(اس باب میں غصب اور عاری کا بیان ہے)
ف: غصب کے معنی یہ ہیں کہ کسی کے مال کو احتیاط زبردست چھین لیں اور عاریہ کے معنی یہ ہیں کہ کسی چیز جس کا طلب کرنا باعث نقص و عار ہو۔
وَقَوْلُ اللّٰہِ عَزَّوَجَلَّ: "وَلَا تَأْكُلُوا أَمْوَالَكُم بَيْنَكُم بَالْبَاطِلِ"۔ اور اللہ تعالیٰ کا ارشاد ہے (سورۃ بقرہ، پ:2، ع:23، آیت نمبر:188، میں)، "تم آپس میں ایک دوسرے کے مال کو احتیاط نہ کھاؤ"۔
وَقَوْلُہُ تعالیٰ: "فَمَن اعْتَدَى عَلَیْكُم فَاعْتَدُوا عَلَیْهِ بِمِثْلِ مَا اعْتَدَى عَلَیْكُم"۔ اور اللہ تعالیٰ کا ارشاد ہے: (سورۃ بقرہ، پ:2، ع:24، آیت نمبر:194، میں) جو تم پرزیادتی کرے تم بھی اس پر اتنی ہی زیادتی کرو جسی اس نے تم پرزیادتی کی ہے۔
غضب کی سزا
This chapter discusses the concepts of usurpation and disgrace.
The meaning of usurpation (غصب) is that someone forcefully takes another person's property, and the meaning of disgrace (عاری) is that something which, when sought, leads to deficiency and dishonor.
And Allah, the Exalted and Glorious, says: "And do not consume one another's wealth unjustly" (Surah Al-Baqarah, Part 2, Section 23, Verse 188), meaning, "Do not unjustly take one another's property."
And His Exalted statement: "So whoever transgresses against you, transgress against him in the same way that he has transgressed against you" (Surah Al-Baqarah, Part 2, Section 24, Verse 194), means, "Whoever wrongs you, wrong him to the extent that he has wronged you."
The punishment for anger.
سعید بن زید رضی اللہ عنہ سے روایت ہے وہ فرماتے ہیں کہ رسول اللہ صلی اللہ علیہ وآلہ وسلم ارشاد فرماتے ہیں کہ جو شخص کسی کی باشتوں پر زینہی ظلم سے (ناحق) حاصل کرتا تو قیامت کے دن اس زین کے ساتول طبق اس کے گل میں طوق بنا کر ذلے جائے گا۔ وہ ان کو اظہا کرے۔ اس سے معلوم ہوا کہ غصب کرنا کسی قدر نا قابل برداشت گناہ ہے۔ اس حدیث کی روایت بخاری اور مسلم نے کی ہے۔
دوسری حدیث
The Messenger of Allah ﷺ said: 'Whoever seizes the adornments of others through unjust oppression will have that adornment made into seven layers around his neck on the Day of Resurrection, and he will be humiliated by it.' This indicates that taking something by force is an intolerable sin. This hadith has been narrated by Bukhari and Muslim.
سالم ابن والد عبد اللہ بن عمر رضی اللہ عنہما سے روایت کرتے ہیں کہ وہ فرماتے ہیں کہ رسول اللہ صلی اللہ علیہ وآلہ وسلم ارشاد فرماتے ہیں کہ جو شخص کسی زین کا پکڑ حصر نا حق لے لے تو
وہ قیامت کے دن زمین کے ساتول طبق کے اندر (بطور سزاء کے) وضعا دیا جائے گا۔ اس کی روایت بخاری میں ہے۔
تیسری حدیث
Salim narrated from his father that the Messenger of Allah (ﷺ) said: “Whoever takes anything from the land without right will be sunk into the seven earths on the Day of Resurrection.” [Narrated by Bukhari].
یعلی بن مرہ رضی اللہ عنہ سے روایت ہے وہ فرماتے ہیں کہ میں نے رسول اللہ صلی اللہ علیہ وآلہ وسلم کوارشا دفرما تے سناتے کہ جو شخص کسی زمین پر احق قبضہ کر لے قیامت کے دن اس کو حکم دیا جائے گا کہ اس (ناحق مغصوب) زمین کی مٹی کو پھیرپراڈھا لے۔ اس کی روایت امام احمد نے میں ہے۔
چوتھی حدیث
Ya‘la ibn Murrah narrated that he heard the Messenger of Allah (ﷺ) say: “Whoever takes land without its right will be tasked with carrying its soil to the gathering place.” [Narrated by Ahmad].
یعلی بن مرہ رضی اللہ عنہ سے روایت ہے وہ فرماتے ہیں کہ میں نے رسول اللہ صلی اللہ علیہ وآلہ وسلم کوارشا دفرما تے سناتے کہ جو شخص ایک بالشت بجرز میں مجھ کسی کی ظلم سے لگا تو اللہ تعالیٰ اس کو (موت کے بعد بطور سزا کے) حکم دے گا کہ وہ اس مغصوب زمین کوسات طبق تک خود پچڑوہ زمین طوق بنا کراس کے گل میں دوالی جائے گی اور وہ قیامت کے اس حال میں رہے گا یہاں تک کہ اللہ تعالیٰ (اس دون) تمام لوگوں کے معاملات کافصلہ فرما دیں۔ اس کی روایت امام احمد نے میں ہے۔
مال غیر کا استعمال بلا اجازت حرام ہے
From him, he heard the Messenger of Allah (ﷺ) say: “Whoever unjustly takes a handspan of land, Allah will task him with digging it to the depth of the seven earths, then it will be hung around him until the Day of Resurrection when judgment is passed.” [Narrated by Ahmad].
ف : واضح ہوگا ذکورہ بالاحديثوں سے معلوم ہوتا ہے کہ زمین کا غصب کرناس قدربطا آناہے کہ بعض کوسزا میں زمین میں وضسا دیا جائے گااور بعض کے گل میں اس زمین کاطوق بنا کروالا جائے گااور بعض کوحکم دیاجائے گاکہ اس زمین کوسرپر اظہا لے اور پیہروز حشر ساری مخلوق کے سامنے ہوگا یعنی برآئی فضحت کی باٹ ہے۔ اللہ تعالیٰ ایسے گناہ سے تم سب کو پچا لے آمین!
عبداللہ بن عمر رضی اللہ عنہما سے روایت ہوہ فرما تے پین کر رسول اللہ صلی اللہ علیہ وآلہ وسلم ارشاد فرماتے پین کر کوئی شخص کسی جانور کا دودھ اس کے ما لکی اجازت کے بغیر نہ دحوے لیجن نہ پچوڑے، کیا تم میں سے کوئی شخص اس بات کو گوارا کرے گا کر کوئی غیر شخص اس کے گودام تک پہوچے اوراس کا قفل توڑ کر غلم لے جائے (جانور کے شخص کا بھی بھی حال ہے کر اس کی مثل مال کے گودام کی طرح ہے کہ) جانور کے شخص کے ما لکے حق میں (دودھ کے گودام کی طرح) پین کروہ ان کی حفاظت کرتے پین۔ اس کی روایت مسلم نے کی ہے۔
Ibn Umar narrated that the Messenger of Allah (ﷺ) said: “Let no one milk another’s livestock without permission. Would any of you like his storehouse to be broken into and his food taken? The udders of their livestock store their food for them.” [Narrated by Muslim]. Abu Dawud and At-Tirmidhi narrated from Samurah that the Prophet (ﷺ) said: “If one of you comes across livestock, if its owner is present, seek his permission. If he permits, milk and drink. If no one is there, call out three times. If someone responds, seek permission. If no one responds, milk and drink but do not take anything.” At-Tirmidhi and Ibn Majah narrated from Ibn Umar that the Prophet (ﷺ) said: “Whoever enters an orchard may eat but not take anything away.” At-Tirmidhi said: This is a strange hadith. At-Tirmidhi, Abu Dawud, and Ibn Majah narrated from Rafi‘ ibn Amr Al-Ghifari, who said: “I was a boy throwing stones at the Ansar’s palm trees. They caught me and brought me to the Prophet (ﷺ). He said, ‘Boy, why are you throwing stones at the palms?’ I said, ‘To eat.’ He said, ‘Do not throw stones; eat what falls beneath them.’ Then he patted my head and said, ‘O Allah, fill his stomach.’”
(1) “Let no one milk…”: This prohibits taking or using someone’s property without permission, whether milk or otherwise, for both the needy and others, except in dire necessity where no carrion is available. In such cases, one may eat and must compensate the owner, per our view and the majority. [Al-Nawawi].
(2) “Milk and drink…”: This is based on the Ansar’s custom of not denying travelers or the hungry. The hadith implies using another’s property requires permission, explicit or implied. Explicit permission is primary, but if no one is present, customary permission suffices. For those without such a custom, only the direly needy may drink and compensate. [From Al-Kawkab Ad-Durri]. Ibn Al-Malik said this is allowed only in necessity, fearing death or being stranded, with compensation when able. [From Al-Marqah].
(3) “May eat…”: Scholars say this and the milking hadith depend on local customs. If the item is precious to the owner, eating it without permission is impermissible. [From Arf Ash-Shadhi].
(4) “Eat what falls…”: This is due to the common custom of allowing fallen fruit, especially for children. Otherwise, even fallen fruit is another’s property, like dates on the tree. [From Al-Marqah].
اور ابوداوداورترمزی نے سمہ رضی اللہ عنہ سے روایت کی ہے کہ نبی کریم صلی اللہ علیہ وسلم نے ارشاد فرمایا کرتم میں سے کوئی شخص (بھوک کے ما رے بیتاب ہواؤر) اس کو (راستے میں) کوئی دوردو لا جانور لگیا اوراس کاما کر وہال مو جودہوتو وہ اس سے اجازت لے (اوردوردنکال کر پی لے) اور اگر ما کر نہ ہو (اورفاقت کی وجہ سے اس کو بلاکت کا اندیشہ ہو) تو وہ تین وقت بلندآوازتے پکارے آگر کوئی جواب دے تو اس سے دودھ پین کی اجازت لے لے اوراگر کوئی جواب نہ دے تو (بقدر ضرورت) دودہ نکا لے اور پی لے البتہ (دودہ کو) ساتھ نہ لے جائے۔

اورترمزی، اور ابن ماجہ نے حضرت ابن عمر رضی اللہ عنہما سے روایت کی ہے کہ حضور نبی کریم صلی اللہ علیہ وسلم نے ارشاد فرمایا کہ جوش (حالت سفر میں) کسی با غیرتے گذرے (اور بھوک کی وجہ سے بیتاب ہوتا ہے بقدر ضرورت پکڑ پھل کھا لے) لیکن پھر میں ساتھ پکڑ نہ لے جائے۔
If someone passes by a tree or plant while traveling and feels hungry, they may eat from it as much as is necessary, but they should not take any with them.
اورترمزی، ابوداوداور ابن ماجہ نے رافع بن عمرو غفاری رضی اللہ عنہ سے روایت کی ہے وہ فرما تے پین کر میں پر تھا اورانصار کے کجورو ل کے درختول پر پڑھ پھینکا کرتا تھا
( ایک وفع الصار ) نہی کریم صلی اللہ علیہ وسلم کی خدمت میں لے گئے (اور میری شکایت کی ) حضور علیہ صلاۃ اللہ
مجھ سے دریافت فرمائیا لے رکے ! تو رختوں پر پڑھ کر کیون پچینتا ہے میں نے عرض کیا ( کہ جو گرا کر )
کہ آتا ہول (پیس کر ) آپ نے ارشاد فرمایا پچھر نہ مارا کرو البتہ جو جو گر کر ہو لے مل جا بین ان کو
کہاسکے میں - پڑھ حضرت علیہ صلاۃ اللہ نے میرے سر پر با تھر کر دعا دی : اے اللہ! اس (پچر ) کوشکم سیر فرماء
ف : واشہ ہو کہ مذکورہ بالا احادیث ثمر یفہے حسب ذیل مسائل مستنبط ہوتے ہیں :
(1) ایک انسان کے لے دوسروں انسان کے مال کا استعمال بغیر اس کی اجازت کے حرام ہے خود وہ کہا نے
پیچ کی چیز ہو یا کوئی اور شے ہو حرم ت میں سب برابر ہیں اور ہی حکم استعمال کرنے والے شخص کے متعلق ہی ہے وہ
متناج ہو یا غیر محتاج البتہ ایسا شخص جوفاقہ سے میتاب ہواور بلا کرت کا اندیشہ ہوتا وہ بقدر ضرورت جان بجان کیلے ما کر
کی اجازت کے بغیر جب کر اجازت کا موقع حاصل نہ ہو کہا لے سکتا ہے لیکن اس پر لازم ہے کر ما کے کواس استعمال
شدہ چیز کا بل دیے علامہ ابن الملک رحم اللہ کا ہی قولا ہے اور جمہور علماء کا بھی ہی نہہب ہے اوراحناف کا بھی
ہی مسلک ہے-
(2) حضرت رافع بن عمر وغفاری رضی اللہ عنہ کی حدیث میں گرے پر پے پچل کے کہانے کی اجازت کا جوز کر
ہے وہ پچول کے حق میں بطور معافی کے ہے ور ناصل پیہ کری پری پچی کا بھی وہی حکم ہے جو درخت پر ہوتی ہے
اس لے کہ ہر دوصورت میں وہ مالی غیرہ جس کا بغیر اجازت استعمال کرنا حرام ہے پیرقات میں نذکور ہے-
غیر مملوک ز میں پر کاشت کر نے اوراس کوآ بادر نے کے احکام
I was with the Prophet ﷺ, and I used to climb the date palm trees and shake the branches to make the dates fall. The Prophet ﷺ said to me: 'Do not do this, but gather what falls.' Then the Prophet ﷺ placed his hand on my head and prayed: 'O Allah, make him a person of good character.'
سعید بن زید رضی اللہ عنہ سے روایت ہے کہ نبی کریم صلی اللہ علیہ وآلہ وسلم نے
ارشاد فرمایا ہے جو شخص مردہ زمین لیجنی ( غیر مملوکہ نجر زمین ) کو زندہ کر لے لیجنی اس کو قابل کاشت
بنالے یا آباد کر لے تو وہ زمین اس کی ہو جائے گی (بشر طیلہ حاکم وقت اس کی اجازت دیے ) اور
حضرت صلی اللہ علیہ وآلہ وسلم نے یہی ارشاد فرمایا ہے ) کہ اگر کوئی شخص ظلماً کسی کی زمین غصب کر
لے اوراس کوآ بادر کرے یا اس میں کاشت کرے ) تو وہ اس کی ملک قرار نہیں پائے -
اس کی روایت امام احمد، ترمذی، اورابوداوڈ نے کی ہے۔
Sa‘id ibn Zaid narrated that the Prophet (ﷺ) said: “Whoever revives dead land, it is his, and an unjust root has no right.” [Narrated by Ahmad, At-Tirmidhi, and Abu Dawud]. Malik narrated from Urwah similarly. At-Tirmidhi said: This is a good, strange hadith. At-Tabarani narrated in his Mu‘jam Al-Kabir and Al-Awsat from Mu‘adh that the Prophet (ﷺ) said: “A man has only what his leader willingly gives.”
(1) “It is his”: The land becomes his, but Abu Hanifah requires the leader’s permission. His two companions, Ash-Shafi‘i, and Ahmad cite the hadith’s generality. The hadith “A man has only what his leader willingly gives” supports requiring permission, as both relate to the same incident. [From Al-Marqah]. Radd Al-Muhtar says the Imam’s view is preferred, as stated in Al-Khaniyya and Al-Multaqa, followed by At-Tahawi and the texts. Ad-Durr Al-Mukhtar says for a Muslim, permission is disputed; for a non-Muslim, it is required; for a protected person, ownership is not possible.
(2) “An unjust root…”: One who plants or sows in another’s land without permission has no right to keep it. The owner may uproot it without compensation. [From Al-Marqah]. Al-Hidayah says if one usurps land and plants or builds, the owner may uproot without compensation. If uprooting harms the land, the owner may compensate for the building or plants’ value when uprooted, and they become his, considering both parties and avoiding harm.
اورامام ماکے نے اس کی روایت حضرت عروة سے کی ہے۔ ترمذی فرماتے ہیں کہ یہ حدیث حسن غریب ہے۔
Imam Maqil narrated it from Hadrat Urwah. Tirmidhi says that this hadith is hasan gharib.
اورطبرانی نے مجتم کبیر اورمجمع اوسط میں حضرت معاذ رضی اللّٰہ عنہ سے روایت کی ہے کہ بی کریم صلی اللّٰہ علیہ وآلہ وسلم نے ارشاد فرمایا کہ آدمی کے لگوئے مال اچھا ہے جس کو حاکم خوش دیتے ہیں۔
کسی کا مال بغیر اجازت لینے یا غصب کرنے کی ممانعت
the Messenger of Allah ﷺ said: 'Good wealth is that which the ruler gives with pleasure. It is forbidden to take someone's wealth without permission or by force.'
فہدایی میں لکھا ہے کہ اگر کس شخص کے کسی زمین غصب کرنے اوراس میں درخت لگانے یا عمارت بنانے تو عمارت گرادی جائے گی اوردرخت مجی نکال دیا جائے گے البتر ما کز مین ان کی قیمت ادا کرنے گا اورپیلک اصل ما کی یہ ہوگی، جہاں نہہب حقی ہے۔
ابوحرہ رقاشی رحمۃ اللّٰہ علیہ اپنے پچپا سے روایت کرتے ہیں کہ ان کے پیپا نے کہا کہ حضور صلی اللّٰہ علیہ وآلہ نے ارشاد فرمایا:خبردار کسی پرلم نہ کرواورکسی کا مال اس کی بغیر اجازت اورخوشی کے بغیر نلو۔
اس کی روایت تبرعی نے شعب الایمان اوردار قطعنی نے مجتبی میں کی ہے۔
مال مغضوب کی ہیبت بدلجانے کے احکام
تلف شدہ چیز کا بدل و بناپچائے
Beware of not cursing anyone, and do not take anyone's wealth without their permission and without their consent.
فہیل الاوطاراور فہاپی میں لکھا ہے کہ غاصب کے کسی کی چیز غصب کرنے اوراس کی ہیبت بدلونے تو غاصب اس کا ما کہو جائے گا اوراصل ما کی ملکیت سے وہ چیز نکل جائے گی مگر غاصب جب تک اس کابدل نہ دیتااس سے فاکده اتحاذا جائز نہیں ورنہ وہ گناہگار ہوگا۔جیسا کہ نے بری غصب کرنے اوراس کو ذنگ کر دیا تو اگرہوں غصب کر لیا اورروہی بنالی یا لو با غصب کر لیا اوراس کی تلوار بنالی۔چونکہ مغضوب مال کی ہیبت بدلجائے ہے اس کے اصل ما کو تبدیل شدہ چیز کے واپس کرنے سے غصب کی ذمہ داری سے بری نہ ہوسکے کاجب تک اصل ما کو مغضوب چیز کی قیمت ادا کر دے۔چیں نہہب حقی ہے۔
اس رضی اللّہ عنہ سے روایت ہے: وہ فرما تے ہیں کہ حضرت صلی اللہ علیہ وسلم (اکیو فع) اپنی اکیو لی لی (ام المومنین حضرت عائشہ کے گھر میں تشریف فرماتے آپ کی اکیو دورسری لی لی نے اکیو رکابی میں آپ کے لے (خادم کے ذریعہ) کہانا مججا پیدیکررام المومنین لی لی عائشہ نے (غیرت کے مارے) خادم کے ہاتھوں پماراجس سے رکابی (پلیٹ) گری اورلوط گئی حضرت صلی اللہ علیہ وسلم نے رکابی کے طروں کو انہا کرا کہا کیا اورگرے ہوئے کہانے کواس میں والریا اور(خادم سے) فرمانے کے تمہاری مال کو غیرت آگئی (جس کی وجہ سے ہے واقعہ ہوگیا) پھر حضرت صلی اللہ علیہ وسلم نے خادم کورو کے رکھااورام المومنین حضرت عائشہ کے گھر سے اکیو اور رکابی جوسالمقصود (اس کے معاوضہ میں) دیئی اور لوطی ہوتی رکابی رکھ لی۔ اس کی روایت بخاری نے کی ہے۔
ف : اس حدیث شریف سے معلوم ہوا کرسی شخص کامل اپنی ہاتھوں سے تلف ہوجانے تو اس کی پابندی میں اگر اس چیز کا شعلے تو ویسی چیز دیدی جانے اور اگروہیمتی چیز ہوتااس کی قیمت دیدی جانے۔
Anas narrated: The Prophet (ﷺ) was with one of his wives when another Mother of the Believers sent a servant with a plate of food. The wife in whose house the Prophet was struck the servant’s hand, causing the plate to fall and break. The Prophet (ﷺ) gathered the pieces, collected the food, and said, “Your mother was jealous.” He detained the servant until a plate was brought from the house of the wife who broke it. He gave the intact plate to the one whose plate was broken and kept the broken one in the house of the breaker. [Narrated by Bukhari].
(1) “Struck the servant’s hand…”: At-Turbishti said this hadith does not relate to usurpation or borrowing but to guaranteeing damaged items. Al-Qadi said its relevance is that the striker was charged with replacing the plate, as it broke due to her unjust act. Destroying another’s property directly or indirectly through aggression is a form of usurpation. [From Al-Marqah].
(2) “Gave the intact plate…”: Abu Hanifah’s view is that for items with a like, the equivalent is due; for valued items, their value is due. If asked why a plate, a valued item, was replaced with another plate, it was out of courtesy, not obligation, as both plates belonged to the Prophet (ﷺ). Alternatively, it was by mutual agreement, or plates were similar then, like counted similar items, allowing substitution. [From Al-Marqah]. At-Tahawi in Mushkil said vessels are valued, not like items, so how was one replaced? Some vessels are like items, especially today, as are some clothes. It may be a settlement, not a ruling. [From Arf Ash-Shadhi]. Hanafi doctrine in Al-Hidayah states that for usurped items with a like (e.g., measured or weighed), the equivalent is due; for items without a like, their value on the day of usurpation is due. Counted similar items, like walnuts or eggs, are like measured items, requiring their equivalent. Most scholars say this hadith contradicts Hanafis, as vessels are not like items, so they interpret it as formal compensation or both vessels being the Prophet’s. Some, like Ibn At-Tin, say it supports Hanafis, depending on whether vessels are like or valued items. [From Al-Kawkab Ad-Durri].
عبداللہ بن زید رضی اللہ عنہ سے روایت ہے وہ فرما تے ہیں کہ نی کریم حضرت صلی اللہ علیہ وسلم نے (مسلمانول کے مال کو) لوٹ کھسوٹ کرنے سے اور مثلہ (لیجن کسی کو بلا ک کرنے کے بعد ناک) کان وغیرہ کاغنجے منع فرما یہ (البتہ قصاص میں ایسا کرنا حرام نہیں ہے)۔
اس حدیث کی راویت بخاری نے کی ہے۔
لوط کے جواز کی صورت میں:
The Noble Messenger of Allah ﷺ prohibited striking the face and striking the private parts, and other similar forms of disfigurement (however, such actions are not prohibited in the case of retribution).
اور وہیمہ کے موٹے پر (جو چیزیں لطیفی جاتی ہیں ان کے) لوٹ میں کوئی حرج نہیں ہے۔ امام شعیع کا
جبی بھی قول ہے۔
اور امام ابو حنیفہ، امام ابو یوسف، اور امام محمد بن الحسن رحمۃ اللہ علیہم کا بھی بھی قول ہے۔ امام طحا
وی فرماتے ہیں کہ تم نے احادیث میں رسول اللہ صلی اللہ علیہ و آلہ وسلم سے اس بارے میں اس کا
جواز پایا ہے چنانچہ
There is no harm in taking light items from the spoils on the camels (which are heavy). This is the saying of Imam Shafi'i whenever he spoke about it. It is also the saying of Imam Abu Hanifah, Imam Abu Yusuf, and Imam Muhammad bin al-Hasan (may Allah have mercy on them). Imam Tahawi says: You have found the permissibility of this in the hadiths from the Messenger of Allah ﷺ.
عبد اللہ بن قرطبہ رضی اللہ عنہ سے روایت ہے وہ فرماتے ہیں کہ رسول اللہ صلی
اللہ علیہ و آلہ وسلم نے ارشاد فرمایا ہے کہ دونوں میں سب سے محبووب دین اللہ تعالیٰ کے پاس یوم
آخر یعنی دسویں ذو الحجہ کا دن ہے پھراس کے بعد عرفہ کا دن یعنی نویں ذو الحجہ کا دن (اللہ تعالیٰ کو
محبوب) ہے پھر میں نے رسول اللہ صلی اللہ علیہ و آلہ وسلم کی خدمت اقدام میں پائیا پھر اونٹیوال
(قربائی دین کے لئے) قربانی کیسے تو وہ اونٹیوال (ذنگہ ہوئے کے لئے ایک دوسرا پرسپوچت
کرتے ہوئے) رسول اللہ صلی اللہ علیہ و آلہ وسلم سے قریب ہوئے نگلبس کر حضور صلی اللہ علیہ و آلہ
و سلام کے پہلے ذنہ فرمائیں گے جب ساری اونٹیوال ذنہ ہوگئی تو حضور صلی اللہ علیہ و آلہ وسلم
نے خفی آواز میں پھر ارشاد فرمایا جس کو میں نہیں سمجھ سکا تو میں نے اپنے ساتھی سے جومیرے قریب
تحادریافت کیا کہ رسول اللہ صلی اللہ علیہ و آلہ وسلم نے کیا ارشاد فرمایا؟ جواب دیا کہ حضور صلی اللہ علیہ و آلہ وسلم
فرما یا کہ جو چاہے (ان اونٹیوال کے گوشے کو) کات کر لے جائے! رسول اللہ صلی اللہ علیہ و آلہ وسلم
نے اس حدیث شریف میں جب فرمادیا کہ جو چاہے۔ (گوشے) کات کر لے جائے (تو اس
طرح لوٹ لینے کی) اجازت دی اس سے اس بات پر دل مل گئی کہ ما کو لوگوں کو کیا فتنہ کے
کہا نے یا کسی اور چیز (کے لوٹ لینے) کی اجازت دیے تو وہ اس کو لے لے سکے ہیں اور اس طرح سے (ما کے لوٹ لینے کی اجازت دینے پر) لوٹ لینا جائز ہے اور یلوط اس عام لوٹ کھسوٹ سے جدا ہے جو منع ہے اور حس کا ذکر اس حدیث سے پہلے والی حدیث (جس کے راوی عبد اللہ بن زید ہیں) میں کیا گیا ہے تو ثابت ہو گیا کہ پہلی حدیث میں حس لوٹ کا ذکر ہو ہا گی لوٹ کھسوٹ سے حس کی اجازت نہ دی گئی ہوا اور حس لوٹ کی اجازت دی گئی ہوا اور وہ جائز ہو گی اور اجازت جواس دوسرا حدیث میں ذکور ہے۔ (جو حضرت عبد اللہ بن قرطب ضی اللہ عہمت مردی ہے)
ف : ابن بطال رحمۃ اللہ علیہ نے فرمایا ہے کہ رام لوٹ وہ ہے جوزمانہ جائیت میں عربول میں رانچی کے دوسروں پر حمل کرتے اور مال واسباب لوٹ لیتے چنانچہ حضرت عبادہ رضی اللہ عنہ کی حدیث میں اس طرح کی لوٹ اور غارت گری نہ کرنے کی بیعت لی گئی ہے، البتہ چون پراور شاد پول میں جو چیزیں چیکی جانی بیان میں علماء کا اختلاف ہے امام ما کا اور امام شافعی نے اس کو کروہ قرار دیا ہے اور احناف نے اس کو جائز رکھا ہے۔ مضمون عبد القاری اور مرقات سے ماخوذ ہے۔
Abdullah ibn Yazid narrated that the Prophet (ﷺ) forbade robbery and mutilation. [Narrated by Bukhari]. Ibn Abi Shaybah narrated from Al-Hasan that he saw no harm in robbery at weddings or feasts, as did Ash-Sha‘bi. This is the view of Abu Hanifah, Abu Yusuf, and Muhammad ibn Al-Hasan. At-Tahawi said: We found the Messenger of Allah (ﷺ) permitted this. Abdullah ibn Qurt narrated that the Prophet (ﷺ) said: “The most beloved days to Allah are the Day of Sacrifice and the Day of Arafah.” Camels were brought to him, five or six, vying for which to start with. When they fell, he said something lightly I did not understand. I asked the person beside me, who said, “He said, ‘Whoever wishes, let him take.’” This shows that what Allah permits people to take, they may take, unlike the forbidden robbery in the first narration, which is taking without permission. [From Al-Marqah].
(1) Ibn Battal said prohibited robbery refers to Arab raids, as in the pledge of Ubadah. Ibn Al-Mundhir said it is taking someone’s property without permission, against their will. The prohibition may apply to a group taking from spoils without division. Scholars differ on scattering items for children or at weddings. Malik and Ash-Shafi‘i disliked it; Hanafis permitted it. عمران بن حصین رضی اللہ عنہما سے روایت ہے وہ حضور میں کریم صلی اللہ علیہ و آ لہ وسلم سے روایت فرما نے ہیں کہ حضور صلی اللہ علیہ و آلہ وسلم نے فرمایا کہ اسلام میں نہ تو جلب جائز ہے اور نہ جحب اور نہ تو شغار اور جو شخص کسی (مسلمان) کا مال بغیر اجازت کے لوٹے وہ تمام میں سے نہیں۔ اس کی روایت تزندی نے کی ہے۔
ف : واضح ہو گیا گھوڑے دوز میں جلب پیہ کر گھوڑے اور زانے والا اپنے چیچے گھوڑے پر ایک شخص کواس غرض سے بھٹھا لے کر وہ گھوڑے کو تیز دوزی کے لئے مارے اور باکے ایا عمل جائز نہیں ہے۔
اور جب پیہ کر گھوڑا دور میں گھوڑا دور اس والا ایک زامند گھوڑے کو اپنے ساتھ لے کر جب پہلا گھوڑا اٹھا
جا تو دور سے پریشان کرائے مقابلے آگے تکل جاتے۔۔۔یہ لہجہ ناجائز ہے۔
اور شغار پیہ کر ایک شخص اپنے جمن کا نکاح کسی کے ساتھ اس شرط کے کرے کہ مہر کے جا توہ شخص اس کی
جمن کا نکاح اس کے ساتھ کرے کا اس بارے میں امام ابو حنیفہ اور سفیان ثوری رحمۃ اللہ علیہما نے فرمایا ہے کہ ایسے عقد
توہو جا کہ البتر ایسی شرط فاسد ہے اور فریقین مہر (یعنی فریقین کے خاندانی مہر) پانے کے مستحق ہیں۔ واقع ہے کہ
حدیث شریف کی تین صورتوں میں عدم جواز کی وجہ یہ کہ کسی نے کسی طریقت فریقین کے حقوق تلف ہورہے ہیں
اسی لئے ان کو ناجائز قرار دیا گیا ہے اور حقوق کو غصب کرنا اسلام میں جائز نہیں۔ اہٰ (یہ مضمون مرقات اور اشعة

مشتری مال کی خریداری کے احکام
Imran ibn Husayn narrated that the Prophet (ﷺ) said: “No jalab, janab, or shighar in Islam. Whoever robs is not of us.” [Narrated by At-Tirmidhi].
(1) “No jalab…”: Al-Qadi said jalab in racing is having someone follow and urge the horse; janab is keeping an unridden horse alongside to switch to if the ridden one tires. Jalab and janab in zakat were explained in the zakat chapter. Shighar is marrying one’s sister to another in exchange for his sister without dowry, derived from a deserted town, as the contract lacks dowry. The hadith indicates this contract’s invalidity, as it would otherwise exist in Islam, per most scholars. The invalidity stems from sharing intimacy as dowry. Abu Hanifah and Ath-Thawri say the contract is valid with dowry of the like. Ibn Al-Humam said the negation targets shighar’s essence, i.e., no dowry and intimacy as dowry. We negate this essence, invalidating such a marriage, but allow a marriage with an invalid dowry, requiring dowry of the like, as with a marriage naming wine as dowry. [From Al-Marqah]. Ayyad said there is no dispute on prohibiting shighar initially. If it occurs, Kufis, Al-Layth, Az-Zuhri, and Ata enforce it with dowry of the like; Malik and Ash-Shafi‘i invalidate it. [From Sharh Az-Zarqani]. Hanafis and Ash-Shafi‘i say the condition is invalid, not the marriage; Malik and Ahmad have two narrations. [From Sharh Al-Qari].
(2) “Whoever robs…”: This relates to the prior three, as taking wealth unjustly, like jalab and janab in horses, is a form of robbery. Similarly, causing distress, as in zakat’s jalab and janab, or shighar leaving women’s rights on husbands or guardians, is robbery. [From Al-Kawkab Ad-Durri].

حضرت ہ رضی اللہ عنہ سے روایت ہے وہ حضور نبی کریم صلی اللہ علیہ وسلم روایت
فرما تے پی کر حضور علیہ سے ارشاد فرمایا کہ شخص اپنا (گم شدہ یا چر ایا ہوا یا غصب کیا ہوا) مال کسی
شخص کے پاس دیکھ تو اس (کے پاس) کا زیادہ مستحق ہے اور (جب شخص نے ایہ مشتری مال کو
خرید لیا تو) اس شخص کو چاہے کہ پیچ وا لے (غاصب کا) پچھا کرے (متلاش کرے اور اس سے
اپنی قیمت لے لے، مال تو بھر صورت اصل مال کا ہو جائے گا)۔ اس کی روايت امام احمد، ابوداود
اور نسائی نے کی ہے۔
Samurah narrated that the Prophet (ﷺ) said: “Whoever finds his exact property with a bankrupt person is most entitled to it, and the buyer follows the seller.” [Narrated by Ahmad, Abu Dawud, and An-Nasa’i]. At-Tabarani narrated from him that the Prophet (ﷺ) said: “Whoever has goods stolen or lost and finds them with someone selling them is most entitled to them, and the buyer seeks the price from the seller.”
(1) At-Turbishti said this refers to usurped, stolen, or lost property. This was discussed in the chapter on bankruptcy and deferment. [From Al-Marqah].
اور طبرانی نے حضرت سے رضی اللہ عنہ سے اس طرح روایت کی ہے کہ
حضرت نبی کریم صلی اللہ علیہ وآلہ وسلم نے ارشاد فرمایا کہ کسی شخص کا کوئی مال چوری جائے یا وہ گم
ہو جائے اور وہ شخص اسی چیز کو سی کے پال پاو تو اس کا مستحق ہی شخص (یعنی اصل مال ک) ہے اور ادا
شره قیمت (غاصب) پیچ وا لے سے (ترم دین والا) خریدارا پی قیمت وصول کرے۔ (اس تے
معلوم ہوا کہ مغصوب ہے یا چوری کا مال کسی صورت میں خریدارا نہیں چاہے اور اگر خریدارے تو مال اصل مال کو
کو واپس ہو جائے گا اور ادا شدہ قیمت چرا کر پیچ وا لے سے وصول طلب ہو گی)۔

کسی کی آزادی کوسلب کرنا یا کسی کا مال غصب کرنا ورزخ میں جنکا سبب ہے
In the case of damage being discovered by fire or light, the liability for damage or the absence of liability depends on the following two scenarios: If the fire or light causes damage, the liability for the damage is general and applies universally. For this reason, Imam al-Bukhari (may Allah have mercy on him) narrates that if someone lights a fire and it damages another person's property during the day, the owner of the fire will not be liable for the damage at night, as the fire would have been extinguished by then. Similarly, if the fire spreads and damages something, the owner of the fire will not be held responsible, provided that the fire was lit with proper caution. However, if the owner does not take proper precautions and the fire spreads, causing damage, the owner will be held liable. In such a scenario, a person can light a fire near their own property without causing any harm to others, and if no damage is caused, there will be no liability. The Prophet (ﷺ) stated that there is no liability for damage caused by fire if it is discovered. The liability for damage caused by fire also does not apply when the fire is lit at a time when it is very intense and spreading, as the intensity of the fire at the initial time of lighting it would have been different. Therefore, if the fire spreads due to its intensity, the person who lit the fire will not be held liable, provided they took proper precautions. Otherwise, they will be held liable. قَبْضَهُ بَيْنَ رِضْوَى اللَّهِ عَنْهُ رَوَاهُ فِرْمَا تَهِي كَرْسُولِ اللَّهِ عَلَيْهِ وَ
آلِهِ وَسَلَامٍ كَمَبَارَكَ زَمَانِ مِنْ أَيْكَرِتَبَسُورِنَجَبِنْ هَوَاتَوَآ بَعَوْسَةَ نَمَا زَكْسُوفَ اِيْكَیْپَطَحَالِ
جِسے اور نماز میں تم پڑھا کرتے ہو۔
اس کی روایت امام طحاوی نے لکی ہے۔
And you recite it in the prayer.
اور مسلم کی ایک روایت میں اس طرح مروی ہے کہ حضرت اللہ علیہ و آلہ
وسلم نے (نماز کے بعد خطبہ میں ارشاد فرمایا) آج میں نے اس نماز میں ان چیزوں کو کیا لیا جس کا
تم سے وعدہ کیا گیا ہے اور وعید کی سنائی گئی ہے۔ اس نماز میں میرے سامنے دوزخ لاٹی گئی اور یہ
اس وقت ہوا جب کہ تم نے نماز میں پڑھے ہیں و یکھا ہوگا اور میں اس وقت دوزخ کے شعلوں
سے نکل کے لے پچھے ہٹ گیا تھا اور میں نے دوزخ میں ایک شخص کو یکھا کہ جس کے پاس ایک
کلہری تھی جس کا سر امر ا ہوا تھا۔ اور پیش خص ا پن آ نتوں کو جنپتا ہوا چل رہا تھا اور پیش خص و می تھا جو پن
اس لاٹی سے حاچون کی چیزوں کو چرا لیا کرتا تھا اس کے اس عمل کو کوئی دکیہ لیتا تو کہر دیتا یہ چیز
میری لاٹی میں ابھی ہوگی اوراگر (صاحب مال) غفلت ہوتا تو میال لے جاتا حضرت اللہ علیہ و
آلہ وسلم نے ارشاد فرمایا کہ میں نے اس بلی والی عورت کو جسی (دوزخ میں) دیکھا کہ جس نے اپنی
بلی کو باندھ کر حا تھا کہ نتو اے کہا نے کو دیتی اور نہ کھول دیتی کہ وہ حشرات الارض کو کھا لیتی یہاں
تک کہ بلی بھوک سے مر گئی۔ پھر میرے سامنے جنت کی لاٹی گئی اور پیاس وقت کا واقعہ ہے جب
کہ تم نے نماز میں آگے برہت ہوئے دیکھا پھر میں اپنی جلد کھڑا ہوگیا اور ہاتھوں برہا کر چاہتا تھا
کہ جنت کا کوئی چجل توڑ دو لتا کہ تم اس کو اپنی آنجھون سے دکیہ لو مجھے مناسب معلوم نہوا کر اپنا
کرول (کیونکہ اس سے ایمان بالغیب باقی نہیں رہتا)۔
(نذورہ بالا مسلم کی روایت سے معلوم ہوا کر کسی کی آزادی کو سلب کر لینا چاہے وہ جانور، یا کسی نہماور کی مال کو اثر الينا وزر میں جلنے کا سبب ہے)- کسی کی کوئی چیز ندا قا بھی لے لتو واپس کر دینی چاہیے
Qubaysah Al-Bajali narrated: The sun eclipsed during the Messenger of Allah’s (ﷺ) time, and he prayed as you pray. [Narrated by At-Tahawi]. Muslim’s narration adds: “Everything promised to you, I saw in this prayer. Hellfire was brought, when you saw me retreat, fearing its heat. I saw in it the man with the hooked stick dragging his intestines in the fire, who stole pilgrims’ belongings with his stick, saying, ‘It caught on my stick,’ if noticed, or taking it if unnoticed. I saw the woman who tied her cat, neither feeding it nor letting it eat from the ground’s creatures, until it died of hunger. Then Paradise was brought, when you saw me advance to my place. I stretched my hand to take its fruit for you to see, then decided not to.” [From Al-Marqah].

فرما تے ہیں کر حضور صلی اللہ علیہ وآلہ وسلم نے فرما یا کر تم میں سے کوئی شخص اپنے مسلمان بھائی کی (کوئی چیز مشا کل طی (و غیرہ) نہیں نذا ق کے طور پر بھی نہ لے جب کر اس کے دل میں پینیت ہو کر (مو قع پا کر پا لون گا) اگر (اتفاقاً) کل طی (و غیرہ) لے لی ہوتا تو اس کو واپس کر دے-
اس کی روایت ترن دی اور ابوداود نے کی ہے اور ابوداود کی روایت میں صرف لفظ جاداً تک ذکر ہے- مستعار چیز کے تلف ہونے میں لینے والے کا قصور نہ ہوتا تاوان عا کند نہ ہوگا
This is narrated by Tirmidhi and Abu Dawud. In Abu Dawud's narration, only the word 'particularly' is mentioned - if there is no negligence on the part of the one who takes possession, he will not be held responsible for the loss of the borrowed item.
روايت فرما تے ہیں کر حضور صلی اللہ علیہ وآلہ وسلم نے ارشاد فرما یا کسی سے کوئی چیز (عاریتاً) بلطو ر غصب یا چرا کر) لے لی جائے تو لینے والے پراس چیز کی ادائیگی کر واپسی کی ذمہ داری رہتی ہے-
اس کی روایت ترن دی، ابوداود اور ابن ماجہ نے کی ہے- قطنی اور ترمذی نے اپنی سنن میں عمرو بن شعیب رضی اللہ عنہ نے روایت کی ہے- وہ اپنے والد کے واسطے اپنے دادا سے روایت کرتے ہیں کہ ان کے دادا نے عمرو بن العاص رضی اللہ عنہ نے کریم صلی اللہ علیہ وآلہ وسلم نے روایت فرما تے ہیں کر حضور صلی اللہ علیہ وسلم نے ارشاد فرما یا کر امانت رکھنے والا شخص خاکن نہ ہوتا (امانت رکھنے والی چیز کے تلف
The one who keeps a trust is not a traitor (in the matter of the entrusted thing).
ہو جائے پر) تاوان نہ ہوگا اور (اس طرح) مستعار لین والا اگر خانہ نہ ہو تو (مستعار چیز کے
تلف ہو جائے پر کچھ) تاوان عاکد نہ ہوگا۔
If the borrowed item is lost and there is no negligence, then there will be no liability. And if the borrower does not have a house, then there will be no liability for the loss of the borrowed item.
اور ابن ماجہ نے اپنی سنن میں عمرو بن عاص رضی اللہ عنہ سے روایت کی
ہے کہ حضرت نبی کریم صلی اللہ علیہ وآلہ وسلم نے فرمایا کونی شخص کسی کے پاس کوئی امانت رکے (اگر وہ
امانت تلف ہو جائے) تو امانت دار پرتاوان عاکد نہ ہوگا۔
If a person leaves any property in trust with someone else, and that property is lost, the trustee will not be held responsible.
اور عبد الرزاق نے اپنی مصنف میں امیر المومنین حضرت عمر بن خطاب رضی
اللہ عنہ سے روایت کی ہے کہ آپ نے فرمایا عاریتا لی ہوئی چیز بہ منزلہ امانتا کے ہے (تلف ہو جائے
کی صورت میں) اس پرتاوان نہ ہوگا البتہ عاریتا لیں والا زیادتی کرے (چیں اگر وہ خیانت کر
جاۓ تو تاوان عاکد ہوگا)۔
Samurah narrated that the Prophet (ﷺ) said: “The hand is responsible for what it takes until it returns.” [Narrated by At-Tirmidhi, Abu Dawud, and Ibn Majah]. Ad-Daraqutni and Al-Bayhaqi narrated from Amr ibn Shu‘ayb from his father from his grandfather that the Prophet (ﷺ) said: “There is no guarantee on the borrower or trustee unless they transgress.” Ibn Majah narrated from him that the Prophet (ﷺ) said: “Whoever is entrusted with a deposit has no guarantee.” Abdur-Razzaq narrated from Umar ibn Al-Khattab: “Borrowed items are like deposits; there is no guarantee unless transgressed.” Ibn Abi Shaybah and Abdur-Razzaq narrated from Ali: “The borrower incurs no guarantee.”
(1) Scholars differ on borrowing. Hanafis say it is a trust; if it perishes without transgression, there is no guarantee, per Ali, Ibn Mas‘ud, Al-Hasan, An-Nakha‘i, Ash-Sha‘bi, Ath-Thawri, Umar ibn Abdul-Aziz, Shurayh, Al-Awza‘i, Ibn Shubrumah, and Ibrahim. Shurayh judged thus for eighty years in Kufa. Ash-Shafi‘i and Ahmad say it is guaranteed, per Ibn Abbas, Abu Hurairah, Ata, and Ishaq, citing this hadith, Safwan ibn Umayyah’s hadith, and Abu Umamah’s. Hanafis cite the subsequent hadiths and say this hadith supports them, as “return” is obligatory without implying guarantee. If guarantee were implied, it would apply to pledges and deposits. Al-Hidayah says the usurper must return the item while it exists, per “The hand is responsible…” and “No one may take his brother’s property in jest or earnest; if taken, return it.” Safwan’s hadith is shaky in chain and text, per Al-Tamhid. Even if sound, “guaranteed” means guaranteed return, or a borrowing with a guarantee condition is guaranteed per Hanafis. Abu Umamah’s hadith does not indicate guarantee, as Allah says: “Indeed, Allah commands you to render trusts to whom they are due” (An-Nisa: 58). If a trust perishes, return is not required. اور ابن ابی شیبا اور عبد الرزاق نے حضرت علی رضی اللہ عنہ سے روایت کی
ہے آپ نے فرمایا کہ (کسی چیز کو) عاریتا لیں وا لے شخص پر (اس چیز کے تلف ہو جائے کی صورت
میں) تاوان نہیں ہوگا۔

ف: واضح ہو کہ مستعار چیز کے حکم میں علماء کا اختلاف ہے۔ ہمارے اتمام احناف فرماتے ہیں کہ مستعار لی ہوئی
چیز بہ منزلہ امانت کے ہے اگر وہ بخیرگی زیادتی کے تلف ہو جائے تو مستعار لین والے پرتاوان عاکد نہ ہوگا۔ حضرت
علی، حضرت ابن مسعود، حضرت حسن بصری، امام نخعی، امام شعیبی، امام ثوری، حضرت عمر بن عبد العزیز قاضی ثرثے، امام
اوزاعی، امام ابن شہبر مرضی اللہ عنہم کا بھی قول ہے اور قاضی شرتح نے اس قول پر کوفیا ایس (80) برس کے مقدما ت
کے فصل کی ہیں۔ اور امام شافعی رحمۃ اللہ علیہ کا بھی قول ہے کہ مستعار لی ہوئی چیز کے تلف ہو جائے پر مطلقاً تاوان عاکد
ہوگا خواہ مستعری غفلت کواس میں داخل ہو یا نہ ہو امام شافعی رحمۃ اللہ علیہ نے صدر کی حیثیت سے استدلال کیا ہے جو
حضرت سرورہ رضی اللہ عنہ سے مرودی ہے۔ امام احمد رحمۃ اللہ، حضرت ابن عباس، حضرت ابوہریرہ، حضرت عطاء اور امام
اساق رضی اللہ عنہما کچھ بیان قول سے لیکن قائل غور امریہ کرام شافعی رحمۃ اللہ علیہ نے حضرت سے مرہ کی حدیث سے
جو استدلال کیاہے حقیقت میں اس سے حقی مسلک کی تائید ہوتی ہے اس لئے کہ حضرت سے مرہ کی حدیث سے مستعار چیز کی
و اپنی کا جواب ثابت ہور باہے نکرتاوالن کا نزوم! اس کے علاوہ نص قرآنی سے کچھ مطلقاً امانت رکھی ہوتی چیز کے
و اپنی کا جواب حاصل ہوتاہے ارشاد ہور باہے: " ان اللہ یامرکم ان توڈوا الامنت الی اهلها".
(سورۃ نساء، پ:5، ع:18 آیت نمبر:58) اس طرح ثابت ہوا کہ امانت رکھی ہوتی چیز اگر تلف ہوجائے اور اس چیز
کے تلف ہونے میں امانت دار کی غفلت کو خلل نہ ہوتا امانت دار پرتاوالن عاکند ہوگا۔ یعنے عمدۃ القاری سے ماخوذہ۔

قرآوہ رحمۃ اللہ سے روایت سے و فرماتے پین کر میں نے حضرت انس رضی
اللہ عنہ کو فرماتے سناہے کہ (ایک دفعہ) میں منورہ میں اس خبر سے اضطراب پیا تو گیا کہ کفار کا
شکر کہیں قریب آگیاہے۔ (پیس کر) حضور صلی اللہ علیہ و آلہ وسلم نے حضرت ابو ظہر رضی اللہ عنہ کا
گھوڑا (ست رفّاری کی وجہتے) جس کو مندوب کہا جاتا تھا عمار پیالیا پاس پرسوار ہوکر (تہا)
نعل گے اور (صورت حال دریافت فرماکر) و اپس تشریف لائے اور فرما کہ خوف کی کوئی بات
نبی کے اور (گھوڑے کی نسبت) فرما کہ نے تو اس کو (اب) کافی تیز رفّار پایا اس حدیث کی
روایت بخاری اور مسلم نے متفرق طور پر کی ہے۔
ف : اس حدیث تشریف سے ثابت ہوتاہے کہ کسی چیز کا مستعار لینا جائزہے نیز یہ بھی معلوم ہوتاہے کہ
حضرۃ اللہ کی سواری کی برکت سے ست رفّار گھوڑا آن کی آن میں تیز قدم ہوگیا۔ اور حضرۃ اللہ کا تہا الشکر کی طرف
چلا جانا اس بات کا ثبوت ہے کہ حضور صلی اللہ علیہ و آلہ وسلم کے قدر رجوع اور زیج ہے۔
Qatadah narrated that Anas said: There was a panic in Medina, so the Prophet (ﷺ) borrowed a horse from Abu Talhah called Al-Mandub, rode it, and upon returning said, “We found nothing, and we found it a sea.” [Agreed upon].
(2) “Borrowed a horse”: This permits borrowing, which is granting benefit without compensation, per Abu Bakr Ar-Razi. Al-Karkhi and Ash-Shafi‘i say it is permitting benefit, not ownership, so the borrower cannot lease it. The first is sounder, as the borrower may lend it, unlike mere permission. Leasing is not allowed as it is stronger than borrowing, and a thing does not entail its equal or stronger. [From Umdat Al-Qari].
