بَابُ التَّعْزِيْرِDiscretionary Punishment

١قوله: باب التعزير: لما ذكر العقوبات المقدرة شرع في غير المقدرة، والتعزير لغة: التأديب مطلقًا بضرب وغيره دون الحد أو أكثر منه، وشرعا: هو تأديب جزاء الفعل هو محظورشرعا، والفرق بين التعزير والحد على ما في (نصاب الاحتساب) و (التاتارخانية) وغيرهما بوجوه، أحدها: أن الحد مقدر شرعا، والتعزير مفوَّض إلى رأي الإمام. وثانيها: أن الحد يندرئ بالشبهة، والتعزير يجب معها. وثالثها: أن الحد لا يجب على الصبي، والتعزير شرع عليه. والرابع: أن الحد يوجد في الذمي ويطلق الحد عليه، وتأديبه لا يسمى تعزيرًا بل عقوبة. والخامس: أن الحد مختص بالإمام، والتعزير يقيمه الزوج والمولى وكل من رأى أحدًا يباشر المعصية. والسادس: أن الرجوع يعمل في الحد لا في التعزير، والسابع: أنه يحبس المشهود عليه حتى يسأل عن الشهود في الحد لا في التعزير. والثامن: أن الحد لا تجوز الشفاعة فيه بخلاف التعزير. والتاسع: أن الحد يسقط بالتقادم دون التعزير. والعاشر: أن الحد لا يجوز للإمام تركه. بخلاف التعزير.

وفي (البحر): أجمعت الأمة على وجوب التعزير في كبيرة لا توجب الحد، وكل من ارتكب معصية ليس فيها حد مقدر، ويثبت عليه عند الحاكم؛ فإنه يجب فيها التعزير، انتهى. وفي(السراجية): من وطئ بشبهة عُزِّر، انتهى. وفي (الذخيرة): إن كان الفعل من جنس ما يجب به الحد، ولم يجب لمانع وعارض، يبلغ التعزير أقصى غاياته، وإن كان منجنس ما لا يجب فيه الحد لا يبلغ أقصى غاياته، ولكنه مفوض إلى رأي الإمام، انتهى. وفي (نصاب الاحتساب):التعزير واجب كالحد؛ لأنه جزاء فعل هو محظور، فيكون واجبًا بخلاف التأديب؛ لأنه غير واجب، بل مباح، انتهى.كذا في (عمدة الرعاية).

وقال في (المرقاة): ثم التعزير فيما شرع فيه التعزير إذا رآه الإمام واجب عندنا، وهو قول مالك وأحمد. وعندالشافعي ليس بواجب؛ لما أن رجلًاً جاء إلى النبيﷺ، فقال: إني رأيت امرأةفأصبت منها ما دون أن أطأها، فقالرسول الله ﷺ: (أصليت معنا؟) قال: نعم، فتلا عليه: ﴿إِنَّ الْحَسَنَتِ يُذْهِبْنَ السَّبِّئَاتِ﴾ (هود: ١١٤). وقال فيالأنصار:(اقبلوا من محسنهم وتجاوزوا عن مسيئهم). وقال رجل للنبي ﷺ في الحكم الذي حكم به للزبير في سقيأرضه، فلم يوافق غرضه: أن كان ابن عمتك، فغضب ﷺ، فلم يعزره. ولنا أن ما كان منصوصًا عليه من التعزير،كما في وطئ جارية امرأته أو جارية مشتركة يجب امتثال الأمر فيه، وما لم يكن منصوصا عليه إذا رأى الإمام بعدمجانبة هوى نفسه المصلحة لو علم أنه لا ينزجر إلا به وجب؛ لأنه زاجر مشروع لحق الله تعالى، فوجب كالحد، وما علم أنه ينزجر بدونه لا يجب، وهو محمل حديث الذي ذكر للنبي ﷺ ما أصاب من إلخ، فإنه لم يذكره النبي ﷺ إلا وهو نادم منزجر لأن ذكره له ليس إلا للاستعلاء بموجبة ليفعل معه، وأما حديث الزبير فالتعزير لحق آدميوهو النبي ﷺ، ويجوز له تركه.

وحاصل ما في (رحمة الأمة): أن التعزير هو مشروع لكل معصية لاحد فيها ولا كفارة، وهل هو فيما يستحقالتعزير في مثله حق واجب للّه عز وجل أم غير واجب. قال الشافعي: لا يجب، بل هو مشروع. وقال أبو حنيفةومالك: إذا غلب على ظنه أنه لا يصلحه إلا الضرب وجب، وإن غلب على ظنه صلاحه بغيره لم يجب. وقال أحمد:إذا استحق بفعله التعزير وجب.

1 The statement: Chapter on discretionary punishment: After mentioning the fixed punishments, he began with the non-fixed. Linguistically, discretionary punishment is discipline in general, by striking or otherwise, less than or more than the prescribed punishment. Legally, it is discipline as a penalty for an act prohibited by Sharia. The difference between discretionary punishment and prescribed punishment, as in Nisab al-Ihtisab, al-Tatarkhaniyya, and others, is in several aspects: First, the prescribed punishment is fixed by Sharia, while discretionary punishment is delegated to the imam’s opinion. Second, the prescribed punishment is averted by doubt, while discretionary punishment is obligatory with it. Third, the prescribed punishment is not enforced on a child, while discretionary punishment is prescribed for him. Fourth, the prescribed punishment applies to a non-Muslim, and the term prescribed punishment is used for him, but his discipline is not called discretionary punishment but penalty. Fifth, the prescribed punishment is exclusive to the imam, while discretionary punishment can be enforced by the husband, master, and anyone who sees someone committing a sin. Sixth, retraction applies in the prescribed punishment, not in discretionary punishment. Seventh, the accused is detained until the witnesses are questioned in the prescribed punishment, not in discretionary punishment. Eighth, intercession is not permissible in the prescribed punishment, unlike discretionary punishment. Ninth, the prescribed punishment is dropped by prescription, unlike discretionary punishment. Tenth, the imam cannot abandon the prescribed punishment, unlike discretionary punishment.

In al-Bahr: The community unanimously agreed on the obligation of discretionary punishment for a major sin that does not warrant a prescribed punishment, and for anyone who commits a sin without a fixed prescribed punishment, if it is established before the judge, discretionary punishment is obligatory. In al-Sirajiyya: One who has intercourse under a misconception is disciplined. In al-Dhakhira: If the act is of the type that warrants a prescribed punishment but is not enforced due to an impediment, discretionary punishment reaches its maximum extent. If it is of a type that does not warrant a prescribed punishment, it does not reach its maximum extent, but it is delegated to the imam’s opinion. In Nisab al-Ihtisab: Discretionary punishment is obligatory like the prescribed punishment, as it is a penalty for a prohibited act, so it is obligatory, unlike discipline, which is not obligatory but permissible. In al-Marqah: Discretionary punishment, where it is prescribed, is obligatory according to us if the imam sees it, and this is the view of Malik and Ahmad. According to al-Shafi’i, it is not obligatory, because a man came to the Prophet (ﷺ) and said: I saw a woman and did with her what is less than intercourse. The Messenger of Allah (ﷺ) said: Did you pray with us? He said: Yes. He recited to him: Indeed, good deeds remove evil deeds [Hud: 114]. He said in al-Ansar: Accept from their good-doers and overlook their wrongdoers. A man said to the Prophet (ﷺ) about a ruling he gave to al-Zubayr regarding irrigating his land, which did not suit his purpose: Is it because he is your cousin? The Prophet (ﷺ) was angered but did not discipline him. For us, what is explicitly prescribed for discretionary punishment, like intercourse with one’s wife’s slave girl or a shared slave girl, the command must be followed. For what is not explicitly prescribed, if the imam sees a benefit in it without following his whims, and knows that deterrence is only achieved by it, it is obligatory, as it is a prescribed deterrent for Allah’s right, so it is obligatory like the prescribed punishment. If he knows deterrence is achieved without it, it is not obligatory. This is the interpretation of the narration where he mentioned to the Prophet (ﷺ) what he did, as the Prophet (ﷺ) did not mention it except with regret and deterrence, as mentioning it was only to seek what to do with him. As for al-Zubayr’s narration, discretionary punishment was for a human right, the Prophet (ﷺ), and he may waive it.

The summary in Mercy of the Nation: Discretionary punishment is prescribed for every sin without a prescribed punishment or expiation. Is it, for what warrants discretionary punishment, an obligatory right for Allah, the Mighty and Exalted, or not obligatory? Al-Shafi’i said: It is not obligatory but prescribed. Abu Hanifa and Malik said: If he believes that only striking reforms him, it is obligatory; if he believes reform is achieved otherwise, it is not obligatory. Ahmad said: If he deserves discretionary punishment by his act, it is obligatory.

عَن التُّعْمَانِ بْن بشِیر رضی اللہ عنه قَالَ: قَالَ رَسُوْلُ اللّهِ ﷺ: (مَنْ ١ بَلَغ حَدًّا فىغَيْرِ حَدٍّ فَهُوَ مِنَ الْمُعْتَدِيْنَ). رَوَاهُ الْبَيْهَقِيُّ فِي سُنَنِهِ، وَرَوَاهُ مُحَمَّدُ بْنُ الْحَسَنِ فِي (كِتَابِالْآثَارِ) مُرْسَلًاً.

Al-Nu’man ibn Bashir (may Allah be pleased with him) said: The Messenger of Allah (ﷺ) said: Whoever applies a prescribed punishment in other than a prescribed punishment is among the transgressors. [Narrated by al-Bayhaqi in his Sunan. Muhammad ibn al-Hasan narrated it in Kitab al-Athar as a mursal narration.]

In al-Hawi al-Qudsi, Abu Yusuf said: The maximum for a slave is thirty-nine whips, and for a free person seventy-five whips, and we take this. Thus, it is known that Abu Yusuf’s sounder view is this. [Bahr.] The author of Refutation of the Perplexed said: It is possible that his statement: We take this, prefers the second narration from Abu Yusuf over the first, as the second is the apparent narration from him, and it does not necessitate preferring his view over theirs, which is the texts of the school, with Qasim’s confirmation of its correctness from the imams. Thus, the commentator did not rely on what is in al-Bahr. From Abu Yusuf, he considers each type according to its kind, so touching and kissing are likened to the punishment for adultery, and slandering a non-chaste person or a chaste person with other than adultery is likened to the punishment for slander, directing each type to its kind. From him, it is considered according to the severity or minor nature of the offense. [Zayla’i.]

The minimum discretionary punishment is three lashes, as al-Quduri mentioned, as if he saw that less than this does not achieve deterrence, but this is not so, as it varies with individuals. There is no point in fixing it when the purpose is achieved with less, so it is delegated to the judge’s opinion to enforce it as he sees fit, as we will detail, and this is the view of our scholars. [Zayla’i, and similar in al-Hidaya.] In al-Fath: If he sees that one whip achieves deterrence, it suffices, as stated in al-Khulasa. If he sees that only more achieves deterrence, he limits it to that, and replaces that excess with another type, like imprisonment.

In Foundation of Care: Know that discretionary punishment has types. It may be by slapping the neck, tweaking the ear, the judge’s stern look, verbal rebuke short of slander, imprisonment, exile, killing, striking, or otherwise. If the judge’s opinion requires striking in a case, he should reduce it from the lowest prescribed punishment, which is forty whips for drinking wine, as confirmed in Fath al-Qadir. Many scholars mentioned discretionary punishment by killing in cases, saying: The imam may kill one who steals repeatedly as a policy, one who repeatedly strangles, a sorcerer who repeats sorcery, a heretic, a habitual sodomite, one who insults the Prophet (ﷺ), and more so if he is a non-Muslim. They also stated that one who finds a man committing adultery with his wife may kill her. Such cases are numerous. In al-Khulasa and al-Zahiriyya, discretionary punishment by taking wealth or burning a house and the like is permissible.

Our companions and al-Shafi’i’s companions said: The narration of Abu Burda ibn Niyar: No one is lashed more than ten lashes, is abrogated by the Companions’ practice contrary to it without objection. Some later scholars said Abu Burda’s narration applies to discipline by non-authorities, like a master striking his slave, a husband his wife, or a father his child, meaning not exceeding ten in discipline unrelated to a sin, like a father disciplining his young child. 1 The statement: Whoever applies a prescribed punishment in other than a prescribed punishment is among the transgressors: The basis for discretionary punishment being less than prescribed punishments is this narration. If applying discretionary punishment as a prescribed punishment is impossible, Abu Hanifa and Muhammad considered the lowest prescribed punishment, which is the punishment for a slave in slander, which is forty, and reduced it by one whip, making the maximum discretionary punishment thirty-nine whips. This is the truth, as considering a prescribed punishment for free persons would be applying a prescribed punishment, which is the slave’s punishment, and the indefinite punishment in the narration negates it. We say al-Shafi’i said for a free person, and for a slave nineteen, as the slave’s punishment is narrated from him, so he made the maximum discretionary punishment seventy-nine whips, which is Zufar’s view and the analogy. The apparent narration from Abu Yusuf is a reduction of five, as narrated from Ali, and following a Companion in what is not grasped by reason is obligatory, but it is unusual from Ali. Its details are in al-Fath.

وقال أصحابنا وأصحاب الشافعي: حديث أبي بردة بن نيار:(لا يجلد فوق عشر جلدات) منسوخ بدليل عملالصحابة بخلافه من غير إنكار أحد، واستدلوا بأن الصحابة جاوزوا عشرة أسواط، وذكر بعض المتأخرين أنحديث ابي بردة محمول علي التاديب الصادر من غير الولاة كالسيد يضرب عبده والزوج يضرب زوجته والاب ولده، يعني لا يزاد على العشر في التأديب التي لا تتعلق بمعصية، كتأديب الأب ولده الصغير. التقطته من (المرقاة) و(الهداية) و(رد المحتار) و (عمدة الرعاية) و(نيل الأوطار) و (عمدة القاري).

وَعَنْ أَبِيْ هُرَيْرَةَ رضي الله عنه ، عَنِ النَّبِيِّ ﷺ قَالَ: (إِذَا ضَرَبَ أَحَدُكُمْ فَلْيَتَّقِالْوَجْهَ). رَوَاهُ أَبُوْ دَاوُدَ.

English

Abu Hurayra (may Allah be pleased with him) narrated that the Prophet (ﷺ) said: If one of you strikes, let him avoid the face. [Narrated by Abu Dawud.]

وَعَنِ ابْنِ عَبَّاسِ رضي الله عُنهَماعَنِالنَّبِيِّ ﷺ قَالَ:(اِذَاقَالَ١ الرَجُلُ للرَجُلِ يا يَهُودِيُّ، فَاضْرِبُوهُ عِشْرِينَ، وَإِذَا قَالَ: يَا مُخَنَّثُ، فَاضْرِبُوهُ عِشْرِينَ، وَمَنْ وَقَعَ عَلَى٢ذات محْرَمٍ فَاقْتُلُوه). رَوَاهُ التِّرْمِذِيُّ. وَهَذَا زَجْرُ وَسِيَاسَةُ، وَحُكْمُهُ حُكْمُ سَائِرِ الزُّنَاةِ.

English

Ibn Abbas (may Allah be pleased with them) narrated that the Prophet (ﷺ) said: If a man says to another man, O Jew, strike him twenty times. If he says, O effeminate, strike him twenty times. Whoever has intercourse with a forbidden relative, kill him. [Narrated by al-Tirmidhi.] This is a deterrent and policy, and his ruling is the ruling of other adulterers.

1 The statement: If a man says to another man, O Jew, etc.: Abu Burda’s narration is abrogated by this narration, as it is established that the Prophet (ﷺ) exceeded ten lashes. [Taken from al-Luma’at.] In al-Durr al-Mukhtar: The one who insults with O effeminate or O Jew is disciplined. The criterion is that if he attributes to him a voluntary prohibited act that is considered a disgrace by custom, he is disciplined; otherwise, not. [Ibn Kamal.]

2 The statement: Whoever has intercourse with a forbidden relative, kill him: It is said: This applies to one who permits it. Al-Muzhir said: Ahmad ruled by the apparent narration. Others said: This is a deterrent; otherwise, his ruling is that of other adulterers, stoned if chaste, lashed if not chaste. [As in al-Marqah.]

وَعَنْ عُمَرَ أَنَّ رَسُولَ اللهِ ﷺ قَالَ: )إِذَا وَجَدْتُمُ الرَّجُلَ غَلَّ فِي سَبِيلِ اللَّهِفَاحْرِقُوا مَتَاعَهُ١وَاضْرِبُوْه). رَوَاهُ التِّرْمِذِيُّ وَأَبُوْ دَاوُد.

وَقَالَ التَّرْمِذِيُّ: قَالَ الْبُخَارِيُّ: وَقَدْ رُوِيَ فِي غَيْرِ حَدِيثٍ عَنِ النَّبِيِّ ﷺ فِي الْغَالَ فَلَمْ يَأْمُرْ فِيهِ بِحَرْقِ مَتَاعِهِ. وَقَالَ الطّحَاوِيُّ: لَوْ صَحَّ الْحَدِيْثُ لَاحْتَمَلَ أَنْ يَكُوْنَ حِيْنَكَانَتِ الْعُقُوْبَةُ بِالْمَالِ.

English

Umar narrated that the Messenger of Allah (ﷺ) said: If you find a man who has stolen in the path of Allah, burn his belongings and strike him. [Narrated by al-Tirmidhi and Abu Dawud.]

Al-Tirmidhi said: Al-Bukhari said: In other narrations from the Prophet (ﷺ) about the thief, he did not order burning his belongings. Al-Tahawi said: If the narration is authentic, it may have been when punishment with wealth was applicable.

1 The statement: Burn his belongings: In al-Arf al-Shadhi: This narration indicates burning wealth as discretionary punishment. In most of our books, discretionary punishment with wealth is negated and abrogated. I found in al-Hawi al-Qudsi the permissibility of discretionary punishment with wealth from Abu Yusuf. In al-Khulasa and al-Zahiriyya, discretionary punishment by taking wealth, burning a house, and the like is permissible.

1 The statement: I will press wine: They said: This indicates that wine is what is pressed, not what is infused. As in (Nayl al-Awtar).

2 The statement: O you who have believed, indeed, wine, gambling, etc.: There are seven proofs in this verse for the prohibition of wine. First: His saying defilement, and defilement is impurity, and every impure thing is forbidden. Second: His saying from the work of Satan (Al-Ma’ida: 90), and whatever is from his work is forbidden. Third: His saying so avoid it (Al-Ma’ida: 90), and whatever Allah commands to avoid is forbidden. Fourth: His saying that you may succeed (Al-Ma’ida: 90), and whatever success is tied to avoiding, its commission is forbidden. Fifth: His saying Satan only wants to cause between you animosity and hatred through wine and gambling (Al-Ma’ida: 91), and whatever causes animosity and hatred among Muslims is forbidden. Sixth: His saying and to avert you from the remembrance of Allah and from prayer (Al-Ma’ida: 91), and whatever Satan uses to divert Muslims from Allah’s remembrance and prayer is forbidden. Seventh: His saying So will you not desist? (Al-Ma’ida: 91), meaning desist, and whatever Allah commands His servants to desist from, its commission is forbidden (Al-Kashshaf). I say: The eighth is its association with idols, as He said: indeed, wine, gambling, [sacrificial] altars, and divining arrows (Al-Ma’ida: 90), and whatever is associated with disbelief is at least forbidden. Hence, the commentator likened the drinker of wine to an idol-worshipper and the drinker of wine to a worshipper of Lat and Uzza. As in (Al-Mirqat).

١قوله: فأحرقوا متاعه: وقال في (العرف الشذي): يدل حديث الباب على إحراق المالتعزيرا، وفي عامة كُتُبنا نفيالتعزير بالمال، وإنه منسوخ، ووجدت في (الحاوي القدسي) جواز التعزير بالمال عن أبي يوسف، انتهى. وصرّح في (الخلاصة) و(الظهيرية) بجواز التعزير بأخذ المال وبإحراق البيت ونحو ذلك .

٢ قوله: يا أيها الذين آمنوا إنما الخمر والميسر إلخ: فيها دلائل سبعة على تحريم الخمر، أحدها: قوله: ﴿رِجْس﴾ والرجس هو النجس، وكل نجس حرام. والثاني: قوله: ﴿مَنْ عَمَلِ الشَّيْطَنِ﴾ (المائدة: ٩٠) وما هو من عمله فهوحرام. والثالث: قوله: ﴿فَأَجْتَنِبُوهُ﴾ (المائدة: ٩٠) وما أمر الله باجتنابه فهو حرام. والرابع: قوله: ﴿لَعَلَّكُمْ تُفْلِحُونَ﴾ (المائدة: ٩٠) وما علّق رجاء الفلاح باجتنابه فالإتيان به حرام. والخامس: قوله: ﴿إِنَّمَا يُرِيدُ الشَّيْطَنُ أَن يُوقِعَبَيْنَكُمُ اَلْعَدَوَةَ وَاَلْبَغْضَآءَ فِى الْخَمْرِ وَاَلْمَيْسِ﴾ (المائدة: ٩١)، وما هو سبب وقوع العداوة والبغضاء بين المسلمينفهو حرام. والسادس: قوله: ﴿وَيصُدَّكُمْ عَن ذِكْرِ اللّهِ وَعَنِ الصَّلَوَةِ﴾ (المائدة: ٩١) وما يصد به الشيطان المسلمينعن ذكر الله وعن الصلاة فهو حرام. والسابع: قوله: ﴿فَهَلْ أَنْتُم مُّنْتَهُونَ ﴾ (المائدة: ٩١) معناه انتهوا، وما أمر اللهعباده بالانتهاء عنه فالإتيان به حرام، (الكشاف). قلت: والثامن: اقترانها بالأوثان حيث قال: ﴿إِنَّمَا الْخَمْرُواَلْمَيْسِرُ وَاَلْأَنْصَابُ وَاَلْأَّزْلَمُ﴾ (المائدة: ٩٠) وما يفترن بالكفر فلا أقل من أن يكون حرامًا، ولذا أورد شاربالخمر كعابد الوثن وشارب الخمر كعابد اللات والعزى. كذا في (المرقاة).
