وَقَوْلِ اللَّهِ عَزَّ وَجَلَّ: يَأَيُّهَا الَّذِينَ ءَامَنُوا إِذَا۱ تَدَايَنتُم بِدَيْنٍ إِلَى أَجَلٍ مُّسَمًّى إِلَخْ(البقرة: ۲۸۲) ، وَقَوْلِهِ: فَرِهَنٌ۲ مَقْبُوضَةٌ (البقرة: ۲۸۳
۱قوله : إذا تداينتم بدين إلخ : وهذه الآية وإن كانت ظاهرة في كل دين سواء كان مبيعًا أو ثمنا، إلا أنه نقل عن ابن عباس الله أن المراد به السلم، وبهذا المعنى قال في الهداية»: السلم عقد مشروع بالكتاب، وهو آية المداينة، فقد قال ابن عباس : أشهد أن الله تعالى أحل السلم المضمون إلى أجل معلوم في كتابه، وأنزل فيها أطول آية في كتابه وتلا قوله تعالى: ﴿يَتَأَيُّهَا الَّذِينَ ءَامَنُوا إِذَا تَدَايَنتُم (البقرة : ۲۸۲ الآية. كذا في التفسيرات الأحمدية».
۲ قوله: فرهان مقبوضة: قال في «العناية»: وأما مشروعية الرهن فبقوله تعالى: ﴿فَرِهَانٌ مَقْبُوضَةٌ﴾ (البقرة: ۲۸۳، وهو جمع رهن كعباد في جمع عبد، وبما روي أنه اشترى من يهودي طعاما ورهنه درعه، وبالإجماع؛ فإن الأمة اجتمعت على جوازه من غير نكير وبالمعقول وهو أنه عقد وثيقة الجانب الاستيفاء، فيعتبر بالوثيقة في طرف الوجوب، وتقريره أن للدين طرفين طرف الوجوب وطرف الاستيفاء؛ لأنه يجب أولا في الذمة، ثم يستوفى المال بعد ذلك، ثم الوثيقة لطرف الوجوب الذي يختص بالذمة، وهو الكفالة جائزة، فكذا الوثيقة التي تختص بالمال، بل بطريق الأولى؛ لأن الاستيفاء هو المقصود والوجوب وسيلة إليه.
And the saying of Allah, the Mighty and Sublime: O you who have believed, when you contract a debt for a specified term (Al-Baqarah: 282), and His saying: Then [let there be] a pledge taken (Al-Baqarah: 283)
1 The statement: “When you contract a debt”: Although this verse appears to apply to all debts, whether for a sold item or its price, it is narrated from Ibn ‘Abbas (may Allah be pleased with him) that it refers to forward sales. In Al-Hidayah, it is stated: Forward sale is a legislated contract based on the Book, which is the verse of indebtedness. Ibn ‘Abbas said: I bear witness that Allah, the Exalted, has permitted forward sales guaranteed for a known term in His Book and revealed the longest verse in His Book regarding it, reciting: O you who have believed, when you contract a debt (Al-Baqarah: 282). This is stated in Tafsir Al-Ahmadiyya.2 The statement: “A pledge taken”: In Al-‘Inayah, it is stated: The legitimacy of pledges is based on Allah’s saying: Then [let there be] a pledge taken (Al-Baqarah: 283). The plural of pledge is like the plural of servant. It is also based on the narration that he bought food from a Jew and pledged his iron armor, on consensus, as the Muslim community agreed on its permissibility without objection, and on reason, as it is a contract securing the side of fulfillment. It is akin to a guarantee on the side of obligation. The explanation is that a debt has two aspects: obligation and fulfillment. It is first obligatory on the person, then the wealth is fulfilled afterward. The guarantee pertains to the obligation tied to the person, which is surety, and it is permissible. Likewise, the guarantee tied to wealth is permissible, even more so, as fulfillment is the goal, and obligation is a means to it.
وَعَنِ ابْنِ عَبَّاسٍ (رضي الله عنهما) قَالَ: قَدِمَ رَسُوْلُ اللهِ ﷺل الْمَدِينَةَ وَهُمْ۱ يُسْلِفُوْنَ فِي الثَّمَارِ السَّنَةَ وَالسَّنَتَيْنِ وَالثَّلَاثَ فَقَالَ: «أَسْلِفُوْا فِي الثَّمَارِ فِي كَيْلٍ مَعْلُومٍ۲ وَوَزْنٍ مَعْلُومٍ إِلَى أَجَلٍ مَعْلُومٍ۳». مُتَّفَقٌ عَلَيْهِ.
Ibn ‘Abbas (may Allah be pleased with him) narrated: When the Messenger of Allah (ﷺ) arrived in Madinah, they were advancing payments for fruits for one, two, or three years. He said: “Advance payments for fruits with a known measure and known weight for a known term.” [Agreed upon]

وَعَنْ أَبِي سَعِيدٍ الْخُدْرِيِّ (رضي الله عنه) قَالَ: قَالَ رَسُولُ اللهِ ﷺ: «مَنْ أَسْلَفَ فِي شَيْءٍ فَلَا يَصْرِفْهُ إِلَى غَيْرِهِ»۱. رَوَاهُ أَبُو دَاوُدَ وَابْنُ مَاجَه.

In Badhl Al-Majhud, Al-Khattabi said: If someone advances a dinar for a qafiz of wheat for a month and the term arrives but wheat is unavailable, Abu Hanifah held that it is not permissible to sell it in exchange for the dinar, but he returns the capital, based on the general and apparent meaning of the narration. 1 The statement: “The measure is the measure of the people of Madinah”: At-Tahawi said in Mushkil Al-Athar: We examined this hadith and found that Makkah had no produce or cultivation at that time, nor before it. Do you not see the saying of Ibrahim (peace be upon him): Our Lord, I have settled some of my descendants in an uncultivated valley (Ibrahim: 37)? It was a trading city where pilgrims brought goods, selling them for the prices of traded goods. Madinah was different, as it was a land of palm trees, and their livelihood came from its fruits. Charities entered it, and the obligatory charity was taken by measure. The Prophet (ﷺ) made all cities follow these two cities. People needed scales for the prices of what they bought and other transactions, for paying zakat, and other purposes, including what they advanced for measured items. The Sunnah prohibited advancing measured items for measured items or weighed items for weighed items but permitted advancing measured items for weighed items and weighed items for measured items. It prohibited selling weighed items for weighed items except in equal amounts and selling measured items for measured items except in equal amounts. The scale was based on what was used in Makkah, and the measure was that of the people of Madinah, unchanged. If people altered it to something contrary, they would return to the knowledge of measured items according to the measure of the people of Madinah and weighed items according to the scale of the people of Makkah at that time. Their rulings do not change or turn to their opposites. From this, Imam Abu Hanifah and his companions took that anything called a sealed measure, qafiz, mukuk, mud, or sa‘ is measured, and the rulings of measured items apply to it in all we described. Anything called a ratl or uqiyyah is weighed. This was narrated from them by Muhammad ibn Al-‘Abbas ibn Ar-Rabi‘ Al-Lu’lu’i from ‘Ali ibn Ma‘bad from Muhammad ibn Al-Hasan from Abu Yusuf from Abu Hanifah, with no disagreement among them reported.

Thus, he may not benefit from the pledged item by use, riding, milk, dwelling, or otherwise, nor sell it to anyone other than the pledgee without his permission. Ibn ‘Abidin said: This contradicts the generally accepted view that it is permissible with permission, unless it is interpreted as a matter of piety, while the accepted view pertains to the ruling. Then I saw in Al-Kawkab Ad-Durri: This applies if the benefit is not stipulated in the pledge, and the custom of the pledgee benefiting is not prevalent, as what is customary is like what is stipulated. It involves two transactions in one, which is prohibited, and every loan yielding a benefit is forbidden.
۱ قوله: عن الشعبي إلخ : فهذا الشعبي يقول هذا، وقد روي عن أبي هريرة الله عن النبي و أنه قال: الظهر يركب بنفقته إذا كان مرهونا، ولبن الدر يشرب بنفقته إذا كان مرهونا، فيجوز عليه أن يكون أبو هريرة الله يحدثه عن النبي بذلك، ثم يقول هو بخلافه ولم يثبت النسخ عنده، فلئن كان ذلك كذلك فلقد صار متهما في رأيه، وإذا كان متهما في رأيه كان متهما في روايته، وإذا ثبتت له العدالة في روايته ثبتت له العدالة في ترك خلافها، وإن وجب سقوط أحد الأمرين وجب سقوط الآخر، والمحتج علينا بحديث أبي هريرة له هذا بقول من روى حديثا عن النبي ﷺ فهو أعلم بتأويله، فكان يجيء على أصله، ويلزمه في قوله أن يقول: لما قال الشعبي ما ذكرنا مما يخالف ما روي عن أبي هريرة له عن النبي ﷺ كان ذلك دليلا على نسخه. قاله في شرح معاني الآثار».
۲ قوله : لا ينتفع من الرهن بشيء: قال إبراهيم النخعي والشافعي وجماعة الظاهرية: إن الراهن يركب المرهون بحق نفقته عليه ويشرب لبنه كذلك، واحتجوا بحديث أبي هريرة الله أن النبي له قال : الظهر يركب بنفقته إذا كان مرهونا، ولبن الدر يشرب بنفقته إذا كان مرهونا، وقال الثوري وأبو حنيفة وأبو يوسف ومحمد ومالك وأحمد في رواية: ليس للراهن ذلك؛ لأنه ينافي حكم الرهن، وهو الحبس الدائم، فلا يملكه، فإذا كان كذلك، فليس له أن ينتفع بالمرهون استخدامًا وركوبًا ولبنا وسكنى وغير ذلك، وليس له أن يبيعه من غير المرتهن بغير إذنه، ولو باعه فوقف على إجازته، فإن أجازه جاز، ويكون الثمن رهنا، سواء شرط المرتهن عند الإجازة أن يكون مرهونا عنده أو لا، وعن أبي يوسف لا يكون رهنا إلا بالشرط، وكذا ليس للمرتهن أن ينتفع بالمرهون حتى لو كان عبدا لا يستخدمه أو دابة لا يركبها أو ثوبا لا يلبسه أو دارًا لا يسكنها أو مصحفاً ليس له أن يقرأ فيه، وليس له أن يبيعه إلا بإذن الراهن، ولذلك قال الشعبي: لا ينتفع من الرهن بشيء، أي لا ينتفع المرتهن وكذا الراهن، أما كون حكم المرتهن ذلك فمذكور في عامة المتون.
وأما كون حكم الراهن ذلك فمأخوذ من المجمع، ونسبه في غاية البيان إلى «الأقطع» حيث قال: قال أصحابنا: لا يجوز للراهن استيفاء منافع الرهن إلا بإذن المرتهن، وكذلك التصرف فيه خلافا للشافعي إلا في وطئ الجارية ولبس الثوب، وقال الطحاوي في الاحتجاج لأصحابنا: أجمع العلماء على أن نفقة الرهن على الراهن لا على المرتهن، وأنه ليس على المرتهن استعمال الرهن، قال: وحديث أبي هريرة الذي احتج به الشافعي ومن معه مجمل فيه، لم يبين فيه الذي يركب ويشرب، فمن أين جاز للمخالف أن يجعله للراهن دون المرتهن، ولا يجوز حمله على أحدهما إلا بدليل، قال: وقد روى هشيم عن زكريا عن الشعبي عن أبي هريرة ذكر أن النبي ﷺ قال: إذا كانت الدابة مرهونة، فعلى المرتهن علفها، ولبن الدر يشرب، وعلى الذي يشرب نفقتها ويركب، فدل هذا الحديث أن المعنى بالركوب وشرب اللبن في الحديث الأول هو المرتهن لا الراهن، فجعل له، وجعلت النفقة بدلا مما يتعوض منه، وكان هذا عندنا - والله أعلم - في وقت ما كان الربا مباحًا، ولم ينه حينئذ عن القرض الذي يجر منفعة، ولا عن أخذ الشيء بشيء، وإن كانا غير متساويين، ثم حرم الربا بعد ذلك، وحرم كل قرض جر منفعة، أخذته من عمدة القاري» و فتح الله المعين. وقال أبو حنيفة: إن منافع المرهون وزوائدها مرهونة، وأما أجرة حفظه وبيته فما كان له دخل في إبقاء المرهون فهو على الراهن، وأما غيره من الذي ليس بدخيل في بقاءه فعلى المرتهن . قاله في «العرف الشذي».
وقال في «الدر المختار»: لا يجوز الانتفاع به مطلقا لا باستخدام ولا سكنى، سواء كان من مرتهن أو راهن، إلا بإذن كل للآخر، وقيل: لا يحل للمرتهن؛ لأنه ربا، وقيل: إن شرطه كان ربا، وإلا لا ، قال ابن عابدين بعد حكاية عن عبد الله بن محمد من كبار علماء سمرقند: إنه لا يحل له الانتفاع وإن أذن له الراهن؛ لأنه أذن في الربا. قال ابن عابدين: هذا مخالف لعامة المعتبرات من أنه يحل بالإذن، إلا أن يحمل على الديانة، وما في المعتبرات على الحكم، انتهى. ثم رأيت في «الكوكب الدري: وهذا إذا لم يكن الانتفاع مشروطًا في الرهن، ولا يكون العرف جاريا بانتفاع المرتهن به؛ فإن المعروف كالمشروط، ويلزم فيه الصفقتان في صفقة، وهو منهي عنه مع أن كل قرض جر نفعًا حرام أيضًا.
وَعَنْ عَطَاءٍ عَنِ النَّبِيَّ ﷺ قَالَ: «الرَّهْنُ۱ بِمَا فِيْهِ». رَوَاهُ أَبُو دَاوُدَ فِي مَرَاسِيْلِهِ. قَالَ ابْنُ القَطَّانِ : مُرْسَلٌ صَحِيحٌ، وَرَوَاهُ الدَّارَقُطْنِيُّ عَنْ أَنَسٍ (رضي الله عنه) مُسْنَدًا.
وَرَوَى أَبُوْ دَاوُدَ فِي مَرَاسِيْلِهِ عَنْ عَطَاءٍ أَنَّ رَجُلًا رَهَنَ فَرَسًا فَنَفَقَ فِي يَدِهِ، فَقَالَ رَسُوْلُ الله ﷺ لِلْمُرْتَهِنِ: ذَهَبَ حَقَّكَ».
‘Ata’ narrated from the Prophet (ﷺ): “The pledge includes what is in it.” [Narrated by Abu Dawud in his Marasil. Ibn Al-Qattan said: It is a sound mursal. Ad-Daraqutni narrated it from Anas (may Allah be pleased with him) as a connected narration]
Abu Dawud narrated in his Marasil from ‘Ata’ that a man pledged a horse, and it died in his possession. The Messenger of Allah (ﷺ) said to the pledgee: “Your right is gone.”

1 The statement: “The pledge includes what is in it”: The “ba” indicates exchange and compensation, as stated in Sa‘di Shalbi’s commentary on Al-‘Inayah. It means the pledge is guaranteed. If the pledgee takes possession and the pledged item perishes in his hand after possession, he guarantees the lesser of the pledge’s value or the debt. This is our view. Ash-Shafi‘i (may Allah have mercy on him) said the pledge is a trust in the pledgee’s hand, and nothing of the debt is waived if it perishes, citing: “The pledge is not withheld from its owner who pledged it; he benefits, and he bears its loss.” This hadith is disconnected, narrated by Ash-Shafi‘i and others as mursal, as the authentic version is from Sa‘id ibn Al-Musayyib’s mursal. Abu Dawud narrated it in his book, and only Ibn Abi Anisa connected it. Malik said: If it perishes due to an apparent cause, it is on the pledger’s guarantee; if due to a hidden cause, it is on the pledgee’s. Our evidence is the narration that a man pledged a horse, and it died, and they disputed before the Prophet (ﷺ), who said: “Your right is gone,” and in another narration: “The pledge includes what is in it,” and the consensus of the Companions that the pledge is guaranteed. This is derived from Al-Hidayah and Al-Marqah. In At-Ta‘liq Al-Mumajjad, regarding “The pledge is not withheld,” the author of An-Nihayah said: This was a saying of the people of ignorance that if the pledger did not repay by the specified time, the pledgee owned it. Islam invalidated this. Ash-Shafi‘i and a group of scholars used this hadith to argue that if the pledge perishes in the pledgee’s hand, the debt is not lost, and the pledger must pay the debt. At-Tahawi narrated in Sharh Ma‘ani Al-Athar that scholars interpreted it differently, citing Mughirah from Ibrahim about a man who gave a pledge for a term and took dirhams, saying: If I bring your right by such time, otherwise the pledge is yours for your right. Tawus, Sa‘id ibn Al-Musayyib, and Malik narrated similarly, indicating that the withholding in the hadith refers to withholding by sale, not loss. Muhammad said in his Muwatta, interpreting “The pledge is not withheld”: A man would pledge to another, saying: If I bring your money by such time, otherwise the pledge is yours for your money. The Messenger of Allah (ﷺ) said: “The pledge is not withheld,” nor is it the pledgee’s for his money. We say the same, as does Abu Hanifah, and Malik ibn Anas interpreted it similarly. In Al-Hidayah, it is stated: The meaning of “The pledge is not withheld” is complete retention by becoming owned, as Al-Karkhi reported from the predecessors. ۱قوله: الرهن بما فيه الباء للمقابلة والمعاوضة. كذا في حاشية سعدي شلبي على العناية»، أي الرهن مضمون يعني إذا قبض المرتهن الرهن دخل في ضمانه، فإذا هلك المرهون في يده بعد قبضه يضمن الأقل من قيمة الرهن ومن الدين، هذا عندنا، وقال الشافعي بالله الرهن كله أمانة في يد المرتهن لا يسقط من الدين شيء لهلاكه لقوله : لا يغلق الرهن من صاحبه الذي رهنه له غنمه وعليه غُرمه هذا حديث منقطع، رواه الشافعي وغيره مرسلًا؛ فإن الصحيح فيه أنه من مراسيل سعيد بن المسيب، وعلى هذا رواه أبو داود في كتابه ولم يوصله غير ابن أبي أنيسة، وقال مالك: إن هلك بأمر ظاهر فهو في ضمان الراهن، وإن هلك بأمر خفي فهو في ضمان المرتهن، ولنا ما روي أن رجلا رهن فرسا فنفق، فاختصما إلى النبي ، فقال: ذهب حقك، وفي رواية: الرهن بما فيه وإجماع الصحابة على أن الرهنمضمون، الهداية» و المرقاة ملتقط منهما.
وقال في «التعليق الممجد»: قوله: «لا يغلق الرهن قال صاحب النهاية»: كان هذا من قول أهل الجاهلية: إن الراهن إذا لم يرد ما عليه في الوقت المعين ملكيه المرتهن، فأبطله الإسلام، واستدل بهذا الحديث الشافعي وجمع من العلماء على أن الرهن إذا هلك في يد المرتهن لا يضيع الدين، بل يجب على الراهن أداء غرمه وهو الدين، ورواه الطحاوي في شرح معاني الآثار» بأنه قال أهل العلم في تأويله غير ما ذكرت، ثم أخرج عن مغيرة عن إبراهيم في رجل دفع إلى أجل رهنا وأخذ منه دراهم، وقال: إن جئتك بحقك إلى كذا وإلا فالرهن لك بحقك.
وأخرج عن طاوس وسعيد بن المسيب ومالك مثل ذلك، فعلم أن الغلق المذكور في الحديث هو الغلق بالبيع لا بالضياع، انتهى. ولذلك قال محمد في موطئه وتفسير قوله: «لا يغلق الرهن أن الرجل كان يرهن الرهن عند الرجل فيقول له: إن جئتك بمالك إلى كذا وكذا وإلا فالرهن لك بمالك. قال رسول الله : لا يغلق الرهن، ولا يكون للمرتهن بماله، وكذلك نقول، وهو قول أبي حنيفة، وكذلك فسره مالك بن أنس، وكذلك قال في الهداية»: والمراد بقوله علية : لا يغلق الرهن على ما قالوا: الاحتباس الكلي بأن يصير مملوكًا له، كذا ذكر الكرخي عن السلف، والكلام في هذه المسألة طويل الذيل، من شاء الاطلاع عليه فليرجع إلى «شرح معاني الآثار».
