بَابُ عِشْرَةِ النِّسَاءِ وَمَا لِكُلِّ وَاحِدٍ مِنَ الْحَقُوقِThe Treatment of Women and the Rights of Each
وَقَوْلِ اللهِ عَزَّ وَجَلَّ: وَعَاشِرُوهُنَّ بِالْمَعْرُوفِ فَإِن كَرِهْتُمُوهُنَّ فَعَسَى أَن تَكْرَهُوا شَيْئًا وَيَجْعَلَ اللَّهُ فِيهِ خَيْرًا كَثِيرًا وَقَوْلِهِ تَعَالَى: (النساء: ۱۹ ﴿وَلَهُنَّ مِثْلُ الَّذِي عَلَيْهِنَّ بِالْمَعْرُوفِ وَلِلرِّجَالِ عَلَيْهِنَّ دَرَجَةٌ وَاللَّهُ عَزِيزٌ حَكِيمٌ (البقرة: ۲۲۸) وَقَوْلِهِ تَعَالَى: ﴿وَالَّتِي تَخَافُونَ نُشُوزَهُنَّ فَعِظُوهُنَّ وَاهْجُرُوهُنَّ فِي الْمَضَاجِعِ وَاضْرِبُوهُنَّ فَإِنْ أَطَعْنَكُمْ فَلَا تَبْغُوا عَلَيْهِنَّ سَبِيلًا إِنَّ اللَّهَ كَانَ عَلِيًّا كَبِيرًا (النساء: ٣٤
۱ قوله : وعاشروهن بالمعروف إلخ : أي عاشروا النساء بالمعروف مثل : النفقة والحسن في القول وغير ذلك، فإن كرهتموهن؛ لسوء خلقهن وقبحهن فعسى أن تكرهوا أي فاصبروا عليهن، ولا تفارقوهن؛ لكراهة فلعمل لكم فيما تكرهون خيرا كثير ليس فيما تحبونه من الثواب الجزيل والولد الصالح وغير ذلك، فأقيم علة جزاء الشرط، أعني فعسى أن تكرهوا مقام الجزاء، أعني قوله: فاصبروا كذا في «التفسيرات الأحمدية».
۲ قوله: ولهن مثل الذي عليهن بالمعروف: إيماء إلى حقوق كل من الزوج والزوجة على الآخر، فحقوق الزوج على الزوجة الخدمة والأدب وترك الاعتراض عليه وامتثال أوامره بالكلية وانقيادها له في كل شيء وترك المنع من الوطء في حالة الحيض والنفاس. وحقوق الزوجة على الزوج النفقة والكسوة وأداء المهر بحسب ما ذكر في الفقه وتعليم الشرائع والأحكام. فالزوج والزوجة وإن كانا مستويين في حق الحقوق، ولكن للرجال عليهن درجة أي زيادة في الحق وفضيلة
بالإنفاق وملك النكاح أو الطلاق والرجعة والميرث ونحوه. كذا في التفسيرات الأحمدية».
۳ قوله: واللاتي تخافون نشوزهن: أي إعراضهن فعظوهن أي انصحوهن للإطاعة، فإن لم ينفع النصحفاهجروهن في المضاجع أي في المراقد، فلا تدخلوهن تحت اللحاف أو تجامعوهن أو وولوهن ظهركم في المضجع، فإن لم ينفع الهجران فاضربوهن ضربا غير مبرح ولا شأن، ثم بعد هؤلاء أن تأتي تلك الناشزة على الإطاعة. فبيانه في قوله تعالى: ﴿فَإِنْ أَطَعْنَكُمْ ﴾ (النساء : ٣٤) أي بترك النشوز بعد الوعظ والهجران والضرب، ﴿فَلا تَبْغُوا عَلَيْهِنَّ سَبِيلًا (النساء: ٣٤) بالتوبيخ والإيذاء، بل أزيلوا عنهن التعرض واجعلوا ما كان منهن كأن لم يكن. وإن التائب من الذنب كمن لا ذنب له، إِنَّ اللهَ كَانَ عَلِيًّا كَبِيرًا ﴾ (النساء : ٣٤ أي أنه أقدر عليكم من قدرتكم على أزواجكم. كذا في «التفسيرات الأحمدية» ملتقطا.
And the saying of Allah, the Mighty and Majestic: "And live with them honourably; for if you dislike them, it may be that you dislike a thing in which Allah has placed abundant good" (An-Nisa: 19); and His saying, the Exalted: "And they have rights like those over them, according to what is honourable, and men have a degree over them; and Allah is Mighty, Wise" (Al-Baqarah: 228); and His saying, the Exalted: "And those from whom you fear rebellion, admonish them, and forsake them in the beds, and strike them; then if they obey you, seek no way against them; indeed Allah is ever Exalted, Great" (An-Nisa: 34).
1 His saying "and live with them honourably", to the end: that is, live with women honourably, in such things as maintenance, goodness of speech and the like. "For if you dislike them" for their ill temper or their plainness, "it may be that you dislike": that is, be patient with them and do not part from them out of dislike, for perhaps Allah will place for you in what you dislike abundant good that is not in what you love, of generous reward and righteous offspring and other things. The cause has been set in the place of the consequent of the condition, that is, "it may be that you dislike" stands in the place of the answer, namely "so be patient". So it is in al-Tafsirat al-Ahmadiyya.
2 His saying "and they have rights like those over them, according to what is honourable": an indication of the rights of each of the husband and the wife over the other. The husband's rights over the wife are service, respectful conduct, refraining from objecting to him, complying fully with his instructions, yielding to him in everything, and not withholding except in the state of menstruation and post-natal bleeding. The wife's rights over the husband are maintenance, clothing, payment of the dower as set out in fiqh, and teaching her the laws and rulings. So husband and wife, though equal in the possession of rights, yet "men have a degree over them", that is, an increase in right and a precedence, through maintaining them and holding the tie of marriage, or divorce, and taking back, and inheritance and the like. So it is in al-Tafsirat al-Ahmadiyya.
3 His saying "and those from whom you fear rebellion": that is, their turning away. "Admonish them": that is, counsel them toward obedience. If counsel does not avail, "forsake them in the beds": that is, in the sleeping places; do not bring them beneath the cover, or do not approach them, or turn your backs to them in the bed. If forsaking does not avail, strike them a striking that is neither violent nor disfiguring. Then after these it is hoped that the rebellious one comes to obedience. Its statement is in His saying, the Exalted: "then if they obey you" (An-Nisa: 34), by leaving rebellion after the admonition, the forsaking and the striking, "seek no way against them" (An-Nisa: 34) by reproach and hurt; rather, cease to trouble them and treat what passed from them as though it had never been, for the one who repents of a sin is as one who has no sin. "Indeed Allah is ever Exalted, Great" (An-Nisa: 34): that is, He has more power over you than you have over your wives. Gathered from al-Tafsirat al-Ahmadiyya.
وَعَنْ أَبِي هُرَيْرَةَ (رضي الله عنه)، قَالَ: قَالَ رَسُولُ اللهِ ﷺ: «وَاسْتَوْصُوا بِالنِّسَاءِ خَيْرًا؛ فَإِنَّهُنَّ خُلِقْنَ مِنْ ضِلَعٍ، وَإِنَّ أَعْوَجَ شَيْءٍ فِي الضَّلَعِ أَعْلَاهُ، فَإِنْ ذَهَبْتَ تُقِيمُهُ كَسَرْتَهُ، وَإِنْ تَرَكْتَهُ لَمْ يَزَلْ أَعْوَجَ ، فَاسْتَوْصُوا بِالنِّسَاءِ خَيْرًا». مُتَّفَقٌ عَلَيْهِ.
Abu Hurayrah (may Allah be pleased with him) narrated: The Messenger of Allah (ﷺ) said: “Treat women kindly, for they were created from a rib, and the most crooked part of the rib is its upper part. If you try to straighten it, you will break it, and if you leave it, it will remain crooked. So treat women kindly.” Agreed upon.
وَعَنْهُ (رضي الله عنه) قَالَ: قَالَ رَسُولُ اللهِ ﷺ: «إِنَّ الْمَرْأَةَ خُلِقَتْ مِنْ ضِلَعِ لَنْ تَسْتَقِيمَ لَكَ عَلَى طَرِيقَةٍ، فَإِنْ اسْتَمْتَعْتَ بِهَا اسْتَمْتَعْتَ بِهَا وَبِهَا عِوَجٌ، وَإِنْ ذَهَبْتَ تُقِيمُهَا كَسَرْتَهَا، وَكَسْرُهَا طَلَاقُهَا. رَوَاهُ مُسْلِمٌ.
Abu Hurayrah (may Allah be pleased with him) narrated: The Messenger of Allah (ﷺ) said: “A woman was created from a rib and will not be straightened for you in any way. If you enjoy her, you enjoy her with her crookedness. If you try to straighten her, you will break her, and breaking her is divorcing her.” Narrated by Muslim.
وَعَنْهُ (رضي الله عنه) قَالَ: قَالَ رَسُولُ اللهِ : لَا يَفْرَكْ مُؤْمِنٌ مُؤْمِنَةً، إِنْ كَرِهَ مِنْهَا خُلُقًا رَضِيَ مِنْهَا آخَرَ». رَوَاهُ مُسْلِمٌ.
Abu Hurayrah (may Allah be pleased with him) narrated: The Messenger of Allah (ﷺ) said: “A believing man should not hate a believing woman. If he dislikes one of her traits, he will be pleased with another.” Narrated by Muslim.
وَعَنْهُ (رضي الله عنه)قَالَ: قَالَ رَسُولُ اللهِ ﷺ: «لَوْلَا بَنُو إِسْرَائِيلَ لَمْ يَخْتَزِ اللَّحْمُ، وَلَوْلَا حَوَّاءُ لَمْ تَخَنَّ أُنْثَى زَوْجَهَا الدَّهْرَ». مُتَّفَقٌ عَلَيْهِ
Abu Hurayrah (may Allah be pleased with him) narrated: The Messenger of Allah (ﷺ) said: “Were it not for the Children of Israel, meat would not spoil, and were it not for Hawwa, no woman would betray her husband forever.” Agreed upon.
وَعَنِ ابْنِ عَبَّاسٍ (رضي الله عنهما) أَنَّ رَسُوْلَ اللهِ ﷺ قَالَ: «أَرْبَعُ مَنْ أُعْطِيَهُنَّ فَقَدْ أُعْطِيَ خَيْرَ الدُّنْيَا وَالْآخِرَةِ: قَلْبُ شَاكِرٌ ، وَلِسَانُ ذَاكِرٌ، وَبَدَنُ عَلَى الْبَلَاءِ صَابِرُ، وَزَوْجَةً لَا تَبْغِيهِ خَوْنًا فِي نَفْسِهَا وَلَا مَالِهِ». رَوَاهُ الْبَيْهَقِيُّ فِي شُعَبِ الْإِيْمَانِ».
Ibn Abbas (may Allah be pleased with them) narrated that the Messenger of Allah (ﷺ) said: “Four things, whoever is given them has been given the best of this world and the Hereafter: a grateful heart, a remembering tongue, a body patient in affliction, and a wife who does not betray him in herself or his wealth.” Narrated by Al-Bayhaqi in Shu‘ab al-Iman.
وَعَنْ عُمَرَ (رضي الله عنه) عَنِ النَّبِيِّ ﷺ قَالَ: «لَا يُسْأَلُ الرَّجُلُ فِيمَا ضَرَبَ امْرَأَتَهُ عَلَيْهِ. رَوَاهُ أَبُو دَاوُدَ وَابْنُ مَاجَه.
Umar (may Allah be pleased with him) narrated from the Prophet (ﷺ): “A man will not be asked about why he struck his wife.” Narrated by Abu Dawud and Ibn Majah.
وَعَنْ عَبْدِ اللهِ بْنِ زَمْعَةَ (رضي الله عنه) قَالَ: قَالَ رَسُولُ اللَّهِ ﷺ: «لَا يَجْلِدُ أَحَدُكُمْ امْرَأَتَهُ جَلْدَ الْعَبْدِ، ثُمَّ يُجَامِعُهَا فِي آخِرِ الْيَوْمِ، ثُمَّ وَعَظَهُمْ فِي ضَحِكِهِمْ مِنَ الضَّرْطَةِ فَقَالَ: «إِلَامَ يَضْحَكُ أَحَدُكُمْ مِمَّا يَفْعَلُ». مُتَّفَقٌ عَلَيْهِ.
Abdullah ibn Zam‘ah (may Allah be pleased with him) narrated: The Messenger of Allah (ﷺ) said: “None of you should whip his wife like whipping a slave, then sleep with her at the end of the day.” Then he admonished them regarding their laughter about flatulence, saying: “Why does one of you laugh at what he himself does?” Agreed upon.
وَعَنْ لَقِيطِ بْنِ صَبْرَةَ (رضي الله عنه)قَالَ: قُلْتُ: يَا رَسُولَ اللَّهِ، إِنَّ لِي امْرَأَةً وَإِنَّ فِي لِسَانِهَاشَيْئًا، يَعْنِي الْبَنَاءَ. قَالَ: «طَلَّقْهَا قُلْتُ: إِنَّ لِي مِنْهَا وَلَدًا وَلَهَا صُحْبَةً، قَالَ: «فَمُرْهَا» - يَقُولُ: عِظْهَا - «فَإِنْ يَكُ فِيهَا خَيْرٌ فَسَتَفْعَلْ، وَلَا تَضْرِبْ ظَعِينَتَكَ ضَرْبَكَ أَمَتَكَ. رَوَاهُ أَبُو دَاوُدَ.
Laqit ibn Sabrah (may Allah be pleased with him) narrated: I said, “O Messenger of Allah, I have a wife, and there is something in her tongue, meaning sharpness.” He said, “Divorce her.” I said, “She has borne me a child, and we have companionship.” He said, “Then admonish her,” meaning advise her. “If there is good in her, she will comply. Do not strike your wife as you would strike your slave girl.” Narrated by Abu Dawud.
وَعَنْ حَكِيمِ بْنِ مُعَاوِيَةَ الْقُشَيْرِي عَنْ أَبِيهِ قَالَ: قُلْتُ: يَا رَسُولَ اللَّهِ، مَا حَقُّ زَوْجَةِ أَحَدِنَا عَلَيْهِ قَالَ: «أَنْ تُطْعِمَهَا إِذَا طَعِمْتَ، وَتَكْسُوهَا إِذَا اكْتَسَيْتَ أَوْ اكْتَسَبْتَ وَلَا تَضْرِبُ الْوَجْهَ، وَلَا تُقَبِّحْ، وَلَا تَهْجُرُ إِلَّا فِي الْبَيْتِ». رَوَاهُ أَحْمَدُ وَأَبُوْ دَاوُدَ وَابْنُ مَاجَه. وَرَوَى الْبُخَارِيُّ عَنْ أَنَسٍ الله قَالَ: آلَى رَسُولُ اللهِ ﷺ مِنْ نِسَائِهِ شَهْرًا، وَكَانَتْ انْفَكَّتْ رِجْلُهُ، فَأَقَامَ فِي مَشْرُبَةٍ تِسْعًا وَعِشْرِينَ لَيْلَةً، ثُمَّ نَزَلَ، فَقَالُوا: يَا رَسُولَ اللَّهِ، آلَيْتَ شَهْرًا؟ فَقَالَ: «إِنَّ الشَّهْرَ يَكُونُ تِسْعًا وَعِشْرِينَ».
وَرَوَى مُسْلِمٌ عَنْ جَابِرٍ (رضي الله عنه)، قَالَ : دَخَلَ أَبُو بَكْرٍ يَسْتَأْذِنُ عَلَى رَسُولِ اللَّهِ ﷺ فَوَجَدَ النَّاسَ جُلُوسًا بِبَابِهِ لَمْ يُؤْذَنْ لِأَحَدٍ مِنْهُمْ، قَالَ: فَأُذِنَ لِأَبِي بَكْرٍ فَدَخَلَ، ثُمَّ أَقْبَلَ عُمَرُ فَاسْتَأْذَنَ فَأُذِنَ لَهُ، فَوَجَدَ النَّبِيَّ ﷺ جَالِسًا حَوْلَهُ نِسَاؤُهُ وَاحِمًا سَاكِيًّا. قَالَ: فَقَالَ: لَأَقُولَنَّ شَيْئًا أُضْحِكُ النَّبِيِّ ، فَقَالَ: يَا رَسُولَ اللهِ، لَوْ رَأَيْتَ بِنْتَ خَارِجَةَ سَأَلَتْنِي النَّفَقَةَ فَقُمْتُ إِلَيْهَا فَوَجَأْتُ عُنْقَهَا، فَضَحِكَ رَسُولُ اللهِ ، وَقَالَ: هُنَّ حَوْلِي كَمَا تَرَى يَسْأَلْنَنِي النَّفَقَةَ، فَقَامَ أَبُو بَكْرٍ إِلَى عَائِشَةَ يَجَأُ عُنُقَهَا، فَقَامَ عُمَرُ إِلَى حَفْصَةَ يَجَأُ عُنُقَهَا كِلَاهُمَا يَقُولُ: تَسْأَلِيْنَ رَسُولَ اللَّهِ ﷺ مَا لَيْسَ عِنْدَهُ؟
فَقُلْنَ: وَاللَّهِ لَا نَسْأَلُ رَسُولَ اللهِ اللهِ شَيْئًا أَبَدًا لَيْسَ عِنْدَهُ، ثُمَّ اعْتَزَلَهُنَّ شَهْرًا أَوْ تِسْعًا وَعِشْرِينَ، ثُمَّ نَزَلَتْ عَلَيْهِ هَذِهِ الْآيَةُ: يَأَيُّهَا النَّبِيُّ قُل لِأَزْوَاجِكَ حَتَّى بَلَغَ لِلْمُحْسِنَاتِ مِنكُنَّ أَجْرًا عَظِيمًا قَالَ: فَبَدَأَ بِعَائِشَةَ، فَقَالَ: «يَا عَائِشَةُ، إِنِّي أُرِيدُ أَنْ (الأحزاب: ۲۸، ۲۹) أَعْرِضَ عَلَيْكِ أَمْرًا، أُحِبُّ أَنْ لَا تَعْجَلِي لَا تَعْجَلِي فِيهِ حَتَّى تَسْتَشِيرِي أَبَوَيْكِ». قَالَتْ: وَمَا هُوَ يَا رَسُولَ اللَّهِ؟ فَتَلَا عَلَيْهَا الْآيَةَ قَالَتْ: أَفِيكَ يَا رَسُولَ اللهِ أَسْتَشِيرُ أَبَوَيَّ؟ بَلْ أَخْتَارُ اللَّهَ وَرَسُولَهُ وَالدَّارَ الْآخِرَةَ، وَأَسْأَلُكَ أَنْ لَا تُخْبِرَ امْرَأَةً مِنْ نِسَائِكَ بِالَّذِي قُلْتُ قَالَ: «لَا تَسْأَلُنِي امْرَأَةٌ مِنْهُنَّ إِلَّا أَخْبَرْتُهَا إِنَّ اللَّهَ لَمْ يَبْعَثْنِي مُعَنَّنَا وَلَا مُتَعَنَّنَا، وَلَكِنْ بَعَثَنِي مُعَلَّمًا مُيَسِّرًا».
Hakim ibn Mu‘awiyah al-Qushayri narrated from his father: I said, “O Messenger of Allah, what is the right of the wife of one of us upon him?” He said: “That you feed her when you eat, clothe her when you clothe yourself or earn, do not strike her face, do not revile her, and do not forsake her except in the house.” Narrated by Ahmad, Abu Dawud, and Ibn Majah.
Bukhari narrated from Anas: The Messenger of Allah (ﷺ) swore an oath (ila) from his wives for a month, and his foot had been injured, so he stayed in an upper room for twenty-nine nights. Then he came down, and they said, “O Messenger of Allah, you swore for a month?” He said, “The month can be twenty-nine days.”
Muslim narrated from Jabir (may Allah be pleased with him): Abu Bakr came to seek permission to enter upon the Messenger of Allah (ﷺ) and found people sitting at his door, none of whom were permitted to enter. Permission was granted to Abu Bakr, and he entered. Then Umar came, sought permission, and was granted entry. He found the Prophet (ﷺ) sitting, surrounded by his wives, silent and upset. Umar said, “I will say something to make the Prophet laugh.” He said, “O Messenger of Allah, if you had seen the daughter of Kharijah asking me for maintenance, I stood and pushed her neck.” The Messenger of Allah (ﷺ) laughed and said, “They are around me, as you see, asking for maintenance.” Abu Bakr stood and pushed Aishah’s neck, and Umar stood and pushed Hafsah’s neck, both saying, “You ask the Messenger of Allah for what he does not have?” They said, “By Allah, we will never ask the Messenger of Allah for what he does not have.” Then he secluded himself from them for a month or twenty-nine days. Then this verse was revealed to him: “O Prophet, say to your wives…” until “…for the doers of good among you, a great reward” [Al-Ahzab: 28-29]. He began with Aishah, saying, “O Aishah, I want to present a matter to you, and I prefer that you not hasten until you consult your parents.” She said, “What is it, O Messenger of Allah?” He recited the verse to her. She said, “Regarding you, O Messenger of Allah, should I consult my parents? Rather, I choose Allah and His Messenger and the Hereafter. I ask you not to inform any of your wives of what I said.” He said, “If any of them asks me, I will tell her. Allah did not send me to be harsh or difficult, but as a teacher and facilitator.”
Notes / الحواشي
1 The statement: “Do not strike her face, etc.”: In Fatawa Qadikhan, a husband may strike his wife for four reasons: neglecting adornment when he desires it, refusing intimacy when she is pure, neglecting prayer (in some narrations, though Muhammad said he cannot strike her for neglecting prayer, and neglecting purification from major impurity or menstruation is akin to neglecting prayer), and leaving the house without his permission, as in Al-Marqah. Al-Khazn said: Ash-Shafi‘i said striking is permissible, but refraining from it is better. 2 The statement: “Do not forsake her except in the house”: This means if something displeases him, he forsakes her in bed but does not move to another house. However, it is established in the Sahih that the Prophet (ﷺ) forsook his wives and went to an upper room. Thus, the restriction in “forsake them in bed” [An-Nisa: 34] is not intended, and the restriction in this Hadith is not followed. It is permissible to forsake outside the house, as the Prophet (ﷺ) did. The reality is that this varies by circumstance; sometimes forsaking in the house is more severe, sometimes outside, especially for women due to their sensitive nature, as in Nayl al-Awtar and Fath al-Bari, summarized.
3 The statement: “The Messenger of Allah swore an oath (ila), etc.”: In Al-Azhar, this is not the well-known ila, as Al-Tayyibi said: Ila in fiqh has specific rulings and is not called ila without them, as in Al-Marqah.
4 The statement: “Rather, I choose Allah and His Messenger, etc.”: This supports the view of Malik, Ash-Shafi‘i, Abu Hanifah, Ahmad, and the majority of scholars that if a husband gives his wife a choice and she chooses him, it is not divorce, and no separation occurs, as in Al-Marqah.
1 قوله : ولا تضرب الوجه إلخ: وفي فتاوى قضيخان للزوج أن يضرب المرأة أربعة منها: ترك الزينة إذا أراد الزوج، والثانية: ترك الإجابة إذا أراد الجماع، وهي طاهرة والثالثة: ترك الصلاة في بعض الروايات، وعن محمد: ليس له أن يضربها على ترك الصلاة، وترك الغسل عن الجنابة والحيض بمنزلة ترك الصلاة. والرابعة: الخروج عن منزله بغير إذنه. كذا في المرقاة». وقال في «الخازن»: قال الشافعي: الضرب مباح، وتركه أفضل.
۲ قوله : ولا تهجر إلا في البيت يعني إذا رابه منها أمر فيهجرها في المضجع، ولا يتحول عنها إلى دار أخرى، ولكنه قد ثبت في الصحيح أن النبي له هجر نساءه وخرج إلى مشربة له. فيكون مفهوم الحصر غير مراد في قوله تعالى: وَاهْجُرُوهُنَّ فِي الْمَضَاجِعِ ) (النساء: ٣٤)، وأيضًا أن الحصر المذكور في هذا الحديث غير معمول به، بل يجوز الهجرة في غير البيوت، كما فعل النبي ، والحق أن ذلك يختلف باختلاف الأحوال، فربما كان الهجران في البيوت أشد من الهجران في غيرها وبالعكس، بل الغالب أن الهجران في غير البيوت آلم للنفوس وخصوصا للنساء؛ لضعف نفوسهن، «نيل الأوطار» و«فتح الباري» ملخصا.
۳ قوله: آلى رسول الله ﷺ إلخ : قال في «الأزهار وليس هو من الإيلاء المشهور، قال الطيبي : للإيلاء في الفقه أحكام تخصه لا يُسمى إيلاءا دونها. كذا في «المرقاة».
۴ قوله: بل أختار الله ورسوله إلخ : فيه دلالة لمذهب مالك والشافعي وأبي حنيفة وأحمد وجماهير العلماء أن من خير زوجته، واختارته لم يكن ذلك طلاقا، ولا يقع به فرقة. كذا في «المرقاة».
وَعَنْ عَائِشَةَ (رضي الله عنها) قَالَتْ: كُنْتُ أَغَارُ عَلَى اللَّاتِي وَهَبْنَ أَنْفُسَهُنَّ لِرَسُولِ اللَّهِ ﷺ وَأَقُولُ: أَتَهَبُ الْمَرْأَةُ نَفْسَهَا؟ فَلَمَّا أَنْزَلَ اللهُ تَعَالَى: }تُرْجِى مَن تَشَاءُ مِنْهُنَّ وَتُئْوِى إِلَيْكَ مَن تَشَاءُ وَمَنِ ابْتَغَيْتَ مِمَّنْ عَزَلْتَ فَلَا جُنَاحَ عَلَيْكَ{(الأحزاب: ٥١ قُلْتُ: مَا أَرَى رَبَّكَ إِلَّا يُسَارِعُ فِي هَوَاكَ. مُتَّفَقٌ عَلَيْهِ.
وَحَدِيثُ جَابِرٍ: «اتَّقُوا اللهَ فِي النِّسَاءِ ذُكِرَ فِي قِصَّةِ حَجَّةِ الْوَدَاعِ.
Aishah (may Allah be pleased with her) narrated: I was jealous of those women who offered themselves to the Messenger of Allah (ﷺ) and said, “Does a woman offer herself?” When Allah revealed: “You may postpone whom you will of them and receive whom you will. And whomever you desire of those you have set aside, there is no blame upon you” [Al-Ahzab: 51], I said, “I see your Lord only hastens to fulfill your desires.” Agreed upon.

1 The statement: “You may postpone whom you will, etc.”: Interpreters differed on its meaning. The most well-known view is that it pertains to division among them. Equal division was obligatory for him, but when this verse was revealed, it was lifted, and the choice was given to him. Abu Razin and Ibn Zayd said: This verse was revealed when some Mothers of the Believers became jealous and sought more maintenance. The Prophet (ﷺ) forsook them for a month until the verse of choice was revealed. Allah commanded him to let them choose between this world and the Hereafter, to release those who chose this world, and to keep those who chose Allah and His Messenger as Mothers of the Believers, never to be married by others. He could receive whom he willed, postpone whom he willed, and they would be content whether he divided among them or not, or favored some in maintenance or division. This was his exclusive privilege, and they accepted it and chose him on this condition, as in Ma‘alim at-Tanzil.
۱ قوله: ترجي من تشاء إلخ: اختلف المفسرون في هذا المعنى، فأشهر الأقاويل أنه في القسم بينهن ذلك أن التسوية بينهن في القسم كانت واجبًا عليه. فلما نزلت هذه الآية سقط عنه، وصار الاختيار إليه فيهن. قال أبو رزين وابن زيد: نزلت هذه الآية حين غار بعض أمهات المؤمنين على النبي الله طلب بعضهن زيادة النفقة، فهجرهن النبي شهرًا حتى نزلت آية التخيير، فأمره الله عَزَّ وَجَلَّ أن يخير من بين الدينا والآخرة، وأن تخلي سبيل من اختارت الدنيا ويمسك من اختارت الله ورسوله على أنهن أمهات المؤمنين. ولا ينكحهن أبدا على أن تؤوي إليه من تشاء منهن، فترجي من تشاء فيرضين به قسم لهن أو لم يُقسم أو قسم لبعضهن دون بعض أو فضل بعضهن في النفقة والقسمة، فيكون الأمر في ذلك إليه يفعل كيف يشاء. وكان ذلك من خصائصه فرضين بذلك واخترنه على هذا الشرط. كذا في معالم التنزيل».
وَعَنْ إِيَاسِ بْنِ عَبْدِ اللهِ قَالَ: قَالَ رَسُولُ اللهِ ﷺ: «لَا تَضْرِبُوا إِمَاءَ اللَّهِ فَجَاءَ عُمَرُ إِلَى رَسُولِ اللهِ ﷺ فَقَالَ: ذَثِرْنَ النِّسَاءُ عَلَى أَزْوَاجِهِنَّ فَرَخَّصَ فِي ضَرْبِهِنَّ، فَأَطَافَ بِآلِ رَسُولِ اللهِ ﷺ نِسَاءٌ كَثِيرٌ يَشْكُوْنَ أَزْوَاجَهُنَّ، فَقَالَ النَّبِيُّ ﷺ: «لَقَدْ طَافَ بِآلِ مُحَمَّدٍ نِسَاءً كَثِيرٌ يَشْكُوْنَ أَزْوَاجَهُنَّ، لَيْسَ أُولَئِكَ بِخِيَارِكُمْ». رَوَاهُ أَبُوْ دَاوُدَ وَابْنُ مَاجَهِ وَالدَّارِيُّ.
Iyas ibn Abdullah narrated: The Messenger of Allah (ﷺ) said: “Do not strike the maidservants of Allah.” Umar came to the Messenger of Allah (ﷺ) and said, “Women have become bold with their husbands.” So he permitted striking them. Many women then surrounded the household of the Messenger of Allah (ﷺ), complaining about their husbands. The Prophet (ﷺ) said, “Many women have surrounded the household of Muhammad, complaining about their husbands. Those are not the best among you.” Narrated by Abu Dawud, Ibn Majah, and Ad-Darimi.

1 The statement: “Women have become bold, etc.”: The Sunnah’s alignment with the Quran on striking suggests the Prophet (ﷺ) prohibited striking before the verse’s revelation. When women became bold, he permitted it, and the Quran confirmed it. When they exceeded in striking, he clarified that while striking is permissible for bad conduct, patience and refraining from striking are better and more virtuous. This meaning is attributed to Ash-Shafi‘i, as in Al-Marqah.
۲ قوله: ذئرن النساء إلخ : ووجه ترتيب السنة على الكتاب في الضرب يحتمل أن نهى النبي ﷺ عن ضربهن قبل نزول الآية. ثم لما ذكرن النساء أذن في ضربهن، ونزل القرآن موافقا له، ثم لما بالغوا في الضرب أخبر أن الضرب وإن كان مباحا على شكاية أخلاقهن، فالتحمل والصبر على سوء أخلاقهن وترك الضرب أفضل وأجمل ويحكى عن الشافعي هذا المعنى. كذا في «المرقاة».

Abu Hurayrah (may Allah be pleased with him) narrated: The Messenger of Allah (ﷺ) said: “The most complete of believers in faith are those with the best character, and the best of you are the best to their women in character.” Narrated by Tirmidhi, who said: This is a good, authentic Hadith. Abu Dawud narrated it up to “character.”

1 The statement: “I used to play with dolls, etc.”: In Radd al-Muhtar: Buying a clay bull or horse for a child’s amusement is not valid, has no value, and the one who destroys it is not liable. Some said otherwise, that it is valid and liable for its value. In Majtabi from Abu Yusuf: It is permissible to sell toys and for children to play with them.

Aishah (may Allah be pleased with her) narrated: The Messenger of Allah (ﷺ) returned from the expedition of Tabuk or Hunayn, and there was a curtain in her alcove. A wind blew, lifting a corner of the curtain, revealing Aishah’s dolls. He said, “What is this, O Aishah?” She said, “My dolls.” He saw among them a horse with wings made of cloth and said, “What is this in their midst?” She said, “A horse.” He said, “What is this on it?” She said, “Wings.” He said, “A horse with wings?” She said, “Have you not heard that Sulayman had horses with wings?” She said: He laughed until I saw his molars. Narrated by Abu Dawud.

1 The statement: “I raced him on foot”: Qadikhan said: Racing is permissible in four things: camels, horses, archery, and running on foot. It is permissible if the wager is from one side, e.g., “If I outrun you, I get this, but if you outrun me, you get nothing.” If the wager is from both sides, it is forbidden as gambling unless a third party is included, e.g., each says, “If you outrun me, you get this, and if I outrun you, I get this, but if the third wins, he gets nothing.” This is permissible and lawful, meaning morally good, not obligatory. What rulers do is also permissible, e.g., saying to two, “Whoever wins gets this.” Racing is allowed in these four due to textual evidence, and there is no evidence for others, as in Al-Marqah.

Aishah (may Allah be pleased with her) narrated: By Allah, I saw the Messenger of Allah (ﷺ) standing at the door of my chamber while the Abyssinians were playing with their spears in the mosque. The Messenger of Allah (ﷺ) covered me with his cloak so I could watch their play from between his ear and shoulder. He stood for my sake until I was the one who left. So consider the value of a young girl, new in age, eager for amusement. Agreed upon.

Aishah (may Allah be pleased with her) narrated: The Messenger of Allah (ﷺ) said to me: “I know when you are pleased with me and when you are angry with me.” I said, “How do you know that?” He said, “When you are pleased with me, you say, ‘No, by the Lord of Muhammad,’ and when you are angry with me, you say, ‘No, by the Lord of Ibrahim.’” I said, “Yes, by Allah, O Messenger of Allah, I only forsake your name.” Agreed upon.

وَعَنْهُ(رضي الله عنه) قَالَ: قَالَ رَسُولُ اللهِ : إِذَا دَعَا الرَّجُلُ امْرَأَتَهُ إِلَى فِرَاشِهِ فَأَبَتْ فَبَاتَ غَضْبَانَ عَلَيْهَا ، لَعَنَتْهَا الْمَلَائِكَةُ حَتَّى تُصْبِحَ». مُتَّفَقٌ عَلَيْهِ. وَفِي رِوَايَةٍ لَهُمَا: «قَالَ: وَالَّذِي نَفْسِي بِيَدِهِ مَا مِنْ رَجُلٍ يَدْعُو امْرَأَتَهُ إِلَى فِرَاشِهَا، فَتَأْبَى عَلَيْهِ إِلَّا كَانَ الَّذِي فِي السَّمَاءِ سَاخِطًا عَلَيْهَا حَتَّى يَرْضَى عَنْهَا».
Abu Hurayrah (may Allah be pleased with him) narrated: The Messenger of Allah (ﷺ) said: “If a man calls his wife to his bed and she refuses, and he spends the night angry with her, the angels curse her until morning.” Agreed upon. In another narration: “By the One in Whose Hand is my soul, no man calls his wife to her bed, and she refuses him, except that the One in the heavens is displeased with her until he is pleased with her.”
وَعَنْ طَلْقِ بْنِ عَلِيَّ (رضي الله عنه) قَالَ: قَالَ رَسُولُ اللهِ ﷺ: «إِذَا الرَّجُلُ دَعَا زَوْجَتَهُ لِحَاجَتِهِ فَلْتَأْتِهِ وَإِنْ كَانَتْ عَلَى التَّنُّورِ». رَوَاهُ التَّرْمِذِيُّ.
Talq ibn Ali (may Allah be pleased with him) narrated: The Messenger of Allah (ﷺ) said: “If a man calls his wife for his need, let her come to him, even if she is at the oven.” Narrated by Tirmidhi.
وَعَنْ أَبِي سَعِيدِ (رضي الله عنه) قَالَ : جَاءَتْ امْرَأَة إِلَى رَسُولِ الله ﷺ وَنَحْنُ عِنْدَهُ، فَقَالَتْ: زَوْجِيْ صَفْوَانُ بْنُ الْمُعَطَّلِ يَضْرِبُنِي إِذَا صَلَّيْتُ، وَيُفَطَّرُنِي إِذَا صُمْتُ، وَلَا يُصَلِّيصَلَاةَ الْفَجْرِ حَتَّى تَطْلُعَ الشَّمْسُ ، قَالَ : - وَصَفْوَانُ عِنْدَهُ - قَالَ: فَسَأَلَهُ عَمَّا قَالَتْ، فَقَالَ: يَا رَسُولَ الله، أَمَّا قَوْلُهَا: يَضْرِبُنِي إِذَا صَلَّيْتُ»؛ فَإِنَّهَا تَقْرَأُ بِسُورَتَيْنِ وَقَدْ نَهَيْتُهَا. قَالَ: فَقَالَ: «لَوْ كَانَتْ سُورَةً وَاحِدَةً لَكَفَتْ النَّاسَ». وَأَمَّا قَوْلُهَا: «يُفَطَّرُنِي فَإِنَّهَا تَنْطَلِقُ فَتَصُومُ وَأَنَا رَجُلٌ شَابُّ فَلَا أَصْبِرُ. فَقَالَ رَسُولُ اللهِ ﷺ يَوْمَئِذٍ: «لَا تَصُومُ امْرَأَةً إِلَّا بِإِذْنِ زَوْجِهَا». وَأَمَّا قَوْلُهَا: «إِنِّي لَا أُصَلِّي حَتَّى تَطْلُعَ الشَّمْسُ»؛ فَإِنَّا أَهْلُ بَيْتٍ قَدْ عُرِفَ لَنَا ذَاكَ، لَا نَكَادُ نَسْتَيْقِظُ حَتَّى تَطْلُعَ الشَّمْسُ قَالَ: «فَإِذَا اسْتَيْقَظْتَ يَا صَفْوَانَ، فَصَلَّ». رَوَاهُ أَبُو دَاوُدَ وَابْنُ مَاجَه.
Abu Sa‘id (may Allah be pleased with him) narrated: A woman came to the Messenger of Allah (ﷺ) while we were with him and said, “My husband, Safwan ibn al-Mu‘attal, strikes me when I pray, makes me break my fast when I fast, and does not pray the dawn prayer until the sun rises.” Safwan was present, and he was asked about what she said. He said, “O Messenger of Allah, as for her saying, ‘He strikes me when I pray,’ she recites two surahs, and I forbade her.” The Prophet (ﷺ) said, “If one surah were sufficient, it would suffice the people.” As for her saying, “He makes me break my fast,” she starts fasting, and I am a young man and cannot be patient. The Messenger of Allah (ﷺ) said that day: “No woman should fast except with her husband’s permission.” As for her saying, “I do not pray until the sun rises,” we are a household known for this; we hardly wake up until the sun rises. He said, “When you wake up, O Safwan, pray.” Narrated by Abu Dawud and Ibn Majah.

1 The statement: “We hardly wake up until the sun rises”: Literally or figuratively, meaning close to sunrise. He said, “When you wake up, O Safwan, pray,” meaning perform or make up the prayer. According to us, Ash-Shafi‘i used this to permit making up missed prayers during prohibited times. I say: Without considering our explanation, it is not necessary to pray immediately upon waking. The most it indicates is that waking is the cause for the obligation to make up, so if he wakes during a prohibited time and delays until it passes, he acts on both this Hadith and the Hadith prohibiting prayer during forbidden times, as in Al-Marqah and Umdat al-Qari.
۱قوله : لا نكاد نستيقظ حتى تطلع الشمس: أي حقيقة أو مجازا مشارفة قال: فإذا استيقظت يا صفوان! فصل أي أداء وقضاء، هذا عندنا، واحتج به الشافعي على جواز قضاء الفوائت في الوقت المنهي عن الصلاة فيه. قلت: مع قطع النظر عن شرحنا المذكور ليس بلازم أن يصلي في أول الاستيقاظ، غاية ما في الباب أن استيقاظه سبب لوجوب القضاء، فإذا استيقظ في الوقت المنهي وأخرها إلى أن يخرج ذلك وصلى يكون عاملا بالحديثين، أحدهما هذا، والآخر حديث النهي في الوقت المنهي عنه، أخذته من المرقاة» و«عمدة القاري».
وَعَنْ أَسْمَاءَ أَنَّ امْرَأَةً قَالَتْ: يَا رَسُوْلَ اللهِ، إِنَّ لِي ضَرَّةً، فَهَلْ عَلَيَّ جُنَاحٌ إِنْ تَشَبَّعْتُ مِنْ زَوْجِي غَيْرَ الَّذِي يُعْطِينِي؟ فَقَالَ رَسُولُ اللهِ: «الْمُتَشَبِّعُ بِمَا لَمْ يُعْطَ كَلَابِسِ تَوْبَيْ زُورٍ». مُتَّفَقٌ عَلَيْهِ
Asma narrated: A woman said, “O Messenger of Allah, I have a co-wife. Is there any sin on me if I boast about what my husband gives me that he does not?” The Messenger of Allah (ﷺ) said: “The one who boasts about what he was not given is like one wearing two garments of falsehood.” Agreed upon.
وَعَنْ أَنَسٍ قَالَ: قَالَ رَسُولُ اللهِ ﷺ: «الْمَرْأَةُ إِذَا صَلَّتْ خَمْسَهَا وَصَامَتْ شَهْرَهَا وَأَحْصَنَتْ فَرْجَهَا وَأَطَاعَتْ بَعْلَهَا فَلْتَدْخُلْ مِنْ أَيِّ أَبْوَابِ الْجَنَّةِ شَاءَتْ». رَوَاهُ أَبُو نُعَيْمٍ فِي الْحِلْيَةِ».
Anas narrated: The Messenger of Allah (ﷺ) said: “If a woman prays her five prayers, fasts her month, guards her chastity, and obeys her husband, let her enter Paradise from whichever gate she wishes.” Narrated by Abu Nu‘aym in Al-Hilyah.
وَعَنْ أُمِّ سَلَمَةَ (رضي الله عنها)قَالَتْ: قَالَ رَسُولُ اللهِ ﷺ: «أَيُّمَا امْرَأَةٍ مَاتَتْ وَزَوْجُهَا عَنْهَا رَاضٍ دَخَلَتِ الْجَنَّةَ. رَوَاهُ التَّرْمِذِيُّ.
Umm Salamah (may Allah be pleased with her) narrated: The Messenger of Allah (ﷺ) said: “Any woman who dies while her husband is pleased with her will enter Paradise.” Narrated by Tirmidhi.
وَعَنْ أَبِي هُرَيْرَةَ (رضي الله عنه)قَالَ: قِيْلَ لِرَسُولِ اللهِ ﷺ: أَيُّ النِّسَاءِ خَيْرُ؟ قَالَ: الَّتِي تَسُرُّهُ إِذَا نَظَرَ، وَتُطِيعُهُ إِذَا أَمَرَ، وَلَا تُخَالِفُهُ فِي نَفْسِهَا وَلَا مَالِهَا بِمَا يَكْرَهُ. رَوَاهُ النَّسَائِيُّ وَالْبَيْهَقِيُّ فِي شُعَبِ الْإِيْمَانِ».
Abu Hurayrah (may Allah be pleased with him) narrated: It was said to the Messenger of Allah (ﷺ), “Which women are the best?” He said, “The one who pleases him when he looks at her, obeys him when he commands, and does not oppose him in herself or his wealth in a way he dislikes.” Narrated by An-Nasa’i and Al-Bayhaqi in Shu‘ab al-Iman.
وَعَنْهُ (رضي الله عنه)قَالَ: قَالَ رَسُولُ اللهِ : لَوْ كُنْتُ آمِرًا أَحَدًا أَنْ يَسْجُدَ لِأَحَدٍ لَأَمَرْتُ الْمَرْأَةَ أَنْ تَسْجُدَ لِزَوْجِهَا». رَوَاهُ التَّرْمِذِيُّ.

وَعَنْ قَيْسِ بْنِ سَعْدٍ (رضي الله عنه) قَالَ: أَتَيْتُ الحِيرَةَ فَرَأَيْتُهُمْ يَسْجُدُوْنَ لِمَرْزُبَانِ لَهُمْ، فَقُلْتُ: لَرَسُولُ اللهِ أَحَقُّ أَنْ يُسْجَدَ لَهُ. قَالَ: فَأَتَيْتُ النَّبِيَّ ﷺ فَقُلْتُ: إِنِّي أَتَيْتُ الْحِيرَةَ فَرَأَيْتُهُمْ يَسْجُدُوْنَ لِمَرْزُبَانِ لَهُمْ، فَأَنْتَ أَحَقُّ أَنْ نَسْجُدَ لَكَ؟ قَالَ: «أَرَأَيْتَ لَوْ مَرَرْتَ بِقَبْرِي أَكُنْتَ تَسْجُدُ لَهُ؟ قَالَ: قُلْتُ: لَا ، قَالَ: «لَا تَفْعَلُوا، لَوْ كُنْتُ آمِرًا أَحَدًا أَنْ يَسْجُدَ لِأَحَدٍ لَأَمَرْتُ النِّسَاءَ أَنْ يَسْجُدْنَ لِأَزْوَاجِهِنَّ؛ لِمَا جَعَلَ الله لَهُمْ عَلَيْهِنَّ مِنَ الْحَقِّ». رَوَاهُ أَبُو دَاوُدَ، وَرَوَاهُ أَحْمَدُ عَنْ مُعَاذِ بْنِ جَبَلٍ.
Qays ibn Sa‘d (may Allah be pleased with him) narrated: I went to Al-Hirah and saw them prostrating to their governor. I said, “The Messenger of Allah is more deserving of prostration.” I came to the Prophet (ﷺ) and said, “I went to Al-Hirah and saw them prostrating to their governor, and you are more deserving of our prostration.” He said, “Would you prostrate to my grave if you passed by it?” I said, “No.” He said, “Do not do it. If I were to command anyone to prostrate to another, I would command women to prostrate to their husbands due to the right Allah has given them over them.” Narrated by Abu Dawud, and Ahmad narrated it from Mu‘adh ibn Jabal.
وَعَنْ عَائِشَةَ (رضي الله عنها) أَنَّ رَسُولَ اللهِ ﷺ كَانَ فِي نَفَرٍ مِنَ الْمُهَاجِرِينَ وَالْأَنْصَارِ، فَجَاءَ بَعِيرُ فَسَجَدَ لَهُ، فَقَالَ أَصْحَابُهُ : يَا رَسُولَ اللهِ، تَسْجُدُ لَكَ الْبَهَائِمُ وَالشَّجَرُ، فَنَحْنُ أَحَقُّ أَنْ نَسْجُدَ لَكَ، فَقَالَ: «اعْبُدُوا رَبَّكُمْ، وَأَكْرِمُوْا أَخَاكُمْ، وَلَوْ كُنْتُ آمِرًا أَحَدًا أَنْ يَسْجُدَ لِأَحَدٍ لَأَمَرْتُ الْمَرْأَةَ أَنْ تَسْجُدَ لِزَوْجِهَا. وَلَوْ أَمَرَهَا أَنْ تَنْقُلَ مِنْ جَبَلٍ أَصْفَرَ إِلَى جَبَلٍ أَسْوَدَ، وَمِنْ جَبَلٍ أَسْوَدَ إِلَى جَبَلٍ أَبْيَضَ ، كَانَ يَنْبَغِي لَهَا أَنْ تَفْعَلَهُ. رَوَاهُ أَحْمَدُ.
Aishah (may Allah be pleased with her) narrated: The Messenger of Allah (ﷺ) was among a group of Muhajirun and Ansar when a camel came and prostrated to him. His companions said, “O Messenger of Allah, the beasts and trees prostrate to you, so we are more deserving to prostrate to you.” He said, “Worship your Lord and honor your brother. If I were to command anyone to prostrate to another, I would command the woman to prostrate to her husband. Even if he ordered her to move from a yellow mountain to a black mountain, and from a black mountain to a white mountain, it would be incumbent upon her to do so.” Narrated by Ahmad.

وَعَنْ مُعَادٍ (رضي الله عنه)عَنِ النَّبِيِّ ﷺ قَالَ: «لَا تُؤْذِي امْرَأَةٌ زَوْجَهَا فِي الدُّنْيَا إِلَّا قَالَتْ زَوْجَتُهُ مِنَ الْحُورِ الْعِينِ: لَا تُؤْذِيهِ، قَاتَلَكِ اللهُ ، فَإِنَّمَا هُوَ عِنْدَكَ دَخِيلٌ، يُوشِكُ أَنْ يُفَارِقَكِ إِلَيْنَا . رَوَاهُ التَّرْمِذِيُّ وَابْنُ مَاجَه. وَقَالَ التَّرْمِذِيُّ: هَذَا حَدِيثُ غَرِيبٌ.
Mu‘adh (may Allah be pleased with him) narrated from the Prophet (ﷺ): “No woman harms her husband in this world but that his wife from the Houris says, ‘Do not harm him, may Allah fight you. He is only a guest with you and will soon leave you for us.’” Narrated by Tirmidhi and Ibn Majah. Tirmidhi said: This is a strange Hadith.
وَعَنْ جَابِرٍ(رضي الله عنه) ، قَالَ : قَالَ رَسُولُ اللهِ ﷺ : ثَلَاثَةٌ لَا تُقْبَلُ لَهُمْ صَلَاةً وَلَا تُصْعَدُ لَهُمْ حَسَنَةً: الْعَبْدُ الْآبِقُ حَتَّى يَرْجِعَ إِلَى مَوْلَاهُ، فَيَضَعَ يَدَهُ فِي أَيْدِيهِمْ، وَالْمَرْأَةُ السَّاخِطُ عَلَيْهَا زَوْجُهَا، وَالسَّكَرَانُ حَتَّى يَصْحُوَ». رَوَاهُ الْبَيْهَقِيُّ فِي شُعَبِ الْإِيْمَانِ».
Jabir (may Allah be pleased with him) narrated: The Messenger of Allah (ﷺ) said: “Three whose prayers are not accepted, and whose good deeds do not ascend: a runaway slave until he returns to his master and places his hand in theirs, a woman whose husband is displeased with her, and a drunkard until he sobers.” Narrated by Al-Bayhaqi in Shu‘ab al-Iman.

1 The statement: “Divorce is twice, etc.”: These two verses address revocable divorce, khul‘, and the final divorce. Regarding the first, His saying, “Divorce is twice”, clarifies that in the pre-Islamic era, the number of divorces was not fixed, allowing a man to divorce his wife multiple times (e.g., ten) and still take her back. He could revoke the divorce at the end of her waiting period, divorce her again, and repeat this cycle. A woman complained to Aishah about her husband’s repeated revocations and divorces, and when this was brought to the Messenger of Allah (ﷺ), the verse “Divorce is twice” was revealed. This means that revocable divorce, which allows revocation, is limited to two times, not more. After that, one must either keep her with kindness or release her with good treatment. This is a command in the form of a statement, as if to say: “Divorce revocably twice.” This interpretation is mentioned in Husayni, Zahidi, Baydawi, and Talwih, aligning with the views of Ash-Shafi‘i and Abu Hanifah.
2 The statement: “And if you wish to exchange a wife…”: It is reported that in the pre-Islamic era, if a man admired another woman for her beauty, wealth, or perfection and wanted to marry her by divorcing his current wife, he would falsely accuse his wife of immorality to force her to ransom herself with what he gave her. He did this to marry the other woman and take back his wealth deceitfully. Allah prohibited this, saying, “And if you wish to exchange a wife…”, meaning if you desire to replace one wife with another for beauty or perfection, having given the first a great amount, do not take anything back, as it would be unjust and sinful. How can you take it when you have been intimate and they have taken a solemn covenant, meaning companionship, intimacy, or Allah’s firm covenant in “Then, either keep [her] in an acceptable manner or release [her] with good treatment” [Al-Baqarah: 229], or the Prophet’s (ﷺ) saying, “Treat women kindly…” This is the verse’s meaning. The author of Hidayah cites this to argue that if the discord is from the husband, taking compensation is disliked, as in the chapter on khul‘: If the discord is from him, it is disliked to take compensation, per “And if you wish to exchange a wife…” to “do not take [back] from it anything” [An-Nisa: 20]. The term “qintar” (great amount) indicates dowry can be any amount, as it means vast wealth. It is narrated that Umar said on the pulpit, “Do not exaggerate women’s dowries.” A woman responded, “Do we follow your words or Allah’s: ‘And you have given one of them a great amount’?” Umar said, “Everyone is more knowledgeable than Umar. Marry with what you wish.” This verse also clearly supports Abu Hanifah’s view that dowry is confirmed by valid seclusion, as Allah prohibits taking back wealth, justified by intimacy (seclusion without barrier), as in Madarik and Tafsir al-Ahmadiyyah (summarized).
1 قوله: الطلاق مرتان إلخ: هاتان الآيتان في الطلاق الرجعي والخلع والغليظة، أما الأول ففي قوله تعالى: الطلاق مَرَّتَانِ ، وبيانه أنه لما كان عدد الطلاق في الجاهلية غير مقرر على وتيرة واحدة، حتى أنه لو طلقها عشرة يمكنه رجعتها، وكان يراجعها وقت انقضاء العدة، ثم يطلقها ويراجعها حتى أن جاءت امرأة إلى عائشة تشكر من مراجعة زوجها، ثم تطليقها، ثم وثم هكذا، فعرضت إلى رسول الله ، فنزل قوله تعالى: ﴿الطَّلَاقُ مَرَّتَانِ فَإِمْسَاكٌ بِمَعْرُوفٍ أَوْ تَسْرِيحٌ بِإِحْسَنِ يعني أن الطلاق الرجعي الذي يتعلق به الرجعة مرتان أي اثنان لا زائدتان، فبعد ذلك إمساكها بمعروف أو تسريحها كذلك، وهذا أمر بصيغة الخبر كأنه قيل : طلقوا الرجعي مرتين، وهذا هو التوجيه المذكور، وفي «الحسيني» و«الزاهدي» و «البيضاوي» و «التلويح : وهو الموافق لمذهب الشافعي وأبي حنيفة جميعا.
وههنا توجيه آخر موافق لمذهب أبي حنيفة فقط، اختاره صاحب الكشاف» و «المدارك وفخر الإسلام، وهو أن المراد بيان الطلاق الشرعي لا الرجعي، إن التطليق الشرعي تطليقة بعد تطليقة على التفريق دون الإرسال دفعة واحدة، ولم يرد بالمرتين التثنية التي يقع مرَّةً واحدةً، ولكن التكرير كقوله تعالى: ثُمَّ ارْجِعِ الْبَصَرَ كَرَّتَيْنِ أي كرة بعد كرة لا كرتين اثنين مرة واحدة؛ لأنه ليس من السنة إيقاع التطليقتين جملة، ويؤيده أنه قال: الطلاق مرتان ولم يقل الطلاق اثنان، وهو أمر بصيغة الخبر، وإلا يلزم الكذب؛ إذ قد يوجد الطلقتان على وجه الجمع، وعند الشافعي يجوز إرسال الاثنين والثلاث دفعة واحدة، وتفضيل المذاهب: أن الطلاق على ثلاثة أوجه أحسن وحسن وبدعي فالأحسن أن يطلقها واحدة في طهر لا وطء فيه ولم يزد عليه، والحسن عندنا أن يطلقها ثلاثة في ثلاثة أطهار أو ثلاثة أشهر، خلافا لمالك؛ فإنه بدعي عنده، والبدعي أن يطلقها اثنين أو ثلاثا في طهر واحد، أو في كلمة واحدة، أو واحدا في طهر وطئ فيه، أو في حيض موطوءة، خلافًا للشافعي في غير الحيض فإنه مباح عنده. ثم في الطلقة والطلقتين يجوز له الرجعة إذا كانت في العدة، ويكون الطلاق بلفظ الصريح، وأما إن انقضت العدة أو كانت كنايات بانت ويحل لها نكاحه ثانيا ونكاح غيره من الأزواج.
وفي الطلقات الثلاث سواء كانت صريحا أو كنايات بمال أو بغيره لا تحل له حتى تنكح زوجا غيره؛ لأن الله تعالى ذكر الطلاق الرجعي في آيتين إحداهما في قوله تعالى: ﴿وَالْمُطَلَّقَاتُ يَتَرَبَّصْنَ الآية، ثم عقب بعدها بالرجعة حيث قال: ﴿وَبُعُولَتُهُنَّ أَحَقُّ بِرَبِّهِنَّ ، وهو فيما إذا طلقها واحدة، والثاني في قوله تعالى: ﴿الطَّلَاقُ مَرَّتَانِ ، وهو الذي بلغ مرتين دفعة أولا وعقب بعدهما بالرجعة حيث قال: ﴿فَإِمْسَاكَ بِمَعْرُوفٍ أَوْ تَسْرِيحُ بإِحْسَانُ أي ليس بعد المرتين إلا الإمساك بمعروف بالمراجعة أو تسريح بإحسان بترك المراجعة حتى تبين بالعدة، وقيل: بالطلقة الثالثة في الطهر الثالث، ثم بين أن الرجعة بعد الثالثة حتى تنكح زوجا آخر، ويدخل ذلك الزوج بها، ثم تطليقها في قوله تعالى: ﴿فإن طَلَّقَهَا فَلَا تَحِلُّ لَه الآية، ثم بين أنه بعد ما بانت بالعدة من طلقتين أو طلقة يجوز أن ينكحها المطلق أو غيره في قوله تعالى: ﴿وَإِذَا طَلَّقْتُمُ النِّسَاءَ فَبَلَغْنَ أَجَلَهُنَّ ) الآية هذا هو تفصيل هذا المقام.
وأما الثاني ففي قوله تعالى: ﴿وَلَا يَحِلُّ لَكُمْ إلى آخره، وقال المفسرون في بيانه: إن جميلة كانت ينفض زوجها ثابت بن قيس، وهو يحبها، وقد أعطاها حديقة في مهرها من قبل، فاختلعت منه بها أي ردتها إليه، وجعلتها سببًا للطلاق منه، فطلقها وأخذ منها تلك الحديقة، وكان رسول الله ﷺ حثها لأجله، فلم تقبل إلا الفراق، فقال : أتردين عليه حديقة؟» قالت: نعم، وهو أول خلع كان في الإسلام، فنزلت هذه الآية، وقد ذكروا هذه القصة بنوع زيادة ونقصان، فمعنى الآية: لا يحل لكم أن تأخذوا وتعيدوا مما آتيتموهن شيئًا أي مما أعطيتموهن من المهور إلا أن يخافا أي في وقت من الأوقات إلا وقت إخافة عدم إقامة حدود الله، وهو عدم الموافقة بينهما بأن يحدث من المرأة النشوز وسوء الخلق وترك الأدب للزوج، ومن الزوج الضرب والشم بغير حق وغير ذلك، فَإِنْ خِفْتُمْ (البقرة: ۲۲۹) عدم إقامة حدود الله بهذه الطريق المذكور، فَلَا جُنَاحَ عَلَيْهِمَا ﴾ (البقرة: ۲۲۹) في مال افتدت المرأة بذلك المال المزوج، وتخلصت به نفسها منه، هذا ما قالوا، ويسمى هذا خُلعًا، وهو طلاق بائن.
ولكن يشترط فيه ذكر لفظ الخلع بأن يقول الزوج خالعتك على ألف درهم وقبلت، أو الزوجة خالعتني على كذا وقبل، حتى أنه لو لم يذكر لفظ الخلع أن يقول الزوج: طلقتك على ألف، أو الزوجة: طلقتني على ألف لا يُسمى خلعًا، بل طلاقا على مال، ولا بأس بالخلع عند الحاجة بما يصلح مهرا، فما جاز أن يكون مهرا في النكاح جاز أن يكون بدلا في الخلع دون العكس، وكره أخذ البدل إن كان النشوز من جانب الزوج وأخذ الفضل على المهر إن كان النشوز من جانب الزوجة، والخلع معاوضة في حقها حتى يصح رجوعها وشرط الخيار لها، ويقتصر على المجلس ويمين في حقه حتى انعكس الأحكام في حقه، هذا كله في كتب الفقه، ثم إنهم اختلفوا في أن الخلع فسخ أم طلاق؟ فقول الشافعي القديم وقول ابن عمرو ابن عباس : إنه فسخ لا طلاق، وعندنا وفي القول الجديد للشافعي واحدي الروايتين عن عثمان : إنه طلاق.
وذلك لما قال فخر الإسلام في بحث الخاص : إن الله تعالى ذكر الطلاق مرَّةً ومرتين وأعقبهما بإثبات الرجعة، ثم أعقب ذلك بالخلع بقوله تعالى: ﴿فَإِنْ خِفْتُمْ أَلَّا يُقِيمَا حُدُودَ الله فَلَا جُنَاحَ عَلَيْهِمَا فِيمَا أَفْتَدَتْ بِهِ﴾ (البقرة: ٢٢٩ فإنما بدأ بفعل الرجل، وهو الطلاق، ثم زاد فعل المرأة، وهو الاقتداء، وفي تحت إفراد المرأة بالذكر في قوله تعالى: ﴿فِيمَا افْتَدَتْ بِهِ ﴾ (البقرة: ۲۲۹ دليل على تقرير فعل الزوج، على ما سبق، وهو الطلاق لا الفسخ؛ لأن الافتدء وضع لإعطاء شيء بمقابلة شيء، فيدل على أن المال عوض ما تقابله وهو مختص بالمرأة، فيكون ما يقابله مختصا بالزوج، وهو الطلاق لا الفسخ، إذ الفسخ يقوم بهما، فإثبات الفعل فسخ من الزوج بطريق الخلع لا يكون عملا به، بل رفعا له. وثمرة الخلاف يظهر في أن عندنا يلحقها طلاق بعد الخلع.
وعنده لا يلحق، ولهذا أوصل قوله تعالى: ﴿فَإِن طَلَّقَهَا﴾ (البقرة: ۲۳۰ بقوله تعالى: ﴿الطَّلَقُ مَرَّتَانِ﴾ (البقرة: ۲۲۹ دون الخلع، وأما الثالث ففي قوله تعالى: ﴿فَإِن طَلَّقَهَا فَلَا تَحِلُّ لَهُ ﴾ (البقرة: ٢٣٠) الآية، وقد اختل في تفسيرها كلام أرباب العقول وعبارات أهل الأصول، فقال أكثر المفسرين: إنها متصلة بقوله تعالى: ﴿الطَّلَقُ مَرَّتَانِ﴾ (البقرة: ۲۲۹، يعني الطلاق الرجعي مرة أو مرتان، فإن طلقها بعدها تطليقة ثالثة فلا تحل له بعد ذلك أبدًا حَتَّى تَنكِحُ زَوْجًا غَيْرَهُ ﴾ (البقرة: ۲۳۰) آخر ، ثم دخل بها ذلك الزوج، فإن طلقها أي الزوج الثاني فَلَا جُنَاحَ عَلَيْهِمَا﴾ (البقرة: ٢٢٩ أي على الزوج الإدخال، والمرأة أن يتراجعا بالنكاح الجديد، إن كان في ظنهما أن يقيما حدود الله من حقوق الزوجية وحسن المعاشرة والموافقة، وعلى هذا التقدير بيان طلاق الخلع معترضة بينهما، وإنما جيء به تنبيها على أنه طلاق أيضًا، ودلالة على أن الطلاق يقع مجانا تارةً وبعوض أخرى، وقد أجمع أهل الأصول على أن ذكر الطلاق في قوله تعالى: ﴿فَإِن طَلَّقَهَا (البقرة: ۲۳۰) بلفظ الفاء عقيب ذكر الخلع دليل على شيئين، الأول: أن الطلاق يصح بعد الخلع عملا بالفاء، والثاني: أن الخلع أيضًا طلاق لا فسخ؛ لأنه لو كان فسخا لا يلحقه الطلاق بعده، وبقرينة قوله تعالى: فِيمَا افْتَدَتْ بِهِ﴾ (البقرة: ۲۲۹، على ما مر تقريره، التفسيرات الأحمدية» ملخصا.
۲ قوله: وإن أردتم استدبدال زوج إلخ ونقل في نزول هذه الآية أنه لما كان الرجل في الجاهلية؛ إذا أعجبته امرأة بالحسن والجمال والمال، وأراد أن ينكحها ويطلق الأولى رماها بفاحشة بهتانا وافتراءا، حتى يلجئها إلى الافتداء منها بما أعطاها، وإنما فعل ذلك ليتخلص إلى نكاح تلك المرأة الأخرى، وليأخذ المال من الأولى بالحيلة والبهتان، فنهى الله تعالى عنه، وقال فيه: ﴿وَإِنْ أَرَدتُّمُ اسْتِبْدَالَ زَوْجٍ﴾(النساء: ۲۰ الآية يعني أن أردتم يا أيها الأزواج استبدال زوجة مكان زوجة للجمال والكمال، والحال إنكم قد آتيتم إحدى الأولى قنطارا أي مالا عظيما، فلا تأخذوه شيئا، لا قليلا ولا كثيرا؛ لأن أخذكم هذا لمجرد البهتان والافتراء بالزنا، وكيف تأخذون المال، والحال إنكم ﴿وَقَدْ أَفْضَى بَعْضُكُمْ إِلَى بَعْضٍ﴾ (النساء: ۲۱ أي خلا بعضكم، وهو زوج مع بعض، وهو زوجة، وَأَخَذْنَ أي الأزواج منكُم مِيثَاقًا غَلِيظًا ﴾ (النساء: ۲۱، أي لحق الصحبة والمضاجعة أو أخذ الله لأجلهن عهدا وثيقا في قوله تعالى: ﴿فَإِمْسَاكٌ بِمَعْرُوفٍ أَوْ تَسْرِيحُ بِإِحْسَانُ﴾ (البقرة: ۲۲۹) أو أخذ النبي ﷺ ذلك في قوله: «استوصوا بالنساء خيرا الحديث هذا مضمون الآية.
وبهذه الآية تمسك صاحب الهداية في أن النشوز إن كان من قبل الرجل يكره له العوض حيث قال في باب الخلع: وإن كان النشوز من قبله يكره له ن يأخذ منها عوضًا لقوله عَزَّ وَجَلَّ: ﴿وَإِنْ أَرَدتُّمُ اسْتِبْدَالَ زَوْجٍ مَكَانَ زوج﴾ (النساء: ٢٠) إلى أن قال: ﴿فَلَا تَأْخُذُوا مِنْهُ شَيْئًا﴾ (النساء: ۲۰ هذا لفظه، وفي قوله تعالى: ﴿قنطارا﴾ دليل على أن المهر يصلح بالغا ما بلغ ؛ لأن معناه مالا عظيما، كما روي أنه قال عمر على المنبر : لا تغالوا بصدقات النساء، فقالت امرأة: أنتبع قولك أم قول الله: ﴿وَءَاتَيْتُمْ إِحْدَتهُنَّ قِنطَارًا﴾ (النساء: ۲۰؟ فقال عمر: كل واحد أعلم من عمر، تزوجوا على ما شئتم، وأيضًا في هذه الآية دليل ظاهر لأبي حنيفة بالله على أن المهر يؤكد بالخلوة الصحيحة حيث أنكر الله تعالى أخذ المال، وعلل ذلك بالإفضاء، وهو الاختلاط والخلوة بلا حائل، هكذا ذكره صاحب المدارك» و«التفسيرات الأحمدية مختصرا.
