عَنْ أَبِيْ هُرَيْرَةَ رضي الله عنه قَالَ: قَالَ رَسُوْلُ اللهِ ﷺ: (مَا أُعْطِيكُمْ وَلَا أَمْنَعُكُمْ،أَنَا قَاسِمُ أَضَعُ حَيْثُ أُمِرْتُ). رَوَاهُ الْبُخَارِيُّ.

English

Abu Hurairah (may Allah be pleased with him) narrated: The Messenger of Allah (ﷺ) said: “I neither give you nor withhold from you; I am a distributor who places where I am commanded.” [Narrated by Bukhari]

وَعَنْ خَوْلَةَ الْأَنْصَارِيَّةَ رضي الله عنها قَالَتْ: قَالَ رَسُوْلُ اللهِ ﷺ: (إِنَّ١ رِجَالًايَتَخَوَّضُونَ فِي مَالِ اللهِ بِغَيْرِ حَقِّ فَلَهُمُ النَّارُ يَوْمَ الْقِيَامَةِ). رَوَاهُ الْبُخَارِيُّ.

English

Khawlah al-Ansariyyah (may Allah be pleased with her) narrated: The Messenger of Allah (ﷺ) said: “Indeed, some men misuse Allah’s wealth unlawfully, and for them is the Fire on the Day of Resurrection.” [Narrated by Bukhari]

English

Buraydah (may Allah be pleased with him) narrated: The Prophet (ﷺ) said: “Whomever we appoint to a task and provide with sustenance, whatever he takes beyond that is misappropriation.” [Narrated by Abu Dawud]

وَعَنْ مُعَاذٍ رضي الله عنه قَالَ بَعَثَني رَسُوْلُ اللهِ ﷺ إِلَى الْيَمَنِ فلَمَّا سرت ارسل في أُثَرِي فَرُدِدْتُ، فَقَالَ: (أَتَدْرِي لِمَ بَعَثْتُ إِلَيْكَ؟ لَا تُصِيبَنَّ١ شَيْئًا بِغَيْرٍ إِذْنِي؛ فَإِنَّهُ غُلُولُ،﴿وَمَن يَغْلُلْ يَأْتِ بِمَا غَلَّ يَوْمَ الْقِيَامَةِ﴾ لِهَذَا دَعَوْتُكَ فَامْضٍ لِعَمَلِكَ). رَوَاهُ التِّرْمِذِيُّ.

English

Mu‘adh (may Allah be pleased with him) narrated: The Messenger of Allah (ﷺ) sent me to Yemen. When I set out, he sent someone after me, and I was brought back. He said: “Do you know why I sent for you? Do not take anything without my permission, for that is misappropriation. And whoever misappropriates will come with what he misappropriated on the Day of Resurrection. This is why I called you. Now proceed to your task.” [Narrated by Tirmidhi]

This was contested in Al-Bahr with what the commentator mentioned from Tatarakhaniyyah and Al-Khaniyyah, that the leader and mufti may accept gifts and specific invitations. It then said: Unless the leader means the mosque imam, but for the leader as governor, gifts are not permissible, which aligns with the evidence, as he is the head of officials. In Al-Nahr, it is apparent that the task refers to authority from the leader or his deputy, like the collector or tithe-taker. I say: Similarly, village or guild leaders and those with authority over others, as gifts are given to them out of fear or favor-seeking. The difference between a mufti and a judge is clear: A judge is binding, a deputy of the Prophet, fulfilling the duty to enforce rulings, so, his gift is a bribe for the hoped-for ruling. and his judgment is invalid. A mufti is not so. It may be said: Their intent is that a gift to a mufti is permissible for his knowledge, not for aiding the giver. Compiled from Al-Mabsut, Ahmad al-Qadir, Radd al-Muhtar, and Al-Durr al-Mukhtar.

In Al-Alamgiriyyah: Regarding a judge’s invitation, Muhammad said in the principle: There is no harm in a judge accepting a general invitation, but not a specific one, as in Bukhariyyah. The correct view is: If the host would not hold it without the judge, it is specific one; if he would, it is general. No distinction was made for specific invitations from relatives or acquaintances before judgeship, whether held for the judge or not. Quduri said a judge accepts a specific invitation from close relatives, as did Shams al-A’immah al-Halwai in Sharh Adab al-Rahi.

Tahtawi said in his Mukhtasar: Per Abu Hanifah and Abu Yusuf, a judge accepts no specific invitation from relatives; per Muhammad, he does. Shams al-A’immah al-Sarkhasi and Shaykh al-Islam said: If the invitee never held invitations for the judge before judgeship, he accepts neither from relatives nor strangers. If he held them monthly before judgeship but weekly after, the judge accepts only monthly. If the invitee increased expenses after judgeship, the judge accepts only if the invitee’s wealth increased proportionally. This applies if the invitee has no dispute; if he does, the judge accepts no invitation, even with prior kinship or acquaintance, as in Al-Muhit.

For general invitations: If it is an innovation, like a competition, he must not attend, as it is impermissible for non-judges, more so for judges. If it is a Sunnah, like a wedding or circumcision feast, he attends, as it follows the Sunnah without suspicion, as in Al-Bada’i. In Al-Kifayah: The author of Al-Hidayah did not distinguish specific invitations by whether the inviter is a stranger or close relative. In the gift section, he said gifts are accepted only from close relatives, necessitating reconciliation. They said: The hospitality ruling applies if the relative’s invitation or gift-giving began after judgeship, making it like a stranger’s. The gift ruling applies if gift-giving occurred before judgeship due to kinship, so accepting post-judgeship is permissible, as stated by Shaykh al-Islam, known as Khwahir Zadah. In Shaykh al-Islam’s Mabsut: Unless the host is a litigant, the judge should not accept, even if general.

1 The statement: “Do not take anything without my permission” etc.: This alludes to the gifts of officials. Its detail is that accepting gifts is recommended in the Shariah. The Prophet (ﷺ) said: “What a good thing is a gift; when it enters the door, the threshold smiles.” He also said: “A gift removes the roughness or harshness of the heart.” And he said: “Exchange gifts, and you will love one another.” However, this applies to those not appointed to a public duty. As for those appointed, such as judges and governors, they must refrain from accepting gifts. In summary: If the giver has a dispute, the gift is not accepted, even if he has a habit of giving or is a close relative. If there is no dispute, but there is no habit of giving due to kinship or friendship, it should not be accepted. If there is a habit, it is permissible provided it does not exceed the usual amount before the appointment; any excess is not accepted. The basis for this is in Bukhari, from Abu Humayd al-Sa‘idi, who said: The Prophet (ﷺ) appointed a man from Azd, called Ibn al-Lutbiyyah, to collect charity. When he returned, he said: “This is for you, and this is for me.” The Prophet (ﷺ) said: “Why did he not sit in his father’s or mother’s house to see if he would be given anything?” Umar ibn Abd al-Aziz said: “In the time of the Messenger of Allah (ﷺ), a gift was a gift; today, it is a bribe,” as mentioned by Bukhari. When Umar appointed Abu Hurairah, and he returned with wealth, Umar asked: “Where did you get this?” He said: “Gifts accumulated.” Umar said: “O enemy of Allah! Why did you not stay in your house to see if you would be given anything?” He took it and placed it in the public treasury. The Prophet’s (ﷺ) reasoning indicates the prohibition of gifts caused by authority, as in Fath. In Al-Bahr, it is stated: Mentioning gifts is not restrictive, as borrowing or lending from those whose gifts are prohibited is also forbidden, as in Al-Khaniyyah. I say: This implies that all voluntary offerings are prohibited, including preferential transactions. If returning the gift causes distress, its equivalent value is given. If returning is impossible due to ignorance of the giver or distance, it is placed in the public treasury. Among the Prophet’s (ﷺ) unique privileges is that his gifts were for him, as in Tatarakhaniyyah, implying that the leader cannot accept gifts, or it would not be a privilege. It is permissible for the leader, mufti, and preacher to accept gifts, as they are given for knowledge, unlike judges.

الأصل في ذلك ما في (البخاري) عن أبي حميد الساعدي قال: استعمل النبي ﷺ رجلًا من الأزد يقال له: ابنللتبية على الصدقة، فلما قدِم قال: هذا لكم، وهذا لي، قال ﷺ:(هلا جلست في بيت أبيه أو بيت أمه فينظر أيهدى لهأم لا؟). قال عمر بن عبد العزيز: كانت الهدية على عهد رسول الله ﷺ هدية واليوم رشوة، ذكره البخاري، واستعملعمر أبا هريرة، فقدِم بمال، فقال له: من أين لك هذا؟ قال: تلاحقت الهدايا، فقال له عمر: أي عدو الله! هلا قعدت فيبيتك فتنظر أيهدى لك أم لا؟ فأخذ ذلك منه، وجعله في بيت المال. وتعليل النبي ﷺ دليل على تحريم الهدية التيسببها الولاية، (فتح).

قال في (البحر): وذكر الهدية ليس احتراز؛ إذ يحرم عليه الاستقراض والاستعارة ممن يحرم على قبول هديته، كمافي (الخانية) اهـ. قلت: ومقتضاه أنه يحرم عليه سائر التبرعات، فتحرم المحاباة أيضًا، ولو تأذى المهدي بالرد يعطيهمثل قيمتها، (خلاصة). ولو تعذر الرد لعدم معرفته أو بعد مكانه وضعها في بيت المال. ومن خصوصياته ﷺ أن هداياهله، (تتارخانية)، ومفاده أنه ليس للإمام قبول الهدية، وإلا لم تكن خصوصية، وفيها يجوز للإمام والمفتي والواعظقبول الهدية؛ لأنه إنما يهدى إلى العالم؛ لعلمه بخلاف القاضي.

واعترضه في (البحر) بما ذكره الشارح عن (التتارخانية) وبما في (الخانية) من أنه يجوز للإمام والمفتي قبولالهدية وإجابة الدعوة الخاصة، ثم قال: إلا أن يراد بالإمام إمام الجامع أي وأما الإمام بمعنى (الوالي) فلا تحل لهالهدية، فلا منافاة. وهذا هو المناسب للأدلة، ولأنه رأس العمال. قال في (النهر): والظاهر أن المراد بالعمل ولايةناشئة عن الإمام أو نائبه كالساعي والعاشر اهـ.قلت: ومثلهم مشايخ القرى والحرف وغيرهم ممن لهم قهر وتسلط على من دونهم؛ فإنه يهدي إليهم خوفامن شرهم أو ليروج عندهم. والفرق بين المفتي وبين القاضي واضح؛ فإن القاضي ملزم وخليفة عن رسول الله والكفاية فيتنفيذ الأحكام، فأخذه الهدية يكون رشوة على الحكم الذي يؤمله المهدي، ويلزم منه بطلان حكمه، والمفتي ليسكذلك. وقد يقال: إن مرادهم بجوازها للمفتي إذا كانت لعلمه لا لإعانته للمهدي. التقطته من (المبسوط) و(فتحالقدير) و (رد المحتار) و (الدر المختار)

وقال في (العالمكيرية): وأما الكلام في دعوة القاضي قال محمد بله في (الأصل): لا بأس للقاضي أن يجيبالدعوة العامة، ولا يجيب الدعوة الخاصة. كذا في (فتاوى قاضي خان). والصحيح أن المضيف لو علم أن القاضي لايحضرها لا يتخذها فهي خاصة، وإن كان يتخذها فهي عامة. كذا في (الكافي). ولم يفصل بين الدعوة الخاصة بينالقريب وبين الأجنبي؛، وكذا لم يفصل بينهما إذا كان بين القاضي وبين صاحب الدعوة مباسطة قبل القضاء، وكانيتخذ الدعوة لاجله أو لم يكن. وذكر القدوري أن القاضي يجيب الدعوة الخاصة في المحرم، وهكذا ذكر شمسالأئمة الحلوائي في (شرح أدب القاضي).

وذكر الطحاوي في مختصره أن على قول أبي حنيفة وأبي يوسف : لا يجيب الدعوة الخاصة من القريب، وعلىقول محمد: يجيب، وذكر شمس الأئمة السرخسي وشيخ الإسلام أن صاحب الدعوة إن كان ممن لا يتخذ الدعوةللقاضي قبل تقلد القضاء لا يجيب دعوة القريب والأجنبي فيه سواء، وإذا كان يتخذ الدعوة قبل القضاء في شهر مَرَّةٌوبعد القضاء في كل أسبوع مَرَّةً فالقاضي لا يجيب دعوته إلا في كل شهر مَرَّةً، وكذلك إذا كان صاحب الدعوة زاد فيالباجات بعد القضاء على ما كان قبل القضاء، فالقاضي لا يجيب الدعوة إلا أن يكون مال صاحب الدعوة قد ازداد،فبقدر ما إزداد من ماله ازداد في الباجات، فالقاضي يجيبه. وهذا كله إذا لم يكن لصاحب الدعوة خصومة، فأما إذاكان لصاحب الدعوة خصومة لا يجيب دعوته، وإن كان بينهما قرابة أو مباسطة قبل القضاء. كذا في (المحيط).

وأما الدعوة العامة، فإن كانت بدعة كدعوة المباراة ونحوها لا يحل له أن يحضرها؛ لأنه لا يحل لغير القاضيإجابتها، فالقاضي أولى، وإن كانت سنة كوليمة العرس والختان فإنه يجيبها؛ لأنه إجابة السنة، ولا تهمة فيه. كذا في (البدائع)، انتهى. وقال في (الكفاية): لم يفصل صاحب (الهداية) في الدعوة الخاصة بين أن يكون الداعي أجنبيا أو ذارحم محرم منه. وقال في (فصل الهدية): لا يقبل إلا من ذي رحم محرم منه، فلا بُدَّ من التأويل بين المسألتين، قالوا: ماذكر في الضيافة محمول على ما إذا كان ذا رحم محرم لم يجر بينهما الدعوة والمهاداة صلة للقراب،وإنما أحدث بعد القضاء، فإذا كانت الحالة هذه فهو والأجنبي سواء في هذا. وما ذكر في الهدية أنه يقبل من ذي رحممحرم فهو محمول على أنه كان جرى المهاداة قبل القضاء صلة للقرابة، فإذا أهدى إليه هدية بعد القضاء فلا بأسبالقبول، هكذا ذكر شيخ الإسلام المعروف بخواهر زاده . وفي (مبسوط) شيخِ الإسلام: إلا أن يكون المضيفخصما فينبغي أن لا يجيب دعوته، وإن كانت عامة.

وَعَنْ عَدِيِّ١ بْنِ عَمِيْرَةَ أَنَّ رَسُوْلَ اللهِ ﷺ قَالَ: (يَا أَيُّهَا النَّاسُ، مَنْ عُمَّلَمِنْكُمْ لَنَا عَلَى عَمَلٍ، فَكَتَمَنَا مِنْهُ مخْيَطًا فَمَا فَوْقَهُ فَهُوَ غُلَّ، يَأْتِي بِهِ يَوْمَ الْقِيَامَةِ). فَقَامَرَجُلٌ مِنَ الْأَنْصَارِ فَقَالَ: يَا رَسُولَ اللهِ، اقْبَلْ عَنِّي عَمَلَكَ، قَالَ: (وَمَا ذَاكَ؟) قَالَ: سَمِعْتُكَتَقُولُ كَذَا وَكَذَا، قَالَ:(وَأَنَا أَقُولُ ذَلِكَ: مَنْ اسْتَعْمَلْنَاهُ عَلَى عَمَلٍ فَلْيَأْتِ بِقَلِيلِهِ وَكَثِيرِهِ،فَمَا أُوتِيَ مِنْهُ أَخَذَهُ، وَمَا نُهِيَ عَنْهُ انْتَهَى). رَوَاهُمُسْلِمُ وَأَبُوْ دَاوُدَ وَاللَّفْظُ لَهُ.

English

Adi ibn Umairah narrated: The Messenger of Allah (ﷺ) said: “O people, whoever we appoint to a task among you and conceals from us even a needle or more, it is misappropriation, and he will come with it on the Day of Resurrection.” A man from the Ansar stood and said: “O Messenger of Allah, take back your task from me.” He said: “Why is that?” He said: “I heard you say such and such.” He said: “And I say that: Whoever we appoint to a task, let him bring its little and much. What he is given, he takes; what he is forbidden, he avoids.” [Narrated by Muslim and Abu Dawud, with the wording of the latter]

وَعَنِ الْمُسْتَوْرِدِ بْنِ شَدَّادٍ رضي الله عنه قَالَ: سَمِعْتُ النَّبِيَّ ﷺ يَقُوْلُ: (مَنْ كَانَ ٢ لَنَاعَامِلًا فَلْيَكْتَسِبْ زَوْجَةً، فَإِنْ لَمْ يَكُنْ لَهُ خَادِمٌ فَلْيَكْتَسِبْ خَادِمًا، فَإِنْ لَمْ يَكُنْ لَهُمَسْكَنُ فَلْيَكْتَسِبْ مَسْكَنًا). وَفِي رِوَايَةٍ: (مَنْ اتَّخَذَ غَيْرَ ذَلِكَ فَهُوَ غَالٌّ). رَوَاهُ أَبُوْ دَاوُدَ.

وَرَوَى الْبُخَارِيُّ عَنْ عَائِشَةَ رضي الله عنها قَالَتْ: لَمَّا اسْتُخْلِفَ أُبُو بَكْرِ الصِّدِّيقُ قَالَ: لَقَدْعَلِمَ قَوْي أَنَّ حِرْفَتِي لَمْ تَكُنْ تَعْجِزُ عَنْ مَؤُوْنَةٍ أَهْلِي، وَشُغِلْتُ بِأَمْرِ الْمُسْلِمِينَ،فَسَيَأْكُلُ آلُّ أَبِي بَكْرٍ مِنْ هَذَا الْمَالِ، وَيَخْتَرِفُ لِلْمُسْلِمِينَ فِيهِ. رَوَاءُ الْبُخَارِيُّ.

English

Mustawrid ibn Shaddad (may Allah be pleased with him) narrated: I heard the Prophet (ﷺ) say: “Whoever is an official for us, let him acquire a wife; if he has no servant, let him acquire a servant; if he has no dwelling, let him acquire a dwelling.” In another narration: “Whoever takes beyond that is a misappropriator.” [Narrated by Abu Dawud]

Aishah (may Allah be pleased with her) narrated: When Abu Bakr al-Siddiq was appointed Caliph, he said: “My people know my trade sufficed for my family’s needs, but I am occupied with the Muslims’ affairs. So, Abu Bakr’s family will eat from this wealth, and he will work for the Muslims in it.” [Narrated by Bukhari]

He takes sustenance only from the treasury of the region he serves, as he works for its people, so his sustenance is from their treasury, as in Al-Atabiyyah. Just as a judge’s sufficiency is from the public treasury, so is that of his dependents and aides, as in the public treasury. Muhammad did not report on taking sustenance on non-working days; later scholars differed, but the correct view is he takes, as in Tatarakhaniyyah.

A judge taking from the public treasury is not a hired worker but works for Allah, taking his right from Allah’s wealth. So too for jurists, scholars, and Quran teachers. It is reported that Abu Bakr took sustenance from the public treasury upon becoming Caliph, as did Umar and Ali. Uthman, being wealthy, served without taking, as in Al-Khulasah. The leader should provide generously for him and his dependents to prevent coveting people’s wealth. It is reported that the Messenger of Allah (ﷺ) appointed Utab ibn Usayd over Makkah, giving him four hundred dirhams annually. The Companions allotted Abu Bakr the same from the public treasury. Ali received a daily dish of stew and five hundred dirhams monthly, as in Al-Bada’i.

2 The statement: “Whoever is an official for us, let him acquire a wife” etc.: The author of Al-Hidayah said: If a judge is poor, it is preferable, or obligatory, to take his sufficiency. If wealthy, it is preferable to abstain from taking sustenance from the public treasury, to ease its burden. Some said taking is better to preserve the judgeship’s dignity and avoid dependency, benefiting future needy successors, taking only what suffices for him and his dependents, as in Umdat al-Qari. In Al-Alamgiriyyah: If a judge is poor and needy, he should, or must, take his sustenance from the public treasury. If wealthy, opinions vary, but preferably he does not take, as in Bukhari al-Qadi Khan.

٢ قوله: من كان لنا عاملا فليكتسب زوجة إلخ: وقال صاحب (الهداية): ثم إن القاضي إذا كان فقيرا فالأفضل، بلالواجب أخذ كفايته، وإن كان غنيا فالأفضل الامتناع عن أخذ الرزق من بيت المال؛ رفقا ببيت المال. وقيل: الأخذ هوالأصح؛ صيانة للقضاء عن الهوان ونظر المن، يولي بعده من المحتاجين، ويأخذ بقدر (الكفاية) له وليعاله. كذا في (عمدةالقاري). وقال في(العالمكيرية): إن كان القاضي فقيرا محتاجا الأولى أن يأخذ رزقه من بيت المال، بل يفترض عليه، فإنكان غنيا تكلموا فيه، والأولى أن لا يأخذ من بيت المال. كذا في (فتاوى قاضي خان).

ولا يأخذ الرزق إلا من بيت مال الكورة التي يعمل فيها؛ لأنه يعمل لأهل هذه الكورة، فيكون رزقه في مالبيت هذه الكورة. كذا في (العتابية). كما يجوز كفاية القاضي من بيت المال يجعل كفاية عياله ومن يمونه من أهلهوأعوانه في مال بيت المال، ولم ينقل عن محمد أن القاضي هليأخذ الرزق في يوم العطلة اختلف المتأخرون فيه،والصحيح أنه يأخذ. كذا في (التاتارخانية).

القاضي إذا كان يأخذ من بيت المال شيئًا لا يكون عاملا بالأجر، بل يكون عاملا للّه تعالى ويستوفي حقه من مال اللهتعالى، وكذا الفقهاء والعلماء والمعلمون الذين يعلمون القرآن. وروي أن أبا بكر، لما استخلف كان يأخذ الرزق من بيت المال، وكذا عمر وعلي ، وأما عثمان ، كان صاحب ثروة ويسار، فكان يحتسب، ولا يأخذ. كذا في (الخلاصة). ينبغي للإمام أن يوسع عليه وعلى عياله كيلا يطمع في أموال الناس. وروي أن رسول الله ﷺ لما بعثعتاب بن أسيد إلى مكة، وولَّاه أمرها، رزقه أربع مائة درهم في كل عام، وروي أن الصحابة أنه أجروا لأبي بكر مثل ذلك من بيت المال، وكان لعلي من بيت المال كل يوم قصعة من ثريد، وروي أن عليا ، فرض له خمس مائةدرهم في كل شهر. كذا في (البدائع).

وَعَنْ عَمْرِو بْنِ الْعَاصِ الله قَالَ: أَرْسَلَ إِلَيَّ رَسُولُ اللَّهِ ﷺ أَنْ أَجْمَعَ عَلَيْكَسِلَحَكَ وَثِيَابَكَ ثُمَّ أُتِنِي). قَالَ: فَأَتَيْتُهُ وَهُوَ يَتَوَضَّأُ، فَقَالَ: (يَا عَمْرُوَ، إِنِّيْ أَرْسَلَتُ إِلَيْكَلِأَبْعَنَكَ فِي وَجْهِ لِيُسَلِّمَكَ اللهُ وَيُغْنِمَكَ، وَأَرْعَبُ لَكَ رَعْبَةً مِنَ الْمَالِ). فَقُلْتُ: يَا رَسُوْلَاللهِ، مَا كَانَتْ هِجْرَتِيُّ لِلْمَالِ، وَمَا كَانَتْ إِلَّا لِلَّهِ وَلِرَسُوْلِهِ، قَالَ: (نِعِمَّا بِالْمَالِ الصَّالِحِ لِلرَّجُلِالصَّالِحِ). رَوَاهُ فِي (شَرْح السُّنَّةِ).

وَرَوَى أَحْمَدُ نَحْوَهُ، وَفِي رَوَايَتِهِ قَالَ: (نِعْمَ الْمَالُ الصَّالِحُ لِلرَّجُلِ الصَّالِحِ).

English

Amr ibn al-As narrated: The Messenger of Allah (ﷺ) sent for me, saying: “Gather your weapons and clothes, then come to me.” I came while he was performing ablution. He said: “O Amr, I am sending you on a mission, that Allah may grant you safety and spoils. I hope for you a good share of wealth.” I said: “O Messenger of Allah, my migration was not for wealth, but for Allah and His Messenger.” He said: “How excellent is righteous wealth for a righteous man.” [Narrated in Sharh al-Sunnah]

Ahmad narrated similarly, and in his narration: “How excellent is righteous wealth for a righteous man.”

وَعَنْ عَبْدِ اللهِ بَّنِ عَمْرٍو رضي الله عنَهُمَا قَالَ: لَعَنَ ١ رَسُوْلُ اللّهِ ﷺ الرَّاشِيْوَالْمُرْتَشِيُّ. رَوَاهُ أَبُوْ دَاوُدَ وَابْنُ مَاجَه.

وَرَوَاهُ التَّرْمِذِيُّ مِنْهُ وَعَنْ أَبِيُّ هُرَيْرَةً. وَرَوَاهُ أَحْمَدُ وَالْبَيْهَقِيُّ فِي (شُعَبِ الْإِيْمَانِ) عَنْثَوْبَانَ، وَزَادَ: (وَالرَّائِشُ) يَعْنِيْ الَّذِيْ يَمْشِيْ بَيْنَهُمَا.

English

Abdullah ibn Amr (may Allah be pleased with them both) narrated: The Messenger of Allah (ﷺ) cursed the briber and the bribed. [Narrated by Abu Dawud and Ibn Majah]

Tirmidhi narrated it from him and Abu Hurairah. Ahmad and Bayhaqi in Shu‘ab al-Iman narrated it from Thawban, adding: “And the intermediary,” meaning the one who facilitates between them.

Another type is giving wealth to someone to facilitate matters with the ruler, in two cases. First: If the need is unlawful, neither giving nor taking is permissible. Second: If the need is permissible, it has two aspects. First: If the gift is explicitly conditioned on aiding with the ruler, taking is impermissible. Is giving permissible? Scholars differed; some said no, others yes. The solution for permissibility is for the needy to hire the person for a day to act with his knowledge for the wealth intended, making the contract valid, and the worker earns the wage. The hirer may use him for this or another task. This solution works only if the task is valid for hiring, like delivering a message. If no duration is specified, it is invalid, as in Al-Khulasah. Is giving permissible without this solution? Opinions differ; some say no, others yes, the latter being sounder. If given after resolving the matter and averting oppression, both giving and taking are permissible, as in Muhit al-Sarakhsi and Bukhari al-Qadi Khan.

Second: If not explicitly conditioned but given to aid with the ruler, most scholars say it is not disliked if there was no prior gift-giving for any reason. If there was prior gift-giving due to friendship or kinship, and he gives as before, and the receiver aids, this is good, as it is repaying kindness with kindness and matching generosity. Another type is giving to a ruler to secure judgeship or another post, which is impermissible for both giver and taker, as in Al-Muhit.

1 The statement: “The Messenger of Allah cursed the briber and the bribed”: In Al-Alamgiriyyah: A gift is given without conditions, while a bribe is wealth given with a condition to aid. As in Khazanat al-Muftin. It also states: Bribery has types. One is giving wealth to seek affection and love, which is permissible for giver and receiver. Another is giving wealth due to fear from someone, to avert harm, or to a ruler to avert oppression from oneself or one’s wealth. This type is impermissible to take, falling under the warning in this chapter. Is it permissible for the giver to give? Most scholars say it is, as he uses his wealth to protect himself or part of it to save the rest.

1 Regarding the saying: And call to witness two witnesses, etc.: The conclusion is that for zina, four male witnesses are required by consensus, based on His saying, Exalted is He: Then call to witness four of you against them [An-Nisa: 15] and His saying: But if they do not bring four witnesses [An-Nur: 4]. For other hudud and qisas, the testimony of two men alone is accepted by consensus, based on al-Zuhri’s statement: The Sunnah from the Messenger of Allah (ﷺ) and the two caliphs after him was that women’s testimony is not accepted in hudud and qisas, so the default is considered, which is the testimony of two men only. For matters other than hudud and qisas, if it is something men can witness, the testimony of two men or one man and two women is accepted, whether it concerns wealth or otherwise, according to us. According to al-Shafi‘i, if it concerns wealth or its derivatives like sales, purchases, option conditions, terms, rentals, loans, and the like, the testimony of two men or one man and two women is accepted. If it is not wealth-related, like marriage and the like, only the testimony of two men is accepted. If it is something men cannot witness, like childbirth and similar matters, the testimony of one woman is accepted according to us, and four women according to al-Shafi‘i, with their evidence detailed in extended texts.

2 Regarding the saying: Be persistently standing firm in justice, witnesses for Allah, even if it be against yourselves, etc.: The author of al-Madarik said: Testifying against oneself is confession, as it has the same effect as testifying against oneself by establishing the right. This is because a claim, testimony, and confession all share in reporting a right of one against another, except that a claim is reporting one’s own right against another, confession is for another against oneself, and testimony is for another against another, as per his words. In summary, the verse is evidence for the legality of confession and the permissibility of testifying to the detriment of parents and relatives, which is well-known. The verse may also indicate that testimony is for Allah, not for show or reputation or self-benefit, so it can be used to argue that the testimony of a partner in a partnership’s wealth, a worker for his employer, a student for his teacher, a parent for his child, and the like is not permissible, as it comes to mind, gathered from Tafsir al-Ahmadiyya.

١ قوله: لعن رسول الله كثيرً الراشي والمرتشي: وقال في (العالمكيرية): الهدية ما يعطيه، ولا يكون معه شرط.والرشوة مال يعطيه بشرط أن يعينه. كذا في (خزانة المفتين). وفيه أيضًا: واعلم أن الرشوة أنواع، منها: أن يهديالرجل إلى رجل مالا لابتغاء التودُّد والتحبُّب. وهذا النوع حلال من جانب المهدي والمهدى إليه. ونوع منها: أنيهدي إلى الرجل مالا بسبب أن ذلك الرجل قد خوفه، فيهدي إليه مالا؛ ليدفع الخوف عن نفسه، أو يهدي إلىالسلطان مالا ليدفع ظلمه عن نفسه أو عن ماله. وهذا نوع لا يحل الأخذ لأحد، وإذا أخذ يدخل تحت الوعيدالمذكور في هذا الباب، وهل يحل للمعطي الإعطاء؟ عامة المشايخ على أنه يحل؛ لأنه يجعل ماله؛ وقاية لنفسه، أويجعل بعض ماله وقاية الباقي.

ونوع منها: أن يهدي الرجل إلى رجل مالا؛ ليسوي أمره في ما بينه وبين السلطان يعينه في حاجته، وأنه علىوجهين، الوجه الأول: أن يكون حاجته حراما، وفي هذا الوجه لا يحل للمهدي الإعطاء ولا للمهدى إليه الأخذ.الوجه الثاني: أن يكون حاجته مباحا، وأنه على وجهين أيضا: الأول: إن يشترط أنه إنما يهدي إليه؛ ليعينه عندالسلطان، وفي هذا الوجه لا يحل لأحد الأخذ. وهل يحل للمعطي الإعطاء؟ تكلموا فيه، منهم من قال: لا يحل،ومنهم من قال: يحل. والحيلة في حل الأخذ وحل الإعطاء عند الكل أن يستأجره صاحب الحادثة يوما إلى الليل ليقومبعلمه بالمال الذي يريد الدفع إليه، فيصحُّ الإجارة، ويستحق الأجير الأجر.

الوجه الثاني: إذا لم يشترط ذلك صريحا، ولكن إنما يهدي إليه ليعينه عند السلطان. وفي هذا الوجه اختلفالمشايخوعامتهم على أنه لا يكره هذا إذا لم يكن بينهما مهاداة قبل ذلك بسبب من الأسباب، وأما إذا كان بينهمامهاداة قبل ذلك بسبب صداقة أو قرابة فأهدى إليه كما كان يهدي قبل ذلك، ثم إن المهدي إليه قام لإصلاح أمره،فهذا أمر حسن؛ لأنه مجازاة الإحسان بالإحسان، ومقابلة بالكرم نوع آخر أن يهدي الرجل إلى سلطان فيقلد القضاء لهأو عملا آخر. وهذا النوع لا يحل للآخذ الأخذ ولا للمعطي الإعطاء. كذا في (المحيط).

١ قوله: واستشهدوا شهيدين إلخ: فالحاصل أن في الزنا يجب شهادة أربعة من الرجال بالاتفاق؛ لقوله تعالى:﴿فَأَسْتَشْهِدُواْ عَلَيْهِنَّ أَرْبَعَةَ مِنكُمَّ﴾ (النساء: ١٥) ولقوله تعالى: ﴿ثُمَّ لَمْ يَأْتُواْ بِأَرْبَعَةِ شُهَدَآءَ﴾ (النور: ٤)، وفي غيرالزنا من الحدود والقصاص تقبل فيها شهادة رجلين فحسب بالاتفاق؛ لقول الزهري: مضت السنة عن رسول اللهﷺ والخليفتين من بعده أن لا شهادة للنساء في الحدود والقصاص، فيعتبر ما هو الأصل، وهو شهادة رجلين فقط،وفي غير الحدود والقصاص إن كان مما يطلع عليه الرجل يقبل شهادة رجلين أو رجل وامرأتين، سواء كان مالًا أو غيرمال عندنا. وعند الشافعي إن كان مالًا أو توابعه كالبيع والشراء وشرط الخيار والأجل والإجارة والإعارة وأمثالهيقبل شهادة رجلين أو رجل وامرأتين، وإن لم يكن مالًا كالنكاح وأمثاله لا يقبل إلا شهادة رجلين فقط، وإن كان ممالا يطلع عليه الرجال كالولادة ونحوها يقبل فيه شهادة امرأة واحدة عندنا، وأربعة منهن عند الشافعي، ودلائلهامذكورة في المطولات.

ثم للشهادة شروط، منها: الإسلام والعدالَّة، وهما المذكوران في الآية، أما الأول فلقوله تعالى: ﴿مِنرِجَالِكُمْ﴾ (البقرة: ٢٨٢)؛ إذ معناه من أهل ملتكم، وهم أهل الإسلام. كذا في التفاسير. وهذا القول لا يصحُّ دليلاللشافعي ومالك فيما ذَهَبًا إليه أنه يشترط إسلام الشهود في جميع الباب، حتى لا يسمع شهادة الكفار بعضهم علىبعض؛ لأنه إنما ذكر ذلك في مقابة المسلمين مع المسلمين كما يشير إليه قوله تعالى: ﴿إِذَا تَدَايَنتُمْ﴾ (البقرة: ٢٨٢)وقوله تعالى: ﴿وَلْيَكْتُبِ بَّيْنَكُمْ﴾ (البقرة: ٢٨٢)، ولهذا حكم أبو حنيفة بأنه يشترط إسلام الشهود فيما إذا كانعلى المسلمين، فلا يسمع شهادة الكفار إلا على الكفار خاصة.

وأما الثاني، ففي قوله: ﴿مِمَّن تَرْضَوْنَ مِنَ الشَّهَدَآءِ﴾ (البقرة: ٢٨٢)؛ إذ المرضي المطلق هو العدل، فكأنه قيل: ممن تعرفون عدالتهم، وتعتمدون على صلاحهم، فينغي أن يكون عادلا، وبه تمسك صاحب (الهداية) في (بابالشهادة)، ولكن قد صرَّح في (باب القضاء): أنه لا ينبغي أن يقبل القاضي شهادة الفاسق ولو قبل جاز عندنا. وقالالشافعي: الفاسق لا يقبل شهادته أصلًا ولعله، ولهذا المعنى قال صاحب (المدارك): وفيه دليل على أن غير المرضيشاهد؛ لأن مفهوم الآية استشهدوا شهيدين من الشهداء الذين ترضون منهم، فعلم أن من الشهداء من لا ترضونمنهم؛ لعلمكم بعدم عدالتهم، فيكون الشاهد أعم من أن يكون عادلا أو لاوأما البواقي من الشروط وهل الحرية والبلوغ والضبط ولفظ الشهادة فسيعرف في مواضعها، ويمكن أن يثبتشرطية الضبط من قوله تعالى: ﴿أَن تَضِلَّ إِحْدَنُهُمَا فَتُذَكِّرَ إِحْدَنُهُمَا الْأَخْرَىَّ﴾ (البقرة: ٢٨٢)، وهكذا اشتراط لفظ الشهادةيمكن أن يثبت من هذه الآية ومن جميع ما ذكر فيها بيان الشهادة، كما صرَّح به صاحب (الهداية)؛ حيث قال: وأما لفظالشهادة فلأن النصوص نطقت باشتراطها؛ إذ الأمر فيها بهذا اللفظ، حتى لو لم يذكر لفظ الشهادة، بل قال: (أعلم) أو (أتقن)لم يقبل شهادته، هذا لفظه. وكذا على ما ذكر في (الحسيني) من أن معنى قوله تعالى: ﴿مِن رِّجَالِكُمْ﴾ (البقرة: ٢٨٢): منرجال المسلمين الأحرار البالغين، ويمكن أن يثبت به شرط الحرية والبلوغ أيضًا من الآية كما لا يخفى.

وقوله تعالى: ﴿وَلَا يَأْبَ الشُّهَدَآءُ إِذَا مَا دُعُوَأْ﴾ (البقرة: ٢٨٢) يحتمل معنيين، أحدهما: أن يكون معناه لا يأبالشهداء لاداء الشهادة بعد ما تحملوا أولا إذا ما دعوا إلى مجلس الحكم، فيكون ذلك بمعنى (الأمر للوجوب). وثانيهما:أن لا يأب الشهداء لتحمل الشهادة، فسموا شهداء باسم ما يؤول، فيكون ذلك بمعنى الأمر للندب، أو(يكونمنسوخًا) بقوله تعالى: ﴿وَلَا يُضَآرَّ كَّاتِبٌ وَلَا شَهِيدٌ﴾ (البقرة: ٢٨٢). وفي (الكشاف): عن قتادة كان الرجل يطوف فيالجداء: أي المجمع العظيم فيه القوم، فلا يتبعه منهم واحد، فنزلت. وصاحب (الهداية) قد جزم بالمعنى الأول حيثقال في أول (كتاب الشهادة): إن الشهادة فرض يلزم الشهود، ولا يسعهم كتمانها إذا طالبهم المدعي؛ لقوله تعالى: ﴿وَلَايَأْبَ الشُّهَدَآءُ إِذَا مَا دُعُواْ﴾ (البقرة: ٢٨٢)، ولكن ينبغي أن يعلم أن هذا في غير الحدود. وأما الشهادة في الحدود فيتخيرفيها الشاهد بين الستر والإظهار، بل الستر أفضل؛ لقوله :(من ستر على مسلم ستر الله تعالى عليه في الدنياوالآخرة). ولكن في السرقة يجب أن يشهد بالمال، فيقول: أَخَذَ المالَ؛ إحياءً لحقوق المسروق منه، ولا يقول: سرق؛محافظة على الستر، ملخص من (التفسيرات الأحمدية).

١قوله: كونوا قوامين بالقسط شهداء لله ولو على أنفسكم إلخ: وقال صاحب (المدارك):والشهادة على نفسه هيالإقرار على نفسه؛ لأنه في معنى الشهادة عليها بإلزام الحق. وهذا لأن الدعوى والشهادة والإقرار يشترك جميعها فيالإخبار عن حق لأحد على أحد، غير أن الدعوى إخبارعن حق نفسه على الغير، والإقرار للغير على نفسه، والشهادةللغير على الغير، هذا كلامه. وبالجملة فالآية دليل على شرعية مسألة الإقرار، وجواز الشهادة على ضرر الوالدينوالأقربين. وهذا معروف. وقد يدل الآية أيضًا على كون الشهادة للّه لا للرياء والسمعة ولا لنفع نفسه، فيستدل بهعلى أن شهادة الشريك في مال الشركة والأجير لمستأجره والتلميذ لأستاذه، وكذا الوالد لولده وأمثاله كل ذلك لايجوز، هكذا يخطر بالبال، ملتقط من (التفسيرات الأحمدية).
