شراب کی حد کا بیان
کے بارے میں مشورہ کیا جب کسی آدمی اس کو پیتا تو سیدنا علی رضی اللہ تعالیٰ عنہ نے آپ کے فرماش کر میری رائے پیہ کر آپ اس کو اسی (80) کوڑے لگا میں کیونکہ جب وہ شراب پیتا تو نشہ میں ہوتا اور نشہ میں ہوتا تو پہ ہودہ بکواس کرتا اور جھجھولی تہمت لگتا ہے یا اس کے مش فرماش راوی نے کہا کہ سیدنا عمر رضی اللہ تعالیٰ عنہ اس کو شراب کے بارے میں اسی (80)
۔ قولہ: ان عمر بن الخطاب استشار الخ (حضرت عمر نے مشورہ کیا) تمام اتمہ کا شراب کی حرمت اور اس کی نجاست پر اجماع ہے اور بقیہ شراب کا کہا زیادہ پیاہر حالت میں سزا کا موجب ہے اور جزئی اس کو حال کی اس کے کافر ہونے کا حکم لگا گیا ہے۔ اور اس کی حد بالاتفاق چاپیس سے کم نہیں ہوتی۔ اختلاف صرف چاپیس پر زیادتی میں ہے پس امام اعظم ابو حنیفہ اور امام ماکر رحمۃ اللہ علیہما نے فرماش کر (اس کی حد) تہمت کی حد کی طرح، اس کوڑے سے تہمت کی حد قرآن سے ثابت ہے اور شراب کی حد اصل احادیث مرفوہ ہے اور اس حد کی مقدار صحابہ کرام کے اتفاق سے ثابت ہے۔ امام شافعی رحمۃ اللہ علیہ نے فرماش کر اس کی حد چاپیس سے اور جو چاپیس سے زیادہ ہے وہ بطور تحریم ہے۔ اور امام کو مزا میں اضافہ کر نے کا اختیار ہے جب کران کا اجتہاد اس با ت کا مقتضی ہو میں کہتا ہوں کہ خرق نے اس کو رانگ قر ار دیا اور ابن عبد البر نے کہا کہ جمہور علما ء سلف و خلف کے پاس شراب نوش کی حد اس کوڑے میں اور یقول سفیان ثوری امام اوزاعی، امام اسحاق اور امام احمد رحمہ اللہ کاہے۔ اور امام شافعی رحمۃ اللہ علیہ کا بھی ایک قول الیا ہے و نیز حضرت عمر رضی اللہ تعالیٰ عنہ کے زمانے میں تمام صحابہ کا اس پر اجماع ہوگیا۔ اور ان کی کوئی مختلف نہیں کیا تا لجین کی جماعت کا اتفاق بھی اس پر ہے۔ اور اس مسل میں اختلاف ایسے شاہ کی طرح سے ہے جو جمہور کے مقابل میں مغلوب سے اور حضرت ابن مسعود رضی اللہ تعالیٰ عنہ م نے فرماش کہ مسلمان جس اچھا بچہ وہ اللہ تعالیٰ کے پاس بھی اچھا ہے اور نبی اکرم صلی اللہ علیہ وسلم نے ارشاد فرماش تم اپنا او پر میری سنہ اور خلافاء راشدین کی سنہ کو لازم کرلو۔ حد آزادی سے متعلق ہے اب ربا غلام پس بالاتفاق اس پراس کا نصف ہے اور علما ء اس پر متفق ہیں کہ ثریب نہری حد کوڑے سے لگانی جانے گی۔ سواں اس روایت کر جو امام شافعی رحمۃ اللہ علیہ سے ہے کر اس کی حد ہاتھوں سے چپلون سے اور کپڑوں کے کناروں سے لگانی جانے گی۔ میں کہتا ہوں کہ حق جمہور کے ساتھ ہے کیونکہ کوڑے سے حد لگانے رصا بہم الرضوان کا اتفاق ہے۔ (ماخوذ از: رحمۃ اللہ، نیل الاوطار، عمدة الرعاية، مرقات، تعلیق محمد)
کوئے لگے - (امام ما لک نے اس کی روایت کی ہے)-
Thawr ibn Zayd al-Diyali narrated that Umar ibn al-Khattab (may Allah be pleased with him) sought counsel regarding a man who drank wine. Ali (may Allah be pleased with him) said to him: We see that you should lash him eighty times, for when he drinks, he becomes intoxicated, and when he is intoxicated, he raves, and when he raves, he slanders, or as he said. So Umar (may Allah be pleased with him) lashed eighty times for drinking wine. [Narrated by Malik, and connected by al-Daraqutni, al-Nasa’i, and al-Hakim, who authenticated it. Abd al-Razzaq narrated it connected through another chain.]
In a narration by Muslim from Anas ibn Malik (may Allah be pleased with him), the Prophet (ﷺ) was brought a man who had drunk wine, and he lashed him with two palm branches about forty times. He said: Abu Bakr (may Allah be pleased with him) did the same. When it was Umar’s (may Allah be pleased with him) time, he consulted the people, and Abd al-Rahman (may Allah be pleased with him) said: The lightest of punishments is eighty. So Umar (may Allah be pleased with him) ordered it.
Ahmad narrated from Abu Sa’id (may Allah be pleased with him), who said: During the time of the Messenger of Allah (ﷺ), a man was lashed for drinking wine with two sandals, forty times. When it was Umar’s time, a whip was used instead of each sandal. Al-Tirmidhi narrated something similar and deemed it good.
Abu Hanifa narrated from Ibn Mas’ud (may Allah be pleased with him), who said: A man brought his nephew, who was intoxicated and had lost his senses, to him. He ordered that he be detained until he sobered and recovered from intoxication. Then he called for a whip, cut its date cluster, softened it, and summoned a flogger, saying: Lash on the skin, raise your hand in lashing, and do not start with your armpits. He said: Abdullah began counting until he completed eighty lashes, then released him. The elder said: O Abu Abd al-Rahman, by Allah, he is my nephew, and I have no child besides him. He said: The worst guardian of an orphan is you, by Allah, you neither disciplined him when young nor protected him when grown.
(1) The statement: Umar ibn al-Khattab sought counsel, etc.: The imams unanimously agreed on the prohibition of wine and its impurity, that drinking a large or small amount warrants punishment, and that one who permits it is ruled a disbeliever. The punishment is not less than forty by consensus, and the disagreement is only regarding increasing beyond forty. Abu Hanifa and Malik said: Eighty, like the punishment for slander, except that the punishment for slander is established by the Qur’an, while the basis for the punishment for drinking is established by prophetic narrations, and its amount is established by the consensus of the Companions. Al-Shafi’i said: Forty, and anything beyond forty is discretionary, and the imam may increase the penalty if his judgment leads to it. I say: Al-Kharqi preferred eighty. Ibn Abd al-Barr said: The majority of scholars from the early and later generations hold that the punishment for drinking is eighty, and this is the view of al-Thawri, al-Awza’i, Ishaq, Ahmad, and one of al-Shafi’i’s two opinions. The Companions reached a consensus during Umar’s time on this, with no opposition, and a group of the Followers held this view. Disagreement on this is like an outlier opinion refuted by the majority. Ibn Mas’ud said: What Muslims see as good is good with Allah. The Prophet (ﷺ) said: Follow my Sunnah and the Sunnah of the rightly guided caliphs. This applies to a free person, but for a slave, it is half by consensus. They agreed that the punishment for drinking is carried out with a whip, except what is narrated from al-Shafi’i that it is carried out with hands, sandals, and the edge of clothing. (2) The statement: A man brought his nephew, intoxicated, etc.: Know that this narration contains benefits, including: The punishment is not carried out except when sober, not when intoxicated, so he feels the pain of the punishment and deterrence is achieved, so the intoxicated is detained until he recovers. Also, intoxication warrants punishment only if the mind is completely lost, unable to distinguish the sky from the earth, which is the decisive limit for punishment, not for invalidating ablution. The prohibition of intoxicants other than wine requires raving, as precaution is necessary in punishments, taken from the narration: Avoid punishments with doubts, according to Abu Hanifa. According to the other two, raving applies absolutely for prohibition, and for the obligation of punishment, both apply, and their view is preferred for fatwa. According to al-Shafi’i, its effect must appear in his walk, movements, and limbs. Also, punishment is carried out only with a trimmed whip or stick, not with palm branches or sandals, as was done initially when wine was prohibited, then its abrogation and the abrogation of forty were established by the consensus during Umar’s caliphate for eighty. Also, he is lashed on bare skin, not over clothing. Also, the flogger raises his hand in lashing. Also, he does not raise it to expose his armpit or side. Also, the punishment for wine is eighty lashes with a stick, not forty. Also, the guardian must discipline the young, improve them, and correct their habits to prevent immorality and corruption. Also, a Muslim should be protected. Also, the imam’s compassion, gentleness, and concern for the punished, and sorrow for their punishment. Also, forgiveness and pardon are preferred before bringing them to the imam. Also, the imam cannot refrain from enforcing punishment once presented. He said: When Umar ibn al-Khattab (RA) consulted the people regarding the prohibition and impurity of all intoxicants, there was consensus among the scholars. As for other intoxicants, their consumption in large quantities leads to punishment, and if one drinks to the point of intoxication, they are considered to have committed disbelief. The prescribed punishment is unanimously agreed to be no less than forty lashes. The disagreement is only about whether it should exceed forty. Imam Abu Hanifah and Imam Malik (may Allah have mercy on them both) stated that the punishment should be like that for slander, which is eighty lashes, as established by the Quran. The punishment for intoxication is established by authentic traditions, and its measure is confirmed by the consensus of the Companions (may Allah be pleased with them). Imam Shafi'i (may Allah have mercy on him) stated that the punishment is forty lashes, and anything exceeding forty is forbidden. The Imam has the discretion to increase the punishment if the circumstances necessitate it. I say that Kharij made this clear, and Ibn Abd al-Barr said that the majority of the scholars of the past and present agree that the punishment for intoxication is forty lashes. Sufyan Thawri, Imam Awza'i, Imam Ishaq, and Imam Ahmad (may Allah have mercy on them) also held this view. Imam Shafi'i (may Allah have mercy on him) also had another opinion, and during the time of Umar (RA), all the Companions reached a consensus on this, with no dissent. The consensus of the community also supports this. Disagreement in this matter is like that of a defeated king before the majority. Ibn Mas'ud (RA) said that a good child is good in the sight of Allah, and the Noble Prophet (peace be upon him) instructed us to follow his Sunnah and the Sunnah of the Rightly Guided Caliphs. Regarding freedom, the punishment is halved for a slave, and the scholars agree that the punishment for theft is to be applied according to the value of the stolen goods. According to a tradition from Imam Shafi'i (may Allah have mercy on him), the punishment for theft is to be applied based on the value of the stolen goods, including clothing and accessories. I say that the truth lies with the majority, as the agreement on applying the punishment based on the value of the stolen goods is the consensus of the scholars. حدیث کو صحیح قرار دیا ہے۔
Dar Qutni, Nasa'i, and Hakim have narrated this with a continuous chain. Furthermore, Hakim has declared this hadith to be authentic.

مسلم کی ایک روایت میں سیدنا انس رضی اللہ تعالیٰ عنہ سے مروی ہے کہ نبی اکرم صلی اللہ علیہ وسلم کی خدمت میں ایک ایسے شخص کو لا یاگیا جس نے شراب پیتی تو آپ صلی اللہ علیہ وسلم نے اس کو دونہیون سے تقریباً چاپیس مارے۔ راوی نے کہا حضرت ابوبکر رضی اللہ تعالیٰ عنہ نے ثانیی کے ساتھ ایسا، کیا حضرت عمر رضی اللہ تعالیٰ عنہ کا دورآیا تو آپ نے لوگوں سے مشورہ کیا تو حضرت عبد الرحمن بن عوف نے کہا کہ تمام حدود میں سب سے بلکہ حد اس کوڑے پینے کو حضرت عمر رضی اللہ عنہ نے اس کا حکم فرما یا - (مسلم)
a person who had drunk wine was brought to the Messenger of Allah ﷺ, and he ordered him to be given about forty lashes with both hands. Abu Bakr (RA) did the same in his time, but when Umar (RA) assumed leadership, he consulted the people, and Abd al-Rahman ibn Auf (RA) said: 'In all the prescribed punishments, the punishment for drinking wine is the most severe.' So Umar (RA) ordered it to be carried out.
- امام احمد نے سیدنا البوسعيد خدری رضی اللہ تعالیٰ عنہ سے روایت نقل کی ہے کہ رسول اللہ صلی اللہ علیہ وسلم کے زمانے میں شراب کی (حد) میں دو چیلون سے چاپیس مارے کے لیکن جب حضرت عمر رضی اللہ تعالیٰ عنہ کا دورآیا تو انہوں نے ہر چیل کی عوض ایک کوڑا امقر کیا۔ امام ترمذی نے اس کے تمام معنی روایت کی ہے اور اس حدیث کو حسن قرار دیا۔
in the time of the Messenger of Allah ﷺ, the punishment for drinking wine was eighty lashes with two whips, but when the era of Umar (RA) came, he replaced each whip with a cane. Imam Tirmidhi has narrated all the meanings of this and classified this hadith as hasan.
- حضرت امام اعظم البوحنیف رحمۃ اللہ علیہ نے سیدنا ابن مسعود رضی اللہ تعالیٰ عنہ نے روایت نقل کی ہے کران کے پاس ایک آدمی 2 چیل کو لا یا جوش میں تھا اور اس کی عقل چل گئی
کہی، تو آپ نے اس کے متعلق حکم فرمایا، تو اس کو قید کر لیا گیا، پھر اس کو جب وہ بھوش میں آیا اور نشرت افاقہ پایا تو آپ نے کوٹا منگوايااوراس کے سرے کی گرہ کو کات دیا، پھراس کو بار کی کیا اور ایک جلا کو بلا کر فرمایا کر اس کی چھڑی پر کوٹا لگاے، اپنے باٹھ کو اٹھاو، اور اپنے بازو کو مرت کھولو راوی نے کہا: حضرت عبد اللہ بن مسعود رضی اللہ عنہ گنے گے، پھر اس کو کر اس نے اس (80) کوٹے کمل کے پھراس کا راستہ چھوڑ دیا گیا، اس کے بعد اس عمر سیدہ آدی نے کہا: اے ابو عبد الرحمن! خدا کی قسم ! وہ میرا بھتیجا ہے، اور اس کے سوا میرا کوئی نہ کا نہ میں ہے، تو آپ نے فرمایا: تو میتیم کی پروش کر نے والا کس قدر برپا ہے، خدا کی قسم ! پچپن میں تو نے اس کی اچھی تربیت نہ میں کی، اور برطے ہوئے پراس کی پردہ پوٹی کچھ نہ میں کی۔
that a man came to him who was in a state of madness, and his reason had left him. When he was brought before him, he gave a ruling that he should be restrained. Later, when the man regained his senses and showed signs of recovery, he asked for a whip and cut off the end of its handle, then he whipped him and called for a jailer, saying, 'Put this whip on his back, lift up his shirt, and open his collar.' The narrator said: 'Abdullah ibn Mas'ud, may Allah be pleased with him, counted, and he made him complete eighty lashes, after which he released him. Then, the old man said, 'O Abu Abdur Rahman! By Allah, he is my nephew, and I have no other relative besides him.' He replied, 'By Allah, how weak you were in fulfilling your responsibility! You did not give him good upbringing in his youth, and you did not guide him when he went astray.'
2قولہ: اتناہ رجل بابن اخ له نشوآن الخ جان لو کر اس حدیث شریف میں کئی فائدے ہیں، نجمل ان کے
حدصرف حالت بھوش میں، یعنی قائم کی جانے کی اور نشر والے کوافاقہ ہو نے کے قید کیا جانے گا۔
نشر موجب حد میں بھگر جب اس کی عقل بالکل طور پر چلنی جانے اس طور پر کہ وہ آسان وزن میں فرق نہ کرے اس قدر نشر کا اعتبار حد جاری کرنے میں ہے۔ وضو و تذکرہ میں نہیں نہر کے سوا وگیر نشر آور نشر ابول کی حرمت اور ان کے حدود کو جاری کرنے کے بارے میں بہتودہ گونی کرنے کا اعتبار ہے۔ کیونکہ حدود کو فرح کرنے کے بارے میں حدیث شریف وارد ہے۔ اس لے حدود جاری کرنے میں احتیاط لازم ہے۔
یا امام اعظم البوحنیف رحمۃ اللہ علیہ کا قول ہے۔ اور صاحبین کے قول میں حرمت اور وجوب حدود نول کے بارے میں صرف بہودہ گونی کا اعتبار ہے۔ اور صاحبین کا قول، یعنی اثاراور ای پرفتوی ہے۔ اور حضرت امام شافعی رحمۃ اللہ علیہ کے پاس کر اس کی چال و حال، حرکات و سکنات اور با تہ پیرو غیرہ میں اس کا اثر ظاہر ہو نے کا اعتبار ہے۔ .......
سیدنا جابر رضی اللہ تعالیٰ عنہ نے حضرت نبی اکرم صلی اللہ علیہ وسلم سے روایت کی ہے۔ آپ صلی اللہ علیہ وسلم نے فرمايا جو شخص شراب پیے تو تم اس کو کوٹے مارو اور اگر وہ چوہی مرتبہ پیے تو تم اس کو تکردو پھراس کے بعد نبی کریم صلی اللہ علیہ وسلم کی خدمت میں ایک آدمی کولا یا گیا جو
۔ اس حدیث شریف میں مجھے فوائد کے پیچھے کے حصر ف درہیائے کوٹے سے لاگئی جانے کی جس کے سرے کی گره کاٹ دی گئی ہے۔ اور اس کواس قدر کوت دیاجانے کرودہبنجا نے طہینون اور چپلون سے مارنہیں جانے گا جسیا کہ شراب کی حرمت کی ابتدا نی زمانہ میں تھا پھر یمنسوخ ہوگیا اور سیدنا عمر فاروق رضی اللہ تعالیٰ عنہ کے دور خلافت میں (40) کی تعداد اجماع سے منسوخ ہوگر (80) کوٹون کی تعداد مقرر فرمائی۔
۔ مجھے فوائد کے پیچھے کر کی چمری پرحد لاگئی جانے کی کپڑون کے اوپر سے نہیں۔
۔ کوٹے لاگئے میں جلا داپنا باتھا اٹھانے کا۔
۔ اس قدر نہیں اٹھانے کا کر اس کے باز اور بلغل دکھائی دے۔
۔ شراب کی حد ای کوٹے سے چا لیس نہیں۔
۔ سر پرست پروا جب سے کر چھوٹول کوادب سکھانے اور ان کے عادات واطوار کو درست کرنے تا کر وہ فسق و فجور میں بتلانے ہو۔
۔ مسلمان کی پردہ پوشتی کرنا مناسب ہے۔
پوچھی مرتبہ 3 شراب پیا تو آپ نے اس کو مارا لیکن قتل نہیں کیا (تردید)۔
Jabir (may Allah be pleased with him) narrated that the Prophet (ﷺ) said: Whoever drinks wine, lash him. If he repeats it a fourth time, kill him. He said: Then the Prophet (ﷺ) was brought a man who had drunk wine for the fourth time, and he struck him but did not kill him. [Narrated by al-Tirmidhi. Abu Dawud narrated it from Qubaysa ibn Dhuwayb.]
This establishes that killing for drinking wine on the fourth time is abrogated. It was said: It remains as a policy, and this is the sounder view.
In a narration by Abu Dawud, he then said: Reprove him. So they turned to him, saying: Did you not fear Allah? Did you not dread Allah? Were you not ashamed before the Messenger of Allah (ﷺ)? Some people said: May Allah disgrace you. He said: Do not say this, do not aid the devil against him, but say: O Allah, forgive him, O Allah, have mercy on him.
(1) The statement: He had drunk wine for the fourth time, and he struck him but did not kill him: The Muslims unanimously agreed on the prohibition of drinking wine and the obligation of punishment for its drinker, whether he drank a little or much. They agreed that he is not killed for drinking it, even if he repeats it, as al-Tirmidhi reported this consensus. Al-Tahawi said: This is the view of Abu Hanifa, Abu Yusuf, and Muhammad, may Allah have mercy on them all. The judge reported from an outlier group that said: He is killed after being lashed four times based on the narration regarding that. This view is invalid, opposing the consensus of the Companions and those after them that he is not killed, even if he repeats it more than four times. The command to kill on the fourth time was in the early days of Islam, then abrogated. A group said: The consensus indicates its abrogation. Some said: It was abrogated by his (ﷺ) saying: The blood of a Muslim is not lawful except for one of three: a life for a life, the married adulterer, and the one who abandons his religion and separates from the community. It was said: It remains as a policy, and this is the sounder view. (Taken from al-Nawawi and al-Tahawi)
(2) The statement: He then said, after ordering the punishment for wine, reprove him: From rebuke, which is verbal reprimand and expression. It appears that this command is recommended, unlike the former, which is obligatory. (As in al-Mirqah)
3۔ اس حدیث شریف میں مجمل فوائد کے پیچ کے حصر ف درہیا لے کوٹے سے لگائی جائے گی جس کے سرے کی گرہ کات دی گئی ہے۔ اور اس کواس قدر کوٹ دیا جائے گر وہ درہ بن جائے۔ طہنیون اور چپلون سے مارنہیں جائے گا جیسا کہ شراب کی حرمت کی ابتدا نی زمانہ میں تھا پھر یمنسوخ ہوگیا اور سیدنا عمر فاروق رضی اللہ تعالیٰ عنہ کے دور خلافت میں (40) کی تعداد اجماع سے منسوخ ہوگر (80) کوٹوں کی تعداد مقرر فرمائی۔
۔ مجمل فوائد کے پیچے کر کلی چھڑی پر حد لگائی جائے گی پکڑوں کے اوپر سے نہیں۔
۔ کوٹے لگانے میں جلا داپنا باتھا لٹھائے گا۔
۔ اس قدر نہیں اٹھائے گا کہ اس کے بازو اور بغل دکھائی دے۔
۔ شراب کی حد ای کوٹے سے چا لیس نہیں۔
۔ سر پر ست پروا جب سے کر چھوٹوں کوادب سکھائے اور ان کے عادات و اطوار کو درست کرے تاکہ وہ فسق و فجور میں بھٹلانہ ہو۔
۔ مسلمان کی پردہ پوٹی کرنا مناسب ہے۔
اس سے ثابت ہوا کہ پوچھی درخ شراب پینے کی پاداش میں قتل کرنا منسوخ ہوگیا اور پیکھا گیا
ہے کہ حکم بطور سیاست اب کی باقی ہے اور یہ قول قابل ترجیح ہے۔

Some said: It was abrogated by his (ﷺ) saying: The blood of a Muslim is not lawful except for one of three: a life for a life, the married adulterer, and the one who abandons his religion and separates from the community. اللهم اغفر له، اللهم ارحمه، اے پروردگار! تو اس کو جش دے، اے پروردگار تو اس پر حم فرمائے۔
زجر و تنزہ کرو اور اس سے لوگ یہ کیے ہوئے متوجہ ہوئے تو اللہ تعالیٰ کیون نہیں ڈرا اور اللہ سے کیون
نہیں خوف کیا تو نرسول اللہ صلی اللہ علیہ وسلم سے حیاء نہیں اس کے بعد کی نے احزاک اللہ کہا لیجئے اللہ
تعالیٰ تجہ کو سوا کرے تو آپ صلی اللہ علیہ وسلم نے فرمایا کہ تم الیامت کہو تم اس پرشيطان کی مدومت کرو بلکہ یکہو
کہ اللہم اغفر لہ، اللہم ارحُمہ، اے پروردگار! تو اس کو جش دے، اے پروردگار تو اس پر حم فرمائے۔
قولہ: قد شرب فی الرابعة فضربه ولم يقتله يقيناً مسلما نول نے شراب پینے کی حمت پراجامع کیا
ہے اور شراب پینے والے پر خواہ تجوڑا پیئے یازیادہ برحالت میں حد کے واجب ہوئے پر مجھی اجماع کیا۔
اس طرح انہوں نے اس بات پر مجھی اجماع کیا کہ شراب پینے کی وجہ سے اس کو قتل نہیں کیا جائے گا اگر عمل اس
سے متعدی مرتبہ ہو۔
اس طرح امام ترمذی نے اس کے بارے میں ہوئے اجماع کو قل کیا ہے۔
اور امام طحاوی رحمۃ اللہ علیہ نے کہا کہ مجھی قول امام بوحنیفہ، امام ابویوسف، امام محمد رحمۃ اللہ علیہم اجمعین کا ہے۔
اور قاضی نے ایک جماعت شاہہ سے قتل کیا ہے کہ انہوں نے نذکورہ حدیث کی بناء پر کہا کہ اس کو چار مرتبہ کوٹے مارنے
کے بعد قتل کرو ایا جائے گا لیکن پر قول باطل ہے اور صحابان کے بعد والو کی اس بات پراجامع کے منافی ہے کہ اس کو
قتل نہیں کیا جائے گا اگرچہ اس سے عمل چار مرتبہ سے زائد ہو پوچھی مرتبہ قتل کرنے کا حکم ابتداء اسلام میں تھا پچھر
منسوخ ہوگیا علماء کی ایک جماعت نے کہا کہ اس کے منسوخ ہوئے پراجامع والیت کر رہا ہے اور بعض حضرات نے کہا
ہے کہ اس کا منسوخ ہونا حضور صلی اللہ علیہ وسلم کے اس ارشاد کی وجہ سے ہے کہ مسلمان کا خون حلال نہیں سوا ہے تین
طریقوں میں کسی ایک طریقے سے۔

قتل کی سزا اگر سیاسی مصلحت ہوتی باقی ہے اور کچھ بات زیادہ قابل ترجیح ہے۔ (نووی طحاوی)
قولہ: ثم قال بكتوه الخ پھر آپ نے فرمایا پیشہ شراب کی حد کو نافذ کرنے کا حکم دینے کے بعد "بکتوہ"
فرمایا پیشہ اس کو زجر و تنزہ کرو پلفظ تبکیت سے مشتق ہے اس کے معنی زجر و تنزہ کرنا اور زبان سے اس کو عار دلانا
ہے اور طاہر ہے کہ حکم استحالی ہے برخلاف حکم اول (اسی کوڑے) کے کروہ واجب ہے۔ (مرقات)
Jabir (may Allah be pleased with him) narrated that the Prophet (ﷺ) said: Whoever drinks wine, lash him. If he repeats it a fourth time, kill him. He said: Then the Prophet (ﷺ) was brought a man who had drunk wine for the fourth time, and he struck him but did not kill him. [Narrated by al-Tirmidhi. Abu Dawud narrated it from Qubaysa ibn Dhuwayb.]
This establishes that killing for drinking wine on the fourth time is abrogated. It was said: It remains as a policy, and this is the sounder view.
In a narration by Abu Dawud, he then said: Reprove him. So they turned to him, saying: Did you not fear Allah? Did you not dread Allah? Were you not ashamed before the Messenger of Allah (ﷺ)? Some people said: May Allah disgrace you. He said: Do not say this, do not aid the devil against him, but say: O Allah, forgive him, O Allah, have mercy on him.
(1) The statement: He had drunk wine for the fourth time, and he struck him but did not kill him: The Muslims unanimously agreed on the prohibition of drinking wine and the obligation of punishment for its drinker, whether he drank a little or much. They agreed that he is not killed for drinking it, even if he repeats it, as al-Tirmidhi reported this consensus. Al-Tahawi said: This is the view of Abu Hanifa, Abu Yusuf, and Muhammad, may Allah have mercy on them all. The judge reported from an outlier group that said: He is killed after being lashed four times based on the narration regarding that. This view is invalid, opposing the consensus of the Companions and those after them that he is not killed, even if he repeats it more than four times. The command to kill on the fourth time was in the early days of Islam, then abrogated. A group said: The consensus indicates its abrogation. سیدنا ابن عباس رضی اللہ تعالیٰ علیہما نے روایت کے کے ایک آدمی شراب پی کر
مدہوش ہو کر گیا راستے میں لڑ کر رات ہوئے ملا تو حضرت رسول اللہ صلی اللہ علیہ وسلم کی خدمت میں
لے جایا گیا اور حضرت عباس کے گھر کے مقابل پہنچا تو چھوٹ گیا اور حضرت عباس کے پاس جا کر
ان سے چھٹ گیا تو انہوں نے حضور پاک صلی اللہ علیہ وسلم سے اس کا ذکر کیا تو آپ صلی اللہ علیہ وسلم
مسکرا دیے اور فرمائے کیا اس نے ایسا کیا اس کے بارے 5 میں کسی چیز کا حکم نہیں فرمایا (ابوداؤد)
Ibn Abbas (may Allah be pleased with them) said: A man drank and became intoxicated. He was found staggering in the path, so he was taken to the Messenger of Allah (ﷺ). When he neared the house of al-Abbas, he slipped away, entered al-Abbas’s house, and clung to him. This was mentioned to the Prophet (ﷺ), who laughed and said: Did he do that? And he did not order anything regarding him. [Narrated by Abu Dawud]
Ubayd ibn Umayr narrated that Ali and Umar said: Whoever dies from a prescribed punishment or retaliation has no blood money, his death is justified. Ibn al-Mundhir narrated something similar from Abu Bakr.
(2) The statement: And he did not order anything regarding him: It is said in al-Maraqat: It is possible that he was not dealt with after entering al-Abbas’s house because the punishment was not established against him by his confession or the testimony of upright witnesses, but he was found staggering in the path, and intoxication was assumed, so the Messenger of Allah (ﷺ) did not investigate him and left him as is. It is also possible that he was not dealt with because he was staggering in the path, meaning the effect of intoxication appeared in his walk, movements, and limbs, which does not warrant punishment. If it were that he did not recognize anything, even the earth from the sky, he would not have been left as is, and the punishment would have been enforced. This is what Abu Hanifa held.
(3) The statement: He has no blood money, etc.: Meaning, if he dies from a prescribed punishment or discretionary punishment, his blood is wasted, and nothing is obligated, neither on the imam nor the flogger, nor the one who disciplines by his order, without distinction between the punishment for drinking and others. This is our view, and that of Malik and Ahmad, contrary to al-Shafi’i, because the imam is commanded to enforce the punishment and discretionary discipline, and the action of the commanded is not conditioned on safety. Its details are in al-Fath and al-Tabyin. I say: The implication of the reasoning by the command is that this is not exclusive to the imam, as it was mentioned that every Muslim may enforce discretionary discipline during the commission of the sin, as he is commanded to remove evil, unless he can refer it to the imam, so enforcement is not required of him, unlike the imam, so reflect. عبید بن عمر نے روایت کیا ہے کہ حضرت علی اور حضرت عمر رضی اللہ علیہما نے
فرمایا کہ جو آدمی حدیاقصاص میں انتقال کر جائے تو اس کے لے اس کے قتل کی کولی دیت نہیں ہے 6-
Whoever dies as a result of qisas (retaliation) is not given the blood money for his murder.
اس کے بعد معتق ابن منذر نے ابو برہ روایت کی ہے -
قولہ: ولم یأمر فيه بشئی اس کے بارے میں کسی چیز کا حکم نہیں فرمایا صاحب مرقات نے فرمایا کہ اس
کے لے کوئی حکم نہیں فرمایے ہوسکتا ہے -
اس بنابرہوکہ اس پر حد ثابت نہیں ہوتی نا اس کے اقرار سے اور نہیں عادل گواہوں سے اور اس سے راستے میں لڑ کر راتے
ہوئے ملاقات ہوتی تو اس پر نشرا کمان کر لیا گیا پھر رسول اللہ صلی اللہ علیہ وسلم پریبات ظاہر نہیں ہوتی تو آپ اس کو چھوڑ دیتے -
اور اس بات کا بھی اختیال ہے کہ آپ نے اس کے بارے میں اس کے بھی کوئی حکم نہیں فرمایا کہ وہ راستے میں
لڑ کر ار باقاعدہ نہیں اس کی چال اور اس کے حرکات اور اس کے باہر پر نشرا کا ظاہر ہور باقاعدہ نہیں اس سے حد واجب نہیں ہوتی -
اور اگراس کی کیفیت پیہوتی کر اس کو کسی چیز کی شاکت نہیں ہوتی یہاں تک کہ زین وآ سمان کون پچپانا ہوتا حضور صلی اللہ علیہ
وسلم ایسی صورت میں اس کو نہیں چھوڑتے تھے بلکہ اس پر حد جاری کرتے تھے امام اعظم ابو حنیفہ رحمۃ اللہ کامہی نہہب پے -
قولہ: فلادیة لہ الخ لعنی کوئی آدمی حدیاقزری میں انتقال کر جائے تو نہیں جس پرامام حد جاری کرے یا قزری
مزارے اور وہ اس میں انتقال کر جائے تو اس کے خون کا کوئی ناوال نہیں -
اور اس کی وجہ سے کوئی چیز واجب نہیں ہوتی نہ امام پر نجلاد پر نا امام کے حکم سے تعریبی سزا دینے والے پر اور
اس معاملہ میں شراب اور غیر شراب کی حد میں کوئی فرق نہیں - اور پیتمارا، امام ما کل اور امام احمد کا ذہب پے برخلاف
امام شافعی کے کیونکہ امام حد جاری کرنے اور تعریب قائم کرنے پرامور پے - اور پامور کے عمل کو سلامتی کی شرط کے ساتھ
مقید نہیں کیا جاسکتا ہے - اور اس کی کمل بجث رخ القدراور نہیں میں پے - میں کہتا ہوں کر اس حکم کی علت کا تقاضہ پیہ

صورت میں اس پر حد قائم کرنا متعمد نہیں پے - برخلاف امام کے اس کو چھی طرح جہو نیز ریاحاویث تعریبی پہی ہماری

He did not command anything regarding it; there is no ruling concerning it. The author of Mirqat said that no ruling can be given regarding it because no hadd (prescribed punishment) is established for it, neither by confession nor by the testimony of just witnesses. If he were to meet someone on the road and fight with him at night, and if the hadd were to be applied, it would not be evident to the Messenger of Allah ﷺ, so he would leave him. It is also possible that he did not give any ruling about it, that fighting on the road is not considered regular behavior, and that his actions and movements, as well as his being outside, do not make the hadd applicable. If his condition were such that he did not have the strength to do anything, to the extent that he could not even handle food and drink, the Messenger of Allah ﷺ would not leave him but would apply the hadd. Imam Abu Hanifah (RA) said: 'There is no retribution for anyone who dies while committing a sin for which the hadd is prescribed, or if he commits a sin and then dies while doing it, there is no retribution for his blood.' And this does not necessitate anything, neither for the imam nor for the one who applies the hadd, nor for the one who administers the ta'zir (discretionary punishment). There is no difference between intoxicants and non-intoxicants in this matter. This is the view of the imams Malik, Ahmad, and Abu Hanifah, contrary to the view of Imam Shafi'i, who holds that the hadd should be applied and the ta'zir should be established in all cases. The action of the imam cannot be restricted to conditions of safety. This is a complete and just position. I say that the reason for this ruling should not be sought specifically with the imam, as every Muslim is commanded to avoid sin and to establish ta'zir when necessary. However, this can only be done for benefit, and the imam can only act to the extent that he deems appropriate. In such a case, applying the hadd intentionally is not permissible. Contrary to the imam, this can be done in six ways, including ta'zir and other forms of punishment.
