عَنْ عِيَاضِ بْنِ حِمَارٍ قَالَ: قَالَ رَسُوْلُ اللهِ ﷺ: «مَنْ وَجَدَ لُقَطَةً فَلْيُشْهِدْ۱ذَا عَدْلٍ أَوْ ذَوِي عَدْلٍ، وَلَا يَكْتُمْ وَلَا يُغَيِّبْ، فَإِنْ وَجَدَ صَاحِبَهَا فَلْيَرُدَّهَا عَلَيْهِ، وَإِلَّا فَهُوَ مَالُ اللَّهِ عَزَّ وَجَلَّ يُؤْتِيهِ مَنْ يَشَاءُ» . رَوَاهُ أَحْمَدُ وَأَبُو دَاوُدَ وَالدَّارِيُّ. وَأَخْرَجَ الطَّحَاوِيُّ هَذَا الْحَدِيثَ، فَقَالَ: «فَلْيُشْهِدْ عَلَيْهَا ذَوِي عَدْلٍ مِنْ غَيْرِ شَكٍّ.
Iyad ibn Himar (may Allah be pleased with him) narrated that the Messenger of Allah (ﷺ) said: “Whoever finds lost property should have one or two just witnesses, not conceal or hide it. If its owner is found, return it to them; otherwise, it is Allah’s property, which He gives to whomever He wills.” [Narrated by Ahmad, Abu Dawud, and Ad-Darimi]
At-Tahawi narrated this narration, saying: “Have just witnesses testify to it without doubt.”

There are two opinions on the method of witnessing. First: Testify that a lost item was found without mentioning its details or features, lest a liar use this to claim it. Second: Testify to all its characteristics, so if the finder dies, the heir does not dispose of it. Some Shafi’is suggested a middle ground: Mention some characteristics but not all. An-Nawawi said: This is the sounder view. Shafi’i’s second opinion, along with Malik, Ahmad, and others, is that witnessing is not obligatory but recommended for caution, as the Prophet (ﷺ) did not command it in Zayd ibn Khalid’s narration, and if it were obligatory, he would have clarified it. I say: According to the Hanafis, witnessing is for establishing trust and removing liability only. They differed on this. According to Abu Hanifah, if they witness, there is no liability. If they do not witness and the owner confirms the finder took it to return it, this confirmation removes liability. If the owner denies it and the finder did not witness, they are liable. ۱قوله: فليشهد ظاهر الأمر يدلُّ على وجوب الإشهاد، وهو أحد قول الشافعي، وبه قال أبو حنيفة. وفي كيفية الإشهاد قولان، أحدهما: يشهد أنه وجد لقطة، ولا يعلم بالعقاص ولا غيره؛ لئلا يتوسل بذلك الكاذب إلى أخذها. والثاني: يشهد على صفاتها كلها حتى إذا مات لم يتصرف فيها الوارث. وأشار بعض الشافعية إلى التوسط بين الوجهين، فقال: لا يستوعب الصفات، ولكن يذكر بعضها. قال النووي: وهو الأصح والثاني من قول الشافعي: أنه لا يجب الإشهاد، وبه قال مالك وأحمد، وغيرهما قالوا: وإنما يستحب احتياطاً؛ لأن النبي الله لم يأمر به في حديث زيد بن خالد، ولو كان واجبا لبينه. قلت: إن الإشهاد عند الحنفية لعيين جهة الأمانة ورفع الضمان فقط.
واختلف فيه، فعند أبي حنيفة اذا أشهد ل ضمان عليه. وإذا لم يشهد وصدقه المالك بأن الملتقط أخذه ليرده على مالكه فتصديقه يرفع الضمان. وأما اذا كذبه وكان الملتقط لم يشهد عليه فعليه الضمان حينئذ أيضًا، وأما عندهما فتحقق الأمانة بوجهين: إما بالتصديق من المالك بأن يصدقه في الأخذ له أو باليمين. قال في البدائع: وأما حالة الضمان فهي أن يأخذها لنفسه؛ لأن المأخوذ لنفسه مغصوب، وهذا لا خلاف فيه، وإنما الخلاف في شيء آخر، وهو أن جهة الأمانة إنما تعرف من جهة الضمان، إما بالتصديق أو بالاشهاد عند أبي حنيفة، وعندهما بالتصديق أو باليمين، حتى لو هلكت فجاء صاحبها وصدقه في الأخذ له لا يجب عليه الضمان بالإجماع، وإن لم يشهد ؛ لأن جهة الأمانة قد ثبتت بتصديقه، وإن كذبه في ذلك فكذا عند أبي يوسف ومحمد رحمنا، أشهد أو لم يشهد، ويكون القول قول الملتقط مع يمينه.
وأما عند أبي حنيفة، فإن أشهد فلا ضمان عليه؛ لأنه بالإشهاد ظهر كان الأخذ أن لصاحبه، فظهر أن يده يد أمانة، وإن لم يشهد يجب عليه الضمان انتهى. قال الشوكاني: قوله: يؤتيه من يشاء استدل به من قال: إن الملتقط يملك اللقطة بعد أن يعرف بها حولاً وهو أبو حنيفة، لكن بشرط أن يكون فقيرًا. واستدلوا على اشتراط الفقر بقوله في هذا الحديث: فهو مال الله، قالوا: وما يضاف إلى الله إنما يتملكه من يستحق الصدقة. قلت: لم يقل الحنفية بتملكها بعد التعريف حولاً، بل قالوا: إن اللقطة تبقى على ملك مالكها، وإن أكلها الملتقط حال كونه فقيرًا، فإن الأكل لم يقع على ملكه، بل وقع على ملك مالكه بالإباحة الشرعية، والمباح له لا يكون مالكا، بل يكون أكلا على ملك المبيح. كذا في بذل المجهود.
وَعَنْ سَهْلِ بْنِ سَعْدٍ (رضي الله عنه) أَنَّ عَلِيَّ بْنَ أَبِي طَالِبٍ دَخَلَ عَلَى فَاطِمَةَ وَحَسَنُ وَحُسَيْنُ يَبْكِيَانِ فَقَالَ مَا يُبْكِيهِمَا؟ قَالَتْ: الْجُوعُ ، فَخَرَجَ عَلِيَّ فَوَجَدَ دِينَارًا بِالسُّوقِ، فَجَاءَ إلَى فَاطِمَةَ وَأَخْبَرَهَا، فَقَالَتْ: اذْهَبْ إِلَى فُلَانٍ الْيَهُودِيَّ فَخُذْ لَنَا دَقِيقًا، فَجَاءَ الْيَهُودِيَّ فَاشْتَرَى بِهِ، فَقَالَ الْيَهُودِيُّ: أَنْتَ خَتَنُ هَذَا الَّذِي يَزْعُمُ أَنَّهُ رَسُولُ اللَّهِ؟ قَالَ: نَعَمْ، قَالَ: فَخُذْ دِينَارَكَ وَلَكَ الدَّقِيقُ، فَخَرَجَ عَلِيٌّ حَتَّى جَاءَ بِهِ فَاطِمَةَ فَأَخْبَرَهَا، فَقَالَتْ: اذْهَبْ إِلَى فُلَانٍ الْجَزَارِ فَخُذْ لَنَا بِدِرْهَم لَحْمًا فَذَهَبَ فَرَهَنَ الدِّينَارَ بِدِرْهَم لَحْمٍ، فَجَاءَ بِهِ، فَعَجَنَتْ وَنَصَبَتْ وَخَبَزَتْ، وَأَرْسَلَتْ إِلَى أَبِيهَا الله فَجَاءَهُمْ، فَقَالَتْ: يَا رَسُولَ اللَّهِ، أَذْكُرُ لَكَ فَإِنْ رَأَيْتَهُ لَنَا حَلَالًا أَكَلْنَاهُ، وَأَكَلْتَ مَعَنَا مِنْ شَأْنِهِ كَذَا وَكَذَا، فَقَالَ: «كُلُوا بِاسْمِ اللَّهِ». فَأَكَلُوا۱ فَبَيْنَمَا هُمْ مَكَانَهُمْ إِذَا غُلَامٌ يَنْشُدُ اللهَ وَالْإِسْلَامَ الدِّينَارَ، فَأَمَرَ رَسُولُ اللهِ ﷺ فَدُعِيَ لَهُ فَسَأَلَهُ، فَقَالَ: سَقَطَ مِنِّي فِي السُّوقِ، فَقَالَ النَّبِيُّ : يَا عَلِيُّ اذْهَبْ إِلَى الْجَزَارِ، فَقُلْ لَهُ: إِنَّ رَسُولَ اللهِ ﷺ يَقُولُ لَكَ : أَرْسِلْ إِلَيَّ بِالدِّينَارِ وَدِرْهَمُكَ عَلَيَّ، فَأَرْسَلَ بِهِ فَدَفَعَهُ رَسُولُ اللهِ ﷺ إِلَيْهِ. رَوَاهُ أَبُو دَاوُدَ وَرَوَاهُ عَبْدُ الرَّزَّاقِ فِي مُصَنَّفِهِ، وَفِيهِ: «أَنَّهُ عَرَّفَهُ۲ ثَلَاثَةَ أَيَّامٍ».
وَفِي رِوَايَةٍ لِمُسْلِمٍ: عَرِّفْهَا۳ فَإِنْ جَاءَ أَحَدٌ يُخْبِرُكَ بِعَدَدِهَا وَوِعَائِهَا وَوِكَائِهَا فَأَعْطِهَا إِيَّاهُ، وَإِلَّا فَاسْتَمْتِعْ بِهَا».
وَفِي رِوَايَةٍ لِأَبِي دَاوُدَ: قَالَ أُبَيُّ ابْنُ كَعْبٍ: وَجَدْتُ صُرَّةً فِيهَا مِائَةُ دِينَارٍ فَأَتَيْتُ النَّبِيَّ ﷺ فَقَالَ: «عَرَّفْهَا حَوْلًا»، فَعَرَّفْتُهَا ٤ حَوْلًا ثُمَّ أَتَيْتُهُ فَقَالَ: «عَرَّفْهَا حَوْلًا»، فَعَرَّفْتُهَا حَوْلًا ثُمَّ أَتَيْتُهُ، فَقَالَ: «عَرِّفْهَا حَوْلًا» ، فَعَرَّفْتُهَا حَوْلًا ، ثُمَّ أَتَيْتُهُ فَقُلْتُ: لَمْ أَجِدْ مَنْ يَعْرِفُهَا، فَقَالَ:احْفَظْ عَدَدَهَا وَوَكَاءَهَا وَوِعَاءَهَا، فَإِنْ جَاءَ صَاحِبُهَا وَإِلَّا فَاسْتَمْتِعْ بِهَا»٥.
وَرَوَى الْبَزَّارُ وَالدَّارِ قُطْنِي عَنْ أَبِي هُرَيْرَةَ لله أَنَّ رَسُولَ اللَّهِ ﷺ سُئِلَ عَنِ النُّقْطَةِ، فَقَالَ: «لَا يُحِلُّ النُّقْطَةُ شَيْئًا، فَلْيُعَرِّفْهُ سَنَةً، فَإِنْ جَاءَ صَاحِبُهُ فَلْيَرُدَّهُ إِلَيْهِ، وَإِنْ لَمْ يَأْتِ فَلْيَتَصَدَّقْ٦ بِهِ، فَإِنْ جَاءَ فَيُخَيَّرُهُ بَيْنَ الْأَجْرِ وَبَيْنَ الَّذِي لَهُ»٩.
وَرَوَى٧ عَنِ ابْنِ عَبَّاسٍ لا أَنَّهُ قَالَ: يَتَصَدَّقُ بِهَا الْغَنِيُّ وَلَا يَنْتَفِعُ بِهَا وَلَا يَتَمَلَّكُهَا».
وَفِي رِوَايَةٍ لِأَبِي دَاوُدَ: أَنَّ رَسُوْلَ اللهِ اللهِ سُئِلَ عَنِ اللُّقْطَةِ، فَقَالَ: «عَرَّفْهَا سَنَةً»، فَإِنْ فَإِنْ جَاءَ بَاغِيهَا فَأَدِّهَا إِلَيْهِ، وَإِلَّا فَاعْرِفْ عِفَاصَهَا وَوِكَاءَهَا، ثُمَّ كُلْهَا۸ فَإِنْ جَاءَ بَاغِيهَا فَأَدَّهَا إِلَيْهِ».
وَفِي الْمُتَّفَقِ عَلَيْهِ عَنْ زَيْدِ بْنِ خَالِدٍ الله قَالَ: سُئِلَ رَسُولُ اللَّهِ ﷺ عَنِ اللُّقَطَةِ الذَّهَبِ أَوْ الْوَرِقِ، فَقَالَ: اعْرِفْ وَكَاءَهَا وَعِفَاصَهَا، ثُمَّ عَرِّفْهَا سَنَةً، فَإِنْ لَمْ تَعْرِفْ فَاسْتَنْفِقْهَا۱۰ وَلْتَكُنْ وَدِيعَةً عِنْدَكَ، فَإِنْ جَاءَ طَالِبُهَا يَوْمًا مِنَ الدَّهْرِ فَأَدَّهَا إِلَيْهِ».
Sahl ibn Sa’d (may Allah be pleased with him) narrated that Ali ibn Abi Talib entered Fatimah’s house while Hasan and Husayn were crying. He asked, “What makes them cry?” She said, “Hunger.” Ali went out and found a dinar in the market. He came to Fatimah and informed her. She said, “Go to so-and-so, the Jew, and buy us flour.” He went to the Jew and bought with it. The Jew said, “Are you the son-in-law of the one who claims to be Allah’s Messenger?” He said, “Yes.” The Jew said, “Take your dinar, and the flour is yours.” Ali returned to Fatimah with it and informed her. She said, “Go to so-and-so, the butcher, and buy us meat for a dirham.” He went, pawned the dinar for a dirham’s worth of meat, and brought it. She kneaded, prepared, and baked. She sent for her father (ﷺ), who came. She said, “O Messenger of Allah, I will tell you, and if you see it as lawful for us, we will eat it, and you will eat with us. The matter is such-and-such.” He said, “Eat in the name of Allah.” They ate. While they were there, a boy cried out, invoking Allah and Islam, about the dinar. The Messenger of Allah (ﷺ) ordered him summoned and asked him. He said, “It fell from me in the market.” The Prophet (ﷺ) said, “O Ali, go to the butcher and say, ‘The Messenger of Allah (ﷺ) says: Send me the dinar, and your dirham is on me.’” He sent it, and the Messenger of Allah (ﷺ) gave it to him. [Narrated by Abu Dawud]
Abdul-Razzaq narrated in his Musannaf: “He announced it for three days.”
In a narration by Muslim: “Announce it. If someone comes and informs you of its number, container, and tie, give it to them; otherwise, use it.”
In a narration by Abu Dawud: Ubayy ibn Ka’b said: “I found a purse with a hundred dinars and came to the Prophet (ﷺ). He said, ‘Announce it for a year.’ I announced it for a year, then came to him. He said, ‘Announce it for a year.’ I announced it for a year, then came to him. He said, ‘Announce it for a year.’ I announced it for a year, then came and said, ‘I found no one who recognizes it.’ He said, ‘Preserve its number, tie, and container. If its owner comes, give it to them; otherwise, use it.’”
Al-Bazzar and Ad-Daraqutni narrated from Abu Hurairah that the Messenger of Allah (ﷺ) was asked about found property and said: “Found property does not make anything lawful. Announce it for a year. If its owner comes, return it to them. If not, give it in charity. If they come, give them the choice between the reward or their property.”
It is narrated from Ibn Abbas that he said: “The rich give it in charity and neither use nor own it.”
In a narration by Abu Dawud: The Messenger of Allah (ﷺ) was asked about found property and said: “Announce it for a year. If its seeker comes, give it to them. Otherwise, note its container and tie, then consume it. If its seeker comes, deliver it to them.”
In the agreed-upon narration from Zayd ibn Khalid: He said: The Messenger of Allah (ﷺ) was asked about found gold or silver. He said, “Note its tie and container, then announce it for a year. If it is not recognized, spend it, but let it remain a trust with you. If its seeker comes one day, deliver it to them.”

۱قوله: فأكلوا وليس فيه ما يدلُّ على عدم التعريف، ولا على عدم التوقف قدر ما يغلب على الظن أن صاحبه لا يطلبه، فإن الفاء قد تأتي لمجرد البعدية، فتقييد الترتيب، وعلى تقدير أن تكون للتعقيب فهو في كل شيء بحسبه. ألا ترى أنه يقال : تزوج فلان فولد له إذا لم يكن بينهما إلا مدة الحمل، وإن كانت مدة متطاولة، وقال تعالى: ﴿أَلَمْ تَرَ أَنَّ اللَّهَ أَنزَلَ مِنَ السَّمَاءِ مَاءً فَتُصْبِحُ الْأَرْضُ مُخْضَرَةً (الحج: ٦٣). قاله في المرقاة». وقال في «نصب الراية»: ولعل تأويله أن التعريف ليس له صيغة يعتد بها، فمراجعته لرسول الله ﷺ على ملأ الخلق إعلان به ، فهذا يؤيد الاكتفاء بالتعريف مرة واحدة، انتهى. ثم اختلفوا في مدة التعريف قدرها محمد ومالك والشافعي بحول من غير فصل بين القليل وبين الكثير بظاهر بعض الأحاديث. والصحيح عند أبي حنيفة وأبي يوسف أنها غير مقدرة بمدة معلومة، بل هي مفوضة بهذه الأحاديث إلى رأي الملتقط، فيعرفها إلى أن يغلب على ظنه أن صاحبها لا يطلبها بعد ذلك، هذا هو الذي اختاره الشمس الأئمة السرخسي. وفي جامع المضمرات» و «الجوهرة»: عليه الفتوى. وذكرُ السَّنَةِ في الحديث وقع اتفاقا باعتبار الغالب، شرح الوقاية» و «عمدة الرعاية» و«اللمعات» ملتقط منها.
۲ قوله : عرفه ثلاثة أيام فيه دليل لمختار شمس الأئمة من أن التقدير بحول وغيره ليس بلازم، بل إلى أن تسكن نفسه إلى أن طالبه قطع نظره عنه. كذا في «فتح القدير».
۳ قوله : عرفها إلخ والصحيح أن شيئًا من تقدير التعريف ليس بلازم، وإن تفويض التقدير إلى رأي الملتقط لإطلاق هذا الحديث. والتقييد بالسنة لعله لكون اللقطة المسئول عنها كانت تقتضي ذلك، كذلك في «المرقاة».
٤قوله: فعرفتها حولا إلخ واستدل على ما اختاره شمس الأئمة بهذا الحديث أن ليس السنة بتقدير لازم، بل ما يقع عند المتلقط أن صاحبه يتركه أولا، وهذا يختلف باختلاف خطر المال. ألا ترى أن المال لما كان ذا خطر كبير أمره أن يعرفه ثلاث سنين. قاله في فتح القدير».
٥قوله: فاستمتع بها هذا الحديث بظاهره يخالف ما ذهب إليه الأحناف من أنه إذا كان الملتقط غنيا لا يجوز له الانتفاع بها. وهذا الحديث يدلُّ على أن الملتقط إذا كان غنيا يجوز له الانتفاع بها؛ لأن أبي بن كعب كان من مياسير أصحاب النبي له وأغنيائهم، ومع هذا فأباح رسول الله ﷺ الانتفاع بها. فالجواب عنه ما في الصحيحين عن أبي طلحة. قلت: يا رسول الله، إن الله تعالى يقول: ﴿لَن تَنَالُوا الْبِرَّ حَتَّى تُنفِقُوا مِمَّا تُحِبُّونَ (آل عمران: ٩٢) وإن أحب أموالي إلي بيرحاء، فما ترى يا رسول الله ؟ فقال رسول الله : اجعلها في فقراء قرابتك، فجعلها أبو طلحة في أبي وحسان، انتهى. فهذا صريح في أن أبيا كان فقيرًا، لكن يحتمل أنه أيسر بعد ذلك، وقضايا الأحوال متى تطرق إليها الاحتمال سقط منها الاستدلال، بذل المجهود» و «نصب الراية» ملخصا.
وقال في «الهداية»: وانتفاع أبي الله كان بإذن الإمام، وهو جائز بإذنه، انتهى. وقال الترمذي عقيب حديث أبي: والعمل عليه عند أهل العلم، وهو قول الشافعي وأحمد وإسحاق قالوا لصاحب اللقطة: إن ينتفع بها إذا كان غنيا. ولو كانت اللقطة لا تحل إلا لمن تحل له الصدقة، لم تحل لعلي بن أبي طالب، وقد أمره عليه بأكل الدينار حين وجده ولم يجد من يعرفه، انتهى. وغرض الترمذي أنه انتفاع به لا تصدق. وقد أجاب عنه الإمام السرخسي في مبسوطه فقال: وأما حديث علي فنقول: إن الصدقة الواجبة كانت لا تحل، وهذا لم تكن من تلك الجملة، بل أنه صدقة نافلة، وهي جائزة لأهل البيت عند أكثرنا، ولذا قلنا بجواز اللقطة على الفروع والأصول، فافترق الزكاة والتصدق باللقطة بذل المجهود و العرف الشذي ملتقط منهما.
٦قوله: فليتصدق به إلخ : قال القاضي : إن من التقط لقطة وعرفها سَنَةً ولم يظهر صاحبها، كان له تملكها، سواء كان غنيا أو فقيرًا، وإليه ذهب الشافعي وأحمد. وروي عن ابن عباس لما أنه قال: يتصدق بها الغني، ولا ينتفع بها، ولا يتملكها، وبه قال أصحاب أبي حنيفة ، ويؤيدنا هذا الحديث، أخذته من «المرقاة».
٧قوله: روي عن ابن عباس إلخ : كذا في «المرقاة».
۸ قوله : ثم كلها فإن جاء باغيها فأدها إليه : قال الحافظ واختلف العلماء فيما إذا تصرف في اللقطة بعد تعريفها سنة، ثم جاء صاحبها هل يضمنها له أم لا ؟ فالجمهور على وجوب الرد إن كانت العين موجودة أو البدل إن كانت استهلكت. وخالف في ذلك الكرابيسي صاحب الشافعي، ووافقه صاحباه البخاري وداود بن علي إمام الظاهرية لكن وافق داود الجمهور إذا كانت العين قائمة. ومن حجة الجمهور قوله في الرواية الآتية: ولتكن وديعة عندك»، وقوله أيضًا عند مسلم: فأعرف عفاصها ووكائها، ثم كلها، فإن جاء صاحبها فأدها إليه وأصرح من ذلك رواية أبي داود بلفظ: فإن جاء باغيها فأدها إليه وإلا فاعرف عفاصها ووكائها، ثم كلها، فإن جاء باغيها فأدها إليه فأمر بأدائها إليه قبل الإذن في أكلها وبعده، وهي أقوى حجة الجمهور. كذا في بذل المجهود».
٩قوله: فأدها إليه: يعني فإن بين مدعيها علامتها حل الدفع، ولا يجب بلا حجة، هذا عندنا. وعند الشافعي يجب الدفع إن بين العلامة، أي لا يجب عندنا الدفع قضاء بلا بينة، وأما ديانة فيردها شرح الوقاية» و«العرف الشذي» ملتقط منهما، وقال في العناية»: ونحن نقول: الأمر في هذا الحديث وجب حمله للإباحة لأجل العمل بالحديث المشهور، وهو قوله : البينة على المدعي الحديث. فإنه لو لم يحمل على الإباحة وحمل الوجوب لزم التعارض المستلزم للترك.
۱۰ قوله: فاستنفقها إلخ: وفي هذه الجملة دلالة ظاهرة على أن اللقطة وديعة عند الملتقط، فالأمر بالاستنفاق على نفسه ما كانت على سبيل التمليك، بل لأنها كانت سبيلها التصدق، فإذا كان الملتقط محلا للصدقة فقيرا ذا حاجة أباحله التصدق على نفسه؛ لأن رسول الله له أمر بعد الإنفاق على نفسه إن جاء صاحبها بعد الإنفاق فأدها إليه أي إن كان موجودًا، وبالبدل إن كان مستهلكا. كذا في بذل المجهود».
وَعَنْ جَابِرٍ (رضي الله عنه)قَالَ: رَخَّصَ لَنَا رَسُولُ اللهِ ﷺ فِي الْعَصَا وَالسَّوْطِ وَالْحَبْلِوَأَشْبَاهِهِ يَلْتَقِطُهُ الرَّجُلُ يَنْتَفِعُ بِهِ۱. رَوَاهُ أَبُو دَاوُدَ.
Jabir (may Allah be pleased with him) narrated: The Messenger of Allah (ﷺ) permitted us to take a stick, whip, rope, or similar items for the finder to use. [Narrated by Abu Dawud]

1 The statement: Use it, Imam As-Sarakhsi said in Al-Mabsut: Found items are of two types. First: Those the owner is unlikely to seek, like pomegranate peels or date pits. Second: Those the owner is likely to seek. The first type may be taken and used, but if the owner finds it in the finder’s possession after collecting it, they may take it, as the owner’s discarding it permits use, not ownership, as ownership from an unknown person is invalid. The owner’s ownership does not cease by permission, but the permitted may use it while the owner’s ownership remains. If the owner finds it, they find their property, as the Prophet (ﷺ) said, “Whoever finds their property is most entitled to it.” The second type, which the owner seeks, must be preserved and announced to return to its owner. Summarized. I say: If a stick, whip, or rope is among trivial items the owner does not seek, it need not be announced, and the finder may use it. ۱ قوله: ينتفع به قال الإمام السرخسي في مبسوطه ثم ما يجده نوعان، أحدهما ما يعلم أن مالكه لا يطلبه كقشور الرمان والنوى والثاني: ما يعلم أن مالكه يطلبه، فالنوع الأول له أن يأخذه وينتفع به إلا أن صاحبه إذا وجده في يده بعد ما جمعه كان له أن يأخذ منه؛ لأن إلقاء ذلك من صاحبه كان إباحة الانتفاع به للواجد ولم يكن تمليكا من غيره، فإن التمليك من المجهول لا يصح، وملك المبيح لا يزول بالإباحة، ولكن للمباح له أن ينتفع به مع بقاء ملك المبيح فإذا وجده في يده فقد وجد عين ملكه ، قال : من وجد عين ماله فهو أحق به»، وأما النوع الثاني فهو ما يعلم أن صاحبه يطلبه، فمن يرفعه فعليه أن يحفظه ويعرفه ليوصله إلى صاحبه ملخصا . قلت: فالعصا والسوط والحبل إن كان بحيث تدخل في الأشياء التافهة التي لا تطلبه المالك، فحكمها أنه لا يجب تعريفها، ويجوز الانتفاع بها للملتقط. وإن كان من النوع الثاني فلا يجوز الانتفاع بها، ويجب تعريفها على حسب قيمتها. كذا في بذل المجهود».
وَعَنْ أَنَسٍ(رضي الله عنه) أَنَّ النَّبِيَّ ﷺ مَرَّ بِتَمْرَةٍ فِي الطَّرِيقِ قَالَ: «لَوْلَا أَنِّي أَخَافُ أَنْ تَكُوْنَ مِنَ الصَّدَقَةِ لَأَكَلْتُهَا». مُتَّفَقٌ عَلَيْهِ. وَفِيهِ إِبَاحَةُ الْمُحَقَّرَاتِ فِي الْحَالِ.۱
وَأَيْضًا فِي الْمُتَّفَقِ عَلَيْهِ: قَالَ: فَضَالَّةُ الْغَنَمِ؟ قَالَ: هِيَ لَكَ أَوْ لِأَخِيكَ أَوْ لِلذَّنْبِ» قَالَ: فَضَالَّةُ الْإِبِلِ؟۲ قَالَ: «مَا لَكَ وَلَهَا، مَعَهَا سِقَاؤُهَا وَحِدَاؤُهَا، تَرِدُ الْمَاءَ وَتَأْكُلُ الشَّجَرَ، حَتَّى يَلْقَاهَا رَبُّهَا».

Anas (may Allah be pleased with him) narrated that the Prophet (ﷺ) passed by a date on the road and said: “Were it not that I fear it might be from charity, I would have eaten it.” [Agreed upon]
This indicates the permissibility of trivial items immediately.
In the agreed-upon narration: He was asked about stray sheep. He said, “It is for you, your brother, or the wolf.” He was asked about stray camels. He said, “What have you to do with it? It has its water and feet, drinks water, eats trees, until its owner finds it.”
Malik narrated in Al-Muwatta from Ibn Shihab: Stray camels in Umar ibn Al-Khattab’s time were left to multiply, untouched by anyone. In Uthman ibn Affan’s time, he ordered their announcement, then sale, and if the owner came, they were given the price. Muhammad narrated similarly in his Muwatta, saying “mursalah” instead of “mu’abbala.”

وَعَنْ زَيْدِ بْنِ خَالِدٍ (رضي الله عنه) قَالَ: قَالَ رَسُوْلُ اللهِ ﷺ: «مَنْ آوَى ضَالَّةً فَهُوَ۱ ضَالُّ مَا لَمْ يُعَرِّفْهَا». رَوَاهُ مُسْلِمٌ. وَرَوَى مُحَمَّدٌ عَنْ عُمَرَ بْنِ الْخَطَابِ اللهِ نَحْوَهُ، وَقَالَ: وَبِهَذَا نَأْخُذُ، وَإِنَّمَا يَعْنِي بِذَلِكَ مَنْ أَخَذَهَا لِيَذْهَبَ بِهَا، فَأَمَّا مَنْ أَخَذَهَا لِيَرُدَّهَا أَوْ لِيُعَرِّفَهَا فَلَا بَأْسَ بِهِ.
Zayd ibn Khalid (may Allah be pleased with him) narrated that the Messenger of Allah (ﷺ) said: “Whoever shelters a stray is astray unless they announce it.” [Narrated by Muslim]
Muhammad narrated from Umar ibn Al-Khattab something similar, saying: This is what we adopt. It refers to one who takes it to keep it. If taken to return or announce it, there is no harm.

Mu’adhah Al-Adawiyyah narrated that a woman asked Aishah, saying: “I found a stray item in the Sanctuary and announced it, but found no one who recognizes it.” Aishah said to her: “Use it.” [Narrated by As-Sahawi]
Ibn Al-Mundhir said: Similar reports are narrated from Umar, Ibn Abbas, and Ibn Al-Musayyib.
The verses from the Qur’an cited are: “Allah instructs you concerning your children: for the male, what is equal to the share of two females. But if there are only daughters, two or more, for them is two-thirds of what he leaves. And if there is only one, for her is half. And for his parents, to each one of them is a sixth of what he leaves if he had a child. But if he had no child and his parents inherit from him, then for his mother is one-third. And if he had brothers, then for his mother is a sixth, after any bequest he may have made or debt. Your parents and your children, you do not know which of them are nearest to you in benefit. This is an obligation from Allah. Indeed, Allah is ever Knowing and Wise. And for you is half of what your wives leave if they have no child. But if they have a child, then for you is one-fourth of what they leave, after any bequest they may have made or debt. And for them is one-fourth of what you leave if you have no child. But if you have a child, then for them is one-eighth of what you leave, after any bequest you may have made or debt. And if a man or woman leaves neither ascendants nor descendants but has a brother or a sister, then for each one of them is a sixth. But if they are more than that, they share in one-third, after any bequest that was made or debt, as long as it causes no harm. This is a commandment from Allah, and Allah is ever Knowing and Forbearing” [An-Nisa: 11-12]. And His saying: “They request from you a ruling. Say, ‘Allah gives you a ruling concerning one who has neither descendants nor ascendants. If a man dies, leaving no child but a sister, she will have half of what he leaves. And he inherits from her if she has no child. But if there are two sisters, they will have two-thirds of what he leaves. And if there are brothers and sisters, the male will have the share of two females.’ Allah makes clear to you lest you go astray. And Allah is Knowing of all things” [An-Nisa: 176]. 1 The statement: Use it, Scholars differed on found property in Makkah. One group said it is not lawful to own after announcement; the finder must preserve it forever for its owner, only announcing it until the owner comes, based on the saying about the Sanctuary: “Its found property is not lawful except for its announcer,” as held by Shafi’i. Another group said there is no difference between the Sanctuary and elsewhere; its ruling is like other places, as held by Abu Hanifah, Malik, and Ahmad. Ibn Al-Mundhir said: We narrate this view from Umar, Ibn Abbas, Aishah, and Ibn Al-Musayyib, supported by these reports and the general saying, Note its container and tie, and announce it for a year, without distinguishing between the lawful and the Sanctuary. Giving it in charity after the announcement period preserves the owner’s ownership in a way, as it earns reward, like other cases. The saying about Makkah, Its found property is not lawful except for its announcer, does not contradict, as it means it is only lawful for one who announces, not for themselves. Specifying Makkah is to dispel the notion that announcement is unnecessary due to Makkah being a place of strangers coming from afar and dispersing, suggesting the property is likely a stranger’s with unknown return, making announcement futile. The Messenger of Allah (ﷺ) dispelled this by saying, Its found property is not lawful except for its announcer. The saying, He prohibited the found property of pilgrims, as Ibn Wahb said in Al-Fath, means to leave it until its owner comes. This is not practiced today due to widespread theft in Makkah, even around the Ka’bah, let alone abandoned items. Rulings established with a condition, if contradicted with a corrupting factor, are discontinued, unlike rulings established for a reason whose absence does not corrupt continuity, like brisk walking and uncovering the shoulder in tawaf to show strength. 1 The statement: In the Book of Allah, meaning in His rulings and obligations. The term “Book” often refers to obligation. This is used by the followers of Abu Hanifah as evidence for the inheritance of distant relatives, supported by the hadith of Al-Miqdam: “The maternal uncle is the heir of one who has no heir.” As stated in Al-Marqah.
2 The statement: And those with whom you have made a pledge, The author of Al-Madarik said: This refers to the contract of alliance, which is legislated, and inheritance through it is established according to most Companions, and this is our view. Shafi’i said: Alliance is nothing, as it nullifies the right of the public treasury. Our evidence is this verse, which pertains to alliance. As stated in At-Tafsir Al-Ahmadiyyah.
3 The statement: And Allah will never grant the disbelievers a way over the believers, As stated in Umdat Al-Qari: A disbeliever does not inherit from a Muslim by consensus, supported by the hadith and this verse. Inheritance establishes a way for the disbeliever over the Muslim.
۱ قوله: استنفعي بها اختلف العلماء في لقطة مكة، فقالت طائفة: لا يحل لأحد تملكها بعد التعريف، بل يجب على الملتقط أن يحفظها أبدا لمالكها، وليس لواجدها إلا إنشادها، ويجب التعريف فيها إلى أن يجيء صاحبها؛ لقوله في الحرم: ولا يحل لقطتها إلا لمنشدها، وبه قال الشافعي وقالت طائفة : لا فرق بين لقطة الحرم وغيره، حكمها كحكم سائر البلدان فلقطة الحل والحرم سواء، وهو قول أبي حنيفة ومالك وأحمد. وقال ابن المنذر: وروينا هذا القول عن عمر وابن عباس وعائشة وابن المسيب. ولنا هذه الآثار، وإطلاق قوله : اعرف عفاصها أي وعائها، ووكائها أي رباطها، وعرفها سنة من غير فصل بين الحل والحرم، ولأنها لقطة، وفي التصدق بعد مدة التعريف إبقاء ملك المالك من وجه؛ لتحصيل الثواب فيملكه، كما في سائرها، وأما قوله في مكة:ولا تحل لقطتها إلا لمنشدها، فقال في «الفتح»: لا يعارضه؛ لأن معناه لا يحل إلا لمن يعرف، ولا يحل لنفسه.
وتخصيص مكة حينئذ لدفع وهم سقوط التعريف بها بسبب أن الظاهر أن مكة مكان الغرباء؛ لأن الناس يأتون إليه من كل فج عميق ثم يتفرقون، فالغالب أن اللقطة للغريب، لا يدرى عوده، فلا فائدة إذا في التعريف، فينبغي أن يسقط التعريف؛ لعدم الفائدة، فأزال رسول الله له ذلك الوهم بقوله : لا تحل لقطتها إلا لمنشدها. وأما قوله : نهى عن لقطة الحاج، فقال في «الفتح»: قال ابن وهب يعني يتركها حتى يجيء صاحبها. ولا عمل على هذا في هذا الزمان لفشو السرقة بمكة من حوالي الكعبة فضلا عن المتروك، فالأحكام إذا علم شرعيتها باعتبار شرط، ثم علم ثبوت ضده متضمنا مفسدة بتقدير شرعيته معه علم انقطاعها، بخلاف العلم بشرعيتها لسبب إذا علم انتفاؤه، ولا مفسدة في البقاء فإنه لا يلزم ذلك كالرمل والاضطباع في الطواف لإظهار الجلادة، عمدة القاري» و«المرقاة» و «البناية» و«فتح القدير» ملتقط منها.
۱قوله: في كتاب الله أي في أحكامه وفرائضه والكتاب كثيرًا ما يجيء بمعنى الفريضة، واستدل به أصحاب أبي حنيفة الله على توريث ذوي الأرحام، وينصره حديث المقدام والخال وارث من لا وارث له. كذا في «المرقاة».
۲ قوله: والذين عقدت أيمانكم إلخ : وقال صاحب المدارك والمراد به عقد الموالات، وهي مشروعة، والوراثةبها ثابتة عند عامة الصحابة، وهو قولنا. وقال الشافعي الموالات ليس بشيء؛ لأن فيه إبطال حق بيت المال. ولنا هذه الآية، وهي في الموالات. كذا في «التفسيرات الأحمدية».
۳ قوله: ولن يجعل الله للكافرين على المؤمنين سبيلا : وقال في عمدة القاري»: إن الكافر لا يرث المسلم بالإجماع وبالحديث وبهذه الآية، وفي الميراث إثبات السبيل للكافر على المسلم.
