بَابُ الْخُلْعِ وَالطَّلَاقِKhul‘ and Divorce

وَقَوْلِ الله عَزَّ وَجَلَّ: الطَّلَـــٰـقُ مَرَّتَانِ فَإِمْسَاكُ بِمَعْرُوفٍ أَوْ تَسْرِيحُ بِإِحْسَانٍ وَلَا يَحِلُّ لَكُمْ أَن تَأْخُذُوا مِمَّا ءَاتَيْتُمُوهُنَّ شَيْئًا إِلَّا أَن يَخَافَا أَلَّا يُقِيمَا حُدُودَ الله فَإِنْ خِفْتُمْ أَلَّا يُقِيمَا حُدُودَ الله فَلَا جُنَاحَ عَلَيْهِمَا فِيمَا افْتَدَتْ بِهِ تِلْكَ حُدُودُ الله فَلَا تَعْتَدُوهَا وَمَن يَتَعَدَّ حُدُودَ الله فَأُوْلَئِكَ هُمُ الظَّالِمُونَ فَإِن طَلَّقَهَا فَلَا تَحِلُّ لَهُ مِنْ بَعْدُ حَتَّى تَنكِحَ زَوْجًا غَيْرَهُ، فَإِن طَلَّقَهَا فَلَا جُنَاحَ عَلَيْهِمَا أَن يَتَرَاجَعَا إِن ظَنَّا أَن يُقِيمَا حُدُودَ الله وَتِلْكَ حُدُودُ الله يُبَيِّنُهَا لِقَوْمٍ يَعْلَمُونَ ﴾ (البقرة : ۲۲۹-۲۳۰)

وَقَوْلِهِ تَعَالَى: ﴿وَإِنْ أَرَدْتُمُ اسْتِبْدَالَ زَوْجٍ مَكَانَ زَوْجٍ وَآتَيْتُمْ إِحْدَاهُنَّ قِنْطَاراً فَلَا تَأْخُذُوا مِنْهُ شَيْئاً أَتَأْخُذُوْنَهُ بُهْتَانًا وَإِثْماً مُبِينًا وَكَيْفَ تَأْخُذُوْنَهُ وَقَدْ أَفْضَى بَعْضُكُمْ إِلَى بَعْضٍ وَأَخَذْنَ مِنْكُمْ مِيثَاقاً غَلِيظًا

(النساء : ٢٠-٢١)

وَقَوْلِهِ تَعَالَى: ﴿يَا أَيُّهَا النَّبِيُّ لِمَ تُحَرِّمُ مَا أَحَلَّ الله لَكَ تَبْتَغِي مَرْضَاتَ أَزْوَاجِكَ وَاللهُ غَفُورٌ رَحِيمٌ قَدْ فَرَضَ الله لَكُمْ تَحِلَّةَ أَيْمَانِكُمْ (التحريم: ١-٢)

1 قوله: الطلاق مرتان إلخ: هاتان الآيتان في الطلاق الرجعي والخلع والغليظة، أما الأول ففي قوله تعالى: الطلاق مَرَّتَانِ ، وبيانه أنه لما كان عدد الطلاق في الجاهلية غير مقرر على وتيرة واحدة، حتى أنه لو طلقها عشرة يمكنه رجعتها، وكان يراجعها وقت انقضاء العدة، ثم يطلقها ويراجعها حتى أن جاءت امرأة إلى عائشة تشكر من مراجعة زوجها، ثم تطليقها، ثم وثم هكذا، فعرضت إلى رسول الله ، فنزل قوله تعالى: ﴿الطَّلَاقُ مَرَّتَانِ فَإِمْسَاكٌ بِمَعْرُوفٍ أَوْ تَسْرِيحٌ بِإِحْسَنِ يعني أن الطلاق الرجعي الذي يتعلق به الرجعة مرتان أي اثنان لا زائدتان، فبعد ذلك إمساكها بمعروف أو تسريحها كذلك، وهذا أمر بصيغة الخبر كأنه قيل : طلقوا الرجعي مرتين، وهذا هو التوجيه المذكور، وفي «الحسيني» و«الزاهدي» و «البيضاوي» و «التلويح : وهو الموافق لمذهب الشافعي وأبي حنيفة جميعا.

وههنا توجيه آخر موافق لمذهب أبي حنيفة فقط، اختاره صاحب الكشاف» و «المدارك وفخر الإسلام، وهو أن المراد بيان الطلاق الشرعي لا الرجعي، إن التطليق الشرعي تطليقة بعد تطليقة على التفريق دون الإرسال دفعة واحدة، ولم يرد بالمرتين التثنية التي يقع مرَّةً واحدةً، ولكن التكرير كقوله تعالى: ثُمَّ ارْجِعِ الْبَصَرَ كَرَّتَيْنِ أي كرة بعد كرة لا كرتين اثنين مرة واحدة؛ لأنه ليس من السنة إيقاع التطليقتين جملة، ويؤيده أنه قال: الطلاق مرتان ولم يقل الطلاق اثنان، وهو أمر بصيغة الخبر، وإلا يلزم الكذب؛ إذ قد يوجد الطلقتان على وجه الجمع، وعند الشافعي يجوز إرسال الاثنين والثلاث دفعة واحدة، وتفضيل المذاهب: أن الطلاق على ثلاثة أوجه أحسن وحسن وبدعي فالأحسن أن يطلقها واحدة في طهر لا وطء فيه ولم يزد عليه، والحسن عندنا أن يطلقها ثلاثة في ثلاثة أطهار أو ثلاثة أشهر، خلافا لمالك؛ فإنه بدعي عنده، والبدعي أن يطلقها اثنين أو ثلاثا في طهر واحد، أو في كلمة واحدة، أو واحدا في طهر وطئ فيه، أو في حيض موطوءة، خلافًا للشافعي في غير الحيض فإنه مباح عنده. ثم في الطلقة والطلقتين يجوز له الرجعة إذا كانت في العدة، ويكون الطلاق بلفظ الصريح، وأما إن انقضت العدة أو كانت كنايات بانت ويحل لها نكاحه ثانيا ونكاح غيره من الأزواج.

وفي الطلقات الثلاث سواء كانت صريحا أو كنايات بمال أو بغيره لا تحل له حتى تنكح زوجا غيره؛ لأن الله تعالى ذكر الطلاق الرجعي في آيتين إحداهما في قوله تعالى: ﴿وَالْمُطَلَّقَاتُ يَتَرَبَّصْنَ الآية، ثم عقب بعدها بالرجعة حيث قال: ﴿وَبُعُولَتُهُنَّ أَحَقُّ بِرَبِّهِنَّ ، وهو فيما إذا طلقها واحدة، والثاني في قوله تعالى: ﴿الطَّلَاقُ مَرَّتَانِ ، وهو الذي بلغ مرتين دفعة أولا وعقب بعدهما بالرجعة حيث قال: ﴿فَإِمْسَاكَ بِمَعْرُوفٍ أَوْ تَسْرِيحُ بإِحْسَانُ أي ليس بعد المرتين إلا الإمساك بمعروف بالمراجعة أو تسريح بإحسان بترك المراجعة حتى تبين بالعدة، وقيل: بالطلقة الثالثة في الطهر الثالث، ثم بين أن الرجعة بعد الثالثة حتى تنكح زوجا آخر، ويدخل ذلك الزوج بها، ثم تطليقها في قوله تعالى: ﴿فإن طَلَّقَهَا فَلَا تَحِلُّ لَه الآية، ثم بين أنه بعد ما بانت بالعدة من طلقتين أو طلقة يجوز أن ينكحها المطلق أو غيره في قوله تعالى: ﴿وَإِذَا طَلَّقْتُمُ النِّسَاءَ فَبَلَغْنَ أَجَلَهُنَّ ) الآية هذا هو تفصيل هذا المقام.

وأما الثاني ففي قوله تعالى: ﴿وَلَا يَحِلُّ لَكُمْ إلى آخره، وقال المفسرون في بيانه: إن جميلة كانت ينفض زوجها ثابت بن قيس، وهو يحبها، وقد أعطاها حديقة في مهرها من قبل، فاختلعت منه بها أي ردتها إليه، وجعلتها سببًا للطلاق منه، فطلقها وأخذ منها تلك الحديقة، وكان رسول الله ﷺ حثها لأجله، فلم تقبل إلا الفراق، فقال : أتردين عليه حديقة؟» قالت: نعم، وهو أول خلع كان في الإسلام، فنزلت هذه الآية، وقد ذكروا هذه القصة بنوع زيادة ونقصان، فمعنى الآية: لا يحل لكم أن تأخذوا وتعيدوا مما آتيتموهن شيئًا أي مما أعطيتموهن من المهور إلا أن يخافا أي في وقت من الأوقات إلا وقت إخافة عدم إقامة حدود الله، وهو عدم الموافقة بينهما بأن يحدث من المرأة النشوز وسوء الخلق وترك الأدب للزوج، ومن الزوج الضرب والشم بغير حق وغير ذلك، فَإِنْ خِفْتُمْ (البقرة: ۲۲۹) عدم إقامة حدود الله بهذه الطريق المذكور، فَلَا جُنَاحَ عَلَيْهِمَا ﴾ (البقرة: ۲۲۹) في مال افتدت المرأة بذلك المال المزوج، وتخلصت به نفسها منه، هذا ما قالوا، ويسمى هذا خُلعًا، وهو طلاق بائن.

ولكن يشترط فيه ذكر لفظ الخلع بأن يقول الزوج خالعتك على ألف درهم وقبلت، أو الزوجة خالعتني على كذا وقبل، حتى أنه لو لم يذكر لفظ الخلع أن يقول الزوج: طلقتك على ألف، أو الزوجة: طلقتني على ألف لا يُسمى خلعًا، بل طلاقا على مال، ولا بأس بالخلع عند الحاجة بما يصلح مهرا، فما جاز أن يكون مهرا في النكاح جاز أن يكون بدلا في الخلع دون العكس، وكره أخذ البدل إن كان النشوز من جانب الزوج وأخذ الفضل على المهر إن كان النشوز من جانب الزوجة، والخلع معاوضة في حقها حتى يصح رجوعها وشرط الخيار لها، ويقتصر على المجلس ويمين في حقه حتى انعكس الأحكام في حقه، هذا كله في كتب الفقه، ثم إنهم اختلفوا في أن الخلع فسخ أم طلاق؟ فقول الشافعي القديم وقول ابن عمرو ابن عباس : إنه فسخ لا طلاق، وعندنا وفي القول الجديد للشافعي واحدي الروايتين عن عثمان : إنه طلاق.

وذلك لما قال فخر الإسلام في بحث الخاص : إن الله تعالى ذكر الطلاق مرَّةً ومرتين وأعقبهما بإثبات الرجعة، ثم أعقب ذلك بالخلع بقوله تعالى: ﴿فَإِنْ خِفْتُمْ أَلَّا يُقِيمَا حُدُودَ الله فَلَا جُنَاحَ عَلَيْهِمَا فِيمَا أَفْتَدَتْ بِهِ﴾ (البقرة: ٢٢٩ فإنما بدأ بفعل الرجل، وهو الطلاق، ثم زاد فعل المرأة، وهو الاقتداء، وفي تحت إفراد المرأة بالذكر في قوله تعالى: ﴿فِيمَا افْتَدَتْ بِهِ ﴾ (البقرة: ۲۲۹ دليل على تقرير فعل الزوج، على ما سبق، وهو الطلاق لا الفسخ؛ لأن الافتدء وضع لإعطاء شيء بمقابلة شيء، فيدل على أن المال عوض ما تقابله وهو مختص بالمرأة، فيكون ما يقابله مختصا بالزوج، وهو الطلاق لا الفسخ، إذ الفسخ يقوم بهما، فإثبات الفعل فسخ من الزوج بطريق الخلع لا يكون عملا به، بل رفعا له. وثمرة الخلاف يظهر في أن عندنا يلحقها طلاق بعد الخلع.

وعنده لا يلحق، ولهذا أوصل قوله تعالى: ﴿فَإِن طَلَّقَهَا﴾ (البقرة: ۲۳۰ بقوله تعالى: ﴿الطَّلَقُ مَرَّتَانِ﴾ (البقرة: ۲۲۹ دون الخلع، وأما الثالث ففي قوله تعالى: ﴿فَإِن طَلَّقَهَا فَلَا تَحِلُّ لَهُ ﴾ (البقرة: ٢٣٠) الآية، وقد اختل في تفسيرها كلام أرباب العقول وعبارات أهل الأصول، فقال أكثر المفسرين: إنها متصلة بقوله تعالى: ﴿الطَّلَقُ مَرَّتَانِ﴾ (البقرة: ۲۲۹، يعني الطلاق الرجعي مرة أو مرتان، فإن طلقها بعدها تطليقة ثالثة فلا تحل له بعد ذلك أبدًا حَتَّى تَنكِحُ زَوْجًا غَيْرَهُ ﴾ (البقرة: ۲۳۰) آخر ، ثم دخل بها ذلك الزوج، فإن طلقها أي الزوج الثاني فَلَا جُنَاحَ عَلَيْهِمَا﴾ (البقرة: ٢٢٩ أي على الزوج الإدخال، والمرأة أن يتراجعا بالنكاح الجديد، إن كان في ظنهما أن يقيما حدود الله من حقوق الزوجية وحسن المعاشرة والموافقة، وعلى هذا التقدير بيان طلاق الخلع معترضة بينهما، وإنما جيء به تنبيها على أنه طلاق أيضًا، ودلالة على أن الطلاق يقع مجانا تارةً وبعوض أخرى، وقد أجمع أهل الأصول على أن ذكر الطلاق في قوله تعالى: ﴿فَإِن طَلَّقَهَا (البقرة: ۲۳۰) بلفظ الفاء عقيب ذكر الخلع دليل على شيئين، الأول: أن الطلاق يصح بعد الخلع عملا بالفاء، والثاني: أن الخلع أيضًا طلاق لا فسخ؛ لأنه لو كان فسخا لا يلحقه الطلاق بعده، وبقرينة قوله تعالى: فِيمَا افْتَدَتْ بِهِ﴾ (البقرة: ۲۲۹، على ما مر تقريره، التفسيرات الأحمدية» ملخصا.

۲ قوله: وإن أردتم استدبدال زوج إلخ ونقل في نزول هذه الآية أنه لما كان الرجل في الجاهلية؛ إذا أعجبته امرأة بالحسن والجمال والمال، وأراد أن ينكحها ويطلق الأولى رماها بفاحشة بهتانا وافتراءا، حتى يلجئها إلى الافتداء منها بما أعطاها، وإنما فعل ذلك ليتخلص إلى نكاح تلك المرأة الأخرى، وليأخذ المال من الأولى بالحيلة والبهتان، فنهى الله تعالى عنه، وقال فيه: ﴿وَإِنْ أَرَدتُّمُ اسْتِبْدَالَ زَوْجٍ﴾(النساء: ۲۰ الآية يعني أن أردتم يا أيها الأزواج استبدال زوجة مكان زوجة للجمال والكمال، والحال إنكم قد آتيتم إحدى الأولى قنطارا أي مالا عظيما، فلا تأخذوه شيئا، لا قليلا ولا كثيرا؛ لأن أخذكم هذا لمجرد البهتان والافتراء بالزنا، وكيف تأخذون المال، والحال إنكم ﴿وَقَدْ أَفْضَى بَعْضُكُمْ إِلَى بَعْضٍ﴾ (النساء: ۲۱ أي خلا بعضكم، وهو زوج مع بعض، وهو زوجة، وَأَخَذْنَ أي الأزواج منكُم مِيثَاقًا غَلِيظًا ﴾ (النساء: ۲۱، أي لحق الصحبة والمضاجعة أو أخذ الله لأجلهن عهدا وثيقا في قوله تعالى: ﴿فَإِمْسَاكٌ بِمَعْرُوفٍ أَوْ تَسْرِيحُ بِإِحْسَانُ﴾ (البقرة: ۲۲۹) أو أخذ النبي ﷺ ذلك في قوله: «استوصوا بالنساء خيرا الحديث هذا مضمون الآية.

وبهذه الآية تمسك صاحب الهداية في أن النشوز إن كان من قبل الرجل يكره له العوض حيث قال في باب الخلع: وإن كان النشوز من قبله يكره له ن يأخذ منها عوضًا لقوله عَزَّ وَجَلَّ: ﴿وَإِنْ أَرَدتُّمُ اسْتِبْدَالَ زَوْجٍ مَكَانَ زوج﴾ (النساء: ٢٠) إلى أن قال: ﴿فَلَا تَأْخُذُوا مِنْهُ شَيْئًا﴾ (النساء: ۲۰ هذا لفظه، وفي قوله تعالى: ﴿قنطارا﴾ دليل على أن المهر يصلح بالغا ما بلغ ؛ لأن معناه مالا عظيما، كما روي أنه قال عمر على المنبر : لا تغالوا بصدقات النساء، فقالت امرأة: أنتبع قولك أم قول الله: ﴿وَءَاتَيْتُمْ إِحْدَتهُنَّ قِنطَارًا﴾ (النساء: ۲۰؟ فقال عمر: كل واحد أعلم من عمر، تزوجوا على ما شئتم، وأيضًا في هذه الآية دليل ظاهر لأبي حنيفة بالله على أن المهر يؤكد بالخلوة الصحيحة حيث أنكر الله تعالى أخذ المال، وعلل ذلك بالإفضاء، وهو الاختلاط والخلوة بلا حائل، هكذا ذكره صاحب المدارك» و«التفسيرات الأحمدية مختصرا.

And the saying of Allah, the Mighty, the Exalted: “Divorce is twice. Then, either keep [her] in an acceptable manner or release [her] with good treatment. And it is not lawful for you to take anything of what you have given them unless both fear that they will not be able to keep [within] the limits of Allah. But if you fear that they will not keep [within] the limits of Allah, then there is no blame upon either of them concerning that by which she ransoms herself. These are the limits of Allah, so do not transgress them. And whoever transgresses the limits of Allah – those are the wrongdoers. And if he has divorced her [for the third time], then she is not lawful to him afterward until [after] she marries a husband other than him. And if [that husband] divorces her, there is no blame upon the two if they return to each other, provided they think that they can keep [within] the limits of Allah. And these are the limits of Allah, which He makes clear to a people who know” [Al-Baqarah: 229-230].And His saying, the Exalted: “And if you wish to exchange a wife for another wife and you have given one of them a great amount [in gifts], do not take [back] from it anything. Would you take it in injustice and manifest sin? And how could you take it when you have gone in unto each other and they have taken from you a solemn covenant?” [An-Nisa: 20-21].And His saying, the Exalted: “O Prophet, why do you prohibit [yourself from] what Allah has made lawful for you, seeking the approval of your wives? And Allah is Forgiving and Merciful. Allah has already ordained for you [Muslims] the dissolution of your oaths…” [At-Tahrim: 1-2].

1 The statement: “Divorce is twice, etc.”: These two verses address revocable divorce, khul‘, and the final divorce. Regarding the first, His saying, “Divorce is twice”, clarifies that in the pre-Islamic era, the number of divorces was not fixed, allowing a man to divorce his wife multiple times (e.g., ten) and still take her back. He could revoke the divorce at the end of her waiting period, divorce her again, and repeat this cycle. A woman complained to Aishah about her husband’s repeated revocations and divorces, and when this was brought to the Messenger of Allah (ﷺ), the verse “Divorce is twice” was revealed. This means that revocable divorce, which allows revocation, is limited to two times, not more. After that, one must either keep her with kindness or release her with good treatment. This is a command in the form of a statement, as if to say: “Divorce revocably twice.” This interpretation is mentioned in Husayni, Zahidi, Baydawi, and Talwih, aligning with the views of Ash-Shafi‘i and Abu Hanifah.

Another interpretation, specific to Abu Hanifah and favored by the authors of Kashshaf, Madarik, and Fakhr al-Islam, holds that this refers to the lawful method of divorce, not just revocable divorce. Lawful divorce is pronounced one at a time with intervals, not all at once. The term “twice” does not imply two divorces at once but rather repetition, as in “Then look again twice” [Al-Mulk: 4], meaning one look after another, not two at once. This is supported by the use of “marratan” (twice) instead of “ithnayn” (two), indicating a command in the form of a statement. Otherwise, it would imply falsehood, as two divorces can occur together. Ash-Shafi‘i permits pronouncing two or three divorces at once. The preferred rulings are: The best divorce is one pronounced in a clean period without intercourse, followed by no further divorce. The good method, per Hanafis, is three divorces in three clean periods or three months, contrary to Malik, who considers this innovated. Innovated divorce includes pronouncing two or three divorces in one clean period, in one statement, or one divorce in a period with intercourse or during menstruation with prior intercourse. Ash-Shafi‘i permits this except during menstruation. After one or two divorces, revocation is allowed during the waiting period if pronounced explicitly. If the waiting period ends or ambiguous terms are used, she is fully divorced and may remarry him or another. After three divorces, explicit or ambiguous, with or without compensation, she is not lawful to him until she marries another husband, as Allah states. Revocable divorce is addressed in two verses: “Divorced women shall wait…” [Al-Baqarah: 228], followed by “And their husbands have more right to take them back”, for one divorce, and “Divorce is twice”, for two divorces, followed by “Then, either keep [her] in an acceptable manner or release [her] with good treatment”, meaning after two divorces, either revoke with kindness or release by letting the waiting period end or pronouncing a third divorce in the third clean period. Revocation after the third divorce requires her to marry another husband who consummates the marriage and then divorces her, as in “And if he has divorced her…” [Al-Baqarah: 230]. After the waiting period of one or two divorces, the divorcing husband or another may marry her, as in “And when you divorce women and they have fulfilled their term…” [Al-Baqarah: 231]. This is the detailed explanation.

Regarding the second, “And it is not lawful for you…”, commentators explain that Jamilah, the wife of Thabit ibn Qays, was averse to him despite his love for her. He had given her a garden as her dowry. She sought khul‘ by returning the garden, making it the cause of her divorce. He divorced her and took back the garden. The Messenger of Allah (ﷺ) encouraged her to stay for his sake, but she insisted on separation. He asked, “Will you return his garden?” She said, “Yes.” This was the first khul‘ in Islam, and this verse was revealed. The verse means it is not lawful to take back anything given as dowry unless both fear they cannot uphold Allah’s limits, i.e., discord arises, such as the wife’s rebellion, bad character, or lack of respect, or the husband’s unjust beating or abuse. If you fear they cannot uphold Allah’s limits in this manner, there is no blame on either for what she ransoms herself with to free herself. This is called khul‘, a final divorce. However, the term “khul‘” must be explicitly mentioned, e.g., the husband says, “I grant you khul‘ for a thousand dirhams, and I accept,” or the wife says, “I seek khul‘ from you for this, and you accept.” If the term “khul‘” is not used, e.g., the husband says, “I divorce you for a thousand,” or the wife says, “Divorce me for a thousand,” it is not khul‘ but a divorce for compensation. Khul‘ is permissible when needed, with anything valid as dowry being valid as compensation, though not vice versa. Taking compensation is disliked if the discord is from the husband, and taking more than the dowry is disliked if from the wife. Khul‘ is a transaction for her, allowing her to revoke or stipulate an option, limited to the session, and an oath for him, reversing rulings for him. This is detailed in fiqh books. Scholars differ on whether khul‘ is a dissolution or a divorce. Ash-Shafi‘i’s old opinion and Ibn Amr ibn Abbas hold it is a dissolution, not a divorce. Hanafis and Ash-Shafi‘i’s new opinion, one narration from Uthman, hold it is a divorce. Fakhr al-Islam explains that Allah mentioned one or two divorces followed by revocation, then khul‘ in “But if you fear that they will not keep [within] the limits of Allah…” [Al-Baqarah: 229]. He began with the husband’s action (divorce) and added the wife’s action (ransom). Mentioning the wife in “concerning that by which she ransoms herself” confirms the husband’s prior action (divorce, not dissolution), as ransom involves giving something for something. This indicates the compensation is for the wife, and the corresponding action (divorce) is for the husband, not dissolution, which involves both. The practical difference is that Hanafis count khul‘ as a divorce, while others do not. Thus, “And if he has divorced her…” [Al-Baqarah: 230] connects to “Divorce is twice” [Al-Baqarah: 229], not khul‘.Regarding the third, “And if he has divorced her…” [Al-Baqarah: 230], scholars differ. Most commentators connect it to “Divorce is twice”, meaning after one or two revocable divorces, a third divorce makes her unlawful to him forever until she marries another husband who consummates the marriage and divorces her. Then, there is no blame on the first husband and wife to remarry if they believe they can uphold Allah’s limits of marital rights, good companionship, and harmony. On this view, the khul‘ ruling is an interjection to clarify that it is also a divorce, indicating divorce can be without or with compensation. Jurists agree that mentioning divorce in “And if he has divorced her…” with the letter fa’ (then) after khul‘ indicates two things: divorce is valid after khul‘, per the fa’, and khul‘ is a divorce, not a dissolution, as dissolution would not be followed by divorce. This is supported by “concerning that by which she ransoms herself”, as explained in Tafsir al-Ahmadiyyah (summarized).

2 The statement: “And if you wish to exchange a wife…”: It is reported that in the pre-Islamic era, if a man admired another woman for her beauty, wealth, or perfection and wanted to marry her by divorcing his current wife, he would falsely accuse his wife of immorality to force her to ransom herself with what he gave her. He did this to marry the other woman and take back his wealth deceitfully. Allah prohibited this, saying, “And if you wish to exchange a wife…”, meaning if you desire to replace one wife with another for beauty or perfection, having given the first a great amount, do not take anything back, as it would be unjust and sinful. How can you take it when you have been intimate and they have taken a solemn covenant, meaning companionship, intimacy, or Allah’s firm covenant in “Then, either keep [her] in an acceptable manner or release [her] with good treatment” [Al-Baqarah: 229], or the Prophet’s (ﷺ) saying, “Treat women kindly…” This is the verse’s meaning. The author of Hidayah cites this to argue that if the discord is from the husband, taking compensation is disliked, as in the chapter on khul‘: If the discord is from him, it is disliked to take compensation, per “And if you wish to exchange a wife…” to “do not take [back] from it anything” [An-Nisa: 20]. The term “qintar” (great amount) indicates dowry can be any amount, as it means vast wealth. It is narrated that Umar said on the pulpit, “Do not exaggerate women’s dowries.” A woman responded, “Do we follow your words or Allah’s: ‘And you have given one of them a great amount’?” Umar said, “Everyone is more knowledgeable than Umar. Marry with what you wish.” This verse also clearly supports Abu Hanifah’s view that dowry is confirmed by valid seclusion, as Allah prohibits taking back wealth, justified by intimacy (seclusion without barrier), as in Madarik and Tafsir al-Ahmadiyyah (summarized).

وَعَنِ ابْنِ عَبَّاسٍ (رضي الله عنهما) أَنَّ امْرَأَةَ ثَابِتِ بْنِ قَيْسٍ أَتَتْ النَّبِيَّ ﷺ فَقَالَتْ: يَا رَسُوْلَ اللهِ، ثَابِتُ بْنُ قَيْسٍ مَا أَعْتِبُ عَلَيْهِ فِي خُلُقٍ وَلَا دِينِ، وَلَكِنِّي أَكْرَهُ الْكُفْرَ فِي الْإِسْلَامِ، فَقَالَ رَسُولُ اللهِ ﷺ: «أَتَرُدِّينَ عَلَيْهِ حَدِيقَتَهُ ؟ قَالَتْ: نَعَمْ، قَالَ رَسُولُ الله ﷺ: «اقْبَلْ الْحَدِيقَةَ وَطَلَّقْهَا تَطْلِيقَةً. رَوَاهُ الْبُخَارِيُّ.

وَرَوَى الدَّارَ قُطْنِيُّ وَالْبَيْهَقِيُّ فِي سُنَنِهِمَا عَنْهُ الله أَنَّ النَّبِيَّ ﷺ جَعَلَ الْخُلْعَ تَطْلِيقَةٌ بَائِنَةٌ.

وَفِي الْبَابِ آثَارُ كَثِيرَةُ مَبْسُوطَةٌ فِي الدُّرِّ الْمَنْثُوْرِ وَغَيْرِهِ.

English

Ibn Abbas (may Allah be pleased with them) narrated that the wife of Thabit ibn Qays came to the Prophet (ﷺ) and said, “O Messenger of Allah, I do not fault Thabit ibn Qays in his character or religion, but I dislike disbelief in Islam.” The Messenger of Allah (ﷺ) said, “Will you return his garden to him?” She said, “Yes.” The Messenger of Allah (ﷺ) said, “Accept the garden and divorce her once.” Narrated by Bukhari.

Ad-Daraqutni and Al-Bayhaqi narrated in their Sunan from him that the Prophet (ﷺ) made khul‘ a single final divorce.

There are many narrations in this regard, detailed in Ad-Durr al-Manthoor and elsewhere.

The author of Kashshaf says: If asked about the ruling on prohibiting the lawful, it is disputed. Abu Hanifah views it as an oath in all cases, considering the intended benefit of what is prohibited. If one prohibits food, it is an oath against eating it; a slave woman, against intimacy; or a wife, against ila’ (oath of abstinence) if no intent is specified. If one intends zihar (likening to a kin), it is zihar; if divorce, it is a final divorce. If two or three divorces are intended, it follows the intent. If one says, “I intended to lie,” it is a matter between him and Allah, not upheld in judgment. 1 The statement: The Messenger of Allah (ﷺ) said: The most rightful thing you take a wage for is the Book of Allah, Al-Qadi said: This indicates the permissibility of hiring for reciting the Qur’an and performing ruqyah with it, and the permissibility of taking wages for teaching the Qur’an. Some scholars prohibited it, including Az-Zuhri, Abu Hanifah, and Ishaq, citing the upcoming narration of Ubadah ibn As-Samit. In Sharh As-Sunnah, this narration proves the permissibility of ruqyah with the Qur’an and Allah’s remembrance and taking wages for it, as recitation is among permissible actions. This was used as evidence by those who permitted the sale and purchase of Qur’an manuscripts and taking wages for writing them, including Al-Hasan, Ash-Sha’bi, and Ikrimah. This view was held by Sufyan, Malik, Shafi’i, and the companions of Abu Hanifah. As stated in Al-Marqah. It is also said in Bazl Al-Majhood: This narration is the greatest evidence that wages are permissible for ruqyah and medicine, as stated by Shafi’i, Malik, Abu Hanifah, and Ahmad. Hanafis say it is a single final divorce, as do Uthman, Ali, Ibn Mas‘ud, Al-Hasan, Ibn al-Musayyib, Ata, Shurayh, Ash-Sha‘bi, Qabisah ibn Dhu’ayb, Mujahid, Abu Salamah, An-Nakha‘i, Az-Zuhri, Ath-Thawri, Al-Awza‘i, Mak-hul, Ibn Abi Najih, Urwah, Malik, and Ash-Shafi‘i in his new opinion. وفي رد المحتار»: قال في الهداية»: وبعض مشايخنا استحسنوا الاستئجار على تعليم القرآن اليوم لظهور التواني في الأمور الدينية، ففي الامتناع تضييع حفظ القرآن، وعليه الفتوى. وقال تاج الشريعة في شرح الهداية»: إن القرآن بالأجرة لا يستحق الثواب لا للميت ولا للقارئ. وقال العيني في شرح الهداية»: ويمنع القارئ للدنيا، والآخذ والمعطي آثمان.

فالحاصل أن ما شاع في زماننا من قراءة الأجزاء بالأجرة لا يجوز؛ لأن فيه الأمر بالقراءة وإعطاء الثواب للآمر والقراءة لأجل المال، فإذا لم يكن للقارئ ثواب؛ لعدم النية الصحيحة فأين يصل الثواب إلى المستأجر، ولولا الأجرة ما قرأ أحد لأحد في هذا الزمان، بل جعلوا القرآن العظيم مكسبا ووسيلة إلى جمع الدنيا، إنا لله وإنا إليه راجعون. وقد اغتر بما في «الجوهرة» صاحب البحر» في كتاب الوقف، وتبعه الشارح في كتاب الوصايا حيث يشعر كلامهما بجواز الاستجئار على كل الطاعات ومنها القراءة، وقد ردَّه الشيخ خير الدين الرملي في حاشية «البحر» في كتاب الوقف حيث قال: أقول: المفتى به جواز الأخذ استحسانًا على تعليم القرآن لا على القراءة المجردة، كما صرحبه في «التاتارخانية، حيث قال: لا معنى لهذه الوصية ولصلة القارئ بقراءته؛ لأن هذا بمنزلة الأجرة، والإجارة في ذلك باطلة، وهي بدعة، ولم يفعلها أحد من الخلفاء، وقد ذكرنا مسألة تعليم القرآن على استحسان، يعني للضرورة، ولا ضرورة في الاستئجار على القراءة على القبر.

وفي «الزيلعي» وكثير من الكتب: لو لم يفتح باب التعليم بالأجر الذهب القرآن، فأفتوا بجوازه ورأوه حسنًا، فتنبه اهـ. وما استدل به بعض المحشين على الجواز بحديث البخاري في اللديغ فهو خطأ؛ لأن المتقدمين المانعين الاستئجار مطلقا جوزوا الرقية بالأجرة، ولو بالقرآن كما ذكره الطحاوي؛ لأنها ليست عبادة محضة، بل من التداوي تم كلام رد المحتار مختصرا.

Nafi‘ narrated from a freedwoman of Safiyyah bint Abi Ubayd that she sought khul‘ from her husband for everything she owned, and Abdullah ibn Umar did not disapprove. Narrated by Malik.

وَعَنْ ثَوْبَانَ(رضي الله عنه) قَالَ: قَالَ رَسُولُ اللهِ ﷺ: «أَيُّمَا امْرَأَةٍ سَأَلَتْ زَوْجَهَا طَلَاقًا فِي غَيْرِ مَا بَأْسٍ فَحَرَامُ عَلَيْهَا رَائِحَةُ الْجَنَّةِ». رَوَاهُ أَحْمَدُ وَالتَّرْمِذِيُّ وَأَبُو دَاوُدَ وَابْنُ مَاجَه وَالدَّارِمِيُّ.

Thawban (may Allah be pleased with him) narrated that the Messenger of Allah (ﷺ) said: “Any woman who requests divorce from her husband without harm, the fragrance of Paradise is forbidden to her.” Narrated by Ahmad, Tirmidhi, Abu Dawud, Ibn Majah, and Ad-Darimi.

۲ قوله: فحرام عليها رائحة الجنة وقال في الخازن ذهب جمهور العلماء إلى أنه يجوز الخلع من غير نشوز، ولا غضب غير أنه يكره لما فيه من قطع الوصلة بلا سبب عن ثوبان أن رسول الله ﷺ قال: أيها أمرأة سألت زوجاه الطلاق من غير بأس فحرام عليها رائحة الجنة، أخرجه أبو داود والترمذي عن ابن عمر عن النبي ﷺ قال: أبغض الحلا إلى الله تعالى الطلاق، أخرجه أبو داود، ودليل الجمهور على جواز الخلع من غير نشوز قوله تعالى: فإن طين لَكُمْ عَن شَيْءٍ مِنْهُ نَفْسًا فَكُلُوهُ هَنِيئًا مَرِيئًا ﴾ (النساء: ٤) ، فإذا جاز لها أن تهب مهرها من غير أن يحصلها شيء، فإذا بذلت كان ذلك في الخلع الذي تصير بسببه مالكة أمر نفسها أولى انتهى. ولكن قال في رحمة الأمة»: واتفق الأئمة على أن المرأة؛ إذا كرهت زوجها لقبح منظر أو سوء عشرة، جاز لها أن تخالعه على عوض، وإن لم يكن من ذلك شيء، وتراضيا على الخلع من غير سبب جاز، ولم يكره.

Our view, per Ad-Durr al-Mukhtar, is that divorce is permissible per the general verses, though some say the most correct view is prohibition except for pressing need or major issue, with the first view being the adopted one, as in Bahr. Their statement, “Its default is prohibition,” means the lawgiver set aside this default and permitted it, even recommending it for a harmful or prayer-neglecting wife. In Radd al-Muhtar’s gloss: The first view (permissibility) is supported by “So divorce them at their prescribed periods” [At-Talaq: 1] and “There is no blame upon you if you divorce women…” [Al-Baqarah: 236]. The Prophet (ﷺ) divorced Hafsah without suspicion or major issue, as did the Companions. Al-Hasan ibn Ali frequently married and divorced. The Hadith, “The most hated of lawful things to Allah is divorce,” narrated by Abu Dawud, means “lawful” includes permissible, recommended, obligatory, and disliked acts, as Ash-Shamni said, per Bahr (summarized). The response is that being hated does not negate being lawful, as lawful includes the disliked, which is hated, unlike lawful acts where abstention is not preferred. This supports the second view, as will be further affirmed. Their statement responds to Fath’s claim that permissibility negates prohibition except for major issues or suspicion, citing the Prophet’s divorce of Hafsah without these. This contradicts their claim that its default is prohibition due to ingratitude for marriage’s blessing, with permissibility for need of escape. The Hadith “The most hated of lawful things to Allah is divorce” is addressed in Bahr: This default indicates legal prohibition, but the lawgiver set it aside, making permissibility the legislated ruling, like marriage’s default prohibition permitted for procreation. Does this imply marriage is prohibited? The truth is divorce’s permissibility without need for escape, per the cited evidence. I say: The difference is clear. Marriage’s default prohibition was entirely lifted, leaving no prohibition except for external reasons. Divorce’s permissibility is inherent as it removes bondage, but its prohibition persists for severing marriage, which holds religious and worldly benefits. This aligns with prayer on usurped land, permissible and prohibited from different aspects. Divorce’s default prohibition remains, unlike marriage’s, which was lifted for procreation and world continuity. Divorce’s default prohibition persists except for permitting reasons, i.e., the need for escape, meaning “Its default is prohibition, permitted for need of escape.” Without cause, it is folly, ingratitude, and harm to her, her family, and children. Thus, its cause is the need for escape due to incompatible temperaments or enmity causing failure to uphold Allah’s limits, not limited to major issues or suspicion, as chosen in Fath. Without a permitting need, it remains prohibited, per “Then if they obey you, do not seek means against them” [An-Nisa: 34], meaning do not seek separation, and the Hadith “The most hated of lawful things to Allah is divorce.” Fath states: “Permissible” applies to times when the need is verified. When present, divorce is permitted, explaining the Prophet’s and Companions’ actions to avoid attributing frivolous harm to them. Bahr’s claim that permissibility without need for escape is incorrect if escape means without cause, as it contradicts “Permitted for need of escape.” If it means with need, it is correct. Bahr’s claim that Fath’s validation is a weak opinion contradicts our scholars, as the weak view limits permissibility to major issues or suspicion, while Fath validates non-restriction, per their general need, as clarified, showing no contradiction between the adopted view and Fath’s validation, per Fath al-Qadir.

قوله : أبغض الحلال اإلى الله الطلاق: وقال الشافعي الله : كل طلاق مباح، قاله في الهداية»، ومذهبنا مذكور في «الدر المختار» بأن إيقاع الطلاق مباح عند العامة لإطلاق الآيات أكمل ، وقيل : قائله الكمال الأصح حظره أي منعه إلا لحاجة كريبة وكبر، والمذهب الأول، كما في البحر» وقولهم: الأصل فيه الحظر»، معناه أن الشارع ترك هذا الأصل فأباحه، بل يستحب لو مؤذية أو تاركة صلاة انتهى. وقال في حاشية رد المحتار: قوله: والمذهب الأول الإطلاق قوله تعالى: فَطَلَقُوهُنَّ لِعِدَّتِهِنَّ ﴾ (الطلاق: ۱ لَا جُنَاحَ عَلَيْكُمْ إِن طَلَّقْتُمُ النِّسَاءَ﴾ (البقرة: ٢٣٦)، ولأنه طلق حفصة لا لريبة ولا كبير، وكذا فعله الصحابة، والحسن بن علي اسكتثر النكاح والطلاق، وأما ما رواه أبو داود أنه قال: أبغض الحلال إلى الله عَزَّ وَجَلَّ الطلاق ، فالمراد بالحلال ما ليس فعله بلازم الشامل للمباح والمندوب والواجب والمكروه، كما قاله الشمني، «بحر» ملخصا. قلت: لكن حاصل الجواب: أن كونه مبغوضا لا ينافي كونه حلالا، فإن الحلال بهذا المعنى يشمل المكروه، وهو مبغوض.

بخلاف ما إذا أريد بالحلال ما لا يترجح تركه على فعله، وأنت خيبر أن الجواب مؤيد للقول الثاني، ويأتي بعده تأييده أيضًا، فافهم. وقوله: وقولهم إلخ جواب عن قوله: في «الفتح»: إن قولهم بإباحته وإبطالهم قول من قال: لا يباح إلا لكبر أو ريبة، بأنه طلق حفصة ولم يقترن بواحد منهما مناف لقولهم: الأصل فيه الحظر فيه من كفران نعمة النكاح، والإباحة للحاجة إلى الخلاص، والحديث : أبغض الحلال إلى الله تعالى الطلاق ، وأجاب في «البحر» بأن هذا الأصل يدل على أنه محظور شرعا، وإنما يفيد أن الأصل فيه الحظر وترك ذلك بالشرع فصار الحل هو المشروع فهو نظير قولهم: الأصل في النكاح الحظر.

وإنما أبيح اللحاجة إلى التوالد والتناسل، فهل يفهم منه أنه محظور، فالحق إباحته لغير حاجة طلبا للخلاص منها؛ للأدلة المارة، أقول: لا يخفي ما بين الأصلين من الفرق، فإن الحظر الذي هو الأصل في النكاح قد زال بالكلية فلم يبق فيه حظر أصلا، إلا لعارض خارجي، بخلاف الطلاق فقد صرح في الهداية» بأنه مشروع في ذاته من حيث إنه إزالة الرق، وأن هذا لا ينافي الحظر لمعنى في غيره، وهو ما فيه من قطع النكاح الذي تعلقت به المصالح الدينية والدنيوية، فهذا صريح في أنه مشروع محظور من جهتين، وإنه لا منافاة في اجتماعهما لاختلاف الحيثية كالصلاة في الأرض المغصوبة، فكون الأصل فيه الحظر لم يزل بالكلية، بل هو باق إلى الآن، بخلاف الحظر في النكاح فإنه من حيث كونه انتفاعا بجزء الآدمي المحترم، وإطلاعا على العورات قد زال للحاجة إلى التوالد وبقاء العالم، وأما الطلاق فإن الأصل فيه الحظر بمعنى أنه محظور إلا لعارض مبيحة، وهو معنى قولهم الأصل فيه الحظر والإباحة للحاجة إلى الخلاص، فإذا كان بلا سبب أصلا لم يكن فيه حاجة إلى الخلاص، بل يكون حمقا وسفاهة رأي، ومجرد كفران النعمة وإخلاص الإيذاء بها وبأهلها وأولادها، ولهذا قالوا: إن سببه الحاجة إلى الخلاص عند تباين الأخلاق وعروض البغضاء الموجبة عدم إقامة حدود الله تعالى، فليست الحاجة مختصة بالكبر والريبة، كما قيل، بل أعم كما اختاره في «الفتح».

فحيث تجرد عن الحاجة المبيحة له شرعًا يبقى على أصله من الحظر، ولهذا قال تعالى: ﴿فَإِنْ أَطَعْنَكُمْ فَلَا تَبْغُوا عَلَيْهِنَّ سَبِيلًا) (النساء: ٣٤ أي لا تطلبوا الفراق، وعليه حديث أبغض الحلال إلى الله تعالى الطلاق. قال في «الفتح»: ويحمل لفظ المباح على ما أبيح في بعض الأوقات أعني أوقات تحقق الحاجة المبيحة. وإذا وجدت الحاجة المذكورة أبيح وعليها يحمل ما وقع منه ، ومن أصحابه وغيرهم من الأيمة صونًا لهم عن العبث والإيذاء بلا سبب، فقوله في البحر»: إن الحق إباحته لغير حاجة طلبا للخلاص عنها إن أراد بالخلاص منها الخلاص بلا سبب، كما هو المتبادر منه فهو ممنوع؛ لمخالفته لقولهم: إن إباحته للحاجة إلى الخلاص، فلم يبيحوه إلا عند الحاجة إليه، لا عند تجرد إرادة الخلاص، وإن أراد الخلاص عند الحاجة إليه فهو المطلوب، وقوله في البحر أيضًا: إن ما صححه في «الفتح» اختيار للقول الضعيف، وليس المذهب عن علمائنا فيه نظر؛ لأن الضعيف وهو عدم إباحته إلا لكبر أو ريبة والذي صححه في «الفتح» عدم التقييد بذلك، كما هو مقتضى إطلاقهم الحاجة، وعما قررناه أيضًا أنه لا مخالفة بين ما ادعاه أنه المذهب، وما صححه في «الفتح»، فاغتنم هذا التحرير فإنه من «فتح القدير».

۱قوله: إن غيلان بن سلمة الثقفي أسلم وله عشر نسوة في الجاهلية إلخ : وقال في الدر المختار»: أسلم الكافر وتحته خمس نسوة فصاعدًا أو أختان أو أم وبنتها بطل نكاحهن، وإن تزوجهن بعقد واحد. فإن رتب فالآخر باطل، وخيره محمد والشافعي عملا بحديث فيروز. قلنا : كان تخييره في التزوج بعد الفرقة أي التزوج بعقد جديد. وقال ابن الهمام والأوجه قول محمد. كذا في الدر المختار» و «المرقاة»، وفي المقام تفصيل آخر، موضع بسطه هو رد المحتار». وقال في العرف الشذي مذهب الشافعي وأحمد ومالك ومحمد أن الرجل يخير يختار أيتهن شاء. وقال أبو يوسف وأبو حنيفة: إنه يختار أولهن نكاحا، تمسك الجمهور بأحاديث الباب، وأجاب الشيخان بما أجاب الطحاوي. وحاصله : أن الكفار مخاطبون بالفروع مثل النكاح.

وأما المسألة التي ذكر الشيخان تكون في الأنكحة التي تنعقد بعد ورود النهي عن الزائد على مثنى وثلاث ورباع، وأما الأنكحة التي قبل ورود الشريعة بهذه المسألة فكانت صحيحة، فإذا أسلم فأنكحته صحيحة، ويختار أيتهن شاء، فالحاصل أن الخلاف في الأنكحة التي بعد ورود النهي، وأما ما مضى قبل ورود الشريعة فلا تبديل فيها، انتهى. وقال في نيل الأوطار فيه دليل على أنه يحكم لعقود الكفار بالصحة وإن لم توفق الإسلام، فإذا أسلموا أجرينا عليهم في الأنكحة أحكام المسلمين، وقد ذهب إلى هذا مالك والشافعي وأحمد وداود، وذهبت العترة وأبو حنيفة وأبو يوسف والثوري والوزاعي والزهري وأحد قولي الشافعي إلى أنه لا يقر من أنكحة الكفار إلا ما وافق الإسلام، فيقولون: إذا أسلم الكافر وتحته أختان وجب عليه إرسال من تأخر عقدها، وكذلك إذا كان تحته أكثر من خمس، أمسك من تقدم العقد عليها منهن، وأرسل من تأخر عقدها إذا كانت خامسة أو نحو ذلك، وإذا وقع العقد على الأختين أو على أكثر من أربع مرَّةً واحدةً بطل، وأمسك من شاء من الأختين وأرسل من شاء، وأمسك أربعا من الزوجات يختارهن ويرسل الباقيات.

وَعَنْ مُعَاذِ بْنِ جَبَلٍ (رضي الله عنه) قَالَ : قَالَ رَسُولُ اللهِ ﷺ: «يَا مُعَادُ، مَا خَلَقَ الله شَيْئًا عَلَى وَجْهِ الْأَرْضِ أَحَبَّ إِلَيْهِ مِنَ الْعِتَاقِ، وَلَا خَلَقَ اللهُ شَيْئًا عَلَى وَجْهِ الْأَرْضِ أَبْغَضَ إِلَيْهِ مِنَ الطَّلَاقِ. رَوَاهُ الدَّارِقُطْنِي.

English

Mu‘adh ibn Jabal (may Allah be pleased with him) narrated that the Messenger of Allah (ﷺ) said: “O Mu‘adh, Allah has not created anything on the face of the earth more beloved to Him than emancipation, nor anything more hated to Him than divorce.” Narrated by Ad-Daraqutni.

وَعَنْ مُجَاهِدٍ قَالَ: كُنْتُ عِنْدَ ابْنِ عَبَّاسٍ فَجَاءَهُ رَجُلٌ فَقَالَ: إِنَّهُ طَلَّقَ امْرَأَتَهُ ثَلَاثًا قَالَ: فَسَكَتَ حَتَّى ظَنَنْتُ أَنَّهُ رَادُّهَا إِلَيْهِ، ثُمَّ قَالَ: يَنْطَلِقُ أَحَدُكُمْ فَيَرْكَبُ الْحُمُوقَةَ، ثُمَّ يَقُولُ: يَا ابْنَ عَبَّاسٍ يَا ابْنَ عَبَّاسٍ وَإِنَّ اللهَ قَالَ: وَمَن يَتَّقِ الله يَجْعَل لَّهُ مَخْرَجًا وَإِنَّكَ لَمْ تَتَّقِ الله فَلَمْ أَجِدْ لَكَ مَخْرَجًا، عَصَيْتَ رَبَّكَ وَبَانَتْ مِنْكَ امْرَأَتُكَ. رَوَاهُ أَبُو دَاوُدَ فِي سُنَنِهِ بِسَنَدٍ صَحِيحٍ.

وَفِي رِوَايَةِ ابْنِ أَبِي شَيْبَةَ وَالدَّارِ قُطْنِي عَنِ ابْنِ عُمَرَ لا قُلْتُ: يَا رَسُوْلَ اللهِ، أَرَأَيْتَ لَوْ طَلَّقْتُهَا ثَلَاثًا؟ قَالَ: إِذًا قَدْ عَصَيْتَ رَبَّكَ وَبَانَكَ مِنْكَ امْرَأَتُكَ.

وَرَوَى الطَّحَاوِيُّ عَنْ مَالِكِ بْنِ الْحَارِثِ قَالَ: جَاء رَجُلٌ إِلَى ابْنِ عَبَّاسٍ، فَقَالَ: إِنَّ عَمِّي طَلَّقَ امْرَأَتَهُ ثَلَاثًا، فَقَالَ: إِنَّ عَمَّكَ عَصَى الله فَأَثِمَ وَأَطَاعَ الشَّيْطَانَ فَلَمْ يَجْعَلْ لَهُ مَخْرَجًا.

وَرَوَى النَّسَائِيُّ عَنْ مَحْمُودِ بْنِ لَبِيْدٍ قَالَ: أُخْبِرَ رَسُولُ الله ﷺ مِنْ رَجُلٍ طَلَّقَ امْرَأَتَهُ ثَلَاثَ تَطْلِيقَاتٍ جَمِيعًا، فَقَامَ غَضْبَانَ، ثُمَّ قَالَ: «أَيُلْعَبُ بِكِتَابِ الله عَزَّ وَجَلَّ وَأَنَا بَيْنَ أَظْهُرِكُمْ حَتَّى قَامَ رَجُلٌ، فَقَالَ: يَا رَسُوْلَ اللهِ، أَلَا أَقْتُلُهُ.

وَفِي رِوَايَةِ مَالِكٍ: أَنَّ رَجُلًا قَالَ لِعَبْدِ اللهِ بْنِ عَبَّاسٍ : إِنِّي طَلَّقْتُ امْرَأَتِي مِائَةَ تَطْلِيقَةٍ، فَمَاذَا تَرَى عَلَيَّ؟ فَقَالَ ابْنُ عَبَّاسٍ: طَلُقَتْ مِنْكَ بِثَلَاثٍ، وَسَبْعُ وَتِسْعُوْنَ اتَّخَذْتَ بِهَا آيَاتِ اللهِ هُزُوًا.

Mujahid narrated: I was with Ibn Abbas when a man came to him and said he had divorced his wife thrice. He remained silent until I thought he would return her to him, then said, “One of you goes and commits folly, then says, ‘O Ibn Abbas, O Ibn Abbas!’ Allah said, ‘And whoever fears Allah, He will make for him a way out.’ You did not fear Allah, so I find no way out for you. You disobeyed your Lord, and your wife is fully divorced from you.” Narrated by Abu Dawud with a sound chain.

In Ibn Abi Shaybah and Ad-Daraqutni’s narration from Ibn Umar: I said, “O Messenger of Allah, what if I divorced her thrice?” He said, “Then you have disobeyed your Lord, and your wife is fully divorced from you.”

At-Tahawi narrated from Malik ibn al-Harith: A man came to Ibn Abbas and said, “My uncle divorced his wife thrice.” He said, “Your uncle disobeyed Allah, sinned, and followed Satan, so no way out was made for him.”

An-Nasa’i narrated from Mahmoud ibn Labid: The Messenger of Allah (ﷺ) was informed of a man who divorced his wife three times at once. He stood angrily and said, “Is the Book of Allah being played with while I am among you?” A man stood and said, “O Messenger of Allah, shall I not kill him?”

In Malik’s narration: A man said to Abdullah ibn Abbas, “I divorced my wife a hundred times. What do you think I should do?” Ibn Abbas said, “She is divorced from you by three, and the ninety-seven you took as mockery of Allah’s verses.”

1 The statement: “You disobeyed your Lord, and your wife is fully divorced from you”: For Hanafis, innovated divorce violates the two Sunnah forms: pronouncing three divorces in one statement or separately in one clean period, two divorces similarly, one divorce during menstruation, in a clean period with prior intercourse, or after intercourse in the following menstruation. If done, the divorce occurs, and he sins. Its occurrence, number, and sinfulness are disputed. The Imamiyyah say three in one statement or during menstruation do not occur. Tawus, Muhammad ibn Ishaq, Al-Hajjaj ibn Artat, An-Nakha‘i, Ibn Muqatil, and Az-Zahiriyyah say three together count as one. The majority of Successors and later scholars, including Al-Awza‘i, An-Nakha‘i, Ath-Thawri, Abu Hanifah and his companions, Malik and his companions, Ash-Shafi‘i and his companions, Ahmad and his companions, Ishaq, Abu Thawr, Abu Ubayd, and others, say three divorces occur, but he sins. Those who differ are considered anomalous, opposing the Sunnah people. Ash-Shafi‘i disregards the number, requiring only a clean period without intercourse. If three or two are pronounced, it is not innovated. Malik recognizes only one divorce as Sunnah and dislikes three, together or separate. Hanafis dislike more than one in a clean period, but not if separate across clean periods. On whether three in one statement is sinful, Ash-Shafi‘i says all divorce is permissible as a legislated act, incompatible with prohibition, unlike divorce during menstruation, where the prohibition is extending the waiting period, not the divorce. For us, innovated divorce occurs and is sinful, as its default is prohibition for severing marriage, which holds religious and worldly benefits. Permissibility is for need of escape. No need exists for combining three, but separate across clean periods is valid per evidence, as the need persists. Its permissibility as bondage removal does not negate prohibition for losing religious and worldly benefits. This was discussed under “The most hated of lawful things to Allah is divorce”. Our evidence is “Divorce is twice…” to “And if he has divorced her…”, implying no lawful divorce except thus, as it restricts the category. No divorce is legislated as three at once. One might assume it does not occur, per the Imamiyyah, but since its illegitimacy is for external reasons (forfeiting its legislated purpose) and regret allows mitigation, it may harm himself or not. Further evidence includes Ibn Abbas’s statement to one who divorced thrice, “You disobeyed your Lord,” Abdur-Razzaq’s narration from Ubadah ibn as-Samit, “She is fully divorced by three in disobedience,” At-Tahawi’s from Malik ibn al-Harith, and An-Nasa’i’s from Mahmoud ibn Labid, as in Al-Marqah, Umdat al-Qari, and Hidayah (summarized).

1 قوله: عصيت ربك وبانت منك امرأتك وعند الحنفية طلاق البدعة ما خالف قسمي السنة، وذلك بأن يطلقها ثلاثا بكلمة واحدة أو مفرقة في طهر واحد أو اثنتين كذلك، أو واحدة في الحيض أو في طهر قد جامعها فيه أو جامعها في الحيض الذي يليه هو، فإذا فعل ذلك وقع الطلاق، وكان عاصيا، وفي كل من وقوعه وعدده، وكونه معصية خلاف، فعن الإمامية لا يقع بلفظ الثلاث، ولا في حالة الحيض، وذهب طاوس ومحمد بن إسحاق والحجاج بن أرطاة والنخعي وابن مقاتل والظاهرية إلى أن الرجل إذا طلق امرأته ثلاثا معا فقد وقعت عليها واحدة، ومذهب جماهير العلماء من التابعين ومن بعدهم، منهم الأوزاعي والنخعي والثوري وأبو حنيفة وأصحابه ومالك وأصحابه والشافعي وأصحابه وأحمد وأصحابه وإسحاق وأبو ثور وأبو عبيد وآخرون كثيرون على أن من طلق امرأته ثلاثا وقعن، ولكنه يأثم وقالوا : من خالف فيه فهو شاذ مخالف لأهل السنة.

وعند الشافعي لا عبرة بالعدد في الطلاق، وإنما السنة أن يطلقها في طهر لا وطئ فيه، فإن طلق فيه ثلاثا أو اثنين لم يكن بدعيا، وقال مالك بن أنس: لا أعرف الطلاق السني إلا واحدة، وكان يكره الثلاث، مجموعة كانت أو متفرقة، وأما أبو حنيفة وأصحابه فإنما كرهوا ما زاد على الواحدة في طهر واحد، فأما متفرقا في الأطهار فلا. ثم عند الشافعي لا بأس بإرسال الثلاث، وقال: لا أعرف في عدد الطلاق سنة ولا بدعة، وهو مباح، فمالك لله يراعي في طلاق السني الواحدة والوقت، والشافعي الله يراعي الوقت وحده. وأما المقام الثالث، وهو كون الثلاث بكمة واحدة معصية أولا، فقال الشافعي الله كل طلاق مباح؛ لأنه تصرف مشروع حتى يستفاد به الحكم والمشروعية لا تجامع الحظر، بخلاف الطلاق في حالة الحيض؛ لأن المحرم تطويل العدة عليها لا الطلاق.

وعندنا يقع الطلاق البدعي، وهو أئم؛ لأن الأصل في الطلاق عندنا هو الحظر؛ لما فيه من قطع النكاح الذي تعلقت به المصالح الدينية والدنياوية والإباحة للحاجة إلى الخلاص، ولا حاجة إلى الجمع بين الثلاث، وهي في المفترق على الأطهار ثابتة نظرا إلى دليلها والحاجة في نفسها باقية، فأمكن تصوير الدليل عليها، والمشروعية في ذاته من حيث إنه إزالة الرق لا تنافي الحظر لمعنى في غيره، وهو ما ذكرناه من فوات مصالح الدين والدنيا، وقد مر الكلام فيه في حديث: أبغض الحلال إلى الله الطلاق مستوفى فليرجع إليه.

ولنا أيضًا قوله تعالى جل جلاله الطلاق مرتان إلى أن قال: فإن طلقها فلزم أن لا طلاق شرعا إلا كذلك؛ لأنه ليس وراء الجنس شيء، وهذا من طرق الحصر فلا طلاق مشروع ثلاثا بمرة واحدة، وكان يتبادر أن لا يقع شيء كما قالت الإمامية، لكن لما علمت أن عدم مشرعيته كذلك لمعنى في غيره، وهو تفويت معنى شرعيته سبحانه له كذلك، وإمكان التدارك عند الندم قد يعود ضرره على نفسه، وقد لا ، ولنا أيضًا ما ذكر في الكتاب من قول ابن عباس للذي طلق ثلاثا، وجاء يسأل عصيت ربك، وكذا ما حدث عبد الرزاق من عبادة بن الصامت حيث قال : بانت بثلاث في معصية، وكذا ما حدث الطحاوي عن مالك بن الحارث، وما روى النسائي عن محمود بن لبيد المرقات» و «عمدة القاري والهداية» ملتقط منها.

وَعَنْ عَبْدِ اللهِ ابْنِ عُمَرَ (رضي الله عنهما) أَنَّهُ طَلَّقَ وَهِيَ حَائِضُ فَذَكَرَ عُمَرُ لِرَسُولِ الله ﷺ فَتَغَيَّظَ فِيهِ رَسُولُ اللهِ ﷺ ثُمَّ قَالَ: «لِيُرَاجِعْهَا ثُمَّ يُمْسِكْهَا حَتَّى تَطْهُرَ، ثُمَّ تَحِيضَ فَتَطْهُرَ، فَإِنْ بَدَا لَهُ أَنْ يُطَلَّقَهَا فَلْيُطَلَّقْهَا طَاهِرًا قَبْلَ أَنْ يَمَسَّهَا، فَتِلْكَ الْعِدَّةُ الَّتِي أَمَرَ الله أَنْ تُطَلَّقَ لَهَا النِّسَاءُ». مُتَّفَقٌ عَلَيْهِ. وَقَالَ الْعَلَامَةُ الْعَيْنِي فِيْهِ الْمُشَارُ إِلَيْهَا حَالَةُ الْحَيْضِ، وَاللَّامُ فِي لَهَا لِلْعَاقِبَةِ، يَعْنِي الاسْتِقْبَالِ، كَمَا فِي قَوْلِهِمْ: تَأَهَبْ لِلشَّتَاءِ. وَفِي رِوَايَةٍ لَهُمَا: مُرْهُ فَلْيُرَاجِعْهَا ثُمَّ لِيُطَلِّقُهَا طَاهِرًا أَوْ حَامِلًا.

English

Abdullah ibn Umar (may Allah be pleased with them) narrated that he divorced his wife while she was menstruating. Umar mentioned this to the Messenger of Allah (ﷺ), who became angry and said, “Let him take her back and keep her until she becomes clean, then menstruates, then becomes clean. If he wishes to divorce her, let him divorce her while clean before touching her. That is the waiting period Allah commanded for women to be divorced.” Agreed upon. Al-Allamah Al-Ayni said: The reference is to the state of menstruation, and the lam in “laha” (for her) indicates consequence, meaning the future, as in “Prepare for winter.” In another narration by both: “Order him to take her back, then divorce her while clean or pregnant.”

This Hadith indicates occurrence and encourages revocation. Some scholars say revocation is recommended, but the most correct view is that it is obligatory to act on the command’s reality and mitigate sin by lifting its effect (the waiting period) and avoiding harm from extending it. When she becomes clean, menstruates, then becomes clean, he may divorce or keep her. Hidayah cites Muhammad in Al-Asl (Al-Mabsut). At-Tahawi says he divorces her in the clean period following the first menstruation. Abu al-Hasan al-Karkhi says At-Tahawi’s view is Abu Hanifah’s, while Al-Asl’s is Abu Hanifah’s and his companions’. Al-Asl’s rationale is that Sunnah divorce requires a menstruation between divorces. Here, part of a menstruation separates, completed by the second, ensuring the second clean period is Sunnah-compliant. If by menstruations, divorce would be commanded during menstruation, which is not so. We respond: For us, the reference is menstruation, and we do not concede “laha” means “in”. It indicates consequence (future), as in “Prepare for winter” or “Three days remain of the month,” meaning future. Az-Zamakhshari says on “So divorce them at their prescribed periods” [At-Talaq: 1], it means facing their waiting periods, as in Al-Marqah and Umdat al-Qari (summarized). 2 The statement: “Then divorce her while clean or pregnant”: Ash-Shafi‘i say this Hadith indicates menstruation and pregnancy can coincide, and a pregnant woman’s divorce is permissible if menstruating, as her waiting period (delivery) is not extended. قوله : فتلك العدة إلخ فيه المشار إليها عند الشافعية حالة الطهر، واللام في «لها» بمعنى «في»، فتكون حجة لما ذهب إليه الشافعي من أن العدة بالأطهار؛ إذ لو كانت بالحيض يلزم أن يكون الطلاق مأمورا به فيه، وليس كذلك، وأجيب بأن المشار إليها عندنا حالة الحيض، ولا نسلم أن اللام هنا بمعنى «في»، بل للعاقبة أي للاستقبال، كما في قولهم: تأهب للشتاء، وكما في قولهم: لثلاث بقين من الشهر، أي مستقبلا لثلاث، وقال الزمخشري في قوله تعالى: فطلقوهن لعدتهن يعني مستقبلات لعدتهن المرقات» و «عمدة القاري» ملتقط منهما.

۲ قوله : ثم ليطلقها طاهرا أو حاملا : قالت الشافعية: دل هذا الحديث على اجتماع الحيض والحبل، وقيل: الحامل إذا كانت حائضة حل طلاقها؛ إذ لا تطويل في العدة في حقها؛ لأن عدتها بوضع الحمل، وعندنا أن الحامل لا تحيض، وما رأته من الدم فهو استحاضة. قلت: لا دليل في الحديث على أن الحامل تحيض، بل فيه دليل على أنها لا تحيض، فإنه سوى في جواز إيقاع الطلاق بين الطاهرة والحاملة، وقد تقدم أن طلاقه الحائضة بدعة، فقد علم منه أن الحامل لا تحيض، ولأجل ذلك سواه بالطاهرة، قاله في بذل المجهود.

وَرَوَى عَبْدُ الرَّزَّاقِ عَنْ مَعْمَرٍ عَنِ الزُّهْرِيِّ أَنَّهُ قَالَ فِي رَجُلٍ قَالَ: كُلُّ امْرَأَةٍ أَتَزَوَّجُهَا فَهِيَ طَالِقُ وَكُلُّ أَمَةٍ أَشْتَرِيْهَا فَهِيَ حُرَّةٌ : هُوَ كَمَا قَالَ. فَقَالَ لَهُ مَعْمَرُ: أَوَ لَيْسَ قَدْ جَاءَ: «لَا طَلَاقَ قَبْلَ نِكَاحٍ وَلَا عِنْقَ إِلَّا بَعْدَ مِلْكٍ؟ قَالَ: إِنَّمَا ذَلِكَ أَنْ يَقُوْلَ الرَّجُلُ: امْرَأَةُ فُلَانٍ طَالِقٌ، وَعَبْدُ فُلَانٍ حُرٌّ وَحَكَى أَبُو بَكْرٍ الرَّازِيُّ عَنِ الزُّهْرِيِّ قَالَ: قَوْلُهُ: «لَا طَلَاقَ قَبْلَ نِكَاح، هُوَ الرَّجُلُ يُقَالُ لَهُ تَزَوَّجْ فُلَانَةً فَيَقُوْلُ: هِيَ طَالِقُ، فَهَذَا لَيْسَ بِشَيْءٍ، فَأَمَّا مَنْ قَالَ: إِنْ تَزَوَّجْتُ فُلَانَةً فَهِيَ طَالِقُ، فَإِنَّمَا طَلَّقَهَا حِيْنَ تَزَوَّجَهَا.

وَرَوَى ابْنِ أَبِي شَيْبَةَ عَنْ سَالِمٍ وَالْقَاسِمِ بْنِ مُحَمَّدٍ وَعُمَرَ بْنِ عَبْدِ الْعَزِيزِ وَالشَّعْبِيِّ وَالنَّخَعِيِّ وَالزُّهْرِيِّ وَالْأَسْوَدِ وَأَبِي بَكْرِ بْنِ عَمْرِو بْنِ حَرْمٍ وَأَبِي بَكْرِ بْنِ عَبْدِ الرَّحْمَنِ وَعَبْدِ الله بْنِ عَبْدِ الرَّحْمَنِ وَمَكْحُوْلِ الشَّامِي فِي رَجُلٍ قَالَ: إِنْ تَزَوَّجْتُ فُلَانَةً فَهِيَ طَالِقُ أَوْ يَوْمَ أَتَزَوَّجُهَا فَهِيَ طَالِقُ أَوْ كُلُّ امْرَأَةٍ أَتَزَوَّجُهَا فَهِيَ طَالِقٌ. قَالُوا: هُوَ كَمَا قَالَ، وَفِي لَفْظ يَجُوْزُ عَلَيْهِ ذَلِكَ.

English

Malik narrated from Mujbir from Abdullah ibn Umar (may Allah be pleased with them) that he said: If a man says, “If I marry so-and-so, she is divorced,” it is as he said upon marrying her. If he divorced her one, two, or three times, it is as he said. Narrated by Muhammad in Al-Muwatta.

Abdur-Razzaq narrated from Ma‘mar from Az-Zuhri that he said about a man who said, “Every woman I marry is divorced, and every slave I buy is free,” it is as he said. Ma‘mar said, “Is it not reported: ‘No divorce before marriage, no emancipation before ownership’?” He said, “That applies to a man saying, ‘So-and-so’s wife is divorced,’ or ‘So-and-so’s slave is free.’” Abu Bakr ar-Razi narrated from Az-Zuhri: The saying, “No divorce before marriage,” refers to a man told, “Marry so-and-so,” who says, “She is divorced,” which is nothing. But if he says, “If I marry so-and-so, she is divorced,” he divorces her upon marrying her.

Ibn Abi Shaybah narrated from Salim, Al-Qasim ibn Muhammad, Umar ibn Abdul-Aziz, Ash-Sha‘bi, An-Nakha‘i, Az-Zuhri, Al-Aswad, Abu Bakr ibn Amr ibn Harm, Abu Bakr ibn Abdur-Rahman, Abdullah ibn Abdur-Rahman, and Mak-hul ash-Shami about a man who said, “If I marry so-and-so, she is divorced,” or “The day I marry her, she is divorced,” or “Every woman I marry is divorced.” They said, “It is as he said,” or in some wording, “It applies to him.”

3 The statement: “If a man says…”: Based on these narrations, Hanafis say that attaching divorce to the cause of ownership is valid. If he says to a non-wife, “If I marry you, you are divorced,” and marries her, the divorce occurs. Ash-Shafi‘i says this condition is invalid, and no divorce occurs, as a condition is like an immediate act. Just as immediate divorce is invalid without ownership, a condition is too. The response is that the condition “If I marry you, you are divorced” exists now, but the divorce occurs when the condition (marriage) is met, when ownership is established, unlike “If you enter the house, you are divorced,” where ownership is absent now and later, so no divorce occurs, as with immediate divorce of a non-wife. Thus, Ash-Shafi‘i’s use of “No divorce before marriage” is invalid. His other Hadiths are weak, per Tanzih’s author, who says they are false, with some narrators being fabricators or thieves. Our view is supported by Sa‘id ibn al-Musayyib, Ata, Hammad ibn Abi Sulayman, and Shurayh (may Allah have mercy on them). If argued that interpreting it as immediate is meaningless, as all know it, so it must mean conditions, the response is that it became clear after the Shariah’s ruling was established. In the pre-Islamic era, they pronounced immediate divorce before marriage, counting it as divorce upon marriage. The Shariah negated this in “No divorce before marriage” and other Hadiths, as in At-Taliq al-Mumajjad, Umdat ar-Ri‘ayah, and Fath al-Qadir (summarized). In Umdat al-Qari, Bukhari says: “Chapter: No divorce before marriage,” meaning no divorce before marriage exists. Al-Kirmani says Hanafis uphold divorce before marriage, and Bukhari refutes them. I say: Hanafis do not say divorce occurs before marriage, a view held by none. It is surprising that Al-Kirmani and his supporters say this, refuting them baselessly. Their argument hinges on conditions, e.g., a man saying to a non-wife, “If I marry you, you are divorced,” and upon marrying her, divorce occurs for Hanafis, contrary to Ash-Shafi‘i. This was discussed earlier, as was the dispute on sale and vows.

فنفى ذلك في الشرع في حديث لا طلاق قبل النكاح وغيره، التعليق الممجد» و«عمدة الرعاية» و«فتحالقدير ملتقط منها، وقال في عمدة القاري: قال البخاري : باب لا طلاق قبل النكاح: أي هذا باب في بيان أنه لا طلاق قبل وجود النكاح، وقال الكرماني: مذهب الحنفية صحة الطلاق قبل النكاح، فأراد البخاري الرد عليهم. قلت: لم تقل الحنفية: إن الطلاق يقع قبل وجود النكاح، وليس هذا بمذهب لأحد، فالعجب من الكرماني ومن وافقه في كلامه هذا، كيف يصدر منهم مثل هذا الكلام، ثم يردون به عليهم من غير وجه، وإنما وتشبثهم في هذا بمسألة التعليق، وهي ما إذا قال رجل لأجنبية: إذا تزوجتك فأنت طالق، فإذا تزوجها يقع الطلاق عند الحنفية، خلافًا للشافعية انتهى. وقدمنا الكلام عليه آنفا، وكذا الاختلاف في البيع والنذر.

وَعَنْ رُكَانَةَ بْنَ عَبْدِ يَزِيدَ (رضي الله عنه) أَنَّهُ طَلَّقَ امْرَأَتَهُ سُهَيْمَةَ الْبَتَّةَ، فَأَخْبَرَ النَّبِيَّ ﷺ بِذَلِكَ وَقَالَ: وَالله مَا أَرَدْتُ إِلَّا وَاحِدَةً، فَقَالَ رَسُولُ اللهِ ﷺ: وَالله مَا أَرَدْتَ إِلَّا وَاحِدَةً؟» فَقَالَ رُكَانَةُ: وَاللهِ مَا أَرَدْتُ إِلَّا وَاحِدَةً، فَرَدَّهَا ۱ إِلَيْهِ رَسُولُ اللهِ ، فَطَلَّقَهَا الثَّانِيَةَ فِي زَمَانِ عُمَرَ، وَالثَّالِثَةَ فِي زَمَانِ عُثْمَانَ. رَوَاهُ أَبُو دَاوُدَ وَالتَّرْمِذِيُّ وَابْنُ مَاجَهِ وَالدَّارِمِيُّ إِلَّا أَنَّهُمْ لَمْ يَذْكُرُوا الثَّانِيَةَ وَالثَّالِثَةَ.

وَقَالَ عَلَى الْقَارِي: أَيْ رَدَّهَا بِتَجْدِيدِ النِّكَاحِ، وَيُؤَيِّدُهُ مَا رَوَاهُ مُحَمَّدُ فِي الْآثَارِ» عَنْ إِبْرَاهِيمَ فِي الْخَلِيَّةِ وَالْبَرِيَّةِ وَالْبَائِنِ وَالْبَيَّةِ إِنْ نَوَى طَلَاقًا فَهُوَ مَا نَوَى، وَإِنَّ نَوَى ثَلَاثًا فَثَلَاثُ، وَإِنْ وَاحِدَةً فَوَاحِدَةٌ بَائِنٌ، وَهُوَ خَاطِبٌ، وَإِنْ لَمْ يَنْوِ طَلَاقًا فَلَيْسَ بِشَيْءٍ.

English

Rukanah ibn Abd Yazid (may Allah be pleased with him) narrated that he divorced his wife Suhaymah finally and informed the Prophet (ﷺ), saying, “By Allah, I intended only one.” The Messenger of Allah (ﷺ) said, “By Allah, you intended only one?” Rukanah said, “By Allah, I intended only one.” The Messenger of Allah (ﷺ) returned her to him. He divorced her a second time in Umar’s era and a third in Uthman’s. Narrated by Abu Dawud, Tirmidhi, Ibn Majah, and Ad-Darimi, though they did not mention the second and third.

Ali al-Qari said: He returned her by renewing the marriage, supported by Muhammad’s narration in Al-Athar from Ibrahim on khaliyyah, bariyyah, bain, and bayyah: If he intended divorce, it is as intended. If three, then three; if one, then one final divorce, and he is a suitor. If he did not intend divorce, it is nothing.

وَعَنْ أَبِي هُرَيْرَةَ(رضي الله عنه) أَنَّ رَسُولَ اللهِ ﷺ قَالَ: ثَلَاثُ جِدُّهُنَّ جِدٌ وَهَزْلُهُنَّ جِد: النِّكَاحُ وَالطَّلَاقُ وَالرَّجْعَةُ». رَوَاهُ التَّرْمِذِيُّ وَأَبُو دَاوُدَ. وَقَالَ التَّرْمِذِيُّ: هَذَا حَدِيثُ حَسَنُ غَرِيبٌ.

Abu Hurairah (may Allah be pleased with him) narrated that the Messenger of Allah (ﷺ) said, "Three matters are serious in their seriousness and joking in their joking: marriage, divorce, and taking back (the wife)." [Narrated by Tirmidhi and Abu Dawud]

وَعَنْ صَفْوَانَ بْنِ عُمَرَ الطَّائِيِّ (رضي الله عنه)، أَنَّ امْرَأَةً كَانَتْ تُبْغِضُ زَوْجَهَا فَوَجَدَتْهُ نَائِمًا أَخَذَتْ شَفْرَةً وَجَلَسَتْ عَلَى صَدْرِهِ، ثُمَّ حَرَّكَتْهُ وَقَالَتْ: لَتُطَلِّقُنِي ثَلَاثًا أَوْ لَأَذْبَحَنَّكَ، فَنَاشَدَهَا الله فَأَبَتْ فَطَلَّقَهَا ثَلَاثًا، وَجَاءَ إِلَى رَسُولِ اللهِ ﷺ فَسَأَلَهُ عَنْ ذَلِكَ، فَقَالَ رَسُولُ اللهِ : «لَا قَيْلُولَةً فِي الطَّلَاقِ. رَوَاهُ مُحَمَّدُ بِإِسْنَادِهِ.

وَرَوَى عَبْدُ الرَّزَّاقِ عَنِ ابْنِ عُمَرَ ما أَنَّهُ أَجَازَ طَلَاقَ الْمُكْرَهِ.

Safwan ibn ‘Umar at-Ta’i (may Allah be pleased with him) narrated that a woman who disliked her husband found him asleep, took a blade, sat on his chest, shook him, and said, "Divorce me three times, or I will slaughter you!" He pleaded with her by Allah, but she refused, so he divorced her three times. He then went to the Messenger of Allah (ﷺ) and asked him about it. The Messenger of Allah (ﷺ) said, "There is no consideration for divorce under coercion." [Narrated by Muhammad with his chain]

Abdur-Razzaq narrated from Ibn ‘Umar that he permitted the divorce of one compelled.

Abu Hurairah (may Allah be pleased with him) narrated that the Messenger of Allah (ﷺ) said, "Every divorce is valid except the divorce of an insane person overwhelmed by his lack of reason." [Narrated by Tirmidhi, who said: This is a gharib hadith.]

1 The statement: "There is no consideration for divorce under coercion", Ash-Shafi’i adhered to the hadith of compulsion and said: Divorce and emancipation under coercion do not occur. According to us, these are valid based on these narrations and by analogy to their validity in jest. The foundational principle in our view is that any contract that cannot be annulled is not prevented from taking effect due to coercion. Likewise, whatever is valid in jest is also valid under coercion, as mentioned in Al-Luma’at. Therefore, Al-Hidayah states: "The divorce of a coerced person is effective, contrary to Ash-Shafi’i’s view."

2 The statement: "Narrated by Muhammad with his chain", In Musannaf Ibn Abi Shaybah, it is mentioned that Ash-Sha’bi considered the divorce of a coerced person permissible. The same was said by Ibrahim, Abu Qilabah, Ibn Mas’ud, and Shurayh. Ibn Hazm also reported that it was authentically narrated from Az-Zuhri, Qatadah, Sa’id ibn Jubayr, and others. Abu Hanifah and his companions adopted this view. Al-Faraj ibn Fadalah narrated from ‘Amr ibn Sharahbil that a woman coerced her husband to divorce her, so he divorced her, and ‘Umar upheld the divorce. A similar narration is reported from Ibn ‘Umar and ‘Umar ibn ‘Abd al-‘Aziz, as mentioned in ‘Umdat al-Qari’.

3 The statement: "Except the divorce of an insane person...", This refers to the divorce of a ma’tuh (mentally deficient). Here, ma’tuh refers to an insane person, not the commonly understood meaning of one lacking maturity or experience. Rather, it denotes a severe mental disorder. This is mentioned in Al-Bahr as the definition of insanity. It includes the ma’tuh, and the best distinction between the two is that a ma’tuh is one with weak comprehension, incoherent speech, and poor judgment, but he does not strike or insult, unlike an insane person. This is cited in Ar-Radd al-Muhtar and Al-Kawkab ad-Durri, derived from both.

2 The statement: "If an intoxicated person divorces, his divorce is valid", This means the divorce of an intoxicated person is effective according to us. This is also Ash-Shafi’i’s view in his most authentic opinion. Al-Karkhi and At-Tahawi preferred that it is not valid, which is one of Ash-Shafi’i’s two opinions, because sound intention requires sanity, which is absent in intoxication, similar to anesthesia or medication. Our evidence is that intoxication results from a sinful cause (consuming intoxicants), so it is treated as if the person is still accountable to deter him. If someone drinks and becomes intoxicated, losing his sanity due to the intoxication, we say his divorce is not valid. This is mentioned in Al-Hidayah and Fath al-Qadir, derived from both.

The divorce of a free woman is three, whether her husband is free or a slave. Ash-Shafi’i said: "The number of divorces depends on the status of the men, based on the verse: 'Divorce is twice...' (2:229)." Our evidence is this hadith, and the interpretation of what Ash-Shafi’i cited is that the execution is related to the men, as mentioned in Al-Hidayah.

4 The statement: "Her waiting period is two menstrual cycles", Al-Hidayah states: "If she is a slave, her waiting period is two menstrual cycles, based on this hadith. This is because slavery reduces the waiting period by half, and a menstrual cycle cannot be divided, so it is completed as two cycles." ‘Umar (may Allah be pleased with him) alluded to this by saying, "If I could, I would have made it one and a half cycles." Al-Maraqi states: "The apparent meaning of the hadith indicates that the waiting period is based on the woman’s status, not the freedom or slavery of the husband, as is our view. It also shows that the waiting period is based on menstruation."

وَرَوَى عَبْدُ الرَّزَّاقِ عَنْ جَابِرِ بْنِ عَبْدِ الله أَنَّهُ قَالَ: إِذَا خَيَّرَ الرَّجُلُ امْرَأَتَهُ، فَلَمْ تَخْتَرْ في مَجْلِسِهَا ذَلِكَ فَلَا خِيَارَ لَهَا.

وَرَوَى الطَّبَرَانِيُّ عَنِ ابْنِ مَسْعُوْدٍ الله وَابْن أَبِي شَيْبَةَ عَنْ عُمَرَ وَعُثْمَانَ نَحْوَهُ، وَقَالَ التَّرْمِذِيُّ: رُوِيَ عَنْ عُمَرَ وَعَبْدِ اللهِ بْن مَسْعُودٍ أَنَّهُمَا قَالَا: إِنَّ اخْتَارَتْ نَفْسَهَا فَوَاحِدَةٌ بَائِنَةٌ.

‘Aishah (may Allah be pleased with her) said, "The Messenger of Allah (ﷺ) gave us the choice, and we chose Allah and His Messenger, so he did not count that as anything (against us)." [Agreed upon]

Abdur-Razzaq narrated from Jabir ibn ‘Abdullah that he said, "If a man gives his wife the choice and she does not make a choice in that sitting, she has no choice afterward."

At-Tabarani narrated from Ibn Mas’ud, and Ibn Abi Shaybah narrated from ‘Umar and ‘Uthman a similar report. Tirmidhi said: "It is narrated from ‘Umar and ‘Abdullah ibn Mas’ud that they said, 'If she chooses herself, it is one irrevocable divorce.'"

5 The statement: "He did not count that as anything", This means it was not counted as a divorce, neither three, nor one, nor an irrevocable or revocable divorce. This was the view of most Companions, and Abu Hanifah and Ash-Shafi’i held this opinion. This hadith refutes those who say that if a woman is given the choice and chooses her husband, it counts as one revocable divorce. Malik held this view. Ibn al-Humam said: "The one given the choice has the choice in that sitting by the consensus of the Companions." Al-Mudhaffar said: "If a man says to his wife, 'Choose between yourself and me,' and she says, 'I choose you' or 'I choose myself,' it results in a revocable divorce according to Ash-Shafi’i and an irrevocable divorce according to Abu Hanifah. Our evidence is the statement of ‘Umar and ‘Abdullah ibn Mas’ud." Tirmidhi said: "Most scholars and jurists from the Companions and those after them in this matter followed the opinion of ‘Umar and ‘Abdullah, which is also the view of Ath-Thawri and the people of Kufa." This is taken from Al-Maraqi and Jami’ at-Tirmidhi.

وَعَنِ ابْنِ عَبَّاسٍ (رضي الله عنهما) قَالَ: إِذَا حَرَّمَ الرَّجُلُ عَلَيْهِ امْرَأَتَهُ فَهِيَ يَمِينُ يُكَفِّرُهَا، وَقَالَ: لَقَدْ كَانَ لَكُمْ فِي رَسُولِ الله أُسْوَةٌ حَسَنَةٌ. مُتَّفَقٌ عَلَيْهِ.

Ibn ‘Abbas (may Allah be pleased with him) said, "If a man declares his wife unlawful for him, it is an oath for which he must make expiation." He then said, "There has certainly been for you in the Messenger of Allah an excellent example." [Agreed upon]

If he did not intend anything, there are two opinions from Ash-Shafi’i: one is that he must make expiation for the oath, and the other is that there is no consequence, as it is meaningless and does not entail any rulings. A group held that it is an oath. If a man says this to his wife or female slave, he does not owe expiation unless he has intercourse with her, just as if he swore not to have intercourse with her. If he prohibits food, it is like swearing not to eat it, so he owes no expiation unless he eats it. This was the view of Abu Hanifah and his companions, as mentioned in Al-Khazin.

This narration supports our view. Al-Kamalayn states: *"Our Imam Abu Hanifah used the verse, 'Allah has already ordained for you the dissolution of your oaths...' (66:2), as evidence that declaring the lawful unlawful is an oath, as Allah called tahrim an oath, necessitating expiation according to Abu Hanifah, contrary to Ash-Shafi’i. It was responded that the obligation of expiation does not necessarily mean it is an oath, as it is possible that Allah used the term 'oath' metaphorically. ‘Abdur-Razzaq narrated from Ash-Sha’bi that a man swore an oath along with tahrim, and Allah rebuked him for the tahrim and prescribed expiation for the oath. Qatadah said, 'He declared her unlawful, and it was an oath.' Ash-Sha’bi’s statement aligns with Ash-Shafi’i’s view, while Qatadah’s supports our view, which is the apparent meaning of the Qur’an."*

1 قوله : إذا حرم الرجل امرأته فهي يمين يكفرها إلخ : اختلف العلماء في لفظ التحريم ، فقيل : ليس هو بيمين فإن قال لزوجته: أنت علي حرام أو قال: حرمتك، فإن نوى طلاقا فهو طلاق، وإن نوى ظهارا فظهار، وإن نوى تحريم ذاتها أو أطلق فعليه كفارة اليمين بنفس اللفظ، وإن قال : ذلك الجاريته، فإن نوى عتقا عتقت، وإن نوى تحريم ذاتها أو أطلق فعليه كفارة اليمين، وإن قال لطعام: حرمته على نفسي فلا شيء عليه ذهب الشافعي وإن لم ينو شيئًا، ففيه قولان للشافعي، أحدهما : أنه يلزمه كفارة اليمين، والثاني: لا شيء عليه وأنه لغو، فلا يترتب عليه شيء من الأحكام، وذهب جماعة إلى أنه يمين، فإن قال ذلك لزوجته أو جاريته، فلا تجب عليه الكفارة ما لم يقربها، كما لو حلف أنه لا يطؤها، وإن حرم طعاما فهو كما لو حلف أن لا يأكله فلا كفارة عليه ما لم يأكله، وإليه ذهب أبو حنيفة وأصحابه، كذا في الخازن». قلت: يؤيدنا هذا الأثر، وقال في الكمالين»: استدل بقوله تعالى : قد فرض الله لكم تحلة أيمانكم إمامنا أبو حنيفة الله أن تحريم الحلال يمين حيث سمى تحريم يمينا، فليزم فيه الكفارة عند أبي حنيفة ، خلافا للشافعي، وأجيب بأنه لا يلزم من وجوب الكفارة كونه يميناً لاحتمال أنه الله أتى بلفظ اليمين، وروى عبد الرزاق عن الشعبي وحلف بيمين مع التحريم، فعاتبه الله في التحريم، وجعل له كفارة اليمين وقال قتادة حرمها فكانت يمينا، فقول الشعبي يوافق مذهب الشافعي وقول قتادة يؤيد قولنا ، وهو ظاهر القرآن، ويؤيده أيضًا أخرجه الحاكم عن ابن عباس أنه جاءه رجل، فقال: جعلت امرأتي علي حراما، قال: عليك أغلظ كفارة، أعتق رقبة، وتلا الآية.

وَعَنْ أَنَسٍ(رضي الله عنه) ، أَنَّ رَسُولَ اللهِ ﷺ كَانَتْ لَهُ أَمَةٌ يَطَوُّهَا فَلَمْ تَزَلْ بِهِ عَائِشَةُ وَحَفْصَةُ حَتَّى حَرَّمَهَا عَلَى نَفْسِهِ، فَأَنْزَلَ اللهُ عَزَّ وَجَلَّ يَتَأَيُّهَا النَّبِيُّ لِمَ تُحَرِّمُ مَا أَحَلَّ الله لَكَ إِلَى آخِرِ الْآيَةِ (التحريم: (( رَوَاهُ النَّسَائِيُّ، وَرَوَى عَبْدُ الرَّزَّاقِ عَنْ قَتَادَةَ أَنَّهُ قَالَ: حَرَّمَهَا، فَكَانَتْ يَمِينًا.

English

Anas (may Allah be pleased with him) narrated that the Messenger of Allah (ﷺ) had a slave woman whom he would visit. ‘Aishah and Hafsah kept pressuring him until he declared her unlawful for himself. Then Allah revealed: "O Prophet, why do you prohibit what Allah has made lawful for you?" (66:1) to the end of the verse. [Narrated by Nasa’i]

Abdur-Razzaq narrated from Qatadah that he said, "He declared her unlawful, and it was an oath."

وَعَنْ عَائِشَةَ (رضي الله عنها) أَنَّ النَّبِيَّ ﷺ كَانَ يَمْكُثُ عِنْدَ زَيْنَبَ بِنْتِ جَحْشٍ، وَيَشْرَبُ عِنْدَهَا عَسَلًا، فَتَوَاصَيْتُ أَنَا وَحَفْصَهُ أَنَّ أَيَّتَنَا دَخَلَ عَلَيْهَا النَّبِيُّ ﷺ فَلْتَقُلْ: إِنِّي أَجِدُ مِنْكَ رِيحَ مَغَافِيرَ ، أَكَلْتَ مَغَافِيرَ ، فَدَخَلَ عَلَى إِحْدَاهُمَا فَقَالَتْ لَهُ ذَلِكَ، فَقَالَ: لَا ، بَلْ شَرِبْتُ عَسَلًا عِنْدَ زَيْنَبَ بِنْتِ جَحْشٍ، وَلَنْ أَعُودَ لَهُ، فَنَزَلَتْ: يَأَيُّهَا النَّبِيُّ لِمَ تُحَرِّمُ مَا أَحَلَّ الله لَكَ الْآيَةَ. رَوَاهُ الْبُخَارِيُّ.

English

‘Aishah (may Allah be pleased with her) narrated that the Prophet (ﷺ) would stay with Zaynab bint Jahsh and drink honey at her place. She and Hafsah agreed that whichever of them the Prophet (ﷺ) visited would say, "I detect the smell of maghafir (a foul-smelling gum) on you. Have you eaten maghafir?" When he visited one of them, she said this to him. He replied, "No, I drank honey at Zaynab bint Jahsh’s, but I will not do it again." Then the verse was revealed: "O Prophet, why do you prohibit what Allah has made lawful for you?" (66:1) [Narrated by Bukhari]

3 The statement: "And those who declare their wives unlawful...", This verse establishes the ruling for zihar. "Then retract what they said" means they retract their declaration by resolving to have intercourse, omitting the implied object. Scholars differed on how retraction occurs. According to us, it is by resolving to have intercourse, the view of Ibn ‘Abbas, Al-Hasan, and Qatadah. Ash-Shafi’i said it is by merely retaining the wife without divorcing her after zihar.

4 The statement: "Must free a slave", They must free a believing or disbelieving slave. A mudabbar (slave to be freed after death), umm walad (mother of the master’s child), or a mukatab (slave buying his freedom) who has paid part is not valid. "Before they touch one another" refers to the one who made zihar and the one over whom zihar was made. "Touch" includes intercourse, touching with desire, or looking at the private parts with desire. That ruling is admonished to deter repetition. "Allah is Aware of what you do" (58:3). If they touch before expiation, they must seek forgiveness and not repeat it until expiation is made. If they free part of a slave and then touch, they must start over according to Abu Hanifah. "But whoever cannot find one" (58:4) a slave "must fast two consecutive months" before touching. "And whoever is unable" to fast "must feed sixty poor people" (58:4), giving each half a sa’ of wheat or one sa’ of dates or barley. It must be given before touching but need not be repeated if intercourse occurs during feeding, as summarized in Al-Madarik.

۳ قوله: والذين يظاهرون إلخ بين في هذه الآية حكم الظهار. وقوله: «ثم يعودون لما قالوا أي يعودون لنقض ما قالوا، على حذف المضاف، ثم اختلفوا أن النقض بماذا يحصل ؟ فعندنا بالعزم على الوطئ، وهو قول ابن عباس والحسن وقتادة، وعند الشافعي بمجرد الإمساك فهو أن لا يطلقها عقيب الظهار.

۴ وقوله : فتحرير رقبة فعليه إعتاق رقبة مؤمنة أو كافرة ولم يجز المدبر وأم الولد والمكاتب الذي أدى شيئًا من قبل أن يتمادا الضمير يرجع إلى ما دل عليه الكلام من المظاهر، والمظاهر منها والمماسة الاستمتاع بها من جماع أو لمس بشهوة أو تظر إلى فرجها بشهوة ذلكم الحكم تو عظوهن به؛ لأن الحكم بالكفارة دليل على ارتكاب الجناية فيجب أن نتعظ بهذا الحكم حتى لا تعودوا إلى الظهار وتخافوا عقاب الله عليه، والله بما تعملون خبير، فإن مس قبل أن يكفر استغفر الله، ولا يعود حتى يكفر، وإن أعتق بعض الرقية، ثم مس عليه أن يستأنف عن أبي حنيفة ، فَمَن لَّمْ يجد (المجادلة: ٤) الرقبة فَصِيَامُ شَهْرَيْنِ (المجادلة: ٤) فعليه صيام شهرين مُتَتَابِعَيْنِ مِن قَبْلِ أَن يَتَمَاسَّا فَمَن لَّمْ يَسْتَطِعْ الصيام ﴿فَإِطْعَامُ سِتِّينَ مِسْكِينَا (المجادلة: ٤ لكل مسكين نصف صاع من بر أو صاع من غيره، ويجب أن يقدمه على المسيس، ولكن لا يستأنف إن جامع في خلال الإطعام، «المدارك» ملخصا.
