بَابُ الْفَرَائِضِInheritance

وَقَوْلِ اللَّهِ عَزَّ وَجَلَّ: {يُوصِيكُمُ اللَّهُ فِي أَوْلَادِكُمْ لِلذَّكَرِ مِثْلُ حَظِّ الْأُنْثَيَيْنِ فَإِنْ كُنَّ نِسَاءً فَوْقَ اثْنَتَيْنِ فَلَهُنَّ ثُلُثَا مَا تَرَكَ وَإِنْ كَانَتْ وَاحِدَةً فَلَهَا النِّصْفُ وَلِأَبَوَيْهِ لِكُلِّ وَاحِدٍ مِنْهُمَا السُّدُسُ مِمَّا تَرَكَ إِنْ كَانَ لَهُ وَلَدٌ فَإِنْ لَمْ يَكُنْ لَهُ وَلَدٌ وَوَرِثَهُ أَبَوَاهُ فَلِأُمِّهِ الثُّلُثُ فَإِنْ كَانَ لَهُ إِخْوَةٌ فَلِأُمِّهِ السُّدُسُ مِنْ بَعْدِ وَصِيَّةٍ يُوصِي بِهَا أَوْ دَيْنٍ آبَاؤُكُمْ وَأَبْنَاؤُكُمْ لَا تَدْرُونَ أَيُّهُمْ أَقْرَبُ لَكُمْ نَفْعًا فَرِيضَةً مِنَ اللَّهِ إِنَّ اللَّهَ كَانَ عَلِيمًا حَكِيمًا 11وَلَكُمْ نِصْفُ مَا تَرَكَ أَزْوَاجُكُمْ إِنْ لَمْ يَكُنْ لَهُنَّ وَلَدٌ فَإِنْ كَانَ لَهُنَّ وَلَدٌ فَلَكُمُ الرُّبُعُ مِمَّا تَرَكْنَ مِنْ بَعْدِ وَصِيَّةٍ يُوصِينَ بِهَا أَوْ دَيْنٍ وَلَهُنَّ الرُّبُعُ مِمَّا تَرَكْتُمْ إِنْ لَمْ يَكُنْ لَكُمْ وَلَدٌ فَإِنْ كَانَ لَكُمْ وَلَدٌ فَلَهُنَّ الثُّمُنُ مِمَّا تَرَكْتُمْ مِنْ بَعْدِ وَصِيَّةٍ تُوصُونَ بِهَا أَوْ دَيْنٍ وَإِنْ كَانَ رَجُلٌ يُورَثُ كَلَالَةً أَوِ امْرَأَةٌ وَلَهُ أَخٌ أَوْ أُخْتٌ فَلِكُلِّ وَاحِدٍ مِنْهُمَا السُّدُسُ فَإِنْ كَانُوا أَكْثَرَ مِنْ ذَلِكَ فَهُمْ شُرَكَاءُ فِي الثُّلُثِ مِنْ بَعْدِ وَصِيَّةٍ يُوصَى بِهَا أَوْ دَيْنٍ غَيْرَ مُضَارٍّ وَصِيَّةً مِنَ اللَّهِ وَاللَّهُ عَلِيمٌ حَلِيمٌ 12} [النساء : ۱۱-۱۲)] ، وَقَوْلِهِ تَعَالَى: {يَسْتَفْتُونَكَ قُلِ اللَّهُ يُفْتِيكُمْ فِي الْكَلَالَةِ إِنِ امْرُؤٌ هَلَكَ لَيْسَ لَهُ وَلَدٌ وَلَهُ أُخْتٌ فَلَهَا نِصْفُ مَا تَرَكَ وَهُوَ يَرِثُهَا إِنْ لَمْ يَكُنْ لَهَا وَلَدٌ فَإِنْ كَانَتَا اثْنَتَيْنِ فَلَهُمَا الثُّلُثَانِ مِمَّا تَرَكَ وَإِنْ كَانُوا إِخْوَةً رِجَالًا وَنِسَاءً فَلِلذَّكَرِ مِثْلُ حَظِّ الْأُنْثَيَيْنِ يُبَيِّنُ اللَّهُ لَكُمْ أَنْ تَضِلُّوا وَاللَّهُ بِكُلِّ شَيْءٍ عَلِيمٌ 176} (النساء: ١٧٦) ، وَقَوْلِهِ تَعَالَى: ﴿وَأُولُو الْأَرْحَامِ بَعْضُهُمْ أَوْلَى بِبَعْضٍ فِي كِتَابِ۱ اللَّهِ} (الأنفال: ٧٥) ، وَقَوْلِهِ تَعَالَى: ﴿وَالَّذِينَ۲ عَقَدَتْ أَيْمَانُكُمْ فَآتُوهُمْ نَصِيبَهُمْ} (النساء: ٣٣ ، وَقَوْلِهِ تَعَالَى: ﴿وَلَنْ۳ يَجْعَلَ اللَّهُ لِلْكَافِرِينَ عَلَى الْمُؤْمِنِينَ سَبِيلًا 141} (النساء: ١٤١)

۱قوله: في كتاب الله أي في أحكامه وفرائضه والكتاب كثيرًا ما يجيء بمعنى الفريضة، واستدل به أصحاب أبي حنيفة الله على توريث ذوي الأرحام، وينصره حديث المقدام والخال وارث من لا وارث له. كذا في «المرقاة».

۲ قوله: والذين عقدت أيمانكم إلخ : وقال صاحب المدارك والمراد به عقد الموالات، وهي مشروعة، والوراثةبها ثابتة عند عامة الصحابة، وهو قولنا. وقال الشافعي الموالات ليس بشيء؛ لأن فيه إبطال حق بيت المال. ولنا هذه الآية، وهي في الموالات. كذا في «التفسيرات الأحمدية».

۳ قوله: ولن يجعل الله للكافرين على المؤمنين سبيلا : وقال في عمدة القاري»: إن الكافر لا يرث المسلم بالإجماع وبالحديث وبهذه الآية، وفي الميراث إثبات السبيل للكافر على المسلم.

The verses from the Qur’an cited are: “Allah instructs you concerning your children: for the male, what is equal to the share of two females. But if there are only daughters, two or more, for them is two-thirds of what he leaves. And if there is only one, for her is half. And for his parents, to each one of them is a sixth of what he leaves if he had a child. But if he had no child and his parents inherit from him, then for his mother is one-third. And if he had brothers, then for his mother is a sixth, after any bequest he may have made or debt. Your parents and your children, you do not know which of them are nearest to you in benefit. This is an obligation from Allah. Indeed, Allah is ever Knowing and Wise. And for you is half of what your wives leave if they have no child. But if they have a child, then for you is one-fourth of what they leave, after any bequest they may have made or debt. And for them is one-fourth of what you leave if you have no child. But if you have a child, then for them is one-eighth of what you leave, after any bequest you may have made or debt. And if a man or woman leaves neither ascendants nor descendants but has a brother or a sister, then for each one of them is a sixth. But if they are more than that, they share in one-third, after any bequest that was made or debt, as long as it causes no harm. This is a commandment from Allah, and Allah is ever Knowing and Forbearing” [An-Nisa: 11-12]. And His saying: “They request from you a ruling. Say, ‘Allah gives you a ruling concerning one who has neither descendants nor ascendants. If a man dies, leaving no child but a sister, she will have half of what he leaves. And he inherits from her if she has no child. But if there are two sisters, they will have two-thirds of what he leaves. And if there are brothers and sisters, the male will have the share of two females.’ Allah makes clear to you lest you go astray. And Allah is Knowing of all things” [An-Nisa: 176]. And His saying: “And those of kinship are more entitled to each other in the Book of Allah” [Al-Anfal: 75]. And His saying: “And to those with whom you have made a pledge, give them their share” [An-Nisa: 33]. And His saying: “And Allah will never grant the disbelievers a way over the believers” [An-Nisa: 141].

1 The statement: In the Book of Allah, meaning in His rulings and obligations. The term “Book” often refers to obligation. This is used by the followers of Abu Hanifah as evidence for the inheritance of distant relatives, supported by the hadith of Al-Miqdam: “The maternal uncle is the heir of one who has no heir.” As stated in Al-Marqah.

2 The statement: And those with whom you have made a pledge, The author of Al-Madarik said: This refers to the contract of alliance, which is legislated, and inheritance through it is established according to most Companions, and this is our view. Shafi’i said: Alliance is nothing, as it nullifies the right of the public treasury. Our evidence is this verse, which pertains to alliance. As stated in At-Tafsir Al-Ahmadiyyah.

3 The statement: And Allah will never grant the disbelievers a way over the believers, As stated in Umdat Al-Qari: A disbeliever does not inherit from a Muslim by consensus, supported by the hadith and this verse. Inheritance establishes a way for the disbeliever over the Muslim.

وَعَنْ عُمَرَ(رضي الله عنه) قَالَ: تَعَلَّمُوا الْفَرَائِضَ ، وَزَادَ ابْنُ مَسْعُودٍ: وَالطَّلَاقَ وَالْحَجَّ، قَالَا : فَإِنَّهُ مِنْ دِينِكُمْ. رَوَاهُ الدَّارِمِيُّ.

English

Umar (may Allah be pleased with him) said: Learn the laws of inheritance. Ibn Mas’ud added: And divorce and Hajj. They said: For they are part of your religion. [Narrated by Ad-Darimi]

وَعَنْ أَبِي هُرَيْرَةَ (رضي الله عنه) عَنِ النَّبِيِّ ﷺ قَالَ: «أَنَا أَوْلَى بِالْمُؤْمِنِينَ مِنْ أَنْفُسِهِمْ، فَمَنْ مَاتَ وَعَلَيْهِ دَيْنٌ وَلَمْ يَتْرُكْ وَفَاءً فَعَلَيْنَا قَضَاؤُهُ، وَمَنْ تَرَكَ مَالًا فَلِوَرَثَتِهِ».

وَفِي رِوَايَةٍ: «مَنْ تَرَكَ دَيْنًا أَوْ ضَيَاعًا فَلْيَأْتِنِي فَأَنَا مَوْلَاهُ». وَفِي رِوَايَةٍ: «مَنْ تَرَكَ مَالًا فَلِوَرَثَتِهِ، وَمَنْ تَرَكَ كَلَّا فَإِلَيْنَا». مُتَّفَقٌ عَلَيْهِ.

English

Abu Hurairah (may Allah be pleased with him) narrated that the Prophet (ﷺ) said: I am closer to the believers than their own selves. Whoever dies with a debt and leaves no means to settle it, its payment is upon us. Whoever leaves wealth, it is for their heirs. In another narration: Whoever leaves a debt or dependents, let them come to me, for I am their patron. In another narration: Whoever leaves wealth, it is for their heirs, and whoever leaves dependents, they are my responsibility. [Agreed upon]

وَعَنِ ابْنِ عَبَّاسٍ (رضي الله عنهما) قَالَ: قَالَ رَسُوْلُ اللهِ ﷺ : «أَلْحِقُوا الْفَرَائِضَ بِأَهْلِهَا، فَمَا بَقِيَ۱ فَهُوَ لِأَوْلَى رَجُلٍ ذَكَرٍ». مُتَّفَقٌ عَلَيْهِ.

وَرَوَى التَّرْمِذِيُّ وَابْنُ مَاجَه عَنْ عَلِيَّ الله أَنَّهُ قَالَ: إِنَّكُمْ تَقْرَءُوْنَ هَذِهِ الْآيَةَ {مِنْ بَعْدِ وَصِيَّةٍ يُوصِي بِهَا أَوْ دَيْنٍ}(النساء: ۱۱ وَإِنَّ رَسُولَ اللهِ ﷺ قَضَى بِالدَّيْنِ۲ قَبْلَ الْوَصِيَّةِ، وَإِنَّ أَعْيَانَ۳ بَنِي الْأُمِّ يَتَوَارَثُوْنَ دُوْنَ بَنِي الْعَلَّاتِ الرَّجُلُ يَرِثُ أَخَاهُ لِأَبِيهِ وَأُمِّهِ دُوْنَ أَخِيهِ لِأَبِيهِ.

وَفِي رِوَايَةِ الدَّرَامِيِّ: قَالَ : الْإِخْوَةُ مِنَ الأُمَّ يَتَوَارَثُوْنَ دُوْنَ بَنِي الْعَلَاتِ إِلَخْ.

English

Ibn Abbas (may Allah be pleased with him) narrated that the Prophet (ﷺ) said: Distribute the inheritance shares to their entitled recipients. Whatever remains is for the closest male relative. [Agreed upon] Tirmidhi and Ibn Majah narrated from Ali (may Allah be pleased with him) that he said: You recite this verse, After a bequest he may have made or debt [An-Nisa: 11], but the Prophet (ﷺ) ruled that debts are settled before bequests. Full siblings inherit to the exclusion of paternal siblings. The man inherits his brother from his father and mother to the exclusion of his brother from his father. In a narration by Ad-Darami: He said: Siblings from the mother inherit to the exclusion of paternal siblings, and so on.

1 The statement: Whatever remains is for the closest male relative, They agreed that what remains after the fixed shares is for the agnates, with the closest taking precedence, so a distant agnate does not inherit in the presence of a closer one. This hadith is their evidence. Then, after prioritizing by degree of closeness, they prioritize by strength of kinship, meaning one with two ties is preferred over one with a single tie, whether male or female, due to the statement: Full siblings inherit to the exclusion of paternal siblings, meaning full siblings are more entitled to inheritance than paternal siblings. The mention of the mother here is to highlight what gives full siblings precedence over paternal siblings, such as a brother or sister from both parents, when they become agnates with a daughter, being more entitled than a brother from the father. If you say: The statement whether male or female is redundant, as the discussion is about agnates by themselves, and they are never female. I say: We concede this, but since he intended to clarify here that a sister from both parents, when she becomes an agnate with daughters, is also more entitled than a brother from the father, this condition was mentioned. As derived from Al-Marqah, As-Sirajiyyah, Ash-Sharifiyyah, and Al-Bayhaqi.

2 The statement: Ruled that debts are settled before bequests, For this reason, their scholars said: Four rights are attached to the deceased’s estate in order. First, burial and preparation without extravagance or stinginess. Then, debts are settled from all that remains of the wealth. Then, bequests are fulfilled from one-third of what remains after debts. Then, the remainder is divided among the heirs according to the Qur’an, Sunnah, and consensus of the Ummah. As stated in As-Sirajiyyah. If you say: If debts take precedence over bequests, why were they mentioned after in the revelation? I say: Due to the importance of bequests, as they resemble inheritance in being taken without compensation, their fulfillment is burdensome for heirs and significant, and their souls are not at ease with it, making it prone to neglect, unlike debts, which their souls are inclined to settle. Thus, bequests were mentioned before debts to emphasize their obligation and urge haste in fulfilling them alongside debts. As stated in Al-Marqah.

3 The statement: Full siblings inherit to the exclusion of paternal siblings, Some of our meticulous scholars said: The notables of a people are their elites, and full siblings are called the notables. The mention of the mother here is to clarify what gives full siblings precedence over paternal siblings. The meaning is that when full siblings are present with paternal siblings, the inheritance goes to full siblings due to the strength of kinship and dual connection. As stated in Al-Marqah. In Dhaw’ As-Siraj: If it is said: The hadith uses the term sons, which includes males but not females. We say: Not so, rather it includes females just as it includes males. Allah says in the Qur’an: O children of Adam [Al-A’raf: 26], and the address includes women as it includes men.

۱ قوله : فما بقي فهو لأولي رجل ذكر : قد أجمعوا على أن ما بقي بعد الفرائض فهوا للعصبات يقدم الأقرب فالأقرب فلا يرث عاصب بعيد مع وجود قريب، واستدلوا بهذا الحديث، ثم بعد الترجيح بقرب الدرجة يرجحون بقوة القرابة، أعني به أن ذا القرابتين أولى من ذي قرابة واحدة، ذكرًا كان أو أنثى؛ لقوله : إن أعيان بني الأم يتوارثون دون بني العلامات، أي بنو الأعيان أولى بالميراث من بني العلامات. والمقصود من ذكر الأم ههنا إظهار ما يترجحبه بنو الأعيان على بني العلامات، كالأخ لأب وأم أو الأخت لأب وأم إذا صارت عصبة مع البنت أولى من الأخ لأب. فإن قلت: قوله : ذكرا كان أو أنثى زائدة؛ لأن البحث في العصبة بنفسه، وهي لا تكون أنثى البتة. قلت: سلمنا ذلك، لكن لما أراد أن يبين ههنا أن الأخت لأب وأم إذا صارت عصبة مع البنات أيضًا أولى من الأخ لأب تعرض هذا القيد، أخذته من المرقاة» و «السراجي» و«الشريفية» و«البيهقي».

۲ قوله : قضى بالدين قبل الوصية : لهذا قال علماؤهم : تتعلق بتركة الميت حقوق أربعة مرتبة الأول يبدأ بتكفينه وتجهيزه من غير تبذير، ولا تقتير، ثم تقضى ديونه من جميع ما بقي من ماله، ثم تنفذ وصاياه من ثلث ما بقي بعد الدين، ثم يقسم الباقي بين ورثته بالكتاب والسنة وإجماع الأمة. كذا في السراجي». فإن قلت: إذا كان الدين مقدما على الوصية فلم قدمت عليه في التنزيل. قلت: اهتماما بشأنها لما كانت الوصية مشبهة بالميراث في كونها مأخوذة من غير عوض كان إخراجها مما يشق عى الورثة ويتعاظم، ولا تطيب أنفسهم بها كان أداؤها مظنة للتفريط، بخلاف الدين، فإن نفوسهم مطمئنة إلى أدائه، فلذلك قدمت على الدين بعثا على وجوبها والمسارعة إلى إخراجها مع الدين. قاله في «المرقاة».

۳ قوله: إن أعيان بني الأم يتوارثون دون بني العلامات: وقال بعض المحققين من أصحابنا: أعيان القوم أشرافهم، والأعيان الإخوة من أب وأم، وهذه الإخوة تسمى المعاينة، وذكر الأم هنا لبيان ما يترجح به بنو الأعيان على بني العلات، والمعنى أن بني الأعيان إذا اجتمعوا مع العلات، فالميراث لبني الأعيان لقوة القرابة وزدواج الوصلة. قاله في «المرقاة». وقال في ضوء السراج»: فإن قيل: في الحديث ذكر بلفظ بني» فيتناول الذكر دون الأنثى، قلنا: لا كذلك، بل يتناول الأنثى كما يتناول الذكر، قال الله تعالى في آية القرآن: ﴿يَبَنِي ءَادَمَ (الأعراف: ٢٦) والخطاب كما يتناول للرجال يتناول للنساء.

وَعَنْ أُسَامَةَ بْنِ زَيْدٍ (رضي الله عنه) قَالَ: قَالَ رَسُوْلُ اللهِ ﷺ: «لَا يَرِثُ۱ الْمُسْلِمُ الْكَافِرَ وَلَا الْكَافِرُ الْمُسْلِمَ». مُتَّفَقٌ عَلَيْهِ.

وَرَوَى الطَّحَاوِيُّ عَنْ أَبِي عَمْرٍو الشَّيْبَانِي عَنْ عَلِيَّ اللهِ أَنَّهُ جَعَلَ مِيْرَاثَ الْمُسْتَوْرِدِ لِوَرَثَتِهِ مِنَ الْمُسْلِمِينَ.

وَفِي رِوَايَةٍ لَهُ عَنْ قَتَادَةَ أَنَّ الْحَسَنَ قَالَ: مِيْرَاثُهُ لِوَارِثِهِ مِنَ الْمُسْلِمِينَ إِذَا ارْتَدَّ عَنِ الْإِسْلَامِ. وَقَالَ الطَّحَاوِيُّ: وَرَوَيْنَا مِثْلَهُ عَنِ ابْنِ مَسْعُوْدٍ الله وَسَعِيدِ بْنِ الْمُسَيِّبِ.

Usamah ibn Zayd (may Allah be pleased with him) narrated that the Prophet (ﷺ) said: A Muslim does not inherit from a disbeliever, nor a disbeliever from a Muslim. [Agreed upon] Tahawi narrated from Abu Amr Ash-Shaybani, from Ali (may Allah be pleased with him), that he assigned the inheritance of an apostate to their Muslim heirs. In another narration by Tahawi, from Qatadah, Hasan said: Their inheritance is for their Muslim heir if they apostatize from Islam. Tahawi said: We narrated the same from Ibn Mas’ud (may Allah be pleased with him) and Sa’id ibn Al-Musayyib.

1 The statement: A Muslim does not inherit from a disbeliever, nor a disbeliever from a Muslim, As for the disbeliever, they do not inherit from a Muslim by consensus, supported by the hadith and the verse: And Allah will never grant the disbelievers a way over the believers [An-Nisa: 141]. Inheritance establishes a way for the disbeliever over the Muslim. As for whether a Muslim inherits from a disbeliever, most Companions said they do not, and this is the view of our scholars and Shafi’i. As for an apostate, they do not inherit from a Muslim by consensus. Regarding a Muslim inheriting from an apostate, there is disagreement. According to Malik, Shafi’i, and Ahmad, a Muslim does not inherit from them. Abu Hanifah said: What they earned during apostasy goes to the public treasury, and what they earned during Islam goes to their Muslim heirs. Abu Yusuf and Muhammad said: Both earnings go to their heirs. Shafi’i said: Both are spoils, as they died a disbeliever, and a Muslim does not inherit from a disbeliever, and their wealth is that of a belligerent with no protection, so it becomes spoils. Our view is that their ownership after apostasy remains, so it transfers upon their death to their heirs, based on their state before apostasy, as apostasy is a cause of death, making it inheritance from a Muslim to a Muslim. This basis is also necessary for the other three Imams, as Muslims taking it when there is no heir is by way of inheritance, which legally requires basing it on their state before apostasy; otherwise, it would be inheritance from a disbeliever to a Muslim. The hadith refers to an original disbeliever who never embraced Islam. In Al-Bada’i, it is argued that when Ali (may Allah be pleased with him) killed Al-Mustawrid Al-Ijli for apostasy, he divided his wealth among his Muslim heirs in the presence of the Companions without objection, making it a consensus.

۱قوله : لا يرث المسلم الكافر ولا الكافر المسلم: أما الكافر فإنه لا يرث المسلم بالإجماع وبالحديث وبقوله تعالى: وَلَن يَجْعَلَ اللهُ لِلْكَافِرِينَ عَلَى الْمُؤْمِنِينَ سَبِيلًا (النساء: ١٤١ ، وفي الميراث إثبات السبيل للكافر على المسلم، وأما المسلم فهل يرث من الكافر أم لا ، فقالت عامة الصحابة : لا يرث، وبه أخذ علماؤنا والشافعي، وأما المرتد فلا يرث المسلم بالإجماع، وأما المسلم من المرتد ففيه أيضًا الخلاف، فعند مالك والشافعي وأحمد أن المسلم لا يرث منه، وقال أبو حنيفة : ما اكتسبه في ردّته فهو لبيت المال، وما اكتسبه في الإسلام فهو لورثته المسلمين، وقال أبو يوسف ومحمد كلا الكسبان جميعا لورثته، وقال الشافعي كلاهما فيء؛ لأنه مات كافرا، والمسلم لا يرث الكافر، ثم هو مال حربي لا أمان له، فيكون فيئا، ولنا أن ملكه بعد الردة باق، فينتقل بموته إلى ورثته مستندا إلى ما قبيل ردته؛ إذ الردة سبب للموت فيكون توريث المسلم من المسلم والاستناد لازم له على قول الأئمة الثلاثة أيضًا؛ لأن أخذ المسلمين له إذا لم يكن له وارث بطريق الوراثة، وهو يوجب الحكم باستناده شرعًا إلى ما قبيل ردته، وإلا كان توريثاً للكافر من المسلم، ومحمل الحديث الكافر الأصلي الذي لم يسبق له إسلام، واستدل في «البدائع» بأن عليا الله لما قتل المستورد العجلي بالردة قسم ماله بين ورثته المسلمين، وكان بمحضر من الصحابة من غير إنكار، فكان إجماعا.

وَعَنْ عُمَرَ ابْنِ الْخَطَابِ (رضي الله عنه) قَالَ : الْمُشْرِكُونَ۱ بَعْضُهُمْ أَوْلِيَاءُ بَعْضٍ، لَا نَرِثُهُمْ وَلَا يَرِثُوْنَا. رَوَاهُ مُحَمَّدٌ.

وَقَالَ: بِهِ نَأْخُذُ الْكُفْرُ مِلَّةٌ وَاحِدَةٌ، يَتَوَارَثُوْنَ بِهِ وَإِنَّ اخْتَلَفُ يَرِثُ الْيَهُودِيُّ النَّصْرَانِي، وَالنَّصْرَانِيُّ الْيَهُودِيَّ، وَلَا يَرِثُهُمْ الْمُسْلِمُوْنَ وَلَا يَرِثُوْنَهُمْ، وَهُوَ قَوْلُ أَبِي حَنِيفَةَ وَالْعَامَّةِ مِنْ فُقَهَائِنَا.

English

Umar ibn Al-Khattab (may Allah be pleased with him) said: Polytheists are allies of one another. We do not inherit from them, nor they from us. [Narrated by Muhammad] He said: We adopt this. Disbelief is one nation, and they inherit through it even if their religions differ. A Jew inherits a Christian, and a Christian inherits a Jew, but Muslims neither inherit from them nor are inherited by them. This is the view of Abu Hanifah and most of our jurists.

The view of Malik and Ahmad is that they do not inherit from one another if they are of different religions, such as a Jew and a Christian, or others among disbelievers if their religions differ. Abu Hanifah and Shafi’i said: They are one nation, all disbelievers, so they inherit from one another. As stated in Rahmat Al-Ummah. The meaning in the hadith of Abdullah ibn Umar, People of two different religions do not inherit from one another, is Islam and disbelief, as all disbelievers are one nation when compared to Muslims, even if they consider themselves of different religions. As stated in Al-Marqah.

وَعَنْ وَائِلَةَ بْنِ الْأَسْفَعِ (رضي الله عنه) قَالَ: قَالَ رَسُولُ اللَّهِ ﷺ: «الْمَرْأَةُ۱ تَحُورُ ثَلَاثَ مَوَارِيثَ عَتِيقِهَا وَلَقِيطِهَا۲ وَوَلَدِهَا۳ الَّذِي لَا عَنَتْ عَلَيْهِ». رَوَاهُ التَّرْمِذِيُّ وَأَبُوْ دَاوُدَ وَابْنُ مَاجَه.

English

Wailah ibn Al-Asqa (may Allah be pleased with him) narrated that the Prophet (ﷺ) said: A woman inherits three types of inheritance: her freed slave, her foundling, and her child from whom she is not cursed. [Narrated by Tirmidhi, Abu Dawud, Ibn Majah]

2 The statement: Her foundling, Most scholars hold that there is no patronage for the one who picks up a foundling, so calling it inheritance is metaphorical, as the foundling’s inheritance goes to the public treasury unless the picker is poor, in which case the leader may leave it for them as charity and compensation for their efforts in protecting and raising them. As stated in Al-Marqah and Bazl Al-Majhood.

3 The statement: Her child from whom she is not cursed, The child denied through mutual cursing has no inheritance with the father, as there is no dispute that neither inherits from the other, since inheritance is based on lineage, and the lineage is negated. As for their lineage through the mother, it is established, and they inherit from each other. As stated in Al-Marqah.

۱ قوله: تحوز المرأة ويظهر من الإرشاد الرضي نكتة في تخصيص ذكر المرأة ههنا، وهو أنها تأخذ من هذه الثلاثة كل المال، بخلاف عامة المواريث.

۲ قوله: لقيطها وعامة العلماء على أنه لا ولاء للملتقط، فإطلاق الوراثة عليه مجاز؛ لأن ميراث اللقيط لبيت المال إلا أن يكون الملتقط فقيرًا، فيترك له الإمام تصدقا عليه ومجازاة له على ما تحمل في حفظه وتربيته، «المرقاة»، وبذل المجهود، ملتقط منهما.

۳ قوله: ولدها الذي لاعنت عنه : فالذي نفاه الرجل باللعان فلا خلاف أن أحدهما لا يرث الآخر؛ لأن التوارث بسبب النسب، وقد انتفى النسب، وأما نسبه من جهة الأم فثابت، ويتوارثان. كذا في «المرقاة».

1 The statement: The freedman of a people is one of them, Scholars interpreted “freedman” here as the freed slave, meaning they inherit from their patron if they have no agnate relatives by lineage, but the patron does not inherit from the freedman according to most. What Tirmidhi and Abu Dawud narrated from Ibn Abbas, that a man died leaving no heir except a slave he had freed, and the Prophet (ﷺ) asked: Does he have anyone? They said: No, except a slave he had freed. So the Prophet (ﷺ) assigned his inheritance to him. Ali Al-Qari said: This assignment is like what was mentioned earlier in Aishah’s hadith: Give his inheritance to a man from his village’s people, by way of charity, as his wealth goes to the public treasury. As stated in Al-Marqah. In As-Sirajiyyah: It begins with the fixed-share heirs, who have designated shares in Allah’s Book. Then the agnates by lineage, who take what the fixed-share heirs leave, and in their absence, take all the wealth. Then the agnates by cause, which is the patron of manumission, then their agnates in order. Then the return to the fixed-share heirs by lineage according to their rights. Then distant relatives, then the patron of alliance, then one acknowledged as a relative through another without established lineage through their acknowledgment, if the acknowledger dies upon their acknowledgment. Then the one bequeathed the entire wealth, then the public treasury.

۱قوله: مولى القوم من أنفسهم وفسر العلماء المولى هنا بالمعتق، أي يرث من العتيق إذا لم يكن له أحد من عصباته النسبية، ولا يرث العتيق المعتق عند الجمهور، وما رواه الترمذي وأبو داود عن ابن عباس، وفيه أن رجلا مات ولم يدع وارثا إلا غلامًا كان أعتقه، فقال النبي : هل له أحد ؟ قالوا : لا إلا غلام له كان أعتقه، فجعل النبي ﷺ ميراثه له، قال علي القاري: هذا الجعل مثل ما سبق في حديث عائشة عليها أعطوا ميراثه رجلا من أهل قريته بطريق التبرع؛ لأنه صار ماله لبيت المال. قاله في المرقاة». وقال في السراجي»: فيبدأ بأصحاب الفرائض، وهم الذين لهم سهام مقدرة في كتاب الله تعالى، ثم بالعصبات من جهة النسب والعصبة كل من يأخذ ما أبقته أصحابالفرائض، وعند الانفراد يحرز جميع المال، ثم بالعصبة من جهة السبب، وهو مولى العتاقة، ثم عصبته على الترتيب، ثم الرد على ذوي الفروض النسبية بقدر حقوقهم، ثم ذوي الأرحام، ثم مولى الموالاة، ثم المقر له بالنسب على الغير بحيث لم يثبت نسبه بإقراره من ذلك الغير، إذا مات المقر على إقراره، ثم الموصى له بجميع المال، ثم بيت المال.

Amr ibn Shu’ayb, from his father, from his grandfather, narrated that the Prophet (ﷺ) said: The right of patronage is inherited by those who inherit the wealth. [Narrated by Tirmidhi]

Al-Muzhir said: This is specific, meaning every agnate who inherits the deceased’s wealth inherits the patronage. A woman, though she inherits, is not an agnate, as agnates are males, not females. If a freedman leaves his patron’s son and daughter, the inheritance is for the son only. If he leaves his patron’s daughter and sister, they have no right to it, and the patronage does not transfer to the public treasury. Women do not inherit through patronage unless they manumitted or their freed slave manumitted someone. As stated in Al-Marqah and Radd Al-Muhtar.

۱قوله: من يرث المال: أي من العصابات الذكور، والمراد العصبة بنفسه. قال المظهر : هذا مخصوص أي يرث الولاء كل عصبة يرث مال الميت كل عصبة يرث مال الميت، والمرأة وإن كانت ترث إلا أنها ليست بعصبة، بل العصبة الذكور دون الإناث، فلو ترك العتيق ابن سيده وبنته فالإرث للابن فقط، ولو ترك بنت سيده وأخته فلا حق لهما فيه، ولا ينقل الولاء إلى بيت المال، ولا يرث النساء بالولاء إلا إذا أعتقن أو أعتق عتيقهن أحدا، «المرقاة»، و«رد المحتار ملتقط منهما.

1 The statement: The son of a people’s sister is one of them, This is used as evidence by those who support inheritance for distant relatives. Distant relatives inherit only if the deceased has no agnates or fixed-share heirs. This is the view of Abu Hanifah, Abu Yusuf, Muhammad, Ahmad, and most Companions, including Ali ibn Abi Talib, Ibn Mas’ud, Ibn Abbas in his most well-known narration, Mu’adh ibn Jabal, Abu Ad-Darda, Abu Ubaidah ibn Al-Jarrah, and the four Caliphs, as stated by Judge Abu Hazim. Uthman ibn Affan, Zayd ibn Thabit, and Abdullah ibn Az-Zubair (may Allah be pleased with them) held that distant relatives have no inheritance, and if someone dies leaving no fixed-share heir or agnate, their wealth goes to the public treasury. This is the view of Malik and Shafi’i, though Shafi’i’s followers today issue fatwas supporting inheritance for distant relatives based on the view of the people of revelation, considering the corruption of the public treasury. Abu Bakr As-Siddiq has two narrations on this. As stated in Umdat Al-Qari.

وَعَنِ الْمِقْدَامِ (رضي الله عنه)، قَالَ: قَالَ رَسُولُ اللهِ ﷺ: «أَنَا أَوْلَى بِكُلِّ مُؤْمِنٍ مِنْ نَفْسِهِ فَمَنْ تَرَكَ دَيْنًا أَوْ ضَيْعَةً فَإِلَيْنَا، وَمَنْ تَرَكَ مَالًا فَلِوَرَثَتِهِ وَأَنَا مَوْلَى مَنْ لَا مَوْلَى لَهُ أَرِثُ مَالَهُ وَأَفُكُ عَانَهُ، وَالْخَالُ مَوْلَى مَنْ لَا مَوْلَى لَهُ يَرِثُ مَا لَهُ وَيَفُكُّ عَانَهُ».

وَفِي رِوَايَةٍ: «وَأَنَا وَارِثُ مَنْ لَا وَارِثَ لَهُ أَعْقِلُ لَهُ وَأَرِثُهُ وَالْخَالُ وَارِثُ مَنْ لَا وَارِثَ لَهُ يَعْقِلُ عَنْهُ وَيَرِثُهُ». رَوَاهُ أَبُوْ دَاوُدَ.

English

Al-Miqdam (may Allah be pleased with him) narrated that the Prophet (ﷺ) said: I am closer to every believer than their own self. Whoever leaves a debt or dependents, they are my responsibility. Whoever leaves wealth, it is for their heirs. I am the patron of those without a patron; I inherit their wealth and settle their liabilities. The maternal uncle is the patron of those without a patron, inheriting their wealth and settling their liabilities. In another narration: I am the heir of one who has no heir; I pay their blood money and inherit them. The maternal uncle is the heir of one who has no heir; he pays their blood money and inherits them. [Narrated by Abu Dawud]

وَرَوَاهُ التَّرْمِذِيُّ وَابْنُ مَاجَه وَالدَّارِمِيُّ عَنْ تَمِيمِ الدَّارِي قَالَ: سَأَلْتُ رَسُوْلَ اللهِ ﷺ: مَا السُّنَّةُ فِي الرَّجُلِ مِنْ أَهْلِ الشَّرْكِ يُسْلِمُ عَلَى يَدَى رَجُلٍ مِنَ الْمُسْلِمِينَ، فَقَالَ: «هُوَ أَوْلَى۲ النَّاسِ بِمَحْيَاهُ وَمَمَاتِهِ».

Kathir ibn Abdullah, from his father, from his grandfather (may Allah be pleased with him), narrated that the Prophet (ﷺ) said: The freedman of a people is one of them, their ally is one of them, and the son of their sister is one of them. [Narrated by Ad-Darimi] Tirmidhi, Ibn Majah, and Ad-Darimi narrated from Tamim Ad-Dari that he asked the Prophet (ﷺ): What is the Sunnah regarding a man from the people of idolatry who embraces Islam at the hands of a Muslim man? He said: He is the most entitled of people to his life and death.

1 The statement: Their ally is one of them, Meaning their confederate, referring to the patron of alliance, who inherits according to us if the deceased has no other heir. Ash-Sha’bi said: There is no patronage except that of manumission, and this is the view of Shafi’i and Zayd ibn Thabit. Our view is that of Umar, Ali, and Ibn Mas’ud. As stated in Al-Marqah. Tahtawi said: Alliance linguistically means friendship, opposite to dispute. In technical terms, it is when one says to another: You are my patron, you inherit me if I die and pay my blood money if I commit a crime, and the other says: I accept. Then the contract of patronage is valid, and the speaker becomes the patron, inheriting them if they die and paying their blood money if they commit a crime. If they stipulate conditions from both sides, it is according to the conditions; otherwise, the silent party’s wealth goes to the public treasury. It is permissible to retract before paying blood money, not after. Sadr Ash-Shari’ah said its condition is that the person’s lineage is unknown. Ibn Kamal said: This is not a condition.

2 The statement: He is the most entitled of people to his life and death, This is evidence that if someone embraces Islam at the hands of a Muslim and dies with no heir except them, they receive the inheritance. Shafi’i and Malik say there is no inheritance, and the wealth goes to the public treasury. Hanafis and Qasimiyyah say they inherit, but Hanafis require a contract of alliance, meaning there is no inheritance if the person’s Islam is only at the hands of a Muslim, but if accompanied by a contract of alliance, the patron is most entitled to the inheritance in the absence of relatives. As stated in Nayl Al-Awtar. In the margin of Al-Kawkab Ad-Durri, Hanafis’ evidence is the hadith of Tamim Ad-Dari mentioned in this chapter, and Al-Ayni elaborated on its suitability for evidence.

۱قوله: وحليف القوم منهم : أي عهيدهم، وأريد به مولى الموالاة؛ فإنه يرث عندنا إذا لم يكن للميت وارث سواه، وكان الشعبي يقول: لا ولاء إلا ولاء العتاقة، وبه أخذ الشافعي ، وهو مذهب زيد بن ثابت، وما ذهبنا إليه مذهب عمر وعلي وابن مسعود . قاله في «المرقاة». وقال الطحطاوي: الموالاة في اللغة: بمعنى المصادقة ضد المجادلة، وفي الاصطلاح: أن يقول شخص لآخر : أنت مولاي ترثني إذا مِتُّ وتعقل عني إذا جنيت، وقال الآخر: قبلت، فحينئذ صح عقد الولاء ويكون القائل مولى له، يرثه إذا مات ويعقل عنه إذا جنى، وإن شرطا من الجانبين فعلى ما شرطا، وإلا فمال الساكت لبيت المال، ويصح الرجوع عنه قبل ما عقل عنه لا بعده، وقال صدر الشريعة شرطه أن يكون مجهول النسب، وقال ابن كمال: هذا ليس بشرط.

۲ قوله: هو أولى الناس بمحياه ومماته فيه دليل على أن من أسلم على يد رجل من المسلمين، ومات ولا وارث له غيره، كان له ميراثه، والشافعي ومالك لا إرث له، بل يصرف الميراث إلى بيت المال دونه، وقالت الحنفية والقاسمية: إنه يرث إلا أن الحنفية يشترطون في إرثه المحالفة، يعني قالت الحنفية: عدم الإرث إذا كان إسلام الرجل على يدي مسلم فقط، وأما إذا اقترن معه المعاقدة والمحالفة، فعند ذلك يكون المولى أولى بالميراث عند عدم الأقارب. كذا في نيل الأوطار». وقال في هامش الكوكب الدري ومستدل الحنفية حديث تميم الداري المذكور في الباب، وبسط العيني في كونه صالحا للاستدلال.

وَرَوَى أَبُو حَنِيفَةَ عَنْ إِبْرَاهِيمَ أَنَّهُ قَالَ: لَا يَرِثُ قَائِلٌ مِمَّنْ قَتَلَ خَطَأً أَوْ عَمْدًا، وَلَكِنْ يَرِثُهُ أَوْلَى النَّاسِ بِهِ بَعْدَهُ. وَكَذَا رَوَاهُ۲ مُحَمَّدُ بْنُ الْحَسَنِ فِي الْآثَارِ» عَنْهُ، وَرَوَى الْبَيْهَقِيُّ وَأَبُو دَاوُدَ فِي الْمَرَاسِيْلِ عَنْ سَعِيدِ بْنِ الْمُسَيِّبِ نَحْوَهُ، وَرَوَاهُ النَّسَائِيُّ وَابْنُ مَاجَه والدار قُطْنِيُّ عَنْ عَمْرِو بْنِ شُعَيْبٍ.

Abu Hurairah (may Allah be pleased with him) narrated that the Prophet (ﷺ) said: The killer does not inherit. [Narrated by Tirmidhi, Ibn Majah] Abu Hanifah narrated from Ibrahim that he said: A killer does not inherit from the one they killed, whether by mistake or intentionally, but the closest person to them after them inherits. Muhammad ibn Al-Hasan narrated the same in Al-Athar from him. Al-Bayhaqi and Abu Dawud narrated something similar from Sa’id ibn Al-Musayyib in mursal form. An-Nasa’i, Ibn Majah, and Ad-Daraqutni narrated it from Amr ibn Shu’ayb.

1 The statement: The killer does not inherit, Know that according to us, the killing that prevents inheritance is that which incurs retribution or expiation. Killing that incurs neither, such as killing for a cause or in retribution, does not cause deprivation, as deprivation of inheritance is a penalty, tied to what incurs a penalty, which is retribution or expiation. Shafi’i (may Allah have mercy on him) ties it to killing in general, so according to him, one does not inherit if they killed in retribution, by stoning, or if the relative was a judge who ruled for it, a witness who testified for it, an aggressor who was killed, or one who drew a sword against them and was killed in defense, all prevent inheritance according to him. This is meaningless, as the Lawgiver obligated or permitted killing in these cases, so how can a penalty be imposed for it afterward? Thus, other penalties for killing do not apply to such cases, and so too deprivation. As stated in Uqud Al-Jawahir Al-Munifah. I say: The following narrations support us.

2 The statement: Muhammad ibn Al-Hasan narrated in Al-Athar, He said: We adopt this. A killer does not inherit from the one they killed, whether by mistake or intentionally, neither from the blood money nor otherwise. As stated in Uqud Al-Jawahir Al-Munifah.

۱ قوله: القاتل لا يرث: اعلم أن عندنا القتل الذي يمنع الإرث هو الذي يتعلق به وجوب القصاص أو الكفارة، وما لا يتعلق به واحد منهما كالقتل بسبب أو بقصاص لا يوجب الحرمان؛ لأن حرمان الإرث عقوبة، فيتعلق به ما تتعلق به العقوبة، وهو القصاص أو الكفارة، والشافعي الله يعلقه بمطلق القتل حتى لا يرث عنده إذا قتله بقصاص أو رجم أو كان القريب قاضيًا فحكم بذلك، أو شاهدا فشهد به، أو باغيا فقتله، أو شهر عليه سيفا فقتله دفعا، كل ذلك يمنع الإرث عنده، وهذا لا معنى له؛ لأن الشارع أوجب عليه قتله، أو أجاز له قتله في هذه الصور، فكيف يوجب عليه العقوبة به بعد ذلك؟ ولهذا لا يتعلق بهذا القتل سائر عقوبات القتل فكذا الحرمان. كذا في عقود الجواهر المنيفة». قلت: ويؤيدنا الآثار الآتية بعد.

۲ قوله: رواه محمد بن الحسن في الآثار عنه وقال: وبه نأخذ، لا يرث قاتل ممن قتل خطأ أو عمدا، لا من الدية ولا غيرها. قاله في عقود الجواهر المنيفة».

وَعَنِ الضَّحَاكِ بْنِ سُفْيَانَ أَنَّ رَسُولَ اللهِ ﷺ كَتَبَ إِلَيْهِ : أَنْ أُوَرِّثَ۱ امْرَأَةَ أَشْيَمَ الضِّبَابِيِّ مِنْ دِيَةِ زَوْجِهَا. رَوَاهُ التَّرْمِذِيُّ وَأَبُو دَاوُدَ، وَقَالَ التَّرْمِذِيُّ: هَذَا حَدِيثُ حَسَنٌ صَحِيحٌ.

English

Ad-Dahhak ibn Sufyan narrated that the Prophet (ﷺ) wrote to him to let the wife of Ashyam Ad-Dibabi inherit from her husband’s blood money. [Narrated by Tirmidhi, Abu Dawud] Tirmidhi said: This is a good, authentic hadith.

1 The statement: Inherit from her husband’s blood money, Muhammad said in his Muwatta: We adopt this. Every heir has a share in the blood money and the killing, whether a woman, a spouse, or otherwise. This is the view of Abu Hanifah and most of our jurists. As stated. In Sharh Al-Fara’id by As-Sayyid: Know that the blood money for one killed by mistake is like their other wealth, so their debts are settled from it, their bequests are fulfilled, and it is inherited by all who inherit their other wealth. Malik said: Spouses do not inherit from the blood money, as marriage ends with death, and blood money is not obligated until after it. Our evidence is this hadith. Az-Zuhri said: Ashyam’s killing was by mistake.

۱ قوله: ورث امرأة أشيم الضبابي من دية زوجها قال محمد في موطئه وبهذا نأخذ لكل وارث في الدية والدم نصيب المرأة كان الوارث أو زوجا أو غير ذلك، وهو قول أبي حنيفة والعامة من فقهائنا، انتهى. وقال السيد في شرحالفرائض: واعلم أن دية المقتول خطأ كسائر أمواله حتى تقضى منها ديونه، وتنفّذ وصاياه، ويرثها كل من يرث سائر أمواله، وقال مالك: لا يرث الزوجان من الدية لانقطاع الزوجية بالموت، ولا وجوب للدية إلا بعده، ولنا هذا الحديث قال الزهري: كان قتل أشيم خطأ.

وَعَنْ قَبِيصَةَ بْنِ ذُوِّيْبٍ قَالَ: جَاءَتِ الْجَدَّةُ إِلَى أَبِي بَكْرٍ تَسْأَلُهُ مِيرَاثَهَا، فَقَالَ لَهَا: مَا لَكِ فِي كِتَابِ اللهِ شَيْءٌ، وَمَا لَكِ فِي سُنَّةِ رَسُولِ اللهِ ﷺ شَيْئًا، فَارْجِعِي حَتَّى أَسْأَلَ النَّاسَ عَنْ ذَلِكَ، فَسَأَلَ فَقَالَ الْمُغِيرَةُ بْنُ شُعْبَةَ: حَضَرْتُ رَسُولَ اللهِ ﷺ أَعْطَاهَا ۱ السُّدُسَ. فَقَالَ أَبُو بَكْرٍ: هَلْ مَعَكَ غَيْرُكَ؟ فَقَامَ مُحَمَّدُ بْنُ مَسْلَمَةَ، فَقَالَ مِثْلَ مَا قَالَ الْمُغِيرَةُ، فَأَنْفَذَهُ لَهَا أَبُو بَكْرٍ الصِّدِّيقُ ، ثُمَّ جَاءَتِ الْجَدَّةُ الْأُخْرَى إِلَى عُمَرَ تَسْأَلُهُ مِيرَاثَهَا، فَقَالَ: هُوَ ذَلِكَ السُّدُسُ، فَإِنْ اجْتَمَعْتُمَا فَهُوَ بَيْنَكُمَا ، وَأَيَّتُكُمَا خَلَتْ بِهِ فَهُوَ لَهَا. رَوَاهُ مَالِكُ وَأَحْمَدُ وَالتَّرْمِذِيُّ وَأَبُو دَاوُدَ وَالدَّارِمِيُّ وَابْنُ مَاجَه.

English

Qabisah ibn Dhuwayb narrated: A grandmother came to Abu Bakr asking about her inheritance. He said to her: You have nothing in the Book of Allah, nor in the Sunnah of the Prophet (ﷺ). Return until I ask people about it. He asked, and Al-Mughirah ibn Shu’bah said: I was present when the Prophet (ﷺ) gave her one-sixth. Abu Bakr said: Is there anyone else with you? Muhammad ibn Maslamah stood and said the same as Al-Mughirah, so Abu Bakr implemented it for her. Then another grandmother came to Umar asking about her inheritance. He said: It is that one-sixth. If you are together, it is shared between you, and whichever of you is alone with it, it is hers. [Narrated by Malik, Ahmad, Tirmidhi, Abu Dawud, Ad-Darimi, Ibn Majah]

1 The statement: Gave her one-sixth, For this reason, it is said in Sharh Al-Fara’id by As-Sayyid: A grandmother gets one-sixth, whether maternal or paternal, whether one or more, if they are established and equal in degree. They are all excluded by the mother, and paternal grandmothers are also excluded by the father. As for the interpretation of what Ibn Mas’ud (may Allah be pleased with him) narrated from the Prophet (ﷺ) that he gave the father’s mother one-sixth in the presence of the father, it may be that the father of that deceased was a slave or a disbeliever.

وَعَنْ جَابِرٍ(رضي الله عنه) قَالَ: قَالَ رَسُولُ اللهِ ﷺ: إِذَا۱ اسْتَهَلَّ الصَّبِيُّ صُلِّيَ عَلَيْهِ وَوُرِثَ.۲ رَوَاهُ ابْنُ مَاجَه وَالدَّارِمِيُّ، وَقَالَ الزُّهْرِيُّ: أَرَى الْعَطَاسَ اسْتِهْلَالًا.

Jabir (may Allah be pleased with him) narrated that the Prophet (ﷺ) said: If a newborn cries, it is prayed over and inherits. [Narrated by Ibn Majah, Ad-Darimi] Az-Zuhri said: I consider sneezing to be crying.

1 The statement: If a newborn cries, The condition of crying is specified because it is the predominant sign of life. Otherwise, any sign of life found allows that newborn to inherit from their deceased relative who died before them. As stated in Bazl Al-Majhood.

2 The statement: Inherits, In Sharh As-Sunnah: If a person dies and their heir is a fetus in the womb, the inheritance is reserved for them. If they are born alive, it is theirs. If they are born dead, they do not inherit, but it goes to the other heirs of the first deceased. If they are born alive and then die, they are inherited from, whether they cried or not, as long as a sign of life is found, such as sneezing, breathing, or movement indicating life, except for the twitching of one emerging from constriction. This is the view of Ath-Thawri, Al-Awza’i, Shafi’i, and the followers of Abu Hanifah. Some said they do not inherit unless they cry, citing this hadith. Crying means raising the voice. Others meant by it the presence of a sign of life, expressed as crying because it typically occurs at birth, and through it, their life is known. As stated in Al-Marqah.

۱ قوله : إذا استهل إلخ : وقيد الاستهلال باعتبار أنه الغالب في القرينة على الحياة، وإلا فأي أمارة على الحياة وجدت يورث ذلك المولود من مورثه الذي مات قبله. كذا في بذل المجهود».

۲ قوله: وورث: وفي شرح السنة لو مات إنسان، ووارثه حمل في البطن، يوقف له الميراث، فإن خرج حيا كان له، وإن خرج ميتا فلا يورث منه، بل لسائر ورثة الأول، فإن خرج حيا ثم مات يورث منه، سواء استهل أو لم يستهل بعد أن وجدت فيه إمارة الحياة من عطاس أو تنفس أو حركة دالة على الحياة سوى اختلاج الخارج عن المضيق، وهو قول الثوري والأوزاعي والشافعي وأصحاب أبي حنيفة ، وذهب قوم إلى أنه لا يورث منه ما لم يستهل، واحتجوا بهذا الحديث والاستهلال رفع الصوت، والمراد منه عند الآخرين وجود أمارة الحياة، وعبر عنها بالاستهلال؛ لأنه يستهل حالة الانفصال في الأغلب، وبه يعرف حياته. كذا في «المرقاة».

وَعَنْ عَمْرِو بْنِ شُعَيْبٍ عَنْ أَبِيْهِ عَنْ جَدِّهِ ، أَنَّ النَّبِيَّ ﷺ قَالَ: «أَيُّمَا رَجُلٍ عَاهَرَ بِحُرَّةٍ أَوْ أَمَةٍ فَالْوَلَدُ وَلَدُ زِنَا لَا يَرِثُ وَلَا يُورَثُ». رَوَاهُ التَّرْمِذِيُّ.

English

Amr ibn Shu’ayb, from his father, from his grandfather, narrated that the Prophet (ﷺ) said: If a man fornicates with a free woman or a slave, the child is a child of fornication, neither inheriting nor inherited. [Narrated by Tirmidhi]

وَعَنْ جَابِرٍ (رضي الله عنه)، قَالَ: جَاءَتْ امْرَأَةُ سَعْدِ بْنِ الرَّبِيعِ بِابْنَتَيْهَا مِنْ سَعْدِ بْنِ الرَّبِيعِ إِلَى رَسُولِ اللهِ ، فَقَالَتْ: يَا رَسُوْلَ اللهِ ، هَاتَانِ ابْنَتَا سَعْدِ بْنِ الرَّبِيعِ قُتِلَ أَبُوهُمَا مَعَكَ يَوْمَ أُحُدٍ شَهِيدًا، وَإِنَّ عَمَّهُمَا أَخَذَ مَالَهُمَا فَلَمْ يَدَعْ لَهُمَا مَالًا، وَلَا تُنْكَحَانِ إِلَّا وَلَهُمَا مَالُ. قَالَ: «يَقْضِي اللهُ فِي ذَلِكَ، فَنَزَلَتْ آيَةُ الْمِيرَاثِ، فَبَعَثَ رَسُولُ اللَّهِ ﷺ إِلَى عَمِّهِمَا، فَقَالَ: أَعْطِ ابْنَتَيْ سَعْدِ الظُّلُتَيْنِ، وَأَعْطِ أُمَّهُمَا الثُّمُنَ، وَمَا بَقِيَ فَهُوَ لَكَ». رَوَاهُ أَحْمَدُ وَالتَّرْمِذِيُّ وَأَبُو دَاوُدَ وَابْنُ مَاجَه ، وَقَالَ التَّرْمِذِيُّ: هَذَا حَدِيْثٌ حَسَنٌ غَرِيبٌ.

English

Jabir (may Allah be pleased with him) narrated: The wife of Sa’d ibn Ar-Rabi came to the Prophet (ﷺ) with her two daughters from Sa’d ibn Ar-Rabi and said: O Messenger of Allah, these are the daughters of Sa’d ibn Ar-Rabi. Their father was killed with you on the day of Uhud as a martyr, and their uncle took their wealth, leaving them nothing, and they cannot be married unless they have wealth. He said: Allah will judge in that. Then the verse of inheritance was revealed, and the Prophet (ﷺ) sent for their uncle and said: Give Sa’d’s two daughters two-thirds, give their mother one-eighth, and what remains is for you. [Narrated by Ahmad, Tirmidhi, Abu Dawud, Ibn Majah] Tirmidhi said: This is a good, rare hadith.

وَعَنْ هُزَيْلِ بْنِ شُرَحْبِيلَ قَالَ: سُئِلَ أَبُوْ مُؤْسَى عَنْ ابْنَةٍ وَبِنْتِ ابْنِ وَأُخْتِ، فَقَالَ: لِلْبِنْتِ النِّصْفُ وَلِلْأُخْتِ النِّصْفُ، وَأْتِ ابْنَ مَسْعُودٍ فَسَيُتَابِعُنِي، فَسُئِلَ ابْنُ مَسْعُودٍ وَأُخْبِرَ بِقَوْلِ أَبِي مُوسَى، فَقَالَ : لَقَدْ ضَلَلْتُ إِذَا وَمَا أَنَا مِنَ الْمُهْتَدِينَ، أَقْضِي فِيهَا بِمَا قَضَى النَّبِيُّ ، لِلْابْنَةِ النِّصْفُ ، وَلِابْنَةِ ابْنِ السُّدُسُ تَكْمِلَةَ الثُلُثَيْنِ، وَمَا بَقِيَ فَلِلْأُخْتِ. فَأَتَيْنَا أَبَا مُوسَى فَأَخْبَرْنَاهُ بِقَوْلِ ابْنِ مَسْعُودٍ ، فَقَالَ: لَا تَسْأَلُونِي مَا دَامَ هَذَا الْخَبْرُ فِيكُمْ. رَوَاهُ الْبُخَارِيُّ.

English

Huzayl ibn Shurahbil narrated: Abu Musa was asked about a daughter, a granddaughter, and a sister. He said: The daughter gets half, and the sister gets half. Go to Ibn Mas’ud, and he will agree with me. Ibn Mas’ud was asked and informed of Abu Musa’s statement. He said: I would have gone astray and not been among the guided if so. I judge in it as the Prophet (ﷺ) judged: the daughter gets half, the granddaughter one-sixth to complete two-thirds, and what remains is for the sister. We came to Abu Musa and informed him of Ibn Mas’ud’s statement. He said: Do not ask me as long as this expert is among you. [Narrated by Bukhari]

وَعَنْ عِمْرَانَ بْنِ حُصَيْنٍ (رضي الله عنه) قَالَ: جَاءَ رَجُلٌ إِلَى رَسُوْلِ اللَّهِ ﷺ فَقَالَ: إِنَّ ابْنَ ابْنِي مَاتَ فَمَا لِي مِنْ مِيرَائِهِ؟ فَقَالَ: «لَكَ السُّدُسُ» فَلَمَّا وَلَّى دَعَاهُ فَقَالَ: «لَكَ سُدُسُ آخَرُ فَلَمَّا وَلَّى دَعَاهُ فَقَالَ: «إِنَّ السُّدُسَ الْآخَرَ طُعْمَةً. رَوَاهُ أَحْمَدُ وَالتَّرْمِذِيُّ وَأَبُو دَاوُدَ، وَقَالَ التَّرْمِذِيُّ: هَذَا حَدِيْثُ حَسَنٌ صَحِيحٌ.

Imran ibn Husayn (may Allah be pleased with him) narrated: A man came to the Prophet (ﷺ) and said: My grandson died, so what is my share of his inheritance? He said: For you is one-sixth. When he turned away, he called him and said: For you is another one-sixth. When he turned away, he called him and said: The other one-sixth is a discretionary grant. [Narrated by Ahmad, Tirmidhi, Abu Dawud] Tirmidhi said: This is a good, authentic hadith.

وَعَنْ عَبْدِ اللهِ بْنِ عُمَرَ(رضي الله عنهما) أَنَّ رَسُوْلَ اللهِ ﷺ قَالَ: «مَا كَانَ۱ مِنْ مِيرَاثِ قُسِمَ فِي الْجَاهِلِيَّةِ فَهُوَ عَلَى قِسْمَةِ الْجَاهِلِيَّةِ، وَمَا كَانَ مِنْ مِيرَاثٍ أَدْرَكَهُ الْإِسْلَامُ فَهُوَ عَلَى قِسْمَةِ الْإِسْلَامِ». رَوَاهُ ابْنُ مَاجَه.

وَقَوْلِ اللَّهِ عَزَّ وَجَلَّ: {مِنْ بَعْدِ وَصِيَّةٍ يُوصَى بِهَا أَوْ دَيْنٍ غَيْرَ مُضَآرٍّ} (النساء: ۱۲

Abdullah ibn Umar (may Allah be pleased with him) narrated that the Prophet (ﷺ) said: Whatever inheritance was divided in the pre-Islamic era follows the division of the pre-Islamic era, and whatever inheritance Islam reached follows the division of Islam. [Narrated by Ibn Majah]
