1 The statement: “Whoever hoards is a sinner”: There are hadiths in this chapter that support each other. The apparent meaning of the hadiths suggests that hoarding is prohibited, without distinction between human or animal sustenance. In An-Nihayah, regarding “Whoever hoards food”: It means he buys and holds it to reduce supply and raise prices. The hadiths prohibiting hoarding are both general and specific to food. For hadiths of this style, the majority hold that the general is not restricted by the specific, implying the general applies generally and is not limited to sustenance. However, the majority agree that prohibited hoarding pertains to human and animal sustenance. This is summarized from Nail Al-Awtar and Subul As-Salam. For this reason, it is stated in Ad-Durr Al-Mukhtar: Hoarding human sustenance like figs, grapes, or almonds, or animal sustenance like straw, is disliked in a place where it harms people, based on the hadith: “The importer is provided for, and the hoarder is cursed.” If it does not harm, it is not disliked. In Radd Al-Muhtar, it is stated: Restricting it to human sustenance is the view of Abu Hanifah and Muhammad, and the fatwa aligns with it, as stated in Al-Kafi. Abu Yusuf said: Anything that harms the public by being withheld is hoarding. Muhammad said hoarding applies to clothing. Abu Yusuf considered the reality of harm, as it is the basis for the dislike. Abu Hanifah considered customary, recognized harm. This is stated in Al-Hidayah. In Rahmat Al-Ummah, it is stated: Hoarding sustenance is unanimously forbidden, which is buying food during high prices and holding it to increase its price. 2 The statement: “Narrated by Muslim”: Abu Dawud narrated something similar, and Muhammad ibn ‘Amr, the narrator, said: I said to Sa‘id ibn Al-Musayyib: You hoard. Sa‘id said to Muhammad ibn ‘Amr: Ma‘mar, my teacher in this hadith, used to hoard. They both hoarded date pits and leaves. The point is that the general hoarding in the hadith refers to the specific, which is hoarding food. Abu Dawud said: I asked Ahmad: What is hoarding? He said: What people live on, which is food and sustenance. Abu Dawud said: Al-Awza‘i said: The hoarder intercepts the market, intending to buy food and sustenance to withhold it and sell it during high prices. If he imports from another city and withholds it, he is not a hoarder. Al-Khattabi said: The statement “Ma‘mar used to hoard” indicates that the prohibited type is specific, not general. It is not conceivable for Sa‘id ibn Al-Musayyib, given his virtue and knowledge, to narrate a hadith from the Prophet (ﷺ) and openly contradict it, let alone a Companion, who is even less likely to do so. This is stated in Badhl Al-Majhud. In Ad-Durr Al-Mukhtar, it is stated: One is not a hoarder by withholding the yield of his land, without disagreement.
۱ قوله: من احتكر فهو خاطئ وفي الباب أحاديث يشد بعضها بعضا، وظاهر أحاديث الباب أن الاحتكار محرم من غير فرق بين قوت الآدمي والدواب، وفي النهاية على قوله : من احتكر طعاما»: أي اشتراه وحبسه ليقل فيغلو والأحاديث الواردة في منع الاحتكار وردت مطلقة ومقيدة بالطعام، وما كان من الأحاديث على هذا الأسلوب، فإنه عند الجمهور لا يقيد فيه المطلق بالمقيد، وهذا يقتضي أنه يعمل بالمطلق مطلقا، ولا يقيد بالقوتين، لكن الجمهور على أن الاحتكار الممنوع في قوت الناس وقوت البهائم، نيل الأوطار وسبل السلام» مختصرا. ولذلك قال في الدر المختار وكره احتكار قوت البشر كتين وعنب ولوز، والبهائم كتبن وقت في بلد يضر بأهله لحديث: الجالب مرزوق والمحتكر ملعون، فإن لم يضر لم يكره، وقال في رد المحتار: والتقييد بقت البشر قول أبي حنيفة ومحمد، وعليه الفتوى. كذا في «الكافي»، وعن أبي يوسف كل ما أضر بالعامة حبسه فهو احتكار، وعن محمد الاحتكار في الثياب، انتهى. فأبو يوسف اعتبر حقيقة الضرر؛ إذ هو المؤثر في الكراهة، وأبو حنيفة اعتبر الضرر المعهود المتعارف. قاله في «الهداية»، وقال في رحمة الأمة والاحتكار في الأقوات حرام بالاتفاق، وهو أن يبتاع طعاما في الغلاء ويمسكه ليزداد ثمنه.
۲ قوله: رواه مسلم وروى أبو داود نحوه، وقال: قال محمد بن عمرو الراوي: فقلت لسعيد بن المسيب: فإنك تحتكر قال سعيد لمحمد بن عمرو: ومعمر - أي شيخي في هذا الحديث - كان يحتكر وهما كانا يحتكران النوى والخبط، حاصله : أن الحكرة المطلقة في الحديث المراد به الخاص منه، وهو حكرة الطعام، قال أبو داود وسألت أحمد: ما الحكرة؟ قال: ما فيه عيش الناس، وهو الطعام والقوت. قال أبو داود: قال الأوزاعي : المحتكر من يعترض السوق يريد أن يشتري الطعام والقوت منه ليحبسه، ويريد أن يبيعه وقت الغلاء، فأما إذا جلب من بلدة أخرى وحبسه، فليس بمحتكر. قال الخطابي: قوله: «ومعمر كان يحتكر يَدلُّ على أن المحظور منه نوع دون نوع، ولا يجوز على سعيد بـ بن المسيب في فضله وعلمه أن يروي عن النبي ﷺ حديثاً، ثم يخالفه كفاحا، وهو علي الصحابي أقل جوازا وأبعد مكانًا. كذا في بذل المجهود». وقال في الدر المختار ولا يكون محتكرا بحبس غلة أرضه بلا خلاف.
وَعَنْ عُمَرَ (رضي الله عنه)عَنِ النَّبِيِّ ﷺ قَالَ: «الْجَالِبُ مَرْزُوقٌ وَالْمُحْتَكِرُ مَلْعُونَ». رَوَاهُ ابْنُ مَاجَهِ وَالدَّارِمِيُّ.
‘Umar (may Allah be pleased with him) narrated that the Prophet (ﷺ) said: “The importer is provided for, and the hoarder is cursed.” [Narrated by Ibn Majah and Ad-Darimi]
وَعَنْهُ (رضي الله عنه)قَالَ: سَمِعْتُ رَسُوْلَ اللهِ ﷺ يَقُولُ: «مَنْ احْتَكَرَ عَلَى الْمُسْلِمِينَ طَعَامًا ضَرَبَهُ اللهُ بِالْجُذَامِ وَالْإِفْلَاسِ». رَوَاهُ ابْنُ مَاجَه، وَالْبَيْهَقِيُّ فِي شُعَبِ الْإِيْمَانِ»، وَرَزِينُ فِي كِتَابِهِ.
From him, he said: I heard the Messenger of Allah (ﷺ) say: “Whoever hoards food against Muslims, Allah will afflict him with leprosy and bankruptcy.” [Narrated by Ibn Majah, Al-Bayhaqi in Shu‘ab Al-Iman, and Razin in his book]

Mu‘adh (may Allah be pleased with him) narrated: I heard the Messenger of Allah (ﷺ) say: “Wretched is the servant who hoards; if Allah lowers prices, he is saddened, and if Allah raises them, he rejoices.” [Narrated by Al-Bayhaqi in Shu‘ab Al-Iman and Razin in his book]
وَعَنِ ابْنِ عُمَرَ(رضي الله عنهما) قَالَ: قَالَ رَسُولُ اللهِ ﷺ: «مَنْ۱ احْتَكَرَ طَعَامًا أَرْبَعِيْنَ يَوْمًا يُرِيدُ بِهِ الْغَلَاءَ فَقَدْ بَرِئَ مِنَ اللهِ وَبَرِئَ اللَّهُ مِنْهُ. رَوَاهُ رَزِينُ وَأَحْمَدُ فِي مُسْنَدِهِ.
Ibn ‘Umar (may Allah be pleased with him) narrated that the Messenger of Allah (ﷺ) said: “Whoever hoards food for forty days intending high prices has disassociated from Allah, and Allah has disassociated from him.” [Narrated by Razin and Ahmad in his Musnad]

1 The statement: “Whoever hoards food for forty days”: If the period is short, it is not hoarding due to lack of harm. If it is long, it is disliked hoarding due to evident harm. Some said it extends to forty days based on this hadith. Some of our scholars said it is limited to a month and did not consider the hadith’s specification binding, as the reason for prohibiting hoarding is harm, which occurs with a long period, not a short one. Less than a month is short. The degree of sin varies between awaiting scarcity and awaiting high prices. The sin of awaiting scarcity is greater than awaiting high prices. This specification applies to worldly transactions like sale or penalty, not to the sin, which occurs even with a short period. This is derived from Al-Hidayah, Ghayat Al-Bayan, and Radd Al-Muhtar.
۱قوله: من احتكر طعاما أربعين يوما إلخ : ثم المدة إذا قصرت لا يكون احتكارًا لعدم الضرر، وإذا طالت يكون احتكارًا مكروها لتحقق الضرر، ثم قيل : هي ممتدة بأربعين يوما لهذا الحديث، وقال بعض مشايخنا: هي مقدرة بشهر، ولم يجعل التقدير في الحديث لازما؛ لأن المعنى في المنع عن الاحتكار هو الضرر، والضرر يلحق في كثير المدة دون قليلها، وما دون الشهر قليل، ويقع التفاوت في المأثم بين أن يتربص العزة وبين أن يتربص القحط، أراد أن إثم من يتربص القحط أعظم من إثم من يتربص عزة الطعام، وهي الغلاء، ثم هذا التقدير للمعاملة في الدنيا بنحو البيع والتعزير لا للإثم لحصوله وإن قلت المدة، الهداية» و«غاية «البيان» و«رد المحتار» ملتقط منها.
وَعَنْ أَبِي أُمَامَةَ (رضي الله عنه) أَنَّ رَسُولَ اللهِ ﷺ قَالَ: «مَنِ احْتَكَرَ طَعَامًا أَرْبَعِيْنَ يَوْمًا ثُمَّ تَصَدَّقَ بِهِ لَمْ يَكُنْ لَهُ كَفَّارَةٌ. رَوَاهُ رَزِينُ.
Abu Umamah (may Allah be pleased with him) narrated that the Messenger of Allah (ﷺ) said: “Whoever hoards food for forty days and then gives it in charity, it will not be an expiation for him.” [Narrated by Razin]
وَعَنْ أَنَسٍ (رضي الله عنه) قَالَ: غَلَا السِّعْرُ عَلَى عَهْدِ رَسُولِ اللهِ ﷺ فَقَالُوا: يَا رَسُولَ اللَّهِ، سَعِّرْ لَنَا، فَقَالَ: «إِنَّ اللهَ۱ هُوَ الْمُسَعِّرُ الْقَابِضُ الْبَاسِطُ الرَّزَّاقُ، وَإِنِّي لَأَرْجُو أَنْ أَلْقَى رَبِّي وَلَيْسَ أَحَدٌ مِنْكُمْ يَطْلُبُنِي بِمَظْلِمَةٍ فِي دَمٍ وَلَا مَالٍ». رَوَاهُ التَّرْمِذِيُّ وَأَبُو دَاوُدَ وَابْنُ مَاجَه وَالدَّارِمِي.
وَقَوْلِ اللَّهِ عَزَّ وَجَلَّ: ﴿وَإِن كَانَ ذُو عُسْرَةٍ فَنَظِرَةٌ إِلَى مَيْسَرَةٌ (البقرة: ۲۸۰)
Anas (may Allah be pleased with him) narrated: Prices rose during the time of the Messenger of Allah (ﷺ), and they said: “O Messenger of Allah, set prices for us.” He said: “Allah is the One who sets prices, the Restrainer, the Expander, the Provider. I hope to meet my Lord with none of you holding a grievance against me for an injustice in blood or wealth.” [Narrated by At-Tirmidhi, Abu Dawud, Ibn Majah, and Ad-Darimi]
