عَنْ عُمَرَ بْنِ الْخَطَّابِ رضي الله عنه أَنَّ رَجُلًا اسْمُهُ عَبْدُ اللهِ، وَكَانَ يُلَقَّبُ حِمَارًا،وَكَانَ يُضْحِكُ النَّبِيَّ عليه، وَكَانَ النَّبِيُّ وَ قَدْ جَلَدَهُ فِي الشَّرَابِ، فَأُتِيَ بِهِ يَوْمًا فَأَمَرَ بِهِ فَجُلِدَ، فَقَالَ رَجُلٌ مِنَ الْقَوْمِ: اللَّهُمَّ الْعَنْهُ، مَا أَكْثَرَ مَا يُؤْتَى بِهِ، فَقَالَ النَّبِيُّ : لَاتَلْعَنُوهُ، فَوَاللّهِ مَا عَلِمْتُ إِنَّهُ يُحِبُّ اللهَ وَرَسُولَهُ). رَوَاهُ الْبُخَارِيُّ.

وَفِي رِوَايَةٍ أُخْرَى لَهُ: فَلَمَّا انْصَرَفَ قَالَ بَعْضُ الْقَوْمِ: أَخْزَاكَ اللهُ، قَالَ: (لَا تَقُولُواهَكَذَا، لَا تُعِينُوا عَلَيْهِ الشَّيْطَانَ).

English

Umar ibn al-Khattab (may Allah be pleased with him) narrated that a man named Abdullah, nicknamed Donkey, used to make the Prophet (ﷺ) laugh. The Prophet (ﷺ) had lashed him for drinking. One day, he was brought, and the Prophet ordered his lashing. A man from the people said: O Allah, curse him, how often he is brought! The Prophet (ﷺ) said: Do not curse him, for by Allah, I know he loves Allah and His Messenger. [Narrated by al-Bukhari.]

In another narration by him: When he left, some people said: May Allah disgrace you. He said: Do not say this, do not aid the devil against him.

وَعَنْ أَبِيُّ هُرَيْرَةَ رضي الله عنه ، قَالَ: جَاءَ الْأَسْلَميُّ إِلَى نَبِيَّ اللّهِ ﷺ فَشَهِدَ عَلَى نَفْسِهِأَنَّهُ أَصَابَ امْرَأَةً حَرَامًا أَرْبَعَ مَرَّاتٍ، كُلُّ ذَلِكَ يُعْرِضُ عَنْهُ، فَأَقْبَلَ فِي الْخَامِسَةِ، فَقَالَ:(أَنِكْتَهَا؟) قَالَ: نَعَمْ، قَالَ: (حَتَّى غَابَ ذَلِكَ مِنْكَ فِي ذَلِكَ مِنْهَا؟) قَالَ: نَعَمْ، قَالَ: (كَمَايَغِيبُ الْمِرْوَدُ فِي الْمُكْحُلَةِ وَالرَّشَاءُ فِي الْبِئُرِ) قَالَ: نَعَمْ، قَالَ: (فَهَلْ تَدْرِي مَا الرَّنَاءُ؟) قَالَ:نَعَمْ، أَتَيْتُ مِنْهَا حَرَامًا مَا يَأْتِي الرَّجُلُ مِنْ امْرَأَتِهِ حَلَالًا، قَالَ: (فَمَا تُرِيدُ بِهَذَا الْقَوْلِ؟)قَالَ: أُرِيدُ أَنْ تُطَهَّرَنِي، فَأَمَرَ بِه فَرُجِمَ، فَسَمِعَ نَبِيُّ اللَّهِ رَجُلَيْنِ مِنْ أَصْحَابِهِ يَقُولُأَحَدُهُمَا لِصَاحِبِهِ: انْظُرْ إِلَى هَذَا الَّذِي سَتَرَ اللهُ عَلَيْهِ، فَلَمْ تَدَعْهُ نَفْسُهُ حَتَّى رُجِمَ رَجْمَالْكُلْبِ، فَسَكَتَ عَنْهُمَا، ثُمَّ سَارَ سَاعَةً حَتَّى مَرَّ بِجِيفَةِ حِمَارٍ شَائِلٍ بِرِجْلِهِ، فَقَالَ: (أَيْنَفُلَانُ وَفُلَانُ؟) فَقَالَا: نَحْنُ ذَانٍ يَا رَسُولَ اللهِ، فَقَالَ: (انْزِلَا فَكُلَا مِنْ جِيفَةٍ هَذَا الْجِمَارِ) فَقَالَا: يَا نَبِيَّ اللهِ، مَنْ يَأْكُلُ مِنْ هَذَا؟ قَالَ:(فَمَا نِلْتُمَا مِنْ عِرْضٍ أَخِيكُمَا آنِفًا أَشَدُّ مِنْأَكْلٍ مِنْهُ، وَالَّذِيْ نَفْسِي بِيَدِهِ، إِنَّهُ الْآنَ لَفِي أَنْهَارِ الْجَّنةِ يَنْقَمِسُ فِيهَا). رَوَاهُ أَبُوْ دَاوُدَ.

English

Abu Hurayra (may Allah be pleased with him) said: Al-Aslami came to the Prophet of Allah (ﷺ) and testified against himself four times that he had committed unlawful intercourse with a woman, each time the Prophet turned away from him. On the fifth time, he turned to him and said: Did you have intercourse with her? He said: Yes. He said: Until that part of you was concealed in that part of her? He said: Yes. He said: Like the stick is concealed in the kohl container or the rope in the well? He said: Yes. He said: Do you know what adultery is? He said: Yes, I did with her unlawfully what a man does with his wife lawfully. He said: What do you want with this statement? He said: I want you to purify me. So he ordered him to be stoned. The Prophet of Allah (ﷺ) heard two of his companions, one saying to the other: Look at this one whom Allah concealed, but his soul did not leave him until he was stoned like a dog. He remained silent about them, then traveled for a while until he passed by the carcass of a donkey with its leg raised. He said: Where are so-and-so and so-and-so? They said: We are here, O Messenger of Allah. He said: Get down and eat from this donkey’s carcass. They said: O Prophet of Allah, who would eat this? He said: What you took from your brother’s honor just now is worse than eating it. By the One in Whose hand is my soul, he is now plunging in the rivers of Paradise. [Narrated by Abu Dawud.]

وَعَنْهُ رضی اللہ عنه قَالَ: قَالَ رَسُوْلُ اللهِ ﷺ:(مَا أَدْرِيْ ١ الْحُدُوْدُ كَفَّارَاتٌ لِأَهْلِهَا أَمْلَا). رَوَاهُ الْبَيْهَقِيُّ فِي سُنَنِهِ. وَرَوَى عَبْدُ الرَّزَّاقِ وَالْحَاكِمُ فِي مُسْتَدْرَكِهِ وَالْبَزَّارُ فِي مُسْنَدِهِمِثْلَهُ، وَقَالَ الْحَاكِمُ: صَحِيْعٌ عَلَى شَرْطِ الشَّيْخَيْنِ، وَالسَّنَدُ قَوِيٌّ بِاعْتِرَافِ الْحافِظِ، وَأَبُوْهُرَيْرَةَ مُتَأَخَّرُ عَنْ عُبَادَةَ فَالْعِبْرَةُ لَهُ.

وَرَوَى الطَّحَاوِيُّ عَنْ أَبِي هُرَيْرَةَ قَالَ: أُتِيَ بِسَارِقٍ إِلَى النَّبِيِّ ﷺ فَقَالُوا: يَا رَسُوْلَ اللهِ، إِنَّ هَذَا سَرَقَ، فَقَالَ: مَا أَخَالُهُ سَرَقَ، فَقَالَ السَّارِقُ: بَلَى يَا رَسُوْلَ اللّهِ ﷺ ، قَالَ(اذْهَبُوا بِهِ فَاقْطَعُوهُ ثُمَّ احْسِمُوهُ ثُمَّ اثْتُونِى بِهِ)، قَالَ: فَذُهِبَ بِهِ فَقُطِعَ ثُمَّ حُسِمَ ثُمَّ أَتِيَ بِهِ،فَقَالَ: (تُبْ إِلَى اللهِ عَزَّ وَجَلَّ) قَالَ: تُبْتُ إِلَى اللهِ. فَقَالَ (تَابَ اللهُ عَلَيْكَ).

وَفِي رِوَايَةٍ لِأَّبِيْ دَاوُدَ وَالنَّسَائِيِّ وَابْنِ مَاجَه وَالدَّارِميِّ: فَأُمَرَ بِهِ فَقُطِعَ وَجِيءَ بِهِ، فَقَالَ لَهُرَسُوْلُ اللهِ ﷺ (اسْتَغْفِرِ اللَّهَ وَتُبْ إِلَيْهِ )فَقَالَ: أَسْتَغْفِرُ اللهَ وَأَتُوبُ إِلَيْهِ، فَقَالَ لَهُ رَسُوْلُ الله ﷺ : (اللَّهُمَّ تُبْ عَلَيْهِ )ثَلَاثًا وَهَذَا يَدُلُّ عَلَى أَنَّ الْحَدَّ لَيْسَ بِكَفَّارَةٍ لِلذُّنُوبِوَالْكَفَّارَةُ هِيَ التَّوْبَةُ.

English

Abu Hurayra (may Allah be pleased with him) said: The Messenger of Allah (ﷺ) said: I do not know whether the prescribed punishments are expiations for their people or not. [Narrated by al-Bayhaqi in his Sunan. Abd al-Razzaq, al-Hakim in his Mustadrak, and al-Bazzar in his Musnad narrated the same. Al-Hakim said: It is authentic on the condition of the two Shaykhs, and the chain is strong by the acknowledgment of the Hafiz. Abu Hurayra is later than Ubada, so the consideration is for him.]

Al-Tahawi narrated from Abu Hurayra, who said: A thief was brought to the Prophet (ﷺ), and they said: O Messenger of Allah, this one stole. He said: I do not think he stole. The thief said: Yes, O Messenger of Allah (ﷺ). He said: Take him, cut him, then cauterize him, and bring him back to me. He said: He was taken, cut, cauterized, and brought back. He said: Repent to Allah, the Mighty and Exalted. He said: I have repented to Allah. He said: Allah has accepted your repentance.

In a narration by Abu Dawud, al-Nasa’i, Ibn Majah, and al-Darimi: He was ordered to be cut, and he was brought back. The Messenger of Allah (ﷺ) said to him: Seek Allah’s forgiveness and repent to Him. He said: I seek Allah’s forgiveness and repent to Him. The Messenger of Allah (ﷺ) said: O Allah, accept his repentance, three times. This indicates that the prescribed punishment is not an expiation for sins, and the expiation is repentance.

As for what al-Bukhari and others narrated authentically: If one commits any of these sins and is punished for it in this world, it is an expiation for him. If one commits any of them and Allah conceals it, it is up to Allah; if He wills, He forgives him, and if He wills, He punishes him. This must be understood as applying when he repents during the punishment, as this is apparent, because it is apparent that his beating or stoning is accompanied by his repentance due to experiencing the cause of his action, so it is qualified by this to reconcile the evidence. Qualifying the speculative with the definitive opposing it is necessary, unlike the reverse. [As in Fath al-Qadir.] Al-Zayla’i argued that it is not a purifier from sin because it is enforced on the disbeliever, and there is no purifier for him by consensus. 1 The statement: I do not know whether the prescribed punishments are expiations for their people or not: The scholars, may Allah have mercy on them, differed on whether purification from sin is among the rulings of the prescribed punishment without repentance. Many scholars, including the Shafi’is, held this view. Our companions held that it is not among the rulings of the prescribed punishment. If the punishment is enforced on him and he does not repent, the sin of that disobedience does not fall from him, and he is not purified without repentance according to us, meaning the punishment is not a purifier according to us, but the purifier is repentance. This is based on these narrations and the verse on highway robbers, as He, the Exalted, said: That is for them disgrace in this world, and for them in the Hereafter is a great punishment, except for those who repent [al-Ma’ida: 33-34]. The demonstrative pronoun refers to killing, crucifixion, or exile. Allah combined worldly and hereafter punishment for them and dropped the hereafter punishment with repentance, as the exception refers to it, due to the consensus that repentance does not drop the prescribed punishment in this world.

1 The statement: Chapter on discretionary punishment: After mentioning the fixed punishments, he began with the non-fixed. Linguistically, discretionary punishment is discipline in general, by striking or otherwise, less than or more than the prescribed punishment. Legally, it is discipline as a penalty for an act prohibited by Sharia. The difference between discretionary punishment and prescribed punishment, as in Nisab al-Ihtisab, al-Tatarkhaniyya, and others, is in several aspects: First, the prescribed punishment is fixed by Sharia, while discretionary punishment is delegated to the imam’s opinion. Second, the prescribed punishment is averted by doubt, while discretionary punishment is obligatory with it. Third, the prescribed punishment is not enforced on a child, while discretionary punishment is prescribed for him. Fourth, the prescribed punishment applies to a non-Muslim, and the term prescribed punishment is used for him, but his discipline is not called discretionary punishment but penalty. Fifth, the prescribed punishment is exclusive to the imam, while discretionary punishment can be enforced by the husband, master, and anyone who sees someone committing a sin. Sixth, retraction applies in the prescribed punishment, not in discretionary punishment. Seventh, the accused is detained until the witnesses are questioned in the prescribed punishment, not in discretionary punishment. Eighth, intercession is not permissible in the prescribed punishment, unlike discretionary punishment. Ninth, the prescribed punishment is dropped by prescription, unlike discretionary punishment. Tenth, the imam cannot abandon the prescribed punishment, unlike discretionary punishment.

قوله: أدزي الحدود كفارات لاهلها أم لا: اختلف العلماء رحمهم الله تعالى في أن الطهرة من الذنب من أحكامالحد من غير توبة، فذهب كثير من العلماء إلى ذلك، ومنهم الشافعية، وذهب أصحابنا إلى أنها ليست من أحكام الحد،فإذا أقيم عليه الحد ولم يتب لم يسقط عنه إثم تلكالمعصية، ولا يطهر بدون التوبة عندنا، يعني ليس الحد مطهراعندنا، بل المطهر التوبة؛ استدلالًا بهذه الأحاديث وعملًا بآية قطاع الطريق؛ فإنه قال تعالى: ﴿ذَلِكَ لَّهُمْ خِزْيٌ فِىاَلْدُنَّیا وَلَّهُمْ فِى الْآَخِرَةَ عَدَّابُ عَظِيمٌ ﴿ إِلَّاَ أَلَّذِينَ أَبْرِأَ﴾ (المائدة: ٣٣-٣٤)، فإن اسم الإشارة يعود إلى التقتيل أوالتصليب أو النفي. فقد جمع الله تعالى بين عذاب الدنيا والآخرة عليهم، وأسقط عذاب الآخرة بالتوبة، فإن الاستثناءعائد إليه للإجماع على أن التوبة لا تسقط الحد في الدنيا.

وأما ما رواه البخاري وغيره مرفوعًا:(إن من أصاب من هذه المعاصي شيئًا فعوقب به في الدنيا فهو كفارة لهمن أصاب منها شيئًا، فستره الله فهو إلى الله، إن شاء عفا عنه، وإن شاء عاقبه)، فيجب حمله على ما إذا تاب في العقوبة؛لأنه هو الظاهر؛ لأن الظاهر أن ضربه أو رجمه يكون معه توبة منه لذوقه سبب فعله، فيتقيد به جمعا بين الأدلة، وتقيد الظني مع معارضة القطعي له متعين بخلاف العكس. كذا في (فتح القدير).واستدل الزيلعي على عدم كونهمطهرا من الذنب بأنه يقام على الكافر ولا مطهر له اتفاقا، وأوضح دليلنا في (النهر). التقطته من (البحر الرائق) و(عمدة الرعاية)و( ردالمحتار)و (العرف الشذي).

١قوله: باب التعزير: لما ذكر العقوبات المقدرة شرع في غير المقدرة، والتعزير لغة: التأديب مطلقًا بضرب وغيره دون الحد أو أكثر منه، وشرعا: هو تأديب جزاء الفعل هو محظورشرعا، والفرق بين التعزير والحد على ما في (نصاب الاحتساب) و (التاتارخانية) وغيرهما بوجوه، أحدها: أن الحد مقدر شرعا، والتعزير مفوَّض إلى رأي الإمام. وثانيها: أن الحد يندرئ بالشبهة، والتعزير يجب معها. وثالثها: أن الحد لا يجب على الصبي، والتعزير شرع عليه. والرابع: أن الحد يوجد في الذمي ويطلق الحد عليه، وتأديبه لا يسمى تعزيرًا بل عقوبة. والخامس: أن الحد مختص بالإمام، والتعزير يقيمه الزوج والمولى وكل من رأى أحدًا يباشر المعصية. والسادس: أن الرجوع يعمل في الحد لا في التعزير، والسابع: أنه يحبس المشهود عليه حتى يسأل عن الشهود في الحد لا في التعزير. والثامن: أن الحد لا تجوز الشفاعة فيه بخلاف التعزير. والتاسع: أن الحد يسقط بالتقادم دون التعزير. والعاشر: أن الحد لا يجوز للإمام تركه. بخلاف التعزير.

وفي (البحر): أجمعت الأمة على وجوب التعزير في كبيرة لا توجب الحد، وكل من ارتكب معصية ليس فيها حد مقدر، ويثبت عليه عند الحاكم؛ فإنه يجب فيها التعزير، انتهى. وفي(السراجية): من وطئ بشبهة عُزِّر، انتهى. وفي (الذخيرة): إن كان الفعل من جنس ما يجب به الحد، ولم يجب لمانع وعارض، يبلغ التعزير أقصى غاياته، وإن كان منجنس ما لا يجب فيه الحد لا يبلغ أقصى غاياته، ولكنه مفوض إلى رأي الإمام، انتهى. وفي (نصاب الاحتساب):التعزير واجب كالحد؛ لأنه جزاء فعل هو محظور، فيكون واجبًا بخلاف التأديب؛ لأنه غير واجب، بل مباح، انتهى.كذا في (عمدة الرعاية).

وقال في (المرقاة): ثم التعزير فيما شرع فيه التعزير إذا رآه الإمام واجب عندنا، وهو قول مالك وأحمد. وعندالشافعي ليس بواجب؛ لما أن رجلًاً جاء إلى النبيﷺ، فقال: إني رأيت امرأةفأصبت منها ما دون أن أطأها، فقالرسول الله ﷺ: (أصليت معنا؟) قال: نعم، فتلا عليه: ﴿إِنَّ الْحَسَنَتِ يُذْهِبْنَ السَّبِّئَاتِ﴾ (هود: ١١٤). وقال فيالأنصار:(اقبلوا من محسنهم وتجاوزوا عن مسيئهم). وقال رجل للنبي ﷺ في الحكم الذي حكم به للزبير في سقيأرضه، فلم يوافق غرضه: أن كان ابن عمتك، فغضب ﷺ، فلم يعزره. ولنا أن ما كان منصوصًا عليه من التعزير،كما في وطئ جارية امرأته أو جارية مشتركة يجب امتثال الأمر فيه، وما لم يكن منصوصا عليه إذا رأى الإمام بعدمجانبة هوى نفسه المصلحة لو علم أنه لا ينزجر إلا به وجب؛ لأنه زاجر مشروع لحق الله تعالى، فوجب كالحد، وما علم أنه ينزجر بدونه لا يجب، وهو محمل حديث الذي ذكر للنبي ﷺ ما أصاب من إلخ، فإنه لم يذكره النبي ﷺ إلا وهو نادم منزجر لأن ذكره له ليس إلا للاستعلاء بموجبة ليفعل معه، وأما حديث الزبير فالتعزير لحق آدميوهو النبي ﷺ، ويجوز له تركه.

وحاصل ما في (رحمة الأمة): أن التعزير هو مشروع لكل معصية لاحد فيها ولا كفارة، وهل هو فيما يستحقالتعزير في مثله حق واجب للّه عز وجل أم غير واجب. قال الشافعي: لا يجب، بل هو مشروع. وقال أبو حنيفةومالك: إذا غلب على ظنه أنه لا يصلحه إلا الضرب وجب، وإن غلب على ظنه صلاحه بغيره لم يجب. وقال أحمد:إذا استحق بفعله التعزير وجب.
