Ibn Abbas (may Allah be pleased with him) narrated that he departed from Arafah with the Prophet (ﷺ), who heard loud shouting and camel drivers beating their animals behind them. The Prophet (ﷺ) gestured to them with his whip and said: "O people! Be calm, for righteousness is not achieved through haste." [Narrated by Bukhari]

Jabir (may Allah be pleased with him) narrated: "The Prophet (ﷺ) departed from Muzdalifah with calm dignity, instructing the people to remain calm. However, he hastened through the valley of Muhassir and instructed them to stone the Jamrah with pebbles the size of chickpeas. He said: 'Perhaps I will not see you after this year.'" The author of Mishkat said: "I did not find this hadith in the Sahihayn except in Jami' al-Tirmidhi with some rearrangement of wording."

English notes

1 “And do not consume…”: Consuming wealth unjustly occurs in several ways:

2 “So whoever transgresses…”: This verse obligates returning the usurped item to its place of usurpation, or its equivalent if it is perishable and has a like, or its value on the day of dispute if the like no longer exists. For items without a like, its value on the day of usurpation is due, by consensus. This applies to animals, counted items that differ, and weighed items that are harmed by division, as it is impossible to consider equivalence in both form and meaning. Thus, equivalence in meaning, i.e., value, is required, as it stands in its place and enables acquiring a similar item. Imam Malik said the equivalent in form is guaranteed, citing a narration from Anas: While in Aisha’s room before the hijab was mandated, a bowl of tharid was brought from one of the Prophet’s wives. Aisha struck the bowl, breaking it, and brought a similar bowl. The Prophet (ﷺ) approved of this. Our evidence is the Prophet’s (ﷺ) saying regarding a slave shared by two men, where one frees his share: If the other is wealthy, he guarantees the other’s share; if insolvent, the slave works for the value of the partner’s share. This is explicit in considering value for items without a like. This verse supports us, as it refers to the commonly accepted equivalent. Aisha’s action was out of courtesy and noble character, not obligation, as both bowls belonged to the Prophet (ﷺ). [As stated in Bahr Ar-Ra’iq].

English

Ibn Abbas (may Allah be pleased with him) narrated from al-Fadl ibn Abbas (who was riding behind the Prophet (ﷺ)) that on the evening of Arafah and morning of Muzdalifah, as people were departing, the Prophet (ﷺ) said: "Maintain tranquility," while restraining his she-camel until they entered Muhassir (which is part of Mina). He said: "Use pebbles the size used for stoning the Jamrah," and added: "The Messenger of Allah (ﷺ) continued reciting the Talbiyah until he stoned the Jamrah." [Narrated by Muslim]

In another narration by Muslim from al-Fadl: "The Messenger of Allah (ﷺ) continued reciting the Talbiyah until he reached the Jamrah."

In al-Bayhaqi's narration from Abdullah (may Allah be pleased with him): "I observed the Prophet (ﷺ) and he continued reciting the Talbiyah until he stoned Jamrat al-Aqabah with the first pebble."

Notes / الحواشي
English notes

1 "Until he entered Muhassir" - This valley is part of Mina. The hadith clearly refutes the Shafi'i opinion that collecting the seven pebbles before Fajr is Sunnah, as their reasoning lacks substance. (Al-Maraqi)

2 "He continued reciting the Talbiyah" - This proves that Talbiyah should continue until beginning to stone Jamrat al-Aqabah on the morning of Eid. This is the position of al-Shafi'i, Sufyan al-Thawri, Abu Hanifah, Abu Thawr, and most scholars among the Companions, Tabi'in, and later jurists. Al-Hasan al-Basri said it continues until Fajr prayer on the day of Arafah. Some narrations from Ali, Ibn Umar, Aisha, Malik and the scholars of Madinah say it continues until Dhuhr on the day of Arafah. Ahmad, Ishaq and some early scholars said it continues until completing the stoning of Jamrat al-Aqabah. The strongest evidence supports the majority opinion, while other views lack definitive proof. The narration "until he stoned" may seem to support Ahmad's view, but scholars reconcile it by interpreting it to mean "until beginning to stone." (Al-Nawawi) Therefore, Al-Hidayah states: "One should stop Talbiyah with the first pebble."

In Muslim's version: "He prayed Fajr before its time when it was still dark." Both Sahihayn record that he prayed both prayers together at Muzdalifah and prayed Fajr at dawn.

Notes / الحواشي
English notes

1 "I never saw" - Al-Nawawi said Abu Hanifah used Ibn Mas'ud's statement "I never saw him pray outside its time except..." to prohibit combining prayers while traveling, since Ibn Mas'ud was among the Prophet's closest companions and only reported this one instance of combination.

1 The statement: "He taught us, etc.": This Hadith of Ibn Mas‘ud is used as evidence for the legitimacy of the sermon at the marriage contract and for every need. Tirmidhi said in his "Sunan": Scholars said marriage is permissible without a sermon, which is the opinion of Sufyan ath-Thawri and others among the scholars. This is supported by the Hadith of Ismail ibn Ibrahim, coming later. Thus, the sermon in marriage is recommended, as in "Nayl al-Awtar" and "Ad-Durr al-Mukhtar."

2 "Prayed Fajr earlier" - This supports Abu Hanifah's view that it is preferable to pray Fajr at the end of its timeframe on other days. (Al-Nawawi)

Ibn Shihab narrated that Salim reported: "When al-Hajjaj ibn Yusuf besieged Ibn al-Zubayr, he asked Abdullah (ibn Umar): 'What do you do when standing at Arafah?' Salim said: 'If you want to follow the Sunnah, pray Zuhr early on the day of Arafah.' Abdullah ibn Umar said: 'He speaks truthfully. They used to combine Zuhr and Asr according to the Sunnah.' I asked Salim: 'Did the Messenger of Allah (ﷺ) do this?' He replied: 'Do you follow anything in this matter except his Sunnah?'" [Narrated by Bukhari]

Notes / الحواشي
English notes

1 "Pray Zuhr early" - In Al-Nihayah: "Al-Tahjir means takbir in all things." Here it means praying Zuhr and Asr combined at the beginning of Zuhr time. This suggests they were residents (not travelers), indicating this combination is a ritual concession, not due to travel. (Al-Maraqi)

Notes / الحواشي
English notes

1 "I was among those sent ahead" - This clearly supports Abu Hanifah's view that standing at Muzdalifah is wajib (obligatory) but not rukn (essential pillar), as sending the weak ahead at night would not be permitted if it were a pillar. Essential pillars cannot be waived due to difficulty - either the entire Hajj is invalidated or postponed if pillars cannot be performed. (Fath al-Qadir)

1 The statement: "The Prophet (ﷺ) gave her the choice" This Hadith is evidence that the guardian has no compulsion over a mature woman, even if a virgin, as Abu Hanifah said. Ash-Shafi‘i and Ahmad opposed him, and our companions have this Hadith, taken from "Al-Marqah"

Notes / الحواشي
English notes

1 "Until after sunrise" - This establishes permissibility by this hadith, while the preferred time is established by other narrations. In Al-Nihayah, quoting from Sheikh al-Islam's Al-Mabsut: "After dawn on Eid day is the time of permissibility with some dislike, from sunrise to zawal is the recommended time, from zawal to sunset is permissible without dislike, and nighttime is permissible with dislike." The evidence comes from the Prophet's practice of stoning after sunrise (in Ibn Abbas' narration) and the preferred time (in other narrations). Some argue with Abu Dawud's narration from Aisha that Umm Salamah stoned before dawn, but its chain has issues. Another weak narration from Asma is disconnected. (Fath al-Qadir, Al-Binayah - summarized)

1 "On donkeys": In Al-Bahr al-Ra'iq, it is stated that riding camels is preferable, while riding pack animals is disliked. This indicates the recommendation of better alternatives. (Al-Maraqi)

2 "O my young ones": The word is pronounced with a dammah on the hamzah, fathah on the ba', and kasrah on the nun. It is a term of endearment for a group.

3 "Until the sun rises": In Al-'Alamgiriyyah, the times for stoning are categorized:

Urwah ibn Mudarris (may Allah be pleased with him) narrated: "I saw the Messenger of Allah (ﷺ) standing at Muzdalifah. He said: 'Whoever prays this prayer with us here, stays with us, and had already stood at Arafah by night or day - his Hajj is complete.'" [Narrated by al-Nasa'i, the authors of Sunan, Ibn Hibban in his Sahih, and al-Hakim who said: "It is authentic by the standards of all Hadith scholars"]

English notes

1 "His Hajj is complete": This links the validity of Hajj to standing at Muzdalifah, suggesting its obligation (not just recommendation). This is supported by Ibn Umar's narration about sending the weak ahead - if it were a pillar (rukn), this wouldn't be permitted. (Fath al-Qadir, Al-'Inayah)

But we depart from Arafah after sunset and from Muzdalifah before sunrise - our way contradicts the way of idol-worshippers.'" [Narrated by al-Bayhaqi]

Ya'qub ibn 'Asim ibn Urwah narrated that he heard al-Sharid say: "I departed from Arafah with the Messenger of Allah (ﷺ). His feet didn't touch the ground until he reached Muzdalifah." [Narrated by Abu Dawud]

English notes

1 "His feet didn't touch the ground": This emphasizes that the Prophet (ﷺ) rode the entire distance without walking. It doesn't mean he never dismounted, as other narrations mention him descending to relieve himself. (Bazl al-Majhud)
