شفعہ کی تعریف اور پروی کے لے اس کا ثبوت
ف: شفعہ اس حق کو کہتے ہیں جو پروی کو جائیداد غیر منقول میں مکان اور زمین وغیرہ کے پیچے وقت حاصل ہوتا
ہے حق شفعہ یہ کہ اس جائداد کی جو قیمت دوسراخرپیدار دے رہا ہو، ای قیمت پروی ماکب جائداد کو کراس پچیز
کو خود لے لے۔
واضح ہوگا تمام اتمکا اس بات پر اتفاق ہے کہ زمین میں کسی ماکونی شرکیے ہوتا زمین کی تقسیم نہ ہوئے تو کہ
شرکیے کے لے حق شفعہ ثابت ہے اوراس میں حکمت یہ کہ شرکیے کے نقصان نہ ہوئے تو کہ شرکیے کے لے حق
شفعہ ثابت ہے اوراس میں حکمت یہ کہ شرکیے کے نقصان کا رفعیہو جائے اورشفعہ کا ثبوت زمین سے محض ص
ہوتا کی وجہ یہ کہ عموماً نقصانات زمینات کے معاملات میں ہوتے ہیں اوراس بات پر بھی سب کا اتفاق ہے کہ
جانورول، کپڑول، اسباب اورمنقول مجا ئیداد میں حق شفعہ ثابت نہیں ہے اورجا ئیداد کی تقسیم کے بعد بھی شرکیے کے لے
نفس مستحیح ( لیکن فروخت شدہ نی جائیداد ) میں شفعہ ثابت ہے اور اس طرح شرکیے کے لے حق امیج جی پانی اور راستے
وگیرہ میں بھی شفعہ کا حق ثابت ہے البترحق شفعہ میں اختلاف ای پروی کے لے ہے جو جائیداد میں شرکیے نہ ہو
چنانچہ امام اوزاعی، امام لیث، امام ماک، امام شافعی، امام احمد، امام اسحاق، امام ابوثورال تمام حضرات کے پاس ایسے
شرکیے کے لے جائیداد میں حق شفعہ ثابت ہے جس کی تقسیم عمل میں نآئی ہواوران حضرات کے پاس پروی کے
لے کوئی حق شفعہ ثابت نہیں اس کے برخلاف حضرت ابراہیم نخی، قاضی شرتح، حضرت سفیان ثؤری، امام عمر و بن
حربیث، امام حسن بن علی اورحضرت قادہ، اورحسن بصری اورامام حماو بن سلیمان، امام ابوحنیفہ، امام ابویوسف اورامام
محمد حضرتهم اللہ سارے حضرات کا قول ہے کہ حق شفعہ اراضی، ربن اورباغات میں شرکیے کے لے ثابت ہے خواہوہ
جا ئیداد تقسیم ہوچکی ہویا نہو، اوراسی طرح حق شفعہ ای پروی کے لے بھی ثابت ہے جس کی جائیداد اس جائیداد سے
متعلق ہو اس قول کی تائید اس باب میں آنے والی احادیث سے بخوبی ہوتی ہے علامہ روابی شافعی نے فرمایا ہے کہ
ہمارے بعض اصحاب اس قول پروی بھی دیتے ہیں۔
اورعلامہ ابن عبد البر نے اپنی کتاب الاستذکار میں اس قول کو اختیار فرمایا ہے کہ پروی کے لے بھی حق شفعہ
ثابت ہے اور ابو عیینہ نے اپنی سنده جس کو حضرت سعد بن ابی وقاص رضی اللہ عنہ تک پہوچایا ہے روایت کی
بھکر حضرت عمر رضی اللہ عنہ نے قاضی شریع کولیا کہ پڑوسی کے لئے شفعہ کا فیصلہ دیا کروچناچوروہاس پر عمل کرتے اور
نہ بہت بھی اس طرح ہے۔ ماخوذ از: "بنایی، عمدة القاری اور بزل الجود"۔
پڑوسی کاحق شفعہ
پہلی حدیث
This chapter discusses the right of pre-emption (shuf‘ah).
Definition and Proof of Pre-emption:
F: Shuf‘ah refers to the right that a neighbor has to acquire immovable property such as land or buildings before others when it is offered for sale. The right of shuf‘ah means that if another person offers to buy the property at a certain price, the neighbor can take precedence and purchase the property at the same price.
It is clear that all scholars agree that if there is a shared interest in a piece of land and the land has not been divided, the right of shuf‘ah is established for the sake of the shared interest. The wisdom behind this is to prevent any loss to the shared interest. The right of shuf‘ah is specifically established in the case of land because, generally, losses occur in matters related to land. It is also agreed upon that the right of shuf‘ah does not apply to animals, clothing, furniture, or other movable property. Even after the division of the property, the right of shuf‘ah remains valid for the shared interest, but not for the sold property. Thus, the right of shuf‘ah is also established for the shared interest in roads and pathways.
However, there is a difference of opinion regarding the right of shuf‘ah for a neighbor who does not have a shared interest in the property. Imam Awza‘i, Imam Layth, Imam Malik, Imam Shafi‘i, Imam Ahmad, Imam Is-haq, Imam Abu Thawr, and all these eminent scholars hold that the right of shuf‘ah is established for a neighbor even if there is no shared interest in the property, provided that the property has not been divided. On the contrary, scholars like Imam Ibrahim Nakh‘i, Qadi Shurayh, Imam Sufyan Thawri, Imam ‘Umar ibn Hubayrah, Imam Hasan ibn ‘Ali, Imam Qatadah, Imam Hasan Basri, Imam Hammad ibn Sulayman, Imam Abu Hanifah, Imam Abu Yusuf, and Imam Muhammad (may Allah be pleased with them all) hold that the right of shuf‘ah is established in lands, fields, and gardens for the sake of the shared interest, whether the property has been divided or not, and that the right of shuf‘ah is also established for a neighbor who has a related interest in the property.
This view is well-supported by the hadiths mentioned in this chapter. Imam Rawabi Shafi‘i has stated that some of our companions also support the right of shuf‘ah for a neighbor. Furthermore, Imam Ibn al-‘Abd al-Barr has adopted this view in his book Al-Istidhkar, affirming the right of shuf‘ah for a neighbor.
It is established that Abu Aiyuna narrated through his chain, which reaches up to Saad bin Abi Waqqas (RA), the tradition that when Umar (RA) appointed a judge for the Shari’ah, he instructed him to make a ruling regarding the right of pre-emption for neighbors and to act upon it, and this is indeed how it should be done. Taken from: “Bana'i, Umda al-Qari, and Bazl al-Jud.” The first hadith pertains to the right of pre-emption for neighbors.
عمرو بن الشریر رضی اللہ عنہ اپنے والد سے روایت کرتے ہیں کہ ایک صحابی نے
عرض کیا یا رسول اللہ میری زمین میں دو کوئی شریک ہے جو حصردار بھجر پڑوسی کے کیا لیے صورت
میں پڑوسی کا کوئی حق ہے؟ (پین کر) رسول اللہ صلی اللہ علیہ وآلہ وسلم نے ارشاد فرمایا (بالا!) پڑوسی
قربت اور (تمہاری زمین سے) متصل ہونے کی وجہ سے (شفعہ کا) حق دار ہے۔ اس کی روایت
ناسائی اور ابن ماجہ نے کی ہے۔ اور بخاری نے بھی اس طرح روایت کی ہے۔
Amr ibn Ash-Sharid narrated from his father that a man said: “O Messenger of Allah, my land has no partnership or division, only neighborhood.” The Messenger of Allah (ﷺ) said: “The neighbor is most entitled to his proximity.” [Narrated by An-Nasa’i and Ibn Majah]. Bukhari narrated similarly. In Al-Bazzar and Ad-Daraqutni’s narration: A man said, “O Messenger of Allah, my land has no partnership or division, only neighborhood.” He said, “The neighbor is most entitled to the preemption of what is.” [From Al-Marqah].
(1) “The neighbor is most entitled…”: Muslims agree on preemption for a partner in undivided immovable property, to remove harm. It is limited to immovable property due to its greater harm. There is no preemption in animals, clothes, or movables. For divided property, preemption applies to the partner in the sold item or its rights, like water or paths. The dispute is over preemption for a neighbor without partnership. Al-Awza‘i, Al-Layth, Malik, Ash-Shafi‘i, Ahmad, and Abu Thawr say preemption is only for an undivided partner. An-Nakha‘i, Shurayh, Ath-Thawri, Amr ibn Harith, Al-Hasan ibn Hayy, Qatadah, Al-Hasan Al-Basri, Hammad ibn Sulayman, Abu Hanifah, Abu Yusuf, and Muhammad say preemption applies to lands, houses, and orchards for an undivided partner, then a divided partner with shared rights, then the adjacent neighbor. This chapter’s hadiths support us. Ar-Ruyani, a Shafi‘i, said some colleagues favor this, and it is preferred. Ibn Abdul-Barr in Al-Istidhkar narrates that Umar wrote to Shurayh to rule preemption for neighbors, and he did. Sufyan narrated from Ibrahim ibn Maysarah that Umar ibn Abdul-Aziz wrote: “If boundaries are set, there is no preemption.” Tawus said neighbors are most entitled. The hadiths of An-Nasa’i and Ibn Majah explicitly support neighbor preemption, refuting the interpretation of “neighbor” as partner. Bukhari’s narration from Jabir: The Prophet (ﷺ) ruled preemption in all undivided property; if boundaries and paths are set, there is no preemption. Al-Khattabi said this clearly negates preemption for non-partners, supporting Ash-Shafi‘i. Hanafis say “no preemption” means no preemption for partnership. Preemption arises from three causes: partnership in the sold item, partnership in its rights, and neighborhood. If divided and paths set, partnership-based preemption ceases, but neighbor-based preemption remains, per An-Nasa’i and Ibn Majah. “If boundaries and paths are set, no preemption” is Jabir’s statement, not the Prophet’s. Al-Kirmani said At-Taymi quoted Ash-Shafi‘i: Preemption is for partners, and Abu Hanifah says for neighbors, and this hadith opposes him. I say: This is odd, as Abu Hanifah says preemption is for partners in the sold item, then its rights, then neighbors. He acted on both hadiths, unlike others who favored one with weak interpretations. [From Al-Binayah, Umdat Al-Qari, and Badhl Al-Majhud].

کہ میری زمین میں دو کوئی شریک ہے اور حصردار بھجر پڑوسی کے پین کر حضرت اللہ علیہ وآلہ وسلم

حضرت علی رضی اللہ عنہ اور حضرت عبد اللہ رضی اللہ عنہ سے روایت ہے۔ پی
دونوں حضرات فرماتے ہیں کہ رسول اللہ صلی اللہ علیہ وآلہ وسلم نے پڑوسی کے لئے شفعہ کے حق کا
فیصلہ فرمایا۔-

اور ابو داود نے سمرہ رضی اللہ عنہ سے روایت کی ہے اور وہ حضور علیہ صلی اللہ
روایت فرما تے پن کر پڑوی جس کا گھرا زوہوا پے پڑوی کے گھر کا (شفع میں) زیادہ حق دار
ہے۔ اس طرح زمین کا پڑوی (جسی زمین کا حق دار ہے) اور تنہی اورامام احمد نے جسی اس طرح
روایت کی ہے۔

ثربید بن سویر ضی اللہ علیہ روایت سے فرما تے پن کر پڑوی اور شرکی
شفع میں زیادہ حق دار ہے جب تک کہ وہ اس چیز کو خرید لے یا پھر چھوڑ دے (لیعنی جاتیدار جس
قیمت پرفروخت کی جارہی ہواور پڑوی یا شرکی اس جاتیدار کو لینا چاہے تو اس قیمت پراس کو لینا
زیادہ حق دار ہے اگر پینے لینا چاہیں تو اورول کو فروخت کر سکتا ہے)۔
اس کی روایت نسائی، ابن ماجہ اور طاوی نے کی ہے۔
Ash-Sharid ibn Suwayd narrated that the Messenger of Allah (ﷺ) said: “The neighbor and partner are most entitled to preemption; he takes it or leaves it.” [Narrated by An-Nasa’i, Ibn Majah, and At-Tahawi].
(1) “And partner”: The conjunction indicates distinction. [From Tansiq An-Nizam].
(2) Narrated by An-Nasa’i…: As stated in Tansiq An-Nizam. [From Tansiq An-Nizam].
حضرت ثربید سے روایت سے وہ فرما تے پن کر نفس میں لیعنی فروخت شدنی
جا تیدار میں) جوشتر کی ہووہ (حق شفع میں) شفع کے مقابلے میں زیادہ حق دار ہے اور شفع (لیعنی وہ
شخص جو حق میں لیعنی پانی اور راست میں ہو) تماسائی کے مقابلے میں زیادہ حق دار ہے اور تمسا ئی (جو
جا تیدار سے متصل رہتا ہووہ) دوسروں کے مقابلے میں (جو متصل نہ ہوں) زیادہ حق دار ہے۔
اس کی روایت ابن ابی شیبہ نے کی ہے اور عبد الرزاق اور امام طاوی نے جسی اس طرح
روایت کی ہے۔
The one who is steadfast in his faith, meaning the one who is sincere, is more deserving of intercession than the one who is more eloquent in speech. And the one who is sincere, meaning the one who is pure and righteous, is more deserving of intercession than the one who is merely outwardly pious. And the one who is outwardly pious, meaning the one who remains connected to the community, is more deserving than those who are not connected.
اور طحاوی کی اکی اور روایت میں قاضی شرتح سے اس طرح مروی ہے کہ انہوں
نے کہا کہ شفعہ کی وضاحت میں ایک بمسائی کا حق شفعہ اور وسرائش کی (جاپیدار) کا حق شفعہ
پڑوی اگر غائب ہوتا سکا حق شفعہ باطل نہ ہوگا
In the explanation of intercession, if a person in need of intercession has a right to intercede and a person in need of assistance has a right to intercede, then if the former is absent, the right to intercede does not become invalid.
جابر رضی اللہ عنہ سے روایت ہے وہ فرماتے ہیں کہ رسول اللہ صلی اللہ علیہ وآلہ
وسلم نے ارشاد فرمایا کہ پڑوی اپنے شفعہ کا زیادہ حق دار ہے (شفعہ کے حق کی وجہ) اس کا انظار کیا
جاتے ہیں اگر چہ کہ وہ غائب ہو جبکہ دونوں کاراست (پانی یا مدورفت کا) ایک ہی ہو۔
اس کی روایت امام احمد، ترمذی، ابوداود، ابن ماجہ اور دارمی نے کی ہے۔
ف : اس حدیث سے ثابت ہوتا ہے کہ پڑوی معاملہ کے وقت موجود ہوتا سکا حق باقی رہتا اور اس کواس
سلسلہ میں تین چیزول کا حق ہے ایک پیکر وہ معاملہ کو کا لعدم کروا سکتا ہے۔ دوسرا اس کو گواہی کے طلب کرنے کا
بحیحق ہے اور تیسرے اس کو دعوی کرنے کا بھی حق ہے۔ پیعرف شنزی میں ذکور ہے اور عنا یہ میں کہا ہے کہ پڑوی
معاملہ کے وقت اگر غائب ہوتا سکے غائب ہونے سے اس کا حق شفعہ باطل نہ ہوگا۔
شفعہ غیر منقول رجایی ادیب ہے اور منقول میں نہیں
Jabir narrated that the Messenger of Allah (ﷺ) said: “The neighbor is most entitled to his preemption; he is waited for even if absent, if their paths are one.” [Narrated by Ahmad, At-Tirmidhi, Abu Dawud, Ibn Majah, and Ad-Darimi].
(1) “Even if absent”: The absent has preemption rights with three demands: immediate claim, witnessing, and litigation. [From Arf Ash-Shadhi]. Al-Inayah says his right persists during absence, as absence does not negate an established right.
(2) “If their paths are one”: This establishes preemption for a co-owner in the sold item’s rights, like water or paths. [From Al-Hidayah]. Those affirming preemption in divided property with shared paths cite this hadith. [From Al-Marqah].
ابن عباس رضی اللہ عنہما سے روایت ہے وہ حضور نبی کریم صلی اللہ علیہ وآلہ وسلم
سے روایت فرماتے ہیں کہ حضور صلی اللہ علیہ وآلہ وسلم نے ارشاد فرمایا کہ شرکی (یعنی ایسا شخص جو
فروخت شری جاسیدا جیسے زمین، مکان اور باغ وغیرہ میں جو غیر منقول ہو لحدار ہو) شفعہ کا حق رکتا
ہے۔ اور حق شفعہ بڑچیز (یعنی غیر منقول رجایی ادیب) میں ثابت ہے۔ اس کی روایت ترمذی نے کی ہے۔
اور ترمذی نے کہا ہے کہ یہ حدیث ابن ابی ملیکہ رحمۃ اللہ علیہ نے حضور نبی
Ibn Abbas narrated that the Prophet (ﷺ) said: “The partner is a preemptor, and preemption is in everything.” [Narrated by At-Tirmidhi]. He said it was narrated mursal from Ibn Abi Mulaykah, which is sounder. As-Sahawi narrated from Ibn Abbas: “There is no preemption in animals.” [From Al-Marqah].
(1) “The partner is a preemptor”: This indicates preemption is obligatory for the co-owner in the sold item, then in its rights. [From Sharh Ma‘ani Al-Athar].
(2) “Preemption is in everything”: This includes divisible and indivisible property, but the four Imams limit it to immovables by consensus, per Ibn Abbas’s narration. [From Al-Hidayah and At-Tahawi].
کریم صلی اللہ علیہ وآلہ وسلم سے مرسل روایت کی ہے اور یہ حدیث (اس طرح سنے کے اعتبار کے)

It is a marasil narration from Karim ﷺ, and the muhadith (RA) considered it to be more sahih (authentic) in this form.
اور امام طحاوی نے اس کی روایت ابن عباس رضی اللہ عنہما سے کی ہے انہوں نے (پیغمبر صلی اللہ علیہ و آلہ وسلم) فرمایا کہ حیوانات (اوراسی طرح کپڑے اور سازوسامان جو منقولہ جاتیادہ ہیں ان) میں شفعت نہیں۔
The Messenger of Allah ﷺ said: 'There is no intercession in animals (nor in such garments and instruments which are movable property).'
جابر رضی اللہ عنہ سے روایت ہے وہ فرماتے ہیں کہ رسول اللہ صلی اللہ علیہ و آلہ وسلم نے ارشاد فرمایا ہے کہ شفوعصرف ثیول اور باغول (اورگھرول لیجن غیر منقولہ جاتیادول) میں ہے۔ اور بالکومناسب نہیں کروہ (شرکیے) اجازت نہیں بغیر (اس جاتیادکو) فروخت کرنا آگروہ چائے توخریدیے لگاپچائے توچھوڑدےگا۔ اس کی روایت بزاردے اپنی مندی میں کی ہے۔
Jabir narrated that the Messenger of Allah (ﷺ) said: “There is no preemption except in a house or orchard, and he should not sell until consulting his partner. If he wishes, he takes; if not, he leaves.” [Narrated by Al-Bazzar]. Muslim’s narration: “If he sells without permission, he is most entitled to it.” Bukhari narrated from him: “The Prophet (ﷺ) ruled preemption in all undivided property.” [From Al-Marqah].
(1) “No preemption except in a house or orchard”: This indicates preemption is limited to immovable property like lands, houses, and orchards, not movables like goods or animals, per most scholars. [From Al-Marqah].
(2) “In all undivided property”: This establishes preemption for partners in undivided property, whether divisible or not. Ash-Shafi‘i says there is no preemption in indivisible property. This hadith’s generality opposes him. Mentioning undivided property does not negate the ruling for others. [From Al-Marqah and Ibn Al-Malik].
مسلم کی ایک روایت میں اس طرح ہے کہ اگر بالکو (جاتیاد غیر منقولکو) اطلاق دیے بغیر نہیں تووہ (لیجن شرکیے) اس (جاتیاد) کا زیادہ حق دار ہے۔
In a narration from Muslim, it is stated that if a slave (a non-transferable possession) is not specified, then the one who has more right to the (non-transferable possession) is the owner (of the slave).
اور بخاری نے حضرت جابر رضی اللہ عنہ سے روایت کی ہے انہوں نے کہا کہ بیکریم صلی اللہ علیہ وآلہ وسلم نے ہراپی (مشترکہ) جاتیاد میں جس کی تقسیم نہ ہوتی ہو (شرکیے کے لئے) شفعت کا حکم دیا ہے۔
پروسیبول کا ایک دومسرے سے رعايت رکھنا
Jabir narrated that the Messenger of Allah (ﷺ) said: “The neighbor is most entitled to his preemption; he is waited for even if absent, if their paths are one.” [Narrated by Ahmad, At-Tirmidhi, Abu Dawud, Ibn Majah, and Ad-Darimi].
(1) “Even if absent”: The absent has preemption rights with three demands: immediate claim, witnessing, and litigation. [From Arf Ash-Shadhi]. Al-Inayah says his right persists during absence, as absence does not negate an established right.
(2) “If their paths are one”: This establishes preemption for a co-owner in the sold item’s rights, like water or paths. [From Al-Hidayah]. Those affirming preemption in divided property with shared paths cite this hadith. [From Al-Marqah].
ابوہریرہ رضی اللہ عنہ سے روایت ہے وہ فرماتے ہیں کہ رسول اللہ صلی اللہ علیہ وآلہ وسلم ارشاد فرمایا ہے کہ ایک پروی اپنے دومسرے پروی کو (ضرورت پر) اس کی دیوار میں کرتی (یا کرتی) نصب کرنے سے منع نہ کرے (بشرطیہ اس سے اس کی دیوار کو نقصان کا اندیشہ نہ ہوامر مستحب ہے)۔
اس کی روایت بخاری اور مسلم نے مستقطر پر کی ہے۔
راستے کے مسائل اور اس کے احکام
Abu Hurairah narrated that the Messenger of Allah (ﷺ) said: “A neighbor must not prevent his neighbor from fixing his wood in his wall.” [Agreed upon].
(1) “Must not prevent…”: This is recommended, not obligatory. Al-Nawawi said scholars differ on whether this is recommended or obligatory. Ash-Shafi‘i has two views, Malik’s companions favor recommendation, as do Hanafis. The second view, obligation, is held by Ahmad and hadith scholars. [From Al-Marqah].
ابو ہریرہ رضی اللہ عنہ سے روایت ہے وہ فرماتے ہیں کہ رسول اللہ صلی اللہ علیہ وآلہ وسلم کو سنا ہے آپ نے ارشاد فرمایا ہے کہ (کسی ایسی زمین پر) راستے کے بارے میں تمہارا اختلاف ہو جائے (جس پر لوگوں کی آمد و رفت ہوتی اور ما لبث زمین اس پر عمارت بنانا چاہتا ہے تو) سات باٹھ چوڑائی (بطور راستے کے) چھوڑ دی جائے۔
اس کی روایت مسلم نے کی ہے۔
ف: واضح ہو کہ اس حدیث شریف میں سات باٹھ راستے چھوڑنے کے بارے میں جوارشاد ہے وہ اس صورت میں ہے کہ جب کہ جدید راستے قائم کیا جارہا ہوا اور اگر راستے قدیم ہو تو وہ اپنی حالت پر قائم رہے گا اگر چیکہ اس کی چوڑائی سات باٹھ سے زیادہ ہواور زاگند حصر پرکی کو تصرف کا حق حاصل نہ ہو گا۔ پیغی واضح ہو کہ سات باٹھ راستے چھوڑنے کا حد ثری نہیں ہے بلکہ موقع، محل، شہر، محل اور حالات کے ناظر سے راستے کا اعتبار ہو گا چنانچہ اسیا کو چھ کہ صرف محل کے لئے اس میں آنے والے جواب ہون تو اس کی اپنی چوڑائی چاہیے جس میں محل والوں کو حرج نہ ہواور سقم، جمال، زمانی سواری اور جنازہ جانے کوئی نہ ہو یہ ضرور مشکل الآثار، مرقات، اشعة اللمعات، لمعات اور عرف شنزی سے ماخوذ ہے۔
بغیر ضرورت غیر متقولہ جانیا دینے کی وعید
Abu Hurairah narrated that the Messenger of Allah (ﷺ) said: “If you dispute over a path, make its width seven cubits.” [Narrated by Muslim].
(1) “Seven cubits”: Hanafis say a path’s length and width are like a door’s. “Length” means height, prohibiting building above the height limit. This hadith does not oppose us. At-Tahawi in Mushkil Al-Athar says it applies to new paths; old paths remain as is, per Bukhari. If a path exists among people’s land and they wish to build, they agree on its size; if disputed, it is seven cubits. If an existing path exceeds seven cubits, no one may encroach. Ath-Thawab Al-Hali says seven cubits is not a fixed limit but based on need. [From Arf Ash-Shadhi and Al-Luma‘at].
سعید بن زریث رضی اللہ عنہ سے روایت ہے وہ فرماتے ہیں کہ میں رسول اللہ صلی اللہ علیہ وآلہ وسلم کو سنا ہے آپ نے ارشاد فرمایا ہے کہ تم میں سے جس کسی نے گھریا زمین (بغیر ضرورت) فروخت کی تو وہ اس بات کا سزاوار ہے کہ اس (زمین یا گھریا پیچے سے جورتم حاصل ہو) اس میں اس کو برکت نہ دی جائے کی مگر پیکر وہ اس (رقم کو) اس رقم کے کام (یعنی گھریا زمین خریدنے) میں لاگے۔ اس کی روایت ابن ماجہ اور داری نے کی ہے۔
ف: اس حديث شريف سے معلوم ہوتا ہے کہ زمین یا مکان کو بلا ضرورت فروخت کرنے حاصل شدہ رقم کو
منقولہ جاتیرادی خریدی میں صرف کرنا غیر مستحب ہے اس لئے کہ غیر منقولہ جاتیراد کے فائدے منقولہ ساز وسائے کے
مقابلہ میں زیادہ ہوتے ہیں اور ان پرآفتین بھی کم آتی ہیں کہ وہ چوری اور ذاکرے محفوظ رہتے ہیں اس لئے مناسب
پیہ کہ غیر منقولہ جاتیراد کون پیچا جائے اور اگر فروخت کرنا ضروری ہو تو حاصل شدہ رقم کوزمین یاگرکی خریدی میں لگایا
جائے۔ مرقہات اوراشعة اللمعات۔
ساپیدارورخت کا طنکی وعیبد
Sa‘id ibn Hurayth narrated that he heard the Messenger of Allah (ﷺ) say: “Whoever sells a house or land deserves no blessing unless he invests it in its like.” [Narrated by Ibn Majah and Ad-Darimi].
(1) “Deserves no blessing…”: Selling lands or houses and spending their price on movables is disliked, as immovables have many benefits, little risk, and are not easily stolen or raided, unlike movables. It is better not to sell, but if sold, the price should be reinvested in land or houses. [From Al-Marqah].
عبداللہ بن حمیش رضی اللہ عنہ سے روایت ہے وہ فرماتے ہیں کہ رسول اللہ صلی اللہ علیہ وآلہ وسلم نے ارشاد فرمایا ہے کہ جو شخص پیری کے درخت کو کاٹو اللہ تعالیٰ سرکے بل اس کو دوزخ میں ذالیس گے۔ اس کی روایت ابوداود نے کی ہے اور ابوداود نے کہا ہے کہ حدیث مختصر ہے (جس کی تفصیل اس طرح ہے لیکن) جو شخص جنگل میں کسی پیری کے ایسے درخت کو ناقظ ظلم اور زیادتی سے کاٹے جس کے ساپی میں مسافراورجانور پناہ لیتے ہوتے اللہ تعالیٰ اس کو (اس ظلم وزیادتی کی سزا میں) سرکے بل دوزخ میں ذالیس گے۔
ف: حدیث شریف میں پیری کے درخت کا ذکر اس لئے ہے کہ پیری کا ساپ اور درخت کے مقابلا زیادہ ہوتا ہے ورنہ ہر ساپیدار درخت کا بھی حکم ہوگا کہ ہر ایسا ساپیدار درخت جس کے ساپی میں انسان اور جانور فائدہ اٹھاتے ہوتے اس کونکا نا جائے مرقہات۔
Abdullah ibn Hubaysh narrated that the Messenger of Allah (ﷺ) said: “Whoever cuts a sidr tree, Allah will plunge his head into the Fire.” [Narrated by Abu Dawud]. He said this hadith is abbreviated, meaning whoever cuts a sidr tree in a desert where travelers and animals seek its shade, unjustly without right, Allah will plunge his head into the Fire. [From Al-Marqah].
(2) “Cuts a sidr tree…”: The sidr’s shade is cooler, but the ruling applies to any tree providing shade for people or animals. The hadith is shaky, as its narrator Urwah cut sidr for doors, and scholars agree cutting it is permissible. [From Al-Marqah and Al-Luma‘at].
