بَابُ الْأَقْضِيَةِ وَالشَّهَادَاتِJudgments and Testimonies

وَقَوْلِ اللهِ عَزَّ وَجَلَّ: ﴿وَأَسْتَشْهِدُ وأ١ شَهِيدَيْنِ مِن رِّجَالِكُمّ فَإِن لَّمْيَكُونَا رَجُلَيْنِ فَرَجُلٌ وَأَمْرَأَتَانٍ مِمَّن تَرْضَوْنَ مِنَ الشُّهَدَآءِ أَنْ تَضِلَإِحْدَنُهُمَا فَتُذَكِّرَ إِحْدَنَهُمَا الْأُخْرَىَّ وَلَا يَأْبَ الشُّهَدَاءُ إِذَا مَا دُعُوَّأْ﴾وَقَوْلِهِ تَعَالَى: ﴿ يَأَيُّهَا الَّذِينَ ءَامَنُواْ كُونُواْ١ قَوَّمِينَ بِالْقِسْطِ شُهَدَآءَلِلْهِ وَلَوْ عَلَىْ أَنْفُسِكُمْ أَوِ الْوَلِدَيْنِ وَالْأَقْرَبِينَّ إِن يَكُنْ غَنِيًّا أَوْ فَقِيرًافَاللَّهُ أَوْلَى بِهِمَاً فَلَا تَتَّبِعُواْ الْهَوَىّ أَن تَعْدِلُواْ وَإِن تَلْوُرَأْ أَوْ تُعْرِضُواْفَإِنَّ اللهَ كَانَ بِمَا تَعْمَلُونَ خَبِيرًا﴾ وَقَوْلِهِ تَعَالَى: ﴿إِنَّ الَّذِينَيَشْتَرُونَ بِعَهْدِ اللّهِ وَأَيْمَنِهِمْ ثَمَنَا قَلِيلًا أُوْلَتَبِكَ لَا خَلَقَ لَهُمْ فِىاَلْآَخِرَةِ وَلَا يُكَّلِّمُهُمُ اللّهُ وَلَا يَنْظُرُ إِلَيْهِمْ يَوْمَ اٌلْقِيَمَةِ وَلَا يُزَكِّيهِمْوَلَهُمْ عَذَابُّ أَلِيمٌ ٌ﴾

١ قوله: واستشهدوا شهيدين إلخ: فالحاصل أن في الزنا يجب شهادة أربعة من الرجال بالاتفاق؛ لقوله تعالى:﴿فَأَسْتَشْهِدُواْ عَلَيْهِنَّ أَرْبَعَةَ مِنكُمَّ﴾ (النساء: ١٥) ولقوله تعالى: ﴿ثُمَّ لَمْ يَأْتُواْ بِأَرْبَعَةِ شُهَدَآءَ﴾ (النور: ٤)، وفي غيرالزنا من الحدود والقصاص تقبل فيها شهادة رجلين فحسب بالاتفاق؛ لقول الزهري: مضت السنة عن رسول اللهﷺ والخليفتين من بعده أن لا شهادة للنساء في الحدود والقصاص، فيعتبر ما هو الأصل، وهو شهادة رجلين فقط،وفي غير الحدود والقصاص إن كان مما يطلع عليه الرجل يقبل شهادة رجلين أو رجل وامرأتين، سواء كان مالًا أو غيرمال عندنا. وعند الشافعي إن كان مالًا أو توابعه كالبيع والشراء وشرط الخيار والأجل والإجارة والإعارة وأمثالهيقبل شهادة رجلين أو رجل وامرأتين، وإن لم يكن مالًا كالنكاح وأمثاله لا يقبل إلا شهادة رجلين فقط، وإن كان ممالا يطلع عليه الرجال كالولادة ونحوها يقبل فيه شهادة امرأة واحدة عندنا، وأربعة منهن عند الشافعي، ودلائلهامذكورة في المطولات.

ثم للشهادة شروط، منها: الإسلام والعدالَّة، وهما المذكوران في الآية، أما الأول فلقوله تعالى: ﴿مِنرِجَالِكُمْ﴾ (البقرة: ٢٨٢)؛ إذ معناه من أهل ملتكم، وهم أهل الإسلام. كذا في التفاسير. وهذا القول لا يصحُّ دليلاللشافعي ومالك فيما ذَهَبًا إليه أنه يشترط إسلام الشهود في جميع الباب، حتى لا يسمع شهادة الكفار بعضهم علىبعض؛ لأنه إنما ذكر ذلك في مقابة المسلمين مع المسلمين كما يشير إليه قوله تعالى: ﴿إِذَا تَدَايَنتُمْ﴾ (البقرة: ٢٨٢)وقوله تعالى: ﴿وَلْيَكْتُبِ بَّيْنَكُمْ﴾ (البقرة: ٢٨٢)، ولهذا حكم أبو حنيفة بأنه يشترط إسلام الشهود فيما إذا كانعلى المسلمين، فلا يسمع شهادة الكفار إلا على الكفار خاصة.

وأما الثاني، ففي قوله: ﴿مِمَّن تَرْضَوْنَ مِنَ الشَّهَدَآءِ﴾ (البقرة: ٢٨٢)؛ إذ المرضي المطلق هو العدل، فكأنه قيل: ممن تعرفون عدالتهم، وتعتمدون على صلاحهم، فينغي أن يكون عادلا، وبه تمسك صاحب (الهداية) في (بابالشهادة)، ولكن قد صرَّح في (باب القضاء): أنه لا ينبغي أن يقبل القاضي شهادة الفاسق ولو قبل جاز عندنا. وقالالشافعي: الفاسق لا يقبل شهادته أصلًا ولعله، ولهذا المعنى قال صاحب (المدارك): وفيه دليل على أن غير المرضيشاهد؛ لأن مفهوم الآية استشهدوا شهيدين من الشهداء الذين ترضون منهم، فعلم أن من الشهداء من لا ترضونمنهم؛ لعلمكم بعدم عدالتهم، فيكون الشاهد أعم من أن يكون عادلا أو لاوأما البواقي من الشروط وهل الحرية والبلوغ والضبط ولفظ الشهادة فسيعرف في مواضعها، ويمكن أن يثبتشرطية الضبط من قوله تعالى: ﴿أَن تَضِلَّ إِحْدَنُهُمَا فَتُذَكِّرَ إِحْدَنُهُمَا الْأَخْرَىَّ﴾ (البقرة: ٢٨٢)، وهكذا اشتراط لفظ الشهادةيمكن أن يثبت من هذه الآية ومن جميع ما ذكر فيها بيان الشهادة، كما صرَّح به صاحب (الهداية)؛ حيث قال: وأما لفظالشهادة فلأن النصوص نطقت باشتراطها؛ إذ الأمر فيها بهذا اللفظ، حتى لو لم يذكر لفظ الشهادة، بل قال: (أعلم) أو (أتقن)لم يقبل شهادته، هذا لفظه. وكذا على ما ذكر في (الحسيني) من أن معنى قوله تعالى: ﴿مِن رِّجَالِكُمْ﴾ (البقرة: ٢٨٢): منرجال المسلمين الأحرار البالغين، ويمكن أن يثبت به شرط الحرية والبلوغ أيضًا من الآية كما لا يخفى.

وقوله تعالى: ﴿وَلَا يَأْبَ الشُّهَدَآءُ إِذَا مَا دُعُوَأْ﴾ (البقرة: ٢٨٢) يحتمل معنيين، أحدهما: أن يكون معناه لا يأبالشهداء لاداء الشهادة بعد ما تحملوا أولا إذا ما دعوا إلى مجلس الحكم، فيكون ذلك بمعنى (الأمر للوجوب). وثانيهما:أن لا يأب الشهداء لتحمل الشهادة، فسموا شهداء باسم ما يؤول، فيكون ذلك بمعنى الأمر للندب، أو(يكونمنسوخًا) بقوله تعالى: ﴿وَلَا يُضَآرَّ كَّاتِبٌ وَلَا شَهِيدٌ﴾ (البقرة: ٢٨٢). وفي (الكشاف): عن قتادة كان الرجل يطوف فيالجداء: أي المجمع العظيم فيه القوم، فلا يتبعه منهم واحد، فنزلت. وصاحب (الهداية) قد جزم بالمعنى الأول حيثقال في أول (كتاب الشهادة): إن الشهادة فرض يلزم الشهود، ولا يسعهم كتمانها إذا طالبهم المدعي؛ لقوله تعالى: ﴿وَلَايَأْبَ الشُّهَدَآءُ إِذَا مَا دُعُواْ﴾ (البقرة: ٢٨٢)، ولكن ينبغي أن يعلم أن هذا في غير الحدود. وأما الشهادة في الحدود فيتخيرفيها الشاهد بين الستر والإظهار، بل الستر أفضل؛ لقوله :(من ستر على مسلم ستر الله تعالى عليه في الدنياوالآخرة). ولكن في السرقة يجب أن يشهد بالمال، فيقول: أَخَذَ المالَ؛ إحياءً لحقوق المسروق منه، ولا يقول: سرق؛محافظة على الستر، ملخص من (التفسيرات الأحمدية).

١قوله: كونوا قوامين بالقسط شهداء لله ولو على أنفسكم إلخ: وقال صاحب (المدارك):والشهادة على نفسه هيالإقرار على نفسه؛ لأنه في معنى الشهادة عليها بإلزام الحق. وهذا لأن الدعوى والشهادة والإقرار يشترك جميعها فيالإخبار عن حق لأحد على أحد، غير أن الدعوى إخبارعن حق نفسه على الغير، والإقرار للغير على نفسه، والشهادةللغير على الغير، هذا كلامه. وبالجملة فالآية دليل على شرعية مسألة الإقرار، وجواز الشهادة على ضرر الوالدينوالأقربين. وهذا معروف. وقد يدل الآية أيضًا على كون الشهادة للّه لا للرياء والسمعة ولا لنفع نفسه، فيستدل بهعلى أن شهادة الشريك في مال الشركة والأجير لمستأجره والتلميذ لأستاذه، وكذا الوالد لولده وأمثاله كل ذلك لايجوز، هكذا يخطر بالبال، ملتقط من (التفسيرات الأحمدية).

And the saying of Allah, the Mighty and Majestic: "And call to witness 1 two witnesses from among your men; and if there are not two men, then a man and two women of such as you approve as witnesses, so that if one of the two errs, the other may remind her; and let the witnesses not refuse when they are called" (Al-Baqarah: 282); and His saying, the Exalted: "O you who believe, be 1 steadfast maintainers of justice, witnesses for Allah, though it be against yourselves or your parents and near relatives; whether one be rich or poor, Allah is nearer to both. So do not follow desire, lest you swerve; and if you distort or turn away, then indeed Allah is aware of what you do" (An-Nisa: 135); and His saying, the Exalted: "Indeed, those who sell the covenant of Allah and their oaths for a small price will have no share in the Hereafter, and Allah will not speak to them nor look at them on the Day of Resurrection, nor will He purify them; and for them is a painful punishment" (Aal Imran: 77).

1 His saying "and call to witness two witnesses", to the end: the upshot is that in zina the testimony of four men is required by agreement, because of His saying, the Exalted: "then call four of you to witness against them" (An-Nisa: 15) and His saying: "then they have not produced four witnesses" (An-Nur: 4). In the hudud other than zina, and in retaliation, only the testimony of two men is accepted, by agreement, because of the saying of al-Zuhri: the Sunnah has passed from the Messenger of Allah ﷺ and the two caliphs after him that women have no testimony in the hudud and retaliation; so what is the root is observed, namely the testimony of two men only. In matters other than the hudud and retaliation, if it is something to which men have access, the testimony of two men, or of one man and two women, is accepted, whether it concerns property or other than property, with us. With al-Shafi'i: if it concerns property or its adjuncts, such as sale and purchase, the stipulation of option, the term, hiring, lending and their like, the testimony of two men or of one man and two women is accepted; and if it does not concern property, such as marriage and its like, only the testimony of two men is accepted. If it is something to which men have no access, such as childbirth and the like, the testimony of a single woman is accepted with us, and of four women with al-Shafi'i; their proofs are set out in the longer works.

Then testimony has conditions, among them Islam and probity, both mentioned in the verse. As for the first, it is from His saying, the Exalted, "from among your men" (Al-Baqarah: 282), whose meaning is: from the people of your religion, and they are the people of Islam; so it is in the commentaries. This wording is not sound as a proof for al-Shafi'i and Malik in their position that the Islam of the witnesses is stipulated in the entire chapter, so that the testimony of unbelievers even against one another is not heard; for it was mentioned only in the case of Muslims with Muslims, as is indicated by His saying, the Exalted, "when you contract a debt among yourselves" (Al-Baqarah: 282) and His saying, "and let a scribe write it between you" (Al-Baqarah: 282). For this reason Abu Hanifa ruled that the Islam of the witnesses is stipulated when the testimony is against Muslims, so the testimony of unbelievers is heard only against unbelievers in particular.

As for the second, it is in His saying, "of such as you approve as witnesses" (Al-Baqarah: 282), since the one approved absolutely is the upright; it is as if it were said: of those whose probity you know and on whose righteousness you rely. So the witness ought to be upright, and by this the author of al-Hidaya held fast in the chapter of testimony; yet he stated plainly in the chapter of judgeship that the judge ought not to accept the testimony of the corrupt, though if he accepted it, it would pass with us. Al-Shafi'i said: the testimony of the corrupt is not accepted at all. For this meaning the author of al-Madarik said: in it is a proof that one not approved is still a witness, for the purport of the verse is: call to witness two of the witnesses whom you approve; so it is known that among the witnesses are those whom you do not approve, through your knowledge of their want of probity; the witness is thus more general than being upright or not.

As for the remaining conditions, such as freedom, majority, retentiveness, and the word "testimony", they will be known in their places. The stipulation of retentiveness may be established from His saying, the Exalted, "so that if one of the two errs, the other may remind her" (Al-Baqarah: 282); likewise the stipulation of the word of testimony may be established from this verse, since everything mentioned in it is a statement of testimony, as the author of al-Hidaya stated plainly where he said: as for the word of testimony, the texts have spoken with its stipulation, since the command in them is by this word; so that if one did not utter the word of testimony but said "I know" or "I am certain", his testimony is not accepted; this is his wording. Likewise, according to what is mentioned in al-Husayni, the meaning of His saying, the Exalted, "from among your men" (Al-Baqarah: 282) is: from the men of the Muslims, free and of age; so the conditions of freedom and majority may also be established from the verse, as is not hidden.

And His saying, the Exalted, "and let the witnesses not refuse when they are called" (Al-Baqarah: 282) bears two meanings. The first: that the witnesses must not refuse to deliver testimony, after having first taken it on, when they are summoned to the session of judgement; so it is a command of obligation. The second: that they must not refuse to take on testimony, being called witnesses by the name of what they will become; so it is a command of recommendation, or it is abrogated by His saying, the Exalted, "and let neither scribe nor witness be harmed" (Al-Baqarah: 282). In al-Kashshaf, from Qatada: a man would go about in a great gathering of people, and not one of them would follow him, so it was sent down. The author of al-Hidaya held decisively to the first meaning where he said at the opening of the book of testimony: testimony is an obligation binding on the witnesses, and it is not open to them to conceal it when the claimant demands it of them, because of His saying, the Exalted, "and let the witnesses not refuse when they are called" (Al-Baqarah: 282). But it should be known that this concerns matters other than the hudud; in the hudud the witness may choose between concealment and disclosure, and concealment is better, because of his saying ﷺ: "whoever covers a Muslim, Allah will cover him in this world and the Hereafter". In theft, however, he must testify to the property, saying "he took the property", to give life to the rights of the one robbed, and he does not say "he stole", out of care for concealment. 1 His saying "be steadfast maintainers of justice, witnesses for Allah, though it be against yourselves", to the end: the author of al-Madarik said: testimony against oneself is confession against oneself, for it has the sense of testimony against it in making the right binding. This is because claim, testimony and confession all share in being reports of a right of one party against another; only that claim is a report of one's own right against another, confession is for another against oneself, and testimony is for another against another; this is his wording. In sum, the verse is a proof for the legitimacy of confession and for the permissibility of testimony to the detriment of parents and near relatives, and this is well known. The verse may also indicate that testimony is for Allah, not for show and repute nor for one's own benefit; so it is used as proof that the testimony of a partner concerning the partnership property, of a hireling for his employer, of a pupil for his teacher, and likewise of a father for his son and their like, none of that is permitted; thus it comes to mind, gathered from al-Tafsirat al-Ahmadiyya.

عَنِ ابْنِ عَبَّاسِ رضي الله عنهما عَنِ النَّبِيِّ ﷺ قَالَ: (لَوْ يُعْطَى النَّاسُ بِدَعْوَاهُمْ لَادَّعَىنَاسُّ دِمَاءَ رِجَالٍ وَأَمْوَالَهُمْ، وَلَكِنَّ الْيَمِينَ عَلَى الْمُدَّعَى عَلَيْهِ). رَوَاهُ مُسْلِمُ.

وَفِي شَرْحِهِ لِلنَّوَوَيِ: أَنَّهُ قَالَ: وَجَاءَ فِي رِوَايَةِ الْبَيْهَقِيِّ بِإِسْنَادٍ حَسَنٍ أَوْ صَحِيْجِ زِيَادَةٌعَنِ ابْنِ عَبَّاسِ رضي الله عنهما مَرْفُوْعًا: (لَكِنَّ١ الْبَيْنَةَ عَلَى الْمُدَّعِيَّ وَالْيَمِيْنُ عَلَى مَنْ أَنْكَرَ). وَقَالَمُحَمَّدُ بْنُ الْحَسَنِ فِي (الْآثَارِ): وَبِهِ نَأْخُذُ.

وَرَوَى التَّرْمِذِيُّ بِإِسْنَادٍ جَيِّدٍ عَنْ عَمْرِو بْنِ شُعَيْبٍ عَنْ أَبِيْهِ عَنْ عَبْدٍ أَنَّ الَّنبِيَّﷺ قَالَ:(الْبَيِّنَةُ عَلَى الْمُدَّعِي وَالْيَمِيْنُ عَلَى الْمُدَّعَى عَلَيْهِ).

فَقَسَّمَ ١ النَّبِيُّ ﷺ بَيْنَ الْخَصْمَيْنِ، فَجَعَلَ الْنبَيِّ ﷺعَلَى الْمُدَّعِيْ وَالْيَمِيْنَ عَلَى مَنْأَنْكَرَ، وَالْقِسْمَةُ تُنَافِيُ الشَّرْكَةَ، وَجَعَلَ جِنْسَ الْأَيْمَانِ عَلَى الْمُنْكِرِيْنَ، وَلَيْسَ وَرَاءَالْجِئْسِ شَيْءُّ. وَحَدِيْث: (الشَّاهِدُ وَالْيَمِيْنُ) غَرِيْبُ، وَمَا رَوَيْنَاهُ مَشْهُوْرٌ، تَلَقَّتْهُ الْأُمَّةُبِالْقُبُوْلِ حَقَّى صَارَ فِي حِيَزَ التَّوَاثُرِ فَلَا يُعَارِضُهُ عَلَى أَنْ يَحْتِى بْنَ مَعِيْنٍ قَدْ رَدَّهُ.

وَرَوَى مُحَمَّدُ بْنُ الْحَسَنِ فِي (الْآثَارِ) عَنْ إِبْرَاهِيْمَ أَنَّهُ قَالَ: الْبَيِّنَةُ عَلَى الْمُدَّعِي وَالْيَمِينُعَلَى الْمُدَّعَى عَلَيْهِ، وَكَانَ لَا يَرُدُّ الْيَمِيْنَ.

Ibn Abbas (may Allah be pleased with them) narrated from the Prophet (ﷺ): If people were given based on their claims, some would claim the blood and wealth of others. But the oath is upon the defendant. [Narrated by Muslim]

In al-Nawawi’s commentary, he said: In al-Bayhaqi’s narration with a good or authentic chain, there is an addition from Ibn Abbas (may Allah be pleased with them), raised to the Prophet: But the proof is upon the claimant, and the oath is upon the one who denies. Muhammad ibn al-Hasan said in al-Athar: And we take it as such.

Al-Tirmidhi narrated with a good chain from Amr ibn Shu‘ayb, from his father, from his grandfather, that the Prophet (ﷺ) said: The proof is upon the claimant, and the oath is upon the defendant.

The Prophet (ﷺ) divided between the two disputants, placing the proof on the claimant and the oath on the one who denies. This division negates partnership. He made the genus of oaths for the deniers, and there is nothing beyond the genus. The hadith: The witness and the oath is strange, while what we narrated is well-known, accepted by the ummah with certainty, reaching the level of tawatur, so it is not opposed. Moreover, Yahya ibn Ma‘in rejected it.

Muhammad ibn al-Hasan narrated in al-Athar from Ibrahim, who said: The proof is upon the claimant, and the oath is upon the defendant, and he did not reject the oath.

There are two issues where al-Shafi‘i differs. First: If the defendant refuses the oath, we rule against him based on his refusal, and he is liable for what was claimed. According to al-Shafi‘i, it is not ruled upon, but the oath is returned to the claimant. If the claimant swears, he takes the property; if he refuses, the dispute ends, as refusal may be due to avoiding a false oath or refraining from a true oath. Our view is that the oath is obligatory on him, as per this hadith’s apparent meaning. Refusing the oath through this refusal indicates he is liable or confessing, as if he were not, he would take the oath to fulfill the obligation and avoid harm by paying the claim. The Sharia obliges avoiding a false oath, not refraining from a true oath, so his refusal leans toward this.

Second: We do not permit judging with one witness and the claimant’s oath, unlike al-Shafi‘i, who relied on Ibn Abbas’s hadith, raised: He judged with one witness and an oath, narrated by Muslim, Abu Dawud, al-Nasa’i, Ibn Majah, and al-Hakim via Qays ibn Sa‘d from Amr ibn Dinar from him. The Imam relied on His saying, Exalted is He: And call to witness two witnesses from among your men. And if there are not two men, then a man and two women [Al-Baqarah: 282], as this restricts the ruling to it, and because He said: That you may not doubt [Al-Baqarah: 282], with no addition beyond the minimum, meaning it is closer to avoiding doubt in the debt’s type, amount, term, witnesses, and the like. The mentioned hadith was responded to by Abbas al-Duri, who narrated from Yahya ibn Ma‘in that it is not preserved. Al-Tahawi criticized it, saying it is not known that Qays narrated from Amr ibn Dinar. Al-Tirmidhi said in al-‘Ilal: I asked Muhammad about this hadith, and he said: He did not hear it from Amr from Ibn Abbas. The hadith was accused of discontinuity in two places: by al-Bukhari between Amr and Ibn Abbas, and by al-Tahawi between Qays and Amr. Some inserted Tawus between Amr and Ibn Abbas, as narrated by al-Daraqutni. Others added Jabir ibn Zayd. Thus, Ibn Abd al-Barr’s statement: There is no criticism of this hadith’s chain, is debatable. Due to this disagreement, acting upon it was abandoned, and the apparent text of the Quran was followed, along with narrations opposing it. In al-Istidhkar: Hisham narrated from al-Mughira from al-Sha‘bi, who said: The people of Madinah judge with an oath and a witness, but we do not say that. In Musannaf Ibn Abi Shayba: Swayd ibn Amr narrated from Abu Awanah from Mughira from Ibrahim and al-Sha‘bi about a man with one witness and his oath, they said: It is not permissible except with two men or one man and two women. Amir said: Even though the people of Madinah accept one witness with the claimant’s oath. This chain’s narrators meet Muslim’s conditions. He also said: Hammad ibn Khalid narrated from Ibn Abi Dhi’b from al-Zuhri, who said: It is an innovation, and Muawiya was the first to judge by it. This chain also meets Muslim’s conditions. In Musannaf Abd al-Razzaq: Ma‘mar narrated: I asked al-Zuhri about the oath with a witness, and he said: This is something people innovated; two witnesses are required. In al-Istidhkar: This is the most well-known from al-Zuhri. In al-Tamhid: Abu Hanifa, his companions, al-Thawri, al-Awza‘i, Ata, al-Hakam, and a group said: Do not judge with an oath and a witness. Al-Istidhkar added al-Nakha‘i. In al-Muhalla by Ibn Hazm: Abd al-Malik ibn Marwan was the first to judge by it, and al-Hukm ibn Utayba criticized it. It was narrated that Umar ibn Abd al-Aziz abandoned judging by it, as he found the people of Sham opposed it, and Ibn Shubruma prohibited it. In al-Tamhid: Yahya ibn Yahya abandoned it in Andalusia, claiming he did not see al-Layth ibn Sa‘d issue a fatwa for it or hold it. The hadith in the Sahihayn: The oath is upon the defendant, and in a narration: The proof is upon the claimant, and the oath is upon the one who denies, supports this, as does the hadith in the Sahihayn: Your two witnesses or his oath, with the Quran’s apparent meaning, as Allah obligated accepting one man and two women in the absence of two men. If one witness exists and the two women are absent, accepting it with an oath negates what the verse requires. Also, Allah said afterward: From those whom you accept as witnesses [Al-Baqarah: 282], and the claimant with one witness is not among those accepted to establish his claim with his word and oath. They claimed the claimant’s oath substitutes for the two women, so if the claimant were a non-Muslim and presented a witness, his oath should not be accepted, as if the two women were non-Muslims. As stated in Uqud al-Jawahir al-Munifa. In al-Kawkab al-Durri: The claimant’s single witness is not considered, and the ruling is by the denier’s oath. This is the meaning of the hadith’s wording: The Messenger of Allah (ﷺ) judged with an oath and a witness, meaning he ruled only by the oath despite one witness, due to the incomplete testimony requirement. Its margin states: An action does not outweigh a statement, especially when the statement is supported by the noble Quran in His saying: And call to witness two witnesses from among your men [Al-Baqarah: 282]. Al-Bukhari elaborated in support of the Hanafis, so refer to it.

If the oath is returned to the claimant, it does not place all oaths on the deniers, which would abrogate the well-known hadith, which is not permissible by a single narration or analogy. وفي مسألتين خلاف الشافعي. الأولى: إذا نكل المدعى عليه عن اليمين، قضى عندنا بالنكول عليه، ولزمه ماادَّعاه عليه. وعند الشافعي لا يقضى به، بل يرد اليمين على المدعي، فإن حلف المدعي أخذ المال، وإن نكل انقطعتالخصومة بينهما؛ لأن النكول يحتمهل أن يكون تورّعا عن اليمين الكاذبة. ويحتمل أن يكون ترفعا عن اليمين الصادقة.ولنا أن اليمين واجبة عليه؛ لظاهر هذا الحديث، وترك اليمين بهذا النكول دليل على أنه باذل أو مقر؛ إذ لو لم يكنكذلك لاقدم على اليمين تفصيا من عهدة الواجب؛ دفعا للضرر عن نفسه ببذل المدعي، والشرع ألزمه التورع عناليمين الكاذبة دون الترفع عن اليمين الصادقة، فيرجع هذا الجانب نكوله.

الثانية: لا يجوز القضاء عندنا بشاهد مع يمين المدعي خلافًا للشافعي، واحتج بحديث ابن عباس رفعه:(قضى بشاهد ويمين)، أخرجه مسلم وأبو داود والنسائي وابن ماجه والحاكم من طريق قيس بن سعد عن عمرو بندينار عنه. والإمام احتج بقوله تعالى: ﴿وَأَسْتَشْهِدُواْ شَهِيدَيْنِ مِن رِّجَالِكُمْ فَإِن لَّمْ يَكُونَا رَجُلَيْنِ فَرَجُلٌوَأَمْرَأْتَانٍ﴾ (البقرة: ٢٨٢)، ومثل هذا إنما يذكر لقصر الحكم عليه، ولأنه قال ذلك: ﴿وَأَذْنَىّ أَلَا تَرْتَابُوَأَ﴾، ولا مزيد علىالأدنى، أي أقرب أن لا تشكّوا في جنس الدَّين وقدره وأجله والشهود ونحو ذلك. وأجيب عن الحديث المذكور بأنعباسا الدوري نقل عن يحيى بن معين أنه ليس بمحفوظ. وأعله الطحاوي بأنه لا يعلم قيسا يحدّث عن عمرو بندينار. وقال الترمذي في (العلل): سألت محمدا عن هذا الحديث، فقال: لم يسمعه من عمرو عن ابن عباس. فقد رمىالحديث بالانقطاع في موضعين من البخاري بين عمرو وابن عباس، ومن الطحاوي بين قيس وعمرو، ومنهم منأدخل بين عمرو وابن عباس طاوسا، أخرجه هكذا الدار قطني.

ومنهم من زاد جابر بن زيد فقول ابن عبد البر: (لا مطعن لأحد في إسناد هذا الحديث) محل نظر، فلأجل هذاالاختلاف ترك العمل به، وبقي العمل بالنص الظاهر من الكتاب مع أنه قد روي ما يعارض ما ذكر.؟ ففي(الاستذكار): روى هشيم أخبرنا المغيرة عن الشعبي قال: إن أهل المدينة يقضون باليمين مع الشاهد، ونحن لانقول ذلك. وفي (مصنف ابن أبي شيبة): حدثنا سويد بن عمرو حدثنا أبو عوانة عن مغيرة عن إبراهيم والشعبي فيالرجل يكون له الشاهد مع يمينه قالا: لا يجوز إلا شهادة الرجلين أو رجل وامرأتين. قال عامر: مع أن أهل المدينةيقبلون شهادة الشاهد مع يمين الطالب. وهذا السند رجاله على شرط مسلم. وقال أيضًا: حدثنا حماد بن خالد عنابن أبي ذئب عن الزهري، قال: هي بدعة، وأول من قضى بها معاوية. وهذا السند أيضًا على شرط مسلم. وفي (مصنف عبد الرزق): أخبرنا معمر سألت الزهري عن اليمين مع الشاهد، فقال: هذا شيء أحدثه الناس لا بُدَّ منشاهدين. وفي (الاستذكار): هو الأشهر عن الزهري.

وفي (التمهيد): قال أبو حنيفة وأصحابه والثوري والأوزاعي: لا يقضى باليمين مع الشاهد، وهو قول عطاءوالحاكم وطائفة، وزاد في (الاستذكار) النخعي. وفي (المحلى) لابن حزم: أول من قضى به عبد الملك بن مروان،وأشار إلى إنكاره الحكم بن عتيبة، وروي عن عمر بن عبد العزير ترك القضاء به؛ لأنه وجد أهل الشام على خلافه،ومنع منه ابن شبرمة، انتهى، وفي (التمهيد): تركه يحيى بن يحيى بالأندلس، وزعم أنه لم ير الليث بن سعد يفتي به،ولا يذهب إليه. وحديث الصحيحين: (اليمين على المدعى عليه) وفي رواية: (البيئة على المدعي واليمين على منأنكرها يردده وكذا حديث الصحيحين (شاهداك اويمينه )مع ظاهر القرأن لانه تعالي اوجب عند عدم الرجلين قبول رجل وامرأتين، وإذا وجد شاهد واحد، والمرأتان معدومتان، ففي قبوله مع اليمين نفي ما اقتضته الآية. وأيضًا قنيهتعالى قال عقبها: ﴿مِمَّن تَرْضَوْنَ مِنَ الشُّهَدَاءِ﴾ (البقرة: ٢٨٢)، وليس المدعي بشاهد واحد ممن يرضى باستحقاق مايدعيه بقوله: ويمينه، وزعموا أن يمين المدعي قائمة مقام المرأتين، فعلى هذا لو كان المدعي ذميا فأقام شاهدًا وجبأن لا تقبل يمينه، كما لو كانت المرأتان ذميتين. كذا في (عقود الجواهر المنيفة). وقال في (الكوكب الدري): أي لا يعتدبشاهد المدعي إذا كان واحد، وإنما يحكم بيمين المنكر. وهذا هو المراد في لفظ الحديث: (قضى رسول الله ﷺ باليمين مع الشاهد): أي لم يحكم إلا باليمين مع وجود الشاهد الواحد؛ لعدم تمام نصاب الشهادة، انتهى. وقال فيهامشه: على أنه فعل لا يقاوم القول، لا سيما إذا تأيد القول بالقرآن المجيد في قوله تعالى: ﴿وَأَسْتَشْهِدُواْ شَهِيدَيْنِ مِنرَّجَالِكُمْ﴾ (البقرة: ٢٨٢)، وبسط البخاري في تأييد الحنفية في ذلك، فارجع إليه.

١قوله: فقسم النبي ﷺ بين الخصمين إلخ: بيان أنه ذكر اليمين محلى بالألف واللام، وإنه للجنس إذا لم يكن ثمهمعهود. ويقال: جعل البيئة حجة جنس المدعين، واليمين حجة جنس المنكرين فيكون جميع الأيمان على المنكرينفمن ردّ اليمين على المدعي لم يجعل جميعها على المنكرين، فيكون ذلك نسخا للحديث المشهور، وإنه لا يجوز بخبرالواحد ولا بالقياس. قاله في (البناية).

وَعَنْ عِمْرَانَ بْنِ حُصَيْنٍ ُ، عَنِ النَّبِيِّ ﷺ قَالَ: (خَيْرُ أُمَّتِي قَرْنِي ثُمَّ الَّذِينَيَلُونَهُمْ ثُمَّ الَّذِينَ يَلُونَهُمْ) قَالَ عِمْرَانُ: فَلَا أَدْرِي أَذَكَّرَ بَعْدَ قَرْنِهِ قَرْئَيْنِ أَوْ ثَلَاثًا، (ثُمَّ إِنَّبَعْدَكُمْ قَوْمًا يَشْهَدُونَ١ وَلَا يُسْتَشْهَدُونَ، وَيَخُونُونَ وَلَا يُؤْتَمَنُونَ، وَيَنْذُرُونَ وَلَا يَفُونَ،وَيَظْهَرُ فِيهِمْ السِّمَنُ). مُتَّفَقُّ عَلَيْهِ.

وَفِي رِوَايَةٍ لِأَحْمَدَ وَمُسْلِمٍ عَنْ أَبِيْ هُرَيْرَةَ رضي الله عنه، قَالَ: قَالَ رَسُوْلُ اللهِ ﷺ: (خَيْرُ أَمَّتِيالْقَرْنُ الَّذِي بُعِثْتُ فِيهِ، ثُمَّ الَّذِينَ يَلُونَهُمْ) - وَاللهُ أَعْلَمُ - أَذَكَّرَ الثَّالِثَ أَمْ لَا، قَالَ : (ثُمَّيَحْلُفُ قَوْمٌ يَشْهَدُونَ قَبْلَ أَنْ يُسْتَشْهَدُوا).

وَرَوَى مُسْلِمٌ عَنْ زَيْدِ بْنِ خَالِدٍ رضي الله عنه ، قَالَ: قَالَ رَسُوْلُ اللّهِ ﷺ: (أَلَا أُخْبِرُكُمْ بِخَيْرِالشُّهَدَاءِ الَّذِي يَأْتِي بِشَهَادَتِهِ قَبْلَ أَنْ يُسْأَلَهَا).

English

Imran ibn Husayn narrated from the Prophet (ﷺ): The best of my ummah are my generation, then those who follow them, then those who follow them. Imran said: I do not know if he mentioned two or three generations after his. Then after you will come people who testify without being asked, betray and are not trusted, vow and do not fulfill, and obesity will appear among them. [Agreed upon]

In a narration by Ahmad and Muslim from Abu Huraira (may Allah be pleased with him), he said: The Messenger of Allah (ﷺ) said: The best of my ummah is the generation in which I was sent, then those who follow them, Allah knows best, whether he mentioned the third or not. He said: Then people will swear and testify before being asked.

Muslim narrated from Zayd ibn Khalid (may Allah be pleased with him), who said: The Messenger of Allah (ﷺ) said: Shall I not inform you of the best of witnesses? The one who gives his testimony before being asked.

1 Regarding the saying: They testify without being asked: Our principle is that one should not testify unless requested, and it is obligatory to testify after the request, while concealing in hudud is preferable. This hadith condemns people who testify without being asked. Two interpretations were given for Zayd ibn Khalid’s hadith. First: It applies to one who has testimony for someone’s right, and the claimant does not know he is a witness, so he informs him. Second: It applies to Allah’s rights, like zakat, expiations, sighting the crescent, endowments, bequests, and the like, where informing the judge is obligatory. It may be interpreted as emphasizing haste in giving testimony after its request. The saying: They testify without being asked, applies to other cases. It was said: It is a metaphor for false testimony or testimony by one unqualified, meaning not among those asked, though this involves some strain. Taken from Al-Lam‘at.

١قوله: يشهدون ولا يستشهدون: الأصل عندنا أن لا يشهد إلا أن يطلب منه الشهادة، ويجب أن يشهد بعد الطلب،وسترها في الحدود أفضل. وقد ورد في هذا الحديث مذمة قوم يشهدون ولا يستشهدون، فذكروا الحديث زيد بنخالد تأويلين، أحدهما: أنه محمول على من عنده الشهادة لأحد بحق، ولا يعلم المدعي أنه شاهد، فيخبره أنه شاهدله. والثاني: أن هذا في حقوق الله، كالزكاة والكفارات ورؤية الهلال والوقف والوصايا ونحو ذلك، فيجب إعلامالحاكم بذلك. وقد يأول بأنه محمول على المبالغة والمسارعة في أداء الشهادة بعد طلبها، وقوله:(يشهدون ولايستشهدون) محمول على ما عدا ذلك. وقيل: إنه كناية عن شهادة الزور وعن شهادة من ليس أهلً لها، أي ليس ممنيستشهد، ولا يخلو عن تكلّف. أخذته من (اللمعات).

وَعَنْ خَرِيْمِ بْنِ فَاتِكِ رضي الله عنه ، قَالَ: صَلَّى رَسُوْلُ اللهِ ﷺ صَلَاةَ الصُّبْحِ، فَلَمَّاانْصَرَفَ قَامَ قَائِمًا فَقَالَ: (عُدِلَتْ شَهَادَةُ الزُّورِ بِالْإِشْرَاكِ بِاللَّهِ) ثَلَاثَ مِرَارٍ. ثُمَّ قَرَأَ:﴿فَأَجْتَنِبُواْ الرِّجْسَ مِنَ آلْأَوْثَنِ وَأَجْتَنِبُواْ قَوْلَ الزُّورِ ٣٠ حُنَفَآءَ لِلُهِ غَيْرَ مُشْرِكِينَ بِهْ﴾.رَوَاهُ أَبُوْ دَاوُدَ وَابْنُ مَاجَه، وَرَوَاهُ أَحْمَدُ وَالتَّرْمِذِيُّ عَنْ أَيْمَنِ بْنِ خَرِيْمٍ إِلَّا أَنَّ أَبْنَ مَّاجَهُلَمْ يَذْكُرِ الْقِرَاءَةَ.

English

Kharim ibn Fatik (may Allah be pleased with him) narrated: The Messenger of Allah (ﷺ) prayed the morning prayer, and when he finished, he stood and said: False testimony has been equated with associating partners with Allah, three times. Then he recited: So avoid the uncleanliness of idols and avoid false speech, inclining toward Allah, not associating with Him [Al-Hajj: 30-31]. [Narrated by Abu Dawud and Ibn Majah] Ahmad and al-Tirmidhi narrated it from Ayman ibn Kharim, except Ibn Majah did not mention the recitation.

وَعَنِ الْأَشْعَثِ بْنِ قَيْسٍ رضی اللہ عنه قَالَ: إِنَّ رَجُلًا مِنْ كِنْدَةً وَرَجُلًا مِنْ حَضْرَمَوْتَاخْتَصَمَا إِلَى رَسُولِ اللهِ ﷺ فِي أَرْضِ مِنَ الْيَمَنِ، فَقَالَ الْحَضْرَيُّ: يَا رَسُولَ اللَّهِ، إِنَّ أَرْضِياغْتَصَبَنِيهَا أَبُو هَذَا، وَهِيَ فِي يَدِهِ. قَالَ: (هَلْ لَكَ بَيَنَةُ؟) قَالَ: لَا، وَلَكِنْ أُحَلَّفُهُ، وَاللَّهِ مَا يَعْلَمُ أَنَّهَا أَرْضِي اغْتَصَبَنِيهَا أَبُوهُ، فَتَهَيَّأَ الْكِنْدِيُّ لِلْيَمِينِ، فَقَالَ رَسُولُ اللهِ ﷺ: (لايَقْتَطِعُ أَحَدُّ مَالًا بِيَمِينٍ إِلَّا لَقيَ اللهَ وَهُوَ أَجْذمُ)، فَقَالَ الْكِنْدِيُّ: هِيَ أَرْضُهُ. رَوَاهُ أَبُوْ دَاوُدَ.

English

Al-Ash‘ath ibn Qays (may Allah be pleased with him) narrated: A man from Kinda and a man from Hadramawt disputed before the Messenger of Allah (ﷺ) over land in Yemen. The Hadrami said: O Messenger of Allah, my land was usurped by this man’s father, and it is in his hand. He said: Do you have proof? He said: No, but I will make him swear, and by Allah, he knows it is my land his father usurped. The Kindi prepared to swear, and the Messenger of Allah (ﷺ) said: No one seizes property by an oath except that he meets Allah with his hand severed. The Kindi said: It is his land. [Narrated by Abu Dawud]

وَعَنْ عَلْقَمَةَ بْنِ وَائِلٍ عَنْ أَبِيْهِ رضى الله عنه ، قَالَ: جَاءَ رَجُلُ مِنْ حَضْرَمَوْتَ وَرَجُلٌ مِنْ كنْدَةَ إِلَى النَّبِيِّ ، فَقَالَ الْحَضْرَمِيُّ: يَا رَسُولَ اللهِ، إِنَّ هَذَا غَلَبَنِي عَلَى أَرْضِ لِي. فَقَالَ الْكِنْدِيُّ هِيَ أَرْضِيْ وَفِي يَدِي لَيْسَ لَهُ فِيهَا حَقٌّ، فَقَالَ النَّبِيُّ ﷺ لِلْحَضْرَي: (أَلَكَ بَيَّنَةُ؟) قَالَ: لَا، قَالَ: (فَلَكَ يَمِينُهُ) قَالَ: يَا رَسُولَ اللهِ، إِنَّ الرَّجُلَ فَاجِرُ، لَا يُبَالِي عَلَىمَا حَلَفَ عَلَيْهِ، وَلَيْسَ يَتَوَرَّعُ مِنْ شَيْءٍ. قَالَ: (لَيْسَ لَكَ مِنْهُ إِلَّا ذَلِكَ) قَالَ: فَانْطَلَقَلِيَحْلِفَ لَهُ، فَقَالَ رَسُولُ اللهِ ﷺ لَمَّا أَدْبَرَ: (لَئِنْ حَلَفَ عَلَى مَالِكَ لِيَأْكُلَهُ ظُلْمًا لَيَلْقَيَنَاللهَ وَهُوَ عَنْهُ مُعْرِضٌ). رَوَاهُ مُسْلِمٌ.

English

Alqama ibn Wa’il narrated from his father (may Allah be pleased with him): A man from Hadramawt and a man from Kinda came to the Prophet (ﷺ). The Hadrami said: O Messenger of Allah, this man overpowered me on my land. The Kindi said: It is my land, in my possession, and he has no right to it. The Prophet (ﷺ) said to the Hadrami: Do you have proof? He said: No. He said: Then you have his oath. He said: O Messenger of Allah, the man is immoral, he does not care what he swears to, and he has no scruple about anything. He said: You have nothing from him but that. He went to swear for him, and when he turned away, the Messenger of Allah (ﷺ) said: If he swears to your property to consume it unjustly, he will meet Allah while He turns away from him. [Narrated by Muslim]

English

Al-Ash‘ath ibn Qays (may Allah be pleased with him) narrated: There was land between me and a Jew, and he denied me, so I brought him to the Prophet (ﷺ). He said: Do you have proof? I said: No. He said to the Jew: Swear. I said: O Messenger of Allah, then he will swear and take my property. So Allah, Exalted is He, revealed: Indeed, those who exchange the covenant of Allah and their oaths for a small price [Aal-E-Imran: 77], the verse. [Narrated by Abu Dawud and Ibn Majah]

فِيهَا فَاجِرُ يَقْتَطِعُ بِهَا مَالَ امْرِئٍ مُسْلِمٍ لَقِيَ اللهَ يَوْمَ الْقِيَامَةِ وَهُوَ عَلَيْهِ غَضْبَانُ). فَأَنْزَلاللهُ تَصْدِيْقَ ذَلِكَ: ﴿إِنَّ اَلَّذِينَ يَشْتَرُونَ بِعَهْدِ اللهِ وَأَيْمَنِهِمْ ثَمَنَا قَلِيلًا﴾ إِلَى آخِرِ الْآيَةِ.مُتَّفَقُّ عَلَيْهِ.

English

Ibn Mas‘ud (may Allah be pleased with him) narrated: The Messenger of Allah (ﷺ) said: Whoever swears an oath in which he is immoral, seizing a Muslim’s property with it, and meets Allah on the Day of Resurrection while He is angry with him. So Allah revealed, confirming it: Indeed, those who exchange the covenant of Allah and their oaths for a small price [Aal-E-Imran: 77], to the end of the verse. [Agreed upon]

In Badhl al-Majhud, Ibn Battal said: This verse and hadith are evidence for the majority’s view that the ghamus oath has no expiation, as the Prophet (ﷺ) mentioned its intent, sin, punishment, and disobedience without mentioning expiation, unlike the contracted oath, where he said: Let him expiate his oath and do what is better. Ibn al-Mundhir said: We know no Sunnah indicating those who require expiation, like al-Shafi‘i, but it supports those who do not, like Abu Hanifa.

وَعَنْ عَبْدِ اللهِ بْنِ أُنَيْسِ رضي الله عنه ، قَالَ: قَالَ رَسُوْلُ اللّهِ ﷺ: (إِنَّ مِنْ أَكْبَرِ الْكَبَائِرِالشَّرْكُ بِاللهِ وَعُقُوقُ الْوَالِدَيْنِ وَالْيَمِينُ الْغَمُوسُ، وَمَا حَلَفَ حَالِفُّ بِاللهِ يَمِينَ صَبْرٍ فَأَذْخَلَفِيهَا مِثْلَ جَنَاجِ بَعُوضَةٍ إِلَّا جُعِلَتْ نُكْتَةً فِي قَلْبِهِ إِلَى يَوْمِ الْقِيَامَةِ). رَوَاهُ التَرْمِذِيُّ.

English

Abdullah ibn Unays (may Allah be pleased with him) narrated: The Messenger of Allah (ﷺ) said: Among the greatest of major sins are associating partners with Allah, disobedience to parents, the ghamus oath, and if a swearer swears a deliberate false oath by Allah, even inserting the wing of a mosquito into it, it becomes a blemish in his heart until the Day of Resurrection. English

Abu Umama (may Allah be pleased with him) narrated: The Messenger of Allah (ﷺ) said: Whoever seizes a Muslim’s right with his oath, Allah has made the Fire obligatory for him and forbidden Paradise to him. A man said to him: Even if it is something minor, O Messenger of Allah? He said: Even if it is a twig from an arak tree. [Narrated by Muslim]

Ibn Abbas narrated that the Prophet (ﷺ) said to a man he made swear: Swear by Allah, the One besides Whom there is no god, that the claimant has nothing with you. [Narrated by Abu Dawud]

وَعَنْ دَاوُدَ بْنِ الْحُصَيْنِ أَنَّهُ سَمِعَ أَبَا غَطَفَانَ الْمُرِّيَّ يَقُولُ: اخْتَصَمَ زَيْدُ بْنُثَابِتٍ وَابْنُ مُطِيعِ فِي دَارٍ كَانَتْ بَيْنَهُمَا إِلَى مَرْوَانَ بْنِ الْحَكَمِ، وَهُوَ أَمِيرُ عَلَى الْمَدِينَةِ،فَقَضَى مَرْوَانُ عَلَى زَيْدِ بْنِ ثَابِتٍ بِالْيَمِينِ عَلَى الْمِنْبَرِ، فَقَالَ زَيْدُ بْنُ ثَابِتٍ: أَحْلِفُ لَهُمَكَانِيْ، فَقَالَ مَرْوَانُ: لَا وَاللهِ إِلَّا عِنْدَ مَقَاطِعِ الْحَقُوقِ، قَالَ: فَجَعَلَ زَيْدُ بْنُ ثَابِتٍ يَحْلِفُأَنَّ حَقَّهُ لَحَقٌّ، وَيَأْبَى ١ أَنْ يَحْلِفَ عَلَى الْمِنْبَرِ، قَالَ: فَجَعَلَ مَرْوَانُ بْنُ الْحُكَّمِ يَعْجَبُ مِنْذَلِكَ. رَوَاهُ مَالِكٌ.

وَذَكَرَهُ الْبُخَارِيُّ فِي صَحِيحِهِ تَعْلِيْقًا، وَقَالَ: قَالَ النَّبِيُّ : شَاهِدَاكَ أَوْ يَمِينُهُ فَلَمْيَخْصَّ مَكَانًا دُونَ مَكَانٍ).

Dawud ibn al-Husayn narrated that he heard Abu Ghatafan al-Murri say: Zayd ibn Thabit and Ibn Muti‘ disputed over a house between them before Marwan ibn al-Hakam, who was the governor of Madinah. Marwan ruled that Zayd ibn Thabit must swear on the pulpit. Zayd said: I will swear for him in my place. Marwan said: No, by Allah, only at the place where rights are settled. Zayd began swearing that his right was true but refused to swear on the pulpit. Marwan was amazed at that. [Narrated by Malik]

Al-Bukhari mentioned it in his Sahih as a ta‘liq, saying: The Prophet (ﷺ) said: Your two witnesses or his oath, without specifying one place over another.

1 Regarding the saying: And he refused to swear on the pulpit: For this reason, we hold that an oath should not be emphasized for a Muslim by time or place absolutely, as emphasizing by time delays the claimant’s right until that time, and by place delays until reaching that emphasized location, so it is not legislated. Al-Hidayah suggests that the obligation of emphasis is negated, implying it is permissible. Al-Muhit indicates its permissibility but states afterward that emphasizing by place is not allowed. The conclusion is that the defendant, when required to swear, swears wherever the oath is due and is not moved from that place. This is the view of the Hanafis and Hanbalis, and al-Bukhari leaned toward it. Al-Shafi‘i said in one view: It is recommended to emphasize by place and time. In another view: It is obligatory. For time, it is on Friday after Asr; for place, it is between the Black Stone and the Maqam if in Makkah, at the Prophet’s (ﷺ) grave if in Madinah, or at the Rock if in Jerusalem. Al-Jami‘ states: If elsewhere, in the absence of a congregational mosque, then in mosques. Our evidence is this report from Malik and al-Bukhari, and the generality of the Prophet’s (ﷺ) saying: The oath is upon the one who denies. If you say: The opponents cite Jabir’s narration that the Messenger of Allah (ﷺ) said: Whoever swears a false oath at this pulpit of mine reserves a seat in the Fire. The response is: This hadith is not authentic. It contradicts the generality of the Prophet’s (ﷺ) saying: The proof is upon the claimant, and the oath is upon the one who denies. وَفِي رِوَايَةٍ لَهُ وَلِلنَّسَائِّيِّ وَابْنِ مَاجَه: أَنَّ رَجُلَيْنِ ادَّعَيَا بَعِيرًا لَيْسَتْ لِوَاحِدٍ مِنْهُمَا بَيَّنَةٌفَجَعَلَهُ النَّبِيُّ ﷺ بَيْنَهُمَا.

وَرَوَى ابْنُ أَبِيْ شَيْبَةَ وَعَبْدُ الرَّزَّاقِ عَنْ تَمِيْمِ بْنِ طَرَفَةَ أَنَّ رَجُلَيْنِ الدَّعَيَا بَعِيرًا فَأَقَامَكُلُّ وَاحِدٍ مِنْهُمَا الْبَيِّنَةَ أَنَّهُ لَهُ، فَقَضَى النَّبِيُّ ﷺ بِهِ بَيْنَهُمَا.

وَفِي رِوَايَةٍ لِلْبَيْهَقِيِّ فِي سُنَنِهِ عَنْ سَعِيْدِ بْنِ أَبِيْ بُرْدَةَ عَنْ أَبِيْهِ أَنَّ رَجُلَيْنِ اخْتَصَمَا إِلَىنَبِيِّ اللّهِ ﷺ فِي دَابَّةٍ لَيْسَ لِوَاحِدٍ مِنْهُمَا بَيَنَةُ، فَجَعَلَهَا بَيْنَهُمَا نِصْفَيْنِ. وَحَدِيْثُ الْقُرْعَةِكَانَ فِي ابْتِدَاءِ الْإِسْلَامِ ثُمَّ نُسِخَ، بَيَّنَهُ الطَّحَاوِيُّ.

English

Abu Musa al-Ash‘ari (may Allah be pleased with him) narrated that two men claimed a camel during the time of the Messenger of Allah (ﷺ). Each provided two witnesses, so the Prophet (ﷺ) divided it between them in halves. [Narrated by Abu Dawud]

In a narration by Abu Dawud, al-Nasa’i, and Ibn Majah: Two men claimed a camel, neither having proof, so the Prophet (ﷺ) divided it between them.

Ibn Abi Shayba and Abd al-Razzaq narrated from Tamim ibn Tarafa that two men claimed a camel, each providing proof that it was his, so the Prophet (ﷺ) ruled it be divided between them.

In al-Bayhaqi’s Sunan, from Sa‘id ibn Abi Burda from his father, two men disputed before the Prophet (ﷺ) over an animal, neither having proof, so he divided it between them in halves. The hadith about lots was in early Islam and was later abrogated, as al-Tahawi clarified.

1 Regarding the saying: Two men claimed, etc.: The scenario is that if two men claim an item in a third party’s possession, neither having proof, or both having proof, and the third says: I do not know if it is yours or another’s, the ruling is to draw lots between the claimants. The one selected by lots swears and is awarded the item. Ali (may Allah be pleased with him) held this view. Al-Shafi‘i says it remains with the third party. Abu Hanifa says it is divided between the claimants in halves. Ibn al-Malik said: Ali’s view was held by Ahmad and al-Shafi‘i in one opinion. In another opinion, with Abu Hanifa, it is divided between the claimants in halves with each swearing. In another opinion, it remains with the third party. [Al-Marqah] Al-Hidayah states: If two claim an item in another’s possession, each asserting it is his, and both provide proof, it is divided between them. Al-Shafi‘i said in one opinion: The proofs cancel each other. In another: Draw lots between them. [Al-Kifaya] clarifies: The issue applies to absolute ownership, as in specified causes or dates, there is detail and disagreement.

وَعَنْ جَابِرِ بْنِ عَبْدِ اللهِ أَنَّ رَجُلَيْنِ تَدَاعَيَا دَابَّةٌ، فَأَقَامَ كُلُّ وَاحِدٍ مِنْهُمَاالْبَيِّنَةَ أَنَّهَا دَابَّتُهُ نَتَجَهَا ، فَقَضَى ٢ بِهَا رَسُولُ اللهِ ﷺ لِلَّذِي فِي يَدِهِ. رَوَاهُ فِي شَرْحِ السُّنَّةِ.

English

Aisha narrated: The Messenger of Allah (ﷺ) said: The testimony of a treacherous man or woman, one punished with a hadd or a woman so punished, one with enmity toward his brother, one suspected in clientage or kinship, or a dependent of the household is not permissible. [Narrated by al-Tirmidhi]

Thus, the treacherous means the sinner, and mentioning the punished or adulterer afterward is an example, with their conjunction being specific to general for their grave treachery. The saying: Nor one punished with a hadd, includes the non-muhsan adulterer, slanderer, and drinker. The saying: Nor one with enmity toward his brother, means testimony of an enemy due to worldly matters is not accepted, but religious enmity is accepted, as it stems from piety, unlike worldly enmity, where fabrication is feared. A friend’s testimony for his friend is accepted unless the friendship is so extreme that one manages the other’s wealth. The saying: Nor one suspected in clientage or kinship, means one accused, from suspicion meaning accusation, like one claiming false clientage, saying: I am so-and-so’s freed slave, lying and known for it, so people accuse and disbelieve him; his testimony is not accepted as he is a sinner, as lying in clientage, severing from the true patron and claiming a false one, is a major sin. The same applies to kinship, with cursing mentioned for it. The saying: Nor a dependent of the household, means the testimony of a private worker, hired servant, follower, or dedicated student who sees his teacher’s harm or benefit as his own is not accepted, like a parent or child’s testimony. This is the meaning of: No testimony for the dependent of the household, meaning one seeking livelihood from them, from dependency, not contentment, implying acceptance of a hired worker or teacher’s testimony. The narration from Abu Huraira from the Messenger of Allah (ﷺ): The testimony of a Bedouin against a town-dweller is not permissible, is interpreted as inappropriate due to potential suspicion from their distance. ١ قوله : لا تجوز شهادة خائن إلخ: يحتمل أن يراد به الخيانة في أمانات الناس. ويحتمل أن يراد الأعم الشامل للخيانة في أحكام الله تعالى، وقد جمع الكل قوله سبحانه: يَاَأَيُّهَا الَّذِينَ امنوا لا تَخُونُوا اللَّهَ وَالرَّسُولُ وَتَخُونُوا أَمْتَتِكُمْ (الأنفال: ۲۷، فيكون المراد بالخائن الفاسق، وحينئذ يكون ذكر المجلود والزاني وغيرها مثلا بعده، وعطفهما عليه من قبيل عطف الخاص على العام لعظم خيانتها، وقوله: (ولا مجلود حدا) يتناول الزاني الغير المحصن والقاذف والشارب، ولكن المجلود في القذف لا يقبل شهادته عند أبي حنيفة أبدا وإن تاب، وجعل قوله تعالى: (ولا تقبلوا لَهُمْ شَهدَهُ أَبَداً وَأُولَئِكَ هُمُ الفسقون إلا الذين تابوا (النور: ٤-٥) عطف على قوله: ﴿فَاجْلِدُ وهُم ثمنينجلدة (النور: ٤ وجعل عدم القبول للشهادة من تمام الحد، وجعل الاستثناء من الفسقون بخلاف المحدودفي غير القذف كالزنا والسرقة وشرب الخمر حيث يقبل شهادته بعد التوبة عندنا أيضًا؛ لأن الرد فيها للفسق لا لتمام الحد، كما في المحدود في القذف. وقد ارتفع الفسق بالتوبة وسائر الأئمة والشافعي يقولون: القذف من جملة الفسوق ولا يتعلق بإقامة الحد،بلإن تاب قبلت شهادته مثل سائر الحدود جلد أو لم يجلد، ومن لم يتب لا يقبل شهادته، سواء جلد أو لم يجلد.

وقوله: ولا ذي غمر على أخيه: أي لا تقبل شهادة عدو بسبب الدنا، وأما العدو بسبب الدين فتقبل؛ لأنها من التدين، بخلاف الدنيوية؛ فإنه لا يأمن من التقول عليه، وأما الصديق لصديقه فتقبل إلا إذا كانت الصداقة متناهية بحيث يتصرف كل مال الآخر، وقوله: ولا ظنين في ولاء ولا قرابة الظنين: المتهم، فعيل بمعنى مفعول من الظنة بمعنى (التهمته) يعني من انتمى إلى غير مواليه، وقال: أنا عتيق فلان، وهو كاذب ومشتهر بكذبه فيه بحيث يتهمه الناس في قوله، ويكذبونه: لا تقبل شهادته؛ لأنه فاسق؛ لأن الكذب في الولاء لقطعه عن المعتق وادعائه لمن ليس معتقه كبيرة، كذا قالوا، وكذا الحكم في القرابة وقد ورد فيه اللعن، وقوله والقانع مع أهل البيت، يعني لا تقبل شهادة الأجبر الخاص المستأجرة مسانهة أو مشاهرة أو الخادم أو التابع أو التلميذ الخاص الذي يعد ضرر أستاذهضرر نفسه ونفعه نفع نفسه، فيكون القانع في حكم شهادة الوالد والولد، وهو معنى قوله ﷺ: (لا شهادة للقانع بأهل البيت) أي الطالب معاشه منهم من القنوع لا من القناعة، ومفاده قبول شهادة المستأجر والأستاذ له. وأما ما روي عن أبي هريرة عن رسول الله ﷺ:( ولا تجوز شهادة بدوي على صاحب قرية) فمحمول على أن معناه لا يحسن؛ الحصول التهمة بحصول البعد بينهما، لذلك قال عامة أهل العلم سوى مالك: شهادة البدوي إذا كان عدلا يقيم الشهادة على وجهها، جائزة. التقطته من (اللمعات) و (الهداية) و(الدر المختار)، و(بذل المجهود).

Amr ibn Shu‘ayb, from his father, from his grandfather (may Allah be pleased with him), narrated that the Prophet (ﷺ) said: The testimony of a treacherous man or woman, an adulterer or adulteress, one with enmity toward his brother is not permissible, and he rejected the testimony of a dependent of the household. وَعَنْ أُمَّ سَلَمَةَ رضي الله عنها أَنَّ رَسُوْلَ اللّهِﷺ قَالَ: (إِنَّمَا أَنَا بَشَرُّ وَإِنَّكُمْتَّخْتَصِمُونَ إِلَّی، فَلَعَلَّ بَعْضَكُمْ أَنْ يَكُونَ أَلْحَنَ بِحُجَّتِهِ مِنْ بَعْضٍ فَأَقْضِيَ لَهُ عَلَى نَحْوِ مَاأَسْمَعُ مِنْهُ، فَمَنْ قَضَيْتُ لَهُ بِشَيْءٍ مِنْ حَقِّ أَخِيهِ فَلَا يَأْخُذَنَّ مِنْهُ شَيْئًا، فَإِنَّمَا أَقْطَعُ لَهُقِطْعَةً مِنَ النَّارِ). مُتَّفَقُّ عَلَيْهِوَقَدْ احْتَجَّ بِهِ مَنْ لَمْ يَرَ أَنْ يَحْكُمَ الْحَاكِمَ بِعِلْمِهِ، وَالْفَتْوَى٢ عِنْدَنَا عَلَى عَدْمالْعَمَلِ بِعِلْمِ الْقَاضِيْ فِي زَمَانِنَا.

وَقَالَ مُحَمَّدُّ رحمة الله عليه فِي (الْأَصْلِ): بَلَغَنَا عَنْ عَلِيٍّ كَرَّمَ اللّهُ وَجْهَهُ أَنَّ رَجُلًا أَقَامَ عِنْدَهُ بَيَّنَةًعَلَى امْرَأَةٍ أَنَّهُ تَزَوَّجَهَا فَأَنْكَرَتْ، فَقَضَى لَهُ بِالْمَرْأَةِ، فَقَالَتْ: إِنَّهُ لَمْ يَتَزَوَّجَنِيْ، فَأَمَّا إِذَاقَضَيْتَ عَلَيَّ فَجَدِّدْ نِكَاحِيْ، فَقَالَ: لَا أُجَدِّدُ نِكَّاحَكِ، الشَّاهِدَانِ١ زَوَّجَاكِ. قَالَ: وَبِهَذَاتَأْخُذُ، وَيُؤَيِّدُهُ مَا قَدْ رُوِيَ عَنْ رَسُوْلِ اللّهِ ﷺ فِي الْمُتَلَاعِنَيْنِ.

English

Umm Salama (may Allah be pleased with her) narrated: The Messenger of Allah (ﷺ) said: I am only human, and you bring disputes to me. Some of you may be more eloquent in argument than others, so I rule for him based on what I hear. Whoever I rule for, taking his brother’s right, let him not take it, for I only assign him a portion of the Fire. [Agreed upon]

This was cited by those who hold that a judge should not rule based on his knowledge. The fatwa today, with us, is not to act on the judge’s knowledge in our time.

Muhammad (may Allah have mercy on him) said in al-Asl: It reached us from Ali (may Allah honor his face) that a man presented proof before him that he married a woman, but she denied it. He ruled for him with the woman. She said: He did not marry me, but since you ruled against me, renew my marriage. He said: I will not renew your marriage; the two witnesses married you. He said: This is what we take, supported by what was narrated from the Messenger of Allah (ﷺ) about the mutual cursers.

Now, a judge does not rule by his knowledge absolutely, whether acquired after or before appointment, whether a non-pure hadd, retribution, or other people’s rights. The fatwa in our time is on this, as cited in al-Ashbah from Jami‘ al-Fusulayn, qualified by our time due to judges’ corruption. Al-Shafi‘i said: Were it not for corrupt judges, I would say a judge may rule by his knowledge. Then he said: If the judge is just, he does not rule by his knowledge in hadd or retribution except what is confessed before him, but he rules by his knowledge in all rights, whether known before or after appointment, qualified by the judge’s justice, hinting that some judges may not be just. The principle is: Whatever a judge rules on outwardly, prohibiting or permitting, is so inwardly with him. Others hold that a ruling for wealth ownership, ownership removal, marriage establishment, or separation, if inwardly contrary to the judge’s basis like testimony, does not permit ownership, removal, marriage, or divorce. This is Abu Yusuf, Muhammad, the three, and Zufar’s view, so it is only enforced outwardly, as false testimony is evidence outwardly, not inwardly, like witnesses being slaves or non-Muslims. 2 Regarding the saying: The fatwa today is not to act on the judge’s knowledge in our time: Our school’s original position is permissibility, with Abu Hanifa’s condition that the judge knows it during his tenure in the city where he judges, for a right not purely Allah’s hadd, like a loan, sale, usurpation, divorce, intentional killing, or slander hadd. If he knew it before his appointment in people’s rights, then was appointed and the case was raised, or knew it during his tenure outside his city, then entered it and it was raised, he does not rule by it. Abd al-Razzaq narrated similarly from Shurayh, who said: He rules. The disagreement applies if he knew it as a judge in his city, was removed, then reinstated. For drinking or adultery hadd, his ruling by knowledge is not enforced by consensus. [Fath, summarized] This clarifies that in pure Allah’s hadd, it is not enforced, as stated in Sharh Adab al-Qada, because every Muslim equals the judge in it, and a non-judge knowing it cannot enforce the hadd, so it differs from other cases where ruling by knowledge is permissible. 3 Regarding the saying: The two witnesses married you: This indicates that a ruling based on false testimony is enforced outwardly and inwardly, with two conditions for inward enforcement. First: The judge’s ignorance of the witnesses’ falsehood; if he knows, his ruling is not enforced. Second: The subject’s suitability; if the woman is married, in idda, apostate, or prohibited by affinity or fosterage, it is not enforced. Scholars differed. Some hold that if the ruling concerns wealth and the inward reality differs from the judge’s outward basis, it does not permit the beneficiary’s taking, but in marriage or divorce, it is enforced outwardly and inwardly, citing Ali’s statement and the mutual cursers’ case, as one is certainly lying, yet the separation is enforced. This is Abu Hanifa’s view.

١ قوله: الشاهدان زوَّجاك: فيه دليل على أن ينفذ القضاء بشهادة الزور، ظاهرًا وباطنًا، لكن للنفاد باطنًا شرطان،الأول: عدم علم القاضي بكذب الشهود، فلو علم به لم ينفذ قضاءه. والثاني: كون المحل قابلًا، فإذا كانت المرأة تحتزوج أو معتدة أو مرتدة أو محرمة بمصاهرة أو برضاع: لم ينفذ. واختلف العلماء فيه، فذهب قوم إلى أن الحكم إن كان فيمال، وكان الأمر في الباطن بخلاف ما استند إليه الحاكم من الظاهر لم يكن ذلك موجبا لحله للمحكوم له، وإن كان فينكاح أو طلاق، فإنه ينفذ ظاهرا وباطنا، وحملوا حديث أم سلمة: (فمن قضيت له بشيء من حق أخيه فلا يأخذنَّه؛ فإنماأقطع له قطعة من النار) على ما ورد فيه، وهو المال، واحتجوا لما عداه بقول علي، وبقصة المتلاعنين. ألا ترى أنالتفريق باللعان ينفذ ظاهرا وباطنا، وأحدهما كاذب بيقين، وهو قول أبي حنيفة.

English

Awf ibn Malik (may Allah be pleased with him) narrated: The Prophet (ﷺ) judged between two men. The one ruled against, as he turned away, said: Allah is sufficient for me, and He is the best Disposer of affairs. The Prophet (ﷺ) said: Allah, Exalted is He, reproves weakness, but you must be prudent. If a matter overcomes you, say: Allah is sufficient for me, and He is the best Disposer of affairs. 1 Regarding the saying: So kill the polytheists, etc.: Know that jihad is a collective obligation (fard kifaya). Its obligation is based on these verses, and its collective nature is due to Allah’s saying: Not equal are those who sit [An-Nisa: 95] to accursed [An-Nisa: 96]. This applies when the call to arms is not general. If it is general, such as an enemy attacking a Muslim town, it becomes an individual obligation (fard ayn), whether the caller is just or unjust. All inhabitants of that town must go forth, and those nearby if the inhabitants are insufficient or neglectful, and so on until it becomes obligatory on all Muslims, east and west. This is supported by Allah’s saying: Go forth, light or heavy [At-Tawba: 41]. [Gathered from al-Marqah]

2 Regarding the saying: Reproves weakness: Meaning He does not approve. Weakness is the opposite of prudence, which is vigilance in affairs and guidance to planning and benefit. It means you should have been vigilant in your dealings and not settled without the claimant’s proof. If the opponent overcomes you, then say: Allah is sufficient for me, etc. [Al-Lam‘at]

٢ قوله: يلوم على العجز: أي لا يرضى. والمراد بالعجز ضد الكيس، والكيس التَيَقَّظ في الأمور والاهتداء إلى التدبيروالمصلحة، يعني كان ينبغي لك أن تتيقّظ في معاملتك، ولا تقتصر فيها قبل إقامة المدعي البينةَ أو مع ذلك إذا غلبكالخصم قلت: (حسبي الله إلخ). كذا في (اللمعات).

١ قوله: فاقتلوا المشركين إلخ: اعلم أن الجهاد فرض على الكفاية، أما الفرضية فلهذه الآيات، وأما كونه على الكفايةفلقوله تعالى: ﴿لَّا يَسْتَوِى اُلْقَّعِدُونَ﴾ (النساء: ٩٥) إلى قوله: ﴿رَجِيمًا ﴾، ثم هذا إذا لم يكن النفير عاما، فإنكان كأن هجموا على بلدة من بلاد المسلمين، فيصير من فروض الأعيان، سواء كان المستنفر عدلا أو فاسقا، فيجبعلى جميع أهل تلك البلدة النفر، وكذا من يقرب منهم إن لم يكن بأهلها كفاية أو تكاسلوا وعصوا، وهكذا إلى أنيجب على جميع أهل الإسلام شرقا وغربا. واستدل على ذلك بقوله تعالى: ﴿أَنفِرُواْ خِفَافًا وَثِقَالًا﴾ (التوبة: ٤١).التقطته من (المرقاة).
