ف : واسع ہو کر لعان کے معنی لعنت اور دوری کے یعنی اوراصلاح ثبوت میں اس کو کہتے ہیں کہ خاوند نے اپنی بیوی پر زنا کی تہمت لگائی اور بیوی اس کا انکار کرتی ہے اور دونوں کے پاس سواں اپنے نفس کے اس کے گواہ نہیں ہیں تو حاکم ان کو بلا کر دونوں سے چار چار مرتبہ قسم لے کر وہ دونوں اپنے بیان میں پڑھیں اور پاچویں بارخود نے سے کہلاپیا جائے گا کہ ازام مجے تو اس پر خدا کا غضب نازل ہو اس کے بعد دونوں میں بمیش کے لے تفرق کرادی جائے گی، پھران میں ملاپ نہیں ہوسکتا اور نہ دوبارہ نکاح ہی ہوسکتا ہے -12 وقول اللہ عزوجل : " والذین یرمون ازواجہم ولم يكن لهم شهداء الا انفسهم فشهادۃ احدہم اربع شہادات با للہ، انه لمین الصدقین . والخامسة ان لعنة اللہ علیہ ان كان من الكاذبين . ویدروا عنها العذاب ان تشهد اربع شهادات بالله، انه لمین الكذبين . والخامسة ان غضب اللہ علیها ان كان میں الصدقین . ولولا فضل الله عليکم ورحمته وان الله تواب حکیم ". اور اللہ تعالی کا ارشاد ہے -(سورۃ نور، پ:18، ع:1آيت نمبر:6/10، میں )"اور جولگا پی پیوپ پر زنا کی تہمت لگائے ہیں اور بزرگ اپنے ان کا کوئی گواہ نہ ہوا لیے دعوی میں سے ہرا کی کا ثبوت نہیں ہے کروہ چار بار خدا کی قسم کحا کر بیان کرے بلا شک و شہر (اپنے دعوی میں ) سجاہے اور پاچویں (وفعم) پول (کہے) کہ آگر وہ جحوط پولنے تو اس پر خدا کی لعنہ ہو اور (شوہر کے حلف کے بعد) پیوی سے اس طرح پرزوال جاسکتی ہے کہ وہ ) (بھی ) چار بار خدا کی قسم کحا کر بیان کرے کہ شخص (زنا کی تہمت لگائے میں ) سرتا سر جحوط نے اور پاچویں (بار) پول (کہے) کہ آگر پی (شوہر اپنے دعوی میں ) سیاہوت اس عورت پر خدا کا غضب پڑے اور آگر اللہ کا فضل اور اس کی رحمت تم پرنہوتی اور پیکہ اللہ تو قبل فرامانہ اور حمت والا ہے (توتمہارا پردہ کھول دیتا)- لعان کا ایک واقعہ اور اس کے احكام سهل بن سعد ساعدی رضی اللہ عنہ سے روایت ہے، وہ فرماتے ہیں کہ

In the case of La'an (the mutual accusation of adultery between spouses), its meaning is that of cursing and separation, and in terms of establishing proof, it is said that if a husband accuses his wife of adultery and she denies it, and neither party has any witnesses other than themselves, then the judge shall summon them and take four oaths from each of them, affirming their statements, and on the fifth occasion, they shall be called upon to say, 'May the curse of Allah be upon me if I am lying.' After this, they shall be separated, and there can be no reconciliation or remarriage between them. And the command of Allah, the Exalted and Glorious, is: 'And those who accuse their wives [of adultery] and have no witnesses except themselves - then the testimony of one of them [shall be] four testimonies [swearing] by Allah that indeed, he is of the truthful. And the fifth [oath will be] that the curse of Allah be upon him if he should be among the liars. And it will avert the punishment from her if she testifies [in the same manner] four times by Allah that indeed, he is among the liars. And the fifth [oath will be] that the wrath of Allah be upon her if he is of the truthful. And were it not for the favor of Allah upon you and His mercy, and that Allah is Accepting of repentance and Wise [it would be otherwise].' And the guidance of Allah, the Most High, is (in Surah An-Nur, verse 18, Ayah number: 6/10): 'And those who accuse their wives [of adultery] and have no witnesses except themselves - then the testimony of one of them [shall be] four testimonies [swearing] by Allah that indeed, he is of the truthful. And the fifth [oath will be] that the curse of Allah be upon him if he should be among the liars. And (after the husband's oaths) the wife may avert the punishment from herself if she swears by Allah four times that he is among the liars. And the fifth [oath will be] that the wrath of Allah be upon her if he is of the truthful. And if it were not for the favor of Allah and His mercy upon you, and that Allah is Accepting of repentance and Wise, [you would be in great distress]. The incident of La'an and its rulings are narrated by Sahl bin Sad Sa'idi (RA), who said,

عویمر عجلان رضی اللہ عنہ (نے حاضر ہوئے) عرض کیا یرسول اللہ (صلی اللہ علیہ وسلم) اس شخص کے بارے میں کیا حکم ہے جواپی پیوی کے ساتھ کسی غیر آدمی کو (زنا کرتا ہوتا) پائے کیا وہ اس کو قتل کروے؟ اور (اگر وہ اس کو قتل کرتا ہے تو مقتو ل کے وارث) اس کو قتل کردیا گے! (صرف اس نے دیکھااور دور مرآ کونی گواہ نہیں، خاموش کہی بری ہے اور قتل کہی بری اب اس بارے میں) وہ کیا کرے؟ (پین کر) رسول اللہ صلی اللہ علیہ وسلم نے فرمایا تمہارے اورتمہاری پیوی کے بارے میں آیت نازل کی گئی ہے! جاو اور پیوی کو بلا لاوحضرت سهل فرماتے ہیں (دونوں حاضر ہوئے) ان دونوں نے مسبد میں لعان کیااور میں کہی (اس وقت) دورست لوگوں کے ساتھ رسول اللہ صلی اللہ علیہ وسلم کی خدمت میں حاضر تھا۔ جب دونوں (لعان سے) فارغ ہوئے تو عویمر نے کہا یرسول اللہ اگر میں اس عورت کو (زوجیت میں) رکھون تو جحوط ثابت ہوئے گا تو عویمر نے اس کو تین طلاق دی چھر رسول اللہ صلی اللہ علیہ وسلم نے ارشاد فرمایا تم دیکھتے رہو اگر یہ عورت سیاہ رنگ کا، کا جلی آکھیوں والا، موٹے سرکین والا، موٹی پنڈیوں والا پچھے جن تو میرا خیال ہے کہ عویمر سجاہے (عورت جحوط ہے) اوراگر وہ عورت ایسا پچھے جوسخ رنگ والا یسرخ رنگ کے کپڑے کی طرح ہو (جسے عویمر چھے) تو میرا غمان ہے کہ عویمر جحوط ہیں (اورعورت پچھے) چنانچہ اس عورت کو ایسائی پیہ پیداہوا جسیا کہ رسول اللہ صلی اللہ علیہ وسلم نے فرمایا جس سے عویمر (کے الزام) کی تصدیق ہوتی ہے۔ اس کے بعد اس (پچھے) کانسب اس کی مال کی طرف ہوئے لگا۔ (اس کی روایت بخاری اور مسلم نے متفرق طور پر لی ہے)

Sahl ibn Sa‘d al-Sa‘idi (may Allah be pleased with him) narrated: Uwaimir al-Jilani said: “O Messenger of Allah, if a man finds another man with his wife, should he kill him, and then you would kill him? Or what should he do?” The Messenger of Allah (ﷺ) said: “A revelation has been sent down concerning you and your wife, so go and bring her.” Sahl said: They performed mutual cursing in the mosque while I was among the people with the Messenger of Allah (ﷺ). When they finished their mutual cursing, Uwaimir said: “I have lied about her, O Messenger of Allah, if I keep her.” Then he divorced her thrice. The Messenger of Allah (ﷺ) said: “Observe, if she gives birth to a child who is dark, with intensely black eyes, large buttocks, and thick legs, I think Uwaimir has spoken the truth about her. But if she gives birth to a reddish child, as if it were a lizard, I think Uwaimir has lied about her.” She gave birth to a child matching the description the Messenger of Allah (ﷺ) gave for Uwaimir’s truthfulness, and thereafter, the child was attributed to its mother. [Narrated by Bukhari and Muslim]

In a narration by Abu Dawud: She gave birth to such a child, and the Prophet (ﷺ) said: “Were it not for what has been decreed in the Book of Allah, I would have dealt with her.” Abu Dawud also narrated from him: I witnessed the mutual cursing during the time of the Messenger of Allah (ﷺ) when I was fifteen years old, and the Messenger of Allah (ﷺ) separated them after they performed mutual cursing. Abu Dawud narrated from Ibn Abbas (may Allah be pleased with them): Hilal ibn Umayyah, one of the three whom Allah accepted their repentance, came from his land in the evening and found a man with his wife. He saw with his eyes and heard with his ears but did not confront him until morning. Then he went to the Messenger of Allah (ﷺ) and said: “O Messenger of Allah, I came to my wife in the evening and found a man with her. I saw with my eyes and heard with my ears.” The Messenger of Allah (ﷺ) disliked what he brought and was distressed by it. Then the verses were revealed: “And those who accuse their wives and have no witnesses except themselves, the testimony of one of them shall be four testimonies by Allah that he is of the truthful. And the fifth that the curse of Allah be upon him if he is of the liars. And it averts the punishment from her if she testifies four testimonies by Allah that he is of the liars. And the fifth that the wrath of Allah be upon her if he is of the truthful. And were it not for the favor of Allah upon you and His mercy, and that Allah is Accepting of repentance, Wise.” [Qur’an 24:6-10] The Messenger of Allah (ﷺ) was relieved and said: “Rejoice, O Hilal, for Allah has made a way out and relief for you.” Hilal said: “I was hoping for that from my Lord.” The Messenger of Allah (ﷺ) said: “Send for her.” She came, and the Messenger of Allah (ﷺ) recited the verses to them, admonished them, and informed them that the punishment of the Hereafter is more severe than the punishment of this world. Hilal said: “By Allah, I have spoken the truth about her.” She said: “He has lied.” The Messenger of Allah (ﷺ) said: “Let them perform mutual cursing.” It was said to Hilal: “Testify.” He testified four times by Allah that he was among the truthful. When it came to the fifth, it was said to him: “O Hilal, fear Allah, for the punishment of this world is easier than the punishment of the Hereafter, and this is the decisive one that will bring punishment upon you.” He said: “By Allah, Allah will not punish me for this as He did not flog me for it.” Then he testified the fifth time that the curse of Allah be upon him if he was among the liars. Then it was said to her: “Testify.” She testified four times by Allah that he was among the liars. When it came to the fifth, it was said to her: “Fear Allah, for the punishment of this world is easier than the punishment of the Hereafter, and this is the decisive one that will bring punishment upon you.” She hesitated for a moment, then said: “By Allah, I will not disgrace my people.” She testified the fifth time that the wrath of Allah be upon her if he was among the truthful. The Messenger of Allah (ﷺ) separated them. In a narration by al-Nasa’i from Ibn Abbas (may Allah be pleased with them): The Prophet (ﷺ) ordered a man, when he commanded the two who were performing mutual cursing, to place his hand over his mouth at the fifth testimony and said: “It is the decisive one.” In the agreed-upon narration: He said: “O Messenger of Allah, what about my property?” He said: “You have no claim to it. If you were truthful about her, it is for what you made lawful of her private parts. If you lied about her, it is even further from you.”

(1) His statement: “What should he do?” The Messenger of Allah (ﷺ) said: “A revelation has been sent down concerning you,” etc. According to al-Shafi‘i, the basis for accusing wives is the prescribed punishment based on the first verse: “And those who accuse chaste women and then do not produce four witnesses, flog them” [Qur’an 24:4]. The verse of mutual cursing clarifies that if the accuser is a husband, he can avert the punishment through mutual cursing. If the accused is the accuser’s wife, she can avert the punishment of adultery through her mutual cursing. If either refuses to perform mutual cursing, the original ruling applies, which is the punishment. Abu Hanifah and his companions held that the obligation for accusing a wife is only mutual cursing, not the punishment. According to us, the verse of mutual cursing abrogates the first verse concerning wives, as the specific ruling that comes later abrogates the general ruling to its extent. Thus, the first verse no longer applies to wives, and the obligation for accusing a wife is mutual cursing. If either refuses, they are imprisoned until they perform it, like a debtor who refuses to fulfill a debt. When Hilal accused his wife, the Messenger of Allah (ﷺ) said to him: “Evidence, or a punishment on your back,” indicating that initially, it warranted the punishment like accusing a non-wife. When the verse of mutual cursing was revealed, it abrogated this for wives, as stated in al-Bada’i‘ and al-Inayah. This was mentioned in al-Bahr al-Ra’iq.

(2) His statement: “They performed mutual cursing,” etc. Its root is from “curse,” meaning expulsion and distancing from Allah’s mercy. Its legal meaning according to us is testimonies confirmed by oaths accompanied by cursing. Al-Shafi‘i said: It is oaths confirmed with the wording of testimony. He requires the eligibility for taking an oath, so it applies between a Muslim and his non-Muslim wife, between a non-Muslim and a non-Muslim wife, and between a slave and his wife. This is also the view of Malik and Ahmad. According to us, the eligibility for testimony is required, so it only applies between free, sane, adult Muslims who have not been punished for false accusation. Al-Shafi‘i’s evidence is the verse: “The testimony of one of them shall be four testimonies by Allah” [Qur’an 24:6], which is definitive regarding oaths, and testimony can include oaths. We interpreted the ambiguous as the definitive, especially since testimony for oneself is not accepted, unlike an oath. Its repetition indicates it is an oath, as it was legislated repeatedly, like in the case of qasamah, unlike delivering testimony. Our evidence is the verse: “And those who accuse their wives and have no witnesses except themselves” [Qur’an 24:6]. It excludes “themselves” from witnesses, establishing that they are witnesses, as the exception is of the same type as what it is excepted from. Then it explicitly mentions their testimony: “The testimony of one of them shall be four testimonies by Allah” [Qur’an 24:6]. It specifies testimony and oath, so we say the core is testimony confirmed by an oath, and confirmation does not negate it being testimony. The claim that testimony for oneself is not accepted is invalid, as it is only rejected in cases of suspicion. When suspicion is absent, it is accepted, as Allah says: “Allah testifies that there is no deity except Him” [Qur’an 3:18], which is among the truest testimonies due to the absence of suspicion. In this case, suspicion is negated by the oath. This was stated by al-Ayni. His testimony stands in place of the punishment for false accusation, and her testimony stands in place of the punishment for adultery. If they perform mutual cursing, the punishment for false accusation is lifted from him, and the punishment for adultery is lifted from her, as invoking Allah is as severe as the punishment, or even more so. Mutual cursing occurs when there are no witnesses. If the husband provides four witnesses to her adultery, there is no mutual cursing or punishment for him, but she receives the punishment for adultery. Similarly, if she confesses to adultery and confirms the husband’s claim. In summary, mutual cursing occurs when a man accuses his wife of adultery, she denies it, and he does not provide witnesses. Its conditions include an existing valid marriage, not an invalid one, and the accusation must be one that would warrant punishment if made against a non-wife, as she is the accused, fulfilling the conditions of chastity. Its core is testimonies confirmed by oaths and cursing. Its ruling is the prohibition of intercourse and enjoyment after mutual cursing, even before separation, based on the hadith: “The two who perform mutual cursing shall never reunite.” Its participants are those eligible to testify among Muslims, meaning both the accuser and the accused must be fit to testify, not having been punished for false accusation, not being non-Muslims, insane, slaves, or minors. This includes the immoral and the blind, as they are eligible to testify. If a man accuses his wife of adultery, either both are eligible to testify, or they are not. If they are not, the details are as in al-Durr al-Mukhtar and Radd al-Muhtar. If the husband is ineligible to testify due to slavery or disbelief (e.g., she converted to Islam, and he accused her before being offered Islam) and is eligible to make the accusation (i.e., sane, adult, and articulate), he is punished. The basis is that if mutual cursing is void due to his status, if the accusation is valid, he is punished; otherwise, there is neither punishment nor mutual cursing. If he is eligible to testify, but she is not, or if her accuser would not be punished, he faces no punishment, as if a stranger accused her, and there is no mutual cursing, as it is absent. However, he is disciplined to prevent such actions. If it is void due to both, such as both having been punished for false accusation, it is like the first case, as it is void due to his status, since he initiated it, and her status is not considered alongside his. This is supported by the hadith: “Four women have no mutual cursing with them: a Christian woman under a Muslim, a Jewish woman under a Muslim, a slave woman under a free man, and a free woman under a slave.” [Narrated by Ibn Majah and others] This was stated in Umdat al-Ri‘ayah. In al-Tafsir al-Ahmadiyya: If both are eligible to testify and the woman demands it, the man must perform mutual cursing. If he refuses, he is imprisoned until he performs it or retracts his claim, in which case he receives the punishment for false accusation. If he chooses to perform mutual cursing, he says four times: “By Allah, I am among the truthful in what I accused her of regarding adultery,” and the fifth time: “The curse of Allah be upon me if I am among the liars.” This is the man’s mutual cursing, which lifts the punishment for false accusation. After his mutual cursing, the woman must perform mutual cursing. If she refuses, she is imprisoned until she performs it or confirms her husband’s claim, in which case she receives the punishment for adultery. According to al-Shafi‘i, she receives the punishment for adultery by merely refusing mutual cursing. If she chooses to perform mutual cursing, she says four times: “By Allah, he is among the liars in what he accused me of regarding adultery,” and the fifth time: “The wrath of Allah be upon me if he is among the truthful.” This is the woman’s mutual cursing, which lifts the punishment for adultery. This is the meaning of the verse: “And it averts the punishment from her” [Qur’an 24:8]. At this point, both are equal in having the punishments lifted. In al-Bada’i‘: Scholars differed on the ruling of mutual cursing. Our three companions said it necessitates separation as long as they remain in the state of mutual cursing, but the separation does not occur by mutual cursing itself without the judge’s ruling, so the husband can still divorce, make zihar, or swear an oath of abstinence, and inheritance remains between them before separation. Zufar and al-Shafi‘i said it causes separation by mutual cursing itself, except that according to Zufar, separation does not occur unless both perform mutual cursing, while al-Shafi‘i said separation occurs by the husband’s mutual cursing before the wife’s. Al-Shafi‘i’s view is that separation pertains to the husband, as he is the cause of separation, so it does not depend on the wife’s action, like divorce. Zufar cited the narration from the Messenger of Allah (ﷺ): “The two who perform mutual cursing shall never reunite,” and their remaining married entails their reunion, which contradicts the text. The response is that it refers to after the judge’s separation, supported by what is in Abu Dawud’s Sunan: “The precedent for those who perform mutual cursing is that they are separated and never reunite.” The evidence that separation does not occur by mutual cursing itself is in Sahih al-Bukhari and elsewhere: After Uwaimir al-Ajlani performed mutual cursing, he said: “O Messenger of Allah, I have lied about her if I keep her,” and divorced her thrice. If separation had occurred by mutual cursing, the Messenger of Allah (ﷺ) would have objected to his pronouncing divorces, saying: “She is not your wife for you to divorce her.” His silence indicates she was still eligible for divorce, and separation had not yet occurred. In al-Inayah: If it is said that he objected by saying: “Go, you have no claim over her,” it is responded that this refers to his request to reclaim the dowry, as it is narrated that he said: “If you were truthful, it is for her for what you made lawful of her private parts, and if you lied, you have no claim over her.” In al-Bahr al-Ra’iq: As for al-Bayhaqi’s statement in al-Ma‘rifah that Uwaimir divorced her thrice, unaware that mutual cursing was separation, so it was like stipulating compensation in a loan, which is binding whether stipulated or not, unlike zihar, the response is that the inference is based on the lack of objection to him, not merely his action, as is clear. We also have the narration from Nafi‘ from Ibn Umar (may Allah be pleased with them): A man performed mutual cursing with his wife during the Prophet’s time (ﷺ) and disowned her child. The Prophet (ﷺ) separated them and attributed the child to the woman. From Ibn Abbas (may Allah be pleased with them): When the Prophet (ﷺ) performed mutual cursing between Asim ibn Adi and his wife, he separated them. It is narrated that the Messenger of Allah (ﷺ) performed mutual cursing between al-Ajlani and his wife, and when they finished, he separated them. These hadiths indicate that separation does not occur by the husband’s or wife’s mutual cursing, as if it had, the Prophet’s (ﷺ) separation after mutual cursing would not have been necessary. In al-Bada’i‘: Scholars also differed on it. Abu Hanifah and Muhammad said the separation in mutual cursing is by one irrevocable divorce, dissolving the marriage bond and establishing the prohibition of reunion and remarriage as long as they remain in the state of mutual cursing. If the husband retracts and is punished for false accusation, or the wife retracts by confirming him, marriage between them becomes permissible, and they can reunite. Abu Yusuf, Zufar, and al-Hasan ibn Ziyad said it is a separation without divorce, causing a permanent prohibition, like that of fosterage or affinity. They cited the Prophet’s (ﷺ) saying: “The two who perform mutual cursing shall never reunite,” which is explicit in this matter. For Abu Hanifah and Muhammad, it is narrated that when the Messenger of Allah (ﷺ) performed mutual cursing between Uwaimir al-Ajlani and his wife, Uwaimir said: “I have lied about her, O Messenger of Allah, if I keep her, she is divorced thrice.” In some narrations: “I have lied about her if I do not separate from her, she is divorced thrice.” Thus, the husband’s divorce after mutual cursing became the precedent for those who perform mutual cursing, as Uwaimir divorced his wife thrice after mutual cursing before the Messenger of Allah (ﷺ), who enforced it. Every person who performs mutual cursing must divorce, and if he refuses, the judge acts in his place to effect separation, making it a divorce, as in the case of impotence. The cause of this separation is the husband’s accusation, as it necessitates mutual cursing, which necessitates separation, which causes the dissolution. Thus, the separation, through these intermediaries, is attributed to the prior accusation. Every separation caused by the husband or his action is a divorce, as in the case of impotence, mutual agreement, or swearing abstinence, which is the view of the predecessors like Ibrahim, al-Hasan, Sa‘id ibn Jubayr, Qatadah, and others. The hadith cannot be taken literally, as we mentioned, because the literal meaning of “mutual cursers” is those engaged in the act. After completing mutual cursing, they are no longer mutual cursers literally. The intended meaning refers to the ruling, which is that the ruling of mutual cursing remains upon them. If the husband retracts and is punished for false accusation, the ruling of mutual cursing is nullified, so they are neither mutual cursers literally nor in ruling, making their reunion permissible. Thus, it is said in al-Hidayah: “They shall not reunite as long as they are mutual cursers.”

(3) His statement: “He divorced her thrice,” etc. Therefore, it is said in al-Bada’i‘ and al-Bahr al-Ra’iq: Every person who performs mutual cursing must divorce, and if he refuses, the judge acts in his place to effect separation, making it a divorce, as in the case of impotence.

(4) His statement: “Were it not for what has been decreed in the Book of Allah,” etc. Meaning, were it not for the Qur’an’s ruling against imposing punishment or reprimand on those who perform mutual cursing, I would have dealt with her. They said: The hadith indicates that the judge does not consider assumptions, signs, or indications but rules based on the apparent requirements of evidence and proofs. It is understood from their words that resemblance and physiognomy are not evidence but mere assumptions and indications, so no ruling is based on them, as is our view. This was stated in al-Luma‘at.

(5) His statement: “The testimony of one of them,” etc. Al-Shafi‘i said mutual cursing is an oath, while Abu Hanifah and his companions said it is testimony. They cited the verse: “The testimony of one of them shall be four testimonies by Allah” [Qur’an 24:6] and the Prophet’s (ﷺ) saying in this hadith: “Hilal came and testified, then she stood and testified.” [Narrated by Nayl al-Awtar, summarized]

(6) His statement: “You have no claim to it,” etc. Know that the dowry is obligated by the contract, either by specification if present, or by the legal ruling, such as the obligation of a comparable dowry if unspecified. The dowry is confirmed by one of three things: consummation, valid seclusion, or the death of either spouse. Consummation confirms the exchange, making the dowry definitive. Seclusion is legally equivalent to consummation, as it typically leads to it. Death ends the marriage, and a thing is confirmed and solidified upon its end. This is stated in al-Hidayah and al-Binayah. This clarifies that the dowry is not obligated by intercourse or death but by the contract itself, and it is confirmed by what was mentioned. In al-Bada’i‘: Once the dowry is confirmed by what was mentioned, it does not lapse thereafter, even if the separation is due to her, as the exchange, once confirmed, does not allow for lapse except by release. Thus, it is clear that the dowry does not lapse due to the wife’s disobedience, though her maintenance does. What is in some fatwas about the dowry lapsing due to disobedience is not relied upon. This was stated in Umdat al-Ri‘ayah.

اور ابوداود کی ایک اور روایت میں اس طرح ہے کہ اس عورت کو ویسے شکل وصورت کا پچھے ہوا جس کی خبر رسول اللہ صلی اللہ علیہ وسلم نے دی تھی پچھربی کریم صلی اللہ علیہ وسلم نے ارشاد فرمایا کہ اگر کتاب اللہ کا حکم پہلے نزایہوتا تو میرا اوراس کا عجب معاملہ ہوتا (یعنی اگرقرآن

مجید میں لعان کا حکم نہ آپہوتا تو میں اس عورت کو سنگسار کرادیتا)-

ف(1): بدلع اور بحر راق میں کہا ہے کر لعان کرنے والے مرد پروا جب ہے کروہ عورت

کوطلاق دیدے اوراگرم رد طلاق دینےستے رکجاےتو قاضی تقریق کرادے گااوری تقریق

طلاق ہوجائے گی

ف(2): اس حدیث ثریف ستھابت ہوتاہے کر لعان کے بعد حقامتنہیں ہوگیاوریکہا کم کو تیافاورگمان

پر عمل نہیں کرنے چاہئے بلکہ دلیل اورگوانی سے جوابات ثابت ہوونی حکم دینے چاہئےاورحدیث سے یہی معلوم ہوا کرتیافر

جحت شرعیہ نہیں ہےاور قیافر کے سبب سے کسی پرحکم نہیں واقع ہوتااور قاضی کو چاہئے کہ ظاہر پر حکم کرے اگرچقریاس

کے خلاف موجود ہو-12 (لمعا ت )-

And in another narration from Abu Dawud, it is stated that the woman appeared in the same form as the Prophet ﷺ had described. The Noble Prophet ﷺ said, 'If the command of Allah's Book had come earlier, my situation with her would have been strange (meaning, if the command of li'an had not been revealed in the Quran, I would have stoned her).' In Badl al-'I' and Bahr al-Ra'iq, it is mentioned that when a man who has performed li'an with a woman is required to divorce her, and if he refuses to give the divorce, the judge will enforce the divorce, and this enforced divorce will take effect. This hadith establishes that after li'an, there is no right of return, and one should not act on suspicion or mere opinion; rather, judgments should be based on clear evidence from reason and testimony. From this hadith, it is understood that there is no legal basis for suspicion, and no ruling can be made based on mere suspicion. The judge should rule based on what is apparent, even if it contradicts analogy.

_اورابوداو دے نہسل بن سعد رضی اللہ عنہ ستراویت کی ہے وہ فراماتے ہیں کہ

دولعان کرنےوالوں کو میں نے رسول اللہ صلی اللہ علیہ وسلم کے زمانے میں دیکھاہے جب کہ میری

عمر 15 پندرہ برس کی تھی جب ان دونوں نے لعان کیا تورسول اللہ صلی اللہ علیہ وسلم نے ان میں

تقریق کروادی-

It is narrated by 'Abd Allah ibn Salama (RA) that he said:

I have seen those who engaged in li'an during the time of the Messenger of Allah ﷺ when I was fifteen years old, when the two of them performed li'an, and the Messenger of Allah ﷺ separated them.

امر رضی اللہ عنہ جوان تین صحابی میں سے ایک ہیں جن کی توبۃ اللہ تعالیٰ نے قبول فرمائی تھی وہ اپنی

زمین سے واپس ہوئے تو اپنی بیوی کے پاس ایک شخص کو پآیااور(زن کرتے ہوئے) اپنی

آنکھوں سے دیکھااوراپنے کانوں سے سناسکے باوجود اس شخص کوبراجعلا پچھان کہاپیہالتک

کرصحح ہوگی تورسول اللہ صلی اللہ علیہ وسلم کی خدمت میں سوریےسوریے حاضر ہوئےاورعرض

کیا یارسول اللہ میرات میں اپنی بیوی کے پاس آپتو ایک شخص کواسکے پاس پآیااور(دونوں

کوزنا کرتے ہوئے) اپنی آنکھوں سے دیکھااوراپنے کانوں سے سناحضور نبی کریم صلی اللہ علیہ

سلم کواسواقعتہ برطی ناگواری ہوتیاورآپ پر(نزول وی کے وقت جوبلو جہہوتاتھا) وہ

کیفیت طاری بهوئی اور بآیت نازل ہوئی : " وَاَللَّذِینَ يَرْمُونَ اَزْواَجُهُمْ " سے " وَاَنَّ اللّٰہَ تَوَابٌ حَلِیْمٌ "، تک پھر رسول اللّٰہ صلی اللّٰہ علیہ وسلم کے اوپر تو آپ نے فرمایا کہ بلا ل تم کومبارک ہوکہ اللّٰہ تعالیٰ نے تمہاری (مشکل) حل فرمادی اور تمہارے لیے راستہ بمоварکردیا (پس کر) حضرت بلا ل نے فرمایا میں اللّٰہ تعالیٰ سے ایسی امید لگا کے رکھتا پھر رسول اللّٰہ صلی اللّٰہ علیہ وسلم نے فرمایا سعورت کوبلا لا وہ آگیا تو رسول اللّٰہ صلی اللّٰہ علیہ وآلہ وسلم نے نازل شدہ (لعان کی) آیتیں ان دونوں پرتلاوت فرمائی پھران دونوں کوشش کی اور ان دونوں کو آگاہ کیا کہ آخرت کاعذاب دنیا کے عذاب سے زیادہ سخت ہے۔ (پس کر) حضرت بلا ل نے عرض کیا : خدا کی قسم ! میں نے اس کے بارے میں چھ ہی کہاہے۔ اس عورت نے جواب دیا انہوں نے ججوٹ کہاہے۔ پھر رسول اللّٰہ صلی اللّٰہ علیہ وآلہ وسلم نے ارشاد فرمایا کہ ان دونوں کے درمیان لعان کراوتوحضرت بلا ل سے کہاگیا کہ تم گواؤں دو تو انہوں نے اللّٰہ کی قسم کہا کر چار مرتبہ گوائی دی کروہ سے پہلی جب پانچویں گوائی کاموقع آیا تو (حضرت بلا ل سے کہاگیا ) اے بلا ل اللّٰہ ستذر! کیونکہ دنیا کی سزا آخرت کے عذاب سے زیادہ سخت ہےاوریہ (پانچویں گوائی ) ایسی فصل کہ نہ جوتم پراس کے عذاب کو اجب کردوئے گی۔ تو انہوں نے کہا قسم اللّٰہ تعالیٰ اس (پانچویں گوائی پر ) مجھے عذاب نہیں دیا گے جس طرح مجھے اس پر کوئے نہیں گلوائے۔ پھر پانچویں مرتبہ گوائی دی کر ان پر اللّٰہ کی لعنت ہو اگر وہ ججوٹولی ہیں ہوئی! پھراس عورت سے کہاگیا تم گوائی دو تو اس نے اللّٰہ کی قسم کہا کر چار مرتبہ گوائی دی کروہ لیجنی بلا ل بن امیہ ججوٹ لی پہلی جب پانچویں گوائی دینے کا موقع آیا تو اس سے کہاگیا تو اللّٰہ ستذر! کیونکہ دنیا کاعذاب آخرت کے عذاب کے مقابلے میں آسان ہےاورپیشکہ پانچویں گوائی تجہ پرعذاب کو اجب کردوئے گا تو وہ تحوزی ہی دبر کیلیے

توقف کی (اورترودمیںپڑگئی) پھرکہفتسم بخدا میں اپنیقوم کرسواںمیںکرولگی - اورپاچویں مرتبہ گوائے دے دی کر اس پر اللہ کا غضب ہو اگر وہ یعنی بلا ل بن امیہ پے ہیں تواس کے بعد رسول اللہ صلی اللہ علیہ وآلہ وسلم نے ان دونوں میں تقسیم کرادی -

It is narrated by Ibn 'Abbas (RA) that he said:

Bilal (RA) was one of the three Companions whose repentance Allah, the Exalted, accepted. When he returned from his land, he found a man with his wife, and he saw with his own eyes and heard with his own ears. Despite this, he recognized the man and said, 'I will go to the Messenger of Allah ﷺ and confess.' So, he went to the presence of the Messenger of Allah ﷺ and said, 'O Messenger of Allah, I found a man with my wife, and I saw with my own eyes and heard with my own ears.' The situation was distressing for the Messenger of Allah ﷺ, and the state that used to come upon him during revelation came upon him, and the verse was revealed: 'And those who accuse their wives [of adultery]...' up to '...and Allah is ever Accepting of repentance and Forbearing.' Then the Messenger of Allah ﷺ said, 'May you be blessed, for Allah has resolved your matter and shown you the way.' Bilal said, 'I hoped for this from Allah, the Exalted.' Then the Messenger of Allah ﷺ said, 'Bring Bilal,' and when he came, the Messenger of Allah ﷺ recited to both of them the verses that were revealed regarding li'an (mutual cursing). Then they both performed the ritual, and they were informed that the punishment of the Hereafter is more severe than the punishment of this world. Bilal said, 'By Allah, I have only said six things about her.' The woman replied, 'He has told the truth.' Then the Messenger of Allah ﷺ instructed them to perform the li'an ritual. He said to Bilal, 'Swear four times by Allah that he is telling the truth.' Bilal did so. When it came time for the fifth oath, he was told, 'O Bilal, seek refuge in Allah, for the punishment of this world is less severe than the punishment of the Hereafter, and this fifth oath will bring a curse upon you if you are lying.' Bilal said, 'By Allah, I will not be cursed as I am not lying, nor will I be punished as I have not committed the act.' Then he swore the fifth time, invoking Allah's curse upon himself if he was lying. Then the woman was told to swear, and she swore four times by Allah that Bilal was lying. When it came time for the fifth oath, she was told, 'Seek refuge in Allah, for the punishment of this world is easier compared to the punishment of the Hereafter, and this fifth oath will bring a curse upon you if you are lying.' She hesitated and then said, 'By Allah, I will lie with the men of my people' and swore the fifth time, invoking Allah's wrath upon herself if she was lying about Bilal. After that, the Messenger of Allah ﷺ separated them.

حضرت رسول اللہ صلی اللہ علیہ وآلہ وسلم نے دولعان کرنے والون کولعان کرنے کا حکم دیا تو ایک شخص کو حکم دیا کر وہ اپنا باتھا س شخص کے منہ پر گھو دے جبکہ وہ پا چویں مرتبہ گوائے دے ر باہو (تا کر وہ اچھی طرح غفور کرے ) کیونکہ پیر (پا چویں گوائے اللہ تعالیٰ کے عذاب کے لے ) فیصلہ کن ہے -

It is narrated from the Messenger of Allah ﷺ

that he ordered the cursing of those who curse. He commanded a person to spit in the mouth of another while the latter was reciting the fifth verse of repentance (so that he may properly seek forgiveness), because the fifth (recitation of the verse) is decisive (in seeking Allah's forgiveness from His punishment).

عضر کیا کر یارسول اللہ صلی اللہ علیہ وآلہ وسلم (میں نے مہر میں مال دیا ہے اب) میرا مال (مجمل جانا چاہیے ) تو آپ نے ارشاد فرما یا کر تھے وہ مال واپس نہیں لے گا اگر تو نے چو کہا بے تو تو نے اس کی شرمنگاہ کو اپنے لیے جانے زکر لیا تو اوراگر تو نے اس پر جھوٹ کہا تو (تجحو لی تہمت لگا کر مال لینا ) برآہے اور بہت برآہے -

وہ چار عورتیں جولعان سے مستثنیٰ ہیں

O Messenger of Allah ﷺ, what should I do? (I have given money as a gift, now) should my money (be returned)? So, you advised or said that he will not take back the money if you have said so. But if you have taken advantage of his embarrassment by keeping the money, then it is wrong. And if you have lied about it, then (taking the money would be) even more wrong. - Those four women are exempt from slander.

عمرو بن شعیب رضی اللہ عنہ اپنے والد کے واسطے اپنے دادا سے روایت کرتے ہیں کہ حضرت بنی کریم صلی اللہ علیہ وآلہ وسلم نے ارشاد فرما یا کر چار تسم کی عورتوں میں لعان نہیں (1) وہ عیسا ئی عورت جومسلمان کے نکاح میں ہو (2) یہودی جومسلمان کے نکاح میں ہو (3) ایسی آزاد عورت جو غلام کے نکاح میں ہو (4) وہ باندی جو آزاد مردوں کے نکاح میں ہو اس کی روایت ابن ماجہ نے کی ہے -

اِنسان کی غیرت اللہاوراس کے رسول کے احکام کے تائے بھونی چاہے

Amr ibn Shu‘ayb narrated from his father, from his grandfather (may Allah be pleased with him): The Prophet (ﷺ) said: “Four women have no mutual cursing with them: a Christian woman under a Muslim, a Jewish woman under a Muslim, a free woman under a slave, and a slave woman under a free man.” [Narrated by Ibn Majah]

مُعیز بن شعبہ رضی اللہ عنہ سے روایت ہے وہ فرما تے ہیں کہ سعد بن عبادہ رضی اللہ عنہ نے کہا کہ اگر میں کسی (اچھی) مردو کو اپنی بیوی کے ساتھ (زن کرتے ہوئے) دیکھوں تو میں اسکو ضرور تلوار سے قتل کر دوں گا۔ پیغمبر رسول اللہ صلی اللہ علیہ وآلہ وسلم کو پہوچی تو آپ نے (صحابت) فرما کیا تم سعد کی کمال غیرت سے تجب کرتے ہو؟ خدا کی قسم میں ان سے زیادہ غیرت کرتے والا ہول اور اللہ تعالیٰ مجھے زیادہ غیرت کرنے والے پیاورا سی غیرت کی وجہ سے اللہ تعالیٰ نے تمام ظاہراور باطن پے حیاتیول کی (باتوناور کامون) کو حرام کیا ہے اور اللہ تعالیٰ کو (بندرول کی) عذرخواہی بے حد پسند ہے اورا سی مجہے اللہ تعالیٰ نے (براتیول سے) ظرانے والے اور (نکے کاموں پر) خوشخبری سنانے والوں کو (جیسے انبیاء کرام کو) بھیجا (تاکہ اللہ تعالیٰ کی مجحت پوری ہو) اور اللہ تعالیٰ کو اپنی تعریف بھی پسند ہے اس لیے اللہ تعالیٰ نے (اپنی تعریف کرنے والوں کو) جنت دینے کا وعدہ کیا ہے۔ (اس کی روایت بخاری اور مسلم نے متفق طور پر کی ہے)۔ جوش اور جذبہ میں احکام شریعت کے خلاف نہ کرے

Al-Mughirah (may Allah be pleased with him) narrated that Sa‘d ibn Ubadah said: “If I found a man with my wife, I would strike him with the sword, not with its flat side.” This reached the Messenger of Allah (ﷺ), and he said: “Are you amazed at Sa‘d’s zeal? By Allah, I am more zealous than him, and Allah is more zealous than me. Because of Allah’s zeal, He has forbidden immoralities, both open and hidden. No one loves excuses more than Allah, and for that, He sent messengers bearing good news and warnings. No one loves praise more than Allah, and for that, Allah promised Paradise.” [Narrated by Bukhari and Muslim]

(1) His statement: “If I found a man,” etc. Allamah al-Ayni said in Umdat al-Qari: It is understood from Sa‘d ibn Ubadah’s words (may Allah be pleased with him) that if this happened to him, he would kill the man. For this reason, when it reached the Prophet (ﷺ), he did not prohibit him from it. Al-Dawudi said: His statement: “Are you amazed at Sa‘d’s zeal?” indicates that he praised and permitted it for him in his relationship with Allah. Zeal is among the most praiseworthy qualities, and one who lacks it is not of commendable character. Our companions elaborated on this, saying: If a man finds someone with his wife or slave girl intending to overpower and commit adultery with her, he may kill him. If he sees him with his wife or a close relative who consents to it, he kills both the man and the woman. Some prohibited this outright. There is disagreement on the ruling. The majority said he is subject to retaliation. Ahmad and Ishaq said: If he provides evidence that he found him with his wife, his blood is spared. Al-Shafi‘i said: It is permissible for him in his relationship with Allah to kill the man if he is married and knows he committed an act requiring purification, but retaliation is not lifted in the apparent ruling. Al-Muhallab said: The hadith indicates that retaliation is obligatory for one who kills a man he found with his wife, as Allah, though more zealous than His servants, required witnesses for punishments. No one may transgress Allah’s limits, and no blood is spared by mere claim. In summary, according to Badr al-Majhud: One who kills a man he found committing adultery with his wife, the majority say he is subject to retaliation unless he provides evidence or the heirs of the killed confess. In his relationship with Allah, if he is truthful, he faces no consequence.

ابوہریرہ رضی اللہ عنہ سے روایت ہے کہ وہ فرما تے ہیں کہ سعد بن عبادہ رضی اللہ عنہ نے فرما کہ اگر میں اپنی بیوی کے ساتھ کسی آدمی کو (زن کرتے ہوئے) پاؤں تو (کیا) میں اس کو پونی (بغیر قتل کے) چھوڑ دوں گا یہاں تک کہ چار گواہ لاوں؟ (پیس کر) رسول اللہ صلی اللہ علیہ وآلہ وسلم نے فرما کیا بل (تم کو چار گواہ لا نے پریس گے) تو انہوں نے کہا ایا نہیں ہوسکتا (اس لیے میری طبيعت کے لحاظ تے عمل نا قابل برداشت ہے) اس ذات کی قسم مجس نے آپ کو سیاہی بنا کر بھیجا ہے میں اس پر (گواہ لا نے سے) پہلے ہی تلوار سے اس کو قتل کی

گردول گا_ رسول اللہ صلی اللہ علیہ وآلہ وسلم نے (حاضرین سے) فرمایا: سنو! تمہارا سردار کیا کہے رباہے یقیناً وہ غیرت مندہے اور میں اس سے بڑھکر غیرت مندہوں اوراللہ تعالیٰ مجھے زیادہ غیرت مندہیں - اس کی روایت مسلم نے کی ہے۔ ف (1): واضح ہو کر اس حدیث ثریف میں حضرت سعد کا یہنا کہ میں زانی کو قتل کردون گا رسول اللہ صلی اللہ علیہ وآلہ وسلم کی خلافت نہی بلکہ ان کا یقول ان کی طبعی غیرت کی وجہ سے یہاں پچار رسول اللہ صلی اللہ علیہ وآلہ وسلم نے ان کے اس جذبے غیرت کو پسند کیا فرما یاور نہ رسول اللہ صلی اللہ علیہ وآلہ وسلم کی خلافت تو کفر ہے - (لمعات) ف (2): اس حدیث ثریف سے یہی معلوم ہوتا ہے کہ بدکاری کے وقت قتل کرنے سے عند اللہ کتنا نہیں لیکن اگر گواہ نہ ہون گے تو حاکم قصاص لے گا ایہ موقع میں بہتر توپیہ کر آئی صبر و حل سے کام لے، یا تو گواہ فراہم کر یا پچار لعان کر لے یاطلاق دے دے جسیا کر او پر کی حد یثون میں حضرت بلا ل بن امیا ور عویمر جبالی نے صبر و حل سے کام لے کر احاکم شریعت کے مطابق لعان کیا - 12 مسلمانوں کی غیرت حرام کام سے پچانے

Abu Hurairah (may Allah be pleased with him) narrated that Sa‘d ibn Ubadah said: “If I found a man with my wife, I would not touch him until I brought four witnesses.” The Messenger of Allah (ﷺ) said: “Yes.” He said: “No, by the One who sent you with the truth, I would hasten to him with the sword before that.” The Messenger of Allah (ﷺ) said: “Listen to what your leader says. He is zealous, and I am more zealous than him, and Allah is more zealous than me.” [Narrated by Muslim]

ابوہریرہ رضی اللہ عنہ سے روایت سے وہ فرماتے ہیں کہ رسول اللہ صلی اللہ علیہ وآلہ وسلم نے ارشاد فرما یہ کہ اللہ تعالیٰ غیرت مندہیں اور مسلمان بھی غیرت مندہے اوراللہ تعالیٰ کی غیرت پیہ کر مسلمان اس کام کون کرے جس کو اللہ تعالیٰ نے حرام کیا ہے - (اس کی روایت بخاری اور مسلم نے متفق طور پر کی ہے - ) پسند کیہا اور نا پسند کیہا غیرت اور فخر کا بیان

Abu Hurairah (may Allah be pleased with him) narrated that the Messenger of Allah (ﷺ) said: “Allah is zealous, and the believer is zealous. Allah’s zeal is that a believer commits what Allah has forbidden.” [Narrated by Bukhari and Muslim]

جابر بن عتقی رضی اللہ عنہ سے روایت سے کہ حضور نبی کریم صلی اللہ علیہ وآلہ وسلم نے ارشاد فرما یا کہ غیرت کی ایک وشتم وہے جس کو اللہ تعالیٰ پسند فرماتے ہیں اور دوسری وشتم وہے جس کو اللہ تعالیٰ پسند نہیں فرماتے - غیرت کی وہتم جس کو اللہ تعالیٰ پسند فرماتے ہیں وہ غیرت سے

جوشک اور شرب کی جگہ ہو (جسے پیوی یا بندی بناو سنگار کر کے اجنبی مردوں کے پاس جائے) اور وہ غیرت جو اللہ تعالیٰ کوناپسند ہے وہ غیرت ہے جو شک اور شرب کی جگہ نہ ہو (یعنی پیوی پر بلا وجہ بدگمان ہوااوروسوسہ میں بھٹلا ہو) اور (اس طرح) تکبر کی ایک قسم وہ ہے جس کو اللہ تعالیٰ پسند فرماتے اور دوسری قسم وہ ہے جس کو اللہ تعالیٰ پسند فرماتے نہیں۔ وہ تکبر جس کو اللہ تعالیٰ پسند فرماتے نہیں آدمی کا فخر کرنا ہے جہاد کے وقت (یعنی جہاد کے وقت دلیری کے ساتھ اپنی شجاعت بیان کرتے ہوئے کفار کی حقارت بیان کرتے ہوئے لڑے) اور (اس طرح) نیرات کے وقت محجمی فخر کرے (یعنی علاؤ نی خوشدلی کے ساتھ نیرات کیا کرے تاکہ دوسروں کو محجمی نزغیب ہو) اور وہ تکبر جو اللہ تعالیٰ کوناپسند ہے وہ تکبر ہے جو نسب پر کیا جاتے۔

Jabir ibn Atik (may Allah be pleased with him) narrated that the Prophet (ﷺ) said: “There is zeal that Allah loves and zeal that Allah hates. The zeal Allah loves is zeal in the face of suspicion, and the zeal Allah hates is zeal without suspicion. There is pride that Allah hates and pride that Allah loves. The pride Allah loves is a man’s pride in himself during battle and during charity, and the pride Allah hates is pride in boasting.” In another narration: “in oppression.” [Narrated by Ahmad, Abu Dawud, and al-Nasa’i]

اور ایک روایت میں یول ہے کہ (اللہ تعالیٰ کو) ظلم اور حسد پر (فخر کرنے پسند نہیں) (اس کی روايت امام احمد، ابوودا و داود نسائی نے کی ہے۔)

حضرت عائشہ کی غیرت کا ایک واقعہ

Jabir ibn Atik (may Allah be pleased with him) narrated that the Prophet (ﷺ) said: “There is zeal that Allah loves and zeal that Allah hates. The zeal Allah loves is zeal in the face of suspicion, and the zeal Allah hates is zeal without suspicion. There is pride that Allah hates and pride that Allah loves. The pride Allah loves is a man’s pride in himself during battle and during charity, and the pride Allah hates is pride in boasting.” In another narration: “in oppression.” [Narrated by Ahmad, Abu Dawud, and al-Nasa’i]

ام المؤمنین لیلی عائشہ رضی اللہ عنہا سے روایت ہے (فرماتی ہیں) کہ رسول اللہ صلی اللہ علیہ وآلہ وسلم (جبران کی باری کاون تھا) آپ کے پاس سے رات میں اٹھ کر باہر تشریف لے گئے۔ اس پر مجھے بری غیرت آئی (اس شب سے کہیں آپ دوسری پیوی کے پاس تشریف لے گئے ہوں، یہو زیادہ بے عد) آپ واپس تشریف لا لے اور مجھے دیکھا کہ میں بے حیا کی حالت میں پڑی ہوئی ہوں (پردہ پکڑ کر) آپ نے فرمایا: عائشہ! کیا بت ہے (بے حیا کیوں ہو؟) کیا تمہیں غیرت آئی۔ میں نے عرض کیا (بے حیا) مجھے عورت پر (جس کا تعلق آپ سے ہوا اور جبڑہ آپ حاملہ جمال و کمال ہیں) غیرت آپ پر جسے پر کیون نہیں آئی گی (پیس کر) رسول اللہ صلی اللہ علیہ وآلہ وسلم نے فرمایا تمہارا شیطان تمہارے پاس آگیا تھا (اور اس نے تم

کو وسوسہ میں والدیا) ام المومنین ﷺ عرض کیا یارسول اللہ صلی اللہ علیہ وآلہ وسلم کیا میرے ساتھ

شیطان ہے؟ آپ نے فرمایا بلال! پھر میں نے عرض کیا یارسول اللہ صلی اللہ علیہ وآلہ وسلم کیا آپ

کے ساتھ بھی (شیطان) ہے (جبکہ آپ سلطان الا صفیاء ﷺ) آپ نے فرمایا: بلال! لیکن اللہ تعالیٰ

نے میری اس پردہ فرمائی ہے اور میں (اس کے وسوستے) محفوظ رہتا ہوں (اس کی روایت مسلم

نے لکی ہے)-

لعلان کے بعد باب پر کے انکار پر لڑ کے کانسب مال سے کرو یا جاتے گا

Aishah (may Allah be pleased with her) narrated: The Messenger of Allah (ﷺ) left her at night. She said: I felt zealous about him. He came and saw what I was doing and said: “What is wrong with you, O Aishah, are you zealous?” I said: “Why wouldn’t someone like me be zealous over someone like you?” The Messenger of Allah (ﷺ) said: “Your devil has come to you.” She said: “O Messenger of Allah, is there a devil with me?” He said: “Yes.” She said: “And with you, O Messenger of Allah?” He said: “Yes, but Allah has helped me against him until he submitted.” [Narrated by Muslim]

پیٹا ہوئے) سے انکار کر دیا پھر آپ نے ان دونوں میں تفرق کروا دی اور لڑ کے کانسب عورت

سے متعلق کر دیا-

Ibn Umar (may Allah be pleased with them) narrated that the Prophet (ﷺ) performed mutual cursing between a man and his wife, and he disowned her child. He separated them and attributed the child to the woman. [Narrated by Bukhari and Muslim]

In their hadith: The Messenger of Allah (ﷺ) admonished him, reminded him, and informed him that the punishment of this world is easier than the punishment of the Hereafter. Then he called her, admonished her, reminded her, and informed her that the punishment of this world is easier than the punishment of the Hereafter.

(1) His statement: “He disowned her child,” etc. Meaning, if a man accuses his wife by denying the child or by denying the child and accusing her of adultery, the judge separates them, and the child’s lineage is negated and attributed to the mother, provided they mention the accusation in the mutual cursing. This is stated in Sharh al-Wiqayah and al-Tafsir al-Ahmadiyya. In Umdat al-Qari: This hadith encompasses three rulings. First, mutual cursing, with no disagreement, and there is consensus on its validity and legislation. Second, separation, where scholars differed. It was mentioned earlier that according to Malik and al-Shafi‘i, separation occurs by mutual cursing itself, while according to Abu Hanifah, it occurs only by the judge’s ruling, based on the apparent meaning of the mentioned hadith, which is evidence against the opponents. Third, attributing the child to the mother, based on the apparent meaning of the hadith, on which the majority of jurists from the successors and those after them, including the four Imams and their followers, agreed. There is another disagreement from another perspective. Our companions said: If the accusation denies the child at the time of birth or a day or two after, or a similar period during which congratulations and purchasing birth items are customary, it is valid. If he denies it after that, it is not negated. Abu Hanifah did not specify a time for this, though it is narrated that he set seven days. Abu Yusuf, Muhammad, and Qatadah set it at the maximum period of postpartum, which is forty days. Al-Shafi‘i considered immediacy, saying if he denies it immediately, it is negated; otherwise, it is not.

پہلے) مردو نصیحت کی اور اسے (دنیا اور آخرت کا عذاب) یا دولا یا اورات بتایا کہ دنیا

کا عذاب (یعنی تہمت کی سزا 80 کوطے) آخرت کے عذاب سے آسان ہے پھر عورت کو بلا یا اور

اس کو نصیحت فرما لی اور اسے (دنیا اور آخرت کا عذاب) یا دولا یا اورات بتایا کہ دنیا کا عذاب (یعنی

زنا کی سزا سگساری) آخرت کے عذاب سے آسان ہے-

ف: واضح ہو کہ شرح و قیا اور تفسیرات احمدی میں کہا ہے کر لعلان کے موقع پر مردا پی بیوی پر تہمت لگے

ہوئے پھر کے بارے میں اپنا پیشہ ہوئے سے انکار کر دے تو قاضی مرداور عورت میں تفرق کرادے گا اور لڑکے کومال کے حوالے کر دیگا اور اس کا نسب مالے سے ہو جائے گا۔ اس حدیث ثریفے سے یہی ثابت ہوتاہے کہ لعان کے بعد خود نخو دمرداور عورت میں تفرق نہیں ہوگی بلکہ اکم دونوں میں تفرق کرادے گا۔ اب رہامرد کا پچے کے بارے میں انکار کرنا اس وقت قبول ہوگا جبکہ مردو لا دت کے بعد فوراً ایک دن یا دو دن بعد انکار کردے ورنہ اس کا انکار قبول نہ ہوگا۔ البتہ امام ابوحنیفہ رحمۃ اللہ علیہ نے اس کے لیکن وقت کا تعین نہیں فرمایاہے اور آپ سے ایک روایت ہے جس سے کرآپ نے انکار کی مدت ایک بھفتہ مقرر فرمائی ہے اور صحیحین نے انکار کی مدت چا لیس دن مقرر کی

ہے۔ (عمدۃ القاری)12 اولاد کارگ باپ سے مختلف ہونے پر پیوی پرتهمت نہیں لگائی جاسکتی

ابوہریرہ رضی اللہ عنہ سے روایت ہے کہ ایک اعرابی رسول اللہ صلی اللہ علیہ وآلہ وسلم کی خدمت میں حاضر ہوکر عرض کیا کہ میری بیوی نے ایک سیاہ لڑکا جناہے اور میں نے اس (لڑکے) کا انکار کر دیاہے۔ کیونکہ میرا رنگ گوراہے اور وہ لڑکا کالا ہے۔ (پیکر) رسول اللہ صلی اللہ علیہ وآلہ وسلم نے فرمایا کیا تمہیں پاس اونٹ ہیں؟ اس نے جواب دیا بال! (میرے پاس اونٹ ہیں) آپ صلی اللہ علیہ وسلم نے اس سے دریافت فرمایا: ان (اونٹول) کا کیارنگ ہے؟ اس نے کہا: سرخ! آپ نے اس سے دریافت فرمایا کیا ان (اونٹول) میں خاکستری (رنگ) کے اونٹ ہیں؟ اس نے جواب دیا (بال!) ان میں خاکستری رنگ کے اونٹ ہیں تو آپ نے اس سے فرمایا تو اب تیرا پیا خیال ہے کہ پیرنگ کہاں سے آیا؟ (یعنی جب سارے اونٹول کے رنگ سرخ ہیں تو ان کی اولاد میں خاکستری رنگ والے کیسے پیدا ہوئے؟) تو اس نے کہا (اس کی نسل میں اور کسی کا کالا رنگ ہوگا) اس رگ نے اسے چھلا یا ہوگا۔ پھر آپ صلی اللہ علیہ وسلم نے فرمایا: یہ حال تیرے اس (بیوی کاہے) ممکن ہے کسی رگ نے (اس رنگ کو) کو چھلا یا ہو اور آپ صلی اللہ علیہ وسلم کو اجازت نہیں دی کہ وہ اپنے یہ کا انکار کرے۔

ف: اس حدیث شریف سے معلوم ہوتا ہے کہ پھر کارگی انقرہ کے اختلاف کی وجہ سے کس شخص کو بیشہ بن کرنا

چاہیے کہ وہ اس کی اولاد نہیں جب تک کہ دلیل قطعی سے اس کا ثبوت نہ ہو مثلًا لیلی لیلی سے صحت، ای نہیں تو یا تو کا صحت

کرنے کے بعد چھماہ سے پہلے پیدا ہوا تو

لڑکا اس کا ہوگا جس کے بستر پروہ پیدا ہوا ہو

Abu Hurairah (may Allah be pleased with him) narrated: A Bedouin came to the Messenger of Allah (ﷺ) and said: “My wife gave birth to a black boy, and I disown him.” He said: “Do you have camels?” He said: “Yes.” He said: “What are their colors?” He said: “Red.” He said: “Is there a gray one among them?” He said: “There are gray ones among them.” He said: “Where do you think that came from?” He said: “O Messenger of Allah, a lineage pulled it.” He said: “Perhaps this is a lineage that pulled it.” He did not permit him to disown him. [Narrated by Bukhari and Muslim]

(1) His statement: “My wife gave birth to a black boy,” etc. This implies an accusation, and scholars differed on its ruling. Some said there is no punishment for implication, only for explicit accusation. This was narrated from Ibn Mas‘ud, al-Qasim ibn Muhammad, al-Sha‘bi, Tawus, Hammad, Ibn al-Musayyib in one narration, al-Hasan al-Basri, and al-Hasan ibn Hayy. This was the view of al-Thawri, Abu Hanifah, and al-Shafi‘i, though they required discipline and deterrence. They cited the hadith of this chapter, and Bukhari’s chapter heading supports this. Others said implication is like explicit accusation, narrated from Umar, Uthman, Urwah, al-Zuhri, and Rabi‘ah. This was the view of Malik and al-Awza‘i. This is stated in Umdat al-Qari. In Rahmat al-Ummah: Implication does not warrant punishment according to Abu Hanifah, even if intended as an accusation. Malik said it warrants punishment absolutely. Al-Shafi‘i said if it is intended and explained as an accusation, it warrants punishment. Ahmad has two narrations, the more apparent being that it warrants punishment absolutely, and the other aligns with al-Shafi‘i’s view. The hadith indicates that denying a child based on mere suspicion or imagination without strong evidence is not permissible. It affirms the use of analogy, consideration, and examples. This was stated in al-Ta‘liq al-Mumajjad. In al-Marqah: The benefit of the hadith is the prohibition of denying a child based on weak indications. There must be clear, evident proof, such as not having had intercourse with her or her giving birth to a child before six months from the start of intercourse. The consideration of color here is to dispel suspicion, as the default is the innocence of Muslims. This differs from the earlier consideration of characteristics in Sharik’s hadith, which was not to dispel suspicion but to highlight that apparent traits are insignificant in the presence of the Qur’an’s text, so how much more so for subtle traces.

بن ابی وقاص نے (اپنی موت کے وقت) اپنے بھائی حضرت سعد بن ابی وقاص کو صیت کی تھی کہ

زمعہ کی باندی کا پیا میرے نطفے سے ہے تم اس کو اپنے قبضے میں لے لینا (اور اس کی تربیت کرنا)

جس سال میں ہوا تو حضرت سعد نے اس لڑکے کو لے لیا اور کہا کہ پیا میرا ہے جیہا ہے۔ لیکن زمعہ کے

بیٹے عبد نے کہا کہ پیا بھائی ہے پیدونول آپس میں لڑتے ہوئے رسول اللہ علیہ و آلہ وسلم

کی خدمت میں حاضر ہوئے حضرت سعد نے کہا یا رسول اللہ علیہ و آلہ وسلم میرے بھائی (عتبہ نے) مجھے اس

لڑکے کے بارے میں وصیت کی تھی پیر کا اس کا ہے اس لیے میں اس کو لے لیا ہے۔ اور عبد بن

زمعہ نے کہا پیا میرا بھائی ہے (اس حیثیت سے کہ وہ) میرے بابپ کی لونڈی کا پیا ہے جواس کے

بستر پر پیدا ہوا ہے۔ (پیس کر) رسول اللہ علیہ و آلہ وسلم نے (عبد بن زمعہ سے) فرمایا پر کا

تم کو لیگا (سنو) اے عبد بن زمعہ! لڑکا بستر والے کا ہے اور زانی کے لے پتر ہے۔ (یعنی لڑکا

اسی کا ہوتا ہے جس کی پیوی یا بندی سے پیدا ہوا اور زانی کو سنگسار کیا جاتے گا) پھر رسول اللہ علیہ و آلہ وسلم نے ام المومنین لیلی سودہ بنت زمعہ سے فرمایا تم اس لڑکے کے پردہ کروا س لیے کہ

آپ نے اس پر کی صورت عتبہ سے ملت جلتی دیکھی تو، اس لڑکے کے نے لیلی سودہ گومرتے دم تک نہیں

ویہا اس کی روایت بخاری اور مسلم نے متفق طور پر کی ہے

ما کا پھی باندی کی اولاد سے انکار کرے تو پھر کا نسب ما کے سے نہوگا

Aishah (may Allah be pleased with her) narrated: Utbah ibn Abi Waqqas entrusted his brother Sa‘d ibn Abi Waqqas, saying: “The son of Zam‘ah’s slave girl is from me, so take him.” In the year of the conquest, Sa‘d took him, saying: “He is my brother’s son.” Abd ibn Zam‘ah said: “He is my brother.” They disputed before the Messenger of Allah (ﷺ). Sa‘d said: “O Messenger of Allah, my brother entrusted me with him.” Abd ibn Zam‘ah said: “He is my brother, the son of my father’s slave girl, born on his bed.” The Messenger of Allah (ﷺ) said: “He is yours, O Abd ibn Zam‘ah. The child belongs to the bed, and for the adulterer is the stone.” Then he said to Sawdah bint Zam‘ah: “Veil yourself from him,” because he saw his resemblance to Utbah. She never saw him until she met Allah. [Narrated by Bukhari and Muslim]

In a narration by al-Tahawi: He said: “Veil yourself from him, for he is not your brother.” Al-Tahawi narrated from Ikrimah: Ibn Abbas would visit his slave girl, and she became pregnant. He said: “He is not from me; I visited her in a way not intending a child.” In another narration by him from Sa‘id ibn al-Musayyib: A slave girl of Zayd ibn Thabit gave birth, and he said: “He is not from me; I withdrew from her.”

(1) His statement: “He is yours, O Abd ibn Zam‘ah. The child belongs to the bed,” etc. Al-Shafi‘i held that if a master has intercourse with his slave girl, every child she bears thereafter is his, whether he claims it or not. He cited this hadith, as the Messenger of Allah (ﷺ) said: “He is yours, O Abd ibn Zam‘ah,” then said: “The child belongs to the bed, and for the adulterer is the stone.” He attributed him to Zam‘ah not because of his son’s claim, as a son’s claim of lineage for another from his father is not accepted, but because his mother was Zam‘ah’s bed through his intercourse with her. A slave girl becomes a bed for her master through his intercourse or his acknowledgment of intercourse, not merely by ownership without intercourse. Abu Hanifah said she does not become a bed through intercourse or acknowledgment of it. If he had intercourse with her or acknowledged it and she bore a child, it is not attributed to him, and it remains a slave, as does its mother. The child is only attributed to him if he acknowledges it. In summary, any child a slave girl bears does not obligate her master unless he acknowledges it. If he dies before acknowledging it, it is not attributed to him and remains for the adulterer. Abu Hanifah’s evidence in the hadith is that the Messenger of Allah (ﷺ) said to Abd ibn Zam‘ah: “He is yours,” and did not say: “He is your brother.” It is possible he meant: “He is yours,” meaning a slave under your ownership, without ruling on his lineage. The evidence is that the Messenger of Allah (ﷺ) ordered Sawdah bint Zam‘ah to veil herself from him. If the Prophet (ﷺ) had made him Zam‘ah’s son, he would not have veiled Zam‘ah’s daughter from him, as he would not order the severance of family ties but their connection, including visits. How could he order her, having made him her brother, to veil from him? This is not permissible for him, as he ordered Aishah to permit her foster uncle to visit her, yet veiled Sawdah from one made her brother and father’s son. In our view, he did not rule on anything except the ownership, attributing him to Abd ibn Zam‘ah and Zam‘ah’s other heirs, excluding Sa‘d. If someone says: What is the meaning of his saying connected to this: “The child belongs to the bed, and for the adulterer is the stone”? It is said: This was instruction to Sa‘d that you claim for your brother, but your brother had no bed. Lineage would be established from him if he had a bed. Since he had no bed, he is an adulterer, and for the adulterer is the stone. If someone says: He ordered her to veil from him because of his resemblance to Utbah, as in Aishah’s hadith, it is said: This is not permissible, as resemblance does not establish lineage, nor does its absence negate lineage. Do you not see the man who said to the Messenger of Allah (ﷺ): “My wife gave birth to a black boy”? The Messenger of Allah (ﷺ) said: “Do you have camels?” He said: “Yes.” He said: “What are their colors?” He mentioned words, saying: “Is there a gray one among them?” He said: “There are gray ones.” He said: “Where do you think that came from?” He said: “A lineage pulled it.” The Messenger of Allah (ﷺ) said: “Perhaps this is a lineage that pulled it.” He did not permit him to deny him due to the lack of resemblance or prevent him from admitting him to his daughters and women, but gave him an example that resemblance does not establish lineage, nor does its absence negate it. Similarly, if Zam‘ah had intercourse with his mother, it would establish his lineage from him, and the lack of resemblance would have no significance, and his lineage from him would be established, entering upon his daughters as his other sons do. This argument is countered by the narration explicitly stating: “He is your brother.” However, it means your brother in faith. It is possible the original hadith was “He is yours,” and the narrator assumed it meant his brother in lineage, interpreting it as such. The narration by Abdullah ibn al-Zubair explicitly states: “He is not your brother.” In Amr ibn Shu‘ayb’s hadith, there are rulings the Messenger of Allah (ﷺ) judged in the early days of Islam and the beginnings of the law, as al-Khattabi said. Thus, it is not used as evidence against requiring acknowledgment for the lineage of a slave girl’s child. The apparent meaning of the hadith mentioned in the text is that the child is attributed to the father after establishing the bed, which is only established after the possibility of intercourse in a valid or invalid marriage. This is the view of the majority. It is narrated from Abu Hanifah that it is established by the contract alone, even if a man from the West marries a woman from the East, neither leaves their place nor has intercourse, and she bears a child after six months or more, it is attributed to him. This is stated in Nayl al-Awtar. The author of al-Tawdih said: According to most scholars, a free woman is not a bed except with the possibility of intercourse, and the child is attributed within a period she could give birth, the minimum being six months. Abu Hanifah diverged, saying if he divorces her immediately after the contract without the possibility of intercourse and she bears a child six months from the contract, it is attributed to him. He also said: What Abu Hanifah held contradicts what Allah has made customary, that a child comes from the man’s and woman’s fluids. Al-Ayni said: Abu Hanifah did not diverge or contradict what Allah has made customary. The author of al-Tawdih and those who followed him did not grasp what Abu Hanifah understood in this issue. He argued for his view with: “The child belongs to the bed,” meaning the owner of the bed, without mentioning the requirement of intercourse. The contract is like intercourse in this regard, unlike a slave girl, who has no bed, so her child’s lineage is only established by her master’s acknowledgment.

اورطحاوی کی ایک روایت میں اس طرح مرودی ہے کہ رسول اللہ صلی اللہ علیہ وآلہ وسلم نے (ام المومنین لیلی سودہ سے) فرمایا تم اس سے پردہ کرواس لئے کہ وہ تمہارا بجا نہیں ہے۔

In a version narrated by Auza'i, it is reported that the Messenger of Allah ﷺ said to Umm al-Mu'minin Layla bint Sada:

Cover yourself from him, for he is not your match.

رضی اللہ عنہما کی ایک باندی سے صحبت کیا کرتے تھے، وہ حاملہ ہوئی تو آپ نے فرمایا کہ سکا حمل مجھ سے نہیں اس لیے کہ میں اس سے اس طرح صحبت کرتا تھا کہ وہ (حاملہ نہ ہو) اور میرا مقصد اس سے اولاد نہونا نہیں ہے۔

They used to have intercourse with a female slave, and when she became pregnant, he said: 'The pregnancy is not from me, because I used to have intercourse with her in such a way that she would not become pregnant, and my intention was not to have offspring from her.'

اورطحاوی کی کی ایک روایت میں سعید بن المسیب رحمۃ اللہ علیہ سے اس طرح مرودی ہے کہ حضرت زید بن ثابت رضی اللہ عنہ کی ایک باندی کو پیہوا تو آپ نے فرمایا میرا پھی نہیں اس لیے کہ میں (صحبت کے وقت) اس سے عزل کیا کرتا تھا۔ اسلام کے بعد جابلیت کی بداعتیوں پر مواخذہ نہیں ہوگا

It is narrated on the authority of Sa'id bin al-Musayyib, may Allah have mercy on him, through a chain of transmission that

when a drink was offered to a slave girl of Zayd bin Thabit (RA), he said: 'I do not drink from it because I used to separate from her during the time of intimacy. There will be no accountability for the pre-Islamic customs after Islam.'

عمرو بن شعیب رضی اللہ عنہ اپنے والد کے واسطے سے اپنے دادا سے روایت کرتے ہیں کہ ان کے دادا نے بیان کیا کہ ایک شخص نے (خدمت اقدس میں) کہرے ہو کر عرض کیا کہ یارسول اللہ فلان شخص میرا بیٹا ہے میں نے زمانہ جابلیت میں اس کی مال کے ساتھ زنا کیا تھا (یعنی کہ) رسول اللہ صلی اللہ علیہ وآلہ وسلم نے فرمایا اسلام میں اس کا نسب کا عوری ثابت نہیں، جابلیت کی با تین ختم ہو گئی اڑکا تو بستر وا لے کا ہے (یعنی اس کا اس کا ہوگا جس کی بیوی یا باندی ہو) اور زانی کے لیے سگساری ہے (یا حروی)۔ (اس کی روایت ابوداود نے کی ہے)۔

باندی زادہ کے دو عموی دارتول توکیا کیاجائے

Amr ibn Shu‘ayb narrated from his father, from his grandfather (may Allah be pleased with him): A man stood and said: “O Messenger of Allah, so-and-so is my son; I committed adultery with his mother in the pre-Islamic era.” The Messenger of Allah (ﷺ) said: “There is no claim in Islam. The affairs of the pre-Islamic era are gone. The child belongs to the bed, and for the adulterer is the stone.” [Narrated by Abu Dawud]

سماک رحمۃ اللہ علیہ بنوخزوم کے ایک مولی (آزادہ کردہ غلام) سے روایت

کرتے ہیں انہوں نے کہا کہ ایک باندی سے دو آدمیوں نے ایک بی طرح میں صحبت کی اوراس

باندی کو مسل ہوگیا اب پہیں معلوم ہوسکا پی نطفہ دونوں میں سے کس کا ہے؟ لڑ کے بارے

میں وہ دونوں جھگڑتے ہوئے حضرت عمر رضی اللہ عنہ کے پاس آئے حضرت عمر نے فرمایا میں نہیں

جانتا کہ اس مسئلے میں کیا فیصلہ دوں؟ تو پیر دونوں حضرت علی رضی اللہ عنہ کی خدمت اقدام میں حاضر

ہوئے تو آپ نے فرمایا وہ (لڑکا) تم دونوں کا ہے وہ تم دونوں کا وارث ہوگا اور تم دونوں (جس)

اس کے وارث ہوئے گے اور تم دونوں کی (واراثت تقسیم ہوئے نے کے بعد) جو پچھے رہ گا وہ مجھی اس

کو مل گا اس کی روایت طحاوی نے کی ہے۔

Sammak narrated from a freed slave of Banu Makhzumah: Two men had intercourse with a slave girl in one period of purity, and she became pregnant. It was not known from which of them the child was. They came to Umar, disputing over the child. Umar said: “I do not know how to judge this.” They went to Ali, who said: “He is shared between you; he inherits from both of you, and you both inherit from him, and he belongs to the one who remains of you.” [Narrated by al-Tahawi]

In a narration by al-Bayhaqi: Two men had intercourse with a slave girl in one month, and she gave birth to a child. They went to Umar, who attributed him to both, so he inherits from them, and they inherit from him. Al-Shawkani said: It is narrated from Imam Yahya that the hadith of physiognomy is abrogated. Al-Tahawi narrated from Urwah ibn al-Zubair that Aishah informed him that marriage in the pre-Islamic era was of four types. One was that men would gather around a woman, and she would not refuse anyone who came to her. These were prostitutes who would place flags at their doors, and anyone who entered would have intercourse with her. If she became pregnant and gave birth, they would gather physiognomists, who would attribute the child to one of them, and he would be called his son, unable to refuse. When Allah sent Muhammad (ﷺ) with the truth, he abolished that form of marriage and its ruling, affirming people in the marriage that does not require physiognomists’ opinions. He made the child belong to the one who claims him, establishing his lineage by that, and abrogated the prior ruling based on physiognomists’ opinions.

(1) His statement: “He is shared between you; he inherits from both of you, and you both inherit from him,” etc. This indicates that the opinion of physiognomists is not used for lineage or otherwise, as held by the Kufans, al-Thawri, Abu Hanifah, and his companions. Al-Shafi‘i and others cited the hadith of al-Mudliji to establish the validity of physiognomy and ruling by their opinions in attributing a child. If it were not so, the Prophet (ﷺ) would have objected to Mujazziz, saying: “How do you know?” His silence and lack of objection indicate that their opinion leads to a truth that warrants ruling. The Hanafis’ evidence against them is that the Prophet’s (ﷺ) pleasure with Mujazziz’s statement in Aishah’s hadith does not indicate what they assumed about the obligation to rule by physiognomists’ opinions. Usamah’s lineage from Zayd (may Allah be pleased with them) was established before that, and the Prophet (ﷺ) did not need anyone’s opinion. Otherwise, Usamah would not have been attributed to Zayd earlier. The Prophet’s (ﷺ) amazement was at Mujazziz’s accuracy, as one is amazed at someone whose assumption correctly identifies the reality, but it does not necessitate ruling by it. The Prophet (ﷺ) did not object because Mujazziz’s statement did not attempt to establish what was not already established. Allah says: “And do not pursue that of which you have no knowledge” [Qur’an 17:36]. This is summarized in Sharh Ma‘ani al-Athar. Al-Qari said: The hadith of al-Mudliji does not establish lineage by physiognomy; it is only for reinforcement and dispelling suspicion, like when a just witness testifies to seeing the crescent moon, and an astrologer agrees. The astrologer’s opinion is not a standalone proof for affirmation or negation but can reinforce a legal proof. Our evidence is the hadith: “The child belongs to the bed.” The inference is that the definite article and the lam of specification indicate exclusivity. Ibn al-Humam said: If a slave girl is shared between two partners and bears a child, and one claims it, his lineage is established from him, whether in sickness or health, and she becomes his umm walad by agreement, without compensating the partner’s share in solvency or insolvency. If both claim it, his lineage is established from both, and she becomes their umm walad, serving each one day. If one dies, she is freed, and the son inherits from both as a full son, and they inherit from him as one father. If one dies, the son’s entire inheritance goes to the surviving one. This is our view, as held by al-Thawri and Ishaq ibn Rahawayh. Al-Shafi‘i held this in his old opinion. Ahmad preferred the hadith of physiognomy, and it is said to be used if physiognomists are absent. Al-Shafi‘i said to refer to the physiognomist’s opinion, and if none is found, the matter is deferred until the child reaches maturity and chooses one. If he does not choose, his lineage remains deferred, not established except from his mother.

اورتہق کی ایک روایت میں اس طرح مروی ہے کہ دو آدمیوں نے ایک

باندی سے ایک بی مہینہ میں صحبت کی اور اس باندی نے اٹکا جناوون نے اپنے مقصد کو حضرت

عمر رضی اللہ عنہ کی خدمت میں پیش کیا تو حضرت عمر نے اس لڑ کے کو دونوں کا وارث بنایا اور (یہی

فیصلہ دیا کہ) وہ دونوں مجھی اس کے وارث ہوئے گے اور قاضی شوکانی نے کہا ہے کہ امام مجہی سے پی

روایت کے قافیہ نسب کے ثبوت والی حدیث منسوخ ہے۔

In one version of the report, it is narrated that two men had intercourse with a slave woman for a month, and when the slave woman presented her case to Umar (RA), Umar made the child the heir of both men, and (ruled that) both men would be the heirs of the child. And Shawkani said that the hadith narrated on the authority of Mujahid, which is based on the evidence of the lineage of the child, is abrogated.

اور امام طحاوی رحمۃ اللہ علیہ نے عروہ بن زبیر رضی اللہ عنہما سے روایت

کی ہے کہ امام المومنین حضرت علی رضی اللہ عنہ نے ان کو بتایا کہ زمانہ جاهلیت میں نکاح

چار طریقے پر کیا جاتا تھا نکاح کی ایک قسم یہوتی تختی کے کی مرد ایک بی عورت کے پاس جاتے

اوراس سے صحبت کرتے) اور جو کسی اسے پاس آئے وہ کسی کو جسی نہیں رکتی اور پی فاحش

عورتیں جو تین اپنے دروازول پر (اپنے خانے کی نشانی کے طور پر) جھندے نصب کرتیں تو ان

کے پاس جو کسی آتا صحبت کرتا جب اس کو حمل ہوتا اور پیڑ پیڑا ہوتا تو قافلہ شناس جمع ہوتے اور

مرد ول میں سے جس کسی سے وہ پیڑ کو منسوب کرتے وہ اس کا باب پکھلا تا اور وہ پیڑ اس کا

پیٹا کہ لاتا اور کوئی اس میں رکاوت نہیں پیدا کر سکتا تھا۔ جب اللہ تعالیٰ نے حضور صلی اللہ

علیہ و آلہ و سلم کو سچا نبی بنائے جسی جس آپ نے اس وقت میں کے نکاح کو باطل قرار دیا جس میں

قافلہ شناس کی ضرورت واقع ہوتی تھی اور لوگوں کو اس نکاح پر قائم فرمادیا جس میں قافلہ شناس

کے قول کی ضرورت نہ ہوا اور کسی کو باب یہ کی طرف منسوب فرمادیا جس کا وہ مدعی ہوا اور اسی

باب یہ کا نسب ثابت ہونے لگا اور آپ نے پیلے حکم کو منسوخ فرمادیا جس میں قافلہ کی بناء

پر (نسب کا) حکم لگا جاتا تھا۔ 12

جان بو جہ کرا پنی نسبت غیر باب یہ کی طرف کرنے کی وعید

Imam Tahawi (may Allah have mercy on him) narrated from Urwah ibn al-Zubayr (RA) that the Commander of the Faithful, Ali (RA), informed him

that in the time of ignorance, marriage was conducted in four ways. One type of marriage was that a man would go to a woman who was not married and engage in intimacy with her. Whoever came to her did not prevent anyone else from coming, and promiscuous women would set up three flags at their door as a sign. When someone came to them and engaged in intercourse, and if there was a dispute about paternity, the caravan leaders would gather, and they would attribute the child to whichever man they chose. That man would then claim the child as his own, and no one could object. When Allah Almighty made the Prophet ﷺ a true prophet, he declared invalid the type of marriage in which the determination of paternity depended on the testimony of the caravan leaders. He established a form of marriage in which the determination of paternity did not depend on such testimony, and he attributed the child to whoever claimed it, thereby establishing the lineage. He abrogated the earlier command that determined lineage based on the testimony of the caravan leaders. This was to prevent people from attributing lineage to those who were not the fathers.

سعد بن ابی وقاص اور ابو بکر رضی اللہ عنہما سے روایت ہے وہ فرماتے ہیں کہ

رسول اللہ صلی اللہ علیہ و آلہ وسلم نے ارشاد فرمایا تھا کہ جس شخص اپنی نسبت غیر باب یہ کی طرف کرے اور

وہ جانتا ہے کہ پی میرا باب پی نہیں تو اس پر جنت حرام ہے۔ (اس کی روایت بخاری اور مسلم نے متفق

طور پر کی ہے۔)

جس کے اپنے باب یہ سے انکار کرنے کی وعید

Sa‘d ibn Abi Waqqas and Abu Bakrah (may Allah be pleased with them) narrated that the Messenger of Allah (ﷺ) said: “Whoever claims a father other than his own, knowing it, Paradise is forbidden to him.” [Narrated by Bukhari and Muslim]

ابو ہریرہ رضی اللہ عنہ سے روایت ہے کہ وہ فرماتے ہیں کہ رسول اللہ صلی اللہ

علیہ و آلہ وسلم نے ارشاد فرمایا کہ (نسب کے بارے میں) اپنے باب پرداوا لے اعراض نہ کرو،

جو کوئی اپنے باب پر اعراض کرے (یعنی اپنے اصلی باب پہوچنے سے انکار کرے) وہ کفر کے

قریب ہوگا۔

(اس کی روایت بخاری اور مسلم نے متفق طور پر کی ہے)-

ف: واشہو کہ ذکورہ بالا دونوں حدیثوں سے معلوم ہوتا ہے کہ جو جان بوجھ کر اپنے باب پر کسی دوسروں

شخص کو اپنا باب بنائے، یا اپنے باب پر انکار کرے تو وہ برطاب نصیب ہے اس لیے کہ اگر حال حال جو کوئی اپنے باب پر

اعراض کرے تو وہ کافر ہو گیاور ناس کفران نعمت ضروری ہے۔ بعض لوگ شخی مغل ہوئے کے باعجود خود کو سید

بتلاتے ہیں وہ بہت برا کرتے ہیں وہ بہشت چھوڑ کر دوزخ کی تیاری کرتے ہیں۔12

وال کا پن بھی کوئی اور میں شامل کرنے اور باب پر کاپن بنیے کے انکار کرنے پر وعید

Abu Hurairah (may Allah be pleased with him) narrated that the Messenger of Allah (ﷺ) said: “Do not disown your fathers. Whoever disowns his father, it is disbelief.” [Narrated by Bukhari and Muslim]

ابوہریرہ رضی اللہ عنہ سے روایت ہے کہ جب آیت ملاعنہ اتری

تو انہوں نے رسول اللہ صلی اللہ علیہ وآلہ وسلم کو پیارشا د فرماتے سنا کہ جو کوئی عورت (اپنے)

کو کسی قوم میں شامل کر لے حالا نکہ وہ اس قوم سے نہیں ہے تو اس کو اللہ تعالیٰ (کے دین اور اس کی

رحمت سے) پکڑنے والے گا۔ اور اللہ تعالیٰ اس کو پنی جنت میں برگز داخل نہیں کریے گا اور جو کوئی

مرد کسی باب اپنے بیٹے کا انکار کرے اور پیتا (اس کے سامنے کہے) اس کو کیہ رہا ہو کہ تو اللہ

تعالیٰ (جب یا مت کے دن) اس سے پردہ فرما ئیں گے اور ایسے (برحم اور سخت دل) شخص کو گلی

چھلی ساری مخلوق کے سامنے رسوائے کریے گے-

(اس کی روایت ابوداود، نسائی اور داری نے کی ہے)-

مجتب کا تقاضا یہ ہے کہ پیوی کون کا حمیں رکھتے ہوئے بدکاری سے روکے

Abu Hurairah (may Allah be pleased with him) narrated that he heard the Prophet (ﷺ) say when the verse of mutual cursing was revealed: “Any woman who introduces to a people someone not from them is not from Allah in anything, and Allah will not admit her to His Paradise. Any man who denies his child while looking at him, Allah will veil Himself from him and expose him before the first and the last.” [Narrated by Abu Dawud, al-Nasa’i, and al-Darimi]

ابن عباس رضی اللہ عنہما سے روایت ہے وہ فرماتے ہیں کہ ایک شخص نے

حضرت نبی صلی اللہ علیہ وآلہ وسلم کی خدمت اقدس میں حاضر ہوکر پیغمبر کی ایک بیوی کے

جوسی چھونے والے کے باٹھ کرنے کی بھٹانی ( لیعنی جوکونی اس سے بدکاری کا ارادہ کرے اس کے

انکار میں کرتی ) تو حضرت نبی کریم صلی اللہ علیہ وآلہ وسلم نے فرمایا تو اس کو طلاق دیے تو اس کے

عرض کیا مجھے اس سے محبت ہے تو آپ نے فرمایا تو اس کی گلمبائی کرتا رہ ( تاکہ وہ بدکاری نہ

کرے )۔ ( اس کی روایت ابوداوداورنسائی نے کی ہے۔ )

Ibn Abbas (may Allah be pleased with them) narrated: A man came to the Prophet (ﷺ) and said: “I have a wife who does not repel the hand of a toucher.” The Prophet (ﷺ) said: “Divorce her.” He said: “I love her.” He said: “Then keep her.” [Narrated by Abu Dawud and al-Nasa’i]

(1) His statement: “Then keep her,” etc. Therefore, it is said in al-Durr al-Mukhtar: It is not obligatory for a husband to divorce an immoral wife. In Radd al-Muhtar: Nor is it obligatory for her to release an immoral husband, unless they fear they will not uphold Allah’s limits, in which case there is no harm in separating. Immorality includes adultery and other sins. The Prophet (ﷺ) said to one whose wife did not repel the hand of a toucher, and who said: “I love her,” “Enjoy her.”
