بَابُ الْعَمَلِ فِي الْقَضَاءِ وَالْخَوْفِ مِنْهُThe Duty of Judging and the Fear of It
عَنْ أَبِيْ بَكْرَةَ رضى الله عنه قَالَ: سَمِعْتُ رَسُوْلَ اللّهِ ﷺ يَقُوْلُ: (لَا يَقْضِيَنَّ٢ حَكَمُ بَيْنَ اثْنَيْنِ وَهُوَ غَضْبَانُ). مُتَّفَقٌّ عَلَيْهِ.
Abu Bakra (may Allah be pleased with him) narrated: I heard the Messenger of Allah (ﷺ) say: No judge should rule between two people while he is angry. [Agreed upon]

2 Regarding the saying: No judge should rule between two people while he is angry: This means it is not befitting for a judge to rule while angry, as it prevents him from reasoning and reflecting. Likewise, in extreme heat, extreme cold, hunger, thirst, or illness, if he rules in these conditions, his ruling is valid but disliked. As stated in al-Marqah and al-Alamkiriyya.
٢ قوله: لا يقضيَّنَّ حكم بين اثنين وهو غضبان: أي لا ينبغي للحاكم أن يحكم في حالالغضب؛ لأنه يمنعه عن الاجتهاد والفكر، وكذلك في الحَرّ الشديد والبرد الشديد والجوع والعطش والمرض، فإن حكم في هذه الأحوال نفذحكمه مع الكراهية. قاله في (المرقاة) وكذا في (العالمكيرية)
وَعَنْ عَبْدِ اللهِ بْنِ عَمْرٍو وَأَبِيُّ هُرَيْرَةَ رضی اللہ عنهم، قَالَا: قَالَ رَسُوْلُ اللهِ ﷺ(إِذَا حَكَمَ١ الْحَاكِمُ فَاجْتَهَدَ فَأَصَابَ فَلَهُ أَجْرَانٍ، وَإِذَا حَكَمَ فَاجْتَهَدَ فَأَخْطَأَ فَلَهُأَجْرُ وَاحِدٌ). مُتَّفَقَّ عَلَيْهِ.
Abdullah ibn Amr and Abu Huraira (may Allah be pleased with them) narrated: The Messenger of Allah (ﷺ) said: If a judge rules and strives to reach the truth and is correct, he will have two rewards. If he rules and strives but errs, he will have one reward. [Agreed upon]

1 Regarding the saying: If a judge rules and strives but errs, he will have one reward: Al-Nawawi said: There is disagreement on whether every mujtahid is correct, or is the correct one the one who aligns with Allah’s ruling, while the other is mistaken? The principle according to al-Shafi‘i and his companions is the latter, as he is called mistaken, and if he were correct, he would not be called mistaken. This applies to one who errs in the text or strives in a matter where striving is not permissible. Those who hold the first view say: He is given a reward for being mistaken, and if he were not correct, he would not have a reward. This applies if he is qualified for striving. As for one not qualified to rule, it is not permissible for him to rule, and his ruling is not enforced, whether it aligns with the truth or not, as his correctness is coincidental, so he is sinful in all his rulings. Abu Hanifa’s view is that in matters not clarified in the texts of the Quran, Sunnah, or consensus, analogy is the only option, like one seeking the qibla; he is correct even if he errs. As stated in al-Marqah.

وَعَنْ عَلِيَّ رضى الله عنه ، قَالَ: بَعَثَنِيْ ٢ رَسُولُ اللهِ ﷺ إِلَى الْيَمَنِ قَاضِيًا، فَقُلْتُ: يَارَسُولَ اللهِ، تُرْسِلُنِي وَأَنَا حَدِيثُ السِّنِّ، وَلَا عِلْمَ لِي بِالْقَضَاءِ، فَقَالَ: (إِنَّ اللهَ سَيَهْدِيقَلْبَكَ، وَيُثَبِّتُ لِسَائَكَ، إِذَا تَقَاضَى إِلَيْكَ رَجُلَانٍ فَلَا تَقْضِ لِلْأَّوَّلِ حَتَّى تَسْمَعَ مِنَ الْآخَرِ؛فَإِنَّهُ أَجْدَرُ أَنْ يَبِينَ لَكَ الْقَضَاءُ). قَالَ: فَمَا شَكَكْتُ فِي قَضَاءٍ بَعْدُ. رَوَاهُ التَّرْمِذِيُّ وَأَبُوْدَاوُدَ وَابْنُ مَاجَه.
Ali (may Allah be pleased with him) narrated: The Messenger of Allah (ﷺ) sent me to Yemen as a judge, and I said: O Messenger of Allah, you send me while I am young and have no knowledge of judging. He said: Allah will guide your heart and make your tongue steadfast. When two men bring a case to you, do not rule for the first until you hear from the other, as that is more likely to clarify the judgment. He said: I never doubted a judgment after that. 2 Regarding the saying: The Messenger of Allah (ﷺ) sent me to Yemen as a judge, etc.: It is stated in al-Hidayah: The appointment of a judge is not valid unless the appointee meets the conditions of testimony and is qualified for striving. It is stated in al-Binaya: The correct view according to us is that this is a condition of priority, not validity. Some said it is a condition of validity, and al-Shafi‘i held this view. In Wajiz al-Shafi‘iyya: Judging requires specific qualities: being male, free, a mujtahid, sighted, and just. Thus, the judgment of a woman, blind person, child, immoral person, ignorant person, or follower is not permissible. Muhammad stated in al-Asl that a follower cannot be a judge, but al-Khasaf indicated its permissibility, as he said: A judge rules by his own striving if he has an opinion; if not, he asks a jurist and follows his ruling. The evidence that striving is not a condition of validity is what Abu Dawud, al-Tirmidhi, and Ibn Majah narrated from Ali (may Allah be pleased with him), who said: The Messenger of Allah (ﷺ) sent me to Yemen as a judge, and I said: O Messenger of Allah! You send me while I am young and have no knowledge of judging, [the hadith]. Al-Hakim narrated it in his Mustadrak and said: Its chain is authentic, and they did not narrate it. Ali was not among the mujtahids at that time.
٢ قوله: بعثني رسول الله ﷺ إلى اليمن قاضيا إلخ: قال في (الهداية): ولا تصح ولاية القاضي حتى يجتمع في المولىشرائط الشهادة، ويكون من أهل الاجتهاد اهـ. وقال في (البناية): الصحيح عندنا أن هذا شرط الأولوية لا شرطالجواز. وقيل: شرط الجواز، وذهب إليه الشافعي. وفي (وجيز الشافعية): لا بُدَّ للقضاء من صفات، وهو أن يكونذَكَرًا حُرًّا مجتهدًا بصيرًا عدلًا، فلا يجوز قضاء المرأة والأعمى والصبي والفاسق والجاهل والمقلد، انتهى. وقد ذكرمحمدفي (الأصل): أن المقلد لا يجوز أن يكون قاضيا، وذكر الخصاف ما يدل على جوازه؛ لأنه قال القاضي يقضيباجتهاد نفسه إذا كان له رأي، فإن لم يكن له رأي سأل فقيهًا وأخذ بقوله. والدليل على أن الاجتهاد ليس بشرطالجواز ما أخرجه أبو داود والترمذي وابن ماجه عن علي رضی اللہ عنه ، قال: بعثني رسول الله ﷺ إلى اليمن قاضيا فقلت: يارسول الله! ترسلني وأنا حديث السن، ولا علم لي بالقضاء، الحديث، ورواه الحاكم أيجا في مستدركه، وقال: صحيحالإسناد، ولم يُخْرِّجاه. وعليٌّ لم يكن حينئذٍ من أهل الاجتهاد.
وَعَنْ بُرَيْدَةَ رضى الله عنه قَالَ: قَالَ رَسُوْلُ اللهِ ﷺ: (الْقُضَاءُ ثَلَاثَةُ، وَاحِدُ فِي الْجَنَّةِوَاثْنَانِ فِي النَّارِ، فَأَمَّا الَّذِي فِي الْجَنَّةِ فَرَجُلٌ عَرَفَ الْحَقَّ فَقَضَى بِهِ، وَرَجُلٌ عَرَفَ الْحَقَّفَجَارَ فِي الْحُكْمِ فَهُوَ فِي النَّارِ، وَرَجُلٌ قَضَى١ لِلنَّاسِ عَلَى جَهْلٍ فَهُوَ فِي النَّارِ). رَوَاهُ أَبُوْدَاوُدَ وَابْنِ مَاجَه.
Buraida (may Allah be pleased with him) narrated: The Messenger of Allah (ﷺ) said: Judges are of three types: one in Paradise and two in the Fire. The one in Paradise is a man who knows the truth and judges by it. A man who knows the truth but deviates in his judgment is in the Fire. And a man who judges for people in ignorance is in the Fire. 1 Regarding the saying: And a man who judges for people in ignorance is in the Fire: It is stated in al-Hidayah: Following an ignorant person is valid according to us, unlike al-Shafi‘i, who says: Judging requires the ability to do so, and there is no ability without knowledge. Our view is that he can judge by another’s fatwa, achieving the purpose of judging, which is delivering the right to its owner. In al-Alamkiriyya: Even if an ignorant person follows and judges by another’s fatwa, it is permissible. As stated in al-Multaqat. However, an ignorant person should not follow in rulings. It is stated in al-Binaya: If you say: Abu Dawud and Ibn Majah narrated from Buraida, in a marfu‘ hadith: And a man who does not know the truth and judges for people in ignorance is in the Fire. It is said: The hadith refers to an ignorant person who acts on his ignorance and does not refer to others. It is stated in al-Alamkiriyya: Judging has five aspects: obligatory, when he is uniquely suited and no one else is fit; recommended, when others are fit but he is the most suitable and capable; optional, when he and others are equally suitable and capable, and he may accept or decline; disliked, when he is suitable but another is more suitable; and forbidden, when he knows his inability and lack of fairness due to following desires unknown to others, making it forbidden for him. وَعَنْ مُعَاذٍ بْنِ جَبَلٍ رضي الله عنه أَنَّ رَسُوْلَ اللهِ ﷺ لَمَّا بَعَثَهُ إِلَى الْيَمَنِ قَالَ:( كَيْفَ٢تَقْضِي إِذَا عَرَضَ لَكَ قَضَاءً؟) قَالَ: أَقْضِي بِكِتَابِ اللهِ. قَالَ: (فَإِنْ لَمْ تَجِدْ فِيكِتَابِ اللهِ؟) قَالَ: فَبِسُنَّةِ رَسُولِ اللهِ ﷺ، قَالَ: (فَإِنْ لَمْ تَجِدْ فِي سُنَّةِ رَسُولِ اللهِ؟) قَالَ:أَجْتَهِدُ رَأْبِي وَلَا آلُو، قَالَ: فَضَرَبَ رَسُولُ اللهِ ﷺ صَدْرَهُ، وَقَالَ: (الْحَمْدُ لِلَّهِ الَّذِي وَقَّقَرَسُولَ رَسُولِ اللهِ لِمَا يُرْضِي رَسُولَ اللهِ). رَوَاهُ التِّرْمِذِيُّ وَأَبُوْ دَاوُدَ وَالدَّارِميُّ.
Muadh ibn Jabal (may Allah be pleased with him) narrated: When the Messenger of Allah (ﷺ) sent him to Yemen, he said: How will you judge when a case is presented to you? He said: I will judge by the Book of Allah. He said: If you do not find it in the Book of Allah? He said: Then by the Sunnah of the Messenger of Allah (ﷺ). He said: If you do not find it in the Sunnah of the Messenger of Allah? He said: I will strive with my opinion and not slacken. The Messenger of Allah (ﷺ) struck his chest and said: Praise be to Allah, who has guided the messenger of the Messenger of Allah to what pleases the Messenger of Allah. 2 Regarding the saying: How will you judge when a case is presented to you, etc.: It is stated in al-Alamkiriyya: A judge should rule by what is in the Book of Allah Almighty and should know what is abrogating and abrogated in it. He should know what is clear and what is ambiguous, where interpretation differs, like the readings. If he does not find it in the Book of Allah Almighty, he should rule by what came from the Messenger of Allah (ﷺ), and he should know the abrogating and abrogated reports. If reports differ, he takes what is most likely and leans toward it in his striving. He must know the ranks of narrators: some are known for jurisprudence and justice, like the Rightly Guided Caliphs and the Abdallahs and others; some are known for long companionship and precision. Taking the narration of one known for jurisprudence is preferable to one not known for it, and likewise for one known for long companionship over one not known for it. If there is no Sunnah of the Messenger of Allah (ﷺ) in the matter, he rules by what the Companions agreed upon, as acting on their consensus is obligatory. If the Companions differed, he strives and prefers the opinion of some over others if he is qualified for striving. He cannot oppose them all by inventing a third opinion, as their disagreement indicates that what is beyond the two opinions is false. Al-Khasaf said he can, as their disagreement shows there is room for striving. The correct view is what we mentioned. If the Companions agreed on a ruling and one Follower opposed them, if the dissenter was from the Sunna and did not live in the Companions’ era, his opposition is not considered, and if a judge rules by his opinion against the Companions’ consensus, it is invalid. If he lived in the Companions’ era and competed with them in fatwas, and they permitted him to strive, like Shurayh and al-Sha‘bi, consensus is not established due to his opposition. If a ruling comes from some Followers and nothing is reported from others, Abu Hanifa has two narrations: in one, he said: I do not follow them, which is the apparent view of the school. In the narration of al-Nawadir, he said: If one of them issued a fatwa in the Companions’ era and they permitted his striving, like Shurayh, Masruq ibn al-Ajda‘, and al-Hasan, I follow them. As stated in al-Muhit. If there is no opinion from the Companions and there is consensus among the Followers, he rules by it. If they differ, he prefers the opinion of some and rules by it. If there is nothing from that, if he is qualified for striving, he analogizes it to similar rulings, strives with his opinion, seeks the truth, and rules by it. If he is not qualified for striving, he seeks a fatwa and follows the mufti’s ruling, does not rule without knowledge, and is not shy to ask. Two matters must be known: first, if our companions, Abu Hanifa, Abu Yusuf, and Muhammad, agree on something, the judge should not oppose them with his opinion. Second, if they differ among themselves, Abdullah ibn al-Mubarak said: Take Abu Hanifa’s opinion, as he was among the Followers and competed with them in fatwas. As stated in Muhit al-Sarakhsi. If no narration exists from Abu Hanifa and his companions (may Allah have mercy on them) and one exists from later scholars, he rules by it. If later scholars differ, he chooses one. If nothing exists from later scholars, he strives with his opinion if he knows the methods of jurisprudence and is recognized among jurists. It is stated in al-Durr al-Mukhtar and Radd al-Muhtar: The judge, like the mufti, takes Abu Hanifa’s opinion absolutely, then Abu Yusuf’s, then Muhammad’s, then Zufar’s and al-Hasan ibn Ziyad’s, which is the correct view. Some said the fatwa follows Abu Yusuf in matters related to judging due to his greater experience.
٢ قوله: كيف تقضي إذا عرض لك قضاء إلخ: وقال في (العالمكيرية): يينبغي للقاضي أن يقضي بما في كتاب اللهتعالى، وينبغي أن يعرف ما في كتاب الله تعالى من الناسخ والمنسوخ، وينبغي أن يعرف من الناسخ ما هو محكم، وماهو متشابه في تأويله اختلاف كالأقرأ. فإن لم يجد في كتاب الله تعالى يقضي بما جاء عن رسول الله ﷺ، وينبغي أنيعرف الناسخ والمنسوخ من الأخبار. فإن اختلف الأخبار يأخذ بما هو الأشبه، ويميل اجتهاده إليه، ويجب أن يعلمالمتواتر والمشهور، وما كان من أخبار الآحاد، ويجب أن يعلم مراتب الرُواة؛ فإن منهم من عُرِفَ بالفقه والعدالةكالخلفاء الراشدين والعبادلة وغيرهم، ومنهم من عُرِفَ بطول الصحبة وحسن الضبط والأخذ برواية من عرفبالفقه أولى من الأخذ برواية من لم يعرف بالفقه، وكذلك الأخذ برواية من عُرِفَ بطول الصحبة أولى من الأخذبرواية من لم يعرف بطول الصحبة وإن كانت حادثة لم يرد فيها سنة رسول الله ﷺ يقضي فيها بما اجتمع عليالصحابة؛ لأن العمل بإجماع الصحابة واجب. فإن كانت الصحابة فيها مختلفين يجتهد في ذلك، ويرجح قول بعضهم على بعض باجتهاده إذا كان من أهل الاجتهاد، وليس له أن يخالفهم جميعا باختراع قول ثالث؛ لأنهم معاختلافهم اتفقوا على أن ما عد القولين باطل، وكان الخصاف يقول له ذلك: لأن اختلافهم يدل على أن للاجتهادفيه مجالًا، والصحيح ما ذكرنا، وإن اجتمعت الصحابة على حكم، وخالفهم واحد من التابعين، إن كان المخالف سنٌّلم يدرك عهد الصحابة لا يعتد خلافه حتى لو قضى القاضي بقوله بخلاف إجماع الصحابة كان باطلًا. وإن كان ممنأدرك عهد الصحابة، وزاحمهم في الفتوى وسوغوا له الاجتهاد، كشريح والشعبي لا ينعقد الإجماع لمخالفته، وإنجاء عن بعض التابعين ولم ينقل عن غيرهم فيه شيء، فعن أبي حنيفة روايتان، في رواية قال: لا أقلدهم، وهوظاهر المذهب. وفي رواية النوادر قال: من كان منهم أفتى في زمن الصحابة، وسوغوا له الاجتهاد مثل شريحومسروق بن الأجدع والحسن، فأنا أقلدهم. كذا في (المحيط).فإن كان شيء لم يأت فيه من الصحابة قول، وكان فيه إجماع التابعين قضى به، وإن كان فيه اختلاف بينهم رجّحقول بعضهم، وقضى به، وإن لم يكن شيء من ذلك، فإن كان من أهل الاجتهاد قاسه على ما يشبهه من الأحكام،واجتهد رأيه فيه، وتحرى الصواب، ثم يقضي به برأيه، وإن لم يكن من أهل الاجتهاد، ويستفتي في ذلك فيأخذ بفتوىالمفتي، ولا يقضي بغير علم، ولا يستحيي من السؤال.
ثم لا بُدَّ من معرفة فصلين: أحدهما: أنه إذا اتفق أصحابنا في شيء أبو حنيفة وأبو يوسف ومحمد لا ينبغيللقاضي أن يخالفهم برأيه، والثاني: إذا اختلفوا فيما بينهم قال عبد الله بن المبارك: يؤخذ بقول أبي حنيفة ؛ لأنه كانمن التابعين، وزاحمهم في الفتوى. كذا في (محيط السرخسي)، ولو لم يوجد الرواية عن أبي حنيفة وأصحابه رحمهم اللهتعالى ووجد عن المتأخرين يقضي به، لو اختلف المتأخرون فيه يختار واحدا من ذلك، ولو لم يوجد عن المتأخرينيجتهد فيه برأيه؛ إذ كان يعرف وجوه الفقه ويشار أهل الفقه فيه اهـ. وقال في (الدر المختار) و(رد المحتار): ويأخذالقاضي كالمفتي بقول أبي حنيفة على الإطلاق، ثم بقول أبي يوسف، ثم بقول محمد، ثم بقول زفر والحسن بن زياد،وهو الأصح. وقيل: إن الفتوى على قول أبي يوسف فيما يتعلق بالقضاء لزيادة تجربته.
وَعَنْ أَنَسِ رضي الله عنه قَالَ: قَالَ رَسُوْلُ اللهِ ﷺ: (مَنْ ابْتَغَى١ الْقَضَاءَ وَسَأْلَ وُكِلَ إِلَىنَفْسِهِ، وَمَنْ أُكْرِهَ عَلَيْهِ أَنْزَلَ اللهُ عَلَيْهِ مَلَكًا يُسَدِّدُهُ) رَوَاهُ التَّرْمِذِيُّ وَأَبُوْ دَاوُدَ وَابْنُ مَاجَه.
Anas (may Allah be pleased with him) narrated: The Messenger of Allah (ﷺ) said: Whoever seeks judging and asks for it is left to himself, but whoever is compelled to it, Allah sends an angel to guide him. [Narrated by al-Tirmidhi, Abu Dawud, and Ibn Majah]

In al-Khulasa: One who seeks authority is not appointed. However, if he is uniquely suited, with no one else fit for judging, he must seek it to protect Muslims’ rights and repel oppressors’ injustice. The Shafi‘is and Malikis recommended seeking judging for one of obscure reputation to spread knowledge.

وَعَنْ أَبِيْ هُرَيْرَةَ رضي الله عنه ، قَالَ: قَالَ رَسُوْلُ اللهِ ﷺ: (مَنْ طَلَبَ قَضَاءَالْمُسْلِمِينَ حَتّى يَنَالَهُ، ثُمَّ غَلَبَ عَدْلُهُ جَوْرَهُ فَلَهُ الْجَنَّةُ، وَمَنْ غَلَبَ جَوْرُهُ عَدْلَهُ فَلَهُ النَّارُ).رَوَاهُ أَبُوْ دَاوُدَ.
Abu Huraira (may Allah be pleased with him) narrated: The Messenger of Allah (ﷺ) said: Whoever seeks to judge Muslims and attains it, if his justice overcomes his injustice, he will have Paradise, but if his injustice overcomes his justice, he will have the Fire. [Narrated by Abu Dawud]
وَعَنْ عَبْدِ اللهِ بْنِ أَبِيَّ أَوْقَى قَالَ: قَالَ رَسُوْلُ اللهِ ﷺ: (إِنَّ اللّهَ مَعَ الْقَاضِيمَا لَمْ يَجُرْ، فَإِذَا جَارَ تَخَلَّى عَنْهُ وَلَزِمَهُ الشَّيْطَانُ). رَوَاهُ التِّرْمِذِيُّ وَابْنُ مَاجَهِ. وَفِي رِوَايَة: (فَإِذَا جَارَ وَكَّلَهُ إِلَى نَفْسِهِ).
Abdullah ibn Abi Awqa narrated: The Messenger of Allah (ﷺ) said: Allah is with the judge as long as he does not act unjustly. If he acts unjustly, He abandons him, and Satan clings to him. [Narrated by al-Tirmidhi and Ibn Majah] In another narration: If he acts unjustly, He entrusts him to himself.
وَعَنْ سَعِيْدِ بْنِ الْمُسَيِّبِ أَنَّ مُسْلِمًا وَيَهُوْدِيًّا اخْتَصَمَا إِلَى عُمَرَ فَرَأَى الْحَقَّلِلْيَهُودِيِّ فَقَضَى لَهُ عُمَرُ بِهِ، فَقَالَ لَهُ الْيَهُودِيُّ: وَاللهِ لَقَدْ قَضَيْتَ بِالْحَقِّ فَضَرَبَهُ عُمَرُبِالدِّرَّةِ، وَقَالَ: وَمَا يُدْرِيكَ؟ فَقَالَ لَهُ الْيَهُودِيُّ: وَاللهِ، إِنَّا تَجِدُ فِي التَّوْرَاةِ أَنَّهُ لَيْسَ قَاضٍيَقْضِي بِالْحَقِّ إِلَّا كَانَ عَنْ يَمِينِهِ مَلَكٌّ وَعَنْ شِمَالِهِ مَلَكُّ يُسَدِّدَانِهِ وَيُوَفِّقَانِهِ لِلْحَقِّ، مَا دَامَمَعَ الْحَقِّ، فَإِذَا تَرَكَ الْحَقَّ عَرَجَا وَتَرَكَاهُ رَوَاهُ مَالِكٌّ.
Sa‘id ibn al-Musayyib narrated: A Muslim and a Jew brought a dispute to Umar, and he saw the right was with the Jew, so Umar ruled in his favor. The Jew said to him: By Allah, you have judged with the truth. Umar struck him with a whip and said: How do you know? The Jew said: By Allah, we find in the Torah that no judge rules with the truth except that an angel is on his right and an angel on his left, guiding and directing him to the truth as long as he upholds it. When he abandons the truth, they ascend and leave him. [Narrated by Malik]

2 Regarding the saying: Whoever is made a judge among people has been slaughtered without a knife: Al-Khasaf cited in Adab al-Qadi hadiths on the dislike of entering judging and the permissibility of it. Some righteous people entered it, and some righteous people refrained, but refraining is better, safer, and more righteous in faith. This is a matter of disagreement among scholars: after fulfilling the conditions of judging, is it permissible to undertake it? Some said it is disliked, as stated in al-Muhit, based on the Prophet’s (ﷺ) saying: Whoever is tested with judging is as if slaughtered without a knife. It is narrated that Abdullah ibn Wahb was appointed as a judge but refused, retired, and entered his home. Everyone who visited him scratched his face and tore his clothes. A Companion came to the window and said: O Abu Abdullah! If you accepted judging and acted justly, it would be better. He replied: Do you say this with your mind? Have you not heard the Messenger of Allah (ﷺ) say: Judges will be raised with rulers, and scholars with prophets? It is well-known that Abu Hanifa was tasked with judging but refused, even when struck ninety lashes. When he feared for himself, he consulted his companions, and Abu Yusuf permitted it, saying: If you-kernelized, you would benefit people. Abu Hanifa said: If I were ordered to swim across the sea, I would be more capable of it. He foresaw you as a judge and lowered his head, not looking at him afterward. As stated in Khazanat al-Muftin. Muhammad was called to judge but refused, was chained and imprisoned, then compelled to accept. As stated in al-Inaya and Sharh al-Hidayah. Al-Karkhi, al-Khasaf, and Iraqi scholars said, per the school’s founder, it is not permissible unless compelled. Our region’s scholars said: There is no harm in accepting it for one fit and safe from injustice, but refraining is better for others, as the Companions and their followers accepted it without dislike. As stated in al-Wajiz li-l-Kurdari. It is disliked for one who fears deviation, but not if he is safe. As stated in al-Kafi. In al-Yanabi‘: He should not seek or ask for authority. Seeking is saying to the imam: Appoint me as judge. Asking is saying to people: If the imam appointed me judge of such a city, I would accept, hoping it reaches the imam to appoint him. Both are disliked. Some said: If appointed without asking, there is no harm in accepting. Most scholars (may Allah have mercy on them) said entering judging is permissible, but refraining is resolute. As stated in al-Sirajiyya and al-Tatar Khaniyya.
٢ قوله: من جعل قاضيا بين الناس فقد ذبح بغير سكين: قال في (العالمكيرية): أورد الخصاف في (أدب القاضي)أحاديث في كراهة الدخول في القضاء، وفي الرخصة فيه قال. وقد دخل فيه قوم صالحون، وامتنع عنه قوم صالحونوترك الدخول أمثل وأسلم وأصلح في الدين. وهذا فصل اختلف فيه المشايخ: أن بعد استجماع شرائط القضاء في شخص هل يجوز له تقلد القضاء؟ قال بعضهم يكره له التقلد كذا في (المحيط)لما روي عن النبي ﷺ انه قال (من ابتلي بالقضاء فكأنما ذبح بلا سكين)أوروي عن عبد الله بن وهب : أنه استقضى فلم يقبل، وتجان ودخلمنزله، وكان كل من يدخل عليه يخدش وجهه ويمزق ثيابه، فجاء واحد من الصحابة عن رأس الكوة، فقال: يا أباعبد الله! لو قبلت القضاء وعدلت كان خيرا، فقال: يا هذا! أو عقلك هذا؟ أما سمعت رسول الله يقول:(القضاة يحشرون مع السلاطين، والعلماء يحشرون مع الأنبياء)؟
المشهور أن أبا حنيفة كلّف القضاء فأبى حتى ضرب تسعين سوطًا، فلما خاف على نفسه شاور أصحابه،فسوغ له أبو يوسف ، ولو تَقلدتْ لنفعت الناس. فقال أبو حنيفة : لو أمرت أن أعبرالبحر سباحة لكنت أقدرعليه، وكأني بك قاضيا، فنكس رأسه ولم ينظر إليه بعد ذلك. كذا في (خزانة المفتين)، ودعي محمد إلى القضاءفأبى حتى قيد وحبس فاضطر ثم تقلد. كذا في (العناية) وشرح (الهداية). قال الكرخي والخصاف وعلماء العراق:وعليه اختيار صاحب المذهب أنه لا يسوغ ما لم يجبر عليه. قال مشايخ ديارنا: لا بأس بقبوله لمن كان صالحا يأمننفسه الجور والامتناع لغيره أولى؛ فإن الصحابة ومن تلاهم قبلوه بلا كره. كذا في (الوجيز للكردري) وكره التقلدلمن يخاف الحيف فيه، وإن أمن لا يكره. كذا في (الكافي).
وفي (الينابيع): ولا ينبغي أن يطلب الولاية ولا يسألها، فالطلب أن يقول للإمام: وَلَّني القضاء، والسؤال أنيقول للناس: لو ولّاني الإمام قضاء مدينة كذا لأجبته إلى ذلك، وهو يطمع أن يبلغ ذلك إلى الإمام فيقلده، وكل ذلكمكروه. وقال بعضهم: من قلد بغير مسألة فلا بأس بالقبول، ومن سأل يكره له ذلك، والذي عليه عامة المشايخرحمهم الله تعالى أن الدخول في القضاء رخصة والامتناع عنه عزيمة. وفي (السراجية): هو المختار، كذا في (التاتار خانية).
وَعَنْ عَبْدِ اللهِ بْنِ مَسْعُوْدٍ ِرضي الله عنه ، قَالَ: قَالَ رَسُوْلُ اللهِ ﷺ: (مَا مِنْ حَاكِمِيَحْكُمُ بَيْنَ النَّاسِ إِلَّا جَاءَ يَوْمَ الْقِيَامَةِ، وَمَلَكٌ آخِذُّ بِقَفَاهُ، ثُمَّ يَرْفَعُ رَأْسَهُ إِلَى السَّمَاءِ، فَإِنْقَالَ أَلْقِهِ أَلْقَاهُ فِي مَهْوَاةٍ أَرْبَعِينَ خَرِيفًا). رَوَاهُ أَحْمَدُ وَابْنُ مَاجَهِ وَالْبَيْهَقِيُّ فِي ((شُعَبِ الْإِيْمَانِ).
Abdullah ibn Mas‘ud (may Allah be pleased with him) narrated: The Messenger of Allah (ﷺ) said: No judge rules among people except that on the Day of Resurrection, an angel seizes him by the nape, raising his head to the sky. If it is said: Cast him, he is cast into an abyss for forty years. [Narrated by Ahmad, Ibn Majah, and al-Bayhaqi in Shu‘ab al-Iman]
وَعَنْ عَائِشَةَ رضي الله عنها عَنْ رَسُوْلِ اللهِ ﷺ قَالَ: (لَيَأْتِيَنَّ عَلَى الْقَاضِي الْعَدْلِ يَوْمَالْقِيَامَةِ سَاعَةٌ يَتَمَتَّى أَنَّهُ لَمْ يَقْضِ بَيْنَ اثْنَيْنِ فِي تَمْرَةٍ قَطُ). رَوَاهُ أَحْمَدُ وَالدَّارِقُطْنِي.
Aisha (may Allah be pleased with her) narrated from the Messenger of Allah (ﷺ): There will come upon the just judge on the Day of Resurrection a time when he will wish he had never judged between two people even over a single date. [Narrated by Ahmad and al-Daraqutni]
وَعَنِ ابْنِ مَوْهَبٍ أَنَّ عُثْمَانَ رضي الله عنه قَالَ لِابْنِ عُمَرَ: اذْهَبْ فَاقْضِ بَيْنَ النَّاسِ،قَالَ: أَوَ تُعَافِينِيِّ يَا أَمِيرَ الْمُؤْمِنِينَ، قَالَ: فَمَا تَكْرَهُ مِنْ ذَلِكَ وَقَدْ كَانَ أَبُوكَ يَقْضِيْ؟ قَالَ:إِنِّ سَمِعْتُ رَسُولَ اللهِ ﷺ يَقُولُ:(مَنْ كَانَ قَاضِيًا فَقَضَى بِالْعَدْلِ فَبِالْحَرِيِّ أَنْ يَنْقَلِبَمِنْهُ كَفَافًا) فَمَا رَاجَعَهُ بَعْدَ ذَلِكَ. رَوَاهُ التِّرْمِذِيُّ.
وَفِي رِوَايَّةٍ رَزِيْنٍ عَنْ نَافِعِ أَنَّ ابْن عُمَرَ قَالَ لِعُثْمَانَ: يَا أَمِيْرَ الْمُؤْمِنِيْنَ، لَا أَقْضِيْ بَيْنَرَجُلَيْنِ. قَالَ: فَإِنَّ أَبَاكَ كَانَ يَقْضِيْ، فَقَالَ: إِنَّ أَبِيْ لَوْ أُشْكِلَ عَلَيْهِ شَيْءٍ سَأَلَ رَسُوْلَ اللّهِ ﷺ، وَلَوْ أُشْكِلَ عَلَى رَسُولِ اللهِ الله شَيْءٌ سَأَلَ جِبْرِيلَ ، وَإِنِّي لَا أَجِدُ مَنْ أَسْأَلُهُ. وَسَمِعْتُ رَسُوْلَ اللهِ ﷺ يَقُوْلُ: «مَنْ عَاذَ بِاللهِ فَقَدْ عَاذَ بِعَظِيمٍ، وَسَمِعْتُهُ يَقُوْلُ: «مَنْ عَاذَبِاللهِ فَأَعِيْدُوْهُوَإِنِّيْ أَعُوْدُ بِاللهِ أَنْ تَجْعَلَنِيْ قَاضِيًا فَأَعْفَاهُ، وَقَالَ: لَا تُخْبِرْ أَحَدًا.
Ibn Mawhab narrated: Uthman (may Allah be pleased with him) said to Ibn Umar: Go and judge among people. He said: Will you excuse me, O Commander of the Faithful? He said: Why do you dislike it when your father judged? He said: I heard the Messenger of Allah (ﷺ) say: Whoever was a judge and judged justly will barely escape it unscathed. He did not argue further. [Narrated by al-Tirmidhi] In a narration by Razin from Nafi‘, Ibn Umar said to Uthman: O Commander of the Faithful, I will not judge between two people. He said: Your father judged. He said: If my father was uncertain about something, he asked the Messenger of Allah (ﷺ), and if the Messenger of Allah (ﷺ) was uncertain, he asked Jibril. I find no one to ask. I heard the Messenger of Allah (ﷺ) say: Whoever seeks refuge with Allah has sought a great refuge. I seek refuge with Allah from being made a judge. So he excused him and said: Do not tell anyone.
