عَنْ ثَوْرِ بْنِ زَيْدِ الدِّيِلِيَّ أَنَّ١ عُمَرَ بْنَ الْخَطَّابِ اسْتَشَارَ فِي الْخَمْرِ يَشْرَبُهَاالرَّجُلُ فَقَالَ لَهُ عَلِيٍّ: نَرَى أَنْ تَجْلِدَهُ ثَمَانِينَ؛ فَإِنَّهُ إِذَا شَرِبَ سَكِرَ، وَإِذَا سَكِرَ هَذَى، وَإِذَاهَذَى افْتَرَى أَوْ كَمَا قَالَ، فَجَلَدَ عُمَرُ فِي الْخَمْرِ ثَمَانِينَ. رَوَاهُ مَالِكٌّ وَوَصَلَهُ الدَّارَقُطِنِيُّوَالنَّسَائِيُّ وَالْحَاكِمُ وَصَحَّحَهُ، وَرَوَاهُ عَبْدُ الرَّزَّاقِ مَوْصُوْلًا مِنْ طَرِيْقٍ آخَرَ.

وَفِي رِوَايَةٍ لِمُسْلِمٍ عَنْ أَنَسِ بْنِ مَالِكٍ ، أَنَّ النَّبِيَّ ﷺ أُتِيَ بِرَجُلٍ قَدْ شَرِبَ الْخَمْرَفَجَلَدَهُ بِجَرِيدَتَيْنٍ نَحْوَ أَرْبَعِينَ. قَالَ: وَفَعَلَهُ أَبُو بَكْرٍ، فَلَمَّا كَانَ عُمَرُ اسْتَشَارَ النَّاسَ،فَقَالَ عَبْدُ الرَّحْمَنِ: أَخَفَّ الْحُدُودِ ثَمَانِينَ، فَأَمَرَ بِهِ عُمَرُ.

وَرَوَى أَحْمَدُ عَنْ أَبِيْ سَعِيْدٍ رضي الله عنه ، قَالَ: جُلِدَ عَلَى عَهْدِ رَسُوْلِ اللهِ ﷺ فِي الْخَمْرِ بِنَعْلَيْنِأَرْبَعِينَ، فَلَمَّا كَانَ زَمَنُ عُمَرَ جُلِد بَدَلَ كُلِّ نَعْلٍ سَوْطًا. وَرَوَى التَّرْمِذِيُّ َنحْوَهُ وَحَسَّنَهُ.

وَرَوَى أُبُوْ حَنِيْفَةَ عَنِ ابْنِ مَسْعُوْدٍ رضی اللہ عنه، قَالَ: أَتَاهُ رَجُلٌ ١ باِبْنِ أَخٍ لَهُ تسوان قَدْ ذَهَبَعَقْلُهُ، فَأَمَرَ بِهِ فَجَلَسَ حَتَّى إِذَا صَحَا وَأَفَاقَ عَنْ السَّكْرِ، دَعَا بِالسَّوْطِ فَقَطَعَ تَمْرَتَهُ ثُمَّرَقَّهُ وَدَعَا جَلَّادًا، فَقَالَ: اجْلِدْ عَلَى حلن وَارْفَعْ يَدَكَ فِي جَلْدِكَ، وَلَا تَبْدَأْ ضَبُعَيْكَ، قَالَ:وَأَنْشَأَ عَبْدُ اللهِ يَعُدُّ حَتى أَكْمَلَ ثَمَانِيْنَ جَلْدَةً خَلَّى سَبِيْلَهُ، فَقَالَ الشَّيْخُ: يَا أَبَا عَبْدٍالرَّحْمَنِ، وَاللهِ إِنَّهُ لابْنُ أَخِيْ، وَمَا لِيْ وَلدٌ غَيْرُهُ، فَقَالَ: شَرُّ الْعَمِّ وَالِيْ الْيَتِيْمِ أَنْتَ كبتوَاللهِ مَا أَحْسَنْتَ أَدَبَهُ صَغِيْرًا وَلَا سَتَرْتَهُ كَبِيْرًا.

English

Thawr ibn Zayd al-Diyali narrated that Umar ibn al-Khattab (may Allah be pleased with him) sought counsel regarding a man who drank wine. Ali (may Allah be pleased with him) said to him: We see that you should lash him eighty times, for when he drinks, he becomes intoxicated, and when he is intoxicated, he raves, and when he raves, he slanders, or as he said. So Umar (may Allah be pleased with him) lashed eighty times for drinking wine. [Narrated by Malik, and connected by al-Daraqutni, al-Nasa’i, and al-Hakim, who authenticated it. Abd al-Razzaq narrated it connected through another chain.]

In a narration by Muslim from Anas ibn Malik (may Allah be pleased with him), the Prophet (ﷺ) was brought a man who had drunk wine, and he lashed him with two palm branches about forty times. He said: Abu Bakr (may Allah be pleased with him) did the same. When it was Umar’s (may Allah be pleased with him) time, he consulted the people, and Abd al-Rahman (may Allah be pleased with him) said: The lightest of punishments is eighty. So Umar (may Allah be pleased with him) ordered it.

Ahmad narrated from Abu Sa’id (may Allah be pleased with him), who said: During the time of the Messenger of Allah (ﷺ), a man was lashed for drinking wine with two sandals, forty times. When it was Umar’s time, a whip was used instead of each sandal. Al-Tirmidhi narrated something similar and deemed it good.

Abu Hanifa narrated from Ibn Mas’ud (may Allah be pleased with him), who said: A man brought his nephew, who was intoxicated and had lost his senses, to him. He ordered that he be detained until he sobered and recovered from intoxication. Then he called for a whip, cut its date cluster, softened it, and summoned a flogger, saying: Lash on the skin, raise your hand in lashing, and do not start with your armpits. He said: Abdullah began counting until he completed eighty lashes, then released him. The elder said: O Abu Abd al-Rahman, by Allah, he is my nephew, and I have no child besides him. He said: The worst guardian of an orphan is you, by Allah, you neither disciplined him when young nor protected him when grown.

1 The statement: Umar ibn al-Khattab sought counsel, etc.: The imams unanimously agreed on the prohibition of wine and its impurity, that drinking a large or small amount warrants punishment, and that one who permits it is ruled a disbeliever. The punishment is not less than forty by consensus, and the disagreement is only regarding increasing beyond forty. Abu Hanifa and Malik said: Eighty, like the punishment for slander, except that the punishment for slander is established by the Qur’an, while the basis for the punishment for drinking is established by prophetic narrations, and its amount is established by the consensus of the Companions. Al-Shafi’i said: Forty, and anything beyond forty is discretionary, and the imam may increase the penalty if his judgment leads to it. I say: Al-Kharqi preferred eighty. Ibn Abd al-Barr said: The majority of scholars from the early and later generations hold that the punishment for drinking is eighty, and this is the view of al-Thawri, al-Awza’i, Ishaq, Ahmad, and one of al-Shafi’i’s two opinions. The Companions reached a consensus during Umar’s time on this, with no opposition, and a group of the Followers held this view. Disagreement on this is like an outlier opinion refuted by the majority. Ibn Mas’ud said: What Muslims see as good is good with Allah. The Prophet (ﷺ) said: Follow my Sunnah and the Sunnah of the rightly guided caliphs. This applies to a free person, but for a slave, it is half by consensus. They agreed that the punishment for drinking is carried out with a whip, except what is narrated from al-Shafi’i that it is carried out with hands, sandals, and the edge of clothing. 2 The statement: A man brought his nephew, intoxicated, etc.: Know that this narration contains benefits, including: The punishment is not carried out except when sober, not when intoxicated, so he feels the pain of the punishment and deterrence is achieved, so the intoxicated is detained until he recovers. Also, intoxication warrants punishment only if the mind is completely lost, unable to distinguish the sky from the earth, which is the decisive limit for punishment, not for invalidating ablution. The prohibition of intoxicants other than wine requires raving, as precaution is necessary in punishments, taken from the narration: Avoid punishments with doubts, according to Abu Hanifa. According to the other two, raving applies absolutely for prohibition, and for the obligation of punishment, both apply, and their view is preferred for fatwa. According to al-Shafi’i, its effect must appear in his walk, movements, and limbs. Also, punishment is carried out only with a trimmed whip or stick, not with palm branches or sandals, as was done initially when wine was prohibited, then its abrogation and the abrogation of forty were established by the consensus during Umar’s caliphate for eighty. Also, he is lashed on bare skin, not over clothing. Also, the flogger raises his hand in lashing. Also, he does not raise it to expose his armpit or side. Also, the punishment for wine is eighty lashes with a stick, not forty. Also, the guardian must discipline the young, improve them, and correct their habits to prevent immorality and corruption. ١قوله: إن عمر بن الخطاب استشار إلخ: أجمع الأئمة على تحريم الخمر ونجاستها، وإن شرب كثيرها وقليلها موجب للحد، وإن من استحلها حكم بكفره، ولا ينقص حده عن الأربعين إجماعًا، والخلاف إنما هو في الزيادة على الأربعين، فقال أبو حنيفة ومالك: ثمانون كحد القذف إلا أن حد القذف ثبت بالقرآن، وحد الشرب أصله ثبت بالأحاديث المرفوعة، وتقديره ثبت باتفاق الصحابة. وقال الشافعي: أربعون وما زاد على الأربعين كان تعزيرا، وللإمام أن يزيد في العقوبة إذا أدى إليه اجتهاده. قلت: ورجح الخرقي الثمانين. وقال ابن عبد البر: الجمهور من علماء السلف والخلف على أن الحد في الشرب ثمانون، وهو قول الثوري والأوزاعي وإسحاق وأحمد وأحد قولي الشافعي، واتفق إجماع الصحابة في زمن عمر على ذلك، ولا مخالف لهم، وعلى ذلك جماعة من التابعين، والخلاف في ذلك كالشذوذ المحجوج بالجمهور.وقد قال ابن مسعود: ما رآه المسلمون حسنا فهو عند الله حسن وقال النبي ﷺ (عليكم بسنتي وسنة خلفاء الراشدين ) انتهي .وهذا في حق الحر،فاما العبد فعلي النصف من ذلك بالاتفاق، واتفقوا على أن حد الشرب يقام بالسوط إلا ما روي عن الشافعي أنه يقام بالأيدي والنعال وطرف الثياب. قلت: والحق مع الجمهور لاجماع الصحابة على السوط، (رحمة الأمة) (نيل الأوطار) (عمدة الرعاية) (التعليق الممجد) ملتقط منها.

١ قوله: أتاه رجل بابن أخ له نشوان إلخ: اعلم أن في هذا الحديث فوائد، منها: أن الحد لا يقام إلا في حالة الصحو لا في حالة السكر؛ ليجد ألم الحد ويحصل الانزجار، فيحبس السكران إلى زمان الإفاقة. ومنها: أن السكر لا يوجب الحد إلا إذا ذهب عقله بالكلية بحيث لا يعرف السماء من الأرض، وهو الحد البالغ المعتبر في الحد لا في نقض الوضوء، والحرمة من الأشربة المسكرة غير الخمر، ففي حقهما أن يهذي؛ لأن الاحتياط في باب الحدود لازم، اخذا من حديث: (ادرأ الحدود بالشبهات)، هذا عند أبي حنيفة ، وعندهما أن يهذي مطلقًا أي في باب الحرمة، وفي باب وجوب الحد كليهما، وقولهما يختار للفتوى.

وعند الشافعي أن يظهر أثره في مشيه وحركاته وأطرافه، ومنها: أنه لا يقام الحد إلا بالدرة أو السوط المقطوع الثمرة حتى يدق ويصير درة لا بالجريدة والنعال، كما ورد في ابتداء الحال من زمان حرمة الخمر، ثم علم نسخه ونسخ الأربعين بالإجماع المنعقد في خلافة عمر على الثمانين. ومنها: أنه يجلد على الجلد المكشوف لا على الثياب.ومنها: أنه يرف الجلاد يده في الجلد، ومنها: أنه لا يرفع بحيث يبدأ إبطه وضبعه، ومنها: أن حد الخمر ثمانون جلدة بالدرة لا أربعون. ومنها: أنه يجب على الولي تأديب الصغير وتحسينه وتقويم عاداته حتى لا يقع في الفسق والفجور، ومنها: أنه ينبغي الستر على المسلم. ومنها: رأفة الإمام ورقته وشفقته على حال المحدود، والاغتمام والحزن بحده. ومنها: أنه ينبغي العفو والصفح عنه قبل الإتيان به إلى الإمام. ومنها: أنه لا يمكن للإمام إذا عرض عليه أن يترك إقامة الحد. مأخوذ من (تنسيق النظام) و(شرح الوقاية) و(عمدة الرعاية).

وَعَنْ جَابِرٍ الله عَنِ النَّبِيَّ ﷺ قَالَ: (مَنْ شَرِبَ الْخَمْرَ فَاجْلِدُوهُ، فَإِنْ عَادَ الرَّابِعَةَ فَاقْتُلُوهُ)، قَالَ: ثُمَّ أَتِيَ النَّبِيُّ ﷺ بَعْدَ ذَلِكَ بِرَجُلٍ قَدْ شَرِبَ فِي الرَّابِعَةِ فَضَرَبَهُ ١وَلَمْ يَقْتُلْهُ، رَوَاهُ التَّرْمِذِيُّ. وَرَوَاهُ أَبُوْ دَاوُدَ عَنْ قُبَيْصَةَ بْنِ ذُوَيْبٍ.

فَثَبَتَ بِهَذَا أَنَّ الْقَتْلَ بِشُرْبِ الْخَمْرِ فِي الرَّابِعَةِ مَنْسُوْخٌ، وَقِيْلَ: إِنَّهُ بَاقٍ سِيَاسَةً، وَهُوَالْأَصَحُّ.

وَفِي رِوَايَةٍ لِأَبِيْ دَاوُدَ ثُمَّ١ قَالَ: بَكِّتُوهُ، فَأَقْبَلُوا عَلَيْهِ يَقُولُونَ: مَا اتَّقَيْتَ اللهَ مَاخَشِيتَ اللهَ وَمَا اسْتَحْيَيْتَ مِنْ رَسُولِ اللهِ ﷺ، فَقَالَ بَعْضُ الْقَوْمِ: أَخْرَاكَ اللهُ، قَالَ:(لا تَقُوْلُوْا هَكَذَا، لَا تُعِيْنُوْا عَلَيْهِ الشَّيْطَانَ، وَلَكِنْ قُولُوا: اللُّهُمَّ اغْفِرْلَهُ اللَّهُمَّ ارْحَمْهُ).

English

Jabir (may Allah be pleased with him) narrated that the Prophet (ﷺ) said: Whoever drinks wine, lash him. If he repeats it a fourth time, kill him. He said: Then the Prophet (ﷺ) was brought a man who had drunk wine for the fourth time, and he struck him but did not kill him. [Narrated by al-Tirmidhi. Abu Dawud narrated it from Qubaysa ibn Dhuwayb.]

This establishes that killing for drinking wine on the fourth time is abrogated. It was said: It remains as a policy, and this is the sounder view.

In a narration by Abu Dawud, he then said: Reprove him. So they turned to him, saying: Did you not fear Allah? Did you not dread Allah? Were you not ashamed before the Messenger of Allah (ﷺ)? Some people said: May Allah disgrace you. He said: Do not say this, do not aid the devil against him, but say: O Allah, forgive him, O Allah, have mercy on him.

1 The statement: He had drunk wine for the fourth time, and he struck him but did not kill him: The Muslims unanimously agreed on the prohibition of drinking wine and the obligation of punishment for its drinker, whether he drank a little or much. They agreed that he is not killed for drinking it, even if he repeats it, as al-Tirmidhi reported this consensus. Al-Tahawi said: This is the view of Abu Hanifa, Abu Yusuf, and Muhammad, may Allah have mercy on them all. The judge reported from an outlier group that said: He is killed after being lashed four times based on the narration regarding that. This view is invalid, opposing the consensus of the Companions and those after them that he is not killed, even if he repeats it more than four times. The command to kill on the fourth time was in the early days of Islam, then abrogated. A group said: The consensus indicates its abrogation. Some said: It was abrogated by his (ﷺ) saying: The blood of a Muslim is not lawful except for one of three: a life for a life, the married adulterer, and the one who abandons his religion and separates from the community. 2 The statement: He then said, after ordering the punishment for wine, reprove him: From rebuke, which is verbal reprimand and expression. It appears that this command is recommended, unlike the former, which is obligatory. (As in al-Mirqah)

١قوله: قد شرب في الرابعة فضربه ولم يقتله: وقد أجمع المسلمون على تحريم شرب الخمر، وأجمعوا على وجوبالحد على شاربها، سواء شرب قليلًا أو كثيرًا، وأجمعوا على أنه لا يقتل لشربها وإن تكرر ذلك منه، هكذا حكى الإجماعفيه الترمذي. وقال الطحاوي: وهو قول أبي حنيفة وأبي يوسف ومحمد رحمة الله عليهم أجمعين، وحكى القاضي عنطائفة شاذة أنهم قالوا: يقتل بعد جلده أربع مرات لحديث الوارد في ذلك. وهذا القول باطل مخالف لاجماعالصحابة، فمن بعدهم على أنه لا يقتل، وإن تكرر منه أكثر من أربع مرات، والأمر بالقتل في المرة الرابعة كان فيابتداء الإسلام، ثم نسخ. قال جماعة: دل الإجماع على نسخه. وقال بعضهم: نسخه قوله ﷺ: (لا يحل دم امرء مسلمإلا بإحدى ثلاث: النفس بالنفس والثيب الزاني والتارك لدينه المفارق للجماعة). وقيل: إنه باق سياسة، وهوالأصح. أخذته من النووي والطحاوي.

١ قوله: ثم قال أي بعد أمر حد الخمر بكتوه: من التبكيت، وهو التوبيخ والتعبير باللسان، والظاهر أن هذا الأمر للاستحباب بخلاف الأول، فإنه للإيجاب. كذا في (المرقاة).

وَعَنِ ابْنِ عَبَّاسِ رضي الله عُنهَما قَالَ: شَرِبَ رَجُلٌ فَسَكِرَ فَلُقِيَ يَمِيلُ فِي الْفَجِّ، فَانْطُلِقَبِهِ إِلَى رَسُوْلِ اللهِ ﷺ، فَلَمَّا حَادَى بِدَارِ الْعَبَّاسِ انْفَلَتَ فَدَخَلَ عَلَى الْعَبَّاسِ فَالْتَزَمَهُ،فَذُكِرَ ذَلِكَ لِلنَّبِيَّ ﷺ فَضَحِكَ، وَقَالَ:(أَفَعَلَهَا؟) وَلَمْ يَأْمُرْ فِيهِ بِشَيْءٍ. ٢ رَوَاهُ أَبُوْ دَاوُدَ.

وَرَوَى عُبَيْدُ بْنُ عُمَيْرٍ أَنَّ عَلِيًّا وَعُمَرَ قَالَا: مَنْ مَاتَ مِنْ حَدٍّ أَوْ قِصَاصٍ فَلَا ٣ دِيَةًلَهُ، الْحَقُّ قَتْلُهُ. وَرَوَاهُ بِنَحْوِهِ ابْنُ الْمُنْذِرِ عَنْ أَبِي بَكْر.

English

Ibn Abbas (may Allah be pleased with them) said: A man drank and became intoxicated. He was found staggering in the path, so he was taken to the Messenger of Allah (ﷺ). When he neared the house of al-Abbas, he slipped away, entered al-Abbas’s house, and clung to him. This was mentioned to the Prophet (ﷺ), who laughed and said: Did he do that? And he did not order anything regarding him. [Narrated by Abu Dawud]

Ubayd ibn Umayr narrated that Ali and Umar said: Whoever dies from a prescribed punishment or retaliation has no blood money, his death is justified. Ibn al-Mundhir narrated something similar from Abu Bakr.

2 The statement: And he did not order anything regarding him: It is said in al-Maraqat: It is possible that he was not dealt with after entering al-Abbas’s house because the punishment was not established against him by his confession or the testimony of upright witnesses, but he was found staggering in the path, and intoxication was assumed, so the Messenger of Allah (ﷺ) did not investigate him and left him as is. It is also possible that he was not dealt with because he was staggering in the path, meaning the effect of intoxication appeared in his walk, movements, and limbs, which does not warrant punishment. If it were that he did not recognize anything, even the earth from the sky, he would not have been left as is, and the punishment would have been enforced. This is what Abu Hanifa held.

3 The statement: He has no blood money, etc.: Meaning, if he dies from a prescribed punishment or discretionary punishment, his blood is wasted, and nothing is obligated, neither on the imam nor the flogger, nor the one who disciplines by his order, without distinction between the punishment for drinking and others. This is our view, and that of Malik and Ahmad, contrary to al-Shafi’i, because the imam is commanded to enforce the punishment and discretionary discipline, and the action of the commanded is not conditioned on safety. Its details are in al-Fath and al-Tabyin. I say: The implication of the reasoning by the command is that this is not exclusive to the imam, as it was mentioned that every Muslim may enforce discretionary discipline during the commission of the sin, as he is commanded to remove evil, unless he can refer it to the imam, so enforcement is not required of him, unlike the imam, so reflect. ٢ قوله: ولم يأمر فيه بشيء: قال في (المراقات): يحتمل أن يكون إنما لم يعرض له بعد دخوله دار العباس من أجل أنه لم يكن ثبت عليه الحد بإقرار منه أو شهادة عدول، وإنما لقي في الطريق يميل فظن به السكر، فلم يكشف عنه رسول الله ﷺ وتركه على ذلك. ويحتمل أن يكون إنما لم يعرض له من أجل أنه يميل في الفج أي يظهر أثر السكر في مشيه وحركاته وأطرافه، وهو لا يوجب الحد، ولو كان هو أن لا يعرف شيئًا حتى الأرض من السماء لما تركه على ذلك وأقام عليه الحد، هذا ما ذهب إليه أبو حنيفة .

٣ قوله: فلا دية له إلخ: أي من حد أو عزر فمات، يعني من حده الإمام أو عزره فمات فدمه هدر لا يجب به شيء، لا على الإمام ولا على الجلاد، والمعزر بأمره من غير فرق بين حد الشرب وغيره، هذا عندنا ومالك وأحمد، خلافًا للشافعي؛ لأن الإمام مأمور بالحد والتعزير، وفعل المأمور لا يتقيد بشرط السلامة، وتمامه في (الفتح) و(التبيين).قلت: ومقتضى التعليل بالأمر أن ذلك غير خاص بالإمام فقد مر أن لكل مسلم إقامة التعزير حال مباشرة المعصية؛ لأنه مأمور بإزالة المنكر إلا أن يفرق بأنه يمكنه الرفع إلى الإمام، فلم تتعين الإقامة عليه بخلاف الإمام، فتأمل.وأيضًا حجتنا هذه الآثار. التقطته من (شرح الوقاية) و(عمدة الرعاية) و(نيل الأوطار) و(رد المحتار).
