سید ناعمر بن خطاب رضی اللہ تعالی عنہ سے روایت ہے کہ ایک آدمی جس کا نام عبد اللہ اور لقب حمار تھا نبی اکرم صلی اللہ علیہ وسلم کو پشما کرتے تھے اور نبی اکرم صلی اللہ علیہ وسلم نے ان پر شراب نوش کی (مزہ ملنے کے لئے) کوئی گلوائے تھے۔ پھر ایک دن ان کو لاگیا پھرا پعلیسه نے کوئی گلوائے کا حکم فرمايااور ان کو کوئی گلوائے کے تو قوم میں سے ایک آدمی نے کہا اللہ تو اس پر لعنہ کرانے کو کس قدر زیادہ لایاگیا ترسول اللہ صلی اللہ علیہ وسلم نے فرمايااس پر تم لعنہ مت کرو۔ خدا کی فتنہ میں جانتاہو لکرو اللہاوراس کے رسول سے محبت کرتا ہے۔ (بخاری)

Umar ibn al-Khattab (may Allah be pleased with him) narrated that a man named Abdullah, nicknamed Donkey, used to make the Prophet (ﷺ) laugh. The Prophet (ﷺ) had lashed him for drinking. One day, he was brought, and the Prophet ordered his lashing. A man from the people said: O Allah, curse him, how often he is brought! The Prophet (ﷺ) said: Do not curse him, for by Allah, I know he loves Allah and His Messenger. [Narrated by al-Bukhari.]

In another narration by him: When he left, some people said: May Allah disgrace you. He said: Do not say this, do not aid the devil against him.

اور امام بخاری کی ایک دوسری روایت میں ہے کہ وہ آدمی جب واپس پلا تو قوم میں سے کسی نے کہا اللہ تجہ رسوا کرے تو آپ صلی اللہ علیہ وسلم نے فرمایتم اس طرح مت کرو، اس پرشیطان کی مدومت کرو۔

And in another narration of Imam Bukhari, it is mentioned that when a man returned to his people, someone from his nation said, 'May Allah disgrace you.' So, the Messenger of Allah ﷺ said, 'Do not do this; rather, say, “O Satan, be gone.”'

سید نا ابوہریرہ رضی اللہ تعالی عنہ سے روایت ہے۔ اس کی صاحب نبی کریم صلی اللہ علیہ وسلم کی خدمت میں آنے اور پچار مرتبہ گوائی دے کر ایک خاتون سے فعل حرام کے جینے مرمتہ آپ الان سے مند پچیر لے تو پاچویں مرتبہ آنے تو آپ پعلیسه نے فرمایا کیا تو داخل کیا ہے تو انہول نے کہا بال پھرا پفرما کیا اس قدر رہوا کہ تیرا (عضو) اس کے عضو میں جچپ گیا تو ان نے کہا، بال تو آپ پعلیسه نے فرمایا کیا جسیا کہ سلا تی سرمدانی میں اور سی کنوی میں جچپ جاتی ہے تو انہول نے کہا: بال پھرا آپ صلی اللہ علیہ وسلم نے فرمایا کیا تو زنا کوجانتا ہے تو انہول نے کہا: بال میں اس کے ساتھ وہی فعل کیا ہے جو کوئی آدمی حلال طریقہ پراپنی بیوی کے ساتھ کرتا ہے پس آپ صلی اللہ علیہ وسلم نے فرمايا تو اس بات سے کیا پاچتا ہے تو اس نے کہا میں پاچتا ہو لکر آپ پمجے پاک کریں اس کے بارے میں آپ صلی اللہ علیہ وسلم نے حکم فرمااوراس کو رحم کرویاگیا اللہ کے نبی صلی اللہ علیہ وسلم نے دوآ دمیون کوسنان میں سے ایک اپنے ساتھی سے کہہ ربا تجا اللہ نے اس کے عیب کو چھپا یا تجا لیکن وہ اپنے کو چھوڑا انجیس یہاں تک کہ کے کی طرح رحم کرویا گیا پھرا پعلیسه پچھڑے لیے اور ایک مردار گدے کے پاس سے گزرے جو اپنا پیرا پرا تھا یا ہوا تھا

آپ صلی اللہ علیہ وسلم نے فرمایا فلان اصحاب کہاں جائے تو ان دونوں نے کہا تم جائے رسول اللہ صلی اللہ علیہ وسلم فرمایا تم دونوں اتر و اوراس مردار گردے کو لحاو ان دونوں نے عرض کیا یا بی اللہ صلی اللہ علیہ وسلم اس کو کون کہتا ہے آپ علیہ السلام نے فرمایا تم دونوں نے اپنے بھائی کے بارے میں اچھی جو پچھے کہا وہ اس کو لحا نے زیادہ نہت ہے اس ذات کی قسم جس کے دست قدرت میں میری جان ہے بلا شیراس وقت وہ جنت کی نہرول میں غوط لگار پایہ۔ (ابوداود)

Abu Hurayra (may Allah be pleased with him) said: Al-Aslami came to the Prophet of Allah (ﷺ) and testified against himself four times that he had committed unlawful intercourse with a woman, each time the Prophet turned away from him. On the fifth time, he turned to him and said: Did you have intercourse with her? He said: Yes. He said: Until that part of you was concealed in that part of her? He said: Yes. He said: Like the stick is concealed in the kohl container or the rope in the well? He said: Yes. He said: Do you know what adultery is? He said: Yes, I did with her unlawfully what a man does with his wife lawfully. He said: What do you want with this statement? He said: I want you to purify me. So he ordered him to be stoned. The Prophet of Allah (ﷺ) heard two of his companions, one saying to the other: Look at this one whom Allah concealed, but his soul did not leave him until he was stoned like a dog. He remained silent about them, then traveled for a while until he passed by the carcass of a donkey with its leg raised. He said: Where are so-and-so and so-and-so? They said: We are here, O Messenger of Allah. He said: Get down and eat from this donkey’s carcass. They said: O Prophet of Allah, who would eat this? He said: What you took from your brother’s honor just now is worse than eating it. By the One in Whose hand is my soul, he is now plunging in the rivers of Paradise. [Narrated by Abu Dawud.]

ان میں روایت ہے انہوں نے کہا فرمایا رسول اللہ صلی اللہ علیہ وسلم نے میں نہیں جانتا کہ حدود امل کے لئے کفارہ جین یا نہیں (سنن نہیں، حاکم) اور بزاز نے اپنی سنن میں

قولہ: ما ادری الحدود کفارات لا هلها ام لا (میں نہیں جانتا کہ حدودو، امل حدود کیلے کفارہ جین یا نہیں) حد جاری کرنے کے بعد بخیر توہ بکے گناہول سے پاک ہو جانے کے بارے میں علماء کے میں اختلاف سے بکثرت علماء کا ذہب یہی سے جن میں علماء شافعیہ جیسی اورہمارے اصحاب کا ذہب پیہ کہ حد جاری کرنے کے سبب گناہ سے پاک ہونا حد کے احکام میں سے نہیں ہے حد جاری ہو جانے اور توہ بند کرنے تو اس جرم کا گناہ ساقط نہیں ہوتا اور بخیر توہ بکے وہ اس گناہ سے پاک نہیں ہوگا لیکن ہمارے پاس حد گناہ سے پاک کرنے والی نہیں سے بلکہ توہ بگناہول سے پاک کرنے والی ہے اس پراستدلال نہیں احادیث سے اور ذاکو ل کی سزا سے متعلق آیت پر مل کرنے ہوئے یہ حکم ویاگیا لے کیونکہ اللہ تعالی کا رشاد ذلک لہم خزی فی الدنیا ولہم فی الآخرۃ عذاب عظیم۔ الالذین تابوا۔ (سورۃ المائدہ، آیت نمبر:34/33) عظیم بیان کیلے دنیا میں رسائی ہے اوران کے لئے آخرت میں عذاب یمہے سواے ان لوگوں کے جنہوں نے توہ بکی ہے اس آیت میں اسم اشارہ کا مشار الیہ ان کو لکر نا سولی پر چڑھا یا ان کا زور توڑ ناہے اللہ تبارک و تعالی ان کے لئے دنیا اوآخرت کا عذاب تیار کیاہے اورآخرت کے عذاب کو توہ بکے ذریعہ ساقط فرمایا ہے اور الالذین تابوا سے استثناء بالاتفاق عذاب آخرت سے کیونکہ توہ بکے دنیا میں حد ساقط نہیں ہوتی لیکن وہ حادیث جس کو امام بخاری وغیرہ نے مرفوعاً روایت کیاہے ان میں اصاب من هذه المعاصی شیئا فعو قب فی الدنیا فهو کفارہ لہ الخ جو کو لی ان معاصی میں سے کسی کا رتکاب کرے اوراس کو دنیا میں اس کی سزا اویگی ہوتی وہ اس کے لئے کفارہ ہے اور کو لی ان میں سے کسی کا رتکاب کرے اور اللہ سے چھپا دے پر وہ ظال و تو اللہ کے حوالے لہ آگروہ چاہے تو اس معاف کر دے اور چاہے تو اس کو سزا دے اس حادیث شریف کو توہ بکرنے کی صورت برغمول کرنا ضروری ہے اور یا کو واگ بات ہے کر اس کو مارتے یا سگسار کرنے کے وقت وہ اپنی عمل کے بدع کے سبب کا مزہ چکنے کی وجہ سے توہ ب کرتا ہے اس لئے اس حادیث کو توہ بکے ساتھ مقید کیا جانے کا تاکر تمام دلال میں یقین اورجمع ہو جائے ظنی کا قطعی کے ساتھ تعارض ہوتا اس کو مقید کرنا متعمد بنے برخلاف اس کے علیس کے ناخ القادری میں اس طرح ہے اور امام زیلی نے حد کے غیر مطہر ہونے لیجن حد کو جاری کرنا اس کو گناہ سے پاک نہیں کرتا اس پرامام زیلی نے کا فر پر حد کا نے سے استدلال کیاہے کا فر پر جی حد کا لی جانے ہے لیکن اس پر تمام علماء کا اتفاق ہے کہ وہ اس کو پاک نہیں کرتے کتاب نہبر میں ہماری واجب ویل موجودہ۔ (بحرالاق، عمدۃ الرعاپ، درختار، رواختار، عرف شنزی)

اس کے تمام معنی روایت کی بے حاکم نے کہا بے کہ یہ حدیث شنخین کی شرط کے مطابق نہیں ہے، حافظ

نے کہا بے کراس کی سنقوی بے اور سیدنا ابوہریرہ رضی اللہ تعالیٰ عنہ حضرت عبادہ سے متاخر ہیں اس

لے سیدنا ابوہریرہ رضی اللہ تعالیٰ عنہ کی حدیث کا اعتبار کیا جائے گا۔

Abu Hurayra (may Allah be pleased with him) said: The Messenger of Allah (ﷺ) said: I do not know whether the prescribed punishments are expiations for their people or not. [Narrated by al-Bayhaqi in his Sunan. Abd al-Razzaq, al-Hakim in his Mustadrak, and al-Bazzar in his Musnad narrated the same. Al-Hakim said: It is authentic on the condition of the two Shaykhs, and the chain is strong by the acknowledgment of the Hafiz. Abu Hurayra is later than Ubada, so the consideration is for him.]

Al-Tahawi narrated from Abu Hurayra, who said: A thief was brought to the Prophet (ﷺ), and they said: O Messenger of Allah, this one stole. He said: I do not think he stole. The thief said: Yes, O Messenger of Allah (ﷺ). He said: Take him, cut him, then cauterize him, and bring him back to me. He said: He was taken, cut, cauterized, and brought back. He said: Repent to Allah, the Mighty and Exalted. He said: I have repented to Allah. He said: Allah has accepted your repentance.

In a narration by Abu Dawud, al-Nasa’i, Ibn Majah, and al-Darimi: He was ordered to be cut, and he was brought back. The Messenger of Allah (ﷺ) said to him: Seek Allah’s forgiveness and repent to Him. He said: I seek Allah’s forgiveness and repent to Him. The Messenger of Allah (ﷺ) said: O Allah, accept his repentance, three times. This indicates that the prescribed punishment is not an expiation for sins, and the expiation is repentance.

As for what al-Bukhari and others narrated authentically: If one commits any of these sins and is punished for it in this world, it is an expiation for him. If one commits any of them and Allah conceals it, it is up to Allah; if He wills, He forgives him, and if He wills, He punishes him. This must be understood as applying when he repents during the punishment, as this is apparent, because it is apparent that his beating or stoning is accompanied by his repentance due to experiencing the cause of his action, so it is qualified by this to reconcile the evidence. Qualifying the speculative with the definitive opposing it is necessary, unlike the reverse. [As in Fath al-Qadir.] Al-Zayla’i argued that it is not a purifier from sin because it is enforced on the disbeliever, and there is no purifier for him by consensus. Our clearest evidence is in al-Nahr. [Taken from al-Bahr al-Ra’iq, Foundation of Care, Refutation of the Perplexed, and al-Arf al-Shadhi.]

After the execution of the prescribed punishment (ḥadd), there is a difference among scholars regarding whether one becomes purified from sin. The majority of scholars, including the Shafi'i scholars and our companions, hold that becoming purified from sin due to the execution of the prescribed punishment is not part of the rulings of the ḥadd. The execution of the ḥadd and the payment of blood money do not nullify the sin of the crime, and the person will not be purified from this sin. However, we consider the ḥadd not as a means of purification from sin but rather as a means of purification through blood money. This ruling is not based on isolated traditions but on the verse concerning the punishment for those who cause corruption on earth, which states: 'Indeed, the recompense for those who wage war against Allah and His Messenger and strive to spread corruption on earth is none but that they be killed or crucified or that their hands and feet be cut off from opposite sides, or that they be exiled from the land. That is for them a disgrace in this world, and for them in the Hereafter is a great punishment, except for those who repent before you apprehend them.' (Qur'an, Al-Ma'idah, Verse 33-34) This indicates that there is disgrace in this world and a great punishment in the Hereafter, except for those who repent. In this verse, the pronoun refers to those who have repented, indicating that Allah, the Exalted, has prepared punishment for them in this world and the Hereafter, but the punishment in the Hereafter is nullified by repentance. The exception in 'except for those who repent' is unanimously understood to refer to the punishment in the Hereafter, because the ḥadd in this world is not nullified by repentance. However, the authentic tradition narrated by Imam Bukhari and others states: 'Whoever commits any of these sins and is punished for it in this world, that is expiation for him. And whoever commits any of these sins and conceals it from Allah, then it is up to Allah whether He forgives him or punishes him.' This noble tradition must be considered in the context of repentance, and it is certain that when someone repents, they do so because they have tasted the evil consequences of their actions. Therefore, this tradition is qualified with repentance to ensure consistency and avoid contradiction. Intentional qualification is necessary to resolve any apparent conflict. The inability to qualify it otherwise is evident, and Imam Zayli has argued that the execution of the ḥadd does not purify one from sin, as executing the ḥadd does not cleanse the person of their sin. This is based on the consensus of all scholars that the ḥadd does not cleanse the person. This is clearly stated in our current text. (Bahar al-Aq, Umda al-Raqa, Darakhtar, Rawakhtar, Arf Shanzai) All meanings of the tradition have been narrated without judgment. Hafiz said that this tradition does not meet the conditions of the two shaykhs, and since Sayyiduna Abu Hurairah (RA) is later than Ubada, the tradition of Sayyiduna Abu Hurairah (RA) will be given precedence.

اللہ (میں نے چوری کی سے) توآپعلیہ نے ارشادفرما اس کو لے جا کر باٹھ کاٹ دو اور اس کو داغ

دو چھراس کومیرے پاس لے کرا قو انہول (راوی) نے کہا کہ پس اس کو لے جا کر باٹھ کا طاگیا چھر

دار غویاگیا چھراس کولا یاگیا آپعلیہ نے فرما تو اللہ بزرگ وبرتر کی جناب میں تو پچکر تو اس

نے کہا میں نے اللہ کی جناب میں تو پچکی آپعلیہ نے فرما اللہ نے تیری تو پچقبول کی (طحاوی)

Abu Hurayra (may Allah be pleased with him) narrated: A thief was brought to the Prophet (ﷺ). They said: O Messenger of Allah, he stole. He said: I don’t think he stole. The thief said: Yes, O Messenger of Allah. He said: Take him, cut him, cauterize him, and bring him back. He was taken, cut, cauterized, and returned. He said: Repent to Allah. He said: I repent to Allah. He said: Allah has accepted your repentance. [Narrated by al-Tahawi]

کا طاگیا اور ان کولا یاگیا تو ان سے رسول اللہ صلی اللہعلیہ وسلم نے فرما یا اللہ سے مغفرت طلب کراور

اس کی جناب میں تو پچکر تو انہول نے کہا میں اللہ کی جناب میں استغفار کرتا ہوں اور تو پچکرتا ہوں چھر

رسول اللہ صلی اللہعلیہ وسلم نے (دعا کرتے ہوئے) تین مرتبہ فرما یا اللہ تو ان کی تو پچقبول فرما

(ابوداود، نساوی، ابن ماجہ، دارمی)

اس سے یہ بات معلوم ہوتی سے کہ گناہوں کا کفارہ حدیث سے بلدا س کا کفارہ تو پچ سے

It is narrated from Taghia and his companion that they said,

The Messenger of Allah ﷺ said, 'O Allah, grant forgiveness.' Then he said, 'I seek forgiveness from Allah, and you should weep.' The Messenger of Allah ﷺ, while supplicating, said three times, 'O Allah, grant acceptance to their weeping.' (Abu Dawud, Nasa'i, Ibn Majah, Darimi) This hadith indicates that the expiation for sins is through weeping.
