( تین طلاق، ایلا ءاور ظہار کا بیان )
The Explanation of Three Divorces, Ila, and Zihar
وقول الله عزوجل فان طلقها فلا تحل له من بعد حتي تنكح زوجا غيره فان طلقها فلا جناح عليهما ان يتراجعا ان ظنا ان يقيما حدود الله وتلك حدود الله يبينها لقوم يعلمون
اور اللہ تعالیٰ کا ارشاد ہے (سورۃ بقرہ،پ:2،ع:28،آیت نمبر:230،میں) "چھراگر (شوبہ نے تیری
بار) عورت کو طلاق دی یا تو اس کے بعد عورت جب تک دوسرے شوہر سے نکاح نہ کر لے (اور وہ صحبت بھی
کرے) اس کے لئے حلال نہیں ہو سکتی چھروہ دوسرا شوہراس کو طلاق دیے تو دونوں (میان بیوی) پر پکڑ گناہ
نہیں ہے کر (چھر باہتم) نکاح کر لیس بثر طیکہ دونوں کو امید ہو کہ اللہ تعالیٰ کی (مقصد کر دہ) حد ول کو قائم رکھ سکیں
گے اوریا اللہ تعالیٰ کی (قتام کر دہ) حد یہیں جن کو وہ ان لوگوں کیلے بیان کرتا ہے جو (خانہداری کی مصلحت کو)
کو) جانتے ہیں۔"
ف: واشہ ہو کہ عورت تیسری طلاق واقع ہو نے کے بعد وہ پہلے شوہر سے دوبارہ نکاح نہیں کر سکتی یہ حال تک کہ
دوسرے شوہر سے نکاح کرے اور دوسرا شوہر صحبت بھی کرے اگر دوسرا شوہر عینیں (نامرہ) ہوتا چھر عورت تیسرے
شوہر سے نکاح کرے اور وہ صحبت بھی کرے اس کے بعد ای عورت اپنے پہلے شوہر سے دوبارہ نکاح کر سکتی
ہے۔بہرحال دوسرا شوہر یا تیسرے شوہر سے جب تک صحبت اور جماع نہ ہو عورت پہلے شوہر کیلے حلال ل
نہیں۔(تفسیرات احمدی12)
And the guidance of Allah Almighty is (in Surah Al-Baqarah, Vol. 2, Pg. 28, Verse No. 230): 'If a man divorces his wife, and then she marries another man and has intercourse with him, it is not lawful for her to return to the first husband until after the second husband has divorced her. Then there is no sin upon them if they reunite, provided that they hope to maintain the limits set by Allah. And these are the limits of Allah, which He makes clear to those who understand.'
It is established that a woman cannot remarry her first husband after the third divorce unless she marries another man and has intercourse with him. If the second husband is impotent, and she marries a third man and has intercourse with him, then she can remarry her first husband. In any case, until the woman has intercourse with the second or third husband, she cannot be lawful for her first husband. (Tafsir Ahmad 12)
وقوله تعالي للذين يولون من نسايهم تربص اربعه اشهر فان فاءو فان الله غفور رحيم وان عزموا الطلاق فان الله سميع عليم
اور اللہ تعالیٰ کا ارشاد ہے (سورۃ بقرہ،پ:2،ع:28،آیت نمبر:226/227،میں) "اور وہ لوگ جو اپنی
بیویوں سے ایلا ئے کرتے ہیں لیئے پیویوں سے صحبت نہ کرنے کی قسم کھائیں ہیں تو ان کو چار مہینے کی مہلت ہے چھر
اگروہ (اس مدت میں) رجوع کر لیں تو پیشک اللہ تعالیٰ سنے والا اور جائے والا ہے۔
ف: واشہ ہو کہ زمانہ جابلیت میں لوگوں کا یمعمول تھا کہ اپنی بیویوں سے مال طلب کرتے اگروہ ویں سے
انہا کر تین تو ایسال یادوسال تین سال یاس سے زیادہ عرصان کے پاس نجاتے اور محبت نہ کرنے کی فتنہ کہا لیتے
تھے اور پھوی کو پریشان حال چھوڑ دیتے، اسلام نے اس ظلم کو مطا اورامی فتنہ کہانے والون کے لے چارمہیندی مدت
مقرر فرمادی کر ای صورت میں چارماه انتظار کی مهلت بے اس عرصے میں خوب سوچ سمجھ لے کر عورت کو چھوڑنا اس
کے لے بہتر رہے یار کہنا، اگر رکھنا بہتر سمجھے اوراس مدت کے اندر رجوع کر لے تو نکاح باقی رہے گا اورتم کا کفارہ لازم
ہوگا اوراگر اس مدت میں رجوع نہ کیااورتم نہ توڑی تو عورت نکاح سے باہر ہوگی اوراس پر طلاق باسن وا قع ہوگی۔ اگر
مرد محبت پرتا در ہوتا رجوع محبت نی سے ہوگا، اگر کسی وجہ سے قدرت نہ ہوتا بعد قدرت محبت کا وعدہ رجوع
ہے۔ (تفسیرات احمدی12)
وقولہ تعالی: "وَا۟لدِّینَ يُظْهِرُوۡنَ مِنَ نِّسَآئِهِمْ ثُمَّ يُعۡدُوۡنَ لِمَا قَالُواْ فَتَحۡرِيۡرُ رَّقَبَةٍ مِّنۡ قَبِلٍ
ۤاَنۡ يَّتَمَآءَا، ذٰلِكُمْ تُوۡعَظُوۡنَ بِهِ، وَاللّٰهُ بِمَا تَعۡمَلُوۡنَ خَبِيۡرٌ۔ فَمَنْ لَّمْ يَجِدْ فَصِيَامُ شَہۡرَيۡنِ مُتَتَابِعَيۡنِ
ۤمِّنۡ قَبْلِ اَنۡ يَّتَمَآءَا، فَمَنْ لَّمْ يَسْتَطِعْ فَاطْعَامُ سَتِّيۡنَ مِسْكِيۡنًا، ذٰلِکَ لِتُوۡمِنُوۡا بِاللّٰهِ وَرَسُوۡلِهِ، وَ
ۤتُلُكَ حُدُوۡدُ اللّٰهِ، وَلِلْکَافِرِيۡنَ عَذَابٌۚ اَلِيمٌ۔
اوراللہ تعالی کا ارشاد ہے: (سورۃ مجادلہ، پ:28، ع:1، آیت نمبر:3/4) اور وہ لوگ جو پیپوپول سے
ظہار کرتے ہیں (یعنی پول کیتے ہیں کہ تیری پیپی میری مال کی پیپی کی جیسی ہے) اور کیہوئی باٹ کی تلافی کرنی چاہتے
ہیں تو ان پر لازم ہے کہ ایک غلام یا بندی آزاد کریں قبل اس کے کہ میال پیوی ایک دوسرے کو باٹھوگا میں (مسلمانو!)
تم کو نصیحت کی جاتی ہے (تاکہ تم اس پر کار بندر ہو) اور جو پیپی تم کرتے ہوواللہ تعالی کواس کی (سب) نہبرہے-
پھر جس کو (غلام یا بندی) میسر نہ ہوتا ایک دوسرے کو باٹھوگا نے سے پیلے (مرد) لگا تار دومہینے کے روزے (پگ)
پھر (بوڑھا پے پیپاری پاگسی اور مجبے سے) روزے بھی نہ ہو سکیسی تو سائے (60) مسکینوں کو (پیپیت پھر کے دو وقت)
کچانا کھلا نے پیر (حمم) اس لی (دیاجاتا ہے) کہ تم لوگ اللہ اوراس کے رسول پر (پوراپورا) ایمان لے آؤ اوریاللہ
تعالی کی بندی ہوئی حد یی یہ اور جو لوگ منکر ہیں ان کو دور دنا کے عذاب ہے۔"،
ف: واضح ہو کہ ظہار پیہ کہ پی پیوی کو مرات نہیں پارضا عی کے کسی ای عضو سے تشہیہ دی جانے جس کو
و کیہنا حرام ہے مشا پیوی سے کہ کہ تو مجھے پر میری مال کی پشت کی مش سے پیپول کہ کہ تیرا سریا تیرا نصف بد میری
مال کی پیپی پیپیت پیاس کی ران کے مش سے پی میری جهن پیپو پی پیو دہ پلا نے والی کی پیپی پیپیت کے مش سے-
تو اپیا کہنا ظہار کہلا تا ہے-
ظہار کے بعض مسائل مندرج ذیل ہیں
(1) چونکہ آیت شریف میں نسائیم "(یہود) کا ذکر ہے اس لیے باندی سے ظہار نہیں ہوگا۔ اس لیے باندی کو حرمات سے تشدد دے تو ظہار نہیں ہوگا۔
(2) کفارہ میں غلام باندی آزاد کرنے کا حکم ہے اس میں حکم عام ہے جس کا کفارہ میں غلام موسیٰ ہو یا ہو کافر صغير ہو یا کبیر، مردو یا عورت سب جائز ہے۔
(3) کفارہ میں غلام یا باندی آزاد کی جائے یا روزے رکے جا سکیں تو کفارہ دینے سے قبل صحبت اوراس کے محکمات سے حرام ہیں۔
(4) کفارہ میں اگر روزے رکے جا سکیں تو متصل روزے اس طرح رکے جا سکیں کہ ان دونوں کے درمیان رمضان نہ آئے نہ ان پانچ دنوں (دو عیدیں اور زوالجگی 11،12،اور 13) میں کوئی دن آئے جس کا روزہ ممنوع ہے اور نہ کسی عذر سے یا بغیر عذر کے درمیان سے کوئی روزہ چھوڑا جائے۔ اگر ایسا ہوا تو ازسرنو روزے رکنے پر نہیں آوریہ کچھ ضروری ہے کہ روزے لگے ذریعہ کفارہ دیاجارہ ہوتا روزے صحبت یا سکے محکمات سے پہلے ہو تو اورجب تک پیروزے پورے نہ ہو لخاوند پیوی میں سے کوئی کسی کو باقی نہ گا۔ اگر کفارہ میں مسکینوں کو کھانا کھلا یا جائے تو ساتھ مسکینوں کو نہ وشام دو نوں وقت پیٹ بھر کر کھلا یا جائے اور کھانا کھلانے کے کفارہ میں شرط نہیں کہ ایک دوم سے کو باقی نہ گا۔ نے قبل ہوئی کر اگر کہنا کہ لا نے کے درمیان میں شوہراور پیوی میں قربت واقع ہو جائے تو نیا کفارہ لازم نہ ہو گا۔ (تفسیرات احدیث)۔
حلال میں جماع شرط ہے
And the guidance of Allah Almighty is (in Surah Al-Baqarah, Vol. 2, Pg. 28, Verse number: 226/227): 'And those who swear an oath to abstain from their wives and do not actually intend to return to them, then they shall wait for four months. If they reconcile during this period, then Allah is All-Hearing and All-Knowing.' It is narrated that in the pre-Islamic era, it was customary for people to seek wealth from their wives, and if they did not receive it, they would swear an oath to abstain from them.
They used to declare their wives as forbidden and then refrain from showing affection for a period longer than four months, causing them distress. Islam has declared this act of injustice and the declaration of such a period as a major sin, and has prescribed a specific duration of four months during which one must wait before leaving the wife. During this period, one should carefully consider whether to keep or leave the wife. If it is deemed better to keep her and reconciliation occurs within this period, the marriage will remain intact, and expiation (kaffarah) will be required. If there is no reconciliation and the period expires without revocation, the wife will be released from the marriage, and the divorce will take effect. If the husband returns out of affection, the return will be due to affection. If he cannot do so for some reason, but later regains the ability, the promise of affection will be considered as the revocation. (Tafseer-e-Ahmedi 12)
And Allah Almighty says: 'And those who make their wives [the subject of a simile] [by saying, “You are like my mother’s back,”] and then seek to go back on what they said - then [for their atonement] there must be the freeing of a slave before the two touch. That is how you are admonished, and Allah is All-Knowing of what you do. And whoever does not find [a slave to free], then a fast for two consecutive months before they touch. And if one does not have the ability [to fast], then the feeding of sixty poor persons. That is so that you may believe in Allah and His Messenger, and those are the limits [set by] Allah. And for the disbelievers is a painful punishment.' (Surah Al-Mujadalah, Part 28, Juz 1, Ayah Number: 3/4)
And the guidance of Allah Almighty is: (Surah Al-Mujadalah, Verse 3-4) Those who declare their wives as forbidden (by saying, “You are like my mother’s back”) and then wish to revoke their statement must free a male or female slave before they touch each other. O believers, this is an admonition for you (so that you may act upon it). Whatever you do, Allah is All-Knowing. Then, if one does not have a slave to free, he must fast for two consecutive months before they touch. And if one cannot fast, he must feed sixty poor people. This is so that you may believe in Allah and His Messenger, and these are the limits set by Allah. And for the disbelievers is a painful punishment.
It is clear that declaring a wife as forbidden (zihar) means not touching her and likening her to a part of one's mother's body, which is forbidden. Saying to one's wife, “You are like my mother’s back,” is considered zihar, and it is haram to liken her to any part of one's mother’s body, such as saying, “Your face is like my mother’s back,” or “Your hand is like my mother’s back.” Therefore, such a statement is called zihar.
1. Since the noble verse mentions 'Nasaim' (Jews), it does not apply to female slaves. Therefore, if a female slave is treated with severity, it does not constitute zihar. 2. In the expiation, the command to free a male or female slave is general, whether the slave is a Muslim, a minor or an adult, male or female, all are permissible. 3. If the expiation involves freeing a slave or observing fasts, then before the expiation is fulfilled, intimacy and its related acts are forbidden. 4. If the expiation involves fasting, the fasts must be observed consecutively such that neither Ramadan intervenes nor any of the five prohibited days (the two Eids and the days of Tashriq, 11th, 12th, and 13th of Dhu al-Hijjah) fall between them. Additionally, no fast should be broken due to any excuse or without an excuse. If this happens, one must start the fasts anew, and it is necessary that the fasts be observed before the expiation is fulfilled. Until the fasts are completed, no sexual intercourse should occur. If the expiation involves feeding the poor, they should be fed until they are fully satisfied, either at night or during the day. It is not a condition of the expiation that one person remains unsatisfied. If intimacy occurs between the time of making the oath and fulfilling the expiation, a new expiation is not required. (Commentary on Hadiths).
Intercourse is a condition in the act of consummation.
امام موسیٰ حضرت علی رضی اللہ عنہا سے روایت ہے، فرما تی ہیں کہ رفاعہ قریشی کی پیوی رسول اللہ صلی اللہ علیہ وسلم کی خدمت میں اقدام حاضر ہو کر عرض کی کہ میں رفاعہ کی پیوی ہیں، انہوں نے مجھے طلاق دیا اور تین طلاق دیا۔ ان کے بعد میں نے عبد الرحمن بن الزبیر سے عقد کیا اور ان کا آلہ تناسل تو کپڑے کا پھنڈہ ہے (یعنی وہ جماع نہیں کر سکتا) اس پر رسول اللہ صلی اللہ علیہ والہ وسلم نے دریافت کیا کیا تم (اپنے پیلے خاوند) رفاعہ کے پاس واپس جانا چاہتی
ہو؟ تواس نے کہا: بال! توآپ صلی اللہ علیہ وسلم نے فرمایا: نہیں (جاکتی) یہاں تک کہتم اس سے جماع کا مزہ نہ چھوواوروہ تم سے جماع کی لذت حاصل نہکرے- (اس کی روايت بخاري اور مسلم نے متفق طور پر کی ہے)
حلال کے جواز کی شرط
ف: واضح ہوگا حلال میں دوسرا شوہر دخول سے پہلے مر جا کے یادخول سے پہلے طلاق دیے تواس صورت میں پیوی پہلے شوہر کے لئے حلال نہیں؛ یہاں تک کہ وہ تیسرے شوہر سے عقد کرے اور چھر دخول کی ہو چھر وہ طلاق دے اور عدت گزرے تو ان سارے مرحلون کے بعد عورت پہلے شوہر کے لئے حلال ہوگی - ( ما نوز از عمدة الرعاية-12)
حلال کرنے والے اور حلال کرائے والے پر لعن ہے
‘Aishah (may Allah be pleased with her) narrated that the wife of Rifa’ah al-Qurazi came to the Messenger of Allah (ﷺ) and said, "I was married to Rifa’ah, and he divorced me irrevocably. Then I married ‘Abdur-Rahman ibn Az-Zubayr, but he has nothing more than this fringe." The Prophet (ﷺ) said, "Do you wish to return to Rifa’ah? No, not until you taste his sweetness and he tastes yours." [Agreed upon]
(1) The statement: "Until you taste his sweetness and he tastes yours", This indicates, according to the majority, that intercourse with the second husband is required for tahill (making lawful return to the first husband). This is the view of the four imams and their followers. Even if the second husband divorces her before consummation or dies before it, she does not become lawful for the first. This is mentioned in ‘Umdat ar-Ri’ayah. Ar-Radd al-Muhtar states: "The requirement of consummation is established by consensus, so the contract alone is insufficient." Al-Kashf and other usul works state: "Scholars, except Sa’id ibn al-Musayyab, agreed on requiring consummation." Az-Zahidi said: "This is established by the consensus of the ummah." Al-Munyah states: "Sa’id retracted his opinion and adopted the majority view. Whoever acts contrary to this is disgraced, and whoever issues such a fatwa is punished. What is attributed to As-Sadr ash-Shahid has no basis in his works; rather, they contradict it." Al-Khulasah states: "Whoever issues such a fatwa is cursed by Allah, the angels, and all people, as it contradicts consensus. A judge’s ruling based on this is invalid."
The majority who require intercourse follow two approaches regarding the verse: "Until she marries a husband other than him" (2:230). Some held that nikah here means intercourse, as nikah linguistically means joining, which is intercourse literally. It is used as such in the verse: "Test the orphans until they reach the age of marriage..." (4:6). Thus, the Book requires intercourse, supported by the hadith of ‘asilah (sweetness).
Others said nikah in the verse means the contract, and the requirement of intercourse is established by the well-known hadiths. These hadiths supplement the Book, as adding to the Book with well-known hadiths is permitted by consensus. Thus, tahill without intercourse contradicts the well-known hadith. This analysis is taken from ‘Umdat ar-Ri’ayah and Sharh al-Wiqayah.
عبد اللہ بن مسعود رضی اللہ عنہ سے روایت ہے و فرماتے ہیں کہ رسول اللہ صلی اللہ علیہ وآلہ وسلم نے حلال کرنے والے اور حلال کرائے والے پر لعن فرمائی ہے-
اس کی روایت داری نہیں ہے-
The Messenger of Allah ﷺ cursed the one who makes something lawful and the one who has it made lawful for him. - This narration is not authentic.
اور ابن ماجہ نے اس کی روایت حضرت علی اور حضرت ابن عباس اور حضرت عقبہ بن عامر رضی اللہ عنہم سے لی ہے-
حلال کے بعد پہلے شوہر کا عقد ثانی کے بعد طلاق دین کا بیان
After the first marriage, the husband’s remarriage should be followed by a divorce.
اور امام محمد رحمۃ اللہ علیہ نے کتاب الآثار میں سعید بن جبیر رحمۃ اللہ علیہ سے روایت لی ہے و فرماتے ہیں کہ عبد اللہ بن عتبہ بن مسعود رضی اللہ عنہ کی خدمت میں بیٹھا تھا ایک اعرابی آپ کے پاس حاضر ہوا اور دریافت کیا کہ ایک شخص نے اپنی پیوی کو ایک طلاق دادو طلاق دینے پچراس کی عدت گزر رگی اور اس عورت نے دوسرا شوہر سے عقد کیا اور اس نے صحبت کی چھر دوسرا شوہر مگر یا اس نے طلاق دی یا چھر عدت گزر گئی اس کے بعد پہلے شوہر کا ارادہ
بھ کر اپنی (قدیم) یوی سے پھر نکاح کرے تو بتائے کر وہ اس (عورت کو عقد ثانی کے
بعضوہر) کو کتنے طلاق کا حق ہوگا؟ یعن کر حضرت عبد اللہ بن عتبہ بن مسعود حضرت ابن عباس کی
طرف متوجہ ہوئے اور کہا کر اس مسئلہ میں آپ کیافرماتے ہیں؟ تو حضرت ابن عباس نے فرمایا کہ
دوسراشوہراکے طلاق، دو طلاق یا تین طلاق کو ختم کر دیتا ہے۔ (یعنی سابقہ دی ہونی طلاقوں کا اعتبار
نہ ہوگا بلکہ اس کو ازسرنو تین طلاق کا حق ہوگا) اور (حضرت عبد اللہ بن عتبہ نے ساسکے کہا کہ) تم
ابن عمر کہتے ہیں (اس بارے میں) دریافت کرو۔ ساسکاپیانہ کہ میں حضرت ابن عمر کے ملا
اور یہ مسئلہ دریافت کیا تو انہوں نے مجھی حضرت ابن عباس کی کے قول کے مطابق، یہ کہا۔
‘Abdullah ibn Mas’ud (may Allah be pleased with him) narrated that the Messenger of Allah (ﷺ) said, "Allah curses the muhallil (one who marries to make a woman lawful for her first husband) and the one for whom he does so." [Narrated by Ad-Darimi]
Ibn Majah narrated it from ‘Ali, Ibn ‘Abbas, and ‘Uqbah ibn ‘Amir. Muhammad narrated in Al-Athar from Sa’id ibn Jubayr: "I was sitting with ‘Abdullah ibn Mas’ud when a Bedouin came and asked about a man who divorced his wife once or twice, her waiting period ended, she married another man, he consummated the marriage, then died or divorced her, and her waiting period ended. The first husband wants to remarry her, how many divorces remain?" Ibn Mas’ud turned to Ibn ‘Abbas and said, "What do you say?" Ibn ‘Abbas replied, "The second husband annuls the first and second (divorces), leaving three. Ask Ibn ‘Umar." The Bedouin met Ibn ‘Umar, who agreed with Ibn ‘Abbas.
Muhammad narrated in Al-Muwatta’ from Abu Hurairah that he sought a verdict from ‘Umar ibn al-Khattab about a man who divorced his wife once or twice, left her until her waiting period ended, she married another, then he died or divorced her. The first husband wanted to remarry her, how many divorces remain? ‘Umar said, "She is on the remaining divorces."
(1) The statement: "Allah curses the muhallil and the one for whom he does so", If a man marries a woman on the condition that he will consummate and divorce her so she can return to her first husband, such a marriage is prohibitively disliked due to this hadith. If he marries her with this condition, consummates, and divorces her, she becomes lawful for the first husband after her waiting period, though the sin remains for such a marriage and tahill.
There is disagreement: Muhammad held that the marriage is valid with the tahill condition, as contracts are not invalidated by invalid conditions. However, she does not become lawful for the first husband through such consummation, as it hastens what the Shari’ah delayed. Abu Yusuf and Ash-Shafi’i said the marriage is invalid due to the tahill condition, as it resembles a temporary marriage.
Abu Hanifah’s view is that the marriage is valid but disliked. If the tahill is concealed in the heart without explicit mention, it is permissible without dislike. The Shafi’i school differs from us in that they consider tahill invalid, while we consider it valid but sinful.
اور امام محمد رحمۃ اللہ علیہ نے اپنی موٹا میں ابوہریرہ رضی اللہ عنہ سے روایت کی
ہے کہ انہوں نے امیر المومنین حضرت عمر بن خطاب رضی اللہ عنہ سے فتوی طلب کیا ایسے شخص
کے بارے میں جس نے اپنی یوی کو ایک طلاق یا دو طلاق دی ہو پھراس کو چھوڑ دیا پھر اس کے کروہ
(عدت گزر اگر دوسرے شوہر کے لیے حال ہو جائے پھر وہ عورت دوسرے شوہر سے نکاح کرے
پھریا (دوسرے شوہر) مر جائے یا سکو طلاق دیے) (پھر عدت گزر نے کے بعد) وہ اپنے پہلے شوہر
کے ساتھ نکاح کرے تو اس کو کتنے طلاق کا حق ہوگا تو حضرت عمر نے فرمایا کہ اس عورت کو جتنے
طلاق باقی رہ گئے ہیں (یعنی ایک یا دو) اتنے ہی طلاق باقی رہیں گے۔ (یعنی پہلے شوہر کو عقد ثانی
کی وجہ سے ازسرنو تین طلاق کا حق نہیں ملے بلکہ زشتی طلاقوں دی تحسین وہ شمار کر لی جائیں گی
اور باقی طلاقوں کا اس کو حق رہے گا اگر ایک طلاق دی ہو تو دو کا حق اور اگر دو طلاق دی تحسین تو ایک کا
حق باقی رہے گا۔
ایلاء طلاق باقی کب ہو جائے؟
‘Abdullah ibn Mas’ud (may Allah be pleased with him) narrated that the Messenger of Allah (ﷺ) said, "Allah curses the muhallil (one who marries to make a woman lawful for her first husband) and the one for whom he does so." [Narrated by Ad-Darimi]
Ibn Majah narrated it from ‘Ali, Ibn ‘Abbas, and ‘Uqbah ibn ‘Amir. Muhammad narrated in Al-Athar from Sa’id ibn Jubayr: "I was sitting with ‘Abdullah ibn Mas’ud when a Bedouin came and asked about a man who divorced his wife once or twice, her waiting period ended, she married another man, he consummated the marriage, then died or divorced her, and her waiting period ended. The first husband wants to remarry her, how many divorces remain?" Ibn Mas’ud turned to Ibn ‘Abbas and said, "What do you say?" Ibn ‘Abbas replied, "The second husband annuls the first and second (divorces), leaving three. Ask Ibn ‘Umar." The Bedouin met Ibn ‘Umar, who agreed with Ibn ‘Abbas.
Muhammad narrated in Al-Muwatta’ from Abu Hurairah that he sought a verdict from ‘Umar ibn al-Khattab about a man who divorced his wife once or twice, left her until her waiting period ended, she married another, then he died or divorced her. The first husband wanted to remarry her, how many divorces remain? ‘Umar said, "She is on the remaining divorces."
(1) The statement: "Allah curses the muhallil and the one for whom he does so", If a man marries a woman on the condition that he will consummate and divorce her so she can return to her first husband, such a marriage is prohibitively disliked due to this hadith. If he marries her with this condition, consummates, and divorces her, she becomes lawful for the first husband after her waiting period, though the sin remains for such a marriage and tahill.
There is disagreement: Muhammad held that the marriage is valid with the tahill condition, as contracts are not invalidated by invalid conditions. However, she does not become lawful for the first husband through such consummation, as it hastens what the Shari’ah delayed. Abu Yusuf and Ash-Shafi’i said the marriage is invalid due to the tahill condition, as it resembles a temporary marriage.
Abu Hanifah’s view is that the marriage is valid but disliked. If the tahill is concealed in the heart without explicit mention, it is permissible without dislike. The Shafi’i school differs from us in that they consider tahill invalid, while we consider it valid but sinful.

زید بن ثابت، حضرت ابن عمر، اور حضرت ابن عباس رضی اللہ عنہم سے روایت ہے ان سب حضرات نے فرمایا ہے کہ ایلاء کے بعد چار مہینے رجوع اور جماع کے بغیر گزر رجا کی تو طلاق باقی واقع ہو جائے گی اور عورت کو پھر ذات کے بارے میں حق حاصل ہو گا کہ عدت گزرنے کے بعد اگر وہ چاہے تو دوبارہ عقد کر سکتی ہے۔ اس حدیث کی روایت نہیں اور عبد الرزاق نے کی ہے۔
‘Umar, ‘Uthman, ‘Ali, Ibn Mas’ud, Zayd ibn Thabit, Ibn ‘Umar, and Ibn ‘Abbas (may Allah be pleased with them) said, "Ila’ (swearing off intercourse) results in one irrevocable divorce if four months pass without retraction, and she has the right to herself."* [Narrated by Al-Bayhaqi and ‘Abdur-Razzaq]
Muhammad said in Al-Muwatta’: "It reached us from ‘Umar ibn al-Khattab, ‘Uthman ibn ‘Affan, ‘Abdullah ibn Mas’ud, and Zayd ibn Thabit that they said, 'If a man swears off his wife and four months pass without retraction, she is irrevocably divorced once, and they did not consider stopping after the four months valid.'"
Ibn ‘Abbas said in interpreting the verse: "For those who swear not to have intercourse with their wives is a waiting period of four months. But if they return, Allah is Forgiving and Merciful. And if they decide on divorce, Allah is Hearing and Knowing." (2:226-227) "Retraction" means resuming intercourse within four months, and "deciding on divorce" means letting the four months pass. If they pass, she is divorced once, and there is no stopping after that. Ibn ‘Abbas was the most knowledgeable of Quranic interpretation.
Al-Bayhaqi and ‘Abdur-Razzaq narrated from Ibn Mas’ud: "If a man swears off his wife and four months pass, it is one irrevocable divorce, and she observes a waiting period of three menstrual cycles afterward."
(1) The statement: "Ila’ results in one irrevocable divorce...", Ila’* is swearing not to have intercourse for four months or more. Its ruling is of two types: the ruling of the oath and the ruling of breaking it. If he has intercourse within the period, he atones for breaking the oath, indicating that atonement before breaking is insufficient. If the oath was by Allah, its atonement is feeding ten poor people, clothing them, or freeing a slave. If unable, fasting three days. If the oath was other than by Allah (e.g., vowing Hajj, fasting, charity, freeing a slave, or divorce), he fulfills what he made the penalty for breaking it.
If he swore, "By Allah, I will not approach my wife for four months," and retracted within the period, he must atone for the oath. If he swore, "If I approach you within four months, I must perform Hajj," and approached her within the period, Hajj becomes obligatory, and ila’ is annulled, as the oath is lifted by breaking it.
If he does not approach her within the period, she is irrevocably divorced by one divorce. This is the view of Ibn Mas’ud, Ibn ‘Umar, Ibn ‘Abbas, Zayd ibn Thabit, and is narrated from ‘Uthman and ‘Ali. It is the view of most Tabi’in.
Ash-Shafi’i said she is not divorced by the passage of time, but the ruling is suspended after the period, and he is ordered to retract or separate. If he refuses, the judge separates them. Thus, the difference is twofold:
Retraction, according to him, is after the period, while according to us, it is within the period.
Separation does not occur except by the judge’s ruling or the husband’s divorce, the view of Malik and Ahmad. Ash-Shafi’i said the judge does not separate but pressures him until he retracts or divorces. According to us, separation occurs by the passage of time.
Their evidence is the verse: "But if they return" (2:226), where "fa" (then) denotes sequence, permitting retraction after the period and separation. Our evidence is the reading of Ibn Mas’ud and Ubayy: "If they return within them," proving retraction is within the period, making it evidence against them. "Fa" in the verse denotes retraction following ila’, as retraction before the period is permitted, which would not be if their view were correct.

سلمہ بن صخر رضی اللہ عنہ سے روایت ہے وہ فرما تے ہیں کہ رمضان کا مہینہ آگیا تو مجھے اندیشہ ہوا (کہ کہیں دن میں) اپنی یوی سے صحبت کریں گوں اس لیے میں نے (ماہ رمضان کی حد تک) اپنی یوی سے ظہار کر لیا (عجیب اتفاق کہ) ایک رات اس کے جسم کا ایک حصہ کحل گیا اوراس پر میری نظر پڑ گئی اور میں نے اس سے صحبت کر لی (حضور صلی اللہ علیہ وسلم نے مجھ سے فرما ایک غلام آزاد کر وتو میں نے عرض کیا کہ میری اپنی گردن کے سوا میں کسی اور چیز کا ما کہ نہیں ہوئے تو آپ صلی اللہ علیہ وسلم نے ارشاد فرما یا: تو پھر تم دو میں کے مسلسل روزے رکھو میں نے عرض کیا (یا رسول اللہ صلی اللہ علیہ وسلم!) روزوں میں کی وجہ سے تویہ واہے، تو آپ صلی اللہ علیہ وسلم نے ارشاد فرما یا کہ ایک تہیلہ کھور (جس کے پنڈرہ یا سولہ صاع ہوتے ہیں) ساتھ مسکینوں کو خلا دو۔ اس کی روایت امام احمد، ترمذی، ابوداؤد اور ابن ماجہ نے کی ہے۔
Salamah ibn Sakhr (may Allah be pleased with him) said: "Ramadan began, and I feared I might approach my wife, so I made zihar against her. One night, I saw something of her and had intercourse with her. The Messenger of Allah (ﷺ) told me, 'Free a slave.' I said, 'I do not own a slave except myself.' He said, 'Fast two consecutive months.' I said, 'What happened to me was due to fasting.' He said, 'Feed a farq (a measure) of dates to sixty poor people.'" [Narrated by Ahmad, Tirmidhi, Abu Dawud, and Ibn Majah]
In Abu Dawud and Ad-Darimi’s version: "Feed a wasq of dates to sixty poor people." Ibn Majah narrated from Ibn ‘Abbas: "The Messenger of Allah (ﷺ) atoned with one sa’ of dates and ordered the people to do so. Whoever could not, then half a sa’ of wheat."
At-Tabarani narrated in Al-Mu’jam from Awf ibn As-Sa’mit: "Feed sixty poor people thirty sa’." He said, "I cannot unless you help me." The Prophet (ﷺ) helped him with fifteen sa’, and the people helped until it was completed.
Tirmidhi narrated from Salamah ibn Sakhr al-Bayadi: "He made his wife unlawful like his mother’s back until Ramadan ended. When half of Ramadan passed, he had intercourse with her at night."
Abu Dawud, Ibn Majah, and Ad-Darimi narrated from him: "I was a man who approached women more than others."
(1) The statement: "So I made zihar against her...", Zihar linguistically is from zahara, meaning to declare something like another. Legally, it is a Muslim equating his wife or part of her to a permanently prohibited female relative (e.g., saying, "You are to me like my mother’s back"). It does not apply to a non-Muslim’s wife, even if she is a kitabiyyah, minor, or insane. It includes equating any part of her to a prohibited relative, not just the back, though zihar is named after the back due to its common usage.
Its condition for the woman is that she is a wife, and for the man, he must be liable for expiation (i.e., free, adult, sane). Its ruling is prohibition of intercourse and its preliminaries until expiation is made. The woman may demand intercourse, as it is her right, but she must prevent him from enjoyment until he atones, and the judge may compel him through imprisonment or beating until he atones or divorces.
Some said expiation is obligatory due to retraction, based on the verse: "Then they retract what they said" (58:3). Scholars differed on its meaning. Ash-Shafi’i said retraction obliging expiation is retaining her without divorce after zihar. Abu Hanifah said retraction in the verse is a firm resolution to have intercourse, the view of Ibn ‘Abbas, Al-Hasan, and Qatadah.
(2) The statement: "Free a slave...", This hadith indicates several rulings:
The order of expiation options.
The slave need not be a believer, unlike in expiation for killing.
The fasting must be consecutive.
Expiation is not entirely waived due to inability, as in As-Subul.
Expiation is freeing a slave before intercourse. If unable, the one who made zihar must fast two consecutive months before intercourse, excluding Ramadan and the five forbidden days. If unable to fast, feed sixty poor people, each receiving half a sa’ of wheat or one sa’ of dates or barley. It must be given before intercourse but need not be repeated if intercourse occurs during feeding, as in Al-Hidayah, Ar-Radd al-Muhtar, and Ad-Durr al-Mukhtar, summarized.
(3) The statement: "He made his wife unlawful like his mother’s back until Ramadan ended...", This means he made zihar until Ramadan ended. At-Tibi said: "This indicates the validity of temporary zihar." Qadi Khan said: "If one makes temporary zihar, he is considered to have made zihar immediately, and it expires after the specified time." As in Al-Maraqi.
اور ابو داؤد اور روا رداری کی ایک روایت میں اس طرح ہے کہ ( رسول اللہ صلی اللہ علیہ وسلم نے فرمایا ) ایک وسق لعنی صاع ) کھجور سائے مسكینون کو طلا دو -
A wasq of dates is equivalent to a sa‘ of barley; give gold to the poor.
اور ابن ماجہ نے حضرت ابن عباس رضی اللہ عنہما سے روایت کی ہے آپ نے فرمایا ہے کہ رسول اللہ صلی اللہ علیہ وسلم نے ( مسکین کو ) ایک صاع کھجور ( کے حساب ) سے کفارہ دیا اور لوگوں کو اس کا حکم دیا اور اگر کسی کو اس کی استطاعت نہ ہوتی پھر وہ آدھا صاع گیہون ( ہرا ایک مسکین کو کفارے میں ) دیوے -
The Messenger of Allah ﷺ gave one sa' of dates as expiation for a poor person and commanded the people to do so. If someone could not afford it, they were to give half a sa' of grain (to each poor person as expiation).
اور طبرانی نے اپنی مجمویہ اوس بن صامت رضی اللہ عنہ سے روایت کی ہے کہ رسول اللہ صلی اللہ علیہ وسلم نے پندرہ صاع کی امدادر مالی اور دوسروں لوگوں نے بھی ان کی مد کی یہاں تک کہ ( مقدار ) پوری ہوگی -
the Messenger of Allah ﷺ gave fifteen saa' as financial aid, and others also contributed until the amount was complete.
اور ترمذی کی ایک روایت میں سلمہ بن صخر رضی اللہ عنہ سے روایت ہے کہ انہوں نے اپنی بیوی کو اپنی مال کی پیٹھ سے مشاہدت دی لیکن ظہار کیا یہاں تک کہ رمضان گزر جا گیا اور جب آدھار رمضان گزر گیا تو وفات میں صحت کر لی -
Salman ibn Sakhr, also known as Salamah ibn Sakhr al-Bayadi, narrated that he made his wife like his mother’s back until Ramadan passed. When half of Ramadan had gone, he had intercourse with her at night. He went to the Messenger of Allah (ﷺ) and mentioned this to him. The Messenger of Allah (ﷺ) said to him: “Free a slave.” The apparent meaning of the verse and the hadith indicates that it is not required for the slave to be a believer. This was the opinion of Ata, al-Nakha‘i, and Zayd ibn Ali. Imam al-Sarakhsi said: “The text mentions the term ‘slave’ without any indication of the attribute of belief or disbelief. Restricting it to the attribute of belief would be an addition, and adding to the text is abrogation, which cannot be established by a solitary report or analogy. Furthermore, the unrestricted term has a ruling, which is its generality, and restricting it to the specific negates its ruling.”
(3) His statement regarding one who makes a declaration of zihar and has intercourse before expiating: He said: “One expiation,” meaning if he has intercourse before expiating, no additional expiation is required due to the intercourse. The only obligation is the initial expiation, meaning nothing else is required beyond the first expiation based on this hadith. This is the view of the four Imams. However, we also hold that he should seek forgiveness from Allah, as transmitted in al-Muwatta from the statement of Malik. Nuh Afandi quoted Allamah Qasim, who mentioned that Muhammad reported it in “al-Asl” as a raised hadith. The intended meaning of seeking forgiveness is repentance from this sin, which is the prohibition of intercourse before expiation.
اور ابو داؤد، ابن ماجہ اور داری نے ان سے ہی روایت کی وہ کہتے ہیں کہ حنیفی میں عورتوں سے صحت کرتا تھا اتنی کوئی شخص صحت نہ کیا کرتا تھا - ظہار کرنے والے کفارہ ادا کرنے سے پہلے بیوی سے صحت کر تو اس پر ایک ہی کفارہ لازم ہے
In the Hanafi school, a man would have sexual intercourse with as many women as he wished before paying the expiation for zihar, but if he had sexual intercourse with his wife before paying the expiation, only one expiation would be required.
عکرمہ رحمۃ اللہ علیہ حضرت ابن عباس رضی اللہ عنہما سے روایت فرما تے ہیں کہ ایک شخص نے اپنی بیوی سے ظہار کیا تھا پھر کفارہ ادا کرنے سے پہلے اس سے صحت کر بیٹھا -
پھر نبی کریم صلی اللہ علیہ والہ وسلم کی خدمت اقدس میں حاضر ہو کر اپنا واقعہ سنایا۔ آپ نے دریافت
فرما کر کس چیز نے تجہ اس پر آمدہ کیا؟ اس نے عرض کیا یارسول اللہ میں نے اس کی پازیب کی
سفیدی کو جاندنی رات میں (چھکتی) دیکھی میں بے قابو ہوگیا یہاں تک کہ اس سے محبت کر لی۔
اس کے اس بیان سے رسول اللہ صلی اللہ علیہ والہ وسلم نفس پڑے اور فرما کر اپنی پیوی سے محبت نہ
کرنا یہاں تک کہ کفارہ ادا کر دے۔
اس کی روایت ابن ماجہ نے کی ہے اور تذکرہ نے بھی اس کے قریب قریب روایت کی ہے۔
‘Ikrimah narrated from Ibn ‘Abbas (may Allah be pleased with him) that a man made zihar against his wife, then had intercourse with her before atoning. He came to the Prophet (ﷺ) and mentioned this. The Prophet (ﷺ) said, "What made you do that?" He said, "O Messenger of Allah, I saw the whiteness of her ankles in the moonlight and could not control myself." The Messenger of Allah (ﷺ) smiled and ordered him not to approach her until he atoned. [Narrated by Ibn Majah]
Tirmidhi narrated a similar hadith and said: "This is a hasan sahih gharib hadith." Abu Dawud and Nasa’i narrated it with connected and disconnected chains. Nasa’i said: "The disconnected chain is more likely correct."
(2) The statement: "Not to approach her until he atones", If he has intercourse before atonement, he must seek forgiveness and atone for zihar only. No additional expiation is required for the unlawful intercourse, and he must not repeat it until atoning, as in Sharh al-Wiqayah.
اور ابو داؤد اور نسائی نے بھی اس کی روایت مسنداور مسل دونوں طریقوں
ست کی ہے۔
دوسری حدیث: ایس شخص کو استغفار کرنا چاہیے
And Abu Dawud and Nasa'i have also narrated this hadith as musnad and mursal through both chains. Another hadith: One should seek forgiveness for this person.
سلیمان بن پیار رحمۃ اللہ علیہ سلم بن صخر رضی اللہ عنہ سے روایت کرتے ہیں
اور وہ حضور نبی کریم صلی اللہ علیہ وسلم سے روایت کرتے ہیں کہ آپ نے ارشاد فرما کر کہ
والشخص کفارہ ادا کرنے سے پیلے (پیوی سے) صحبت کر تو اس پر ایک کی کفارہ لازم ہے۔
اس کی روایت ترمذی، اور ابن ماجہ نے کی ہے اور امام ماکر رحمۃ اللہ علیہ نے فرما یہ کہ
جو اپنی پیوی سے ظہار کرے پھر کفارہ ادا کرنے سے پہلے صحبت کرے تو اس پر ایک کی کفارہ
واجب ہے لیکن وہ صحبت سے رکارہ یہاں تک کہ کفارہ ادا کرے اور اللہ تعالیٰ سے استغفار کرے
اور امام ماکر نے پیچھی فرما یہ کہ اس بارے میں میں نے جتنے اقوال سے جین ان سب میں یہ
قول بہترین قول ہے۔

اللہ علیہ والہ وسلم سے پر روایت پہو چی ہے کر ایک شخص نے اپنی پیوی سے ظہار کیا اور کفارہ
اور کر نے سے پہلے صحبہ کر لیا س کی اطلاع حضور صلی اللہ علیہ وآلہ وسلم کو ملی تو آپ نے اس کو حکم دیا
کروہ اللہ تعالیٰ سے استغفار کرے اور کفارہ ادا کر نے سے پہلے دوبارہ صحبہ نہ کرے۔
اور امام محمد رحمۃ اللہ علیہ کے بیانات کی سندر سول اکرم صلی اللہ علیہ وآلہ وسلم تک پہوچتی ہے
چنانچہ کتاب الصوم میں امام محمد نے اس روایت کی سندر سول اللہ صلی اللہ علیہ وآلہ وسلم تک
پہوچایا ہے۔
