بَابُ بُلُوغِ الصَّغِيرِ وَحِضَانَتِهِ فِي الصَّغْرِThe Maturity of the Child and Their Custody in Childhood
وَقَوْلِ الله عَزَّ وَجَلَّ: ﴿وَإِذَا بَلَغَ الْأَطْفَالُ مِنكُمُ الْحُلُمَ فَلْيَسْتَئْذِنُوا كَمَا اسْتَعْذَنَ الَّذِينَ مِن قَبْلِهِمْ﴾ (النور: ٥٩)
1 قوله: إذا بلغ الأطفال منكم الحلم إلخ : أي إذا صاروا بالغين بالاحتلام، فَلْيَسْتَقْدِنُوا كَمَا اسْتَنْذَنَ الَّذِينَ مِن قَبْلِهِمْ أي كما استأذن الذين بلغوا من قبلهم وهم الرجال أو كما استأذن الذين كانوا مذكورين من قبل هذا في الآية السابقة، يعني يحتاجون إلى الاستئذان في جميع الأوقات كما يحتاج في ذلك سائر الرجال؛ لقوات المرخص في بعض الأوقات وهو الطفولية، ووجدان الموجب الزائد وهو البلوغة. وإنما خصص البلوغ بالاحتلام؛ لأن البلوغ به أظهر، وإن كان في نفس الأمر غير مقيد به، بل يكون بالسن وغيره أيضًا. كذا في التفسيرات الأحمدية».
And the words of Allah, the Mighty and Majestic: And when the children among you reach puberty, let them seek permission [to enter] as those before them sought permission [An-Nur: 59].
1 The statement: “When the children among you reach puberty, etc.” means when they become mature through wet dreams, let them seek permission as those before them sought permission, meaning as those who reached puberty before them, i.e., men, sought permission, or as those mentioned earlier in the previous verse sought permission. This means they must seek permission at all times, just as other men are required to do, because the exemption for certain times, which is during childhood, has ended, and the additional condition, which is puberty, has been met. Puberty is specified by wet dreams because it is the most evident sign, although in reality, it is not limited to it; it can also occur through age or other means. Thus, it is stated in Al-Ahmadiyya Tafsirs.
وَعَنْ عَلِيِّ بْنِ أَبِي طَالِبٍ (رضي الله عنه) قَالَ: حَفِظْتُ عَنْ رَسُولِ اللهِ ﷺ: «لَا يُتْمَ بَعْدَ احْتِلَامٍ وَلَا صُمَاتَ يَوْمٍ إِلَى اللَّيْلِ. رَوَاهُ أَبُو دَاوُدَ وَالْبَيْهَقِيُّ فِي سُنَنِهِ.
Ali ibn Abi Talib (may Allah be pleased with him) narrated: I memorized from the Messenger of Allah (ﷺ): “There is no orphanhood after wet dreams, and no silence [fasting] from day until night.” [Narrated by Abu Dawud and Al-Bayhaqi in his Sunan]
In a narration by Al-Bayhaqi from him (may Allah be pleased with him), the Messenger of Allah (ﷺ) said: “The pen is lifted from three: the sleeping person until he wakes, the boy until he has wet dreams, and the insane until he recovers.” In the agreed-upon narration from Ibn Umar, he said: “I was presented to the Messenger of Allah (ﷺ) in the year of Uhud when I was fourteen years old, and he rejected me. Then I was presented to him in the year of Khandaq when I was fifteen years old, and he permitted me.” Umar ibn Abdul Aziz said: “This is the distinction between fighters and dependents.”

2 The statement: “There is no orphanhood after wet dreams” clarifies the limit of a child’s maturity. In detail, a boy reaches maturity through one of three things: wet dreams, impregnation, or ejaculation, as these are signs of puberty, and this is by consensus. As for wet dreams, it is due to his (ﷺ) saying: “There is no orphanhood after wet dreams.” As for ejaculation, it is the primary sign by any cause, because wet dreams are only considered with it, and impregnation cannot occur without it. If none of these signs are present, his maturity is deferred until he completes eighteen years. A girl reaches maturity through one of three things: menstruation, wet dreams, or pregnancy. Menstruation is a sign because it typically occurs at the time of potential pregnancy, so it is considered a sign of puberty. Pregnancy is a sign because it indicates ejaculation, as a child is created from the water of the man and the woman. Ejaculation is not mentioned among the signs of a girl’s maturity because it is rarely known, unlike with a boy. If none of these signs are present, her maturity is deferred until she completes seventeen years, because a girl matures faster than a boy, so it is reduced by one year due to her temperament aligning with one of the four seasons. The ruling on maturity for both men and women is set at fifteen years, according to the two [Abu Hanifah and his students], the three [Malik, Shafi‘i, and Ahmad], and a narration from Abu Hanifah (may Allah be pleased with him), based on what was narrated from Ibn Umar (may Allah be pleased with him), who said: “I was presented to the Messenger of Allah (ﷺ) on the day of Uhud when I was fourteen years old, and he did not permit me. Then I was presented to him on the day of Khandaq when I was fifteen years old, and he permitted me.” It appears that the refusal was due to not having reached puberty, and the permission was due to reaching puberty, as it is the common and predominant case. The signs usually appear during this period, so the duration is taken as a sign for those who do not show the signs. The minimum age for puberty for a boy is twelve years, and for a girl, nine years, meaning the earliest time for a boy’s puberty, according to us, is the completion of twelve years, and for a girl, nine years, as they may exhibit signs of puberty at this age. If they claim puberty at this age, it is accepted, but not below that, as the apparent situation contradicts it. The specification of wet dreams and the like indicates that the growth of pubic hair is not considered, though Shafi‘i held this view, citing that the Prophet (ﷺ) ordered regarding the killing of Qurayzah to check: whoever had pubic hair was killed, and whoever did not was spared. The response is that he only ordered this there because there was no other way to determine their status, as they would not truthfully answer about their ages if asked, especially since the truth could lead to their killing, as the mature are killed and others spared. There was no way to know about their wet dreams except through their statements, so only the observation of pubic hair remained, which is a majority-based ruling, and knowledge was based on it, though it is not among the definitive proofs. Looking at it was permitted due to legal necessity. As for Ibn Umar’s case, puberty was not determined there except by age, because knowledge of puberty through wet dreams was only possible if he had a wife to be intimate with. If he had no wife or slave girl, it was not possible to ascertain through impregnation, and wet dreams during sleep are not necessarily present after puberty, as many people go years without them. Thus, only age remained the criterion, which is our position. Also, the beard is not considered, nor are the breasts’ prominence, as Al-Hamawi stated that it is not ruled by in the apparent narration. Similarly, a deep voice, as in the explanation of An-Nazm Al-Hamili by Abu As-Sa‘ud, and likewise hair on the legs, armpits, and mustache, as gathered from the commentaries of Al-Kanz, Ad-Durr Al-Mukhtar, Radd Al-Muhtar, and Al-Kawkab Ad-Durri.
۲ قوله: لا يتم بعد الاحتلام فيه بيان حد بلوغ الصبيان تفصيله أن بلوغ الغلام بأحد ثلاثة أشياء: بالاحتلام والإحبال والإنزال؛ لأنها أمارات البلوغ، وهذا بالإجماع. أما الاحتلام فلقوله لة : لا يتم بعد الاحتلام، وأما الإنزال هو الأصل بأي سبب كان؛ لأن الاحتلام لا يعتبر إلا معه، والإحبال لا يتأتى إلا به، وإن لم يوجد علامة من هذه العلامات، فبلوغه موقوف حتى يتم ثمان عشرة سنة، وبلوغ الجارية بأحد ثلاثة أشياء: الحيض والاحتلام والحبل أما الحيض فلأنه يكون في أوان الحبل عادة، فجعل ذلك علامة البلوغ، وأما الحبل فلأنه دليل على الإنزال؛ لأن الولد يخلق من ماء الرجل والمرأة، ولم يذكر الإنزال في علامات بلوغها؛ لأن إنزالها قلما يعلم.
بخلاف الصبي، وإن لم توجد علامة من هذه العلامات، فبلوغها موقوف حتى يتم لها سبع عشرة سنة، توجد علامة من هذه العلامات، فبلوغها موقوف حتى يتم لها سبع عشرة سنة؛ لأن الجارية أسرع إدراكا من الغلام، فتنقص سنة؛ لاشتمالها على الفصول الأربع التي يوافق المزاج واحد منها لا محالة، ويفتى بالبلوغ في حق الرجل والمرأة خمس عشر سنة، وهذا قولهما، وهو قول الثلاثة، وهو أيضًا رواية عن أبي حنيفة الله لما روي عن ابن عمر الله قال: عُرضت على رسول الله ﷺ يوم أحد وأنا ابن أربع عشرة سنة، فلم يجزني، وعُرضت عليه يوم الخندق وأنا ابن خمس عشرة سنة فأجازني.
فالظاهر أن عدم الإجازة؛ لعدم البلوغ والإجازة للبلوغ، ولأنه المعتاد الغالب، فإن العلامات تظهر في هذه المدة غالبا، فجعلوا المدة علامة في حق من لم يظهر له العلامة وأدنى مدة البلوغ في حق الغلام اثنتا عشرة سنة، وفي حق الجارية تسع سنين، يعني أول وقت بلوغ الغلام عندنا استكمال اثني عشرة سنة وتسع سنين للجارية؛ إذ قد يحصل لهما في هذا السن علامة البلوغ، فلو ادعيا البلوغ في هذه المدة تقبل منهما، ولا تقبل فيهما دون ذلك؛ لأن الظاهر يكذبه، والتقييد بالاحتلام ونحوه يفيد أنه لا اعتبار بنبات العانة والشافعي قال به، ومستدله أن النبي ﷺ أمر في قتل قريظة أن ينظروا، فمن أنبت عانته قتل، ومن لا فلا.
والجواب: أنه لم يأمر بذلك ثمه إلا لأنه لم يك ثمه سوى ذلك من سبيل للعلم بحالهم؛ لأنهم لو سئلوا عن أعمارهم ما كانوا ليجيبوا وفاقا للحق، كيف والحق يجوز قتلهم؛ لأن البالغ يقتل وغيره يترك، ولا سبيل إلى العلم باحتلامهم إلا إخبارهم، فلم يبق إلا رؤية العانات، وهو أيضًا حكم أكثري، فأدير العلم عليه، وإن لم يكن من دلائل العلم القطعية، وأبيح النظر إليها؛ الجواز النظر عند الضرورات الشرعية، وأما قضية ابن عمر فإنما لم يحكم ثمه بالبلوغ إلا بالسن؛ لأن البلوغ بالاحتلام لم يكن علمه إلا إذا كانت له زوجة، فيطأها، وإذا لم تكن له زوجة أو أمة لا يمكن التوصل إلى العلم بالإحبال واحتلام النائم ليس ضروريا وجوده بعد البلوغ، فكثير من الناس لا يحتلم أعواما، فلم يبق العبرة إلا للسن، وهو المذهب عندنا وأيضًا لا اعتبار لللحية، وأما نهود الثدي، فذكر الحموي أنه لا يحكم به في ظاهر الرواية، وكذا ثقل الصوت، كما في شرح النظم الهاملي أبو السعود، وكذا شعر الساق والإبط والشارب التقطته من شروح «الكنز» و «الدر المختار» و رد المحتار» و«الكوكب الدري».
وَفِي رِوَايَةٍ لِلْبَيْهَقِيِّ عَنْهُ الله أَنَّ رَسُوْلَ اللهِ ﷺ قَالَ: «رُفِعَ الْقَلَمُ عَنْ ثَلَاثَةٍ: عَنِ النَّائِمِ حَتَّى يَسْتَيْقِظَ ، وَعَنِ الْغُلَامِ حَتَّى يَحْتَلِمَ، وَعَنِ الْمَجْنُونِ حَتَّى يُفِيقَ».
وَفِي الْمُتَّفَقِ عَلَيْهِ عَنِ ابْنِ عُمَرَ ما أَنَّهُ قَالَ: عُرِضْتُ عَلَى رَسُوْلِ الله عَلَيْهِ وَسَلَّمَ عَامَ أُحُدٍ وَأَنَا ابْنُ أَرْبَعَ عَشْرَةَ سَنَةٌ فَرَدَّنِي، ثُمَّ عُرِضْتُ عَلَيْهِ عَامَ الْخَنْدَقِ وَأَنَا ابْنُ خَمْسَ عَشْرَةَ سَنَةً فَأَجَازَنِي. فَقَالَ عُمَرُ بْنُ عَبْدِ الْعَزِيزِ: هَذَا فَرْقُ مَا بَيْنَ الْمُقَاتَلَةِ وَالذُّرِّيَّةِ.
وَعَنْ عَمْرِو بْنِ شُعَيْبٍ عَنْ أَبِيْهِ عَنْ جَدِّهِ عَبْدِ الله بْنِ عَمْرٍو (رضي الله عنه)، أَنَّ امْرَأَةً قَالَتْ: يَا رَسُوْلَ اللهِ، إِنَّ ابْنِي هَذَا كَانَ بَطْنِي لَهُ وِعَاءً وَثَدْیَيَّ لَهُ سِقَاءً وَحِجْرِي لَهُ حِوَاءً وَإِنَّ أَبَاهُ طَلَّقَنِي وَأَرَادَ أَنْ يَنْزِعَهُ مِنِّي ، فَقَالَ رَسُولُ اللهِ ﷺ: «أَنْتِ أَحَقُّ بِهِمَا لَمْ تَنْكِحِي». رَوَاهُ أَحْمَدُ وَأَبُو دَاوُدَ.
Amr ibn Shu‘ayb, from his father, from his grandfather Abdullah ibn Amr (may Allah be pleased with him), narrated that a woman said: “O Messenger of Allah, this son of mine, my womb was a vessel for him, my breasts were a source for him, and my lap was a shelter for him. His father has divorced me and wants to take him from me.” The Messenger of Allah (ﷺ) said: “You have more right to him as long as you do not remarry.” [Narrated by Ahmad and Abu Dawud]

1 The statement: “You have more right to him as long as you do not remarry”: Know that custody is the right of the child due to their need for someone to care for them. Sometimes they need someone to tend to their physical well-being in custody, and sometimes someone to manage their wealth to prevent harm. Each is assigned to the one most capable and knowledgeable. Guardianship over wealth is given to the father or grandfather because they are more knowledgeable and capable in trade than women. The right of custody is given to women because they are more knowledgeable and capable in caring for children than men, due to their greater compassion and constant presence at home, as stated in Bahr Ar-Ra’iq. They agreed that the right of custody belongs to the mother, whether divorced or not, as long as she does not marry another man, unless she is an apostate or immoral. The basis for this is this hadith. If the child has no mother, because she is deceased, unfit for custody, unwilling to take the child, her right has lapsed, or she has married a non-relative, then the maternal grandmother is more entitled than the paternal grandmother, even if distant, because this guardianship is derived through mothers due to their abundant compassion. One connected through a mother is more entitled than one connected through a father. If there is no maternal grandmother, the paternal grandmother is more entitled than sisters, because she is among the mothers, and thus inherits a sixth, and she has greater compassion for the children, so she is prioritized over sisters and maternal aunts. As for the statement in Abu Dawud’s hadith: “The maternal aunt is a mother,” this is a metaphor that may refer to establishing custody or something else, but the context suggests the former. It remains general, whether in establishing the principle of custody or her being more entitled to the child than anyone else, but there is no evidence for the latter. The former is certain and established, so it does not indicate that she is specifically more entitled than anyone with a right to custody. Then comes the sister from the mother, then the sister from the father, because their right is through the mother. After sisters, the right goes to the daughter of the sister from both parents, then the daughter of the maternal sister, then the maternal aunt, and the daughter of the paternal sister is deferred after the maternal aunt according to the correct view. After that, the right goes to paternal aunts, then the maternal grandmother’s maternal aunt, then the paternal grandmother’s maternal aunt, then the grandmothers’ and grandfathers’ aunts. 2 The statement: “As long as you do not remarry”: Any woman among those entitled to custody who marries a non-mahram of the child loses her right to custody due to his (ﷺ) saying: “You have more right to him as long as you do not remarry.” It is specified to a non-mahram because of the lack of compassion, as he spends little on the child and looks at him with resentment, unlike if the husband is a mahram relative of the child, such as the grandmother whose husband is the grandfather, or the mother whose husband is the child’s paternal uncle, or the maternal aunt whose husband is his paternal uncle, or the paternal aunt whose husband is his maternal uncle. Her right does not lapse because the harm to the child is absent due to the presence of compassion. This is taken from the commentaries of Al-Kanz. It is stated in Rahmat Al-Ummah: They differed on whether custody returns if she is divorced with a final divorce from a non-mahram of the child. Abu Hanifah, Shafi‘i, and Ahmad said it returns because the impediment has been removed. Malik, in his well-known opinion, said it does not return with divorce.
1 قوله: أنت أحق به ما لم تنكحي: اعلم أن الحضانة حق الصغير لاحتياجه إلى من يمسكه فتارة يحتاج إلى من يقوم بمنفعة بدنه في حضانته، وتارة إلى من يقوم بماله حتى لا يلحقه الضرر، وجعل كل واحد منهما إلى من أقوم به وأبصر، فالولاية في المال جعلت إلى الأب والجد؛ لأنهم أبصر وأقوم في التجارة من السناء، وحق الحضانة جعل إلى النساء لأنهن أبصر وأقوم على حفظ الصبيان عن الرجال لزيادة شفقتهن وملازمتهن البيوت. قاله في «البحر الرائق»، واتفقوا على أن حق الحضانة للأم سواء طلقت أو لا ما لم تتزوج بزوج آخر، إلا أن تكون مرتدة أو فاجرة، والأصل فيه هذا الحديث، فإن لم تكن الولد أم بأن كانت ميتة أو ليست أهلا للحضانة أو لم تقبل الولد أو سقطت حقها أو تزوجت بأجنبي فأم الأم أولى من أم الأب وإن بعدت؛ لأن هذه الولاية تستفاد من قبل الأمهات؛ لما ذكرنا من وفور شفقتهن فيمن كانت تدلي إليه بأم، فهي أولى ممن تدلي بأب، فإن لم تكن أم الأم فأم الأب أولى من الأخوات؛ لأنها من الأمهات، ولهذا تحرز ميراثهن السدس، ولأنها أوفر شفقة للولاد، فهي مقدمة على الأخوات والخالات.
وأما قوله في حديث أبي داود: إنها الخالة أم، فهذا تشبيه يحتمل كونه في ثبوت الحضانة أو غيره إلا أن السياق أفاد إرادة الأول، فيبقى أعم من كونه في ثبوت أصل الحضانة أو كونها أحق بالولد من كل من سواها، ولا دلالة على الثاني، والأول متيقن فيثتب، فلا يفيد الحكم بكونها أحق من أحد بخصوصه أصلا ممن له حق في الحضانة فيبقى المعنى الذي عنيناه بلا معارض من أن الجدة أم، فإن لم تكن له جدة فالأخوات أولى من العمات والخالات؛ لأنهن بنات الأبوين، ولهذا قدمن في الميراث، وفي رواية الخالة أولى من الأخت لأب لقوله عليها: الخالة والدة، وتقدم الأخت لأب وأم؛ لأن ذات قرابتين تترجح على ذات قرابة واحدة لما فيها من زيادة الشفقة، ثم الأخت من الأم، ثم الأخت من الأب؛ لأن الحق لهن من قبل الأم.
وعند الشافعي في الجديد وأحمد الأخت للأب أولى من الأخت للأم، ومن الخالة، ثم بعد الأخوات الحق لبنت الأخت لأبوين، ثم بنت الأخت لأم، ثم الخالة وبنت الأخت لأب مؤخرة عن الخالة على الصحيح وبعدها الحق لبنات الأخ لأب وأم، ثم لأم، ثم لأب وبعد ذلك الحق للعمات، ثم خالة الأم، ثم خالة الأب، ثم عمات الأمهات والآباء، وإن لم تكن للصبي امرأة من أهل الحضانة، واختصم فيه الرجال فأولاهم بالحضانة العصبات بترتيب الإرث، يقدم الأقرب فالأقرب، فيقدم الأب، ثم الجد، ثم الأخ الشقيق، ثم لأب، ثم بنوه كذلك، ثم العم، ثم بنوه، وإذا اجتمعوا فالأورع، ثم الأسن، غير أن الصغيرة لا تدفع إلى غير المحرم من الأقارب كابن العم، ولا للأم التي لم تكن أهلا للحضانة، بأن كانت ارتدت أو كانت فاجرة جورًا يضيع به الولد كزنا وغنا أو سرقة ونياحة، وكانت غير مأمونة بأن تخرج كل وقت وتترك الولد أو كانت أمة، ولا لعصبة الفاسق تحرزا عن الفتنة، بخلاف الغلام، وإذا لم يكن للصغير عصبة يدفع إلى ذوي الأرحام عند أبي حنيفة؛ لأن لهم ولاية الإنكاح عنده، فكذا الحضانة، التقطته من شروح «الكنز» و «الهداية» و«العناية» و«فتح القدير» و«عمدة الرعاية».
۲ قوله: ما لم تنكحي : أي كل امرأة من هؤلاء اللاتي لهن حق في الحضانة إذا تزوجت بغير محرم الصغير سقط حقها في الحضانة لقوله : أنت أحق به ما لم تنكحي، وقيد بغير المحرم؛ لعدم الشفقة فإنه ينفق على الولد قليلا وينظر إليه مبغضا، بخلاف ما إذا كان الزوج ذا رحم محرم الصغير كالجدة، إذا كان زوجها الجد أو الأم إذا كان زوجها عم الصغير أو الخالة إذا كان زوجها عمه أو العمة إذا كان زوجها خاله لا يسقط حقها لانتفاء الضرر عن الصغير لقيام الشفقة، أخذته من شروح «الكنز». وقال في رحمة الأمة»: ثم اختلفوا فيما إذا طلقت طلاقا بائنا من غير محرم الصغير هل تعود حضانتها ؟ فقال أبو حنيفة والشافعي وأحمد : تعود؛ لأن المانع قد زال. وقال مالك له في المشهور عنه : لا تعود بالطلاق.
وَعَنِ الْبَرَاءِ بْنِ عَازِبِ (رضي الله عنه)قَالَ: صَالَحَ النَّبِيُّ ﷺ الْمُشْرِكِينَ يَوْمَ الْحُدَيْبِيَةِ عَلَى ثَلَاثَةِ أَشْيَاءَ: عَلَى أَنَّ مَنْ أَتَاهُ مِنَ الْمُشْرِكِينَ رَدَّهُ إِلَيْهِمْ، وَمَنْ أَتَاهُمْ مِنَ الْمُسْلِمِينَ لَمْ يَرُدُّوهُ، وَعَلَى أَنْ يَدْخُلَهَا مِنْ قَابِلٍ وَيُقِيمَ بِهَا ثَلَاثَةَ أَيَّامٍ فَلَمَّا دَخَلَهَا وَمَضَى الْأَجَلُ خَرَجَ، فَتَبِعَتْهُ ابْنَةُ حَمْزَةَ تُنَادِي : يَا عَمِّ يَا عَمّ، فَتَنَاوَلَهَا عَلِيٌّ فَأَخَذَ بِيَدِهَا، فَاخْتَصَمَ فِيهَا عَلِيٌّ وَزَيْدُ وَجَعْفَرُ، قَالَ عَلِيٌّ : أَنَا أَخَذْتُهَا وَهِيَ بِنْتُ عَنِّي، وَقَالَ جَعْفَرُ: ابْنَةُ عَمِّيْ وَخَالَتُهَا تَحْتِي، وَقَالَ زَيْدُ: ابْنَةُ أَخِي.
فَقَضَى بِهَا النَّبِيُّ ﷺ لِخَالَتِهَا، وَقَالَ: «الْخَالَةُ بِمَنْزِلَةِ الْأُمِّ وَقَالَ لِعَلِي: «أَنْتَ مِنِّي وَأَنَا مِنْكَ، وَقَالَ لِجَعْفَرٍ: أَشْبَهْتَ خَلْقِي وَخُلُقِي وَقَالَ لِزَيْدٍ: «أَنْتَ أَخُوْنَا وَمَوْلَانَا». مُتَّفَقٌ عَلَيْهِ.
Al-Bara’ ibn Azib (may Allah be pleased with him) narrated: The Prophet (ﷺ) made a truce with the polytheists on the day of Hudaybiyyah on three conditions: that whoever came to him from the polytheists would be returned to them, whoever came to them from the Muslims would not be returned, and that he would enter it the following year and stay for three days. When he entered it and the term expired, he left. The daughter of Hamzah followed him, calling out: “O uncle, O uncle!” Ali took her and held her hand. Ali, Zayd, and Ja‘far disputed over her. Ali said: “I took her, and she is my cousin’s daughter.” Ja‘far said: “She is my cousin’s daughter, and her maternal aunt is my wife.” Zayd said: “She is my brother’s daughter.” The Prophet (ﷺ) ruled in favor of her maternal aunt and said: “The maternal aunt is like the mother.” He said to Ali: “You are from me, and I am from you.” He said to Ja‘far: “You resemble my appearance and my character.” He said to Zayd: “You are our brother and our freedman.” [Agreed upon]

وَعَنِ الْقَاسِمِ بْنَ مُحَمَّدٍ قَالَ: كَانَتْ عِنْدَ عُمَرَ امْرَأَةُ مِنَ الْأَنْصَارِ، فَوَلَدَتْ لَهُ عَاصِمَ بْنَ عُمَرَ، ثُمَّ فَارَقَهَا عُمَرُ، فَرَكِبَ يَوْمًا إِلَى قُبَاءٍ، فَوَجَدَ ابْنَهُ يَلْعَبُ بِفِنَاءِ الْمَسْجِدِ، فَأَخَذَ بِعَضُدِهِ فَوَضَعَهُ بَيْنَ يَدَيْهِ عَلَى الدَّابَّةِ، فَأَدْرَكَتْهُ جَدَّةُ الْغُلَامِ فَنَازَعَتْهُ إِيَّاهُ حَتَّى أَتَيَا أَبَا بَكْرٍ، فَقَالَ عُمَرُ: هَذَا ابْنِي، وَقَالَتِ الْمَرْأَةُ : ابْنِي، فَقَالَ أَبُو بَكْرٍ: خَلَّ بَيْنَهَا وَبَيْنَهُ. فَمَا رَاجَعَهُ عُمَرُ الْكَلَامَ. رَوَاهُ الْبَيْهَقِيُّ وَعَبْدُ الرَّزَّاقِ وَمَالِكُ فِي الْمُوَطَّأَ وَزَادَ الْبَيْهَقِيُّ: ثُمَّ قَالَ أَبُو بَكْرٍ: سَمِعْتُ رَسُولَ اللهِ ﷺ يَقُوْلُ: «لَا تُوَلَّهُ وَالِدَةٌ عَنْ وَلَدِهَا».
Al-Qasim ibn Muhammad narrated: Umar had a wife from the Ansar who bore him Asim ibn Umar. Then Umar separated from her. One day, he rode to Quba and found his son playing in the courtyard of the mosque. He took him by the arm and placed him in front of him on the mount. The boy’s grandmother caught up with him and disputed over him until they came to Abu Bakr. Umar said: “This is my son.” The woman said: “My son.” Abu Bakr said: “Leave him with her.” Umar did not argue back. [Narrated by Al-Bayhaqi, Abdur-Razzaq, and Malik in Al-Muwatta]. Al-Bayhaqi added: Then Abu Bakr said: “I heard the Messenger of Allah (ﷺ) say: ‘A mother is not to be separated from her child.’”

2 The statement: “Leave him with her”: For this reason, it is stated in Al-Hidayah: There is no choice for the boy or girl. Shafi‘i said they have a choice because the Prophet (ﷺ) gave a choice. For us, due to the child’s deficient intellect, they choose the one who offers ease and allows play, so the choice is not reliable. It is established that the Companions did not give a choice. As for the hadith, we say he said: “O Allah, guide him,” so he was guided to the better choice through his (ﷺ) supplication, or it applies to one who has reached puberty. In detail: The child has no choice, as per Malik and our position, whether the child is discerning or not, boy or girl. Shafi‘i said if they become discerning, they are given a choice between the parents, based on what Abu Hurayrah (may Allah be pleased with him) narrated: A woman came to the Messenger of Allah (ﷺ) and said: “My husband wants to take my son, and he has provided me water from Abu Utbah’s well and benefited me.” Her husband said: “Is she disputing me over my son?” He (ﷺ) said: “This is your father, and this is your mother, so take the hand of whichever you wish.” He took his mother’s hand, and she left with him. For us, the child is young, not prudent, and unaware of their best interest, so their choice is not relied upon. Due to their deficient intellect, they choose the one who offers comfort and freedom, so the choice is not sound. The conclusion is that as long as they have not reached an age where they can choose what is more beneficial, giving them a choice is futile or harmful if they do not choose the more beneficial and compassionate parent but choose, due to poor understanding and deficient intellect, the one whose company is more harmful. Thus, when Umar ibn Al-Khattab and his divorced wife disputed over their young child, Abu Bakr As-Siddiq assigned the child to the mother and did not give him a choice. This was in the presence of the Companions, and none objected. Abu Bakr said: “I heard the Messenger of Allah (ﷺ) say: ‘A mother is not to be separated from her child.’” There is no proof for Shafi‘i in the hadith because it is possible the child was mature, which is apparent since the one who draws water from a well is mature. A pre-pubescent child is not sent to wells to draw water due to fear of falling in because of their limited intellect. We say if they reach puberty, they have the choice to live independently or with whichever parent they wish, unless they are foolish or corrupt, in which case they are joined to one parent for their own protection, like their wealth. There is no evidence that they are given a choice at seven, as the hadith does not mention the child’s age. Shafi‘i also cites that the Prophet (ﷺ) gave a child a choice between his mother and father and said: “Go to whichever you wish,” and said: “O Allah, guide him,” and he chose his mother. Our scholars responded that his supplication guided him to the better, more compassionate choice, so others are not compared to him. This is gathered from Al-Hidayah, and the commentaries of Al-Kanz and Umdat Ar-Ri‘ayah.
۲ قوله: خل بينه وبينها : لذلك قال في الهداية»: ولا خيار للغلام والجارية. وقال الشافعي: لهما الخيار؛ لأن النبي عليه خير، ولنا أنه لقصور عقله يختار من عنده الدعة لتخليته بينه وبين اللعب، فلا يتحقق النظر، وقد صح أن الصحابة لم يخيروا، وأما الحديث فقلنا : قد قال : اللهم اهده، فوفق لاختياره الأنظر بدعائه الله أو يحمل على ما إذا كان بالغا، انتهى. تفصيله: أن الولد لا خيار له، وبه قال مالك، وهو مذهبنا، سواء كان الولد مميزا أو لا، غلامًا أو جارية. وقال الشافعي: إذا صار مميزا خير بين الأبوين؛ لما روى أبو هريرة الله امرأة جاءت إلى رسول الله ﷺ
فقالت: إن زوجي يريد أن يذهب بابنه، وقد سقاني من بئر أبي عتبة وقد نفعني. وقال زوجها: أتحاقني أي تخاصمني في ولدي، فقال لي: هذا أبوك وهذه أمك، فخذ بيد أيهما شئت، فأخذ بيد أمه، فانطلقت به ولنا أنه صغير غير رشيد، ولا عارف بمصلحته، فلا يعتمد اختياره، ولأنه لقصور عقله يختار من عنده الراحة والتخلية، فلا يتحقق النظر. حاصله: أنه ما لم يبغ مبلغا يختار فيه ما هو أنفع له، فيكون تخييره لغوا بل مضرا إذا لم يختر موافقة من هو أنفع له وأشفق من والديه، بل اختار لسوء فهمه ونقص عقله من مرافقته أضربه، ولهذا لما تنازع عمر بن الخطاب وزوجته المطلقة في طفل له فوض أبو بكر الصديق الولد إلى الأم ولم يخيره.
وذلك كان بمحضر من الصحابة له، ولم ينكره أحد. وقال أبو بكر: سمعت رسول الله ﷺ يقول: لا توله والدة، عن ولدها، ولا حجة للشافعي في الحديث؛ لأنه يحتمل أنه كان بالغا ، بل هو الظاهر؛ لأن الذي يسقي من البئر هو البالغ، ومن هو دون البلوغ لا يرسل إلى الآبار للاستقاء للخوف عليه من السقوط فيه؛ لقلة عقله، ونحن نقول: إذا بلغ فهو مخير بين أن ينفرد بالسكني، وبين أن يكون عند أيهما أراد، لا أن يبلغ سفيها مفسدا، فحينئذ يضمهما إلى نفسه اعتبارا لنفسه بماله، وليس فيه دليل على أنه يخير في السبع؛ لأنه ليس في الحديث ذكر عمره، وللشافعي أيضًا ما ثبت عن النبي ﷺ أنه خير طفلًا بين أمه وأبيه ، وقال : اذهب إلى أيتهما شئت، وقال: اللهم اهده، فاختار أمه، وأجاب عنه أصحابنا بأن دعاءه قد وفقه لاختيار الأنظر الأرفق، فلا يقاس عليه غيره، الهداية» وشروح «الكنز» «عمدة الرعاية ملتقط منها.
