اور الل بزر برتر كا رشاد والسارق والسارق فاقطعوا ايديهما جزاء بما كسبا نكالا من الل والل عزيز حكيم فمن تاب من بعد ظلمه واصلح فان الل يتوب عليه ان الل غفور رحيم سور المايد ايت نمبر
اور تم چوری کرنے والے مرداور چوری کرنے والی عورت کے ہاتھوں کو کات دو بد لے میں
اس عمل کے جوان دونوں نے کیا ہے اور عبرت ناک مزاہ اللہ تعالی کی طرف سے اور اللہ غالب
ہے حکمت والا ہے۔ پس وہ جو توہب کرے اپنے ظلم کرنے کے بعد 1 اور اصلاح کرے تو بلاشبہ اللہ
تعالی اس کی توہب قبول کرے گا۔ یقینا اللہ تعالی بہت مغفرت کرنے والا اور نہایت رحم کرنے والا ہے۔
And cut off the hands of the male and female thief as a consequence of their actions, as a deterrent from Allah, the Exalted, and Allah is Almighty and Wise. Then, whoever repents after committing injustice and reforms, there is no doubt that Allah, the Exalted, will accept his repentance. Indeed, Allah, the Exalted, is Most Forgiving and Most Merciful.
حضرت عبد اللہ بن مسعود رضی اللہ تعالی عنہ حضرت نبی اکرم صلی اللہ علیہ وسلم سے
روایت کرتے ہیں باٹھ نیس کا طاجا لے گاگردوس درہم میں 2۔
قولہ: فمن تاب۔ کشاف میں ہے توہب کرنے آخرت میں عذاب کا نہونا معلوم ہوتا ہے لیکن حد ساقط
نہیں ہوگی۔ امام اعظم ابوحنیفہ رحمۃ اللہ علیہ اور ان کے اصحاب رحمۃ اللہ کے پاس توہب کی وجہ سے قطع یرساقط نہیں ہوگا۔ اور

تو قطع یرساقط ہوجاتے گا تاکہ پیاس کے اسلام کا سبب بن جائے مسلمان سے قطع یرساقط نہیں ہوگا کیونکہ قطع یہ کے
قانون میں مسلمانوں کے لیے صلاح ہے۔

کہ طور پر لیا جسی چیز چوری کیا جو مال نہیں ہے۔ اگر محفوظ مال ہو جسے اپنے کسی محرم لیجنی قربی رشتہ دار کے گھر سے یاپیوی
کے گھر سے سرال سے اور میزبان کے گھر سے چوری کرے۔ یا جیل کو باہر سے کات کراس میں سے مال لے لیا پیا۔۔۔۔۔

4866/2 – امام ترمذی نے اپنی کتاب جامع میں حضرت عبد اللہ بن مسعود رضی اللہ تعالیٰ علیہ
سے روایت لقل کی ہے انہوں نے کہا باتوں میں کافا جاے کاگر ایک دینار یا دس درہم میں – اور یہ
حدیث مرسل ہے کیونکہ اس کو قاسم بن عبد الرحمن نے حضرت عبد اللہ بن مسعود رضی اللہ تعالیٰ علیہ سے
روایت کیا ہے – اور قاسم بن عبد الرحمن کو حضرت عبد اللہ بن مسعود رضی اللہ تعالیٰ علیہ سے سماع حاصل نہیں ہے –
حضرت ملا علی قاری نے فرمايی بات تجہے لیکن امام حصفیٰ کی جمع کروہ
4867/3 – مسندا امام ابوحذیفر رحمۃ اللہ علیہ میں ہے کہ ابن مقاتل نے حضرت ابوحذیفر ( امام
اعظم ) سے روایت کی ہے اور آپ قاسم بن عبد الرحمن بن عبد اللہ بن مسعود سے اوروہ اپنے والد سے
اور وہ عبد اللہ بن مسعود رضی اللہ تعالیٰ علیہ سے روایت کرتے ہیں کہ انہوں نے فرمایا حضرت رسول اللہ
صلی اللہ علیہ وسلم کے زمانے میں ہاتھوں س درہم میں کافا جا تا تھا –
4868/4 – اور ایک روایت میں ہے کہ یقیناً ہاتھوں کا ناوس درہم میں تھا – پس روايت موصول اور
مرفوع ہے اگر پر روایت موقوف ہوتی ہی وہ مرفو ع کے حکم میں ہے کیونکہ ثبوت کے مقروہ حدود
مال حفوظ جو کسی کی قطعی ملکیت نہیں ہے جسے وقف کا مال یا دس درہم سے کم والا مال چوری کیا ان تمام صورتوں میں
باتوں کا ناواجب نہیں ہے لیکن اگر وہ مال موجودہ تو اس کو واپس کرنا ضروری ہے اور اگر وہ بلاکہ وگیا ہے تو اس کی قیمت
کا ضمان ( ناوان ) دینا واجب ہے –
اس کا حکم باطوں کا تھا ہے اور پیزہ جریعنی بازر کے کے لے ہے اور زہر کی ضرورت ایے مال کے لے ہوتی ہے جو
لوگوں کے پاس ایمیت کا ہے اور ایمیت کا معنوم غیر معروف ہے اور ایمیت کے متعلق سب لوگ عموما برائی میں ہی اس لے
شریعت کی طرف سے اس کی تعریف کی ضرورت لا حق ہوتی – چنانچہ حدیث شریف میں ہے لا يقطع السارق الا في شن
ا مالن چور کا ( باطوں ) کا نا نہیں جا ے کاگر ذہال کی قیمت میں اور ذہال کی قیمت کے تقیین میں اختلاف ہے ہمارے
( خفیہ ) کے پاس دس درہم میں اور حضرت امام شافعی رحمۃ اللہ کے پاس ربع (1/4) ویں اربے اور امام ما لک رحمۃ اللہ
علیہ کے پاس تین درہم میں – علماء کرام ذہال کی قیمت میں اختلاف کرنے کے باوجود سب اس امر پر مشفق ہیں کر قطع
ید کانصاب شریعت کی طرف سے مقرر ہے – اور تم اس کی زیادہ جو قیمت ہے زیادہ جو قیمت کے اس کو اختیار کے ہیں کیونکہ وہ قطعی
ہے – اور دس درہم میں باطوں کے نہ کا لے جانے کی بات کسی نے کچھ نہیں کی ہے – البتہ دس درہم سے کم میں قطع کے
بارے میں اختلاف ہے اور شک و شہر کی بناء پر قطع یہ نہیں ہوگا – بلکہ شہادات کی وجہ سے عدود کو دفع کر دیا جاتا ہے – نیز دس
درہم کی روایت فقیر راوی کی ہے – ......

Al-Tirmidhi narrated in Jami‘ from Ibn Mas‘ud: No amputation except for a dinar or ten dirhams, but it is mursal, narrated by al-Qasim ibn Abd al-Rahman from Ibn Mas‘ud, and al-Qasim did not hear from Ibn Mas‘ud. Ali al-Qari said: It is authentic, but in Abu Hanifa’s Musnad, compiled by al-Hasfaki, from Ibn Muqatil, from Abu Hanifa, from al-Qasim ibn Abd al-Rahman ibn Abdullah ibn Mas‘ud, from his father, from Abdullah ibn Mas‘ud: Hands were amputated in the Prophet’s (ﷺ) time for ten dirhams. Another narration: Amputation was only for ten dirhams. This is connected and raised. Even if stopped, it has the ruling of a raised hadith, as legal quantifications are not subject to reason, so a stopped narration is treated as raised. Muhammad narrated in Kitab al-Athar from Abu Hanifa, from al-Qasim, from his father, from Ibn Mas‘ud: A thief’s hand is not amputated for less than ten dirhams. (2) The statement: No amputation except for ten dirhams: Theft linguistically is taking another’s property secretly, regardless of what it is. Legally, conditions were added: the thief must be sane, as Allah called amputation a deterrent, a punishment requiring a crime, which needs sanity and puberty. Due to disagreement on the shield’s value but consensus on its specification, we take the highest to be certain, as no one denies amputation for ten dirhams, while lesser amounts are disputed, so amputation is not required due to doubt, to avert punishment. The ten-dirham narration is from a jurist. In sum: Consensus holds amputation for ten dirhams; below that, scholars differ due to varying hadiths, creating uncertainty, so it is not required, as punishments are averted by doubts and require certainty. Ibn al-Humam said: Some, like Hasan al-Basri, Dawud, the Khawarij, and Ibn Bint al-Shafi‘i, said amputation applies to any amount, per the verse’s generality and the Prophet’s (ﷺ) saying: Cursed is the thief who steals an egg and his hand is cut, or a rope and his hand is cut. Most jurists of the regions hold it requires a specific amount. Our school and some Tabi‘in say ten dirhams; al-Shafi‘i, a quarter dinar; Malik and Ahmad, a quarter dinar or three dirhams. Companion consensus is cited, restricting the verse. Reason: Trivial items lack desire, like a wheat grain, included in the verse’s generality, and cannot be taken secretly, failing theft’s condition of secrecy. ابن الی شیہ نے قاسم سے روایت کی سے کہ حضرت عمر رضی اللہ تعالیٰ عنہ کے پاس ایک آدمی لا یاگیا جو چوری کیا تھا تو آپ نے حضرت عثمان رضی اللہ تعالیٰ عنہ نے فرما اس کی قیمت کا اندازہ کرو ا نہول نے اس کی قیمت کا اندازہ آ کھود رہم بتایا تو آپ نے اس کا باٹھ نہیں کا ظا۔
a man who had committed theft was brought to Umar (RA). He then said to Uthman (RA), 'Estimate the value of what he stole.' Uthman (RA) estimated it to be less than a quarter of a dinar. Umar (RA) did not have his hand cut off.
حضرت عبد اللہ بن عباس رضی اللہ تعالیٰ عنہما سے روایت کے آپ نے فرما کر کہ پراکی آدمی کا باٹھ کا ظا (ابوداود) حضرت رسول اللہ صلی اللہ علیہ وسلم نے ایک ذو حال جس کی قیمت ایک دینار یا دس ورتم کی چوری
A non-Arab man's bath soap was stolen, and it was worth one dinar or ten dirhams. The Messenger of Allah ﷺ said about it:
امام نسائی، امام ترمذی اور امام طحاوی نے ان (حضرت ابن عباس رضی اللہ تعالیٰ
خلاصہ کلام یہ ہے کہ دس ورتم میں قطع یرواجب ہو نے پراماع ہے اور دس ورتم سے کم میں احادیث ثریفہ علی صحابہ والہ الصلاۃ والسلام میں اختلاف کی وجہ سے علماء کا اختلاف ہوا اوراس میں اختلاف پیدا ہوگیا اور اختلاف کی وجہ سے قطع یرواجب نہیں ہوتا۔ جب احادیث ثریفہ اور صحابہ کے آثار میں اختلاف ہوا اوراس میں مقدم ومؤخر کونسا قول ہے معلوم نہیں جس سے ناسخ و منسوخ کا پیہاچل سے تو تم قابل اعتبار اختیاط کا پیلو جس میں کوئی شک نہ واختیار کے میں اور دس ورتم میں کیونکہ شبهات سے حدود رفت ہوجاتے میں اورصرف اس وقت جاری کے جاتے میں۔ جب کر اس میں کوئی شبهہ ہے۔ اور ثانیہ میں ہم نے فرما یہ کہ قطع یروے متعلق مستد میں اختلاف سے کر کیا مالی کو کوئی مقدار ہوا س میں قطع یہ ہوگا یا اس کے لئے کوئی ایسی مقدار مقرر ہے کر اس سے کم میں باٹھ نہیں کا ظا جائے گا۔ پہلا قول حضرت حسن بصری، امام راود خوارج اور امام شافعی کے نواسہ میں۔ کیونکہ آیت قرآنی مطلق ہے اور حدیث ثریفہ میں لعن اللہ السارق الخ اللہ تعالیٰ لعنہ کرے سارق پرکہ وہ اثر چوری کرتا ہے۔ باٹھ کا ظا جاتا ہے ری چوری کرتا ہے باٹھ کا ظا جاتا ہے اور حضرات کے علاوہ دیگر علماء کرام کے پاس قطع یرو کے لئے مقررہ مقدار دس ورتم متعین ہے۔ اور امام شافعی رحمۃ اللہ علیہ کے پاس رنج وینار ہے اور امام ما کے۔

امام حاکم نے مستدرک میں ابن اسحاق سے روایت کی ہے اور فرماپے حدیث
امام مسلم کی شرط کے مطابق تھے مگران دونوں نے اس کی تخریج نہیں کی ہے۔
نسائی کی روايت عن عمر بن شعیب عن ابن ابیہ عن جدہ میں سے انہول نے کہا کہ

حضرت رافع بن خدر رضی اللہ تعالیٰ عنہ نے حضرت نبی اکرم صلی اللہ علیہ وسلم
سے روایت کی ہے آپ نے ارشاد فرمایا پحل میں اور کثر (کچور کا گاجھا اور رودی چیز) میں باٹھ کا تا
نہیں جاتے گا۔ (امام ماک، ترمذی، ابوداود، نسائی، دارمی، ابن ماجہ)
اور امام احمد رحمہ اللہ کے پاس رلع ویاریا تین درہم ہیں۔ اور اس پر (لیکن تعین مقدار پر) صحابہ رحمہم الرضوان کا
جماع منقول ہے۔ اس سے ظاہر ہے کہ آئت مطلق نہیں بلکہ مقید ہے۔ اور عقلی طور پر اگر دیکھا جائے تو حقیقت چیز میں
رغبت کم ہوتی ہے۔ اور اس کو منع کیا جاتا جیسے گیہون کا اندہ ہے حالاکہ یہ آئت کے اطلاق میں شامل ہے۔ اور اس
(حقیر چیز) کالینا پوشیدہ جس نہیں رہتا اس لے اس کو لینے سے چوری کار کن (پوشیدہ طور پر لینا) پیہان پایا نہیں جاتا۔
پس یہ خصوص عقلی ہے جب کہ پہلے سے اس آئت میں بال غیر محفوظ کی بالاجماع خصوصیت ہوچکی ہے۔ اس لے اس حدیث
میں جس میں ری اور پیڑ کی چوری کا ذکر ہے اس میں تاویل کرنا ضروری ہوا کر ری سے مراد وہ ری ہے جو دس درہم کی
قیمت کی ہو۔ بیشتر مراد لوہ کا خورد (لوہ کی ٹوپی (بلمت)) ہے۔ یا ہوسکتا ہے کہ آپ فرماتے ہوں
جب پرآئت نازل ہوتی تھی جو معلم ہے انہی اس کا بیان نہیں آیا تھا۔ اس کے بعد اس کا نصاب بیان کرویا گیا یا کے
منسوخ ہوگیا۔ ہوئی ابتدا اسلام میں قطع یدا کوئی نصاب نہیں تھا پھر یہ منسوخ ہوگیا۔

قولہ: لا قطع فی ثمر ولا کثر ثرح السنة میں ہے کہ حضرت امام اعظم ابوحنیفہ رحمۃ اللہ علیہ کے پاس ظاہر
حدیث کے مطابق تازہ میوں میں خواہ وہ محفوظ ہوں یا غیر محفوظ قطع نہیں ہے۔ گوشت، دودھ اور شربت وغیرہ کو اس پر
قیاس کیا ہے۔ اور دومروں نے ایسی تمام چیزوں میں بشطر کیوہ محفوظ ہوں قطع یدا حکم دیا ہے۔ حضرت امام ماک اور
حضرت امام شافعی رحمہ اللہ نے جس ایس کو اختیار کیا ہے۔ (مراقب)
ہر ایسی میں ہے کہ ایسی چیزیں جو جلد خراب ہوجاتی ہیں ان میں قطع نہیں ہے۔ جیسے دودوہ گوشت نہ میوں
و غیرہ۔ کیونکہ حضرت نبی اکرم صلی اللہ علیہ وسلم کا ارشاد ہے لا قطع فی ثمر ولا کثر۔ اور کثر جمار (کچور کا گاجہ) اور
ری چیز کو جی کر کہا گیا ہے۔ اور نبی کریم صلی اللہ علیہ وسلم کا ارشاد لا قطع فی الطعام سے مراد ایسی چیزیں ہیں۔
Rafi‘ ibn Khadij (may Allah be pleased with him) narrated: The Prophet (ﷺ) said: No amputation for fruit or palm pith. [Narrated by Malik, al-Tirmidhi, Abu Dawud, al-Nasa’i, al-Dari, and Ibn Majah]
Abu Dawud narrated in Marasil from Hasan al-Basri: The Messenger of Allah (ﷺ) said: I do not amputate for food. Abd al-Haqq mentioned it without faulting it beyond being mursal, which, as you know, is not a flaw in our view, so it must be acted upon.
(1) The statement: No amputation for fruit or palm pith: In Sharh al-Sunna, Abu Hanifa followed this hadith’s apparent meaning, not requiring amputation for stealing fresh fruits, whether secured or not, and analogized to meat, milk, and drinks. Others required amputation if secured, per Malik and al-Shafi‘i. In Al-Hidaya: No amputation for perishable items like milk, meat, or fresh fruits, per: No amputation for fruit or palm pith. Palm pith is the palm’s core or sap. The Prophet (ﷺ) said: No amputation for food, meaning perishables prepared for eating, like meat or fruit, as amputation applies to wheat and sugar by consensus. Al-Shafi‘i said: Amputation applies, per: No amputation for fruit or palm pith, but if stored in a granary, amputation applies. We say: He followed custom, where granary-stored fruit is dry, subject to amputation. In Al-Mirqat: They conflict on secured fresh fruit; in punishments, the view preventing punishment prevails to avert it. In Al-Lam‘at: No amputation for fruit on trees or unharvested crops due to lack of security. For harvested, secured fruit, al-Shafi‘i requires amputation; Ahmad, in one narration, if from a guarded orchard or tree in a secured house with a nisab stolen. In our view, no amputation for perishables like milk, meat, or fresh fruits, per: No amputation for fruit or palm pith, meaning perishables prepared for eating.
امام ابوداؤد نے مراسیل میں حضرت حسن بصری رضی اللہ تعالیٰ عنہ سے روایت کی
ہے کہ حضرت رسول اللہ صلی اللہ علیہ وسلم نے فرمایا میں (پکے ہوئے) کھانے میں باقی نہیں کاٹا۔
اور حضرت عبد الحق (محدث دہلوی) نے اس حدیث کا ذکر کرتے ہوئے بیان کیا ہے کہ اس
میں ارسال کے سوا اور کوئی علم نہیں ہے اور تم کو بیبات معلوم ہے کہ ارسال کی تمام پاس علی
نہیں ہے۔ پس اس کے مطابق عمل کرنا ہمارے پاس واجب ہے۔
the Messenger of Allah ﷺ said: 'I do not cut off what remains of cooked food.' And Imam Abd al-Haq (the Muhaddith of Delhi) mentioned this hadith, stating that there is no knowledge in it except through transmission, and you know for certain that all transmission is not with Ali. Therefore, acting according to this is obligatory for us.
حضرت جابر رضی اللہ تعالیٰ عنہ حضرت بی کریم صلی اللہ علیہ وسلم سے روایت
کرتے ہیں کہ آپ صلی اللہ علیہ وسلم نے فرمایا خیانت کرنے والے، لوٹنے والے اور چھین لینے
والے کا باقی نہیں کاٹا جائے گا۔ (ترمذی، نسائی، ابن ماجہ، دارمی)
Jabir (may Allah be pleased with him) narrated: The Prophet (ﷺ) said: No amputation for a betrayer, plunderer, or snatcher. [Narrated by al-Tirmidhi, al-Nasa’i, Ibn Majah, and al-Darimi]
(1) The statement: No amputation for a betrayer, plunderer, or snatcher: In Al-Hidaya: No amputation for a betrayer, male or female, due to insufficient security, nor for a plunderer or snatcher, as they act openly. The Prophet (ﷺ) said: No amputation for a snatcher, plunderer, or betrayer.
جوگلد خراب ہوجائی ہیں۔ (واللہ اعلم) جیسے پکا ہوا کھانا اور اسی مفہوم کی دوسری چیزیں جیسے گوشت اور چھل وغیرہ ہیں۔
اس لئے کہ بالاتفاق گیہون اور شکر میں باقی کاٹا جاتا ہے۔ اور امام شافعی رحمۃ اللہ علیہ کے پاس ان تمام میں باقی کاٹا جاتے گا۔ کیونکہ رسول اللہ صلی اللہ علیہ وسلم کا ارشاد ہے ثمریں اور جمار میں قطع نہیں البتہ اگر وہ کھلیان میں آ جائیں
لیتن وہ خشک ہو جائیں تو قطع یہہ تم احتیاط ہی کہہ ہیں اور عام طور پر جرین (کھلیان) خشک ہوئے پرآ جاتا ہے اور
اس وقت اس میں قطع یہ وگا۔ جو کھلیان میں رکے ہوئے تازہ چھل اور اس جیسی چیزوں کے متعلق حدود کی بات احادیث
متعارض ہیں ایسی صورت میں حدود کو فخر نے کا حکم مقدم ہوگا۔ اور لمعات میں ہے اس بات کو جان کر چھل جب تک
درخت پر ہیں اور کھیت انجی کا لے نہیں گے۔ جیسا س میں چونکہ وہ انجی محفوظ نہیں ہیں۔ اس لے ہے اس میں قطع نہیں ہیں۔
چھل جب وہ درخت سے اتار لیے گئے ہیں اور محفوظ کر لیے گئے ہوئے تو اس میں امام شافعی رحمۃ اللہ علیہ کے پاس قطع یہ
ہے اور حضرت امام احمد بن حنبل رحمۃ اللہ علیہ کے پاس ان کی ایک روایت میں ہے کہ چھل کسی ایسے باغ میں جو محفوظ ہے
یا وہ درخت کسی محفوظ گھر میں ہے اور نصاب کے مطابق چوری ہو جائے تو اس میں قطع یہہ لیکن تم احتیاط کے پاس
اگر چیزوں میں جلد فساد اور خرابی آئی ہے جیسے دودھ گوشت، تازہ میوے وغیرہ اس میں قطع نہیں ہے۔ کیونکہ حضور علیہ
والصلاة والسلام کا ارشاد ہے لا قطع فی ثمر ولا کثر اور حضور علیہ والصلاة والسلام نے ارشاد فرما یا لا قطع فی طعام کہانے
میں قطع نہیں ہے۔ اس سے مراد تیار کھانا جیسے میں جلدی خرابی آجائے ہے اور وہ سب چیزیں جیسے جو اسی مفہوم میں ہیں
جیسے گوشت اور چھل۔
قولہ: لیس علی خائن و لا منتهب و لا مختلس قطع۔ بدایی میں ہے خاص اور خاص کا اتحاد اس لے
نہیں کاٹا جائے گا کہ وہ مال محفوظ نہیں ہے اور منتهب اور مختلس لیجن لوٹنے اورا چک لینے والے کا باقی نہیں کاٹا جائے گا۔
اس لے کہ وہ علا نہیں یہ کرتے کر رہے۔ اور بی کریم علیہ الصلاۃ والسلام ارشاد فرما یے لا قطع فی مختلس و لا
منتهب و لا خائن۔
اور انہیں سے روایت بہ کر رسول اللہ صلی اللہ علیہ وسلم نے فرمایا لو طے والے
کا اپاتھو کا نہیں سے اور جو شخص کہ بندرول ذاکر ظا لے وہ تم میں سے نہیں - (ابوداود )
شخ ابن همام نے فرمایا صفوان کی حدیث میں اضطراب بہ اور اضطراب حدیث کے ضعیف
ہونے کا باعث ہوتا ہے 5
قولة : فی حديث صفوان اضطراب الخ اس بات کوجانو ! جس آدمی کا مال چوری ہوا بہ اگر سارق کوہ
مال ہبہ کردے یاس کواس کے باٹہ چڑا لے جب کر عمل قضاء تقاضی سے پہلے ہوا بہ تو اس کا اپاتھو کا نہیں جا بے کا
کیونکہ اس کا جعل زا ختم ہوگیا بہ اور اس میں کسی کا اختلاف نہیں سے اور اگر قضاء تقاضی کے بعد اس کو نافذ کرنے سے
پہلے ہوا بہ تو حضرت امام اعظم ابوحنیفر رحمۃ اللہ علیہ اور حضرت امام محمد رحمۃ اللہ علیہ کے پاس قطع یہ ساقط ہو جائے گا اور امام
ابویوسف اور امام شافعی رحمۃ اللہ علیہما کے پاس قطع یہ ساقط نہیں ہوگا اور ان دونوں حضرات کی دلیل حضرت صفوان رضی اللہ
تعالی عنہ کی حدیث سے کہو ایک مرتبہ حضرت رسول اللہ صلی اللہ علیہ وسلم کی مسجد میں اپنی چادر کو تکمی بنا کرسور بہ تک کروئی
ان کی چادر چوری کر لیا تو انشول نے اس کا پچھا کر کے کپڑا لیا اور اس کو حضرت رسول اللہ صلی اللہ علیہ وسلم کی خدمت میں
حاضر کیا تو حضور علیه والصلاة والسلام نے قطع یدا حکم فرمایا تو حضرت صفوان عرض کہ یارسول اللہ صلی اللہ علیہ وسلم میری
چادر کی وجہ سے آپ نے اس کے باٹہ کا تن کا حکم فرمایا تو میں اپنی چادر اس کو بہہ کر دیتا ہوں تو آپ علیہ صلاۃ اللہ نے فرمایا تم
میرے پاس آئے تو پہلے کیون ہمیشہ کروئے اس سے معلوم ہوتا بہ کر قضاء تقاضی کے بعد قطع یہ ساقط نہیں ہوتا
ہماری دلیل پیہ کر حدود کے باب میں بالفعل حد کجاری کرنے کا حکم تقاضی کے قول فصل کا تمہیں بہ حد جاری
کرنے کے حکم سے پہلے کی صورت حال فیصلہ پہلے کی صورت حال کی طرح بہ اور اگر قبل القضاء اس کو ما کہ بنادیا تو
اس کا اپاتھو کا نہیں جا بے کا ( مخصوص از مبسوط، بدل امجہو و، فتح القدیر، عناوی )
اور جومز یہ تفصیل چاہتا سے نذکورہ کتاب کی طرف مراجعت کر لے اور فتح القدیر میں سے کہ صفوان رضی اللہ تعالی
عنہ کی نذکورہ حدیث مشکوک کی روایت کے مطالب سے اور مستدرک للحاکم کی روایت میں انا ابيعہ و انسئہ ثمنہ
وسکت علیہ سے ( میں اس کوفر وخت کر دیتا ہوں اور اس کی قیمت اوہار کرتا ہوں ) آپ اس پر سکوت اختیار کے اور
کسی ایک روايات میں اس کا ذکر نہیں سے بلکہ ما کنت ارید هذا ( میں نہیں چاہتا تھا ) اور ایقاطع رجل من العرب
فی ثلاثین درهما ( کیا عرب کے کسی آدمی کا باٹہ تمیں درتم میں کاظا جا بے کا ) سے
واقعا ایک، یہ اور اس میں جوزیادہ سے اس میں اضطراب سے اور حدیث اضطراب کی وجہ سے ضعیف قرار
پائی سے اور ہو صدقہ علیہ ( وہ اس پر صدقہ سے ) کے قول میں احتمال سے کہ اس کو واپس کر دینے کے بعد قبض کیا
ہو اور قبض سے قبل ملک ثابت نہیں ہوتا
کتاب مبسوط میں سے صفوان رضی اللہ تعالیٰ عنہ کی جو حدیث سے بعض روايات میں عفوتو عنہ، ( میں ان کو معاف کر
دیا ) آیہ اور حدیث شریف میں دکايت حال سے اس میں عموم نہیں ہوتا سے حضور صلی اللہ علیہ وسلم کا ارشاد بیکام میں .......
سَّمع الْاَمام سرخسي نے فرمایا کہ کسی حدیث مشہور میں بیروی نہیں کر صفوائے، اپنا مال سارق کو
جبہ کرنے کے بعد نہ آکر مصلی اللہ علیہ وسلم نے سارق کا اٹھ کا طنز کا حکم فرمایا۔
علیہ وسلم نے فرمایا تم اللہ تعالیٰ راہ میں لوگوں سے قریب ہو یادور، جہاں کرو اور اللہ تعالیٰ کے معاملے میں کسی
ملامت کرنے والے کی پرواہ مت کرواور حضر وسفر میں اللہ تعالیٰ کے حدود کو قائم کرو -6(مسنداحمد)
…… پاس لا نے سے پہلے کیون نہیں کرتا کس کی پردہ دری نہ ہوتی” کیا تم نہیں دیکھتا کہ مریجوروايت آئی ہے کرسول اللہ صلی
اللہ علیہ وسلم کا چہرا متغیر ہوگیا تو حضرت صفوان رضی اللہ تعالیٰ عنہ نے کہا یا رسول اللہ (عَلَیْہِ السَّلام ) گویا کہی بات آپ پرشاق
گزری فرمایا مجھے پر کیون شائق نہیں گزرے گی تم لوگ اپنے عمل سے اپنے مسلمان بجاٹی کے خلاف شیطان کے مدگار بن گے
جو اس سے معلوم ہوا کہ حضور علیہ والصلاة والسلام کو ان کے عیب کی پردہ دری ناپسند ہوتی، کسی مشہور روایت میں اس جہہ کے
بعد ان کا ابتدا طماروی نہیں سے اور کی اور روایت میں باہر کا نہ کاز کرہے تو اس میں اختمال سے کے سارق اس جہہ کو قبل نہ کیا ہو
اور جب اس کی پردہ دری ہوچکی تو حضرت رسول اللہ صلی اللہ علیہ وسلم نے ان کو پاک کرنے کی غرض سے حد جاری کرنے کو مناسب
مجما س لے اس کے پہلوقبل نہیں فرمایا اور ہمارے پاس مسلم پیہ کے سارق پہلوقبل ذکر لے تو باہر کا افسا قط نہیں ہوگا
بزل انجحو د میں سے حضرت صفوان رضی اللہ تعالیٰ عنہ کی روایت میں اس پر کوئی دلیل نہیں ہے کیوں کہ ان کی
روایت میں ہو علیہ صدقہ کے الفاظ میں لیکن وہ ان پر صدقہ سے اس میں اختمالات میں ہوسکتا ہے مال مسروقہ
جبہ کرو یا ہو یا اس کی مراد قید کو پہڑ کرنا (معاف کرنا) ہو قطع ید کو پہڑ کرنا (معاف کرنا) سے حد ساقط نہیں ہوتی ہے
اس لے کچھ کے بعض روايات میں وهبة القطع سے اور اس با ت کا کچھ اختمال سے کے مال مسروق کو صدقہ لیکن پہڑ کر دیا ہو
لیکن وہ اس پر قید نہ کیا ہو اور قطع ید کے ساقط ہو نے کے لے پہہ قصد کے ساتھ پہو نا چاہے -
۔ قول: واقیمو ا حدوداللہ فی الحضر والسفر اس با ت کو جاناواس حدیث ثریف میں سفر عام سے-
کیونکہ مسا فر کچھ غازی ہوتا ہے اور کچھ غازی نہیں ہوتا ہے اس حدیث ثریف سے یہ با ت ثابت ہوتی ہے کہ حالت
جنگ میں کچھ حدود جاری کے جاسکتے ہیں اس لے کہہمارے فقہاء کرام نے فقيهي چھاو نی میں کچھ حد جاری کرنے کو جائز
قرار دیاہے اب رباربن ارطاۃ رضی اللہ تعالیٰ عنہ کی روایت کے لا تقاطع الايدى فی الغزو-
جنگ میں باہر کا طنمیں جا میں گے اس کے بارے میں بعض نے کہاہے کہ پروايت ضعیف سے اور اس کو امام
اوزا ئی اختیار کے میں ہمارے فقہاء کرام نے اس کو اختیار نہیں کیاہے اور دیگر بہت سے فقيها نے کچھ اس کو اختیار نہیں کیا-
کیونکہ ان حضرات نے جنگ کی زمین اور غیر جنگ کی زمین میں کوئی فرق نہیں کیاہے ان کی پرادے کے جنگ کی زمین
میں جس طرح فرا ض وعبادات ان پروا جب ہیں اس طرح حدود کچھ وہال جاری کے جاسکتے ہیں اس حدیث ثریف کے
بارے میں بعض نے پیکہاہے کہ حدیث میں لفظ "غزو" سے مراد مال غنیمت ہے مال غنیمت کے تقسیم سے پہلے کوئی چوری کیا تو
باہر کا نہیں جا سکا کیونکہ اس میں اس کا کچھ حق ہے ( ماخوذ از حاشیہ کرب الدین، نبل الاوطار، سننی، مرقات)
Take [the path] of the one who is firm, not of the one who is weak. And whoever among you mentions the tyrant, he is not of you.
Ibn Humam said that the confusion in Safwan's hadith and the weakness of the hadith are due to the variations. It is known that if a person's property is stolen and the thief returns the property or compensates for it before the legal judgment is sought, then there is no punishment for the thief because the crime has been resolved, and there is no dispute about this. However, if the compensation is made after the legal judgment is sought but before it is enforced, then according to Imam Abu Hanifa (RA) and Imam Muhammad (RA), the punishment will be waived, while according to Imam Abu Yusuf (RA) and Imam Shafi (RA), the punishment will not be waived. Both these scholars base their views on the hadith of Safwan (RA), who once spread his cloak in the Prophet's (SAW) mosque and it was stolen. When the thief was caught, he brought the cloak to the Prophet (SAW), who ordered the amputation of the thief's hand. Safwan (RA) then said, 'O Messenger of Allah (SAW), I will give my cloak to him,' to which the Prophet (SAW) replied, 'If you had come to me before, you could have done so.' This indicates that after the legal judgment is sought, the punishment is not waived. In our view, the command to enforce the punishment is based on the actual demand for the punishment, and the situation before the demand is like the situation after the demand. If the compensation is made before the demand, there is no punishment. (From Mabsut, Badal Amjadi, Fath al-Qadir, Enaoui)
And whoever wants more details should refer to the aforementioned books, especially Fath al-Qadir, where it is mentioned that the hadith of Safwan (RA) is considered weak due to the variations in its transmission. In some narrations, it is reported that Safwan (RA) said, 'I will give it to him and take its price,' and the Prophet (SAW) remained silent. In another narration, it is said, 'I did not intend this,' and in yet another, 'Is the hand of an Arab man cut off for thirty dirhams?' These variations and the confusion in the hadith make it weak. According to one view, the compensation is returned, and ownership is not established until after the seizure.
In the Mabsut, it is mentioned that in some narrations of Safwan's (RA) hadith, it is said, 'I forgave them,' and in the noble hadith, the general rule does not apply when the theft occurs during a raid. Imam Sarakhsi said that in a well-known hadith, there is no contradiction with the practice of giving the stolen property to the thief after it has been taken, as the Prophet (SAW) ordered the amputation of the thief's hand. The Prophet (SAW) said, 'Be close to people on the path of Allah, and do not care about those who criticize in matters of Allah, and establish the limits of Allah in both presence and absence.'
Before the matter was brought to him, why did he not do it? Do you not see that the face of the Messenger of Allah (SAW) changed when he saw the thief? Safwan (RA) said, 'O Messenger of Allah (SAW), it seems something unpleasant has happened to you.' The Prophet (SAW) replied, 'It will not happen to me, but you people have become Satan's helpers against your Muslim brothers through your actions.' This shows that the Prophet (SAW) disliked exposing faults. In some narrations, it is said that he did not initially forgive, and in others, if the fault was not exposed, the punishment would not have been enforced. When the fault was exposed, the Prophet (SAW) deemed it appropriate to enforce the punishment to cleanse them, and he did not order it before that. If we mention a thief to Muslims, the punishment is not necessarily enforced without exposing the fault.
In some narrations of Safwan (RA), there is no evidence for this, as the words 'I will give it as charity' are mentioned, but this can be interpreted in different ways. Whether the stolen property is returned or the intention is to imprison, the amputation of the hand is not waived. In some narrations, it is said that the amputation is waived, but this is based on some possibilities, such as the stolen property being given as charity, but not imprisoned, and the amputation is not waived unless there is an intention.
The statement: 'Establish the limits of Allah in both presence and absence' is understood from the weak hadith, as some travelers are warriors and some are not. This weak hadith proves that some punishments can be enforced during war. Therefore, our noble scholars have allowed the enforcement of some punishments in legal contexts. Regarding the hadith of Rabi'ah (RA) about not cutting hands during war, some say it is weak, and our noble scholars have not adopted it, nor have many other scholars, as they do not differentiate between war and non-war zones. Just as obligations and worship are performed in war zones, some punishments can also be enforced. Some have said that the word 'ghazw' in the hadith refers to spoils of war, and if theft occurs before the distribution of spoils, the hand is not cut off because the thief has some right to it (taken from Hashiya Karb al-Din, Nabil al-Awatar, Sunni, Mirqat).
سیر نا علی رضی اللہ تعالیٰ عنہ سے روایت ہے کہ آپ نے فرمایا جب چوڑ چوری کر لے تو اس کا سید حا بات کا ثنا جائے گا۔ پھر دوبارہ کر لے تو اس کا باپ ل پاؤل کا ثنا جائے گا پھراس کے بعد کر لے تو اس کو قید کیا جائے گا پھال تک کر اچھی صورت رونما ہو مجھے اللہ تعالیٰ سے حیاء آئی ہے کر اس کو اس طرح کردول کر اس کا کونی باٹھنے ہوجس سے وہ لحا سک اور استجاء کر سکے اوراس کا کونی پاؤل نہ ہوجس سے وہ چل سکے۔ (کتاب الآثار امام محمد، مصنف عبد الرزاق، مصنف ابن ابی شیبہ، بہقی، دار قطنی)
Ali ibn Abi Talib (may Allah be pleased with him) narrated: If a thief steals, his right hand is cut. If he repeats, his left foot is cut. If he repeats, he is imprisoned until he does good. I am ashamed before Allah to leave him without a hand to eat or clean with, or a leg to walk on. [Narrated by Muhammad ibn al-Hasan in Kitab al-Athar]
Abd al-Razzaq, Ibn Abi Shayba, al-Bayhaqi, and al-Daraqutni narrated similarly. Ibn Abi Shayba narrated: Najda wrote to Ibn Abbas about a thief, and he replied with Ali’s view. Sa‘id ibn Mansur narrated from Sa‘id ibn Abi Sa‘id al-Qaburi, from his father: I was with Ali ibn Abi Talib when a man, whose hand and foot were cut, was brought for stealing. Ali asked his companions: What do you think? They said: Cut, O Commander of the Faithful. He said: That would kill him, and he does not deserve death. How would he eat, perform ablution, clean, or stand for his needs? He sent him to prison for days, then consulted again. They repeated their view, and he repeated his, flogged him severely, and released him. Ibn al-Humam said: Narrations of cutting a third or fourth time, if authentic, are understood as policy or abrogated.
(1) The statement: If a thief steals, his right hand is cut, etc.: Scholars agree that for the first theft, the right hand is cut; for the second, the left foot. For a third theft after losing hand and foot, al-Shafi‘i and followers say the left hand is cut, then the right foot for a fourth, then discipline and imprisonment, per Abu Salama and Jabir’s hadith. Abu Hanifa and his companions say: For a third theft, he is imprisoned until he repents, not cut, but disciplined with beating and imprisonment, as amputation no longer applies, leaving deterrence. Our evidence: Companion consensus, as Ali argued: I am ashamed before Allah to leave him without a hand to act or a leg to walk, and none cited a raised hadith, indicating its absence. Al-Tahawi said: We traced these narrations and found no basis. No killing for a fifth theft. If al-Shafi‘i’s narration of killing is authentic, it is policy or abrogated, as the Prophet’s (ﷺ) saying for a fifth theft: If he repeats, kill him, is policy by consensus. In Fath al-Qadir and Al-Mabsut: The hadith is not authentic, or if accepted, abrogated, as early Islam had severe punishments, like the Urayna tribe’s hands, feet, and eyes. In Fath al-Qadir, citing Ali, Ibn Abbas, and Umar’s view: This is firmly established. It is unlikely the Prophet (ﷺ) cut four limbs then killed, unknown to Ali, Ibn Abbas, and Umar, close Companions who would know by custom. Ali’s refusal suggests the narration’s weakness or that it was not a fixed punishment but the Imam’s discretion, seeing corruption or incorrigibility, allowing killing as policy, meaning figurative killing. This aligns with killing as policy for the third theft. (As in Radd al-Muhtar)
مصنف ابن ابی شیبہ کی روایت میں ہے کہ جب حضرت عبد اللہ بن عباس رضی اللہ تعالیٰ عنہما کے پاس چور کے بارے میں کلام کر مسئلہ دریافت کیا تھا تو آپ نے حضرت علی رضی اللہ
قوله: اذا سرق السارق قطعت يده اليمنى الخ (جب چور چوری کر لے تو اس کا سید حا بات کا ثنا جائے گا) سب کا اس امر پر اتفاق ہے کہ اگر چور پہلا مرتبہ چوری کیا تو اس کا سید حا بات کا ثنا جائے گا اور دوسرا مرتبہ چوری کر لے تو باپ ل پیر کا ثنا جائے گا اور باٹھ پاؤل کا لے جانے کے بعد تیسری مرتبہ چوری کر لے تو اس میں علماء کا اختلاف ہے حضرت امام شافعی اور ان کے اصحاب رحمہم اللہ کے پاس اس کا باپ ل باٹھ کا ثنا جائے گا پھر چوتھی مرتبہ چوری کر لے تو سید حا پاؤل کا ثنا جائے گا چور چوری کر لے تو تعزیری سزا دی جائے گی اور حضرت ابوبسلہ اور حضرت جابر رضی اللہ تعالیٰ عنہما کی روایت کے مطابق اس کو قید کیا جائے گا حضرت امام اعظم ابوحنیفہ رحمہ اللہ علیہ اورآپ کے اصحاب کے پاس تیسری مرتبہ چوری کر لے تو قید کیا جائے گا یہاں تک کہوہتاہب ہوجائے تیسری مرتبہ چوری کرنے کی صورت میں باٹھ نیں کا ثنا جائے گا لیکن تعزیری سزا کے طور پراس کو قید کرنے کے ساتھ مار جی سکتے ہیں کیونکہ (تیسری مرتبہ میں) باٹھ کا نامیہ سے تو اب صرف ضرب و جس کے ذریعہ اس کو زجر و تادیب کی جائے گی۔ اور ہماری دلیل اجماع صحابہ رحمہم الرضوان ہے جب کہ سید نا علی رضی اللہ تعالیٰ عند نے صحابہ کے ساتھ پیچت پیش کی کہ مجھے اللہ تعالیٰ سے حیاء آئی ہے کہ میں اس چور کا کونی باٹھ پاؤل نہ چھوڑوں جس سے وہ نکل سکتا ہواور نہ چل سکتا ہو۔ اوراس مسئلہ میں کسی نے کچھ مرفوع حدیث سے استدلال نہیں کیا ہے۔ اس سے یقین ہے کہ اس باب میں کوئی مرفوع حدیث نہیں ہے۔ امام طحاوی رحمہ اللہ فرما تے ہیں کہ اس مسئلہ میں تمام آثار تلاش کے گئے اس میں اس کے لے کوئی دلیل نہیں ملی۔ اس لے کہ پا چویں مرتبہ چوری کر لے تو قتل نہیں کیا جائے گا۔ اور حضرت امام شافعی رحمہ اللہ علیہ سے پا چویں مرتبہ قتل کے جانے کی روایت اگرچہ ہے تو سیاسی سزا پر محمل کی جائے گی۔ یا وہ منسوخ ہے۔ سیاسی سزا پر محمل کرنے کی دلیل یہ ہے کہ حضور علی والہ الصلاۃ والسلام نے پا چویں مرتبہ میں فرمایا اگر وہ چوری کا پہر اعادہ کر لے تو تم اس کو قتل کردو۔ اس کو بالا تقاق سیاسی سزا پر محمل کیا گیا ہے۔ (ماخوذ از مرقات، مشروح کنز، بدایی، عنایت)

سعود بن منصور، سعید بن البوسیعی مقبری سے روایت کرتے ہیں وہ اپنے والد سے روایت کرتے ہیں کہ میں حضرت علی رضی اللہ تعالیٰ عنہ کے پاس حاضر ہوا آپ کے پاس ایک بات کو پیر کرنا ہوا آدمی لا یاگیا جو پھر چوری کیا تھا تو آپ نے اپنے اصحاب سے فرما یا سبارے میں تمہاری کیا رائے ہے تو انہول نے کہا امیر المومنین آپ اس کا پھر باٹھ کاہ وتبہ تو آپ نے فرما یا بات تو ایسی ہے کہ میں اس کو گویا قتل کر دیا حالا کر اس پر ل نہیں ہے وہ کس چیز کے کہنا کہا گا کس چیز کے نماز کے لئے وضو کرنے گا کس چیز کے جنازت کا غسل کرنے گا کس چیز سے وہ اپنی ضرورت پوری کرنے گا آپ نے اس کو چند دنوں کے لئے قید خانے میں دیا پھر آپ اس کو باہر لانے اور اس کے اصحاب سے اس بارے میں مشورہ فرما یا تو انہول نے پہلے کی طرح مشورہ دیا تو آپ نے ان کو پھر مرتبہ جو فرما یا تھا وہ فرما یا اور اس کو سخت کوڑے لگا پھر پھوڑ دیا۔ اور شخ ابن حام نے فرما یا تیری یا چوہی مرتبہ قطع کی روایت اگر درجہ صحیح میں ہے تو اس
قولہ: ان صح حمل على السياسة اونسخ - اگر پروايت درجہ صحیح میں ہے تو اس کو سیاسی سزا پہچول کیا جاتے گا وہ منسوخ ہے اس میں امام طحاوی رحمۃ اللہ علیہ کے قول کی طرف اشارہ ہے کہ تم نے آثار کو تلاش کیا لیکن ان میں سے کسی کے لئے کوئی اصل تم کو میل نہیں، صاحب فتح القدیر نے کہا میں سوط میں سے کرپی حدیث درجہ صحیح میں نہیں ہے اور اگراس کی صحیح کو شلیم نہیں کر لیا جانے تو یحدیث منسوخ ہے کیونکہ ابتدا میں حدود میں نہیں جسیا کے عربیین کے ہاتھوں پیر کا لئے گئے اوران کے آنکھوں پر گرم سلائی پھیری گئی پھر فتح القدیر میں اس کو قل کرنے کے بعد کہتا ہیں کہ ہمارے اس نہیں ب کے مطابق سید نا علی اور سید نا ابن عباس اور سید نا عمر رضی اللہ تعالیٰ عنہم سے روایت منتقل ہے اور امر اسیا ثابت شدہ سے کہ اس کے خلاف کی کوئی نہیں کش نہیں اور بات بھی از فهم ہے کہ حضرت رسول اللہ صلی اللہ علیہ و آلہ وسلم نے سارق کے قطع کا حکم فرما گے ہول پھراس کو قل بھی کرو گے ہول اور سید نا علی اور سید نا عباس اور سید نا عمر رضی اللہ عنہم جیسے حضور علیہ الصلاۃ والسلام کی خدمت اقدس میں بیشتر بنے والے صحابہ کواس بات کا علم نہ ہو اور اگر پی حضرات غیر موجود ہی رہ ہول تو بھر حال بی بات ان کے علم میں ضرور آئی تھی سید نا علی رضی اللہ عنہ کا عمل سے رکنا یا تو اس امر زشت کے ضعیف ہو نے کی بناء پر یا س کے وا قفیت کی بناء پر ہے کہ یحد داگی نہیں ہے بلکہ امام کی سیاسی رائے کی بناء پر ہے اگر امام د کیو رپابہ کروہ زمین میں فساو پچھیلا نے کے لئے کوشش ہے اور اس کی طبیعت بازآئے نے سے بعید سے تو ای وقت امام کے لئے سیاسی مصلحت کی بناء پراس کو قل کر دینے کا اختیار ہے تو وہ معنوی قتل بھی کر سکتا ہے معنوی قتل سے مراد اس کے چاروں اعضاء کو کٹ دیناہے سیاسی مصلحت کی بناء پراس کو قل کر ناجبا س کے لئے درست ہے تو معنوی قتل بھی اس کے لئے درست ہے اور اس میں اشارہ ہے اس بات کی طرف جو تہم بیان کے یہ کے تیری مرتبہ سیاسی مصلحت سے قتل کرنے کا اس کو اختیار حاصل ہے (رد اختر)
کو سیاسی سزا پر حمول کیا جائے گا یا وہ مفسوخ ہے۔
He says: If the private degree is in the correct state, then will he be subjected to political punishment? This has been abrogated. This alludes to the opinion of Imam Tahaawi (RA) that you have searched for traditions but none of them are satisfactory. The author of Fath al-Qadeer said: 'This tradition is not in the correct state, and if its correctness is not established, then this tradition is abrogated because initially, there were no prescribed punishments, as seen in the case of the Arabs where their hands and feet were cut off and hot iron was placed over their eyes. After mentioning this in Fath al-Qadeer, it is stated that according to our understanding, the reports from Sayyidna Ali, Sayyidna Ibn Abbas, and Sayyidna Umar (RA) are transmitted, and the matter is established without any contradiction. It is also clear that the Messenger of Allah (ﷺ) ordered the hand of a thief to be cut off, and if he were to be reduced in status, it would still apply. How can it be that Sayyidna Ali, Sayyidna Abbas, and Sayyidna Umar (RA), who spent most of their time in the sacred service of the Prophet (ﷺ), did not know about this matter, and even if they were absent, it would certainly have come to their knowledge. The stance of Sayyidna Ali (RA) or his abstention is either due to the severity of the matter being weak or due to its non-existence, meaning it is not a theft but rather a political decision by the Imam. If the Imam's effort is to prevent disorder in the land and this is far from his nature, then at such a time, the Imam has the authority to reduce his status for political benefit, and he can even resort to symbolic execution. Symbolic execution means cutting off his limbs. If reducing his status for political benefit is correct, then symbolic execution is also correct for him, and this alludes to the fact that the Imam has the authority to execute someone for political benefit (Radd al-Akhtaar). Will he be subjected to political punishment or is it abrogated?
سیدنا ابو ہریرہ رضی اللہ تعالیٰ علیہ روایت ہے کر رسول اکرم صلی اللہ علیہ وسلم
کے پاس ایک چور لا یا گیا جو چادر چوری کیا تھا۔ تو نہیں اکرم صلی اللہ علیہ وسلم نے ارشاد فرمایا۔ میں نہیں
سمجھتا کہ وہ چوری کیا ہے۔ چور نے کہا کیون کہ میں یا رسول اللہ علیہ وسلم (یعنی میں چوری کیا ہوں) آپ
نے فرمایا سکو لے جا واور باٹھ کا ت دو9 داغ دواور پھراس کومبرے پاس لا او۔
اور پھراس کومبرے پاس لا او۔ چناچرا س کا بات کا نا گیا اور داغ پھرا پ کی خدمت میں لا یا
گیا۔ تو آپ نے فرمایا اللہ تعالیٰ کی جنا ب میں تو ب کر: تو اس نے کہا میں نے اللہ تعالیٰ کی جنا ب میں
تو ب کی۔ آپ علیہ وسلم نے ارشاد فرمایا اللہ تعالیٰ نے تیری تو ب قبول کی۔ (مستدرک، علی ثرط مسلم)
Abu Hurayra (may Allah be pleased with him) narrated: A thief who stole a cloak was brought to the Prophet (ﷺ). He said: I don’t think he stole. The thief said: Yes, O Messenger of Allah. He said: Take him, cut him, cauterize him, and bring him back. He was cut, cauterized, and returned. He said: Repent to Allah. He said: I repent to Allah. He said: Allah has accepted your repentance. [Narrated by al-Hakim in Al-Mustadrak, who said: Authentic per Muslim’s conditions]
Al-Baghawi narrated in Sharh al-Sunna on thief amputation from the Prophet (ﷺ): Cut him, then cauterize him. Al-Daraqutni, Abu Dawud in Marasil, Abd al-Razzaq, and others narrated similarly.
(2) The statement: Cut him, then cauterize him, etc.: Cauterization is recommended per al-Shafi‘i, obligatory per us, as the hadith’s apparent command implies obligation, with no diversion from its literal meaning, especially since neglecting it risks death, and punishment deters, not destroys, making it obligatory otherwise. The linguistic scholar did not narrate from the Prophet ﷺ regarding the punishment for theft, but rather paraphrased it. (Al-Darqutni, Abd al-Razzaq, and others have narrated this with similar meaning.)
حضرت فضالہ بن عبید رضی اللہ تعالیٰ علیہ روایت ہے کر رسول اللہ صلی اللہ
علیہ وسلم کے پاس ایک چور لا گیا تو اس کا بات کا نا گیا پھرا پ علیہ وسلم نے اس کے بارے میں حکم فرمایا تو

اور امام نسا ئی نے کہا کر اس کی سنہ میں راوی جب ان ارطاہ ضعیف ہیں۔ ان کی حدیث میں
استدلال نہیں کیا جاسکتا۔ اور شخص ابن همام نے کہا ہے کر ہمارے پاس پیغم امام کے لے مطلق ہے
اگر وہ مصلحت بحقہ بھی تو کر سکتا ہے۔ اور حضور علیہ الصلاۃ والسلام سے اس شخص کے لئے جس کا اپنے کا طاقات اس طرح کا عمل ثابت نہیں ہے کروہ سنہ ہو جائے۔
Fudala ibn Ubayd (may Allah be pleased with him) narrated: A thief was brought to the Messenger of Allah (ﷺ), his hand was cut, and he ordered it hung around his neck. [Narrated by al-Tirmidhi, Abu Dawud, al-Nasa’i, and Ibn Majah]
Al-Nasa’i said: It includes al-Hajjaj ibn Arta’a, who is weak, and his hadith is not used as evidence. Ibn al-Humam said: In our view, this is at the Imam’s discretion if he sees fit, and it is not established that the Prophet (ﷺ) did this for every amputee to make it a Sunna. Abu Dawud, al-Nasa’i, and Ibn Majah narrated from Abu Hurayra (may Allah be pleased with him): The Messenger of Allah (ﷺ) said: If a slave steals, sell him, even for a pittance.
(1) The statement: Hung around his neck: Ibn al-Humam said: Al-Shafi‘i and Ahmad hold it is recommended to hang the hand around the neck, as the Prophet (ﷺ) ordered it. In our view, it is at the Imam’s discretion if he sees fit, and it is not established for every amputee to be a Sunna.
(2) The statement: If a slave steals, sell him, even for a pittance: In Badhl al-Majhud: Mawlana Muhammad Yahya noted: This is mentioned to indicate the Imam may add what he deems appropriate beyond the punishment, as a form of discipline. Selling for a pittance or less than his value is a humiliation, like hanging the hand around the neck.
قو لہ: فاقطعوہ ثم احسموہ الخ (باتھ کا ت دواور داغ دو) واغ دینا امام شافعی رحمۃ اللہ کے پاس مستحب
ہے اور ہمارے پاس واجب ہے۔ کیونکہ حدیث میں صیغہ امر ہو نے کی بناء پراس امر کا واجب ہونا ظاہر ہے۔ جب کہ
حقیقی معنی کے لے کوئی مانع نہیں ہے، خصوصاً ایسی صورت میں جب کہ باٹھ کا ت دینے کے بعد ویسے چھوڑ دیا جائے
تو بی تلف ہوجائے کا موجب بن گا۔ حدود باز رکھنے کے لے ہوتے ہیں تلف کرنے کے لے نہیں ہوتے۔ اور اس
دوسری جہت سے بھی یواجبن قرار پاتا ہے۔
قو لہ: فعلقت فی عنقه۔ شخص ابن همام نے فرمایا کر امام شافعی اور امام احمد رحمہ اللہ سے منقول ہے کر چور
کے باٹھ کو اس کی گردان میں لکنا مستون ہے کیونکہ رسول اللہ صلی اللہ علیہ وآلم وسلم نے اس کا حکم فرمایا ہے اور ہمارے
پاس یہ حکم امام کے لے اگر اس کی راے ہوتے مطلق ہے کیونکہ ہر باٹھ کا ت کے وقت اس طرح کامل حضور علیہ الصلاۃ
والسلام سے ثابت نہیں ہے کر وہ سنہ ہوجائے۔ (درختار، نبل الاوطار، بداری)
سیرنا ابو ہریرہ رضی اللہ تعالیٰ عنہ نے روایت ہے جب غلام چوری کر لے 11 تو تم اس کو اگر چیز آدی قیمت میں ہو فروخت کردو۔ (ابوداود نسائی، ابن ماجہ)
When a slave steals, you should sell him if the stolen item is worth its price.
حضرت نافع نے روایت ہے کہ عبد اللہ بن عمر رضی اللہ تعالیٰ عنہ کا غلام جہاگ گیا اور اس حالات میں چوری کیا۔ اس کو عبد اللہ بن عمر رضی اللہ تعالیٰ عنہ کے پاس لا یاگیا عبد اللہ بن عمر رضی اللہ تعالیٰ عنہ نے اس سے کہا کہ تیرا جہاگنا ہر کوٹہ کو اللہ تعالیٰ کی کسی حد سے نہیں پچا لے گا۔ راوی نے کہا کہ آپ نے اس کا اٹھ کاٹ دیا۔ (سنن نسائی) اور اس معنی میں امام مالک نے روایت ہے۔
Nafi‘ narrated: A slave of Ibn Umar fled and stole during his flight. He was brought to Ibn Umar, who said: Your flight will not save you from Allah’s limits. He cut him. [Narrated by al-Bayhaqi in his Sunan]
Malik narrated similarly.
(3) The statement: He cut him: In Al-Bahr al-Raiq, Al-Mirqat, and Al-Hidaya: If a slave steals from someone other than his master or his master’s wife, he is cut, whether fugitive or not, per this report and the verse: “As for the thief, male or female, cut off their hands” [Al-Ma’ida: 38], which does not distinguish between free and slave. Halving the punishment between free and slave is infeasible, so it is fulfilled to protect people’s property. This is the view of Abu Hanifa, Malik, and al-Shafi‘i (may Allah have mercy on them).
سیرنا ابن عمر رضی اللہ تعالیٰ عنہما نے روایت ہے کہ ایک آدمی حضرت عمر کے پاس اپنے غلام کولایا اور کہا اس کا اٹھ کاٹ دیے کیونکہ اس نے میری پیوی کا آئینہ چرا یا تو حضرت عمر نے فرمایا اس پر قطع کی سزا نہیں ہے۔ 13 کیونکہ یہ تہمارا خادم ہے اور تہمارا مال لیا ہے۔ امام
ما کے نے اس کی روایت کی بے اور امام محمد نے اپنی روایت میں پر اضافہ کیا ہے کہ میری پیوی کا آئینہ جس کی قیمت سات ہزارہم بے اس نے چوری کیا ہے۔
Ibn Umar (may Allah be pleased with them) narrated: A man brought his slave to Umar, saying: Cut his hand; he stole my wife’s mirror. Umar said: No amputation; he is your servant, part of your possessions. [Narrated by Malik]
Muhammad’s narration adds: He stole my wife’s mirror worth sixty dirhams.
(4) The statement: No amputation, etc.: Ibn al-Humam said: If one spouse steals from the other, or a slave from his master or master’s wife, there is no amputation, as customary permission to enter disrupts security. (As in Al-Mirqat)
11قولہ: اذا سرق المملوک فبعه ولو بنش (جب غلام چوری کرے تو تم اس کو اگر چیز کر آدی قیمت میں ہو فروخت کردو) بدل انجحو ویس ہے کہ مولا نامحمد کیا مرحموم نے اپنی تقریبن کچا سے کر اس حد پرث کواس باپ میں لا نے کا مقصد اس امر پر تنبیہ کرنا ہے کہ امام کو اگر وہ مناسب بحقہ ہے تو حد پر اضافہ کر نے کا حق حاصل ہے۔ اور پی تعزیر کہ لیتا ہے۔ مزید برآ ل نصف قیمت یا س کے سوا کی چیز سے پیچا جواس کی قیمت کی بر ابر نیس ہے تو اس کو عیب واراور ذیل کرنا ہے۔ اور یا س کی گردان میں باٹھ کا نے کی طرح سے ہے۔
قولہ: فقطعہ (انہوں نے اس کا اٹھ کاٹ دیا)۔ جرالراق، مرقات اور بدایی میں سے جو غلام اپنے آقا اور اپنے ماکن کے شوہر کے سوا کسی اور کے پاس چوری کرے اس کا خواہ بھگوڑا ہو یا نہ ہو اس حیثیت کی بناء پراس کا اٹھ کاٹا جائے گا اور اس لئے کچی کر نقص قرآنی و السارق والسارقة فاقطعوآ أيديهما (الآیة) نے غلام اور آزاد کے درمیان کوئی فرق نہیں کیا ہے۔ کیونکہ غلام کے لئے آزاد کی حد کا آوحا کرنا مشکل ہے۔ پس لوگوں کے مال کی حفاظت کے لئے اس پر کامل حد جاری کی جائے گی۔ امام اعظم البوعنیفہ، امام ماک امام شافعی رحمہ اللہ کہتے ہیں۔
قولہ: لاقطع عليه۔ اس پرامامہمام نے کہا ہے کہ جب زوجین میں سے کوئی ایک دوسرے کا مال چوری کرے یا غلام اپنے آقا کا مال کسی کے شوہر کا مال چوری کرے تو اس کا اٹھ نہیں کا طاقات کا کیونکہ عام طور پراس کو آنے جائے کی اجازت ہے اس لئے مال غیر محفوظ ہے۔ (مرقات)
حضرت سیدنا عائشہ صدیقه رضی اللہ تعالیٰ علیہا سے روايت ہے کہ رسول اللہ صلی اللہ علیہ و آلہ وسلم کی خدمت میں ایک چور لا یاگیا تو آپ اس کا باٹھ کاٹ دیے تو صحابہ عرض کے تم نہیں سمجھتے کہ اپنے اس کے ساتھ ایسا کر نے کا حکم فرمائیں گے تو آپ علیہ صلی اللہ نے فرما یاگر فاطمہ کی ہوتی تو میں اس کا باٹھ کاٹ دیتا۔(نسائی)
حضرت سیدنا عائشہ صدیقہ رضی اللہ تعالیٰ علیہا سے روایت ہے کہ رسول اللہ صلی اللہ علیہ و آلہ وسلم کی خدمت میں ایک چور لا یاگیا تو آپ اس کا باٹھ کاٹ دیے تو صحابہ عرض کے تم نہیں سمجھتے کہ اپنے اس کے ساتھ ایسا کر نے کا حکم فرمائیں گے تو آپ علیہ صلی اللہ نے فرما یاگر فاطمہ کی ہوتی تو میں اس کا باٹھ کاٹ دیتا۔(نسائی)
Aisha (may Allah be pleased with her) narrated: A thief was brought to the Messenger of Allah (ﷺ), and he cut him. They said: We did not want it to reach this. He said: If it were Fatima, I would cut her. [Narrated by al-Nasa’i]
سیدنا ابن عباس رضی اللہ تعالیٰ علیہما سے روایت ہے کہ کفن چور پر 14 باٹھ 14قولہ: لیس علی النّباش قطع : ( کفن چور کا باٹھ کاٹنا نہیں ہے ) نون کے زبر کے ساتھ ہے - میت کو دفن کرنے کے بعد اس کا کفن چوری کرنے میں باٹھ کاٹنا امام اعظم ابو حنیفہ اور امام محمد رحمہ اللہ تعالیٰ کا نہیب ہے - خواہ وہ قبر سی مقفل گہری ہو یا جنگل میں، خواہ قبر سے لجا نے والی چیز میت کا کفن ہو یا اس کے سوا کوئی اور چیز - حفاظت نہ پائے جانے کی وجہ سے کفن کی چوری، چوری نہیں کہلا تی - کیونکہ میت اپنے نفس کی حفاظت نہیں کر سکتی اور نہ قبر حفاظت کی جگہ ہے - اور کفن کی ملکیت میں کچھ شہر آگیا ہے اس لیے کہ میت کی درحقیقت کوئی ملکیت نہیں ہوتی اور نہ دارث کی ملکیت ہے کیونکہ میت کی ضرورتیں مثل تجمیز و غیبن ورش کے حقوق پر مقدم ہیں (حواسی بدایی) اور ابن عباس رضی اللہ تعالیٰ علیہما کے قول سے جس کو ابن الی شیہ سے روایت کی ہے کہ کفن چور پر قطع نہیں ہے، اس کی تفسیر ہوتی ہے نیز ابن الی شیہ سے امام زہری کی روایت نقل کی ہے کہ مردان کے پاس پچھلوگ لائے گے جو کفن چور چلتے اس نے ان کو پیچا اور شہر بدر کرویا اس وقت صحابہ کثرت موجود تھے - عبد الرزاق نے اس کی تخریج کی ہے اور اس میں پر اضافہ ہے کہ ان لوگوں کی کرا یاگیا امام زہری سے ابن الی شیہ کی ایک روایت سے کہ حضرت معاویہ رضی اللہ تعالیٰ علیہ کے زمانے میں ایک کفن چور پکڑا گیا اور مراوان مدینہ کا گورنر تھا اس نے صحابہ اور فقہاء سے جوموجود تھے دریافت کیا تو سب کی رائے کا اس بات پر اتفاق ہوا کہ اس کو ضرب لگائی جائے اور (شہر میں) گھما یا جائے - امام ابو یوسف اور امام شافعی رحمہ اللہ علیہما کے پاس کفن چور کے باٹھ کو کاشا ضروری ہے اور اس مستند میں ابن زہر رضی اللہ تعالیٰ علیہ نے مقدم ہیں کہ انشول نے کفن چور کا باٹھ کاٹا ہے - امام بخاری رحمہ اللہ نے اپنی کتاب التاریخ میں اس کی تخریج کی ہے - حضرت عمر رضی اللہ تعالیٰ علیہ سے بھی اس جیسی روایت ثابت ہے جس کی تخریج حضرت عبد الرزاق نے کی ہے - اور یہ حدیث کی ان دونوں کے موافق ہے - من نبش قطعنہ (جو کفن چوری کرے گا اتم اس کا باٹھ کاٹ دیے گے - اما شیہ نے مرفوعاً اس کی تخریج کی ہے - صحابہ بدا کا اس حدیث کی مرفوع ہونے سے انکار کرنا نہ نہیں ہے - نیز حدیث "لا قطع علی المختفی" (کفن چور پر قطع نہیں ہے) کے الفاظ کے ساتھ اس کو صحابہ بدا کا مرفوع کہنا قابل التفات نہیں ہے - حضرت امام اعظم ابو حنیفہ رحمہ اللہ علیہ کی طرف سے اس کے جواب میں یہ ہے کہ "من نبش قطعنہ"......
Ibn Abbas (may Allah be pleased with them) narrated: No amputation for a grave robber. [Narrated by Ibn Abi Shayba]
In his narration from al-Zuhri: A grave robber was caught in Muawiya’s time, with Marwan governing Madinah. He consulted attending Companions and jurists, who agreed he should be beaten and paraded. Abd al-Razzaq narrated similarly. Ali al-Qari said: A house locked over a grave, literally or legally, does not make it secure. If something is taken from a house without a locked door or guard, there is no amputation by consensus.
(1) The statement: No amputation for a grave robber: Grave robbing is taking a corpse’s shroud after burial. No amputation for it is the view of Abu Hanifa and Muhammad, whether the grave is in a locked house or open land, and whether the taken item is the shroud or else. The reason: Grave robbing is not theft due to lack of security, as the dead do not secure themselves, and a grave is not a secure place. Ownership is doubtful, as the dead have no true ownership, nor do heirs, as the deceased’s needs for burial precede inheritance rights. As in Hidaya’s notes. Ibn Abbas’s saying: No amputation for a grave robber, narrated by Ibn Abi Shayba, supports this. Al-Zuhri said: Marwan was brought people robbing graves, beat and exiled them, with many Companions present. Abd al-Razzaq narrated it, adding: And paraded them. Abu Yusuf and al-Shafi‘i hold amputation is required, following Ibn al-Zubayr, who cut a grave robber, per Bukhari’s History. Umar did similarly, per Abd al-Razzaq. The hadith: Whoever robs a grave, we cut him, narrated raised by al-Bayhaqi, supports them. Hidaya’s denial of its being raised is baseless, as is dismissing the hadith: No amputation for a grave robber as insignificant. Abu Hanifa’s response to: Whoever robs a grave, we cut him: First, its chain includes an unknown narrator, so it is not considered. Second, it is understood as policy, supported by some narrations adding: Whoever drowns, we drown him. No hadith in this matter is narrated with a chain suitable for evidence on amputation or its absence. Companion disagreement hinges on whether grave robbing is theft. Those deeming it theft ruled for amputation; those seeing no theft due to lack of security or ownership ruled against it, except as policy. The truth likely aligns with this unless a hadith with a valid chain proves otherwise. The case of pickpocketing, taking another’s property while they are awake, present, and intent on guarding it by exploiting a moment of inattention, is also not theft, like grave robbing. Why then is a pickpocket’s hand cut but not a grave robber’s? Ibn Malik in Sharh al-Manar and other usulis explain: The theft verse implying amputation applies to secretive taking, but for pickpockets and grave robbers, we assess if secrecy adds or detracts. For pickpockets, secrecy enhances, as pickpocketing, though distinct, exceeds theft, taking openly with inattention. For grave robbers, secrecy detracts, as grave robbing is lesser than theft. Thus, amputation applies to pickpocketing but not grave robbing, as a ruling for the lesser extends to the greater, not vice versa. (As in Umdat al-Ri‘aya)
The letter 'nun' is with a zabar - after burying the deceased, cutting off the hand of the person who steals the shroud is the opinion of Imam-e-Azam Abu Hanifah and Imam Muhammad (RA) - whether the grave is deep and locked or in the jungle, whether the thing taken from the grave is the shroud of the deceased or something else - the theft of the shroud, due to lack of protection, is not called theft - because the deceased cannot protect itself, nor is the grave a place of protection - and there is no ownership in the shroud because the deceased has no real ownership, nor does the heir have ownership, as the needs of the deceased, such as purification and burial rights, take precedence (over other claims) - and according to the saying of Ibn Abbas (RA), narrated by Ibn al-Shiha, there is no cutting off for the shroud thief, which means that Imam Zuhri's narration, transmitted by Ibn al-Shiha, states that men brought a shroud thief, and he questioned them and exiled them from the city; at that time, many Companions were present - Abdur Razzaq has narrated this, and it is added that they were exiled from the city based on Imam Zuhri's narration through Ibn al-Shiha, that during the time of Hadrat Muawiyah (RA), a shroud thief was caught, and Marwan was the governor of Madinah. He consulted the Companions and jurists who were present, and all agreed that the thief should be beaten and paraded through the city - Imam Abu Yusuf and Imam Shafi (RA) consider it necessary to cut off the hand of the shroud thief, and in this authentic tradition, Ibn Zuhri (RA) is mentioned as having precedence, stating that Anshul cut off the hand of the shroud thief - Imam Bukhari (RA) has narrated this in his book Al-Tarikh - a similar narration is also established from Hadrat Umar (RA), which Abdur Razzaq has narrated - and this hadith agrees with both of these - 'Man nabsa qatana' (whoever steals a shroud, his hand will be cut off) - Amash has narrated this as a marfu' hadith - it is not correct for the early Companions to deny the authenticity of this hadith - nor is it appropriate to consider the hadith 'la qat'ala al-mukhtafi' (there is no cutting off for the hidden thief) as a marfu' hadith from the early Companions - the response to this from Imam-e-Azam Abu Hanifah (RA) is that 'man nabsa qatana'...
امام زہری سے ابن ابی شہاب کی ایک اور روایت میں ہے کہ حضرت معاویہ رضی اللہ تعالیٰ عنہ کے زمانے میں ایک کفن چور پکڑا گیا۔ مردان میں کاگوزنگا اس میں صحابہ اور فقہاء کے جومو جود تھے دریافت کیا، تو سب کی رائے کا سبات پر اتفاق ہوا کہ اس کو پیٹا جائے اور کھما جائے۔ اور محمد ثعبد الرزاق نے اس کے تم معنی روایت کی ہے۔ ملا علی قاری نے کہا ہے کہ کفر کا قبر ر حقیقتاً یاحکماً اطلاق کے جانے سے یہ لازم نہیں آتا کہ قبر محفوظ جگہ ہو کیا پہ نہیں و کیہت کر اگر کوئی شخص کسی ایسے گھر سے کونی چیز لے لے جس کو بندروازہ نہ ہواور نہ پہریدار ہوتا اس کا باطن نہیں کا ظاہر جائے گا اس میں کسی کا اختلاف نہیں ہے۔
کی حدیث شریف کی سنن میں مجهول راوی ہے اس کا اعتبار نہیں ہے دوسری بات یہ کہ اس کو سائی مصلحت پر محول کیا گیا۔ نیز اس کی تفسیر ان بعض روایت سے موتی ہے جس میں اس کے بعدومن غرق غرقناہ (جوی کوؤوبا گے تو ہم اس کو ؤوبوئیس گے) کا اضافہ ہے۔ لیکن اگر سائی مصلحت ہوتا قطع کیا جاسکتا ہے خلاصہ یہ کہ اس باب میں ایسی کوئی مرفوع حدیث جو سنن کے اعتبار سے قابل جمع ہوئیس ہے جس میں کفن چور کے باٹھ کا ظاہر یا نہ کا ظاہر پرداللت ہو اس مستند میں صحابہ بیہم الرضوان کے اختلاف کی بیاد یہ کہ کفن چوری دراصل چوری کی تعریف میں ہے یا نہیں؟ جس میں یہ محاج کہ وہ چوری ہے تو باٹھ کا ظاہر کا حکم دیااور جس میں یہ محاج کہ یہ چوری نہیں ہے کیونکہ اس میں مال کی حفاظت نہیں اور ملیت کچھ ثابت نہیں تو اخون لے باطن کا ظاہر کافتوی دیا سوائے اس کے کو بالکوئی سائی مصلحت ہو جب تک صاحب شریعت (علیہ السلام) کی طرف سے کسی مضبوط سنن کو ؤی حدیث ثابت نہ ہو جس سے اس کے خلاف استدلال کیا جاسکے حق بات اس کے اطراف گھومتی رہے گی۔ یہاں ایک اعتراض یہوتا ہے کہ طر (جب کتر لینا) لیکن کسی بپیارآدمی کے مال کو جب کروہ اس کی حفاظت کا قصد کیا ہواہے تحویزی سی غفلت میں اثر الینا ری کچھ چوری میں نہیں ہے جسیا کہ کفن چوری، چوری کی تعریف میں نہیں ہے اس کے باوجود فقہا نے جیب کتر لے کے باٹھ کا ظاہر کا حکم فرمایاہے۔ برخلاف کفن چور کے کر اس کا باطن کا ظاہر کا حکم نہیں دیاہے اس کا جواب علامہ ابن ماکے نے شرح منار میں اور دوسرے علماء اصول نے تفصیل کے ساتھ دیاہے کہ سرقت کی آیت جس میں قطع یدا حکم سے سارق کے مفہوم میں تو واضح ہے جیب کتر اور کفن چور کے بارے میں اس میں خفاء ہے اور جب ہم نے غور کیا کہ ان دونوں میں خفاء کی وجہ یہ آیا کہ معنی کی زیادتی ہے یا کوئی نقصان وکی ہے تو یہ بات ظاہر ہوئی کہ جیب کتر لے کے بارے میں خفاء زیادتی کی وجہ یہ کہ کیونکہ اس کے معنی اگر چہ کہ چوری کے نہیں ہے مگر چوری سے برطہ کر اس کا مفہوم ہے۔ کیونکہ چور چھپ کر چوری کرتاہے اس کے برخلاف جیب کتر ا علائی تحویزی سی غفلت میں اثر الیتہ ہے اور کفن چور کے بارے میں خفار کی اور نقصان کی وجہ یہ سے کہ کیونکہ کفن چوری کرنا سرقت سے کم درجہ ہے اس لے کہم جیب کتر لے پر باطن کا ظاہر کو واجب قرار دے چیں برخلاف کفن چور کے کر اس کا باطن نہیں کا ظاہر ہے گا اولی کے لے باطن کا ظاہر کا حکم ہے تو اعلی کے لے بدرجاولی ہوگا اس کا عكس نہیں ہوگا (عمدۃ الرعایی)۔
Ibn Abbas (may Allah be pleased with them) narrated: No amputation for a grave robber. [Narrated by Ibn Abi Shayba]
In his narration from al-Zuhri: A grave robber was caught in Muawiya’s time, with Marwan governing Madinah. He consulted attending Companions and jurists, who agreed he should be beaten and paraded. Abd al-Razzaq narrated similarly. Ali al-Qari said: A house locked over a grave, literally or legally, does not make it secure. If something is taken from a house without a locked door or guard, there is no amputation by consensus.
(1) The statement: No amputation for a grave robber: Grave robbing is taking a corpse’s shroud after burial. No amputation for it is the view of Abu Hanifa and Muhammad, whether the grave is in a locked house or open land, and whether the taken item is the shroud or else. The reason: Grave robbing is not theft due to lack of security, as the dead do not secure themselves, and a grave is not a secure place. Ownership is doubtful, as the dead have no true ownership, nor do heirs, as the deceased’s needs for burial precede inheritance rights. As in Hidaya’s notes. Ibn Abbas’s saying: No amputation for a grave robber, narrated by Ibn Abi Shayba, supports this. Al-Zuhri said: Marwan was brought people robbing graves, beat and exiled them, with many Companions present. Abd al-Razzaq narrated it, adding: And paraded them. Abu Yusuf and al-Shafi‘i hold amputation is required, following Ibn al-Zubayr, who cut a grave robber, per Bukhari’s History. Umar did similarly, per Abd al-Razzaq. The hadith: Whoever robs a grave, we cut him, narrated raised by al-Bayhaqi, supports them. Hidaya’s denial of its being raised is baseless, as is dismissing the hadith: No amputation for a grave robber as insignificant. Abu Hanifa’s response to: Whoever robs a grave, we cut him: First, its chain includes an unknown narrator, so it is not considered. Second, it is understood as policy, supported by some narrations adding: Whoever drowns, we drown him. No hadith in this matter is narrated with a chain suitable for evidence on amputation or its absence. Companion disagreement hinges on whether grave robbing is theft. Those deeming it theft ruled for amputation; those seeing no theft due to lack of security or ownership ruled against it, except as policy. The truth likely aligns with this unless a hadith with a valid chain proves otherwise. The case of pickpocketing, taking another’s property while they are awake, present, and intent on guarding it by exploiting a moment of inattention, is also not theft, like grave robbing. Why then is a pickpocket’s hand cut but not a grave robber’s? Ibn Malik in Sharh al-Manar and other usulis explain: The theft verse implying amputation applies to secretive taking, but for pickpockets and grave robbers, we assess if secrecy adds or detracts. For pickpockets, secrecy enhances, as pickpocketing, though distinct, exceeds theft, taking openly with inattention. For grave robbers, secrecy detracts, as grave robbing is lesser than theft. Thus, amputation applies to pickpocketing but not grave robbing, as a ruling for the lesser extends to the greater, not vice versa. (As in Umdat al-Ri‘aya)
Mulla Ali Qari has stated that the application of the term 'kafir' to a grave, whether in reality or by way of analogy, does not necessarily imply that the grave is a secure place. For instance, if someone takes something from a house that has no guard or watchman, and its interior is not revealed, there would be no difference of opinion about this. The hadith in question is weak (mujmal) in the chain of narrators and thus lacks credibility. Furthermore, it has been interpreted based on some narrations where the addition is made: 'If he drowns, we will drown him.' However, if it were for a valid benefit, it could be considered. In summary, there is no authentic hadith in this matter that meets the criteria of the Sunnah, which clearly addresses whether the theft of a shroud should result in the amputation of the hand or not. The Companions (may Allah be pleased with them) differed on whether the theft of a shroud is considered actual theft or not. One argument is that since it is theft, the amputation of the hand should be carried out. Another argument is that it is not theft because there is no protection of property, and no ownership is established, hence the concealment of the hand is the ruling. Unless there is a valid benefit, no other ruling can be made until a strong tradition from the Lawgiver (peace be upon him) is established that can be used to argue against this. An objection arises that when something is taken from a person's property without their knowledge, even though the intention was to protect it, it is not considered theft, such as the theft of a shroud, which is not included in the definition of theft. Despite this, jurists have ruled that the amputation of the hand should be carried out for pickpocketing but not for the theft of a shroud. Imam Ibn al-Makki provided a detailed answer in his commentary on Minar, and other scholars of principles have explained that the verse on theft, which commands the cutting off of the hand, clearly applies to a thief. However, regarding pickpocketing and the theft of a shroud, there is ambiguity. Upon reflection, it became clear that the reason for the ambiguity in both cases is either due to excess meaning or some deficiency. It was found that the ambiguity in pickpocketing is due to the fact that although it is not theft, it resembles theft in meaning. This is because a thief steals secretly, whereas pickpocketing occurs due to negligence. The ambiguity and deficiency in the theft of a shroud are because it is a lesser degree of theft compared to pickpocketing. Therefore, while the concealment of the hand is obligatory for pickpocketing, it is not for the theft of a shroud. If the concealment of the hand is required for a lesser offense, it would be excessive for a higher offense, and the reverse is not true (Umda al-Ra'i).
