خلع اور طلاق کاپان
ف : واضح ہو کہ عربی زبان میں خلع کے لفظی معنی بدنا سے کثر اتارنے اور کسی چیز کے نکالنے کے ہیں اور اصطلاح شرع میں مال کے بدل میں طلاق دینے کو کہتے ہیں جس میں میان بیوی کے درمیان نا اتفاقی پیدا ہوجائے اور بیوی کسی صورت میں اپنے شوہر کے ساتھ رہنے کیلئے تیار نہ ہو تو خودند کے ذیہ ہوئے مہر کو واپس کردے یا معاف کردے اور شوہراس کے عوض طلاق دیے۔ جس طرح مردوی حق حاصل ہے کہ کسی وجہ سے اگر بیوی ناپسند ہے اور نباه نہیں تو مردو طلاق دے سکتا ہے اس طرح عورت کو بھی حق حاصل ہے کہ اگر شوہراس پسند نہ ہے اور کسی صورت میں باہ مکن نہیں تو مال دے کراپنی خلاصی کرسکتی ہے۔ طلاق کے لغوی معنی کہولنے کے ہیں اور اصطلاح شریعت میں نکاح کی گره کو ٹول دینے اور زوجیت کے رشتے اور ربط کو توڑ دینے کو طلاق کہتے ہیں۔ جب میان بیوی میں نا اتفاقی پیدا ہوجائے تو دونوں میں انہٹائی کوشش کرنے ملاب کرادیاجائے بلصورت مجبری دونول کوالگ کرادیاجائے اوراس صورت میں طلاق جائزہے لیکن اللہ تعالیٰ کے نزوکیے سارے حال او رجا نزکامون میں ناپسندیدہ کامطلاق ہے۔ اگر ایک سی ثست میں تین طلاق دیے تو عورت بمیش کے لیے اپنے شوہر سے جدا ہوجائے گی اور یطریقہ محکی نہیں اس لی طلاق دینے کی بہترین صورت یہ ہے کہ ایک ایک مہینے کے فاصلے میں ایک طلاق دے پھر دومسر مہینے کے ختم پر پھرتیرسے کے ختم پر ای فاصلا اس لیے رکھا گیا تاکہ دونول کوسوچنے کا موقع مل جائے جس سے اصلاح کی کوئی صورت نکل آئے اگر نباه کی کوئی صورت پیدا نہ ہوتے چھوڑدینے کا اختیار ہے۔12
It is clear that in Arabic, the literal meaning of divorce (khul‘) is to remove something from its place or to take something out. In the legal terminology of Islam, it refers to the act of a husband granting divorce to his wife in exchange for some compensation, when there is a lack of harmony between them and the wife is unwilling to continue living with her husband under any circumstances. In such a case, she may return her dower (mahr) or forego it, and the husband grants her a divorce in return. Just as a man has the right to divorce his wife if he finds her disagreeable for some reason, but not for a prohibited reason, similarly, a woman also has the right to seek separation if she finds her husband disagreeable and there is no compelling reason to remain together. She can achieve this by offering some compensation.
The lexical meaning of divorce (talaq) is to untie or release, and in the legal terminology of Islam, it refers to the dissolution of the marital bond and the termination of the relationship and ties of marriage. When there is a lack of harmony between a husband and wife, every effort should be made to reconcile them before resorting to separation. However, if reconciliation is impossible, then divorce is permissible, though Allah, the Exalted, considers all forms of separation undesirable. If three divorces are pronounced at once, the woman will be permanently separated from her husband, and this method is not recommended. The best way to pronounce divorce is to do so one at a time, with a month's interval between each pronouncement. The first divorce is pronounced at the end of the first month, the second at the end of the second month, and the third at the end of the third month. This interval is intended to provide both parties with an opportunity to reflect and seek reconciliation. If no reconciliation is possible, the option to separate remains.
وقول الله عز وجل الطلاق مرتين فامساك بمعروف او تسريح باحسان ولا يجب لكم ان تاخذوا مما اتيتموهن شييا الا ان يخافا الا يقيما حدود الله فان خفتما الا يقيما حدود الله فلا جناح عليهما فيما افتدت به تلك حدود الله فلا تعتدوها ومن يتعد حدود الله فاوليك هم الظالمون فان طلقها فلا تحل له من بعد حتي تنكح زوجا غيره فان طلقها فلا جناح عليهما ان يتراجعا ان ظنا ان يقيما حدود الله وتلك حدود الله يبينها لقوم يعلمون
اور ارشاد باری تعالیٰ ہے : (سورۃ بقرہ، پ:2، ع:28، آیت نمبر:228/230، میں) طلاق (جس کے بعد رجوء کر لے سلسلہ ہو تو دوسری طلاق پیش ہیں جو) دودفع (کر کے دی جائیں) پھر (دو طلاق کے بعد یاتو) وسطور کے مطابق (بحلاٰئی کے ساتھ زوجیت میں) رکنا ہے یاحسن سلوک کے ساتھ رخصت کرو دینا ہے اور جوتم ان کو دے پھر ہوا س میں سے تم کو پچھڑا (پچھوں والے) لینا جائز نہیں گمری کہ میال پیوی کو (اس باٹ کا) خوف ہوگے خدا نے (میال پیوی کے سلوک کی) جو حدی نظہرادی ہیں ان پرتام نہیں رہ سکیں گے تو اس صورت میں کرتم لوگون کو اس باٹ کا خوف ہو کہ میال پیوی اللہ کی مقرر کردہ حدول پرتام نہیں رہ سکیں گے اورعورت (اپنا پچھا پچڑا نے کے عوض) پچھو دیدے تو اس میں دونوں پرپچھڑا نہیں - پیالدکی (قاٰتم کی ہوتی) حدی میں قوتم (ان کوتوڑ کر) آ گے نہ برصحو اور جوالدکی (مقرر کردہ) حدول کوتوڑ کرآ گے برہو جا کیں تو میں لوگ خالم ہیں - پھراگر (تمہاری بار) عورت کوطلاق دی تو اس کے بعد عورت جب تک دوسروں شوبرہ نکاح نکر لے (اور وہ صحبت کچھ کر لے) اس کے لے حلال نہیں ہوسکتی پھروہ دوسرا شوبراس کوطلاق دیے تو دونوں (میال پیوی) پرپچھڑا نہیں سکتا کہ (پھرباتم) نکاح کر لیس بشتر طیکہ دونوں کو امید ہو کہ اللہ کی (مقرر کردہ) حدول کو قائم رکسکیں گے اور پیالدکی (قاٰتم کردہ) حدی میں جتن کووہ ان لوگون کے لے بیان کرتا ہے جو (خانداری کی مصلحت کو) جاتے ہیں -
And the guidance is from Allah, the Exalted (in Surah Al-Baqarah, Vol. 2, Pg. 28, Verse number: 228/230): Divorce (if followed by reconciliation and then another divorce) should be pronounced twice, after which (if the second divorce has been pronounced) one should either retain (the wife) with kindness or release her with kindness. And it is not lawful for you to take back anything from what you have given them, unless both fear that they will not be able to maintain the limits ordained by Allah. If you fear that they will not be able to maintain the limits ordained by Allah, then there is no blame upon either of them concerning the ransom paid by her (to regain her freedom). These are the limits set by Allah; do not transgress them, for those who transgress the limits of Allah are the wrongdoers. And if he divorces her (for the third time), she shall not be lawful to him again until she marries another husband and he divorces her. Then, if he divorces her, there is no blame upon them if they return to each other, provided they believe that they can maintain the limits ordained by Allah. These are the limits of Allah, which He makes clear to a people who have knowledge.
وقوله تعالي وان اردتم استبدال زوج مكان زوج وانيتم احدهن قنطارا فلا تاخذوا منه شييا اتاخذونه بهتانا واثما مبينا وكيف تاخذونه وقد افضي بعضكم الي بعض واخذنا منكم ميثاقا غليظا
اور اللہ تعالیٰ کا ارشاد ہے : (سورۃ نساء، پ:4، ع:3، آیت نمبر:20/21، میں) اوراگر (تمہاری ایک سے زائد پیویاں ہوتی) تم (ان میں سے) ایک پیوی کے بدلہ دوسری بلدناجا پہا ورتمنے ان میں سے ایک کومال کثرت دیتیا ہوتو تم اس میں سے پچھو واپس نہ لو کیا (تمہاری غیرت جاتز رشتہ سے کر) کسی قسم کا بهتان لگا کروا رصرتح گناہ کا الزام دے کر (اپنا ویاہو مال) اس سے داپس لینا جا ہیں اورتم اس کے واپس لے لے سکتے ہو حالاکہ تم ایک دوسروں سے پہلو پہلو ول چک ہو، اوروہ تم سے پنہتعمہر کچھ لے چکی ہیں -
And the guidance of Allah Almighty is: (Surah An-Nisa, Part 4, Page 3, Verse Number: 20/21) If you wish to replace one of your wives with another and you have given one of them a great deal, do not take back anything from what you have given her. Would you take it by slandering her or accusing her of a sin, and then take back what you have given her, even though you have already consummated the marriage with her, and she has taken some of what you have given her? -
وقوله تعالي يا ايها النبي لم تحرم ما احل الله لك تبتغي مرضات ازواجك والله غفور رحيم قد فرض الله لكم تحله امانكم
اور اللہ تعالیٰ کا ارشاد ہے : (سورۃ تحریم، پ:28، ع:1، آیت نمبر:1/2، میں) " اے نبی (صلی اللہ علیہ
والمسلم) جو حزیری اللہ نے آپ کیلئے حلال کی جین آپ اپنی پیوون کی خوشنوودی حاصل کرنے کیلئے (اپنے اوپر)
کیول حرام کر لیتا ہے جس کوالله نے آپ پ کیلئے حلال فرماتا ہے۔ اور اللہ تعالیٰ بھٹش والا اور مہربان ہے تم
دونوں کیلئے) اللہ تعالیٰ نے تمہاری قسموں کو توڑ ذا لے کا (جس) کفارہ مقرر کروایا ہے۔
ف: واضح ہوا کہ "تفسیرات احمدی" میں لکھا ہے کہ اس آیت سے ثابت ہے کہ کسی حلال چیز کا پن اوپر حرام
کر لینا وقت میں ہے اور اس پر کفارہ بھی واجب ہے۔ چنانچہ حضرت مقاطل رحمۃ اللہ علیہ سے مرودی ہے کہ رسول اللہ صلی اللہ
علیہ وسلم نے لی لی ماری رضی اللہ عنہا کو اپنے اوپر جو حرام کر لیا تھا آپ نے کفارہ میں ایک غلام آزاد فرما یا (اہ) اور
کشف میں یوں لکھا ہے امام ابوحنیفہ رحمۃ اللہ علیہ کے پاس برودہ حلال چیز حس کو حرام کر لیا جاتے وہ تم ہے مشاہدہ کہا نے
کو اپنے اوپر حرام کر لیا توگو یا س نے کہا نا نے کہا نے کی تم کہا نی، لوئذی کو حرام کر لیا توگو یا س نے صحبت ذکر نے کی تم
کہا نی اور پیوی کو بخیر کی نیت کے حرام کر لیا توگو یا س نے ایلا کیا (ایلاء کے احکام آگے آرہے ہیں) اور اگر ظہار کی
نیت کیا تو ظہار ہو گا (ظہار کے احکام بھی آگے آرہے ہیں) اور اگر پیوی کو حرام کرتے وقت طلاق کی نیت کر لیا تو طلاق
باتن واقع ہو گیاور پیوی کو حرام کرنے میں نیت کا اعتبار ہو گا لیکن دو طلاق کی نیت کر نے تو دو طلاق اگر تین کی نیت کر نے تو
تین طلاق وا قع ہو گی اور اگر بی کہ کر میں نے جحوی نیت کی سے توی معاملہ اس کے اور اللہ تعالیٰ کے درمیان سے قانون
کاس سے تعقل نہیں اور اگر بخیر نیت کے پی کہ کہ برحلال چیز مجھ پر حرام ہے تو اس کی قسم کہا نے اور پانی پر ہو گی اور نیت
کرنے کی صورت میں نیت کے مطابق قسم ہو گی۔ حضرت ابوبرہ، حضرت عمر اور حضرت ابن عباس اور حضرت ابن مسعود اور
حضرت زید رضی اللہ عنہم ان تمام حضرات سے مجھی مرودی ہے کہ کی حلال چیزوں کو پن اوپر حرام کر لینا قسم ہے۔12
خاوندے ناراضی پر پیوی خلع لے سکتے ہے
And the guidance of Allah Almighty is: (Surah Tahrim, Vol. 28, Part 1, Verse number: 1/2) "O Prophet (peace be upon him)"
And the Muslim, whom Allah has made lawful for you to enjoy, He would not make unlawful for you what He has made lawful for you to obtain the pleasure of your wives. And Allah, the Exalted, is Forgiving and Merciful to both of you. Allah, the Exalted, has prescribed expiation for breaking oaths. It is clear that in 'Tafseer-e-Ahmedi' it is written that this verse establishes that making something lawful unlawful for oneself at a specific time and its expiation are obligatory. According to a narration from Hazrat Mughirah (RA), the Messenger of Allah (SAW) took as expiation for making Mary (RA) unlawful for himself the freeing of a slave. In 'Kashf,' it is written that Imam Abu Hanifah (RA) observed that when a lawful thing is made unlawful for oneself, it is considered an oath. If one makes something unlawful for oneself, it is considered an oath; if one makes sexual intercourse unlawful for oneself, it is considered an oath; if one makes divorce the intention while making something unlawful, then divorce will occur, and the intention in making something unlawful is valid. However, if two divorces are intended, then two divorces will occur; if three are intended, then three divorces will occur. If one makes a conditional oath, the matter is between the person and Allah, the Exalted. If one makes an oath with the intention of making a lawful thing unlawful for oneself, then the oath is considered as such, and the oath will be according to the intention. Narrations from Hazrat Abu Bakr, Hazrat Umar, Hazrat Ibn Abbas, Hazrat Ibn Masud, and Hazrat Zaid (RA) all indicate that making lawful things unlawful for oneself is considered an oath. A husband can seek a divorce (khul') due to dissatisfaction with his wife's sexual relations.
_ امن عباس رضی اللہ عنہما سے روایت ہے کہ ثابت بن قیس رضی اللہ تعالیٰ عنہ کی
پیوی نی کریم صلی اللہ علیہ والہ وسلم کی خدمت اقدس میں حاضر ہو گی اور عرض کیس یار سول اللہ صلی
اللہ علیہ والہ وسلم میں ثابت بن قیس کے اخلاق اور دینداری پر عجب نہیں کہتی ہو ل اور نہ آن پر غصہ
کرتی ہو ل لیکن میں اسلام میں ناشکری کو پسند نہیں کرتی ہو ل (لیکن میں ان کی نافرمانی سے دورتی
ہو ل اور میں ان کی کماحق خدمت نہیں کرسکتی اس لیے آپ مجھے ان سے علیحدہ کرادیں) رسول اللہ
صلی اللّٰہ علیہ وسلم نے فرمايانہول نے تم کو (مہر میں) جواب دیا تھا کیا تم اس کو واپس کردوگے؟ انہوں نے جواب دیا بل! تو رسول اللّٰہ صلی اللّٰہ علیہ وسلم نے (ان کے خاوند سے) فرمایا تم باغ کو لے لواوران کو طلاق دیرو)-
اس کی روایت بناری نے کی ہے-
قطعن اوردارتی اورنہیقت نے اپنی اپنی سنن میں حضرت ابن عباس رضی اللّٰہ عنہما روایت کی ہے کہ نبی کریم صلی اللّٰہ علیہ وسلم نے خلع کو طلاق باں قرار دیا ہے اوراس مستند میں کئی روايتین وارد ہیں جن کو درمنشور اوردوسری کتابوں میں تفصیل سے بیان کیا گیا ہے-
ف(1): واقع ہو کر اس حدیث ثریف میں حضرت ثابت بن قیس رضی اللّٰہ عنہ کی پیوی نے خلع کی جوخواش کی اس کی وجہ شارحین حدیث نے پیشانی ہے کہ ان کی پیوی بہت خوبصورت تھی اوران کے مقابلہ میں ثابت بن قیس بہت بدصورت اورنہایت پست قد تھا اوراس وجہ سے ان کی پیوی میں طبعاً ناگواری پیدا ہوگی تھی اوروہ اپنے شوہر کے ساتھ وزندگی گزرنا نہیں چاہتی تھی اس لیے ان کی پیوی نے رسول اللّٰہ صلی اللّٰہ علیہ وسلم کی خدمت میں خلع کی ورخواست کی اورحضور نے ان کے اوران کی پیوی کے درمیان خلع کروا دیا-(اشعة اللمعات)-
ف(2): اس حدیث ثریف سے خلع کی مشروعيت ثابت ہوتی ہے کہ پیوی کو خاوند سے ناگواری ہوجائے اورسی صورت میں وہ اپنے خاوند کے ساتھ وزندگی گزرنا نہ چاہے تو وہ اپنامہر معاف کر کے خلع حاصل کرسکتی ہے جسیا کہ ثابت بن قیس رضی اللّٰہ عنہ کی پیوی نے مہر میں دیہ ہوئے باغ کو واپس کر کے خلع حاصل کر لیا۔12
ف(3): واقع ہو کر حضور نبی کریم صلی اللّٰہ علیہ وسلم نے صدر کی حدیث میں خلع کو طلاق باں قرار دیا ہے اور صحابہ کرام میں حضرت عثمان،حضرت علی،حضرت ابن مسعود رضی اللّٰہ عنہم اورتا بیین میں حضرت حسن بصری،حضرت سعید بن المسیب،حضرت عطاء،ثرتہ،حضرت شعیب،حضرت قبیصہ بن ذؤیب،حضرت مجاهد،حضرت ابلسلیم،حضرت ثعلبی،حضرت زبری،حضرت ثوری،ماما او زاعی،حضرت محول،ماما ابن البلا ث،حضرت عروہ،ماما ما کے ان سارے حضرات نے خلع کو طلاق باں قرار دیا ہے اوراما مشفی رحمۃ اللّٰہ علیہ کا قول جدید ہی ہے۔بتا ماما احد بن
حنبعل اورامام اسماعیل کا قول پیہ کر خلع سے نکاح فسخ ہوتا ہے طلاق واقع نہیں ہوتی یقول حضرت ابن عباس رضی اللہ عنہ بہ اورامام شافعی کا قول قد میں بھی بہ۔اورحنفی کی ویل کر خلح سے طلاق باقی ہوتی ہے صدر کی حدیث اوردوسرو احدیث بھی ہیں (اہ) اورواحد ہو کر خلح کے طلاق ہونے سے تین طلاق کا جوہ مردوحاصل ہے اس میں کی ہوجائے گی اورخلع والی عورت کومطلقہ عورت کی طرح عدت بھی گزر انہی ہوگی البند خلح کے فسخ ہونے کی صورت میں طلاق کے احکام متتعلق نہیں ہوں گے۔(تعلیق محمد، عمرۃ الرعاي12)
Ibn Abbas (may Allah be pleased with them) narrated that the wife of Thabit ibn Qays came to the Prophet (ﷺ) and said, “O Messenger of Allah, I do not fault Thabit ibn Qays in his character or religion, but I dislike disbelief in Islam.” The Messenger of Allah (ﷺ) said, “Will you return his garden to him?” She said, “Yes.” The Messenger of Allah (ﷺ) said, “Accept the garden and divorce her once.” Narrated by Bukhari.
Ad-Daraqutni and Al-Bayhaqi narrated in their Sunan from him that the Prophet (ﷺ) made khul‘ a single final divorce.
There are many narrations in this regard, detailed in Ad-Durr al-Manthoor and elsewhere.
(1) The statement: “Allah has already ordained for you [Muslims] the dissolution of your oaths”: This means Allah made prohibiting the lawful an oath, requiring expiation. The end of the verse mentioning “dissolution of your oaths” relates to the beginning about prohibiting the lawful. It is narrated from Muqatil that the Messenger of Allah (ﷺ) freed a slave to expiate prohibiting Mariyah. Allah did not merely prescribe expiation but termed it an oath, as in Tafsir al-Ahmadiyyah (summarized). The author of Kashshaf says: If asked about the ruling on prohibiting the lawful, it is disputed. Abu Hanifah views it as an oath in all cases, considering the intended benefit of what is prohibited. If one prohibits food, it is an oath against eating it; a slave woman, against intimacy; or a wife, against ila’ (oath of abstinence) if no intent is specified. If one intends zihar (likening to a kin), it is zihar; if divorce, it is a final divorce. If two or three divorces are intended, it follows the intent. If one says, “I intended to lie,” it is a matter between him and Allah, not upheld in judgment. If one says, “All lawful things are unlawful to me,” it applies to food and drink if no intent is specified, otherwise per the intent. Ash-Shafi‘i does not view it as an oath but a cause for expiation only for women. If divorce is intended, it is revocable for him. Abu Bakr, Umar, Ibn Abbas, Ibn Mas‘ud, and Zayd say prohibiting the lawful is an oath.
(2) The statement: “Accept the garden and divorce her…”: This proves the legitimacy of khul‘, on which scholars unanimously agree. The details of khul‘ were discussed under “Divorce is twice”, which is relevant here.
(3) The statement: “The Prophet (ﷺ) made khul‘ a single final divorce”: Scholars differ on whether khul‘ is a divorce. Hanafis say it is a single final divorce, as do Uthman, Ali, Ibn Mas‘ud, Al-Hasan, Ibn al-Musayyib, Ata, Shurayh, Ash-Sha‘bi, Qabisah ibn Dhu’ayb, Mujahid, Abu Salamah, An-Nakha‘i, Az-Zuhri, Ath-Thawri, Al-Awza‘i, Mak-hul, Ibn Abi Najih, Urwah, Malik, and Ash-Shafi‘i in his new opinion. Ahmad and Ishaq say it is a separation and dissolution, not a divorce, as do Ibn Abbas and Ash-Shafi‘i in his old opinion. Our evidence is this Hadith and other narrations. The practical difference is that khul‘ reduces the number of divorces and her waiting period follows the second ruling, not the first, as in At-Taliq al-Mumajjad and Umdat ar-Ri‘ayah (summarized).
This narration is reported by Banari-
Qutain, Darati, and Nihaiq have narrated in their respective Sunan that the noble Ibn Abbas (RA) has reported that the Blessed Prophet (SAW) declared Khul' as a form of divorce. In this authentic tradition, several narrations are mentioned, which have been elaborated upon in the manuscripts and other books.
(1): It is reported in this tradition that the wife of Thabit bin Qays (RA) sought Khul' due to her aversion towards him. The commentators of Hadith have explained that his wife was very beautiful, while Thabit bin Qays was very ugly and extremely short, which naturally caused aversion in his wife, and she did not want to live with her husband. Therefore, she requested Khul' from the Messenger of Allah (SAW), and he granted the Khul' between them and her husband. (Ash'at al-Lama'at)
(2): This tradition establishes the legitimacy of Khul' when a wife feels aversion towards her husband and does not wish to live with him. In such a case, she can obtain Khul' by forfeiting her dowry, as the wife of Thabit bin Qays (RA) returned the garden given as part of her dowry and obtained Khul'.
(3): Indeed, the Blessed Prophet (SAW) declared Khul' as a form of divorce in the aforementioned tradition. Among the noble Companions, Uthman, Ali, Ibn Mas'ud (RA), and among the Tabi'in, Hasan Basri, Sa'id bin Musayyib, Ata, Tariq, Shu'ayb, Qubaysah bin Dhuayb, Mujahid, Ubaysalim, Tha'labi, Zabri, Thawri, Maimun, Ibn al-Bala, Urwa, and others all considered Khul' as a form of divorce. However, the opinion of Ash-Shafi'i (RA) is more recent. According to Imam Ahmad bin Hanbal and Imam Isma'il, Khul' results in the annulment of marriage without actual divorce, as stated by Ibn Abbas (RA) and Imam Shafi'i in his later opinion. According to the Hanafis, Khul' results in actual divorce. Both the primary tradition and the secondary traditions support this view (Ah). Moreover, the three divorces that would be required for a man to divorce his wife will be fulfilled by Khul', and the woman who obtains Khul' will observe the waiting period (iddah) like a divorced woman. If Khul' results in the annulment of marriage, the rulings related to divorce will not apply. (Taliq Muhammad, Umrat al-Ra'iy)
نافع رحمۃ اللہ علیہ سے روایت ہے اور وہ صفیہ بنت ابی عبید کی ایک آزادشده لونڈی سے روایت کرتے ہیں کہ صفیہ رضی اللہ عنہا نے اپنا پورا مال دے کراپنے خاوند (حضرت ابن عمر رضی اللہ عنہما) سے خلع کیا تو عبد اللہ بن عمر نے اس پر (اعتراض کیا اور نہ انکار کیا)-اس کی روایت امام ماکے نے کی ہے)- بلا وجہ طلاق طلب کرنے والی عورت پر جنت کی خوشبودرامہ
Nafi‘ narrated from a freedwoman of Safiyyah bint Abi Ubayd that she sought khul‘ from her husband for everything she owned, and Abdullah ibn Umar did not disapprove. Narrated by Malik.
ثوبان رضی اللہ عنہ سے روایت ہے کہ وہ فرماتے ہیں کہ رسول اللہ صلی اللہ علیہ وسلم نے ارشادفرمايا کہ جس کسی عورت نے اپنے شوہر سے بغیر کسی (معقول) عذر کے طلاق کا مطالبہ کیا تو اس پر جنت کی خوشبودرامہ۔ اس کی روایت امام احمد،ترمزی،ابوداوود،ابن ماجراوردار قی نے کی ہے۔ ف: واضح ہو کہ حضرت ابن عباس رضی اللہ عنہما نے ایک اورروايت ہے کہ رسول اللہ صلی اللہ علیہ وسلم نے فرمایا ہے کہ یہوی اپنے خاوند سے طلاق طلب نہ کرے جب تک وہ بالکلیہ مجبر نہ ہو جائے۔ لیکن جب تک اس کو ایسی تکلیف نہ ہو کہ طلاق کے بغیر کوئی اور علاج نہ ہو، اور اگر مجبوری کے بغیر اگر یوی اپنے شوہر سے طلاق طلب کرے گی تو وہ جنت کی خوشبود پا نے گی اور جنت کی خوشبود پا نے بر س کے فاصلے آئی ہے۔ لیکن ایسی عورت جنت سے اس قدر دور رہ گی-(حاشیہ مشکوۃ)-
منافق عورتیس کوئی ہے۔
Thawban (may Allah be pleased with him) narrated that the Messenger of Allah (ﷺ) said: “Any woman who requests divorce from her husband without harm, the fragrance of Paradise is forbidden to her.” Narrated by Ahmad, Tirmidhi, Abu Dawud, Ibn Majah, and Ad-Darimi.
(1) The statement: “She sought khul‘ from her husband for everything she owned…”: In Ad-Durr al-Mukhtar, it is prohibitively disliked to take anything, including waiving her rights, if the discord is from the husband. If from the wife, it is not disliked, even if both are at fault or more than what was given, per the preferred view. Ash-Shamni validated the dislike of taking more. Multaqa’s phrasing, “no harm in it,” suggests it is mildly disliked, reconciling Fath’s rejection of dislike for taking more (per Jami‘ as-Saghir) with Ash-Shamni’s affirmation (per Asl). The first negates prohibition, the second affirms mild dislike, as clarified in Fath and followed in Bahr. The issue was disputed among the Companions, with texts from both sides, and Fath concludes Jami‘’s narration is stronger, though taking more is less preferable, as in Radd al-Muhtar (summarized).
(2) The statement: “The fragrance of Paradise is forbidden to her”: Al-Khazn states that most scholars permit khul‘ without discord or anger, though it is disliked due to severing ties without cause, per Thawban’s Hadith: “Any woman who requests divorce from her husband without harm, the fragrance of Paradise is forbidden to her,” narrated by Abu Dawud and Tirmidhi. Ibn Umar narrated the Prophet (ﷺ) said: “The most hated of lawful things to Allah is divorce,” narrated by Abu Dawud. The majority’s evidence for permitting khul‘ without discord is “And if they give something of it willingly, then eat it pleasantly and wholesomely” [An-Nisa: 4]. If she can gift her dowry without harm, it is more fitting for khul‘, which makes her master of herself. In Rahmat al-Ummah, the Imams agree that if a woman dislikes her husband for his appearance or bad companionship, she may seek khul‘ for compensation. If they mutually agree on khul‘ without cause, it is permissible and not disliked.
ابوبهریه رضی اللہ عنہ سے روایت ہے کہ نبی کریم صلی اللہ علیہ وسلم نے
ارشاد فرمایا ہے کہ شوہر ول کی نافرمانی کرنے والی عورتیس اور (ب ضرورت) خلع طلب کرنے والی
عورتیس، یہ منافق عورتیس ہے۔-
اس کی روایت نسلی نے کی ہے-
اللہ تعالیٰ کو طلاق ناپسند ہے
Abu Hurayrah (may Allah be pleased with him) narrated that the Prophet (ﷺ) said: “Women who seek divorce or khul‘ are hypocrites.” Narrated by An-Nasa’i.
ابن عمر رضی اللہ عنہما سے روایت ہے کہ حضرت نبی کریم صلی اللہ علیہ وسلم نے ارشاد
فرمایا ہے کہ اللہ تعالیٰ کے پاس حلال چیزول میں زیادہ ناپسندیدہ چیز طلاق ہے- (اس کی روایت
ابوداوود نے کی ہے)-
ف : واضح ہوگا کہ نکاح کا مقصد ازواج و اتحی زندگی میں اتفاق اور زندگی بھرا تحاور محبت سے زندگی بسر کرنا اور نسل
انسانی میں اضافہ کرنے کے لیے طلاق منتہے اس کے برخلاف اگر میان بیوی میں کسی ایک کی طرف سے ایسی
زیادتی اور ایذاء رسانی ہوجائے تو زندگی گزرنا دونوں کے لیے دشور ہو جائے تو ان کی صورت میں طلاق درست
ہے

Ibn Umar (may Allah be pleased with them) narrated that the Prophet (ﷺ) said: “The most hated of lawful things to Allah is divorce.” Narrated by Abu Dawud.
(1) The statement: “The most hated of lawful things to Allah is divorce”: Ash-Shafi‘i says all divorce is permissible, as in Hidayah. Our view, per Ad-Durr al-Mukhtar, is that divorce is permissible per the general verses, though some say the most correct view is prohibition except for pressing need or major issue, with the first view being the adopted one, as in Bahr. Their statement, “Its default is prohibition,” means the lawgiver set aside this default and permitted it, even recommending it for a harmful or prayer-neglecting wife. In Radd al-Muhtar’s gloss: The first view (permissibility) is supported by “So divorce them at their prescribed periods” [At-Talaq: 1] and “There is no blame upon you if you divorce women…” [Al-Baqarah: 236]. The Prophet (ﷺ) divorced Hafsah without suspicion or major issue, as did the Companions. Al-Hasan ibn Ali frequently married and divorced. The Hadith, “The most hated of lawful things to Allah is divorce,” narrated by Abu Dawud, means “lawful” includes permissible, recommended, obligatory, and disliked acts, as Ash-Shamni said, per Bahr (summarized). The response is that being hated does not negate being lawful, as lawful includes the disliked, which is hated, unlike lawful acts where abstention is not preferred. This supports the second view, as will be further affirmed. Their statement responds to Fath’s claim that permissibility negates prohibition except for major issues or suspicion, citing the Prophet’s divorce of Hafsah without these. This contradicts their claim that its default is prohibition due to ingratitude for marriage’s blessing, with permissibility for need of escape. The Hadith “The most hated of lawful things to Allah is divorce” is addressed in Bahr: This default indicates legal prohibition, but the lawgiver set it aside, making permissibility the legislated ruling, like marriage’s default prohibition permitted for procreation. Does this imply marriage is prohibited? The truth is divorce’s permissibility without need for escape, per the cited evidence. I say: The difference is clear. Marriage’s default prohibition was entirely lifted, leaving no prohibition except for external reasons. Divorce’s permissibility is inherent as it removes bondage, but its prohibition persists for severing marriage, which holds religious and worldly benefits. This aligns with prayer on usurped land, permissible and prohibited from different aspects. Divorce’s default prohibition remains, unlike marriage’s, which was lifted for procreation and world continuity. Divorce’s default prohibition persists except for permitting reasons, i.e., the need for escape, meaning “Its default is prohibition, permitted for need of escape.” Without cause, it is folly, ingratitude, and harm to her, her family, and children. Thus, its cause is the need for escape due to incompatible temperaments or enmity causing failure to uphold Allah’s limits, not limited to major issues or suspicion, as chosen in Fath. Without a permitting need, it remains prohibited, per “Then if they obey you, do not seek means against them” [An-Nisa: 34], meaning do not seek separation, and the Hadith “The most hated of lawful things to Allah is divorce.” Fath states: “Permissible” applies to times when the need is verified. When present, divorce is permitted, explaining the Prophet’s and Companions’ actions to avoid attributing frivolous harm to them. Bahr’s claim that permissibility without need for escape is incorrect if escape means without cause, as it contradicts “Permitted for need of escape.” If it means with need, it is correct. Bahr’s claim that Fath’s validation is a weak opinion contradicts our scholars, as the weak view limits permissibility to major issues or suspicion, while Fath validates non-restriction, per their general need, as clarified, showing no contradiction between the adopted view and Fath’s validation, per Fath al-Qadir.
معاز بن جبل رضی اللہ عنہ سے روایت ہے وہ فرماتے ہیں کہ رسول اللہ صلی اللہ
علیہ وسلم نے ارشاد فرمایا ہے کہ اے معاز! تم مخلوق ایسی میں روے زمین پر(غلامول کو)
آزاڈ کرنے سے بلاہ کر کونی چیز اللہ تعالیٰ کو محبوب بہیں ہے اور روے زمین پر اللہ تعالیٰ نے طلاق
سے بلاہ کر کونی مبغوض چیزہیں پیدا کی- اس کی روایت دار قطی نے کی ہے-
ف : اس حدیث شریف میں ارشاد ہے کہ اللہ تعالیٰ کو اپنی مخلوقات میں غلاموں کو آزاد کرنا بھی پسند ہے۔ اس لیے کہ غلام کو آزاد کرنا حقیقت میں ایک انسان کو دوسروں انسان کی غلاوی سے آزاد کرنے کے حسے وہ اپنے رب کی بنگی کے حقوق ادا کرنے میں کیسوہو جاتا ہے اور جس ما کے نے اپنے غلام کو آزاد کیا اس کو دوزخ سے رہائی ملتی ہے، غلاموں کو آزاد کرنا اپنے جیسے انسانوں کو غلاوی کے بندہ سے جوانسان کے لئے عارہ نکالا ہے اور غلاموں کی آزادی دوسروں پر حمت اور شفقت ہے جودراصل اللہ تعالیٰ کی صفت ہے، اس سے اپنے آپ کو متصرف کرنے ہے۔(مرقات12)
وقت واحد میں تین طلاق دینے سے پیوی جداہوتی ہے
Mu‘adh ibn Jabal (may Allah be pleased with him) narrated that the Messenger of Allah (ﷺ) said: “O Mu‘adh, Allah has not created anything on the face of the earth more beloved to Him than emancipation, nor anything more hated to Him than divorce.” Narrated by Ad-Daraqutni.
مجابد رحمۃ اللہ تعالیٰ روایت ہے وہ فرماتے ہیں کہ میں حضرت ابن عباس رضی اللہ عنہما کے پاس موجود تھا ایک شخص آپ کی خدمت میں حاضر ہو کر عرض کیا کہ اس نے اپنی پیوی کو تین طلاق دی ہیں، مجابد کہتا ہیں کہ حضرت ابن عباس نے سکوت اختیار فرما تو میں نے مگران کیا کہ شاید آپ اس پراس کی پیوی کولوٹاوی گے (لمجن) آپ نے فرمایا کہ تم میں ایک شخص جماقت کر بیٹھتا ہے اور پھر (میرے پاس) آتا ہے (لمجن تین طلاق دیتاتا ہے جس سے پیوی کو رجوع نہیں کر سکتا ہے اور میرے پاس آکر کہتا ہے) اے ابن عباس ! اے ابن عباس ! (پیوی کو رجوع کر لینے کی کونی صورت نہیں لے) اور اللہ تعالیٰ نے ارشاد فرمایا ہے کہ جواللہ تعالیٰ سے دورتاتے اللہ تعالیٰ ایسے شخص کے لئے راستہ نکالتا ہے اورتو اللہ تعالیٰ سے ذرا نہیں تو میں مجھے تیرے لیے کونی راستہ نہیں نکال سکتا تو نے اپنے رب کی نافرمانی کی ہے اور تیری پیوی (تیرے تین طلاق دینے سے) تجہے جداہوتی۔

Mujahid narrated: I was with Ibn Abbas when a man came to him and said he had divorced his wife thrice. He remained silent until I thought he would return her to him, then said, “One of you goes and commits folly, then says, ‘O Ibn Abbas, O Ibn Abbas!’ Allah said, ‘And whoever fears Allah, He will make for him a way out.’ You did not fear Allah, so I find no way out for you. You disobeyed your Lord, and your wife is fully divorced from you.” Narrated by Abu Dawud with a sound chain.
In Ibn Abi Shaybah and Ad-Daraqutni’s narration from Ibn Umar: I said, “O Messenger of Allah, what if I divorced her thrice?” He said, “Then you have disobeyed your Lord, and your wife is fully divorced from you.”
At-Tahawi narrated from Malik ibn al-Harith: A man came to Ibn Abbas and said, “My uncle divorced his wife thrice.” He said, “Your uncle disobeyed Allah, sinned, and followed Satan, so no way out was made for him.”
An-Nasa’i narrated from Mahmoud ibn Labid: The Messenger of Allah (ﷺ) was informed of a man who divorced his wife three times at once. He stood angrily and said, “Is the Book of Allah being played with while I am among you?” A man stood and said, “O Messenger of Allah, shall I not kill him?”
In Malik’s narration: A man said to Abdullah ibn Abbas, “I divorced my wife a hundred times. What do you think I should do?” Ibn Abbas said, “She is divorced from you by three, and the ninety-seven you took as mockery of Allah’s verses.”
(1) The statement: “You disobeyed your Lord, and your wife is fully divorced from you”: For Hanafis, innovated divorce violates the two Sunnah forms: pronouncing three divorces in one statement or separately in one clean period, two divorces similarly, one divorce during menstruation, in a clean period with prior intercourse, or after intercourse in the following menstruation. If done, the divorce occurs, and he sins. Its occurrence, number, and sinfulness are disputed. The Imamiyyah say three in one statement or during menstruation do not occur. Tawus, Muhammad ibn Ishaq, Al-Hajjaj ibn Artat, An-Nakha‘i, Ibn Muqatil, and Az-Zahiriyyah say three together count as one. The majority of Successors and later scholars, including Al-Awza‘i, An-Nakha‘i, Ath-Thawri, Abu Hanifah and his companions, Malik and his companions, Ash-Shafi‘i and his companions, Ahmad and his companions, Ishaq, Abu Thawr, Abu Ubayd, and others, say three divorces occur, but he sins. Those who differ are considered anomalous, opposing the Sunnah people. Ash-Shafi‘i disregards the number, requiring only a clean period without intercourse. If three or two are pronounced, it is not innovated. Malik recognizes only one divorce as Sunnah and dislikes three, together or separate. Hanafis dislike more than one in a clean period, but not if separate across clean periods. اطاعت کی اور ( پھوئی کے رجوع کرنے کا ) اس نے کوئی راستہ نہ چھوڑا -

On whether three in one statement is sinful, Ash-Shafi‘i says all divorce is permissible as a legislated act, incompatible with prohibition, unlike divorce during menstruation, where the prohibition is extending the waiting period, not the divorce. For us, innovated divorce occurs and is sinful, as its default is prohibition for severing marriage, which holds religious and worldly benefits. Permissibility is for need of escape. No need exists for combining three, but separate across clean periods is valid per evidence, as the need persists. Its permissibility as bondage removal does not negate prohibition for losing religious and worldly benefits. This was discussed under “The most hated of lawful things to Allah is divorce”. Our evidence is “Divorce is twice…” to “And if he has divorced her…”, implying no lawful divorce except thus, as it restricts the category. No divorce is legislated as three at once. One might assume it does not occur, per the Imamiyyah, but since its illegitimacy is for external reasons (forfeiting its legislated purpose) and regret allows mitigation, it may harm himself or not. Further evidence includes Ibn Abbas’s statement to one who divorced thrice, “You disobeyed your Lord,” Abdur-Razzaq’s narration from Ubadah ibn as-Samit, “She is fully divorced by three in disobedience,” At-Tahawi’s from Malik ibn al-Harith, and An-Nasa’i’s from Mahmoud ibn Labid, as in Al-Marqah, Umdat al-Qari, and Hidayah (summarized).

The Messenger of Allah ﷺ was informed about a man who had given his wife three divorces at once. He became angry and said, 'Is the Book of Allah being challenged while I am still among you? I am the one who will enforce it.' A man then stood up and said, 'O Messenger of Allah ﷺ, shall I not kill him?'

Abdullah ibn Umar (may Allah be pleased with them) narrated that he divorced his wife while she was menstruating. Umar mentioned this to the Messenger of Allah (ﷺ), who became angry and said, “Let him take her back and keep her until she becomes clean, then menstruates, then becomes clean. If he wishes to divorce her, let him divorce her while clean before touching her. That is the waiting period Allah commanded for women to be divorced.” Agreed upon. Al-Allamah Al-Ayni said: The reference is to the state of menstruation, and the lam in “laha” (for her) indicates consequence, meaning the future, as in “Prepare for winter.” In another narration by both: “Order him to take her back, then divorce her while clean or pregnant.”
(1) The statement: “Let him take her back…”: In Hidayah, if a man divorces his wife during menstruation, the divorce occurs, and it is recommended to take her back. This Hadith indicates occurrence and encourages revocation. Some scholars say revocation is recommended, but the most correct view is that it is obligatory to act on the command’s reality and mitigate sin by lifting its effect (the waiting period) and avoiding harm from extending it. When she becomes clean, menstruates, then becomes clean, he may divorce or keep her. Hidayah cites Muhammad in Al-Asl (Al-Mabsut). At-Tahawi says he divorces her in the clean period following the first menstruation. Abu al-Hasan al-Karkhi says At-Tahawi’s view is Abu Hanifah’s, while Al-Asl’s is Abu Hanifah’s and his companions’. Al-Asl’s rationale is that Sunnah divorce requires a menstruation between divorces. روایت کرتے ہیں حضرت ابن عمر رضی اللہ عنہما نے
مُجَبَّر رحمۃ اللہ علیہ حضرت عبد اللہ بن عمر رضی اللہ عنهما سے
عورت سے نکاح کر لئے تو اس پر طلاق ہو جائے گی تو ایسی صورت میں وہ اس عورت سے
نکاح کر لئے تو اس پر طلاق واقع ہو جائے گی اور طلاق اس کے قول کے مطابق واقع
ہو گی (یعنی) اگر وہ ایک طلاق دے تو ایک ، یا دو طلاق دے تو دو یا تین طلاق دے تو تین

اس کی روایت امام محمد رحمۃ اللہ علیہ نے موطا میں کی ہے -
اور عبد الرزاق نے معمر سے اور انہوں نے زہری سے روایت کی ہے

صحیح نہیں ہے کہ نکاح سے پہلے طلاق نہیں اور ما کہ ہو نے کے بعد ہی (غلام باندی)
آزاد ہو لے گے - تو زہری نے جواب دیا (تم نے جو روایت سنائی ہے) اس کا مطلب یہ ہے کہ کوئی
شخص پول کہ کہ فلان شخص کی پیوی کو طلاق دیتا ہوں اور فلان شخص کے غلام کو آزاد کرتا ہوں
(تو کیا میں طلاق واقع ہو گی اور اپنے غلام آزاد ہو گا) اور ابو بر رازی نے زہری سے بیان کیا ہے کہ
لاطلاق قبل النكاح (یعنی نکاح سے پہلے طلاق نہیں) ایسے شخص سے متعلق ہے جس کو کسی شخص کے بارے میں کہا جائے کہ اس نے فلان عورت سے نکاح کیا ہے تو وہ کہدے ہیں کہ اس کو طلاق ہے تو اس کے اس قول کا کوئی اثر نہیں بلکہ کوئی شخص یہ کہ کر اگر میں فلان عورت سے نکاح کر لے تو اس پر طلاق ہے تو گویا اس نے نکاح کے ساتھ ہی طلاق دیا ہے۔
Malik narrated from Mujbir from Abdullah ibn Umar (may Allah be pleased with them) that he said: If a man says, “If I marry so-and-so, she is divorced,” it is as he said upon marrying her. If he divorced her one, two, or three times, it is as he said. Narrated by Muhammad in Al-Muwatta.
Abdur-Razzaq narrated from Ma‘mar from Az-Zuhri that he said about a man who said, “Every woman I marry is divorced, and every slave I buy is free,” it is as he said. Ma‘mar said, “Is it not reported: ‘No divorce before marriage, no emancipation before ownership’?” He said, “That applies to a man saying, ‘So-and-so’s wife is divorced,’ or ‘So-and-so’s slave is free.’” Abu Bakr ar-Razi narrated from Az-Zuhri: The saying, “No divorce before marriage,” refers to a man told, “Marry so-and-so,” who says, “She is divorced,” which is nothing. But if he says, “If I marry so-and-so, she is divorced,” he divorces her upon marrying her.
Ibn Abi Shaybah narrated from Salim, Al-Qasim ibn Muhammad, Umar ibn Abdul-Aziz, Ash-Sha‘bi, An-Nakha‘i, Az-Zuhri, Al-Aswad, Abu Bakr ibn Amr ibn Harm, Abu Bakr ibn Abdur-Rahman, Abdullah ibn Abdur-Rahman, and Mak-hul ash-Shami about a man who said, “If I marry so-and-so, she is divorced,” or “The day I marry her, she is divorced,” or “Every woman I marry is divorced.” They said, “It is as he said,” or in some wording, “It applies to him.”
(3) The statement: “If a man says…”: Based on these narrations, Hanafis say that attaching divorce to the cause of ownership is valid. If he says to a non-wife, “If I marry you, you are divorced,” and marries her, the divorce occurs. Ash-Shafi‘i says this condition is invalid, and no divorce occurs, as a condition is like an immediate act. Just as immediate divorce is invalid without ownership, a condition is too. The response is that the condition “If I marry you, you are divorced” exists now, but the divorce occurs when the condition (marriage) is met, when ownership is established, unlike “If you enter the house, you are divorced,” where ownership is absent now and later, so no divorce occurs, as with immediate divorce of a non-wife. Thus, Ash-Shafi‘i’s use of “No divorce before marriage” is invalid. His other Hadiths are weak, per Tanzih’s author, who says they are false, with some narrators being fabricators or thieves. Our view is supported by Sa‘id ibn al-Musayyib, Ata, Hammad ibn Abi Sulayman, and Shurayh (may Allah have mercy on them). If argued that interpreting it as immediate is meaningless, as all know it, so it must mean conditions, the response is that it became clear after the Shariah’s ruling was established. In the pre-Islamic era, they pronounced immediate divorce before marriage, counting it as divorce upon marriage. The Shariah negated this in “No divorce before marriage” and other Hadiths, as in At-Taliq al-Mumajjad, Umdat ar-Ri‘ayah, and Fath al-Qadir (summarized). In Umdat al-Qari, Bukhari says: “Chapter: No divorce before marriage,” meaning no divorce before marriage exists. Al-Kirmani says Hanafis uphold divorce before marriage, and Bukhari refutes them. اورابن ابی شیبہ نے سالم، قاسم بن محمد، عمر بن عبد الرحمن، شعیب، ثعلبی، زہری، اسود، ابوکبر بن عمرو بن حزرم، ابوکبر بن عبد الرحمن، عبد اللہ بن عبد الرحمن اور محول شامی ان سارے حضرات سے روایت کی ہے کہ کوئی شخص یہ کہ کر اگر میں فلان عورت سے نکاح کر لے تو اس پر طلاق ہے یا جس دن میں نکاح کر لے گا اس دن طلاق ہوگی یا (یوں کہے) کہ ہر وہ عورت جس سے میں نکاح کر لے اس پر طلاق ہوگی تو ایسے شخص کے بارے میں ان سب حضرات نے کہا ہے کہ ایسے شخص کے قول کے مطابق طلاق واقع ہو جائے گی اور بعض روایتوں میں یوں کہہ کر ایسا کہنا درست ہے۔

اللہ تعالیٰ والدین کے ان سے دریافت کیا بندا! کیا تم نے ایک بیٹی کی نیت کی تھی؟ تو رکانے نے عرض کیا خدا کی قسم میں نے ایک بیٹی کی نیت کی ہے! تورسول اللہ صلی اللہ علیہ والدین کے پیوی کوان کی طرف لوٹادیا پھر انہوں نے حضرت عمر رضی اللہ عنہ کیخلافت میں دوسروں طلاق دی اور حضرت عثمان رضی اللہ عنہ کیخلافت میں تیری طلاق دی۔ اس کی روایت ابوداود نے کی ہے اورترمزی، ابن ماجہاوردارمی نے بھی اس کی روایت کی ہے گر ان حضرات نے دوسروں اورتمیزی طلاق کا ذکر نہیں کیا ہے۔ اورملائی قاری رحمۃ اللہ علیہ نے کہا ہے کرسول اللہ صلی اللہ علیہ وسلم نے رکانہ پرانی پیوی کولوٹا یا تحاوه نکاح کی تجدید پیدا کے ساتھ تھا اوراس کی تامیر اس روایت سے ہوتی ہے جس کو امام محمد رحمۃ اللہ علیہ نے کتاب الاشار میں حضرت ابراہیم نخعی رحمۃ اللہ علیہ سے کی ہے کر طلاق ایسے الفاظ سے دی جائے جس میں کناپیا اوراشارہ ہوجیے خلیه (تو نکاح سے خالی ہوگی) اوربریہ (تو نکاح سے بری ہوگی) کہا جائے یا طلاق باسندی یا طلاق بتدری تو ان تمام صورتوں میں طلاق دینے والے کی نیت کا اعتبار ہوگا اگراس نے تین طلاق کی نیت کی ہوتی تین طلاق واقع ہو جائیں گے اوراس نے ایک طلاق باسند کی نیت کی ہوتا ایک طلاق واقع ہوگی اوراگراس نے طلاق کی نیت نہیں ہوتا کوئی بھی طلاق واقع نہ ہوگی۔
طلاق بتہ سے کیا مراد ہے
ف: واضح ہو کہ اس حدیث شریف میں "طلاق البنت" کا ذکر ہے بنت لفظ "بت" سے ماخوذ ہے اور بت کے معنی کا تین کے ہیں اور طلاق میں بتت کناپی کے طور پر استعمال ہوتا ہے جس سے مراد نکاح کا منقطع کرنا یا الفت کا منقطع کرنا ہوتا ہے۔ اس لیے بت کے لفظ سے طلاق دی جائے تو طلاق دینے والے کی نیت کا اعتبار ہوگا۔ (رد المختار -12)
پہلی نذاق میں جونکہ تو اطلاق تو یار جوع بو
پیسب با تین نافزہو جا کیگی
Rukanah ibn Abd Yazid (may Allah be pleased with him) narrated that he divorced his wife Suhaymah finally and informed the Prophet (ﷺ), saying, “By Allah, I intended only one.” The Messenger of Allah (ﷺ) said, “By Allah, you intended only one?” Rukanah said, “By Allah, I intended only one.” The Messenger of Allah (ﷺ) returned her to him. He divorced her a second time in Umar’s era and a third in Uthman’s. Narrated by Abu Dawud, Tirmidhi, Ibn Majah, and Ad-Darimi, though they did not mention the second and third.
Ali al-Qari said: He returned her by renewing the marriage, supported by Muhammad’s narration in Al-Athar from Ibrahim on khaliyyah, bariyyah, bain, and bayyah: If he intended divorce, it is as intended. If three, then three; if one, then one final divorce, and he is a suitor. If he did not intend divorce, it is nothing.
(1) The statement: “Returned her to him…”: Meaning to Rukanah, i.e., he ordered revocation. For Ash-Shafi‘i, final divorce is revocable per this interpretation: If one is intended, it is one; two, then two; three, then three; if no divorce is intended, it is not divorce. Abu Hanifah agrees, except that this statement causes one final divorce, whether one or two are intended. If three are intended, it is three. Consider that return for him is renewing the marriage. The dispute with Ash-Shafi‘i is in two points: the validity of revocation and the validity of intending two. We deny both, while Ash-Shafi‘i affirms them. For Malik, it is three, as in Al-Luma‘at and Al-Musawwa (summarized).
ابوہریرہ رضی اللہ عنہ سے روایت سے کر رسول اللہ صلی اللہ علیہ وسلم نے
ارشاد فرمایا کہ تین با تین ایسے کر جن کاچ تو پچی سے اوران کا نذاق پچی پچی
ہے۔(1) نکاح (2) طلاق (3) رجوع کرنا (اس کی روایت ترتیبی اورابوداود نے کی ہے)
ف: حضرت ثابت عبد الحق محدث دبلوی رحمۃ اللہ علیہ نے "لمعات" میں فرمایا کہ جس کسی نے نکاح
کیا اطلاق دیا مطلق سے رجوع کیا اور کہا کہ میں نے یہ با تین بطور مذاق کے کی تحسین اور میرا مقصد ایسائے تھا تو اس کا
پیو ل معترف نہوگا بلکہ طلاق واقع ہوجائے گی، نکاح منعقد ہوجائے گا اور رجوع بھی درست ہوگا۔ اور میں حکم دوسروں
معاملات میں خرید فروخت اورہبہ وغیرہ میں نافزہوگا اور حیثیت شریف میں ان میں پچیوں پچیوں کا ذکر بطور خاص اس
لیے ارشاد ہوا کہ ان با تول کا اہتمام ظاہر ہوا اور "عالمگیری" میں کہا ہے کہ نذاق سے طلاق دینے والے کی طلاق واقع
ہو جائے گی جسیا کہ در مختار میں صراحت ہے۔12
Talaaq should be given in a manner similar to how it is pronounced, and it should be done in a clear and distinct manner. (1) Nikah (marriage), (2) Talaaq (divorce), (3) Raj'ah (reinstatement) should all be done clearly and distinctly. This narration is reported in order by Abu Dawud.
صفوان بن عمر طائی رضی اللہ عنہ سے روایت سے کر ایک عورت کو پے شوہر
سے بغرض تھا (ایک وفہ) اس کو سوتا ہوا پا کر ایک چھڑی لی اور اس کے سینہ پر پیٹی اور اس
کو پلا یا اور کہا اتو تو مجھے تین طلاق دے یا پھر میں تچہ زنگ کر دیتی ہوں! اس کے (شوہر) نے اس
کو اللہ کی قسم دی (کہ تو اپیا نہ کر) پیوی نے انکار کیا (حس پر شوہر نے) اس کو تین طلاق دی اور پھر
وہ شخص رسول اللہ صلی اللہ علیہ وسلم کی خدمت میں حاضر ہو کر اپنے اس (طلاق دینے) کے بارے
میں دریافت کیا تورسول اللہ صلی اللہ علیہ وسلم نے فرمایا کہ طلاق دینے کے بعد نہیں (یعنی تمہاری
طلاق نافذ ہوگی۔)
اس کی روایت امام محمد رحمۃ اللہ نے اپنی سنده پر ان کی ہے

The Messenger of Allah (ﷺ) said, "There is no consideration for divorce under coercion." [Narrated by Muhammad with his chain]
Abdur-Razzaq narrated from Ibn ‘Umar that he permitted the divorce of one compelled.
Abu Hurairah (may Allah be pleased with him) narrated that the Messenger of Allah (ﷺ) said, "Every divorce is valid except the divorce of an insane person overwhelmed by his lack of reason." [Narrated by Tirmidhi, who said: This is a gharib hadith.]
(1) The statement: "There is no consideration for divorce under coercion", Ash-Shafi’i adhered to the hadith of compulsion and said: Divorce and emancipation under coercion do not occur. According to us, these are valid based on these narrations and by analogy to their validity in jest. The foundational principle in our view is that any contract that cannot be annulled is not prevented from taking effect due to coercion. Likewise, whatever is valid in jest is also valid under coercion, as mentioned in Al-Luma’at. Therefore, Al-Hidayah states: "The divorce of a coerced person is effective, contrary to Ash-Shafi’i’s view."
(2) The statement: "Narrated by Muhammad with his chain", In Musannaf Ibn Abi Shaybah, it is mentioned that Ash-Sha’bi considered the divorce of a coerced person permissible. The same was said by Ibrahim, Abu Qilabah, Ibn Mas’ud, and Shurayh. Ibn Hazm also reported that it was authentically narrated from Az-Zuhri, Qatadah, Sa’id ibn Jubayr, and others. Abu Hanifah and his companions adopted this view. Al-Faraj ibn Fadalah narrated from ‘Amr ibn Sharahbil that a woman coerced her husband to divorce her, so he divorced her, and ‘Umar upheld the divorce. A similar narration is reported from Ibn ‘Umar and ‘Umar ibn ‘Abd al-‘Aziz, as mentioned in ‘Umdat al-Qari’.
(3) The statement: "Except the divorce of an insane person...", This refers to the divorce of a ma’tuh (mentally deficient). Here, ma’tuh refers to an insane person, not the commonly understood meaning of one lacking maturity or experience. Rather, it denotes a severe mental disorder. This is mentioned in Al-Bahr as the definition of insanity. It includes the ma’tuh, and the best distinction between the two is that a ma’tuh is one with weak comprehension, incoherent speech, and poor judgment, but he does not strike or insult, unlike an insane person. This is cited in Ar-Radd al-Muhtar and Al-Kawkab ad-Durri, derived from both.
اور عبد الرزاق نے حضرت ابن عمر رضی اللہ عنہما سے روایت کی ہے کہ انہوں نے مگرہ یاجبریاز بردستی سے طلاق دی جائے تو اس کو جائز قرار دیاہے۔ 12 نیم پاگل اور مجنون کی طلاق واقع نہ ہوگی

اَلْوَهْرِيْهُ رَضِيَ اللَّهُ عَنْهُ رَوَى عَنْهُ فَرْمَا تَ هِيْنَ كَرْسُوْلِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ اَرْشَادَ فَرْمَا يَهْ كَرْطَلاَقِ وَاقَعُ هُوْجَاتِيْ بَهْ سَوَاءَ اَسَكِيْ طَلاَقِ كَرْ جُوْنِمِ پَاگَلُّ هُوْيَجْسِ پَرْجُوْنَ غَالِبُ هُوْ (اَسَكِيْ رَوَايَتِ تَرْذِيْ نَكِيْ)۔
وہ تین لوگ جن کا طلاق اور دوسری باٹول میں اعتبار نہیں
Those three people whose divorce and other invalid actions are not considered valid.
اَمِيْرَاْلْمُؤْمِنِيْنَ حَضَرَتِ عَلِيْ رَضِيَ اللَّهُ عَنْهُ رَوَى عَنْهُ فَرْمَا تَ هِيْنَ كَرْ رَسُوْلِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ نَ اَرْشَادَ فَرْمَا يَهْ كَرْتِيْنَ آدَمِيْوْلِ سَهْ قَلْمِ اْنْحَاْلِيَآگِيَهْ (لَيْمِنَ اْنَکَرْ قَوْلِ وَفْعَلِ كَاْعْتِباَرِ نَهُوْگَاْ اْوْرَنَ اْنَ پَرْمُواْخْذِهِ هُوْگَاْ) اَيْ سَوْنَ وَاْلَا پِيْهَاْلِ تَكْ پِيْدَارِ هُوْجَاْکَرْ دُوْسِرَ پِيْ پِيْهَاْلِ تَکْ کَرْ بَالَغِ هُوْجَاْکَرْ، تَيْسِرَ نَیْمِ پَاگَلِ پِيْهَاْلِ تَکْ اْسَکُوْہُوْشِ آْجَاْکَرْ (لَيْمِنَ اْسَ حَالَتِ مِيْنَ اْنَ سَهْ جُوْاْمُوْرِ صَاْدِرِ هُوْلِ وَهْ مُعَافِ پِيْنَ اْنَکَاْاعْتِباَرِ نَهُوْگَاْ) اَسَ حَدِيْثِ کِيْ رَوَايَتِ تَرْذِيْ اْوْرَاْبُوْدَاْوْدِ نَکِيْ ہَےْ۔

Abu Hurayrah (may Allah be pleased with him) narrated: The Messenger of Allah (ﷺ) said: “Whoever believes in Allah and the Last Day should honor his guest, (1) should not harm his neighbor, and should speak good or remain silent.” (2) In another narration, instead of “neighbor”: “should maintain ties of kinship.” [Narrated by Bukhari and Muslim]
اَوْرَداْرِيْ نَ حَضَرَتِ عَاْشِرِ رَضِيَ اللَّهُ عَنْهَاْ سَ اْوْراْبِنِ مَلْجَرْ نَ حَضَرَتِ عَلِيْ رَضِيَ اللَّهُ عَنْهَاْوَرَ حَضَرَتِ عَاْشِرِ رَضِيَ اللَّهُ عَنْهَاْوَنُوْلِ سَهْ رَوَايَتِ کِيْ ہَےْ)
ف : اس حدیث شریف کی روشنی میں فتح القدیر میں لکھا ہے کہ پچیسی دی ہوئی طلاق واقع نہیں ہوگی اگر چہ کہ عظیمنہ واور مجنون اور سونے والے کی طلاق بھی واقع نہ ہوگی۔ 12
نشکی حالت میں دی ہوئی طلاق واقع ہوجائے گی۔
In the light of this noble hadith, it is written in Fath al-Qadir that a divorce given while intoxicated will not take effect, even though the divorce of a great person, a mad person, or a sleeping person will also not take effect. Divorce given in a state of unconsciousness will take effect.
سَعید بن المُسیب اور سلمیان بن پیار رحمۃ اللہ علیہما سے روایت ہے ان دونوں حضرات سے نشکی حالت میں طلاق دینے والے کے بارے میں دریافت کیا گیا تو ان دونوں نے فرما کہ اگر کوئی نشکی حالت میں طلاق دے تو وہ واقع ہوجائے گی۔ (اس کی روایت امام ماکے نے کی ہے)
ف: واضح ہو کہ نشکی حالت میں طلاق اس وقت واقع ہوتی ہے جبکہ عقل اور بھی باقی ہوا س کے برخلاف کسی شراب اس قدر پی لی کہ اس کو سکا دوڑے اور وہ بیہوش ہو گیا اور اس نے بیہوشی میں طلاق دیا تو اس کی طلاق واقع نہ ہو گی۔

باندی کے لیے رف دو طلا قین ہیں
Sa’id ibn al-Musayyab and Sulayman ibn Yasar were asked about the divorce of an intoxicated person, and they said, "If an intoxicated person divorces, his divorce is valid." [Narrated by Malik]
(2) The statement: "If an intoxicated person divorces, his divorce is valid", This means the divorce of an intoxicated person is effective according to us. This is also Ash-Shafi’i’s view in his most authentic opinion. Al-Karkhi and At-Tahawi preferred that it is not valid, which is one of Ash-Shafi’i’s two opinions, because sound intention requires sanity, which is absent in intoxication, similar to anesthesia or medication. Our evidence is that intoxication results from a sinful cause (consuming intoxicants), so it is treated as if the person is still accountable to deter him. If someone drinks and becomes intoxicated, losing his sanity due to the intoxication, we say his divorce is not valid. This is mentioned in Al-Hidayah and Fath al-Qadir, derived from both.
ام المومنین حضرت عائشہ رضی اللہ عنہا سے روایت ہے کہ رسول اللہ صلی اللہ علیہ والہ وسلم نے ارشاد فرما ئے کہ باندی کیلئے دو طلاق قین ہیں اور اس کی عدت بھی دو حیض ہیں۔
( اس کی روایت ترمذی، ابوداود، ابن ماجہ اور دارمی نے کی ہے )
شوبہ رکا پیوی کو طلاق کا اختیار دینا
‘Aishah (may Allah be pleased with her) narrated that the Messenger of Allah (ﷺ) said, "The divorce of a slave woman is two divorces, and her waiting period is two menstrual cycles." [Narrated by Tirmidhi, Abu Dawud, Ibn Majah, and Ad-Darimi]
(3) The statement: "The divorce of a slave woman is two divorces", This means, according to us, the divorce of a slave woman is two, whether her husband is free or a slave. The divorce of a free woman is three, whether her husband is free or a slave. Ash-Shafi’i said: "The number of divorces depends on the status of the men, based on the verse: 'Divorce is twice...' (2:229)." Our evidence is this hadith, and the interpretation of what Ash-Shafi’i cited is that the execution is related to the men, as mentioned in Al-Hidayah.
(4) The statement: "Her waiting period is two menstrual cycles", Al-Hidayah states: "If she is a slave, her waiting period is two menstrual cycles, based on this hadith. This is because slavery reduces the waiting period by half, and a menstrual cycle cannot be divided, so it is completed as two cycles." ‘Umar (may Allah be pleased with him) alluded to this by saying, "If I could, I would have made it one and a half cycles." Al-Maraqi states: "The apparent meaning of the hadith indicates that the waiting period is based on the woman’s status, not the freedom or slavery of the husband, as is our view. It also shows that the waiting period is based on menstruation."
ام المومنین حضرت عائشہ رضی اللہ عنہا سے روایت ہے، وہ فرما ئی کہ رسول اللہ صلی اللہ علیہ والہ وسلم نے ہم کو اختیار دیا ہے ( کہ یا تو ہم دنیا اور اس کی زیبے ت کو اختیار کریں یا اللہ تعالیٰ کو اور اس کے رسول کو اختیار کریں ) تو ہم نے اللہ اور اس کے رسول کو اختیار کیا تو آپ نے ہم پر سے فتنہ ( کی طلاق کو ) شارنے کیا۔ اس کی روایت بخاری اور مسلم نے متفقہ طور پر کی ہے۔
The Messenger of Allah ﷺ gave us the choice (whether we would choose the world and its adornments or Allah and His Messenger). So, we chose Allah and His Messenger, and He protected us from trials (by divorcing us from trials). This has been narrated by Bukhari and Muslim on a muttafaqun 'alayhi basis.
اور عبد الرزاق نے جابر بن عبد اللہ سے روایت کی ہے کہ حضرت جابرؓ نے فرمایا کہ جب آدمی اپنی بیوی کو (ایک مجلس میں طلاق کا) اختیار دیدے اور پھر نے اس مجلس میں اپنے اختیار کو استعمال نہیں کیا تو (مجلس ختم ہوجانے کے بعد) اس کو (طلاق لینے کا) اختیار باقی نہیں رہتا۔
‘Aishah (may Allah be pleased with her) said, "The Messenger of Allah (ﷺ) gave us the choice, and we chose Allah and His Messenger, so he did not count that as anything (against us)." [Agreed upon]
Abdur-Razzaq narrated from Jabir ibn ‘Abdullah that he said, "If a man gives his wife the choice and she does not make a choice in that sitting, she has no choice afterward."
At-Tabarani narrated from Ibn Mas’ud, and Ibn Abi Shaybah narrated from ‘Umar and ‘Uthman a similar report. Tirmidhi said: "It is narrated from ‘Umar and ‘Abdullah ibn Mas’ud that they said, 'If she chooses herself, it is one irrevocable divorce.'"
(5) The statement: "He did not count that as anything", This means it was not counted as a divorce, neither three, nor one, nor an irrevocable or revocable divorce. This was the view of most Companions, and Abu Hanifah and Ash-Shafi’i held this opinion. This hadith refutes those who say that if a woman is given the choice and chooses her husband, it counts as one revocable divorce. Malik held this view. Ibn al-Humam said: "The one given the choice has the choice in that sitting by the consensus of the Companions." Al-Mudhaffar said: "If a man says to his wife, 'Choose between yourself and me,' and she says, 'I choose you' or 'I choose myself,' it results in a revocable divorce according to Ash-Shafi’i and an irrevocable divorce according to Abu Hanifah. Our evidence is the statement of ‘Umar and ‘Abdullah ibn Mas’ud." Tirmidhi said: "Most scholars and jurists from the Companions and those after them in this matter followed the opinion of ‘Umar and ‘Abdullah, which is also the view of Ath-Thawri and the people of Kufa." This is taken from Al-Maraqi and Jami’ at-Tirmidhi.
اور طبرانی نے ابن مسعود رضی اللہ عنہ سے
اور ابن ابی شیبہ نے حضرت عمر اور حضرت عثمان رضی اللہ عنہما سے اس طرح روایت کی ہے۔
اور تمذی نے کہاہے کہ
And Tamimi said:
حضرت عمر اور حضرت عبد اللہ بن مسعود رضی اللہ عنہما نے فرمایا کہ (شوعہ کی طرف سے طلاق کا اختیار ملنے پر) بیوی اپنے نفس کو اختیار کر لے تو ایک طلاق بان واقع ہوجائے گی۔ ف: واہ ہو کہ حدیث ثریف میں شوعہ کی طرف سے بیوی کو طلاق کا اختیار دینے کا ذکر ہے اس کی تفصیل یہ ہے کہ اگر کوئی شخص خود کھود اپنی زبان سے طلاق کا لفظ نہیں کہتا تو بلکہ بیوی سے کہتا ہے کہ تمہیں اختیار ہے چاہو تو تم اپنے نفس کو اختیار کر لوا اور اپنے آپ کو طلاق دیدو اور اگر چاہو تو مجھے لیجنی خاوند کو اختیار کر لوا اور طلاق مت لوتا اگر بیوی نے اس مجلس میں بیکہا کر میں نے اپنے کو اختیار کر لیا تو اس سے ایک بان طلاق پڑ جائے گی۔ اور اگر اس نے اپنے خاوند کو اختیار کیا تو طلاق نہیں پڑے گی۔ اور اگر مجلس ختم ہوجائے تو اور بیوی نے اپنے اختیار کو استعمال نہیں کیا تو بیوی کا اختیار باقی نہیں رہتا۔ رسول اللہ صلی اللہ علیہ وسلم نے اپنے ازواج مطہرات رضی اللہ عنهن کو اختیار دیا تھا تو از واج مطهرات نے رسول اللہ صلی اللہ علیہ وسلم کو اختیار کیا تو طلاق نہیں واقع ہوتی۔ 12 شوعہ کا بیوی کو اپنے لیے حرام کر لینا قسم ہے
‘Aishah (may Allah be pleased with her) said, "The Messenger of Allah (ﷺ) gave us the choice, and we chose Allah and His Messenger, so he did not count that as anything (against us)." [Agreed upon]
Abdur-Razzaq narrated from Jabir ibn ‘Abdullah that he said, "If a man gives his wife the choice and she does not make a choice in that sitting, she has no choice afterward."
At-Tabarani narrated from Ibn Mas’ud, and Ibn Abi Shaybah narrated from ‘Umar and ‘Uthman a similar report. Tirmidhi said: "It is narrated from ‘Umar and ‘Abdullah ibn Mas’ud that they said, 'If she chooses herself, it is one irrevocable divorce.'"
(5) The statement: "He did not count that as anything", This means it was not counted as a divorce, neither three, nor one, nor an irrevocable or revocable divorce. This was the view of most Companions, and Abu Hanifah and Ash-Shafi’i held this opinion. This hadith refutes those who say that if a woman is given the choice and chooses her husband, it counts as one revocable divorce. Malik held this view. Ibn al-Humam said: "The one given the choice has the choice in that sitting by the consensus of the Companions." Al-Mudhaffar said: "If a man says to his wife, 'Choose between yourself and me,' and she says, 'I choose you' or 'I choose myself,' it results in a revocable divorce according to Ash-Shafi’i and an irrevocable divorce according to Abu Hanifah. Our evidence is the statement of ‘Umar and ‘Abdullah ibn Mas’ud." ابن عباس رضی اللہ عنہما سے روایت ہیوہ فرماتے ہیں کہ جب آدمی اپنی بیوی
کو اپنے اوپر حرام کر لے تو فتم ہوگی اور ایسے شخص کواس کا کفارہ ادا کرنا ہوگا _ حضرت ابن عباس رض
نے بھی فرمایا کہ تہمارے لیے رسول اللہ صلی اللہ علیہ والہ وسلم کی پیروی اس بارے میں اچھی ہے _
(اس کی روایت بخاری اور مسلم میں متفق طور پر ہے _)
ف : واضح ہو کہ جب کوئی شخص اپنی یوی سے کہ کہ تو مجھے پر حرام ہے اور نیت طلاق کی کرے تو طلاق واقع
ہوگی اور اگر ظہار کی نیت کرے تو ظہار ہوگا (جس کا بیان آگے آر بات ہے ) اور اگر حرام کر لینے کی نیت کرے تو فتم ہوگی
اور فتم توثر نے کی وجہ سے اس کو کفارہ دینا ہوگا اور فتم کا کفارہ دس مسکینون کا کھانا کھلانا یا ان کو کپڑا پہنا نا یا کیے غلام
کا آزاد کرنا ہے _ اور اگر کوئی شخص کسی حلال چیز کو اپنے اوپر حرام کر لے تو وہ چیز اس پر حرام نہیں ہوگی بلکہ وہی فتم ہوگی
اور فتم توثر نے پر کفارہ دینا ہوگا _12

حلال چیزوں کو اپنے اوپر حرام کر لینے فتم ہے
Ibn ‘Abbas (may Allah be pleased with him) said, "If a man declares his wife unlawful for him, it is an oath for which he must make expiation." He then said, "There has certainly been for you in the Messenger of Allah an excellent example." [Agreed upon]
(1) The statement: "If a man declares his wife unlawful for him, it is an oath for which he must make expiation...", Scholars differed regarding the wording of tahrim (declaring unlawful). Some said it is not an oath. If a man says to his wife, "You are unlawful to me," or "I have made you unlawful," and he intends divorce, it is a divorce. If he intends zihar (declaring her like his mother’s back), it is zihar. If he intends to prohibit her essence or is vague, he must make expiation for the oath by the wording itself. If he says this to his female slave and intends emancipation, she is emancipated. If he intends to prohibit her essence or is vague, he must make expiation for the oath. If he says to food, "I have made it unlawful for myself," there is no consequence. Ash-Shafi’i held this view.
If he did not intend anything, there are two opinions from Ash-Shafi’i: one is that he must make expiation for the oath, and the other is that there is no consequence, as it is meaningless and does not entail any rulings. A group held that it is an oath. If a man says this to his wife or female slave, he does not owe expiation unless he has intercourse with her, just as if he swore not to have intercourse with her. If he prohibits food, it is like swearing not to eat it, so he owes no expiation unless he eats it. This was the view of Abu Hanifah and his companions, as mentioned in Al-Khazin.
This narration supports our view. Al-Kamalayn states: *"Our Imam Abu Hanifah used the verse, 'Allah has already ordained for you the dissolution of your oaths...' (66:2), as evidence that declaring the lawful unlawful is an oath, as Allah called tahrim an oath, necessitating expiation according to Abu Hanifah, contrary to Ash-Shafi’i. It was responded that the obligation of expiation does not necessarily mean it is an oath, as it is possible that Allah used the term 'oath' metaphorically. ‘Abdur-Razzaq narrated from Ash-Sha’bi that a man swore an oath along with tahrim, and Allah rebuked him for the tahrim and prescribed expiation for the oath. Qatadah said, 'He declared her unlawful, and it was an oath.' Ash-Sha’bi’s statement aligns with Ash-Shafi’i’s view, while Qatadah’s supports our view, which is the apparent meaning of the Qur’an."*
اس رضی اللہ عنہ سے روایت ہے کہ رسول اللہ صلی اللہ علیہ وسلم کی ایک باندی
تمام جس سے آپ صحبت فرماتے تھے اور حضرت عائشہ رضی اللہ عنہا اور حضرت حفصہ رضی اللہ عنہا کو پی
ناگوار رہتا یہاں تک کہ آپ نے اس باندی کو اپنے اوپر حرام کر لیا اور اللہ تعالیٰ نے یا آیت نازل فرمائی:
(سورۃ نساء، پ:4، ع:3، آیت نمبر:20/21، میں)(سورۃ نساء، پ:4،
ع:3، آیت نمبر:20/21، میں)"یَاۤیُّہَا النَّبِیُّ لِمَ تُحَرِّمُ مَا أَحَلَّ اللّٰہُ لَکَ، تَبْتَغِی
مَرْضَاتَ ازْوَاجِکَ، وَاللّٰہُ غَفُوْرٌ رَّحِیْمٌ "۔ (سورۃ تہریم پ:28، ع:1، آیت نمبر:1) اے
نبی (صلی اللہ علیہ وسلم) جو چیزیں اللہ تعالیٰ نے آپ کیے حلال کیں ہیں، آپ اپنی یویوں کی
خوشنووی حاصل کرنے کے لیے کیون حرام کیا، اللہ تعالیٰ بچتھ وا لے مہربان ہیں _ اس کی
روایت نساوی نے کی ہے _
Anas (may Allah be pleased with him) narrated that the Messenger of Allah (ﷺ) had a slave woman whom he would visit. ‘Aishah and Hafsah kept pressuring him until he declared her unlawful for himself. Then Allah revealed: "O Prophet, why do you prohibit what Allah has made lawful for you?" (66:1) to the end of the verse. [Narrated by Nasa’i]
Abdur-Razzaq narrated from Qatadah that he said, "He declared her unlawful, and it was an oath."
اور عبد الرزاق نے اس کی روایت قواعد سے کی ہے کہ حدیث میں حضور صلی اللہ علیہ وآلہ وسلم نے "حرمها" کالفظ جو فرماے وہ تمہیں -
دوسری حدیث

ام المومنین حضرت عائشہ رضی اللہ عنہا سے روایت ہے کہ حضور صلی اللہ علیہ وسلم (اپنی بیوی) زینب بنت خجش رضی اللہ عنہا کے بال (تشریف لیجاتے تو) پھڑ دیئے تھے جاتے اور آپ پ کے پاس شہد نوش فرماتے (ام المومنین فرماتی ہیں کہ) میں نے اور لی لی خفض نے آپس میں مشورہ کیا اور پیٹ کر لیا کہ تم دونوں میں سے جس کے پاس مجھی تشریف لا کیسے تو وہ پول کچ کر (پارسول اللہ) آپ کے (وہسن مبارک) سے مغا فیر کی بوآتی ہے تو کیا آپ نے مغا فیر کہا یہ؟ (اس کے بعد) نے صلی اللہ علیہ والہ وسلم،تم دونوں میں سے کسی ایک کے پاس تشریف لائے تو اس نے کہا (یعنی طے شدہ بات کو دہرا دیا گیا) (یعن کر) حضور صلی اللہ علیہ والہ وسلم نے فرمایا نہیں بلکہ میں نے لی لی زینب بنت خجش کے پاس شہد پیا ہے۔ (اور اگر تم کو شہد پیئے سے بد بوا ری ہے) تو آپ نے ہمیں پول کا اس پر پیآئے نازل ہوتی " یَا يَهَا النَّبِیُّ لِمَ تُحَرِّمُ مَا أَحَلَّ اللَّهُ لَكَ "۔ (اس آیت کی روایت بخاری نے کی ہے)۔
‘Aishah (may Allah be pleased with her) narrated that the Prophet (ﷺ) would stay with Zaynab bint Jahsh and drink honey at her place. She and Hafsah agreed that whichever of them the Prophet (ﷺ) visited would say, "I detect the smell of maghafir (a foul-smelling gum) on you. Have you eaten maghafir?" When he visited one of them, she said this to him. He replied, "No, I drank honey at Zaynab bint Jahsh’s, but I will not do it again." Then the verse was revealed: "O Prophet, why do you prohibit what Allah has made lawful for you?" (66:1) [Narrated by Bukhari]
ف : حدیث تشریف میں مغا فیر کا لفظ ذکور ہے مغا فری امغا فیر ایک چل ہے جس کا مغز گوند ہے۔
