بَابُ رَمْيِ الْجِمَارِStoning the Pillars (Ramy al-Jimar)
وَقَوْلِ اللَّهِ عَزَّ وَجَلَّ: {فَمَن تَعَجَّلَ فِي يَوْمَيْنِ فَلَا إِثْمَ عَلَيْهِ وَمَن تَأَخَّرَ فَلَا إِثْمَ عَلَيْهِ لِمَنِ اتَّقَى }(البقرة: ۲۰۳
And the saying of Allah, the Mighty and Majestic: "Whoever hastens on in two days, no sin is upon him; and whoever delays, no sin is upon him, for the one who is godfearing" (Al-Baqarah: 203).
عَنْ جَابِرٍ (رضي الله عنه) قَالَ: رَأَيْتُ النَّبِيَّ ﷺ يَرْمِي۱ عَلَى رَاحِلَتِهِ يَوْمَ النَّحْرِ، وَيَقُوْلُ: لَتَأْخُذُوْا مَنَاسِكَكُمْ؛ فَإِنِّي لَا أَدْرِي لَعَلِّي لَا أَحُجُ بَعْدَ حَجَّتِيْ هَذِهِ». رَوَاهُ مُسْلِمٌ.
Jabir (may Allah be pleased with him) narrated: "I saw the Prophet (ﷺ) stoning on the Day of Sacrifice while mounted, saying: 'Learn your rituals from me, for I do not know if I will perform Hajj after this one.'" [Narrated by Muslim]

1 "While mounted": Abu Hanifah and Muhammad held that stoning while riding is superior, based on these narrations. Abu Yusuf considered it a situational act for visibility. Later scholars preferred walking for humility, especially in crowded times. (Fatawa Qadi Khan, Al-Maraqi)
۱ قوله : يرمي على راحلته وفي فتاوى قاضى خان: قال أبو حنيفة ومحمد عمها : الرمي كله راكبا أفضل؛ لأنه روي ركوبه فيه كله، وكان أبو يوسف يحمل ما روي من ركوبه الله في رمي الجمار كلها على أنه ليظهر فعله، فيقتدى به، ويسئل ويحفظ عنه المناسك، كما ذكر في طوافه راكبا، في الظهيرية» أطلق استحباب المشي، قال: يستحب المشي إلى الجمار، وإن ركب إليها فلا بأس به، والمشي أفضل، وتظهر أولويته؛ لأنا إذا حملنا ركوبه ، على ما قلنا: يبقى كونه مؤديا عبادة، وأداؤها ماشيا أقرب إلى التواضع والخشوع، وخصوصا في هذا الزمان؛ فإن عامة المسلمين مشاة في جميع الرمي، فلا يأمن الأذى بالركوب بينهم بالزحمة. كذا في «المرقاة».
وَعَنْ قُدَامَةَ ابْنِ عَبْدِ اللهِ بْن عَمَّارٍ (رضي الله عنه)قَالَ: رَأَيْتُ النَّبِيَّ ﷺ يَرْمِي الْجَمْرَةَ يَوْمَ النَّحْرِ عَلَى نَاقَةٍ صَهْبَاءَ لَيْسَ ضَرْبَ وَلَا طَرْدَ وَلَيْسَ قِيلَ: إِلَيْكَ إِلَيْكَ. رَوَاهُ الشَّافِعِيُّ وَالتَّرْمِذِيُّ وَالنَّسَائِيُّ وَابْنُ مَاجَهِ وَالدَّارِمِيُّ.
Qudamah ibn Abdullah ibn Ammar narrated: "I saw the Prophet (ﷺ) stoning on the Day of Sacrifice on a reddish she-camel, without pushing or shouting 'Make way!'" [Narrated by al-Shafi'i, al-Tirmidhi, al-Nasa'i, Ibn Majah, and al-Daraqutni]
وَعَنْ جَابِرٍ(رضي الله عنه) قَالَ: رَأَيْتُ رَسُولَ اللهِ ﷺ رَمَى الْجَمْرَةَ بِمِثْلِ حَصَى الْخَذْفِ. رَوَاهُ مُسْلِمٌ.
Jabir (may Allah be pleased with him) narrated: "I saw the Messenger of Allah (ﷺ) stoning with pebbles the size of chickpeas." [Narrated by Muslim]

1 The statement: Use it, Imam As-Sarakhsi said in Al-Mabsut: Found items are of two types. First: Those the owner is unlikely to seek, like pomegranate peels or date pits. Second: Those the owner is likely to seek. The first type may be taken and used, but if the owner finds it in the finder’s possession after collecting it, they may take it, as the owner’s discarding it permits use, not ownership, as ownership from an unknown person is invalid. The owner’s ownership does not cease by permission, but the permitted may use it while the owner’s ownership remains. If the owner finds it, they find their property, as the Prophet (ﷺ) said, “Whoever finds their property is most entitled to it.” The second type, which the owner seeks, must be preserved and announced to return to its owner. Summarized. I say: If a stick, whip, or rope is among trivial items the owner does not seek, it need not be announced, and the finder may use it. If it is of the second type, it may not be used, and announcement is required based on its value. As stated in Bazl Al-Majhood.
۱ قوله: ينتفع به قال الإمام السرخسي في مبسوطه ثم ما يجده نوعان، أحدهما ما يعلم أن مالكه لا يطلبه كقشور الرمان والنوى والثاني: ما يعلم أن مالكه يطلبه، فالنوع الأول له أن يأخذه وينتفع به إلا أن صاحبه إذا وجده في يده بعد ما جمعه كان له أن يأخذ منه؛ لأن إلقاء ذلك من صاحبه كان إباحة الانتفاع به للواجد ولم يكن تمليكا من غيره، فإن التمليك من المجهول لا يصح، وملك المبيح لا يزول بالإباحة، ولكن للمباح له أن ينتفع به مع بقاء ملك المبيح فإذا وجده في يده فقد وجد عين ملكه ، قال : من وجد عين ماله فهو أحق به»، وأما النوع الثاني فهو ما يعلم أن صاحبه يطلبه، فمن يرفعه فعليه أن يحفظه ويعرفه ليوصله إلى صاحبه ملخصا . قلت: فالعصا والسوط والحبل إن كان بحيث تدخل في الأشياء التافهة التي لا تطلبه المالك، فحكمها أنه لا يجب تعريفها، ويجوز الانتفاع بها للملتقط. وإن كان من النوع الثاني فلا يجوز الانتفاع بها، ويجب تعريفها على حسب قيمتها. كذا في بذل المجهود».
وَعَنْهُ (رضي الله عنه) قَالَ: رَمَى رَسُولُ اللهِ اللهِ الْجَمْرَةَ يَوْمَ النَّحْرِ ضُحًى، وَأَمَّا بَعْدَ ذَلِكَ فَإِذَا زَالَتِ الشَّمْسُ مُتَّفَقٌ عَلَيْهِ.
وَفِي رِوَايَةِ الْبَيْهَقِيَّ عَنِ ابْنِ عَبَّاسٍ مَا إِذَا انْتَفَحَ۱ النَّهَارُ مِنْ يَوْمِ النَّفَرِ فَقَدْ حَلَّ الرَّمْيُ وَالصَّدْرُ.
Jabir (may Allah be pleased with him) narrated: "The Messenger of Allah (ﷺ) stoned on the Day of Sacrifice at mid-morning (Dhuha), but on subsequent days he stoned after zawal (midday)." [Agreed upon]
Al-Bayhaqi's version from Ibn Abbas adds: "When the day has advanced (after sunrise) on the day of departure, stoning and leaving are permitted."

وَعَنْ عَبْدِ اللهِ بْنِ مَسْعُوْدٍ (رضي الله عنه) أَنَّهُ انْتَهَى إِلَى الْجُمْرَةِ الْكُبْرَى، فَجَعَلَ۱الْبَيْتَ عَنْ يَسَارِهِ وَمِنّى عَنْ يَمِينِهِ، وَرَقَى بِسَبْعِ حَصَيَاتٍ، يُكَبِّرُ۲ مَعَ كُلِّ حَصَاةٍ، ثُمَّ قَالَ: هَكَذَا رَمَى الَّذِي أُنْزِلَتْ عَلَيْهِ سُوْرَةُ الْبَقَرَةِ. مُتَّفَقٌ عَلَيْهِ.
Abdullah ibn Mas'ud (may Allah be pleased with him) narrated: "When he reached the largest Jamrah, he positioned the Ka'bah to his left and Mina to his right. He threw seven pebbles, saying Takbir with each, then said: 'This is how the one upon whom Surah al-Baqarah was revealed stoned.'" [Agreed upon]

وَعَنْ جَابِرٍ (رضي الله عنه) قَالَ: قَالَ رَسُولُ اللهِ ﷺ: الاسْتِجْمَارُ۱ تَوٌّ، وَرَحْيُ الْحِمَارِ تَو، وَالسَّعْيُ بَيْنَ الصَّفَا وَالْمَرْوَةِ تَوٌّ ، وَالطَّوَافُ تَوَ، وَإِذَا اسْتَجْمَرَ أَحَدُكُمْ فَلْيَسْتَجْمِرْ بِتَوٍّ. رَوَاهُ مُسْلِمٌ.
Jabir (may Allah be pleased with him) narrated that the Messenger of Allah (ﷺ) said:
"Stoning is an odd number (of pebbles), the millstone of a donkey is an odd number, Sa'i is an odd number, Tawaf is an odd number. When you stone, do so with an odd number." [Narrated by Muslim]

۱ قوله: الاستجمار تو وليس العدد ثلاثا بمسنون فيه، بل مستحب. قاله في الدر المختار». وقال في رد المحتار» أشار أي أن المراد نفي السنة المؤكدة لا أصلها؛ لما ورد من الأمر بالاستنجاء بثلاثة أحجار، ولم ينقل أن الأمر للوجوب كما قال الإمام الشافعي؛ لأن قوله : من استجمر فليوتر، فمن فعل فحسن، ومن لا فلا حرج، دليل على عدم الوجوب، فحمل الأمر على الاستحباب توقيفا.
وَعَنْ عَائِشَةَ (رضي الله عنها) عَنِ النَّبِيِّ ﷺ قَالَ: «إِنَّمَا۱ جُعِلَ رَأْيُ الْحِمَارِ وَالسَّعْيُ بَيْنَ الصَّفَا وَالْمَرْوَةِ لِإِقَامَةِ ذِكْرِ اللهِ». رَوَاهُ التَّرْمِذِيُّ وَالدَّارِمِيُّ، وَقَالَ التَّرْمِذِيُّ: هَذَا حَدِيثُ حَسَنٌ صَحِيحٌ.
Aisha (may Allah be pleased with her) narrated that the Prophet (ﷺ) said:
"Stoning and Sa'i were only instituted to establish the remembrance of Allah." [Narrated by al-Tirmidhi and al-Daraqutni. Al-Tirmidhi said: "This is hasan sahih"]

وَعَنْهَا قَالَتْ: قُلْنَا : يَا رَسُولَ اللهِ ، أَلَا نَبْنِي لَكَ بَيْتًا يُظِلُّكَ بِمِنّى؟ قَالَ: «لَا۳ مِنِّى مُنَاخُ مَنْ سَبَقَ». رَوَاهُ التَّرْمِذِيُّ وَابْنُ مَاجَه وَالدَّارِمِيُّ.
Nafi' narrated: "Ibn Umar would stand for a long time at the first two Jamarat, making Takbir, Tasbih, Tahmid, and dua', but not at Jamrat al-Aqabah." [Narrated by Malik. Bukhari narrated something similar as marfu']
Aisha's narration in Abu Dawud adds: "He would return to Mina during the Days of Tashriq, stoning each Jamrah with seven pebbles after zawal, saying Takbir with each. He would stand at the first two for lengthy supplication, but not at the third."
She also reported: "We said: 'O Messenger of Allah, shall we build a shelter for you at Mina?' He replied: 'No, Mina is a resting place for whoever arrives first.'" [Narrated by al-Tirmidhi, Ibn Majah, and al-Darimi]
