بَابُ الشَّرْكَةِ وَالْوَكَالَةِ وَالْمُضَارَبَةِPartnership, Agency, and Profit-Sharing

۱ قوله: باب الشركة وشرعيتها بالكتاب، فقد قال الله تعالى في آية المواريث: فَهُمْ شُرَكَاء في الثلث (النساء: ۱۲)، وقال الله تعالى: ﴿وَإِنَّ كَثِيرًا مِنَ الْخُلَطَاءِ) (ص: ٢٤ وبالسنة كحديث السائب: كان رسول الله ﷺ شريكي في الجاهلية، أخرجه ابن ماجه وأبو داود والحاكم، والأحاديث التي تذكر في هذا الباب، وبالتعامل من زمان رسول الله ﷺ وأصحابه و مجتهدي أمته إلى عصرنا هذا من غير نكير. الشركة ضربان، شركة ملك: وهي أن يملك متعدد عينا، يعني يرثونها أو يشترونها، وكل كأجنبي في مال صاحبه، فلا يجوز لأحدهما أن يتصرف في نصيب الآخر، والضرب الثاني: شركة عقد. وركنها - أي ماهيتها - الإيجاب والقبول، وشرطها كون المعقود عليه قابلا للوكالة، فلا تصح في مباح كاحتطاب وعدم ما يقطعها كشرط دراهم مسماة من الربح لأحدهما؛ لأنه قد لا يربح غير المسمى، وحكمها الشركة في الربح. ثم هي أربعة أوجه: مفاوضة، وعنان، وشركة الصنائع، وشركة الوجوه.

فأما شركة المفاوضة فهي شركة متساويين مالا وتصرفا ودينا، المراد المساواة في المال الذي يصح فيه الشركة، ولا بأس بزيادة مال لا يجري فيه الشركة، فلا يجوز بين الحر والمملوك، ولا بين الصبي والبالغ، ولا بين المسلم والكافر، وهذه الشركة جائزة عندنا استحسانًا، وفي القياس لا يجوز، وهو قول الشافعي، وجه الاستحسان ما رواه ابن ماجه عن صهيب مرفوعا: ثلاث فيهن البركة: البيع إلى أجل والمفاوضة واختلاط البر بالشعير للبيت لا للبيع، وأما شركة العنان فهي شركة في كل تجارة أو في نوع، ولا تتضمن الكفالة، وتصح ببعض ماله، ومع فضل مال أحدهما وتساوي ماليهما لا الربح، أي يصح بأن يشترط أن يكون المال مساويًا، ولا يكون الربح مساويا خلافًا للشافعي، فإن عنده يشترط التساوي في الربح عند تساوي المال. وأما شركة الصنائع وتسمى شركة التقبل والأعمال والأبدان، فهي أن يشترك صانعان، كخياطين أو خياط وصباغ ويتقبلا العمل لأجر بينهما صحت، وإن شرطا العمل نصفين والأجرة أثلاثا بينهما، هذا عندنا، وعند الشافعي لا يجوز هذه الشركة، وحديث أبي عبيدة الذي يأتي في هذا الباب حجة لنا في شركة الأبدان. وأما شركة الوجوه، فالرجلان يشتركان ولا مال لهما على أن يشتريا بوجوههما، ويبيعانهما فما حصل من الثمن يدفعان منه الثمن إلى بائعهما، فإن فضل شيء يكون مشتركا بينهما، هذه الشركة جائزة عندنا، خلافًا للشافعي فإنها لا تجوز عنده، أخذته من «الهداية» و«شرح الوقاية» و«عمدة الرعاية».

وَقَوْلِ اللَّهِ عَزَّ وَجَلَّ: وَإِنَّ كَثِيرًا مِّنَ الْخُلَطَاءِ (ص: ٢٤ ، وَقَوْلِهِ تَعَالَى: فَابْعَثُوا۱ أَحَدَكُم بِوَرِقِكُمْ هَذِهِ إِلَى الْمَدِينَةِ فَلْيَنظُرْ أَيُّهَا أَزْكَى طَعَامًا فَلْيَأْتِكُم بِرِزْقٍ مِّنْهُ وَلْيَتَلَطَّفْ وَلَا يُشْعِرَنَّ بِكُمْ أَحَدًا (الكهف: ۱۹

۱ قوله: فابعثوا أحدكم إلخ : فيه أن أصحاب الكهف وكلوا بشراء الطعام أحدًا منهم، وقد قص الله تعالى ذلك من غير إنكار، فدل على أن الوكالة ثابتة مشروعة، هكذا أفاده شراح الهداية. كذا في التفسيرات الأحمدية».

1 The statement: “Chapter on Partnership”: Its legitimacy is established by the Book, as Allah, the Exalted, said in the verse on inheritance: They are partners in the third (An-Nisa: 12), and His saying: Indeed, many partners (Sad: 24). It is also established by the Sunnah, such as the hadith of As-Sa’ib: “The Messenger of Allah (ﷺ) was my partner in the pre-Islamic era,” narrated by Ibn Majah, Abu Dawud, and Al-Hakim, and the hadiths mentioned in this chapter. It is further established by the practice from the time of the Messenger of Allah (ﷺ), his Companions, and the scholars of his nation until our time without objection. Partnership is of two types: partnership of ownership, where multiple people own a specific item, such as through inheritance or purchase, and each is like a stranger regarding the other’s share, so one may not dispose of another’s share; and partnership of contract, whose essence is offer and acceptance. Its condition is that the subject matter must be eligible for agency, so it is invalid for permissible acts like gathering firewood or with conditions that nullify it, such as stipulating a fixed amount of profit for one, as there may be no profit beyond that amount. Its ruling is partnership in profit. It has four forms: mutual partnership, limited partnership, partnership of crafts, and partnership of reputation.Mutual partnership is between equals in capital, actions, and liability, meaning equality in the capital eligible for partnership. There is no issue with additional capital not included in the partnership. It is not permissible between a free person and a slave, a minor and an adult, or a Muslim and a disbeliever. This partnership is permissible according to us by analogy, though in reasoning it is not, which is Ash-Shafi‘i’s view. The basis for analogy is what Ibn Majah narrated from Suhaib, attributed to the Prophet (ﷺ): “Three things bring blessing: sale on credit, mutual partnership, and mixing wheat with barley for the household, not for sale.” Limited partnership is a partnership in all trade or a specific type, not including surety, valid with part of one’s wealth, even if one has more wealth, and with equal or unequal capital, but not necessarily equal profit, contrary to Ash-Shafi‘i, who requires equal profit with equal capital. Partnership of crafts, also called partnership of acceptance, work, or labor, is when two craftsmen, like tailors or a tailor and a dyer, agree to undertake work for a wage shared between them. It is valid even if they stipulate equal work but unequal wages, according to us. Ash-Shafi‘i holds this partnership invalid. The hadith of Abu ‘Ubaidah, mentioned in this chapter, is our evidence for the partnership of labor. Partnership of reputation is when two people without capital partner to buy based on their reputation, sell, pay the seller from the proceeds, and share any surplus. This is permissible according to us, contrary to Ash-Shafi‘i, who deems it invalid. This is derived from Al-Hidayah, Sharh Al-Wiqayah, and Umdat Ar-Ri‘ayah.

And the saying of Allah, the Mighty and Sublime: Indeed, many partners (Sad: 24), and His saying: So send one of you with this silver coin of yours to the city and let him look for the best food and bring you provision from it, and let him be cautious and not make anyone aware of you (Al-Kahf: 19)

2 The statement: “So send one of you”: This indicates that the People of the Cave delegated one of their group to buy food, and Allah recounted this without disapproval, proving that agency is established and legislated. This is noted by the commentators of Al-Hidayah, as stated in Tafsir Al-Ahmadiyya.

وَعَنْ زُهْرَةَ بْنِ مَعْبَدٍ أَنَّهُ كَانَ يَخْرُجُ بِهِ جَدُّهُ عَبْدُ اللَّهِ بْنُ هِشَامٍ إِلَى السُّوقِ فَيَشْتَرِي الطَّعَامَ، فَيَلْقَاهُ ابْنُ عُمَرَ وَابْنُ الزُّبَيْرِ الله فَيَقُولَانِ لَهُ: أَشْرِكْنَا؛ فَإِنَّ النَّبِيَّ ﷺ قَدْ دَعَا لَكَ بِالْبَرَكَةِ فَيُشْرِكُهُمْ۱ فَرُبَّمَا أَصَابَ الرَّاحِلَةَ كَمَا هِيَ فَيَبْعَثُ بِهَا إِلَى الْمَنْزِلِ، وَكَانَ عَبْدُ اللهِ بْنِ هِشَامٍ ذَهَبَتْ بِهِ أُمُّهُ إِلَى النَّبِيِّ ﷺ فَمَسَحَ رَأْسَه وَدَعَا لَهُ بِالْبَرْكَةِ. رَوَاهُ الْبُخَارِيُّ.

English

Zuhrah ibn Ma‘bad narrated that his grandfather, ‘Abdullah ibn Hisham, used to take him to the market to buy food. Ibn ‘Umar and Ibn Az-Zubair (may Allah be pleased with them) would meet him and say: “Include us as partners, for the Prophet (ﷺ) prayed for blessing for you.” So he would include them, and sometimes he would acquire a camel’s load as it was and send it to the household. ‘Abdullah ibn Hisham’s mother had taken him to the Prophet (ﷺ), who stroked his head and prayed for blessing for him. [Narrated by Bukhari]

وَعَنْ أَبِي هُرَيْرَةَ (رضي الله عنه) قَالَ: قَالَتِ الْأَنْصَارُ لِلنَّبِيِّ ﷺ: اقْسِمْ بَيْنَنَا وَبَيْنَ إِخْوَانِنَا النَّخِيلَ، قَالَ: لَا ، فَقَالُوا: تَكْفُوْنَا الْمَثُوْنَةَ وَنُشْرِكْكُمْ فِي الثَّمَرَةِ، قَالُوا: سَمِعْنَا ۱ وَأَطَعْنَا. رَوَاهُ الْبُخَارِيُّ.

English

Abu Hurairah (may Allah be pleased with him) narrated: The Ansar said to the Prophet (ﷺ): “Divide the palm trees between us and our brothers.” He said: “No.” They said: “You handle the labor, and we will share the fruit with you.” They replied: “We hear and obey.” [Narrated by Bukhari]

وَعَنْهُ (رضي الله عنه) رَفَعَهُ قَالَ: «إِنَّ الله عَزَّ وَجَلَّ يَقُوْلُ : أَنَا۱ ثَالِثُ الشَّرِيكَيْنِ مَا لَمْ يَخُنْ أَحَدُهُمَا صَاحِبَهُ، فَإِذَا خَانَهُ خَرَجْتُ مِنْ بَيْنِهِمَا. رَوَاهُ أَبُوْ دَاوُدَ، وَزَادَ رَزِينُ: وَجَاءَ الشَّيْطَانُ.

English

From him, attributed to the Prophet (ﷺ), he said: “Allah, the Mighty and Sublime, says: I am the third of two partners as long as neither betrays the other. If one betrays, I depart from them.” [Narrated by Abu Dawud. Razin added: “And Satan comes.”]

وَعَنْهُ (رضي الله عنه) عَنِ النَّبِيِّ ﷺ قَالَ: «أَدِّ الْأَمَانَةَ إِلَى مَنْ ائْتَمَنَكَ، وَلَا تَخُنْ مَنْ خَانَكَ».۱ رَوَاهُ التَّرْمِذِيُّ وَأَبُوْ دَاوُدَ وَالدَّارِيُّ.

English

From him, the Prophet (ﷺ) said: “Fulfill the trust to those who entrust you, and do not betray those who betray you.” [Narrated by At-Tirmidhi, Abu Dawud, and Ad-Darimi]

1 The statement: “Do not betray those who betray you”: Al-Qadi said: This means do not deal with a betrayer by betraying him or reciprocate his betrayal with betrayal, becoming like him. It does not include taking one’s right from a denier’s wealth, as that is fulfillment, not betrayal’s aggression. This is stated in Al-Marqah. In Al-Kawkab Ad-Durri, it is stated: Its apparent meaning supports those who say one may not take their right from someone who owes it when they have the opportunity. However, deeper analysis confirms the Imam’s view undeniably. The explanation is that if someone takes a hundred from you, taking a hundred back does not wrong them. How could it, when Allah, the Exalted, said: The recompense for an evil is an evil like it (Ash-Shura: 40)? They agreed that calling the recompense an evil is for literary symmetry. Thus, the meaning here is: Do not take more than your right, as that is betrayal. Taking your exact right involves no betrayal. This is supported by the Prophet’s saying to Abu Sufyan’s wife, who complained of her husband’s stinginess: “Take what suffices you and your children reasonably.” The disagreement remains on whether one takes their right from the same type or from another. The Imam said: One may only take from the same type, as taking from another requires assuming a sale, which they have no authority for due to lack of guardianship. His two companions said: They may take from either, as they are equivalent in ruling. Ash-Shafi‘i said: They may take from another type, even real estate. Later jurists of our school favored this view due to the corruption of judges and their taking bribes in rulings.

۱قوله: ولا تخن من خانك قال القاضي: أي لا تعامل الخائن بمعاملت، ولا تقابل خيانته بالخيانة فتكون مثله، ولا يدخل فيه أن يأخذ الرجل مثل حقه من مال الجاحد فإنه استيفاء، وليس بعدوان الخيانة عدوان. كذا في «المرقاة». وقال في الكوكب الدري: ظاهره مفيد لمن قال: لا يأخذ حقه ممن عليه متى ظفر به، لكن النظر الغائر يثبت مذهب الإمام بما لا شبهة فيه، وبيانه أن من أخذ منك مائة، فأنت بأخذ المائة غير جان عليه، كيف وقد قال الله تعالى: وَجَزَوْا سَيِّئَةٍ سَيِّئَةٌ مِثْلُهَا (الشورى: ٤٠ ، وأجمعوا على أن تسمية الجزاء سيئة اعتبارًا للمشاكلة، فكان المراد بقوله هذا: أن لا تأخذ فوق حقك فإنه يكون خائنة، وأما إذا أخذت مثل حقك فهو ليس في شيء من الخيانة، ويؤيدهقوله لامرأة أبي سفيان حين شكت إليه بخل زوجها خذي ما يكفيك وبنيك بالمعروف، بقي الاختلاف في أنه هل يأخذ حقه من عين جنسه أم له أن يأخذ من غيره ؟ قال الإمام: ليس له إلا الأخذ من عين جنس حقه؛ لأن الأخذ من غيره لا يتصور إلا بعد اقتضاء البيع، أي تقدير البيع اقتضاء ، وليس إليه ذلك لعدم ولايته، وقال صاحباه له الأخذ من الثمنين؛ لأنهما في الحكم كواحد، وقال الشافعي: له الأخذ من غير جنسه حتى العقار، واستحسن متأخر و فقهائنا هذه الرواية لفساد القضاة وأخذهم الرشى في الحكم.

وَعَنْ أَبِي عُبَيْدَةَ عَنْ عَبْدِ اللهِ قَالَ: اشْتَرَكْتُ۱ أَنَا وَعَمَّارُ وَسَعْدُ فِيمَا نُصِيبُ يَوْمَ بَدْرٍ، قَالَ: فَجَاءَ سَعْدُ بِأَسِيرَيْنِ وَلَمْ أَجِئْ أَنَا وَعَمَّارُ بِشَيْءٍ. رَوَاهُ أَبُوْ دَاوُدَ وَالنَّسَائِيُّ وَابْنُ مَاجَه، وَهُوَ حُجَّةٌ فِي شِرْكَةِ الْأَبْدَانِ.

English

Abu ‘Ubaidah narrated from ‘Abdullah, who said: “I, ‘Ammar, and Sa‘d partnered in what we would gain on the day of Badr. Sa‘d brought two captives, while ‘Ammar and I brought nothing.” [Narrated by Abu Dawud, An-Nasa’i, and Ibn Majah. It is evidence for partnership of labor]

وَعَنْ صُهَيْبِ (رضي الله عنه) قَالَ: قَالَ رَسُولُ اللهِ ﷺ: ثَلَاثُ فِيهِنَّ الْبَرَكَةُ، الْبَيْعُ إِلَى أَجَلٍ، وَالْمُقَارَضَةُ، وَأَخْلَاطُ الْبُرِّ بِالشَّعِيرِ لِلْبَيْتِ لَا لِلْبَيْعِ». رَوَاهُ ابْنُ مَاجَهِ، وَفِي بَعْضِ نُسَخِهِ: «الْمُفَارَضَةُ بَدْلَ الْمُقَارَضَةُ».

English

Suhaib (may Allah be pleased with him) narrated that the Messenger of Allah (ﷺ) said: “Three things bring blessing: sale on credit, profit-sharing, and mixing wheat with barley for the household, not for sale.” [Narrated by Ibn Majah. In some versions, “mutual partnership” replaces “profit-sharing.”]

وَعَنْ عُرْوَةَ بْنِ أَبِي الْجَعْدِ الْبَارِقِيِّ قَالَ: إِنَّ رَسُوْلَ اللهِ ﷺ أَعْطَاهُ دِينَارًا يَشْتَرِي لَهُ۱ بِهِ شَاةً، فَاشْتَرَى لَهُ بِهِ شَاتَيْنِ، فَبَاعَ إِحْدَاهُمَا بِدِينَارٍ وَجَاءَهُ بِدِينَارٍ وَشَاةٍ، فَدَعَا لَهُ بِالْبَرَكَةِ فِي بَيْعِهِ، فَكَانَ لَوْ اشْتَرَى تُرَابًا لَرَبِحَ فِيهِ. رَوَاهُ الْبُخَارِيُّ.

English

‘Urwah ibn Abi Al-Ja‘d Al-Bariqi narrated: The Messenger of Allah (ﷺ) gave him a dinar to buy a sheep for him. He bought two sheep, sold one for a dinar, and brought him a sheep and a dinar. The Prophet (ﷺ) prayed for blessing in his trade. He was such that if he bought dust, he would profit from it. [Narrated by Bukhari]

1 The statement: “To buy a sheep for him”: Ibn Al-Malik said: This indicates the permissibility of delegating in transactions and all matters allowing representation. If someone sells another’s property without permission, the sale is valid pending the owner’s approval. This is our view. Ash-Shafi‘i said in one opinion: It is not permissible, even if the owner approves afterward. This was discussed in the chapter on prohibited sales. This is stated in Al-Marqah.

وَعَنْ حَكِيمِ بْنِ حِزَامٍ (رضي الله عنه) أَنَّ رَسُوْلَ اللهِ ﷺ بَعَثَ مَعَهُ بِدِينَارٍ لِيَشْتَرِيَ لَهُ بِهِ أُضْحِيَةً، فَاشْتَرَى كَبَشًا بِدِينَارٍ وَبَاعَهُ بِدِيْنَارَيْنِ، فَرَجَعَ فَاشْتَرَى أُضْحِيَةً بِدِينَارٍ فَجَاءَ بِهَا، وَبِالدِّيْنَارِ الَّذِي اسْتَفْضَلَ مِنَ الْأُخْرَى فَتَصَدَّقَ رَسُوْلُ اللَّهِ ﷺ بِالدِّيْنَارِ فَدَعَا لَهُ أَنْ يُبَارَكَ لَهُ فِي تِجَارَتِهِ. رَوَاهُ التَّرْمِذِيُّ وَأَبُو دَاوُدَ.

English

Hakim ibn Hizam (may Allah be pleased with him) narrated that the Messenger of Allah (ﷺ) sent him with a dinar to buy a sacrificial animal. He bought a ram for a dinar, sold it for two dinars, returned, and bought a sacrificial animal for a dinar. He brought it and the extra dinar from the other. The Messenger of Allah (ﷺ) gave the dinar in charity and prayed for blessing in his trade. [Narrated by At-Tirmidhi and Abu Dawud]

وَعَنْ جَابِرٍ (رضي الله عنه) قَالَ: أَرَدْتُ الْخُرُوجَ إِلَى خَيْبَرَ فَأَتَيْتُ رَسُولَ اللهِ ﷺ فَسَلَّمْتُ عَلَيْهِ، وَقُلْتُ لَهُ: إِنِّي أَرَدْتُ الْخُرُوجَ إِلَى خَيْبَرَ، فَقَالَ: «إِذَا أَتَيْتَ وَكِيلِي فَخُذْ مِنْهُ خَمْسَةَ عَشَرَ وَسْقًا، فَإِنْ ابْتَغَى مِنْكَ آيَةً فَضَعْ يَدَكَ عَلَى تَرْقُوَتِهِ». رَوَاهُ أَبُوْ دَاوُدَ.

وَقَوْلِ اللَّهِ عَزَّ وَجَلَّ: وَلَا تَأْكُلُوا۱ أَمْوَالَكُم بَيْنَكُم بِالْبَاطِلِ (البقرة: ۱۸۸) ، وَقَوْلِهِ تَعَالَى: ﴿فَمَنِ۲ اعْتَدَى عَلَيْكُمْ فَاعْتَدُوا عَلَيْهِ بِمِثْلِ مَا اعْتَدَى عَلَيْكُمْ (البقرة: ١٩٤)

English

Jabir (may Allah be pleased with him) narrated: I intended to go to Khaybar, so I came to the Messenger of Allah (ﷺ), greeted him, and said: “I intend to go to Khaybar.” He said: “When you reach my agent, take fifteen wasqs from him. If he seeks a sign from you, place your hand on his collarbone.” [Narrated by Abu Dawud]

Allah Almighty says: Allah, the Exalted, says: “And do not consume one another’s wealth unjustly” (Al-Baqarah: 188).

And He says: “So whoever transgresses against you, transgress against him in the same way that he transgressed against you” (Al-Baqarah: 194).

First: Taking it through transgression, robbery, or usurpation.

Second: Taking it through frivolous means, such as gambling, payment for singers, or the price of wine, musical instruments, or similar.

Third: Taking it through bribery in judgment or false testimony.

Fourth: Betrayal, such as in deposits or trusts. [As stated in Al-Khazin].

1 “And do not consume…”: Consuming wealth unjustly occurs in several ways:

2 “So whoever transgresses…”: This verse obligates returning the usurped item to its place of usurpation, or its equivalent if it is perishable and has a like, or its value on the day of dispute if the like no longer exists. For items without a like, its value on the day of usurpation is due, by consensus. This applies to animals, counted items that differ, and weighed items that are harmed by division, as it is impossible to consider equivalence in both form and meaning. Thus, equivalence in meaning, i.e., value, is required, as it stands in its place and enables acquiring a similar item. Imam Malik said the equivalent in form is guaranteed, citing a narration from Anas: While in Aisha’s room before the hijab was mandated, a bowl of tharid was brought from one of the Prophet’s wives. Aisha struck the bowl, breaking it, and brought a similar bowl. The Prophet (ﷺ) approved of this. Our evidence is the Prophet’s (ﷺ) saying regarding a slave shared by two men, where one frees his share: If the other is wealthy, he guarantees the other’s share; if insolvent, the slave works for the value of the partner’s share. This is explicit in considering value for items without a like. This verse supports us, as it refers to the commonly accepted equivalent. Aisha’s action was out of courtesy and noble character, not obligation, as both bowls belonged to the Prophet (ﷺ). [As stated in Bahr Ar-Ra’iq].

۱ قوله: ولا تأكلوا إلخ : أكل المال بالباطل على وجوه، الأول: أن يأكله بطريق التعدي والنهب والغصب، الثاني: أن يأكله بطريق اللهو كالقمار وأجرة المغني وثمن الخمر والملاهي ونحو ذلك، الثالث: أن يأكله بطريق الرشوة في الحكم وشهادة الزور، الرابع: الخيانة، وذلك في الوديعة والأمانة ونحو ذلك. كذا في «الخازن».

۲ قوله: فمن اعتدى إلخ لهذه الآية يجب رد عينه في مكان غصبه أو مثله إن هلك، وهو مثلي وإن انصرم المثل فقيمته يوم الخصومة، وما لا مثل له فقيمته يوم غصبه، وهذا بالإجماع، وهو المذروح والحيوان والمعدودات المتفاوتة والوزني الذي يضره التبعيض؛ لأنه تعذر اعتبار المثل صورة ومعنى، وهو الكامل فوجب اعتبار المثل معنى، وهو القيمة؛ لأنها تقوم مقامه، ويحصل بها مثله، واسمها ينبئ عنه، وقال الإمام مالك: يضمن مثله صورة لما روي عن أنس له قال : كنت في حجرة عائشة ما قبل أن يضرب الحجاب، فأتي بقصعة من ثريد بعض أزواجه ، فضربت عائشة القصعة بيدها فكسرتها، وجاءت بقصعة مثل تلك القصعة في يدها، فاستحسن رسول الله ﷺ ذلك منها، الحديث. ولنا قوله عليه الصلاة والسلام في عبد بين رجلين يعتق أحدهما نصيبه، فإن كان موسرا ضمن نصيب الآخر، وإن كان معسرا سعى العبد في قيمة نصيب شريكه، وهذا نص صريح في اعتبار القيمة فيما لا مثل له، وهذه الآية شاهدة لنا؛ لأنه هو المثل المتعارف بين الناس وفعل عائشة ما كان على طريق المروءة ومكارم الأخلاق لا على طريق الواجب؛ إذ كانت القصعتان للنبي . كذا في البحر الرائق».
