وَقَوْلِ اللهِ عَزَّ وَجَلَّ: ﴿وَالَّذِينَ يَرْمُونَ أَزْوَاجَهُمْ وَلَمْ يَكُن لَّهُمْ شُهَدَاءُ إِلَّا أَنفُسُهُمْ فَشَهَادَةُ أَحَدِهِمْ أَرْبَعُ شَهَدَاتٍ بِالله إِنَّهُ لَمِنَ الصَّادِقِينَ * وَالْخَامِسَةُ أَنَّ لَعْنَتَ الله عَلَيْهِ إِن كَانَ مِنَ الْكَاذِبِينَ* وَيَدْرَؤُا عَنْهَا الْعَذَابَ أَن تَشْهَدَ أَرْبَعَ شَهَادَاتٍ بِالله إِنَّهُ لَمِنَ الْكَذِبِينَ* وَالْخَامِسَةَ أَنَّ غَضَبَ الله عَلَيْهَا إِن كَانَ مِنَ الصَّدِقِينَ * وَلَوْلَا فَضْلُ الله عَلَيْكُمْ وَرَحْمَتُهُ وَأَنَّ الله تَوَّابُ حَكِيمٌ * (النور : ٦ - ١٠)
And the saying of Allah, the Mighty and Majestic: "And those who accuse their wives and have no witnesses except themselves, the testimony of one of them shall be four testimonies by Allah that he is of the truthful; and the fifth, that the curse of Allah be upon him if he is of the liars. And it shall avert the punishment from her that she testify four testimonies by Allah that he is of the liars; and the fifth, that the wrath of Allah be upon her if he is of the truthful. And were it not for the bounty of Allah upon you and His mercy, and that Allah is Accepting of repentance, Wise" (An-Nur: 6-10).
وَعَنْ سَهْلِ بْنِ سَعْدٍ السَّاعِدِي الله قَالَ: إِنَّ عُوَيْمِرًا الْجِلَانِي قَالَ: يَا رَسُوْلَ اللهِ، أَرَأَيْتَ رَجُلًا وَجَدَ مَعَ امْرَأَتِهِ رَجُلًا أَيَقْتُلُهُ فَتَقْتُلُوْنَهُ؟ أَمْ كَيْفَ يَفْعَلُ؟ فَقَالَ رَسُوْلُ الله ﷺ: «قَدْ أُنْزِلَ فِيْكَ وَفِي صَاحِبَتِكَ فَاذْهَبْ فَأْتِ بِهَا قَالَ: سَهْلٌ فَتَلَاعَنَا فِي الْمَسْجِدِ وَأَنَا مَعَ النَّاسِ عِنْدَ رَسُوْلِ اللهِ ، فَلَمَّا فَرَغَا مِنْ تَلاعُنِهِمَا قَالَ عُوَيْمِرُ: كَذَبْتُ عَلَيْهَا يَا رَسُولَ الله إِنْ أَمْسَكْتُهَا. فَطَلَّقَهَا ثَلاثاً. ثُمَّ قَالَ رَسُولُ الله ﷺ: «انْظُرُوْا، فَإِنْ جَاءَتْ بِهِ أَسْحَمَ أَدْعَجَ الْعَيْنَيْنِ عَظِيمَ الْأَلْيَتَيْنِ خَدَلَّجَ السَّاقَيْنِ، فَلَا أَحْسِبُ عُوَيْمِرًا إِلَّا قَدْ صَدَقَ عَلَيْهَا، وَإِنْ جَاءَتْ بِهِ أُحَيْمِرَ كَأَنَّهُ وَحَرَةً فَلَا أَحْسِبُ عُوَيْمِرًا إِلَّا قَدْ كَذَبَ عَلَيْهَا فَجَاءَتْ بِهِ عَلَى النَّعْتِ الَّذِي نَعَتَ بِهِ رَسُولُ اللهِ ﷺ مِنْ تَصْدِيقِ عُوَيْمِرٍ، فَكَانَ بَعْدُ يُنْسَبُ إِلَى أُمَّهِ. مُتَّفَقٌ عَلَيْهِ.
وَفِي رِوَايَةٍ لِأَبِي دَاوُدَ: فَجَاءَتْ بِهِ كَذَلِكَ فَقَالَ النَّبِيُّ ﷺ: «لَوْلَا مَا مَضَى مِنْ كِتَابِ الله لَكَانَ لِي وَلَهَا شَأْنُ».
وَرَوَى أَبُو دَاوُدَ عَنْهُ قَالَ : شَهِدْتُ الْمُتَلَاعِنَيْنِ عَلَى عَهْدِ رَسُولِ الله ﷺ وَأَنَا ابْنُ خَمْسَ عَشْرَةَ، فَفَرَّقَ بَيْنَهُمَا رَسُولُ اللهِ ﷺ حِينَ تَلَاعَنَا.
وَرَوَى أَبُوْ دَاوُدَ عَنِ ابْنِ عَبَّاسٍ الله قَالَ: جَاءَ هِلَالُ بْنُ أُمَيَّةَ وَهُوَ أَحَدُ الثَّلَاثَةِ الَّذِينَ تَابَ اللهُ عَلَيْهِمْ، فَجَاءَ مِنْ أَرْضِهِ عَشِيًّا، فَوَجَدَ عِنْدَ أَهْلِهِ رَجُلًا، فَرَأَى بِعَيْنِهِ وَسَمِعَ بِأُذُنِهِ فَلَمْ يَهِجْهُ حَتَّى أَصْبَحَ، ثُمَّ غَدًا عَلَى رَسُولِ اللهِ ، فَقَالَ: يَا رَسُولَ الله، إِنِّي جِئْتُ أَهْلِي عِشَاءً فَوَجَدْتُ عِنْدَهُمْ رَجُلًا، فَرَأَيْتُ بِعَيْنَيَّ وَسَمِعْتُ بِأُذُنَيَّ، فَكَرِهَ رَسُولُ الله ﷺ مَا جَاءَ بِهِ وَاشْتَدَّ عَلَيْهِ.
فَنَزَلَتْ: وَالَّذِينَ يَرْمُونَ أَزْوَاجَهُمْ وَلَمْ يَكُن لَّهُمْ شُهَدَاءُ إِلَّا أَنفُسُهُمْ فَشَهَادَةُ أَحَدِهِمْ الْآيَتَيْنِ كِلْتَيْهِمَا، فَسُرِّيَ عَنْ رَسُولِ الله ، فَقَالَ: «أَبْشِرْ يَا هِلَالُ، قَدْ جَعَلَ الله عَزَّ وَجَلَّ لَكَ فَرَجًا وَمَخْرَجًا قَالَ هِلَالُ : قَدْ كُنْتُ أَرْجُو ذَلِكَ مِنْ رَبِّي، فَقَالَ رَسُولُ اللهِ ﷺ: «أَرْسِلُوْا إِلَيْهَا فَجَاءَتْ فَتَلَاهَا عَلَيْهِمَا رَسُولُ الله ، وَذَكَرَهُمَا وَأَخْبَرَهُمَا أَنَّ عَذَابَ الْآخِرَةِ أَشَدُّ مِنْ عَذَابِ الدُّنْيَا، فَقَالَ هِلَالُ: وَالله لَقَدْ صَدَقْتُ عَلَيْهَا، فَقَالَتْ: قَدْ كَذَبَ، فَقَالَ رَسُولُ اللهِ : لَاعِنُوا بَيْنَهُمَا».
فَقِيلَ لِهِلَالٍ: اشْهَدْ، فَشَهِدَ أَرْبَعَ شَهَادَاتٍ بِاللهِ إِنَّهُ لَمِنْ الصَّادِقِينَ، فَلَمَّا كَانَتِ الْخَامِسَةُ قِيلَ لَهُ: يَا هِلَالُ، اتَّقِ الله؛ فَإِنَّ عَذَابَ الدُّنْيَا أَهْوَنُ مِنْ عَذَابِ الْآخِرَةِ، وَإِنَّ هَذِهِ الْمُوجِبَةُ الَّتِي تُوجِبُ عَلَيْكَ الْعَذَابَ. فَقَالَ: وَاللهِ لَا يُعَذِّبُنِي اللهُ عَلَيْهَا كَمَا لَمْ يُجَلِّدْنِي عَلَيْهَا. فَشَهِدَ الْخَامِسَةَ أَنَّ لَعْنَةَ اللهِ عَلَيْهِ إِنْ كَانَ مِنَ الْكَاذِبِينَ، ثُمَّ قِيْلَ لَهَا: اشْهَدِي فَشَهِدَتْ أَرْبَعَ شَهَادَاتٍ بِالله إِنَّهُ لَمِنْ الْكَاذِبِينَ، فَلَمَّا كَانَتِ الْخَامِسَةُ قِيلَ لَهَا: اتَّقِي الله؛ فَإِنَّ عَذَابَ الدُّنْيَا أَهْوَنُ مِنْ عَذَابِ الْآخِرَةِ، وَإِنَّ هَذِهِ الْمُوجِبَةُ الَّتِي تُوجِبُ عَلَيْكِ الْعَذَابَ. فَتَلَكَأَتْ سَاعَةً ثُمَّ قَالَتْ: وَاللهِ! لَا أَفْضَحُ قَوْمِي، فَشَهِدَتِ الْخَامِسَةَ أَنَّ غَضَبَ اللهِ عَلَيْهَا إِنْ كَانَ مِنَ الصَّادِقِينَ. فَفَرَّقَ رَسُولُ اللهِ ﷺ بَيْنَهُمَا.
وَفِي رِوَايَة لِلنَّسَائِي عَنِ ابْنِ عَبَّاسِ لا أَنَّ النَّبِيَّ ﷺ أَمَرَ رَجُلًا حِيْنَ أَمَرَ الْمُتَلَاعِنَيْنِ أَنْ يَتَلَاعَنَا أَنْ يَضَعَ يَدَهُ عِنْدَ الْخَامِسَةِ عَلَى فِيْهِ، وَقَالَ: إِنَّهَا مُوْجِبَةٌ. وَفِي الْمُتَّفَقِ عَلَيْهِ: قَالَ: يَا رَسُوْلَ اللهِ، مَالِي؟ قَالَ: «لَا مَالَ لَكَ إِنْ كُنْتَ صَدَقْتَ عَلَيْهَا فَهُوَ بِمَا اسْتَحْلَلْتَ مِنْ فَرْجِهَا، وَإِنْ كُنْتَ كَذَبْتَ عَلَيْهَا فَذَاكَ أَبْعَدُ لَكَ مِنْهَا».
Sahl ibn Sa‘d al-Sa‘idi (may Allah be pleased with him) narrated: Uwaimir al-Jilani said: “O Messenger of Allah, if a man finds another man with his wife, should he kill him, and then you would kill him? Or what should he do?” The Messenger of Allah (ﷺ) said: “A revelation has been sent down concerning you and your wife, so go and bring her.” Sahl said: They performed mutual cursing in the mosque while I was among the people with the Messenger of Allah (ﷺ). When they finished their mutual cursing, Uwaimir said: “I have lied about her, O Messenger of Allah, if I keep her.” Then he divorced her thrice. The Messenger of Allah (ﷺ) said: “Observe, if she gives birth to a child who is dark, with intensely black eyes, large buttocks, and thick legs, I think Uwaimir has spoken the truth about her. But if she gives birth to a reddish child, as if it were a lizard, I think Uwaimir has lied about her.” She gave birth to a child matching the description the Messenger of Allah (ﷺ) gave for Uwaimir’s truthfulness, and thereafter, the child was attributed to its mother. [Narrated by Bukhari and Muslim]
In a narration by Abu Dawud: She gave birth to such a child, and the Prophet (ﷺ) said: “Were it not for what has been decreed in the Book of Allah, I would have dealt with her.” Abu Dawud also narrated from him: I witnessed the mutual cursing during the time of the Messenger of Allah (ﷺ) when I was fifteen years old, and the Messenger of Allah (ﷺ) separated them after they performed mutual cursing. Abu Dawud narrated from Ibn Abbas (may Allah be pleased with them): Hilal ibn Umayyah, one of the three whom Allah accepted their repentance, came from his land in the evening and found a man with his wife. He saw with his eyes and heard with his ears but did not confront him until morning. Then he went to the Messenger of Allah (ﷺ) and said: “O Messenger of Allah, I came to my wife in the evening and found a man with her. I saw with my eyes and heard with my ears.” The Messenger of Allah (ﷺ) disliked what he brought and was distressed by it. Then the verses were revealed: “And those who accuse their wives and have no witnesses except themselves, the testimony of one of them shall be four testimonies by Allah that he is of the truthful. And the fifth that the curse of Allah be upon him if he is of the liars. And it averts the punishment from her if she testifies four testimonies by Allah that he is of the liars. And the fifth that the wrath of Allah be upon her if he is of the truthful. And were it not for the favor of Allah upon you and His mercy, and that Allah is Accepting of repentance, Wise.” [Qur’an 24:6-10] The Messenger of Allah (ﷺ) was relieved and said: “Rejoice, O Hilal, for Allah has made a way out and relief for you.” Hilal said: “I was hoping for that from my Lord.” The Messenger of Allah (ﷺ) said: “Send for her.” She came, and the Messenger of Allah (ﷺ) recited the verses to them, admonished them, and informed them that the punishment of the Hereafter is more severe than the punishment of this world. Hilal said: “By Allah, I have spoken the truth about her.” She said: “He has lied.” The Messenger of Allah (ﷺ) said: “Let them perform mutual cursing.” It was said to Hilal: “Testify.” He testified four times by Allah that he was among the truthful. When it came to the fifth, it was said to him: “O Hilal, fear Allah, for the punishment of this world is easier than the punishment of the Hereafter, and this is the decisive one that will bring punishment upon you.” He said: “By Allah, Allah will not punish me for this as He did not flog me for it.” Then he testified the fifth time that the curse of Allah be upon him if he was among the liars. Then it was said to her: “Testify.” She testified four times by Allah that he was among the liars. When it came to the fifth, it was said to her: “Fear Allah, for the punishment of this world is easier than the punishment of the Hereafter, and this is the decisive one that will bring punishment upon you.” She hesitated for a moment, then said: “By Allah, I will not disgrace my people.” She testified the fifth time that the wrath of Allah be upon her if he was among the truthful. The Messenger of Allah (ﷺ) separated them. In a narration by al-Nasa’i from Ibn Abbas (may Allah be pleased with them): The Prophet (ﷺ) ordered a man, when he commanded the two who were performing mutual cursing, to place his hand over his mouth at the fifth testimony and said: “It is the decisive one.” In the agreed-upon narration: He said: “O Messenger of Allah, what about my property?” He said: “You have no claim to it. If you were truthful about her, it is for what you made lawful of her private parts. If you lied about her, it is even further from you.”

2 His statement: “They performed mutual cursing,” etc. Its root is from “curse,” meaning expulsion and distancing from Allah’s mercy. Its legal meaning according to us is testimonies confirmed by oaths accompanied by cursing. Al-Shafi‘i said: It is oaths confirmed with the wording of testimony. He requires the eligibility for taking an oath, so it applies between a Muslim and his non-Muslim wife, between a non-Muslim and a non-Muslim wife, and between a slave and his wife. This is also the view of Malik and Ahmad. According to us, the eligibility for testimony is required, so it only applies between free, sane, adult Muslims who have not been punished for false accusation. Al-Shafi‘i’s evidence is the verse: “The testimony of one of them shall be four testimonies by Allah” [Qur’an 24:6], which is definitive regarding oaths, and testimony can include oaths. We interpreted the ambiguous as the definitive, especially since testimony for oneself is not accepted, unlike an oath. The claim that testimony for oneself is not accepted is invalid, as it is only rejected in cases of suspicion. When suspicion is absent, it is accepted, as Allah says: “Allah testifies that there is no deity except Him” [Qur’an 3:18], which is among the truest testimonies due to the absence of suspicion. In this case, suspicion is negated by the oath. This was stated by al-Ayni. Similarly, if she confesses to adultery and confirms the husband’s claim. In summary, mutual cursing occurs when a man accuses his wife of adultery, she denies it, and he does not provide witnesses. Its conditions include an existing valid marriage, not an invalid one, and the accusation must be one that would warrant punishment if made against a non-wife, as she is the accused, fulfilling the conditions of chastity. Its core is testimonies confirmed by oaths and cursing. Its ruling is the prohibition of intercourse and enjoyment after mutual cursing, even before separation, based on the hadith: “The two who perform mutual cursing shall never reunite.” Its participants are those eligible to testify among Muslims, meaning both the accuser and the accused must be fit to testify, not having been punished for false accusation, not being non-Muslims, insane, slaves, or minors. This includes the immoral and the blind, as they are eligible to testify. If a man accuses his wife of adultery, either both are eligible to testify, or they are not. If they are not, the details are as in al-Durr al-Mukhtar and Radd al-Muhtar. Al-Shafi‘i’s view is that separation pertains to the husband, as he is the cause of separation, so it does not depend on the wife’s action, like divorce. Zufar cited the narration from the Messenger of Allah (ﷺ): “The two who perform mutual cursing shall never reunite,” and their remaining married entails their reunion, which contradicts the text. The response is that it refers to after the judge’s separation, supported by what is in Abu Dawud’s Sunan: “The precedent for those who perform mutual cursing is that they are separated and never reunite.” The evidence that separation does not occur by mutual cursing itself is in Sahih al-Bukhari and elsewhere: After Uwaimir al-Ajlani performed mutual cursing, he said: “O Messenger of Allah, I have lied about her if I keep her,” and divorced her thrice. If separation had occurred by mutual cursing, the Messenger of Allah (ﷺ) would have objected to his pronouncing divorces, saying: “She is not your wife for you to divorce her.” His silence indicates she was still eligible for divorce, and separation had not yet occurred. In al-Inayah: If it is said that he objected by saying: “Go, you have no claim over her,” it is responded that this refers to his request to reclaim the dowry, as it is narrated that he said: “If you were truthful, it is for her for what you made lawful of her private parts, and if you lied, you have no claim over her.” In al-Bahr al-Ra’iq: As for al-Bayhaqi’s statement in al-Ma‘rifah that Uwaimir divorced her thrice, unaware that mutual cursing was separation, so it was like stipulating compensation in a loan, which is binding whether stipulated or not, unlike zihar, the response is that the inference is based on the lack of objection to him, not merely his action, as is clear. We also have the narration from Nafi‘ from Ibn Umar (may Allah be pleased with them): A man performed mutual cursing with his wife during the Prophet’s time (ﷺ) and disowned her child. The Prophet (ﷺ) separated them and attributed the child to the woman. From Ibn Abbas (may Allah be pleased with them): When the Prophet (ﷺ) performed mutual cursing between Asim ibn Adi and his wife, he separated them. It is narrated that the Messenger of Allah (ﷺ) performed mutual cursing between al-Ajlani and his wife, and when they finished, he separated them. These hadiths indicate that separation does not occur by the husband’s or wife’s mutual cursing, as if it had, the Prophet’s (ﷺ) separation after mutual cursing would not have been necessary. In al-Bada’i‘: Scholars also differed on it. Abu Hanifah and Muhammad said the separation in mutual cursing is by one irrevocable divorce, dissolving the marriage bond and establishing the prohibition of reunion and remarriage as long as they remain in the state of mutual cursing. If the husband retracts and is punished for false accusation, or the wife retracts by confirming him, marriage between them becomes permissible, and they can reunite. Abu Yusuf, Zufar, and al-Hasan ibn Ziyad said it is a separation without divorce, causing a permanent prohibition, like that of fosterage or affinity. They cited the Prophet’s (ﷺ) saying: “The two who perform mutual cursing shall never reunite,” which is explicit in this matter. For Abu Hanifah and Muhammad, it is narrated that when the Messenger of Allah (ﷺ) performed mutual cursing between Uwaimir al-Ajlani and his wife, Uwaimir said: “I have lied about her, O Messenger of Allah, if I keep her, she is divorced thrice.” In some narrations: “I have lied about her if I do not separate from her, she is divorced thrice.” Thus, the husband’s divorce after mutual cursing became the precedent for those who perform mutual cursing, as Uwaimir divorced his wife thrice after mutual cursing before the Messenger of Allah (ﷺ), who enforced it. Every person who performs mutual cursing must divorce, and if he refuses, the judge acts in his place to effect separation, making it a divorce, as in the case of impotence. The cause of this separation is the husband’s accusation, as it necessitates mutual cursing, which necessitates separation, which causes the dissolution. Thus, the separation, through these intermediaries, is attributed to the prior accusation. Every separation caused by the husband or his action is a divorce, as in the case of impotence, mutual agreement, or swearing abstinence, which is the view of the predecessors like Ibrahim, al-Hasan, Sa‘id ibn Jubayr, Qatadah, and others. The hadith cannot be taken literally, as we mentioned, because the literal meaning of “mutual cursers” is those engaged in the act. After completing mutual cursing, they are no longer mutual cursers literally. The intended meaning refers to the ruling, which is that the ruling of mutual cursing remains upon them. If the husband retracts and is punished for false accusation, the ruling of mutual cursing is nullified, so they are neither mutual cursers literally nor in ruling, making their reunion permissible. Thus, it is said in al-Hidayah: “They shall not reunite as long as they are mutual cursers.”
3 His statement: “He divorced her thrice,” etc. Therefore, it is said in al-Bada’i‘ and al-Bahr al-Ra’iq: Every person who performs mutual cursing must divorce, and if he refuses, the judge acts in his place to effect separation, making it a divorce, as in the case of impotence.
4 His statement: “Were it not for what has been decreed in the Book of Allah,” etc. Meaning, were it not for the Qur’an’s ruling against imposing punishment or reprimand on those who perform mutual cursing, I would have dealt with her. They said: The hadith indicates that the judge does not consider assumptions, signs, or indications but rules based on the apparent requirements of evidence and proofs. It is understood from their words that resemblance and physiognomy are not evidence but mere assumptions and indications, so no ruling is based on them, as is our view. This was stated in al-Luma‘at.
5 His statement: “The testimony of one of them,” etc. Al-Shafi‘i said mutual cursing is an oath, while Abu Hanifah and his companions said it is testimony. They cited the verse: “The testimony of one of them shall be four testimonies by Allah” [Qur’an 24:6] and the Prophet’s (ﷺ) saying in this hadith: “Hilal came and testified, then she stood and testified.” [Narrated by Nayl al-Awtar, summarized]
6 His statement: “You have no claim to it,” etc. Know that the dowry is obligated by the contract, either by specification if present, or by the legal ruling, such as the obligation of a comparable dowry if unspecified. The dowry is confirmed by one of three things: consummation, valid seclusion, or the death of either spouse. Consummation confirms the exchange, making the dowry definitive. Seclusion is legally equivalent to consummation, as it typically leads to it. Death ends the marriage, and a thing is confirmed and solidified upon its end. This is stated in al-Hidayah and al-Binayah. This clarifies that the dowry is not obligated by intercourse or death but by the contract itself, and it is confirmed by what was mentioned. In al-Bada’i‘: Once the dowry is confirmed by what was mentioned, it does not lapse thereafter, even if the separation is due to her, as the exchange, once confirmed, does not allow for lapse except by release. Thus, it is clear that the dowry does not lapse due to the wife’s disobedience, though her maintenance does. What is in some fatwas about the dowry lapsing due to disobedience is not relied upon. This was stated in Umdat al-Ri‘ayah.
۱ قوله: كيف يفعل فقال رسول الله ﷺ : قد أنزل فيك إلخ الأصل في قذف الزوجات عند الشافعي الحد عملابالآية الأولى، وهي قوله تعالى: ﴿وَالَّذِينَ يَرْمُونَ الْمُحْصَنَاتِ ثُمَّ لَمْ يَأْتُواْ بِأَرْبَعَةِ شُهَدَاءَ فَاجْلِدُوهُمْ﴾ (النور: ٤) الآية وبين بآية اللعان أن القاذف إذا كان زوجا له أن يدفع الحد عنه باللعان، وإذا كان المقذوف زوجة القاذف لها أن تدفع حد الزنا عنها بلعانها فأيها امتنع عن اللعان وجب الأصل، وهو الحد، وذهب أبو حنيفة وأصحابه إلى أن اللازم بقذف الزوج إنما هو اللعان فقط، ولا يلزمه الحد، فعندنا آية اللعان ناسخة للأولى في حق الزوجات؛ لأن الخاص المتأخر عن العام ينسخ العام بقدره، فلم تبق الآية الأولى متناولة للزوجات، فصار الواجب بقذف الزوجة اللعان فأيهما امتنع عنه حبس حتى يأتي به كالمديون إذا امتنع عن إفاء حق عليه، ولذا لما قذف هلال زوجته قال له رسول الله البيئة وإلا حد في ظهرك، فدل على أنه كان في الابتداء ويوجب الحد كقذف الأجنبات، ثم لما نزلت آية اللعان انتسخ في حق الزوجات، كما في البدائع» و «العناية». قاله في البحر الرائق».
۲ قوله : فتلاعنا إلخ : أصله من اللعن، وهو الطرد والإبعاد عن رحمة الله، ومعناه الشرعي عندنا شهادات مؤكدات بالأيمان مقرونة باللعن. وقال الشافعي: هي أيمان مؤكدات بلفظ الشهادة، فيشترط أهلية اليمين عنده، فيجري بين المسلم وامرأته الكافرة وبين الكافر والكافرة وبين العبد وامرأته، وبه قال مالك وأحمد، وعندنا يشترط أهلية الشهادة، فلا يجري إلا بين المسلمين الحرين العاقلين البالغين غير محدودين في قذف للشافعي له قوله تعالى: فَشَهَدَهُ أَحَدِهِمْ أَرْبَعُ شَهَدَاتٍ بِاللهِ ﴾ (النور:٦ محكم في اليمين، والشهادة تحتمل اليمين، فحملنا المحتمل على المحكم، لا سيما إذا تعذر حمله على الحقيقة؛ لأن الشهادة لنفسه غير مقبولة، بخلاف اليمين، وتكرره يدل على أنه يمين أيضًا؛ لأنها شرعت مكررة، كما في القسامة دون أداء الشهادة.
ولنا قوله تعالى: ﴿وَالَّذِينَ يَرْمُونَ أَزْوَاجَهُمْ وَلَمْ يَكُن لَّهُمْ شُهَدَاءُ إِلَّا أَنفُسُهُمْ ﴾ (النور: ٦) استثنى «أنفسهم» عن الشهداء، فثبت أنهم شهداء؛ لأن المستثنى يكون من جنس المتسثنى منه، ثم نص على شهادتهم، فقال: ﴿فَشَهَادَةُ أَحَدِهِمْ أَرْبَعُ شَهَدَاتٍ بِاللهِ﴾ (النور: ٦ فنص على الشهادة واليمين فقلنا: الركن هو الشهادة المؤكدة باليمين، والتأكيد لا يخرجه من أن يكون شهادة. وقوله: الشهادة لنفسه غير مقبولة، قلنا: إنما لا تقبل في موضع التهمة، وأما إذا انتفت التهمة فمقبولة، قال الله تعالى: ﴿شَهِدَ اللهُ أَنَّهُ لَا إِلَهَ إِلَّا هُوَ (آل عمران : ۱۸، فهذا من أصدق الشهادات لانتفائه من التهمة والتهمة فيما نحن فيه منتفية باليمين. قاله العيني.
فشهاداته قائمة مقام حد القذف في حقه، وشهادتها مقام حد الزنا في حقها، أي إذا تلاعنا سقط عنه حد القذف وعنها حد الزنا؛ لأن الاستشهاد بالله مهلك كالحد بل أشد، ثم اللعان عند عدم إقامة الشهود، فإن أقام الزوج أربعة شهداء على زناها فلا لعان ولا حد عليه، بل تحد حد الزنا، وكذا إذا أقرت بالزنا وصدقت الزوج.
وبالجملة اللعان إنما يكون إذا رمى لرجل زوجته بالزنا وأنكرته ولم يأت بالشهود، وشرطه قيام الزوجية وكون النكاح صحيحا لا فاسدا وسبيه قذف الرجل زوجته قذفا يوجب الحد في الأجنبية خصت بذلك؛ لأنها هي المقذوفة فتتم لها شروط الإحصان.
وركنه شهادات مؤكدات باليمين واللعن، وحكمه حرمة الوطئ والاستمتاع بعد التلاعن ولو قبل التفريق بينهما ؛ الحديث المتلاعنان لا يجتمعان أبدًا، وأهله من هو أهل للشهادة على المسلم، أي كل من الزوجين القاذف والمقذوف يكون صالحا للشهادة، أي لأدائها بأن لا يكون أحدهما محدودا في قذف أو كافرا أو مجنونا أو قنا أو صغيرًا، ويدخل فيه الفاسق والأعمى؛ لأنهما من أهل أداء الشهادة فإذا قذف الرجل زوجته بالزنا، فلا يخلو إما أن يكون كل منهما أهلا للشهادة أولا، فإن لم يكن كل منهما أهلا للشهادة، فتفصيله على ما في الدر المختار» و«رد المحتار» أنه إذا لم يصلح الزوج شاهدا لرقه أو كفره بأن أسلمت، ثم قذفها قبل عرض الإسلام عليه، وكان أهلا للقذف، أي بالغا عاقلا ناطقا حد.
الأصل أن اللعان إذا سقط لمعنى من جهته، فلو كان القذف صحيحا حد وإلا فلا حد ولا لعان، فإن صلحشاهدا، والحال أنها هي لم تصلح أو ممن لا يحد قاذفها فلا حد عليه كما لو قذفها أجنبي ولا لعان؛ لأنه خلفه، لكنه يعزر حسما لهذا الباب، وبقي ما لو سقط من جهتهما، كما لو كانا محدودين في قذف فهو كالأول؛ لأنه سقط لمعنى من جهته؛ لأن البداءة به، فلا تعتبر جهتها معه، انتهى. ويدل عليه حديث: أربعة من النساء لا ملاعنة بينهن : النصرانية تحت المسلم، واليهودية تحت المسلم، والمملوكة تحت الحر، والحرة تحت المملوك، أخرجه ابن ماجه وغيره. قاله في عمدة الرعاية».
وقال في التفسيرات الأحمدية»: وإن كان كل منهما أهلا للشهادة، فطالبت المرأة به يجب على الرجل أن يلاعن فإن أبي من اللعان حبس حتى يلاعن، أو يكذب الرجل نفسه، فحينئذ يجب حد القذف، وإن شاء أن يلاعن يقول: أربع مرات بالله إني لمن الصادقين فيما رميتها به من الزنا، ويقول مرَّةً خامسة : لعنة الله علي إن كنت من الكاذبين، وهذا لعان الرجل، وبه يسقط عن الرجل حد القذف، فبعد لعان الرجل يجب على المرأة أن تلاعن، فإن أبت حبست حتى لا عن أو تصدق زوجها فتحد حد الزنا، وعند الشافعي يجب عليها حد الزنا بمجرد النكول عن اللعان، وإن شاءت أن تلاعن تقول أربع مرات : بالله إنه لمن الكاذبين فيها رماني به من الزنا، وتقول مرة خامسة: غضب الله علي إن كان من الصادقين، هذا لعان المرأة.
وبهذا القدر سقط عنها حد الزنا، وهذا معنى قوله تعالى: ﴿وَيَدْرَوُا عَنْهَا الْعَذَابَ (النور: ۸ فحينئذ استويا في سقوط الحد، انتهى. وقال في البدائع: اختلف العلماء في حكم اللعان قال أصحابنا الثلاثة: هو وجوب التفريق ما داما على حال اللعان لا وقوع الفرقة بنفس اللعان من غير تفريق الحاكم حتى يجوز طلاق الزوج وظهاره وإيلائه، ويجري التوارث بينهما قبل التفريق. وقال زفر والشافعي: هو وقوع الفرقة بنفس اللعان إلا أن عند زفر لا تقع الفرقة ما لم يلتعنا، وعند الشافعي تقع الفرقة بلعان الزوج قبل أن تلتعن المرأة، وجه قول الشافعي: أن الفرقة أمر يختص بالزوج. ألا ترى أنه هو المختص بسبب الفرقة، فلا يقف وقوعها على فعل المرأة كالطلاق، واحتج زفر بما روى عن رسول الله الله أنه قال: المتلاعنان لا يجتمعان أبدا، وفي بقاء النكاح اجتماعهما، وهو خلاف النص.
والجواب عنه: أن المراد بعد تفريق الحاكم، تشهد له ما في سنن أبي داود ومضت السنة في المتلاعنين أن يفرق بينهما، ثم لا يجتمعان، والذي يدلُّ على أن التفريق لا يقع بنفس التلاعن ما ورد في صحيح البخاري وغيره: أن عويمر العجلاني بعد ما لا عن قال: يا رسول الله ! كذبت عليها إن أمسكتها فطلقها ثلاثا، ولو كانت الفرقة حصلت بنفس التلاعن لأنكر عليه رسول الله الله في إيقاعه الطلقات، ويقال له : هي ليست زوجتك حتى تطلقها، فسكوته دل على أنها محل لوقوع الطلاق، وإن الفرقة لم تحصل بعد. وقال في «العناية»: فإن قيل: قد أنكر عليه بقوله: اذهب فلا سبيل لك عليها، أجيب بأن ذلك منصرف إلى طلبه رد المهر فإنه روي أنه قال: إن كنت صادقا فهو لها بما استحللت من فرجها، وإن كنت كاذبا فلا سبيل لك عليها
وقال في البحر الرائق: أما قول البيهقي في المعرفة»: إن عويمرا حين طلقها ثلاثا كان جاهلا بأن اللعان فرقة، فصار كمن شرط القضمان في السلف، وهو يلزمه شرط أو لم يشرط، بخلاف المظاهر والجواب أن الاستدلال إنما هو لعدم إنكاره عليه ، لا بمجرد فعله، كما لا يخفى، انتهى. ولنا أيضًا ما روي نافع عن ابن عمر لهما : أن رجلا لا عن امرأته في زمن النبي ﷺ وانتفى من ولدها، ففرق النبي الله بينهما وألحق الولد بالمرأة، وعن ابن عباس له : أن النبي ﷺ لما لا عن بين عاصم بن عدي وبين امرأته فرق بينهما وري: أن رسول الله ﷺ لا عن بين العجلاني وبين امرأته. فلما فرغا من اللعان فرق بينهما، فدلت الأحاديث على أن الفرقة لا تقع بلعان الزوج، ولا بلعانها؛ إذ لو وقعت لما احتمل التفريق من رسول الله ﷺ بعد وقوع الفرقة بينهما بنفس اللعان.
وقال في البدائع»: واختلف العلماء فيه أيضًا، قال أبو حنيفة ومحمد الفرقة في اللعان بتطليقة بائنة، فيزول ملك النكاح وتثبت حرمة الاجتماع والتزوج ما داما على حالة اللعان، فإن أكذب الزوج نفسه فجلد الحد، أو أكذبت المرأة نفسها بأن صدقته جاز النكاح بينهما، ويجتمعان وقال أبو يوسف وزفر والحسن بن زياد: هي فرقة بغير طلاق، وإنها توجب حرمة مؤبدة، كحرمة الرضاع والمصاهرة، واحتجوا بقول النبي : المتلاعنان لا يجتمعان أبدا، وهو نص في الباب، ولأبي حنيفة ومحمد ما روي أن رسول الله الله لما لا عن بين عويمر العجلاني وبين امرأته، فقال عويمر : كذبت عليها يا رسول الله ! إن أمسكتها فهي طالق ثلاثا.
وفي بعض الروايات: كذبت عليها إن لم أفارقها فهي طالق ثلاثا، فصار طلاق الزوج عقيب اللعان سنة المتلاعنين؛ لأن عويمرا طلق زوجته ثلاثا بعد اللعان عند رسول الله ، فأنفذها عليه رسول الله ﷺ، فيجب على كل ملاعن أن يطلق، فإذا امتنع ينوب القاضي منابه في التفريق، فيكون طلاقا، كما في العنين، ولأن سبب هذه الفرقة قذف الزوج؛ لأنه يوجب اللعان واللعان يوجب التفريق والتفريق يوجب الفرقة، فكانت الفرقة بهذا الوسائط مضافة إلى القذف السابق، وكل فرقة تكون من الزوج أو يكون فعل الزوج سببها تكون طلاقا، كما في العنين والخلع والإيلاء ونحو ذلك وهو قول السلف إن كل فرقة وقعت من قبل الزوج من نحو إبراهيم والحسن وسعيد بن جبير وقتادة وغيرهم ، وأما الحديث فلا يمكن العمل بحقيقته؛ لما ذكرنا أن حقيقة المتفاعل هو المتشاغل بالفعل، وكما فرغا من اللعان ما بقيا متلاعنين حقيقة، فانصرف المراد إلى الحكم، وهو أن يكون حكم اللعان فيهما ثابتا، فإذا أكذب الزوج نفسه وحد حد القذف بطل حكم اللعان فلم يبق متلاعنان حقيقة وحكما فجاز اجتماعهما، انتهى. لذلك قال في «الهداية»: لا يجتمعان ما داما متلاعنين.
۳ قوله: فطلقها ثلاثا إلخ لذلك قال في البدائع» و«البحر الرائق: فيجب على كل ملاعن أن يطلق، فإذا امتنع ينوب القاضي منابه في التفريق، فيكون طلاقا، كما في العنين.
۴ قوله: لا ما مضى من كتاب الله إلخ : أي لولا أن القرآن حكم بعدم إقامة الحد والتعزير على المتلاعنين لفعلت بها ما فعلت، وقالوا: في الحديث دليل على أن الحاكم لا يلتفت إلى المظنة والأمارات والقرائن، وإنما يحكم بظاهر ما يقتضيه الحجج والدلائل، ويفهم من كلامهم هذا أن الشبه والقيافة ليست بحجة، وإنما هي إرادة ومظنة، فلا يحكم بها كما هو مذهبنا. كذا في «اللمعات».
۵ قوله: فشهادة أحدهم إلخ : قال الشافعي: إن اللعان يمين، وذهب أبو حنيفة وأصحابه إلى أنه شهادة، واحتجوا بقوله تعالى: ﴿فَشَهَادَةُ أَحَدِهِمْ أَرْبَعُ شَهَدَاتٍ بِاللهِ (النور: ٦) وبقوله ﷺ في هذا الحديث: فجاء هلال فشهد، ثم قامت فشهدت «نيل الأوطار» ملخصا.
۶ قوله: لا مال لك إلخ: اعلم أن المهر يجب بالعقد إما بالتسمية إذا وجدت، وإلا فبحكم الشرع كوجوب مهر المثل عند عدم التسمية، ثم يستقر المهر بأحد أشياء ثلاثة: الدخول أو الخلوة الصحيحة أو موت أحد الزوجين؛ لأن بالدخول يتحقق تسليم المبدل فيتأكد البدل، وهو المهر، والخلوة قائمة شرعًا مقام الدخول؛ لكونها سببًا له مفضيا إليه غالبا، وبالموت ينتهي النكاح والشيء بانتهاء يتقرر ويتأكد. كذا في الهداية» و«البناية»، وبهذا ظهر أنه ليس وجوب المسمى عند الوطئ أو الموت، بل وجوبه بنفس العقد، وبما ذكر يتأكد. قال في البدئع»: وإذا تأكد المهر بما ذكر لا يسقط بعد ذلك، وإن كانت الفرقة من قبلها؛ لأن البدل بعد تأكده لا يحتمل السقوط إلا بالإبراء، انتهى. وبه ظهر أنه لا يسقط المهر بنشوز المرأة نعم تسقط به النفقة، وما في بعض الفتاوى من سقوط المهر بالنشوز غير معتمد عليه. كذا في عمدة الرعاية».
وَعَنْ عَمْرِو بْنِ شُعَيْبٍ عَنْ أَبِيْهِ عَنْ جَدِّهِ ، أَنَّ النَّبِيَّ ﷺ قَالَ: «أَرْبَعُ مِنَ النِّسَاءِ لَا مُلَاعَنَةَ بَيْنَهُنَّ النَّصْرَانِيَّةُ تَحْتَ الْمُسْلِمِ، وَالْيَهُودِيَّةُ تَحْتَ الْمُسْلِمِ، وَالْحُرَّةُ تَحْتَ الْمَمْلُوكِ، وَالْمَمْلُوكَةُ تَحْتَ الْحُرَّ». رَوَاهُ ابْنُ مَاجَه.
Amr ibn Shu‘ayb narrated from his father, from his grandfather (may Allah be pleased with him): The Prophet (ﷺ) said: “Four women have no mutual cursing with them: a Christian woman under a Muslim, a Jewish woman under a Muslim, a free woman under a slave, and a slave woman under a free man.” [Narrated by Ibn Majah]
وَعَنِ الْمُغِيرَةِ (رضي الله عنه) قَالَ سَعْدُ بْنُ عُبَادَةَ: لَوْ رَأَيْتُ رَجُلًا مَعَ امْرَأَتِي لَضَرَبْتُهُ بِالسَّيْفِ غَيْرَ مُصْفَحٍ، فَبَلَغَ ذَلِكَ رَسُولَ اللهِ ﷺ فَقَالَ: «أَتَعْجَبُوْنَ مِنْ غَيْرَةِ سَعْدٍ فَوَالله! لَأَنَا أَغْيَرُ مِنْهُ وَاللهُ أَغْيَرُ مِنِّي، وَمِنْ أَجْلِ غَيْرَةِ الله حَرَّمَ الْفَوَاحِشَ مَا ظَهَرَ مِنْهَا وَمَا بَطَنَ. وَلَا أَحَدَ أَحَبُّ إِلَيْهِ الْعُذْرُ مِنَ اللهِ، وَمِنْ أَجْلِ ذَلِكَ بَعَثَ الْمُبَشِّرِينَ وَالْمُنْذِرِينَ. وَلَا أَحَدَ أَحَبُّ إِلَيْهِ الْمِدْحَةُ مِنَ اللهِ، وَمِنْ أَجْلِ ذَلِكَ وَعَدَ الله الْجَنَّةَ». مُتَّفَقٌ عَلَيْهِ.
Al-Mughirah (may Allah be pleased with him) narrated that Sa‘d ibn Ubadah said: “If I found a man with my wife, I would strike him with the sword, not with its flat side.” This reached the Messenger of Allah (ﷺ), and he said: “Are you amazed at Sa‘d’s zeal? By Allah, I am more zealous than him, and Allah is more zealous than me. Because of Allah’s zeal, He has forbidden immoralities, both open and hidden. No one loves excuses more than Allah, and for that, He sent messengers bearing good news and warnings. No one loves praise more than Allah, and for that, Allah promised Paradise.” [Narrated by Bukhari and Muslim]

1 His statement: “If I found a man,” etc. Allamah al-Ayni said in Umdat al-Qari: It is understood from Sa‘d ibn Ubadah’s words (may Allah be pleased with him) that if this happened to him, he would kill the man. For this reason, when it reached the Prophet (ﷺ), he did not prohibit him from it. Al-Dawudi said: His statement: “Are you amazed at Sa‘d’s zeal?” indicates that he praised and permitted it for him in his relationship with Allah. Zeal is among the most praiseworthy qualities, and one who lacks it is not of commendable character. Our companions elaborated on this, saying: If a man finds someone with his wife or slave girl intending to overpower and commit adultery with her, he may kill him. If he sees him with his wife or a close relative who consents to it, he kills both the man and the woman. Some prohibited this outright. There is disagreement on the ruling. The majority said he is subject to retaliation. Ahmad and Ishaq said: If he provides evidence that he found him with his wife, his blood is spared. Al-Shafi‘i said: It is permissible for him in his relationship with Allah to kill the man if he is married and knows he committed an act requiring purification, but retaliation is not lifted in the apparent ruling. Al-Muhallab said: The hadith indicates that retaliation is obligatory for one who kills a man he found with his wife, as Allah, though more zealous than His servants, required witnesses for punishments. No one may transgress Allah’s limits, and no blood is spared by mere claim. In summary, according to Badr al-Majhud: One who kills a man he found committing adultery with his wife, the majority say he is subject to retaliation unless he provides evidence or the heirs of the killed confess. In his relationship with Allah, if he is truthful, he faces no consequence.
1 قوله: لو رأيت رجلا إلخ وقال العلامة العيني في عمدة القاري: يفهم من كلام سعد بن عبادة له أن هذا الأمر لو وقع له لقتل الرجل، ولهذا لما بلغ النبي الله لم ينهه عن ذلك حتى قال الداودي: قوله : أتعجبون من غيرة سعد ؟ يدل على أنه حمد ذلك وأجازه له فيما بينه وبين الله، والغيرة من أحمد الأشياء، ومن لم تكن فيه فليس على خلق محمود، وبالغ أصحابنا في هذا حيث قالوا: رجل وجد مع امرأته أو جاريته يريد أن يغلبها ويزني بها له أن يقتله، فإن رآه مع امرأته أو مع محرم له، وهي مطاوعة له على ذلك قتل الرجل والمرأة جميعًا، ومنهم من منع ذلك مطلقا، وقد اختلف في الحكم، فقال الجمهور: عليه القدد.
وقال أحمد وإسحاق: إن أقام بينة أنه وجده مع امرأته هدر دمه. وقال الشافعي يسعه فيما بينه وبين الله قتل الرجل إن كان ثيبا، وعلم أنه نال منها ما يوجب الغسل، ولكن لا يسقط عنه القود في ظاهر الحكم، فقال المهلب: الحديث دال على وجوب القود فيمن قتل رجلا وجده مع امرأته؛ لأن الله عَزَّ وَجَلَّ وإن كان أغير من عباده، فإنه أوجب الشهود في الحدود، فلا يجوز لأحد أن يتعدى حدود الله، ولا يسقط دما بدعوى انتهى. فحاصله على ما في بذل المجهود : أن من قتل رجلا وجده مع امرأته قد زنى، قال الجمهور : يقتل إلا أن يقوم بذلك بينة أو يعترف له ورثة القتيل، وأما فيما بينه وبين الله تعالى إن كان صادقا فلا شيء عليه.
وَعَنْ أَبِي هُرَيْرَةَ (رضي الله عنه) قَالَ: قَالَ سَعْدُ بْنُ عُبَادَةَ: لَوْ وَجَدْتُ مَعَ أَهْلِي رَجُلًا لَمْ أَمَسَّهُ حَتَّى آتِي بِأَرْبَعَةِ شُهَدَاءَ، قَالَ رَسُولُ اللهِ ﷺ نَعَمْ، قَالَ: كَلَّا وَالَّذِي بَعَثَكَ بِالْحَقِّ إِنْ كُنْتُ لَأُعَاجِلُهُ بِالسَّيْفِ قَبْلَ ذَلِكَ، قَالَ رَسُولُ اللهِ ﷺ : «اسْمَعُوْا إِلَى مَا يَقُولُ سَيِّدُكُمْ، إِنَّهُ لَغَيُورٌ وَأَنَا أَغْيَرُ مِنْهُ، وَالله أَغْيَرُ مِنِّي». رَوَاهُ مُسْلِمٌ.
Abu Hurairah (may Allah be pleased with him) narrated that Sa‘d ibn Ubadah said: “If I found a man with my wife, I would not touch him until I brought four witnesses.” The Messenger of Allah (ﷺ) said: “Yes.” He said: “No, by the One who sent you with the truth, I would hasten to him with the sword before that.” The Messenger of Allah (ﷺ) said: “Listen to what your leader says. 1 The statement: “When you contract a debt”: Although this verse appears to apply to all debts, whether for a sold item or its price, it is narrated from Ibn ‘Abbas (may Allah be pleased with him) that it refers to forward sales. In Al-Hidayah, it is stated: Forward sale is a legislated contract based on the Book, which is the verse of indebtedness. Ibn ‘Abbas said: I bear witness that Allah, the Exalted, has permitted forward sales guaranteed for a known term in His Book and revealed the longest verse in His Book regarding it, reciting: O you who have believed, when you contract a debt (Al-Baqarah: 282). This is stated in Tafsir Al-Ahmadiyya. 2 The statement: “A pledge taken”: In Al-‘Inayah, it is stated: The legitimacy of pledges is based on Allah’s saying: Then [let there be] a pledge taken (Al-Baqarah: 283). The plural of pledge is like the plural of servant. It is also based on the narration that he bought food from a Jew and pledged his iron armor, on consensus, as the Muslim community agreed on its permissibility without objection, and on reason, as it is a contract securing the side of fulfillment. It is akin to a guarantee on the side of obligation. The explanation is that a debt has two aspects: obligation and fulfillment. It is first obligatory on the person, then the wealth is fulfilled afterward. The guarantee pertains to the obligation tied to the person, which is surety, and it is permissible. Likewise, the guarantee tied to wealth is permissible, even more so, as fulfillment is the goal, and obligation is a means to it.
۱ قوله: خذ ذهبك مني إلخ الأصل أن مسائل ما يدخل في البيع تبعا، وما لا يدخل مبنية على قاعدتين، إحداهما: ما أفاده بقوله: كل ما كان في الدار من البناء يعني كل ما هو متناول اسم المبيع عرفا يدخل بلا ذكر ، وذكر الثانية بقوله: أو متصلا به تبعا لها دخل في بيعها، يعني أن كل ما كان متصلا بالمبيع اتصال قرار، وهو ما وضع، لا لأن يفصله البشر دخل تبعا، وما لا فلا، وما لم يكن من القسمين، فإن من حقوقه ومرافقه دخل بذكرها وإلا لا، فيدخل الحجارة المخلوقة والمثبتة في الأرض والدار لا المدفونة، يدل عليه قولهم: لو اشترى أرضا بحقوقها، وانهدم حائط منها، فإذا فيه رصاص أو ساج أو خشب من جملة البناء كالذي يكون تحت الحائط يدخل، وإن شيئًا مودعا فيه فهو للبائع، وإن قال البائع ليس لي فحكمه حكم اللقطة، فقولهم: «شيئًا مودعا» يدخل فيه الأحجار المدفونة، ويقع كثيرا في بلادنا أنه يشتري الأرض أو الدار، فيرى المشتري فيها بعد حفرها أحجار المرمر والكدان والبلاط، والحكم فيه إن كان مبنيا فللمشتري وإن موضوعا لا على وجه البناء فللبائع، وهي كثيرة الوقوع، فاغتنم ذلك. بقي لو ادعى البائع أنها كانت مدفونة فلم تدخل والمشتري أنها مبنية، فقد يقال: يتحالفان؛ لأنه يرجع إلى الاختلاف في قدر المبيع، وقد يقال: يصدق البائع؛ لأن اختلافهما في تابع لم يرد عليه العقد، والتحالف على خلاف القياس فيما ورد عليه العقد، فلا يقاس عليه غيره، والبائع ينكر خروجه عن ملكه، والأصل بقاء ملكه، فتأمل. كذا في «الدر المختار» و «رد المحتار».

Jabir ibn Atik (may Allah be pleased with him) narrated that the Prophet (ﷺ) said: “There is zeal that Allah loves and zeal that Allah hates. The zeal Allah loves is zeal in the face of suspicion, and the zeal Allah hates is zeal without suspicion. There is pride that Allah hates and pride that Allah loves. The pride Allah loves is a man’s pride in himself during battle and during charity, and the pride Allah hates is pride in boasting.” In another narration: “in oppression.” [Narrated by Ahmad, Abu Dawud, and al-Nasa’i]

Aishah (may Allah be pleased with her) narrated: The Messenger of Allah (ﷺ) left her at night. She said: I felt zealous about him. He came and saw what I was doing and said: “What is wrong with you, O Aishah, are you zealous?” I said: “Why wouldn’t someone like me be zealous over someone like you?” The Messenger of Allah (ﷺ) said: “Your devil has come to you.” She said: “O Messenger of Allah, is there a devil with me?” He said: “Yes.” She said: “And with you, O Messenger of Allah?” He said: “Yes, but Allah has helped me against him until he submitted.” [Narrated by Muslim]

Ibn Umar (may Allah be pleased with them) narrated that the Prophet (ﷺ) performed mutual cursing between a man and his wife, and he disowned her child. He separated them and attributed the child to the woman. [Narrated by Bukhari and Muslim]
In their hadith: The Messenger of Allah (ﷺ) admonished him, reminded him, and informed him that the punishment of this world is easier than the punishment of the Hereafter. 1 His statement: “He disowned her child,” etc. Meaning, if a man accuses his wife by denying the child or by denying the child and accusing her of adultery, the judge separates them, and the child’s lineage is negated and attributed to the mother, provided they mention the accusation in the mutual cursing. This is stated in Sharh al-Wiqayah and al-Tafsir al-Ahmadiyya. In Umdat al-Qari: This hadith encompasses three rulings. First, mutual cursing, with no disagreement, and there is consensus on its validity and legislation. Second, separation, where scholars differed. It was mentioned earlier that according to Malik and al-Shafi‘i, separation occurs by mutual cursing itself, while according to Abu Hanifah, it occurs only by the judge’s ruling, based on the apparent meaning of the mentioned hadith, which is evidence against the opponents. This was the view of al-Thawri, Abu Hanifah, and al-Shafi‘i, though they required discipline and deterrence. They cited the hadith of this chapter, and Bukhari’s chapter heading supports this. Others said implication is like explicit accusation, narrated from Umar, Uthman, Urwah, al-Zuhri, and Rabi‘ah. This was the view of Malik and al-Awza‘i. This is stated in Umdat al-Qari. In Rahmat al-Ummah: Implication does not warrant punishment according to Abu Hanifah, even if intended as an accusation. Malik said it warrants punishment absolutely. وأفاد الحديث عدم جواز نفي الولد بمجرد الوهم والخيال من دون دليل قوي، وفيه إثبات القياس والاعتبار وضرب الأمثال. قاله في التعليق الممجد». وقال في المرقاة: وفائدة الحديث المنع عن نفي الولد بمجرد الأمارات الضعيفة، بل لا بد من تحقق وظهور دليل قوي كأن لم يكن وطئها أو أتت بولد قبل ستة أشهر من مبتدأ وطئها، وإنما يعتبر وصف اللون ههنا لدفع التهمة؛ لأن الأصل برائة المسلمين، بخلاف ما سبق من اعتبار الأوصاف في حديث شريك، فإنه لم يكن هناك لدفع التهمة لينبه على أن تلك الحلية الظاهرة مضمحلة عند وجود نص كتاب الله، فكيف بالآثار الخفية.
وَعَنْ عَائِشَةَ (رضي الله عنها) قَالَتْ: كَانَ عُتْبَةُ بْنُ أَبِي وَقَّاصٍ عَهِدَ إِلَى أَخِيهِ سَعْدِ بْنِ أَبِي وَقَّاصٍ أَنَّ ابْنَ وَلِيدَةِ زَمْعَةَ مِنِّي فَاقْبِضْهُ إِلَيْكَ. فَلَمَّا كَانَ عَامُ الْفَتْحِ أَخَذَهُ سَعْدُ، فَقَالَ: إِنَّهُ ابْنُ أَخِي، وَقَالَ عَبْدُ بْنُ زَمْعَةَ: أَخِي ، فَتَسَاوَقَا إِلَى رَسُولِ الله ، فَقَالَ سَعْدُ: يَا رَسُولَ الله! إِنَّ أَخِي قَدْ كَانَ عَهِدَ إِلَيَّ فِيهِ، وَقَالَ عَبْدُ بْنُ زَمْعَةَ: أَخِي، وَابْنُ وَلِيدَةِ أَبِي، وُلِدَ عَلَى فِرَاشِهِ، فَقَالَ رَسُولُ اللهِ : هُوَ لَكَ ۱ يَا عَبْدُ بْنَ زَمْعَةَ الْوَلَدُ لِلْفِرَاشِ وَلِلْعَاهِرِ الْحَجَرُ». ثُمَّ قَالَ لِسَوْدَةَ بِنْتِ زَمْعَةَ: «احْتَجِيْ مِنْهُ»؛ لِمَا رَأَى مِنْ شَبَهِهِ بِعُتْبَةَ، فَمَا رَآهَا حَتَّى لَقِيَ الله مُتَّفَقٌ عَلَيْهِ.

Sa‘d said: “O Messenger of Allah, my brother entrusted me with him.” Abd ibn Zam‘ah said: “He is my brother, the son of my father’s slave girl, born on his bed.” The Messenger of Allah (ﷺ) said: “He is yours, O Abd ibn Zam‘ah. In a narration by al-Tahawi: He said: “Veil yourself from him, for he is not your brother.” Al-Tahawi narrated from Ikrimah: Ibn Abbas would visit his slave girl, and she became pregnant. He said: “He is not from me; I visited her in a way not intending a child.” In another narration by him from Sa‘id ibn al-Musayyib: A slave girl of Zayd ibn Thabit gave birth, and he said: “He is not from me; I withdrew from her.”

He cited this hadith, as the Messenger of Allah (ﷺ) said: “He is yours, O Abd ibn Zam‘ah,” then said: “The child belongs to the bed, and for the adulterer is the stone.” He attributed him to Zam‘ah not because of his son’s claim, as a son’s claim of lineage for another from his father is not accepted, but because his mother was Zam‘ah’s bed through his intercourse with her. A slave girl becomes a bed for her master through his intercourse or his acknowledgment of intercourse, not merely by ownership without intercourse. How could he order her, having made him her brother, to veil from him? In our view, he did not rule on anything except the ownership, attributing him to Abd ibn Zam‘ah and Zam‘ah’s other heirs, excluding Sa‘d. If someone says: What is the meaning of his saying connected to this: “The child belongs to the bed, and for the adulterer is the stone”? It is said: This was instruction to Sa‘d that you claim for your brother, but your brother had no bed. Lineage would be established from him if he had a bed. Since he had no bed, he is an adulterer, and for the adulterer is the stone. The author of al-Tawdih said: According to most scholars, a free woman is not a bed except with the possibility of intercourse, and the child is attributed within a period she could give birth, the minimum being six months. Abu Hanifah diverged, saying if he divorces her immediately after the contract without the possibility of intercourse and she bears a child six months from the contract, it is attributed to him. He also said: What Abu Hanifah held contradicts what Allah has made customary, that a child comes from the man’s and woman’s fluids. Al-Ayni said: Abu Hanifah did not diverge or contradict what Allah has made customary. The author of al-Tawdih and those who followed him did not grasp what Abu Hanifah understood in this issue. والدليل على ذلك أن رسول الله ﷺ قد أمر سودة بنت زمعة بالحجاب منه، فلو كان النبي ﷺ كان قد جعله ابن زمعة إذا لما حجب بنت زمعة منه ؛ لأنه الله لم يكن يأمر بقطع الأرحام، بل كان يأمر بصلتها، ومن صلتها التزاور، فكيف يجوز أن يأمرها، وقد جعله أخاها بالحجاب منه، هذا لا يجوز عليه ، وكيف يجوز ذلك عليه، وهو يأمر عائشة أن تأذن لعمها من الرضاعة عليها، ثم يحجب سودة ممن قد جعله أخاها وابن أبيها، ولكن وجه ذلك عندنا - والله أعلم - أنه لم يكن حكم فيه بشيء غير اليد التي جعله بها لعبد ابن زمعة ولسائر ورثة زمعة دون سعد، فإن قال قائل : فما معنى قوله الذي وصله بهذا الولد للفراش وللعاهر الحجر ؟ قيل له : ذلك على التعليم منه لسعد أي تدعي لأخيك وأخوك لم يكن له فراش، وإنما يثبت النسب منه لو كان له فراش، فإذا لم يكن له فراش فهو عاهر وللعاهر الحجر.
فإن قال قائل : إنما كان أمرها بالحجاب منه لما كان رأى من شبه بعتبة، كما في حديث عائشة ، قيل له : هذا لا يجوز أن يكون كذلك؛ لأن وجود الشبهة لا يجب به ثبوت نسب، ولا يجب بعدمه انتفاء النسب. ألا ترى إلى الرجل الذي قال الرسول الله ﷺ : إن امرأتي ولدت غلاما أسود، فقال له رسول الله : هل لك من إبل؟ فقال: نعم، قال: فما ألوانها ؟ فذكر كلاما قال: فهل فيها من أورق ؟ قال: إن فيها لورقا ، قال : مما ترى ذلك جاءها؟ قال: من عرق نزعه، فقال رسول الله ﷺ: ولعل هذا من عرق نزعه، فلم يرخص له رسول الله ﷺ في نفيه لبعد شبهه منه ولا منعه من إدخاله على بناته وحرمه، بل ضربه له مثلا الله به أن الشبه لا يوجب ثبوت الأنساب، وإن عدمه لا يجب به انتفاء الأنساب، فكذلك ابن وليدة زمعة لو كان وطئ زمعة لأمه يوجب ثبوت نسبه منه، إذا لما كان لبعد شبهه منه معنى، ولكان نسبه منه ثابتا لدخل على بناته، كما يدخل عليهن غيره من بنيه. وهذا الكلام متعقب بالرواية المصرحفيها بقوله: هو أخوك». ولكن يراد به أخوك في الدين، ويحتمل أن يكون أصل الحديث هو لك، فظن الراوي أن معناه أخوه في النسب، فحمله على المعنى الذي عنه، والخبر الذي يرويه عبد الله بن الزبير صرح بأنه قال: «فإنه ليس لك بأخ».
وفي حديث عمرو بن شعيب أحكام قضى بها رسول الله ﷺ في أوائل الإسلام ومبادي الشرع. قاله الخطابي؛ لذا لا يستدل به على عدم شرط الدعوة في نسب ولد الأمة، وأيضًا ظاهر الحديث الذي ذكر في المتن أن الولد إنهما يلحق بالأب بعد ثبوت الفراش، وهو لا يثبت إلا بعد إمكان الوطئ في النكاح الصحيح أو الفاسد وإلى ذلك ذهب الجمهور وروي عن أبي حنيفة الله أنه يثبت بمجرد العقد قال: حتى لو نكح المغربي مشرقية ولم يفارق واحد منهما وطئه، ثم أتت بولد لستة أشهر أو أكثر يلحقه. قاله في نيل الأوطار».
وقال صاحب التوضيح: وعند جمهور العلماء أن الحرة لا تكون فراشا إلا بإمكان الوطئ، ويلحق الولد في مدة تلد في مثلها، وأقل ذلك ستة أشهر، وشذ أبو حنيفة، فقال: إذا طلقها عقيب النكاح من غير إمكان وطئ فأتت بولد لستة أشهر من وقت العقد فإنه يلحقه. وقال أيضا: وما ذهب إليه أبو حنيفة خلاف ما أجرى الله تعالى به العادة من أن الولد إنما يكون من ماء الرجل وماء المرأة، انتهى. قال العلامة العيني: إن أبا حنيفة لم يشذ فيما ذهب إليه ولا خالف ما أجرى الله به العادة، وإن صاحب التوضيح ومن سلك مسلكه لم يدركا في هذه المسألة ما أدركه أبو حنيفة؛ لأنه احتج فيما ذهب إليه بقوله: الولد للفراش أي لصاحب الفراش، ولم يذكر فيه اشتراط الوطئ، ولأن العقد فيها كالوطئ، بخلاف الأمة فإنه ليس لها فراش، فلا يثت نسب ما ولدته الأمة إلا باعتراف مولاها، انتهى.
وقال في تنسيق النظام واعلم أن النووي شرط في هذا النسب إمكان الوطئ على ما هو مذهب مالك والشافعي ما وفيه رد على أبي حنيفة في عدم الاشتراط ومثل فيه المغربية والمشرقية، قال: وهذا ضعيف ظاهر الفساد ولا حجة له في إطلاق الحديث؛ لأنه خرج على الغالب، وهو حصول الإمكان عند العقد، انتهى. أقول عليه أما أولا أن الحكم قد يدار على الداعي، والدال نائبا عن المدعو والمدلول، ولا يلتفت إلى حقيقة وجودهما أصلا، كما في السفر والمشقة، فالعقد جعل بمنزلة الوطئ في هذا المعنى.
وقد قال النووي أيضًا: فإن كانت زوجة صارت فراشا بمجرد عقد النكاح فمذهبه ليس ضعيفًا ظاهر الفساد بل مذهبهم كذلك، وثانيا: أن مذهبهم خلاف إطلاق الحديث وخروجه على الغالب ممنوع، لا بد له من دليل وثالثا : أن الموطوءة إذا مضت عليها سنون هو زوجها في السفر وحاضت فيها مرات، فإذا طلقها تعتد بلا مرية مع أن براءة الرحم معلومة بالضرورة، وكذا لو كان معها ويعلم أنها تحيض، وليست بحامل كما هو السنة في الطلاق في طهر لا وطئ فيه، فظهر أن مطلق الوطئ جعل قائما مقام شغل الرحم، وإن علم برائتها قطعًا، فأين الإمكان ههنا؟ فقوله: مناف للأصول الشرعية، فافهم.
۲قوله: مع عدم الدلالة على حصول تباين الدارين وقال في الجوهر النقي: وأما صفوان فإن عمير بن وهب أدركه، وهو يريد أن يكركب البحر، فرجع به، وذكر القدوري في التجريد عن الواقدي: أنه أدركه بمرقاء السفن لأهل مكة، ومنه ركب المسلمون في الهجرة إلى الحبشةن ومنه أحدث قريش السفية التي سقفت بها الكعبة، وهذا الموضع من توابع مكة وفي حكمها، فلم يختلف به وبزوجه الدار.

Amr ibn Shu‘ayb narrated from his father, from his grandfather (may Allah be pleased with him): A man stood and said: “O Messenger of Allah, so-and-so is my son; I committed adultery with his mother in the pre-Islamic era.” The Messenger of Allah (ﷺ) said: “There is no claim in Islam. Ash-Shafi‘i said: The cause of separation is captivity, not the difference in abodes. The reasoning is that the difference in abodes disrupts mutual benefits, interrupting the marriage, while captivity entails ownership of the person, which does not inherently conflict with marriage initially, as when a man marries his slave woman to another, and likewise in continuation. If you say: It is reported that Zaynab, the daughter of the Prophet, migrated from Makkah to Madinah, leaving her husband Abu al-‘As ibn ar-Rabi‘ in Makkah. When he embraced Islam and arrived in Madinah, the Messenger of Allah (ﷺ) returned her to him under the original marriage. Sammak narrated from a freed slave of Banu Makhzumah: Two men had intercourse with a slave girl in one period of purity, and she became pregnant. It was not known from which of them the child was. They came to Umar, disputing over the child. Umar said: “I do not know how to judge this.” They went to Ali, who said: “He is shared between you; he inherits from both of you, and you both inherit from him, and he belongs to the one who remains of you.” [Narrated by al-Tahawi]

They went to Umar, who attributed him to both, so he inherits from them, and they inherit from him. Al-Shawkani said: It is narrated from Imam Yahya that the hadith of physiognomy is abrogated. Al-Tahawi narrated from Urwah ibn al-Zubair that Aishah informed him that marriage in the pre-Islamic era was of four types. One was that men would gather around a woman, and she would not refuse anyone who came to her. These were prostitutes who would place flags at their doors, and anyone who entered would have intercourse with her. If she became pregnant and gave birth, they would gather physiognomists, who would attribute the child to one of them, and he would be called his son, unable to refuse. When Allah sent Muhammad (ﷺ) with the truth, he abolished that form of marriage and its ruling, affirming people in the marriage that does not require physiognomists’ opinions. Al-Qari said: The hadith of al-Mudliji does not establish lineage by physiognomy; it is only for reinforcement and dispelling suspicion, like when a just witness testifies to seeing the crescent moon, and an astrologer agrees. The astrologer’s opinion is not a standalone proof for affirmation or negation but can reinforce a legal proof. Our evidence is the hadith: “The child belongs to the bed.” The inference is that the definite article and the lam of specification indicate exclusivity. Ibn al-Humam said: If a slave girl is shared between two partners and bears a child, and one claims it, his lineage is established from him, whether in sickness or health, and she becomes his umm walad by agreement, without compensating the partner’s share in solvency or insolvency. If both claim it, his lineage is established from both, and she becomes their umm walad, serving each one day. If one dies, she is freed, and the son inherits from both as a full son, and they inherit from him as one father. If one dies, the son’s entire inheritance goes to the surviving one. This is our view, as held by al-Thawri and Ishaq ibn Rahawayh. Al-Shafi‘i held this in his old opinion. Ahmad preferred the hadith of physiognomy, and it is said to be used if physiognomists are absent. Al-Shafi‘i said to refer to the physiognomist’s opinion, and if none is found, the matter is deferred until the child reaches maturity and chooses one. If he does not choose, his lineage remains deferred, not established except from his mother.

1 قوله: فقال: هو بينكما يرثكما وترثانه إلخ فيه دليل على عدم الحكم بقول القافة في نسب ولا غيره، به قال الكوفيون والثوري وأبو حنيفة وأصحابه. وقال الشافعي وغيره في حديث المدلجي ثبوت العمل بالقافة وصحة الحكم بقولهم في إلحاق الولد، ولولا ذلك لأنكر النبي لا على مجزز ولقال له: وما يدريك؟ فلما سكت ولم ينكر عليه دل أن ذلك القول مما يؤدي إلى حقيقة يجب بها الحكم، وكان من الحجة للحنفية عليهم أن سرور النبي ﷺ بقول مجزز المدلجي الذي ذكر في حديث عائشة ليس فيه دليل على ما توهموا من واجب الحكم بقول القافة؛ لأن أسامة قد كان نسبه ثبت من زيد الله قبل ذلك، ولم يحتج النبي الله في ذلك إلى قول أحد، ولولا ذلك لما كان دُعِي أسامة فيما تقدم إلى زيد.
وإنما تعجب النبي من إصابة مجزز كما يتعجب من ظن الرجل الذي يصوب بظنه حقيقة الشيء الذي ظنه، ولا يجب الحكم بذلك، فترك رسول الله ﷺ الإنكار عليه ؛ لأنه لم يتعاط بقوله ذلك إثبات ما لم يكن ثابتا، وقد قال تعالى: ﴿وَلَا تَقْفُ مَا لَيْسَ لَكَ بِهِ عِلْمٌ﴾ (الإسراء: ٣٦). كذا في شرح معاني الآثار» ملخصا. وقال القاري: ليس في حديث المدلجي ثبوت النسب بعلم القيافة إنما هو تقوية ودفع تهمة ورفع مظنة كما إذا شهد عدل برؤية هلال ووافقه منجم، فإن قول المنجم لا يصلح أن يكون دليلا مستقلا، لا نفيا ولا إثباتا، ويصح أن يكون مقويا للدليل الشرعي، انتهى. واحتج لنا صاحب البحر بحديث: الولد للفراش». ووجه الاستدلال به أن تعريف المسند إليه، واللام الداخلة على المسند للاختصاص يفيدان الحصر.
قال ابن الهمام: وإذا كانت الجارية بين شريكين فجاءت بولد فادعاه أحدهما ثبت نسبه منه، سواء كانت في المرض أو الصحة، وصارت أم ولد له اتفاقا، لا أنه يضمن نصيب شريكه في اليسار والإعسار، قال: وإن ادعياه معا يثبت نسبه منهما، وكانت الأم أم ولد لهما، فتخدم كلا منهما يوما، وإذا مات أحدهما عتقت ويرث الابن من كل منهما ميراث ابن كامل، ويرثان منه ميراث أب واحد، وإذا مات أحدهما كان كل من ميراث الابن للباقي منهما، وقال: وبقولنا قال الثوري وإسحاق بن راهويه، وكان الشافعي يقوله في القديم، ورجح عليه أحمد حديث القيافة، وقيل: يعمل به إذا فقدت القافة. وقال الشافعي : يرجع إلى قول القائف، فإن لم يوجد القائف وقف حتى يبلغ الولد، فينسب إلى أيهما شاء، فإن لم ينسب إلى واحد منهما كان نسبه موقوفا، لا يثبت له نسب من غير أمه، انتهى.
وفي بذل المجهود»: الجواب عما استدلوا على صحة القيافة بحديث اللعان حيث قال فيه : إلا جاءت به أصهب أسحم حمش الساقين فهو لزوجها وإن جاءت به أورق جعدا جماليا خدلج الساقين سابغ الأليتين فهو الذي رميت به، وهذه هي القيافة والحكم بالشبهة بأن هذا الحكم منه الله لم يكن الحكم بالقيافة، ولم يكن رسول الله قائفا قط، ولا عرف ذلك منه في مدة عمره ودعوى وجود القيافة فيه قدح في رسالته، بل هو حكم بالوحي الإلهي على أنه لو كانت القيافة معتبرة لكانت شرعية اللعان لغوا، بل يكون المداد على الشبه، فإذا كان الولد له شبها بالزوج ثبت كذبه، ويحد الزوج حد القذف، ولو كان له شبها بغير الزوج لكان يثبت شرعًا زناها وتحد حد الزنا.

وَعَنْ سَعْدِ بْنِ أَبِي وَقَّاصٍ وَأَبِي بَكْرَةَ (رضي الله عنهما) قَالَا : قَالَ رَسُوْلُ الله ﷺ: «مَنْ ادَّعَى إِلَى غَيْرِ أَبِيهِ وَهُوَ يَعْلَمُ فَالْجَنَّةُ عَلَيْهِ حَرَامٌ». مُتَّفَقٌ عَلَيْهِ.
Sa‘d ibn Abi Waqqas and Abu Bakrah (may Allah be pleased with them) narrated that the Messenger of Allah (ﷺ) said: “Whoever claims a father other than his own, knowing it, Paradise is forbidden to him.” [Narrated by Bukhari and Muslim]

1 The statement: Do not withhold excess water to withhold excess grass, they differed on whether this prohibition is for unlawfulness or disapproval. In At-Tawdih: The prohibition is for unlawfulness according to Malik and Al-Awza’i, and Al-Khattabi and Ibn At-Tin narrated it from Shafi’i. Some preferred it and interpreted it as recommended. The correct view among us is that it is obligatory to provide it for livestock, not for crops, as stated by Al-Ayni. He said: This is also the Hanafi view, specific to livestock. In Al-Hidayah: It is not permissible to sell or lease pastures, meaning grass, as per the statement: People are partners in three: fire, grass, and water. At-Tahawi and others said: This means if someone lights a fire, anyone can warm themselves by it or dry their clothes. He cannot take embers without permission. This is the meaning of partnership in fire. In water, it means drinking, watering animals, and drawing from owned wells, reservoirs, and rivers. In grass, it means harvesting it, even in owned land. This applies if the water is not contained in vessels or the grass is not cut. If they are contained, selling them is permissible, as containment makes them owned. This also applies if they grew naturally. If the owner watered and prepared the land for growth, and it grew, he can sell it, as he owns it, as in Adh-Dhakhirah, Al-Muhit, and An-Nawazil. This is the chosen view of As-Sadr Ash-Shahid and the majority. Al-Quduri prohibited its sale. In Fath Al-Qadir: Al-Quduri said: It is not permissible to sell grass in its land, even if he brought water to his land and incurred expenses, as the partnership in it is established naturally, and partnership ends only by containment. Bringing water to his land is not containment, so the grass remains shared, and selling it is not permissible. The majority hold the first view. Al-Halwani narrated from Muhammad (may Allah be pleased with him) that grass is what has no stem, and what has a stem is not grass. Al-Fadli said: It is also grass. In Al-Mughrib: It is everything grazed by animals. The details were covered in the chapter on prohibited sales.
وَعَنْهُ (رضي الله عنه)، أَنَّهُ سَمِعَ النَّبِيَّ ﷺ يَقُوْلُ لَمَّا نَزَلَتْ آيَةُ الْمُلَاعَنَةِ: «أَيُّمَا امْرَأَةٍ أَدْخَلَتْ عَلَى قَوْمٍ مَنْ لَيْسَ مِنْهُمْ، فَلَيْسَتْ مِنَ الله فِي شَيْءٍ، وَلَنْ يُدْخِلَهَا الله جَنَّتَهُ، وَأَيُّمَا رَجُلٍ جَحَدَ وَلَدَهُ وَهُوَ يَنْظُرُ إِلَيْهِ احْتَجَبَ اللهُ مِنْهُ، وَفَضَحَهُ عَلَى رُءُوسِ الْأَوَّلِينَ وَالْآخِرِينَ». رَوَاهُ أَبُو دَاوُدَ وَالنَّسَائِيُّ وَالدَّارِمِيُّ.
Abu Hurairah (may Allah be pleased with him) narrated that he heard the Prophet (ﷺ) say when the verse of mutual cursing was revealed: “Any woman who introduces to a people someone not from them is not from Allah in anything, and Allah will not admit her to His Paradise. 1 His statement: “Then keep her,” etc. Therefore, it is said in al-Durr al-Mukhtar: It is not obligatory for a husband to divorce an immoral wife. In Radd al-Muhtar: Nor is it obligatory for her to release an immoral husband, unless they fear they will not uphold Allah’s limits, in which case there is no harm in separating. Immorality includes adultery and other sins. The Prophet (ﷺ) said to one whose wife did not repel the hand of a toucher, and who said: “I love her,” “Enjoy her.”
1 The statement: And for divorced women, This verse clarifies the maintenance of divorced women, as provision refers to maintenance, which is the preferred view of the author of Al-Madarak. The meaning of the verse is that a divorced woman is entitled to maintenance from her husband as long as she is observing her waiting period, whether the divorce is revocable, irrevocable, or otherwise. This verse’s ruling remains in effect and is not abrogated by consensus. There is a difference of opinion regarding the irrevocably divorced woman, which will be discussed in this chapter, God willing. This is derived from At-Tafsir Al-Ahmadiyya.
2 The statement: Do not expel them, This means it is not permissible to expel a divorced woman observing her waiting period from her husband’s house, nor for her to leave. Do not expel them means, O husbands, do not remove them from their homes at the time of separation until their waiting period ends. Nor should they leave [At-Talaq: 1] means they should not leave voluntarily except if they commit a clear immorality [At-Talaq: 1], i.e., an evident sinful act that warrants a prescribed punishment, such as adultery or theft, in which case they may be expelled for that reason, or if she harms the household with obscenity or immorality, it is permissible to expel her as she is considered rebellious (nashiz). This exception applies to both forms of expulsion. In summary, the verse proves her right to housing and her obligation to remain in the place of separation. This is summarized from At-Tafsir Al-Ahmadiyya.
3 The statement: House them, This clarifies that providing housing is obligatory for a divorced woman observing her waiting period. House them means, O men, provide them a place where you dwell [At-Talaq: 6], i.e., a place from your residence according to your means [At-Talaq: 6], i.e., within your capacity. And do not harm them [At-Talaq: 6] in housing or maintenance to oppress them in their livelihood and force them to leave. The first phrase indicates partial provision, and the second clarifies it, as stated by the authors of Al-Kashshaf and Al-Madarak. Fakhr Al-Islam mentioned in Aqsam As-Sunnah that it means: Spend on them according to your means, indicating both housing and maintenance. This is from At-Tafsir Al-Ahmadiyya.
4 The statement: Menstrual periods, There is disagreement regarding the menstrual periods mentioned in the verse, whether they refer to periods of purity or menstruation. The apparent meaning of the Prophet’s (ﷺ) saying: She observes her waiting period with three menstruations, and his saying: She remains during her menstrual periods, and his saying: Her waiting period is two menstruations, and the narrations mentioned in the book, indicate that the menstrual periods are menstruations. This is the view of Abu Hanifah. This is derived from Nayl Al-Awtar.
۱ قوله: فأمسكها إذا لذلك قال في الدر المختار لا يجب على الزوج تطليق الفاجرة، انتهى. وقال في رد المحتار»، ولا عليها تسريح الفاجر، إلا إذا خاف أن لا يقيما حدود الله فلا بأس أن يتفرقا انتهى، «مجتبي» والفجور يعم الزنا وغيره، وقد قال ﷺ لمن زوجته لا ترديد لامس، وقد قال: إني أحبها: «استمتع بها».
