it is valid and permissible in the apparent narration, though the guardian can object if the match is unequal, supported by the Hadiths forthcoming in the book and by what Muslim and others narrated: "The widow is more entitled to herself than her guardian, and the virgin is consulted about herself." The widow is one without a husband, whether virgin or previously married, divorced, or widowed, which is its linguistic meaning and intended here. A non-mature woman is excluded by consensus. The true meaning is preferred as long as possible, and metaphor is disregarded due to the possibility of the true meaning and the absence of a metaphorical clue, which is the contrast with the virgin. It is only considered after the true meaning is impossible. Thus, it does not mean an elderly woman. In either case, it is an absolute truth, encompassing permission, choice, undertaking, and executing the contract, as in other contracts, contradicting Ash-Shafi‘i’s view with the Exalted’s sayings: until she marries another husband [Al-Baqarah: 230], that they marry their husbands [Al-Baqarah: 232], and there is no blame upon you for what they do with themselves by what is right [Al-Baqarah: 234]. Also, what Abdul Razzaq narrated from Khansa’s Hadith: "Marry whomever you wish." The default in attribution is to the actual doer, and one does not resort to rational or elliptical metaphor unless necessary, which is not the case here, supported by the Hadiths we narrated, which state that guardians or fathers have no authority over a mature widow or previously married woman. The response to Ash-Shafi‘i’s arguments: As for the verse, the address is to the husbands, as clarified by the preceding: When you divorce women and they reach their term [Al-Baqarah: 231]. Making the address to the guardians contradicts the Qur’an’s text and its explicit context, as Al-Fakhr ar-Razi established in his exegesis, and some prominent Dehlawi scholars chose in "Al-Musaffa Sharh al-Muwatta." As for the Hadiths, they are weak, containing unknowns and weak narrators. Moreover, As-Suyuti, the Shafi‘i, in "Qut al-Mughtadhi Sharh at-Tirmidhi," regarding: "No marriage except with a guardian," said the majority interpreted it as negating validity, while Abu Hanifah interpreted it as negating perfection. Thus, it is recommended for us that a woman’s marriage be through a guardian, and for one without a guardian, it is the judge. As for the rational response, choice in transactions is achieved by maturity. Indeed, in marrying an unequal match, there is a semblance of poor choice, so the guardian has the right to object. This is the detailed auditory and rational arguments from both sides, and the issue’s verification is sought from "Al-Binayah," "Fath al-Qadir," and the commentaries of Bukhari and Muslim. The second issue is whether a mature virgin can be compelled by the guardian in marriage, as with a non-mature virgin, or not. The Shafi‘is hold the former, the Hanafis the latter. The default is that the compelling guardianship’s reason, for us, is minority, and for them, virginity. The issue is detailed in the mentioned books, auditorily and rationally, so seek it there. The narrated Hadiths in the book support the Hanafi view in several ways, evident upon reflection. Umm Salamah’s marriage without a guardian, as narrated by the Sunan compilers, supports the Hanafis in the first issue. As for her son, he was young by consensus. When she stated the excuse that she had no guardian, the Prophet (ﷺ) refuted it, saying none of the guardians, present or absent, would disapprove. Thus, it is understood that the guardian is not a pillar of the contract but part of its completion and perfection, as Az-Zuhri and others said, so understand, taken from "Tansiq an-Nizam" 2 The statement: "A virgin is not to be married until her permission is sought" For this reason, it is stated in "Sharh al-Wiqayah": Compelling guardianship is established for a minor female, not a mature one, according to us. According to Ash-Shafi‘i, it is established for a virgin, not a previously married woman. Thus, a minor virgin is compelled by consensus, not a mature previously married woman by consensus. A mature virgin is not compelled according to us but is compelled according to him. A minor previously married woman is compelled according to us, not according to him. According to us, every guardian has compelling guardianship, while according to Ash-Shafi‘i, the compelling guardian is only the father or grandfather 3 The statement: "The Prophet (ﷺ) married her when she was seven years old, etc." This Hadith is cited to prove that a father may marry his minor daughter without her permission. The Hadith: "A widow is not to be married until she is consulted, and a virgin is not to be married until her permission is sought," in its generality, makes an exception for the minor due to Aishah’s story (may Allah be pleased with her). The guardian’s marrying a minor male or female compulsorily is also supported by the Hadith: "No marriage except with a guardian," which, according to us, is interpreted as referring to this compelling guardianship to reconcile the evidence, taken from "Nayl al-Awtar" and "Umdat ar-Ri‘ayah"
۱ قوله: لا تنكح الأيم حتى تستأمر : اعلم أن الخلاف بيننا وبين الشافعية وغيرهم ههنا في موضعين، الأول: أن النكاح هل ينعقد بعبارة النساء، وهل يجوز أن تستولاه بنفسها بلا ولي، إذا كانت بالغة، أو لا يجوز، ولا ينعقد، فالشافعي وأحمد ذَهَبًا إلى عدم الانعقاد والجواز؛ استدلالا بقوله تعالى:﴿فَلَا تَعْضُلُوهُنَّ أَن يَنكِحْنَ أَزْوَاجَهُنَّ) (البقرة: ۲۳۲) بناء على أن الخطاب للأولياء، على ما روي عن معقل بن يسار أنه منع أخته عن نكاح زوجها، فنزلت فلو لم يكن للولي مدخل لم يكن للنهي عن العضل معنى، فعلم أن النكاح بيد الولي وأنه يتولاه، وبالأحاديث الواردة في هذا الباب كحديث عائشة مرفوعا : أيما امرأة نكحت بغير إذن وليها فنكاحها باطل ، فقالها ثلاثا، أخرجه أبو داود والنسائي وابن ماجه والترمذي وحسنه.
وحديث أبي موسى مرفوعا: لا نكاح إلا بولي، أخرجه الترمذي وغيره، وحديث ابن مسعود رواه رواه الدارقطني في سننه، وابن عمر رواه فيها لا نكاح إلا بولي وشاهدي عدل، وحديث أنس: لا نكاح إلا بولي ، رواه الحاكم، وحديث عمران بن حصين: لا يجوز النكاح إلا بولي وشاهدي عدل، رواه البيهقي، وحديث أبي هريرة مرفوعا: لا تزوج المرأة المرأة، ولا تزوج المرأة نفسها، فإن الزانية هي التي تزوج نفسها ، رواه ابن ماجه.
وحديث معاذ بن جبل مرفوعا: أيما امرأة تزوجت بغير ولي فهي زانية، رواه ابن عدي، وحديث جابر مرفوعا: لا نكاح إلا بولي، فإن اشتجروا فالسلطان ولي من ولا ولي له، رواه الطبراني في الأوسط، وحديث علي اليد مرفوعا: أيما امرأة تزوجت بغير إذن وليها فنكاحها باطل، الحديث رواه ابن عدي في الكامل». وفي الباب أيضًا عن ابن عمر وأبي ذر والمقداد والمسور بن مخرمة وأم سلمه وزينب بنت جحش .
وبالمعقول وهو أن النكاح يراد المقاصده، والتفويض إليهن بها؛ لأنهن ناقصات عقل ودين، سريعات الاغترار سيئات الاختيار، وأبو حنيفة وصحاباه آخرًا ذهبوا إلى الانعقاد والجواز مطلقا في ظاهر الرواية، لكن للولي الاعتراض في غير الكفؤ، واستدلت الحنفية بالأحاديث الآتية في الكتاب بعد، وبما أخرجه مسلم وغيره الأيم أحق بنفسها من وليها، والبكر تستأذن في نفسها، والأيم: من لا زوج لها، بكرا كانت أو ثيبا، مطلقة أو متوفى عنها زوجها، وهذا هو معناه اللغوي، وهو المراد هنا، وغير البالغة مستثناة بالإجماع، فيراد المعنى الحقيقي ما أمكن، ويسقط المجاز لإمكان الحقيقة وقرينة المجاز، وهو مقابلة البكر، إنما تعتبر بعد تعذر الحقيقة، فلا يراد به الشيب.
ثم على كلا التقديرين حقيقة مطلقة، فتتناول الإذن والاختيار والتولي ومباشرة العقد، كما في سائر العقود، فينافي مذهب الشافعي بأقواله تعالى: حَتَّى تَنكِحَ زَوْجًا غَيْرَةُ (البقرة: ۲۳۰ و أَن يَنكِحْنَ أَزْوَاجَهُنَّ} (البقرة: ۲۳۲)، و فَلا جُنَاحَ عَلَيْكُمْ فِيمَا فَعَلْنَ فِي أَنفُسِهِنَّ بِالْمَعْرُوفِ (البقرة: ٢٣٤ ، وبما أخرجه عبد الرزاق من حديث خنساء الكحي من شئت، والأصل في النسبة أن تكون إلى الفاعل حقيقة، ولا يصار إلى المجاز العقلي أو المجاز بالحذف إلا بضرورة، وليست ههنا، وبما روينا من الأحاديث، وفيها أنه ليس للأولياء أو الآباء أمر في حق الأيم أو الثيب البالغة.
والجواب عن وجوه الشافعي أما عن الآية: فلأن الخطاب إنما هو للأزواج كما يفصح عنه قوله قبله: وَإِذَا ظَلَّلْتُمُ النِّسَاءَ فَبَلَغْنَ أَجَلَهُنَّ ) (البقرة: ۲۳۱ ، وجعل الخطاب إلى الأولياء خلاف نص القرآن، وصريحه في سياقه، وحققه الفخر الرازي في تفسيره، واختاره بعض مشاهير الدهلي في المصفى شرح الموطأ»، وأما الجواب عن الأحاديث: فهو أنها ضعاف فيها مجاهيل وضعفاء، علا أنه قال السيوطي الشافعي في قوت المغتدي شرح الترمذي في قوله : لا نكاح إلا بولي، حمله الجمهور على نفي الصحة، وأبو حنيفة على نفي الكمال، فيستح عندنا أن يكون زواج المرأة على يد الولي، ومن لم يكن له قوليه القاضي. وأما الجواب من المعقول فلا من الاختار في التصرفات يحصل بالبلوغ. نعم، في نكاح غير الكفؤ شبهة سوى لاختيار، فلذا كان فلأن للولي الاعتراض فيه، هذا تفصيل الوجوه السمعية والعقلية من الطرفين، وتحقيق المسألة على وجه الصواب، يطلب من البناية» و«فتح القدير» وشروحالبخاري ومسلم.
والمقام الثاني: أن البكر البالغة هل يمكن إجبار الولي عليها في النكاح، كما في البكر الغير البالغة أو لا، فذهب الشافعية إلى الأول، والحنفية إلي الثاني، والأصل أن علة الولاية المجبرة عندنا الصغر، وعنده البكارة، والمسألة مفصلة في الكتب المذكورة سمعا وعقلا فليطلب منها، والأحاديث المروية في الكتاب تؤيد مذهب الحنفية بوجوه عديدة تظهر بعد التأمل، ثم نكاح أم سلمة بغير ولي ما رواه أصحاب السنن يؤيد الحنفية في المقام الأول، وأما ابنها فكان صغيرا بالاتفاق، وإذا بينت العذر أن ليس لها ولي دفعه النبي بأن ليس من الأولياء حاضر ولا غائب، ولا يرضى بهذا الأمر، فعلم أن ليس الولي من أركان العقد، بل من تمامه وكماله، كما قاله الزهري وغيره، فافهم، أخذته من تنسيق النظام».
۲قوله : لا تنكح البكر حتى تستأذن : لذلك قال في شرح الوقاية»: إن ولاية الإجبار ثابتة على الصغيرة دون البالغة عندنا، وعند الشافعي ثابتة على البكر دون الثيب، فالبكر الصغيرة تجبر اتفاقا لا الثيب البالغة اتفاقا، والبكر البالغة لا تجبر عندنا، وتجبر عنده، والثيب الصغيرة تجبر عندنا لا عنده، ثم عندنا كل ولي فله ولاية الإجبار، وعند الشافعي الولي المجبر ليس إلا الأب والجد.
۳قوله: إن النبي ﷺ تزوجها وهي بنت سبعين سنين إلخ : الحديث، أورده للاستدلال به على أنه يجوز للأب أن يزوج ابنته الصغيرة بغير استئذانها، فحديث لا تنكح الأيم حتى تستأمر، ولا تنكح البكر حتى تتستأذن على عمومه، رخص منه الصغيرة لقصة عائشة اله، وللولي إنكاح الصغير والصغيرة جبرا الحديث: لا نكاح إلا بولي أيضا، فإنه عندنا محمول على هذه الولاية الجبرية جمعًا بين الأدلة ملتقط من نيل الأوطار» و «عمدة الرعاية».
وَعَنِ ابْنِ عَبَّاسٍ (رضي الله عنه) أَنَّ النَّبِيَّ ﷺ قَالَ: «الْأَيِّمُ۱ أَحَقُّ بِنَفْسِهَا مِنْ وَلِيِّهَا، وَالْبِكْرُ تُسْتَأْذَنُ فِي نَفْسِهَا وَإِذْنُهَا صُمَاتُهَا». وَفِي رِوَايَةٍ: «وَالْبِكْرُ۲ يَسْتَأْذِنُهَا أَبُوهَا فِي نَفْسِهَا وَإِذْنُهَا صُمَاتُهَا. رَوَاهُ مُسْلِمٌ.
Ibn Abbas (may Allah be pleased with them) narrated: The Prophet (ﷺ) said: "A widow is more entitled to herself than her guardian, and a virgin is consulted about herself, and her permission is her silence." In another narration: "And a virgin, her father consults her about herself, and her permission is her silence" [Narrated by Muslim]

1 The statement: "A widow is more entitled to herself, etc." means more than her guardian in everything, including the contract and otherwise, as Abu Hanifah said, as stated in "Al-Marqah." Shaykh Ibn al-Humam said: The mentioned Hadith is opposed by: "No marriage except with a guardian." The widow is one without a husband, virgin or previously married. The proof is that it establishes for each a right, and for the guardian, within the statement "more entitled," it is known that the guardian has only the execution of the contract if she consents, and she is made more entitled to it than him. After this, either this Hadith and what they narrated are reconciled by preference or combination. On the first, this prevails due to the strength of its chain and lack of dispute in its authenticity, unlike: "No marriage except with a guardian," which is weak and inconsistent in its chain, connection, disconnection, and transmission. Also, Aishah’s Hadith (may Allah be pleased with her): "Any woman who marries without her guardian’s permission, her marriage is void, void, void," which Az-Zuhri denied. At-Tahawi said: Ibn Jurayj asked Ibn Shihab about it, and he did not recognize it. On the second, by applying combination, its generality is specified, which is common. This specifies Abu Musa’s Hadith (may Allah be pleased with him): "No marriage except with a guardian," after allowing the negation to be for perfection and Sunnah, which is the interpretation of her statement: "For women do not undertake or marry," in Al-Bayhaqi’s narration, meaning no marriage except with one who requires permission, i.e., no marriage except for one with guardianship, to negate the marriage of a non-Muslim to a Muslim woman, an insane woman, a slave woman, or a slave man, as marriage in the Hadith is general, not restricted. It specifies Aishah’s Hadith for one who married an unequal match, as stated. In "Sharh Jami‘ al-Jawami‘," the Hanafis interpreted it for the minor, the slave woman, and the partially freed slave woman 2 The statement: "And a virgin, her father consults her, etc." The apparent Hadiths of this chapter indicate that if a mature virgin is married without her permission, the contract is invalid, as held by Al-Awza‘i, Ath-Thawri, Al-Utrah, and the Hanafis, narrated by At-Tirmidhi from most scholars. Malik, Ash-Shafi‘i, Al-Layth, Ibn Abi Layla, Ahmad (‘anhum), and Ishaq held that a father may marry her without permission, countered by the Hadiths in this chapter stating: "And a virgin, her father consults her," and also countered by Abdullah ibn Buraydah’s Hadith, as stated in "Nayl al-Awtar"
۱قوله: الأيم أحق بنفسها إلخ : يراد به من وليها في كل شيء من العقد وغيره، كما قال أبو حنيفة. كذا في «المرقاة». وقال الشيخ ابن الهمام: الحديث المذكورة معارض بقوله : لا نكاح إلا بولي، والأيم: من لا زوج لها بكرا كانت أو ثيبا، ووجه الاستدلال أنه أثبت لكل منها، ومن الولي حقا في ضمن قوله أحق ومعلوم أنه ليس للولي سوى مباشرة العقد إذا رضِيت، وقد جعلها أحق منه به، وبعد هذا إما أن يجري بين هذا الحديث، وما رووا حكم المعارضة والترجيح أو طريقة الجمع، فعلى الأول يترجح هذا بقوة السند وعدم الاختلاف في صحته، بخلاف حديث: لا نكاح إلا بولي؛ فإنه ضعيف مضطرب في إسناده، وفي وصله وانقطاعه وإرساله، وكذا حديث عائشة (رضي الله عنها) أيما امرأة نكحت بغير إذن وليها فنكاحها باطل فنكاحها باطل فنكاحها باطل، وقد أنكره الزهري، قال الطحاوي: وذكر ابن جريج أنه سأل عنه ابن شهاب فلم يعرفه، وعلي الثاني وهو إعمال طريقه الجمع فبأن يحمل عمومه على الخصوص، وذلك شائع، وهذا يخص حديث أبي موسى (رضي الله عنه)لا نكاح إلا بولي، بعد جواز كون النفي للكمال والسنة، وهو محمل قولها : فإن النساء لا تلي ولا ينكحن في رواية البيهقي بأن يراد بالولي من يتوقف على إذنه، أي لا نكاح إلا ممن له ولاية؛ لينفي نكاح الكافر المسلمة والمعتوهة والأمة والعبد أيضًا؛ لأن النكاح في الحديث عام غير مقيد، ويخص حديث عائشة بمن نكحت غير الكفؤ، انتهى. وفي شرح جمع الجوامع حمله الحنفية على الصغيرة والأمة والمكاتبة.
۲قوله والبكر يستأذنها أبوها إلخ : ظاهر أحاديث الباب أن البكر البالغة إذا زوجت بغير إذنها لم يصح العقد، وإليه ذهب الأوزاعي والثوري والعترة والحنفية، وحكاه الترمذي عن أكثر أهل العلم، وذهب مالك والشافعي والليث وابن أبي ليلى وأحمد وإسحاق إلى أنه يجوز للأب أن يزوجها بغير استئذان ويرد عليهم ما في أحاديث الباب من قوله: والبكر يستأمرها أبوها ويرد عليهم أيضًا حديث عبد الله بن بريدة. كذا في نيل الأوطار».
وَعَنْ أَبِي هُرَيْرَةَ (رضي الله عنه)، قَالَ: قَالَ رَسُولُ اللهِ ﷺ: «الْيَتِيمَةُ۱ تُسْتَأْمَرُ فِي نَفْسِهَا، فَإِنْ صَمَتَتْ فَهُوَ إِذْنُهَا، وَإِنْ أَبَتْ فَلَا جَوَازَ عَلَيْهَا . رَوَاهُ التَّرْمِذِيُّ وَأَبُو دَاوُدَ وَالنَّسَائِيُّ. وَرَوَاهُ الدَّارِمِيُّ عَنْ أَبِي مُوسَى.

۱قوله: اليتيمة إلخ : هي صغيرة لا أب لها، والمراد هنا البكر البالغة سماها باعتبار ما كانت كقوله تعالى: ﴿وَءَاتُوا الْيَتٰمٰى أَمْوَالَهُم) (النساء: ۲ وفائدة التسمية مراعاة حقها والشفقة عليها في تحري الكفاية والصلاح، فإن اليتيم مظنة الرأفة والرحمة، ثم هي قبل البلوغ لا معنى لإذنها ولا لآبائها، فكأنه شرط بلوغها، فمعناه: لا تنكح حتى تبلغ فتستأمر أي تستأذن. كذا في «المرقاة».

Abdullah ibn Buraydah, from his father (may Allah be pleased with him), narrated: A girl came to the Messenger of Allah (ﷺ) and said: "My father married me to his nephew to elevate his lowly status." He gave her the matter. She said: "I have approved what my father did, but I wanted women to know that fathers have no authority in the matter" [Narrated by Ibn Majah, Ahmad, and An-Nasa’i from Ibn Buraydah’s Hadith]

1 The statement: "He gave her the matter, etc." This is evidence for Abu Hanifah (may Allah have mercy on him) on a mature woman marrying herself and not being compelled, as stated in "Tansiq an-Nizam" 2 The statement: "I have approved what my father did, etc." The unauthorized agent in jurists’ terminology is one who is neither a proxy nor a messenger. If he marries a man or a woman without their permission, the contract is, according to us, suspended. If approved, it is valid; if rejected, it is void. Ash-Shafi‘i said the unauthorized agent’s marriage is void due to lack of guardianship, as the executor cannot establish the ruling, which is ownership, so it is null due to lack of benefit. For us, it is supported by what was narrated that he gave the matter of the woman married by her father without her permission to her, and she said: "I have approved what my father did, I only wanted to know if women have any authority in the matter." Also, because the contract was issued by its people, attributed to its subject, and there is no harm in its conclusion, so it must be deemed concluded. If he sees the benefit, he approves it. ۲قوله: قد أجزت من صنع أبي الخ: الفضولي في عرف الفقهاء من ليس بوكيل ولا رسول، فإنه إذا زوج رجلا بغير إذنه، أو امرأة بغير إذنها، ينعقد عندنا موقوفا، فإن أجازه جاز وإلا بطل، وقال الشافعي نكاح الفضولي باطل؛ لعدم الولاية؛ لأن المباشر لا يقدر على إثبات الحكم ووهو الملك فيلغو؛ لعدم الفائدة. ولنا ما روي أنه جعل أمر المرأة التي زوجها أبوها بغير إذنها إليها فقالت: قد أجزت ما صنع إبى، إنما أردت لا علم هل للنساء من الأمر شيء، ولأن العقد صدر من أهله مضافًا إلى محله، ولا ضرر في انعقاده، فوجب القول بانعقاده حتى إن رأى المصلحة أجازه، وقد يتراخى حكم العقد عنه كالبيع بشرط الخيار، فيتم صونًا لكلام المتعاقدين، ويتوقف حكمه دفعا للضرر عنه، وبه قال أحمد في رواية. كذا في العيني» و «فتح المعين».

Aishah (may Allah be pleased with her), the Prophet’s wife, narrated: She married Hafsah, the daughter of Abdul Rahman, to Mundhir ibn az-Zubayr, while Abdul Rahman was absent in Sham. When Abdul Rahman arrived, he said: "Is this done to someone like me, and preempted?" Aishah spoke to Mundhir about it, and Mundhir said: "It is in Abdul Rahman’s hands." Abdul Rahman said: "I would not undo a matter you have decided." So Hafsah remained with him, and it was not a divorce [Narrated by As-Sahawi, and Malik narrated similarly in "Al-Muwatta"]

Umm Salamah (may Allah be pleased with her) narrated: The Messenger of Allah (ﷺ) came to me after Abu Salamah’s death and proposed to me directly. I said: "O Messenger of Allah, none of my guardians are present." He said: "None of them, present or absent, would dislike it." She said: "Rise, O Umar, and marry the Prophet (ﷺ)." So he married her [Narrated by At-Tahawi]

1 The statement: "He proposed to me directly, etc." At-Tahawi said: This Hadith shows that the Messenger of Allah (ﷺ) proposed to her directly, indicating that the authority in marriage is hers, not her guardians’. She said to him: "None of my guardians are present." He said: "None of them, present or absent, would dislike it." She said: "Rise, O Umar! Marry the Prophet (ﷺ)." Umar was her son, then a young, non-mature child, as she said in this Hadith: "I am a woman with orphans," meaning Umar, her son, and Zaynab, her daughter. A child has no guardianship, so she delegated him to execute the marriage contract for her, and he did so. The Prophet (ﷺ) deemed it permissible. Umar, with that delegation, stood in place of the one who delegated him. Thus, Umm Salamah was as if she executed the marriage contract for herself to the Prophet (ﷺ). Since the Prophet (ﷺ) did not wait for her guardians’ presence, it indicates that her person is hers, not theirs. ۱قوله: فخطبني إلى نفسي إلخ : قال الطحاوي فكان في هذا الحديث أن رسول الله ﷺ خطبها إلى نفسها، ففي ذلك دليل على أن الأمر في التزويج إليها دون أوليائها، فإنما قالت له: إنه ليس أحد من أوليائي شاهدا قال: إنه ليس منهم شاهد ولا غائب يكره ذلك، فقالت: قم يا عمر ! فزوج النبي الله وعمر هذا ابنها، وهو يومئذ طفل صغير غير بالغ؛ لأنها قد قالت للنبي ﷺ في هذا الحديث: إني امرأة ذات أيتام، يعني عمر ابنها وزينب بنتها، والطفل لا ولاية له، فولته هي أن يعقد النكاح عليها، ففعل، فرآه النبي جائزا، وكان عمر بتلك الوكالة قام مقام من وكله، فصارت أم سلمة يا كأنها هي عقدت النكاح على نفسها للنبي الله ، ولما لم ينتظر النبي ﷺ حضور أوليائها دل ذلك أن بضعها إليها دونهم، ولو كان لهم في ذلك حق أو أمر لما أقدم النبي ﷺ على حق هو لهم قبل إباحتهم ذلك له.
وأما النظر في ذلك فإنا قد رأينا المرأة قبل بلوغها يجوز أمر والدها عليها في بضعها ومالها، فيكون العقد في ذلك كله إليه لا إليها، وحكمه في ذلك كله حكم واحد غير مختلف، فإذا بلغت فكل قد أجمع أن ولايتها على مالها قد ارتفعت، وإن ما كان إليه من العقد عليها في مالها في صغرها قد عاد إليها، فالنظر على ذلك أن يكون كذلك العقد على بضعها يخرج ذلك من يد أبيها ببلوغها، فيكون ما كان إليه من ذلك قبل بلوغها، فدعاء إليها، ويستوي حكمها في مالها وفي بضعها بعد بلوغها، فيكون ذلك إليها دون أبيها، ويكون حكمها مستويا بعد بلوغها، كما كان مستويا قبل بلوغها.

Abu Salamah ibn Abdul Rahman (may Allah be pleased with him) narrated: Abdullah ibn Abbas and Abu Hurayrah were asked about a pregnant woman whose husband dies. Ibn Abbas said: "The later of the two terms." Abu Hurayrah said: "When she gives birth, she becomes permissible." Abu Salamah ibn Abdul Rahman went to Umm Salamah, the Prophet’s wife (ﷺ), and asked her about it. Umm Salamah said: Subay‘ah al-Aslamiyyah gave birth half a month after her husband’s death. Two men proposed to her: one young, one elderly. She inclined toward the young man. The elderly man said: "You are not yet permissible." Her family was absent, and he hoped when they arrived, they would prefer him for her. She came to the Messenger of Allah (ﷺ) and mentioned it to him. He said: "You are permissible, so marry whomever you wish" [Narrated by Malik in "Al-Muwatta"]

وَفِي رِوَايَةٍ لِلدَّارَقُطْنِي عَنِ ابْنِ عَبَّاسِ لا أَنَّ النَّبِيَّ ﷺ رَدَّ نِكَاحَ بِكْرٍ وَثَيِّبٍ أَنْكَحَهُمَا أَبُوهُمَا وَهُمَا كَارِهَتَانِ، فَرَدَّ النَّبِيُّ ﷺ نِكَاحَهُمَا.
Khansa (may Allah be pleased with her) narrated: My father married me while I was unwilling, and I was a virgin. I complained about it to the Prophet (ﷺ), and he said: "Do not marry her while she is unwilling" [Narrated by An-Nasa’i in his "Sunan"]. In a narration by Ad-Daraqutni from Ibn Abbas, the Prophet (ﷺ) annulled the marriage of a virgin and a previously married woman whom their father married while they were unwilling, so the Prophet (ﷺ) annulled their marriage

1 The statement: "From Khansa, etc." Muhammad narrated in "Al-Muwatta," and Abu Dawud, An-Nasa’i, and Ibn Majah narrated Khansa bint Khidham’s Hadith, and in most of them: "She was previously married." It was narrated from Abdullah ibn Yazid ibn Wadi‘ah from Khansa that she was then a virgin. Here, Malik’s narration from Abdul Rahman and Majma‘, that she was previously married, conflicts with Ibn al-Mubarak’s narration from Abdullah that she was a virgin. I say: There is no conflict requiring preference. It is possible that this incident happened to her twice: once when she was a virgin, then when she was previously married. This is easier than rejecting a sound Hadith with this weak excuse, especially since the one saying she was previously married, Abdul Rahman and Majma‘, sons of Yazid, and the one saying she was a virgin is Khansa herself. ۱قوله: عن خنساء إلخ : أخرج محمد في الموطأ» وأبو داود والنسائي وابن ماجه حديث خنساء بنت خذام، وفي أكثرها: وهي ثيب، وروي عن عبد الله بن يزيد بن وديعة عن خنساء أنها كانت يومئذ بكرا، فيتعارض ههنا نقل مالك عن عبد الرحمن ومجمع في كونها ثيبا، ونقل ابن المبارك عن عبد الله أنها كانت بكرا. قلت: لا معارضة بينهما حتى يحتاح إلى الترجيح، فيحتمل أن يكون وقع لها هذه القصة مرتين، مرَّةً وقعت لها حال كونها بكرا، ثم وقعت لها حال كونها ثيبا، وهذا أهون من أن يرد الحديث الصحيح بهذا العذر الواهي، مع أن القائل بكونها ثيبا، وهو عبد الرحمن ومجمع ابني يزيد والقائلة بكونها بكرا هي خنساء نفسها، فلا يرجح قولهما بمقابلة قولها، أخذته من بذل المجهود».
وَعَنِ ابْنِ عَبَّاسٍ (رضي الله عنهما) قَالَ: إِنَّ جَارِيَةً بِكْرًا أَتَتْ رَسُولَ اللَّهِ ﷺ فَذَكَرَتْ أَنَّ أَبَاهَا زَوَّجَهَا وَهِيَ كَارِهَةٌ، فَخَيَّرَهَا۱ النَّبِيُّ ﷺ. رَوَاهُ أَبُو دَاوُدَ.

وَعَنْ أَبِي سَعِيدٍ (رضي الله عنه)، وَابْنِ عَبَّاسٍ قَالَا : قَالَ رَسُوْلُ اللَّهِ ﷺ: «مَنْ وُلِدَ لَهُ وَلَدٌ فَلْيُحْسِنِ اسْمَهُ وَأَدَبَهُ، فَإِذَا بَلَغَ فَلْيُزَوِّجْهُ، فَإِنَّ بَلَغَ وَلَمْ يُزَوِّجْهُ فَأَصَابَ إِثْمًا فَإِنَّمَا إِثْمُهُ عَلَى أَبِيْهِ».
Abu Sa‘id and Ibn Abbas (may Allah be pleased with them) narrated: The Messenger of Allah (ﷺ) said: "Whoever has a child born to him, let him give him a good name and good manners. When he matures, let him marry him. If he matures and is not married and commits a sin, its sin is upon his father" [Narrated by Al-Bayhaqi in "Shu‘ab al-Iman"]
وَعَنْ عُمَرَ بْنِ الْخَطَابِ وَأَنَسِ بْنِ مَالِكٍ(رضي الله عنه) عَنْ رَسُوْلِ اللَّهِ ﷺ قَالَ: «فِي التَّوْرَاةِ مَكْتُوبٌ: مَنْ بَلَغَتْ ابْنَتُهُ اثْنَتَيْ عَشْرَةَ سَنَةً وَلَمْ يُزَوِّجْهَا فَأَصَابَتْ إِثْمًا فَإِثْمُ۱ ذَلِكَ عَلَيْهِ. رَوَاهُمَا الْبَيْهَقِيُّ فِي شُعَبِ الْإِيْمَانِ».
Umar ibn al-Khattab and Anas ibn Malik (may Allah be pleased with them) narrated from the Messenger of Allah (ﷺ): "It is written in the Torah: Whoever has a daughter who reaches twelve years and does not marry her, and she commits a sin, its sin is upon him" [Narrated by Al-Bayhaqi in "Shu‘ab al-Iman"]

1 The statement: "Its sin is upon him" for his negligence, interpreted as a warning and threat for emphasis. It includes recommended guardianship to reconcile the Hadiths. Guardianship in marriage is of two types: recommended and desirable guardianship, which is over a rational, mature woman, virgin or previously married, and compelling guardianship, which is over a minor female, virgin or previously married, and also a mature insane or enslaved woman, taken from "Al-Marqah" and "Ad-Durr al-Mukhtar"

Ibn Abbas (may Allah be pleased with them) narrated: The Prophet (ﷺ) said: "The prostitutes are those who marry themselves without evidence." The most correct view is that it is stopped at Ibn Abbas [Narrated by At-Tirmidhi]

1 The statement: "The prostitutes, etc." The evidence means the witness, so without it, it is adultery according to Ash-Shafi‘i and Abu Hanifah. It is stated in "Al-Marqah." In "Umdat ar-Ri‘ayah": Requiring the presence of two witnesses is due to the Hadith: "No marriage except with a guardian and two just witnesses," narrated by Ibn Hibban in his "Sahih." At-Tirmidhi narrated elevated: "The prostitutes are those who marry themselves without evidence," and Abdul Razzaq narrated it stopped at Ibn Abbas. Other Hadiths in this chapter were narrated by Ad-Daraqutni and others, and though some chains are weak, the weakness is compensated by the multiplicity of paths. In "Al-Muwatta": Umar was brought a man in a marriage witnessed only by a man and a woman. Umar said: "This is a secret marriage, and we do not permit it. Had I preceded in it, I would have stoned." This distinguishes marriage from other contracts, which are valid without witnessing, though witnessing in them is recommended or Sunnah. Marriage, however, is not concluded without two witnesses, neither judicially nor religiously. Witnessing the delegation for marriage is not a condition for its validity, but its benefit is proof in case of denial of the delegation, as stated in "Al-Bahr." In "Al-Mabsut": If a man married a woman without witnesses or with one witness, then witnessed afterward, the marriage is not valid, as the condition is witnessing the contract, which was not met. What was witnessed was the acknowledgment of an invalid contract, and acknowledging an invalid contract is not a contract, nor does witnessing it turn the invalid into valid
۱ قوله: البغايا إلخ المراد بالبينة الشاهد، فبدونه زنا عند الشافعي وأبي حنيفة له. قاله في «المرقاة». وقال في عمدة الرعاية»: أما اشتراط حضور الشاهدين فلحديث: لا نكاح إلا بولي وشاهدي عدل، أخرجه ابن حبان في صحيحه، وأخرج الترمذي مرفوعا: البغايا اللاتي ينكحن أنفسهن بغير بينة، وأخرجه عبد الرزاق موقوفا على ابن عباس، وفي الباب أحاديث أخرجها الدار قطني وغيره، وسند بعضها وإن كان ضعيفًا، إلا أن الضعف انجبر بكثرة الطرق، وفي الموطأ»: أن عمر أتى برجل في نكاح لم يشهد عليه إلا رجل وامرأة، فقال عمر الله: هذا نكاح السر، ولا نجيزه، ولو كنت تقدمت فيه لرجمت، وبهذا فارق النكاح سائر العقود، فإنها تنفذ بغير إشهاد، ولكن الإشهاد فيها مستحب أو سنة.
وأما النكاح فلا ينعقد بدون حضور شاهدين، لا قضاءً ولا ديانة، وأما الشهادة على التوكيل بالنكاح فليست شرطا لصحته، وإنما فائدتها الاثبات عند جحود التوكيل. كذا في البحر انتهى. وقال في المبسوط: ولو تزوج امرأة بغير شهود أو بشاهد واحد، ثم أشهد بعد ذلك، لم يجز النكاح؛ لأن الشرط هو الإشهاد على العقد ولم يوجد، وإنما وجد الإشهاد على الإقرار بالعقد الفاسد، والإقرار بالعقد الفاسد ليس بعقد، وبالإشهاد عليه لا ينقلب الفاسد صحيحًا.
وَعَنْ جَابِرٍ(رضي الله عنه) عَنِ النَّبِيِّ ﷺ قَالَ: «أَيُّمَا عَبْدٍ تَزَوَّجَ بِغَيْرِ إِذْنِ مَوَالِيهِ فَهُوَ عَاهِرٌ.۱ رَوَاهُ التَّرْمِذِيُّ وَأَبُوْ دَاوُدَ وَالدَّارِمِيُّ.
وَفِي الْبَابِ عَنْ إِبْرَاهِيمَ قَالَ: إِذَا تَزَوَّجَ الْعَبْدُ بِغَيْرِ إِذْنِ مَوْلَاهُ فَنِكَاحُهُ فَاسِدٌ، وَإِنْ أَ ذِنَ لَهُ بَعْدَ مَا تَزَوَّجَ فَنِكَاحُهُ ثَابِتُ. رَوَاهُ مُحَمَّدُ فِي الْآثَارِ».
وَقَالَ: وَبِهِ نَأْخُذُ، وَإِنَّمَا يَعْنِي بِقَوْلِهِ : إِنْ أَذِنَ لَهُ بَعْدَ مَا تَزَوَّجَ يَقُوْلُ: إِنْ أَجَازَ مَا صُنِعَ فَهُوَ جَائِزُ، وَهُوَ قَوْلُ أَبِي حَنِيفَةَ.
Jabir (may Allah be pleased with him) narrated from the Prophet (ﷺ): "Any slave who marries without his masters’ permission is a fornicator" [Narrated by At-Tirmidhi, Abu Dawud, and Ad-Darimi]. In this chapter, from Ibrahim, he said: If a slave marries without his master’s permission, his marriage is invalid, but if permission is granted after he married, his marriage is valid. Muhammad narrated in "Al-Athar" and said: We take by it, and what he means by saying: "If permission is granted after he married," is that if what was done is approved, it is permissible, and this is Abu Hanifah’s view

1 The statement: "He is a fornicator" means a slave’s marriage without the master’s permission is not permissible, as Ash-Shafi‘i and Ahmad said, and the contract does not become valid by approval afterward. Abu Hanifah and Malik said: If approved after the contract, it is valid, as the marriage of a slave, a partially freed slave, a slave dedicated to emancipation, a slave woman, or a slave mother is suspended without the master’s permission. If he approves, it is executed; if he rejects, it is void, due to this Hadith and its interpretation as mentioned by Muhammad in "Al-Athar"
۱قوله: فهو عاهر : أي لا يجوز نكاح العبد بغير إذن السيد، وبه قال الشافعي وأحمد، ولا يصير العقد صحيحًا عندهما بالإجازة بعده، وقال أبو حنيفة ومالك: إن أجاز بعد العقد صح؛ لأن نكاح الفن والمكاتب والمدبر والأمة وأم الولد بلا إذن السيد موقوف عندنا، إن أجاز له نفذ، وإن ردّ بطل لهذا الحديث، وتفسيره الذي ذكره محمد في الآثار عن إبراهيم.
