وَقَوْلِ اللهِ عَزَّ وَجَلَّ: ﴿فَلَا اقْتَحَمَ الْعَقَبَةَ وَمَا أَدْرَـــٰكَ مَا الْعَقَبَةُ فَكُ رَقَبَةٍ أَوْ إِطْعَمٌ فِي يَوْمٍ ذِي مَسْغَبَةٍ يَتِيمًا ذَا مَقْرَبَةٍ أَوْ مِسْكِينَا ذَا مَتْرَبَةٍ﴾ (البلد : ١١-١٦)

1 قوله : وما أدراك ما العقبة فك رقبة : ندب الشرع إلى فك الرقبة بهذه الآية. كذا في «المبسوط».

English

And the saying of Allah, the Mighty and Majestic: "But he has not attempted the steep ascent. And what will make you know what the steep ascent is? The freeing of a neck, or feeding on a day of hunger an orphan of near kinship, or a poor man lying in the dust" (Al-Balad: 11-16).

1 His saying "and what will make you know what the steep ascent is? The freeing of a neck": the Law commends the freeing of the neck by this verse. So it is in al-Mabsut.

عَنْ أَبِي هُرَيْرَةَ قَالَ: قَالَ رَسُوْلُ اللهِ ﷺ: (مَنْ أَعْتَقَ رَقَبَةً مُسْلِمَةً أَعْتَقَ اللهُ بِكُلِّ عُضْرٍ مِنْهُ عُضْوًا مِنَ النَّارِ، حَتَّى فَرْجَهُ بِفَرْجِهِ». مُتَّفَقٌ عَلَيْهِ.

English

Abu Hurayrah (may Allah be pleased with him) narrated: The Messenger of Allah (ﷺ) said: “Whoever frees a Muslim slave, Allah will free for every limb of his a limb from the Fire, even his private parts for his private parts.” [Agreed upon]

2 The statement: “Whoever frees a Muslim slave, etc.”: This indicates that freeing a Muslim is superior to freeing a non-Muslim, which is the opinion of all scholars. This means there is no disagreement that one who frees a non-Muslim slave is rewarded for the emancipation, but it is not equivalent to the reward for freeing a believing slave. The specification of Islam is to increase the reward. This is the essence of what is stated in Umdat Al-Qari, Nayl Al-Awtar, and Al-Mirqat. It is said to him: Any Muslim who frees a believer, Allah will free for every limb of his a limb from the Fire. For this reason, they recommended that a man free a male slave and a woman free a female slave to ensure the correspondence of limbs to limbs.

۲ قوله: من أعتق رقبة مسلمة إلخ : وفيه إن عتق المسلم أفضل من عتق الكافر، وهو قول كافة العلماء، يعني لا خلاف أن معتق الرقبة الكافرة مثاب على العتق، ولكنه ليس كثواب الرقبة المؤمنة، فالتقييد بالإسلام ليكون ثوابه أكثر، هذا حاصل ما في عمدة القاري و نيل الأوطار» و «المرقاة».

( إليه، قال له: أيما مسلم أعتق مؤمنا أعتق الله بكل عضو منه عضوا منه من النار، ولهذا استحبوا أن يعتق الرجل العبد والأمة المرأة؛ ليتحقق مقابلة الأعضاء بالأعضاء.

۳) قوله : أعتق الله بكل [عضو ] منه عضوا منه من النار حتى فرجه بفرجه: قال في «الهداية»: الإعتاق تصرف مندوب

وَعَنْ عَمْرِو بْنِ عَبَسَةَ (رضي الله عنه) أَنَّ النَّبِيَّ ﷺ قَالَ: «مَنْ بَنَى مَسْجِدًا يُذْكَرُ الله فِيهِ بَنَى الله لَهُ بَيْتًا فِي الْجَنَّةِ، وَمَنْ أَعْتَقَ نَفْسًا مُسْلِمَةً كَانَتْ فِدْيَتَهُ مِنْ جَهَنَّمَ، وَمَنْ شَابَ شَيْبَةً فِي سَبِيلِ الله كَانَتْ لَهُ نُورًا يَوْمَ الْقِيَامَةِ». رَوَاهُ صَاحِبُ الْمَصَابِيحِ فِي شَرْحِ السُّنَّةِ».

English

Amr ibn Abasah (may Allah be pleased with him) narrated that the Prophet (ﷺ) said: “Whoever builds a mosque in which Allah is remembered, Allah will build for him a house in Paradise. Whoever frees a Muslim soul, it will be his ransom from Hell. Whoever grows gray in the way of Allah, it will be a light for him on the Day of Resurrection.” [Narrated by the author of Al-Masabih in Sharh As-Sunnah]

وَعَنِ الْغَرِيفِ بْنِ الدَّيْلَمِيِّ قَالَ: أَتَيْنَا وَائِلَةَ بْنَ الْأَسْفَعِ فَقُلْنَا لَهُ حَدِّثْنَا حَدِيثًا لَيْسَ فِيهِ زِيَادَةٌ وَلَا نُقْصَانُ فَغَضِبَ، وَقَالَ: إِنَّ أَحَدَكُمْ لَيَقْرَأُ وَمُصْحَفُهُ مُعَلَّقُ فِي بَيْتِهِ فَيَزِيدُ وَيَنْقُصُ، قُلْنَا: إِنَّمَا أَرَدْنَا حَدِيثًا سَمِعْتَهُ مِنَ النَّبِيِّ ، فَقَالَ: أَتَيْنَا رَسُولَ الله ﷺ فِي صَاحِبِ لَنَا أَوْجَبَ يَعْنِي النَّارَ بِالْقَتْلِ، فَقَالَ: «أَعْتِقُوْا عَنْهُ يُعْتِقُ الله بِكُلِّ عُضْوٍ مِنْهُ عُضْوًا مِنْهُ مِنَ النَّارِ». رَوَاهُ أَبُوْ دَاوُدَ وَالنَّسَائِيُّ.

English

Al-Gharif ibn Ad-Daylami narrated: We came to Wailah ibn Al-Asqa‘ and said to him: “Tell us a hadith without addition or omission.” He became angry and said: “One of you recites while his Quran is hung in his house, yet he adds and omits.” We said: “We only meant a hadith you heard from the Prophet (ﷺ).” He said: “We came to the Messenger of Allah (ﷺ) regarding a companion of ours who had incurred punishment, meaning the Fire, due to killing. He said: ‘Free a slave on his behalf, and Allah will free for every limb of his a limb from him from the Fire.’” [Narrated by Abu Dawud and An-Nasa’i]

1 The statement: “Who had incurred, etc.”: This means he committed a sin that necessitated entering the Fire, meaning intentional killing, due to the words of Allah, the Exalted: And whoever kills a believer intentionally, his recompense is Hell [An-Nisa: 93]. It must be specified that this was after fulfilling the penalty for killing; otherwise, how could freeing a slave suffice for the right of the victim’s guardian, or it is understood that he killed himself. This indicates that, according to us, punishments do not suffice to expiate the crime, for if they did, there would be no need to free a slave afterward. Thus, it is stated in Badhl Al-Majhud. The essence is what is stated in Ad-Durr Al-Mukhtar and Radd Al-Muhtar: The punishment is not purifying according to us; rather, purification is through repentance. If one is punished but does not repent, the sin of the disobedience remains. Many scholars hold that it is purifying, and our clearest evidence is in An-Nahr.

3 The statement: “Allah will free for every limb of his a limb from him from the Fire, even his private parts for his private parts”: It is stated in Al-Hidayah: Emancipation is a recommended act.

1 قوله : أوجب إلخ : أي ارتكب خطيئه استوجب بها دخول النار، يعني بقتل العمد؛ لقوله تعالى: ﴿وَمَن يَقْتُلْ مُؤْمِنًا مُتَعَمِّدًا فَجَزَاؤُهُ جَهَنَّمُ﴾ (النساء: ۹۳ ويلزم أن يقيد أن هذا كان بعد أداء موجب القتل، وإلا فكيف يجتزأ بتحرير الرقبة من حق ولي المقتول، أو يحمل على أنه كان قتل نفسه. وفيه دلالة على أن الحدود عندنا غير كافية في تكفير الجناية؛ إذ لو كانت فيها كفاية لما احتيج إلى إعتاق الرقبة بعدها. قاله في بذل المجهود». حاصله ما قال في «الدر المختار» ورد المحتار: أن الحد ليس مطهرا عندنا، بل المطهر التوبة، فإذا حد ولم يتب يبقى عليه إثم المعصية، وذهب كثير من العلماء إلى أنه مطهر، وأوضح دليلنا في «النهر».

وَعَنِ الْبَرَاءِ بْنِ عَازِبٍ (رضي الله عنه)قَالَ: جَاءَ أَعْرَابِي إِلَى النَّبِيِّ ، فَقَالَ: عَلِّمْنِي عَمَلًا يُدْخِلْنِي الْجَنَّةَ، فَقَالَ: لَئِنْ كُنْتَ أَقْصَرْتَ الْخُطْبَةَ لَقَدْ أَعْرَضْتَ الْمَسْأَلَةَ، أَعْتِقِ النَّسَمَةَ وَفُكَ الرَّقَبَةَ قَالَ: أَوَلَيْسَا وَاحِدًا؟ قَالَ: «لَا عِتْقُ النَّسَمَةِ أَنْ تَفَرَّدَ بِعِتْقِهَا وَفَكَ الرَّقَبَةِ أَنْ تُعِينَ فِي ثَمَنِهَا، وَالْمِنْحَةُ الْوَكُوفُ، وَالْفَيْءُ عَلَى ذِي الرَّحِمِ الظَّالِمِ، فَإِنْ لَمْ تُطِقْ ذَلِكَ فَأَطْعِمِ الْجَائِعَ وَاسْقِ الظَّمْآنَ، وَأْمُرْ بِالْمَعْرُوفِ وَانْهَ عَنِ الْمُنْكَرِ، فَإِنْ لَمْ تُطِقْ ذَلِكَ فَكُفَّ لِسَانَكَ إِلَّا مِنَ الْخَيْرِ». رَوَاهُ الْبَيْهَقِيُّ فِي شُعَبِ الْإِيْمَانِ».

English

Al-Bara’ ibn Azib (may Allah be pleased with him) narrated: A Bedouin came to the Prophet (ﷺ) and said: “Teach me a deed that will enter me into Paradise.” He said: “Though you have shortened the speech, you have broadened the request. Free a soul and emancipate a slave.” The Bedouin said: “Are they not the same?” He said: “No, freeing a soul is to emancipate it entirely on your own, and emancipating a slave is to assist in its price. Also, lending a milch animal, and showing kindness to an oppressive relative. If you cannot do that, then feed the hungry, give drink to the thirsty, enjoin what is right, and forbid what is wrong. If you cannot do that, then restrain your tongue except from good.” [Narrated by Al-Bayhaqi in Shu‘ab Al-Iman]

وَعَنْ أَبِي ذَرٍّ (رضي الله عنه)، قَالَ : سَأَلْتُ النَّبِيَّ ﷺ أَيُّ الْعَمَلِ أَفْضَلُ؟ قَالَ: «إِيمَانُ بِالله وَجِهَادُ فِي سَبِيلِهِ قُلْتُ: فَأَيُّ الرِّقَابِ أَفْضَلُ؟ قَالَ: «أَعْلَاهَا ثَمَنًا وَأَنْفَسُهَا عِنْدَ أَهْلِهَا»، قُلْتُ: فَإِنْ لَمْ أَفْعَلْ؟ قَالَ: «تُعِينُ ضَابِعًا أَوْ تَصْنَعُ لِأَخْرَقَ قُلْتُ: فَإِنْ لَمْ أَفْعَلْ؟ قَالَ: «تَدَعُ النَّاسَ مِنَ الشَّرِّ ؛ فَإِنَّهَا صَدَقَةٌ تَصَدَّقُ بِهَا عَلَى نَفْسِكَ». مُتَّفَقٌ عَلَيْهِ.

English

Abu Dharr (may Allah be pleased with him) narrated: I asked the Prophet (ﷺ): “Which deed is best?” He said: “Faith in Allah and striving in His way.” I said: “Which slaves are best?” He said: “The most valuable in price and the most precious to their owners.” I said: “If I cannot do that?” He said: “Help a worker or do something for the incapable.” I said: “If I cannot do that?” He said: “Leave people from harm, for it is a charity you give to yourself.” [Agreed upon]

1 The statement: “Which slaves are best?” He said: “The most valuable in price and the most precious to their owners”: It is stated in Al-Mabsut: These narrations clarify that emancipation is an act of righteousness and kindness, and the best slaves are those most valued by their owners. As for what is narrated from Malik, that if a non-Muslim slave is more valuable than a Muslim slave, his emancipation is better than that of a Muslim due to the saying, “The best are the most valuable,” this is far from correct and must be restricted to the most valuable among Muslims. This is because it enables the Muslim to achieve his objectives and frees him. The apparent reason for preferring the emancipation of a non-Muslim is to collect jizyah from him for the Muslims, and as for freeing him for contemplation, it is conceded as a possibility. Thus, it is stated in Al-Mirqat.

1 قوله : فأي الرقاب أفضل ؟ قال : أغلاها ثمنا وأنفسها عند أهلها : قال في المبسوط»: فهذه الآثار تبين أن الإعتاق من باب البر والإرفاق وأن أفضل الرقاب أعزها عند صاحبها، انتهى. وأما ما روي عن مالك إذا كان العبد الكافر أغلى ثمناً من العبد المسلم يكون عتقه أفضل من عتق المسلم؛ لقوله : أفضلها أغلاها، فبعيد عن الصواب ويجب تقييده بالأغلى من المسلمين؛ لأنه تمكين للمسلم من مقاصده وتفريغه، والوجه الظاهر في استحباب عتق الكافر تحصيل الجزية منه للمسلمين، وأما تفريغه للتأمل، فيُسلّم فهو احتمال. كذا في «المرقاة».

وَعَنْ سَمُرَةَ بْنِ جُنْدُبٍ (رضي الله عنه) قَالَ: قَالَ رَسُولُ الله ﷺ: «أَفْضَلُ الصَّدَقَةِ الشَّفَاعَةُ بِهَا يَفَكُ الرَّقَبَةَ». رَوَاهُ الْبَيْهَقِيُّ فِي شُعَبِ الْإِيْمَانِ».

English

Samurah ibn Jundub (may Allah be pleased with him) narrated: The Messenger of Allah (ﷺ) said: “The best charity is intercession by which a slave is freed.” [Narrated by Al-Bayhaqi in Shu‘ab Al-Iman]

1 The statement: Uproot his palm trees, he ordered the Ansari to uproot the palm trees because it was clear that Samurah was harming him, as it was known that they were planted on borrowed land. As stated in Al-Marqah. In Al-Hidayah: If someone borrows land to build or plant, it is permissible, and the lender can retract and require the removal of the building or plants.

1 The statement: “And give them a contract, etc.”: It is stated in Al-Hidayah: This command is not obligatory by consensus among jurists; rather, it is a recommendation, which is the correct view. Interpreting it as permission nullifies the condition, i.e., His saying: if you know there is good in them [An-Nur: 33], because the contract of emancipation is permissible without it. However, the recommendation is tied to it. The meaning of “good” mentioned in His saying: if you know there is good in them [An-Nur: 33], as has been said, is that they will not harm Muslims after emancipation. If they would harm them, it is better not to grant the contract, though it would be valid if the master did so.

1 قوله: وكاتبوهم إلخ : قال في الهداية»: هذا الأمر ليس أمرا يجاب بإجماع بين الفقهاء، وإنما هو أمر ندب هو الصحيح، ففي الحمل على الإباحة إلغاء الشرط، أي قوله : ﴿إِنْ عَلِمْتُمْ فِيهِمْ خَيْرًا﴾ (النور:۳۳)؛ إذ عقد الكتابة مباحبدونه، أما الندبية فمعلقة به، والمراد بالخير المذكور في قوله تعالى: ﴿إِنْ عَلِمْتُمْ فِيهِمْ خَيْرًا﴾ (النور: ۳۳)؛ على ما قيل: إن لا يضر بالمسلمين بعد العتق، فإن كان يضر بهم، فالأفضل أن لا يكاتبه، وإن كان يصح لو فعل المولى عقد الكتابة.
