وَعَنْ عَمْرِو بْنِ الشَّرِيدِ عَنْ أَبِيْهِ (رضي الله عنه) أَنَّ رَجُلًا قَالَ: يَا رَسُولَ اللَّهِ، أَرْضِيْ لَيْسَ لِأَحَدٍ فِيْهَا شِرْكَةٌ وَلَا قِسْمَةً إِلَّا الْجَوَارُ. فَقَالَ رَسُولُ اللهِ ﷺ: «الْجَارُ۱ أَحَقُّ بِسَقَبِهِ». رَوَاهُ النَّسَائِيُّ وَابْنُ مَاجَه.

وَفِي رِوَايَةِ الْبَزَارِ وَالدَّارَقُعْنِي: أَنَّ رَجُلًا قَالَ : يَا رَسُولَ اللَّهِ، أَرْضِيْ لَيْسَ لِأَحَدٍ فِيْهَا شِرْكَةُ وَلَا [قِسْمَةٌ] إِلَّا الْجَوَارُ، فَقَالَ: «الْجَارُ أَحَقُّ بِشُفْعَةِ مَا كَانَ».
Amr ibn Ash-Sharid narrated from his father that a man said: “O Messenger of Allah, my land has no partnership or division, only neighborhood.” The Messenger of Allah (ﷺ) said: “The neighbor is most entitled to his proximity.” [Narrated by An-Nasa’i and Ibn Majah]. Bukhari’s narration from Jabir: The Prophet (ﷺ) ruled preemption in all undivided property; if boundaries and paths are set, there is no preemption. ۱ قوله: الجار أحق بسقبه أجمع المسلمون على ثبوت الشفعة للشريك في العقار ما لم يقسم والحكمة في ثبوتها إزالة الضرر عن الشريك، وخصت بالعقار؛ لأنه أكثر الأنواع ضررًا، واتفقوا على أنه لا شفعة في الحيوان والثياب والأمتعة وسائر المنقول. أما المقسوم فلا خلاف في ثبوتها للشريك في النفس المبيع، وكذلك للشريك في حق المبيع كالشرب والطريق. إنما الخلاف في ثبوتها لجار ليس له شركة في شيء منهما، فمذهب الأوزاعي والليث ومالك والشافعي وأحمد وإسحاق وأبي ثوران: لا شفعة إلا لشريك لم يقاسم، ولا تجب الشفعة بالجوار، وقال النخعي وشريح القاضي والثوري وعمرو بن حريث والحسن بن حيّ وقتادة والحسن البصري وحماد بن سليمان وأبو حنيفة وأبو يوسف ومحمد: تجب الشفعة في الأراضي والرباع والحوائط للشريك الذي لم يقاسم، ثم للشريك الذي قاسم وقد بقي حق طريقه أو مشربه، ثم من بعدهما للجار الملاصق، ويؤيدنا أحاديث الباب، وقال الرؤياني الشافعي: بعض أصحابنا يفتي به، وهو الاختيار.
وفي الاستذكار لابن عبد البر روى ابن عيينة عن عمرو بن دينار عن أبي بكر عن ابن عمر من سعد ابن أبي وقاص أن عمر كتب إلى شريح أن اقض بالشفعة للجار، فكان يقضي بها، وسفيان عن إبراهيم بن ميسرة قال: كتب إلينا عمر بن عبد العزيز إذا حدّت الحدود فلا شفعة. قال إبراهيم فذكرت ذلك لطاوس، فقال: لا الجار أحق، فهذا حديث النسائي وابن ماجه صريح؛ لوجوبها لجار لا شركة فيه، فيدخل على سقوط تأويلهم: الجار بالشريك، وما رواه البخاري عن جابر، وفيه قضى النبي الله بالشفعة في كل ما لم يقسم، فإذا وقعت الحدود، وصرفت الطريق فلا شفعة. قال الخطابي: هذا أبين في الدلالة على نفي الشفعة لغير الشريكوحجة للشافعي، فإنهم قالوا: إذا وقعت الحدود وصرفت الطرق، فليس فيه حق شفعة لأحد. قلت: وقالت الحنفية معنى قوله فلا شفعة: أي لا شفعة للشركة؛ فإن الشفعة عندهم يثبت بثلاثة أمور، أحدها: الشركة في نفس المبيع والثاني: الشركة في حق المبيع، والثالث: الشركة للجوار. فأما إذا قسمت وحدت وصرفت الطرق فلم يبق الشركة في نفس المبيع، ولا شركة في حق المبيع، فلم يبق حق الشفعة بالأمر الأول، ولا بالثاني، وأما حق الشفعة بالأمر الثالث فبقي، وهو ثابت بحديث النسائي وابن ماجه، فعلى هذا معنى قوله: «إذا وقعت الحدود وصرفت الطرق فلا شفعة»: أي للشركة، يعني ضاع حق الشفعة باعتبار الشركة في نفس المبيع. وفي حقه، وقوله: «إذا وقعت الحدود وصرفت الطرق فلا شفعة هذا مدرج من قول جابر، لا من رسول الله . قال الكرماني: قال التيمي: قال الشافعي: الشفعة إنما هي للشريك، وأبو حنيفة للجار، وهذا الحديث حجة عليه. قلت: سبحان الله هذا كلام عجيب؛ لأن أبا حنيفة لم يقل: الشفعة للجار على الخصوص، بل قال: الشفعة للشريك في نفس المبيع، ثم في حق المبيع، ثم من بعدهما للجار، وكيف يقول، وهو حجة عليه، وإنما يكون حجة عليه إذا ترك العمل به، وهو عمل به أولا، ثم عمل بحديث الجار، ولم يحمل واحدا منهما، ووهم عملوا بأحدهما، وأهملوا الآخر بتأويلات بعيدة فاسدة، كذا التقطناه من البناية» و «عمدة القاري وبذل المجهود».

وَعَنْ عَلِيٍّ وَعَبْدِ اللهِ (رضي الله عنهما) قَالَا : قَضَى رَسُولُ اللهِ ﷺ بِالشَّفْعَةِ لِلْجَوَارِ. رَوَاهُ ابْنُ أَبِي شَيْبَةَ وَالطَّحَاوِيُّ.
وَرَوَى أَبُو دَاوُدَ عَنْ سَمُرَةَ (رضي الله عنه)عَنِ النَّبِيِّﷺ : جَارُ الدَّارِ أَحَقُّ بِدَارِ الْجَارِ أَوْ الْأَرْضِ، وَرَوَى التَّرْمِذِيُّ وَأَحْمَدُ نَحْوَهُ.

وَعَنْ عَبْدِ اللَّهِ بْنِ حُبَيْشِ (رضي الله عنه) قَالَ: قَالَ رَسُوْلُ اللهِ ﷺ: «مَنْ قَطَعَ۱ سِدْرَةً صَوَّبَ اللهُ رَأْسَهُ فِي النَّارِ». رَوَاهُ أَبُو دَاوُدَ.
وَقَالَ: هَذَا الْحَدِيثُ مُخْتَصَرُ ، يَعْنِي مَنْ قَطَعَ سِدْرَةً فِي فَلَاةٍ يَسْتَظِلُّ بِهَا ابْنُ السَّبِيلِ وَالْبَهَائِمُ عَبَثًا وَظُلْمًا بِغَيْرِ حَقٍّ يَكُونُ لَهُ فِيهَا صَوَّبَ اللَّهُ رَأْسَهُ فِي النَّارِ.
Abdullah ibn Hubaysh narrated that the Messenger of Allah (ﷺ) said: “Whoever cuts a sidr tree, Allah will plunge his head into the Fire.” [Narrated by Abu Dawud]. He said this hadith is abbreviated, meaning whoever cuts a sidr tree in a desert where travelers and animals seek its shade, unjustly without right, Allah will plunge his head into the Fire. 2 “Cuts a sidr tree…”: The sidr’s shade is cooler, but the ruling applies to any tree providing shade for people or animals. The hadith is shaky, as its narrator Urwah cut sidr for doors, and scholars agree cutting it is permissible. [From Al-Marqah and Al-Luma‘at].
۱ قوله: من قطع سدرة إلخ لعل وجه تخصيصها أن ظلها أبرد من ظل غيرها، وإلا فالحكم غير مختص بها، بل عام في كل شجر يستظل به الناس والبهائم بالجلوس تحته. قاله في المرقاة». وقال في اللمعات والحديث مضطرب فإن راويه عروة كان يقطعه ويتخذ منه أبوابا، وأجمعوا على إباحة قطعه.
