بَابُ الْفَيْءِAl-Fay’ (Spoils Taken Without Fighting)

١ قوله: الفيء: اعلم أن بيوت مال المسلمين أربعة لكل خزانة، ومصرف الأول: مال الفيء، أي الخراج والجزيةوالمأخوذ من التغلبي وهدية أهل الحرب للإمام، والذي أخذنا من أهل الحرب بلا قتال ومن جملة هذا النوع ما يأخذهالعاشر من أهل الحرب وأهل الذمة إذا مروا عليه، ومال أهل نجران وما صولح عليه أهل الحرب على ترك القتال، قيل:نزول العسكر بساحتهم لا خمس في ذلك عندنا، كل ذلك يصرف إلى مصالح المسلمين مثل سد الثغور - أي تخصينهابالرجال - والعدة والذخيرة وبناء القناطر والجسور وأرزاق القضاة والعمال الذين يأخذون الصدقات، والرقباء علىالسواحل، ومثل أرزاق العلماء - أي أصحاب التفسير والفقه والحديث ولعلوم الشرعية - ومثل المقاتلة ومثل نفقةذراري هؤلاء؛ لأن نفقة الذرية على الآباء، فلو لم يعطوا كفايتهم لاحتاجوا إلى الاكتساب.

وإنما قيد بقوله:(بلا قتال)؛ لأن المأخوذ منهم بالقتال يخمس، ثم يقسم بين الغانمين، وأفاد بقوله: (كسدالثغور) بكاف التمثيل أنه يصرف أيضًا هذا النوع لنحو الكراع والسلاح وعمارة المساجد والرباطات والعُدة للعدووحفر أنهار العامة وترميمها والصرف على إقامة شعائر المساجد من وظائف الإمامة والأذان ونحوهما.

والثاني من أنواع بيت المال الزكاة والعشر، ومصرفهما ما ذكر في كتاب الزكاة ممن يجوز صرف الزكاة إليه.والثالث: خمس الغنائم والمعادن والركاز، ومصرفه ما ذكره اللّٰه تعالى في قوله: (فَأَنَّ لِلهِ خُمُسَهُ ) (الأنفال: ٤١)الآية. وقد ذكر في كتاب السير. والرابع: اللقطات والتركات التي لا وارث لها، ودية مقتول لا ولي له، ومصرفهااللقيط الفقير، والفقراء الذين لا أولياء لهم، يعطون منها نفقاتهم وأدويتهم، ويكفن منها موتاهم، ويعقل منهاجناياتهم، وعلى الإمام أن يجعل لكل نوع من هذه الأنواع بيتًا يخصه، ولا يخلط بعضه ببعض، فإن لم يكن في بعضهاشيء فله أن يستقرض عليه من النوع الآخر، ويصرفه إلى أهل ذلك، ثم إذا حصل من ذلك النوع شيء يرده فيالمستقرض منه، إلا أن يكون المصروف من الصدقات أو خمس الغنيمة على أهل الخراج وهم فقراء؛ فإنه لا يرد فيهشيئًا؛ لأنهم مستحقون للصدقات، وكذا في غيره إذا صرفه إلى مستحقه، ويجب على الإمام أن يتقي اللّٰه تعالى، ويصرفإلى كل مستحق قدر حاجته من غير زيادة، فإن قصر في شيء من ذلك كان اللّٰه عليه حسيبا، هذا حاصل ما في شروح(الكنز).

وَقَوْلِ اللهِ عَزَّ وَجَلَّ: (وَمَا أَفَاءَ اللهُ عَلَى رَسُولِهِ، مِنْهُمْ فَمَآ أَوْجَفْتُمْعَلَيْهِ مِنْ خَيْلِ وَلَا رِكَابٍ وَلَكِنَّ اللهَ يُسَلِّطُ رُسُلَهُ و عَلَى مَنيَشَآءُ وَاللهُ عَلَىٰ كُلِّ شَءٍ قَدِيرٌ ٦(الحشر : ٦)

English

1 The statement: “Al-Fay’”: Know that the treasuries of the Muslims’ wealth are four, each with its own treasury. The first is the wealth of fay’, which includes kharaj (land tax), jizyah (poll tax), what is taken from the rebels, and gifts from the people of war to the Imam, as well as what is taken from the people of war without fighting, including what the tithe collector takes from the people of war and dhimmah when they pass by, the wealth of the people of Najran, and what the people of war agree to in order to avoid fighting. It is said: When the army encamps in their territory, there is no khums (one-fifth) on it according to us. All of this is spent on the interests of the Muslims, such as fortifying the borders with men, equipment, and provisions, building bridges and causeways, salaries for judges and workers who collect zakat, guards on the coasts, and salaries for scholars, those of tafsir, fiqh, hadith, and religious sciences, as well as fighters and the maintenance of their dependents, because the dependents’ expenses are upon the parents, and if they are not given enough, they would need to seek income.It is specified with “without fighting” because what is taken from them through fighting is subject to khums and then distributed among those who fought. The phrase “such as fortifying the borders” with the letter of example indicates that this type is also spent on things like horses, weapons, maintaining mosques and garrisons, preparing for the enemy, digging public rivers, repairing them, and spending on the establishment of mosque rituals such as imamate, adhan, and similar matters.

The second type of treasury is zakat and ushr, and its expenditure is as mentioned in the Book of Zakat for those eligible to receive it. The third is the khums of spoils, minerals, and buried treasures, and its expenditure is as Allah, the Exalted, mentioned in His statement: And know that anything you obtain of war booty, then for Allah is its fifth (Qur’an 8:41), as detailed in the Book of Siyar. The fourth is found property and estates without heirs, and the blood money of a killed person without a guardian. Its expenditure is for the poor foundling, the poor without guardians, providing their maintenance, medicine, shrouding their deceased, and paying for their crimes. The Imam must designate a treasury for each type and not mix them. If one treasury lacks funds, he may borrow from another type and spend it on its rightful recipients. When funds are available for that type, they are returned to the borrowed treasury, except if what was spent was from zakat or khums of spoils on the poor eligible for kharaj, as it is not returned because they are entitled to zakat. Similarly, in other cases, if it is spent on its rightful recipients. The Imam must fear Allah, the Exalted, and spend on each entitled person according to their need without excess. If he falls short in any of this, Allah will hold him accountable. This is the summary of what is in the commentaries of “Al-Kanz.”

And the statement of Allah, the Mighty and Majestic: And what Allah restored to His Messenger from them, you did not spur for it any horses or camels, but Allah gives His messengers power over whom He wills, and.Advanced: Allah is over all things competent (Qur’an 59:6).

عَنِ ابْنِ عَدِيِّ بْنِ عَدِيِّ الْكِنْدِيِّ أَنَّ عُمَرَ بْنَ عَبْدِ الْعَزِيْزِ رحمة الله عليه كَتَبَ إِنَّ مَنْ سَأَلَ عَنْ مَوَاضِعِ الْفَيْءِ أَنَّهُ مَا حَكَمَ فِيهِ عُمَرُ بْنُ الخَطَّابِ رضي الله عنه ، فَرَآهُ الْمُؤْمِنُونَ عَدْلًا مُوَافِقًا لِقَوْلِ النَّبِيِّ صلي الله عليه واله وسلم ( جَعَلَ اللهُ الْحَقَّ عَلَى لِسَانٍ عُمَرَ وَقَلْبِهِ) فَرَضَ الْأُعْطِيَةَ لِلْمُسْلِمِينَ وَعَقَدَ لِأَهْلِ الْأَدْيَانِ ذِمَّةً بِمَا فَرَضَ عَلَيْهِمْ مِنَ الْجِزْبَةِ لَمْ يَضْرِبْ١ فِيهَايِخُمُسٍ وَلَا مَغْنَمِ. رَوَاهُ أَبُوْ دَاوُدَ فِي سُنَنِهِ فِي(كِتَابِ الخِرَاجِ).

وَرَوَى ٢ أَنَّ النَّبِيَّ صلي الله عليه واله وسلم أَخَذَ الْجِزْبَةَ وَكَذَا عُمَرُ وَكَذَا مُعَاذٌ رضي الله عنهما، وَوُضِعَ فِي بَيْتِالْمَالِ، وَلَمْ يُخَمَّسْ.

English

Ibn Adi ibn Adi al-Kindi narrated that Umar ibn Abd al-Aziz (may Allah have mercy on him) wrote: Whoever asks about the allocations of fay’, it is what Umar ibn al-Khattab (may Allah be pleased with him) judged, and the believers deemed it just and in accordance with the statement of the Prophet (ﷺ): “Allah has placed the truth on Umar’s tongue and in his heart.” He allocated stipends for the Muslims and established a covenant for the people of other religions by imposing jizyah on them, without applying khums 1 or treating it as spoils. [Narrated by Abu Dawud in his Sunan in the Book of Kharaj]

It is narrated that the Prophet (ﷺ) took jizyah, 2 as did Umar and Mu’adh (may Allah be pleased with them both), and it was placed in the treasury without applying khums.

1 The statement: “Without applying khums”: It is said in “Rahmat al-Ummah”: The wealth of fay’ is what is taken from a polytheist due to their disbelief without fighting, such as jizyah taken per head, the rent of land taken as kharaj, what they abandon out of fear and flee, the wealth of an apostate killed in apostasy, and the wealth of a disbeliever who dies without an heir. What is taken from them as ushr when they travel to Muslim lands or agree to it, does it have khums or not? Abu Hanifah and Ahmad, in what is explicitly narrated from him, said: It is for all Muslims, so no khums is applied; rather, it is entirely for the interests of Muslims. Malik said: All of it is fay’, not divided, and the Imam spends it on the interests of Muslims after taking what he needs. Al-Shafi’i said: It is subject to khums. This was for the Messenger of Allah (ﷺ), and as for what is done with it after him, there are two opinions: one, for the interests of Muslims; the other, for the fighters. As for what is subject to khums, there are two opinions: the new one, that all of it is subject to khums, which is a narration from Ahmad; the Tentative: the old one, that only what they abandon out of fear and flee is subject to khums.

2 The statement: “It is narrated that the Prophet (ﷺ) took jizyah, etc.”: This is the opinion of the author of “Al-Hidayah,” who cited the action of the Prophet (ﷺ), as he took jizyah from the Magians of Hajar and the Christians of Najran and imposed jizyah on the people of Yemen at one dinar per adult male, and it is not reported that he applied khums to it. It was distributed among the Muslim community, and if it were subject to khums, it would have been reported, even through a weak chain, as is customary. Contradicting the custom is invalid, so its occurrence is invalid. Rather, the opposite is reported, as narrated by Abu Dawud from Ibn Adi ibn Adi al-Kindi, etc. Thus, it is stated in “Fath al-Qadir.”

١ قوله: لم يضرب فيها بخمس: قال في (رحمة الأمة): مال الفيء، وهو ما أخذ من مشرك لاجل كفره بغير قتالكالجزية المأخوذة على الرؤوس وأجرة الأرض المأخوذة باسم الخراج، أو ما تركوه فزعا وهربوا ومال المرتد إذاقتل في ردته ومال كافر مات بلا وارث. وما يؤخذ منهم من العشر إذا اختلفوا إلى بلاد المسلمين أو صولحوا عليه،هل يخمس أم لا؟ قال أبو حنيفة وأحمد في المنصوص عنه: هو للمسلمين كافة فلا يخمس، بل جميعه لمصالحالمسلمين وقال مالك: كل ذلك فيء غير مقسوم، يصرفه الإمام في مصالح المسلمين بعد أخذ حاجته منه. وقالالشافعي: يخمس. وقد كان ذلك لرسول الله صلي الله عليه واله وسلم و ما الذي يصنع به بعده فقولان، أحدها: لمصالح المسلمين،والثاني: للمقاتلة، وما الذي يخمس منه قولان، الجديد: أنه يخمس جميعه، وهي رواية عن أحمد، والقديم: لا يخمس إلاما تركوه فزعا وهربوا.

٢ قوله: قوله: روي أن النبي رضي الله عنه أخذ الجزية إلخ: هذا قول صاحب (الهداية) استدل بفعله صلي الله عليه واله وسلم فانه أخذ الجزيةمن مجوس هجر ونصارى نجران، وفرض الجزية على أهل اليمن على كل حالم دينارا، ولم ينقل قط في ذلك أنه خمَّسه.

بل كان بين جماعة المسلمين، ولو كان لنقل، ولو بطريق ضعيف على ما قضت به العادة، ومخالفة ما قضت به العادةباطل، فوقوعه باطل، بل قد ورد فيه خلافه أخرجه أبو داود عن ابن العدي بن عدي الكندي إلخ. كذا في (فتحالقدير).

وَعَنْ عُمَرَرضى الله عنه قَالَ: كَانَتْ أَمْوَالُ بَنِي النَّضِيرِ مِمَّا أَفَاءَ اللهُ عَلَى رَسُولِهِ مِمَّالَمْ يُوجِفْ الْمُسْلِمُونَ عَلَيْهِ بِخَيْلٍ وَلَا رِكَابٍ،فَكَانَتْ ١ لِرَسُولِ اللهِ صلي الله عليه واله وسلم خَاصَّةً، وَكَانَ يُنْفِقُ عَلَى أَهْلِهِ نَفَقَةَ سَنَتِهِ، ثُمَّ يَجْعَلُ ٢ مَا بَقِيَفِي السِّلَاحِ وَالْكُرَاعِ عُدَّةً فِي سَبِيلِ اللهِ. مُتَّفَقُ عَلَيْهِ.

English

Umar (may Allah be pleased with him) narrated: The wealth of Banu Nadir was among what Allah restored to His Messenger from what the Muslims did not spur horses or camels for, so it was exclusively for the Messenger of Allah (ﷺ). 1 He would spend on his family for a year’s maintenance, then place what remained in weapons and horses as preparation in the way of Allah. 2 [Narrated by Bukhari and Muslim]

2 The statement: “Then place what remained in weapons and horses as preparation in the way of Allah”: Ibn al-Humam said: What the Muslims did not spur horses for from the wealth of war without fighting is spent on the interests of Muslims, like kharaj, as well as jizyah, for building bridges and causeways, fortifying borders, digging great rivers like Sayhun, Jayhun, Euphrates, and Tigris that no one owns, and for the salaries of judges, market inspectors, teachers, and fighters, and securing roads from thieves. It is not exclusive to anyone or anything. They said: It is like the lands from which their people were expelled and jizyah, and there is no khums on it according to us. Umar’s opinion was that fay’ is not subject to khums like spoils but is entirely prepared for the interests of Muslims and allocated for their needs according to their varying ranks and classes. This is the opinion of most jurists, except al-Shafi’i, who held that fay’ should be subject to khums, with four-fifths spent on fighters and interests. This is compiled from “Al-Mirqat.”

وَعَنْ مَالِكِ بْنِ أَوْسِ بْنِ الْحَدَثَانِ رضي الله عنه قَالَ: ذَكَرَ عُمَرُ بْنُ الخَطَابِ رضي الله عنه يَوْمًاالْفَيْءَ، فَقَالَ: مَا أَنَا ١ بِأَحَقَّ بِهَذَا الْقَيْءِ مِنْكُمْ، وَمَا أَحَدٌ مِنَّا بِأَحَقَّ بِهِ مِنْ أَحَدٍ، إِلَّا أَنَّاعَلَى مَنَازِلِنَا مِنْ كِتَابِ اللهِ عَزَّ وَجَلَّ، وَقَسْمِ رَسُولِ اللهِ صلي الله عليه واله وسلم ، فَالرَّجُلُ وَقِدَمُهُ، وَالرَّجُلُوَبَلَاؤُهُ، وَالرَّجُلُ وَعِيَالُهُ، وَالرَّجُلُ وَحَاجَتُهُ. رَوَاهُ أَبُوْ دَاوُدَ.

English

Malik ibn Aws ibn al-Hadathan (may Allah be pleased with him) narrated: Umar ibn al-Khattab (may Allah be pleased with him) mentioned fay’ one day and said: “I am not more entitled to this fay’ 1 than you, nor is anyone among us more entitled to it than another, except that we are according to our ranks from the Book of Allah, the Mighty and Majestic, and the division of the Messenger of Allah (ﷺ). The man and his seniority, the man and his trials, the man and his dependents, the man and his need.” [Narrated by Abu Dawud]

1 The statement: “I am not more entitled to this, etc.”: In “more entitled,” there is an indication that he (may Allah be pleased with him) is not more entitled to it, as the Messenger of Allah (ﷺ) was. The statement: “from the Book of Allah, the Mighty and Majestic” is a state of “our ranks,” meaning derived from it. The exception is likely disconnected, meaning: but we are according to our ranks and stations specified in the Book of Allah, such as His statement: For the poor emigrants (Qur’an 59:8) in the three verses, and His statement: And the first forerunners among the emigrants and the helpers (Qur’an 9:100), and other verses indicating the varying ranks of Muslims. ١ قوله: ما أنا أحق بهذا إلخ: في (أحق) إشارة إلى أنه رضي الله عنه ليس أحق به، كما كان صلي الله عليه واله وسلم أحق به، قوله:(من كتاب اللّٰهعز وجل) حال من منازلنا أي حاصلة منه، والأظهر أن الاستثناء منقطع أي لكن نحن على منازلنا ومراتبنا المبينة منكتاب الله، كقوله تعالى: (لِلْفُقَرَاءِ ٱلْمُهَٰجِرِينَ) (الحشر: ٨) الآياتِ الثلاث، وقوله سبحانه: (وَٱلسَّبِقُونَ ٱلْأَوَّلُونَمِنَ ٱلْمُهَجِرِينَ وَالْأَنصَارِ) (التوبة: ١٠٠) الآية وغيرهما من الآيات الدالَّة على تفاوت منازل المسلمين، وقوله:(وقسم رسوله صلي الله عليه واله وسلم ) بالجر عطف على كتاب الله، أي ومن قسمه مما كان يسلكه صلي الله عليه واله وسلم من مراعاة التمييز بين أهل بدروأصحاب بيعة الرضوان وذوي المشاهد الذين شهدوا الحرب وبين المعيل وغيره المشار إليه بقوله:(فالرجلوقِدمه) أي سبقه في الإسلام، وقوله:(والرجل وبلاؤه) والمراد مشقته وسعيه، (والرجل وعياله) أي ممن يمونه،(والرجل وحاجته) أي مقدرا حاجته، فالرجل وقدمه على وجه التفسير لقوله (إلا أنا على منازلنا) إلخ. قال التوربشتي: كان رأي عمر رضي الله عنه ، أن الفيء لا يخمس، وأن جملته لعامة المسلمين يصرف في مصالحهم لا مزية لاحد منهم على آخر في أصل الاستحقاق، وإنما التفاوت في التفاضل بحسب اختلافحسب اختلاف المراتب والمنازل، وذلك إما بتنصيص اللّٰه تعالى على استحقاقهم، كالمذكورين في الآية خصوصا،منهم من كان من المهاجرين والأنصار؛ لقوله تعالى: {وَالسَّبِقُونَ ٱلْأَوَلُونَ مِنَ ٱلْمُهَٰجِرِينَ وَٱلْأَنصَارِ)، أو بتقديمالرسول صلي الله عليه واله وسلم و تفضيله إما لسبق إسلامه، وإما بحسب بلائه، وإما لشدة احتياجه وكثرة عياله. التقطته من (المرقاة).

وَعَنْهُ رضى الله عنه قَالَ: كَانَ فِيمَا ١ احْتَجَّ بِهِ عُمَرُ رضي الله عنه أَنَّهُ قَالَ: كَانَتْ لِرَسُولِ اللهِ صلي الله عليه واله وسلم ثَلَاثُ صَفَايا: بَنُو النَّضِيرِ وَخَيْبَرُ وَفَدَكُ، أَفَاءَهَا اللَهُ تَعَالَى عَلَى نَبِيِّهِ صلي الله عليه واله وسلم أَمَّا بَنُوالنَّضِيرِ فَكَانَتْ حُبُسًا لِنَوَائِبِهِ، وَأَمَّا فَدَكُ فَكَانَتْ حُبُسًا لأَبْنَاءِ السَّبِيلِ، وَأَمَّا خَيْبَرُ ٢ فَجَزَّأَهَا رَسُولُ اللهِ صلي الله عليه واله وسلم تَلَاَثةَ أَجْزَاءٍ: جُزْأَيْنِ بَيْنَ الْمُسْلِمِينَ، وَجُزْءًا نَفَقَةً لِأَهْلِهِ، فَمَافَضُلَ عَنْ نَفَقَةِ أَهْلِهِ جَعَلَهُ بَيْنَ فُقَرَاءِ الْمُهَاجِرِينَ. رَوَاهُ أَبُوْ دَاوُدَ.

English

Umar (may Allah be pleased with him) narrated: Among what Umar (may Allah be pleased with him) 1 used as evidence was that he said: The Messenger of Allah (ﷺ) had three exclusive properties: Banu Nadir, Khaybar, and Fadak, which Allah, the Exalted, restored to His Prophet (ﷺ). As for Banu Nadir, it was reserved for his emergencies. As for Fadak, it was reserved for wayfarers. As for Khaybar, 2 the Messenger of Allah (ﷺ) divided it into three parts: two parts among the Muslims and one part for the maintenance of his family. What remained after his family’s maintenance was distributed among the poor emigrants. [Narrated by Abu Dawud]

1 The statement: “Among what Umar used as evidence, etc.”: Meaning he used it as evidence that fay’ is not subject to khums, and this was in the presence of the Companions, and they did not object to him. This is stated in “Al-Mirqat.”

2 The statement: “As for Khaybar, the Messenger of Allah (ﷺ) divided it into three parts, etc.”: In “Sharh al-Sunnah,” it is stated: The Prophet (ﷺ) did this because Khaybar had many villages, some of which were conquered by force, and the Prophet (ﷺ) had one-fifth of the fifth from it, while some were taken by peace without fighting or spurring horses or camels, and it was pure fay’ for the Messenger of Allah (ﷺ), to be placed where Allah deemed fit for his needs, emergencies, and the interests of Muslims. The division and adjustment required it to be divided into thirds between him and the army. Thus, it is stated in “Al-Mirqat.”

وَعَنِ الْمُغِيْرَةِ بْنِ شُعْبَةَ قَالَ: إِنَّ عُمَرَ بْنَ عَبْدِ الْعَزِيْنِ رضي الله عنه جَمَعَ بَنِي مَرْوَانَحِينَ اسْتُخْلِفَ، فَقَالَ: إِنَّ رَسُولَ اللهِ صلي الله عليه واله وسلم كَانَتْ لَهُ فَدَكُ، فَكَانَ يُنْفِقُ مِنْهَا، وَيَعُودُ مِنْهَاعَلَى صَغِيرِ بَنِي هَاشِمٍ، وَيُزَوِّجُ مِنْهَا أَيِّمَهُمْ، وَإِنَّ فَاطِمَةَ سَأَلَتْهُ أَنْ يَجْعَلَهَا لَهَا، فَأْبَى فَكَانَتْ كَذَلِكَ فِي حَيَاةِ رَسُولِ اللهِ صلي الله عليه واله وسلم حَتَّى مَضَى لِسَبِيلِهِ، فَلَمَّا أَنْ وُلِّي أَبُو بَكْرٍرضى الله عنه عَمِلَفِيهَا بِمَا عَمِلَ النَّبِيُّ صلي الله عليه واله وسلم فِي حَيَاتِهِ حَتَّى مَضَى لِسَبِيلِهِ، فَلَمَّا أنْ وُلَيَ عُمَرُ ابْنُ الخَطَّابِعَمِلَ فِيهَا بِمِثْلِ مَا عَمِلًا حَتَّى مَضَى لِسَبِيلِهِ، ثُمَّ أَقْطَعَهَا مَرْوَانُ، ثُمَّ صَارَتْ لِعُمَرَ بْنِعَبْدِ الْعَزِيزِ، فَرَأَيْتُ أَمْرًا مَنَعَهُ رَسُولُ اللهِ صلي الله عليه واله وسلم فَاطِمَةَ رضى الله عنها لَيْسَ لِي بِحَقِّ، وَإِنِّي أُشْهِدُكُمْأَنِّي قَدْ رَدَدْتُهَا عَلَى مَا كَانَتْ، يَعْنِي عَلَى عَهْدِ رَسُولِ اللهِ صلي الله عليه واله وسلم وَأْبِيْ بَكْرٍ وَعُمَرَ رضي الله عنهما . رَوَاهُأبُوْ دَاوُدَ.

English

Al-Mughirah ibn Shu’bah narrated: When Umar ibn Abd al-Aziz (may Allah be pleased with him) was appointed as caliph, he gathered the Banu Marwan and said: The Messenger of Allah (ﷺ) had Fadak, from which he spent, supported the young of Banu Hashim, and married off their widows. Fatimah asked him to give it to her, but he refused. It remained so during the life of the Messenger of Allah (ﷺ) until he passed away. When Abu Bakr (may Allah be pleased with him) assumed leadership, he managed it as the Prophet (ﷺ) did during his lifetime until he passed away. When Umar ibn al-Khattab assumed leadership, he managed it similarly until he passed away. Then Marwan took it as a fief, and it came to Umar ibn Abd al-Aziz. I believe that something the Messenger of Allah (ﷺ) withheld from Fatimah (may Allah be pleased with her) is not rightful for me. I bear witness to you that I have returned it to its state during the time of the Messenger of Allah (ﷺ), Abu Bakr, and Umar (may Allah be pleased with them both). [Narrated by Abu Dawud]

وَعَنْ عَوْفِ بْنِ مَالِكِ أَنَّ رَسُولَ اللهِ صلي الله عليه واله وسلم كَانَ إِذَا أَتَّاهُ الْفَيْءُ قَسَمَهُ فِي يَوْمِهِ،فَأَعْطَى٣ الآهِلَ حَظَّيْنِ، وَأَعْطَى الْعَزَبَ حَظَّا، فَدُعِيتُ فَأَعْطَانِي حَظَيْنِ وَكَانَ لِي أَهْلٌ،ثُمَّ دُعِيَ بَعْدِي عَمَّارُ بْنُ يَاسِرٍ فَأَعْطَى لَهُ حَظًا وَاحِدًا. رَوَاهُ أَبُوْ دَاوُدَ.

English

Awf ibn Malik narrated: When fay’ came to the Messenger of Allah (ﷺ), he divided it on the same day, giving a married man two shares 3 and an unmarried man one share. I was called, and he gave me two shares because I was married. Then Ammar ibn Yasir was called after me, and he was given one share. [Narrated by Abu Dawud]

3 The statement: “Giving a married man two shares, etc.”: It is understood from this that the fay’ is used to provide sustenance for fighters and their dependents. In the commentary of “Durr al-Bihar,” dependents are explained as the wife and children. If they were not given sufficient sustenance, they would need to seek income, leaving them no time for fighting. This is taken from “Al-Hidayah” and “Radd al-Muhtar.” It is stated in “Nayl al-Awtar”: This indicates that the allocation should be according to the number of dependents a man is responsible for, such as women and others, as those besides the wife are similarly in need of provisions.

٣قوله: فأعطى الآهل حظين إلخ: ويستفاد منه أن يدفع من مال الفيء أرزاق المقاتلة وذراريهم، وفسر الذراري فيشرح (دررالبحار) بالزوجة والأولاد، فلو لم يعطوا كفايتهم لاحتاجوا إلى الاكتساب، ولا يفرغون للقتال. أخذتهمن (الهداية) و(رد المحتار). وقال في (نيل الأوطار): وفيه دليل على أنه ينبغي أن يكون العطاء على مقدار أتباعالرجل الذي يلزم نفقتهم من النساء وغيرهم؛ إذ غير الزوجة مثلها في الاحتياج إلى المؤنة.

English

Ibn Umar (may Allah be pleased with them both) narrated: I saw that when something came to the Messenger of Allah (ﷺ), he began with the freed slaves. 4 [Narrated by Abu Dawud]

وَعَنْ عَائِشَةَ رضي الله عنها أَنَّ النَبَّي صلي الله عليه واله وسلم أَتِيَ بِخَبْيَةٍ فِيهَا خَرَزٌ، فَقَسَمَهَا لِلْحُرَّةِ وَالْأَمَةِ، قَالَتْ عَائِشَة: كَانَ أَبِي٥ يَقْسِمُ لِلْحُرَّ وَالْعَبْدِ. رَوَاهُ أَبُوْ دَاوُدَ.

English

Aisha (may Allah be pleased with her) narrated: The Prophet (ﷺ) was brought a leather bag containing beads, and he divided it among free women and slave women. Aisha said: My father used to divide among the free and the slaves. 5 [Narrated by Abu Dawud]

1 The statement: “And [game caught by] what you have trained of hunting animals, etc.”: The hunting animals refer to predators among beasts and birds, such as dogs, cheetahs, falcons, hawks, and eagles. This is the opinion of al-Shafi’i and a narration from Abu Yusuf, as mentioned in “Al-Baydawi” and “Al-Kashaf.” In “Al-Madariq,” it is said: The hunting animals are from “jaraha” (wounding), making wounding a condition for permissibility, which is Abu Hanifah’s opinion, as clarified in “Al-Hidayah,” where it is stated first that hunting animals are those that hunt, then it is mentioned that Allah’s statement And [game caught by] what you have trained of hunting animals (Qur’an 5:4) indicates the condition of wounding, as it is derived from “jaraha” (wounding) in interpretation. There is no contradiction between them, and Abu Yusuf did not require wounding, reverting to the first interpretation. The verse implies that if one sends a dog or falcon to hunt, it is permissible under conditions: First, the dog or falcon belongs to a Muslim or equivalent and is trained, with training proven by the dog refraining from eating three times or the falcon returning when called. Second, it wounds decisively according to him. Third, the name of Allah is mentioned upon sending. Fourth, if it is caught alive, it is slaughtered again; if not, it suffices. If any condition is missing, such as the animal not being trained, not wounding, not mentioning Allah’s name, being caught alive but not slaughtered again, or being caught with an untrained dog or a dog without Allah’s name mentioned or a Magian’s dog, it is absolutely forbidden. This applies to hunting with predators. Similarly, for hunting with an arrow, if one shoots an arrow, mentions Allah’s name, and it wounds, it is permissible. If it is not caught alive, it suffices; if caught alive, it is slaughtered again with Allah’s name. If Allah’s name is not mentioned, it does not wound, or it is caught alive but not slaughtered, it is absolutely forbidden. Thus, it is stated in “Al-Tafsir al-Ahmadiyya.”

2 The statement: “And He forbids them what is evil”: This indicates the prohibition of all sea creatures except fish, as they are impure, refuting al-Shafi’i’s view on the permissibility of all sea creatures. Thus, it is stated in “Al-Tafsir al-Ahmadiyya.”

5 The statement: “My father used to divide among the free and the slaves”: Meaning he gave each free person and slave according to their need from the fay’. It appears that the slave and slave woman refer to the emancipated or contracted slaves, as an owned slave does not own property, and their maintenance is upon their master, not the treasury. Thus, it is stated in “Al-Mirqat.”
