وَقَوْلِ اللَّهِ عَزَّ وَجَلَّ: وَلَا تَأْكُلُوا۱ أَمْوَالَكُم بَيْنَكُم بِالْبَاطِلِ (البقرة: ۱۸۸) ، وَقَوْلِهِ تَعَالَى: ﴿فَمَنِ۲ اعْتَدَى عَلَيْكُمْ فَاعْتَدُوا عَلَيْهِ بِمِثْلِ مَا اعْتَدَى عَلَيْكُمْ (البقرة: ١٩٤)
۱ قوله: ولا تأكلوا إلخ : أكل المال بالباطل على وجوه، الأول: أن يأكله بطريق التعدي والنهب والغصب، الثاني: أن يأكله بطريق اللهو كالقمار وأجرة المغني وثمن الخمر والملاهي ونحو ذلك، الثالث: أن يأكله بطريق الرشوة في الحكم وشهادة الزور، الرابع: الخيانة، وذلك في الوديعة والأمانة ونحو ذلك. كذا في «الخازن».
۲ قوله: فمن اعتدى إلخ لهذه الآية يجب رد عينه في مكان غصبه أو مثله إن هلك، وهو مثلي وإن انصرم المثل فقيمته يوم الخصومة، وما لا مثل له فقيمته يوم غصبه، وهذا بالإجماع، وهو المذروح والحيوان والمعدودات المتفاوتة والوزني الذي يضره التبعيض؛ لأنه تعذر اعتبار المثل صورة ومعنى، وهو الكامل فوجب اعتبار المثل معنى، وهو القيمة؛ لأنها تقوم مقامه، ويحصل بها مثله، واسمها ينبئ عنه، وقال الإمام مالك: يضمن مثله صورة لما روي عن أنس له قال : كنت في حجرة عائشة ما قبل أن يضرب الحجاب، فأتي بقصعة من ثريد بعض أزواجه ، فضربت عائشة القصعة بيدها فكسرتها، وجاءت بقصعة مثل تلك القصعة في يدها، فاستحسن رسول الله ﷺ ذلك منها، الحديث. ولنا قوله عليه الصلاة والسلام في عبد بين رجلين يعتق أحدهما نصيبه، فإن كان موسرا ضمن نصيب الآخر، وإن كان معسرا سعى العبد في قيمة نصيب شريكه، وهذا نص صريح في اعتبار القيمة فيما لا مثل له، وهذه الآية شاهدة لنا؛ لأنه هو المثل المتعارف بين الناس وفعل عائشة ما كان على طريق المروءة ومكارم الأخلاق لا على طريق الواجب؛ إذ كانت القصعتان للنبي . كذا في البحر الرائق».
Allah Almighty says: Allah, the Exalted, says: “And do not consume one another’s wealth unjustly” (Al-Baqarah: 188).
And He says: “So whoever transgresses against you, transgress against him in the same way that he transgressed against you” (Al-Baqarah: 194).
1 “And do not consume…”: Consuming wealth unjustly occurs in several ways:
First: Taking it through transgression, robbery, or usurpation.
Second: Taking it through frivolous means, such as gambling, payment for singers, or the price of wine, musical instruments, or similar.
Third: Taking it through bribery in judgment or false testimony.
Fourth: Betrayal, such as in deposits or trusts. [As stated in Al-Khazin].
2 “So whoever transgresses…”: This verse obligates returning the usurped item to its place of usurpation, or its equivalent if it is perishable and has a like, or its value on the day of dispute if the like no longer exists. For items without a like, its value on the day of usurpation is due, by consensus. This applies to animals, counted items that differ, and weighed items that are harmed by division, as it is impossible to consider equivalence in both form and meaning. Thus, equivalence in meaning, i.e., value, is required, as it stands in its place and enables acquiring a similar item. Imam Malik said the equivalent in form is guaranteed, citing a narration from Anas: While in Aisha’s room before the hijab was mandated, a bowl of tharid was brought from one of the Prophet’s wives. Aisha struck the bowl, breaking it, and brought a similar bowl. The Prophet (ﷺ) approved of this. Our evidence is the Prophet’s (ﷺ) saying regarding a slave shared by two men, where one frees his share: If the other is wealthy, he guarantees the other’s share; if insolvent, the slave works for the value of the partner’s share. This is explicit in considering value for items without a like. This verse supports us, as it refers to the commonly accepted equivalent. Aisha’s action was out of courtesy and noble character, not obligation, as both bowls belonged to the Prophet (ﷺ). [As stated in Bahr Ar-Ra’iq].
وَعَنْ سَعِيدِ بْنِ زَيْدٍ (رضي الله عنه)، قَالَ: قَالَ رَسُوْلُ اللَّهِ ﷺ: «مَنْ أَخَذَ۱ شِبْرًا مِنَ الْأَرْضِ ظُلْمًا فَإِنَّهُ يُطَوَّقُهُ يَوْمَ الْقِيَامَةِ مِنْ سَبْعِ أَرَضِينَ». مُتَّفَقٌ عَلَيْهِ.
Sa‘id ibn Zaid narrated that the Messenger of Allah (ﷺ) said: “Whoever takes a handspan of land unjustly, it will be hung around his neck from the seven earths on the Day of Resurrection.” [Agreed upon].

1 Usurpation is removing a rightful hand and establishing an unjust one. Ash-Shafi‘i considers only establishing the hand, with the difference being in increments (e.g., fruit from a usurped garden is not guaranteed by us, unlike him). Muhammad considers removing the rightful hand in movable usurpation, and in immovable, dominion replaces removal. Thus, immovable property is guaranteed even without removal. [From Ad-Durr Al-Mukhtar and Radd Al-Muhtar]. Al-Kirmani said: This includes land usurpation, contrary to the Hanafis. I say: Al-Kirmani’s claim is baseless, as the Hanafi view differs. Abu Hanifah and Abu Yusuf say usurpation only applies to movable items, as removal requires transfer, which immovable property lacks. If usurped immovable property perishes, it is not guaranteed. ۱ قوله: من أخذ شبرا من الأرض ظلما إلخ : وهو أي الغصب إزالة يد محقة بإثبات يد مبطلة، واعتبر الشافعي إثبات اليد فقط، والثمرة في الزوائد، فثمرة بستان مغصوب لا تضمن عندنا، خلافا له، واعتبر محمد إزالة اليد المحقة في غصب المنقول، وفي غيره يقيم الاستيلاء مقام الإزالة، كما حققه في النهاية»، ولذا ضمن العقار، وإن لم تتحقق فيه الإزالة، التقطته من الدر المختار و رد المحتار». وقال الكرماني: وفيه غصب الأرض خلافا للحنفية. قلت: رمى الكرماني كلامه جزافًا من غير وقوف على كيفية مذهب الحنفية؛ فإن مذهبهم فيه خلاف، فعند أبي حنيفة وأبي يوسف الغصب لا يتحقق إلا فيما ينقل ويحول؛ لأن إزالة اليد بالنقل، ولا نقل في العقار، فإذا غصب عقار فهلك في يده لا يضمن، وقال محمد يضمن، وهو قول أبي يوسف الأول، وبه قال زفر والشافعي ومالك وأحمد؛ لأن الغصب عندهم يتحقق في العقار والخلاف في الغصب لا في الإتلاف، وبعض مشايخنا قالوا: يتحقق الغصب في العقار أيضًا عند أبي حنيفة وأبي يوسف، لكن لا على وجه يوجب الضمان، والأكثرون على أنه لا يتحقق في العقار أصلا، والاستدلال بهذا الحديث على ما ذهبوا إليه غير مستقيم؛ لأنه الله جعل جزاء غصب الأرض التطوق يوم القيامة، ولو كان الضمان واجبا لبينه؛ لأن الضمان من أحكام الدنيا، فالحاجة إليه أمس، والمذكور جميع جزائه، فمن زاد عليه كان نسخا، وذا لا يجوز بالقياس.
وإطلاق لفظ الغصب عليه لا يَدلُّ على تحقق الغصب الموجب للضمان، كما أنه أطلق لفظ البيع على الحر بقوله: من باع حرا، ولا يدل ذلك على البيع الموجب للحكم على أنه جاء في هذا الحديث بلفظ «أخذ»، فقال: من أخذ شبرا في الأرض ظلما فإنه يطوقه الله يوم القيامة من سبع أرضين، فعلم أن المراد من الغصب الأخذ ظلما لا غصبا موجبا فللضمان. فإن قلت: قوله : على اليد ما أخذت حتى ترد يدلُّ على ذلك بإطلاقه والتقييد بالمنقول خلافه. قلت: هذا مجاز؛ لأن الأخذ حقيقة لا يتصور في العقار؛ لأن حدالأخذ أن يصير المأخوذ تبعا ليده، فافهم. كذا في عمدة القاري». وقال في «الدر المختار»: إنما لا يتحقق الغصب عندهما في العقار في حكم الضمان، أما فيما وراء ذلك فيتحقق. ألا ترى أنه يتحقق في الرد، فكذا في استحقاق الأجرة، فليحفظ.
وَعَنْ سَالِمٍ عَنْ أَبِيْهِ قَالَ: قَالَ رَسُولُ اللهِ ﷺ: «مَنْ أَخَذَ مِنَ الْأَرْضِ شَيْئًا بِغَيْرِ حَقَّهِ خُسِفَ بِهِ يَوْمَ الْقِيَامَةِ إِلَى سَبْعِ أَرَضِينَ. رَوَاهُ الْبُخَارِيُّ.
Salim narrated from his father that the Messenger of Allah (ﷺ) said: “Whoever takes anything from the land without right will be sunk into the seven earths on the Day of Resurrection.” [Narrated by Bukhari].
وَعَنْ يَعْلَى بْنِ مَرَّةً (رضي الله عنه) قَالَ: سَمِعْتُ رَسُولَ اللَّهِ ﷺ يَقُوْلُ: «مَنْ أَخَذَ أَرْضًا بِغَيْرِ حَقَّهَا كُلَّفَ أَنْ يَحْمِلَ تُرَابَهَا إِلَى الْمَحْشَرِ». رَوَاهُ أَحْمَدُ.
Ya‘la ibn Murrah narrated that he heard the Messenger of Allah (ﷺ) say: “Whoever takes land without its right will be tasked with carrying its soil to the gathering place.” [Narrated by Ahmad].
وَعَنْهُ (رضي الله عنه)قَالَ : سَمِعْتُ رَسُولَ اللهِ ﷺ يَقُوْلُ: «أَيُّمَا رَجُلٍ ظَلَمَ شِبْرًا مِنَ الْأَرْضِ كَلَّفَهُ اللهُ عَزَّ وَجَلَّ أَنْ يَحْفِرَهُ حَتَّى يَبْلُغَ آخِرَ سَبْعِ أَرَضِينَ، ثُمَّ يُطَوَّقَهُ إِلَى يَوْمِ الْقِيَامَةِ حَتَّى يُقْضَى بَيْنَ النَّاسِ». رَوَاهُ أَحْمَدُ.
From him, he heard the Messenger of Allah (ﷺ) say: “Whoever unjustly takes a handspan of land, Allah will task him with digging it to the depth of the seven earths, then it will be hung around him until the Day of Resurrection when judgment is passed.” [Narrated by Ahmad].
وَعَنِ ابْنِ عُمَرَ (رضي الله عنهما) قَالَ: قَالَ رَسُولُ اللهِ ﷺ: «لَا يَحْتَلِبَنَّ۱ أَحَدُ مَاشِيَةَ امْرِئٍ بِغَيْرِ إِذْنِهِ أَيُحِبُّ أَحَدُكُمْ أَنْ تُؤْتَى مَشْرُبَتُهُ فَتُكْسَرَ خِزَانَتُهُ فَيُنْتَقَلَ طَعَامُهُ وَإِنَّمَا تَخْزُنُ لَهُمْ ضُرُوعُ مَوَاشِيهِمْ أَطْعِمَاتِهِمْ. رَوَاهُ مُسْلِمٌ.
وَرَوَى أَبُو دَاوُدَ وَالتَّرْمِذِيُّ عَنْ سَمُرَةَ أَنَّ النَّبِيَّ ﷺ قَالَ: «إِذَا أَتَى أَحَدُكُمْ عَلَى مَاشِيَةٍ فَإِنْ كَانَ فِيهَا صَاحِبُهَا فَلْيَسْتَأْذِنْهُ، فَإِنْ أَذِنَ لَهُ فَلْيَحْتَلِبْ۲ وَلْيَشْرَبْ وَإِنْ لَمْ يَكُنْ فِيهَا أَحَدٌ فَلْيُصَوِّتْ ثَلَاثًا فَإِنْ أَجَابَهُ أَحَدٌ فَلْيَسْتَأْذِنُهُ فَإِنْ لَمْ يُجِبْهُ أَحَدٌ فَلْيَحْتَلِبْ وَلْيَشْرَبْ وَلَا يَحْمِلْ».
وَرَوَى التَّرْمِذِيُّ وَابْنُ مَاجَه عَنِ ابْنِ عُمَرَ ما عَنِ النَّبِيِّ ﷺ قَالَ: «مَنْ دَخَلَ حَائِطًا فَلْيَأْكُلْ۳ وَلَا يَتَّخِذْ خُبْنَةٌ، وَقَالَ التَّرْمِذِيُّ: هَذَا حَدِيْثُ غَرِيبٌ.
وَرَوَى التَّرْمِذِيُّ وَأَبُو دَاوُدَ وَابْنُ مَاجَه عَنْ رَافِعِ بْنِ عَمْرٍو الْغِفَارِيِّ أَنَّهُ قَالَ: كُنْتُ غُلَامًا كُنْتُ أَرْمِي نَخْلَ الْأَنْصَارِ فَأَخَذُونِي فَأُتِيَ بِي النَّبِيَّ ﷺ فَقَالَ: «يَا غُلَامُ، لِمَ تَرْمِي النَّخْلَ؟ قَالَ قُلْتُ: أَكُلُ، قَالَ: «لَا تَرْمِ وَكُلْ مِمَّا سَقَطَ٤ فِي أَسْفَلِهَا»، ثُمَّ مَسَحَ رَأْسَهُ، فَقَالَ: «اللَّهُمَّ أَشْبِعْ بَطْنَهُ».
Ibn Umar narrated that the Messenger of Allah (ﷺ) said: “Let no one milk another’s livestock without permission. Would any of you like his storehouse to be broken into and his food taken? The udders of their livestock store their food for them.” [Narrated by Muslim]. Abu Dawud and At-Tirmidhi narrated from Samurah that the Prophet (ﷺ) said: “If one of you comes across livestock, if its owner is present, seek his permission. If he permits, milk and drink. If no one is there, call out three times. If someone responds, seek permission. If no one responds, milk and drink but do not take anything.” At-Tirmidhi and Ibn Majah narrated from Ibn Umar that the Prophet (ﷺ) said: “Whoever enters an orchard may eat but not take anything away.” At-Tirmidhi said: This is a strange hadith. At-Tirmidhi, Abu Dawud, and Ibn Majah narrated from Rafi‘ ibn Amr Al-Ghifari, who said: “I was a boy throwing stones at the Ansar’s palm trees. They caught me and brought me to the Prophet (ﷺ). He said, ‘Boy, why are you throwing stones at the palms?’ I said, ‘To eat.’ He said, ‘Do not throw stones; eat what falls beneath them.’ Then he patted my head and said, ‘O Allah, fill his stomach.’”

1 “Let no one milk…”: This prohibits taking or using someone’s property without permission, whether milk or otherwise, for both the needy and others, except in dire necessity where no carrion is available. In such cases, one may eat and must compensate the owner, per our view and the majority. [Al-Nawawi].
2 “Milk and drink…”: This is based on the Ansar’s custom of not denying travelers or the hungry. The hadith implies using another’s property requires permission, explicit or implied. ۱ قوله : لا يحتلبن أحد ماشية امرئ بغير إذنه إلخ فيه تحريم أخذ مال الإنسان بغير إذنه والأكل والتصرف فيه، وإنه لا فرق بين اللبن وغيره، وسواء المحتاج وغيره إلا المضطر الذي لا يجد ميتة ويجد طعاما لغيره، فليأكل الطعام للضرورة ويلزمه بدله لمالكه عندنا وعند الجمهور. قاله النووي.
۲ قوله: فليحتلب وليشرب إلخ : هذا مبني على عرف الأنصار، فإنهم كانوا لا يمنعون المسافر ولا الجائع عنه إلا أن لفظ الحديث يشير إلى أن استعمال ملك الغير لا يجوز من غير إذنه، غير أن الأمر والإذن قد يكون صراحة، وقد يكون دلالة، والأول هو الأول والأولى، فعليه أن يجهد لتحصيل صريح الإذن لأصالته، وإذا علم أن ليس هناك أحد يستأذنه يكتفي بدلالة إذن العرف، ولا يجوز الإقدام عليه فيمن ليس لهم عرف في الإذن، إلا أن المضطر يشرب منه ويضمن قاله في الكوكب الدري»، وقال في المرقاة عن ابن الملك لله : هذا إنما يجوز للضرورة بأن يخاف الموت من الجوع أو انقطاعه من السبيل ويرد قيمته لمالكه عند القدرة.
۳ قوله : فليأكل إلخ : قال العلماء : إن هذا الحديث وحديث حلب اللبن للمار بها دائر على عرف الناس، فما كان وقيعا وعزيزا عند المالك لا يجوز أكله بلا إجازة. قاله في العرف الشذي».
٤قوله: كل مما سقط في أسفلها : أي لأن العادة جارية غالبا بمسامحة الساقط للاقط لا سيما للصغار المائلين إلى الثمار، وإلا لم يجز له أن يأكل مما سقط أيضًا؛ لأنه مال الغير كالرطب على رأس النخل. كذا في «المرقاة».
وَعَنْ سَعِيدِ بْنِ زَيْدٍ (رضي الله عنه)عَنِ النَّبِيِّ ﷺ أَنَّهُ قَالَ: «مَنْ أَحْيَا أَرْضًا مَيْتَةً فَهِيَ لَهُ۱ وَلَيْسَ۲ لِعِرْقٍ ظَالِمٍ حَقٌّ». رَوَاهُ أَحْمَدُ وَالتَّرْمِذِيُّ وَأَبُو دَاوُدَ.
وَرَوَاهُ مَالِكُ عَنْ عُرْوَةَ، وَقَالَ التَّرْمِذِيُّ: هَذَا حَدِيْثٌ حَسَنٌ غَرِيبٌ، وَرَوَى الطَّبَرَانِيُّ فِي مُعْجَمِهِ الْكَبِيرِ وَالْأَوْسَطِ عَنْ مُعَادٍ أَنَّ النَّبِيَّ ﷺ قَالَ: «إِنَّمَا لِلْمَرْءِ مَا طَابَتْ بِهِ نَفْسُ إِمَامِهِ».

وَعَنْ أَبِي حُرَّةَ الرّقاضي عَنْ عَمِّهِ قَالَ: قَالَ رَسُولُ اللهِ ﷺ: «أَلَا لَا تَظْلِمُوا، أَلَا لَا يَحِلُّ۱ مَالُ امْرِئٍ إِلَّا بِطِيبِ نَفْسٍ مِنْهُ». رَوَاهُ الْبَيْهَقِيُّ فِي شُعَبِ الْإِيْمَانِ وَالدَّارَقُطْنِي في الْمُجْتَبى».
Abu Hurrah Ar-Raqqashi narrated from his uncle that the Messenger of Allah (ﷺ) said: “Beware, do not oppress. No one’s property is lawful except with his willing consent.” [Narrated by Al-Bayhaqi in Shu‘ab Al-Iman and Ad-Daraqutni in Al-Mujtaba].

1 If the usurped item changes due to the usurper’s action, losing its name and primary benefit, the original owner’s right ceases, the usurper owns it, and must compensate. This applies, e.g., to a usurped sheep slaughtered and cooked, wheat ground, iron made into a sword, or copper made into a vessel. Per our view, Ash-Shafi‘i says the owner’s right persists. This hadith supports Abu Hanifah, as the usurper’s transformation destroys the owner’s right in one sense, as the name changes and primary purpose is lost, while the usurper’s right in the craft remains. ۱قوله : لا يحل إلخ إذا تغيرت العين المغصوبة بفعل الغاصب حتى زال اسمها وأعظم منافعها، زال ملك المغصوب منه عنها، وملكها الغاصب وضمنها، ولا يحل له الانتفاع بها حتى يؤدي بدلها كمن غصب شاة وذبحهاوشواها أو طبخها أو حنطة فطحنها أو حديدًا فاتخذه سيفا أو صفرا فعمله آيذة، وهذا كل عندنا، وقال الشافعي: لا ينقطع حق المالك، وعموم هذا الحديث حجة له، ولكن حجة هذا الحديث ظاهر في الدلالة لمذهب أبي حنيفة؛ لأن الغاصب أحدث صنعه متقومة فصير حق المالك هالكا من وجه، ألا ترى أنه تبدل الاسم وفات معظم للقاصد وحقه في الصنعة قائم من كل وجه، فيترجح على الأصل الذي هو فائت من وجه، ولا نجعله سببا للملك من حيث إنه محظور، بل من حيث إنه إحداث الصنعة، فما هو متعلق هذا الحديث لم نثبته، وما أثبتناه لم يتعلق به هذا الحديث، التقطته من نيل الأوطار» و «الهداية».
وَعَنْ أَنَسٍ(رضي الله عنه) قَالَ: كَانَ النَّبِيُّ ﷺ عِنْدَ بَعْضِ نِسَائِهِ فَأَرْسَلَتْ إِحْدَى أُمَّهَاتِ الْمُؤْمِنِينَ مَعَ خَادِمٍ بِصَحْفَةٍ فِيهَا طَعَامٌ فَضَرَبَتْ۱ الَّتِي النَّبِيُّ ﷺ فِي بَيْتِهَا يَدَ الْخَادِمِ، فَسَقَطَتْ الصَّحْفَةُ فَانْفَلَقَتْ، فَجَمَعَ النَّبِيُّ ﷺ فَلَقَ الصَّحْفَةِ، ثُمَّ جَعَلَ يَجْمَعُ فِيهَا الطَّعَامَ الَّذِي كَانَ فِي الصَّحْفَةِ، وَيَقُولُ: «غَارَتْ أُمُّكُمْ»، ثُمَّ حَبَسَ الْخَادِمَ حَتَّى أُتِيَ بِصَحْفَةٍ مِنْ عِنْدِ الَّتِي هُوَ فِي بَيْتِهَا، فَدَفَعَ۲ الصَّحْفَةَ الصَّحِيحَةَ إِلَى الَّتِي كُسِرَتْ صَحْفَتُهَا وَأَمْسَكَ الْمَكْسُورَةَ فِي بَيْتِ الَّتِي كَسَرَتْ رَوَاهُ الْبُخَارِيُّ.
Anas narrated: The Prophet (ﷺ) was with one of his wives when another Mother of the Believers sent a servant with a plate of food. The wife in whose house the Prophet was struck the servant’s hand, causing the plate to fall and break. The Prophet (ﷺ) gathered the pieces, collected the food, and said, “Your mother was jealous.” He detained the servant until a plate was brought from the house of the wife who broke it. He gave the intact plate to the one whose plate was broken and kept the broken one in the house of the breaker. [Narrated by Bukhari].

1 “Struck the servant’s hand…”: At-Turbishti said this hadith does not relate to usurpation or borrowing but to guaranteeing damaged items. Al-Qadi said its relevance is that the striker was charged with replacing the plate, as it broke due to her unjust act. Destroying another’s property directly or indirectly through aggression is a form of usurpation. [From Al-Marqah].
2 “Gave the intact plate…”: Abu Hanifah’s view is that for items with a like, the equivalent is due; for valued items, their value is due. If asked why a plate, a valued item, was replaced with another plate, it was out of courtesy, not obligation, as both plates belonged to the Prophet (ﷺ). Alternatively, it was by mutual agreement, or plates were similar then, like counted similar items, allowing substitution. [From Al-Marqah]. At-Tahawi in Mushkil said vessels are valued, not like items, so how was one replaced? Some vessels are like items, especially today, as are some clothes. It may be a settlement, not a ruling. Hanafi doctrine in Al-Hidayah states that for usurped items with a like (e.g., measured or weighed), the equivalent is due; for items without a like, their value on the day of usurpation is due. Counted similar items, like walnuts or eggs, are like measured items, requiring their equivalent. Most scholars say this hadith contradicts Hanafis, as vessels are not like items, so they interpret it as formal compensation or both vessels being the Prophet’s. ۱ قوله: فضربت التي النبي الله في بيتها يد الخادم إلخ : قال التوربشتي : هذا الحديث لا تعلق له بالغصب ولا بالعارية، وإنما كان من حقه أن يورد في باب ضمان المتلفات، قال القاضي: وجه إيراد هذا الحديث في هذا الباب أنه غرم الضاربة ببدل الصحفة؛ لأنها انكسرت بسبب ضربها يد الخادم عدوانًا، ومن أنواع الغصب إتلاف مال الغير مباشرة أو بسبب على وجه العدوان. كذا في «المرقاة».
۲ قوله: فدفع الصحفة الصحيحة إلخ : مذهب أبي حنيفة أن كل ما كان مثليا إذا استهلكه شخص يجب عليه مثله، وإن كان من ذوات القيم يجب عليه قيمته، فإن قيل : الصحفة مضمونة بالقيمة، وليست من ذوات الأمثال، فما وجه دفعه صحفة مكانها ؟ أجيب بأنه فعل ذلك على سبيل المروءة لا على طريق الضمان؛ لأن الصحفتين كانتا الرسول الله ، وقيل : فعل ذلك بتراضيهما فلم يبق يدعي القيمة ، وقيل : كانت الصحفات متقاربة في ذلك الوقت، وكانت كالعدديات المتقاربة، فجاز أن يدفع إحداهما بدل الأخرى. كذا في المرقاة مع زيادة، ولذلك قال الطحاوي في المشكل»: إن الإناء من ذوات القيم لا من المثليات، فكيف يكون الإناء بإناء؟ أقول: إن بعض الأواني يكون مثليا، بل في زماننا أكثر الأواني مثلية، وكذلك بعض الثياب، كما نقل في «الهداية» عن العتابي:أن الكرباس مثلي، ويمكن أن يقال: إنه ليس بفصل الأمر على الضوابط، بل هو صلح لا قضاء. كذا في العرف الشذي». وقال في هامش الكوكب الدري مسلك الحنفية في ذلك ما في الفروع من الهداية» وغيره: من غصب شيئا له مثل كالمكيل والموزون، فهلك في يده، فعليه مثله، وما لا مثل له فعليه قيمته يوم غصبه، معناه العدديات المتفاوتة، أما العددي المتقارب، كالجوز والبيض، فهو كالمكيل حتى يجب مثله، ثم بعد ذلك اختلفوا في الحديث فعامتهم على أنه يخالف الحنفية؛ لأن الإناء عندهم ليس بمثلي، ولذا أولوا الحديث بأن الضمان كان صوريا والإناءان كانا في ملكه ، وقال بعضهم: إن الحديث حجة للحنفية كما قاله ابن التين وغيره، وإليه ميل الشيخ، وهو الأوجه، والمدار على كون الإناء مثليا أو قيميًا، وكلاهما يحتملان، فإن الأواني قد يتماثل بعضهم بحيث لا تتمايز فيما بينهما وقد تتفاوت، وعليه مدار الاختلاف.
وَعَنْ عَبْدِ اللهِ بْنِ يَزِيدَ (رضي الله عنه) عَنِ النَّبِيِّ ﷺ أَنَّهُ نَهَى عَنِ النُّهْبَةِ۱ وَالْمُثْلَةِ. رَوَاهُ الْبُخَارِيُّ.
وَرَوَى ابْنُ أَبِي شَيْبَةَ عَنِ الْحَسَنِ أَنَّهُ كَانَ لَا يَرَى بَأْسًا بِالنَّهْبِ فِي الْعَرْسَاتِ وَالْوَلَائِمِ، وَكَذَلِكَ الشَّعْبِيُّ.
وَهَذَا قَوْلِ أَبِي حَنِيفَةَ وَأَبِي يُوْسُفَ وَمُحَمَّدِ بْنِ الْحَسَنِ رَحْمَةُ اللَّهِ عَلَيْهِمْ. قَالَ الطَّحَاوِيُّ: وَقَدْ وَجَدْنَا مِثْلَ ذَلِكَ قَدْ أَبَاحَهُ رَسُوْلُ اللَّهِ ﷺ.
وَرَوَى عَنْ عَبْدِ اللَّهِ بْنِ قُرَطٍ قَالَ: قَالَ رَسُولُ اللهِ ﷺ: «أَحَبُّ الْأَيَّامِ إِلَى اللَّهِ يَوْمُ النَّحْرِ ثُمَّ يَوْمُ عَرَفَةَ فَقُرِبَتْ إِلَى رَسُوْلِ اللهِ البُدْنَاتٍ خَمْسًا أَوْ سِرًّا فَطَفِقْنَ يَزْدَلِفْنَ إِلَيْهِ، بِأَيَّتِهِنَّ يَبْدَأُ، فَلَمَّا وَجَبَتْ جُنُوبُهَا قَالَ كَلِمَةً خَفِيفَةٌ لَمْ أَفْهَمْهَا، فَقُلْتُ لِلَّذِي كَانَ إِلَى جَنْبِي مَا قَالَ رَسُوْلُ اللَّهِ ؟ فَقَالَ: قَالَ: «مَنْ شَاءَ اقْتَطَعَ».
فَلَمَّا قَالَ رَسُوْلُ اللهِ ﷺ فِي هَذَا الْحَدِيثِ: «مَنْ شَاءَ اقْتَطَعَ ذَلِكَ دَلَّ هَذَا أَنَّ مَا أَبَاحَهُ رَبُّهِ لِلنَّاسِ مِنْ طَعَامٍ أَوْ غَيْرِهِ فَلَهُمْ أَنْ يَأْخُذُوا مِنْ ذَلِكَ، وَهَذَا خِلَافُ النُّهْبَةِ الَّتِي نُهِيَ عَنْهَا فِي الْأَثَرِ الْأَوَّلِ، فَثَبَتَ بِمَا ذَكَرْنَا أَنَّ النُّهْبَةَ الَّتِي فِي الْأَثَرِ الْأَوَّلِ هِيَ نُّهْبَةُ مَا لَمْ يُؤْذَنْ فِيْهِ، وَإِنَّ مَا أُبِ مَا أُبِيْحَ مِنْ ذَلِكَ وَأُذِنَ أذِنَ فِيْهِ فَعَلَى مَا فِي هَذَا الا الأثر الثاني.
Abdullah ibn Yazid narrated that the Prophet (ﷺ) forbade robbery and mutilation. [Narrated by Bukhari]. Ibn Abi Shaybah narrated from Al-Hasan that he saw no harm in robbery at weddings or feasts, as did Ash-Sha‘bi. This is the view of Abu Hanifah, Abu Yusuf, and Muhammad ibn Al-Hasan. At-Tahawi said: We found the Messenger of Allah (ﷺ) permitted this. Abdullah ibn Qurt narrated that the Prophet (ﷺ) said: “The most beloved days to Allah are the Day of Sacrifice and the Day of Arafah.” Camels were brought to him, five or six, vying for which to start with. When they fell, he said something lightly I did not understand. I asked the person beside me, who said, “He said, ‘Whoever wishes, let him take.’” This shows that what Allah permits people to take, they may take, unlike the forbidden robbery in the first narration, which is taking without permission. 1 Ibn Battal said prohibited robbery refers to Arab raids, as in the pledge of Ubadah. Ibn Al-Mundhir said it is taking someone’s property without permission, against their will. The prohibition may apply to a group taking from spoils without division. Scholars differ on scattering items for children or at weddings. Malik and Ash-Shafi‘i disliked it; Hanafis permitted it. ۱قوله: النهبة قال ابن بطال الانتهاب المحرم هو ما كانت العرب عليه من الغارات، وعليه وقعت البيعة في حديث عبادة، وقال ابن المنذر النهبة المحرمة أن ينهب مال الرجل بغير إذنه، وهو له كاره، انتهى. وقد يؤول النهي في هذا الحديث على الجماعة ينتهبون من الغنيمة، ولا يدخلونها في القسمة، واختلف العلماء فيما ينثر على رؤوس الصبيان وفي الأعراس، فيكون فيه النهبة، فكرهه مالك والشافعي، وأجازه الحنفية، «عمدة القاري» و«المرقاة» ملتقط منهما .
وَعَنْ عِمْرَانَ بْنِ حُصَيْنٍ (رضي الله عنه) عَنِ النَّبِيِّ ﷺ أَنَّهُ قَالَ: «لَا جَلَبَ۱ وَلَا جَنَبَ وَلَا شِغَارَ فِي الْإِسْلَامِ، وَمَنْ انْتَهَبَ۲ نُهْبَةً فَلَيْسَ مِنَّا». رَوَاهُ التَّرْمِذِيُّ.
Imran ibn Husayn narrated that the Prophet (ﷺ) said: “No jalab, janab, or shighar in Islam. Whoever robs is not of us.” [Narrated by At-Tirmidhi].

1 “No jalab…”: Al-Qadi said jalab in racing is having someone follow and urge the horse; janab is keeping an unridden horse alongside to switch to if the ridden one tires. Jalab and janab in zakat were explained in the zakat chapter. Shighar is marrying one’s sister to another in exchange for his sister without dowry, derived from a deserted town, as the contract lacks dowry. The hadith indicates this contract’s invalidity, as it would otherwise exist in Islam, per most scholars. The invalidity stems from sharing intimacy as dowry. Abu Hanifah and Ath-Thawri say the contract is valid with dowry of the like. Ibn Al-Humam said the negation targets shighar’s essence, i.e., no dowry and intimacy as dowry. We negate this essence, invalidating such a marriage, but allow a marriage with an invalid dowry, requiring dowry of the like, as with a marriage naming wine as dowry. [From Al-Marqah]. ۱ قوله : لا جلب إلخ : قال القاضي: الجلب في السباق أن يتبع فرسه رجلًا يجلب عليه ويزجره، والجنب أن يجنب إلى فرسه فرسا عريانا، فإذا افتر المركوب تحوّل إليه، والجلب والجنب في الصدقة قد مر تفسيرهما في كتاب الزكاة والشغار أن تشاغر الرجل، وهو أن تزوجه أختك على أن يزوجك أخته ولا مهر إلا هذا من شغر البلد إذا خلا من الناس؛ لأنه عقد خال عن المهر، والحديث يدلُّ على فساد هذا العقد؛ لأنه لو صح لكان في الإسلام، وهو قول أكثر أهل العلم، والمقتضى إفساده الاشتراك في البضع بجعله صداقا، وقال أبو حنيفة الله والثوري: يصح العقد ولكل منهما مهر المثل.
قال ابن الهمام: اعلم أن متعلّق النفي مسمى الشغار، ومأخوذ من مفهومه خلو الصداق وكون البضع صداقا، ونحن قائلون بنفي هذه الماهية وما يصدق عليه شرعًا، فلا يثبت النكاح كذلك، بل نبطله، فنبقي نكاحا سمى فيه مالا يصلح مهرا، فينعقد موجبا لمهر المثل كالنكاح المسمى فيه خمر، فما هو متعلّق النفي لم نثبته، وما أثبتناه لم يتعلق به النفي. قاله في المرقاة». وقال في التعليق الممجد قال عياض: لا خلاف في النهي عن الشغار ابتداء، فإن وقع أمضاه الكوفيون والليث والزهري وعطاء بصداق المثل، وأبطله مالك والشافعي. كذا في شرح الزرقاني»، وفي شرحالقاري»: لا يفسد النكاح ويفسد الشرط عند أبي حنيفة والشافعي وعن مالك وأحمد روايتان.

وَعَنْ سَمُرَةَ (رضي الله عنه) عَنِ النَّبِيَّ ﷺ قَالَ: «مَنْ۱ وَجَدَ عَيْنَ مَالِهِ عِنْدَ رَجُلٍ قَدْ أَفْلَسَ فَهُوَ أَحَقُّ بِهِ، وَيَتَّبِعُ الْبَيِّعُ مَنْ بَاعَهُ». رَوَاهُ أَحْمَدُ وَأَبُوْ دَاوُدَ وَالنَّسَائِيُّ.
وَرَوَى الطَّبَرَانِيُّ عَنْهُ أَنَّ النَّبِيَّ ﷺ قَالَ: «مَنْ سُرِقَ لَهُ مَتَاعٌ أَوْ ضَاعَ لَهُ مَتَاعٌ، فَوَجَدَهُ فِي يَدِ رَجُلٍ يَبِيعُهُ فَهُوَ أَحَقُّ بِهِ، وَيَرْجِعُ الْمُشْتَرِي عَلَى الْبَائِعِ بِالثَّمَنِ».
Samurah narrated that the Prophet (ﷺ) said: “Whoever finds his exact property with a bankrupt person is most entitled to it, and the buyer follows the seller.” [Narrated by Ahmad, Abu Dawud, and An-Nasa’i]. At-Tabarani narrated from him that the Prophet (ﷺ) said: “Whoever has goods stolen or lost and finds them with someone selling them is most entitled to them, and the buyer seeks the price from the seller.”

If the owner is present and driving it, he guarantees all damage. If leading or riding, he guarantees damage by mouth or hand, not leg, unless he intentionally causes damage, then he guarantees due to transgression. Ash-Shafi‘i says daytime damage by livestock, if the owner is absent, incurs no guarantee, per Ibn Muhayyisa’s hadith. If the owner is present, he guarantees all damage, whether riding, driving, leading, or standing, by hand, leg, or mouth. ۱قوله: العجماء جبار احتج به أبو حنفة الله على أن ما أفسدت الماشية من مال الغير إن لم يكن معها مالكها فلا ضمان عليه، ليلا كان أو نهارا، وما كان معها مالكها، فإن كان يسوقها فعليه ضمان ما أتلفت بكل حال، وإن كان قائدها أو راكبها فعليه ضمان ما أتلفت بفمها أو يدها، ولا يجب ضمان ما أتلفت برجلها إلا أن يحملها الذي معها على الإتلاف أو يقصده، فحينئذ يضمن لوجود التعدي منه، وقال الشافعي: إن ما أفسدت الماشية بالنهار من مال الغير فلا ضمان على ربها؛ لحديث ابن محيصة، هذا إذا لم يكن معها مالكها، وإن كان معها فعليه ضمان ما أتلفته، سواء كان راكبها أو سائقها أو قائدها أو كانت واقفة عنده، سواء أتلفت بيدها أو رجلها أو فمها، وأجاب أصحاب أبي حنيفة بأن «العجماء جبار» مطلق عام، فوجب العمل بعمومه.

۲ قوله: النار جبار : يعني ما أحرقته النار التي يوقدها الرجل في ملكه فيطير بها الريح إلى ملك غيره من حيث لا يمكنه ردُّها فهو هدر، وهذا إذا أوقد في وقت سكون الريح، ثم هبت الريح، كذا في «اللمعات».
وَعَنْ قُبَيْصَةَ الْبَجلِي قَالَ: انْكَسَفَتِ الشَّمْسُ عَلَى عَهْدِ رَسُولِ اللَّهِ ﷺ فَصَلَّى۱ كَمَا تُصَلُّوْنَ. رَوَاهُ الطَّحَاوِيُّ.
وَفِي رِوَايَةٍ لِمُسْلِمٍ: وَقَالَ: مَا مِنْ شَيْءٍ تُوعَدُوْنَهُ إِلَّا قَدْ رَأَيْتُهُ فِي صَلَاتِي هَذِهِ، لَقَدْ جِيءَ بِالنَّارِ، وَذَلِكَ حِينَ رَأَيْتُمُونِي تَأَخَّرْتُ مَخَافَةَ أَنْ يُصِيبَنِي مِنْ لَفْحِهَا، وَحَتَّى رَأَيْتُ فِيهَا صَاحِبَ الْمِحْجَنِ يَجُرُّ قُصْبَهُ فِي النَّارِ، كَانَ يَسْرِقُ الْحَاجَ بِمِحْجَنِهِ، فَإِنْ فُطِنَ لَهُ قَالَ: إِنَّمَا تَعَلَّقَ بِمِحْجَنِي، وَإِنْ غُفِلَ عَنْهُ ذَهَبَ بِهِ، وَحَتَّى رَأَيْتُ فِيهَا صَاحِبَةَ الْهِرَّةِ الَّتِي رَبَطَتْهَا فَلَمْ تُطْعِمْهَا، وَلَمْ تَدَعْهَا تَأْكُلُ مِنْ خَشَاشِ الْأَرْضِ حَتَّى مَاتَتْ جُوعًا، ثُمَّ جِيءَ بِالْجَنَّةِ، وَذَلِكَ حِينَ رَأَيْتُمُونِي تَقَدَّمْتُ حَتَّى قُمْتُ فِي مَقَامِي، وَلَقَدْ مَدَدْتُ يَدِي وَأَنَا أُرِيدُ أَنْ أَتَنَاوَلَ مِنْ ثَمَرِهَا لِتَنْظُرُوا إِلَيْهِ، ثُمَّ بَدَا لِي أَنْ لَا أَفْعَلَ».
Qubaysah Al-Bajali narrated: The sun eclipsed during the Messenger of Allah’s (ﷺ) time, and he prayed as you pray. [Narrated by At-Tahawi]. Muslim’s narration adds: “Everything promised to you, I saw in this prayer. Hellfire was brought, when you saw me retreat, fearing its heat. I saw in it the man with the hooked stick dragging his intestines in the fire, who stole pilgrims’ belongings with his stick, saying, ‘It caught on my stick,’ if noticed, or taking it if unnoticed. I saw the woman who tied her cat, neither feeding it nor letting it eat from the ground’s creatures, until it died of hunger. Then Paradise was brought, when you saw me advance to my place. I stretched my hand to take its fruit for you to see, then decided not to.” [From Al-Marqah].

وَعَنِ السَّائِبِ بْنِ يَزِيدُ عَنْ أَبِيْهِ عَنِ النَّبِيِّ ﷺ قَالَ: «لَا يَأْخُذْ أَحَدُكُمْ عَصَا أَخِيهِ لَاعِبًا أَوْ جَادًّا۱، فَمَنْ أَخَذَ عَصَا أَخِيهِ فَلْيَرُدَّهَا إِلَيْهِ». رَوَاهُ التَّرْمِذِيُّ وَأَبُوْ دَاوُدَ رِوَايَتَهُ إِلَى قَوْلِهِ: «جَادًّا».
As-Sa’ib ibn Yazid narrated from his father that the Prophet (ﷺ) said: “Let none of you take his brother’s stick, whether in jest or earnest. Whoever takes it, let him return it.” [Narrated by At-Tirmidhi and Abu Dawud, up to “earnest”].

2 “In jest or earnest” means jest outwardly but earnest inwardly, i.e., taking playfully with intent to keep. The stick is an example of a trivial item, indicating that more valuable items are even more prohibited. [From Al-Marqah]. Nail Al-Awtar says this prohibits taking someone’s property in jest or mockery. [From Nail Al-Awtar].
۱ قوله : لاعبا أو جادا: أي لاعبا ظاهرا جادًا باطنا أي يأخذ على سبيل الملاعبة، وقصده في ذلك إمساكه لنفسه؛ لئلا يلزم اللعب والجد في زمن واحد. وإنما ضرب المثل بالعصا؛ لأنه من الأشياء التافهة التي لا يكون لها كبير خطر عند صاحبها؛ ليعلم أن ما كان فوقه فهو بهذا المعنى وأحق أجدر. قاله في المرقاة». وقال في نيل الأوطار»، فيه دليل على عدم جواز أخذ متاع الإنسان على جهة المزاح والهزل.
وَعَنْ سَمُرَةَ (رضي الله عنه) عَنِ النَّبِيِّ ﷺ قَالَ: «عَلَى الْيَدِ۱ مَا أَخَذَتْ حَتَّى تُؤَدِّيَ». رَوَاهُ التَّرْمِذِيُّ وَأَبُوْ دَاوُدَ وَابْنُ مَاجَه.
وَرَوَى الدَّارَقُطْنِيُّ وَالْبَيْهَقِيُّ فِي سُنَنَيْهِمَا عَنْ عَمْرِو بْنِ شُعَيْبٍ عَنْ أَبِيْهِ عَنْ جَدِّهِ عَنِ النَّبِيِّ ﷺ لَيْسَ وَلَا عَلَى الْمُسْتَوْدَعِ غَيْرِ الْمُغِلَّ ضَمَانٌ، وَلَا عَلَى الْمُسْتَعِيْرِ غَيْرِ الْمُغِلِّ ضَمَانٌ».
وَرَوَى ابْنُ مَاجَه فِي سُنَنِهِ عَنْهُ عَنِ النَّبِيِّ ﷺ قَالَ: «مَنْ أُوْدِعَ وَدِيعَةً فَلَا ضَمَانَ عَلَيْهِ». وَرَوَى عَبْدُ الرَّزَّاقِ فِي مُصَنَّفِهِ عَنْ عُمَرَ بْنِ الْخَطَابِ قَالَ: الْعَارِيَةُ بِمَنْزِلَةِ الْوَدِيْعَةِ لَا ضَمَانَ فِيْهَا إِلَّا أَنْ يَتَعَدَّى، وَرَوَى ابْنُ أَبِي شَيْبَةَ وَعَبْدُ الرَّزَّاقِ عَنْ عَلَيَّ الله : لَيْسَ عَلَى صَاحِبِ الْعَارِيَةِ ضَمَانٌ.
Samurah narrated that the Prophet (ﷺ) said: “The hand is responsible for what it takes until it returns.” [Narrated by At-Tirmidhi, Abu Dawud, and Ibn Majah]. Ad-Daraqutni and Al-Bayhaqi narrated from Amr ibn Shu‘ayb from his father from his grandfather that the Prophet (ﷺ) said: “There is no guarantee on the borrower or trustee unless they transgress.” Ibn Majah narrated from him that the Prophet (ﷺ) said: “Whoever is entrusted with a deposit has no guarantee.” Abdur-Razzaq narrated from Umar ibn Al-Khattab: “Borrowed items are like deposits; there is no guarantee unless transgressed.” Ibn Abi Shaybah and Abdur-Razzaq narrated from Ali: “The borrower incurs no guarantee.”

1 Scholars differ on borrowing. Hanafis say it is a trust; if it perishes without transgression, there is no guarantee, per Ali, Ibn Mas‘ud, Al-Hasan, An-Nakha‘i, Ash-Sha‘bi, Ath-Thawri, Umar ibn Abdul-Aziz, Shurayh, Al-Awza‘i, Ibn Shubrumah, and Ibrahim. Shurayh judged thus for eighty years in Kufa. Ash-Shafi‘i and Ahmad say it is guaranteed, per Ibn Abbas, Abu Hurairah, Ata, and Ishaq, citing this hadith, Safwan ibn Umayyah’s hadith, and Abu Umamah’s. Hanafis cite the subsequent hadiths and say this hadith supports them, as “return” is obligatory without implying guarantee. If guarantee were implied, it would apply to pledges and deposits. [From Umdat Al-Qari]. Al-Hidayah says the usurper must return the item while it exists, per “The hand is responsible…” and “No one may take his brother’s property in jest or earnest; if taken, return it.” Safwan’s hadith is shaky in chain and text, per Al-Tamhid. Even if sound, “guaranteed” means guaranteed return, or a borrowing with a guarantee condition is guaranteed per Hanafis. Abu Umamah’s hadith does not indicate guarantee, as Allah says: “Indeed, Allah commands you to render trusts to whom they are due” (An-Nisa: 58). If a trust perishes, return is not required. ۱ قوله : على اليد ما أخذت إلخ : اختلف العلماء في العارية. فقال أصحابنا الحنفية العارية أمانة، إن هلكت من غير تعد لم تضمن، وهو قول علي وابن مسعود والحسن والنخعي والشعبي والثوري وعمر بن عبد العزيز وشريحوالأوزاعي وابن شبرمة وإبراهيم، وقضى شريح بذلك ثمانين سنة بالكوفة. وقال الشافعي: تضمن وبه قال أحمد، وهو قول ابن عباس وأبي هريرة وعطاء وإسحاق، واحتج الشافعي ومن معه بأحاديث منها هذا الحديث، ومنها حديث صفوان ابن أمية، ومنها حديث أبي أمامة. ولنا الأحاديث التي ذكرت بعد، وحجة هذا الحديث أيضًا ظاهر في الدلالة لمذهبنا؛ لأن الأداء فيه فرض ولا يلزم منه الضمان، ولو لزم من اللفظ الضمان للزم الخصم أن يضمن المرهون والودائع؛ لأنها مما قبضته اليد. كذا في عمدة القاري، ولذلك قال في «الهداية» وعلى الغاصب رد العين المغصوبة، معناه ما دام قائما ؛ لقوله علا على اليد ما أخذت حتى ترد ، وقال : لا يحل لأحد أن يأخذ متاع أخيه لاعبا ولا جادا، فإن أخذه فليرده عليه، انتهى.
وأما حديث صفوان بن أمية فهو مضطرب سندًا ومتنا، وجميع وجوهه لا يخلو عن نظر، ولهذا قال صاحب التمهيد»: الاضطراب فيه كثير، ولا حجة فيه عندي في تضمين العارية، انتهى ثم على تقدير صحته قوله: مضمونة» أي مضمونة الرد عليك بدليل قوله: «حتى يؤديها إليك، ويحتمل أن يريد اشتراط الضمان والعارية بشرط الضمان مضمونة في رواية للحنفية، والجواب عن حديث أبي أمامة أنه ليس فيه دلالة على التضمين؛ لأن الله تعالى قال: ﴿إِنَّ اللَّهَ يَأْمُرُكُمْ أَن تُؤَدُّوا الْأَمَانَاتِ إِلَى أَهْلِهَا﴾ (النساء: ٥٨ ، فإذا تلفت الأمانة لم يلزمه ردُّها. قاله في «عمدة القاري».
وَعَنْ قَتَادَةَ قَالَ: سَمِعْتُ أَنَسًا يَقُولُ: كَانَ فَزَعُ بِالْمَدِينَةِ، فَاسْتَعَارَ۱ النَّبِيُّ ﷺ فَرَسًا مِنْ أَبِي طَلْحَةَ يُقَالُ لَهُ: الْمَنْدُوبُ، فَرَكِبَ، فَلَمَّا رَجَعَ قَالَ: «مَا رَأَيْنَا مِنْ شَيْءٍ، وَإِنْ وَجَدْنَاهُ لَبَحْرًا». مُتَّفَقٌ عَلَيْهِ.
Qatadah narrated that Anas said: There was a panic in Medina, so the Prophet (ﷺ) borrowed a horse from Abu Talhah called Al-Mandub, rode it, and upon returning said, “We found nothing, and we found it a sea.” [Agreed upon].

2 “Borrowed a horse”: This permits borrowing, which is granting benefit without compensation, per Abu Bakr Ar-Razi. Al-Karkhi and Ash-Shafi‘i say it is permitting benefit, not ownership, so the borrower cannot lease it. The first is sounder, as the borrower may lend it, unlike mere permission. Leasing is not allowed as it is stronger than borrowing, and a thing does not entail its equal or stronger. [From Umdat Al-Qari].
۱قوله : فاستعار النبي ﷺ فرسا: وفيه جواز العارية، وهي تمليك المنفعة بلا عوض، وهو اختيار أبي بكر الرازي. وقال الكرخي والشافعي: هي إباحة المنافع لا تمليك المنعفة حتى لا يملك المستعير إجارة ما استعاره لو ملك المنافع لملك إجارتها، والأول أصح؛ لأن المستعير له أن يعير، ولو كانت إباحة لما ملك ذلك، وإنما لم يجزالإجارة؛ لأنها أقوى وألزم من العارة والشيء لا يستتبع مثله، فبالأحرى أن لا يستتبع الأقوى. كذا في عمدة القاري».
