عَنِ ابْنِ عُمَرَ (رضي الله عنه)أَنَّ عُمَرَ أَصَابَ أَرْضًا بِخَيْبَرَ، فَأَتَى النَّبِيَّ ﷺ فَقَالَ: يَا رَسُولَ اللَّهِ، إِنِّي أَصَبْتُ أَرْضًا بِخَيْبَرَ لَمْ أُصِبْ مَالًا قَط أَنْفَسَ عِنْدِي مِنْهُ، فَمَا تَأْمُرُنِي بِهِ؟ قَالَ: «إِنْ شِئْتَ حَبَسْتَ أَصْلَهَا وَتَصَدَّقْتَ بِهَا»، قَالَ: فَتَصَدَّقَ بِهَا عُمَرُ أَنَّهُ لَا يُبَاعُ۱ وَلَا يُوهَبُ وَلَا يُورَثُ. وَتَصَدَّقَ بِهَا فِي الْفُقَرَاءِ، وَفِي الْقُرْبَى، وَفِي الرِّقَابِ، وَفِي سَبِيلِ اللَّهِ وَابْنِ السَّبِيلِ وَالضَّيْفِ، لَا جُنَاحَ عَلَى مَنْ وَلِيَهَا أَنْ يَأْكُلَ مِنْهَا بِالْمَعْرُوفِ، أَوْ يُطْعِمَ غَيْرَ مُتَمَوِّلٍ. قَالَ ابْنُ سِيرِينَ: غَيْرَ مُتَأَثْلٍ مَالًا . مُتَّفَقٌ عَلَيْهِ.

Ibn Umar (may Allah be pleased with them) narrated that Umar acquired land in Khaybar and came to the Prophet (ﷺ), saying: “O Messenger of Allah, I have acquired land in Khaybar, the most valuable property I have ever obtained. What do you command me to do with it?” He said: “If you wish, you may endow its principal and give its proceeds in charity.” So Umar gave it in charity, stipulating that it should not be sold, gifted, or inherited. He designated its proceeds for the poor, relatives, freeing slaves, the cause of Allah, travelers, and guests. There is no sin on its administrator to eat from it reasonably or feed others without accumulating wealth. Ibn Sirin said: “Without accumulating wealth.” [Agreed upon]

1 The statement: It should not be sold, gifted, or inherited, etc., The majority, along with Abu Yusuf and Muhammad, used this as evidence for the permissibility of endowment (waqf). There is no dispute among them regarding the obligation to give in charity the proceeds of the endowment as long as the endower is alive, such that if someone endows a house or land, they must give its yield in charity, akin to a vow to give its yield. There is also no dispute about its permissibility in terms of transferring ownership of the principal if it is accompanied by a judge’s ruling or designated for after death, such as saying: “When I die, my house or land is an endowment for such-and-such,” or “It is an endowment in my lifetime and a charity after my death.” They differed, however, on its permissibility to transfer ownership of the principal without designation for after death or a judge’s ruling. Abu Hanifah said it is not permissible, and the endower retains the right to sell or gift the endowed property, and upon their death, it becomes an inheritance for their heirs. Abu Yusuf, Muhammad, and the majority said it is permissible, so it cannot be sold, gifted, or inherited. They also differed on whether it enters the ownership of the beneficiary. Our scholars said it does not, but the beneficiary benefits from its yield through charity, as endowment is the retention of the principal and giving its proceeds in charity, and retention does not entail ownership of the retained property. Shafi’i, Malik, and Ahmad said it transfers to the ownership of the beneficiary if they are eligible, and Shafi’i also said in one opinion that it transfers to Allah, which is a narration from our scholars. As stated in Umdat Al-Qari. In Ad-Durr Al-Mukhtar: Endowment is the retention of the asset under the endower’s ownership rule and giving its benefit in charity, even partially. The sounder view according to Abu Hanifah is that it is permissible but not binding, like a loan. According to Abu Yusuf and Muhammad, it is the retention of the asset under Allah’s ownership rule, and its benefit is directed to whomever the endower wishes, even if wealthy, making it binding, so it cannot be revoked or inherited, and the fatwa is based on their view of its binding nature.

۱ قوله : لا يباع ولا يوهب ولا يورث إلخ : احتج به الجمهور وأبو يوسف ومحمد على جواز الوقف، ولا خلاف بينهم في جواز الوقف في حق وجوب التصدق بما يحصل من الوقف ما دام الواقف حيا حتى إن من وقف داره أو أرضه يلزمه التصدق بغلة الدار والأرض، ويكون ذلك بمنزلة النذر بالغلة. ولا خلاف أيضًا في جوازه في حق زوال ملك الرقبة إذا اتصل به قضاء القاضي أو أضافه إلى ما بعد الموت بأن قال: إذا مت فقد جعلت داري أو أرضي وقفا على كذا، أو قال: هو وقف في حياتي صدقة بعد وفاتي. واختلفوا في جوازه مزيلا لملك الرقبة إذا لم يوجد الإضافة إلى ما بعد الموت، ولا اتصل به حكم حاكم، فقال أبو حنيفة: لا يجوز حتى كان للواقف بيع الموقوف وهبته، وإذا مات يصير ميرانا لورثته، وقال أبو يوسف ومحمد والجمهور: يجوز حتى لا يباع ولا يوهب ولا يورث.

واختلفوا هل يدخل في ملك الموقوف عليه أم لا ؟ فقال أصحابنا: لا يدخل، لكنه ينتفع بغلته بالتصدق عليه؛ لأن الوقف حبس الأصل وتصدق بالفرع، والحبس لا يوجب ملك المحبوس. وعن الشافعي ومالك وأحمد: ينتقل إلى ملك الموقوف عليه لو كان أهلا له، وعن الشافعي في قول: ينتقل إلى الله، وهو رواية عن أصحابنا. قاله في عمدة القاري». وقال في الدر المختار: الوقف هو حبس العين على حكم ملك الواقف والتصدق بالمنفعة ولو في الجملة والأصح أنه عنده جائز غير لازم كالعارية. وعندهما هو حبسها على حكم ملك الله تعالى وصرف منفعتها على من أحب ولو غنيا فيلزم، فلا يجوز له إبطاله، ولا يورث عنه، والفتوى على قولهما بلزومه.

وَعَنْ أَبِي هُرَيْرَةَ (رضي الله عنه)عَنِ النَّبِيَّ ﷺ قَالَ: «الْعُمْرَى جَائِزَةٌ» ۱. مُتَّفَقٌ عَلَيْهِ.

Abu Hurairah (may Allah be pleased with him) narrated that the Prophet (ﷺ) said: “The lifelong gift (umra) is permissible.” [Agreed upon]

In Al-Marqah: An-Nawawi said: Our scholars stated that the lifelong gift has three scenarios. First: If someone says, “I grant you this house for your lifetime, and after your death, it goes to your heirs or descendants,” it is valid without dispute, and the recipient owns the house’s title, as it is a gift. After their death, it goes to their heirs, or else to the public treasury, and it never reverts to the giver. Second: If they say only, “I grant it to you for your lifetime,” without mentioning anything else, Shafi’i has two opinions. The sounder and newer opinion is that it is valid, with the same ruling as the first scenario. Third: If they say, “I grant it to you for your lifetime, and after your death, it reverts to me or my heirs,” its validity is disputed. The sounder view among us is that it is valid, with the same ruling as the first scenario, relying on the unrestricted narrations and deviating from the analogy of conditions. Ahmad said: The unrestricted lifelong gift is valid, but not the time-bound one. Malik said: In all cases, the lifelong gift grants ownership of the house’s benefits, not its title. وَعَنْهُ (رضي الله عنه) قَالَ: قَالَ رَسُوْلُ اللهِ ﷺ: «أَيُّمَا رَجُلٍ أُعْمِرَ عُمْرَى لَهُ وَلِعَقِبِهِ فَإِنَّهَا لِلَّذِي أُعْطِيَهَا، لَا يَرْجِعُ إِلَى الَّذِي أَعْطَاهَا؛ لِأَنَّهُ أَعْطَى عَطَاءٌ وَقَعَتْ فِيهِ الْمَوَارِيثُ»۱. مُتَّفَقٌ عَلَيْهِ.

Jabir (may Allah be pleased with him) narrated that the Messenger of Allah (ﷺ) said: “If a man grants a lifelong gift to someone and their descendants, it belongs to the one to whom it was given and does not revert to the giver, as he gave a gift subject to inheritance.” [Agreed upon]

وَعَنْهُ (رضي الله عنه)قَالَ: قَالَ رَسُولُ اللهِ ﷺ: «أَمْسِكُوا۱ عَلَيْكُمْ أَمْوَالَكُمْ، وَلَا تُفْسِدُوهَا؛ فَإِنَّهُ مَنْ أَعْمَرَ عُمْرَى فَهِيَ لِلَّذِي أُعْمِرَهَا حَيًّا وَمَيْتًا وَلِعَقِبِهِ». رَوَاهُ مُسْلِمٌ.

Jabir (may Allah be pleased with him) narrated that the Messenger of Allah (ﷺ) said: “Hold onto your wealth and do not spoil it, for whoever grants a lifelong gift, it belongs to the recipient, alive or dead, and their descendants.” [Narrated by Muslim]

وَعَنْهُ (رضي الله عنه) عَنِ النَّبِيِّ ﷺ قَالَ: «لَا تُرْقِبُوا۱ وَلَا تُعْمِرُوْا، فَمَنْ أُرْقِبَ شَيْئًا أَوْ أُعْمِرَهُ فَهُوَ لِوَرَثَتِهِ»۲. رَوَاهُ أَبُو دَاوُدَ.

Jabir (may Allah be pleased with him) narrated that the Prophet (ﷺ) said: “Do not grant conditional gifts (ruqba) or lifelong gifts, for whoever is granted a conditional or lifelong gift, it belongs to their heirs.” [Narrated by Abu Dawud]

1 The statement: Do not grant conditional gifts or lifelong gifts, etc., Some of our scholars said this is a prohibition for guidance, meaning do not give your wealth temporarily and then take it back. Rather, if you give something, it leaves your ownership and does not revert, whether termed a gift, lifelong gift, or conditional gift. It means do not grant conditional or lifelong gifts thinking they do not entail ownership for the recipient and will revert to you after their death. This is not so, as whoever grants a conditional or lifelong gift, it belongs to the recipient’s heirs. The prohibition was before permissibility, or it means it is not ideal for the benefit, but if done, it is valid and belongs to the recipient’s heirs, so there is no need to claim abrogation. Understand. In An-Nihayah: They used to do this in the pre-Islamic era, but the Lawgiver annulled it and informed them that whoever grants a lifelong or conditional gift, it belongs to their heirs after them. As stated in Al-Marqah and Al-Luma’at, summarized from them. 2 The statement: It belongs to their heirs, At-Tayyibi said: The pronoun refers to the recipient, as does “its people.” The “fa” in “whoever is granted” indicates causation and explanation for the prohibition. ۱ قوله : لا ترقبوا ولا تعمروا إلخ : قال بعض الشراح من علمائنا هذا نهي إرشاد، يعني لا تهبوا أموالكم مدة، ثم تأخذونها، بل إذا وهبتم شيئًا زال عنكم ولا يرجع إليكم، سواء كان بلفظ الهبة أو العمرى أو الرقبى، يعني لا ترقبوا ولا تعمروا ظنا منكم واغترارًا أن كلا منهما ليس بتمليك للمعمر له، فيرجع إليكم بعد موته، وليس كذلك، فإن من أرقب شيئًا أو أعمر فهو لورثة المعمر له، فكان النهي قبل تجويز، أو المعنى لا يليق ذلك بالمصلحة، ولكن بعد ما فعلتم يكون صحيحًا، ويكون لورثة المعمر له، فلا حاجة إلى القول بالنسخ، فافهم.

وفي النهاية»: كانوا في الجاهلية يفعلون ذلك فأبطله الشارع، وأعلمهم أن من أعمر شيئًا أو أرقبه في حياته فهو لورثته من بعده، «المرقاة و اللمعات ملتقط منهما.

۲ قوله : فهو لورثته قال الطيبي الله : الضمير للمعمر له، وكذا المراد بأهلها، والفاء في فمن أرقب تسبب للنهي وتعليل له. كذا في «المرقاة».

وَعَنْهُ (رضي الله عنه) عَنِ النَّبِيِّ ﷺ قَالَ: «الْعُمْرَى جَائِزَةٌ لِأَهْلِهَا، وَالرُّقْبَى جَائِزَةٌ۱ لِأَهْلِهَا». رَوَاهُ أَحْمَدُ وَالتَّرْمِذِيُّ وَأَبُو دَاوُدَ.

1 The statement: The conditional gift is permissible, etc., In Al-Hidayah: The conditional gift is invalid according to Abu Hanifah and Muhammad, but Abu Yusuf said it is permissible. The disagreement stems from interpreting the conditional gift, though they agree it involves waiting. Abu Yusuf interpreted this term as immediate ownership with the giver expecting reversion, so the ownership is valid, but the expectation of reversion is invalid, as in the lifelong gift. They said: The waiting is in the ownership itself, as the meaning of a conditional gift is, “This house belongs to the one who outlives the other,” as if saying, “I await your death, and you await mine. If you die first, it is yours; if I die first, it is mine.” This makes ownership contingent on the risk of the owner’s death before the other, which is invalid. As stated in Nata’ij Al-Afkar. In Al-Kawkab Ad-Durri: Know that the conditional gift is explained in two ways. First: It is given as a gift with the condition that it belongs to the giver if they die first. This is permissible, but the corrupt condition does not invalidate the gift, as gifts are not nullified by invalid conditions. Second: It is not given as a gift but said, “If you die first, this thing is yours; if I die first, it is mine,” or “Live in this house or use this thing on the condition that it is yours if I die first, and if you die first, it is mine.” This conditional gift is invalid, meaning it does not become the recipient’s property or their heirs’ after them, as it is a loan presently or a conditional bequest ultimately. The invalidity is due to the gambling element of tying ownership to a risky condition. This resolves the disagreement between the narrations that the conditional gift is invalid and permissible, as permissible refers to one meaning and invalid to another, which is the Imam’s view.

۱ قوله والرقبى جائزة إلخ : وقال في الهداية» والرقبى باطلة عند أبي حنيفة ومحمد (رحمهما الله)، وقال أبو يوسف(رحمه الله) :جائزة.

حاصل الاختلاف راجع إلى تفسير الرقبي مع اتفاقهم على أنها من المراقبة، فحمل أبو يوسف هذا اللفظ على أنه تمليك للحال مع انتظار الواهب في الرجوع، فالتمليك جائز، وانتظار الرجوع باطل، كما في العمرى. وقالا: المراقبة في نفس التمليك؛ لأن معنى الرقبي هذه الدار الآخرنا موتا، كأنه يقول : أراقب موتك وتراقب موتي، فإن من قبلك فهي لك، وإن من قبلي فهي لي. فكان هذا تعليق التمليك ابتداء بالخطر، وهو موت المالك قبله، وهذا باطل. قاله في نتائج الأفكار».

وقال في الكوكب الدري : اعلم أن الرقبى مفسرة بتفسيرين : أن يهب له، ثم يشترط أن يكون لي لو مت قبلي، وهذه جائزة، غاية الأمر أنه اشترط في الهبة شرطاً فاسدًا، والهبة لا تبطل بالشروط الفاسدة. وأن لا يهب له، بل يقول: إن من قبلك فهذا الشيء لك، وإن من قبلي فهو لي، أو يقول: اسكن هذه الدار، واستعمل هذا الشيء على أنها لك إن مت قبلي، وإن من قبلك فهو لي. وهذه الرقبى باطلة بمعنى أنه لا يكون ملكا له، ولا لورثته بعده، وذلك لأنه عارية حالا أو وصية مشروطة مآلا . ووجه البطلان ما فيه من القمار من تعليق الملك بشرط على خطر الوجود. فارتفع الخلاف بين حديثيي الرقبى باطلة والرقبى جائزة، فإن الجائز بمعنى آخر، والفاسد بمعنى آخر، وهذا هو الذي ذهب إليه الإمام.

Abu Hurairah (may Allah be pleased with him) narrated that the Messenger of Allah (ﷺ) said: “Whoever is offered a fragrant plant should not refuse it, for it is light to carry and pleasant in scent.” [Narrated by Muslim]

Ibn Umar (may Allah be pleased with them) narrated that the Messenger of Allah (ﷺ) said: “Three things should not be refused: cushions, oil, and milk.” [Narrated by Tirmidhi, who said: This is a rare narration. It is said that “oil” refers to perfume.]

وَعَنْ أَبِي عُثْمَانَ النَّهْدِي(رضي الله عنه) قَالَ: قَالَ رَسُولُ اللَّهِ ﷺ: «إِذَا أُعْطِيَ أَحَدُكُمُ الرَّيْحَانَ فَلَا يَرُدَّهُ؛ فَإِنَّهُ خَرَجَ مِنَ الْجَنَّةِ. رَوَاهُ التَّرْمِذِيُّ مُرْسَلًا.

Abu Uthman An-Nahdi narrated that the Messenger of Allah (ﷺ) said: “If one of you is given a fragrant plant, let him not refuse it, for it comes from Paradise.” [Narrated by Tirmidhi, mursal]

وَعَنْ أَبِي هُرَيْرَةَ (رضي الله عنه) قَالَ: قَالَ رَسُولُ اللهِ: «الرَّجُلُ۱ أَحَقُّ بِهِبَتِهِ مَا لَمْ يُثَبْ مِنْهَا. رَوَاهُ ابْنُ مَاجَهِ وَالدَّارِقُطْنِي وَابْنِ أَبِي شَيْبَةَ.

وَرَوَاهُ الطَّبَرَانِيُّ عَنِ ابْنِ عَبَّاسٍ، وَرَوَى الْحَاكِمُ عَنِ ابْنِ عُمَرَ فِي الْمُسْتَدْرَكِ» مِثْلَهُ. وَقَالَ: حَدِيثُ صَحِيحٌ عَلَى شَرْطِ الشَّيْخَيْنِ وَلَمْ يُخَرِّجَاهُ، وَقَالَ عَبْدُ الْحَقِّ فِي الْأَحْكَامِ»: حَدِيثُ ابْنِ عُمَرَ صَحِيحٌ مَرْفُوعًا، وَرُوَاتُهُ ثِقَاتُ، وَصَحَّحَهُ ابْنُ حَزَمٍ أَيْضًا.

وَفِي رِوَايَةٍ لِلْبُخَارِيِّ عَنِ ابْنِ عَبَّاسِ لا أَنَّ النَّبِيَّ ﷺ قَالَ: «الْعَائِدُ فِي هِبَتِهِ كَالْكَلْبِ يَعُودُ فِي قَيْئِهِ، لَيْسَ لَنَا مَثَلُ السَّوْءِ».

English

Abu Hurairah (may Allah be pleased with him) narrated that the Messenger of Allah (ﷺ) said: “A man has the right to his gift as long as he has not been compensated for it.” [Narrated by Ibn Majah, Ad-Daraqutni, and Ibn Abi Shaybah]

At-Tabarani narrated it from Ibn Abbas, and Al-Hakim narrated it from Ibn Umar in Al-Mustadrak, saying: It is a sound narration meeting the conditions of the two Shaykhs, though they did not include it. Abdul-Haqq said in Al-Ahkam: The narration of Ibn Umar is sound, raised, with trustworthy narrators. Ibn Hazm also authenticated it.

In a narration by Bukhari from Ibn Abbas, the Prophet (ﷺ) said: “One who retracts his gift is like a dog returning to its vomit. We do not take the example of evil.”

1 The statement: A man has the right, etc., If someone gives a gift to a non-relative, according to us, they may revoke it after acceptance. Before acceptance, the gift is not complete without a preventing factor, though revoking is disliked, either prohibitively or preferably. Shafi’i said there is no revocation, and this narration supports us. As stated in Al-Hidayah and Ad-Durr Al-Mukhtar.

If not accepted, the giver may retract it, and their retraction is effective, as an unaccepted gift does not confer ownership, as An-Nakha’i said: A gift is not valid until accepted, while charity is valid before acceptance. The condition of acceptance is evidenced by the narration of Abu Bakr’s gift. If accepted, it is either to a close relative (e.g., parents or children) or to someone else, whether a complete stranger, a distant relative like cousins, or a non-blood relative like a foster sibling. If to a close relative, retraction is invalid, as the purpose is maintaining family ties, which is achieved, as is the case with gifts between spouses. This is supported by Samurah’s narration. If to someone else, if given as charity to a poor person solely for Allah’s sake, retraction is also invalid. ۱ قوله: إذا كانت الهبة إلخ : تفصيله بحيث تظهر فوائد قيوده، على ما في الهداية وشروحه: أن الهبة لا تخلو إما أن تكون مقبوضة أو غير مقبوضة، فإن كانت غير مقبوضة يجوز للواهب الرجوع فيها ويعمل برجوعه؛ لأن الهبة الغير المقبوضة لا تفيد ملكا، كما قال النخعي: لا تجوز الهبة حتى تقبض، والصدقة تجوز قبل أن تقبض. ويدل على اشتراط القبض حديث نحلة أبي بكر الصديق.

وإن كانت مقبوضة، فلا يخلو إما أن يكون لذي رحم محرم، أي الذي قرابة المحرمية كالأصول والفروع، وإما أن يكون لغيره، سواء كان أجنبيا محضًا أو كان ذا قرابة ولم يكن محرما كبني الأعمام، أو كان محرما ولم يكن ذا رحم كالأخ الرضاعي، فإن كان الأول فلا يصح الرجوع فيه؛ لأن المقصود صلة الرحم، وقد حصل، وكذلك في هبة أحد الزوجين للآخر، ويدل عليه حديث سمرة مرفوعا له : إذا كانت الهبة لذي رحم محرم إلخ. وإن كان الثاني، فإن كان على سبيل الصدقة على الفقير يقصد بها وجه الله فحسب، فلا رجوع أيضًا، وإلا فله الرجوع، إلا أن يمنع مانع، نحو: أن يعوض عنها الموهوب له، فحينئذ تتقلب الهبة لازمة، كذا إذا زاد الموهوب له في الموهوب خيرا كالغرس والبناء، وكذا إذا خرج من ملكه بالبيع أو الهبة، وكذا إذا هلك الموهوب أو مات أحدهما. كذا في «التعليق الممجد». وقال في رحمة الأمة»: وإذا وهب الوالد لابنه هبة، قال أبو حنيفة: ليس له الرجوع فيها بحال، وقال الشافعي: له الرجوع بكل حال.

Ash-Sha’bi narrated: I heard An-Nu’man say on our pulpit: The Messenger of Allah (ﷺ) said: “Treat your children equally in giving gifts, just as you would like them to treat you equally in kindness.” [Narrated by As-Sahawi]

He favored Abu Yusuf’s view, citing the statement: Treat your children equally in giving gifts as you would like them to treat you equally in kindness as evidence for equalizing males and females. As stated in At-Ta’liq Al-Mumajjad. In Rahmat Al-Ummah: Favoring some children with gifts is unanimously disliked, as is preferring some over others. If one favors, must they retract? Anas (may Allah be pleased with him) narrated: A man was with the Messenger of Allah (ﷺ) when his son came. He kissed him and seated him on his lap. Then his daughter came, and he seated her beside him. The Prophet (ﷺ) said: “Could you not have treated them equally?” [Narrated by At-Tahawi]

English

Jabir (may Allah be pleased with him) narrated: The wife of Bashir said, “Give my son your slave and have the Messenger of Allah (ﷺ) witness it.” Bashir came to the Messenger of Allah (ﷺ) and said, “The daughter of so-and-so asked me to give her son my slave and said, ‘Have the Messenger of Allah witness it.’” He said, “Does he have siblings?” He said, “Yes.” He said, “Did you give each of them the same as you gave him?” He said, “No.” He said, “This is not appropriate, and I only witness what is just.” [Narrated by Muslim]

In another narration by Muslim: “Have someone else witness this.”

The author of At-Tawdih said: According to us, rewarding is not obligatory in any case, whether the gift is from a superior to an inferior, vice versa, or between equals. They differed on one who gives a gift and then seeks reward, saying, “I only intended the reward.” Malik said: It depends. If the giver is someone who typically seeks reward from the recipient, like a poor person giving to a rich one, they are entitled to it, as Shafi’i said in his old opinion. Abu Hanifah said, and Shafi’i in his newer opinion: They are not entitled unless stipulated, as the essence of a gift is voluntary giving, and requiring reward contradicts its essence. Malik cited the narration of the Bedouin for the obligation of reward, saying: If it were not obligatory, he would not have rewarded or increased it, and if rewarding were voluntary, the increase would not be obligatory, and he would have disapproved of the Bedouin’s request. I say: He hoped for his noble character and habit of rewarding. As stated in Umdat Al-Qari.

۱قوله: ويثيب عليها: أي يكافئ عليها بأن يعطي صاحبها العوض والمكافاة على الهدية مطلوبة تطوعا عندنا اقتداء بالشارع. قال صاحب التوضيح: وعندنا لا يجب فيها ثواب مطلقا، سواء وهب الأعلى للأدنى أو عكسه أو للمساوي. واختلفوا فيمن وهب هبة، ثم طلب ثوابها، وقال: إنما أردت الثواب، فقال مالك: ينظر فيه، فإن كان مثله ممن يطلب الثواب من الموهوب له ، فله ذلك مثل هبة الفقير للغني، وبه قال الشافعي في القديم. وقال أبو حنيفة: لا يكون له ذلك إذا لم يشترطه - وهو قول الشافعي الثاني الجديد - لأن موضوع الهبة التبرع، وفي وجوب المكافاة خلاف الموضوع. واستدل مالك بحديث الأعرابي على وجوب المكافاة على الهداية، وقال: ولو لم يكن واجبا لم يثبه ولم يزده، ولو أثاب تطوعًا لم تلزمه الزيادة، وكان ينكر على الأعرابي طلبها. قلت: طمع في مكارم أخلاقه وعادته في الإثابة. كذا في عمدة القاري».

Jabir (may Allah be pleased with him) narrated that the Prophet (ﷺ) said: “Whoever is given a gift and has the means, let him reciprocate. If he cannot, let him praise it, for whoever praises it has shown gratitude. Whoever conceals it has shown ingratitude, and whoever adorns himself with what he was not given is like one wearing two false garments.” [Narrated by Tirmidhi and Abu Dawud]

وَعَنْ أَنَسٍ (رضي الله عنه)، قَالَ : لَمَّا قَدِمَ رَسُولُ اللهِ ﷺ الْمَدِينَةَ أَتَاهُ الْمُهَاجِرُوْنَ، فَقَالُوا: يَا رَسُولَ اللَّهِ، مَا رَأَيْنَا قَوْمًا أَبْذَلَ مِنْ كَثِيرٍ، وَلَا أَحْسَنَ مُوَاسَاةً مِنْ قَلِيلٍ مِنْ قَوْمٍ نَزَلْنَا بَيْنَ أَظْهُرِهِمْ، لَقَدْ كَفَوْنَا الْمُؤْنَةَ وَأَشْرَكُونَا فِي الْمَهْنَا حَتَّى لَقَدْ خِفْنَا أَنْ يَذْهَبُوا بِالْأَجْرِ كُلِّهِ، فَقَالَ النَّبِيُّ : لَا مَا دَعَوْتُمُ اللهَ لَهُمْ وَأَثْنَيْتُمْ عَلَيْهِمْ». رَوَاهُ التَّرْمِذِيُّ وَصَحَّحَهُ.

Anas (may Allah be pleased with him) narrated: When the Messenger of Allah (ﷺ) arrived in Madinah, the Muhajirun came to him and said, “O Messenger of Allah, we have never seen people more generous with abundance or better in supporting with little than the people among whom we settled. They have spared us burden and shared their livelihood with us, so much that we fear they will take all the reward.” The Prophet (ﷺ) said: “Not as long as you pray to Allah for them and praise them.” [Narrated by Tirmidhi, who authenticated it]

وَعَنْ عَائِشَةَ (رضي الله عنها) عَنِ النَّبِيِّ ﷺ قَالَ: «تَهَادَوْا فَإِنَّ الْهَدِيَّةَ تُذْهِبُ الضَّغَائِنَ». رَوَاهُ التَّرْمِذِيُّ.

English

Aishah (may Allah be pleased with her) narrated that the Prophet (ﷺ) said: “Exchange gifts, for gifts remove grudges.” [Narrated by Tirmidhi]

وَعَنْ أَبِي هُرَيْرَةَ (رضي الله عنه)أَنَّ النَّبِيَّ ﷺ قَالَ: «تَهَادَوْا فَإِنَّ الْهَدِيَّةَ تُذْهِبُ وَحَرَ الصَّدْرِ، وَلَا تَحْقِرَنَّ جَارَةُ لِجَارَتِهَا وَلَوْ شِقَّ فِرْسِنِ شَاةٍ. رَوَاهُ التَّرْمِذِيُّ.

English

Abu Hurairah (may Allah be pleased with him) narrated that the Prophet (ﷺ) said: “Exchange gifts, for gifts remove ill feelings from the heart. Let no neighbor belittle a gift to her neighbor, even if it is half a sheep’s hoof.” [Narrated by Tirmidhi]

وَعَنْهُ (رضي الله عنه)، قَالَ: رَأَيْتُ رَسُولَ اللهِ ﷺ إِذَا أُتِيَ بِبَاكُورَةِ الْفَاكِهَةِ وَضَعَهَا عَلَى عَيْنَيْهِ وَعَلَى شَفَتَيْهِ، وَقَالَ: «اللَّهُمَّ كَمَا أَرَيْتَنَا أَوَّلَهُ فَأَرِنَا آخِرَهُ، ثُمَّ يُعْطِيْهَا مَنْ يَكُوْنُ عِنْدَهُ مِنَ الصَّبْيَانِ. رَوَاهُ الْبَيْهَقِيُّ فِي الدَّعَوَاتِ الْكَبِيرِ».

English

Abu Hurairah (may Allah be pleased with him) narrated: I saw the Messenger of Allah (ﷺ) when brought the first fruits, place them on his eyes and lips, saying: “O Allah, as You have shown us its beginning, show us its end.” Then he would give it to the children around him. [Narrated by Al-Bayhaqi in Ad-Da’awat Al-Kabir]
