بَابُ الْجِزْيَةِThe Jizyah (Poll Tax)

وَقَوْلِ اللهِ عَزَّ وَجَلَّ: ﴿ قٰتِلُواْ الَّذِينَ لَا يُؤْمِنُونَ بِاللهِ وَلَا بِلْيَوْمِ الْآخِرِوَلَا يُحْرِّمُونَ مَا حَرَّمَ آللّهُ وَرَسُولُهُ، وَلَا يَدِيئُونَ دِينَ الْحَقِّ مِنَ ١ الَّذِينَأُوتُواْ الْكِتَبَ حَقَّى يُعْطُواْ الْجِزْيَةَ عَن يَدِ وَهُمْ صَغِرُونَ﴾ وَقَوْلِهِتَعَالَى: ﴿قُل ٢ لِّلْمُخَلَّفِينَ مِنَ الْأَعْرَابِ سَتُدْعَوْنَ إِلَى قَوْمٍ أُوْلِى بَأَسٍ شَدِيدٍ تُقٰتِلُونَهُمْ أَوْ يُسْلِمُونَ فَإِن تُطِيعُواْ يُؤْتِكُمُ اللهُ أَجْرًا حَسَنَاًوَإِن تَتَوَلَّوْ كَمَا تَوَلَّيْتُم مِّن قَبْلُ يُعَذِّبْكُمْ عَذَابًا أَلِيمًا ٌ﴾

١ قوله: من الذين أوتوالكتاب: بيان لقوله: الذين لا يؤمنون بالله، والمعنى: توضع الجزية على الذي يعتقد كتابا منالكتب المنزلة كاليهودي؛ فإنه يعتقد التوراة والسامري؛ فإنه يعتقد الزبور والنصراني؛ فإنه يعتقد الإنجيل. التقطتهمن (التفسيرات الأحمدية) وشروح (الكنز).

٢ قوله: قل للمخالفين إلخ: قال في (التفسيرات الأحمدية): فيكون الآية دليلا على أن المرتدين ومشركي العرب لا يقبلمنهما الجزية صرَّح به المفسرون، وصاحب (الهداية) أيضًا؛ حيث قال في (باب كيفية القتال): وهذا في حق من يقبلمنه الجزية، ومن لا يقبل منه، كالمرتدين وعَبَدَة الأوثان من العرب لا فائدة في دعائهم إلى قبول الجزية؛ لأنه لا يقبلمنهم إلا الإسلام، قال الله تعالى: ﴿تُقَتِلُونَهُمْ أَوْ يُسْلِمُونٌّ﴾ (الفتح: ١٦). هذا لفظه.

English

Allah, the Exalted, says: “Fight those who do not believe in Allah or the Last Day, nor forbid what Allah and His Messenger have forbidden, nor follow the religion of truth, from among those given the Scripture,1 until they pay the jizyah willingly while they are humbled” [Qur’an 9:29].

And He says: “Say to those who remained behind 2 from the Bedouins: You will be called to fight a people of great might; you will fight them, or they will submit. If you obey, Allah will grant you a good reward, but if you turn away as you did before, He will punish you with a painful punishment” [Qur’an 48:16].

1 The statement: “From among those given the Scripture”: This clarifies “those who do not believe in Allah”, meaning the jizyah is imposed on those who believe in a revealed scripture, like Jews who believe in the Torah, Samaritans who believe in the Psalms, and Christians who believe in the Gospel. As in (At-Tafsir al-Ahmadiyyah) and (Sharh al-Kanz).

2 The statement: “Say to those who remained behind, etc.”: In (At-Tafsir al-Ahmadiyyah), this verse indicates that apostates and Arab idol-worshippers are not offered jizyah, as stated by exegetes and the author of (Al-Hidayah) in the chapter on fighting: This applies to those from whom jizyah is accepted. For those from whom it is not, like apostates and Arab idol-worshippers, there is no benefit in offering jizyah, as only Islam is accepted from them, per Allah’s saying: “You will fight them, or they will submit” [Qur’an 48:16].

وَعَنْ يَزِيْدَ بْنِ رومان وَعَبْد الله ابْن أَبِيْ بَكْرٍ أَنَّ رَسُوْلَ اللهِ صلي الله عليه واله وسلم بَعَثَخَالِدَ بْنَ الْوَليدِ إِلَى أُكَيْدِرِ بْنِ عَبْدِ الْمَلِكِ رَجُلٍ مِنْ كِنْدَةَ كَانَ مَلِكًا عَلَى دُوْمَةَ، وَكَانَنَصْرَانِيًّا، فَقَالَ رَسُوْلُ اللّهِ صلي الله عليه واله وسلم لخَالِدٍ: (إِنَّكَ سَتَجِدْهُ يَصِيْدُ الْبَقَرَ)، فَخَرَجَ خَالِدٌ حَتَّى إِذَاكَانَ مِنْ حِصْنِهِ مَنْظَرَ الْعَيْنِ وَفِي لَيْلَةٍ مُقْمِرَةٍ صَافِيَةٍ، وَهُوَ عَلَى سَطْحٍ، وَمَعَهُ امْرَأَتُهُ، فَأَتَتالْبَقَرُ تَحْكُ بِقُرُوْنِهَا بَابَ الْقَصَرِ، فَقَالَتْ لَهُ امْرَأَتُهُ: هَلْ رَأَيْتَ مِثْلَ هَذَا قَطُ؟ قَالَ: لَا وَاللهِ،قَالَتْ: فَمَنْ يَتْرُكُ مِثْلَ هَذَا؟ قَالَ: لَا أَحَدٌ، فَنزَلَ، فَأَمَرَ بِفَرَسِهِ فَأُسْرِجَ، وَرَكِبَ مَعَهُنَفَرٌ مِنْ أَهْلِ بَيْتِهِ فِيْهِمْ أَخٌّ لَهُ يُقَالُ لَهُ: حَسَّانُ، فَخَرَجُوْا مَعَهُ بِمَطَارِفِهِمْ، فَتَلَقَّاهُمْ خَيْلُرَسُوْلِ اللهِ صلي الله عليه واله وسلم فَأَخَذَتْهُ، وَقَتَلُوْا أَخَاهُ حَسَّانَ، وَكَانَ عَلَيْهِ قُبَاءُ دِيْبَاجٍ مُخوصِ بِالذّهَبِفَاسْتَلَبَّهُ إِيَّاهُ خَالِدُ بْنُ الْوَلِيْدِ، فَبَعَثَ بِهِ إِلَى رَسُوْلِ اللهِ صلي الله عليه واله وسلم قَبْلَ قُدُوْمِهِ عَلَيْهِ، ثُمَّ إِنَّخَالِدًا قَدِمَ بِالْأُكَيْدِرِ عَلَى رَسُوْلِ اللّهِ صلي الله عليه واله وسلم ، فَحَقَنَ لَهُ دَمَهُ، وَصَالحَهُ عَلَى الْجِزْيَةِ، وَخَلَّىسَبِيْلَهُ، فَرَجَعَ إِلَى قَرْيَتِهِ. رَوَاهُ الْبَيْهَقِيُّ فِي (السُّنَنِ الْكُبْرَى)، وَلأَّبِيْ دَاوُدَ عَنْ أَنَسِ رضى الله عنه أَقْصَرُ مِنْهُ.

English

Yazid ibn Ruman and Abdullah ibn Abi Bakr narrated: The Messenger of Allah (ﷺ) sent Khalid ibn al-Walid to Ukaydir ibn Abd al-Malik, a man from Kindah, king of Dumah, who was Christian. The Messenger of Allah (ﷺ) said to Khalid: “You will find him hunting cattle.” Khalid set out until he was within sight of his fortress on a clear, moonlit night. Ukaydir was on the roof with his wife. Cattle came rubbing their horns against the palace gate. His wife said: “Have you ever seen this before?” He said: “No, by Allah.” She said: “Who would let such a thing go?” He said: “No one.” He descended, ordered his horse saddled, and rode out with a group from his household, including his brother Hassan. The Messenger’s cavalry met them, captured Ukaydir, and killed his brother Hassan, who wore a gold-embroidered silk robe, which Khalid took as spoils and sent to the Messenger of Allah (ﷺ) before arriving. Khalid then brought Ukaydir to the Messenger of Allah (ﷺ), who spared his life, made a treaty for jizyah, and released him to return to his town. [Narrated by Al-Bayhaqi in (As-Sunan al-Kubra); Abu Dawud narrated a shorter version from Anas (may Allah be pleased with him)]

وَعَنْ عُمَرَ رضي الله عنه أَنَّهُ لَمْ يَأْخُذِ الْجِزْيَةَ مِنَ الْمَجُوْسِ، حَقَّى شَهِدَ عَبْدُ الرَّحْمَنِبْنُ عَوْفٍ أَنَّ رَسُوْلَ اللهِ صلي الله عليه واله وسلم أَخَذَهَا مِنْ مَجُوسِ هَجَرَ. رَوَاهُ أَحْمَدُ وَالْبُخَارِيُّ وَأَبُوْ دَاوُدَوَالتَّرْمِذِيُّ. وَفِي رِوَايَةٍ:(إِنَّ عُمَرَ ذَكَرَ الْمَجُوسَ، فَقَالَ: مَا أَدْرِيْ كَيْفَ أَصْنَعُ فِي أَمْرِهِمْ،فَقَالَ لَهُ عَبْدُ الرَّحْمَنِ بْنُ عَوْفٍ: أَشْهَدُ لَسَمِعْتُ رَسُولَ اللهِ صلي الله عليه واله وسلم يَقُولُ: (سُنُوا١ بِهِمْ سُنَّةًأَهْلِ الْكِتَابِ). رَوَاهُ الشَّافِعِيُّ.

وَهُوَ دَلِيْلٌ عَلَى أَنَّهُمْ لَيْسُوْا مِنْ أَهْلِ الْكِتَابِ، وَأَيْضًا عَلَى أَنَّ الْجِزْيَةَ تُؤْخَدُ مِنْ غَيْرِأَهْلِ الْكِتَابِ؛ لِكَوْنِهِمْ فِي مَعْنَاهُمْ، وَقَدْ رَوَى عَبْدُ الرَّزَّاقِ عَنِ ابْنِ جُرَيْجٍ قَالَ: قُلْتُلِعَطَاءِ: الْمَجُوْسُ أَهْلُالْكِتَابِ؟ قَالَ: لَا، وَقَالَ أَيَضًا: أَخْبَرَنَا مَعْمَرٌ قَالَ: سَمِعْتُ الزُّهْرِيَّسُئِلَ : أَتُؤْخَذُ الْجِزْيَةِ عَمَّنْ لَيْسَ مِنْ أَهْلِ الْكِتَابِ؟ قَالَ: نَعَمْ، أَخَذَهَا رَسُولُ اللَّهِ ﷺ مِنْأَهْلِ الْبَحْرَيْنِ وَعُمَرُ مِنْ أَهْلِ السّوَادِ وَعُثْمَانُ مِنْ بَرْبَر.

English

Umar (may Allah be pleased with him) did not take jizyah from the Magians until Abdur-Rahman ibn Awf testified that the Messenger of Allah (ﷺ) took it from the Magians of Hajar. [Narrated by Ahmad, Bukhari, Abu Dawud, and Tirmidhi] In another narration: Umar mentioned the Magians, saying: “I do not know what to do with them.” Abdur-Rahman ibn Awf said: “I testify I heard the Messenger of Allah (ﷺ) say: ‘Treat them as you treat the People of the Scripture.’” 1 [Narrated by Shafi‘i]

This is evidence that Magians are not People of the Scripture and that jizyah is taken from those beyond the People of the Scripture, as they resemble them. Abdur-Razzaq narrated from Ibn Jurayj, who said: I asked Ata, “Are the Magians People of the Scripture?” He said: “No.” Ma‘mar narrated: I heard Az-Zuhri asked, “Is jizyah taken from those not of the People of the Scripture?” He said: “Yes, the Messenger of Allah (ﷺ) took it from the people of Bahrain, Umar from the people of Sawad, and Uthman from the Berbers.”

1 The statement: “Treat them as you treat the People of the Scripture”: This refers to jizyah, proving Magians are not People of the Scripture, per Abu Hanifah and most jurists. Shafi‘i holds jizyah is specific to the People of the Scripture, considering Magians among them. He also narrated they were People of the Scripture but altered it, based on a weak report from Ali via Abu Sa‘id al-Baqqal. Most scholars reject this, citing: “Lest you say, ‘The Scripture was only sent to two groups before us’” [Qur’an 6:156], meaning Jews and Christians, and “O People of the Scripture, why do you argue about Ibrahim when the Torah and Gospel were not revealed until after him?” [Qur’an 3:65], and “O People of the Scripture, you have no basis until you uphold the Torah and Gospel” [Qur’an 5:68]. This shows the People of the Scripture are only Jews and Christians. As in (Al-Jawhar an-Naqi), (Rahmat al-Ummah), and (Sharh al-Kanz).

وَعَنْ الرُّهْرِيَّ أَنَّ١ النبِيّ صلي الله عليه واله وسلم صَالَحَ عَبَدَةَ الْأَوْثانِ عَلَى الْجِزْيَةٍ إِلَّا مَنْ كَانَمِنْهُمْ مِنَ الْعَرَبِ. رَوَاهُ عَبْدُ الرَّزَّاقِ.

وَرَوَى الْبَيْهَقِيُّ فِي هَذَا الْبَابِ مِنْ (السُّنَنِ الْكُبْرَى) حَدِيْثَ بُرَيْدَةً: (إِذَا لَقِيتَ عَدُوَّكَمِنَ الْمُشْرِكِينَ فَادْعُهُمْ إِلَى إِحْدَى ثَلَاثِ خِصَالٍ) الْحَدِيْثَ، وَفِيْهِ: (فَإِنْ هُمْ أَبَوْا فَادِعُهُمْإِلَى إِعْطَاءِ الْجِزْيَةِ)، وَقَالَ أَبُوْ عُمَرَ: فَحَدِيْثُ الزُّهْرِيِّ اسْتَثْنَى الْعَرَبَ مِنَ الْمُشْرِكِيْنَ. وَقَالَالْعَرَبِ إِلَّا الْإِسْلَامُ أَوْ السَّيْفُ)، وَيُؤَيِّدُهُ قَوْلُهُ تَعَالَى: ﴿تُقَاتِلُونَهُمْ أَوْ يُسْلِمُونَ﴾.

English

Ar-Ruhri narrated: The Prophet (ﷺ) made a treaty with idol-worshippers for jizyah, 1 except those among the Arabs. [Narrated by Abdur-Razzaq]

Al-Bayhaqi narrated in this chapter from (As-Sunan al-Kubra) the Hadith of Buraydah: “When you meet your enemy among the polytheists, invite them to one of three options,” including: “If they refuse, invite them to pay jizyah.” Abu Umar said: Az-Zuhri’s Hadith excludes Arab polytheists, stating for them: “Only Islam or the sword,” supported by Allah’s saying: “You will fight them, or they will submit” [Qur’an 48:16].

1 The statement: “The Prophet (ﷺ) made a treaty with idol-worshippers for jizyah, except those among the Arabs”: Imams agree jizyah is imposed on the People of the Scripture (Jews and Christians) and Magians, but not idol-worshippers generally. They differ on whether Magians are People of the Scripture or resemble them. Abu Hanifah, Malik, and Ahmad say they are not, but resemble them. Shafi‘i has two views. They also differ on whether jizyah is taken from those with no scripture or resemblance, like idol-worshippers among Arabs and non-Arabs. Abu Hanifah says it is taken from non-Arabs, not Arabs. Malik says it is taken from all disbelievers, Arab or not, except Quraysh polytheists. Shafi‘i and Ahmad (in his stronger narration) say jizyah is not accepted from idol-worshippers at all. Az-Zuhri’s Hadith and others are evidence against Shafi‘i for not allowing it from non-Magians or non-Scripture people, and against Malik for accepting it from Arab polytheists. وَعَنِ ابْنِ عَبَّاسِ رضي الله عنهما قَالَ: عَادَ رَسُوْلُ اللهِ صلي الله عليه واله وسلم أَبَا طَالِبٍ وَعِنْدَهُ نَاسٌّ مِنْقُرَيْشٍ وَعِنْدَ رَأْسِهِ مَقْعَدُ رَجُلٍ، فَلَمَّا رَآهُ أَبُوْ جَهْلٍ قَامَ فَجَلَسَ، فَقَالَ: ابْنُ أَخِيْكَ يَذْكُرُآلِهَتَنَا، فَقَالَ أَبُوْ طَالِبٍ: مَا شَأْنُ قَوْمِكَ يَشْكُونَكَ قَالَ: (يَا عَمِّ، أُرِيدُهُمْ عَلَى كَلِمَةٍ وَاحِدَةٍتَدِينُ لَهُمْ بِهَا الْعَرَبُ، وَتُؤَّدِّي إِلَيْهِمْ الْعَجَمُ الْجِزْيَةَ)، قَالَ: مَا هِيَ؟ قَالَ:(شَهَادَةُ أَنْ لَا إِلَهَ إِلَّاالله) فَقَامُوا فَقَالُوا: أَجَعَلَ الْآلِهَةَ إِلَهَا وَاحِدًا؟ قَالَ: وَنَزَلَ ﴿صَ وَاَلْقُرْءَانِ ذِى الذِّكْرِ﴾(صَ: ١) حَتّى إِذَا بَلَغَ ﴿إِنَّ هَذَا لَشَىْءٌ عُجَابٌ ﴾. رَوَاهُ الْبَيْهَقِيُّ فِي (السُّنَنِ).

وَرَوَى التّرْمِذِيُّ مِثْلَهُ، وَقَالَ: حَسَنٌ صَحِيْحٌ. وَقَالَ عُلَمَاؤُنَا: يُؤَيِّدُ مَذْهَبَنَا قَوْلَهُ صلي الله عليه واله وسلم فِي هَذَا الْحَدِيْثِ:(وَتُؤَدِّي إِلَيْهِمْ الْعَجَمُ الْجِزْيَةَ).

English

Ibn Abbas (may Allah be pleased with them both) narrated: The Messenger of Allah (ﷺ) visited Abu Talib while Quraysh men were with him, with a man’s seat by his head. When Abu Jahl saw him, he sat there. He said: “Your nephew insults our gods.” Abu Talib said: “What is wrong with your people complaining about you?” The Prophet (ﷺ) said: “O uncle, I want them to accept one word by which the Arabs will submit to them, and the non-Arabs will pay them jizyah.” He said: “What is it?” He said: “The testimony that there is no god but Allah.” They stood, saying: “Do you make the gods one god?” Then “Sad. By the Qur’an, full of reminder” [Qur’an 38:1] was revealed, up to “Indeed, this is a strange thing” [Qur’an 38:5]. [Narrated by Al-Bayhaqi in (As-Sunan)] Tirmidhi narrated similarly, saying: Hasan Sahih. Our scholars said: This supports our view with his saying (ﷺ): “The non-Arabs will pay them jizyah.”

وَعَنْ أَبِيْ عَوْنٍ مُحَمَّدِ بْنِ عُبَيْدِ اللهِ الثَّقَفِيِّ قَالَ: وَضَعَ ١ عُمَرُ بْنُ الْحَظّابِ فِيالْجِزْيَةِ عَلَى رُؤُوْسِ الرَّجَالِ عَلَى الْغَنِيِّ ثَمَانِيَةٌ وَأَرْبَعِيْنَ دِرْهَمًا، وَعَلَى الْمُتَوَسِّطِ أَرْبَعَةًوَعِشْرِيْنَ، وَعَلَى الْفَقِيْرِ٢ اثْنَا عَشَرَ دِرْهَمًا. رَوَاهُ ابْنُ أَبِيْ شَيْبَةَ وَالْبَيْهَقِيُّوَطُرُقُ إِسْنَادِهِ مُتَعَدَّدَةُ. وَقَالَ الشَّيْخُ ابْنُ الْهُمَامِ: وَقَدْ جَاءَ فِي بَعْضٍ طُرُقِهِ: وَعَلَى الْفَقِيْرِالْمُكْتَسِبِ اثْنَيْ عَشَرَ دِرْهَمَا، أَخْرَجَهُ الْبَيْهَقِيِّ، وَحَدِيْثُ الدَّيْنَارِ مَحْمُوْلُ عَلَى الصُّلْحِ.

Abu Awn Muhammad ibn Ubaydullah ath-Thaqafi narrated: Umar ibn al-Khattab imposed jizyah on men’s heads: 1 48 dirhams for the rich, 24 for the middle class, and 12 for the poor. 2 [Narrated by Ibn Abi Shaybah and Al-Bayhaqi with multiple chains] Shaykh Ibn al-Humam said: Some chains specify “the poor who earn,” as narrated by Al-Bayhaqi. 1 The statement: “Umar ibn al-Khattab imposed jizyah on men’s heads, etc.”: Regarding the amount of jizyah, Hanafis and Shafi‘is differ. Hanafis say jizyah is of two types: by agreement, set as agreed, as the Prophet (ﷺ) made a treaty with Najran for 2,000 garments, since the obligation is by consent, so it cannot exceed the agreement; or imposed by the leader after overpowering disbelievers, allowing them to keep their property, 48 dirhams yearly for the visibly rich (4 monthly), 24 for the middle class (2 monthly), and 12 for the poor who earn. Shafi‘i says one dinar or its equivalent for all, rich or poor, per the Prophet’s (ﷺ) saying to Mu‘adh: “Take a dinar or its equivalent in garments from every adult,” without distinction. Hanafis’ view is narrated from Umar, Uthman, and Ali, unopposed by Migrants or Ansar, making it a consensus. Jizyah is for protection, a substitute for fighting support, which varies with wealth, so its substitute does too. Shafi‘i’s narration is for a treaty, as it includes women, who are not subject to jizyah. As in (At-Tafsir al-Ahmadiyyah), (Badhl al-Majhud), and (Sharh al-Kanz).

2 The statement: “12 dirhams for the poor”: The poor here are those able to earn. Those unable to work are exempt from jizyah per Hanafis, as Ibn Zanjawaih narrated in (Kitab al-Amwal) from Abu Bakr al-Absi, from Silah ibn Zufar: Umar saw an elderly dhimmi begging and asked why. He said: “I have no wealth, yet jizyah is taken from me.” Umar said: “We have not been just; we took your youth, then impose jizyah.” He wrote to his governors not to take jizyah from the elderly. The reason is that land tax is not imposed on unproductive land, so too with head tax. Uthman ibn Hunayf, sent by Umar to Iraq’s Sawad, imposed jizyah only on workers. Shafi‘i says jizyah applies to non-workers too, per Mu‘adh’s Hadith: “Take from every adult, male or female.” Hanafis say this applies to treaties, as it mentions women, and excludes the blind and similar, as well as the non-working poor. As in (‘Umdat ar-Ri‘ayah), (Al-Mirqat), and (Fath al-Qadir).

وقال الشافعي: يضع على كل حالم دينارًا أو ما يعدل الدينار الغني والفقير في ذلك سواء؛ لقوله عليه السلام لمعاذ:(خذ من حالم دينارا أو عدله معافر) من غير فصل بين غني وفقير. ومذهبنا منقول عن عمر وعثمان وعلي ولم ينكرعليهم أحد من المهاجرين والأنصار، فصار إجماعًا، ولأن الجزية وجبت نصره للمقاتلة؛ لأنها وجبت بدلا عنالنصرة بالنفس والمال، والنصرة يتفاوت بكثرة المال وقلّته، فكذا ما هو بدله، وما رواه الشافعي فهو في مال وقع عليهالصلح بدليل وجوبه على الحالمة، ولا جزية عليهن. أخذته من (التفسيرات الأحمدية) و(بذل المجهود) وشروح (الكنز).

٢ قوله: وعلى الفقير اثنا عشر درهما: المراد بالفقير هو الذي يقدر على الكسب والعمل، وأما الذي لا يقدر علىالعمل فلا جزية عليه عندنا؛ لما روي ابن زنجويه في ((كتاب الأموال) عن أبي بكر العبسي صلة بن زفر قال: أبصرعمر شيخا كبير من أهل الذمة يسأل، فقال له: مالك؟ قال: ليس لي مال، وإن الجزية تؤخذ مني، فقال له عمر: ماأنصفناك، أكلنا شبيبتك، ثم نأخذ منك الجزية، ثم كتب إلى عُماله أن لا يأخذوا الجزية من شيخ كبير. والوجه فيه أنخراج الأرض لا يوظف على أرض لا طاقة لها، فكذا خراج الرأس. ويشهد له أن عثمان بن حنيف حين وجَّهه عمربن الخطاب إلى سواد العراق إنما وضع الجزية على المعتمل، ولم يثبت أنه وضعها على غير المعتمل.

وقال الشافعي: على غير المعتمل أيضًا الجزية في ذمته له إطلاق حديث معاذ، وهو قوله عليه السلام: (خذ من كل حالموحالمة). قلنا: حديث وضع الجزية على كل حالم وحالمة. فقد مر أنه محمول على الصلح بدليل ذكر الحالمة فيه علىأنه كما خص منه الأعمى ونحوه منه يخص الفقير الغير المعتمل،(عمدة الرعاية) و(المرقاة) و(فتح القدير) ملتقطمنها.

وَعَنِ ابْنِ عَبَّاس رضى ألله عنهما قَالَ: قَالَ رَسُوْلُ اللهِ صلي الله عليه واله وسلم : (لَا تَصْلَحُ ١ قِبْلَتَانِ فِيأَرْض وَاحِدَةٍ، وَلَيْسَ ٢ عَلَى مُسْلِمِ جِزْيَةً). رَوَاهُ أَحْمَدُ وَأَبُوْ دَاوُدَوَالتَّرْمِذِيُّ.

وَقَالَ أَبُوْ دَاوُدَ: سُئِلَ سُفْيَانُ الثَّوْرِيُّ عَنْ تَفْسِيْرِ هَذَا، فَقَالَ: إِذَا أَسْلَمَ فَلَا جِزْيَةَعَلَيْهِ. وَرَوَى الطَّبَرَانِيُّ فِي مُعْجَمِهِ الْأَوْسَطِ عَنِ ابْنِ عُمَرَ ها عَنِ النَّبِيِّ وَلِهِ قَالَ: (مَنْأَسْلَمَ فَلَا جِزْيَةَ عَلَيْهِ).

English

Ibn Abbas (may Allah be pleased with them both) narrated: The Messenger of Allah (ﷺ) said: “Two qiblahs cannot coexist in one land, 1 and no jizyah is on a Muslim.” 2 [Narrated by Ahmad, Abu Dawud, and Tirmidhi]

Abu Dawud said: Sufyan ath-Thawri was asked about its interpretation and said: “If he becomes Muslim, no jizyah is upon him.” At-Tabarani narrated in Al-Mu‘jam al-Awsat from Ibn Umar, from the Prophet (ﷺ): “Whoever becomes Muslim has no jizyah upon him.”

1 The statement: “Two qiblahs cannot coexist in one land”: Per (Fath al-Bari), this implies prohibition, meaning Muslims are forbidden from residing in the land of disbelief, or rulers are forbidden from allowing dhimmis to display disbelief’s symbols in Muslim lands. As in (Badhl al-Majhud). In (Al-Mirqat), Turbishti said: Two religions cannot coexist equally in one land. A Muslim must not choose to live among disbelievers, as this places him like a dhimmi among us, adopting the mark of those who pay jizyah, which is humiliation, while honor belongs to Allah, His Messenger, and the believers. A non-Muslim cannot reside in Muslim lands except by paying jizyah, and is not permitted to propagate his religion. Some say this Hadith refers to expelling Jews and Christians from the Arabian Peninsula. Ibn al-Malik said: A Muslim and disbeliever cannot live in one town, specific to the Arabian Peninsula.

2 The statement: “No jizyah is on a Muslim”: If a person under jizyah converts to Islam after the year’s term, jizyah is lifted, per: “Whoever becomes Muslim has no jizyah upon him.” Unlike slavery, which remains due to established rights, jizyah is specific. Shafi‘i and Malik (for death) say jizyah is a debt, not lifted by Islam or death, as it is compensation for protection and residence in Muslim lands, which persists. Hanafis cite the narration and argue jizyah is a penalty for disbelief or a substitute for fighting support, which ends with Islam or death, as penalties do not apply after these. Jizyah is a substitute for our protection, which a Muslim provides himself, and protection as a human persists for dhimmis, who own their residence, so no compensation is due for living in their own property. As in (Sharh al-Kanz), (Badhl al-Majhud), and (‘Inayah).

١ قوله: لا تصلح قبلتان في أرض واحدة: نقل في الحاشية عن (الفتح): الظاهر أنه نفي بمعنى النهي. والمراد نهيالمؤمن عن الإقامة بأرض الكفر أو نهي الحكام عن أن يمكنوا أهل الذمة من إظهار شعار الكفر في بلاد المسلمين.كذا في (بذل المجهود). وقال في (المرقاة): قال التوربشتي: أي لا يستقيم دينان بأرض على سبيل المظاهرةوالمعادلة، أما المسلم فليس له أن يختار الإقامة بين ظهراني قوم كفار؛ لأن المسلم إذا صنع ذلك. فقد أحل نفسهفيهم محل الذمي فينا، وليس له أن يجر إلى نفسه الصغار ويتوسم بسمة من ضرب عليه الجزية، وأنى له الصغار والذلة،ولله العزة ولرسوله وللمؤمنين، وأما الذي يخالف دينه دين الإسلام، فلا يمكن من الإقامة في بلاد الإسلام إلا ببذلالجزية، ثم لا يؤذن له في الإشاعة بدينه اھ. وقيل: هذا الحديث إشارة إلى إجلاء اليهود والنصارى من جزية العرب،قال ابن الملك: أي لا يجوز أن يسكن المسلم والكافر في بلدة واحدة. وهذا مختص بجزيرة العرب.

٢ قوله: وليس على المسلم جزية: أي لو أسلم من عليه الجزية بعد ما تمت السنة تسقط عنه الجزية؛ لقوله عليه السلام:(منأسلم فلا جزية عليه). وإنما لم يسقط الرق بالإسلام؛ لأنه تعلق به حق معين، فلا يبطل به وقيد بالجزية؛لأن الديون والخراج ولأجرة لا تسقط بالإسلام والموت اتفاقا. وقال الشافعي: لا تسقط الجزية بالإسلاموالموت؛ لأنها دَين، وبه قال مالك في الموت، ولأنها وجبت عوضا عن العصمة، وعن السكنى في دار الإسلام. وقدوصل إليه المعوض بنيل العصمة والسكنى، فلا يسقط عنه العوض بعارض. ولنا ما روينا، ولأنها عوض عن امتهانوجوده، وهو القتل؛ لأنها وجبت عقوبة على الكفر أو بدلا عن النصرة، ولا تبقى العقوبة على الكفر بعد الإسلام ولابعد الموت، ولأن شرع العقوبة في الدنيا لا يكون إلا لدفع الشر. وقد اندفع بالموت والإسلام، ولأنها وجبت بدلا عن النصرة في حقنا. وقد قدر عليها بنفسه بعد الإسلام والعصمة ثبت بكونه آدميا، والذمي يسكن ملك نفسه، فلامعنى لا يجاب بدل العصمة والسكنى، ومعناه أن الذمي يملك موضع السكنى بالشراء وغيره من الأسباب، فلا يجوزإيجاب البدل بسكناه في موضع مملوك له. أخذته من شروح (الكنز) و (بذل المجهود) و(العناية).

وَعَنْ زِيَادِ بْنِ جَدِيْرٍ قَالَ: بَعَثَنِيْ عُمَرُ بْنُ الخَطَّابِ رضي الله عنه إِلَى عَيْنِ التَّمَرِ مُصَدَّقًا فَأَمَرَنِي١ أَنْ آخُدَ مِنَ الْمُسْلِمِيْنَ مِنْ أَمْوَالِهِمْ إِذَا اخْتَلَفُوْا بِهَا لِلتَّجَارَةِ رُبْعَالْعُشْرِ، وَمَنْ أَمْوَالِ أَهْلِ الدِّمَّةِ نَصْفَ الْعُشْرِ، وَمَنْ أَمْوَالِ أَهْلِ الْحُرْبِ الْعُشْرَ. رَوَاهُ مُحَمَّدُبْنُ الْحَسَنِ في (كِتَابِ الْآَثَارِ) وَعَبْدُ الرَّزَّاقِ فِي مُصَنَّفِهِ. وَرَوَى الطَّبَرَانِيُّ فِي مُعْجَمِهِ الْوَسِطِنَحْوَهُ مَرْفُوْعًا.

وَقَالَ عَليُّ الْقَارِيْ رَحِمَهُ اللهُ الْبَارِيْ: حَدِيْثُ عُقْبَةَ بْنِ عَامِرٍ: إِنْ أَبَوْ٢ أَن لَا تَأْخُذُوْاكَرْهاً فَخُذُوْا كَانَ فِي بَدْءِ الْإِسْلَامِ، وَالْأَمْرُ بِأَخْذِ مِقْدَارِ الْقَرِيِّ مِنَ الْمَالِ الْمَنْزُوْلِ بِهِكَرْهَا كَانَ مِنْ جُمْلِةِ الْعُقُوْبَاتِ الَّتِيْ نُسِخَتْ بِوُجُوْبِ الزَّكَاةِ.

English

Ziyad ibn Jadir narrated: Umar ibn al-Khattab (may Allah be pleased with him) sent me to Ayn at-Tamr as a collector, ordering me 1 to take from Muslims’ trade wealth a quarter of a tenth, from dhimmis’ wealth half a tenth, and from the enemy’s wealth a full tenth. [Narrated by Muhammad ibn al-Hasan in (Kitab al-Athar) and Abdur-Razzaq in his Musannaf; At-Tabarani narrated similarly in Al-Mu‘jam al-Awsat, attributed to the Prophet]

Ali al-Qari (may Allah have mercy on him) said: The Hadith of Uqbah ibn Amir, “If they refuse, take it by force,” 2 was in early Islam. Taking the specified amount from transferred wealth by force was among punishments abrogated by the obligation of zakat.

1 The statement: “Ordering me to take from Muslims, etc.”: This is established in the Hanafi school for trade wealth: a tenth from the enemy, half a tenth from dhimmis, and a quarter of a tenth from Muslims, per conditions in (Kitab az-Zakat). This was narrated from Umar, who ordered his governors thus in the presence of Companions. What is taken from Muslims is zakat, spent on its recipients; from dhimmis, it is not zakat but spent on jizyah or kharaj recipients, as is wealth from the enemy, taken for protection. As in (Al-Binayah), (Al-Mirqat), and (‘Umdat ar-Ri‘ayah).

2 The statement: “If they refuse, take it by force”: In (Al-Mirqat), this was in early Islam when the Prophet (ﷺ) sent armies to battle, passing Arab tribes without markets or provisions, requiring their hospitality to avoid disrupting the campaign. When Islam grew strong and compassion prevailed, this obligation was abrogated, leaving it permissible and recommended.

٢ قوله: إن أبوا أن لا تأخذوا كرها فخذوا: قال في (المرقاة): هذا كان في بدء الإسلام فإنه صلي الله عليه واله وسلم كان يبعث الجيوشإلى الغزو، وكانوا يمرون في طريقهم بأحياء العرب ليس هناك سوق يشترون منه الطعام، ولا معهم زاد، فأوجبعليهم ضيافتهم؛ لئلا ينقطعوا عن الغزو، فلما قوي الإسلام وغلبت الشفقة والرحمة على الناس نسخ، الوجوب،وبقي الجواز والاستحباب.
