كِتَابُ الصَّيْدِ وَالذَّبَائِحِHunting and Slaughter
وَقَوْلِ اللهِ عَزَّ وَجَلَّ: (يَسْئَلُونَكَ مَاذَا أُحِلَّ لَهُمّ قُلْ أُحِلَّ لَكُمُالطَّيِّبَاتُ وَمَا عَلَّمْتُم ١ مِنَ ٱلْجَوَارِحِ مُكَلِّبِينَ تُعَلِّمُونَهُنَّ مِمَّاعَلَّمَكُمُ ٱللَّهُ فَكُلُواْ مِمَّآ أَمْسَكْنَ عَلَيْكُمْ وَٱذْكُرُواْ ٱسْمَ ٱللهِ عَلَيْهِوَاتَّقُواْ ٱللَّهَ إِنَّ ٱللَّهَ سَرِيعُ ٱلْحِسَابِ) وَقَوْلِهِ تَعَالَى: (أُحِلَّ لَكُمْصَيْدُ ٱلْبَحْرِ وَطَعَامُهُ و مَتَعًا لَكُمْ وَلِلسَّيَّارَةٍ وَحُرِمَ عَلَيْكُمْ صَيْدُالْبَرِّمَا دُمْتُمْ حُرُمًا وَاتَّقُواْ ٱللَهَ ٱلَّذِي إِلَيْهِ تُحْشَرُونَ) وَقَوْلِهِ تَعَالَى: (وَإِذَا حَلَلْتُمْ فَاصْطَادُوا) وَقَوْلِهِ تَعَالَى: (حُرِّمَتْعَلَيْكُمُ ٱلْمَيْتةُ وَٱلدَّمُ وَلَحْمُ ٱلْخِنْزِيْرِ وَمَا أُهِلَّ لِغَيْرِ اللهِ بِهِوَٱلْمُنْخَنِقَةُ وَٱلْمَوْقُوذَةُ وَٱلْمُتَرَدِّيَةُ وَٱلنَّطِيحَةُ وَمَآ أَكَلَ ٱلسَّبُعُ إِلَّا مَاذَكَّيْتُمْ)وَقَوْلِهِ تَعَالَى: (وَيُحَرِمُ ٢ عَلَيْهِمُ ٱلْخَبَيِثَ)(الأعراف: ١٥٧)
١ قوله: وما علمتم من الجوارح إلخ: والمراد من الجوارح كراسب الصيد من سباع البهائم والطير كالطلب والفهدوالعقاب والصقر والبازي والشاهين وغير ذلك من ذي ناب أو مخلب، هذا هو قول الشافعي، وهو رواية عن أبييوسف، وهو المذكور في (البيضاوي )و(الكشاف). وقال في (المدارك): وقيل: الجوارح من الجراحة، فيكون الجرحشرطا للحل، وهو مذهب أبي حنيفة، صرَّح بذلك في (الهداية) حيث قال أولا: إن الجوارح هو الكواسب فيتأويل، ثم ذكر أن في قوله تعالى: (وَمَا عَلَّمْتُم مِنَ الْجَوَارِجِ) (المائدة: ٤) ما يشير إلى اشتراط الجرح؛ إذ هو منالجراحة في تأويل، ولا تنافي بينهما، وأبو يوسف لم يشترط رجوعا إلى التأويل الأول.
وجملة ما فهم من الآية أن من أرسل كلبا أو صقرا إلى صيد يحل له ذلك الصيد بشرائط، الأول: إن يكون الكلبأو الصقر للمسلم وما في معناه، ويكون معلما، ثم يعلم المعلم بترك أكل الكلب ثلاث مرات، ورجوع البازيبدعائه. والثاني: أن يكون بجرحه البتة عنده. والثالث: أن يسميه عند الإرسال. والرابع: إنه يدركه ذكاه ثانيا، وإن لميدركه كفى، فإن فقد شيء من الشروط المذكورة بأن لم يكن معلما، أو يكون معلما لكن لم يجرح، أو لم يسم عندالإرسال، أو أدركه حيا ولم يذكه ثانيا، أو شاركه كلب غير معلم، أو كلب لم يذكر اسم اللّٰه عليه، أو كلب مجوسيحرم البتة. هذا هو بيان أحكام الاصطياد بالسباع، وهكذا الحال في الاصطياد برمي السهم إن رمى سهما إلى صيدوسمى وجرح أُكل، فإن لم يدركه حيا كفى، وإن أدركه حيا ذكاه ثانيا مسميا، فإن لم يسم عليه أو لم يجرحه أو أدركهولم يذكه حرم البتة. كذا في (التفسيرات الأحمدية).
٢ قوله: ويحرم عليهم الخبائث: وفيه دليل على حرمة ما سوى السمك من حيوان البحر؛ لأن كلها خبيث، فيكونردا على الشافعي في حلّيّة جميع حيوان البحر. كذا في (التفسيراتالأحمدية)
And the statement of Allah, the Mighty and Majestic: They ask you what is lawful for them. Say, “Lawful for you are [all] good foods and [game caught by] what you have trained of hunting animals which you train as Allah has taught you. 1 So eat of what they catch for you, and mention the name of Allah upon it, and fear Allah. Indeed, Allah is swift in account” (Qur’an 5:4).
And His statement: Lawful to you is the game of the sea and its food as provision for you and the travelers, but forbidden to you is the game of the land as long as you are in the state of ihram. And fear Allah to whom you will be gathered (Qur’an 5:96).
And His statement: And when you are lawful [from ihram], then hunt (Qur’an 5:2).
And His statement: Prohibited to you are dead animals, blood, the flesh of swine, and that which has been dedicated to other than Allah, and [those animals] killed by strangling or by a violent blow or by a head-long fall or by the goring of horns, and those from which a wild animal has eaten, except what you [are able to] slaughter [before it dies] (Qur’an 5:3).
And His statement: And He forbids them what is evil (Qur’an 7:157). 2
1 The statement: “And [game caught by] what you have trained of hunting animals, etc.”: The hunting animals refer to predators among beasts and birds, such as dogs, cheetahs, falcons, hawks, and eagles. This is the opinion of al-Shafi’i and a narration from Abu Yusuf, as mentioned in “Al-Baydawi” and “Al-Kashaf.” In “Al-Madariq,” it is said: The hunting animals are from “jaraha” (wounding), making wounding a condition for permissibility, which is Abu Hanifah’s opinion, as clarified in “Al-Hidayah,” where it is stated first that hunting animals are those that hunt, then it is mentioned that Allah’s statement And [game caught by] what you have trained of hunting animals (Qur’an 5:4) indicates the condition of wounding, as it is derived from “jaraha” (wounding) in interpretation. There is no contradiction between them, and Abu Yusuf did not require wounding, reverting to the first interpretation. The verse implies that if one sends a dog or falcon to hunt, it is permissible under conditions: First, the dog or falcon belongs to a Muslim or equivalent and is trained, with training proven by the dog refraining from eating three times or the falcon returning when called. Second, it wounds decisively according to him. Third, the name of Allah is mentioned upon sending. Fourth, if it is caught alive, it is slaughtered again; if not, it suffices. If any condition is missing, such as the animal not being trained, not wounding, not mentioning Allah’s name, being caught alive but not slaughtered again, or being caught with an untrained dog or a dog without Allah’s name mentioned or a Magian’s dog, it is absolutely forbidden. This applies to hunting with predators. Similarly, for hunting with an arrow, if one shoots an arrow, mentions Allah’s name, and it wounds, it is permissible. If it is not caught alive, it suffices; if caught alive, it is slaughtered again with Allah’s name. If Allah’s name is not mentioned, it does not wound, or it is caught alive but not slaughtered, it is absolutely forbidden. Thus, it is stated in “Al-Tafsir al-Ahmadiyya.”
2 The statement: “And He forbids them what is evil”: This indicates the prohibition of all sea creatures except fish, as they are impure, refuting al-Shafi’i’s view on the permissibility of all sea creatures. Thus, it is stated in “Al-Tafsir al-Ahmadiyya.”
وَعَنْ عَدِيٍّ بْنِ حَاتِمٍ رضي الله عنه قَالَ: قَالَ لِيْ رَسُوْلُ اللهِ صلي الله عليه واله وسلم : (إِذَا١ أَرْسَلْتَكَلْبَكَ فَاذْكُرْ اسْمَ اللهِ، فَإِنْ أَمْسَكَ عَلَيْكَ فَأَدْرَكْتَهُ حَيًّا فَاذْبَحْهُ، وَإِنْ أَدْرَكْتَهُ قَدْ قَتَلَوَلَمْ يَأْكُلْ مِنْهُ فَكُلْهُ، وَإِنْ أكل فَلَا تَأْكُلْ؛ فَإِنَّمَا أَمْسَكَ عَلَى نَفْسِهِ، وَإِنْ وَجَدْتَ مَعَ كَلْبِكَكَلْبًا غَيْرَهُ وَقَدْ قَتَلَ فَلَا تَأْكُلْ؛ فَإِنَّكَ لَا تَدْرِي أَيُّهُمَا قَتَلَهُ، وَإِذَا رَمَيْتَ٢ بِسَهْمِكَ فَاذْكُرْاسْمَ اللهِ، فَإِنْ غَابَ عَنْكَ يَوْمًا فَلَمْ تَجِدْ فِيهِ إِلَّا أَثَرَ سَهْمِكَ فَكُلْ إِنْ شِئْتَ، وَإِنْ وَجَدْتَهُ ٣غَرِيقًا فِي الْمَاءِ فَلَا تَأْكُلْ). مُتَّفَقُ عَلَيْهِ.
وَرَوَى ابْنُ أَبِيْ شَيْبَةَ فِي مُصَنَّفِهِ، وَالطَّبَرَانِيُّ فِي مُعْجَمِهِ عَنْ أَبِيْ رَزِيْنٍ عَنِ النَّبِيّ صلي الله عليه واله وسلم فِي الصَّيْدِ يَتَوَارَى عَنْ صَاحِبِهِ قَالَ:(لَعَلَّ هَوَامَ الأَرْضِ هِيَ قَتَلَتْهُ).
وَرَوَى عَبْدُ الرَّزَّاقِ نَحْوَهُ عَنْ عَائِشَةَ رضي الله عنها مَرْفُوْعًا. وَقَالَ عُلَمَاءُنَا: يُحْمَلُ هَذَا الْحَدِيْثُعَلَى مَا إِذَا قَعَدَ عَنْ طَلَبِهِ، وَالْأَوَّلُ عَلَى مَا إِذَا لَمْ يَقْعُدْ.
Adi ibn Hatim (may Allah be pleased with him) narrated: The Messenger of Allah (ﷺ) said to me: “When you send your dog, mention the name of Allah. 1 If it catches for you and you find it alive, slaughter it. If you find it killed but it has not eaten from it, eat it. If it has eaten, do not eat, for it caught it for itself. If you find another dog with your dog and it has been killed, do not eat, for you do not know which one killed it. When you shoot your arrow, mention the name of Allah. 2 If it disappears for a day and you find only the mark of your arrow, eat if you wish. If you find it drowned in water, do not eat.” 3 [Narrated by Bukhari and Muslim]
Ibn Abi Shaybah narrated in his Musannaf and al-Tabarani in his Mu’jam from Abu Razin, from the Prophet (ﷺ), regarding game that disappears from its hunter: “Perhaps the vermin of the earth killed it.” Abd al-Razzaq narrated something similar from Aisha (may Allah be pleased with her), attributed to the Prophet. Our scholars said: This hadith applies when one stops pursuing it, while the first applies when one does not stop.

1 The statement: “When you send your dog, etc.”: In “Al-Hidayah,” it is stated: If one sends a trained dog or falcon and mentions Allah’s name upon sending, and it catches and wounds the game, causing it to die, it is permissible to eat, based on the hadith of Adi. This is because the dog or falcon is a tool, and slaughter is not achieved by the tool alone except through its use, which is sending, akin to shooting or using a knife. Thus, mentioning Allah’s name is necessary. If omitted forgetfully, it is still permissible, as explained. The prohibition of omitting the name intentionally applies to slaughtered animals. Wounding is required in the apparent narration, and the fatwa is based on it to ensure emergency slaughter, which is wounding anywhere on the body, attributed to the tool’s use. The verse And [game caught by] what you have trained of hunting animals (Qur’an 5:4) indicates the requirement of wounding, as it is derived from “jaraha” (wounding), meaning a hunting predator with fangs or claws. There is no contradiction, and it ensures certainty. Abu Yusuf did not require wounding, reverting to the first interpretation, and our response is as stated. If the dog or cheetah eats from it, it is not eaten; if the falcon eats, it is eaten. The difference is that a falcon’s body cannot withstand beating, but a dog’s can, so it is beaten to stop eating. The sign of a dog’s training is refraining from its habit of eating and seizing, while a falcon’s wild nature and response to a call are its training sign. The statement “If it has eaten, etc.” is supported by Adi’s hadith, which is evidence against Malik and al-Shafi’i’s old opinion permitting what a dog eats from. In “Nata’ij al-Afkar,” it is said: If it is argued that Abu Tha’labah al-Khushani’s narration, which permits eating what a dog eats from, supports Malik and al-Shafi’i, the response is that Abu Tha’labah’s narration is countered by Adi’s, which is preferred because it prohibits what a dog eats from, and in jurisprudence, the prohibitive is preferred over the permissive in conflicts, making it the abrogating narration. Thus, Adi’s hadith is followed over Abu Tha’labah’s. In “Al-Hidayah,” it is stated: If the sender finds the game alive, he must slaughter it; if he neglects to do so and it dies, it is not eaten, as with a falcon or arrow, because he could perform the original act before achieving the purpose of the substitute. If the dog strangles it without wounding, it is not eaten, as wounding is a condition in the apparent narration. If an untrained dog, a Magian’s dog, or a dog sent without mentioning Allah’s name participates, it is not eaten, as per Adi’s hadith, because the permissible and forbidden combine, and prohibition prevails by text or precaution.
2 The statement: “When you shoot your arrow, etc.”: If an arrow hits game, and it struggles to move or fly with difficulty due to the arrow and disappears from sight, if the shooter does not stop pursuing and finds it dead, it is permissible. If he stops pursuing and finds it dead, it is not permissible, based on the Prophet’s (ﷺ) statement to Abu Tha’labah: “If you shoot your arrow and it disappears for three days.” In this narration: “If it disappears for a day and you find it, eat it unless it has spoiled.” It is narrated that the Prophet (ﷺ) disliked eating game that disappears from the shooter, saying: “Perhaps the vermin of the earth killed it.” This applies when one stops pursuing, while the first applies when one does not stop. It is possible it died from another cause, so precaution is taken when possible. The speculative in prohibitions is treated as certain, but not when precaution is impossible due to necessity, as it would close the door to hunting. Hunting often occurs in wildernesses where game disappears frequently, so if one does not stop pursuing, it is permissible to eat to avoid hardship. If one engages in other tasks, it is forbidden, which is the analogy for all cases, but we abandon it for necessity when precaution is impossible, and it remains on the principle when precaution is possible. For permissibility, no wound other than the arrow’s must be found. This is the summary of what is in the commentaries of “Al-Kanz.”
3 The statement: “If you find it drowned, etc.”: In “Al-Hidayah,” it is stated: If game is shot and falls into water, onto a roof, or a mountain and then falls to the ground, it is not eaten, as it is a “mutaraddiyah” (fallen), which is forbidden by text. It may have died from a cause other than the arrow, as water or falling from a height is deadly. This is supported by the Prophet’s (ﷺ) statement to Adi: “If your shot falls into water, do not eat, for you do not know whether the water or your arrow killed it.” If it falls directly on the ground, it is eaten, as precaution is impossible, and considering it would close the door to hunting. Unlike the former cases, precaution is possible, so when the causes of prohibition and permissibility combine and precaution is possible, prohibition prevails for caution. If precaution is impossible, its existence is treated as non-existent, as obligation is according to capacity.
١ قوله: إذا أرسلت كلبك إلخ: قال في (الهداية): وإذا أرسل كلبه المعلم أو بازيَه، وذكر اسم اللّٰه تعالى عند إرساله، فأخذ الصيد وجرحه، فمات حل أكله؛ لما روينا من حديث عدي، ولأن الكلب أو البازي آلة، والذبح لا يحصلبمجرد الآلة إلا بالاستعمال، وذلك فيهما بالإرسال، فنزل منزلة الرمي وإمرار السكين، فلا بُدَّ من التسمية عنده، ولوتركه ناسيا حل أيضًا على ما بيناه، وحرمة متروك التسمية عامدا في الذبائح، ولا بُدَّ من الجرح في ظاهر الرواية،(والفتوى عليه) ليتحقق الذكاة الاضطراري، وهو الجرح في أيٍّ موضع كان من البدن، بانتساب ما وجد من الآلة إليهبالاستعمال.
وفي ظاهر قوله تعالى: (وَمَا عَلَّمْتُم مِنَ ٱلْجَوَارِجِ) (المائدة: ٤) ما يشير إلى اشتراط الجرح؛ إذ
هو من الجرح بمعنى الجراحة في تأويل فيحمل على الجارح الكاسب بنابه ومخلبه، ولا تنافي، وفيه أخذ باليقين، وعن أبي يوسف أنه لا يشترط رجوعا إلى التأويل الأول، وجوابه ما قلنا، فإن أكل منه الكلب أو الفهد لم يؤكل، وإن أكل منه البازيأكل، والفرق أن بدن البازي لا يحتمل الضرب، وبدن الكلب يحتمل، فيضرب ليتركه، وأن آية التعليم ترك ما هومألوفه عادة، والبازي متوحش متنفر، فكانت الإجابة آية تعليمه. أما لكلب فهو مألوف يعتاد الانتهاب، فكان آية تعليمه ترك مألوفه، وهو الأكل والاستلاب. وقوله: فإن أكل منه الكلب إلخ: هو مؤيد بما رويناه من حديث عدي، وهو حجة على مالك وعلى الشافعي ل في قوله القديم في إباحة ما أكل الكلب منه.وقال في (نتائج الأفكار): فإن قيل: روى أبو ثعلبة الخشني ، أنه عليلا قال في صيد الكلب: (وإن أكل منه)وذلك دليل واضح لمالك والشافعي. قلت: رواية أبي ثعلبة معارضة بحديث عدي،وحديث عدي مرجَّح علىحديث أبي ثعلبة؛ لأنه حديث يحل ما أكل منه الكلب، وحديث عدي يحرم ما أكل الكلب منه. وقد عرف في أصولالفقه أن المحرم يرجح على المحل عندالتعارض، فيجعل ناسخا له، فوجب العمل بحديث عدي دون حديث أبيثعلبة، انتهى. وفي (الهداية): وإن أدرك المرسل والصيد حيا وجب عليه أن يذكيه، وإن ترك تذكيته حتى مات لم يؤكل،وكذا البازي والسهم؛ لأنه قدر على الأصل قبل حصول المقصود بالبدل؛ إذ المقصود هو الإباحة ولم تثبت قبل موته،فبطل حكم البدل، وإن خنقه الكلب ولم يجرحه لم يؤكل؛ لأن الجرح شرط على ظاهر الرواية، وإن شاركه كلب غيرمعلم أو كلب مجوسي أو كلب لم يذكر اسم اللّٰه عليه - يريد به عمدا - لم يؤكل؛ لما روينا في حديث عدي ؛ لأنهاجتمع المبيح والمحرم، فيغلب جهة الحرمة نصًّا أو احتياطًا.
٢ قوله: وإذا رميت بسهمك إلخ: يعني إذا وقع سهم بصيد فتحامل الصيد أي تكلف المشي أو الطيران بمشقة معوقوع السهم فيه، وغاب عن النظر، فإن لم يقعد الرامي عن الطلب ولم يزل في طلبه حتى وجده ميتا فهو حلال، وإنقعد هو عن طلبه ثم أصابه ميتا لا يجل؛ لقوله صلي الله عليه واله وسلم لا بي ثعلبة:(إذا رميت سهمك فغاب ثلاثة أيام). وفي هذهالرواية: (غاب عنك يوما، فأدركته فكله ما لم ينتن)، وروي أنه صلي الله عليه واله وسلم كره أكل الصيد إذا غاب عن الرامي، وقال:(لعل هوام الأرض قتلته) فيحمل هذا على ما إذا قعد عن طلبه،والحديث الأول على ما إذا لم يقعد، ولأنه يحتمل أنيموت بسبب آخر فيعتبر فيما يمكن التحرز عنه؛ لأن الموهوم في المحرمات كالمتحقق، وسقط اعتباره فيما يمكنالتحرز عنه؛ لأن الموهوم في المحرمات كالمتحقق، وسقط اعتباره فيما لا يمكن التحرز عنه للضرورة؛ لأن الاعتبارفيه يؤدي إلى سد باب الاصطياد. وهذا لان الاصطياد يكون غالبا في البراري، وتوري الصيد فيها غالب، فما لم يقعدعن طلبه حل أكله دفعا للضرورة، ولا ضرورة فيما إذا اشتغل بعمل آخر فيحرم، وهو القياس في الكل، إلا أننا تركناه للضرورة فيما لا يمكن التحرز عنه، وبقي على الأصل فيما يمكن، ويشترط للحل أن لا يوجد جراحة سوى جراحةسهمه، هذا حاصل ما في شروح (الكنز).
٣ قوله: وإن وجدته غريقا إلخ: قال في (الهداية): وإذا رمى صيدا فوقع في الماء أو وقع على سطح أو جبل ثم تردَّىمنه إلى الأرض لم يؤكل؛ لأنه المتردِّية، وهو حرام بالنص، ولأنهاحتمل الموت بغير الرمي؛ إذ الماء مهلك، وكذاالسقوط من علو، يؤيد ذلك قوله صلي الله عليه واله وسلم لعدي :(وإن وقعت رميتك في الماء فلا تأكل؛ فإنك لا تدري أن الماء قتلهأو سهمك)، وإن وقع على الأرض ابتداء أكل؛ لأنه لا يمكن الاحتراز عنه، وفي اعتباره سد باب الاصطياد، بخلافما تقدم؛ لأنه يمكن التحرز عنه، فصار الأصل أن سبب الحرمة والحل إذا اجتمعا وأمكن التحرز عما هو سبب الحرمة ترجح جهة الحرمة احتياطا، وإن كان مما لا يمكن التحرز عنه جرى وجوده مجرى عدمه؛ لأن التكليف بحسبالوسع.

وَعَنِ ابْنِ عَبَّاس رضى الله عنهما قَالَ: مَا أَمْسَكَ عَلَيْكَ كَلْبَكَ، إِنْ كَانَ عَالِمًا فَكُلْ، فَإِنْ أَكَلَ فَلَا تَأْكُلْ مِنْهُ؛ فَإِنَّمَا أَمْسَكَهُ عَلَى نَفْسِهِ، وَأَمَّا الصَّقْرُ وَالْبَازِيْ فُكُلْ وَإِنْ أَكَلَ، فَإِنَّتَعْلِيْمَهُ إِذَا دَعَوْتَهُ أَنْ يُجِيْبَكَ، وَلَا تَسْتَطِيْعُ ضَرْبَهُ حَتَّى تَدَعَ الْأَكُلَ. رَوَاهُ مُحَمَّدٌ فِي (كِتَابِالآثَارِ).
وَرَوَى سَعِيْدُ بْنُ مَنْصُوْرٍ عَنْ رَاشِدِ بْنِ سَعِيْدٍ قَالَ: قَالَ رَسُوْلُ اللهِ صلي الله عليه واله وسلم : (ذَبِيْحَةُالْمُسْلِمِ حَلَالٌ وَإِنْ ١ لَمْ يُسَمِّ إِذَا لَمْ يَتَعَمَّدْ). وَقَالَ الْبُخَارِيُّ تَعْلِيْقًا: قَالَ ابْنُ عَبَّاس: مَنْ نَسِيَ فَلَا بَأْسَ، وَقَالَ الله: (وَلَا تَأْكُلُواْ مِمَّا لَمْ يُذْكَرِ ٱسْمُ ٱللَهِ عَلَيْهِ وَإِنَّهُو لَفِسْقُ) وَالنَّاسِيْ لَا يُسَمَّى فَاسِقًا، وَقَالَ مَالِكٌ : حَدِيْثُ٢ عَائِشَةَ: (اذْكُرُوْا أَنْتُمُ اسْمَ اللهِ وَكُلُوْا) كَانَ فِي ابْتِدَاءِ الإِسْلَامِ.
Ibn Abbas (may Allah be pleased with them both) narrated: Whatever your trained dog catches for you, eat. If it eats from it, do not eat, for it caught it for itself. As for the falcon or hawk, eat even if it eats, for its training is that it responds when you call it, and you cannot beat it to stop eating. [Narrated by Muhammad in “Kitab al-Athar”]
Sa’id ibn Mansur narrated from Rashid ibn Sa’id that the Messenger of Allah (ﷺ) said: “The slaughter of a Muslim is permissible even if he does not mention [Allah’s name] if he did not do so intentionally.” 1 Al-Bukhari commented: Ibn Abbas said: There is no harm if one forgets, and Allah said: And do not eat of that upon which the name of Allah has not been mentioned, for indeed, it is grave disobedience (Qur’an 6:121). The one who forgets is not called disobedient. Malik said: Aisha’s hadith, 2 “Mention Allah’s name yourselves and eat,” was at the beginning of Islam.

Al-Shafi’i said: It is eaten in both cases. Malik said: It is not eaten in either case. The Muslim and the person of the Book are equal in omitting the name. The same applies to omitting the name when sending a falcon, dog, or shooting. Al-Shafi’i’s opinion contradicts consensus, as there is no dispute among those before him about the prohibition of intentionally omitting the name. The dispute is about forgetting, with Ibn Umar’s opinion prohibiting it, and Ali and Ibn Abbas permitting it, unlike intentional omission, which is forbidden by consensus. There are people recently from polytheism who bring us meat, and we do not know if they mentioned Allah’s name over it.” He said: “Mention Allah’s name yourselves and eat.” In “Umdat al-Qari,” it is said: Some used this hadith to argue that mentioning Allah’s name on slaughter is not obligatory, as if it were, the Prophet (ﷺ) would not have permitted eating the Bedouins’ slaughter. The response is that this was at the beginning of Islam, as Malik added at the end: “And that was at the beginning of Islam.” It is possible they were not ignorant of mentioning the name.

Adi (may Allah be pleased with him) narrated: I said: “O Messenger of Allah, I shoot game and find my arrow in it the next day?” He said: “If you know your arrow killed it and see no trace of a predator, eat.” [Narrated by Abu Dawud]
We say it is known that another condition is not to stop pursuing it. In “Al-Bada’i,” it is narrated that a man gifted the Prophet (ﷺ) game, and he said: “Where did you get this?” He said: “I shot it yesterday and was pursuing it until night overtook me, cutting me off from it. Then I found it today with my arrow in it.” The Prophet (ﷺ) said: “It disappeared from you, and I do not know, perhaps some vermin assisted you with it. I have no need for it.” It is narrated from Ibn Abbas (may Allah be pleased with them both) that he was asked about it and said: “Eat what you hit directly and leave what disappears.” Abu Yusuf said: “Direct hit” means what you see, and “disappears” means what is hidden from you. Hisham said from Muhammad: “Direct hit” means what does not disappear from your sight, and “disappears” means what is hidden from your sight, except that pursuit replaces sight due to necessity.
وَعَنْ أَبِيْ ثَعْلَبَةَ الْخُشَنِيِّقَالَ: قُلْتُ: يَا نَبِيَّ اللهِ، إِنَّا بِأَرْضِ قَوْمٍ مِنْأَهْلِ الْكِتَابِ، أَفَنَأْكُلُ فِي آنِيَتِهِمْ؟ وَبِأَرْضِ صَيْدٍ أَصِيدُ بِقَوْسِي وَبِكَلْبِيِ الَّذِي لَيْسَبِمُعَلَّمِ وَبِكَلْبي الْمُعَلَّمِ، فَمَا يَصْلُحُ لِي؟ قَالَ: (أَمَّا مَا ذَكَرْتَ مِنْ آنِيَةِ أَهْلِ الْكِتَابِ، فَإِنْ وَجَدْتُمْ غَيْرَهَا فَلَا تَأْكُلُوا فِيهَا، وَإِنْ لَمْ تَجِدُوا فَاغْسِلُوهَا وَكُلُوا فِيهَا، وَمَا صِدْتَ بِقَوْسِكَفَذَكَرْتَ اسْمَ اللهِ فَكُلْ، وَمَا صِدْتَ بِكَلْبِكَ الْمُعَلَّمِ فَذَكَرْتَ اسْمَ اللهِ فَكُلْ، وَمَا صِدْتَبِكُلْبِكَ غَيْرِ مُعَلَّمٍ فَأَدْرَكْتَ ذَكَاتَهُ فَكُلْ). مُتَفَقُ عَلَيْهِ.
وَفِي رِوَايَةِ التَّرْمِذِيِّ عَنْهُ قَالَ: قُلْتُ: يَا رَسُولَ اللهِ، إِنَّا أَهْلُ صَيْدٍ، قَالَ:(إِذَا أَرْسَلْتَكَلْبَكَ وَذَكَرْتَ اسْمَ اللهِ عَلَيْهِ فَأَمْسَكَ عَلَيْكَ فَكُلْ)، قُلْتُ: وَإِنْ قَتَلَ، قَالَ: (وَإِنْ قَتَلَ) قُلْتُ: إِنَّا أَهْلُ رَمي، قَالَ:(مَا رَدَّتْ عَلَيْكَ قَوْسُكَ فَكُلْ)، قَالَ: قُلْتُ: إِنَّا أَهْلُ سَفَرٍ، نَمُرُّبِالْيَهُودِ وَالنَّصَارَى وَالْمَجُوس فَلَا نَجِدُ غَيْرَ آنِيَتِهِمْ؟ قَالَ: (فَإِنْ لَمْ تَجِدُوا غَيْرَهَا فَاغْسِلُوهَابِالْمَاءِ، ثُمَّ كُلُوا فِيهَا وَاشْرَبُوا).
وَرَوَى التَّرْمِذِيُّ وَأَبُوْ دَاوُدَ عَنْ قَبِيصَةَ بْنَ هُلْبٍ عَنْ أَبِيْهِ قَالَ: سَأَلْتُ النَّبِيِّ صلي الله عليه واله وسلم عَنْ طَعَامِ النَّصَارَى. وَفِي رِوَايَةٍ: سَأْلَهُ رَجُلٌ، فَقَالَ: إِنَّ مِنَ الطَّعَامِ طَعَامًا أتَحَرَّجُ مِنْهُ،فَقَالَ: (لَا يَتَخَلَّجَنَّ فِي صَدْرِكَ شَيْءُ صَارَعْتَ فِيهِ النَّصْرَانِيَّةَ).
Abu Tha’labah al-Khushani narrated: I said: “O Prophet of Allah, 1 we are in the land of the People of the Book; may we eat from their vessels? And in a land of game, I hunt with my bow, my untrained dog, and my trained dog, what is permissible for me?” He said: “As for the vessels of the People of the Book, if you find others, do not eat from them. If you do not find others, wash them and eat from them. What you hunt with your bow and mention Allah’s name, eat. What you hunt with your trained dog and mention Allah’s name, eat. What you hunt with your untrained dog and catch it in time to slaughter, eat.” [Narrated by Bukhari and Muslim]
In al-Tirmidhi’s narration from him, he said: I said: “O Messenger of Allah, we are people of hunting.” He said: “When you send your dog and mention Allah’s name over it and it catches for you, eat.” I said: “Even if it kills it?” He said: “Even if it kills it.” I said: “We are people of shooting.” He said: “What your bow returns to you, eat.” I said: “We are people of travel, passing by Jews, Christians, and Magians, and find only their vessels.” He said: “If you find no others, wash them with water, then eat and drink from them.”
Al-Tirmidhi and Abu Dawud narrated from Qabisah ibn Hulb, from his father, who said: I asked the Prophet (ﷺ) about the food of Christians. In another narration: A man asked him, saying: “I am hesitant about some food.” He said: “Let not your heart be troubled by something you have fought Christianity over.”
The second issue is about hunting with a bow, trained dog, and untrained dog. He answered: “What you hunt, etc.” Several rulings are derived: First, hunting with a bow is permissible if Allah’s name is mentioned. In Abu Dawud’s narration from Amr ibn Shu’ayb, from his father, from his grandfather, a Bedouin named Abu Tha’labah said: “O Messenger of Allah, I have trained dogs,” and he asked about his bow. The Prophet (ﷺ) said: “Eat what your bow returns to you, whether slaughtered or not.” He said: “Even if it disappears from me?” He said: “Even if it disappears, as long as it has not spoiled or you find a mark other than your arrow.” The term “not spoiled” means not decayed. Second, mentioning Allah’s name is obligatory, as discussed earlier. Third, the dog must be trained. If one hunts with a trained dog and mentions Allah’s name upon sending, it is eaten. If hunted with an untrained dog and its slaughter is caught in time, it is slaughtered and eaten; otherwise, it is not eaten. Fourth, the dog’s color, white, black, or red, does not matter; it is permissible regardless, refuting Ahmad’s view prohibiting a black dog, even if trained. Fifth, the conditions are that the dog is trained and Allah’s name is mentioned. If an untrained dog is sent, a trained dog is sent without mentioning Allah’s name, or a dog catches without being sent, it is not permissible unless caught with stable life and slaughtered. This is stated in “Umdat al-Qari.” In “Al-Mirqat,” it is said: Since the question comprised two issues, the answer was detailed. Regarding the vessels of the People of the Book and eating from them: “If you find others, do not eat from them” for precaution, based on the Prophet’s (ﷺ) saying: “Leave what makes you doubt for what does not.” This is to avoid using their vessels, even after washing, and to discourage mingling with them emphatically. This is piety. What follows is the ruling for fatwa, and the generality of the wording, not the specific cause, is considered. “If you find no others, wash them” is a command of obligation if impurity is likely, and recommendation otherwise, as stated by Ibn al-Malik. The Prophet’s (ﷺ) command to wash disbelievers’ vessels applies when impurity is certain; otherwise, it is a dislike of avoidance.

Second, the hadith refers to cases where impurity is confirmed, as supported by Abu Dawud’s narration: “We neighbor the People of the Book, and they cook pork in their pots and drink wine in their vessels.” The Prophet (ﷺ) said: “If you find others, eat and drink from them. If you find no others, wash them with water and eat and drink.” Understand this.
١ قوله: يا نبي الله! إنا بأرض قوم أهل الكتاب، أفنأكل في آنيتهم إلخ: استفتى أبو ثعلبة المذكور رسولَ اللّٰه صلي الله عليه واله وسلم عنمسألتين، الأولى: عن الأكل في آنية أهل الكتاب، فأجاب النبي صلي الله عليه واله وسلم بقوله: (فإن وجدتم غيرها - أي غير آنية أهلالكتاب - فلا تأكلوا فيها، وإلا فاغسلوها وكلوا فيها). وهذا التفصيل يقتضي كراهة استعمالها إن وجد غيرها، مع أنالفقهاء قالوا بجواز استعمالها بعد الغسل بلا كراهة، سواء وجد غيرها أو لا، وأجيب بأن المراد النهي عن الآنية التييطبخون فيها لحوم الخنازير ويشربون فيها الخمور، وإنما نهى عنها بعد الغسل للاستقذار وكونها معد للنجاسة، ومرادالفقهاء أواني الكفار التي ليست مستعملة في النجاسات غالبا. قلت: التحقيق في هذا أن في حديث أبي ثعلبة هذاترجيح الظاهر على الأصل؛ لأن الأصل في آنية أهل الكتاب والمجوس الطهارة، ومع هذا فقد أمر بغسلها عند عدموجود غيرها، والصحيح أن الحكم للأصل حتى تتحقق النجاسة، ثم يحتاج إلى الجواب عن الحديث، فأجيببجوابين: أحدهما: أن الأمر بالغسل للاحتياط والاستحباب. والثاني: أن المراد بالحديث حالة تحقق نجاستها، ويدلعليه قوله في رواية أبي داود: إنا نجاور اأهل لكتاب وهم يطبخون في قدورهم الخنزير ويشربون في آنيتهم الخمر، فقالرسول اللّٰه صلي الله عليه واله وسلم (إن وجدتم غيرها فكلوا فيها واشربوا، وإن لم تجدوا غيرها فاغسلوها بالماء وكلوا وشربوا)،فافهم.
المسألة الثانية: عن الصيد بالقوس وبالكلب المعلم وغير المعلم، فأجاب بقوله: (وما صدت) إلى آخره.ويستفاد منه أحكام، الأول : فيه جواز الصيد بالقوس إذا ذكر اسم اللّٰه عليه، وفي رواية أبي داود من حديث عمرو بنشعيب عن أبيه عن جده أن أعرابيا يقال له: أبو ثعلبة قال: يا رسول الله! إن لي كلابا مكلَّبة الحديث، وفيه: أفتني فيقوسي، قال:(كل ما ردت عليك قوسك، ذكياوغير ذكي)، قال: وإن تغيب عني؟ قال: (وإن تغيب عنك ما لم يصِلّأو تجد فيه أثر غير سهمك) قوله:(ما لم يصلّ) بكسر الصاد المهملة واللام الثقيلة أي ما لم ينتن. الثاني: وجوباشتراط التسمية. وقد مرت مباحثها عن قريب.
الثالث: إن الكلب لا بُدَّ أن يكون معلما، فإذا صاد بكلبه المعلم، وذكر اسم اللّٰه عند الإرسال؛ فإنه يؤكل، وإذاصاد بكلب غير معلم، فإن أدرك ذكاته يذكى ويؤكل وإلا فلا يؤكل. الرابع: إن ذكر الكلب مطلقًا يتناول أي لون كانأبيض أو أسود أو أحمر، فيجوز بأيّ لون كان، وفيه حجة على أحمد حيث لا يجوز بالكب الأسود، وإن كان معلما.الخامس: إن فيه شرطين كون الكلب معلما والتسمية، فإذا أرسل كلبا غير معلم أو أرسل معلما بغير تسمية أو وجدكلبا قد صاد من غير إرسال، فلا يحل صيده، إلا بأن يدركه فيه حياة مستقرة، ثم يذكيه. قاله في(عمدة القاري). وقالفي (المرقاة): ولما كان السؤال مركبا من مسألتين قال مفصلا في الجوابأما ما ذكرت من آنية أهل الكتاب أي ومن الأكل فيها، (فإن وجدتم غير ها فلا تأكلوا فيها) أي احتياطا؛ لقوله صلي الله عليه واله وسلم : (دع ما يريبك إلى ما لا يريبك)، وتنزها عن استعمال ظروفهم المستعملة في أيديهم ولو بعد الغسل، وتنفيرا عن مخالطتهم على طريق المبالغة. وهذا هو التقوى، وما بعده حكم الفتوى، والعبرة بعموم اللفظ لابخصوص السبب الآتي ذكره، (وإن لم تجدوا) أي غيرها (فاغسلوها) أمر وجوب إذا كان هناك غلبة الظن علىنجاستها، وأمر ندب إذا كان الأمر بخلاف ذلك، قاله ابن الملك. أمره صلي الله عليه واله وسلم بغسل إناء الكفار فيما إذا تيقَّن نجاسته،وما لا فكراهته تنزيهية، (وكلوا فيها).
وَعَنْ عَدِيِّ بْنِ حَاتِمِ قَالَ: قُلْتُ: يَا رَسُولَ اللهِ إِنَّا نُرْسِلُ الْكِلَابَالْمُعَلَّمَةَ؟ قَال :(كُلْ مَا أَمْسَكْنَ١عَلَيْكَ)، قُلْتُ: وَإِنْ قَتَلْنَ؟ قَالَ: (وَإِنْ قَتَلْنَ) قُلْتُ: وَإِنَّا نَرْمي٢ بِالْمِعْرَاضِ؟ قَالَ: (كُلْ مَا خَزَقَ، وَمَا أَصَابَ بِعَرْضِهِ فَلَا تَأْكُلْ). مُتَفَقُ عَلَيْهِ .
Adi ibn Hatim narrated: I said, “O Messenger of Allah, we send trained dogs?” He said: “Eat what they catch for you.” 1 I said, “Even if they kill it?” He said: “Even if they kill it.” I said, “And we shoot with the mi’rad (a blunt arrow)?” 2 He said: “Eat what it pierces, but do not eat what it strikes with its side.” [Narrated by Bukhari and Muslim]

1 The statement: “Eat what they catch for you”: This general statement aligns with Allah’s saying: So eat of what they catch for you (Qur’an 5:4), without requiring wounding, supporting the view of al-Hasan from Abu Hanifah and Abu Yusuf that wounding is not a condition. However, the apparent position of the school is that wounding is required for predators with fangs or claws, in any part of the body Amelia: body, to ensure emergency slaughter. They said: The purpose is to let out the flowing blood, which is achieved by wounding, as in voluntary slaughter or shooting with an arrow. If it does not wound, it becomes like a “mawqudha” (struck animal), which is forbidden by text. The fatwa is based on the apparent narration. The principle here is that if death is certainly caused by wounding, it is eaten; if caused by weight or there is doubt, it is not eaten, either absolutely or as a precaution. This is taken from “Al-Mirqat” and “Al-Inayah.”
2 The statement: “And we shoot with the mi’rad, etc.”: In “Al-Hidayah,” it is stated: What is struck by the side of the mi’rad is not eaten; if it wounds, it is eaten, based on the Prophet’s (ﷺ) saying: “What it hits with its edge, eat; what it hits with its side, do not eat.” This is because wounding is necessary to fulfill the meaning of slaughter, as explained earlier. What is killed by a pellet is not eaten, as it crushes and breaks without wounding, like a mi’rad that does not pierce. In “Al-Mirqat,” al-Nawawi said: The “mawqudha” is what is killed by a non-sharp object like a stick or stone. They agreed that if hunted with a mi’rad and killed by its edge, it is permissible; if by its side, it is not. They said nothing killed by a pellet is permissible, per the mi’rad hadith. Makhul, al-Awza’i, and other Syrian jurists said what is killed by a mi’rad or pellet is permissible.
١ قوله: كل ما أمسكن عليك: في هذا الإطلاق المطابق لقوله تعالى: (فَكُلُواْ مِمَّآ أَمْسَكْنَ عَلَيْكُمْ ) (المائدة: ٤) منغير قيد بالجرح تأييد؛ لما روى الحسن عن أبي حنيفة وأبي يوسف أنه لا يشترط الجرح، وظاهر المذهب أنه يشترطجرح ذي الناب وذي المخلب للصيد في أيِّ موضع كان لتحقق الذكاه الاضطرارية، قالوا: ووجهه أن المقصود إخراج الدم المسفوح، وهو بالجرح عادة، فأقيم الجرح مقامه، كما في الذكاة الاختيارية والرمي بالسهم، ولأنه لو لم يجرحه صارموقوذة، وهي محرمة بالنص، والفتوى على ظاهر الرواية، والأصل هنا أن الموت إن حصل بالجرح بيقين يؤكل، وإنحصل بالثقل أو شك فيه لا يؤكل حتما أو احتياطا. أخذته من (المرقاة) و (العناية).
٢ قوله: إنا نرمي بالمعراض إلخ: قال في (الهداية): وما أصابه المعراض بعرضه لم يؤكل، وإن جرحه يؤكل؛ لقوله صلي الله عليه واله وسلم فيه: (ما أصاب بحده فكل، وما أصاب بعرضه فلا تأكل) ولأنه لا بُدَّ من الجرح؛ ليتحقق معنى الذكاة على ما قدمناه،ولا يؤكل ما أصابه البندقة فمات بها؛ لأنها تدق وتكسر ولا تجرح، فصار كالمعراض إذا لم يخرق اه. وقال في (المرقاة): قال النووي: الوقيذ والموقوذة هو الذي يقتل بغير محدد من عصا أو حجر أو غيرهما، واتفقوا على أنه إذااصطاد بالمعراض فقتل الصيد بحده حل، وإن قتله بعرضه لم يجل، وقالوا: لا يحل ما قتله بالبندقة مطلقًا لحديثالمعراض. وقال مكحول والأوزاعي وغيرهما من فقهاء الشام: يحل ما قتل بالمعراض والبندقة.
وَعَنْهُ رضي الله عنه أَنَّ النَّبِيَّ صلي الله عليه واله وسلم قَالَ:(مَا عَلَّمْتَ مِنْ كَلْبٍ أَوْ بَازٍ، ثُمَّ أَرْسَلْتَهُ،وَذَكَرْتَ اسْمَ اللهِ فَكُلْ مِمَّا أَمْسَكَ عَلَيْكَ)، قُلْتُ: وَإِنْ قَتَلَ؟ قَالَ:(إِذَا قَتَلَهُ وَلَمْ يَأْكُلْ مِنْهُشَيْئًا، فَإِنَّمَا أَمْسَكَهُ عَلَيْكَ). رَوَاهُ أَبُوْ دَاوُدَ.
Adi ibn Hatim (may Allah be pleased with him) narrated that the Prophet (ﷺ) said: “Whatever you train of a dog or falcon, then send it and mention Allah’s name, eat what it catches for you.” I said, “Even if it kills it?” He said: “If it kills it and does not eat from it, it caught it for you.” [Narrated by Abu Dawud]

Rather, it refers to game caught by a dog, whether belonging to a Muslim or a Magian. A Muslim’s game is permissible, whether caught by a Muslim’s or Magian’s dog. This is stated in “Al-Kawkab al-Durri.” In “Al-Hidayah,” it is said: The game of a Magian, apostate, or idolater is not eaten, as they are not among those whose slaughter is valid, as explained in the chapter on slaughter. This is unlike a Christian or Jew, whose slaughter is valid voluntarily or by necessity. The ruling of slaughter does not purify a separated part. 3 The statement: “May Allah curse whoever slaughters for other than Allah”: In “Al-Durr al-Mukhtar,” for example, slaughtering for the arrival of a governor or similar dignitary is forbidden, as it is dedicated to other than Allah, even if Allah’s name is mentioned. Slaughtering for a guest is not forbidden, as it is the way of Ibrahim and honoring a guest is honoring Allah. The difference is that if offered for eating, the slaughter is for Allah with benefit to the guest, feast, or profit; if given to another for their glorification, it is forbidden. There are two opinions on whether it constitutes disbelief, per “Bazzaziyyah” and “Sharh Wahbaniyyah.” In “Radd al-Muhtar,” it is said: Does it constitute disbelief? Rafi’ ibn Khadij (may Allah be pleased with him) narrated: I said, “O Messenger of Allah, we will meet the enemy tomorrow and have no knives; can we slaughter with cane?” He said: “Whatever makes the blood flow 1 and Allah’s name is mentioned upon it, eat, except with a tooth or nail. I will tell you about them: the tooth is bone, and the nail is the knife of the Abyssinians.” We acquired spoil of camels and sheep, and a camel fled, so a man shot it with an arrow, stopping it. 2 The Messenger of Allah (ﷺ) said: “These camels have wildness like wild animals; if any overcome you, do so with it.” [Narrated by Bukhari and Muslim]
Al-Bukhari narrated from Ka’b ibn Malik (may Allah be pleased with him) that he had sheep grazing at Sal’, and a servant girl saw one dying, so she broke a stone and slaughtered it with it. 3 He asked the Prophet (ﷺ), who ordered them to eat it.
Ali al-Qari said: If a stone is suitable for slaughter by wounding, so are a detached bone or tooth, unlike an attached one, as it causes death by weight with sharpness, making the slaughter like a “munkhaniqah” (strangled). However, slaughtering with a detached one is disliked due to harm to the animal, like using a dull blade. Rafi’s hadith is interpreted to reconcile narrations. This is supported by al-Tahawi’s narration from Abu Raja’ al-Ataridi, who said: We went on Hajj, and a man caught a rabbit, slaughtered it with his nail, roasted it, and they ate it, but I did not. When we reached Madinah, I asked Ibn Abbas (may Allah be pleased with him), who said: “Perhaps you ate with them?” I said, “No.” He said, “You did well; it was killed by strangling.” 4

1 The statement: “Whatever makes the blood flow, etc.”: In “Al-Bada’i,” tools are of two types: cutting and breaking. Cutting tools are sharp or dull. Sharp ones, whether iron or not, are permissible for slaughter. The basis for allowing non-iron slaughter is Adi ibn Hatim’s narration: He said, “O Messenger of Allah, if one of us hits game without a knife, can he slaughter with a flint or a stick’s edge?” He said: “Make the blood flow with whatever you wish and mention Allah’s name.” A dull tool is permissible if it cuts, achieving the meaning of slaughter, but is disliked for causing unnecessary pain. The Prophet (ﷺ) ordered sharpening the blade and easing the animal. Slaughtering with a detached nail or tooth is permissible but disliked. Al-Shafi’i said it is not permissible due to this hadith, as it excludes the tooth and nail from permissibility, making it a prohibition. We say: Since the jugular veins are cut, it is permissible, as with flint or cane. The hadith refers to an attached tooth or nail, as Abyssinians did so to show prowess, which applies to attached ones. Some narrations state: “Except what is bitten with a tooth or cut with a nail,” referring to attached ones. A breaking tool, like an attached nail or tooth, is not permissible by consensus; if used, it is a dead animal, per the hadith, as it relies on the animal, causing strangulation. They said: If another takes his hand and passes it like a knife while silent, it is permissible and eaten.
2 The statement: “A man shot it with an arrow, etc.”: In “Al-Hidayah,” domesticated game’s slaughter is by cutting, while wild livestock’s is by wounding or piercing, as emergency slaughter is resorted to when voluntary slaughter is impossible, which is evident in the latter case.
3 The statement: “She broke a stone and slaughtered it with it, etc.”: In “Al-Binayah,” it is best to use this hadith as evidence for our scholars. The reasoning is that texts are based on rationale, and a stone is suitable for slaughter by wounding, as are a detached nail or tooth, unlike an attached one, which is the Abyssinian knife, as per the first hadith’s interpretation.
4 The statement: “It was killed by strangling”: Al-Tahawi said in “Sharh Ma’ani al-Athar”: Do you not see that Ibn Abbas clarified in this hadith that the prohibition of eating what is slaughtered with a nail is due to strangling, as it is slaughtered with the hand, making it strangled? This indicates that the prohibition applies to an attached nail, not a detached one, and similarly for a tooth, as it refers to an attached tooth in the mouth, not a detached one. This is the view of Abu Hanifah, Abu Yusuf, and Muhammad (may Allah have mercy on them all).
١ قوله: فكل ليس السن والظفر إلخ: قال في (البدائع): وجملة الكلام فيه أن الآلة على ضربين: آلة تقطع، وآلةتفسخ، والتي تقطع نوعان: حادة وكليلة. أما الحادة فيجوز الذبح بها، حديدا كانت أو غير حديد، والأصل في جوازالذبح بدون الحديد ما روي عن عدي ابن حاتم أنه قال: قلت: يا رسول الله! أرأيت أحدنا أصاب صيدا وليسمعه سكين أيذكي بمروة أو بشقة العصا؟ فقال صلي الله عليه واله وسلم :(أنهر الدم بما شئت، واذكر اسم اللّٰه تعالى). وأما الكليلة فإنكانت تقطع يجوز لحصول معنى الذبح، لكنه يكره لما فيه من زيادة إيلام لا حاجة إليها. ولهذا امر رسول الله صلي الله عليه واله وسلم بتحديد الشفرة وإراحة الدبيحة، وكذلك إذا ذبح بظفر منزوع او سن منزوع جاز الذبحبهما ويكره. وقال الشافعي : لا يجوز لهذا الحديث؛ لأنه استثنى الظفر، والسن من الإباحة، والاستثناء من الإباحةيكون حظرا. ولنا أنه لما قطع الأوداج. فقد وجد الذبح بهما، فيجوز كما لو ذبح بالمروة وليطة القصب، وأما الحديثفالمراد السن القائم والظفر القائم؛ لأن الحبشة إنما كانت تفعل ذلك لإظهار الجلادة، وذلك بالقائم لا بالمنزوع،والدليل عليه أنه روي في بعض الروايات: (إلا ما كان قرضا بسن أو حزا بظفر)، والقرض إنما يكون بالسن القائم، وأماالآلة التي تفسخ فالظفر القائم، والسن القائم، ولا يجوز الذبح بهما بالإجماع، ولو ذبح بهما كان ميتة؛ للخبر الذي روينا،ولأن الظفر والسن إذا لم يكن منفصلا فالذابح يعتمد على الذبيح فيخنق فينفسخ، فلا يحل أكله، حتى قالوا: لو أخذغيره يده، فأمرّ يده كما أمر السكين وهو ساكت يجوز ويحل أكله، انتهى.
٢ قوله: فرماه رجل بسهم إلخ: لذلك قال في (الهداية): وما استأنس من الصيد فذكاته الذبح، وما توحش من النعمفذكاته العقر والجرح؛ لأن ذكاة الاضطرار إنما يصار إليه عند العجز عن ذكاة الاختيار على ما مرّ، والعجز متحقق فيالوجه الثاني دون الأول.
٣ قوله: فكسرت حجرا فذبحتها به إلخ: قال في (البناية): والأحسن أن يستدل لاصحابنا بهذا الحديث، وجه الاستدلال: أن الأصل في النصوص التعليل، والحجر يصلح آلة للذبح بمعنى الجرح فكذا الظفر المنزوع والسنالمنزوع، بخلاف غير المنزوع؛ فإنه لا يصلح آلة لكونه مدى الحبشة، وهو محمل الحديث الأول.
٤قوله: إنما قتلها خنقا: قال الطحاوي: في (شرح معاني الآثار): أفلا ترى أن ابن عباس قد تبين في حديثه هذاالمنعى الذي به حرم أكل ما ذبح بالظفر أنه الخنق؛ لأن ما ذبح به فإنما ذبح بكف لا بغيرها فهو مخنوق، فَدَلَّ ذلك أنما نهي عنه من الذبح بالظفر هو الظفر المركب في الكف لا الظفر المنزوع، وكذلك ما نيه عنه مع ذلك من الذبحبالسن، فإنها هو على السن المركبة في الفم؛ لأن ذلك لا يكون عضوا، فأما السن المنزوعة فلا. وهذا قول أبي حنيفة وأبي يوسف ومحمد رحمة اللّٰه عليهم أجمعين.
وَعَنْ أَبِي الْعُشَرَاءِ عَنْ أَبِيْهِ رضي الله عنه أَنَّهُ قَالَ: يَا رَسُوْلَ اللهِ، أَمَا تَكُونُ الذَّكَاةُ إِلَّا فِي الْحَلْقِ وَاللَّبَةِ؟ قَالَ: (لَوْ طَعَنْتَ فِي فَخِذِهَا لَأَجْرَأَ عَنْكَ). رَوَاهُ التّرْمِذِيُّ وَأَبُوْ دَاوُدَوَالنَّسَائِيُّ وَابْنُ مَاجَه وَالدَّارِمِيُّ.
وَقَالَ أَبُوْ دَاوُدَ: وَهَذَا ذَكَاةُ الْمُتَرَدِيْ. وَقَالَ التَّرْمِذِيُّ: هَذَا فِي١ الضَّرُوْرَةِ.
Abu al-Ushara, from his father (may Allah be pleased with him), narrated: He said, “O Messenger of Allah, is slaughter only in the throat or chest?” He said: “If you stabbed it in its thigh, it would suffice for you.” [Narrated by al-Tirmidhi, Abu Dawud, al-Nasa’i, Ibn Majah, and al-Darimi]

Emergency slaughter is wounding anywhere on the body, while voluntary slaughter is cutting between the throat and chest. The slaughter veins are the trachea (airway), esophagus (food and drink passage), and two jugular veins. It is permissible to cut any three of them. Thus, in “Al-Mirqat.”

Ibn Abbas and Abu Hurayrah (may Allah be pleased with them both) narrated that the Messenger of Allah (ﷺ) forbade the “sharitah of the devil,” which Ibn Isa explained as a slaughter where the skin is cut without severing the jugular veins, then left to writhe until it dies. [Narrated by Abu Dawud]
وَعَنْ أَبِيِ الدَّرْدَاءِ رضى الله عنه قَالَ: نَهَى رَسُوْلُ اللهِ وَلِلِهِ عَنْ أَكْلِ ٢ الْمُجَثَّمَةِ، وَهِيَالَتِي تُصْبَرُ بِالنَّبْلِ. رَوَاهُ التَّرْمِذِيُّ.

Al-Irbad ibn Sariyah (may Allah be pleased with him) narrated that on the day of Khaybar, the Messenger of Allah (ﷺ) forbade every fanged predator, 1 every clawed bird, the meat of domestic donkeys, the “mujaththamah,” the “khalisah,” and approaching pregnant women until they give birth. Muhammad ibn Yahya said: Abu Asim was asked about the “mujaththamah,” and he said: It is when a bird or thing is set up and shot at. He was asked about the “khalisah,” and he said: It is when a wolf or predator catches it, a man takes it, and it dies in his hand before slaughter. [Narrated by al-Tirmidhi]
Some of our scholars said: If a person acquires a pregnant slave girl, it is not permissible to approach her until she gives birth, and similarly for a woman pregnant from fornication.

وَقَالَ عُلَمَاوُنَا: حَمَلَهُ الْإِمَامُ أَبُوْ حَنِيْفَةَ عَلَى التَّشْبَيْهِ، أَيْ كَذَكَاةِ أُمِّهِ، بِدَلِيْلٍ أَنَّهُ رُوِيبِالنَّصبِ، وَإِنْ كَانَ مَرْفُوْعًا فَكَذَلِكَ؛ لِأَنَّهُ أَقْوَى فِي التَّشْبَيْهِ مِنَ الْأَوَّلِ، وَمِمَّا يَدُلُّ عَلي َذَلِكَ تَقْدِيْمُ ذَكَاةِ الْجَنِينِ، وَيُؤَيِّدُهُ مَا رُوِيَ فِي (مُوَطّاً) مُحَمَّدٍ عَنْ إِبْرَاهِيْمَ أَنَّهُ قَالَ: لَايَكُوْنُ ذَكَاةُ نَفسِ ذَكَاةَ نَفْسِيْنِ.

1 The statement: “The slaughter of the fetus is the slaughter of its mother”: Our scholars said: Imam Abu Hanifah interpreted it as a simile, meaning like the slaughter of its mother, as it is narrated with the accusative case. Even if narrated in the nominative, it is the same, as it is stronger in simile than the former. This is supported by the precedence of mentioning the fetus’s slaughter and by what is narrated in Muhammad’s “Muwatta” from Ibrahim: “The slaughter of one soul is not the slaughter of two.” In “Al-Hidayah,” Abu Hanifah said: If a camel or cow is slaughtered and a dead fetus is found, whether formed or not, it is not eaten. This is the view of Zufar and al-Hasan ibn Ziyad. Abu Yusuf, Muhammad, and al-Shafi’i said: If fully formed, it is eaten, based on the hadith, meaning the mother’s slaughter substitutes for the fetus’s. Al-Sarakhsi in “Al-Mabsut” cited: And [those animals] killed by strangling (Qur’an 5:3), as the fetus, at best, is alive during the mother’s slaughter and dies by suffocation, which is a “munkhaniqah” (strangled). The Prophet (ﷺ) said to Adi ibn Hatim: “If your shot falls into water, do not eat, for you do not know whether the water or your arrow killed it.” Eating is prohibited when there is doubt about the cause of death, which applies to the fetus, as it is unknown whether it died from the mother’s slaughter or suffocation. Precaution is possible, as it may be separated alive and slaughtered. Ibrahim said: The slaughter of one soul is not the slaughter of two. The fetus is a separate soul in life, sustained by Allah in the mother without nourishment or as He wills. After separation, it may be nourished by the mother’s milk, not as a part. In other rulings, it follows the mother, so its slaughter cannot be established without her, as it cannot be separated alive after her death. If separated alive and dies, it is not permissible. The purpose of slaughter is to let out flowing blood to distinguish pure from impure, which the mother’s slaughter does not achieve for the fetus, nor does it purify its meat through cooking. This responds to their claim that slaughter is for leniency, as it is not waived by excuse, like a dog killing game by suffocation. Slaughtering a pregnant animal is permissible, as the fetus may be separated alive and slaughtered, and the mother’s meat is the goal. The hadith means a simile, not substitution, as the fetus is mentioned first, unlike a substitute, which would mention the agent first. In “Al-Mirqat,” Abu Sa’id al-Khudri’s hadith states: We found a fetus in its belly; should we discard or eat it? He said: “Eat it if you wish.” Their hesitation was whether the fetus is permissible to slaughter due to mercy for its small size. The response is that there is no difference between the fetus and mother in slaughter, as both have souls, made permissible by slaughter. Otherwise, it is a dead animal, prohibited by: Prohibited to you are dead animals (Qur’an 5:3). In “Al-Bada’i,” if the fetus emerges alive after the mother’s slaughter and is slaughtered, it is permissible; if it dies before, it is not eaten without disagreement. In “Bazl al-Majhud,” al-Shami cited “Al-Kifayah”: If birth coincides with slaughter, it is disliked, per the Imam’s view. If it emerges alive without time to slaughter and dies, it is eaten, per Abu Yusuf and Muhammad. This contradicts “Al-Bada’i”’s general statement that it is not eaten if it dies before slaughter. If it emerges dead and not fully formed, it is not eaten by all, as it is like a clot. If fully formed, Abu Hanifah, Zufar, and al-Hasan said it is not eaten; Abu Yusuf, Muhammad, and al-Shafi’i said it is permissible, citing the hadith, as it implies the mother’s slaughter purifies the fetus, as it is legally and physically dependent. Abu Hanifah cited: Prohibited to you are dead animals and blood (Qur’an 5:3), as the fetus is a dead animal without life, included in the text. Even if conceded, it may have been alive and died with the mother, so it is prohibited as a precaution. As a principle in life, it requires its own slaughter. Its potential to survive after the mother’s slaughter proves it is a separate entity, not dependent on her life, requiring its own slaughter, as slaughter ends life. Since it can survive after the mother’s slaughter, her slaughter does not let out its blood, as blood-dependent animals typically cannot live without blood. Thus, its flowing blood remains, making it prohibited, per: Blood poured forth (Qur’an 6:145) and Prohibited to you are dead animals and blood (Qur’an 5:3). Its meat is also prohibited, as it cannot be distinguished from its blood. The hadith, narrated in the accusative, means like the mother’s slaughter, as similes may omit the particle, per: And it passes like the passing of clouds (Qur’an 27:88) and They look at you like the look of one fainting from death (Qur’an 47:20). This supports our view, as equating their slaughter implies both require it. The nominative narration may also imply a simile or substitution, as they claim, but it is a single report in a matter of general concern, indicating lack of establishment, as it would be widely known if certain.
١ قوله: ذكاة الجنين ذكاة أمه: أي ذكاة الجنين كذكاة أمه، فمن نحر ناقة أو ذبح بقرة فوجد في بطنها جنينًا ميتة لم يؤكل، أشعر أو لم يُشعر، هذا عند أبي حنيفة ، وهو قول زفر والحسن بن زياد علا. وقال أبو يوسف ومحمد علها: إذا تمخلقته أكِل، وهو قول الشافعي لقوله عليه السلام: (ذكاة الجنين ذكاة أمه)، معناه عندهم ذكاة الأم نائبة عن ذكاة الجنين.أخذته من (الهداية). وقال الإمام السرخسي في مبسوطه: وأبو حنيفة استدل بقوله تعالى: (وَٱلْمُنْخَنقَةُ) (المائدة:)٣)فإن أحسن أحواله أن يكون حيًّا عند ذبح الأم فيموت باحتباس نفسه، وهذا هو المنخنقة.
وقال عليه السلام لعدي بن حاتم :(إذا وقعت رميتك في الماء فلا تأكل؛ فإنك لا تدري أن الماء قتله أم سهمك). فقدحرم الأكل عنده وقوع الشك في سبب زهوق الحياة، وذلك موجود في الجنين؛ فإنه لا يدري أنه مات بذبح الأم أوباحتباس نفسه. وقد يتأتى الاحتراز عنه في الجملة؛ لأنه قد يتوهم انفصاله حيا ليذبح، وعلل إبراهيم، فقال: ذكاةنفس لا تكون ذكاة نفسَينِ، ومعنى هذا أن الجنين في حكم الحياة نفس على حدة مودعة في الأم، حتى ينفصل حيافيبقى، ولا يتوهم بقاء الجزء حيا بعد الانفصال، وكذلك بعد موت الأم يتوهم انفصال الجنين حيا، ولا يتوهم بقاءحياة الجزء بعد موت الأصل، والذكاة تصرف في الحياة، فإذا كان في حكم الحياة نفسا على حدة فيشترط فيه ذكاة علىحدة.
ولا نقول: يتغذى بغذاء الأم، بل يبقيه اللّٰه تعالى في بطن الأم من غير غذاء أو يوصل اللّٰه إليه الغداء كيف شاء، ثمبعد الانفصال قد يتغذى أيضا بغداء الأم بواسطة اللبن، ولم يكن في حكم الجزء، ولما جعل في سائر الأحكام تبعا لميتصور تقرر ذلك الحكم في الأم دونه، حتى لا يتصور انفصاله حيا بعد موت الأم، ولو انفصل حيا ثم مات لم يحلعندهم، فعرفنا أنه ليس يتبع في هذا الحكم، وحقيقة المعنى فيه ما بينا أن المطلوب بالذكاة تسييل الدم لتمييز الطاهر منالنجس، وبذبح الأم لا يحصل هذا المقصود في الجنين، أو المقصود تطييب اللحم بالنضج الذي يحصل بالتوقدوالتلهب، ولا يحصل ذلك في الجنين بذبح، وهذا الجواب عما قالوا: إن الذكاة تبني على التوسع.قلنا: نعم، ولكن لا يسقط بالعذر، كما لو قتل الكلب صيدا غما أو اختناقا، وهذا لأن المقصود لا يحصلبدون الجرح وإباحة ذبح الحامل؛ لأنه يتوهم أن ينفصل الجنين حيا فيذبح، ولأن المقصود لحم الأم، وذبح الحيوانلغرض صحيح حلال، كما لو ذبح ما ليس بمأكول لمقصود الجلد، والمراد بالحديث التشبيه لا النيابة أي ذكاة الجنين كذكاة أمه. ألا ترى أنه ذكر الجنين أولا ولو كان المراد النيابة لذكر النائب أولا دون المندوب عنه، كما قيل فيالألفاظ الذي استشهد بها، ومثل هذا يذكر للتشبيه، يقال: فلان شبيه أبيه وخط فلان خط أبيه. وقال القائل: وعيناكعيناها وجيدك جيدها سوى أن عظم الساق منك دقيق.
والمراد التشبيه، ويصح هذا التأويل في الرواية بالنصب؛ فإن المنزوع حرف الكاف، قال اللّٰه تعالى: (وَهِيَ تَمُرُّمَرَّ السَّحَابِ) (النمل: ٨٨) أي كمر السحاب، ويحتمل الباء أيضًا، ولكن إن جعلنا المنزوع حرف الكاف لم يحلالجنين، وإن جعلناه حرف الباء يحل، ومتى اجتمع الموجب للحل والموجب للحرمة يغلب الموجب للحرمة،والحديث مع القصة لا يكاد يصحُّ، ولو ثبت فالمراد من قولهم: فيخرج من بطنها جنين ميت أي مشرف على الموت،قال اللّٰه تعالى: (إِنَّكَ مَيِّتٌ وَإِنَّهُم مَيِّتُونَ ٣) (الزمر: ٣٠) ومعنى قوله صلي الله عليه واله وسلم (كلوه) أي اذبحوه وكلوه، والمرادبالفراش الصغار، فلا يتناول الجنين، ولئن كان المراد به الجنين ففيه بيان أن الجنين مأكول، وبه نقول، ولكن عندوجود الشرط فيه، وهو أن ينفصل حيا فيذبح فيحل به، انتهى.
وقال في (المرقاة): حديث أبي سيعد الخدري فنجد في بطنها الجنين أنلقيه أم نأكله، قال: كلوه إن شئتم، فالظاهرفيه أن وجه ترددهم هو أن الجنين هل يحل ذبحه أم لا؟ نظرا إلى الرحمة والشفقة عليه؛ لكونه صغيرًا، وحاصلالجواب: أنه لا فرق بين الجنين وأمه في الذكاة؛ لأن كلا منهما ذات روح. وقد أحلهما اللّٰه لنا بالذبح، وإلا فالمتبادر منكونه ميتة أن لا يحل أكله لشموله؛ لقوله تعالى: (حُرِّمَتْ عَلَيْكُمُ ٱلْمَيْتَةُ) (المائدة: ٣) فلا وجه لسؤالهم حينئذٍ. قالفي (البدائع): وعلى هذا يخرج الجنين إذا خرج بعد ذبح أمه إن خرج حيا فَذُكِّي يحل، وإن مات قبل الذبح لا يؤكل بلاخلاف. قال في (بذل المجهود): قلت: ولكن حكى الشامي عن (الكفاية): إن تقارنت الولادة يكره ذبحها، وهذاالفرع لقول الإمام، وإذا خرج حيا ولم يكن من الوقت مقدار ما يقدر على ذبحه فمات يؤكل، وهو تفريع على قولهمااه.
وهذا يخالف عموم قول (البدائع): وإن مات قبل الذبح لا يؤكل بلا خلاف، وإن خرج ميتا، فإن لم يكن كاملالخلق لا يؤكل أيضًا في قولهم جميعا؛ لأنه بمعنى المضغة، وإن كان كامل الخلق اختلف فيه، قال أبو حنيفة: لا يؤكل،وهو قول زفر والحسن بن زياد . وقال أبو يوسف ومحمد والشافعي :لا بأس بأكله، واحتجوا بحديث(ذكاة الجنين ذكاه أمه)، فيقتضي إنه يتذكى بذكاة أمه، ولأنه تبع لأمه حقيقة وحكمًا، والحكم في التبع يثبت بعلةالأصل، ولأبي حنيفة قوله تعالى: (حُرِّمَتْ عَلَيْكُمُ ٱلْمَيْنَةُ وَالدَّمُ) (المائدة: ٣) والجنين ميتة؛ لأنه لا حياة فيه،والميتة ما لا حياة فيه، فيدخل تحت النص، فإن قيل: الميتة اسم لزائل الحياة فيستدعي تقدم الحياة، وهذا لا يعلم فيالجنين؟ فالجواب: أن تقدم الحياة ليس بشرط لإطلاق اسم الميت، قال اللّٰه تبارك وتعالى: (وَكُنتُمْ أَمْوَاتَا فَأَحْيَكُمْ)(البقرة: ٢٨) على أنا سلمنا ذلك فلا بأس به؛ لأنه يحتمل أنه كان حيا فمات بموت الأم، ويحتمل أنه لم يكن فيحرماحتياطا، ولأنه أصل في الحياة، فيكون له أصل في الذكاة.
والدليل على أنه أصل في الحياة أنه يتصور بقاؤه حيا بعد ذبح الأم، ولو كان تبعا للأم في الحياة لما تصور بقائه حيابعد زوال الحياة عن الأم، وإذا كان أصلًا في الحياة يكون أصلًا في الذكاة؛ لأن الذكاة تفويت الحياة، ولأنه إذا تصوربقائه حيا بعد ذبح الأم لم يكن ذبح الأم سببا لخروج الدم عنه؛ إذ لو كان لما تصور بقاؤه حيا بعد ذبح الأم؛ إذ الحيوانالدموي لا يعيش بدون الدم عادةً، فبقي الدم المسفوح فيه، ولهذا إذا جرح يسيل منه الدم، وإنه حرام؛ لقوله سبحانهوتعالى: (دَمَّا مَسْفُوحًا) (الأنعام: ١٤٥) وقوله عز شأنه: (حُرِّمَتْ عَلَيْكُمُ ٱلْمَيْتَةُ وَٱلدَّمُ) (المائدة: ٣)، ولا يمكنالتمييز بين لحمه ودمه فيحرم اللحم أيضًا.
وأما الحديث فقد روي بنصب الذكاة الثانية، معناه كذكاة أمه؛ إذ التشبيه قد يكون بحرف التشبيه وقد يكونبحذف حرف التشبيه، قال تعالى: (وَهِيَ تَمُرُّ مَرَّ ٱلسَّحَابِ) (النمل: ٨٨). وقال عز شأنه: (يَنظُرُونَ إِلَيْكَ نَظّرَالْمَغْشِيِّ عَلَيْهِ مِنَ ٱلْمَوْتِ) (محمد: ٢٠) أي كنظر المغشي عليه، وهذا حجة عليكم؛ لأن تشبيه ذكاة الجنين بذكاة أمهيقتضي استوائهما في الافتقار إلى الذكاة، ورواية الرفع تحتمل التشبيه أيضًا، قال اللّٰه تعالى: (وَجَنَّةٍ عَرْضُهَا ٱلسَّمَٰوَاتُوَٱلْأَرْضُ) (آل عمران: ١٣٣) أي عرضها كعرض السموات والأرض، فيكون حجة عليكم، وتحتمل النيابة كماقالوا، فلا تكون حجة مع الاحتمال معه أنه من أخبار الآحاد، ورد فيما تعم به البلوى، وأنه دليل عدم الثبوت؛ إذ لوكان ثابتا لاشتهر.
وَعَنْ جَعْفَرِ بْنِ مُحَمَّدٍ عَنْ أَبِيْهِ عَنْ عَليٍّ رضي الله عنه قَالَ: الْحِيْتَانُ١ وَالْجَرَادُ ذَكِيْ كُلُّهُ.رَوَاهُ عَبْدُ الرَّزَّاقِ فِي مُصَنَّفِهِ. وَرَوَى أَبُوْ دَاوُدَ وَابْنِ مَاجَه.

1 The statement: “Fish and locusts are all purified”: According to us, no aquatic animal is eaten except non-floating fish. Aquatic refers to those born and living in water, not land-born animals living in water, like some birds, which are eaten. Malik, al-Shafi’i, and others, including Abd al-Rahman ibn Abi Layla, said all sea creatures are eaten, even eels, predators, dogs, and humans, though some Malikis excluded dogs and pigs. They cite: Lawful to you is the game of the sea (Qur’an 5:96) without distinction, and the Prophet’s (ﷺ) saying: “Its water is pure, and its dead are lawful.” We cite: And He forbids them what is evil (Qur’an 7:157), as non-fish sea creatures are impure. The Prophet (ﷺ) forbade treatment with medicine containing frogs and the sale of crabs. The “game” in the verse refers to hunting, which is permissible even for what is not eaten. The “dead” in the hadith refers to fish, per: “Two dead things and two bloods are made lawful for us: fish and locusts, liver and spleen.” Texts prohibiting predators and pigs apply to both land and sea. In “Mulla Miskin” and others, the dispute over sale and eating is the same. Al-Zayla’i said their sale is permissible by consensus due to their purity. “Non-floating” means fish is eaten when not floating; floating fish is not eaten according to us. Malik and al-Shafi’i said floating fish is permissible, citing the hadith. We cite the Prophet’s (ﷺ) saying: “Eat what the sea casts out or leaves behind; do not eat what dies in it and floats.” Their evidence is inapplicable, as “sea’s dead” refers to what it casts out, attributed to the sea, not what dies in it from disease or otherwise. A floating fish is one that dies naturally in the water, rising and appearing belly-up. If its back is up, it is not floating and is eaten. What is in the belly of a floating fish is eaten. “Floating” is from “tafa” (to rise on water). The principle is that if the cause of death is known, e.g., cast out by the sea, confined in a small enclosure, swallowed by a fish, killed by a water bird, or frozen in ice, it is eaten, as the cause is known. If it dies from water’s heat, cold, or recession, Hisham narrated from Muhammad: If its head is above water, it is not eaten; if its tail is in water and head exposed, it is eaten, as the head’s exposure caused death, unlike the tail. The condition is knowing the cause of death. If a limb is severed by a blow, both it and the fish are eaten. This is from “Al-Kanz” commentaries.
١ قوله: الحيتان والجراد ذكي كله: يعني عندنا لا يؤكل مائي إلا السمك غير طاف، المراد بالمائي مائي المولدوالمعاش، دون بري المولد مائي المعاش كبعض الطيور؛ فإنه يؤكل. وقال مالك والشافعي وجماعة منهم عبد الرحمنبن أبي ليلى: يؤكل جميع حيوان البحر حتى الجريث والسباع والكلب والإنسان، واستثنى بعض المالكية الكلب والخنزير،لهم قوله تعالى: (أَحِلَّ لَكُمْ صَيْدُ ٱلْبَحْرِ) (المائدة: ٩٦) من غير فصل، وقوله صلي الله عليه واله وسلم في البحر: (هو الطهور ماؤه والحلميتته). ولنا قوله تعالى: (وَيُحَرِّمُ عَلَيْهِمُ ٱلْخَبَايِثَ) (الأعراف: ١٥٧) وما سوى السمك خبيث، ونهى النبي صلي الله عليه واله وسلم عنالتداوي بدواء اتخذ فيه الضفدع، وعن بيع السرطان، والصيد في الآية محمولة على الاصطياد، وهو مباح فيما لا يحل أكله،والميتة المذكورة في الحديث محمولة على السمك، وهو مستثنى لقوله صلي الله عليه واله وسلم :(أحلت لنا ميتتان ودمان، أما الميتتانفالسمك والجراد، وأما الدمان فالكبد والطحال)والنصوص على تحريم السباع والخنزير مطلقة، فتناول البري والبحري. واعلم أنه قال في (ملا مسكين) وغيره:إن الخلاف في البيع والأكل واحد. وقال الزيلعي: ينبغي أن يجوز بيعه بالإجماع لطهارته، وقوله: (غير طاف) أي يؤكلالسمك حال كونه غير طاف، وأما الطافي فلا يؤكل عندنا. وقال مالك والشافعي: لا بأس السمك الطافي؛ لأن ميتةالبحر حلال للحديث، ولنا قوله صلي الله عليه واله وسلم :(ما نضب عنه الماء فكلوا، وما طفأ فلا تأكلوا). ولا دليل لهما فيما روي؛ لأنالمراد بميتة البحر ما لفظه حتى يكون موته مضافا إلى البحر، ولا يتناول ما مات فيه بمرض أو نحوه، والطافي هوالذي مات في الماء حتف أنفه، فيعلو، ويظهر منقلبا على ظهره، فإن كان ظهره من فوق فليس بطاف، فيؤكل ما في بطنالطافي، وهو اسم فاعل من طفا الشيء فوق الماء يطفو طفوا إذا علا، والأصل في هذا أن ما عرف سبب موته كلفظالبحر أو بحبسه في مكان كالحظيرة الصغيرة بحيث يمكن أخذه من غير حيلة أو ابتلاع سمكة أو قتل طير الماء إياها أوإجماد الماء عليها حل أكلها؛ لأن سبب موتها معلوم، ولو ماتت من شدة حر الماء أو برده أو انحسر الماء عن بعضه ومات، روى هشام عن محمد: إن كان رأسه على الماء لا يؤكل، وإن كان ذنبه في الماء ورأسه انحسر عنه الماء يؤكل؛لأن خروج رأسه من الماء سبب لموته، فكان معلوما بخلاف خروج ذنبه، فحاصله أن الشرط فيه أن يعلم سبب موتهحتى لو أبان عضوا بضرب؛ فإنه يؤكل ويؤكل العضو، ملتقط من شروح (الكنز).
وَعَنْ جَابِرٍ رضي الله عنه انَّ رَسُوْلَ اللهِ صلي الله عليه واله وسلم قَالَ:(مَا أَلْقَى الْبَحْرُ أَوْ جَزَرَ عَنْهُ فَكُلُوهُ،وَمَا مَاتَ فِيهِ وَطَفَا فَلَا تَأْكُلُوهُ)، وَفِيْهِ يَحْيَى بْنُ سُلَيْمِ، أَخْرَجَ لَهُ الشَّيْخَانِ، فَهُوَ ثِقَةٌ، كَذَاقَالَ ابْنُ مَعِيْنٍ، وَقَالَ الشَّوْكَانِيُ: حَدِيْثُ جَابِرٍ : (مَا مِنْ دَابَّةٍ فِي الْبَحْرِ إِلَّا وَقَدْ ذَكَّاهَااللهُ لِبَنِيْ آدَمَ) فِي سَنَدِهِ ضُعْفٌ.
Jabir (may Allah be pleased with him) narrated that the Messenger of Allah (ﷺ) said: “Eat what the sea casts out or leaves behind; do not eat what dies in it and floats.” Yahya ibn Sulaym is in its chain, included by the two Shaykhs (Bukhari and Muslim), so he is reliable, as Ibn Ma’in said. Al-Shawkani said: Jabir’s hadith, “No creature in the sea but Allah has purified it for the children of Adam,” has weakness in its chain.
